Document Review CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE (Sala Constitucional de la Corte Suprema de Justicia). San José, at nine hours and twenty-five minutes on the seventeenth of July, two thousand twenty-six.
Writ of amparo (recurso de amparo) filed by [Nombre 001], national identity card number (cédula de identidad) [Valor 001], against the MUNICIPALIDAD DE LIMÓN and the NATIONAL SERVICE OF GROUNDWATER, IRRIGATION AND DRAINAGE (SERVICIO NACIONAL DE AGUAS SUBTERRÁNEAS, RIEGO Y AVENAMIENTO) (SENARA).
Whereas:
In relation to point a) of the appeal, in which the appellant states that in the Barrio Quinto sector the area has become a dump for sewage waters, with no sheet piling (tablestacas) or retaining walls (muros de contención) installed, and that during flooding events contaminated water is swept into homes, the following is reported to the Sala Constitucional: The Environmental Impact Study (Estudio de Impacto Ambiental, EsIA) of the Project "Sistema de Control de Inundaciones en el área de Limoncito (PSCIAL)," prepared by the Programa de Investigación en Desarrollo Urbano Sostenible of the Universidad de Costa Rica for SENARA, identified at the baseline stage that the contamination of water bodies in the urban portion of the lower basin of the Limoncito River does not correspond to an effect caused by the PSCIAL works, but rather to a pre-existing condition associated primarily with two sources: the disposal of solid waste in rivers and streams (quebradas), and the direct discharge of domestic wastewater from homes located in front of or very close to the watercourses (cauces).
Said study notes that, when flooding occurs, the water that reaches homes may carry a high degree of contamination, thereby becoming a public health problem due to the possibility of outbreaks of waterborne diseases, skin conditions, the presence of disease vectors, and the population's exposure to wastewater mixed with stormwater runoff (escorrentía pluvial). The EsIA concluded that the reduction in the frequency of flooding resulting from the execution of the works of the Proyecto de Control de Inundaciones Limoncito PSCIAL contributes to reducing the population's exposure to that sanitary condition; however, it also cautioned that the flood-control project does not by itself eliminate the existing contamination in the watercourses, since addressing it depends on a comprehensive sanitation solution, solid waste management, and urban planning within the basin.
Regarding sanitary sewerage, the EsIA determined that the area presents physical conditions that hinder the adequate use of individual treatment systems, particularly due to the high water table (nivel freático), the predominantly fine clay materials present, and the small lot sizes in much of the urban area. Furthermore, the study identified that a significant portion of the population uses septic tanks and that there are direct discharges into rivers or streams, which reinforces the need for a comprehensive sanitary solution connected to the corresponding system. Consequently, the EsIA itself recommended that the flood-control project be complemented by the construction and operation of sanitary sewerage infrastructure, as this is an indispensable condition for effectively improving water quality in the Limoncito River and its tributaries (afluentes).
This complementarity was also subsequently reflected in Ley N.° 9690, through which Loan Agreement N.° 2198, signed between the Republic of Costa Rica and the Banco Centroamericano de Integración Económica (BCIE), was approved to finance the Programa de Alcantarillado y Control de Inundaciones para Limón. Said program comprises two distinct but complementary projects: the Proyecto de Ampliación y Mejoramiento del Alcantarillado Sanitario de la ciudad de Limón, managed by the Instituto Costarricense de Acueductos y Alcantarillados (AyA), and the Proyecto de Canalización y Control de Inundaciones del río Limoncito, Limón, managed by SENARA. Consequently, the very legal and financial framework of the program recognizes that a comprehensive response to the problem requires, on the one hand, hydraulic works to reduce flood risk and, on the other, sanitary infrastructure to address wastewater contamination.
Regarding solid waste, the EsIA also documented that, although the Municipalidad de Limón provides collection and final disposal services in the areas surrounding the Limoncito River, there is a recurrent practice of improper disposal of waste in watercourses, riverbanks (márgenes), and points near narrow streets where collection may be difficult. This situation causes waste to be swept into the river during rainfall events, obstructing hydraulic flow, reducing the conveyance capacity of the watercourse, and worsening flooding and contamination conditions. For this reason, the EsIA proposed environmental education actions, municipal coordination, improved waste management, and community participation as necessary complementary non-structural measures for the sustainability of the system. These non-structural measures form part of the components planned for the proper environmental and social management of the project, and do not constitute merely general recommendations, but rather actions tied to the execution and sustainability of the Programa de Alcantarillado y Control de Inundaciones para Limón.
Within this framework, an environmental education program is being implemented aimed at strengthening community awareness of the relationship between solid waste, watercourse contamination, hydraulic obstruction, and increased flood risk. This program includes, among other actions, the development of a series of workshops directed at schools located within the project's area of influence, with the purpose of raising awareness among students, teaching staff, and the school community regarding the proper management of waste, the protection of the Limoncito River and its tributaries, the importance of not disposing of garbage in watercourses, and citizens' shared responsibility in the prevention of flooding and sanitary risks.
Specifically regarding the absence of sheet piling or retaining walls in the sector indicated by the appellant, it must be clarified that the structural works of the PSCIAL are executed in accordance with the technical, environmental, budgetary, and contractual scope defined for each phase of the project. In the stretches prioritized upstream of the Barrio Quinto bridge, works involving hydraulic cross-section widening (ampliación de la sección hidráulica), re-excavation (recava), bridge construction, and the installation of sheet piling have been carried out; however, the stretch downstream of the Barrio Quinto bridge to the confluence with the Cieneguita River and its outlet to the sea was not incorporated from the project's formulation for the installation of sheet piling or retaining walls, due to the environmental, technical, and economic constraints detailed further on in this report.
It must also be noted that the installation of sheet piling or retaining walls is primarily intended to stabilize banks, protect infrastructure, channel flow, and reduce the occurrence or magnitude of overflow in the intervened sectors; however, such works do not constitute a sanitation solution, nor do they replace sanitary sewerage infrastructure, discharge control, solid waste collection, or the regulation of occupations within protection zones (zonas de protección). Therefore, even if a containment structure can help improve hydraulic capacity and reduce homes' exposure to flooding events, it does not eliminate the source of contamination if wastewater discharges and waste disposal in the watercourse persist.
In this regard, SENARA reports that its competence within the PSCIAL is limited to the execution of hydraulic works for flood control and mitigation, in accordance with the approved design, the corresponding environmental clearances and authorizations, and available resources. The handling of wastewater discharges, sanitary sewerage, discharge control, solid waste collection, routine cleaning of public spaces, urban control, and municipal road and stormwater drainage management falls under the purview of other competent institutions, without prejudice to the inter-institutional coordination that may be required to comprehensively address the problems described by the community.
For the foregoing reasons, SENARA does not deny the existence of contamination in the Limoncito River or the sanitary risks associated with the transport of contaminated water during flooding events. On the contrary, that condition was identified and documented in the EsIA as a structural problem of the lower basin, whose resolution requires complementary measures in sanitation, sewerage, waste management, environmental education, control of occupations within the protection zone, and coordination among the Municipalidad de Limón, the Instituto Costarricense de Acueductos y Alcantarillados, the Ministerio de Salud, SINAC, SETENA, MOPT, and the other competent entities. The PSCIAL contributes to reducing the frequency and magnitude of flooding in the intervened sectors, but cannot, by itself, resolve the sanitary contamination that originates outside the material and competential scope of the hydraulic works executed by SENARA (…)
In relation to point b) of the appeal, concerning the erosion of the banks of the Limoncito River and the risk that this situation could pose for homes and residents, the Sala Constitucional is informed that the PSCIAL has executed works specifically aimed at addressing, within its approved scope, the reduction of hydraulic risk and the protection of banks in the prioritized sectors of the lower basin. As part of the works corresponding to Phase I of the PSCIAL, approximately 1.5 kilometers of sheet piling were installed and the hydraulic cross-section of the Limoncito River was widened in the stretch between the Chitá bridge and Barrio Quinto, works completed during 2023. Likewise, as part of Phase II of the project, the hydraulic cross-section was widened through excavation and the installation of sheet piling over approximately 5 kilometers of the Limoncito River, between the Chitá bridge and the Santa Fe sector, works completed during 2025.
The primary function of sheet piling is to act as a containment and channeling structure that controls flooding, reinforces the riverbanks, and ensures an orderly water flow during heavy rainfall events. Its implementation contributes significantly to reducing risks for homes, roads, and public infrastructure. Furthermore, when integrated with other complementary works—such as bridges and culverts—it forms part of a comprehensive protection system for communities located within the project's area of influence.
According to official communications SENARA-INDEP-PSCIAL-OFI-292-2025, SENARA-INDEP-RHC-OFI082-2025, and SENARA-INDEP-PSCIAL-OFI-002-2026, Phase I included, among other works: the installation of approximately 1.5 kilometers of sheet piling and widening of the Limoncito River from the Chitá bridge to Barrio Quinto; the construction of cantonal bridges; the cleaning of the Santa Rosa canal; the cleaning of the Quebrada Chinita; the construction of an overflow spillway (vertedor de excedencias); the cleaning of the JAPDEVA canal; the construction of the transfer channel (canal trasvase); and the construction of access bridges to homes over the Quebrada Chocolate. Phase II includes and executes additional works, among them: the widening of the hydraulic cross-section through excavation and the installation of sheet piling in the Limoncito River between the Chitá bridge and the Santa Fe sector; the re-excavation and widening of the Quebrada Chocolate between the railroad bridge and Ruta 32; the re-excavation of the Colina canal; the construction of the railroad bridge; the re-excavation and cleaning of the Santa Rosa canal; LIDAR surveying to generate elevation models of the lower basin; the acquisition of meteorological and flow-measurement equipment; consulting services for environmental education and social capacity-building; and a feasibility study for waste management.
It must be clarified that the works executed and currently underway do not completely eliminate the natural flood hazard or all erosion processes inherent to an intervened urban basin. However, they do increase the hydraulic capacity of the intervened watercourses, reduce the frequency and magnitude of overflow in the prioritized sectors, stabilize banks by means of sheet piling where technically and environmentally feasible, replace bridges that restricted flow, improve connectivity, and allow for more orderly hydraulic management during heavy rainfall events.
The foregoing must also be analyzed in light of the legal limitations established by the Ley de Aguas N.° 276 and the Ley Forestal N.° 7575. The Ley de Aguas recognizes rivers, their tributaries, watercourses, and other water flows as public domain properties; therefore, any intervention within a public domain watercourse—including channeling works, bank protection, cleaning, widening, or the construction of hydraulic structures—requires the corresponding technical and administrative authorizations from the competent authorities, particularly the Dirección de Agua of the Ministerio de Ambiente y Energía. Consequently, SENARA cannot execute works outside the authorized scope of the project, nor intervene in additional watercourses without the prior permits required by the legal framework.
Similarly, the Ley Forestal N.° 7575 establishes protection areas (áreas de protección) along the banks of rivers, streams, and creeks, including protection strips (franjas de protección) in urban and rural areas, and restricts the felling of trees, the modification of vegetation cover (cobertura vegetal), and the development of works within those areas, except in the cases and under the conditions expressly authorized by environmental regulations. These restrictions are intended to protect the water resource, preserve bank stability, prevent erosion processes, conserve biodiversity, and reduce the risk associated with the occupation of vulnerable banks. Therefore, the mere existence of erosion processes or damage on a bank does not automatically authorize the immediate execution of containment works, sheet piling installation, or river realignment (reencauzamiento). Such interventions must be technically viable, environmentally compatible, budgetarily funded, and legally authorized.
In sectors where wetlands (humedales), Yolillo palm stands (Yolillales), riparian vegetation (vegetación riparia), homes within the protection zone, or private structures close to the watercourse are present, the legal restrictions are even more significant and require the evaluation of intervention alternatives based on technical, environmental, social, and economic criteria, as well as coordination with SINAC, MINAE, the Municipalidad de Limón, and other competent institutions (…)
In relation to point c) of the appeal, regarding damage to roads and difficulty of transit for persons with reduced mobility and minors, it is reported that the PSCIAL has incorporated within its scope works that positively affect connectivity and safety in the area of influence; however, the repair, routine maintenance, and administration of public roads falls under the competent institutional authorities in road and municipal matters.
The floods that have historically affected the roads within the PSCIAL's area of influence have caused various consequences, including pavement deterioration, culvert collapse, impacts on people's mobility, and public health risks. This situation is aggravated by the accumulation of solid waste and sediments that obstruct drainage systems and cause saturation or insufficiency of the existing stormwater infrastructure.
Among the actions carried out by the PSCIAL, the following stand out: the installation of sheet piling along the banks of the Limoncito River and the Quebrada Chocolate, the re-excavation and widening of watercourses, and the construction of access bridges to communities and homes. However, achieving sustainable solutions requires the implementation of comprehensive watershed management for the Limoncito River basin and the Quebrada Chocolate, encompassing respect for protection zones and the delimitation of flood-prone areas (áreas inundables).
Technical communications indicate that the project has included the construction and replacement of cantonal bridges, bridges in front of homes, a railroad bridge, re-excavation and watercourse-widening works, and slope (taludes) protection using sheet piling in the intervened stretches. These works make it possible to reduce hydraulic obstructions, improve water passage, reduce overflow, and facilitate mobility in sectors where previously insufficient or vulnerable structures existed.
In this regard, it has been confirmed that buildings have been constructed under conditions of vulnerability, some of them located on the banks of the river or the stream. In particular, in the stretch between the Barrio Quinto bridge and the confluence of the Limoncito and Cieneguita Rivers, numerous constructions do not comply with the protection zone established in Article 33 of the Ley Forestal N.° 7575, which provides, among other things, that the ten meters on each side of rivers, streams, or creeks located in urban areas with flat terrain are considered protection areas. These areas constitute legal limitations on the use of private property for the purpose of protecting the water resource, biodiversity, and bank stability. Traditionally, constructions and uses incompatible with environmental protection were not permitted within such strips. Subsequently, through the reform enacted in 2022, Articles 33 bis and 33 ter were incorporated into the Ley Forestal, permitting certain low-impact works or works of public interest, subject to compliance with specific requirements and authorizations.
The disorderly urbanization that has developed around the Limoncito River, the Quebrada Chocolate, and other water bodies has favored the establishment of settlements (asentamientos) in risk zones. This situation is compounded by the effects of climate change, reflected in more frequent and intense rainfall events, as well as the physical limitations inherent to densely urbanized areas, where the expansion of drainage infrastructure is particularly complex.
Finally, it is noted that the corresponding municipality is the entity responsible for the care and repair of public roads affected by flooding. However, achieving sustainable solutions requires effective coordination among the municipality, the Ministerio de Obras Públicas y Transportes (MOPT), the Instituto Nacional de Vivienda y Urbanismo (INVU), and other competent institutions. Likewise, citizen participation is fundamental, through the timely reporting of damage and collaboration in prevention and risk management initiatives.
It should also be noted that Phase II includes non-structural and complementary works, such as the construction of community integration areas and landscape improvements within the area of influence, the acquisition of meteorological and flow-measurement equipment, consulting services for environmental education and social capacity-building, and a feasibility study for waste management. These actions contribute to the sustainability of the system, risk prevention, and the improvement of conditions for the use of public space, although they do not substitute the municipal competence over cantonal roads, urban control, stormwater drainage, and comprehensive waste management.
In accordance with the information provided in official communications SENARA-GG-OFI-010-2026 (responding to Official Communication N.° 14884-2025-DHR) and SENARA-INDEP-PSCIAL-OFI-002-2026, submitted to the Defensoría de los Habitantes, the following is reported regarding the stretch running downstream from the Barrio Quinto bridge to the confluence with the Cieneguita River and its outlet to the sea.
Regarding the bank slippage (deslizamiento de las márgenes) of the Limoncito River in the stretch between CRTM05 coordinates (E: 605260, N: 1104333) and (E: 605348, N: 1104383), located downstream of the Barrio Quinto bridge on the right bank of the Limoncito River, it is noted that in November 2021, watercourse cleaning work was carried out. However, from its formulation, the Proyecto Sistema de Control de Inundaciones del Área Limoncito (PSCIAL) did not include the installation of sheet piling or any other slope stabilization or containment system in that sector. The exclusion of this stretch was based on environmental, technical, and economic criteria, which are detailed below:
Environmental aspects: The area presents environmental limitations that restrict the execution of infrastructure works. Based on information obtained from the Sistema Nacional de Información Territorial (SNIT), consultations with the Área de Conservación La Amistad Caribe (ACLAC), and the applicable environmental regulations, the stretch located downstream of the Barrio Quinto bridge presents a combination of sensitive conditions, including: wetland areas and vegetation associated with riparian ecosystems, water body protection zones, low gradient towards the river mouth, proximity to areas subject to natural hydrological dynamics, and the presence of vegetation cover that serves functions of stability, buffering, and environmental protection. In particular, the sector downstream of the Barrio Quinto bridge to the confluence with the Cieneguita River and its outlet to the sea presents environmental and geomorphological conditions that require a prior comprehensive assessment.
The presence of wetlands, riparian vegetation, legal protection zones, low-gradient areas, possible restrictions on the removal of vegetation cover, and the proximity of human settlements to the watercourse limit the possibility of executing widening, sheet piling, or containment works without specific studies and without the corresponding environmental authorizations. Therefore, the environmental limitation is not confined solely to the presence of environmentally sensitive areas, but encompasses the combination of site conditions and the legal regime applicable to watercourses, wetlands, protection zones, riparian vegetation, and public domain properties. Any intervention in that stretch must take into account the Ley de Aguas, the Ley Forestal, the regulations on wetlands, and the competences of MINAE, SINAC, the Dirección de Agua, and other competent authorities.
Technical aspects: From a construction standpoint, the execution of works in this sector presents significant limitations due to the proximity of existing infrastructure on both banks of the river. Homes are found practically on the watercourse itself, along with private docks (atracaderos privados) and other structures that significantly reduce the space available for the operation of machinery, the installation of equipment, the temporary stockpiling of materials, the formation of safe access routes, and the implementation of stabilization or containment works. To this must be added the geotechnical characteristics of the sector. According to the baseline of the EsIA, the project area is located on recent alluvial and colluvial deposits, with the presence of intermediate-plasticity clays, silts with sand (limos con arena), medium to fine sands, and gravels. These materials, associated with a low-gradient zone, high humidity, the influence of the water table, and proximity to the watercourse, may exhibit susceptibility to expansion and contraction processes, loss of strength due to saturation, surface erosion, local scour (socavación local), and slope destabilization when the existing cover is disturbed or loads on the bank are increased.
In that context, the entry of heavy machinery into a narrow space with saturable soils and banks already eroded or disturbed by human occupations could generate additional risks: increased vibration, overloading of unstable edges, loss of lateral confinement, material detachment, increased erosion, impact on nearby homes, and a greater contribution of sediments to the watercourse. Therefore, far from constituting a straightforward intervention, the movement of machinery in this stretch could temporarily or permanently worsen the existing instability conditions. This situation differs substantially from the conditions upstream of the Barrio Quinto bridge, where it was possible to carry out the interventions contemplated in the PSCIAL, since conditions of access, maneuverability, hydraulic design, permits, budget, and construction viability had been previously defined within the approved scope.
Economic aspects: Taking into account the environmental and technical limitations described above, as well as the approved budget for the comprehensive execution of the PSCIAL—both in its Phase I, funded through a transfer from the Ministerio de Hacienda, and in its Phase II, funded through Loan Agreement N.° 2198 of the Banco Centroamericano de Integración Económica (BCIE)—the referenced stretch was not incorporated within the scope of the project. A potential intervention would have required the expropriation of properties, the relocation of existing infrastructure, the acquisition of additional materials, and the implementation of special construction measures, which would have generated a substantial increase in project costs. For these reasons, that sector was excluded from the planning and design stage of the PSCIAL.
For the foregoing reasons, this does not involve an incomplete work within the PSCIAL's scope, but rather a stretch excluded from the project's technical, environmental, budgetary, and contractual formulation. Any subsequent intervention in that sector would require new technical, environmental, hydraulic, social, and economic studies, as well as the identification of a different or complementary funding source, the corresponding permits, and coordination with the Municipalidad de Limón, the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, SINAC, the Ministerio de Ambiente y Energía, AyA, and other competent entities. SENARA has also indicated that it is prepared to provide technical advice to the competent institutions when formally requested to do so, particularly if the need to assess provisional or future interventions outside the PSCIAL's scope is identified. However, the institution does not have its own resources to execute works not included in the approved project, nor can it unilaterally modify the scope defined in Loan Agreement N.° 2198 BCIE without the corresponding technical, institutional, and financial approvals (…)" (sic) (emphasis not in the original).
Drafted by Magistrate Araya García; and,
Whereas:
I.Object of the appeal. The petitioner alleged that the Municipalidad de Limón and the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA) are carrying out a flood control project to benefit the communities of Envaco, Limoncito, and Barrio Quinto. The works reached as far as the bridge at Barrio Quinto and did not continue. The petitioner stated that: a) at the Barrio Quinto bridge, the area was turned into a sewage dump, without the placement of planks or retaining walls (muros de contención), so that floodwaters carry contaminated water into the homes; b) the erosion of the banks of the Río Limoncito (in the sector located beyond the local bridge up to the bridge of Los Cocos) endangers several houses and the lives of their inhabitants; c) the flooding has damaged the road and makes it difficult for persons with reduced mobility and minors to move about. He stated that the Municipalidad de Limón has not conducted site visits or taken corrective action to address the problem, alleging, together with SENARA, that it is not possible to bring in heavy machinery. He emphasized that everything described was brought to the attention of the Municipalidad de Limón as of July 17, 2025, and that the residents even went to the Defensoría de los Habitantes (Ombudsman's Office), which requested information from SENARA regarding the situation described.
II.Preliminary matter. Before analyzing the merits of the case—given the alleged violation of the right to prompt and effective proceedings—it must be explained that, beginning with voto No. 2008-02545 of 8:55 a.m. on February 22, 2008, this Chamber has held that matters in which it is disputed whether the public administration has or has not complied with the deadlines set by the Ley General de la Administración Pública (Articles 261 and 325) or sectoral laws for special administrative proceedings—in order to resolve by final act an administrative procedure initiated ex officio or at the request of a party, or to decide on available administrative appeals—must be referred to the administrative-contentious jurisdiction, with some exceptions. In the matter at hand, an exceptional circumstance is presented: the apparent delay by the Administration in resolving complaints concerning situations that affect life, health, and the environment. With that point clarified, the Court proceeds to resolve the situation presented in these proceedings.
SENARA: "(…) is the Executing Unit (Unidad Ejecutora) of the Sistema de Control de Inundaciones del Área de Limoncito Project (PSCIAL), in its Stages I and II, as well as of the works associated with the Quebrada Chocolate component, carried out in the central canton of Limón. The PSCIAL's objective is to reduce flood risk in the lower watershed (cuenca baja) of the Río Limoncito by expanding the hydraulic capacity (capacidad hidráulica) of the main drainage network (red de drenaje), both natural and artificial, in order to improve living conditions for the population located in sectors historically affected by flooding, including Envaco, Barrio Quinto, Colina, El Ceibón, El Carmen, Juan Gobán, Limoncito, Los Cocos, Cieneguita, and Westfalia. According to the project's technical information, the PSCIAL area of influence corresponds to the Río Limoncito watershed, covering an approximate area of 81.5 km²; the urban area involved comprises approximately 733 hectares, equivalent to 7% of the total watershed; and the indirectly benefited population amounts to approximately 23,729 persons.
This is therefore a high-impact public intervention—socially, environmentally, and hydraulically—aimed at reducing the vulnerability of communities settled in an urban area historically exposed to recurring flooding (…)" (sic) (see the sworn report submitted by the SENARA authorities, included in the digital case file).
On July 17, 2025, residents of the Barrio Quinto community, by means of a written communication, filed the following complaint with the Municipalidad de Limón: "(…) 1- Roads in poor condition since the previous administration of Mattis have left the community located behind the Feria del Agricultor, crossing the bridge on the left-hand side and up to the border with Barrio Los Cocos, in a neglected state. 2- The Company SENARA carried out the Río Limoncito cleanup project and in this indicated area did not carry out any cleanup and did not place retaining walls or sheet piles (tablestacas), which causes, during flooding or overflow, blackwater and sewage water to flood into the community. 3- This small, abandoned community is divided behind the Feria del Agricultor, known as Barrio Quinto, and once you cross the Río Limoncito bridge, it belongs to Barrio Quinto and borders the Bridge and Clinic of Barrio Los Cocos (…)" (sic) (see the filing included in the digital case file; undisputed fact).
By means of official communication No. AML-3438-2025 of October 1st, 2025, the Mayor of the Municipalidad de Limón forwarded to the protected party and to the residents of Barrio Quinto official communication No. UTGVM-903-2025 from the Technical Road Management Unit (Unidad Técnica de Gestión Vial), which stated: "(…) In response to the referenced communication, regarding the request from [Name 001] and neighbors for the repair of roads 7-01-810 and 7-01-811, located in the B° Quinto – Limoncito sector, I inform you that this unit works with the programming of the Five-Year Road Conservation and Development Plan (Plan Quinquenal de Conservación y Desarrollo Vial) of the Canton of Limón, and road intervention is carried out according to the score assigned to each road, in accordance with the classification parameters used in its preparation. The referenced roads are not scheduled for early intervention, as the Cantonal Road Network (Red Vial Cantonal) of Limón comprises 1,074 roads, and since it is not possible to attend to all of them in the same year, the aforementioned Plan Vial Quinquenal is used as an orientation tool for intervention using resources from Ley 8114 and Ley 9329 (…) Road 7-01-810 is included in Policy No. 2, at position No. 150, and road 7-01-811 is included in Policy No. 3, at position No. 364, as shown in the following table (…) With the understanding that they will be addressed in the order corresponding to the annual intervention schedule, without it being possible to give an exact date, as this will depend on the progress of intervention on the preceding roads under Policy No. 1, Policy No. 2, and Policy No. 3, until reaching position No. 150 and position No. 364 respectively, over the five-year period covered by the Plan Vial Quinquenal (…)" (sic) (see the evidence submitted by the petitioner, included in the digital case file).
On September 26, 2025, the petitioner submitted to the Defensoría de los Habitantes a request for intervention with the Municipalidad de Limón, in the following terms: "(…) On July 30, 2025, a group of neighbors submitted a formal written complaint to the Municipalidad de Limón, stating that in Barrio Quinto, specifically behind the property where the Feria del Agricultor is held, the road is in poor condition, a situation that extends to the boundary with Barrio Los Cocos. Additionally, they noted that, within the framework of an inter-institutional project involving SENARA and the Municipalidad de Limón, cleanup work was carried out on the Río Limoncito and retaining walls were built. However, these works were left unfinished, which has generated greater concern in the community. For this reason, they requested the appropriate municipal intervention in order to provide a comprehensive solution.
However, as of the date of this request, they had not received a formal response from the Local Government. Therefore, the Defensoría de los Habitantes is requested to investigate the reasons why the Municipalidad de Limón has not addressed the reported events and, in the event that the works are scheduled for this year or the next, to expressly communicate that information so that the community can properly follow up on the potential solutions proposed by the municipal authority (…)" (sic) (see the evidence submitted by the petitioner, included in the digital case file).
By means of official communication No. 11381-2025-DHR of October 2, 2025, the Defensoría de los Habitantes requested a report from the Mayor and the Coordinator of the Technical Road Management Unit, both of the Municipalidad de Limón (see the evidence submitted by the petitioner, included in the digital case file).
By means of official communication No. UTGVM-939-2025 of October 7, 2025, addressed to the Mayor of the Municipalidad de Limón, the Technical Road Management Unit of the Municipalidad de Limón stated: "(…) In response to the referenced communications, regarding the complaint filed by Mr. [Name 001] and neighbors of the B° Quinto – Limoncito sector, as indicated in official communication No. 11381-2025-DHR from the Defensoría de los Habitantes (…) I submit a report in response to the following points (…) With respect to the intervention of the streets, as indicated in the previous point: they will be addressed in the order corresponding to the annual intervention schedule, without it being possible to give an exact date, as this will depend on the progress of intervention on the preceding roads under Policy No. 1, Policy No. 2, and Policy No. 3, until reaching position No. 150 and position No. 364 respectively, over the five-year period covered by the Plan Vial Quinquenal.
Regarding the works carried out by the company SENARA on the Río Limoncito cleanup project and the construction of retaining walls, the matter had already been raised with SENARA since August 21, 2024, by means of official communication UTGVM-700-2024 (…), requesting specific information about the "Proyecto Sistema Control de Inundaciones Área Limoncito," in response to a request from Ms. (…) and neighbors of the same sector (…) Therefore, by means of official communication UTGV-005-2025 (…) of January 2, 2025, in response to official communication AML-3867-2024, information is provided regarding the response received under SENARA-INDEP-PSCIAL-0060-2024 (…), in relation to the query as to "whether the dredging (dragado) and riverbank protection project extended to the point where it stood at that time, or whether an expansion was going to be carried out," to which they replied that "the Proyecto Sistema Control de Inundaciones Área Limoncito currently does not contemplate sheet-pile (tablestaca) protection for the stretch," because at the technical level there is a construction difficulty for the development of the project given that infrastructure exists very close to both sides of the riverbanks, making intervention in this stretch impossible, and that, at the economic level, given the above situation and due to the amount approved under the loan for the project, this stretch was not considered within the budget, as costs would increase due to property expropriations (expropiaciones), additional machinery, and materials that would be needed if this sector were included.
By means of official communication UTGVM-789-2024 (…) of September 16, 2024, a copy of the said SENARA official communication was delivered to Ms. (…) and neighbors. It is important to note that contact is maintained with the company SENARA, and recently, via email, official communication SENARA-INDEP-PSCIAL-OFI-368-2025 (…) of October 2, 2025, was received, in which we are asked, as an institution, to collaborate in clarifying certain aspects related to the imminent commencement of road intervention and improvement works within the area of influence of the "Proyecto Sistema Control de Inundaciones Área Limoncito" (…)" (sic) (see the evidence submitted by the petitioner, included in the digital case file).
By means of official communication No. 14884-2025-DHR of December 17, 2025, the Defensoría de los Habitantes put forward a series of questions to SENARA, which provided the following information in official communications Nos. SENARA-GG-OFI-010-2026 of January 9, 2026 and SENARA-INDEP-PSCIAL-OFI-002-2026: "(…) – the PSCIAL emerged as one of the surviving projects of the "Proyecto Limón Ciudad Puerto" (PLCP). – Which was divided into two stages, indirectly benefiting thousands of people; however, the PLCP had problems with its structure and design that hindered its implementation. – Two of the project's most significant components—namely the Sanitary Sewerage (Alcantarillado Sanitario) component, whose Executing Unit is AyA, and the Flood Control component, whose Executing Unit is SENARA—showed significant progress. For this reason, the Sistema de Control de Inundaciones del Área de Limoncito Project (PSCIAL) is executed solely by SENARA and was divided into two stages: one stage financed by a transfer from the Ministerio de Hacienda and the other through a BCIE loan, to address the Río Limoncito watershed. – Flooding problems were brought to an end: uncontrolled human settlements (asentamientos humanos) on the riverbanks, narrowing of channels due to illegal construction, and poor solid waste management. – The project's main objective was to reduce flood risk in the lower watershed of the Río Limoncito to improve living conditions for the population, through the expansion of the hydraulic capacity of the main drainage network, both natural and artificial. – To achieve this objective, specific works were established for each stage of the project. – The works of the first stage were completed at the end of 2023 (placement of 1.5 km of sheet piling, construction of 17 pedestrian bridges, and cleaning of various channels). – As part of the second stage, the placement of sheet piling and re-channeling (recava) in the Río Limoncito was completed, with other works pending in accordance with the BCIE's schedule. Additionally, SENARA explains why the sector downstream of the Barrio Quinto bridge was not intervened, noting the following: - That the Proyecto Sistema Control de Inundaciones Área Limoncito (PSCIAL) did not from its inception contemplate the placement of sheet piling, nor any other slope (talud) support system in that sector, even though channel cleanup work was carried out in November 2021 downstream of the Barrio Quinto bridge, on the right bank of the Río Limoncito. – At the environmental level, there is a constraint because the area contains protected wetlands (humedales) where the law limits intervention. – The proximity of houses and private boat docks to the channel prevents the use of heavy machinery, which constitutes a technical limitation. There is also an economic limitation, since intervention requires expropriations that would generate a high cost not contemplated in the original project budget. These limitations caused this sector to be excluded from the project from the outset. The official communication outlines SENARA's competencies and responsibilities and concludes by stating that there are no unfinished works under its responsibility within the current scope of the PSCIAL. Additionally, in response to the specific questions posed by the Defensoría de los Habitantes to SENARA, it states verbatim: "… Finally, with respect to the questions raised by the Defensoría de los Habitantes, it must be stated: 1. Inform the reasons justifying the exclusion of the Barrio Quinto stretch from the project that prevent its execution. A/. According to what is stated in the preceding text, there are three reasons: 1. Environmental situation: the mentioned area presents an environmental condition that limits intervention with works, since from the Barrio Quinto bridge downstream, the location shows the existence of several areas classified as Yolillal—one downstream of the bridge on the left bank (light-blue patch), a second further downstream presenting another Yolillal area under the same conditions on the right bank, and a third further downstream upon reaching the confluence between the Río Limoncito and the Río Cieneguita—all in addition to the little or no gradient of the area until reaching the river mouth at the sea. The Yolillal is a type of wetland or swamp in which yolillo palms are the dominant vegetation. These are important habitats for biodiversity in Costa Rica, are protected by law, and are safeguarded by the Sistema Nacional de Áreas de Conservación; for this reason they are mapped in the SNIT. 2. Technical situation: there is a construction difficulty for the development of works in the location, given that infrastructure exists very close to both sides of the riverbanks—such as houses that are practically on top of the river—as well as private boat docks, making intervention in this stretch impossible. Upstream of the bridge the situation is entirely different, as can be verified in the field. 3. Economic situation: given the above situation and due to the amount approved for the entirety of the PSCIAL project, both for Stage I (Transfer from the Ministerio de Hacienda) and Stage II (Loan Agreement No. 2198 BCIE financing the Sewerage and Flood Control program for Limón), this stretch was not considered within the budget, since the cost increase resulting from the expropriations of properties that would have to be carried out in the area (houses, boat docks)—given the lack of maneuvering space for machinery, as well as the additional materials needed for sheet piling—caused this sector to be excluded from the project from the outset. 2. Inform whether there is an alternative action plan to address the unfinished works. A/. The PSCIAL project has intervention and financing plans for whatever the project may require, provided it falls within the project's scope, as defined by the signing of Loan Agreement No. 2198 with BCIE. This means that, in order to make any modification to what has already been signed, a "No-Objection" (No objeción) must be requested from the bank. The said loan is supervised by Crédito Público de Hacienda through site visits and report submissions. The works, therefore, cannot remain unfinished, and if for any reason any of the works could not be executed, a detailed technical justification for the reasons behind the decision must be submitted and approved by SENARA's Management, its Board of Directors (Junta Directiva), and BCIE. It must be made clear that intervention in the area in question, downstream of the bridge at Barrio Quinto, is not a work that formed part of the original project, for the reasons already explained, so non-intervention is what is appropriate according to the current project scope and does not imply that SENARA is leaving unfinished works in that sector. If so, submit a critical path (ruta crítica), responsible parties, and timelines for such intervention (…) Due to the works that SENARA has been carrying out over several years in the central canton of Limón, other critical flooding-affected points outside the PSCIAL (Stages I and II) area of influence have been identified, which has led SENARA to schedule meetings with senior officials of the Municipalidad de Limón so that, through the local government, SENARA may be requested to develop projects along the same lines as the PSCIAL and so that together possible financing alternatives may be sought, which could include CNE, the canon (levy) administered by Japdeva, resources from IFAM, among others, since technical studies must be financed, specialized personnel—which is limited at SENARA—is required, as well as financing of the costs of the proposed works (…) Likewise, efforts have been made to explain to those who have requested it the scope of the Stage I and Stage II works of the PSCIAL and that it is not possible to address all flooding problems in the central canton of Limón through a single project. It has also been proposed that affected persons could request intervention in their communities from the local government (Municipalidad de Limón) and from CNE (through the Comité Municipal de Emergencias), to the extent that their situation constitutes an emergency, since these institutional bodies could, together with a formal request to SENARA—which would contribute the technical component—seek possible solutions to each problem. In the specific case of the area behind the farmers' market, it might be possible to arrange a provisional intervention, with first-response funds (fondos de primer impacto), by the Municipalidad de Limón and CNE, as deemed appropriate by the professionals at those institutions, who could have access to other types of resources—unlike SENARA, which does not have its own resources to carry out interventions of this kind (…)" (sic)
By means of official communication No. 03332-2026-DHR of March 18, 2026, the Defensoría de los Habitantes issued a final report without recommendations, reaching the following conclusions: "(…) Upon conclusion of the investigation, the following facts were established: - Roads with codes 7-01-810 and 7-01-811 are duly registered in the Technical Road Management Unit of the Municipality; however, these roads will not be intervened in the short term, as the Cantonal Road Network comprises 1,074 roads, which are prioritized for intervention according to their classification score. – These roads are classified at positions 150 and 364 respectively within the Plan Vial Quinquenal. – As of this date, the Municipalidad de Limón states that it cannot provide an exact date for their intervention, as this depends on the progress of the preceding positions over the period covered by the Plan Vial Quinquenal. – The Municipalidad de Limón and SENARA both state that there are no unfinished works in the Barrio Quinto sector, as this sector was never part of the project. – Both the Municipalidad de Limón and SENARA establish that this sector is not being considered for intervention, so as of this date there is no comprehensive future solution capable of addressing the resident's ([Name 001]'s) request.
On the other hand, the following facts were not established: - That there is future programming for cleanup work and/or construction of retaining walls on the Río Limoncito. Based on the foregoing, the Defensoría de los Habitantes makes the following considerations (…) Regarding the specific case: Through analysis of the documentation submitted by the Municipalidad de Limón and SENARA, it was possible to determine the reasons why the sector has not been addressed, both in road and river matters, establishing that the failure to attend to the road is attributable to the Cantonal Road Network being governed by a scoring and technical prioritization system that is not favorable for the attention of the requested road. Additionally, it was determined that river intervention was excluded from the project from the outset for economic, technical, and environmental reasons, so since it never formed part of the project from the beginning, it cannot be addressed.
Therefore, it is not possible to conclude that there are unfinished works on the part of the administration, nor an established schedule of actions to be implemented by the Municipalidad de Limón. In this regard, given that resident [Name 001]'s request before the Defensoría was limited to investigating the reasons why the Municipalidad de Limón did not address the reported events and to ascertain whether works are scheduled for that purpose, through the efforts undertaken by this Defensoría the reasons why the administration has not attended to his request have been established; and while the responses provided are not favorable to his interests, they do inform the legal, technical, and budgetary situation. The interested party is advised to: consider filing formal requests with the local government and/or the Comité Municipal de Emergencias, so that, through inter-institutional coordination with entities such as CNE or SENARA, the viability of interventions in the sector may be analyzed, particularly in the event of potential risk scenarios.
Likewise, with respect to the road repair, periodic monitoring of the Plan Vial Quinquenal is advised, requesting updated information from the Municipality regarding the position and progress of the roads of interest (…)" (sic) (see the evidence submitted by the authorities of the Municipalidad de Limón, included in the digital case file).
Regarding the condition of roads and transit infrastructure in the sector reported by the petitioner and the residents of Barrio Quinto in Limón, SENARA detailed: "(…) the PSCIAL has incorporated within its scope works that positively affect connectivity and safety in the area of influence; however, the repair, routine maintenance, and administration of public roads fall within the competence of the relevant institutional bodies responsible for road and municipal matters. The flooding that has historically affected the roads of communication located within the PSCIAL project's area of influence has generated various consequences, including pavement deterioration, culvert collapse, and disruption to people's mobility, as well as public health risks. This situation is aggravated by the accumulation of solid waste and sediment that obstructs drainage systems and causes the saturation or insufficiency of the existing stormwater drainage (drenaje pluvial) infrastructure.
Among the actions developed by the PSCIAL project, the following stand out: the placement of sheet piling on the banks of the Río Limoncito and the Quebrada Chocolate, the re-channeling and widening of channels, as well as the construction of access bridges to communities and homes. However, to achieve sustainable solutions it is essential to implement integrated watershed management (gestión integral de la cuenca) of the Río Limoncito and the Quebrada Chocolate, incorporating respect for protection zones (zonas de protección) and the delimitation of flood-prone areas. The technical official communications indicate that the project has included the construction and replacement of cantonal bridges, bridges in front of residences, a railway bridge, re-channeling and channel widening works, as well as slope protection through sheet piling in the intervened stretches. These works make it possible to reduce hydraulic obstructions, improve water flow, reduce overflows, and facilitate mobility in sectors where previously insufficient or vulnerable structures existed.
In this regard, it has been established that buildings constructed under conditions of vulnerability exist in the area, some of them located on the banks of the river or stream. In particular, in the stretch between the Barrio Quinto bridge and the confluence of the Ríos Limoncito and Cieneguita, numerous structures do not respect the protection zone established in Article 33 of the Ley Forestal N.° 7575, which provides, among other aspects, that the ten meters on each side of rivers, streams (quebradas), or creeks (arroyos) located in urban areas with flat terrain are considered protection areas (áreas de protección). These areas constitute legal limitations on the use of private property in order to protect water resources, biodiversity, and bank stability. Traditionally, construction and uses incompatible with environmental protection within these strips were not permitted. Subsequently, through the reform enacted in 2022, Articles 33 bis and 33 ter were incorporated into the Ley Forestal, allowing certain low-impact or public-interest works, subject to compliance with specific requirements and authorizations.
The disorderly urbanization that has developed in the surroundings of the Río Limoncito, the Quebrada Chocolate, and other bodies of water has fostered the establishment of settlements in risk zones (zonas de riesgo). This situation is aggravated by the effects of climate change (cambio climático), reflected in more frequent and intense rainfall events, as well as by the physical constraints inherent in densely urbanized areas, where expanding drainage infrastructure is particularly complex. Finally, it is noted that the corresponding Municipality is the entity responsible for the attention and repair of public roads affected by flooding. Nevertheless, the implementation of sustainable solutions requires effective coordination among the municipality, MOPT, INVU, and other competent institutions. Likewise, citizen participation is fundamental, through the timely reporting of impacts and collaboration in prevention and risk management initiatives.
It should also be noted that Stage II includes non-structural and complementary works, such as the construction of community integration areas and landscape improvement of the area of influence, acquisition of meteorological and flow-measurement equipment, consulting services for environmental education and social capacity-building, and a feasibility study for waste management. These actions contribute to the sustainability of the system, risk prevention, and improvement of conditions for the use of public space, although they do not replace municipal competence over cantonal roads, urban control, stormwater drainage, and integrated waste management (…)" (sic) (see the sworn report submitted by the SENARA authorities, included in the digital case file).
Regarding the problem of sewage (aguas negras) disposal in the sector denounced by the appellant and the residents of Barrio Quinto de Limón, SENARA explained: "(…) The Environmental Impact Study (Estudio de Impacto Ambiental, EsIA) for the Project 'Flood Control System for the Limoncito Area (PSCIAL),' prepared by the Sustainable Urban Development Research Program of the University of Costa Rica for SENARA, identified during the baseline (línea base) phase that the contamination of water bodies (cuerpos de agua) in the urban portion of the lower basin (cuenca baja) of the Limoncito River does not correspond to an effect caused by the PSCIAL works, but rather to a pre-existing condition associated primarily with two sources: the disposal of solid waste in rivers and streams, and the direct discharges of domestic wastewater (aguas residuales domésticas) from dwellings located directly on or very close to the watercourses (cauces).
That study notes that, when flooding occurs, the water that reaches homes can carry a high degree of contamination, thereby becoming a public health problem due to the possibility of outbreaks of waterborne diseases (enfermedades de origen hídrico), skin ailments, the presence of disease vectors, and the population's exposure to wastewater mixed with stormwater runoff (escorrentía pluvial). The EIA concluded that the reduction in flooding frequency resulting from the execution of the PSCIAL Flood Control Project works contributes to decreasing the population's exposure to that sanitary condition; however, it also warned that the flood control project does not by itself eliminate the existing contamination in the watercourses, because this depends on a comprehensive solution involving sanitation (saneamiento sanitario), solid waste management, and urban planning (ordenamiento urbano) within the watershed.
With respect to the sanitary sewerage system (alcantarillado sanitario), the EIA determined that the area presents physical conditions that hinder the adequate use of individual treatment systems, particularly due to the high water table (nivel freático), the predominant presence of fine clay materials, and the small lot sizes in many parts of the urban area. Furthermore, the study identified that a significant portion of the population uses septic tanks (tanques sépticos) and that there are direct discharges into rivers or streams, which reinforces the need for a comprehensive sanitary solution connected to the corresponding system. Consequently, the EIA itself recommended that the flood control project be complemented by the construction and operation of sanitary sewerage infrastructure, as this is an indispensable condition for effectively improving water quality in the Limoncito River and its tributaries.
This complementarity was subsequently also reflected in Ley N.° 9690, through which Loan Agreement N.° 2198, entered into between the Republic of Costa Rica and the Central American Bank for Economic Integration (BCIE), was approved to finance the Sewerage and Flood Control Program for Limón. Said program comprises two distinct but complementary projects: the Limón City Sanitary Sewerage Expansion and Improvement Project, under the responsibility of the Costa Rican Institute of Aqueducts and Sewers (Instituto Costarricense de Acueductos y Alcantarillados, AyA), and the Limoncito River Channelization and Flood Control Project, Limón, under the responsibility of SENARA. Consequently, the legal and financial framework of the program itself recognizes that comprehensive attention to the problem requires, on the one hand, hydraulic works to reduce flood risk and, on the other, sanitary infrastructure to address contamination from wastewater.
With respect to solid waste, the EIA also documented that, although the Municipalidad de Limón provides collection and final disposal services in the vicinity of the Limoncito River, there is a recurrent practice of improper disposal of waste in watercourses, riverbanks (márgenes), and points near narrow streets where collection may be difficult. This situation causes waste to be swept into the river during rainfall events, obstructs hydraulic flow, reduces the watercourse's conveyance capacity, and worsens flooding and contamination conditions. For this reason, the EIA proposed environmental education actions, municipal coordination, improvements in waste management, and community participation as complementary non-structural measures necessary for the system's sustainability. Said non-structural measures form part of the components envisaged for the adequate environmental and social management of the project, and they do not constitute merely general recommendations but rather actions linked to the execution and sustainability of the Sewerage and Flood Control Program for Limón.
Within that framework, an environmental education program is currently being implemented, aimed at strengthening community awareness of the relationship between solid waste, watercourse contamination, hydraulic obstruction, and increased flood risk. This program includes, among other actions, the development of a series of workshops directed at schools located within the project's area of influence, with the purpose of raising awareness among students, teaching staff, and the educational community regarding proper waste management, the protection of the Limoncito River and its tributaries, the importance of not depositing waste in watercourses, and citizens' shared responsibility in preventing flooding and sanitary hazards. With specific regard to the absence of sheet piles (tablestacas) or retaining walls (muros de contención) in the sector indicated by the appellant, it must be noted that the structural works of the PSCIAL are being executed in accordance with the technical, environmental, budgetary, and contractual scope defined for each phase of the project.
In the reaches (tramos) prioritized upstream of the Barrio Quinto bridge, hydraulic widening works, re-excavation, bridge construction, and sheet pile installation have been carried out; however, the reach downstream of the Barrio Quinto bridge through to the confluence with the Cieneguita River and its mouth at the sea was not incorporated from the project's formulation stage for the placement of sheet piles or retaining walls, due to the environmental, technical, and economic constraints that are further developed later in this report. It should also be noted that the placement of sheet piles or retaining walls has as its primary purpose the stabilization of banks, protection of infrastructure, channeling of flow, and reduction of the occurrence or magnitude of overflows in the intervened sectors; however, such works do not constitute a sanitation solution nor do they replace sanitary sewerage infrastructure, discharge control, solid waste collection, or the regulation of occupations located in the protection zone (zona de protección).
Therefore, even when a containment work may contribute to improving hydraulic capacity and reducing homes' exposure to flooding events, it does not eliminate the source of contamination if wastewater discharges and waste disposal in the watercourse persist. In this regard, SENARA reports that its competence within the PSCIAL is limited to the execution of hydraulic flood control and mitigation works, in accordance with the approved design, the corresponding environmental permits and authorizations, and the available resources. The handling of wastewater discharges, sanitary sewerage, discharge control, solid waste collection, ordinary cleaning of public spaces, urban control, and municipal management of roads and stormwater drainage systems falls within the competence of other responsible institutions, without prejudice to the interinstitutional coordination that may be necessary to comprehensively address the problems described by the community.
For the foregoing reasons, SENARA does not deny the existence of contamination in the Limoncito River nor the sanitary risks associated with contaminated water being carried during flooding events. On the contrary, said condition was identified and documented in the EIA as a structural problem of the lower basin, the resolution of which requires complementary measures in sanitation, sewerage, waste management, environmental education, control of occupancies in the protection zone, and coordination among the Municipalidad de Limón, the Instituto Costarricense de Acueductos y Alcantarillados, the Ministerio de Salud, SINAC, SETENA, MOPT, and other competent entities. The PSCIAL contributes to reducing the frequency and magnitude of flooding in the intervened sectors, but it cannot, by itself, resolve the sanitary contamination that originates outside the material scope and competence of the hydraulic works executed by SENARA (…)" (sic) (see the sworn report submitted by SENARA's authorities, added to the digital case file).
Regarding the allegedly unfinished works in the sector denounced by the appellant and the residents of Barrio Quinto de Limón, SENARA stated: "(…) In accordance with what was indicated in official communications SENARA-GG-OFI-010-2026 (In Response to Official Communication N.° 14884-2025-DHR) and SENARA-INDEP-PSCIAL-OFI-002-2026, submitted to the Defensoría de los Habitantes, the following is reported regarding the reach comprising the area downstream of the Barrio Quinto bridge through to the confluence with the Cieneguita River and its mouth at the sea. Regarding the bank slippage (deslizamiento) of the Limoncito River in the reach between CRTM05 coordinates (E: 605260, N: 1104333) and (E: 605348, N: 1104383), located downstream of the Barrio Quinto bridge on the right bank of the Limoncito River, it is noted that in November 2021 watercourse-clearing works were carried out. However, from its formulation, the PSCIAL did not contemplate the placement of sheet piles or any other slope (talud) stabilization or containment system in that sector.
The exclusion of this reach was based on environmental, technical, and economic criteria, which are detailed below: Environmental aspects: The area presents environmental limitations that restrict the execution of infrastructure works. Based on information obtained from the National Territorial Information System (Sistema Nacional de Información Territorial, SNIT), consultations with ACLAC, and applicable environmental regulations, the reach located downstream of the Barrio Quinto bridge presents a combination of sensitive conditions, including wetland (humedal) areas and vegetation associated with riparian ecosystems, water body protection zones, low gradient toward the river mouth, proximity to areas subject to natural hydrological dynamics, and the presence of vegetation cover (cobertura vegetal) that performs stabilization, buffering, and environmental protection functions. In particular, the sector downstream of the Barrio Quinto bridge through to the confluence with the Cieneguita River and its mouth at the sea presents environmental and geomorphological conditions that require a prior comprehensive assessment.
The presence of wetlands, riparian vegetation (vegetación riparia), legal protection zones, areas of low gradient, possible restrictions on the removal of vegetation cover, and the proximity of human settlements to the watercourse limit the possibility of carrying out widening, sheet piling, or containment works without specific studies and without the corresponding environmental authorizations. Therefore, the environmental limitation is not confined solely to the presence of environmentally sensitive areas, but encompasses the full set of site conditions and the legal framework applicable to watercourses, wetlands, protection zones, riparian vegetation, and public domain (dominio público) assets. Any intervention in that reach must take into account the Ley de Aguas, the Ley Forestal, the regulations on wetlands, and the competencies of MINAE, SINAC, the Dirección de Agua, and other competent authorities.
Technical aspects: From a construction standpoint, the execution of works in this sector presents significant limitations due to the proximity of existing infrastructure on both banks of the river. Dwellings are observed to be located practically on the watercourse, as are private boat docks (atracaderos privados) and other structures that significantly reduce the space available for machinery operation, equipment installation, temporary material storage, the formation of safe access routes, and the implementation of stabilization or containment works. Added to the foregoing are the geotechnical (geotécnicas) characteristics specific to the sector. According to the EIA baseline, the project area sits on recent deposits of alluvial and colluvial (aluvial y coluvial) origin, with the presence of intermediate-plasticity clays, silts with sand, medium to fine sands, and gravels. These materials, associated with a low-gradient area, high humidity, water table influence, and proximity to the watercourse, may be susceptible to expansion and contraction processes, loss of strength due to saturation, surface erosion, local scour (socavación local), and slope destabilization when existing cover is disturbed or loads on the bank are increased.
In this context, the entry of heavy machinery into a confined space with saturable soils and banks already eroded or disturbed by human settlements could generate additional risks: increased vibrations, surcharging of unstable edges, loss of lateral confinement, material detachment, increased erosion, impact on nearby dwellings, and greater sediment (sedimento) input to the watercourse. Therefore, far from being a straightforward intervention, the movement of machinery in this reach could temporarily or permanently worsen existing instability conditions. This situation differs substantially from the conditions existing upstream of the Barrio Quinto bridge, where it was possible to carry out the interventions contemplated in the PSCIAL given the previously defined access conditions, maneuverability, hydraulic design, permits, budget, and construction feasibility within the approved scope.
Economic aspects: Taking into account the environmental and technical limitations described above, as well as the approved budget for the overall execution of the PSCIAL — both in its First Phase, financed by a transfer from the Ministerio de Hacienda, and in its Second Phase, financed through Loan Agreement N.° 2198 from the BCIE — the referenced reach was not incorporated within the project's scope. Any eventual intervention would have required property expropriations (expropiaciones), relocation of existing infrastructure, acquisition of additional materials, and the implementation of special construction measures, which would have generated a substantial increase in project costs. For these reasons, that sector was excluded from the planning and design phase of the PSCIAL. For the foregoing reasons, this does not constitute an unfinished work within the scope of the PSCIAL, but rather a reach excluded from the outset at the technical, environmental, budgetary, and contractual formulation stage of the project.
Any subsequent intervention in that sector would require new technical, environmental, hydraulic, social, and economic studies, as well as the identification of a separate or complementary funding source, the corresponding permits, and coordination with the Municipalidad de Limón, the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, SINAC, the Ministerio de Ambiente y Energía, AyA, and other competent entities. SENARA has also indicated that it is willing to provide technical advisory assistance to the competent institutions when formally requested to do so, particularly if the need to assess provisional or future interventions outside the scope of the PSCIAL is identified. However, the institution does not have its own resources to execute works not contemplated in the approved project, nor can it unilaterally modify the scope defined in Loan Agreement N.° 2198 BCIE without the corresponding technical, institutional, and financial approvals (…)" (sic) (see the sworn report submitted by SENARA's authorities, added to the digital case file).
IV.On the matters denounced. First, it is necessary to delineate what the appellant has denounced before the Municipalidad de Limón (directly), and before SENARA (through the intervention of the Defensoría de los Habitantes).
V.In the sub examine it was demonstrated that on July 17, 2025, residents of the Barrio Quinto community, by means of a written communication, filed the following claim before the Municipalidad de Limón: "(…) 1- Roads in poor condition since the previous administration of Mattis have left the community located behind the Feria del Agricultor, crossing the bridge to the left and up to the border with Barrio Los Cocos. 2- The company SENARA carried out the Río Limoncito Cleanup Project and in the indicated area did not perform any cleanup and did not install retaining walls or sheet piles, which causes, during high-water events or overflows, the entry of sewage and fecal water into the community. 3- This small abandoned community is divided behind the Feria del Agricultor, known as Barrio Quinto, and once one crosses the Río Limoncito bridge, it belongs to Barrio Quinto and borders the bridge and clinic of Barrio Los Cocos (…)" (sic).
On September 26, 2025, the appellant submitted to the Defensoría de los Habitantes a request for intervention before the Municipalidad de Limón, in the following terms: "(…) On July 30, 2025, a group of residents submitted a formal written complaint before the Municipalidad de Limón, in which they stated that in Barrio Quinto, specifically behind the grounds where the Feria del Agricultor is held, the road is in poor condition, a situation that extends to the border with Barrio Los Cocos. Additionally, they noted that within the framework of an interinstitutional project in which SENARA and the Municipalidad de Limón participated, cleanup works on the Río Limoncito and construction of retaining walls were carried out. However, said works were left unfinished, which has generated greater concern in the community. For the foregoing reasons, they requested the appropriate municipal intervention in order to provide a comprehensive solution.
Nonetheless, as of the date of this filing, they have received no formal response from the local government. Therefore, the appellant requests the Defensoría de los Habitantes to investigate the reasons why the Municipalidad de Limón has not addressed the reported facts and, should the works be scheduled for this year or the next, to expressly communicate this so that the community may provide timely follow-up on any eventual solutions proposed by the municipal authority (…)" (sic).
VI.From the foregoing it may be inferred that the matters denounced before the Municipalidad de Limón were: 1. roads in poor condition; 2. the entry of sewage into the community, due to the fact that SENARA allegedly did not carry out cleanup and infrastructure construction in the area; and 3. the existence of unfinished works by SENARA. These three points, specifically in "(…) the community located behind the Feria del Agricultor, crossing the bridge to the left and up to the border with Barrio Los Cocos (…)" (sic). Consequently, the appellant did not expressly denounce — at least the evidence he submitted does not allow it to be established — that erosion of the banks of the Río Limoncito is endangering several homes and the lives of their inhabitants. However, the final report submitted by the Defensoría de los Habitantes indicates that both institutions are also aware of this problem. In official communication No. 03332-2026-DHR of March 18, 2026, the Defensoría de los Habitantes issued a final report without recommendations, concluding as follows: "(…) Upon conclusion of the investigation, the following facts were established: (…) – Both the Municipalidad de Limón and SENARA state that there are no unfinished works in the Barrio Quinto sector, as this sector was never part of the project. – Both the Municipalidad de Limón and SENARA establish that this sector is not currently being assessed for intervention; therefore, as of this date, there is no comprehensive future solution that can address the resident's ([Nombre 001]) request.
On the other hand, the following facts were not established: - That there is any future schedule for carrying out cleanup works and/or construction of retaining walls on the Río Limoncito. Based on the foregoing, the Defensoría de los Habitantes offers the following considerations (…) On the specific case: Through analysis of the documentation submitted by the Municipalidad de Limón and SENARA, it was possible to determine the reasons why the sector has not been intervened, both in road matters and in fluvial matters (…) Furthermore, it is determined that the fluvial intervention was excluded from the outset of the project for economic, technical, and environmental reasons; therefore, as it was never part of the project from the beginning, it cannot be addressed. (…) That being so, since the request of resident [Nombre 001] before the Defensoría was limited to investigating the reasons why the Municipalidad de Limón did not address the reported facts and to ascertaining whether any works are scheduled for that purpose, through the proceedings conducted by this Defensoría the reasons why the administration has not addressed the request have been made known; and while the responses provided are not favorable to the interests of the resident, they do inform the legal, technical, and budgetary situation.
The interested party is suggested to: consider filing formal requests before the local government and/or the Municipal Emergency Committee (Comité Municipal de Emergencias), so that, through interinstitutional coordination with entities such as CNE or SENARA, the feasibility of interventions in the sector may be analyzed, particularly should potential risk scenarios arise (…)" (sic) (emphasis not in the original).
VII.Regarding roads in poor condition. It was established that, through official communication No. AML-3438-2025 of October 1, 2025, the Mayor of the territorial corporation forwarded to the protected party and the residents of Barrio Quinto, official communication No. UTGVM-903-2025 from the Road Management Technical Unit (Unidad Técnica de Gestión Vial), which stated: "(…) In response to the referenced communication, regarding the request by [Nombre 001] and neighbors for the repair of roads 7-01-810 and 7-01-811, located in the B° Quinto - Limoncito area, I inform you that: this unit operates in accordance with the scheduling set out in the Plan Quinquenal de Conservación y Desarrollo Vial del Cantón de Limón, and road interventions are carried out according to the score assigned to each road, in accordance with the classification parameters used to prepare it. The aforementioned roads are not scheduled for intervention in the near future, as the cantonal road network (Red Vial Cantonal) of Limón comprises 1,074 roads, and since it is not possible to address all of them in a single year, the Plan Vial Quinquenal serves as a guiding tool for interventions funded with resources from Ley 8114 and Ley 9329 (…) Road 7-01-810 is included under Policy No. 2, at position No. 150, and road 7-01-811 is included under Policy No. 3, at position No. 364, as shown in the following table (…) With the understanding that they will be addressed in the order corresponding to the annual intervention schedule, without it being possible to provide an exact date, as this will depend on the progress made on the preceding roads under Policy No. 1, Policy No. 2, and Policy No. 3, until positions No. 150 and No. 364 are reached, respectively, over the five years covered by the Plan Vial Quinquenal (…)" (sic) (emphasis not in the original).
Through official communication No. UTGVM-939-2025 of October 7, 2025, addressed to the Mayor of the Municipalidad de Limón, the Road Management Technical Unit of the Municipalidad de Limón stated: "(…) In response to the referenced communications, regarding the complaint filed by Mr. [Nombre 001] and residents of the B° Quinto – Limoncito area, as indicated in official communication No. 11381-2025-DHR from the Defensoría de los Habitantes (…) I submit the following report in response to the points raised (…) With respect to the intervention of the streets, as indicated in the previous point: they will be addressed in the order corresponding to the annual intervention schedule, without it being possible to provide an exact date, as this will depend on the progress made on the preceding roads under Policy No. 1, Policy No. 2, and Policy No. 3, until positions No. 150 and No. 364 are reached, respectively, over the five years covered by the Plan Vial Quinquenal (…)" (sic) (emphasis not in the original).
In official communication No. 03332-2026-DHR of March 18, 2026, the Defensoría de los Habitantes concluded as follows: "(…) Upon completion of the investigation, the following facts have been established: - Roads coded 7-01-810 and 7-01-811 are duly registered with the Road Management Technical Unit of the Municipality; however, these roads will not be addressed in the short term, as the cantonal road network consists of 1,074 roads, which are prioritized for intervention according to their classification score. – These roads are ranked at positions 150 and 364, respectively, within the Plan Vial Quinquenal. – As of this date, the Municipalidad de Limón states that it cannot provide an exact date for their intervention, as this depends on the progress of the preceding positions during the period covered by the Plan Vial Quinquenal (…)" (sic) (emphasis not in the original). Regarding the condition of roads and transit infrastructure in the area, SENARA elaborated: "(…) the PSCIAL has incorporated within its scope works that positively affect connectivity and safety in the area of influence; however, the repair, routine maintenance, and administration of public roads falls within the jurisdiction of the institutions competent in road and municipal matters.
The floods that have historically affected the roads within the PSCIAL project's area of influence have caused various consequences, including pavement deterioration, culvert collapse, and impacts on the mobility of residents, as well as risks to public health. This situation is aggravated by the accumulation of solid waste and sediments that obstruct drainage systems and cause the existing stormwater infrastructure to become saturated or insufficient. Among the actions carried out by the PSCIAL project are the placement of sheet piles (tablestacas) along the banks of the Limoncito River and the quebrada Chocolate, the re-excavation (recava) and widening of watercourses (cauces), as well as the construction of access bridges to communities and residences. However, in order to achieve sustainable solutions, it is essential to implement comprehensive management of the Limoncito River watershed (cuenca) and the quebrada Chocolate, including respect for protection zones (zonas de protección) and the demarcation of flood-prone areas.
Technical communications indicate that the project has included the construction and replacement of cantonal bridges, residential access bridges, a railway bridge, re-excavation and channel widening works, as well as slope protection by means of sheet piles in the intervened sections. These works help to reduce hydraulic obstructions, improve water flow, reduce overflows, and facilitate mobility in sectors where previously inadequate or vulnerable structures existed. In this regard, it has been confirmed that buildings have been constructed under conditions of vulnerability, some of them located on the banks of the river or stream. In particular, in the reach between the Barrio Quinto bridge and the confluence of the Limoncito and Cieneguita rivers, numerous structures do not comply with the protection zone established in Article 33 of Ley Forestal N.° 7575, which provides, among other things, that a strip of ten meters on each side of rivers, streams, or creeks located in urban areas with flat terrain is considered a protection area.
These areas constitute legal limitations on the use of private property for the purpose of protecting water resources, biodiversity, and the stability of riverbanks (riberas). Traditionally, construction and uses incompatible with environmental protection were not permitted within these strips. Subsequently, through the 2022 reform, Articles 33 bis and 33 ter were added to the Ley Forestal, allowing certain low-impact works or works of public interest, subject to compliance with specific requirements and authorizations. The disorderly urbanization that has developed around the Limoncito River, the quebrada Chocolate, and other bodies of water has facilitated the establishment of settlements in risk-prone areas. This situation is aggravated by the effects of climate change, reflected in more frequent and intense rainfall events, as well as by the physical limitations inherent to densely urbanized areas, where expanding drainage infrastructure is particularly complex.
Finally, it is noted that the corresponding municipality is the entity responsible for addressing and repairing public roads affected by flooding. However, the implementation of sustainable solutions requires effective coordination among the municipality, MOPT, INVU, and other competent institutions. Likewise, citizen participation is essential through the timely reporting of damage and collaboration in prevention and risk management initiatives. It should also be noted that Phase II contemplates non-structural and complementary works, such as the construction of community integration areas and landscape improvement within the area of influence, the acquisition of meteorological and flow-measurement equipment, consultancy for environmental education and social capacity building, and a feasibility study for waste management. These actions contribute to the sustainability of the system, risk prevention, and improvement of public space conditions, although they do not replace the municipal competence over cantonal roads, urban controls, stormwater drainage, and comprehensive waste management (…)" (sic) (emphasis not in the original).
VIII.It is not apparent that the Municipalidad de Limón has definitively resolved the matter of the poor road conditions reported, as it is repeatedly stated that no intervention is planned in the near future for the roads in question (Nos. 7-01-810 and 7-01-811). It should be noted that the complaint was filed approximately one year ago.
IX.Regarding the ingress of sewage (aguas negras). In particular, with respect to the problem of sewage ingress, SENARA explained: "(…) The Environmental Impact Study (EsIA) for the 'Sistema de Control de Inundaciones en el área de Limoncito (PSCIAL)' project, prepared by the Sustainable Urban Development Research Program of the Universidad de Costa Rica for SENARA, identified from the baseline study stage that the contamination of water bodies in the urban portion of the lower watershed of the Limoncito River does not correspond to an effect caused by the PSCIAL works, but rather to a pre-existing condition associated primarily with two sources: the disposal of solid waste in rivers and streams, and direct discharges of domestic wastewater (aguas residuales) from residences located in front of or very close to the watercourses. That study notes that, when flooding occurs, the water that reaches homes may carry a high degree of contamination, becoming a public health problem due to the possibility of waterborne disease outbreaks, skin conditions, the presence of disease vectors, and exposure of the population to wastewater mixed with stormwater runoff.
The EsIA concluded that the reduction in the frequency of flooding resulting from the execution of the PSCIAL flood control project works contributes to reducing the population's exposure to those sanitary conditions; however, it also warned that the flood control project does not, by itself, eliminate the existing contamination in the watercourses, as this depends on a comprehensive sanitation (saneamiento) solution, solid waste management, and urban planning (ordenamiento urbano) within the watershed. With respect to the sanitary sewer system (alcantarillado sanitario), the EsIA determined that the area presents physical conditions that hinder the adequate use of individual treatment systems, particularly due to the high water table (nivel freático), the predominant presence of fine clay materials, and the small lot sizes prevalent in the urban area. Furthermore, the study identified that a significant portion of the population uses septic tanks and that there are direct discharges into rivers or streams, which reinforces the need for a comprehensive sanitary solution connected to the corresponding system.
Consequently, the EsIA itself recommended that the flood control project be complemented by the construction and operation of sanitary sewer infrastructure, as this is an indispensable condition for effectively improving water quality in the Limoncito River and its tributaries. This complementarity was subsequently also incorporated into Ley N.° 9690, through which Loan Agreement No. 2198, entered into between the Republic of Costa Rica and the Central American Bank for Economic Integration (Banco Centroamericano de Integración Económica, BCIE), was approved to finance the Programa de Alcantarillado y Control de Inundaciones para Limón. That program comprises two distinct but complementary projects: the Proyecto de Ampliación y Mejoramiento del Alcantarillado Sanitario de la ciudad de Limón, under the responsibility of the Costa Rican Institute of Aqueducts and Sewers (Instituto Costarricense de Acueductos y Alcantarillados, AyA), and the Proyecto de Canalización y Control de Inundaciones del río Limoncito, Limón, under the responsibility of SENARA.
Consequently, the legal and financial framework of the program itself acknowledges that a comprehensive response to the problem requires, on one hand, hydraulic works to reduce the risk of flooding, and on the other, sanitary infrastructure to address contamination from wastewater. With respect to solid waste, the EsIA also documented that, although the Municipalidad de Limón provides collection and final disposal services in the vicinity of the Limoncito River, there is a recurring practice of improper disposal of waste in watercourses, along their banks, and at points near narrow streets where collection may present difficulties. This situation causes waste to be swept into the river during rainfall events, obstructing hydraulic flow, reducing the channel's conveyance capacity, and worsening flooding and contamination conditions. For this reason, the EsIA proposed environmental education actions, municipal coordination, improvements in waste management, and community participation as necessary complementary non-structural measures for the sustainability of the system.
These non-structural measures form part of the components envisioned for the adequate environmental and social management of the project, and constitute not merely general recommendations, but actions associated with the implementation and sustainability of the Programa de Alcantarillado y Control de Inundaciones para Limón. In this framework, an environmental education program is being implemented, aimed at strengthening community awareness of the relationship between solid waste, watercourse contamination, hydraulic obstruction, and increased flood risk. This program includes, among other actions, the development of a series of workshops directed at educational centers located in the project's area of influence, with the purpose of raising awareness among students, teaching staff, and the educational community about the proper management of waste, the protection of the Limoncito River and its tributaries, the importance of not dumping garbage in watercourses, and citizens' shared responsibility in flood and sanitary risk prevention.
Specifically regarding the absence of sheet piles or retaining walls in the area identified by the appellant, it should be clarified that the structural works of the PSCIAL are executed in accordance with the technical, environmental, budgetary, and contractual scope defined for each phase of the project. In the reaches prioritized upstream of the Barrio Quinto bridge, hydraulic expansion works, re-excavation, bridge construction, and sheet pile placement have been carried out; however, the reach downstream of the Barrio Quinto bridge up to the confluence with the Cieneguita River and its outlet to the sea was not incorporated from the project's formulation stage for the placement of sheet piles or retaining walls, due to environmental, technical, and economic restrictions that are addressed later in this report. It should also be noted that the primary purpose of placing sheet piles or retaining walls is to stabilize banks, protect infrastructure, channel flow, and reduce the occurrence or magnitude of overflows in the intervened sectors; however, such works do not constitute a sanitation solution and do not replace sanitary sewer infrastructure, discharge controls, solid waste collection, or the regulation of occupations located within the protection zone.
Therefore, even if a containment work may contribute to improving hydraulic capacity and reducing the exposure of homes to flood events, it does not eliminate the source of contamination if wastewater discharges and waste disposal into the watercourse persist. In this regard, SENARA states that its competence within the PSCIAL is limited to the execution of hydraulic works for flood control and mitigation, in accordance with the approved design, the corresponding environmental viability approvals and authorizations, and the available resources. The management of wastewater discharges, the sanitary sewer system, discharge controls, solid waste collection, routine cleaning of public spaces, urban controls, and municipal management of roads and stormwater drainage falls within the jurisdiction of other competent institutions, without prejudice to the interinstitutional coordination that may be necessary to comprehensively address the issues described by the community.
For the foregoing reasons, SENARA does not deny the existence of contamination in the Limoncito River nor the associated sanitary risks from the transport of contaminated water during flood events. On the contrary, this condition was identified and documented in the EsIA as a structural problem of the lower watershed, the resolution of which requires complementary measures related to sanitation, sewerage, waste management, environmental education, control of occupations within the protection zone, and coordination among the Municipalidad de Limón, the Instituto Costarricense de Acueductos y Alcantarillados, the Ministerio de Salud, SINAC, SETENA, MOPT, and other competent entities. The PSCIAL contributes to reducing the frequency and magnitude of flooding in the intervened sectors, but cannot, by itself, resolve the sanitary contamination that originates outside the material and jurisdictional scope of the hydraulic works executed by SENARA (…)" (sic) (emphasis not in the original).
X.Consequently, contrary to what the petitioner sought to imply, the problem of improper sewage disposal in the area was not caused by the works being executed by SENARA, but rather is a prior or pre-existing condition, generated primarily, according to SENARA's assessment, by: "(…) the disposal of solid waste in rivers and streams, and direct discharges of domestic wastewater from residences located in front of or very close to the watercourses. (…)" (sic). It is not possible to affirm that the Municipalidad de Limón has taken the legally appropriate steps to definitively resolve this aspect of the complaint filed on July 17, 2025.
XI.Regarding erosion and the resulting risk. Concerning the erosion of the Limoncito River and the risk it poses to the homes and residents of Barrio Quinto – Río Limoncito, SENARA elaborated: "(…) the PSCIAL has executed works specifically aimed at addressing, within its approved scope, the reduction of hydraulic risk and the protection of riverbanks in the prioritized sectors of the lower watershed. As part of the works corresponding to the First Phase of the PSCIAL project, approximately 1.5 kilometers of sheet pile were placed and the hydraulic section of the Limoncito River was widened in the reach between the Chitá bridge and Barrio Quinto, works that were completed during 2023. Likewise, as part of the Second Phase of the project, the hydraulic section was expanded through excavation and sheet pile placement over approximately 5 kilometers of the Limoncito River, between the Chitá bridge and the Santa Fe sector, works completed during 2025.
The primary function of sheet piles is to act as a containment and channeling structure that enables flood control, reinforces the river's banks, and ensures an orderly flow of water during intense rainfall events. Their implementation contributes significantly to reducing risks to homes, roads, and public infrastructure. Moreover, when integrated with other complementary works, such as bridges and culverts, they form part of a comprehensive protection system for communities located within the project's area of influence. According to official communications SENARA-INDEP-PSCIAL-OFI-292-2025, SENARA-INDEP-RHC-OFI082-2025, and SENARA-INDEP-PSCIAL-OFI-002-2026, Phase I included, among other works, the placement of approximately 1.5 kilometers of sheet pile and the widening of the Limoncito River from the Chitá bridge to Barrio Quinto; the construction of cantonal bridges; the cleaning of the canal Santa Rosa; the cleaning of the quebrada Chinita; the construction of an overflow weir; the cleaning of the canal JAPDEVA; the construction of the transfer canal; and the construction of residential access bridges over the quebrada Chocolate.
Phase II contemplates and is executing additional works, including the expansion of the hydraulic section through excavation and sheet pile placement on the Limoncito River between the Chitá bridge and the Santa Fe sector; the re-excavation and widening of the quebrada Chocolate between the railway bridge and Ruta 32; the re-excavation of the canal Colina; the construction of the railway bridge; the re-excavation and cleaning of the canal Santa Rosa; LIDAR surveying to generate elevation models of the lower watershed; the acquisition of meteorological and flow-measurement equipment; consultancy for environmental education and social capacity building; and a feasibility study for waste management. It should be clarified that the works executed and in progress do not completely eliminate the natural flood threat nor all erosion processes inherent to an urbanized, intervened watershed. However, they do increase the hydraulic capacity of the intervened watercourses, reduce the frequency and magnitude of overflows in the prioritized sectors, stabilize banks by means of sheet piles where technically and environmentally feasible, replace bridges that restricted flow, improve connectivity, and allow for more orderly hydraulic management during intense rainfall events.
The foregoing must also be analyzed in light of the legal limitations established by Ley de Aguas N.° 276 and Ley Forestal N.° 7575. The Ley de Aguas N.° 276 recognizes rivers, their tributaries, channels, and other watercourses as public domain assets, and therefore any intervention within the public domain watercourse, including channeling works, bank protection, cleaning, widening, or construction of hydraulic structures, requires the corresponding technical and administrative authorizations from the competent authorities, particularly the Water Directorate of MINAE. Consequently, SENARA cannot execute works outside the project's authorized scope nor intervene in additional watercourses without the prior permits required by the legal framework. Similarly, Ley Forestal N.° 7575 establishes protection areas along the banks of rivers, streams, and creeks, including protection strips in urban and rural areas, and restricts tree felling, modification of forest cover (cobertura boscosa), and the development of works within those areas, except in the cases and under the conditions expressly authorized by environmental regulations.
The purpose of these restrictions is to protect water resources, preserve the stability of riverbanks, prevent erosion processes, preserve biodiversity, and reduce the risk associated with the occupation of vulnerable banks. Therefore, the mere existence of erosion processes or bank deterioration does not automatically authorize the immediate execution of containment, sheet piling, or channel realignment works. Such interventions must be technically feasible, environmentally compatible, budgetarily funded, and legally authorized. In sectors with wetlands, Yolillales, riparian vegetation, residences within the protection zone, or private structures near the watercourse, the legal restrictions are even more significant and require the evaluation of intervention alternatives based on technical, environmental, social, and economic criteria, as well as coordination with SINAC, MINAE, the Municipalidad de Limón, and other competent institutions (…)" (sic) (emphasis not in the original).
XII.As highlighted above, this matter was brought to the attention of the Municipalidad de Limón and SENARA through the action promoted by the appellant before the Defensoría de los Habitantes. SENARA insists that addressing the problem requires coordinated action with other entities. The following statement made by SENARA to the Defensoría de los Habitantes should be taken into account: "(…) As a result of the works that SENARA has been carrying out over several years in the Cantón Central de Limón, other critical flooding points have been identified outside the PSCIAL (Phases I and II) area of influence, which has led SENARA to hold meetings with senior officials of the Municipalidad de Limón so that the local government may request from SENARA projects along the same lines as the PSCIAL and so that together they may seek possible financing alternatives, which could include CNE, the canon administered by JAPDEVA, resources from IFAM, and others, given that technical studies must be funded, specialized personnel — which SENARA has in limited supply — is required, as well as financing for the costs of the proposed works (…)" (sic) (emphasis not in the original).
However, there is no evidence that those institutions, despite being aware of the problem, have coordinated or are coordinating a definitive solution. The Defensoría de los Habitantes, in official communication No. 03332-2026-DHR of March 18, 2026, noted: "(…) – Both the Municipalidad de Limón and SENARA state that this sector is not being assessed for intervention, and therefore there is currently no comprehensive future solution that could address the claim of resident [Nombre 001] (…)" (sic).
XIII.Regarding the alleged unfinished works. With respect to the alleged unfinished works by SENARA, the following was stated: "(…) In accordance with what is indicated in official letters SENARA-GG-OFI-010-2026 (Attention to Official Letter N.° 14884-2025-DHR) and SENARA-INDEP-PSCIAL-OFI-002-2026, forwarded to the Defensoría de los Habitantes, regarding the stretch downstream from the Barrio Quinto bridge to the confluence with the Cieneguita river and its mouth at the sea, the following is reported. With regard to the landslide affecting the banks of the Río Limoncito in the stretch between CRTM05 coordinates (E: 605260, N: 1104333) and (E: 605348, N: 1104383), located downstream from the Barrio Quinto bridge, on the right bank (margen derecha) of the Río Limoncito, it is noted that in November 2021 cleaning of the watercourse (cauce) was carried out. However, from its inception, the Limoncito Area Flood Control System Project (Proyecto Sistema de Control de Inundaciones del Área Limoncito, PSCIAL) did not contemplate the installation of sheet piles (tablestacas) or any other slope (talud) stabilization or containment system in that area.
The exclusion of this stretch was based on environmental, technical, and economic criteria, which are detailed below: Environmental considerations: The area presents environmental limitations that restrict the execution of infrastructure works. Based on information obtained from the National Territorial Information System (Sistema Nacional de Información Territorial, SNIT), consultations made with the Área de Conservación La Amistad Caribe (ACLAC), and applicable environmental regulations, the stretch located downstream from the Barrio Quinto bridge presents a combination of sensitive conditions, including wetland (humedal) areas and vegetation associated with riparian ecosystems, water body protection zones, low gradient toward the river mouth, proximity to areas subject to natural hydrological dynamics, and the presence of plant cover that performs functions of stability, buffering, and environmental protection.
In particular, the area downstream from the Barrio Quinto bridge to the confluence with the Cieneguita river and its mouth at the sea presents environmental and geomorphological conditions that require a prior comprehensive assessment. The presence of wetlands, riparian vegetation (vegetación riparia), legally protected zones, areas of low gradient, possible restrictions on the removal of plant cover, and the proximity of human settlements to the watercourse limit the possibility of carrying out widening works, sheet pile installation, or containment works without specific studies and without the corresponding environmental authorizations. Therefore, the environmental limitation is not confined solely to the presence of environmentally sensitive areas, but encompasses the totality of site conditions and the legal framework applicable to watercourses, wetlands, protection areas, riparian vegetation, and public-domain assets.
Any intervention in that stretch must take into account the Ley de Aguas, the Ley Forestal, the regulations on wetlands, and the jurisdiction of MINAE, SINAC, the Dirección de Agua, and other competent authorities. Technical considerations: From a construction standpoint, the execution of works in this area faces significant limitations due to the proximity of existing infrastructure on both banks (márgenes) of the river. Dwellings are observed located practically over the watercourse, as well as private docks and other structures that significantly reduce the space available for machinery operation, equipment installation, temporary material storage, the formation of safe access routes, and the implementation of stabilization or containment works. Added to the foregoing are the geotechnical characteristics specific to the area. According to the baseline of the Environmental Impact Study (EsIA), the project area is situated on recent alluvial and colluvial deposits, with the presence of intermediate-plasticity clays, silts with sand, medium to fine sands, and gravels.
These materials, associated with an area of low gradient, high humidity, influence of the water table, and proximity to the watercourse, may exhibit susceptibility to expansion and contraction processes, loss of strength due to saturation, surface erosion, local scouring (socavación local), and slope destabilization when the existing cover is disturbed or loads on the riverbank are increased. In that context, the entry of heavy machinery into a narrow space with saturable soils and banks already eroded or disturbed by human settlements could generate additional risks: increased vibrations, overloading on unstable edges, loss of lateral confinement, material detachment, increased erosion, damage to nearby dwellings, and greater sediment input to the watercourse. Therefore, far from constituting a straightforward intervention, the movement of machinery in this stretch could temporarily or permanently worsen the existing instability conditions.
This situation differs substantially from the conditions existing upstream from the Barrio Quinto bridge, where it was possible to carry out the interventions contemplated in PSCIAL, as there existed access conditions, maneuverability, hydraulic design, permits, budget, and constructive feasibility that had been previously defined within the approved scope. Economic considerations: Taking into account the environmental and technical limitations described above, as well as the budget approved for the integral execution of PSCIAL—both in its First Phase, financed by a transfer from the Ministerio de Hacienda, and in its Second Phase, financed through Loan Agreement N.° 2198 of the Banco Centroamericano de Integración Económica (BCIE)—the referenced stretch was not incorporated within the scope of the project. A potential intervention would have required property expropriations (expropiaciones), relocation of existing infrastructure, acquisition of additional materials, and the implementation of special construction measures, which would have generated a substantial increase in project costs.
For these reasons, that area was excluded from the planning and design stage of PSCIAL. For the foregoing reasons, this does not constitute an unfinished work within the scope of PSCIAL, but rather a stretch excluded from the technical, environmental, budgetary, and contractual formulation of the project. Any subsequent intervention in that area would require new technical, environmental, hydraulic, social, and economic studies, as well as the identification of a different or supplementary source of financing, the corresponding permits, and coordination with the Municipalidad de Limón, the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, SINAC, the Ministerio de Ambiente y Energía, AyA, and other competent entities. SENARA has also indicated that it is available to provide technical advice to the competent institutions when formally requested, particularly if a need is identified to assess provisional or future interventions outside the scope of PSCIAL.
Nevertheless, the institution does not have its own resources to execute works not contemplated in the approved project, nor can it unilaterally modify the scope defined in Loan Agreement N.° 2198 BCIE without the corresponding technical, institutional, and financial approvals (…)" (sic) (emphasis not in the original).
XIV.It is therefore possible to conclude that SENARA did not leave PSCIAL works unfinished; rather, those works were never included within the project. It is clarified to the petitioner (promovente) that neither the summary nature of the writ of amparo (recurso de amparo), nor the jurisdiction of this Tribunal, as delimited by statute and the Constitución Política, allows this Constitutional Chamber to determine whether the area should or should not have been included in the project in question. Any discussion in that regard must be raised before the Administration, or, as the case may be, before the ordinary courts of law (sede jurisdiccional de legalidad ordinaria).
XV.Furthermore, from an examination of the evidence submitted by the appellant (recurrente), it may be inferred that at the time the writ of amparo was filed, the petitioner was already aware of the foregoing, since he submitted an extract from official letter No. UTGVM-939-2025 of 7 October 2025, addressed to the Mayor of the Municipalidad de Limón, in which the Unidad Técnica de Gestión Vial de la Municipalidad de Limón stated: "(…) Regarding the works carried out by SENARA in connection with the Río Limoncito cleanup project and the construction of retaining walls, proceedings had already been initiated with SENARA as early as 21 August 2024, by means of official letter UTGVM-700-2024 (…) requesting specific information about the 'Proyecto Sistema Control de Inundaciones Área Limoncito', in response to the request of Ms. (…) and neighboring residents of the same area (…) Therefore, by official letter UTGV-005-2025 (…) dated 2 January 2025, in response to official letter AML-3867-2024, information was provided regarding the response received in SENARA-INDEP-PSCIAL-0060-2024 (…) in relation to the inquiry as to 'whether the dredging and bank-protection project extended up to where it then stood, or whether an extension was going to be carried out', to which they replied that: 'the Proyecto Sistema Control de Inundaciones Área Limoncito currently does not contemplate sheet pile protection for that stretch', because, from a technical standpoint, there is a constructive difficulty for the development of the project given that there is infrastructure located very close on both sides of the riverbank, which makes intervention in this stretch impossible, and that, from an economic standpoint, given the foregoing situation and as a result of the loan amount approved for the project, this stretch was not considered within the budget since costs would increase as a result of property expropriations, additional machinery and materials required if this area were to be included.
By official letter UTGVM-789-2024 (…) of 16 September 2024, a copy of the aforementioned SENARA letter was delivered to Ms. (…) and neighboring residents. It is important to note that contact is maintained with SENARA, and recently, by email, official letter SENARA-INDEP-PSCIAL-OFI-368-2025 (…) of 2 October 2025 was received, in which, as an institution, we are asked to collaborate in clarifying certain aspects related to the forthcoming commencement of road intervention and improvement works within the area of influence of the 'Proyecto Sistema Control de Inundaciones Área Limoncito' (…)" (sic). In view of the foregoing, the appellant is not correct in asserting that this point had not been resolved by the territorial corporation (corporación territorial).
XVI.Final clarification. It must not be overlooked that the Municipalidad de Limón, as administrator of local interests and services (article 169 of the Constitución Política), and as the body before which the complaint of 17 July 2025 was filed, cannot disregard the problems set out herein, and must act as coordinator of the concerted intervention of the Administration, since, as has been seen, the definitive solution requires the integration of efforts and the action of various agencies. This Constitutional Chamber, in ruling No. 2020-010630 of 09:15 hours of 12 June 2020, explained:
"(…) MUNICIPAL JURISDICTION AND OBLIGATION OF INTER-INSTITUTIONAL COORDINATION. Municipal jurisdiction and obligation of inter-institutional coordination. Article 169 of the Constitución Política provides that 'The administration of local interests and services in each canton shall be under the charge of the Municipal Government (...)'. This provision has been developed by the ordinary legislator; accordingly, article 3 of the Código Municipal, Ley N° 7794 of 30 April 1998, provides that: 'The government and administration of cantonal interests and services shall be under the charge of the municipal government'. In the same vein, the Constitutional Chamber has expressed itself in its case law. For example, in Ruling N° 5445-99, of 14:30 hours of 14 July 1999, the following was provided:
'VI.- ON THE POWERS OF MUNICIPALITIES WITH RESPECT TO SUBJECT MATTER (THE CONCEPT OF "THE LOCAL"). By express constitutional provision—article 169—there is an assignment of functions or powers in favor of local governments with respect to subject matter, namely "the local," that is, "the administration of the services and interests" of the locality within which it is circumscribed, for which purpose it is endowed with autonomy (…) So that its powers are generic, in that there is no detailed enumeration of its own duties, but only a simple statement of the scope of its jurisdiction; yet this does not make them indeterminate, as this Tribunal referred to in ruling number 6469-97, of sixteen hours and twenty minutes of eight October nineteen ninety-seven, in the following terms:
"(…) the local has such a connotation that defining its scope by the legislator or the judge must lead to the maintenance of the integrity of local interests and services, such that not even the legislator could enact legislation tending to dismember the Municipality (territorial element), if it does not do so observing the procedures previously established in the Constitución Política; nor could it enact legislation that places its inhabitants (population) in clear conditions of inferiority relative to the rest of the country; nor legislation that affects the very essence of the local (government), such that the Corporation becomes a mere empty container of which only the name subsists, with the entire regime deactivated just as it was conceived by the National Constituent Assembly. In other terms, there will be duties that by their nature are municipal—local—and cannot be removed from that sphere of jurisdiction to be converted into national or state services or interests, because doing so would disarticulate the Municipality, or rather, empty it of constitutional content, and therefore it is not possible to establish in advance the insurmountable limits of the local; rather, to discern what does or does not belong to communal government, it must be extracted from the examination conducted in each specific case (…)".
From the foregoing, it stands out that, by the express will of our Fundamental Charter, a specific jurisdiction is assigned to local governments, an attribution that is moreover exclusive to them; that is, it is an original jurisdiction of the municipality, and only by means of a nationalization or regionalization law can it be displaced, in whole or in part.' Consequently, if a group of municipal residents (munícipes), within their territorial circumscription, suffer flooding that puts their lives at risk and causes serious patrimonial, psychological, quality-of-life, and general well-being harm, this falls within the concept of 'local interests and services' under article 169 of the Constitución Política—problems whose causes must be identified with precision and, even more so, whose solutions must be identified—in order to implement them as soon as possible; for which purpose it falls to the Municipality to coordinate with national-level institutions with jurisdiction to act on the problem. Indeed, the Chamber has already developed the municipal obligation to coordinate with other state institutions in order to attend to 'interests' and duly provide 'local services'. In the aforementioned Ruling N° 5445-99, the Chamber stated:
'(…) they refer to the obligation of coordination that must exist among local governments, decentralized institutions, and the Executive Branch, in order to carry out the functions entrusted to them, which must be analyzed from the very nature of municipal autonomy. It is by virtue of article 170 of the Constitución Política that municipalities (local corporate entities) enjoy functional, administrative, and financial autonomy in the administration of local interests and services (article 169 of the Constitución Política) (…) Therefore, no conflict may be created by antagonism or rivalry between the subject matter comprising the general aim of "local interests and services" and "national" or "state" public interests and services, which are intrinsically distinct from one another, but which are in fact called to coexist (…) Once the material jurisdiction of the municipality within a given territorial circumscription has been defined, it is clear that there will be duties that by their nature are exclusively municipal, alongside others that may be deemed national or state in nature; it is therefore essential to define the form of co-participation in powers that is unavoidable, since the public capacity of municipalities is local, and that of the State and other entities is national; whence it follows that municipal territory is simultaneously state and institutional, to the extent required by circumstances.
That is to say, municipalities may share their jurisdictions with the Public Administration in general, a relationship that must develop in the terms as defined by law (article 5 of the former Código Municipal, article 7 of the new Código), which establishes the obligation of "coordination" between municipalities and the public institutions that concur in the exercise of their powers, in order to avoid duplication of efforts and contradictions, above all because only voluntary coordination is compatible with municipal autonomy as its expression. In other terms, the municipality is called to enter into cooperative relations with other public entities, and vice versa, given the concurrent or coinciding nature—in many cases—of interests around a specific matter. In the doctrine, coordination is defined from the existence of several independent centers of action, each with its own duties and decision-making powers, and occasionally divergent; despite this, a community of purposes by subject matter must exist, but by concurrence, insofar as the object receiving the final results of the activity and the acts of each is common.
So that coordination is the ordering of relations among these various independent activities, which takes charge of that concurrence in the same object or entity so as to make it useful for an overall public plan, without suppressing the mutual independence of the acting subjects. Since there is no hierarchical relationship among decentralized institutions, nor of the State itself in relation to municipalities, the imposition on the latter of specific conduct is not possible, which gives rise to the indispensable inter-institutional "concert," in the strict sense, whereby the autonomous and independent centers of action reach agreement on that preventive and global scheme, in which each one plays a role with a view to a mission entrusted to the others.' It should also be noted, moreover, that Municipalities are obligated, by the imperative of article 50 of the Constitución Política, to devote themselves to the protection of the environment (Ruling N° 2006-7994 of 8:57 hours of 2 June 2006) (…)" (sic) (reiterated in ruling No. 2026-05217 of 09:34 hours of 13 February 2026) (emphasis not in the original).
XVII.Conclusion. Under these circumstances, it is necessary to partially grant the appeal, with the consequences specified in the operative part (parte dispositiva) of this ruling, on account of: a) the failure of the Municipalidad de Limón to attend to and definitively resolve, as required by law, the complaint filed by the appellant on 17 July 2025 (roads in poor condition, and the entry of sewage into the community, all of this in Barrio Quinto, specifically in "(…) the community located behind the Feria del Agricultor, crossing the bridge on the left-hand side and up to the boundary with barrio los cocos (…)" (sic)); and b) the failure of the Municipalidad de Limón and SENARA to attend to and definitively resolve, as required by law, the problem of erosion of the banks of the Río Limoncito, which endangers several homes and the lives of the inhabitants of the community of Barrio Quinto (from after the local bridge to the bridge at los Cocos, as specified by the appellant in the filing brief), as brought to their attention by the Defensoría de los Habitantes when processing a claim filed by the petitioner.
XVIII.Note by magistrate Castillo Víquez, regarding prompt and effective administrative justice. I have supported the position of this Tribunal that, when a party alleges a violation of the right to prompt and effective justice in administrative proceedings, those who must hear the legal dispute are the Tribunales de lo Contencioso-Administrativo and not this Chamber. However, with the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, it has been established that this right is susceptible to judicial protection by means of the writ of amparo established by article 32 of the Ley de la Jurisdicción Constitucional, in conjunction with article 27 of the Constitución Política de la República de Costa Rica, in those cases in which the petitioner considers that the material actions of the Administration, its administrative acts, or its response are affecting his or her fundamental rights.
In my view, the recently enacted legislation does not imply that this Tribunal must modify its case-law line, which, pursuant to article 7 of its enabling statute, is exclusively responsible for defining its own jurisdiction. Therefore, except for those legal-constitutional disputes that have been recognized by this same Chamber as exceptional circumstances that may properly be heard within this jurisdiction through the constitutional amparo process, in all other cases, and for the reasons given by this Tribunal (ruling N° 2008-02545 of 8:55 hours of 22 February 2008), those with jurisdiction are the judges of the administrative-contentious courts, all of which is consistent with article 25 of the Convención Americana sobre Derechos Humanos, the Law of the Constitution (values, principles, and norms), and the corresponding statutory provisions, based on a logical, systemic, and teleological interpretation of the legal order.
XIX.Note by magistrate Salazar Alvarado. As a matter of principle, I consider that cases related to the inactivity of the Public Administration in the repair, construction, modification, or demolition of any infrastructure work should be dismissed, since such omission constitutes a matter of legality, the discussion of which belongs to the ordinary courts, before which the interested party may argue their disagreements with greater breadth. However, when such administrative omissive conduct gives rise to a violation of other fundamental rights protected under this constitutional jurisdiction, or when it affects groups considered vulnerable, I do proceed to examine the merits of the matter, as this situation constitutes an exception to my position in this area, as is the case here, in which there is a claim regarding the failure to respond to a complaint about the omission of the Municipalidad de Limón and the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA) to continue executing the flood control project from the Barrio Quinto bridge onward—a situation that generates problems of sewage contamination, erosion of the banks of the Río Limoncito with risk to several homes and the lives of the inhabitants, as well as road damage and difficulty in transit for persons with reduced mobility and minors.
XX.Partial dissenting vote (Voto salvado parcial) of magistrate Garro Vargas regarding the operative part of this ruling. While I agree with the majority of the Chamber that the appeal should be granted, I disagree as to where the enforcement phase of the matter should be lodged, due to the absence of adequate mechanisms provided by the regulations governing this constitutional jurisdiction to monitor a ruling that involves technical aspects of some complexity, as is the case here, where the Municipalidad de Limón must resolve, within periods of six and twelve months respectively from the notification of this ruling, the roads in poor condition and the entry of sewage by overflow in the community of Barrio Quinto, and where that municipality and SENARA are ordered to resolve the problem of erosion of the banks of the Río Limoncito within eighteen months. By contrast, the provisions of the Código Procesal Contencioso-Administrativo on enforcement (article 155 and following) offer evident advantages, such as the possibility of requesting schedules, imposing fines, establishing responsibilities, overseeing compliance stages, etc. Therefore, in accordance with the provisions of article 56 of the Ley de Jurisdicción Constitucional, I consider that the enforcement phase with respect to that order should take place before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under the judgment-enforcement rules of that Code.
XXI.Documentation submitted to the case file. The parties are hereby reminded that, if they have submitted any document in paper form, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be retrieved from the office within a maximum period of 30 business days from the notification of this ruling. Otherwise, all material not retrieved within this period will be destroyed, pursuant to the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by Corte Plena in session No. 27-11 of 22 August 2011, article XXVI, and published in Boletín Judicial number 19 of 26 January 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial in session No. 43-12 held on 3 May 2012, article LXXXI.
Por tanto:
The writ of amparo (recurso de amparo) is granted in part, on the following grounds: a) the failure by the Municipality of Limón to attend to and definitively resolve, in accordance with applicable law, the complaint filed by the petitioner (recurrente) on July 17, 2025 (concerning roads in poor condition (carreteras en mal estado) and the entry of sewage (aguas negras) into the community, all within Barrio Quinto, specifically in "(…) la comunidad ubicada detrás de la Feria del Agricultor, cruzando el puente a mano izquierda y hasta colindar con el barrio los cocos (…)" (sic)); and b) the failure by the Municipality of Limón and SENARA to attend to and definitively resolve, in accordance with applicable law, the problem of bank erosion along the Río Limoncito, which endangers several homes and the lives of the residents of the community of Barrio Quinto (from the local bridge to the Puente de los Cocos, as specified by the petitioner in the filing brief (escrito de interposición)), as brought to the attention of the respondent authorities by the Office of the Ombudsman (Defensoría de los Habitantes) while processing a petition filed by the petitioner (promovente).
Ana Matarrita McCalla and Yerlin Aguilar Brenes are ordered, in their respective capacities as Mayor (Alcaldesa) and Coordinator of the Road Management Technical Unit (Unidad Técnica de Gestión Vial), both of the Municipality of Limón, or whoever holds those positions in their place, to issue the pertinent orders and carry out all actions within the scope of their competencies so that, within a period of SIX MONTHS counted from the date of notification of this judgment, the complaint filed by the petitioner on June 17, 2025, regarding roads in poor condition in the community of Barrio Quinto, specifically in "(…) la comunidad ubicada detrás de la Feria del Agricultor, cruzando el puente a mano izquierda y hasta colindar con el barrio los cocos (…)" (sic), (roads Nos. 7-01-810, and 7-01-811), is definitively resolved in accordance with applicable law.
Ana Matarrita McCalla, in her capacity as Mayor of the Municipality of Limón, or whoever holds that position in her place, is ordered to issue the pertinent orders and carry out all actions within the scope of her competencies so that, within a period of TWELVE MONTHS counted from the date of notification of this judgment, the complaint filed by the petitioner on June 17, 2025, regarding the overflow entry of sewage into the community of Barrio Quinto, specifically in "(…) la comunidad ubicada detrás de la Feria del Agricultor, cruzando el puente a mano izquierda y hasta colindar con el barrio los cocos (…)" (sic), is definitively resolved in accordance with applicable law.
Ana Matarrita McCalla, in her capacity as Mayor of the Municipality of Limón, as well as Juan Gabriel Ramírez Guillén and Osvaldo Quirós Arias, in their respective capacities as Minister of Agriculture and Livestock (Ministro de Agricultura y Ganadería) and Chairman of the Board of Directors (Presidente de la Junta Directiva), and as General Manager (Gerente General), both of the National Groundwater, Irrigation, and Drainage Service (Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento) (SENARA), or whoever holds those positions in their place, are ordered to carry out all actions within the scope of their respective competencies and to coordinate as necessary so that, within a period of EIGHTEEN MONTHS counted from the date of notification of this judgment, the problem of bank erosion along the Río Limoncito, which endangers several homes and the lives of the residents of Barrio Quinto (from the local bridge to the Puente de los Cocos, as specified by the petitioner in the filing brief), is definitively resolved in accordance with applicable law.
The respondent authorities (autoridades recurridas) are warned that, pursuant to Article 71 of the Law on Constitutional Jurisdiction (Ley de la Jurisdicción Constitucional), imprisonment of three months to two years, or a fine of twenty to sixty day-fines (días multa), shall be imposed on any person who receives an order that they are required to comply with or enforce, issued in the context of a writ of amparo, and who fails to comply with or enforce it, provided the offense is not more severely penishable under another provision. The Municipality of Limón and the National Groundwater, Irrigation, and Drainage Service (SENARA) are adjudged to pay the costs, damages, and losses (costas, daños y perjuicios) caused by the facts underlying this declaration (declaratoria), which shall be assessed in enforcement of judgment (ejecución de sentencia) proceedings before the administrative litigation (contencioso administrativo) court.
Justice Castillo Víquez files a separate note. Justice Salazar Alvarado files a separate note. Justice Garro Vargas files a partial dissent (salva el voto) with respect to the enforcement of this judgment as regards point iii), and, pursuant to Article 56 of the Law on Constitutional Jurisdiction, holds that enforcement must be carried out before the Enforcement Division of the Administrative Litigation and Civil Treasury Court (Tribunal Contencioso Administrativo y Civil de Hacienda), under the enforcement rules set forth in Articles 155 and following of the Code of Administrative Litigation Procedure (Código Procesal Contencioso Administrativo). She further orders that a copy of the judgment be sent to that court so that the enforcement proceedings for this ruling may be initiated. In all other respects, the writ is denied. Notify.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del diecisiete de julio de dos mil veintiseis .
Recurso de amparo interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra la MUNICIPALIDAD DE LIMÓN y el SERVICIO NACIONAL DE AGUAS SUBTERRÁNEAS, RIEGO Y AVENAMIENTO (SENARA).
Resultando:
Redacta el Magistrado Araya García; y,
Considerando:
I.Objeto del recurso. El promovente alegó que la Municipalidad de Limón y el Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA), están ejecutando un proyecto de control de inundaciones, para beneficiar a las comunidades de Envaco, Limoncito y Barrio Quinto. Dichas obras llegaron hasta el puente de Barrio Quinto, y no continuaron. El recurrente aseguró que: a) en el puente de Barrio Quinto, se convirtió el área en un vertedero de aguas fecales, sin colocar tablas ni muros de contención, por lo que las inundaciones arrastran aguas contaminadas hacia las viviendas; b) la erosión de las orillas del Río Limoncito (en el sector ubicado luego del puente de la localidad hasta el puente de los cocos), pone en peligro varias casas y la vida de sus habitantes; c) las inundaciones han dañado la carretera y dificultan el tránsito de personas con movilidad reducida y menores de edad. Afirmó que la Municipalidad de Limón no ha efectuado visitas ni acciones correctivas para atender la problemática, alegando junto al SENARA, que no es posible ingresar maquinaria. Enfatizó que todo lo descrito fue puesto en conocimiento de la Municipalidad de Limón desde el 17 de julio de 2025, e incluso los vecinos acudieron a la Defensoría de los Habitantes, dependencia que solicitó información al SENARA, sobre la situación expuesta.
II.Cuestión preliminar. Previo a analizar el fondo del asunto —por la presunta violación del derecho a un procedimiento pronto y cumplido— debe explicarse que a partir del voto No. 2008-02545 de las 8:55 horas de 22 de febrero de 2008, esta Sala ha estimado que deben remitirse a la jurisdicción contencioso administrativa —con algunas excepciones— aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –incoado de oficio o a instancia de parte— o conocer de los recursos administrativos procedentes. En el sub lite se plantea un supuesto de excepción: la aparente demora de la Administración en resolver denuncias por situaciones que afectan la vida, salud y el ambiente. Aclarado el punto, se entra a resolver la situación planteada en este proceso.
III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
El SENARA: “(…) es la Unidad Ejecutora del Proyecto Sistema de Control de Inundaciones del Área de Limoncito (PSCIAL), en sus I y II Etapas, así como de las obras asociadas al componente Quebrada Chocolate, ejecutadas en el cantón central de Limón. El PSCIAL tiene como objetivo disminuir el riesgo de inundación en la cuenca baja del río Limoncito, mediante la ampliación de la capacidad hidráulica de la red de drenaje principal, natural y artificial, con el fin de mejorar las condiciones de vida de la población ubicada en sectores históricamente afectados por inundaciones, entre ellos Envaco, Barrio Quinto, Colina, El Ceibón, El Carmen, Juan Gobán, Limoncito, Los Cocos, Cieneguita y Westfalia. De acuerdo con la información técnica del proyecto el área de influencia del PSCIAL corresponde a la cuenca del río Limoncito, con una extensión aproximada de 81,5 km²; el área urbana involucrada comprende alrededor de 733 hectáreas, equivalente a un 7% del total de la cuenca; y la población beneficiada indirectamente asciende aproximadamente a 23.729 personas.
Se trata, por tanto, de una intervención pública de alto impacto social, ambiental e hidráulico, orientada a reducir la vulnerabilidad de comunidades asentadas en una zona urbana históricamente expuesta a inundaciones recurrentes (…)” (sic) (ver el informe rendido bajo juramento por las autoridades del SENARA, agregado al expediente digital).
El 17 de julio de 2025, vecinos de la comunidad de Barrio Quinto, mediante un oficio, reclamaron ante la Municipalidad de Limón lo siguiente: “(…) 1- Carreteras en mal estado desde la administración pasada de Mattis, han dejado a la comunidad ubicada detrás de la Feria del Agricultor, cruzando el puente a mano izquierda y hasta colindar con el barrio los cocos. 2- La Empresa SENARA, realizo en Proyecto de limpieza de Río Limoncito y esta zona indicada no realizo limpieza y no coloco muros de contención o table estacas lo que provoca que, en las llenas o desbordamiento de las aguas, de agua negras y de agua fecal en la comunidad. 3- Esta pequeña comunidad abandonada está dividida detrás de la Feria del Agricultor conocido como Barrio Quinto y una vez que cruza el Puente del Rio Limoncito, pertenece al Barrio Quinto y colinda con el Puente y Clínica del Barrio los Cocos (…)” (sic) (ver el escrito de interposición agregado al expediente digital; hecho no controvertido).
Mediante el oficio No. AML-3438-2025 de 1° de octubre de 2025, la Alcaldesa de la Municipalidad de Limón remitió al tutelado y a los vecinos de Barrio Quinto, el oficio No. UTGVM-903-2025 de la Unidad Técnica de Gestión Vial, en el que se indicó: “(…) En atención al oficio en referencia, respecto a la solicitud de [Nombre 001] y vecinos para reparación de los caminos 7-01-810, y 7-01-811, ubicados en el sector de B° Quinto - Limoncito, le informo que; esta unidad trabaja con la programación del Plan Quinquenal de Conservación y Desarrollo Vial del Cantón de Limón, y la intervención de los caminos se hace de acuerdo con el puntaje que tiene cada uno, conforme a los parámetros de clasificación con el cual fue confeccionado. Los referidos caminos no están programados para ser intervenidos pronto, ya que la Red Vial Cantonal de Limón está compuesta por 1074 caminos, y como no es posible atenderlos todos en un mismo año; se recurre al referido Plan Vial Quinquenal como herramienta de orientación para la intervención con los recursos de la Ley 8114 y Ley 9329 (…) El camino 7-01-810 está incluido en la Política N°2, en la posición N°150 y el camino 7- 01-811 está incluido en la Politica N°3, en la posición N°364, tal y como se muestra en la siguiente tabla (…) Con el entendido que serán intervenidos en el orden que le corresponde de acuerdo con la programación anual de intervención, sin poder dar una fecha exacta porque va a depender del avance en la intervención de los caminos anteriores de la Politica N°1, la Polltica N°2, y la Política N°3, hasta llegar a la posición N°150 y posición N°364 respectivamente, durante los cinco años que comprende el Plan Vial Quinquenal (…)” (sic) (ver la prueba aportada por el recurrente, agregada al expediente digital).
El 26 de setiembre de 2025, el recurrente presentó ante la Defensoría de los Habitantes, una solicitud de intervención ante la Municipalidad de Limón, en los siguientes términos: “(…) El día 30 de julio de 2025, un grupo de vecinos presentó por escrito ante la Municipalidad de Limón un reclamo formal, en el que expusieron que, en Barrio Quinto, específicamente detrás del predio donde se realiza la Feria del Agricultor, la carretera se encuentra en mal estado, situación que se extiende hasta la colindancia con Barrio Los Cocos. Adicionalmente, señalaron que en el marco de un proyecto interinstitucional en el que participaron el SENARA y la Municipalidad de Limón, se efectuaron trabajos de limpieza en el Río Limoncito y de construcción de muros de contención. Sin embargo, dichas obras quedaron inconclusas, lo que ha generado mayor preocupación en la comunidad. En razón de lo anterior, solicitaron la debida intervención municipal a fin de que se brinde una solución integral.
No obstante, a la fecha de la presente gestión, no han recibido respuesta formal por parte del Gobierno Local. Por tanto, solicita a la Defensoría de los Habitantes que se investiguen las razones por las cuales la Municipalidad de Limón no ha atendido los hechos denunciados y, en caso de que las obras están programadas para este o el próximo año, se informe de manera expresa, a fin de que la comunidad pueda dar seguimiento oportuno a las eventuales soluciones planteadas por la autoridad municipal (…)” (sic) (ver la prueba aportada por el recurrente, agregada al expediente digital).
Mediante el oficio No. 11381-2025-DHR de 2 de octubre de 2025, la Defensoría de los Habitantes solicitó un informe a la Alcaldesa y a la Coordinadora de la Unidad Técnica de Gestión Vial, ambas de la Municipalidad de Limón (ver la prueba aportada por el recurrente, agregada al expediente digital).
Mediante el oficio No. UTGVM-939-2025 de 7 de octubre de 2025, dirigido a la Alcaldesa de la Municipalidad de Limón, la Unidad Técnica de Gestión Vial de la Municipalidad de Limón señaló: “(…) En atención a los oficios en referencia, respecto a la denuncia interpuesta por el Sr. [Nombre 001], y vecinos del sector de B° Quinto – Limoncito, según lo indicado en el oficio No. 11381-2025-DHR de la Defensoría de los Habitantes (…) rindo informe en respuesta a los siguientes puntos (…) Con relación a la intervención e las calles, como se indicó en el punto anterior: serán intervenidas en el orden que le corresponde de acuerdo con la programación anual de intervención, sin poder dar una fecha exacta porque va a depender del avance en la intervención de los caminos anteriores de la Política N°1, la Política No. 2, y la Política N°3, hasta llegar a la posición N°150 y posición N°364 respectivamente, durante los cinco años que comprende el Plan Vial Quinquenal.
Respecto a los trabajos realizados por la empresa SENARA, en cuanto al proyecto de limpieza del Río Limoncito, y la construcción de muros de contención, ya se había gestionado ante SENARA desde el 21 de agosto de 2024, con oficio UTGVM-700-2024 (…) solicitando información específicamente del “Proyecto Sistema Control de Inundaciones Área Limoncito”, en respuesta a la solicitud de la Sra. (…) y vecinos del mismo sector (…) Por lo tanto; con oficio UTGV-005-2025 (…) de fecha 2 de enero de 2025, en respuesta al oficio AML-3867-2024, se informa respecto de la respuesta recibida SENARA-INDEP-PSCIAL-0060-2024 (…) con relación a la consulta; “si el proyecto de dragado y protección del margen del río llegaba hasta donde estaba en ese momento, o si iban a realizar una ampliación de éste”, a lo que contestaron qué: “actualmente el Proyecto Sistema Control de Inundaciones Área Limoncito, no contempla la protección con tablestaca del tramo”, debido a que; a nivel técnico se presenta una dificultad constructiva para el desarrollo del proyecto dado que existen infraestructuras muy cercanas en ambos lados al margen del río, lo que imposibilita la intervención en este tramo, y que, a nivel económico, dada la situación anterior y por efecto del monto aprobado en el préstamo para el proyecto, este tramo no fue considerado dentro del presupuesto ya que se incrementaría el costo por efecto de las expropiaciones de propiedades, maquinaria y materiales adicionales necesarios en caso de que este sector fuera incluido.
Con oficio UTGVM-789-2024 (…) del 16 de setiembre de 2024, se le entregó copia a la Sra. (…) y vecinos, del referido oficio de SENARA. Es importante indicar que se mantiene contacto con la empresa SENARA, y recientemente se recibió mediante un correo, el oficio SENARA-INDEP-PSCIAL-OFI-368-2025 (…) del 2 de octubre de 2025, en donde se nos solicitan como institución, la colaboración para aclarar algunos aspectos relacionados en el inicio próximo de labores de Intervención y mejoramiento de caminos dentro del área de influencias del “Proyecto Sistema Control de Inundaciones Área Limoncito” (…)” (sic) (ver la prueba aportada por el recurrente, agregada al expediente digital).
Por medio del oficio No. 14884-2025-DHR de 17 de diciembre de 2025, la Defensoría de los Habitantes planteó una serie de consultas al SENARA, dependencia que brindó la siguiente información en los oficios Nos. SENARA-GG-OFI-010-2026 de 9 de enero de 2026 y SENARA-INDEP-PSCIAL-OFI-002-2026: “(…) – el PSCIAL surgió como uno de los proyectos sobrevivientes del “Proyecto Limón Ciudad Puerto” (PLCP). – El cual se dividió en dos etapas, beneficiando indirectamente a miles de personas, sin embargo, el PLCP tuvo problemas en su estructura y diseño, que entorpecieron su ejecución. – dos de los Componentes trascendentales del proyecto, como lo son el de Alcantarillado Sanitario cuya Unidad Ejecutora es el AyA y el Control de Inundaciones cuya Unidad Ejecutora es el Senara, mostraron un avance significativo. Motivo por el cual el proyecto Sistema de Control de Inundaciones del Área de Limoncito (PSCIAL), lo ejecuta solo el SENARA y se dividió en dos etapas: una etapa financiada por transferencia realizada por el Ministerio de Hacienda y la otra por medio del préstamo del BCIE, para influenciar la cuenta del río Limoncito. – Se terminaron los problemas de inundaciones: asentamientos humanos no controlados en las márgenes del río, estrechamiento de causes por construcciones ilegales y mal manejo de residuo sólido. – Como objetivo principal ese proyecto tenía el de disminuir el riesgo de inundación en la cuenta baja del Río Limoncito para mejorar las condiciones de vida de los pobladores, mediante la ampliación de la capacidad hidráulica de la red de drenaje principal natural y artificial. – Para cumplir dicho objetivo cada una de las etapas del proyecto se establecieron ciertas obras. – Las obras de la primera etapa fueron concluidas a finales del 2023 (colocación de 1.5 km de tablesca, construcción de 17 puentes peatonales y limpieza de diversos canales). – Como parte de la segunda etapa se finalizó con la colocación de tablesca y recava en el río Limoncito, con otras pendientes de acuerdo cronograma del BCIE. Adicionalmente SENARA explica porqué no se intervino el sector aguas abajo del puente de Barrio Quinto, señalando lo siguiente: - Que el Proyecto Sistema Control de Inundaciones Área Limoncito (PSCIAL) no contempló desde su génesis la colocación de tablestaca, así como ningún otro sistema de sostén para el talud en ese sector, a pesar de que en aguas abajo del puente de Barrio Quinto, margen derecha del río Limoncito se realizaron trabajos de limpieza del cauce en noviembre 2021. – A nivel ambiental existe una limitante ya que la zona tiene humedales protegidos onde la ley limita la intervención. – La proximidad de las casas y atracaderos privados al cauce impide el uso de maquinaria pesada, lo que constituye una limitación técnica. Existe además una limitación económica ya que para intervenir es necesario realizar expropiaciones que generarían un costo elevado que no esta contemplado en el presupuesto original del proyecto. Limitaciones que ocasionaron que ese sector fuera excluido desde el inicio del proyecto. El oficio señala las competencias y responsabilidades de SENARA y concluye indicando que no existen obras inconclusas bajo su responsabilidad dentro del alcance actual del PSICAL. Aunado a lo anterior, en atención a las consultas puntuales realizadas por la Defensoría de los Habitantes a SENARA, señala textualmente: “… Finalmente, con respecto a las consultas realizadas por parte de la Defensoría de los Habitantes se debe indicar: 1. Informar las razones por las cuales se justifica la exclusión del tramo Barrio Quinto del proyecto que impide su ejecución. R/. Según lo indicado en el texto anterior, es por tres motivos: 1. Situación ambiental: la zona mencionada, presenta una condición ambiental que limita la intervención con obras, ya que del puente de Barrio Quinto hacia aguas debajo de dicho puente, el lugar muestra la existencia de varias zonas catalogadas por Yolillal, una aguas bajo del puente en la margen izquierda (mancha color celeste claro), la segunda siguiendo más abajo, presenta otra zona de Yolillal en iguales condiciones en la margen derecho y la tercera más abajo al llegar a la confluencia entre el río Limoncito y el río Cieneguita, esto aunado a la poca o nula pendiente del lugar hasta llegar a la desembocadura con el mar. El Yolillal es un tipo de humedal o pantano en el que las palmas (yolillos) son la vegetación dominante. Son hábitats importantes para la biodiversidad en Costa Rica y son protegidos por Ley y resguardado por el Sistema Nacional de Áreas de Conservación, por esta razón, están mapeados en el SNIT. 2. Situación técnica: se presenta una dificultad constructiva para el desarrollo de obras en el lugar dado que existan infraestructuras muy cercanas en ambos lados de las márgenes del río como casas que prácticamente están sobre el río, además de atracaderos privados, lo que imposibilita la intervención en este tramo. Aguas arriba del puente la situación es totalmente diferente, según se puede constatar en campo. 3. Situación económica: dada la situación anterior y por efecto del monto aprobado para la totalidad del proyecto del PSCIAL, tanto para la I Etapa (Transferencia del Ministerio de Hacienda) como la II Etapa (Contrato Préstamo N.°2198 BCIE que financia el programa de Alcantarillado y el de Control de inundaciones para Limón), este tramo no fue considerado dentro del presupuesto ya que el incremento del costo por efecto de las expropiaciones de propiedades que tendría que realizarse en el lugar (casas, atracaderos), al no haber espacio de maniobra para la maquinaria, así como de los materiales adicionales necesarios para tablaestaca, hizo que este sector fuera excluido desde el inicio del proyecto. 2. Informar si se cuenta con un plan de acción alternativo para atender las obras inconclusas. R/. El proyecto del PSCIAL cuenta con planes de intervención y financiamiento para lo que el proyecto requiera, siempre y cuando se encuentre dentro de los alcances de dicho proyecto, alcances que fueron definidos por la firma del Contrato Préstamo N.° 2198 con el BCIE. Esto quiere decir, que, para realizar cualquier modificación a lo ya firmado, se debe solicitar la “No objeción” del banco. Dicho préstamo está fiscalizado por Crédito Público de Hacienda, mediante visitas y entrega de informes. Las obras, por tanto, no pueden quedar inconclusas y si por alguna razón alguna de las obras no se pudo ejecutar, se debe entregar una justificación detallar y técnica sobre las razones que mediaron en la decisión y esto debe ser aprobado por la Gerencia, la Junta Directiva del Senara y el banco BCIE. Hay que dejar claro que, la intervención en la zona en cuestión, aguas abajo del puente en Barrio Quinto, no es una obra que formara parte inicial del proyecto, por las razones ya explicadas, por lo que la no intervención, es lo que corresponde según el alcance del proyecto vigente y no implica que Senara esté dejando obras inconclusas en ese sector. En caso afirmativo remitir ruta crítica, responsables y plazos para dicha intervención (…) Debido a los trabajos que se han estado ejecutando por parte del Senara durante varios años en el cantón Central de Limón, se ha podido identificar otros puntos críticos por afectación de inundaciones fuera del área de influencia del PSCIAL (I y II Etapa), lo que ha llevado a la institución Senara a plantear reuniones con altos cargos de la Municipalidad de Limón para que desde el gobierno local, se solicite al Senara proyectos en la misma línea del PSCIAL y que juntos se busquen posibles alternativas de financiamiento, las cuales podrían ser la CNE, el Canon que administra Japdeva, recursos del IFAM, entre otros, ya que se deben financiar estudios técnicos, se requiere personal especializado el cual es limitado en el Senara, así como el financiamiento de los costos de las obras que se propongan (…) Igualmente, se ha tratado de explicar a las personas que así lo han solicitado, el alcance de las obras de la I y II Etapa del PSCIAL y que no es posible atender todos los problemas de inundaciones del cantón Central de Limón en un solo proyecto. También se ha planteado que las personas afectadas podrían solicitar la intervención en sus comunidades tanto al gobierno local (Municipalidad de Limón), a la CNE (mediante el Comité Municipal de Emergencias), en el tanto que su situación sea de emergencia, ya que estos entes institucionales podrían en conjunto con una solicitud formal al Senara, quien estaría aportando la parte técnica, buscar posibles soluciones a cada problemática. En el caso específico de la zona detrás de la feria, tal vez sería posible gestionar una intervención provisional, con fondos de primer impacto, por parte de la Municipalidad de Limón y la CNE, según lo que estimen conveniente los profesionales en dichas instituciones, que podrían disponer de otro tipo de recursos, no así el Senara, que no cuenta con recursos propios para realizar intervenciones de este tipo (…)” (sic)
Por medio del oficio No. 03332-2026-DHR de 18 de marzo de 2026, la Defensoría de los Habitantes emitió un informe final sin recomendaciones, concluyendo lo siguiente: “(…) Concluida la investigación se han constatado los siguientes hechos: - Que los caminos con código 7-01-810 y 7-01-811 están debidamente registraos en la Unidad Técnica de Gestión Vial Municipalidad, sin embargo, estos caminos no serán intervenidos en el corto plazo ya que la Red Vial Cantonal consta de 1074 caminos, los cuales se priorizan para intervención según puntaje de clasificación. – Estos caminos se encuentran clasificados en los puntajes 150 y 364 respectivamente dentro del Plan Vial Quinquenal. – A la fecha, la Municipalidad de Limón señala que no puede brindar fecha exacta para su intervención ya que depende del avance de las posiciones anteriores durante el plazo que abarca el plan vial quinquenal. – La Municipalidad de Limón como SENARA señalan que no existen obras inconclusas en el sector de Bario Quinto ya que este sector nunca formó parte del proyecto. – Tanto la Municipalidad de Limón como SENARA establecen que este sector no esta siendo valorado para intervención por lo que no existe a la fecha una solución integral futura que pueda atender la pretensión del habitante ([Nombre 001]).
Por otra parte, no se constataron los siguientes hechos: - Que exista programación futura para realizar trabajos de limpieza y/o construcción de muros de contención en el Río Limoncito. Con fundamento en lo expuesto la Defensoría de los Habitantes realiza las siguientes consideraciones (…) Sobre el caso concreto: Mediante el análisis de la documentación aportada por la Municipalidad de Limón y SENARA, se logró determinar las razones por las cuales no se ha intervenido el sector tanto en materia vial como en materia fluvial, estableciendo que la falta de atención al camino responde a que la Red Vial Cantonal se rige por un sistema de puntaje y priorización técnica, que no es favorable para la atención del camino solicitado. Aunado a lo anterior, se determina que la intervención de materia fluvial fue excluida desde un inicio del proyecto por razones económicas, técnicas y ambientales, por lo que al no haber formado parte desde un inicio del proyecto, no puede ser atendido.
Por lo tanto, no se logra desprender la existencia de obras inconclusas por parte de la administración, ni programación establecida de acciones a ejecutar por parte de la Municipalidad de Limón. Así las cosas, dado que la pretensión del habitante [Nombre 001] ante la Defensoría se circunscribió a Investigar las razones por las cuales que la Municipalidad de Limón no atendió los hechos denunciados y conocer si hay obras programadas al efecto, por medio de las gestiones realizadas por esta Defensoría se han conocido las razones por las cuales la administración no ha atendido su solicitud; y si bien las respuestas brindadas no son favorables para sus intereses, estas informan la situación jurídica, técnica y presupuestaria. A la persona interesada se le sugiere: valorar la presentación de gestiones formales ante el gobierno local y/o Comité Municipal de Emergencias, a efecto de que, mediante una coordinación interinstitucional con entidades como CNE o SENARA, se analice la viabilidad de intervenciones en el sector, particularmente si existieran eventuales escenarios de riesgo.
Así mismo, con respecto a la reparación del camino, se sugiere dar seguimiento periódico al Plan Vial Quinquenal, solicitando a la Municipalidad información actualizada sobre la posición y avance de los caminos de interés (…)” (sic) (ver la prueba aportada por las autoridades de la Municipalidad de Limón, agregada al expediente digital).
En lo que concierne al estado de las carreteras e infraestructura de tránsito en el sector denunciado por el recurrente y los vecinos de Barrio Quinto de Limón, el SENARA detalló: “(…) el PSCIAL ha incorporado dentro de su alcance obras que inciden positivamente en la conectividad y seguridad del área de influencia; sin embargo, la reparación, mantenimiento ordinario y administración de vías públicas corresponde a la institucionalidad competente en materia vial y municipal. Las inundaciones que históricamente han afectado las vías de comunicación ubicadas dentro del área de influencia del Proyecto PSCIAL han generado diversas consecuencias, entre ellas el deterioro del pavimento, el colapso de alcantarillas y afectaciones a la movilidad de las personas, así como riesgos para la salud pública. Esta situación se ve agravada por la acumulación de residuos sólidos y sedimentos que obstruyen los sistemas de drenaje y provocan la saturación o insuficiencia de la infraestructura pluvial existente.
Entre las acciones desarrolladas por el Proyecto PSCIAL destacan la colocación de tablestacas en las márgenes del río Limoncito y de la quebrada Chocolate, la recava y ampliación de cauces, así como la construcción de puentes de acceso a comunidades y viviendas. Sin embargo, para lograr soluciones sostenibles resulta indispensable implementar una gestión integral de la cuenca del río Limoncito y de la quebrada Chocolate, que contemple el respeto a las zonas de protección y la delimitación de áreas inundables. Los oficios técnicos indican que el proyecto ha incluido la construcción y sustitución de puentes cantonales, puentes frente a viviendas, puente ferroviario, obras de recava y ampliación de cauces, así como protección de taludes mediante tablestaca en los tramos intervenidos. Estas obras permiten disminuir obstrucciones hidráulicas, mejorar el paso del agua, reducir desbordamientos y facilitar la movilidad en sectores donde anteriormente existían estructuras insuficientes o vulnerables.
En este sentido, se ha constatado la existencia de edificaciones construidas en condiciones de vulnerabilidad, algunas de ellas ubicadas sobre las márgenes del río o de la quebrada. Particularmente, en el tramo comprendido entre el puente de Barrio Quinto y la confluencia de los ríos Limoncito y Cieneguita, numerosas construcciones no respetan la zona de protección establecida en el artículo 33 de la Ley Forestal N.° 7575, el cual dispone, entre otros aspectos, que se consideran áreas de protección los diez metros a cada lado de los ríos, quebradas o arroyos ubicados en zonas urbanas con terreno plano. Estas áreas constituyen limitaciones legales al uso de la propiedad privada con el fin de proteger el recurso hídrico, la biodiversidad y la estabilidad de las riberas. Tradicionalmente, no se permitían construcciones ni usos incompatibles con la protección ambiental dentro de dichas franjas.
Posteriormente, mediante la reforma efectuada en el año 2022, se incorporaron los artículos 33 bis y 33 ter a la Ley Forestal, permitiendo determinadas obras de bajo impacto o de interés público, sujetas al cumplimiento de requisitos y autorizaciones específicas. La urbanización desordenada desarrollada en los alrededores del río Limoncito, la quebrada Chocolate y otros cuerpos de agua ha favorecido el establecimiento de asentamientos en zonas de riesgo. Esta situación se ve agravada por los efectos del cambio climático, reflejados en eventos de lluvia más frecuentes e intensos, así como por las limitaciones físicas propias de áreas densamente urbanizadas, donde la ampliación de la infraestructura de drenaje resulta particularmente compleja. Finalmente, se señala que la Municipalidad correspondiente es la entidad responsable de la atención y reparación de las vías públicas afectadas por las inundaciones.
No obstante, la implementación de soluciones sostenibles requiere una coordinación efectiva entre la municipalidad, el Ministerio de Obras Públicas y Transportes (MOPT), el Instituto Nacional de Vivienda y Urbanismo (INVU) y demás instituciones competentes. De igual forma, la participación ciudadana resulta fundamental mediante el reporte oportuno de afectaciones y la colaboración en las iniciativas de prevención y gestión del riesgo. Asimismo, debe destacarse que dentro de la II Etapa se contemplan obras no estructurales y complementarias, tales como la construcción de áreas de integración comunal y mejoramiento paisajístico del área de influencia, la adquisición de equipos de medición meteorológica y de caudales, la consultoría para educación ambiental y desarrollo de capacidades sociales, y el estudio de factibilidad para el manejo de residuos. Estas acciones contribuyen a la sostenibilidad del sistema, a la prevención del riesgo y a la mejora de las condiciones de uso del espacio público, aunque no sustituyen la competencia municipal sobre vías cantonales, control urbano, drenaje pluvial y gestión integral de residuos (…)” (sic) (ver el informe rendido bajo juramento por las autoridades del SENARA, agregado al expediente digital).
En cuanto al problema de disposición de aguas negras en el sector denunciado por el recurrente y los vecinos de Barrio Quinto de Limón, el SENARA explicó: “(…) El Estudio de Impacto Ambiental del Proyecto “Sistema de Control de Inundaciones en el área de Limoncito (PSCIAL)”, elaborado por el Programa de Investigación en Desarrollo Urbano Sostenible de la Universidad de Costa Rica para SENARA, identificó desde la etapa de línea base que la contaminación de los cuerpos de agua en la parte urbana de la cuenca baja del río Limoncito no corresponde a un efecto originado por las obras del PSCIAL, sino a una condición preexistente asociada principalmente a dos fuentes: la disposición de residuos sólidos en ríos y quebradas, y las descargas directas de aguas residuales domésticas provenientes de viviendas ubicadas frente o muy cerca de los cauces. Dicho estudio señala que, al ocurrir inundaciones, el agua que alcanza las viviendas puede transportar un alto grado de contaminación, convirtiéndose en un problema de salud pública por la posibilidad de brotes de enfermedades de origen hídrico, afectaciones dérmicas, presencia de vectores y exposición de la población a aguas residuales mezcladas con escorrentía pluvial.
El EsIA concluyó que la reducción de la frecuencia de las inundaciones producto de la ejecución de las obras del Proyecto de Control de Inundaciones Limoncito PSCIAL, contribuye a disminuir la exposición de la población a esa condición sanitaria; sin embargo, también advirtió que el proyecto de control de inundaciones no elimina por sí solo la contaminación existente en los cauces, pues esta depende de la solución integral del saneamiento sanitario, del manejo de residuos sólidos y del ordenamiento urbano en la cuenca. En cuanto al alcantarillado sanitario, el EsIA determinó que la zona presenta condiciones físicas que dificultan el uso adecuado de sistemas individuales de tratamiento, particularmente por el alto nivel freático, la presencia predominante de materiales finos arcillosos y el reducido tamaño de muchos lotes en el área urbana. Además, el estudio identificó que una parte importante de la población utiliza tanques sépticos y que existen descargas directas hacia ríos o quebradas, lo cual refuerza la necesidad de una solución sanitaria integral conectada al sistema correspondiente.
En consecuencia, el propio EsIA recomendó que el proyecto de control de inundaciones se complementara con la construcción y operación de infraestructura de alcantarillado sanitario, por tratarse de una condición indispensable para mejorar de manera efectiva la calidad del agua del río Limoncito y de sus afluentes. Esta complementariedad también fue recogida posteriormente por la Ley N.° 9690, mediante la cual se aprobó el Contrato de Préstamo N.° 2198, suscrito entre la República de Costa Rica y el Banco Centroamericano de Integración Económica (BCIE), para financiar el Programa de Alcantarillado y Control de Inundaciones para Limón. Dicho programa comprende dos proyectos diferenciados pero complementarios: el Proyecto de Ampliación y Mejoramiento del Alcantarillado Sanitario de la ciudad de Limón, a cargo del Instituto Costarricense de Acueductos y Alcantarillados (AyA), y el Proyecto de Canalización y Control de Inundaciones del río Limoncito, Limón, a cargo de SENARA.
En consecuencia, el propio marco legal y financiero del programa reconoce que la atención integral de la problemática requiere, por una parte, obras hidráulicas para reducir el riesgo de inundación y, por otra, infraestructura sanitaria para atender la contaminación por aguas residuales. Respecto a los residuos sólidos, el EsIA también documentó que, aunque la Municipalidad de Limón brinda el servicio de recolección y disposición final en los alrededores del río Limoncito, existe una práctica reiterada de disposición inadecuada de desechos en cauces, márgenes y puntos cercanos a calles angostas, donde la recolección puede presentar dificultades. Esta situación provoca que los residuos sean arrastrados hacia el río durante eventos de lluvia, obstruyan el flujo hidráulico, reduzcan la capacidad de conducción del cauce y agraven las condiciones de inundación y contaminación. Por ello, el EsIA propuso acciones de educación ambiental, coordinación municipal, mejora en la gestión de residuos y participación comunitaria como medidas no estructurales complementarias necesarias para la sostenibilidad del sistema.
Dichas medidas no estructurales forman parte de los componentes previstos para la adecuada gestión ambiental y social del proyecto, y no constituyen únicamente recomendaciones generales, sino acciones asociadas a la ejecución y sostenibilidad del Programa de Alcantarillado y Control de Inundaciones para Limón. En ese marco, se encuentra en ejecución un programa de educación ambiental orientado a fortalecer la conciencia comunitaria sobre la relación entre residuos sólidos, contaminación de los cauces, obstrucción hidráulica e incremento del riesgo de inundación. Este programa incluye, entre otras acciones, el desarrollo de una serie de talleres dirigidos a centros educativos ubicados en el área de influencia del proyecto, con el propósito de sensibilizar a estudiantes, personal docente y comunidad educativa sobre el manejo adecuado de residuos, la protección del río Limoncito y sus afluentes, la importancia de no depositar basura en los cauces y la corresponsabilidad ciudadana en la prevención de inundaciones y riesgos sanitarios.
En relación específica con la ausencia de tablestacas o muros de contención en el sector indicado por el recurrente, debe precisarse que las obras estructurales del PSCIAL se ejecutan conforme al alcance técnico, ambiental, presupuestario y contractual definido para cada etapa del proyecto. En los tramos priorizados aguas arriba del puente de Barrio Quinto se han ejecutado obras de ampliación hidráulica, recava, construcción de puentes y colocación de tablestacas; no obstante, el tramo aguas abajo del puente de Barrio Quinto hasta la confluencia con el río Cieneguita y su desembocadura al mar no fue incorporado desde la formulación del proyecto para la colocación de tablestacas ni muros de contención, debido a las restricciones ambientales, técnicas y económicas que se desarrollan más adelante en este informe. Debe destacarse, además, que la colocación de tablestacas o muros de contención tiene como finalidad principal estabilizar márgenes, proteger infraestructura, canalizar el flujo y reducir la ocurrencia o magnitud de desbordamientos en los sectores intervenidos; sin embargo, tales obras no constituyen una solución de saneamiento ni sustituyen la infraestructura de alcantarillado sanitario, el control de vertidos, la recolección de residuos sólidos o el ordenamiento de las ocupaciones ubicadas en zona de protección.
Por tanto, aun cuando una obra de contención pueda contribuir a mejorar la capacidad hidráulica y disminuir la exposición de las viviendas a eventos de inundación, no elimina la fuente de contaminación si persisten descargas de aguas residuales y disposición de residuos en el cauce. En ese sentido, SENARA informa que su competencia dentro del PSCIAL se circunscribe a la ejecución de obras hidráulicas de control y mitigación de inundaciones, conforme al diseño aprobado, las viabilidades y autorizaciones ambientales correspondientes y los recursos disponibles. La atención de descargas de aguas residuales, alcantarillado sanitario, control de vertidos, recolección de residuos sólidos, limpieza ordinaria de espacios públicos, control urbano y gestión municipal de caminos y drenajes pluviales corresponde a otras instituciones competentes, sin perjuicio de la coordinación interinstitucional que resulte necesaria para atender integralmente la problemática descrita por la comunidad.
Por lo anterior, SENARA no desconoce la existencia de contaminación en el río Limoncito ni los riesgos sanitarios asociados al arrastre de aguas contaminadas durante eventos de inundación. Por el contrario, dicha condición fue identificada y documentada en el EsIA como una problemática estructural de la cuenca baja, cuya atención exige medidas complementarias de saneamiento, alcantarillado, manejo de residuos, educación ambiental, control de ocupaciones en zona de protección y coordinación entre la Municipalidad de Limón, el Instituto Costarricense de Acueductos y Alcantarillados, el Ministerio de Salud, el SINAC, la SETENA, el MOPT y las demás entidades competentes. El PSCIAL contribuye a reducir la frecuencia y magnitud de las inundaciones en los sectores intervenidos, pero no puede, por sí solo, resolver la contaminación sanitaria que se origina fuera del alcance material y competencial de las obras hidráulicas ejecutadas por SENARA (…)” (sic) (ver el informe rendido bajo juramento por las autoridades del SENARA, agregado al expediente digital) En lo que respecta a las supuestas obras inconclusas en el sector denunciado por el recurrente y los vecinos de Barrio Quinto de Limón, el SENARA indicó: “(…) De conformidad con lo indicado en los oficios SENARA-GG-OFI-010-2026 (Atención al Oficio N.° 14884-2025-DHR) y SENARA-INDEP-PSCIAL-OFI-002-2026, remitidos a la Defensoría de los Habitantes, respecto al tramo comprendido aguas abajo del puente de Barrio Quinto, hasta la confluencia con el río Cieneguita y su desembocadura al mar se informa lo siguiente.
En relación con el deslizamiento de las márgenes del río Limoncito en el tramo comprendido entre las coordenadas CRTM05 (E: 605260, N: 1104333) y (E: 605348, N: 1104383), ubicado aguas abajo del puente de Barrio Quinto, margen derecha del río Limoncito, se indica que en noviembre de 2021 se realizaron labores de limpieza del cauce. No obstante, desde su formulación, el Proyecto Sistema de Control de Inundaciones del Área Limoncito (PSCIAL) no contempló la colocación de tablestacas ni ningún otro sistema de estabilización o contención de taludes en dicho sector. La exclusión de este tramo obedeció a criterios ambientales, técnicos y económicos, los cuales se detallan a continuación: Aspectos ambientales: La zona presenta limitaciones de carácter ambiental que restringen la ejecución de obras de infraestructura. De acuerdo con la información obtenida del Sistema Nacional de Información Territorial (SNIT), las consultas realizadas al Área de Conservación La Amistad Caribe (ACLAC) y la normativa ambiental aplicable, el tramo ubicado aguas abajo del puente de Barrio Quinto presenta una combinación de condiciones sensibles, entre ellas áreas de humedal y vegetación asociada a ecosistemas ribereños, zonas de protección de cuerpos de agua, baja pendiente hacia la desembocadura, cercanía con áreas sujetas a dinámica hídrica natural y presencia de cobertura vegetal que cumple funciones de estabilidad, amortiguamiento y protección ambiental.
En particular, el sector aguas abajo del puente de Barrio Quinto hasta la confluencia con el río Cieneguita y su desembocadura al mar presenta condiciones ambientales y geomorfológicas que obligan a una valoración previa integral. La presencia de humedales, vegetación riparia, zonas de protección legal, áreas de escasa pendiente, posibles restricciones para remoción de cobertura vegetal y la cercanía de ocupaciones humanas al cauce limitan la posibilidad de ejecutar obras de ampliación, tablestacado o contención sin estudios específicos y sin las autorizaciones ambientales correspondientes. Por tanto, la limitación ambiental no se circunscribe únicamente a la presencia de áreas ambientalmente sensibles, sino al conjunto de condiciones del sitio y al régimen jurídico aplicable a los cauces, humedales, áreas de protección, vegetación ribereña y bienes de dominio público. Cualquier intervención en ese tramo debe considerar la Ley de Aguas, la Ley Forestal, la normativa sobre humedales y las competencias del MINAE, SINAC, Dirección de Agua y demás autoridades competentes.
Aspectos técnicos: Desde el punto de vista constructivo, la ejecución de obras en este sector presenta importantes limitaciones debido a la proximidad de infraestructura existente en ambas márgenes del río. Se observan viviendas ubicadas prácticamente sobre el cauce, así como atracaderos privados y otras estructuras que reducen significativamente el espacio disponible para la operación de maquinaria, la instalación de equipos, el acopio temporal de materiales, la conformación de accesos seguros y la implementación de obras de estabilización o contención. A lo anterior se suman las características geotécnicas propias del sector. Según la línea base del EsIA, el área del proyecto se ubica sobre depósitos recientes de origen aluvial y coluvial, con presencia de arcillas de plasticidad intermedia, limos con arena, arenas medias a finas y gravas. Estos materiales, asociados a una zona de baja pendiente, alta humedad, influencia del nivel freático y cercanía al cauce, pueden presentar susceptibilidad a procesos de expansión y contracción, pérdida de resistencia por saturación, erosión superficial, socavación local y desestabilización de taludes cuando se altera la cobertura existente o se incrementan las cargas sobre la margen.
En ese contexto, el ingreso de maquinaria pesada en un espacio estrecho, con suelos saturables y márgenes ya erosionadas o intervenidas por ocupaciones humanas, podría generar riesgos adicionales: aumento de vibraciones, sobrecarga sobre bordes inestables, pérdida de confinamiento lateral, desprendimiento de material, incremento de la erosión, afectación de viviendas próximas y mayor aporte de sedimentos al cauce. Por tanto, lejos de constituir una intervención sencilla, el movimiento de maquinaria en este tramo podría agravar temporal o permanentemente las condiciones de inestabilidad existentes. Esta situación difiere sustancialmente de las condiciones existentes aguas arriba del puente de Barrio Quinto, donde sí fue posible desarrollar las intervenciones contempladas en el PSCIAL al existir condiciones de acceso, maniobrabilidad, diseño hidráulico, permisos, presupuesto y viabilidad constructiva previamente definidos dentro del alcance aprobado Aspectos económicos: Considerando las limitaciones ambientales y técnicas descritas anteriormente, así como el presupuesto aprobado para la ejecución integral del PSCIAL — tanto en su Primera Etapa, financiada mediante transferencia del Ministerio de Hacienda, como en su Segunda Etapa, financiada mediante el Contrato de Préstamo N.° 2198 del Banco Centroamericano de Integración Económica (BCIE)—, el tramo referido no fue incorporado dentro del alcance del proyecto.
La eventual intervención habría requerido expropiaciones de propiedades, reubicación de infraestructura existente, adquisición de materiales adicionales y la implementación de medidas constructivas especiales, lo que hubiera generado un incremento sustancial en los costos del proyecto. Por estas razones, dicho sector fue excluido desde la etapa de planificación y diseño del PSCIAL. Por lo anterior, no se trata de una obra inconclusa dentro del alcance del PSCIAL, sino de un tramo excluido desde la formulación técnica, ambiental, presupuestaria y contractual del proyecto. Cualquier intervención posterior en ese sector requeriría nuevos estudios técnicos, ambientales, hidráulicos, sociales y económicos, así como la definición de una fuente de financiamiento distinta o complementaria, los permisos correspondientes y la coordinación con la Municipalidad de Limón, la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, el SINAC, el Ministerio de Ambiente y Energía, el AyA y demás entidades competentes.
SENARA ha indicado, además, que está en disposición de brindar asesoramiento técnico a las instituciones competentes cuando así sea solicitado formalmente, en especial si se identifica la necesidad de valorar intervenciones provisionales o futuras fuera del alcance del PSCIAL. No obstante, la institución no cuenta con recursos propios para ejecutar obras no contempladas en el proyecto aprobado, ni puede modificar unilateralmente el alcance definido en el Contrato de Préstamo N.° 2198 BCIE sin las aprobaciones técnicas, institucionales y financieras correspondientes (…)” (sic) (ver el informe rendido bajo juramento por las autoridades del SENARA, agregado al expediente digital)
IV.Sobre lo denunciado. En primer lugar, lo que corresponde es deslindar lo que el recurrente ha denunciado ante la Municipalidad de Limón (directamente), y el SENARA (a través de la intervención de la Defensoría de los Habitantes).
V.En el sub examine quedó demostrado que el 17 de julio de 2025, vecinos de la comunidad de Barrio Quinto, mediante un oficio, reclamaron ante la Municipalidad de Limón lo siguiente: “(…) 1- Carreteras en mal estado desde la administración pasada de Mattis, han dejado a la comunidad ubicada detrás de la Feria del Agricultor, cruzando el puente a mano izquierda y hasta colindar con el barrio los cocos. 2- La Empresa SENARA, realizo en Proyecto de limpieza de Río Limoncito y esta zona indicada no realizo limpieza y no coloco muros de contención o table estacas lo que provoca que, en las llenas o desbordamiento de las aguas, de agua negras y de agua fecal en la comunidad. 3- Esta pequeña comunidad abandonada está dividida detrás de la Feria del Agricultor conocido como Barrio Quinto y una vez que cruza el Puente del Rio Limoncito, pertenece al Barrio Quinto y colinda con el Puente y Clínica del Barrio los Cocos (…)” (sic).
El 26 de setiembre de 2025, el recurrente presentó ante la Defensoría de los Habitantes, una solicitud de intervención ante la Municipalidad de Limón, en los siguientes términos: “(…) El día 30 de julio de 2025, un grupo de vecinos presentó por escrito ante la Municipalidad de Limón un reclamo formal, en el que expusieron que, en Barrio Quinto, específicamente detrás del predio donde se realiza la Feria del Agricultor, la carretera se encuentra en mal estado, situación que se extiende hasta la colindancia con Barrio Los Cocos. Adicionalmente, señalaron que en el marco de un proyecto interinstitucional en el que participaron el SENARA y la Municipalidad de Limón, se efectuaron trabajos de limpieza en el Río Limoncito y de construcción de muros de contención. Sin embargo, dichas obras quedaron inconclusas, lo que ha generado mayor preocupación en la comunidad. En razón de lo anterior, solicitaron la debida intervención municipal a fin de que se brinde una solución integral.
No obstante, a la fecha de la presente gestión, no han recibido respuesta formal por parte del Gobierno Local. Por tanto, solicita a la Defensoría de los Habitantes que se investiguen las razones por las cuales la Municipalidad de Limón no ha atendido los hechos denunciados y, en caso de que las obras están programadas para este o el próximo año, se informe de manera expresa, a fin de que la comunidad pueda dar seguimiento oportuno a las eventuales soluciones planteadas por la autoridad municipal (…)” (sic).
VI.De lo expuesto se infiere que lo denunciado ante la Municipalidad de Limón fue: 1. carreteras en mal estado; 2. el ingreso de aguas negras a la comunidad, debido a que el SENARA, supuestamente, no realizó limpieza y construcción de infraestructura en la zona; y 3. la existencia de obras inconclusas por parte del SENARA. Estos tres puntos, específicamente en la “(…) la comunidad ubicada detrás de la Feria del Agricultor, cruzando el puente a mano izquierda y hasta colindar con el barrio los cocos (…)” (sic). Por consiguiente, el promovente no denunció expresamente – por lo menos la prueba que él aportó no permite acreditarlo – que la erosión de las orillas del Río Limoncito ponga en peligro varias casas y la vida de sus habitantes. Sin embargo, el informe final rendido por la Defensoría de los Habitantes denota que ambas instituciones tienen conocimiento de este problema también. En el oficio No. 03332-2026-DHR de 18 de marzo de 2026, la Defensoría de los Habitantes emitió un informe final sin recomendaciones, concluyendo lo siguiente: “(…) Concluida la investigación se han constatado los siguientes hechos: (…) – La Municipalidad de Limón como SENARA señalan que no existen obras inconclusas en el sector de Bario Quinto ya que este sector nunca formó parte del proyecto. – Tanto la Municipalidad de Limón como SENARA establecen que este sector no esta siendo valorado para intervención por lo que no existe a la fecha una solución integral futura que pueda atender la pretensión del habitante ([Nombre 001]).
Por otra parte, no se constataron los siguientes hechos: - Que exista programación futura para realizar trabajos de limpieza y/o construcción de muros de contención en el Río Limoncito. Con fundamento en lo expuesto la Defensoría de los Habitantes realiza las siguientes consideraciones (…) Sobre el caso concreto: Mediante el análisis de la documentación aportada por la Municipalidad de Limón y SENARA, se logró determinar las razones por las cuales no se ha intervenido el sector tanto en materia vial como en materia fluvial (…) Aunado a lo anterior, se determina que la intervención de materia fluvial fue excluida desde un inicio del proyecto por razones económicas, técnicas y ambientales, por lo que al no haber formado parte desde un inicio del proyecto, no puede ser atendido. (…) Así las cosas, dado que la pretensión del habitante [Nombre 001] ante la Defensoría se circunscribió a Investigar las razones por las cuales que la Municipalidad de Limón no atendió los hechos denunciados y conocer si hay obras programadas al efecto, por medio de las gestiones realizadas por esta Defensoría se han conocido las razones por las cuales la administración no ha atendido su solicitud; y si bien las respuestas brindadas no son favorables para sus intereses, estas informan la situación jurídica, técnica y presupuestaria.
A la persona interesada se le sugiere: valorar la presentación de gestiones formales ante el gobierno local y/o Comité Municipal de Emergencias, a efecto de que, mediante una coordinación interinstitucional con entidades como CNE o SENARA, se analice la viabilidad de intervenciones en el sector, particularmente si existieran eventuales escenarios de riesgo (…)” (sic) (el énfasis no pertenece al original).
VII.En lo que respecta a las carreteras en mal estado. Se demostró que mediante el oficio No. AML-3438-2025 de 1° de octubre de 2025, la Alcaldesa de la corporación territorial remitió al tutelado y a los vecinos de Barrio Quinto, el oficio No. UTGVM-903-2025 de la Unidad Técnica de Gestión Vial, en el que se indicó: “(…) En atención al oficio en referencia, respecto a la solicitud de [Nombre 001] y vecinos para reparación de los caminos 7-01-810, y 7-01-811, ubicados en el sector de B° Quinto - Limoncito, le informo que; esta unidad trabaja con la programación del Plan Quinquenal de Conservación y Desarrollo Vial del Cantón de Limón, y la intervención de los caminos se hace de acuerdo con el puntaje que tiene cada uno, conforme a los parámetros de clasificación con el cual fue confeccionado. Los referidos caminos no están programados para ser intervenidos pronto, ya que la Red Vial Cantonal de Limón está compuesta por 1074 caminos, y como no es posible atenderlos todos en un mismo año; se recurre al referido Plan Vial Quinquenal como herramienta de orientación para la intervención con los recursos de la Ley 8114 y Ley 9329 (…) El camino 7-01-810 está incluido en la Política N°2, en la posición N°150 y el camino 7- 01-811 está incluido en la Politica N°3, en la posición N°364, tal y como se muestra en la siguiente tabla (…) Con el entendido que serán intervenidos en el orden que le corresponde de acuerdo con la programación anual de intervención, sin poder dar una fecha exacta porque va a depender del avance en la intervención de los caminos anteriores de la Politica N°1, la Política N°2, y la Política N°3, hasta llegar a la posición N°150 y posición N°364 respectivamente, durante los cinco años que comprende el Plan Vial Quinquenal (…)” (sic) (el énfasis no pertenece al original).
Mediante el oficio No. UTGVM-939-2025 de 7 de octubre de 2025, dirigido a la Alcaldesa de la Municipalidad de Limón, la Unidad Técnica de Gestión Vial de la Municipalidad de Limón señaló: “(…) En atención a los oficios en referencia, respecto a la denuncia interpuesta por el Sr. [Nombre 001], y vecinos del sector de B° Quinto – Limoncito, según lo indicado en el oficio No. 11381-2025-DHR de la Defensoría de los Habitantes (…) rindo informe en respuesta a los siguientes puntos (…) Con relación a la intervención de las calles, como se indicó en el punto anterior: serán intervenidas en el orden que le corresponde de acuerdo con la programación anual de intervención, sin poder dar una fecha exacta porque va a depender del avance en la intervención de los caminos anteriores de la Política N°1, la Política No. 2, y la Política N°3, hasta llegar a la posición N°150 y posición N°364 respectivamente, durante los cinco años que comprende el Plan Vial Quinquenal (…)” (sic) (el énfasis no pertenece al original).
En el oficio No. 03332-2026-DHR de 18 de marzo de 2026, la Defensoría de los Habitantes concluyó lo siguiente: “(…) Concluida la investigación se han constatado los siguientes hechos: - Que los caminos con código 7-01-810 y 7-01-811 están debidamente registraos en la Unidad Técnica de Gestión Vial Municipalidad, sin embargo, estos caminos no serán intervenidos en el corto plazo ya que la Red Vial Cantonal consta de 1074 caminos, los cuales se priorizan para intervención según puntaje de clasificación. – Estos caminos se encuentran clasificados en los puntajes 150 y 364 respectivamente dentro del Plan Vial Quinquenal. – A la fecha, la Municipalidad de Limón señala que no puede brindar fecha exacta para su intervención ya que depende del avance de las posiciones anteriores durante el plazo que abarca el plan vial quinquenal (…)” (sic) (el énfasis no pertenece al original). En lo que concierne al estado de las carreteras e infraestructura de tránsito en el sector, el SENARA detalló: “(…) el PSCIAL ha incorporado dentro de su alcance obras que inciden positivamente en la conectividad y seguridad del área de influencia; sin embargo, la reparación, mantenimiento ordinario y administración de vías públicas corresponde a la institucionalidad competente en materia vial y municipal.
Las inundaciones que históricamente han afectado las vías de comunicación ubicadas dentro del área de influencia del Proyecto PSCIAL han generado diversas consecuencias, entre ellas el deterioro del pavimento, el colapso de alcantarillas y afectaciones a la movilidad de las personas, así como riesgos para la salud pública. Esta situación se ve agravada por la acumulación de residuos sólidos y sedimentos que obstruyen los sistemas de drenaje y provocan la saturación o insuficiencia de la infraestructura pluvial existente. Entre las acciones desarrolladas por el Proyecto PSCIAL destacan la colocación de tablestacas en las márgenes del río Limoncito y de la quebrada Chocolate, la recava y ampliación de cauces, así como la construcción de puentes de acceso a comunidades y viviendas. Sin embargo, para lograr soluciones sostenibles resulta indispensable implementar una gestión integral de la cuenca del río Limoncito y de la quebrada Chocolate, que contemple el respeto a las zonas de protección y la delimitación de áreas inundables.
Los oficios técnicos indican que el proyecto ha incluido la construcción y sustitución de puentes cantonales, puentes frente a viviendas, puente ferroviario, obras de recava y ampliación de cauces, así como protección de taludes mediante tablestaca en los tramos intervenidos. Estas obras permiten disminuir obstrucciones hidráulicas, mejorar el paso del agua, reducir desbordamientos y facilitar la movilidad en sectores donde anteriormente existían estructuras insuficientes o vulnerables. En este sentido, se ha constatado la existencia de edificaciones construidas en condiciones de vulnerabilidad, algunas de ellas ubicadas sobre las márgenes del río o de la quebrada. Particularmente, en el tramo comprendido entre el puente de Barrio Quinto y la confluencia de los ríos Limoncito y Cieneguita, numerosas construcciones no respetan la zona de protección establecida en el artículo 33 de la Ley Forestal N.° 7575, el cual dispone, entre otros aspectos, que se consideran áreas de protección los diez metros a cada lado de los ríos, quebradas o arroyos ubicados en zonas urbanas con terreno plano.
Estas áreas constituyen limitaciones legales al uso de la propiedad privada con el fin de proteger el recurso hídrico, la biodiversidad y la estabilidad de las riberas. Tradicionalmente, no se permitían construcciones ni usos incompatibles con la protección ambiental dentro de dichas franjas. Posteriormente, mediante la reforma efectuada en el año 2022, se incorporaron los artículos 33 bis y 33 ter a la Ley Forestal, permitiendo determinadas obras de bajo impacto o de interés público, sujetas al cumplimiento de requisitos y autorizaciones específicas. La urbanización desordenada desarrollada en los alrededores del río Limoncito, la quebrada Chocolate y otros cuerpos de agua ha favorecido el establecimiento de asentamientos en zonas de riesgo. Esta situación se ve agravada por los efectos del cambio climático, reflejados en eventos de lluvia más frecuentes e intensos, así como por las limitaciones físicas propias de áreas densamente urbanizadas, donde la ampliación de la infraestructura de drenaje resulta particularmente compleja.
Finalmente, se señala que la Municipalidad correspondiente es la entidad responsable de la atención y reparación de las vías públicas afectadas por las inundaciones. No obstante, la implementación de soluciones sostenibles requiere una coordinación efectiva entre la municipalidad, el Ministerio de Obras Públicas y Transportes (MOPT), el Instituto Nacional de Vivienda y Urbanismo (INVU) y demás instituciones competentes. De igual forma, la participación ciudadana resulta fundamental mediante el reporte oportuno de afectaciones y la colaboración en las iniciativas de prevención y gestión del riesgo. Asimismo, debe destacarse que dentro de la II Etapa se contemplan obras no estructurales y complementarias, tales como la construcción de áreas de integración comunal y mejoramiento paisajístico del área de influencia, la adquisición de equipos de medición meteorológica y de caudales, la consultoría para educación ambiental y desarrollo de capacidades sociales, y el estudio de factibilidad para el manejo de residuos.
Estas acciones contribuyen a la sostenibilidad del sistema, a la prevención del riesgo y a la mejora de las condiciones de uso del espacio público, aunque no sustituyen la competencia municipal sobre vías cantonales, control urbano, drenaje pluvial y gestión integral de residuos (…)” (sic) (el énfasis no pertenece al original).
VIII.No se vislumbra que la Municipalidad de Limón haya resuelto, en definitiva, lo referente al mal estado de las carreteras denunciado, pues reiteradamente se indica que no se tiene previsto intervenir pronto los caminos implicados (Nos. 7-01-810, y 7-01-811). Tómese en cuenta que la denuncia fue planteada hace aproximadamente 1 año.
IX.En cuanto al ingreso de aguas negras. Particularmente en cuanto al problema de ingreso de aguas negras, el SENARA explicó: “(…) El Estudio de Impacto Ambiental del Proyecto “Sistema de Control de Inundaciones en el área de Limoncito (PSCIAL)”, elaborado por el Programa de Investigación en Desarrollo Urbano Sostenible de la Universidad de Costa Rica para SENARA, identificó desde la etapa de línea base que la contaminación de los cuerpos de agua en la parte urbana de la cuenca baja del río Limoncito no corresponde a un efecto originado por las obras del PSCIAL, sino a una condición preexistente asociada principalmente a dos fuentes: la disposición de residuos sólidos en ríos y quebradas, y las descargas directas de aguas residuales domésticas provenientes de viviendas ubicadas frente o muy cerca de los cauces. Dicho estudio señala que, al ocurrir inundaciones, el agua que alcanza las viviendas puede transportar un alto grado de contaminación, convirtiéndose en un problema de salud pública por la posibilidad de brotes de enfermedades de origen hídrico, afectaciones dérmicas, presencia de vectores y exposición de la población a aguas residuales mezcladas con escorrentía pluvial.
El EsIA concluyó que la reducción de la frecuencia de las inundaciones producto de la ejecución de las obras del Proyecto de Control de Inundaciones Limoncito PSCIAL, contribuye a disminuir la exposición de la población a esa condición sanitaria; sin embargo, también advirtió que el proyecto de control de inundaciones no elimina por sí solo la contaminación existente en los cauces, pues esta depende de la solución integral del saneamiento sanitario, del manejo de residuos sólidos y del ordenamiento urbano en la cuenca. En cuanto al alcantarillado sanitario, el EsIA determinó que la zona presenta condiciones físicas que dificultan el uso adecuado de sistemas individuales de tratamiento, particularmente por el alto nivel freático, la presencia predominante de materiales finos arcillosos y el reducido tamaño de muchos lotes en el área urbana. Además, el estudio identificó que una parte importante de la población utiliza tanques sépticos y que existen descargas directas hacia ríos o quebradas, lo cual refuerza la necesidad de una solución sanitaria integral conectada al sistema correspondiente.
En consecuencia, el propio EsIA recomendó que el proyecto de control de inundaciones se complementara con la construcción y operación de infraestructura de alcantarillado sanitario, por tratarse de una condición indispensable para mejorar de manera efectiva la calidad del agua del río Limoncito y de sus afluentes. Esta complementariedad también fue recogida posteriormente por la Ley N.° 9690, mediante la cual se aprobó el Contrato de Préstamo N.° 2198, suscrito entre la República de Costa Rica y el Banco Centroamericano de Integración Económica (BCIE), para financiar el Programa de Alcantarillado y Control de Inundaciones para Limón. Dicho programa comprende dos proyectos diferenciados pero complementarios: el Proyecto de Ampliación y Mejoramiento del Alcantarillado Sanitario de la ciudad de Limón, a cargo del Instituto Costarricense de Acueductos y Alcantarillados (AyA), y el Proyecto de Canalización y Control de Inundaciones del río Limoncito, Limón, a cargo de SENARA.
En consecuencia, el propio marco legal y financiero del programa reconoce que la atención integral de la problemática requiere, por una parte, obras hidráulicas para reducir el riesgo de inundación y, por otra, infraestructura sanitaria para atender la contaminación por aguas residuales. Respecto a los residuos sólidos, el EsIA también documentó que, aunque la Municipalidad de Limón brinda el servicio de recolección y disposición final en los alrededores del río Limoncito, existe una práctica reiterada de disposición inadecuada de desechos en cauces, márgenes y puntos cercanos a calles angostas, donde la recolección puede presentar dificultades. Esta situación provoca que los residuos sean arrastrados hacia el río durante eventos de lluvia, obstruyan el flujo hidráulico, reduzcan la capacidad de conducción del cauce y agraven las condiciones de inundación y contaminación. Por ello, el EsIA propuso acciones de educación ambiental, coordinación municipal, mejora en la gestión de residuos y participación comunitaria como medidas no estructurales complementarias necesarias para la sostenibilidad del sistema.
Dichas medidas no estructurales forman parte de los componentes previstos para la adecuada gestión ambiental y social del proyecto, y no constituyen únicamente recomendaciones generales, sino acciones asociadas a la ejecución y sostenibilidad del Programa de Alcantarillado y Control de Inundaciones para Limón. En ese marco, se encuentra en ejecución un programa de educación ambiental orientado a fortalecer la conciencia comunitaria sobre la relación entre residuos sólidos, contaminación de los cauces, obstrucción hidráulica e incremento del riesgo de inundación. Este programa incluye, entre otras acciones, el desarrollo de una serie de talleres dirigidos a centros educativos ubicados en el área de influencia del proyecto, con el propósito de sensibilizar a estudiantes, personal docente y comunidad educativa sobre el manejo adecuado de residuos, la protección del río Limoncito y sus afluentes, la importancia de no depositar basura en los cauces y la corresponsabilidad ciudadana en la prevención de inundaciones y riesgos sanitarios.
En relación específica con la ausencia de tablestacas o muros de contención en el sector indicado por el recurrente, debe precisarse que las obras estructurales del PSCIAL se ejecutan conforme al alcance técnico, ambiental, presupuestario y contractual definido para cada etapa del proyecto. En los tramos priorizados aguas arriba del puente de Barrio Quinto se han ejecutado obras de ampliación hidráulica, recava, construcción de puentes y colocación de tablestacas; no obstante, el tramo aguas abajo del puente de Barrio Quinto hasta la confluencia con el río Cieneguita y su desembocadura al mar no fue incorporado desde la formulación del proyecto para la colocación de tablestacas ni muros de contención, debido a las restricciones ambientales, técnicas y económicas que se desarrollan más adelante en este informe. Debe destacarse, además, que la colocación de tablestacas o muros de contención tiene como finalidad principal estabilizar márgenes, proteger infraestructura, canalizar el flujo y reducir la ocurrencia o magnitud de desbordamientos en los sectores intervenidos; sin embargo, tales obras no constituyen una solución de saneamiento ni sustituyen la infraestructura de alcantarillado sanitario, el control de vertidos, la recolección de residuos sólidos o el ordenamiento de las ocupaciones ubicadas en zona de protección.
Por tanto, aun cuando una obra de contención pueda contribuir a mejorar la capacidad hidráulica y disminuir la exposición de las viviendas a eventos de inundación, no elimina la fuente de contaminación si persisten descargas de aguas residuales y disposición de residuos en el cauce. En ese sentido, SENARA informa que su competencia dentro del PSCIAL se circunscribe a la ejecución de obras hidráulicas de control y mitigación de inundaciones, conforme al diseño aprobado, las viabilidades y autorizaciones ambientales correspondientes y los recursos disponibles. La atención de descargas de aguas residuales, alcantarillado sanitario, control de vertidos, recolección de residuos sólidos, limpieza ordinaria de espacios públicos, control urbano y gestión municipal de caminos y drenajes pluviales corresponde a otras instituciones competentes, sin perjuicio de la coordinación interinstitucional que resulte necesaria para atender integralmente la problemática descrita por la comunidad.
Por lo anterior, SENARA no desconoce la existencia de contaminación en el río Limoncito ni los riesgos sanitarios asociados al arrastre de aguas contaminadas durante eventos de inundación. Por el contrario, dicha condición fue identificada y documentada en el EsIA como una problemática estructural de la cuenca baja, cuya atención exige medidas complementarias de saneamiento, alcantarillado, manejo de residuos, educación ambiental, control de ocupaciones en zona de protección y coordinación entre la Municipalidad de Limón, el Instituto Costarricense de Acueductos y Alcantarillados, el Ministerio de Salud, el SINAC, la SETENA, el MOPT y las demás entidades competentes. El PSCIAL contribuye a reducir la frecuencia y magnitud de las inundaciones en los sectores intervenidos, pero no puede, por sí solo, resolver la contaminación sanitaria que se origina fuera del alcance material y competencial de las obras hidráulicas ejecutadas por SENARA (…)” (sic) (el énfasis no pertenece al original).
X.Por consiguiente, contrario a lo que quiso dar a entender el promovente, el problema de incorrecta disposición de aguas negras en la zona no fue causado por las obras que el SENARA ejecuta, sino que es anterior o preexistente, generado básicamente, de acuerdo con el criterio del SENARA, por: “(…) la disposición de residuos sólidos en ríos y quebradas, y las descargas directas de aguas residuales domésticas provenientes de viviendas ubicadas frente o muy cerca de los cauces. (…)” (sic). No es posible afirmar que la Municipalidad de Limón haya dispuesto lo que en Derecho corresponde para resolver en definitiva este extremo de la denuncia de 17 de julio de 2025.
XI.En cuanto a la erosión y el riesgo generado. Atinente a la erosión del río Limoncito y al riesgo que esta situación representa para las viviendas y habitantes de Barrio Quinto – Río Limoncito, el SENARA detalló: “(…) el PSCIAL ha ejecutado obras precisamente orientadas a atender, dentro de su alcance aprobado, la reducción del riesgo hidráulico y la protección de márgenes en los sectores priorizados de la cuenca baja. Como parte de las obras correspondientes a la Primera Etapa del Proyecto PSCIAL, se ejecutó la colocación de aproximadamente 1,5 kilómetros de tablestaca y la ampliación de la sección hidráulica del río Limoncito en el tramo comprendido entre el puente Chitá y Barrio Quinto, obras que fueron concluidas durante el año 2023. De igual manera, como parte de la Segunda Etapa del proyecto, se realizó la ampliación de la sección hidráulica mediante excavación y colocación de tablestaca en aproximadamente 5 kilómetros del río Limoncito, entre el puente Chitá y el sector de Santa Fe, obras concluidas durante el año 2025 La función principal de la tablestaca es actuar como una estructura de contención y canalización que permite controlar inundaciones, reforzar las márgenes del río y garantizar un flujo ordenado de las aguas durante eventos de lluvia intensa.
Su implementación contribuye significativamente a reducir los riesgos para viviendas, caminos e infraestructura pública. Además, al integrarse con otras obras complementarias, como puentes y alcantarillas, forma parte de un sistema integral de protección para las comunidades ubicadas dentro del área de influencia del proyecto. Según los oficios SENARA-INDEP-PSCIAL-OFI-292-2025, SENARA-INDEP-RHC-OFI082-2025 y SENARA-INDEP-PSCIAL-OFI-002-2026, la I Etapa incluyó, entre otras obras, la colocación de aproximadamente 1,5 kilómetros de tablestaca y ampliación del río Limoncito desde el puente Chitá hasta Barrio Quinto; la construcción de puentes cantonales; la limpieza del canal Santa Rosa; la limpieza de la quebrada Chinita; la construcción de un vertedor de excedencias; la limpieza del canal JAPDEVA; la construcción del canal trasvase; y la construcción de puentes de acceso a viviendas sobre la quebrada Chocolate.
La II Etapa contempla y ejecuta obras adicionales, entre ellas la ampliación de la sección hidráulica mediante excavación y colocación de tablestaca en el río Limoncito entre el puente Chitá y el sector de Santa Fe; la recava y ampliación de la quebrada Chocolate entre el puente de ferrocarril y la Ruta 32; la recava del canal Colina; la construcción del puente de ferrocarril; la recava y limpieza del canal Santa Rosa; el levantamiento LIDAR para generar modelos de elevación de la cuenca baja; la adquisición de equipos de medición meteorológica y de caudales; la consultoría para educación ambiental y desarrollo de capacidades sociales; y el estudio de factibilidad para el manejo de residuos. Debe aclararse que las obras ejecutadas y en ejecución no eliminan por completo la amenaza natural de inundación ni todos los procesos de erosión propios de una cuenca urbana intervenida. No obstante, sí aumentan la capacidad hidráulica de los cauces intervenidos, reducen la frecuencia y magnitud de los desbordamientos en los sectores priorizados, estabilizan márgenes mediante tablestacas donde técnica y ambientalmente fue viable, sustituyen puentes que limitaban el flujo, mejoran la conectividad y permiten un manejo hidráulico más ordenado durante eventos de lluvia intensa.
Lo anterior debe analizarse, además, a la luz de las limitaciones legales establecidas por la Ley de Aguas N.° 276 y la Ley Forestal N.° 7575. La Ley de Aguas reconoce como bienes de dominio público los ríos, sus afluentes, cauces y demás corrientes de agua, por lo que cualquier intervención dentro del cauce de dominio público, incluyendo obras de canalización, protección de márgenes, limpieza, ampliación o construcción de estructuras hidráulicas, requiere contar con las autorizaciones técnicas y administrativas correspondientes ante las autoridades competentes, particularmente la Dirección de Agua del Ministerio de Ambiente y Energía. En consecuencia, SENARA no puede ejecutar obras fuera del alcance autorizado del proyecto ni intervenir cauces adicionales sin los permisos previos exigidos por el ordenamiento jurídico. De igual forma, la Ley Forestal N.° 7575 establece áreas de protección en las márgenes de ríos, quebradas y arroyos, incluyendo franjas de protección en zonas urbanas y rurales, y limita la corta de árboles, la modificación de cobertura vegetal y el desarrollo de obras dentro de dichas áreas, salvo en los casos y bajo las condiciones expresamente autorizadas por la normativa ambiental.
Estas restricciones tienen como finalidad proteger el recurso hídrico, conservar la estabilidad de las riberas, evitar procesos erosivos, preservar la biodiversidad y reducir el riesgo asociado a la ocupación de márgenes vulnerables. Por ello, la sola existencia de procesos erosivos o de afectación en una margen no habilita automáticamente la ejecución inmediata de obras de contención, tablestacado o reencauzamiento. Tales intervenciones deben ser técnicamente viables, ambientalmente compatibles, presupuestariamente financiadas y jurídicamente autorizadas. En sectores con presencia de humedales, Yolillales, vegetación riparia, viviendas dentro de la zona de protección o estructuras privadas próximas al cauce, las restricciones legales son aún más relevantes y obligan a valorar alternativas de intervención bajo criterios técnicos, ambientales, sociales y económicos, así como a coordinar con SINAC, MINAE, Municipalidad de Limón y demás instituciones competentes (…)” (sic) (el énfasis no pertenece al original).
XII.Tal y como se destacó supra, este extremo fue puesto en conocimiento de la Municipalidad de Limón y el SENARA a través de la gestión promovida por el recurrente ante la Defensoría de los Habitantes. El SENARA insiste en que para abordar el problema es necesaria una actuación coordinada con otras dependencias. Debe tomarse en cuenta lo indicado por el SENARA a la Defensoría de los Habitantes: “(…) Debido a los trabajos que se han estado ejecutando por parte del Senara durante varios años en el cantón Central de Limón, se ha podido identificar otros puntos críticos por afectación de inundaciones fuera del área de influencia del PSCIAL (I y II Etapa), lo que ha llevado a la institución Senara a plantear reuniones con altos cargos de la Municipalidad de Limón para que desde el gobierno local, se solicite al Senara proyectos en la misma línea del PSCIAL y que juntos se busquen posibles alternativas de financiamiento, las cuales podrían ser la CNE, el Canon que administra Japdeva, recursos del IFAM, entre otros, ya que se deben financiar estudios técnicos, se requiere personal especializado el cual es limitado en el Senara, así como el financiamiento de los costos de las obras que se propongan (…)” (sic) (el énfasis no pertenece al original).
Sin embargo, no se evidencia que dichas instituciones, teniendo conocimiento de la problemática, hayan coordinado o estén coordinando su solución definitiva. La Defensoría de los Habitantes, en el oficio No. 03332-2026-DHR de 18 de marzo de 2026, puntualizó: “(…) – Tanto la Municipalidad de Limón como SENARA establecen que este sector no esta siendo valorado para intervención por lo que no existe a la fecha una solución integral futura que pueda atender la pretensión del habitante [Nombre 001] (…)” (sic).
XIII.En cuanto a las obras inconclusas. En lo que respecta a las supuestas obras inconclusas por el SENARA, se indicó: “(…) De conformidad con lo indicado en los oficios SENARA-GG-OFI-010-2026 (Atención al Oficio N.° 14884-2025-DHR) y SENARA-INDEP-PSCIAL-OFI-002-2026, remitidos a la Defensoría de los Habitantes, respecto al tramo comprendido aguas abajo del puente de Barrio Quinto, hasta la confluencia con el río Cieneguita y su desembocadura al mar se informa lo siguiente. En relación con el deslizamiento de las márgenes del río Limoncito en el tramo comprendido entre las coordenadas CRTM05 (E: 605260, N: 1104333) y (E: 605348, N: 1104383), ubicado aguas abajo del puente de Barrio Quinto, margen derecha del río Limoncito, se indica que en noviembre de 2021 se realizaron labores de limpieza del cauce. No obstante, desde su formulación, el Proyecto Sistema de Control de Inundaciones del Área Limoncito (PSCIAL) no contempló la colocación de tablestacas ni ningún otro sistema de estabilización o contención de taludes en dicho sector.
La exclusión de este tramo obedeció a criterios ambientales, técnicos y económicos, los cuales se detallan a continuación: Aspectos ambientales: La zona presenta limitaciones de carácter ambiental que restringen la ejecución de obras de infraestructura. De acuerdo con la información obtenida del Sistema Nacional de Información Territorial (SNIT), las consultas realizadas al Área de Conservación La Amistad Caribe (ACLAC) y la normativa ambiental aplicable, el tramo ubicado aguas abajo del puente de Barrio Quinto presenta una combinación de condiciones sensibles, entre ellas áreas de humedal y vegetación asociada a ecosistemas ribereños, zonas de protección de cuerpos de agua, baja pendiente hacia la desembocadura, cercanía con áreas sujetas a dinámica hídrica natural y presencia de cobertura vegetal que cumple funciones de estabilidad, amortiguamiento y protección ambiental. En particular, el sector aguas abajo del puente de Barrio Quinto hasta la confluencia con el río Cieneguita y su desembocadura al mar presenta condiciones ambientales y geomorfológicas que obligan a una valoración previa integral.
La presencia de humedales, vegetación riparia, zonas de protección legal, áreas de escasa pendiente, posibles restricciones para remoción de cobertura vegetal y la cercanía de ocupaciones humanas al cauce limitan la posibilidad de ejecutar obras de ampliación, tablestacado o contención sin estudios específicos y sin las autorizaciones ambientales correspondientes. Por tanto, la limitación ambiental no se circunscribe únicamente a la presencia de áreas ambientalmente sensibles, sino al conjunto de condiciones del sitio y al régimen jurídico aplicable a los cauces, humedales, áreas de protección, vegetación ribereña y bienes de dominio público. Cualquier intervención en ese tramo debe considerar la Ley de Aguas, la Ley Forestal, la normativa sobre humedales y las competencias del MINAE, SINAC, Dirección de Agua y demás autoridades competentes. Aspectos técnicos: Desde el punto de vista constructivo, la ejecución de obras en este sector presenta importantes limitaciones debido a la proximidad de infraestructura existente en ambas márgenes del río.
Se observan viviendas ubicadas prácticamente sobre el cauce, así como atracaderos privados y otras estructuras que reducen significativamente el espacio disponible para la operación de maquinaria, la instalación de equipos, el acopio temporal de materiales, la conformación de accesos seguros y la implementación de obras de estabilización o contención. A lo anterior se suman las características geotécnicas propias del sector. Según la línea base del EsIA, el área del proyecto se ubica sobre depósitos recientes de origen aluvial y coluvial, con presencia de arcillas de plasticidad intermedia, limos con arena, arenas medias a finas y gravas. Estos materiales, asociados a una zona de baja pendiente, alta humedad, influencia del nivel freático y cercanía al cauce, pueden presentar susceptibilidad a procesos de expansión y contracción, pérdida de resistencia por saturación, erosión superficial, socavación local y desestabilización de taludes cuando se altera la cobertura existente o se incrementan las cargas sobre la margen.
En ese contexto, el ingreso de maquinaria pesada en un espacio estrecho, con suelos saturables y márgenes ya erosionadas o intervenidas por ocupaciones humanas, podría generar riesgos adicionales: aumento de vibraciones, sobrecarga sobre bordes inestables, pérdida de confinamiento lateral, desprendimiento de material, incremento de la erosión, afectación de viviendas próximas y mayor aporte de sedimentos al cauce. Por tanto, lejos de constituir una intervención sencilla, el movimiento de maquinaria en este tramo podría agravar temporal o permanentemente las condiciones de inestabilidad existentes. Esta situación difiere sustancialmente de las condiciones existentes aguas arriba del puente de Barrio Quinto, donde sí fue posible desarrollar las intervenciones contempladas en el PSCIAL al existir condiciones de acceso, maniobrabilidad, diseño hidráulico, permisos, presupuesto y viabilidad constructiva previamente definidos dentro del alcance aprobado Aspectos económicos: Considerando las limitaciones ambientales y técnicas descritas anteriormente, así como el presupuesto aprobado para la ejecución integral del PSCIAL — tanto en su Primera Etapa, financiada mediante transferencia del Ministerio de Hacienda, como en su Segunda Etapa, financiada mediante el Contrato de Préstamo N.° 2198 del Banco Centroamericano de Integración Económica (BCIE)—, el tramo referido no fue incorporado dentro del alcance del proyecto.
La eventual intervención habría requerido expropiaciones de propiedades, reubicación de infraestructura existente, adquisición de materiales adicionales y la implementación de medidas constructivas especiales, lo que hubiera generado un incremento sustancial en los costos del proyecto. Por estas razones, dicho sector fue excluido desde la etapa de planificación y diseño del PSCIAL. Por lo anterior, no se trata de una obra inconclusa dentro del alcance del PSCIAL, sino de un tramo excluido desde la formulación técnica, ambiental, presupuestaria y contractual del proyecto. Cualquier intervención posterior en ese sector requeriría nuevos estudios técnicos, ambientales, hidráulicos, sociales y económicos, así como la definición de una fuente de financiamiento distinta o complementaria, los permisos correspondientes y la coordinación con la Municipalidad de Limón, la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, el SINAC, el Ministerio de Ambiente y Energía, el AyA y demás entidades competentes.
SENARA ha indicado, además, que está en disposición de brindar asesoramiento técnico a las instituciones competentes cuando así sea solicitado formalmente, en especial si se identifica la necesidad de valorar intervenciones provisionales o futuras fuera del alcance del PSCIAL. No obstante, la institución no cuenta con recursos propios para ejecutar obras no contempladas en el proyecto aprobado, ni puede modificar unilateralmente el alcance definido en el Contrato de Préstamo N.° 2198 BCIE sin las aprobaciones técnicas, institucionales y financieras correspondientes (…)” (sic) (el resaltado no pertenece al original).
XIV.Es posible concluir, entonces, que el SENARA no dejó obras del PSCIAL inconclusas, sino que las mismas no estaban incluidas dentro del proyecto. Se aclara al promovente que la naturaleza sumaria del recurso de amparo, ni la competencia de este Tribunal, delimitada en la Ley y la Constitución Política, permiten a esta Sala Constitucional establecer si el sector debió ser incluido o no en el proyecto en cuestión. Cualquier discusión al respecto debe ser planteada ante la Administración, o dado el caso, en la sede jurisdiccional de legalidad ordinaria.
XV.Ahora bien, del examen de la prueba aportada por el recurrente se infiere que para el momento de interposición del recurso de amparo, el promovente ya tenía conocimiento de lo expuesto, toda vez que aportó un extracto del oficio No. UTGVM-939-2025 de 7 de octubre de 2025, dirigido a la Alcaldesa de la Municipalidad de Limón, en el que la Unidad Técnica de Gestión Vial de la Municipalidad de Limón señaló: “(…) Respecto a los trabajos realizados por la empresa SENARA, en cuanto al proyecto de limpieza del Río Limoncito, y la construcción de muros de contención, ya se había gestionado ante SENARA desde el 21 de agosto de 2024, con oficio UTGVM-700-2024 (…) solicitando información específicamente del “Proyecto Sistema Control de Inundaciones Área Limoncito”, en respuesta a la solicitud de la Sra. (…) y vecinos del mismo sector (…) Por lo tanto; con oficio UTGV-005-2025 (…) de fecha 2 de enero de 2025, en respuesta al oficio AML-3867-2024, se informa respecto de la respuesta recibida SENARA-INDEP-PSCIAL-0060-2024 (…) con relación a la consulta; “si el proyecto de dragado y protección del margen del río llegaba hasta donde estaba en ese momento, o si iban a realizar una ampliación de éste”, a lo que contestaron qué: “actualmente el Proyecto Sistema Control de Inundaciones Área Limoncito, no contempla la protección con tablestaca del tramo”, debido a que; a nivel técnico se presenta una dificultad constructiva para el desarrollo del proyecto dado que existen infraestructuras muy cercanas en ambos lados al margen del río, lo que imposibilita la intervención en este tramo, y que, a nivel económico, dada la situación anterior y por efecto del monto aprobado en el préstamo para el proyecto, este tramo no fue considerado dentro del presupuesto ya que se incrementaría el costo por efecto de las expropiaciones de propiedades, maquinaria y materiales adicionales necesarios en caso de que este sector fuera incluido.
Con oficio UTGVM-789-2024 (…) del 16 de setiembre de 2024, se le entregó copia a la Sra. (…) y vecinos, del referido oficio de SENARA. Es importante indicar que se mantiene contacto con la empresa SENARA, y recientemente se recibió mediante un correo, el oficio SENARA-INDEP-PSCIAL-OFI-368-2025 (…) del 2 de octubre de 2025, en donde se nos solicitan como institución, la colaboración para aclarar algunos aspectos relacionados en el inicio próximo de labores de Intervención y mejoramiento de caminos dentro del área de influencias del “Proyecto Sistema Control de Inundaciones Área Limoncito” (…)” (sic). Así las cosas, no lleva razón el recurrente al aseverar que este punto no se había resuelto por parte de la corporación territorial
XVI.Aclaración final. No debe perderse de vista que la Municipalidad de Limón como administradora de los intereses y servicios locales (artículo 169 de la Constitución Política), e instancia ante la cual se planteó la denuncia de 17 de julio de 2025, no puede desentenderse de los problemas expuestos, y debe actuar como articulador de la intervención coordinada de la Administración, pues como se ha visto, la solución definitiva hace necesaria la integración de esfuerzos y la actuación de diversas dependencias. Esta Sala Constitucional, en la sentencia No. 2020-010630 de las 09:15 horas de 12 de junio de 2020, explicó:
“(…) COMPETENCIA MUNICIPAL Y OBLIGACIÓN DE COORDINACIÓN INTERINSTITUCIONAL. Competencia municipal y obligación de coordinación interinstitucional. El artículo 169, de la Constitución Política, dispone que "La administración de los intereses y servicios locales en cada cantón, estará a cargo del Gobierno Municipal (...)". Esta norma ha sido desarrollada por el legislador ordinario, en atención a ello, el artículo 3, del Código Municipal, Ley N° 7794 de 30 de abril de 1998, dispone que: "El gobierno y la administración de los intereses y servicios cantonales estarán a cargo del gobierno municipal". En este mismo sentido, se ha expresado la Sala Constitucional en su jurisprudencia. Verbigracia, en Sentencia N° 5445-99, de las 14:30 horas del 14 de julio de 1999, se dispuso lo siguiente:
"VI.- DE LAS ATRIBUCIONES DE LAS MUNICIPALIDADES EN RAZÓN DE LA MATERIA (CONCEPTO DE "LO LOCAL"). Por disposición constitucional expresa -artículo 169-, hay una asignación de funciones o atribuciones en favor de los gobiernos locales en razón de la materia a "lo local", sea, "la administración de los servicios e intereses" de la localidad a la que está circunscrita, para lo cual se la dota de autonomía (") De manera que sus potestades son genéricas, en tanto no hay una enumeración detallada de sus cometidos propios, sino una simple enunciación del ámbito de su competencia; pero no por ello no determinable, a lo que hizo referencia este Tribunal en sentencia número 6469-97, de las dieciséis horas veinte minutos del ocho de octubre de mil novecientos noventa y siete, en los siguientes términos:
" (...) lo local tiene tal connotación que definir sus alcances por el legislador o el juez, debe conducir al mantenimiento de la integridad de los intereses y servicios locales, de manera que ni siquiera podría el legislador dictar normativa que tienda a desmembrar el Municipio (elemento territorial), si no lo hace observando los procedimientos previamente establecidos en la Constitución Política; ni tampoco promulgar aquella que coloque a sus habitantes (población) en claras condiciones de inferioridad con relación al resto del país; ni la que afecte la esencia misma de lo local (gobierno), de manera que se convierta a la Corporación en un simple contenedor vacío del que subsista solo la nominación, pero desactivando todo el régimen tal y como fue concebido por la Asamblea Nacional Constituyente. En otro giro, habrá cometidos que por su naturaleza son municipales -locales- y no pueden ser substraídos de ese ámbito de competencia para convertirlos en servicios o intereses nacionales, porque hacerlo implicaría desarticular a la Municipalidad, o mejor aún, vaciarla de contenido constitucional, y por ello, no es posible de antemano dictar los límites infranqueables de lo local, sino que para desentrañar lo que corresponde o no al gobierno comunal, deberá extraerse del examen que se haga en cada caso concreto (...)".
De lo anterior, resalta el hecho de que, por voluntad expresa de nuestra Carta Fundamental, se asigna una competencia específica a los gobiernos locales, atribución que además es exclusiva de éstos; es decir, se trata de una competencia originaria de la municipalidad y sólo mediante una ley de nacionalización o de regionalización es que puede ser desplazada, total o parcialmente".
En consecuencia, si un grupo de munícipes, en su circunscripción territorial, sufren inundaciones con riesgo para sus vidas y graves daños patrimoniales, psicológicos, calidad de vida y bienestar general, esto se enmarca dentro del concepto de "intereses y servicios locales" del numera 169, constitucional, problemas cuyas causas tienen que ser identificadas con precisión y, más aun, las soluciones, a fin de implementarlas a la mayor brevedad posible; para lo cual corresponde a la Municipalidad coordinar con las instituciones de nivel nacional con competencia para actuar sobre el problema. En efecto, la Sala ya ha desarrollado la obligación municipal de coordinar con otras instituciones estatales en aras de atender los "intereses" y prestar cumplidamente los "servicios locales". En la citada Sentencia N° 5445-99, la Sala manifestó:
"(...) se refieren a la obligación de coordinación que debe existir entre los gobiernos locales, las instituciones descentralizadas y el Poder Ejecutivo, para llevar a cabo las funciones que le han sido encomendadas, lo que debe ser analizado a partir de la naturaleza misma de la autonomía municipal. Es en virtud de lo dispuesto en el artículo 170 constitucional, que las municipalidades (entes corporativos locales) gozan de autonomía funcional, administrativa y financiera en la administración de los intereses y servicios locales (artículo 169 de la Constitución Política) (...) No puede, entonces, crearse un conflicto por antagonismo o protagonismo entre la materia que integra el fin general de "los intereses y servicios locales" de los intereses y servicios públicos "nacionales" o "estatales", intrínsecamente distintos unos de otros, pero que en realidad están llamados a coexistir (....) Definida la competencia material de la municipalidad en una circunscripción territorial determinada, queda claro que habrá cometidos que por su naturaleza son exclusivamente municipales, a la par de otros que pueden ser reputados nacionales o estatales; por ello es esencial definir la forma de cooparticipación de atribuciones que resulta inevitable, puesto que la capacidad pública de las municipalidades es local, y la del Estado y los demás entes, nacional; de donde resulta que el territorio municipal es simultáneamente estatal e institucional, en la medida en que lo exijan las circunstancias. Es decir, las municipalidades pueden compartir sus competencias con la Administración Pública en general, relación que debe desenvolverse en los términos como está definida en la ley (artículo 5 del Código Municipal anterior, artículo 7 del nuevo Código), que establece la obligación de "coordinación" entre la municipalidades y las instituciones públicas que concurran en el desempeño de sus competencias, para evitar duplicaciones de esfuerzos y contradicciones, sobre todo, porque sólo la coordinación voluntaria es compatible con la autonomía municipal por ser su expresión. En otros términos, la municipalidad está llamada a entrar en relaciones de cooperación con otros entes públicos, y viceversa, dado el carácter concurrente o coincidente -en muchos casos-, de intereses en torno a un asunto concreto. En la doctrina, la coordinación es definida a partir de la existencia de varios centros independientes de acción, cada uno con cometidos y poderes de decisión propios, y eventualmente discrepantes; pese a ello, debe existir una comunidad de fines por materia, pero por concurrencia, en cuanto sea común el objeto receptor de los resultados finales de la actividad y de los actos de cada uno". De manera que la coordinación es la ordenación de las relaciones entre estas diversas actividades independientes, que se hace cargo de esa concurrencia en un mismo objeto o entidad, para hacerla útil a un plan público global, sin suprimir la independencia recíproca de los sujetos agentes. Como no hay una relación de jerarquía de las instituciones descentralizadas, ni del Estado mismo en relación con las municipalidades, no es posible la imposición a éstas de determinadas conductas, con lo cual surge el imprescindible "concierto" interinstitucional, en sentido estricto, en cuanto los centros autónomos e independientes de acción se ponen de acuerdo sobre ese esquema preventivo y global, en el que cada uno cumple un papel con vista en una misión confiada a los otros".
Adviértase, por lo demás, que las Municipalidades están obligadas, por imperativo del ordinal 50, de la Constitución Política, a prodigarse en la protección del ambiente (Sentencia N° 2006-7994 de las 8:57 horas de 2 de junio de 2006) (…)” (sic) (reiterado en la sentencia No. 2026-05217 de las 09:34 horas de 13 de febrero de 2026) (el énfasis no pertenece al original).
XVII.Conclusión. Bajo estas circunstancias se impone declarar parcialmente con lugar el recurso, con las consecuencias que se especifican en la parte dispositiva de esta sentencia, por: a) la falta de atención y resolución definitiva, conforme a Derecho corresponda, por parte de la Municipalidad de Limón, de la denuncia planteada por el recurrente el 17 de julio de 2025 (carreteras en mal estado, y el ingreso de aguas negras en la comunidad, todo esto en Barrio Quinto, específicamente en“(…) la comunidad ubicada detrás de la Feria del Agricultor, cruzando el puente a mano izquierda y hasta colindar con el barrio los cocos (…)” (sic)); y b) la falta de atención y resolución definitiva, conforme a Derecho corresponda, por parte de la Municipalidad de Limón y el SENARA, del problema de erosión de las orillas del Río Limoncito, que pone en peligro varias casas y la vida de los habitantes de la comunidad de Barrio Quinto (luego del puente de la localidad hasta el puente de los Cocos, según especificó el recurrente en el escrito de interposición), conforme fue puesto en conocimiento por la Defensoría de los Habitantes al tramitar una gestión formulada por el promovente.
XVIII.Nota del magistrado Castillo Víquez, en cuanto a la justicia administrativa pronta y cumplida. He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales.
A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia. Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.
XIX.Nota del magistrado Salazar Alvarado. En tesis de principio, considero que los casos relacionados con la inactividad de la Administración Pública en la reparación, construcción, modificación o demolición de cualquier obra de infraestructura, deben ser desestimados, por constituir, esa omisión, un tema de legalidad, cuya discusión corresponde a la jurisdicción ordinaria, ante la cual la persona interesada puede debatir, con mayor amplitud, sus disconformidades. Sin embargo, cuando de aquella conducta administrativa omisiva se derive alguna violación a otros derechos fundamentales tutelados en esta jurisdicción constitucional, o se afecten grupos considerados vulnerables, sí entro a conocer el fondo del asunto, por constituir esta situación una excepción a mi posición en esta materia, tal y como sucede en este caso, en que se reclama, la falta de respuesta a una denuncia por la omisión de la Municipalidad de Limón y el Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA) de continuar con la ejecución del proyecto de control de inundaciones a partir del puente de Barrio Quinto, situación que genera problemas de contaminación por aguas fecales, erosión de las orillas del Río Limoncito con riesgo para varias casas y la vida de los habitantes, así como, daños en la carretera y dificultad en el tránsito de personas con movilidad reducida y menores de edad.
XX.Voto salvado parcial de la magistrada Garro Vargas respecto a la parte dispositiva de esta sentencia. Si bien coincido con la mayoría de la Sala en que el recurso se debe declarar con lugar, difiero sobre dónde residenciar la fase de ejecución del asunto, debido a la inexistencia de mecanismos adecuados previstos por la normativa que rige esta jurisdicción constitucional para dar seguimiento a una sentencia que reviste aspectos técnicos de cierta complejidad, como es en este caso que, en los plazos de seis y doce meses, contado a partir de la notificación de esta sentencia, la Municipalidad de Limón debe resolver, respectivamente, las carreteras en mal estado y el ingreso de aguas negras por desbordamiento en la comunidad de barrio Quinto, así como se ordena a ese ayuntamiento y a SENARA resolver en el plazo de dieciocho meses el problema de erosión de las orillas del río Limoncito. En cambio, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (artículo 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el artículo 56 de la Ley de Jurisdicción Constitucional, estimo que la fase de ejecución respecto a esa orden debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.
XXI.Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 de 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial número 19 de 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.
Por tanto:
Se declara parcialmente con lugar el recurso, por: a) la falta de atención y resolución definitiva, conforme a Derecho corresponda, por parte de la Municipalidad de Limón, de la denuncia planteada por el recurrente el 17 de julio de 2025 (carreteras en mal estado, y el ingreso de aguas negras en la comunidad, todo esto en Barrio Quinto, específicamente en la “(…) la comunidad ubicada detrás de la Feria del Agricultor, cruzando el puente a mano izquierda y hasta colindar con el barrio los cocos (…)” (sic)); y b) la falta de atención y resolución definitiva, conforme a Derecho corresponda, por parte de la Municipalidad de Limón y el SENARA, del problema de erosión de las orillas del Río Limoncito, que pone en peligro varias casas y la vida de los habitantes de la comunidad de Barrio Quinto (luego del puente de la localidad hasta el puente de los Cocos, según especificó el recurrente en el escrito de interposición), conforme fue puesto en conocimiento por la Defensoría de los Habitantes al tramitar una gestión formulada por el promovente.
Se ordena a Ana Matarrita McCalla y a Yerlin Aguilar Brenes, en sus calidades respectivas de Alcaldesa y Coordinadora de la Unidad Técnica de Gestión Vial, ambas de la Municipalidad de Limón, o a quienes en sus lugares ocupen esos cargos, girar las órdenes pertinentes y llevar a cabo todas las actuaciones que estén dentro del ámbito de sus competencias para que dentro del plazo de SEIS MESES, contado a partir de la notificación de esta sentencia, se resuelva en definitiva y conforme a Derecho corresponda la denuncia planteada por el recurrente el 17 de junio de 2025, en lo relativo a las carreteras en mal estado, en la comunidad de Barrio Quinto, específicamente en “(…) la comunidad ubicada detrás de la Feria del Agricultor, cruzando el puente a mano izquierda y hasta colindar con el barrio los cocos (…)” (sic), (caminos Nos. 7-01-810, y 7-01-811). Se ordena a Ana Matarrita McCalla, en su condición de Alcaldesa de la Municipalidad de Limón, o a quien en su lugar ocupe ese cargo, girar las órdenes pertinentes y llevar a cabo todas las actuaciones que estén dentro del ámbito de sus competencias para que, dentro del plazo de DOCE MESES, contado a partir de la notificación de esta sentencia, se resuelva en definitiva y conforme a Derecho corresponda, la denuncia planteada por el promovente el 17 de junio de 2025, en lo atinente al ingreso de aguas negras por desbordamiento en la comunidad de Barrio Quinto, específicamente en“(…) la comunidad ubicada detrás de la Feria del Agricultor, cruzando el puente a mano izquierda y hasta colindar con el barrio los cocos (…)” (sic).
Se ordena a Ana Matarrita McCalla, en su condición de Alcaldesa de la Municipalidad de Limón, así como a Juan Gabriel Ramírez Guillén y a Osvaldo Quirós Arias, en sus calidades respectivas de Ministro de Agricultura y Ganadería y Presidente de la Junta Directiva, así como Gerente General, ambos del Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA), o a quienes en sus lugares ocupen esos cargos, que lleven a cabo todas las actuaciones dentro del ámbito de sus competencias, y coordinen lo pertinente para que, dentro del plazo de DIECIOCHO MESES, contado a partir de la notificación de esta sentencia, se resuelva en definitiva y conforme a Derecho corresponda, el problema de erosión de las orillas del Río Limoncito, que pone en peligro varias casas y la vida de los habitantes de Barrio Quinto (luego del puente de la localidad hasta el puente de los Cocos, según especificó el recurrente en el escrito de interposición).
Se advierte a las autoridades recurridas que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Limón y al Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA) al pago de las costas, daños y perjuicios ocasionados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. El magistrado Castillo Víquez pone nota. El magistrado Salazar Alvarado pone nota. La magistrada Garro Vargas salva el voto respecto a la ejecución de esta sentencia en cuanto a lo ordenado en el punto iii) y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución, establecidos en los artículos 155 y siguientes del Código Procesal Contencioso Administrativo. Asimismo, ordena que se le remita copia de la sentencia para que se inicie los procedimientos de ejecución de este fallo. En lo demás se declara sin lugar el recurso. Notifíquese.
