  1. 1By written petition submitted through the Online Management System (Gestión en Línea) at 14:57 hours on June 17, 2026, the petitioners request that EXECUTIVE DECREE No. 45019-S, ENTITLED "REFORMA REGLAMENTO PARA LA CALIDAD DEL AGUA POTABLE," specifically its Articles 1 and 2, be declared unconstitutional, on the grounds that those provisions conflict with Articles 21 and 50 of the Political Constitution, as well as with the constitutional block (bloque de constitucionalidad) applicable to the human right to drinking water, health, life, and a healthy and ecologically balanced environment. They allege that Executive Decree No. 45019-S amends the Reglamento para la Calidad del Agua Potable, contained in Executive Decree No. 38924-S of January 12, 2015. Specifically, Article 1 of the challenged decree reforms Table 5 of Anexo 1 of those Regulations and adds a new Table 6, while Article 2 amends Article 4 of the Regulations with respect to definitions and acronyms.Under the prior regulatory regime, the presence of pesticides (plaguicidas) or metabolites (metabolitos) in drinking water at a concentration equal to or exceeding 0.10 µg/L operated as a Maximum Admissible Value (Valor Máximo Admisible), the exceedance of which caused the water to no longer be considered suitable for human consumption. The challenged rule reclassifies that threshold as a mere Alert Value (Valor de Alerta), which no longer automatically triggers a prohibition on water distribution, but instead activates a subsequent phase of administrative risk evaluation and management. Regarding the preceding regulatory framework for chlorothalonil, the petitioners note that through Resolution No. 2023-013384, this Chamber determined that the regulation of chlorothalonil must be analyzed under a heightened constitutional standard of environmental protection, public health, and the precautionary principle (principio precautorio), given that it is a persistent fungicide (fungicida) that degrades into multiple mobile metabolites—between seven and twenty distinct documented compounds—classified by the International Agency for Research on Cancer as a probable human carcinogen (Group 2B), with possible effects as an endocrine disruptor (perturbador endocrino), causing damage to embryonic development, and exhibiting high toxicity to fish and aquatic invertebrates. On the basis of that resolution, Executive Decree No. 44280-S-MAG-MINAE of October 24, 2023, ordered the absolute prohibition on the registration, importation, exportation, manufacture, formulation, storage, distribution, transportation, repackaging, rebottling, handling, sale, mixing, and use of raw materials or formulated products containing chlorothalonil.

The petitioners argue that Executive Decree No. 45019-S, issued two years later, is regressive and contradictory with respect to that level of protection, as it establishes risk-adjusted maximum admissible values for chlorothalonil metabolites in drinking water of up to 80 µg/L. They raise three grounds of unconstitutionality. First, they allege a violation of the right to health and the right to life recognized in Article 21 of the Political Constitution, on the grounds that the reform replaces a preventive standard of excluding contaminated water with a model of ex post risk management, permits the distribution of water with concentrations of pesticides or metabolites exceeding those previously admitted, and reduces the legal and public health certainty of the consuming population, without the State having demonstrated, on a sufficient and verifiable scientific basis, that the new standard does not diminish the health protection previously guaranteed.

In support of their argument, they cite Resolution No. 4555-2009 of the Constitutional Chamber, which holds that the right to health derives from Article 21 of the Constitution and must be interpreted broadly, progressively, and expansively, and that public authorities are obligated to provide positive measures to guarantee the conditions necessary to prevent, treat, and restore health. Second, they allege a violation of the human right to safe drinking water recognized in Article 50 of the Constitution, insofar as the reform replaces a potability limit with a merely preventive value; inverts the preventive logic required by the human right to water by shifting from a system of anticipatory exclusion of contaminated water to a model of administrative tolerance; compromises the State's duty to guarantee the purity of water sources and ecological integrity; disregards the priority of human consumption, since continuity of supply cannot prevail over the safety of water; constitutes a regressive measure in the area of fundamental rights; and weakens the State's obligations to respect, protect, and fulfill the right to water in accordance with General Comment No. 15 of the Committee on Economic, Social and Cultural Rights (Comité DESC), incorporated into the constitutional block by means of Resolution No. 9354-2024 of this Chamber.

Third, they allege an infringement of the precautionary principle, the non-regression principle (principio de no regresión), and the principle of objectification of environmental protection (principio de objetivación de la tutela ambiental), all derived from Article 50 of the Constitution. Regarding the precautionary principle, they argue that the reform inverts its logic by allowing scientific uncertainty about the cumulative and chronic effects of chlorothalonil metabolites to be used to raise the tolerance threshold, rather than to reinforce protection. They cite Resolutions No. 024807-2021 and No. 14917-2026 of this Chamber, as well as Advisory Opinion 32 of 2025 of the Inter-American Court of Human Rights, which links the protection of nature to the effective realization of human rights and recognizes that the prohibition of conduct capable of generating massive or irreversible environmental damage constitutes a norm of jus cogens.

Regarding the non-regression principle, they argue that the challenged rule reduces the level of protection previously achieved through Resolution No. 2023-013384 and Executive Decree No. 44280-S-MAG-MINAE, without sufficient technical and scientific justification, in contravention of Resolution No. 12746-2019 of this Chamber. Regarding the principle of objectification of environmental protection, they argue that the recitals of Executive Decree No. 45019-S do not establish that the new admissible values guarantee a level of protection equal to or higher than the one previously in force, nor that the risks associated with chlorothalonil and its metabolites—recognized by this Chamber and by Decree No. 44280-S-MAG-MINAE—have been scientifically ruled out or reduced. They further note that the technical studies referenced in the administrative file—prepared by PAHO (OPS) and the Ministerio de Salud—only establish tolerable intake levels for human health under a risk-management approach, without demonstrating that the new standard is equivalent to or higher than the absolute prohibition previously in effect.

They request that the Chamber declare Articles 1 and 2 of Executive Decree No. 45019-S unconstitutional, with the consequent annulment of the challenged provisions, on the grounds that they constitute an unjustified and regressive reduction of the level of fundamental rights protection with respect to drinking water, health, life, and a healthy environment.

  1. 2For purposes of admissibility, the petitioners state that they derive their standing from Article 75, second paragraph of the Ley de la Jurisdicción Constitucional, insofar as they invoke diffuse interests (intereses difusos) linked to the human right to drinking water, the right to health, and the right to a healthy and ecologically balanced environment. They maintain that the challenged rule does not affect only specific individuals, but rather the entire population of water consumers and the integrity of water resources as a common environmental good, which falls within the category of diffuse interests recognized by this Chamber in Resolution No. 04423-1993 and in Article 50 of the Constitution.
  2. 3Pending before this same Chamber is constitutional challenge No. 25-023487-0007-CO, which challenges the same decree that is the subject of the present proceedings. That action was admitted by resolution issued at 16:01 hours on September 4, 2025, and the first publication of the notice referred to in Article 84 of the Ley de la Jurisdicción Constitucional was made in the Boletín Judicial No. 170 on September 11, 2025.

Considering:

Considerando I.- Pursuant to Article 84 of the Ley de la Jurisdicción Constitucional, if, after a constitutional challenge has been filed and before the publication of the corresponding notice, other actions are brought against the same law, decree, provision, agreement, or resolution, the later actions shall be consolidated with the first and treated as supplements thereto. Actions filed in that capacity by parties to the suspended proceedings shall also be consolidated, provided they are submitted within fifteen days following the first publication of the legal notice. However, actions filed after that deadline shall be held in abeyance until those previously filed have been resolved.

Considerando II.- As is evident from the account set forth in the recitals above, the present action was filed after the fifteen-business-day period following the first publication of the notice corresponding to the filing of constitutional challenge No. 25-23487-0007-CO (September 11, 2025) had elapsed. Consequently, the provision set forth in the final clause of the aforementioned Article 84 is fully applicable, and the proceedings must be suspended until the first action is resolved.

Alegan que el Decreto Ejecutivo N.° 45019-S modifica el Reglamento para la Calidad del Agua Potable, contenido en el Decreto Ejecutivo N.° 38924-S del 12 de enero de 2015. Los accionantes aportan como antecedentes relevantes casos documentados de contaminación de fuentes de agua por agroquímicos en distintas zonas del país: en Siquirres, donde desde 2007 aproximadamente seis mil personas consumieron agua contaminada con bromacil, diurón y triadimefón provenientes de plantaciones piñeras; en la Zona Norte, donde el CICA-UCR identificó bromacil en concentraciones superiores al límite reglamentario en aguas subterráneas, lo que llevó al cierre preventivo de nacientes en comunidades abastecidas por ASADAS de Río Cuarto; y en Cartago, donde en octubre de 2024 el Ministerio de Salud detectó metabolitos de clorotalonil por encima del límite máximo permitido en cuatro de setenta y cinco fuentes analizadas en la Zona Norte, afectando a aproximadamente setecientas personas y motivando órdenes sanitarias de restricción al consumo.

En cuanto al marco normativo precedente sobre el clorotalonil, señalan que mediante la Resolución N.° 2023-013384, esta Sala determinó que la regulación del clorotalonil debe analizarse bajo un estándar constitucional reforzado de protección ambiental, salud pública y principio precautorio, por tratarse de un fungicida persistente que se degrada en múltiples metabolitos móviles —entre siete y veinte compuestos distintos documentados—, clasificado por la Agencia Internacional para la Investigación sobre el Cáncer como probable carcinógeno humano (Grupo 2B), con posibles efectos como perturbador endocrino, daños al desarrollo embrionario y alta toxicidad para peces e invertebrados acuáticos. Con fundamento en esa resolución, el Decreto Ejecutivo N.° 44280-S-MAG-MINAE del 24 de octubre de 2023 dispuso la prohibición absoluta del registro, importación, exportación, fabricación, formulación, almacenamiento, distribución, transporte, reempaque, reenvase, manipulación, venta, mezcla y uso de materia prima o productos formulados que contengan clorotalonil.

Los accionantes consideran que el Decreto Ejecutivo N.° 45019-S, emitido dos años después, resulta regresivo y contradictorio respecto de ese nivel de protección, al establecer valores máximos admisibles ajustados por riesgo para metabolitos de clorotalonil en agua potable de hasta 80 µg/L. Invocan tres motivos de inconstitucionalidad. En primer lugar, alegan vulneración al derecho a la salud y a la vida reconocido en el artículo 21 de la Constitución Política, por cuanto la reforma sustituye un estándar preventivo de exclusión del agua contaminada por un modelo de gestión posterior del riesgo, permite la distribución de agua con concentraciones de plaguicidas o metabolitos superiores a las previamente admitidas y reduce la certeza jurídica y sanitaria de la población consumidora, sin que el Estado haya demostrado, con base científica suficiente y verificable, que el nuevo estándar no disminuye la protección sanitaria previamente garantizada.

Citan en apoyo a su tesis, la resolución N.° 4555-2009 de la Sala Constitucional, que establece que el derecho a la salud deriva del artículo 21 constitucional y debe interpretarse de manera amplia, progresiva y expansiva, y que los poderes públicos están en la obligación de brindar prestaciones positivas para garantizar las condiciones necesarias para prevenir, tratar y restablecer la salud. En segundo lugar, alegan violación al derecho humano al agua potable segura reconocido en el artículo 50 constitucional, en tanto sustituye un límite de potabilidad por un valor meramente preventivo; invierte la lógica preventiva que exige el derecho humano al agua, al pasar de un sistema de exclusión anticipada del agua contaminada a un modelo de tolerancia administrativa; compromete el deber estatal de garantizar la pureza de las fuentes y la integridad ecológica; desatiende la prioridad del consumo humano, pues la continuidad del suministro no puede prevalecer sobre la inocuidad del agua; configura una medida regresiva en materia de derechos fundamentales; y debilita las obligaciones estatales de respetar, proteger y cumplir el derecho al agua conforme a la Observación General N.° 15 del Comité DESC, incorporada al bloque de constitucionalidad mediante la resolución n.° 9354-2024 de esta Sala.

En tercer lugar, alegan lesión al principio de precaución, al principio de no regresión y al principio de objetivación de la tutela ambiental, todos derivados del artículo 50 constitucional. Respecto del principio precautorio, argumentan que la reforma invierte su lógica al permitir que la incertidumbre científica sobre los efectos acumulativos y crónicos de los metabolitos de clorotalonil sea utilizada para elevar el umbral de tolerancia, en lugar de reforzar la protección. Citan las resoluciones N.° 024807-2021 y N.° 14917-2026 de esta Sala, así como la Opinión Consultiva 32 de 2025 de la Corte Interamericana de Derechos Humanos, que vincula la protección de la naturaleza con la vigencia efectiva de los derechos humanos y reconoce que la prohibición de conductas capaces de generar daños ambientales masivos o irreversibles constituye una norma de jus cogens. En cuanto al principio de no regresión, señalan que la norma impugnada reduce el nivel de protección previamente alcanzado mediante la sentencia n.° 2023-013384 y el Decreto Ejecutivo N.° 44280-S-MAG-MINAE, sin justificación técnico-científica suficiente, lo que contraviene la resolución n.° 12746-2019 de esta Sala.

Respecto del principio de objetivación de la tutela ambiental, argumentan que los considerandos del Decreto Ejecutivo N.° 45019-S no acreditan que los nuevos valores admisibles garanticen un nivel igual o superior de protección al previamente vigente, ni que los riesgos del clorotalonil y sus metabolitos reconocidos por esta Sala y por el Decreto N.° 44280-S-MAG-MINAE hayan sido descartados o disminuidos científicamente. Agregan que los estudios técnicos referenciados en el expediente —elaborados por la OPS y el Ministerio de Salud— únicamente acreditan ingestas tolerables para la salud humana bajo un enfoque de gestión de riesgo, sin demostrar que el nuevo estándar resulte equivalente o superior al de la prohibición absoluta anteriormente vigente. Solicitan a la Sala que declare la inconstitucionalidad de los artículos 1 y 2 del Decreto Ejecutivo N.° 45019-S, con la consecuente anulación de las disposiciones impugnadas, por configurar una reducción regresiva e injustificada del nivel de protección de los derechos fundamentales al agua potable, la salud, la vida y el ambiente sano.

  1. 2Para efectos de admisibilidad, señalan que derivan su legitimación del artículo 75, párrafo segundo de la Ley de la Jurisdicción Constitucional, en tanto invocan intereses difusos vinculados con el derecho humano al agua potable, el derecho a la salud y el derecho a un ambiente sano y ecológicamente equilibrado. Sostienen que la norma impugnada no afecta únicamente a personas determinadas, sino a la totalidad de la población consumidora de agua y a la integridad de los recursos hídricos como bien ambiental común, lo que encuadra en la categoría de intereses difusos reconocidos por esta Sala en la Resolución N.° 04423-1993 y en el artículo 50 constitucional.
  2. 3Ante esta misma Sala pende la acción de inconstitucionalidad número 25-023487-0007-CO, en la que se impugna el mismo decreto que es objeto de cuestionamiento en el sub examine. A esta acción se le dio curso por resolución de las 16:01 horas del 4 de setiembre de 2025 y la primera publicación del aviso, a que hace referencia el artículo 84 de la Ley de la Jurisdicción Constitucional, se realizó en el Boletín Judicial n°. 170 del 11 de setiembre de 2025.

Redacta el Magistrado Castillo Víquez; y,

Considerando:

I.De conformidad con el numeral 84 de la Ley de la Jurisdicción Constitucional, si después de interpuesta una acción de inconstitucionalidad y antes de la publicación del aviso respectivo se presentaren otras acciones contra la misma ley, decreto, disposición, acuerdo o resolución, las segundas se acumularán a la primera y se tendrán como ampliación. También se acumularán las acciones que con ese carácter interpongan las partes de los juicios suspendidos, si fueren presentadas dentro de los quince días posteriores a la primera publicación del edicto de ley. No obstante, las acciones que se planteen después de ese plazo se dejarán en suspenso, mientras se resuelven las que hubieren sido presentadas anteriormente.

II.Como se desprende de lo relatado en la parte de resultandos supra, la presente demanda ingresó una vez transcurrido el plazo de quince días hábiles luego de la publicación del primer aviso correspondiente a la interposición de la acción de inconstitucionalidad número 25-23487-0007-CO (11 de setiembre de 2025). En consecuencia, resulta plenamente aplicable lo indicado en el citado artículo 84 in fine, debiéndose suspender el trámite hasta que se resuelva la primera gestión.

Por tanto:

Se reserva el dictado de la sentencia de esta acción hasta tanto no sea resuelta la que bajo expediente número 25-023487-0007-CO se tramita ante esta Sala.
