Document Review CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours and twenty-five minutes on the second of July of two thousand and twenty-six.
Constitutional protection action (recurso de amparo) filed by [Nombre 001], national identification number [Valor 001], against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS and the MUNICIPALIDAD DE DESAMPARADOS (ICAA).
Findings:
"[H]e is an alternate council member (regidor suplente) of the Municipal Corporation of Desamparados and a resident of the community of San Rafael Abajo de Desamparados. He states that in the Plaza Higuerones area of San Rafael Abajo de Desamparados, a serious sewage (aguas negras) leak has existed for months—that is, contaminated sewer water that generates an intense number of flies and mosquitoes, as well as a tremendously nauseating odor, which is causing health problems not only for him but for the entire community. He states that despite the foregoing, multiple complaints have been filed with both the respondent institute and the municipal corporation without receiving any positive response. He recounts that, with regard to AYA, reference may be made to service order No. 53436437, order 54224292, and order 47990522, through which the relevant complaints were filed with that institution, but the general result has been that the matter falls within municipal competence. He adds that with regard to the Municipalidad de Desamparados, the case has been channeled through the municipal trustee (síndico municipal), Lizandro Porras Calderón, who has managed to speak with municipal corporation officials and technicians, and they have told him that the matter falls to AYA, that they have even intervened in the area and that the work pertains to that institution. He states that as a resident of the area and a directly affected party, he finds himself in a situation of absolute defenselessness on the part of both institutions, since they pass responsibility for the problem back and forth and neither one resolves it; this problem has been ongoing for months and is causing harm to his health and to all citizens—they face an extremely serious public health issue that grows worse day by day. He states that the conduct of both institutions is violating multiple constitutional principles, such as those of efficiency and effectiveness, full legal certainty, rationality and proportionality, prohibition of arbitrariness, legal security (seguridad jurídica), as well as Article 50 of the Constitution relating to a balanced environment" (sic).
"The alleged violation of fundamental rights put forward by the petitioner is rejected in its entirety, on the basis of the following facts.
1- As can be clearly observed from the filing of the constitutional protection action, the petitioner limits himself to submitting photographs from which it is not possible to determine the exact location of the problem, in order to ascertain whether we are dealing with a situation occurring on a national highway (carretera nacional) or a canton road (calle cantonal), since he merely states that it is in the Plaza Higuerones area of San Rafael Abajo de Desamparados, which has both national and canton roads.
2- There is no request for processing before this Mayor's Office regarding the reported matter through the appropriate channels, such as the official email address [email protected] or the service platform, from which neither the council member nor the municipal trustee is exempt. Nor does he indicate with which official he spoke, nor does he demonstrate that any proceeding regarding the reported matter was left unattended by the Municipality, which renders a ruling against this Municipality premature, at least at the procedural stage.

While it is true that Article 169 of the Political Constitution provides that Municipalities have the duty and stewardship of local interests, it clearly differentiates the technical and legal competences belonging to other specialized institutions where there is no certainty that the problem stems from municipal infrastructure. For this reason, the Municipality, in observance of the principles of inter-institutional coordination, protection of public health, and stewardship of local interests and services set forth in the Municipal Code and the Political Constitution, remains disposed to collaborate and manage the necessary actions to address any situation that may eventually affect the residents of the canton. Nevertheless, the facts set forth in this action do not precisely indicate whether the alleged sewage leak originates from infrastructure located on a canton road or a national road, nor whether it corresponds to sanitary sewer networks (redes de alcantarillado sanitario) administered by specialized state entities.
The national legal system assigns specific technical competences in the areas of sanitary sewerage, wastewater (aguas residuales), sanitation (saneamiento), and sanitary control to institutions such as the Instituto Costarricense de Acueductos y Alcantarillados and the Ministry of Health, entities that possess specialized regulatory, technical, and operational authority in such matters.
Consequently, even though this Municipality maintains a general duty of collaboration and coordination for addressing problems affecting the canton, determining the origin of the leak, the ownership of the infrastructure, and the substantive competence to carry out corrective works requires the participation and technical opinion of the competent national institutions, and above all, the precise location of the incident.
In addition to the foregoing, the territorial and local management competence of the Municipality does not extend universally over the entire sanitary network existing in the canton. AyA administers sanitary sewer systems in multiple sectors of the country. The Ministry of Health holds sanitary surveillance competences and sanitary orders; if the exact origin of the leak is unknown, responsibility cannot automatically be attributed to the Municipality, especially where no concrete proceeding exists through official channels—since the petitioner has made no request whatsoever through the Municipality's official channels to address the matter presented—and therefore I respectfully request that the constitutional protection action be declared without merit with respect to this Municipality, as at the procedural stage it is not possible to pinpoint the exact location, no pending proceeding exists at this Municipality, and it has not been established whether there is a sanitary sewer system, whether the wastewater disposal system consists of a septic tank (tanque séptico) and its corresponding drainage, or whether some residents are discharging their wastewater into informal drainage channels (caños artesanales) or stormwater channels (canales pluviales), thereby producing contamination.

Based on the foregoing, I respectfully request that this Honorable Court declare the present constitutional protection action without merit, as my represented institution has not violated any constitutional right."

Response to the facts:
SOLE FINDING: Memorandum DRyT-MCER-2026-00161, which transmits the PLAZA HIGUERONES Report, Responsible Area: Civil and Electromechanical Maintenance DRyT GAM (which also annexes DRyT-OMSR-2025-00777 and DRyT-OMSR-2025-00849), prepared by the Civil and Electromechanical Maintenance Area of the Collection and Treatment Directorate GAM, determines that the problem reported as an overflow of water onto the public roadway in front of Plaza Higuerones bears no relation to the sanitary sewer system administered by AyA, but rather originates in stormwater infrastructure.
The field inspections conducted confirm that the sanitary sewer network constructed by AyA in the eastern sector of Plaza Higuerones is provisioned, without user connections and out of service, and therefore presents no blockages, damage, or spillage onto the roadway. The manholes (pozos de registro) associated with this network were verified to be dry, with no presence of wastewater, ruling out AyA as the source of the reported overflow.
On the contrary, the point where the overflow manifests corresponds to a well in the stormwater network (red pluvial), which does not form part of AyA's assets, does not coincide with the alignment of the institutional sanitary network, and presents construction characteristics typical of municipal infrastructure. Consequently, its administration, maintenance, and remediation are the responsibility of the Municipalidad de Desamparados, given that stormwater networks do not fall within AyA's competence.
It is hereby placed on record that the Instituto Costarricense de Acueductos y Alcantarillados (AyA) diligently and promptly attended to the proceedings associated with the case through the execution of service orders No. 53436437, No. 54224292, and No. 47990522, carrying out the corresponding technical field verifications. These responses made it possible to ascertain the state of the existing sanitary infrastructure, rule out impacts attributable to the sanitary sewer network administered by AyA, and ensure an adequate institutional response to the reports received, in accordance with its technical and operational competences." It is important to highlight that this conclusion is not new, as the matter was previously addressed in 2025 and the Municipalidad de Desamparados was formally and timely notified through official letters DRyT-OMSR-2025-00777, dated October 29, 2025, and DRyT-OMSR-2025-00849, dated November 26, 2025, in which it was indicated that AyA's sanitary sewer network in the area was not in use, that the manhole exhibiting overflow did not correspond to institutional sanitary infrastructure, and that the origin of the event should be assessed by the Municipalidad, as it involved a stormwater drainage system (sistema pluvial).
In summary, the technical report reaffirms that the problem observed in front of Plaza Higuerones is a consequence of the operation or condition of the stormwater drainage system, the management of which falls within municipal competence, and that the Municipalidad had been in possession of this information since 2025, without any responsibility attributable to AyA having been established with respect to the generation of the overflow.

Following the site visit conducted on Friday, May 8, the following was observed:
1. AyA's sanitary sewer network (red de alcantarillado sanitario) constructed on the eastern side of Plaza Higuerones is currently not in use and is provisioned, and therefore does not present obstructions or spillage onto the road. (attached manhole data) (…)

Conclusions
1. The sanitary sewer network located to the east of Plaza Higuerones, constructed by AyA, is provisioned and not in use, and as of today presents no damage, has no connected users, and presents no water spillage onto the road.
2. The manhole observed on the road with water spillage is a stormwater manhole administered by the Municipalidad de Desamparados.
3. The matter had already been forwarded to the Municipalidad de Desamparados through official letters DRyT-OMSR-2025-00777 and DRyT-OMSR-2025-00849 addressed to Mr. Walter Mena G.

It is important to note that in Costa Rica there are two separate sewer systems: one called the "Stormwater Drainage System" (Sistema de Alcantarillado Pluvial), whose purpose is to convey rainwater from rooftops, gutters, and downspouts of dwellings, as well as rainwater running along public roads; and the other system, called the "Sanitary Sewer System" (Sistema de Alcantarillado Sanitario), whose purpose is exclusively to convey wastewater from sinks, kitchen drains, showers, and toilets generated inside dwellings.
Under current regulations, stormwater drainage systems are administered by the municipal government (municipalidad) of each canton, and the sanitary sewer system is operated and maintained by the service provider responsible for supplying potable water within its respective geographic service area. In accordance with the Código Municipal and the Ley General de Salud, municipalities have competence to receive and administer sanitation systems including treatment plants.
Local governments (Gobiernos Locales), for their part, have the authority to impose a range of restrictions on construction and development projects through urban planning, and it is worth noting that in cases of non-compliance with the conditions they order, they possess a series of coercive mechanisms to enforce their mandates — mechanisms that AyA lacks. In addition to the foregoing, it is clear that municipalities are the entities that collect the corresponding fees for the maintenance and proper functioning of the stormwater drainage network, as provided in Código Municipal No. 7794, Title IV, Municipal Treasury, Chapter II, Municipal Revenues.
In the present case, it must not be overlooked that when municipalities collect municipal taxes they include the corresponding item for maintenance and operation of the stormwater drainage network, which underscores municipal competence in this field, and it is further evident that this item should be applied to the maintenance and operation of each municipality's stormwater drainage network, as indicated by the Sala Constitucional in Voto 2001-2320, Considerando IV, which reads verbatim:
"IV.- In light of the foregoing, and based on what is set forth in the above-cited Law and on municipal competence by reason of subject matter, this Constitutional Tribunal finds that the entity that should have addressed the complaint filed by the petitioner in defense of the right to health was the Municipalidad de Alajuelita — not solely because the matter at issue falls within the 'local interest' of its canton, but also because, according to Acueductos y Alcantarillados, that municipal body is responsible for administering the stormwater drainage system (alcantarillado pluvial) where the deficiency exists. As for the actions of the respondent Institute, the Court does not find it to bear any responsibility for the violation of the fundamental rights of Mr. Cruz Vega, since, while it is true that as the autonomous governing body in this field it has a duty to resolve problems arising in connection with the supply of potable water, the collection and disposal of sewage and stormwater in urban areas, it is equally true that this is a priority duty of the municipalities when, as in the present case, they have responsibility for administering the water supply and sewer systems of the canton; or when, as also occurs here, the problem to be solved involves the protection of fundamental rights whose remedy does not require specialized or technical knowledge that only a specific body could provide.
For this reason, the petition must be granted, on account of the violation of the right to health committed by the Municipalidad de Alajuelita to the detriment of the petitioner…" (Emphasis not in the original) Likewise, Ley General de Salud No. 5395, specifically with respect to the matter at hand, provides in Articles 285 and 292 as follows:
"ARTICLE 292.- The discharge of sewage (aguas negras), greywater (aguas servidas), and industrial waste into the stormwater drainage system (alcantarillado pluvial) is prohibited in all cases. The Ministry is authorized to restrict, regulate, or prohibit the disposal of non-biodegradable synthetic products through waste and sewage collection systems.
ARTICLE 285.- Excreta, sewage, greywater, and stormwater (aguas pluviales) must be disposed of adequately and in a sanitary manner so as to avoid contamination of the soil and natural water sources used for human consumption, the formation of breeding grounds for disease vectors, and air pollution under conditions that threaten its purity or quality." In the same vein, Article 1 of the Ley de Construcciones No. 833 provides as follows:
"The Municipalities of the Republic are responsible for ensuring that cities and other population centers meet the necessary conditions of safety, healthfulness, convenience, and aesthetic quality in their public roads and in the buildings and structures erected on such land, without prejudice to the powers granted by law to other administrative bodies in these matters." The foregoing demonstrates the interconnection between municipal obligations in the area of stormwater drainage and the obligation set out above, both of which are linked and fall under the administration of local governments as part of the services they are obligated to provide.
Furthermore, Article 60 of the Ley Orgánica del Ambiente provides, with respect to the prevention and control of environmental contamination:
"To prevent and control environmental contamination, the State, municipalities, and other public institutions shall give priority, among other measures, to the establishment and operation of adequate services in areas fundamental to environmental health, such as:
These services shall be provided in the manner prescribed by the applicable laws and regulations, promoting the participation of the population and its organizations." Based on the foregoing provisions, it is concluded that the Municipalidad bears direct responsibility for determining the measures required to resolve the problem identified at the manhole observed on the road with water spillage, which is a stormwater manhole administered by the Municipalidad de Desamparados, and it is therefore appropriate that the recommendations already forwarded to the Municipalidad de Desamparados through official letters DRyT-OMSR-2025-00777 and DRyT-OMSR-2025-00849 addressed to Mr. Walter Mena G. be complied with.

Based on the foregoing, on the duly established facts, on memorandum DRyT‑MCER‑2026‑00161 transmitting the Technical Report for the Plaza Higuerones Case, and on official letters DRyT‑OMSR‑2025‑00777 and DRyT‑OMSR‑2025‑00849, it is respectfully requested that the Honorable Sala Constitucional consider the audience granted to have been duly addressed, and consider it fully demonstrated that the Instituto Costarricense de Acueductos y Alcantarillados (AyA) acted diligently, timely, and in accordance with the law, within the framework of its legal and technical competencies; that AyA's actions were consistent with the rule of law, carried out in adherence to the principles of efficiency, effectiveness, prevention, and precaution, and directed exclusively toward the protection of the human right to potable water, to sanitation, to a healthy environment, and to the public interest.
Therefore, given that there is no causal link whatsoever between AyA's actions and the alleged rights violation, since the point presenting water spillage corresponds to a manhole belonging to the stormwater drainage system — infrastructure that does not form part of AyA's assets and whose administration, maintenance, and operation falls exclusively to the Municipalidad de Desamparados; a local government that was formally notified as early as 2025 of these conclusions, and with respect to which no omissive, irregular, or arbitrary action attributable to AyA exists — it is requested that the present amparo petition be dismissed in all its claims against the Instituto Costarricense de Acueductos y Alcantarillados."
"ON THE SET OF FACTS AND ACTIONS ALLEGED Regarding the procedural background of the proceedings conducted by the Municipal Council, and in relation to the facts alleged by the petitioner, this Presidency states that, upon completing the corresponding review of the files and records of the Secretariat of the Municipal Council of Desamparados, no formal note, complaint, proceeding, or request related to the subject matter of the present appeal was found on record for the year 2026.
Likewise, from the statement of facts contained in the decision issued by the Constitutional Chamber, it is apparent that the actions, complaints, and service requests cited by the petitioner were channeled before administrative and technical bodies, particularly before the Instituto Costarricense de Acueductos y Alcantarillados (ICAA) and municipal administrative departments, these being matters of an executive and operational nature.
Finally, it is noted that with respect to this Municipal Presidency, actions taken under the Principle of Legality are limited to the powers established in Article 34 of the Municipal Code, which are parliamentary in nature and concern the chairing of sessions of the full Municipal Council; and that the Municipal Presidency constitutes a Council Seat that is a member of the collegiate body, whose actions are conditioned upon the will and collective expression of the Municipal Council through the adoption of municipal agreements.
Having clarified the scope of this Presidency's competencies, and bearing in mind that it falls to the Municipal Mayor's Office, pursuant to the provisions of Article 17 of the Municipal Code, to exercise the administrative and executive powers of the municipality, it is clear that with respect to the proper and legal competencies of the Municipal Council, there is no omissive conduct attributable to this collegiate body, nor any violation of any constitutional right on the part of the Municipal Council of Desamparados, inasmuch as no proceeding formally submitted before that body regarding the facts at issue in the present appeal appears on record.

PETITUM On the basis of the foregoing, I respectfully request that the Constitutional Chamber declare the present Amparo Appeal filed against the Municipal Council of Desamparados without merit.
"By means of official letter AM-JU-TJ-073-2026, we submitted the report requested by Your Authority; however, in view of the statements made by the also-respondent ICAA, which indicated in its conclusions that the sanitary sewer network (red de alcantarillado sanitario) located east of Plaza Higuerones, constructed by AyA, is planned but unused, and that as of today it shows no damage, no persons are connected to it, and there is no wastewater overflow onto the road; and that the drainage well (pozo) observed on the road with water overflow is a stormwater well (pozo pluvial) administered by the Municipality of Desamparados, and that the matter had already been referred to the Municipality of Desamparados by means of official letters DRyT-OMSR-2025-00777 and DRyT-OMSR-2025-00849 to Mr. Walter Mena G. — I proceeded to request a report from Mr. Walter Mena, who, by means of official letter SP-AL-0117-2026 dated last 26 May, indicated, in the relevant part:
"… Although it had previously been determined on technical grounds that the municipal stormwater system presented no obstructions, the Municipality of Desamparados carried out a new on-site intervention on 13 March 2026, in order to once again verify the source of the overflow reported by residents. For that purpose, a hydro-vacuum truck contracted by the Municipality for cleaning and maintenance work on the stormwater drainage system (sistema de alcantarillado pluvial) was dispatched. During the intervention, the well identified by the complainants was cleaned and inspected, and it was technically verified that said well does not correspond to the municipal stormwater drainage system but rather to infrastructure associated with the sanitary sewer system. As a result of the inspection carried out and the conditions observed in the field, it was once again determined that the reported problem does not originate in the stormwater network administered by the Municipality of Desamparados. …" Although the foregoing had already been indicated in the report submitted by this Mayor's Office — to the extent that we may be dealing with a national road, as confirmed by AyA — the truth is that the attached report demonstrates that the Municipality responded to AyA's referral and to that of certain residents other than the petitioner and the protected party, and verified that the problem does not originate in the stormwater network administered by this Municipality, compounded by the fact that no formal complaint from the petitioner has been received.
On the basis of the foregoing, I reiterate to the Honorable Tribunal the request to declare the present Amparo Appeal without merit, as my represented institution has not violated any constitutional right and has, on the contrary, intervened in the area and confirmed that the leak does not originate in the stormwater network administered by this Municipality."
The opinion is written by Justice Garro Vargas; and,
Considering:
I.Subject of the appeal. The petitioner alleges that there is a wastewater leak (fuga de aguas negras) in the vicinity of Plaza Higuerones, in San Rafael Abajo de Desamparados, generating foul odors, proliferation of insects, and health impacts on residents, and that despite the multiple complaints filed, ICAA and the Municipality of Desamparados have failed to adopt effective measures to resolve the problem, each attributing jurisdiction over the matter to the other, which the petitioner considers to be injurious to his fundamental rights, particularly the right to a healthy and ecologically balanced environment.
II.Preliminary matter. Prior to analyzing the merits of the case — with respect to the alleged violation of the right to prompt and effective proceedings — it must be clarified that, beginning with Decision No. 2008-02545 of 8:55 a.m. on 22 February 2008, this Chamber has referred to the contentious-administrative jurisdiction — with certain exceptions — those matters in which it is disputed whether the public administration has or has not complied with the time limits established by the General Law of Public Administration (Articles 261 and 325), or by sector-specific laws governing special administrative procedures, both for resolving an administrative proceeding by final act — whether initiated ex officio or at the request of a party — and for deciding applicable administrative appeals. In this case, precisely one of the recognized exceptions applies, since the matter involves a delay in the resolution of a complaint related to the right to a healthy and ecologically balanced environment. Having clarified this point, the Court proceeds to resolve the specific situation raised in this amparo.
IV.Unproven fact. The following fact of relevance to this decision is not considered established: Sole fact. That, as of the date of the reports submitted, the problem had been definitively resolved.
V.On the specific case. After analyzing the evidentiary elements submitted and the information reported by the respondent authorities under oath, with the consequences — including criminal consequences — provided for in Article 44 of the Law of Constitutional Jurisdiction, it is established that the petitioner denounces the existence of a water overflow in the vicinity of Plaza Higuerones, in San Rafael Abajo de Desamparados — a situation that, according to the initial pleading, has persisted for several months and generates foul odors, proliferation of flies and mosquitoes, as well as concern over possible health impacts on the community. Furthermore, it is on record that the problem was known to ICAA at least as of October and November 2025, as that institution reported that it addressed the case and forwarded to the Municipality of Desamparados official letters DRyT-OMSR-2025-00777, dated 29 October 2025, and DRyT-OMSR-2025-00849, dated 26 November 2025.
The matter must be examined in light of the rights to health and to a healthy and ecologically balanced environment, derived from Articles 21 and 50 of the Political Constitution. When a situation involving water overflow, foul odors, and proliferation of disease vectors is reported, the public authorities called upon to intervene must act with diligence, efficacy, and coordination, in order to technically verify the source of the problem and adopt the measures that fall within the scope of their respective competencies.
In the specific case, ICAA reported that it attended to service orders No. 53436437, No. 54224292, and No. 47990522, and that it carried out on-site inspections. According to that institution, the sanitary sewer network constructed by ICAA on the east side of Plaza Higuerones is planned, with no user connections and out of service; furthermore, it indicated that it presents no obstructions, damage, or overflow onto the road. In ICAA's view, the point where the overflow is observed corresponds to a stormwater network well not administered by that institution, and therefore its resolution would be the responsibility of the Municipality of Desamparados.
For its part, the Municipalidad de Desamparados initially reported that the appealing party had not filed a formal petition with the Mayor's Office through the designated official channels, and that, based on the information provided, it was not possible to determine with precision whether the situation was located on a national or cantonal road, or whether it originated from municipal infrastructure or from networks administered by another specialized entity. Subsequently, the municipal mayor indicated that she requested a report from staff member Walter Mena, who noted that the municipality carried out a new on-site intervention on March 13, 2026, using a contracted hydrovacuum truck for cleaning and maintenance work on the storm drainage (alcantarillado pluvial) system, and that during that operation it was technically verified that the manhole in question did not correspond to the municipal storm drainage system, but rather to infrastructure associated with the sanitary sewer (alcantarillado sanitario) system.
Nevertheless, although the Municipalidad de Desamparados alleged that the appealing party had not filed a formal petition with the Mayor's Office through the designated official channels, the fact is that the municipal corporation did have prior knowledge of the reported situation, at least as of October 29, 2025, and November 26, 2025, dates on which ICAA communicated its conclusions to the municipality through official memoranda DRyT-OMSR-2025-00777 and DRyT-OMSR-2025-00849, respectively. Furthermore, the municipality itself acknowledged having carried out an on-site intervention on March 13, 2026, using a hydrovacuum truck, to inspect the manhole identified by the complainants. Therefore, the absence of a formal petition filed directly by the appellant does not negate the fact that the municipal authority was aware of the problem and had undertaken actions related to it.
From the foregoing it follows that the respondent authorities have carried out actions related to the reported situation; however, the record also shows that they maintain opposing positions regarding the origin of the overflow (rebalse) and the infrastructure to which it corresponds. ICAA maintains that the problem originates from a storm drainage manhole whose resolution falls within the municipality's responsibility, while the municipality asserts, based on its March 13, 2026 intervention, that the problem does not originate in the municipal storm drainage network but rather in infrastructure associated with the sanitary sewer system. That technical discrepancy has not been resolved in the case file.
Likewise, the reports submitted do not indicate that, as of this date, the reported problem has been definitively resolved. On the contrary, the record shows that both institutions have conducted inspections or interventions and have attributed the origin of the overflow to infrastructure that, according to each of them, is not under their administration. Consequently, there persists a lack of conclusive institutional determination regarding the origin of the problem and the specific measures needed to address it.
This Court is not unaware that each institution must act within the framework of its legal and technical competencies. Nor does it fall within this jurisdiction to substitute the specialized judgment of the competent authorities in order to determine, on its own, whether the manhole belongs to the storm drainage network or to the sanitary sewer system. Nevertheless, from a constitutional standpoint, it is inadmissible that a situation reported months ago, known to the involved authorities at least since October 2025 and linked to possible public health hazards, should remain without an effective solution due to conflicting institutional positions.
The duty to protect health and the environment requires that the respondent entities coordinate effectively, conduct such joint verifications as may be necessary, and determine, on the basis of technical grounds, the origin of the overflow and the authority responsible for implementing corrective measures. The absence of a definitive solution, in the face of a situation that has been brought to the attention of both institutions and that involves potentially unhealthy conditions, constitutes a violation of the fundamental rights invoked.
Therefore, the appropriate course of action is to grant the appeal, in order to order ICAA and the Municipalidad de Desamparados to, in a coordinated manner and within the scope of their respective competencies, conduct a joint technical inspection at the reported site, determine with precision the origin of the overflow and the nature of the infrastructure involved, and adopt the appropriate measures to address the situation, so that the burden arising from the lack of inter-institutional definition is no longer transferred to the community.
VI.Note of Justice Castillo Víquez, regarding prompt and effective administrative justice. I have supported this Court's position that when a party before the court alleges a violation of the right to prompt and effective administrative justice, it is the Administrative Contentious Courts (Tribunales de lo Contencioso-Administrativo), and not this Court, that must hear the legal dispute. However, with the recent enactment of Law No. 9097, Ley de Regulación del Derecho de Petición, it has been established that this right is subject to judicial protection by means of the amparo remedy provided for in Article 32 of the Ley de la Jurisdicción Constitucional, in conjunction with Article 27 of the Constitución Política de la República de Costa Rica, in those cases where the petitioner considers that the Administration's material actions, its administrative acts, or its response are affecting their fundamental rights.
In my view, the recently enacted legislation does not imply that this Court must modify its line of case law; pursuant to Article 7 of its governing Law, this Court is exclusively responsible for defining its own competence. Accordingly, except for those legal-constitutional disputes that this Court itself has recognized as exceptional circumstances, which are properly heard in this jurisdiction through the constitutional amparo process, in all other cases, and for the reasons set forth by this Court (judgment No. 2008-02545 of 8:55 a.m. on February 22, 2008), the competent tribunals are the judges of the administrative contentious jurisdiction, all of which is consistent with Article 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and norms), and the corresponding statutory provisions, based on a logical, systemic, and teleological interpretation of the legal order.
VII.Note of Justice Salazar Alvarado. In environmental matters, it is also my personal position that if the Public Administration has already intervened, I consider that the matter's examination and resolution falls within the jurisdiction of the administrative contentious courts. Nevertheless, I do proceed to rule on the merits when other rights of persons affected by the source of contamination are at stake, including health, quality of life, and the right to enjoy a healthy environment free of contamination (Article 50 of the Constitución Política), as is the case here, in which the appealing party alleges that there is a sewage (aguas negras) leak in the vicinity of Plaza Higuerones, in San Rafael Abajo de Desamparados, generating foul odors, insect proliferation, and health impacts on neighboring residents, without the Instituto Costarricense de Acueductos y Alcantarillados and the Municipalidad de Desamparados having adopted effective measures to solve the problem despite the multiple complaints filed, each institution attributing competence over the matter to the other, to the detriment of a healthy and ecologically balanced environment and a dignified standard of quality of life.
VIII.Note of Justice Garro Vargas. On other occasions, when there is a significant legal and/or factual dispute between the involved parties regarding which of them is competent to resolve the problem affecting the appealing party, I have considered that the matter cannot be resolved in this jurisdiction but rather in the administrative contentious jurisdiction.
However, in the present case it does not appear that this involves a legal dispute but rather a specific factual issue—albeit a decisive one—that can well be clarified as part of the coordination process.
IX.Documentation submitted to the case file. The parties are hereby advised that, if they have submitted any document in paper form, as well as objects or evidence contained in any additional electronic, computer-based, magnetic, optical, telematic, or new-technology device, these must be retrieved from the court office within a maximum period of thirty business days, counted from the notification of this judgment. Otherwise, all material not retrieved within this period will be destroyed, pursuant to the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena in Session No. 27-11 of August 22, 2011, Article XXVI, and published in Boletín Judicial No. 19 of January 26, 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial in Session No. 43-12, held on May 3, 2012, Article LXXXI.
Por tanto:
The appeal is granted. María Antonieta Naranjo Brenes, in her capacity as mayor of the Municipalidad de Desamparados, and Lourdes María Suárez Barboza, in her capacity as executive president of the Instituto Costarricense de Acueductos y Alcantarillados, or whoever may hold those positions, are hereby ordered to coordinate as necessary and issue the pertinent instructions so that, within a period of ONE MONTH, counted from the notification of this judgment, a joint technical inspection be conducted in the vicinity of Plaza Higuerones, in San Rafael Abajo de Desamparados, in order to determine, with technical precision, the origin of the reported overflow and the nature of the infrastructure involved. They are likewise ordered that, once the joint technical inspection has been conducted and the cause of the overflow and the institution competent to address it have been determined, the appropriate administrative, technical, and material measures to resolve the reported situation be adopted, within a period of THREE MONTHS, counted from said technical determination, and within the scope of their respective competencies.
The respondent authorities are warned that, in accordance with Article 71 of the Ley de la Jurisdicción Constitucional, imprisonment of three months to two years, or a fine of twenty to sixty days, shall be imposed on any person who receives an order that they must comply with or cause to be complied with, issued in an amparo proceeding, and who fails to comply with it or fails to cause it to be complied with, provided the offense is not subject to a more severe penalty. The Municipalidad de Desamparados and the Instituto Costarricense de Acueductos y Alcantarillados are condemned to pay the costs, damages, and losses occasioned by the facts upon which this declaration is based, which shall be determined in enforcement proceedings before the administrative contentious jurisdiction. Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del dos de julio de dos mil veintiseis .
Recurso de amparo promovido por [Nombre 001], cédula de identidad [Valor 001], contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS y la MUNICIPALIDAD DE DESAMPARADOS (ICAA).
Resultando:
“[E]s regidor suplente de la Corporación Municipal de Desamparados y vecino de la comunidad de San Rafael Abajo de Desamparados. Indica que en la zona de Plaza Higuerones en San Rafael Abajo de Desamparados desde hace meses existe una seria fuga de aguas negras, es decir, agua contaminada de cloaca que genera una intensa cantidad de moscas y zancudos, así como un olor tremendamente nauseabundo, que está generándole problemas de salud y no solo a él sino a la totalidad de la comunidad. Manifiesta que a pesar de lo anterior se han realizado múltiples denuncias tanto al instituto recurrido, como a la corporación municipal sin tener ninguna respuesta positiva. Narra que, en relación con el AYA se puede denotar la orden de servicio No. 53436437, orden 54224292, orden 47990522, donde se han hecho las denuncias correspondientes ante dicha institución, pero, el resultado general ha sido que la competencia es municipal. Agrega que en relación con la Municipalidad de Desamparados, el caso ha sido canalizado mediante el síndico municipal, Lizandro Porras Calderón, quien ha logrado conversar con los funcionarios y los técnicos de la corporación municipal y estos le han expresado que le corresponde al AYA, que incluso ellos han intervenido la zona y que el trabajo es correspondiente a dicha institución. Indica que como vecino de la zona y afectado directo se encuentra en una situación de absoluta indefensión por parte de ambas instituciones, ya que, se tiran la pelota del problema una a la otra y ninguna resuelve, teniendo este problema meses, el cual, está causando afectación a la salud del suscrito y a toda la ciudadanía, se enfrentan a un tema de salud pública sumamente serio que se acrecienta día con día. Manifiesta que el actuar de ambas instituciones está conculcando múltiples principios de índole constitucional, tales como los de eficiencia y eficacia, certeza plena, racionalidad y proporcionalidad, interdicción de la arbitrariedad, seguridad jurídica, así como el artículo 50 constitucional relacionado a un ambiente equilibrado” (sic).
“Se rechaza en todos sus extremos la violación de los derechos fundamentales alegados por el recurrente de acuerdo a los siguientes hechos.
1- Conforme se puede observar con meridiana claridad de la interposición del recurso de amparo, el amparado se limita a aportar fotos de las cuales no es posible deducir la ubicación exacta de la problemática, para poder determinar si estamos ante una situación presentada en carretera nacional o una calle cantonal, al limitarse a indicar que es en la zona de Plaza Higuerones en San Rafael Abajo de Desamparados, la cual tiene tanto carretera nacional como cantonal.
2- No existe solicitud de trámite ante esta Alcaldía sobre lo denunciado, por los medios que corresponden, como lo es el correo oficial [email protected] o la plataforma de servicios, de lo cual no está exento el Señor regidor ni el Señor síndico. Tampoco indica con qué funcionario conversó ni demuestra que algún trámite sobre lo denunciado no haya sido atendido por la Municipalidad, lo que hace improcedente una condena a esta Municipalidad al menos a la altura de los procedimientos.

Si bien es cierto que el numeral 169 de la Constitución Política, dispone que las Municipalidades tienen el deber y tutela de los intereses locales , pero diferenciando claramente las competencias técnicas y legales que correspondan a otras instituciones especializadas cuando no exista certeza de que el problema deriva de infraestructura municipal. Es por lo anterior que la Municipalidad en observancia de los principios de coordinación interinstitucional , protección de la salud pública y tutela de los intereses y servicios locales previstos en el Código Municipal y la Constitución Política , mantiene disposición de colaborar y gestionar las acciones necesarias para atender cualquier situación que eventualmente afecte a los habitantes del cantón . No obstante, de los hechos expuestos en el presente recurso no se desprende con precisión si la supuesta fuga de aguas negras proviene de infraestructura ubicada en vía cantonal o nacional, ni si corresponde a redes de alcantarillado sanitario administradas por entes especializados del Estado.
El ordenamiento jurídico nacional atribuye competencias técnicas específicas en materia de alcantarillado sanitario, aguas residuales , saneamiento y control sanitario a instituciones como el Instituto Costarricense de Acueductos y Alcantarillados y el Ministerio de Salud, entes que poseen potestades regulatorias , técnicas y operativas especializadas en dicha materia.
En consecuencia aun cuando esta Municipalidad mantiene un deber general de colaboración y coordinación para la atención de problemáticas que afecten el cantón , la determinación del origen de la fuga, la titularidad de la infraestructura y la competencia material para ejecutar las obras correctivas requiere la participación y criterio técnico de las instituciones nacionales competentes, y sobre todo su precisa ubicación.
Aunado a lo anterior la competencia territorial y de gestión local de la Municipalidad no es universal sobre toda la red sanitaria existente en el cantón . El AyA administra sistemas de alcantarillado sanitarios en múltiples sectores del país. El Ministerio de Salud posee competencias de vigilancia sanitaria y órdenes sanitarias, si se desconoce el origen exacto de la fuga , no puede atribuirse automáticamente la responsabilidad a la Municipalidad más aun si no existe un trámite concreto por los canales oficiales, al no existir gestión alguna por parte del recurrente por los medios oficiales de la Municipalidad para atender el caso que presenta , por lo que solicito con todo respeto declarar sin lugar el recurso de amparo con respecto a esta Municipalidad ya que a la altura de los procedimientos no es posible ubicar exactamente el lugar , no existe trámite pendiente en esta Municipalidad, no se acredita si hay sistema de alcantarillado sanitario, o si el sistema de disposición de las aguas residuales es por tanque séptico y su respectivo drenaje o si algunos vecinos descargan sus aguas residuales en algunos caños artesanales o canales pluviales, produciendo contaminación.

Con base en lo anterior, solicito al Honorable Tribunal declarar sin lugar el presente Recurso de amparo, al no haber violentado mi representada ningún derecho constitucional”.

UNICO: El memorando DRyT-MCER-2026-00161 que remite el informe PLAZA HIGUERONES, Área responsable: Mantenimiento Civil y Electromecánico DRyT GAM (que anexa además DRyT-OMSR-2025-00777, DRyT-OMSR-2025-00849), elaborado por el Área de Mantenimiento Civil y Electromecánico de la Dirección de Recolección y Tratamiento GAM, determina que la problemática denunciada por rebalse de aguas en la vía pública frente a Plaza Higuerones no guarda relación con el sistema de alcantarillado sanitario administrado por el AyA, sino que tiene su origen en infraestructura pluvial.
Las inspecciones de campo realizadas confirman que la red de alcantarillado sanitario construida por el AyA en el sector este de Plaza Higuerones se encuentra prevista, sin conexión de usuarios y fuera de operación, por lo que no presenta obstrucciones, daños ni derrames sobre la carretera. Los pozos de registro asociados a esta red se verificaron secos, sin presencia de aguas residuales, descartándose que el AyA sea la fuente del rebalse reportado.
Por el contrario, el punto donde se manifiesta el rebalse corresponde a un pozo de la red pluvial, el cual no forma parte de los activos del AyA, no coincide con el trazo de la red sanitaria institucional y presenta características constructivas propias de infraestructura municipal. En consecuencia, su administración, mantenimiento y atención corresponden a la Municipalidad de Desamparados, dado que las redes pluviales no están bajo competencia del AyA.
Se deja constancia de que el Instituto Costarricense de Acueductos y Alcantarillados (AyA) atendió de forma diligente y oportuna las gestiones asociadas al caso, mediante la ejecución de las órdenes de servicio N.º 53436437, N.º 54224292 y N.º 47990522, realizando las verificaciones técnicas correspondientes en campo. Estas atenciones permitieron constatar el estado de la infraestructura sanitaria existente, descartar afectaciones atribuibles a la red de alcantarillado sanitario administrada por el AyA y asegurar una respuesta institucional adecuada ante los reportes recibidos, en concordancia con sus competencias técnicas y operativas.
Es importante destacar que esta conclusión no es nueva, ya que el caso fue atendido previamente en el año 2025 y la Municipalidad de Desamparados fue informada formal y oportunamente mediante los oficios DRyT-OMSR-2025-00777, de fecha 29 de octubre de 2025, y DRyT-OMSR-2025-00849, de fecha 26 de noviembre de 2025, en los cuales se indicó que, la red sanitaria del AyA en la zona no se encontraba en uso, que el pozo que presentaba rebalse no correspondía a infraestructura sanitaria institucional, y la procedencia del evento debía ser valorada por la Municipalidad al tratarse de un sistema pluvial.
En síntesis, el informe técnico reafirma que el problema observado frente a Plaza Higuerones es consecuencia del funcionamiento o condición del sistema pluvial, cuya gestión es de competencia municipal, y que la Municipalidad ya contaba con esta información desde el año 2025, sin que se haya determinado responsabilidad atribuible al AyA en cuanto a la generación del rebalse.

Se tiene que después de la visita realizada el viernes 08 de mayo al sitio se observa lo siguiente:
1. La red de alcantarillado sanitario del AyA construida al costado Este de Plaza Higuerones hoy en día no está en uso y es prevista por lo que no presenta obstrucciones ni derrames en la carretera. (adjunto doto del pozo) (…)

2. La red que presenta rebalse de aguas en la carretera es una red pluvial, las redes pluviales no son administradas por el AyA y le corresponde a la Municipalidad del sector atender el caso. Para eso los usuarios deben presentar el caso ante dicha Municipalidad.

Pozo de la red pluvial (Municipal) presentando rebalse de aguas) Cabe mencionar que este caso le había ingresado en octubre y noviembre del 2025 a los compañeros de Mantenimiento de Colectores y Subcolectores, quienes en ambos casos dieron respuesta al Señor Walter Mena G de la Municipalidad de Desamparados mediante los oficios DRyT-OMSR-2025-00777 y DRyT-OMSR2025-00849 con fecha de 29 de octubre y 26 de noviembre de 2025 respectivamente. (Ver Oficios en Anexos).
En cuanto a las ordenes consultadas en el oficio PRE-J-2026-01555 se tiene que:

1. Orden de servicio # 53436437. Se cierra el caso ya que el pozo localizado es pluvial y debe verlo la Municipalidad de Desamparados.

2. Orden de servicio # 54224292. Se cierra el caso ya que el pozo localizado es pluvial y debe verlo la Municipalidad de Desamparados.

3. de Orden Servicio # 47990522. Esta orden se generó como una orden de fuga de agua potable y fue asignada a Zona 2 como se observa y la enviaron a reparar.

Conclusiones
1. La red de alcantarillado sanitario ubicada al Este de Plaza Higuerones construida por el AyA es prevista y sin uso y a hoy no presenta daños, no hay personas conectadas y no presenta derrames de aguas en la carretera.
2. El pozo que se observa en la carretera con derrame de aguas es un pozo pluvial el cual es administrado por la Municipalidad de Desamparados.
3. El caso ya se había enviado a la Municipalidad de Desamparados mediante oficios DRyT-OMSR-2025-00777 y DRyT-OMSR-2025-00849 al Señor Walter Mena G.

Resulta de importancia indicar que en Costa Rica existen dos sistemas de alcantarillado separados, uno denominado “Sistema de Alcantarillado Pluvial” cuyo objetivo es transportar las aguas de lluvia provenientes de techos, canoas y bajantes de las viviendas, así como las aguas de lluvia que discurren por las vías públicas, y el otro sistema se denomina “Sistema de Alcantarillado Sanitario” cuyo objetivo es transportar únicamente las aguas residuales provenientes de pilas, fregaderos, duchas e inodoros que se generan a lo interno de las viviendas.
De acuerdo con la reglamentación vigente, los sistemas de alcantarillado pluvial son administrados por las municipalidades de cada cantón y el sistema de alcantarillado sanitario es operado y mantenido por el operador a cargo de prestar el servicio de agua potable dentro de su respectiva área geográfica de cobertura. De conformidad con el Código Municipal y la Ley General de Salud, las Municipalidades tienen competencia para recibir y administrar sistemas de saneamiento de Plantas de Tratamiento.
Por su parte, los Gobiernos Locales cuentan con la facultad de establecer una serie de limitaciones a construcciones y proyectos, mediante la planificación urbana, destacando que en caso de que se incumplan las condiciones que ordenen cuentan con una serie de mecanismos coercitivos para hacer cumplir sus mandatos, de los cuales carece AyA. Aunado a lo anterior, se tiene claro que las Municipalidades son los entes que recaudan los montos respectivos para mantenimiento y buen funcionamiento de la red pluvial, tal y como lo dispone el Código Municipal No. 7794, en el Título IV. Hacienda Municipal, Capítulo II. Los ingresos municipales.
En el presente caso, no se puede dejar de lado que las Municipalidades cuando cobran los impuestos municipales incluyen el rubro correspondiente al mantenimiento y operación de la red pluvial, lo que recalca la competencia municipal en este campo, además de que resulta evidente que este rubro debería ser utilizado en el mantenimiento y operación de la red pluvial de cada Municipalidad, como lo indica la Sala Constitucional en el Voto 2001-2320, en el Considerando IV, que a la letra dice:
“IV.- Así las cosas, de lo expuesto en la Ley supra citada y de lo relativo a la competencia municipal por razón de la materia, este Tribunal Constitucional considera que quien debió atender la denuncia planteada por el amparado en salvaguarda del derecho a la salud, fue la Municipalidad de Alajuelita, no únicamente por el hecho de que el problema en cuestión calza dentro del denominado "interés local" de su cantón, sino también porque de acuerdo a Acueductos y Alcantarillados, ese ayuntamiento es el encargado de administrar el alcantarillado pluvial en donde se encuentra la falla. En cuanto a lo actuado por el Instituto accionado, no estima la Sala que él tenga responsabilidad alguna en la violación de los derechos fundamentales del señor Cruz Vega, por cuanto, si bien es cierto que como ente autónomo rector en la materia, tiene el deber de solventar los problemas que se susciten en relación con el suministro de agua potable, con la recolección y evacuación de aguas negras y de aguas pluviales en las áreas urbanas, también es cierto que ello es deber prioritario de las municipalidades cuando, como en el presente caso, tienen a su haber la administración de los acueductos y alcantarillados del cantón; o bien, cuando, como también sucede aquí, el problema a solucionar tenga de por medio la tutela de derechos fundamentales cuyo remedio no requiera conocimientos especial o técnicos que solo pueda brindar un ente determinado.
En razón de ello, el recurso debe ser declarado con lugar, por la violación al derecho a la salud cometida por la Municipalidad de Alajuelita en perjuicio del amparado…” (El resaltado no es del original) Asimismo, la Ley General de Salud No. 5395, propiamente sobre el caso que nos ocupa, señala en sus artículos 285 y 292 lo siguiente:
“ARTÍCULO 292.- Queda prohibido en todo caso la descarga de las aguas negras, de las aguas servidas y de residuos industriales al alcantarillado pluvial. El Ministerio queda facultado para restringir, regular, o prohibir la eliminación de productos sintéticos no biodegradables a través de los sistemas de recolección de excretas, aguas negras y servidas.
ARTÍCULO 285.- Las excretas, las aguas negras, las servidas y las pluviales, deberán ser eliminadas adecuada y sanitariamente a fin de evitar la contaminación del suelo y de las fuentes naturales de agua para el uso y consumo humano, la formación de criaderos de vectores y enfermedades y la contaminación del aire mediante condiciones que atenten contra su pureza o calidad.” En este mismo sentido, el artículo 1 de la Ley de Construcciones N° 833, señala lo siguiente:
"Las Municipalidades de la República son las encargadas de que las ciudades y demás poblaciones reúnan las condiciones necesarias de seguridad, salubridad, comodidad y belleza en sus vías públicas y en los edificios y construcciones que en terrenos de estas se levanten sin perjuicio de las facultades que las leyes les concedan en estas materias a otros órganos administrativos".
Lo anterior evidencia la conexidad de las obligaciones municipales en materia de alcantarillado pluvial y la obligación señalada supra, las cuales se encuentran ligadas y bajo la administración de los Gobiernos Locales como parte de los servicios que se encuentran obligados a suministrar.
Ahora bien, el artículo 60 de la Ley Orgánica del Ambiente establece, sobre la prevención y control de la contaminación:
“Para prevenir y controlar la contaminación del ambiente, el Estado, las municipalidades y las demás instituciones públicas, darán prioridad, entre otros, al establecimiento y operación de servicios adecuados en áreas fundamentales para la salud ambiental, tales como:
Estos servicios se prestarán en la forma que las leyes y los reglamentos específicos lo determinen, procurando la participación de la población y sus organizaciones.” Con base en las normas citadas, se concluye que la Municipalidad es la responsable directa en la determinación de las medidas requeridas para solucionar el problema que se identifica en el pozo que se observa en la carretera con derrame de aguas, que es un pozo pluvial el cual es administrado por la Municipalidad de Desamparados, resultando procedente que se acaten las recomendaciones que ya se habían enviado a la Municipalidad de Desamparados mediante oficios DRyTOMSR-2025-00777 y DRyT-OMSR-2025-00849 al Señor Walter Mena G.

Con fundamento en lo expuesto, en los hechos debidamente acreditados, en el memorando DRyT‑MCER‑2026‑00161 que remite el Informe Técnico Caso Plaza Higuerones, así como en los oficios DRyT‑OMSR‑2025‑00777 y DRyT‑OMSR‑2025‑00849, se solicita respetuosamente a la Honorable Sala Constitucional que tenga por debidamente atendida la audiencia conferida, y por plenamente demostrado que el Instituto Costarricense de Acueductos y Alcantarillados (AyA) actuó de forma diligente, oportuna y ajustada a derecho, dentro del marco de sus competencias legales y técnicas, las actuaciones del AyA fueron conformes al bloque de legalidad, ejecutadas con apego a los principios de eficiencia, eficacia, prevención y precaución, y orientadas exclusivamente a la tutela del derecho humano al agua potable, al saneamiento, a un ambiente sano y al interés público.
Por tanto, al no existir nexo causal alguno entre la actuación del AyA y la supuesta vulneración de derechos alegada, dado que el punto que presenta el derrame de aguas corresponde a un pozo del sistema pluvial, infraestructura que no forma parte de los activos del AyA y cuya administración, mantenimiento y operación corresponde exclusivamente a la Municipalidad de Desamparados; Gobierno Local que fue informado formalmente desde el año 2025 sobre estas conclusiones, sin que exista actuación omisiva, irregular o arbitraria atribuible al AyA. En la atención a lo anterior, se solicita que el presente recurso de amparo sea declarado sin lugar en todos sus extremos respecto al Instituto Costarricense de Acueductos y Alcantarillados”.
“SOBRE EL ELENCO DE HECHOS Y ACCIONES ALEGADAS Sobre los antecedentes del trámite seguido por parte del Concejo Municipal, en relación con los hechos alegados por el recurrente, manifiesta esta Presidencia que, realizada la revisión correspondiente de los archivos y registros de la Secretaría del Concejo Municipal de Desamparados, no consta durante el año 2026 la presentación formal de nota, denuncia, gestión o solicitud alguna relacionada con el objeto del presente recurso Asimismo, de la relación de hechos contenida en la resolución emitida por la Sala Constitucional, se desprende que las actuaciones, denuncias y solicitudes de servicio señaladas por el recurrente fueron canalizadas ante instancias administrativas y técnicas, particularmente ante el Instituto Costarricense de Acueductos y Alcantarillados y dependencias administrativas municipales, tratándose de materias de naturaleza ejecutiva y operativa.
Finalmente, se indica que en lo que respecta a esta Presidencia Municipal, las actuaciones al tenor del Principio de Legalidad se limitan a las atribuciones establecidas en el artículo 34 del Código Municipal, las cuales son de naturaleza parlamentaria y de dirección de las sesiones del Concejo Municipal en pleno; siendo además que la Presidencia Municipal constituye una Regiduría integrante del órgano colegiado, cuya actuación se encuentra condicionada a la voluntad y manifestación colegiada del Concejo Municipal mediante la adopción de acuerdos municipales.
Ahora bien, aclarados los alcances de las competencias de esta Presidencia; y teniendo claro que corresponde a la Alcaldía Municipal, de conformidad con lo dispuesto en el artículo 17 del Código Municipal, el ejercicio de las competencias administrativas y ejecutivas del municipio; queda claro que en lo referente a las competencias propias y legales del Concejo Municipal, no existe conducta omisiva atribuible a este órgano colegiado ni vulneración a derecho constitucional alguno por parte del Concejo Municipal de Desamparados, toda vez que no consta gestión alguna presentada formalmente ante dicho órgano relacionada con los hechos objeto del presente recurso.

PETITORIA Con fundamento en lo expuesto, solicito respetuosamente a la Sala Constitucional que se declare sin lugar el presente Recurso de Amparo presentado en contra del Concejo Municipal de Desamparados”.
“Mediante el oficio AM-JU-TJ-073-2026, rendimos el informe solicitado por su Autoridad, no obstante vistas las manifestaciones del también recurrido Instituto Costarricense de Acueductos y Alcantarillados, en cuanto indica en sus conclusiones que la red de alcantarillado sanitario ubicada al Este de Plaza Higuerones construida por el AyA es prevista y sin uso y a hoy no presenta daños, no hay personas conectadas y no presenta derrames de aguas en la carretera. Que el pozo que se observa en la carretera con derrame de aguas es un pozo pluvial el cual es administrado por la Municipalidad de Desamparados y que el caso ya se había enviado a la Municipalidad de Desamparados mediante oficios DRyT-OMSR-2025-00777 y DRyTOMSR-2025-00849 al Señor Walter Mena G. , procedí a solicitar el informe al señor Walter Mena, quien mediante el oficio SP-AL-0117-2026 de fecha 26 de mayo pasado indicó en lo conducente:
“… Pese a que previamente se había determinado técnicamente que el sistema pluvial municipal no presentaba obstrucciones, la Municipalidad de Desamparados realizó una nueva intervención en sitio el día 13 de marzo de 2026, con el fin de verificar nuevamente el origen del rebalse reportado por los vecinos. Para dicha atención, se coordinó el envío de un camión hidrovaciador, contratado por la Municipalidad para labores de limpieza y mantenimiento del sistema de alcantarillado pluvial. Durante la intervención se efectuó la limpieza y revisión del pozo señalado por los denunciantes, verificándose técnicamente que dicho pozo no corresponde al sistema de alcantarillado pluvial municipal, sino a infraestructura asociada al sistema de alcantarillado sanitario. Producto de la inspección realizada y de las condiciones observadas en campo, se determinó nuevamente que la problemática reportada no se origina en la red pluvial administrada por la Municipalidad de Desamparados. …” Si bien lo anterior se había manifestado con el informe rendido por esta Alcaldía, en cuanto podríamos estar en carretera nacional, lo cual constató el AYA lo cierto es que con el informe adjunto se demuestra que la Municipalidad atendió el llamado del AYA y algunos vecinos distintos al recurrente y amparado y verificó que la problemática no se origina en la red pluvial administrada por esta Municipalidad, aunado al hecho que no se ha recibido formalmente denuncia alguna del recurrente.
Con base en lo anterior, reitero al Honorable Tribunal la solicitud de declarar sin lugar el presente Recurso de amparo, al no haber violentado mi representada ningún derecho constitucional y por el contrario haber intervenido la zona y constatado que la fuga no se origina en la Red Pluvial administrada por esta Municipalidad”.
Redacta la Magistrada Garro Vargas; y,
Considerando:
I.Objeto del recurso. La parte recurrente alega que existe una fuga de aguas negras en las inmediaciones de Plaza Higuerones, en San Rafael Abajo de Desamparados, que genera malos olores, proliferación de insectos y afectaciones a la salud de los vecinos, sin que, pese a las múltiples denuncias presentadas, el ICAA y la Municipalidad de Desamparados hayan adoptado medidas efectivas para solucionar el problema, atribuyéndose recíprocamente la competencia sobre el caso, lo que estima lesiona sus derechos fundamentales, en particular el derecho a un ambiente sano y ecológicamente equilibrado.
II.De previo. De previo a analizar el fondo del asunto –por la presunta violación del derecho a un procedimiento pronto y cumplido– debe aclararse que, a partir de la sentencia No. 2008-02545 de las 8:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones– aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos, pautados por la Ley General de la Administración Pública (artículos 261 y 325) o por las leyes sectoriales relativas a los procedimientos administrativos especiales, tanto para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– como para conocer de los recursos administrativos procedentes. Precisamente, en este caso, se plantea un supuesto de excepción, pues, se trata de un retardo en resolución de una denuncia relacionada con el derecho a un ambiente sano y ecológicamente equilibrado. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.
III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
IV.Hecho no probado. No se estima demostrado el siguiente hecho de relevancia para esta resolución: Único. Que a la fecha de los informes rendidos la problemática haya sido solucionada de manera definitiva.
V.Sobre el caso concreto. Después de analizar los elementos probatorios aportados y lo informado por las autoridades recurridas bajo fe de juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley de Jurisdicción Constitucional, se tiene acreditado que la parte recurrente denuncia la existencia de un rebalse de aguas en las inmediaciones de Plaza Higuerones, en San Rafael Abajo de Desamparados, situación que, según lo indicado en el escrito inicial, se presenta desde hace meses y genera malos olores, proliferación de moscas y zancudos, así como preocupación por eventuales afectaciones a la salud de la comunidad. Además, consta que la problemática fue conocida por el ICAA, al menos, desde octubre y noviembre de 2025, pues esa institución informó que atendió el caso y remitió a la Municipalidad de Desamparados los oficios DRyT-OMSR-2025-00777, de 29 de octubre de 2025, y DRyT-OMSR-2025-00849, de 26 de noviembre de 2025.
El asunto debe ser examinado a la luz de los derechos a la salud y a un ambiente sano y ecológicamente equilibrado, derivados de los artículos 21 y 50 de la Constitución Política. Cuando se denuncia una situación vinculada con rebalse de aguas, malos olores y proliferación de vectores, las autoridades públicas llamadas a intervenir deben actuar con diligencia, eficacia y coordinación, a fin de verificar técnicamente el origen del problema y adoptar las medidas que correspondan dentro del ámbito de sus competencias.
En el caso concreto, el ICAA informó que atendió las órdenes de servicio No. 53436437, No. 54224292 y No. 47990522, y que realizó inspecciones en el sitio. Según lo manifestado por esa institución, la red de alcantarillado sanitario construida por el ICAA al costado este de Plaza Higuerones se encuentra prevista, sin conexión de usuarios y fuera de operación; además, indicó que no presenta obstrucciones, daños ni derrames sobre la carretera. En criterio del ICAA, el punto donde se observa el rebalse corresponde a un pozo de la red pluvial, no administrado por esa institución, por lo que su atención correspondería a la Municipalidad de Desamparados.
Por su parte, la Municipalidad de Desamparados informó inicialmente que la parte recurrente no había presentado gestión formal ante la Alcaldía por los medios oficiales indicados y que, con la información aportada, no era posible determinar con precisión si la situación se ubicaba en carretera nacional o cantonal, ni si provenía de infraestructura municipal o de redes administradas por otro ente especializado. Posteriormente, la alcaldesa municipal indicó que solicitó informe al funcionario Walter Mena, quien señaló que la municipalidad realizó una nueva intervención en sitio el 13 de marzo de 2026, con un camión hidrovaciador contratado para labores de limpieza y mantenimiento del sistema de alcantarillado pluvial, y que en dicha diligencia se verificó técnicamente que el pozo señalado no correspondía al sistema de alcantarillado pluvial municipal, sino a infraestructura asociada al sistema de alcantarillado sanitario.
No obstante, aunque la Municipalidad de Desamparados alegó que la parte recurrente no presentó gestión formal ante la Alcaldía por los canales oficiales indicados, lo cierto es que esa corporación municipal sí tenía conocimiento previo de la situación denunciada, al menos desde el 29 de octubre de 2025 y el 26 de noviembre de 2025, fechas en que el ICAA le comunicó sus conclusiones mediante los oficios DRyT-OMSR-2025-00777 y DRyT-OMSR-2025-00849, respectivamente. Además, la propia Municipalidad reconoció haber realizado una intervención en sitio el 13 de marzo de 2026, con un camión hidrovaciador, para revisar el pozo señalado por los denunciantes. Por ello, la inexistencia de una gestión formal presentada directamente por el recurrente no desvirtúa que la autoridad municipal conocía la problemática y había realizado actuaciones relacionadas con esta.
De lo anterior se desprende que las autoridades recurridas han realizado actuaciones relacionadas con la situación denunciada; sin embargo, también consta que mantienen posiciones contrapuestas sobre el origen del rebalse y sobre la infraestructura a la que este corresponde. El ICAA sostiene que el problema proviene de un pozo pluvial cuya atención corresponde a la municipalidad, mientras que la municipalidad afirma, con base en su intervención del 13 de marzo de 2026, que la problemática no se origina en la red pluvial municipal, sino en infraestructura asociada al alcantarillado sanitario. Esa discrepancia técnica no ha sido superada en el expediente.
Asimismo, de los informes rendidos no se desprende que, a la fecha, la problemática denunciada haya sido solucionada de manera definitiva. Por el contrario, lo que consta es que ambas instituciones han efectuado inspecciones o intervenciones y han atribuido el origen del rebalse a infraestructura que, según cada una, no se encuentra bajo su administración. En consecuencia, persiste una falta de determinación institucional concluyente sobre el origen del problema y sobre las medidas concretas necesarias para atenderlo.
Esta Sala no desconoce que cada institución debe actuar dentro del marco de sus competencias legales y técnicas. Tampoco corresponde a esta jurisdicción sustituir el criterio especializado de las autoridades competentes para determinar, por sí misma, si el pozo pertenece a la red pluvial o al alcantarillado sanitario. No obstante, desde la perspectiva constitucional, resulta inadmisible que una situación denunciada desde meses atrás, conocida al menos desde octubre de 2025 por las autoridades involucradas y vinculada con posibles afectaciones a la salubridad pública, permanezca sin una solución efectiva debido a criterios institucionales contrapuestos.
El deber de tutela de la salud y del ambiente exige que las entidades recurridas coordinen de manera efectiva, practiquen las verificaciones conjuntas que resulten necesarias y definan, con sustento técnico, el origen del rebalse y la autoridad responsable de ejecutar las medidas correctivas. La ausencia de una solución definitiva, frente a una situación que ha sido puesta en conocimiento de ambas instituciones y que involucra condiciones potencialmente insalubres, configura una lesión a los derechos fundamentales invocados.
Por consiguiente, lo procedente es la estimatoria del recurso, a fin de ordenar al ICAA y a la Municipalidad de Desamparados que, de forma coordinada y dentro del ámbito de sus respectivas competencias, realicen una inspección técnica conjunta en el sitio denunciado, determinen con precisión el origen del rebalse y la naturaleza de la infraestructura involucrada, y adopten las medidas que correspondan para atender la situación, de manera que no continúe trasladándose a la comunidad la carga derivada de la falta de definición interinstitucional.
VI.Nota del magistrado Castillo Víquez, en cuanto a la justicia administrativa pronta y cumplida. He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicci ón Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales.
A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia. Por ende, salvo aquellas controversias jurí dico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.
VII.Nota del magistrado Salazar Alvarado. En asuntos ambientales, es también criterio del suscrito, de que si ya ha habido intervención de la Administración Pública, considero que su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que la parte recurrente acusa que existe una fuga de aguas negras en las inmediaciones de Plaza Higuerones, en San Rafael Abajo de Desamparados, que genera malos olores, proliferación de insectos y afectaciones a la salud de los vecinos, sin que, pese a las múltiples denuncias presentadas, el Instituto Costarricense de Acueductos y Alcantarillados y la Municipalidad de Desamparados hayan adoptado medidas efectivas para solucionar el problema, atribuyéndose recíprocamente la competencia sobre el caso, en detrimento de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.
VIII.Nota de la magistrada Garro Vargas. En otras oportunidades, cuando hay un conflicto jurídico y/o fáctico de gran envergadura entre las instancias involucradas sobre cuál es la competente para resolver el problema que aqueja la parte recurrente, he considerado que el asunto no puede dilucidarse en esta jurisdicción sino en la jurisdicción contencioso-administrativa.
Sin embargo, en el presente caso no parece que se trate de un problema de orden jurídico sino fáctico puntual -aunque determinante- que bien puede aclararse como parte de la coordinación.
IX.Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles, contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión No. 27-11, del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial No. 19, del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión No. 43-12, celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara con lugar el recurso. Se ordena a María Antonieta Naranjo Brenes, en su condición de alcaldesa de la Municipalidad de Desamparados y a Lourdes María Suárez Barboza, en su condición de presidenta ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados, o a quienes ocupen esos cargos, que coordinen lo necesario y giren las instrucciones pertinentes para que, dentro del plazo de UN MES, contado a partir de la notificación de esta sentencia, se realice una inspección técnica conjunta en las inmediaciones de Plaza Higuerones, en San Rafael Abajo de Desamparados, a fin de determinar, con precisión técnica, el origen del rebalse denunciado y la naturaleza de la infraestructura involucrada. Asimismo, se les ordena que, una vez realizada la inspección técnica conjunta y determinada la causa del rebalse y la institución competente para su atención, adopte, dentro del plazo de TRES MES, contado a partir de dicha determinación técnica, y dentro del ámbito de sus respectivas competencias, las medidas administrativas, técnicas y materiales que correspondan para solucionar la situación denunciada.
Se advierte a las autoridades recurridas que, de conformidad con el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien reciba una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo, y no la cumpla o no la haga cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Desamparados y al Instituto Costarricense de Acueductos y Alcantarillados al pago de las costas, daños y perjuicios ocasionados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. El magistrado Castillo Víquez consigna nota. El magistrado Salazar Alvarado pone nota. La magistrada Garro Vargas consigna nota. Notifíquese.
