Background:

  1. 1By written submission incorporated into the electronic case file on April 15, 2026, the petitioner files an amparo petition. He alleges that in the public zone (zona pública) of the maritime-terrestrial zone (zona marítimo terrestre) of Puerto Viejo and Cocles, in the canton of Talamanca, an illegal occupation has become entrenched through makeshift structures known as "chinamos," extending to the Cocles area. He further alleges that certain commercial establishments, such as restaurants, have privatized the zone, thereby harming public leisure (solaz), pedestrian access, and the scenic beauty characteristic of the area. He notes that within those structures, lucrative commercial activities are conducted without a concession (concesión), municipal permits, sanitary permits, or environmental permits, in clear violation of the legal framework. He states that those activities take place under entirely inadequate conditions, without sanitary controls, without waste management, and without minimal infrastructure, generating an evident risk to public health.He alleges that the occupation has caused serious environmental harm, affecting coastal vegetation, including beach almond trees, coconut palms, and undergrowth that form part of a biological corridor (corredor biológico) of high ecological significance, linked to the Refugio Nacional de Vida Silvestre Gandoca-Manzanillo and to the Parque Nacional Cahuita, sites where white-faced capuchin monkeys, sloths, iguanas, and great green macaws were frequently observed. He also contends that the free access of citizens to the public domain (dominio público) has been impaired, undermining its common use. He states that he has filed formal complaints with various authorities, including the Ministerio de Salud, Ministerio de Ambiente y Energía, Dirección General de Migración y Extranjería, and the Municipalidad de Talamanca. He mentions that on January 16, 2026, he filed a formal complaint with the Procuraduría General de la República, with no response or action taken to date.He charges that, despite effective knowledge of the situation, none of the respondent authorities has adopted effective measures, thereby allowing the persistence, expansion, and consolidation of the illegal conduct. He contends that the administrative omission has resulted in a progressive worsening of the environmental, social, and legal harm, constituting a situation of high injuriousness to the public interest. The petitioner submits complaints filed with the respondent authorities on January 16, 2026. He requests the intervention of this Chamber.
  2. 2By resolution issued at 8:33 a.m. on April 30, 2026, the President of the Chamber admitted the amparo petition and requested reports from the Minister of Ambiente y Energía, the Director of the Dirección de Protección al Ambiente Humano of the Ministerio de Salud, the Procurador General de la República, and the Mayor and the head of the Departamento de Zona Marítimo Terrestre, both of the Municipalidad de Talamanca.
  3. 3By written submission incorporated into the electronic case file on May 6, 2026, Iván Vinicio Vicenti Rojas, in his capacity as Procurador General de la República, reports under oath. He states: "First: These are the same facts that the petitioner set out in the letter he directed to the Procuraduría on January 16 of this year. However, the Procuraduría has no knowledge of the veracity of those facts or of who may have committed them. In any event, the facts described are not attributable to the Procuraduría General de la República, since, as will be explained below, it is not a body that exercises functions of active administration (administración activa), environmental police enforcement, or direct demanial control over State property. Second: The foregoing response to the first point is reiterated, as this constitutes additional details regarding the facts that the petitioner communicated to the Procuraduría in his letter of January 16.Third: The foregoing response to the first point is reiterated, as this constitutes additional details regarding the facts that the petitioner communicated to the Procuraduría in his letter of January 16. It is true that the petitioner submitted a letter to the Procuraduría, titled 'complaint for illegal occupation of the public domain and environmental harm in the public zone of the ZMT — Puerto Viejo Centro and Cocles'; however, it must be clarified that this letter was submitted to the Procuraduría on January 16, 2026 (see exhibit no. 1 and the image of the letter submitted to the Procuraduría that the petitioner provides as evidence).It is entirely false that the Procuraduría did not respond to the petitioner's request; on the contrary, the institution addressed the request as follows: — On January 21, 2026, official letter no. DAA-OFI-65-2026 was issued, by which Procuradora Natalia Aguilar Porras, to whom the matter was assigned, forwarded the petitioner's request to the Tribunal Ambiental Administrativo and requested that it 'conduct proceedings in compliance with due process, so as to determine the merit of a possible violation of environmental protection legislation and the consequent adoption of preventive or corrective measures, pursuant to the powers conferred under Articles 1, 2, 98, 99, 101, 103, 106, 108, and 111 of the Ley Orgánica del Ambiente.' (See exhibit no. 1). — On January 21, 2026, official letter no. DAA-OFI-66-2026 was issued, by which Procuradora Aguilar Porras forwarded the petitioner's request to the Municipalidad de Talamanca and requested that it 'take whatever action is appropriate in accordance with the municipal entity's competences.' (See exhibit no. 1). — On January 21, 2026, official letter no. DAA-OFI-67-2026 was issued, by which the same Procuradora responded to the petitioner regarding his request, informing him that 'Pursuant to Article 111 of the Ley Orgánica del Ambiente, we are forwarding 1 attached image, constituting a complaint, to the Tribunal Ambiental Administrativo, which we have requested to conduct proceedings in compliance with due process, in order to determine the merit of a possible violation of environmental protection legislation and the consequent adoption of preventive or corrective measures.This is done in accordance with the powers conferred under Articles 1, 2, 98, 99, 101, 103, 106, 108, and 111 of the Ley Orgánica del Ambiente. We have also forwarded said complaint image to the Municipalidad de Talamanca, pursuant to Articles 12, 13, and 20 of Ley No. 6043.' Copies of the official letters sent to the Tribunal Ambiental Administrativo and to the Municipalidad de Talamanca were also enclosed. (See exhibit no. 1). — Official letter no. DAA-OFI-67-2026 was properly communicated to the email address that Mr. Nombre01 designated as the means of receiving notifications in the request submitted on January 16, 2026, ...01, on January 21, 2026. (See exhibit no. 1). — The Tribunal Ambiental Administrativo opened case no. 17-26-02-TAA as a result of official letter no. DAA-OFI-65-2026 of January 21, 2026, by which the Procuraduría forwarded the petitioner's request. And, as indicated in the received email, the case is currently under investigation and resolution.(See exhibit no. 2). Eighth: This is not true. I reject it. As demonstrated in the response to the preceding point, the Procuraduría did in fact address and respond to the petitioner's request correctly and in a timely manner. Ninth: It is not true that there was any administrative omission on the part of the Procuraduría. As demonstrated in the response to the seventh point, the institution did address and respond to the petitioner's request correctly and in a timely manner. However, the Procuraduría has no knowledge of the veracity of the environmental harm alleged by the petitioner or of who may have caused it. In any event, the facts described are not attributable to the Procuraduría General de la República, since, as will be explained below, it is not a body that exercises functions of active administration, environmental police enforcement, or direct demanial control over State property.II. SUBJECT MATTER OF THE PETITION AND CLAIMS AGAINST THE PROCURADURÍA. According to the petition for amparo, it is requested that the petition be granted, that the existence of an unconstitutional omission on the part of the respondent institutions be declared, and further, that the respondents be ordered, within a peremptory deadline, to act in a coordinated manner to recover the public domain, eliminate the illegal occupations, protect the environment, and guarantee public health; to transmit testimony to the Ministerio Público for the investigation of possible liability for dereliction of duties; and that the State be ordered to pay costs, damages, and losses. As already anticipated in the responses to the facts of the case and as will be set forth below, the claims of the petition are inadmissible as regards the Procuraduría General de la República. III. THE PROCURADURÍA ATTENDED TO THE PETITIONER'S REQUEST IN A TIMELY MANNER AND WITHIN THE SCOPE OF ITS LEGAL COMPETENCES.As set forth and demonstrated in the responses to the facts of the amparo petition, on January 16, 2026, the Procuraduría received a letter that Mr. Nombre01 titled 'complaint for illegal occupation of the public domain and environmental harm in the public zone of the ZMT — Puerto Viejo Centro and Cocles.' In that request, the petitioner indicated that in the area of Puerto Viejo and Cocles, there is an illegal occupation of the public zone, with commercial structures that lack a concession, that obstructs the free access of persons, and that causes serious harm to the environment. In that request, the petitioner sought: '1. That the Procuraduría intervene ex officio in defense of the public domain. 2. That the competent institutions be formally urged to proceed with the immediate closure and eviction of the illegal occupants. 3. That the possible administrative liability for omission on the part of officials who have tolerated this situation be analyzed. 4.I request a formal response regarding the processing of this complaint.' In response to that request, the Procuraduría, through official letters nos. DAA-OFI-065-2026 and DAA-OFI-066-2026 of January 21, 2026, forwarded the complaint to the Tribunal Ambiental Administrativo and to the Municipalidad de Talamanca, so that both institutions, in the exercise of their competences, might receive and process the matter. And subsequently, through official letter no. DAA-OFI-067-2026 of January 21, 2026, notified that same day, it responded to Mr. Nombre01's letter, informing him of the steps taken by the Procuraduría to address the situation of illegal occupation of the maritime-terrestrial zone that he had raised. Thus, it has been demonstrated that the Procuraduría attended to and handled Mr. Nombre01's request in a timely manner, having responded in fewer than three business days. Moreover, the attention, handling, and response of the Procuraduría to the matter raised by the petitioner conformed to the scope of its legally assigned competences.As already noted in the response to the amparo petition docketed under case no. 26-10395-0007-CO, the Procuraduría General de la República is, by express legal mandate, the superior technical-legal advisory body of the Public Administration and the representative of the State in judicial matters. Its institutional function is confined to the issuance of legal opinions and advisory rulings and to the procedural representation of the State before courts of justice. The Procuraduría does not exercise functions of active administration, does not hold police power (potestad de policía), does not issue orders to the entities and bodies of the Public Administration in the exercise of their own competences, and cannot substitute them in the making of their executive decisions. Accordingly, the Procuraduría is not the hierarchical superior of the Municipalidad de Talamanca and, therefore, has no competence to substitute it in decision-making, to review or annul the acts it has adopted in the exercise of its own competences, or to act as a controller of legality of its actions, except in the strictly enumerated cases set forth in Articles 173 and 183 of the Ley General de la Administración Pública — concerning absolute, evident, and manifest nullity of favorable acts, which are neither invoked nor configured in the present matter.Nor can the Procuraduría substitute the Municipalidad de Talamanca in the exercise of its competences to directly oversee compliance with the rules of Ley 6043, concerning the dominion, development, use, and enjoyment of the maritime-terrestrial zone (Articles 3, 34, and 35 of Ley 6043). Article 13 of that same body of law confers upon the Municipalidad de Talamanca the police power and administrative eviction authority over the coastal strip, without the need for judicial authorization, in accordance with the principle of demanial self-protection (autotutela del dominio público), which constitutes a power-duty that obligates the Administration holding title to public domain property to exercise continuous oversight over its public domain assets, preserving them from deterioration and improper use through the application of protective sanctions that safeguard the collective social order.(Barckausen, H., cited by Marienhoff, M.: Tratado de dominio público, Ed T. E. A. In the same vein, Cassese, S., I beni pubblici, A., Giuffré, Milano, 1969, p. 313. See rulings of this Constitutional Chamber nos. 04380–2009, 13655–2008, 13073–2009, 14453-2010, 13072–2009, among others). Pursuant to Article 34 of Ley 6043, the Municipalidad must directly attend to the care and conservation of the maritime-terrestrial zone and its natural resources, and, to that end, must have the necessary inspectors, who in the performance of their duties are vested with full authority and have free access to all land and installations, except private residences, all in accordance with the law. Therefore, it is precisely the Municipalidad de Talamanca — and not the Procuraduría — that has direct knowledge of the illegal occupants, administers the registry of concessions and permits, conducts physical inspections, and possesses the legal and factual instruments to execute the eviction of the violators and restore the free transit and public use of the public zone.Furthermore, given that the petition raises a possible impact on the natural resources of the Refugio de Vida Silvestre Gandoca Manzanillo, as noted in the report submitted in case no. 26-10395-0007-CO, the resources within that refuge fall under the exclusive competence, control, and management of the Sistema Nacional de Áreas de Conservación and the Ministerio de Ambiente y Energía, through the Área de Conservación La Amistad Caribe, whose demanial self-protection powers are equivalent to those of municipalities with respect to that category of protected spaces, and the Procuraduría does not exercise functions of active administration over that protected area. Furthermore, the body legally competent to receive, process, and resolve, at the administrative level, complaints against public or private persons regarding active or omissive conduct that violates or threatens to violate the rules of environmental or natural resources legislation — and to impose the corresponding sanctions and resolve matters relating to environmental damages arising from such conduct — is the Tribunal Ambiental Administrativo, a decentralized body (órgano desconcentrado) of the Ministerio de Ambiente y Energía created by Articles 99, 103, 107, and 111 of the Ley Orgánica del Ambiente, no. 7554 of October 13, 1995.Article 107 of that Law provides that any person may file a complaint before the Tribunal regarding facts that, in their judgment, constitute a violation of environmental legislation, while Articles 111 and 112 provide that the Tribunal itself may forward or receive complaints from public institutions that have knowledge of such conduct. The Procuraduría only assists before that Tribunal when formally given standing and there are legal grounds justifying it, and no competence to autonomously process or resolve environmental complaints may be derived from that role. Consequently, the Procuraduría's approach to Mr. Nombre01's request was correct and in accordance with the scope of its competences. In adherence to the provisions of Ley 6043 regarding municipal competences in the management, administration, and protection of the maritime-terrestrial zone, and the provisions of the Ley Orgánica del Ambiente regarding the processing of complaints about environmental harm, the Procuraduría forwarded the petitioner's letter to the Municipalidad de Talamanca and to the Tribunal Ambiental Administrativo, so that both institutions, in the exercise of their functions of active administration, might process it and carry out the relevant actions.Furthermore, the Procuraduría is not competent to substitute or supervise the Ministerio de Salud or the Ministerio de Gobernación y Policía in the exercise of their competences relating to the sanitary conditions of commercial activities or those relating to the carrying out of lucrative activities by foreigners in an irregular immigration status, as mentioned in the amparo petition and in the evidence submitted. Therefore, based on all of the foregoing, there is no unlawful act or omission attributable to the Procuraduría General de la República that has violated the right to a healthy and ecologically balanced environment, the right to health, legal certainty, effective judicial protection, or any of the other rights mentioned by the petitioner. Accordingly, it is not appropriate to declare the existence of an unconstitutional omission on the part of the Procuraduría, nor to order the institution to carry out actions to recover the public domain, eliminate the illegal occupations, protect the environment, and guarantee public health, since, as set forth above, those are competences of other administrative bodies.And, given that it has been demonstrated that the Procuraduría attended to the petitioner's request in a timely manner and within the scope of its legal competences, it is entirely inappropriate to transmit testimony to the Ministerio Público for the investigation of possible liability for dereliction of duties. Finally, there is no act or omission on the part of the Procuraduría that could give rise to a judgment against the State for the payment of costs, damages, and losses (…) Based on the factual and legal considerations set forth herein, I respectfully request of the Honorable Constitutional Chamber:1) To declare the present amparo petition WITHOUT MERIT as regards the Procuraduría General de la República, inasmuch as this body has not engaged in any unlawful act or omission that violates any fundamental right of the petitioner.2) To reject the request to order the Procuraduría, within a peremptory deadline, to act in a coordinated manner to recover the public domain, eliminate the illegal occupations, protect the environment, and guarantee public health.3) To reject the request to transmit testimony to the Ministerio Público for the investigation of possible liability of the Procuraduría for dereliction of duties.4) To reject the claim for a judgment in costs, damages, and losses against the Procuraduría."
  4. 4By written submission incorporated into the electronic case file on May 6, 2025, Franz Tattenbach Capra, in his capacity as Minister of Environment and Energy, reports under oath. He states: "FIRST: The writ of amparo (recurso de amparo) is a judicial proceeding conducted before the Constitutional Chamber (Sala Constitucional) and constitutes what is known as the constitutional jurisdiction of liberty (jurisdicción constitucional de la libertad); its existence guarantees the validity of the fundamental rights established in the Political Constitution and in the international human rights treaties in force in the country. The Ley de la Jurisdicción Constitucional establishes in its Article 29 that the writ of amparo guarantees the fundamental rights and liberties referred to in that law, except those protected by habeas corpus; it further provides that the writ lies against any provision, agreement, or resolution, and in general against any action, omission, or simple material act not grounded in a valid administrative act, by public servants and public bodies, that has violated, violates, or threatens to violate any of those rights.It lies not only against arbitrary acts, but also against actions or omissions based on erroneously interpreted or improperly applied legal norms. SECOND: Within the Costa Rican legal order, the writ of amparo derives from constitutional norms 10 and 48 of the Political Constitution, which establish that every person has the right to the writ of amparo to maintain or restore enjoyment of the rights enshrined in the Constitution, as well as of the fundamental rights established in the international human rights instruments applicable in the Republic. There is an entire title within that body of law setting forth a series of individual rights and guarantees, such as the right to life in Article 21, the right to privacy, liberty, and confidentiality of communications in Article 24, the right to equality enshrined in Article 33, the right of consumers and users (of public services) to environmental protection in Article 46, and many others established among the social rights and guarantees, such as the right to a healthy and ecologically balanced environment and the corresponding state duty to protect it in Article 50, and the state duty to protect natural beauty.III. With respect to what this Honorable Chamber ordered: 'To render a report within THREE BUSINESS DAYS following notification of this resolution.' In response to the requirement set forth in case file 26-013062-0007-CO, at eight hours and thirty-three minutes on April 30, 2026, the following is reported: In compliance with the Chamber's mandate, a report was requested from the Directorate of the La Amistad Caribbean Conservation Area (Área de Conservación La Amistad Caribe) as the competent body, which reported the following through report CARTA-SINACACLAC-DR-0356-2026: FIRST: That on January 19, 2026, through a transfer from the Office of the Deputy Minister of Environment with consecutive number Priv.028, a referral was made to the Regional Directorate of the La Amistad Caribbean Conservation Area with a request to respond directly to the interested party, with a copy to this Office.SECOND: That on January 20, 2026, through official communication CARTA-SINAC-ACLAC-DR-0044-2026, the complaint was transferred to Mr. Deiver Contreras Arguedas, head of the prevention, control, and protection program, for his attention and response. THIRD: That through official communication CARTA-SINAC-ACLAC-PPCP-043-2026 dated March 7, 2026, the complaint was referred to the Municipality of Talamanca, as it falls within that body's jurisdiction. FOURTH: That on April 17, 2026, the Mayor's Office assigned the handling of the complaint to Helmer Zumbado Edwards, Byron Marchena Esquivel, and Jesús Alanís Nelson via email. FIFTH: That in follow-up to the process and in order to keep the complainant informed, official communication CARTA-SINAC-ACLACPPCP-089-2026 was sent on May 4, 2026, in which the following was communicated: 'In attention and follow-up to the complaint filed with the Office of the Minister of Environment and Energy, Mr.Franz Tattenbach Capra, concerning alleged encroachments, structures, and activities in the public zone (zona pública) of the Maritime-Terrestrial Zone (Zona Marítimo Terrestre, ZMT) in the sectors of Puerto Viejo and Cocles, canton of Talamanca, and referred for attention through official communication CARTA-SINAC-ACLAC-DR-0044-2026 dated January 20, 2026, a response is hereby provided within the scope of SINAC-ACLAC's competencies. In your written submission, you expressly requested: "That MINAE immediately order and carry out environmental protection, recovery, restoration, and restitution actions in the public zone of the ZMT in Puerto Viejo and Cocles." "That the immediate eviction of all persons, structures, and activities illegally occupying said zone be coordinated." "That effective preventive and corrective measures be adopted to prevent the reestablishment of these encroachments and the continuation of environmental harm." "I request a formal response to the processing of this complaint." In this regard, your requests are addressed in the same order presented: Regarding the request for protection, recovery, restoration, and restitution of the public zone of the ZMT: The Ley sobre la Zona Marítimo Terrestre, N.° 6043, establishes that the Maritime-Terrestrial Zone constitutes part of the national patrimony, belongs to the State, and is inalienable and imprescriptible, with the State, its institutions, and all inhabitants under an obligation to protect it and conserve its natural resources.Likewise, that law provides that it falls to the municipalities to directly oversee compliance with the rules governing the ownership, development, exploitation, and use of the Maritime-Terrestrial Zone, and that the usufruct and administration of the public zone and the restricted zone (zona restringida) belong to the municipality of the respective jurisdiction. In that regard, for the specific case of the Puerto Viejo sector, direct administration of the Maritime-Terrestrial Zone falls to the Municipality of Talamanca, without prejudice to the environmental competencies that may correspond to SINAC when harm to natural resources, ecosystems, wildlife, forest cover (cobertura boscosa), wetlands, mangroves, protected areas, or other elements under environmental stewardship is identified. For the foregoing reasons, through official communication CARTA-SINAC-ACLAC-PPCP-0432026 dated March 7, 2026, this coordination formally referred to the Municipality of Talamanca the complaint filed by you, so that the Municipality may assess, within its competencies, the existence or non-existence of permits, concessions, municipal authorizations, administrative acts, case files, or any other background information related to the reported structures and activities.In that same communication, ACLAC expressed its willingness to coordinate a potential joint on-site inspection, so as to facilitate a comprehensive assessment of the case in accordance with each institution's competencies. Regarding the request for the immediate eviction of persons, structures, and activities: With respect to the request for immediate eviction, it is necessary to note that Ley N.° 6043 prohibits, without the proper legal authorization, the erection of buildings or installations, the felling of trees, the extraction of products, or any other type of development, activity, or occupation within the Maritime-Terrestrial Zone. Likewise, that regulation establishes that, when the competent authorities become aware of violations, they may proceed—after having gathered the relevant information if deemed necessary—to the eviction of violators and the destruction or demolition of constructions, remodeling works, or installations carried out outside the law.However, in order to validly proceed with eviction, demolition, or removal measures, the competent authority must first determine the exact location of the reported structures, their relationship to the public or restricted zone, the existence or non-existence of authorizations, permits, concessions, or administrative acts, as well as any other legal or technical condition applicable to the specific case. For these reasons, it falls to the Municipality of Talamanca, as direct administrator of the Maritime-Terrestrial Zone within its jurisdiction, to conduct the corresponding administrative analysis and determine the appropriate actions, without prejudice to any inter-institutional coordination that may be required with SINAC, the Fuerza Pública, the Ministerio Público, or other competent authorities, should illegal encroachment or associated environmental harm be established. Regarding the adoption of preventive and corrective measures: In relation to the adoption of preventive and corrective measures to prevent the reestablishment of encroachments or the continuation of possible environmental harm, this coordination considers it essential that, first and foremost, the Municipality of Talamanca determine the legal status of the reported structures, activities, or occupations, as well as the existence of permits, concessions, authorizations, prior studies, or administrative case files linked to the site.Once that municipal assessment has been conducted, and should possible environmental harm be identified, SINAC-ACLAC may assess, within its technical competencies, the preparation of reports, technical opinions, or environmental expert assessments, as appropriate. Should a possible environmental violation or potential harm to natural resources be established, such inputs may be referred to the Ministerio Público or to the competent administrative authority, so that it may evaluate the preventive, corrective, precautionary, or judicial actions appropriate under due process. Likewise, SINAC-ACLAC remains prepared to participate in a joint inspection with the Municipality of Talamanca, provided that such a proceeding is formally coordinated and allows the case to be addressed comprehensively, distinguishing the aspects of Maritime-Terrestrial Zone administration from those that are strictly environmental.Regarding the status of the complaint process: As to the processing of your complaint, it is reported that, in addition to the internal referral made by the ACLAC Regional Directorate through official communication CARTA-SINAC-ACLAC-DR-0044-2026, this coordination forwarded the matter to the Municipality of Talamanca through official communication CARTASINAC-ACLAC-PPCP-043-2026 dated March 7, 2026. Subsequently, on Friday, April 17, 2026, the Office of the Mayor of Talamanca communicated, by email, the assignment of municipal officials Helmer Zumbado Edwards, Byron Marchena Esquivel, and Jesús Alanís Nelson to handle the note submitted by you and the communication sent by SINAC-ACLAC. Accordingly, this Conservation Area remains awaiting the actions, assessments, or coordination that the Municipality of Talamanca, in its capacity as direct administrator of the Maritime-Terrestrial Zone in the canton, may decide upon, in order to determine whether a joint inspection should be conducted or other technical actions within SINAC-ACLAC's scope of competence should be activated.Finally, it is clarified that this response is issued within the competency framework of SINAC-ACLAC and does not substitute the pronouncement that the Municipality of Talamanca is responsible for issuing with regard to permits, concessions, encroachments, evictions, demolitions, or administrative recovery of the Maritime-Terrestrial Zone. Nevertheless, this institution remains prepared to attend to, document, and refer to the corresponding authorities any verifiable environmental harm that may be found at the site.' SIXTH: That the request by Nombre01 was processed through the internal institutional communication channels of the Ministry of Environment and Energy for the handling of complaints. Considering the principle of inter-institutional coordination (coordinación interinstitucional) framed by the Political Constitution, the Ley General de la Administración Pública (N° 6227), and the Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos (N° 8220), the complaint was referred to the Municipality of the Canton of Talamanca as administrator of the area in which the complaint was filed, given that SINAC-MINAE lacks jurisdiction to regulate the reported activities.The foregoing reflects the proper exercise of the principle of inter-institutional coordination as a pillar of administrative law and public management, which seeks to harmonize the actions of different public bodies and agencies to ensure efficacy and efficiency and to avoid duplication of effort or contradictions in their functions. In order to keep the complainant informed about the progress of the matter, official communication CARTA-SINAC-ACLAC-PPCP-089-2026 was sent, with details of the steps taken for follow-up. SEVENTH: In light of the facts set forth and the attached documentation, it is conclusively demonstrated that the La Amistad Caribbean Conservation Area has acted at all times strictly within its legal and technical competencies, and no omission whatsoever on the part of this institution exists. EIGHTH: The situation described by the appellant regarding the improvised makeshift stalls ("chinamos") and the commercial establishments that have allegedly privatized the zone falls within the primary and exclusive jurisdiction of the Municipality of Talamanca, specifically its Mayor's Office and its Maritime-Terrestrial Zone Department, by virtue of the provisions of the Código Municipal and the Ley sobre Zona Marítimo Terrestre.It is that municipality that is responsible for issuing occupancy permits, carrying out the corresponding evictions, and preventing the spread of illegal encroachments along that coastal strip. PETITION 1. In accordance with the foregoing and the documentary evidence provided, the required report has been submitted; therefore, this Ministry requests that the Honorable Chamber note compliance with the mandate ordered by it. 2. Based on the arguments and evidence presented, declare the writ of amparo filed by Nombre01 without merit."
  5. 5By written submission incorporated into the electronic case file on May 7, 2026, Mariela de los Ángeles Marín Mena, in her capacity as acting Director General of Health with additional responsibility for the Directorate of Environmental Health of the Ministry of Health, reports under oath. She states: "I address the present writ of amparo on the basis of Technical Report No. CARTA-MS-DRRSHC-DARST-1235-2026, dated May 5, 2026, issued by Dr. Jennifer Jones Villiers, Director of the Regional Health Authority (Área Rectora de Salud) of Talamanca, which reports the following: 'With respect to the appellant's comments regarding the illegal occupation through improvised structures known as "chinamos" in the public zone of the Maritime-Terrestrial Zone (ZMT) extending from Puerto Viejo to Cocles, it must be stated that the ZMT falls within the material and territorial jurisdiction—including the granting of permits for constructions and business licenses (patentes)—of the Municipality of Talamanca as mandated by law, which must exercise its authority in full sovereignty, a sovereign power of imperium (potestad de imperio) rooted in that regulatory framework.For this reason, there exists no formal legal or technical obligation in the legislation requiring us to issue opinions for the acceptance or rejection of an Operating Health Permit (Permiso Sanitario de Funcionamiento, PSF) in said zone, as that authority is a municipal power, which must exercise oversight within its jurisdiction. What is clearly ordered of us through the Reglamento general para Permisos Sanitarios de Funcionamiento, Permisos de Habilitación y Autorizaciones para Eventos Temporales de Concentración Masiva de Personas, otorgados por el Ministerio de Salud, Decreto Ejecutivo N°43432-S, in its Articles 8 and 13, obliges the administration to duly process PSF applications filed for the first time and/or renewals submitted to our office. For our purposes, we are obligated to attend to the applications submitted through the single window (ventanilla única) in compliance with Decreto Ejecutivo N°43432-S that meet the technical and legal requirements, so as to be able to conduct inspections of those permit applications and, if appropriate, to issue the PSF.Outside of that context, with respect to the "chinamos" mentioned in this complaint, we cannot process any health permit, as they fall outside the scope of our legal authority. It will fall to the local Municipality to assume the authority to exercise health oversight and control through its municipal inspectors, since for our purposes in health matters we can only conduct physical-health inspections if they are covered by the Reglamento especial para el control de riesgos sanitarios en ventas autorizadas in accordance with Article 218 bis of the Ley General de Salud, N°41332-S-MTSS. Within recital (considerando) 4 of Decreto Ejecutivo N°41332-S-MTSS, it is stated that "through the addition of Article 218 bis of Law N°5395 of October 30, 1973, 'Ley General de Salud,' municipalities may regulate the circumstances in which temporary permits may be granted for the sale of fruit and for the preparation and sale of food and beverages at sites previously defined by them; provided that the necessary public services are in place to guarantee the protection of public health." Likewise, according to recital 6, it is established that "it is the duty of natural persons who hold a temporary permit granted by the respective municipality for the sale of fruit and for the preparation and sale of food and beverages at sites defined by the municipality, to ensure the safety and quality of food and beverages, in order to guarantee the health of the population." As the regulations clearly provide, it is the municipalities that must process permits provided that the site conditions for the sale of fruit and the preparation and sale of food and beverages are met, as ordered by Article 4 of the above-cited decree.Furthermore, Article 218 bis of the Ley General de Salud establishes that "Municipalities may regulate, within their respective jurisdictions, the circumstances in which temporary permits may be granted for commercial activities conducted under the Ley Especial de Comercio sobre Ruedas, for the sale of fruit, and for the preparation and sale of food and beverages at sites previously defined by them, provided that the necessary public services are in place to guarantee the protection of public health (…)." As you will note, we wish to make clear that this Regional Health Authority, under the principle of legality governing public administration, cannot act contrary to what the laws governing this matter require. Despite the existing regulations, the Municipality of Talamanca grants temporary permits to sites that do not meet the physical-health requirements established in the health regulations cited above.Field visits have confirmed that the operators of these stands have shown business license payment receipts. With regard to the environmental harm reported concerning coastal flora and fauna, we cannot issue an opinion as that matter does not fall within this Ministry's authority, being within the material and legal jurisdiction of other public institutions, which are obligated to issue an opinion and thus hold standing. In January 2026, the appellant filed a complaint with the Central Level, which was forwarded to the Regional Health Authority of Talamanca, which through an inadvertent error was not formally registered by this local office. However, this matter has been reviewed in the field through the actions of the health authorities, within our powers. The following are submitted as evidence: — Technical Report No. IT-MS-DRRSHC-DARST-0171-2026 — Technical Report No. IT-MS-DRRSHC-DARST-0206-2026 It is noted that, as health authorities, we issue PSFs to sites or establishments with a defined structure in which the physical-health aspects are assessed; we do not do so for temporary infrastructure in public locations, except in cases of health authorizations that comply with all requirements established under current regulations in this area.' CONCLUSION: From the foregoing, it is determined that, in light of the regulations cited—the 'Reglamento general para Permisos Sanitarios de Funcionamiento, Permisos de Habilitación y Autorizaciones para Eventos Temporales de Concentración Masiva de Personas, otorgados por el Ministerio de Salud,' Decreto Ejecutivo N°43432-S, and the Ley General de Salud, Ley N°5395—this Ministry has jurisdiction only to process and regulate matters relating to PSF applications submitted through the single window that meet the technical and legal requirements, so as to be able to conduct inspections of those permit applications and, if appropriate, to issue the PSF; for this reason, it will fall to the local Municipality to assume the authority to exercise health oversight and control through its municipal inspectors, since for our purposes in health matters we can only conduct physical-health inspections if they are covered by the Reglamento especial para el control de riesgos sanitarios en ventas autorizadas in accordance with Article 218 bis of the Ley General de Salud, Decreto Ejecutivo Nº41332-S-MTSS.Under these circumstances, we consider that this Ministry has not violated the fundamental rights of the appellant in any way.   3. 10The legal requirements have been observed in the proceedings conducted.

The opinion is drafted by Justice (Magistrado) Rueda Leal; and,

Considering:

I.Preliminary matter. In view of the fact that the head of the Maritime-Terrestrial Zone Department of the Municipality of Talamanca failed to respond to the hearing within the deadline set by this Tribunal in the scheduling resolution in the case at hand (sub lite), the writ is resolved in accordance with Article 45 of the Ley de la Jurisdicción Constitucional and taking into consideration the evidentiary elements appearing in the case record (autos).

II.On the exception under Article 41 of the Political Constitution. Before analyzing the merits of the matter, it must be clarified that, beginning with judgment number 2008002545, issued at 8:55 a.m. on February 22, 2008, this Chamber has referred to the administrative-contentious jurisdiction—with certain exceptions—those matters in which it is disputed whether the Public Administration has or has not complied with the time limits set by the General Law of Public Administration (Articles 261 and 325) or by sector-specific laws governing special administrative procedures, in order to resolve by final act an administrative proceeding—initiated ex officio or at the request of a party—or to rule on the applicable administrative appeals. In the present case, an exceptional scenario arises, since what is before the Court is an environmental complaint filed with the Office of the Attorney General of the Republic, the Ministry of Environment and Energy, the Municipality of Talamanca, and the Ministry of Health, which the complainant alleges has not been resolved within a reasonable time. With that clarification made, the Court proceeds to resolve the specific situation raised in this amparo petition.

III.Subject matter of the appeal. The petitioner alleges that on January 16, 2026, he filed formal complaints with the Ministry of Health, the Ministry of Environment and Energy, the Office of the Attorney General of the Republic, the Directorate General of Immigration and Foreigners (Dirección General de Migración y Extranjería), and the Municipality of Talamanca, on the grounds that, in the public zone (zona pública) of the Maritime-Terrestrial Zone (Zona Marítimo Terrestre, ZMT) of Puerto Viejo and Cocles, canton of Talamanca, an illegal occupation has taken hold through improvised structures known as "chinamos." He adds that certain commercial establishments, such as restaurants, have also privatized the area, to the detriment of public leisure, passage, and the scenic beauty inherent to the location. He states that within these structures, lucrative commercial activities are conducted without any concession, municipal permits, health permits, or environmental permits, in open violation of the legal order.

He asserts that these activities are carried out under absolutely inadequate conditions, without sanitary controls, without waste management, and without minimum infrastructure, thereby creating an evident risk to public health. He alleges that the occupation has caused serious environmental harm, affecting coastal vegetation—including beach almond trees (almendros de playa), coconut palms, and understory (sotobosque)—that forms part of a biological corridor of high ecological relevance, connected to the Refugio Nacional de Vida Silvestre Gandoca-Manzanillo and to the Parque Nacional Cahuita. He accuses all the respondent authorities of having failed, despite their effective knowledge of the situation, to adopt effective measures, thereby allowing the illegality to persist, expand, and consolidate. He requests the intervention of the Chamber.

IV. Proven facts. Of relevance to the decision in this matter, the following facts are deemed to have been duly established

Regarding the Office of the Attorney General of the Republic:

  • a)On January 16, 2026, the petitioner filed a complaint with the Office of the Attorney General of the Republic, stating: "I respectfully appear before this Office of the Attorney General to formally denounce an illegal, systematic, and tolerated occupation of public domain property, specifically of the public zone of the Maritime-Terrestrial Zone in Puerto Viejo center and Cocles, canton of Talamanca, which prevents citizens from freely accessing said strip for leisure and enjoyment. In those areas, illegal commercial structures have been installed that carry out lucrative activities without a concession or authorization, in direct contradiction with Law No. 6043 and with the principles governing the defense of public patrimony. These occupations also generate serious environmental harm, as they directly affect the natural coastal vegetation—beach almond trees, coconut palms, and understory—that sustains a coastal biological corridor of enormous relevance, used by migratory birds, sloths, squirrels, howler monkeys, and white-faced capuchin monkeys, and functionally connecting with the Refugio Nacional de Vida Silvestre Gandoca-Manzanillo and its wetlands and the scenic beauty of the southern Caribbean.

The prolonged inaction of the competent authorities has allowed the consolidation of this illegal situation, creating a precedent that is highly harmful to the State, the environment, and the common use of public assets. I REQUEST: 1. That the Office of the Attorney General intervene ex officio in defense of the public domain. 2. That the competent institutions be formally urged to proceed with the immediate closure and eviction of the illegal occupiers. 3. That the possible administrative liability for omission on the part of officials who have tolerated this situation be analyzed. 4. I request to receive a formal response regarding the processing of this complaint" (see sworn report and supporting evidence submitted).

  • b)By official letter DAA-OFI-65-2026 of January 21, 2026, addressed to the Environmental Administrative Tribunal (Tribunal Ambiental Administrativo), attorney Natalia Aguilar Porras stated: "Based on Articles 111 and 112 of the Organic Law of the Environment (Ley Orgánica del Ambiente), I am forwarding 1 image received from Licenciado Nombre01 (…01), which corresponds to a complaint regarding the illegal occupation of public domain property and environmental harm in the public zone of the ZMT—Puerto Viejo and Cocles, which was received at our offices. In light of the foregoing, we request that proceedings be initiated in compliance with due process, so that the merits of a possible violation of environmental protection legislation may be determined, and the consequent adoption of preventive or corrective measures, in accordance with the powers conferred by Articles 1, 2, 98, 99, 101, 103, 106, 108, and 111 of the Organic Law of the Environment" (see evidence submitted).
  • c)By official letter DAA-OFI-66-2026 of January 21, 2026, addressed to the Municipality of Talamanca, attorney Natalia Aguilar Porras stated: "Based on Articles 12, 13, and 20 of Law No. 6043, I am forwarding 1 image received from Licenciado Nombre01 (…01), which corresponds to a complaint regarding the illegal occupation of public domain property and environmental harm in the public zone of the ZMT—Puerto Viejo and Cocles, which was received at our offices. I hereby request that appropriate action be taken within the competencies of the municipal entity" (see evidence submitted).
  • d)By official letter DAA-OFI-67-2026 of January 21, 2026, attorney Natalia Aguilar Porras replied to the petitioner: "Please receive my cordial greetings. In response to your complaint received at our offices (attached), I respectfully state the following: Based on Article 111 of the Organic Law of the Environment, we have forwarded the 1 attached image, which constitutes a complaint, to the Environmental Administrative Tribunal, which we have requested to initiate proceedings, observing due process, so that it may determine the merits of a possible violation of environmental protection legislation, and the consequent adoption of preventive or corrective measures. This is done in accordance with the powers conferred by Articles 1, 2, 98, 99, 101, 103, 106, 108, and 111 of the Organic Law of the Environment. We have also forwarded said complaint image to the Municipality of Talamanca, pursuant to Articles 12, 13, and 20 of Law No. 6043." Said official letter was sent to the email address …01 at 6:10 p.m. on January 21, 2026 (see evidence submitted).
  • e)The order admitting the amparo petition for processing was notified to the Office of the Attorney General of the Republic on April 30, 2026 (see notification record).

Regarding the Ministry of Health:

  • f)On January 16, 2026, the petitioner filed the following complaint with the Ministry of Health: "(…) I respectfully appear before that authority to bring to its attention facts of extreme sanitary, environmental, and legal gravity occurring in the public zone of the Maritime-Terrestrial Zone (ZMT), specifically in Puerto Viejo center and Cocles, canton of Talamanca, province of Limón. In said public zone, multiple chinamos and improvised structures operate from which activities involving the preparation and sale of food, beverages, crafts, and personal services such as massages and haircuts are carried out, all without sanitary permits, without inspections, without any oversight whatsoever, and entirely outside public health regulations. These activities are carried out under absolutely unsanitary conditions, given that: -There are no sanitary facilities (bathrooms) to meet the physiological needs of those who operate or visit these stalls. -Solid waste is generated on a constant basis, without adequate systems for collection, storage, or final disposal. -A significant portion of solid and liquid waste is thrown directly into the environment, including onto the beach and into the sea. -Other waste is handled in an improvised manner, without any technical, sanitary, or environmental criteria, worsening the contamination of the soil, the waters, and the coastal environment. -Foul odors are also generated, which are not appropriate for a tourist area.

This situation not only constitutes a flagrant violation of the General Health Law (Ley General de Salud), but also represents a real and unacceptable risk to the public health of the local population and of tourists, as well as a factor of severe environmental degradation in a fragile coastal ecosystem of significant ecological importance, connected to a biological corridor of high relevance" (see evidence submitted).

  • g)The order admitting the amparo petition for processing was notified to the director of the Directorate for Protection of the Human Environment (Dirección de Protección al Ambiente Humano) of the Ministry of Health on April 30, 2026 (see notification record).
  • h)The petitioner's complaint was forwarded to the local health governing area (área rectora de salud) of Talamanca; however, it was not formally registered by that local office (see sworn report submitted).

Regarding the Ministry of Environment and Energy:

  • i)On January 16, 2026, the petitioner filed a complaint with the Ministry of Environment and Energy, stating: "(…) I respectfully appear before that authority to bring to its attention facts of extreme environmental and legal gravity occurring in the public zone of the Maritime-Terrestrial Zone (ZMT), specifically in Puerto Viejo center and Cocles, canton of Talamanca, province of Limón. In those areas, in a public, notorious, permanent, and tolerated manner, multiple chinamos and improvised structures have been installed within the public zone of the ZMT, from which lucrative commercial activities such as the sale of food, crafts, and the provision of personal services are carried out, all without a concession, without legal authorization, without environmental viability, and in open violation of the public domain legal framework. These occupations not only constitute an illegitimate usurpation of public domain property prohibited by the Maritime-Terrestrial Zone Law, Law No. 6043, but also cause serious environmental harm by taking place within a coastal ecosystem of the highest ecological relevance.

In the affected public zone there is characteristic natural vegetation, including coconut palms, beach almond trees, and understory, which perform essential ecological functions such as coastal stabilization, shelter, feeding, and biological connectivity for numerous species of wildlife, including migratory birds, sloths, squirrels, howler monkeys, and white-faced capuchin monkeys. Said coastal strip forms part of a continuous biological corridor extending from Puerto Viejo, Cocles, and Punta Uva to Manzanillo, functionally connecting with the Refugio Nacional de Vida Silvestre Gandoca–Manzanillo and its wetlands, a corridor indispensable for the safe movement of fauna and the conservation of biodiversity. The illegal occupation, the removal of vegetation, soil compaction, waste generation, and the associated human disturbance caused by these activities fragment and degrade said biological corridor, producing a cumulative, serious, and potentially irreversible environmental impact, not to mention the harm to the scenic beauty characteristic of the southern Caribbean" (see evidence submitted).

  • j)On January 19, 2026, the petitioner's complaint was forwarded to the Regional Directorate of the La Amistad Caribe Conservation Area (Área de Conservación la Amistad Caribe) (see evidence submitted).
  • k)On March 7, 2026, by official letter CARTA-SINAC-ACLAC-PPCP-043-2026, the complaint was forwarded to the Municipality of Talamanca (see sworn report and evidence submitted).
  • l)On May 4, 2026, by official letter CARTA-SINAC-ACLAC-PPCP-089-2026, the petitioner was informed: "In response to and as a follow-up on the complaint filed with the office of the Minister of Environment and Energy, Mr. Franz Tattenbach Capra, concerning alleged occupations, structures, and activities in the public zone of the Maritime-Terrestrial Zone in the sectors of Puerto Viejo and Cocles, canton of Talamanca, and forwarded for attention by official letter CARTA-SINAC-ACLAC-DR-0044-2026, dated January 20, 2026, a response is hereby provided within the scope of the competencies of SINAC-ACLAC. In your written submission, you expressly requested: 'That MINAE order and immediately carry out environmental protection, recovery, restoration, and restitution actions in the public zone of the ZMT in Puerto Viejo and Cocles.' 'That the immediate eviction of all persons, structures, and activities illegally occupying said zone be coordinated.' 'That effective preventive and corrective measures be adopted to prevent the reinstallation of these occupiers and the continuation of the environmental harm.' 'I request to receive a formal response regarding the processing of this complaint.' In response, your requests are addressed in the same order in which they were raised: Regarding the request for protection, recovery, restoration, and restitution of the public zone of the ZMT: The Maritime-Terrestrial Zone Law, No. 6043, establishes that the Maritime-Terrestrial Zone constitutes part of the national patrimony, belongs to the State, and is inalienable and imprescriptible, and that it is the obligation of the State, its institutions, and all inhabitants to protect it and conserve its natural resources.

Likewise, said law provides that it is the duty of municipalities to directly oversee compliance with the rules governing the dominion, development, use, and exploitation of the Maritime-Terrestrial Zone, and that the usufruct and administration of the public zone and the restricted zone correspond to the municipality of the respective jurisdiction. In that regard, for the specific case of the Puerto Viejo sector, the direct administration of the Maritime-Terrestrial Zone corresponds to the Municipality of Talamanca, without prejudice to the environmental competencies that may correspond to SINAC when impacts on natural resources, ecosystems, wildlife, forest cover (cobertura boscosa), wetlands, mangroves, protected areas, or other elements under environmental stewardship are identified. In light of the foregoing, through official letter CARTA-SINAC-ACLAC-PPCP-043-2026, dated March 7, 2026, this coordination formally forwarded to the Municipality of Talamanca the complaint filed by you, so that said Municipality may assess, within its competencies, the existence or non-existence of permits, concessions, municipal authorizations, administrative acts, case files, or any other related precedents concerning the structures and activities reported.

In that same official letter, ACLAC expressed its willingness to coordinate a possible joint on-site inspection, in order to facilitate a comprehensive assessment of the case in accordance with the competencies of each institution. Regarding the request for the immediate eviction of persons, structures, and activities: With respect to the request for immediate eviction, it is necessary to note that Law No. 6043 prohibits, without the proper legal authorization, erecting buildings or installations, felling trees, extracting products, or carrying out any other type of development, activity, or occupation within the Maritime-Terrestrial Zone. Likewise, said regulations establish that when competent authorities become aware of violations, they may proceed—after gathering the relevant information if deemed necessary—to evict violators and to destroy or demolish constructions, renovations, or installations carried out outside the law.

However, in order to validly proceed with eviction, demolition, or removal measures, the competent authority must first determine the exact location of the reported structures, their relationship to the public or restricted zone, the existence or non-existence of authorizations, permits, concessions, or administrative acts, as well as any other legal or technical conditions applicable to the specific case. For this reason, it is the responsibility of the Municipality of Talamanca, as the direct administrator of the Maritime-Terrestrial Zone within its jurisdiction, to carry out the corresponding administrative analysis and determine the appropriate course of action, without prejudice to the interinstitutional coordination that may be required with SINAC, the Public Security Force (Fuerza Pública), the Public Prosecutor's Office (Ministerio Público), or other competent authorities, should an illegal occupation or an associated environmental impact be established.

Regarding the adoption of preventive and corrective measures: In relation to the adoption of preventive and corrective measures to prevent the reinstallation of occupiers or the continuation of possible environmental harm, this coordination considers it essential that, in the first instance, the Municipality of Talamanca determine the legal status of the reported structures, activities, or occupations, as well as the existence of permits, concessions, authorizations, prior studies, or administrative case files related to the site. Once that municipal assessment has been completed, and should possible environmental impacts be identified, SINAC-ACLAC may evaluate, within its technical competencies, the preparation of reports, technical opinions, or environmental expert assessments, as appropriate. Should a possible environmental violation or eventual damage to natural resources be confirmed, such inputs may be forwarded to the Public Prosecutor's Office or to the competent administrative authority, so that appropriate preventive, corrective, precautionary, or judicial actions may be assessed in accordance with due process.

Likewise, SINAC-ACLAC remains willing to participate in a joint inspection with the Municipality of Talamanca, provided that such a proceeding is formally coordinated and allows the case to be addressed comprehensively, distinguishing aspects related to the administration of the Maritime-Terrestrial Zone from those that are strictly environmental in nature. Regarding the status of the complaint proceedings: As to the processing of your complaint, please be informed that, in addition to the internal referral made by the ACLAC Regional Directorate through official letter CARTA-SINAC-ACLAC-DR-0044-2026, this coordination forwarded the case to the Municipality of Talamanca through official letter CARTA-SINAC-ACLAC-PPCP-043-2026, dated March 7, 2026. Subsequently, on Friday, April 17, 2026, the office of the Mayor (Alcaldía Municipal) of Talamanca communicated, by email, the assignment of municipal officials Helmer Zumbado Edwards, Byron Marchena Esquivel, and Jesús Alanís Nelson to attend to the note filed by you and to the official letter sent by SINAC-ACLAC.

Consequently, this Conservation Area remains awaiting the actions, assessments, or coordination that the Municipality of Talamanca, in its capacity as direct administrator of the Maritime-Terrestrial Zone in the canton, may decide to undertake, in order to determine whether a joint inspection should be conducted or other technical actions should be activated within the scope of SINAC-ACLAC's competencies. Finally, it is clarified that this response is issued within the competency framework of SINAC-ACLAC and does not substitute for the pronouncement that the Municipality of Talamanca must issue regarding permits, concessions, occupations, evictions, demolitions, or the administrative recovery of the Maritime-Terrestrial Zone. Nonetheless, this institution maintains its willingness to address, document, and refer to the corresponding authorities any verifiable environmental impact that may be confirmed on site" (see sworn report and evidence submitted).

Regarding the Municipality of Talamanca:

  • m)On January 16, 2026, the petitioner filed a complaint with the Municipality of Talamanca (uncontested fact).
  • n)The Office of the Attorney General of the Republic and the Ministry of Environment and Energy forwarded the petitioner's complaints to the Municipality of Talamanca (see sworn reports submitted).
  • o)The Municipality of Talamanca prepared the following table of interventions in response to the illegitimate occupation in the zone:

Regarding the Directorate General of Immigration and Foreigners:

  • p)On January 16, 2026, the petitioner filed a complaint with the Directorate General of Immigration and Foreigners, stating: "(…) I appear before this Directorate General to bring to its attention and to denounce facts of extreme legal and administrative gravity related to the carrying out of lucrative activities by foreign nationals allegedly in an irregular immigration status, in the public zone of the Maritime-Terrestrial Zone (ZMT), specifically in Puerto Viejo center and Cocles, canton of Talamanca, province of Limón. It is a public, notorious, permanent, and easily verifiable fact that in those sectors, multiple improvised structures and chinamos located within the public zone of the ZMT are in operation, from which commercial activities such as the sale of food, beverages, crafts, and the provision of personal services are carried out, without a concession, without administrative authorization, and in open violation of the public domain legal framework.

Concurrently, it has been established that a significant portion of those engaged in said activities are foreign nationals who, according to publicly available information and direct observation, do not hold regular immigration status nor authorization to engage in remunerated activities in the country, in direct contravention of the General Law of Immigration and Foreigners (Ley General de Migración y Extranjería), Law No. 8764, as well as its regulations (…)" (see evidence submitted).

V. Unproven fact. The following fact, which is of importance to the resolution of this matter, cannot be established

SOLE ITEM. That the authorities of the Ministry of Health and the Municipality of Talamanca have attended to the complaints filed by the petitioner on January 16, 2026.

VI.On the specific case. In the present matter, the petitioner alleges that on January 16, 2026, he filed formal complaints with the Ministry of Health, the Ministry of Environment and Energy, the Office of the Attorney General of the Republic, the Directorate General of Immigration and Foreigners, and the Municipality of Talamanca, on the grounds that, in the public zone of the Maritime-Terrestrial Zone of Puerto Viejo and Cocles, canton of Talamanca, an illegal occupation has taken hold through improvised structures known as "chinamos." He adds that certain commercial establishments, such as restaurants, have also privatized the area, to the detriment of public leisure, passage, and the scenic beauty inherent to the location. He states that within these structures, lucrative commercial activities are conducted without any concession, municipal permits, health permits, or environmental permits, in open violation of the legal order.

He requests the intervention of the Chamber.

As a first matter, with respect to the Ministry of Health, it is on record that on January 16, 2026, the petitioner filed the following complaint: "(…) I respectfully appear before that authority to bring to its attention facts of extreme sanitary, environmental, and legal gravity occurring in the public zone of the Maritime-Terrestrial Zone (ZMT), specifically in Puerto Viejo center and Cocles, canton of Talamanca, province of Limón. In said public zone, multiple chinamos and improvised structures operate from which activities involving the preparation and sale of food, beverages, crafts, and personal services such as massages and haircuts are carried out, all without sanitary permits, without inspections, without any oversight whatsoever, and entirely outside public health regulations. The order admitting the amparo petition for processing was notified to the director of the Directorate for Protection of the Human Environment of the Ministry of Health on April 30, 2026.

In that regard, the respondent authorities do not deny the facts attributed to them and confine themselves to stating that: "In January 2026, the petitioner filed a complaint at the Central Level, which was forwarded to the local health governing area of Talamanca, which, due to an involuntary error, was not formally registered by that local office. However, this matter has been reviewed in the field through the actions carried out by the health authorities within our powers." That being so, while the authorities claim to have "reviewed in the field" the situation reported by the applicant, there is no record that his complaint was formally attended to. Consequently, the amparo petition is granted with respect to this issue, as will be indicated in the operative part of this judgment.

Furthermore, with respect to the Municipality of Talamanca, although the petitioner did not submit a copy of the complaint he claims to have filed on January 16, 2026, bearing a received stamp, the fact remains that the respondent authorities made no reference to that complaint but merely reported that they had prepared a table setting out the proposed intervention plan in response to the alleged illegitimate occupation in the zone, namely:

In any event, it is on record that the Office of the Attorney General of the Republic had already forwarded the petitioner's complaint to the municipality as early as January 21, 2026. Likewise, the Ministry of Environment and Energy had also channeled the applicant's complaint as of March 7, 2026, which demonstrates that the Municipality of Talamanca had knowledge of the complaints filed.

With the foregoing clarified, there is no record that the Municipality of Talamanca communicated to the petitioner the steps taken to address his claim; therefore, the amparo petition is granted with respect to this issue.

Regarding MINAE, it is on record that on January 16, 2026, the petitioner filed a complaint with MINAE, in which he stated: "(…) I respectfully appear before your authority to bring to your attention facts of extreme environmental and legal gravity occurring in the public zone (zona pública) of the Maritime-Terrestrial Zone (Zona Marítimo Terrestre, ZMT), specifically in Puerto Viejo centro and Cocles, canton of Talamanca, province of Limón. In those sectors, in a public, notorious, permanent, and tolerated manner, multiple makeshift stalls (chinamos) and improvised structures have been installed within the public zone of the ZMT, from which lucrative commercial activities are carried out, such as the sale of food, handicrafts, and the provision of personal services, all without a concession, without legal authorization, without environmental viability (viabilidad ambiental), and in open violation of the public-domain legal regime (régimen jurídico demanial).

These occupations not only constitute an illegitimate usurpation of the public domain (dominio público) prohibited by the Ley sobre la Zona Marítimo Terrestre, Ley N.° 6043, but also cause serious environmental harm by taking place within a coastal ecosystem of the highest ecological relevance. In the affected public zone there is characteristic natural vegetation, including coconut palms, sea almond trees, and understory (sotobosque), which perform essential ecological functions such as coastal stabilization, shelter, food provision, and biological connectivity for numerous species of wildlife, including migratory birds, sloths, squirrels, howler monkeys (monos congos), and white-faced capuchin monkeys (monos cariblancos). This coastal strip forms part of a continuous biological corridor (corredor biológico) extending from Puerto Viejo, Cocles, and Punta Uva to Manzanillo, functionally connecting with the Refugio Nacional de Vida Silvestre Gandoca – Manzanillo and its wetlands—a corridor indispensable for the safe movement of fauna and the conservation of biodiversity.

The illegal occupation, the removal of vegetation, soil compaction, waste generation, and the associated human disturbance from these activities fragment and degrade this biological corridor, producing a cumulative, serious, and potentially irreversible environmental impact, not to mention the harm to the scenic beauty characteristic of the southern Caribbean coast." On January 19, 2026, the petitioner's complaint was forwarded to the Regional Directorate of the Área de Conservación la Amistad Caribe. On March 7, 2026, by official communication CARTA-SINAC-ACLAC-PPCP-043-2026, the complaint was forwarded to the Municipalidad de Talamanca. On May 4, 2026, by official communication CARTA-SINAC-ACLAC-PPCP-089-2026, the petitioner was notified as follows: "In response and follow-up to the complaint filed with the office of the Minister of MINAE, Mr. Franz Tattenbach Capra, concerning alleged occupations, structures, and activities in the public zone of the ZMT in the sectors of Puerto Viejo and Cocles, canton of Talamanca, and forwarded for attention by official communication CARTA-SINAC-ACLAC-DR-0044-2026, dated January 20, 2026, we proceed to provide a response within the scope of SINAC-ACLAC's competencies.

In your written submission, you expressly requested: 'That MINAE immediately order and execute environmental protection, recovery, restoration, and restitution measures for the public zone of the ZMT in Puerto Viejo and Cocles.' 'That the immediate eviction of all persons, structures, and activities illegally occupying that zone be coordinated.' 'That effective preventive and corrective measures be adopted to prevent the reinstallation of these occupations and the continuation of environmental harm.' 'That I receive a formal response regarding the handling of this complaint.' These requests are addressed below in the order in which they were presented:

On the request for protection, recovery, restoration, and restitution of the public zone of the ZMT The Ley sobre la Zona Marítimo Terrestre, N.° 6043, establishes that the ZMT constitutes part of the national patrimony, belongs to the State, and is inalienable and imprescriptible, it being an obligation of the State, its institutions, and all inhabitants to protect it and conserve its natural resources. Likewise, said law provides that municipalities are directly responsible for ensuring compliance with the rules governing the domain, development, use, and enjoyment of the ZMT, and that the usufruct and administration of the public zone and the restricted zone (zona restringida) fall to the municipality of the respective jurisdiction. In that regard, for the specific case of the Puerto Viejo sector, the direct administration of the ZMT falls to the Municipalidad de Talamanca, without prejudice to the environmental competencies that may correspond to SINAC when impacts to natural resources, ecosystems, wildlife, forest cover (cobertura boscosa), wetlands, mangroves, protection areas, or other elements under environmental oversight are identified.

For the foregoing reasons, by official communication CARTA-SINAC-ACLAC-PPCP-043-2026, dated March 7, 2026, this coordination formally forwarded to the Municipalidad de Talamanca the complaint submitted by you, so that said Municipality may assess, within its competencies, the existence or non-existence of permits, concessions, municipal authorizations, administrative acts, case files, or any other related background information concerning the reported structures and activities. In that same official communication, this coordination expressed its willingness to coordinate a possible joint on-site inspection, in order to facilitate a comprehensive assessment of the case in accordance with the competencies of each institution.

On the request for the immediate eviction of persons, structures, and activities With respect to the request for immediate eviction, it is necessary to note that Ley N.° 6043 prohibits, without proper legal authorization, the erection of buildings or installations, the cutting of trees, the extraction of products, or the carrying out of any other type of development, activity, or occupation within the ZMT. Likewise, said regulations establish that when competent authorities become aware of violations, they may proceed—after gathering the relevant information if deemed necessary—with the eviction of violators and the destruction or demolition of constructions, renovations, or installations carried out outside the law. Nevertheless, in order to validly proceed with eviction, demolition, or removal measures, the competent authority must first determine the exact location of the reported structures, their relationship to the public or restricted zone, the existence or non-existence of authorizations, permits, concessions, or administrative acts, as well as any other legal or technical conditions applicable to the specific case.

For the foregoing reasons, it is for the Municipalidad de Talamanca, as the direct administrator of the ZMT within its jurisdiction, to carry out the corresponding administrative analysis and determine the appropriate course of action, without prejudice to the inter-institutional coordination that may be required with SINAC, the Fuerza Pública, the Ministerio Público, or other competent authorities, should an illegal occupation or an associated environmental impact be established.

On the adoption of preventive and corrective measures In relation to the adoption of preventive and corrective measures to prevent the reinstallation of occupations or the continuation of possible environmental harm, this coordination considers it essential that, in the first instance, the Municipalidad de Talamanca determine the legal status of the reported structures, activities, or occupations, as well as the existence of permits, concessions, authorizations, prior studies, or administrative case files linked to the site. Once said municipal assessment has been conducted, and should possible environmental impacts be identified, SINAC-ACLAC may assess, within its technical competencies, the preparation of reports, technical opinions, or environmental expert assessments, as appropriate. Should a possible environmental violation or potential damage to natural resources be confirmed, said inputs may be forwarded to the Ministerio Público or the competent administrative authority, so that preventive, corrective, precautionary, or judicial measures appropriate in accordance with due process may be considered.

Likewise, SINAC-ACLAC maintains its willingness to participate in a joint inspection with the Municipalidad de Talamanca, provided that such proceedings are formally coordinated and allow the case to be addressed in a comprehensive manner, distinguishing ZMT administration matters from those that are strictly environmental.

On the status of the complaint proceedings With respect to the handling of your complaint, it is hereby reported that, in addition to the internal forwarding carried out by the ACLAC Regional Directorate by official communication CARTA-SINAC-ACLAC-DR-0044-2026, this coordination forwarded the case to the Municipalidad de Talamanca by official communication CARTA-SINAC-ACLAC-PPCP-043-2026, dated March 7, 2026. Subsequently, on Friday, April 17, 2026, the office of the Mayor of Talamanca communicated by email the assignment of municipal officers Helmer Zumbado Edwards, Byron Marchena Esquivel, and Jesús Alanís Nelson to attend to the note submitted by you and the official communication sent by SINAC-ACLAC. Consequently, this Conservation Area awaits the actions, assessments, or coordination that the Municipalidad de Talamanca may undertake, in its capacity as direct administrator of the ZMT within the canton, to determine whether a joint inspection should be conducted or other technical actions within SINAC-ACLAC's scope of competence should be initiated.

Finally, it is clarified that this response is issued within the framework of SINAC-ACLAC's competencies and does not substitute for the ruling that the Municipalidad de Talamanca must issue regarding permits, concessions, occupations, evictions, demolitions, or the administrative recovery of the ZMT. Nevertheless, this institution maintains its willingness to attend to, document, and refer to the corresponding authorities any verifiable environmental impact confirmed on site." That being said, it is on record that MINAE received the petitioner's complaint as of January 16, 2026, and, while it analyzed the claim and decided to refer the matter to the Municipalidad de Talamanca on grounds of competency, it was not until May 4, 2026—after the writ of amparo (recurso de amparo) had been admitted for processing—that the petitioner was notified of official communication CARTA-SINAC-ACLAC-PPCP-089-2026 setting out the actions taken in connection with the complaint.

Consequently, since the waiting period for attending to the petitioner's complaint was excessive and the corrective measure was not taken until after notification of the admission of this writ of amparo, the writ must be granted with respect to this point.

On a separate matter, regarding the Procuraduría General de la República, it is on record that on January 16, 2026, the petitioner filed a petition in which he stated: "I respectfully appear before this Procuraduría to formally report an illegal, systematic, and tolerated occupation of the public domain, specifically of the public zone of the ZMT in Puerto Viejo centro and Cocles, canton of Talamanca, which prevents citizens from freely accessing said strip for recreation and enjoyment. In those areas, illegal commercial structures have been installed that carry out lucrative activities without a concession or authorization, in open contradiction with Ley N.° 6043 and with the principles governing the defense of public patrimony. These occupations also cause serious environmental harm by directly affecting the natural coastal vegetation—sea almond trees, coconut palms, and understory—that sustains a coastal biological corridor of enormous relevance, used by migratory birds, sloths, squirrels, howler monkeys, and white-faced capuchin monkeys, and functionally connecting with the Refugio Nacional de Vida Silvestre Gandoca-Manzanillo and its wetlands and the scenic beauty characteristic of the southern Caribbean coast.

The prolonged inaction of the competent authorities has allowed this illegal situation to become entrenched, setting a highly damaging precedent for the State, the environment, and the common use of public assets. I REQUEST: 1. That the Procuraduría intervene ex officio in defense of the public domain. 2. That the competent institutions be formally urged to proceed with the immediate closure and eviction of the illegal occupations. 3. That the possible administrative liability for omission on the part of the officials who have tolerated this situation be analyzed. 4. That I receive a formal response regarding the handling of this complaint." Subsequently, by official communication DAA-OFI-65-2026 dated January 21, 2026, addressed to the Tribunal Ambiental Administrativo, Attorney Natalia Aguilar Porras stated: "Pursuant to Articles 111 and 112 of the Ley Orgánica del Ambiente, I am forwarding 1 image received from Licenciado Nombre01 (…01), corresponding to a complaint for illegal occupation of the public domain and environmental harm in the public zone of the ZMT–Puerto Viejo and Cocles, which was received in our offices.

We therefore request that proceedings be instituted in accordance with due process, to determine the merits of a possible violation of environmental protection legislation, and the consequent adoption of preventive or corrective measures, pursuant to the competencies conferred by Articles 1, 2, 98, 99, 101, 103, 106, 108, and 111 of the Ley Orgánica del Ambiente." Furthermore, by official communication DAA-OFI-66-2026 dated January 21, 2026, addressed to the Municipalidad de Talamanca, Attorney Natalia Aguilar Porras stated: "Pursuant to Articles 12, 13, and 20 of Ley No. 6043, I am forwarding 1 image received from Licenciado Nombre01 (…01), corresponding to a complaint for illegal occupation of the public domain and environmental harm in the public zone of the ZMT–Puerto Viejo and Cocles, which was received in our offices. This is submitted requesting that appropriate proceedings be instituted in accordance with the competencies of the municipal entity." Finally, by official communication DAA-OFI-67-2026 dated January 21, 2026, Attorney Natalia Aguilar Porras replied to the petitioner: "Please receive my kind regards.

In response to your complaint received in our offices (attached), I respectfully state: Pursuant to Article 111 of the Ley Orgánica del Ambiente, we have forwarded 1 attached image, constituting a complaint, to the Tribunal Ambiental Administrativo, which we have requested to institute proceedings in accordance with due process, to determine the merits of a possible violation of environmental protection legislation, and the consequent adoption of preventive or corrective measures. This is in accordance with the competencies conferred by Articles 1, 2, 98, 99, 101, 103, 106, 108, and 111 of the Ley Orgánica del Ambiente. We have also forwarded said complaint image to the Municipalidad de Talamanca, in conformity with Articles 12, 13, and 20 of Ley No. 6043." Said official communication was sent to the email address …01 at 6:10 p.m. on January 21, 2026.

That being said, it is clear that the Procuraduría General de la República did process the petitioner's complaint, referred it to the Municipalidad de Talamanca and to the Tribunal Ambiental Administrativo, and notified the petitioner of the actions taken, prior to the filing of the writ of amparo. Therefore, with respect to the Procuraduría as the respondent, the writ of amparo is denied.

Finally, with respect to the Dirección General de Migración y Extranjería, it is noted that on January 16, 2026, the petitioner filed a petition with the Dirección General de Migración y Extranjería in which he stated: "(…) I appear before this General Directorate to bring to your attention and to report facts of the utmost legal and administrative gravity, related to the carrying out of lucrative activities by foreign nationals who are allegedly in an irregular immigration status, in the public zone of the ZMT, specifically in Puerto Viejo centro and Cocles, canton of Talamanca, province of Limón. It is a public, notorious, permanent, and easily verifiable fact that in those sectors multiple improvised structures and makeshift stalls located within the public zone of the ZMT are in operation, from which commercial activities such as the sale of food, beverages, handicrafts, and the provision of personal services are carried out, without a concession, without administrative authorization, and in open violation of the public-domain legal regime.

Concurrently, it has been established that a significant portion of those engaging in such activities are foreign nationals who, according to publicly known information and direct observation, do not hold regular immigration status nor authorization to engage in remunerated activities in the country, in direct contravention of the Ley General de Migración y Extranjería, Ley N.° 8764, as well as its regulations (…)." In this regard, it should be noted that this complaint does not fall within the exceptions established in considerando I of this judgment, since what is claimed is that, in the petitioner's view, there are foreign nationals in irregular status engaging in commercial activities without authorization.

In that sense, it should be noted that the Presidency of the Sala Constitucional did not even admit the writ of amparo with respect to this point, since the alleged failure to resolve the petition filed by the petitioner would constitute, if proven, a violation of Article 41 of the Constitución Política, for which reason the claim must be brought before the contentious-administrative jurisdiction (jurisdicción contencioso-administrativa), in accordance with the following considerations:

"III.- NEW ADMINISTRATIVE JUSTICE: A SWIFT AND EFFECTIVE MECHANISM FOR THE PROTECTION OF SUBSTANTIVE LEGAL SITUATIONS OF ADMINISTERED PARTIES. The Sala Constitucional, since its founding, has applied broad admissibility criteria in view of the absence of expeditious and swift procedural channels for the protection of substantive legal situations grounded in the infra-constitutional legal order or legality parameter, which bear an indirect connection to fundamental rights and Constitutional Law. In this regard, it must not be overlooked that the Constitution, by virtue of its supremacy, super-legality, and direct and immediate efficacy, indirectly underpins any conceivable substantive legal situation of individuals. However, upon more careful reflection, and following the enactment of the Código Procesal Contencioso-Administrativo (Ley No. 8508 de 24 de abril de 2006) and its entry into force on January 1, 2008, it has become evident that litigants now have access to a plenary and universal contentious-administrative jurisdiction, highly expeditious and swift by virtue of the various procedural mechanisms incorporated into the legal order by said legislation, such as shortened deadlines for carrying out the various procedural acts, broad standing, precautionary measures, a numerus apertus of admissible claims, orality—and its sub-principles of concentration, immediacy, and celerity—single-instance proceedings with appeal in expressly enumerated situations, intra-procedural conciliation, the unified process, the preferential proceeding or 'amparo de legalidad,' pure-law proceedings, new enforcement measures (coercive fines, substitutive or commissarial enforcement, attachment of fiscal-domain assets and some public-domain assets), the broad powers of the panel of enforcement judges, the extension and adaptation of jurisprudential effects to third parties, and the flexibility of the cassation appeal.

All of these novel procedural mechanisms have as their manifest purpose and aim to achieve procedural economy, speed, promptness, and the effective and full protection of the substantive legal situations of administered parties, all with guarantees of basic fundamental rights such as due process, the right of defense, and the adversarial principle. In sum, the new contentious-administrative jurisdiction is a suitable channel, by virtue of its new characteristics of simplicity, speed, and promptness, for the effective protection and safeguarding of the substantive legal situations of administered parties in cases where evidence must be gathered or certain questions of ordinary legality must be resolved.

IV. VERIFICATION OF LEGALLY PRESCRIBED DEADLINES FOR RESOLVING ADMINISTRATIVE PROCEEDINGS

AN EVIDENT QUESTION OF ORDINARY LEGALITY. It is evident that determining whether the public administration complies or fails to comply with the deadlines prescribed by the Ley General de la Administración Pública (Articles 261 and 325) or by sectoral laws for special administrative proceedings—for resolving by final act an administrative proceeding initiated ex officio or at the request of a party, or for hearing applicable administrative appeals—is a matter of ordinary legality that, going forward, may be discussed and resolved before the contentious-administrative jurisdiction with the application of the principles that inform the constitutional jurisdiction, such as vicarious standing, the possibility of substantive self-representation—that is, appearing without legal counsel—and the principle of no-cost access for petitioners. Consequently, outright dismissal is required, and the petitioner is to be informed that, if they see fit, they may resort to the contentious-administrative jurisdiction" (judgment No. 2008002545 of 8:55 a.m. on February 22, 2008).

Therefore, with respect to this point, the writ is denied.

VII.Documentation submitted to the case file. The parties are hereby warned that, should they have submitted any paper documents, objects, or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be retrieved within a maximum period of 30 business days, counted from the notification of this judgment. It is hereby noted that all material not collected within that period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial" (approved by Corte Plena in Article XXVI of session No. 27-11 of August 22, 2011, and published in Boletín Judicial No. 19 of January 26, 2012) and Article LXXXI of session No. 43-12 of the Consejo Superior del Poder Judicial of May 3, 2012.

Por tanto:

The writ is partially granted. Rugeli Morales Rodríguez and Mariela de los Ángeles Marín Mena, in their respective capacities as mayor of Talamanca and director general of health additionally assigned to the Dirección de Salud Ambiental of the Ministerio de Salud, or whoever holds those positions, are hereby ordered to, within FIFTEEN DAYS from notification of this judgment, attend as required by law to the complaints filed by the petitioner since January 16, 2026, and to notify the petitioner accordingly. The foregoing is issued with the warning that, pursuant to Article 71 of the Law of this Jurisdiction, imprisonment of three months to two years, or a day-fine of twenty to sixty days, shall be imposed on any person who receives an order that they must comply with or cause to be complied with, issued in a writ of amparo, and fails to comply with it or fails to cause it to be complied with, provided the offense is not more severely penalized under other provisions. The Municipalidad de Talamanca and the State are ordered to pay the costs, damages, and losses caused by the acts underlying this ruling, which shall be assessed in the course of execution of judgment before the contentious-administrative jurisdiction. In all other respects, the writ is denied. Notify the parties.

Recurso de amparo que se tramita en expediente nro. 26-013062-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra el MINISTERIO DE AMBIENTE Y ENERGÍA, MINISTERIO DE SALUD, MUNICIPALIDAD DE TALAMANCA, PROCURADURÍA GENERAL DE LA REPÚBLICA, DIRECCIÓN GENERAL DE MIGRACIÓN Y EXTRANJERÍA.

Resultando:

  1. 1Por escrito incorporado al expediente electrónico el 15 de abril de 2026, el recurrente interpone recurso de amparo. Alega que en la zona pública de la Zona Marítimo Terrestre de Puerto Viejo y Cocles, cantón de Talamanca, se ha consolidado una ocupación ilegal mediante estructuras improvisadas tipo "chinamos", que van hasta la zona de Cocles. Añade que también algunos comercios como restaurantes privatizaron la zona, perjudicando el solaz, el paso y la belleza escénica propia del lugar. Señala que en dichas estructuras se desarrollan actividades comerciales lucrativas sin contar con concesión, permisos municipales, sanitarios ni ambientales, en abierta violación del ordenamiento jurídico. Afirma que esas actividades se realizan en condiciones absolutamente inadecuadas, sin controles sanitarios, sin manejo de residuos y sin infraestructura mínima, generando un riesgo evidente para la salud pública.Alega que la ocupación ha provocado un grave daño ambiental, afectando la vegetación costera, incluyendo almendros de playa, cocoteros y sotobosque, que forman parte de un corredor biológico de alta relevancia ecológica, vinculado al Refugio Nacional de Vida Silvestre Gandoca-Manzanillo y al Parque Nacional Cahuita, sitios donde era frecuente ver monos cariblancos, perezosos, iguanas y lapas verdes. Asimismo, aduce que se ha afectado el libre acceso de los ciudadanos al dominio público, desnaturalizando su uso común. Refiere que ha presentado denuncias formales ante diversas autoridades, incluyendo el Ministerio de Salud, Ministerio de Ambiente y Energía, Dirección General de Migración y Extranjería, y la Municipalidad de Talamanca. Menciona que el 16 de enero de 2026 gestionó una denuncia formal ante la Procuraduría General de la República, sin que a la fecha exista respuesta ni actuación alguna.Acusa que, pese al conocimiento efectivo de la situación, ninguna de las autoridades recurridas ha adoptado medidas eficaces, permitiendo la permanencia, expansión y consolidación de la ilegalidad. Aduce que la omisión administrativa ha generado un agravamiento progresivo del daño ambiental, social y jurídico, configurando una situación de alta lesividad para el interés público. El recurrente aporta denuncias presentadas ante las autoridades recurridas en fecha 16 de enero de 2026. Solicita la intervención de esta Sala.
  2. 2Por resolución de las 8:33 horas del 30 de abril de 2026, la Presidencia de la Sala dio curso al amparo y solicitó informe al ministro de Ambiente y Energía, al director de la Dirección de Protección al Ambiente Humano del Ministerio de Salud, al procurador general de la República, así como al alcalde y encargado del Departamento de Zona Marítimo Terrestre, ambos de la Municipalidad de Talamanca.
  3. 3Por escrito incorporado al expediente electrónico el 6 de mayo de 2026, informa bajo juramento Iván Vinicio Vicenti Rojas en su condición de procurador general de la República. Expone: “Primero: Se trata de los mismos hechos que el recurrente expuso en la nota que dirigió a la Procuraduría el 16 de enero del año en curso. Sin embargo, la Procuraduría no tiene conocimiento sobre la veracidad de esos hechos ni de quiénes podrían haberlos cometido. En todo caso, los hechos descritos no son imputables a la Procuraduría General de la República, puesto que, como se explicará más adelante, no es un órgano que ejerza funciones de administración activa, de gestión policial ambiental ni de control demanial directo sobre bienes del Estado. Segundo: Se reitera lo indicado en la respuesta dada al hecho anterior, dado que se trata de más detalles sobre los hechos que el recurrente comunicó a la Procuraduría en su nota de 16 de enero.Tercero: Se reitera lo indicado en la respuesta dada al hecho primero, dado que se trata de más detalles sobre los hechos que el recurrente comunicó a la Procuraduría en su nota de 16 de enero. Cuarto: Se reitera lo indicado en la respuesta dada al hecho primero, dado que se trata de más detalles sobre los hechos que el recurrente comunicó a la Procuraduría en su nota de 16 de enero. Quinto: Se reitera lo indicado en la respuesta dada al hecho primero, dado que se trata de más detalles sobre los hechos que el recurrente comunicó a la Procuraduría en su nota de 16 de enero. Sexto: La Procuraduría no tiene conocimiento de las gestiones que el recurrente haya planteado ante otras instituciones públicas. Sétimo: Lo rechazo parcialmente. Es cierto que el recurrente presentó una nota a la Procuraduría, titulada como “denuncia por ocupación ilegal del dominio público y daño ambiental en la zona pública de la ZMT - Puerto Viejo Centro y Cocles”, sin embargo, debe precisarse que esa nota fue presentada en la Procuraduría el 16 de enero de 2026 (Véase la prueba no. 1 y la imagen de la nota presentada a la Procuraduría que el recurrente aporta como prueba).Es totalmente falso que la Procuraduría no haya respondido la gestión del recurrente, al contrario, la institución atendió la solicitud de la siguiente manera: -El 21 de enero de 2026, se emitió el oficio no. DAA-OFI-65-2026, mediante el cual, la Procuradora Natalia Aguilar Porras, a quien se le asignó el conocimiento del asunto, remitió la gestión del recurrente al Tribunal Ambiental Administrativo, y solicitó “instruir el procedimiento observando el debido proceso, para que se determine el mérito de una posible infracción a la legislación tutelar del ambiente, y la consecuente adopción de medidas preventivas o correctivas, conforme a las competencias conferidas en los artículos 1, 2, 98, 99, 101, 103, 106, 108 y 111 de la Ley Orgánica del Ambiente.” (Ver prueba no. 1). -El 21 de enero de 2026, se emitió el oficio no. DAA-OFI-66-2026, con el que, la Procuradora Aguilar Porras remitió la gestión del recurrente a la Municipalidad de Talamanca y solicitó “instruir lo procedente conforme a las competencias del ente municipal.” (Ver prueba no. 1). -El 21 de enero de 2026, se emitió el oficio no. DAA-OFI-67-2026, mediante el cual, la misma procuradora le respondió al recurrente la gestión planteada, indicándole que “Con fundamento en el artículo 111 de la Ley Orgánica del Ambiente, trasladamos 1 imagen adjunta, que constituye denuncia, al Tribunal Ambiental Administrativo, a quien hemos solicitado instruir el procedimiento, observando el debido proceso, para que determine el mérito de una posible infracción a la legislación tutelar del ambiente, y la consecuente adopción de medidas preventivas o correctivas.Lo anterior, conforme a las competencias conferidas en los artículos 1, 2, 98, 99, 101, 103, 106, 108 y 111 de la Ley Orgánica del Ambiente. También hemos trasladado dicha imagen de denuncia a la Municipalidad de Talamanca, de conformidad con lo que establecen los artículos 12, 13 y 20 de la Ley No. 6043.” Además, se adjuntó copia de los oficios remitidos al Tribunal Ambiental Administrativo y a la Municipalidad de Talamanca. (Ver prueba no. 1). -El oficio no. DAA-OFI-67-2026 fue comunicado correctamente al correo electrónico que el señor Nombre01 señaló como medio para recibir notificaciones en la gestión presentada el 16 de enero de 2026, ...01, el 21 de enero de 2026. (Ver prueba no. 1). -El Tribunal Ambiental Administrativo abrió el expediente no. 17-26-02-TAA, a raíz del oficio no. DAA-OFI-65-2026 de 21 de enero de 2026, con el cual la Procuraduría le trasladó la gestión del recurrente.Y, tal y como se indica en el correo electrónico recibido, el expediente se encuentra en proceso de investigación y resolución. (Ver prueba no. 2). Octavo: No es cierto. Lo rechazo. Como se acreditó en la respuesta del hecho anterior, la Procuraduría sí atendió y respondió la gestión del recurrente correcta y oportunamente. Noveno: No es cierto que haya existido omisión administrativa por parte de la Procuraduría. Como se acreditó en la respuesta del hecho sétimo, la institución sí atendió y respondió la gestión del recurrente correcta y oportunamente. Sin embargo, la Procuraduría no tiene conocimiento sobre la veracidad del daño ambiental que acusa el recurrente ni de quiénes podrían haberlo cometido. En todo caso, los hechos descritos no son imputables a la Procuraduría General de la República, puesto que, como se explicará más adelante, no es un órgano que ejerza funciones de administración activa, de gestión policial ambiental ni de control demanial directo sobre bienes del Estado.II. OBJETO DEL RECURSO Y PRETENSIONES FRENTE A LA PROCURADURÍA Según el escrito de interposición, se requiere que se declare con lugar el recurso de amparo y se declare la existencia de una omisión inconstitucional por parte de las instituciones recurridas. Y, además, se requiere que se ordene a la recurridas, en un plazo perentorio, actuar de forma coordinada para recuperar el dominio público, eliminar las ocupaciones ilegales, proteger el ambiente y garantizar la salud pública; remitir testimonio al Ministerio Público para la investigación de posibles responsabilidades por incumplimiento de deberes; y que se condene al Estado al pago de costas, daños y perjuicios. Como ya se adelantó al contestar los hechos y como se expondrá de seguido, las pretensiones del recurso son improcedentes en cuanto a la Procuraduría General de la República. III. LA PROCURADURÍA ATENDIÓ LA GESTIÓN DEL RECURRENTE DE MANERA OPORTUNA Y SEGÚN EL ÁMBITO DE SUS COMPETENCIAS LEGALES.Tal y como se expuso y acreditó al contestar los hechos del recurso de amparo, el 16 de enero de 2026, la Procuraduría recibió una nota que el señor Nombre01 tituló como “denuncia por ocupación ilegal del dominio público y daño ambiental en la zona pública de la ZMT - Puerto Viejo Centro y Cocles”. En esa gestión, el recurrente indicó que en la zona de Puerto Viejo y Cocles se presenta una ocupación ilegal de la zona pública, con estructuras comerciales que no cuentan con concesión, que impide el libre acceso de las personas y que genera un grave daño al ambiente. En esa gestión, el recurrente solicitó “1. Que la Procuraduría intervenga de oficio en defensa del dominio público. 2. Que se inste formalmente a las instituciones competentes a proceder con el cierre y desalojo inmediato de las ocupaciones ilegales. 3. Que se analice la eventual responsabilidad administrativa por omisión de los funcionarios que han tolerado esta situación. 4.Solicito obtener respuesta formal del trámite correspondiente a la presente denuncia.” Ante esa solicitud, la Procuraduría, mediante los oficios nos. DAA-OFI-065-2026 y DAA-OFI-066-2026 de 21 de enero de 2026, remitió la queja planteada al Tribunal Ambiental Administrativo y a la Municipalidad de Talamanca, para que ambas instituciones, en ejercicio de sus competencias, conocieran y tramitaran la gestión. Y, posteriormente, mediante el oficio no. DAA-OFI-067-2026 de 21 de enero de 2026, notificado ese mismo día, respondió la nota del señor Nombre01, comunicándole las gestiones efectuadas por la Procuraduría para atender la situación de ocupación ilegal de la zona marítimo terrestre que planteó. De tal forma, ha quedado acreditado que la Procuraduría atendió y gestionó la solicitud del señor Nombre01 de manera oportuna, pues se respondió en menos de tres días hábiles. Y, además, la atención, gestión y respuesta de la Procuraduría ante el asunto planteado por el recurrente se apegó al ámbito de competencias que legalmente le corresponden.Como ya se indicó al contestar el recurso de amparo tramitado bajo el expediente no. 26-10395-0007-CO, la Procuraduría General de la República es, por mandato legal expreso, el órgano superior consultivo técnico-jurídico de la Administración Pública y el representante del Estado en materia judicial. Su función institucional se circunscribe a la emisión de dictámenes, opiniones jurídicas y a la representación procesal del Estado ante los tribunales de justicia. La Procuraduría no ejerce funciones de administración activa, no tiene potestad de policía, no gira órdenes a los entes y órganos de la Administración Pública en el ejercicio de sus competencias propias y no puede sustituir a éstos en la toma de sus decisiones ejecutivas. De tal modo, la Procuraduría no es superior jerárquico de la Municipalidad de Talamanca, y, por tanto, no tiene competencia para sustituirla en la toma de decisiones, revisar o anular los actos que han adoptado en el ejercicio de sus competencias propias, ni actuar como contralor de legalidad de sus actuaciones, salvo en los supuestos estrictamente tasados por los artículos 173 y 183 de la Ley General de la Administración Pública -nulidad absoluta evidente y manifiesta de actos favorables, que no son invocados ni configurados en el presente asunto.Tampoco puede la Procuraduría sustituir a la Municipalidad de Talamanca en el ejercicio de las competencias de velar directamente por el cumplimiento de las normas de la Ley 6043, referentes al dominio, desarrollo, aprovechamiento y uso de la zona marítimo terrestre. (artículos 3°, 34 y 35 de la Ley 6043). El artículo 13 de ese mismo cuerpo normativo le confiere a la Municipalidad de Talamanca la potestad de policía y desalojo administrativo sobre la franja costera, sin necesidad de autorización judicial, de conformidad con el principio de autotutela del dominio público, que constituye un poder-deber que obliga a la Administración titular del bien demanial a ejercer una vigilancia continua sobre sus bienes de dominio público, preservándolos de deterioros y usos indebidos mediante la aplicación de sanciones de tutela que protegen el orden social colectivo. (Barckausen, H., cit. por Marienhoff, M.: Tratado de dominio público, Ed T. E. A. En sentido concordante, Cassese, S., I beni pubblici, A., Giuffré, Milano, 1969, pg. 313.Véanse los votos de esta Sala Constitucional nos. 04380 – 2009, 13655–2008, 13073–2009, 14453-2010, 13072 – 2009, entre otros). Conforme con el artículo 34 de la Ley 6043, la Municipalidad debe atender directamente al cuidado y conservación de la zona marítimo terrestre y de sus recursos naturales, y, para esos efectos, debe contar con los inspectores necesarios, quienes en el desempeño de sus funciones están investidos de plena autoridad y tienen libre acceso a todos los terrenos e instalaciones excepto a los domicilios particulares, todo conforme a la ley. Por tanto, es precisamente la Municipalidad de Talamanca -y no la Procuraduría- quien tiene conocimiento directo de los ocupantes ilegales, administra el registro de concesiones y permisos, realiza las inspecciones físicas y cuenta con los instrumentos legales y fácticos para ejecutar el desalojo de los infractores y restaurar el libre tránsito y uso público de la zona pública.Por otra parte, dado que en el recurso se plantea una posible afectación a los recursos naturales del Refugio de Vida Silvestre Gandoca Manzanillo, como se señaló en el informe rendido en el expediente no. 26-10395-0007-CO, los recursos comprendidos dentro de ese refugio, se encuentran bajo la competencia, control y manejo exclusivos del Sistema Nacional de Áreas de Conservación y el Ministerio de Ambiente y Energía, a través del Área de Conservación La Amistad Caribe, cuyas potestades de autotutela demanial son equivalentes a las de las municipalidades en lo que a esa categoría de espacios protegidos respecta, y la Procuraduría no ejerce funciones de administración activa sobre ese espacio protegido. Además, el órgano competente por ley para conocer, tramitar y resolver en sede administrativa las denuncias contra personas públicas o privadas sobre conductas activas u omisas que violen o amenacen violar las normas de la legislación ambiental o de los recursos naturales -e imponer las respectivas sanciones y resolver lo referente a los daños ambientales derivados de esas conductas- es el Tribunal Ambiental Administrativo, órgano desconcentrado del Ministerio de Ambiente y Energía creado por los artículos 99, 103, 107 y 111 de la Ley Orgánica del Ambiente, no. 7554 del 13 de octubre de 1995.El artículo 107 de esa Ley dispone que cualquier persona puede denunciar ante el Tribunal los hechos que a su juicio constituyan infracción a la legislación ambiental, mientras que los artículos 111 y 112 prevén que el propio Tribunal puede remitir o recibir denuncias de instituciones públicas que tengan conocimiento de tales conductas. La Procuraduría únicamente coadyuva ante ese Tribunal cuando se le da intervención formal y existen fundamentos jurídicos que lo ameriten, sin que de ello pueda derivarse una competencia para tramitar o resolver en forma autónoma denuncias ambientales. En consecuencia, el abordaje de la Procuraduría frente a la gestión del señor Nombre01 fue correcto y acorde a su ámbito de competencias. En apego a las disposiciones de la Ley 6043 en cuanto a las competencias municipales en el manejo, administración y protección de la zona marítimo terrestre y las disposiciones de la Ley Orgánica del Ambiente sobre la tramitación de denuncias sobre daños ambientales, la Procuraduría remitió la nota del recurrente a la Municipalidad de Talamanca y al Tribunal Ambiental Administrativo, para que, ambas instituciones, en el ejercicio de sus funciones de administración activa, la tramiten y lleven a cabo las acciones que resulten pertinentes.Ahora bien, la Procuraduría tampoco es competente para sustituir o supervisar al Ministerio de Salud ni al Ministerio de Gobernación y Policía en el ejercicio de sus competencias relativas a las condiciones sanitarias de las actividades comerciales y aquellas relacionadas con el desarrollo de actividades lucrativas por parte de extranjeros en condición migratoria irregular que se mencionan en el recurso de amparo y en la prueba aportada. Entonces, con base en todo lo aquí expuesto, no existe acción u omisión ilegítima atribuible a la Procuraduría General de la República que haya vulnerado el derecho a un ambiente sano y ecológicamente equilibrado, a la salud, a la seguridad jurídica, a la tutela judicial efectiva, ni a los otros derechos que menciona el recurrente. Por tanto, no es procedente declarar la existencia de una omisión inconstitucional por parte de la Procuraduría ni ordenar que la institución ejecute acciones para recuperar el dominio público, eliminar las ocupaciones ilegales, proteger el ambiente y garantizar la salud pública, pues, según lo expuesto, ésas son competencias propias de otras instancias administrativas.Y, dado que se ha acreditado que la Procuraduría atendió la gestión del recurrente de manera oportuna y según el ámbito de sus competencias legales, resulta totalmente improcedente remitir testimonio al Ministerio Público para la investigación de posibles responsabilidades por incumplimiento de deberes. Por último, no existe ninguna actuación u omisión por parte de la Procuraduría que pueda generar una condena para el Estado en cuanto al pago de costas, daños y perjuicios (…) Con fundamento en las consideraciones de hecho y de derecho expuestas, solicito respetuosamente a la Honorable Sala Constitucional:1) Declarar SIN LUGAR el presente recurso de amparo en lo que respecta a la Procuraduría General de la República, por cuanto este órgano no ha incurrido en acción u omisión ilegítima que vulnere derecho fundamental alguno del recurrente.2) Rechazar la solicitud de ordenar a la Procuraduría, en un plazo perentorio, actuar de forma coordinada para recuperar el dominio público, eliminar las ocupaciones ilegales, proteger el ambiente y garantizar la salud pública.3) Rechazar la solicitud de remitir testimonio al Ministerio Público para la investigación de posibles responsabilidades de la Procuraduría por incumplimiento de deberes.4) Rechazar la pretensión de condena en costas, daños y perjuicios en contra de la Procuraduría”.
  4. 4Por escrito incorporado al expediente electrónico el 6 de mayo de 2025, informa bajo juramento Franz Tattenbach Capra en su condición de ministro de Ambiente y Energía. Expone: “PRIMERO: El recurso de amparo es un proceso judicial que se tramita en la Sala Constitucional y que constituye la denominada jurisdicción constitucional de la libertad, su existencia garantiza la vigencia de los derechos fundamentales establecidos en la Constitución Política y en los tratados internacionales de derechos humanos vigentes en el país. La Ley de la Jurisdicción Constitucional establece en su numeral 29 que el recurso de amparo garantiza los derechos y libertades fundamentales a que se refiere esta ley, salvo los protegidos por el de hábeas corpus, establece además que procede contra toda disposición, acuerdo o resolución y en general, contra toda acción, omisión o simple actuación material no fundada en un acto administrativo eficaz, de los servidores y órganos públicos, que haya violado, viole o amenace violar cualquiera de aquellos derechos.No sólo procede contra los actos arbitrarios, sino también contra las actuaciones u omisiones fundadas en normas erróneamente interpretadas o indebidamente aplicadas. SEGUNDO: En el ordenamiento jurídico costarricense, el Recurso de Amparo se desprende de las normas constitucionales 10 y 48 de la Constitución Política establece que toda persona tiene derecho al recurso de amparo para mantener o restablecer el goce de los derechos consagrados en la Constitución, así como de los de carácter fundamental, establecidos en los instrumentos internacionales sobre derechos humanos, aplicables en la República. Existe todo un título dentro de este cuerpo normativo, donde se establecen una serie de derechos y garantías individuales tales como el derecho a la vida en el artículo 21, el derecho a la intimidad, libertad y secreto de las comunicaciones del artículo 24, el derecho de igualdad que se consagra en el artículo 33, derecho que tienen los consumidores y usuarios (de servicios públicos) a la protección del ambiente en el artículo 46 y muchos otros, establecidos dentro de los derechos y garantías sociales, tales como derecho a un ambiente sano y ecológicamente equilibrado y el correlativo deber estatal de tutelarlo artículo 50 y deber estatal de proteger las bellezas naturales.III En relación con lo ordenado por esta honorable Sala: “Rendir informe, dentro de los TRES DÍAS HÁBILES siguientes a la notificación de esta resolución” Para responder al requerimiento formulado mediante el expediente 26- 013062-0007-CO, ocho horas treinta y tres minutos del treinta de abril de dos mil veintiséis se informa lo siguiente: En atención al mandato de la Sala, se procedió a solicitar informe a la Dirección del Area de Conservación La Amistad Caribe como ente competente informando lo siguiente mediante informe CARTA-SINACACLAC-DR-0356-2026: PRIMERO: Que el 19 de enero del 2026, mediante trámite del Despacho del viceministro de Ambiente se realiza traslado con consecutivo Priv.028, a la Dirección Regional del Área de Conservación la Amistad Caribe con la solicitud de dar respuesta directamente a la persona interesada, con copia a este Despacho. SEGUNDO: Que con fecha 20 de enero del 2026, mediante oficio CARTA-SINAC-ACLAC-DR-0044-2026, se traslada la denuncia al señor Deiver Contreras Arguedas, jefe del programa de prevención, control y protección para su atención y respuesta.TERCERO: Que con oficio CARTA-SINAC-ACLAC-PPCP-043-2026 de fecha 07 de marzo del 2026, se le traslada denuncia a la Municipalidad de Talamanca, por ser un asunto de su competencia. CUARTO: Que con fecha 17 de abril de 2026, el Despacho del Alcalde asigna la atención de la denuncia a los señores Helmer Zumbado Edwards, Byron Marchena Esquivel, Jesús Alanís Nelson vía correo electrónico. QUINTO: Que en seguimiento a la gestión y con el fin de mantener informado al denunciante, se remite oficio CARTA-SINAC-ACLACPPCP-089-2026 con fecha 04 de mayo del 2026, en la cual se le informa: “En atención y seguimiento a la denuncia presentada ante el despacho del señor Ministro de Ambiente y Energía, señor Franz Tattenbach Capra, relacionada con presuntas ocupaciones, estructuras y actividades en la zona pública de la Zona Marítimo Terrestre en los sectores de Puerto Viejo y Cocles, cantón de Talamanca, y trasladada para atención mediante oficio CARTA-SINAC-ACLAC-DR-0044-2026, de fecha 20 de enero del 2026, se procede a brindar respuesta dentro del ámbito de competencias del SINAC-ACLAC.En su escrito, usted solicitó expresamente: “Que el MINAE ordene y ejecute de inmediato acciones de protección ambiental, recuperación, restauración y restitución de la zona pública de la ZMT en Puerto Viejo y Cocles”. “Que se coordine el desalojo inmediato de todas las personas, estructuras y actividades que ocupan ilegalmente dicha zona”.“Que se adopten medidas preventivas y correctivas eficaces para impedir la reinstalación de estas ocupaciones y la continuidad del daño ambiental”. “Solicito obtener respuesta formal del trámite correspondiente a la presente denuncia”. Al respecto, se atienden sus solicitudes en el mismo orden planteado: Sobre la solicitud de protección, recuperación, restauración y restitución de la zona pública de la ZMT La Ley sobre la Zona Marítimo Terrestre, N.° 6043, establece que la Zona Marítimo Terrestre constituye parte del patrimonio nacional, pertenece al Estado y es inalienable e imprescriptible, siendo obligación del Estado, sus instituciones y todos los habitantes protegerla y conservar sus recursos naturales.Asimismo, dicha ley dispone que corresponde a las municipalidades velar directamente por el cumplimiento de las normas relativas al dominio, desarrollo, aprovechamiento y uso de la Zona Marítimo Terrestre, y que el usufructo y administración de la zona pública y la zona restringida corresponden a la municipalidad de la jurisdicción respectiva. En ese sentido, para el caso concreto el sector de Puerto Viejo, la administración directa de la Zona Marítimo Terrestre corresponde a la Municipalidad de Talamanca, sin perjuicio de las competencias ambientales que puedan corresponder al SINAC cuando se identifiquen afectaciones a recursos naturales, ecosistemas, vida silvestre, cobertura boscosa, humedales, manglares, áreas de protección u otros elementos bajo tutela ambiental. Por lo anterior, mediante oficio CARTA-SINAC-ACLAC-PPCP-0432026, de fecha 07 de marzo del 2026, esta coordinación trasladó formalmente a la Municipalidad de Talamanca la denuncia presentada por su persona, con el fin de que dicha Municipalidad valore, dentro de sus competencias, la existencia o inexistencia de permisos, concesiones, autorizaciones municipales, actos administrativos, expedientes o cualquier otro antecedente relacionado con las estructuras y actividades denunciadas.En ese mismo oficio, se manifestó la disposición del ACLAC para coordinar una eventual inspección conjunta en el sitio, a fin de facilitar una valoración integral del caso conforme a las competencias de cada institución. Sobre la solicitud de desalojo inmediato de personas, estructuras y actividades Con respecto a la solicitud de desalojo inmediato, resulta necesario indicar que la Ley N.° 6043 prohíbe, sin la debida autorización legal, levantar edificaciones o instalaciones, cortar árboles, extraer productos o realizar cualquier otro tipo de desarrollo, actividad u ocupación dentro de la Zona Marítimo Terrestre. Asimismo, dicha normativa establece que, cuando las autoridades competentes tengan noticia de infracciones, podrán proceder, previa información levantada al efecto si se estimare necesaria, al desalojo de infractores y a la destrucción o demolición de construcciones, remodelaciones o instalaciones realizadas al margen de la ley.No obstante, para efectos de proceder válidamente con medidas de desalojo, demolición o remoción, resulta necesario que la autoridad competente determine previamente la ubicación exacta de las estructuras denunciadas, su relación con la zona pública o restringida, la existencia o inexistencia de autorizaciones, permisos, concesiones o actos administrativos, así como cualquier otra condición jurídica o técnica que resulte aplicable al caso concreto. En razón de lo anterior, corresponde a la Municipalidad de Talamanca, como administradora directa de la Zona Marítimo Terrestre en su jurisdicción, realizar el análisis administrativo correspondiente y determinar las acciones procedentes, sin perjuicio de la coordinación interinstitucional que pueda requerirse con el SINAC, Fuerza Pública, Ministerio Público u otras autoridades competentes, en caso de acreditarse una ocupación ilegal o una afectación ambiental asociada.Sobre la adopción de medidas preventivas y correctivas. En relación con la adopción de medidas preventivas y correctivas para impedir la reinstalación de ocupaciones o la continuidad de un posible daño ambiental, esta coordinación considera indispensable que, en primera instancia, la Municipalidad de Talamanca determine la situación legal de las estructuras, actividades u ocupaciones denunciadas, así como la existencia de permisos, concesiones, autorizaciones, estudios previos o expedientes administrativos vinculados con el sitio. Una vez realizada dicha valoración municipal, y en caso de que se identifiquen posibles afectaciones ambientales, el SINAC-ACLAC podrá valorar, dentro de sus competencias técnicas, la elaboración de informes, criterios técnicos o peritajes ambientales, según corresponda. De comprobarse una posible infracción ambiental o un eventual daño a recursos naturales, dichos insumos podrán ser remitidos al Ministerio Público o a la autoridad administrativa competente, a efectos de que se valoren las acciones preventivas, correctivas, cautelares o judiciales que procedan conforme al debido proceso.Asimismo, el SINAC-ACLAC mantiene la disposición de participar en una inspección conjunta con la Municipalidad de Talamanca, siempre que dicha diligencia sea coordinada formalmente y permita abordar el caso de manera integral, diferenciando los aspectos de administración de la Zona Marítimo Terrestre de aquellos estrictamente ambientales. Sobre el estado del trámite de la denuncia. En cuanto al trámite dado a su denuncia, se informa que, además del traslado interno realizado por la Dirección Regional del ACLAC mediante oficio CARTA-SINAC-ACLAC-DR-0044-2026, esta coordinación remitió el caso a la Municipalidad de Talamanca mediante oficio CARTASINAC-ACLAC-PPCP-043-2026, de fecha 07 de marzo del 2026. Posteriormente, con fecha viernes 17 de abril del 2026, el despacho de la Alcaldía Municipal de Talamanca comunicó, por medio de correo electrónico, la asignación de los funcionarios municipales Helmer Zumbado Edwards, Byron Marchena Esquivel y Jesús Alanís Nelson para la atención de la nota presentada por su persona y del oficio remitido por el SINAC-ACLAC.En consecuencia, esta Área de Conservación se mantiene a la espera de las actuaciones, valoraciones o coordinación que disponga la Municipalidad de Talamanca, en su condición de administradora directa de la Zona Marítimo Terrestre en el cantón, para determinar si corresponde realizar una inspección conjunta o activar otras acciones técnicas dentro del ámbito de competencia del SINAC-ACLAC. Finalmente, se aclara que la presente respuesta se emite dentro del marco competencial del SINAC-ACLAC y no sustituye el pronunciamiento que corresponde emitir a la Municipalidad de Talamanca respecto de permisos, concesiones, ocupaciones, desalojos, demoliciones o recuperación administrativa de la Zona Marítimo Terrestre. No obstante, esta institución mantiene su disposición de atender, documentar y remitir a las autoridades correspondientes cualquier afectación ambiental verificable que sea constatada en el sitio”.SEXTO: Que la solicitud del señor Nombre01, se tramitó siguiendo los canales de comunicación institucional interna del Ministerio de Ambiente y Energía, para la atención de denuncias. Que, considerando el principio de coordinación interinstitucional enmarcado por la Constitución Política, Ley General de la Administración Pública (N° 6227), Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos (N° 8220), se procedió con el traslado de la denuncia a la Municipalidad del Cantón de Talamanca como administradora del área donde se interpuso la denuncia, al no tener competencia el SINAC-MINAE en la regulación de las actividades indicadas. Lo anterior, en el buen ejercicio del principio de coordinación interinstitucional como pilar del derecho administrativo y la gestión pública, que busca armonizar las actuaciones de diferentes entes y órganos públicos para asegurar la eficacia, eficiencia y evitar la duplicación de esfuerzos o contradicciones en sus funciones.Que, a efectos de mantener al denunciante informado sobre su gestión, se le remite oficio CARTA-SINAC-ACLAC-PPCP-089-2026, con las gestiones realizadas para su seguimiento. SEPTIMO: En atención a los hechos expuestos y a la documentación adjunta, se demuestra de manera fehaciente que el Área de Conservación La Amistad Caribe, ha actuado en todo momento dentro del estricto marco de sus competencias legales y técnicas, no existiendo omisión alguna por parte de esta institución. OCTAVO: La situación descrita por el recurrente respecto de las estructuras improvisadas tipo "chinamos" y los comercios que presuntamente han privatizado la zona, es de competencia primaria y exclusiva de la Municipalidad de Talamanca, específicamente de su Alcaldía y del Departamento de la Zona Marítimo Terrestre, en virtud de lo dispuesto en el Código Municipal y la Ley sobre Zona Marítimo Terrestre. Es a dicha municipalidad a quien corresponde otorgar permisos de ocupación, realizar los desalojos respectivos y evitar el avance de ocupaciones ilegales en esa franja costera.PETITORIA 1.-De conformidad con lo estipulado y las pruebas documentales aportadas, se cumple con la presentación del informe solicitado por tanto este Ministerio solicita se tome nota del cumplimiento del mandato ordenado por esta honorable Sala. 2. Con base a los argumentos y pruebas presentadas declarar sin lugar el Recurso de Amparo interpuesto por el señor Nombre01”.
  5. 5Por escrito incorporado al expediente electrónico el 7 de mayo de 2026, informa bajo juramento Mariela de los Ángeles Marín Mena en su condición de directora general de salud a. i. con recargo de la Dirección de Salud Ambiental del. Ministerio de Salud. Expone: “Atiendo el presente recurso de amparo, con sustento en el informe técnico N°CARTA-MS-DRRSHC-DARST-1235-2026, de fecha 05 de mayo del 2026, emitido por la suscrita Dra. Jennifer Jones Villiers, Directora del Área Rectora de Salud de Talamanca, donde informa lo siguiente: “Con respecto al comentario del recurrente referente a la ocupación ilegal mediante estructuras improvisadas tipo "chinamos", en la zona pública de la Zona Marítimo Terrestre (ZMT) que va desde Puerto Viejo a Cocles, hemos de manifestar que la ZMT es de competencia material y territorial, incluyendo el otorgamiento de los permisos para las construcciones y patentes, según le ordenan las leyes a la Municipalidad de Talamanca, la cual debe ejercer su autoridad en su soberanía plena, lo que es una potestad de imperio arraigada en esa normativa.Por tal motivo, no existe vínculo alguno de formalidades técnicas y/o legales que nos ordene la legislación, emitir criterios para acoger o rechazar un Permiso Sanitario de Funcionamiento (PSF) en dicha zona, ya que es potestad municipal, la cual debe ejercer la vigilancia en su jurisdicción. Lo que con meridiana claridad para nuestros efectos se nos ordena mediante el Reglamento general para Permisos Sanitarios de Funcionamiento, Permisos de Habilitación y Autorizaciones para Eventos Temporales de Concentración Masiva de Personas, otorgados por el Ministerio de Salud, decreto N°43432-S, en sus numerales 8 y 13 y nos obliga a la administración a dar cumplimiento fehaciente, para mejor resolver, las solicitudes de PSF por primera vez y/o renovaciones presentadas ante nuestra instancia. Para nuestros efectos, debemos atender obligatoriamente, las solicitudes que ingresan por ventanilla única en cumplimiento del decreto ejecutivo N°43432-S y que se cumplan con los requerimientos técnico-legales, para así poder realizar las inspecciones a dichas solicitudes de permiso y si fuera el caso otorgar el PSF.Fuera de ese contexto a los “chinamos” que se mencionan en la presente denuncia, no podemos tramitar permiso sanitario alguno, por cuando están fuera del ámbito de nuestra competencia legal. Será la potestad de la Municipalidad local atribuirse la autoridad para ejercer la vigilancia y el control sanitario a través de sus inspectores municipales, ya que para nuestros efectos en salud solo podemos realizar las inspecciones físico-sanitarias si se encuentran amparadas a través del Reglamento especial para el control de riesgos sanitarios en ventas autorizadas de acuerdo con el artículo 218 bis de la Ley General de Salud, Nº41332-S-MTSS. Dentro del considerando 4° del decreto ejecutivo N°41332-S-MTSS, se indica que “mediante la adición del artículo 218 bis de la Ley Nº5395 del 30 de octubre de 1973 "Ley General de Salud", las municipalidades podrán regular los supuestos en los que se podrán otorgar permisos temporales para la venta de frutas y para la preparación y venta de alimentos y bebidas en los sitios que previamente ellas definan; siempre y cuando se cuente con los servicios públicos necesarios para garantizar la protección de la salud pública”.Asimismo, según el considerando 6° se establece que “es deber de las personas físicas que cuenten con un permiso temporal otorgado por la municipalidad respectiva para la venta de frutas y para la preparación y venta de alimentos y bebidas en los sitios que la municipalidad defina, garantizar la inocuidad y calidad de los alimentos y bebidas, para garantizar la salud de la población”. Como bien se regula en la normativa, son las municipalidades las que deben tramitar permisos siempre y cuando cumplan con las condiciones de los sitios para la venta de frutas y la preparación y venta de alimentos y bebidas, tal y como lo ordena el artículo 4° del decreto supra citado. Por otra parte, el artículo 218 bis de la Ley General de Salud establece que “Las municipalidades podrán regular, en sus respectivas jurisdicciones, los supuestos en los que se podrán otorgar permisos temporales para las actividades comerciales que se desarrollen bajo la Ley Especial de Comercio sobre Ruedas, la venta de frutas y para la preparación y venta de alimentos y bebidas en los sitios que previamente ellas definan, siempre y cuando se cuente con los servicios públicos necesarios para garantizar la protección de la salud pública (…)”.Como es de su atención queremos dejar claro que esta Área Rectora de Salud bajo el principio de legalidad que atañe a la administración pública, no podemos actuar en contra de lo que nos ordenan las leyes que rigen la materia. A pesar de la normativa existente la Municipalidad de Talamanca otorga permisos temporales a sitios que no cumplen con los requisitos físico-sanitarios que se establecen en las normativas de salud anteriormente citadas. En visitas de campo se ha comprobado que los encargados de estos puestos han mostrado facturas de pago de patente. En relación con el daño ambiental denunciado sobre la flora y fauna costera, no podemos emitir un criterio por cuanto no es potestad de este Ministerio, siendo que es competencia material y legal de otras instituciones públicas, las cuales deben obligatoriamente emitir un criterio y por ende la legitimación. En enero del 2026 el recurrente interpuso una denuncia ante el Nivel Central, misma que fue remitida al Área Rectora de Salud de Talamanca, la cual por un error involuntario no fue registrada formalmente por esta área local.Sin embargo, este asunto se ha revisado en campo a través de las actuaciones propias de las autoridades de salud, dentro de nuestras potestades. Se aportan como medios de prueba: -Informe Técnico No IT-MS-DRRSHC-DARST-0171-2026 -Informe Técnico No IT-MS-DRRSHC-DARST-0206-2026 No se omite manifestar que nosotros como autoridades de salud otorgamos PSF a sitios o establecimientos con una estructura definida en la cual se valoran los aspectos físico-sanitarios de los mismos; no así a infraestructuras temporales en lugares públicos en sitios, a excepción que sean autorizaciones sanitarias cumpliendo con todo lo que establece la normativa vigente en materia.” CONCLUSIÓN De lo anteriormente expuesto, se determina que a la luz de la normativa expuesta “Reglamento general para Permisos Sanitarios de Funcionamiento, Permisos de Habilitación y Autorizaciones para Eventos Temporales de Concentración Masiva de Personas, otorgados por el Ministerio de Salud”, Decreto Ejecutivo N°43432-S y la Ley General de Salud Ley N°5395, este Ministerio sólo tiene competencia de tramitar y regular lo correspondiente a las solicitudes de permisos sanitarios de funcionamiento (PSF) que ingresa en ventanilla única y que se cumplan con los requerimientos técnico-legales, para así poder realizar las inspecciones a dichas solicitudes de permiso y si fuera el caso otorgar el PSF; por lo anterior será potestad de la Municipalidad local atribuirse la autoridad para ejercer la vigilancia y el control sanitario a través de sus inspectores municipales, ya que para nuestros efectos en salud solo podemos realizar las inspecciones físico-sanitarias si se encuentran amparadas a través del Reglamento especial para el control de riesgos sanitarios en ventas autorizadas de acuerdo con el artículo 218 bis de la Ley General de Salud, Decreto Ejecutivo Nº41332-S-MTSS.Así las cosas, consideramos que este Ministerio, no ha violentado los derechos fundamentales de manera alguna a la parte aquí recurrente. PETITORIA En virtud de lo expuesto, respetuosamente solicito a ese Honorable Tribunal Constitucional, DECLARAR SIN LUGAR el presente recurso de amparo, por cuanto este Ministerio, no ha violentado derecho fundamental alguno a la parte aquí recurrente; por lo cual reitero, respetuosamente, la solicitud de que se EXIMA DE TODA RESPONSABILIDAD A LA SUSCRITA DIRECTORA GENERAL DE SALUD a.i. CON RECARGO DE LA DIRECCION DE SALUD AMBIENTAL Y AL MINISTERIO DE SALUD Y SE DECLARE SIN LUGAR EL PRESENTE RECURSO DE AMPARO”. No se omite manifestar que nosotros como autoridades de salud otorgamos PSF a sitios o establecimientos con una estructura definida en la cual se valoran los aspectos físico-sanitarios de los mismos; no así a infraestructuras temporales en lugares públicos en sitios, a excepción que sean autorizaciones sanitarias cumpliendo con todo lo que establece la normativa vigente en materia.” CONCLUSIÓN De lo anteriormente expuesto, se determina que a la luz de la normativa expuesta “Reglamento general para Permisos Sanitarios de Funcionamiento, Permisos de Habilitación y Autorizaciones para Eventos Temporales de Concentración Masiva de Personas, otorgados por el Ministerio de Salud”, Decreto Ejecutivo N°43432-S y la Ley General de Salud Ley N°5395, este Ministerio sólo tiene competencia de tramitar y regular lo correspondiente a las solicitudes de permisos sanitarios de funcionamiento (PSF) que ingresa en ventanilla única y que se cumplan con los requerimientos técnico-legales, para así poder realizar las inspecciones a dichas solicitudes de permiso y si fuera el caso otorgar el PSF; por lo anterior será potestad de la Municipalidad local atribuirse la autoridad para ejercer la vigilancia y el control sanitario a través de sus inspectores municipales, ya que para nuestros efectos en salud solo podemos realizar las inspecciones físico-sanitarias si se encuentran amparadas a través del Reglamento especial para el control de riesgos sanitarios en ventas autorizadas de acuerdo con el artículo 218 bis de la Ley General de Salud, Decreto Ejecutivo Nº41332-S-MTSS.Así las cosas, consideramos que este Ministerio, no ha violentado los derechos fundamentales de manera alguna a la parte aquí recurrente. PETITORIA En virtud de lo expuesto, respetuosamente solicito a ese Honorable Tribunal Constitucional, DECLARAR SIN LUGAR el presente recurso de amparo, por cuanto este Ministerio, no ha violentado derecho fundamental alguno a la parte aquí recurrente; por lo cual reitero, respetuosamente, la solicitud de que se EXIMA DE TODA RESPONSABILIDAD A LA SUSCRITA DIRECTORA GENERAL DE SALUD a.i. CON RECARGO DE LA DIRECCION DE SALUD AMBIENTAL Y AL MINISTERIO DE SALUD Y SE DECLARE SIN LUGAR EL PRESENTE RECURSO DE AMPARO”.
  6. 6Por escrito incorporado al expediente electrónico el 7 de mayo de 2026, informa bajo juramento Iván Vinicio Vincenti Rojas en su condición de procurador general de la República. Expone: “(…) manifiesto que, después de haber firmado el informe remitido el día de ayer, contestando la audiencia conferida a la Procuraduría sobre este recurso de amparo, recibimos el oficio del Tribunal Ambiental Administrativo no. Oficio-246-2026-TAA, en el cual se actualizó el estado del expediente no. 017-26-02-TAA y se adjuntó una copia certificada de éste. Dado que, al elaborar el informe remitido solo contábamos con la información que el Tribunal Ambiental nos envió por correo electrónico el 5 de mayo, amplío la respuesta dada al hecho número 7, únicamente en cuanto a que, ese Tribunal dictó la resolución no. 374-2026- TAA de las 10 horas 15 minutos de 27 de abril de 2026, notificada al denunciante el 6 de mayo de 2026, mediante la cual resolvió declararse incompetente para conocer la denuncia planteada, por no corresponder a una competencia de ese Tribunal, y trasladar la denuncia a la Municipalidad de Talamanca.Asimismo, se actualiza la prueba no. 2 aportada, y en su lugar, se aporta el oficio no. Oficio-246-2026-TAA de 6 de mayo de 2026 y la copia certificada del expediente no. 017-26-02-TAA (Certificación N° C-106-2026-TAA). En todo lo demás, el informe rendido y la posición de la Procuraduría General de la República, se mantienen”.
  7. 7Por escrito incorporado al expediente electrónico el 14 de mayo de 2026, informa bajo juramento Rugeli Morales Rodríguez en su condición de alcalde de Talamanca. Expone: “Se aporta el siguiente cuadro de intervención que promueve la municipalidad de Talamanca como una forma de regulación en la ocupación ilegítima en esta zona:

  1. 8Por constancia elaborada por el técnico judicial y la secretaria, ambos de la Sala Constitucional, indican: “revisado, a las ocho horas ocho minutos del dieciocho de mayo de dos mil veintiséis, en el sistema costarricense de gestión de despachos judiciales el control de documentos recibidos y este expediente, no apareció que del 12/04/2026 al 14/05/2026, el ENCARGADO DEL DEPARTAMENTO DE LA ZONA MARÍTIMO TERRESTRE DE LA MUNICIPALIDAD DE TALAMANCA haya presentado escrito o documento alguno, a fin de rendir el informe que se le solicitó en la resolución dictada a las ocho horas treinta y tres minutos del treinta de abril de dos mil veintiséis, en el expediente número 26-013062-0007-CO que es RECURSO DE AMPARO promovido por Nombre01”.
  2. 9Por constancia elaborada por el técnico judicial y la secretaria, ambos de la Sala Constitucional, indican: “revisado, a las ocho horas ocho minutos del dieciocho de mayo de dos mil veintiséis, en el sistema costarricense de gestión de despachos judiciales el control de documentos recibidos y este expediente, no apareció que del 12/04/2026 al 14/05/2026, el ENCARGADO DEL DEPARTAMENTO DE LA ZONA MARÍTIMO TERRESTRE DE LA MUNICIPALIDAD DE TALAMANCA haya presentado escrito o documento alguno, a fin de rendir el informe que se le solicitó en la resolución dictada a las ocho horas treinta y tres minutos del treinta de abril de dos mil veintiséis, en el expediente número 26-013062-0007-CO que es RECURSO DE AMPARO promovido por Nombre01”.
  3. 10En los procedimientos seguidos se han observado las prescripciones legales.

Redacta el Magistrado Rueda Leal; y,

Considerando:

I.Cuestión previa. En vista de que el encargado del Departamento de la Zona Marítimo Terrestre de la Municipalidad de Talamanca omitió contestar la audiencia dentro del plazo fijado por este Tribunal en la resolución de curso del sub lite, se procede a resolver el recurso de acuerdo con el artículo 45 de la Ley de la Jurisdicción Constitucional y tomando en consideración los elementos probatorios que constan en los autos.

II.Sobre la excepción del artículo 41 de la Constitución Política. Antes de analizar el fondo del asunto debe aclararse que, a partir de la sentencia número 2008002545 de las 8:55 horas de 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones aquellos asuntos en los que se discute si la Administración Pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– o conocer de los recursos administrativos procedentes. Precisamente, en el sub lite, se plantea un supuesto de excepción, pues se está ante una denuncia ambiental gestionada ante la Procuraduría General de la República, Ministerio de Ambiente y Energía, Municipalidad de Talamanca y Ministerio de Salud, la cual se acusa que no ha sido resuelta dentro de un plazo razonable. Aclarado el punto, se entra a resolver la situación concreta reclamada en este amparo.

III.Objeto del recurso. El recurrente alega que el 16 de enero de 2026 gestionó denuncias formales ante el Ministerio de Salud, Ministerio de Ambiente y Energía, Procuraduría General de la República, Dirección General de Migración y Extranjería y la Municipalidad de Talamanca, pues en la zona pública de la Zona Marítimo Terrestre de Puerto Viejo y Cocles, cantón de Talamanca, se ha consolidado una ocupación ilegal mediante estructuras improvisadas tipo "chinamos". Añade que también algunos comercios como restaurantes privatizaron la zona, perjudicando el solaz, el paso y la belleza escénica propia del lugar. Señala que en dichas estructuras se desarrollan actividades comerciales lucrativas sin contar con concesión, permisos municipales, sanitarios ni ambientales, en abierta violación del ordenamiento jurídico. Afirma que esas actividades se realizan en condiciones absolutamente inadecuadas, sin controles sanitarios, sin manejo de residuos y sin infraestructura mínima, generando un riesgo evidente para la salud pública.

Alega que la ocupación ha provocado un grave daño ambiental, afectando la vegetación costera, incluyendo almendros de playa, cocoteros y sotobosque, que forman parte de un corredor biológico de alta relevancia ecológica, vinculado al Refugio Nacional de Vida Silvestre Gandoca-Manzanillo y al Parque Nacional Cahuita. Acusa que, pese al conocimiento efectivo de la situación, ninguna de las autoridades recurridas ha adoptado medidas eficaces, permitiendo la permanencia, expansión y consolidación de la ilegalidad. Solicita la intervención de la Sala.

IV.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

En cuanto a la Procuraduría General de la República:

  • a)El 16 de enero de 2026, el recurrente interpuso gestión ante la Procuraduría General de la República, en la que indicó: “comparezco respetuosamente ante esta Procuraduría para denunciar formalmente una ocupación ilegal, sistemática y tolerada del dominio público, concretamente de la zona pública de la Zona Marítimo Terrestre en Puerto Viejo centro y Cocles, cantón de Talamanca, lo que impide el libre acceso de los ciudadanos a dicha franca para el solaz y disfrute. En dichas áreas se han instalado estructuras comerciales ilegales que desarrollan actividades lucrativas sin concesión ni autorización, en abierta contradicción con la Ley N.° 6043 y con los principios que rigen la defensa del patrimonio público. Estas ocupaciones generan además un grave daño ambiental, al afectar directamente la vegetación costera natural -almendros de playa, cocoteros y sotobosque- que sostiene un corredor biológico costero de enorme relevancia, utilizado por aves migratorias, perezosos, ardillas, monos congos y monos cariblancos, y conectando funcionalmente con el Refugio Nacional de Vida Silvestre Gandoca-Manzanillo y sus humedales y la belleza escénica propia del caribe sur.

La inacción prolongada de las autoridades competentes ha permitido la consolidación de esta situación ilegal, generando un precedente altamente lesivo para le Estado, el ambiente y el uso común de los bienes públicos. SOLICITO: 1. Que la Procuraduría intervenga de oficio en defensa del dominio público. 2. Que se inste formalmente a las instituciones competentes a proceder con el cierre y desalojo inmediato de las ocupaciones ilegales. 3. Que se analice la eventual responsabilidad administrativa por omisión de los funcionarios que han tolerado esta situación. 4. Solicito obtener respuesta formal del trámite correspondiente a la presente denuncia” (véase informe rendido bajo juramento y prueba aportada).

  • b)Por oficio DAA-OFI-65-2026 del 21 de enero de 2026 dirigido al Tribunal Ambiental Administrativo, la procuradora Natalia Aguilar Porras indicó: “Con fundamento en los artículos 111 y 112 de la Ley Orgánica del Ambiente, traslado 1 imagen que recibimos del Licenciado Nombre01 (...01), que corresponde a una denuncia por ocupación ilegal del dominio público y daño ambiental en la zona pública de la ZMT-Puerto Viejo y Cocles, la cual fue recibida en nuestras oficinas. Ante ello, solicitamos instruir el procedimiento observando el debido proceso, para que se determine el mérito de una posible infracción a la legislación tutelar del ambiente, y la consecuente adopción de medidas preventivas o correctivas, conforme a las competencias conferidas en los artículos 1, 2, 98, 99, 101, 103, 106, 108 y 111 de la Ley Orgánica del Ambiente” (véase prueba aportada).
  • c)Por oficio DAA-OFI-66-2026 del 21 de enero de 2026 dirigido a la Municipalidad de Talamanca, la procuradora Natalia Aguilar Porras indicó: “Con fundamento en los artículos 12, 13 y 20 de la Ley No. 6043, traslado 1 imagen que recibimos de Licenciado Nombre01 (...01), que corresponde a una denuncia por ocupación ilegal del dominio público y daño ambiental en la zona pública de la ZMT- Puerto Viejo y Cocles la cual fue recibida en nuestras oficinas. Lo anterior, solicitando instruir lo procedente conforme a las competencias del ente municipal” (véase prueba aportada).
  • d)Por oficio DAA-OFI-67-2026 del 21 de enero de 2026, la procuradora Natalia Aguilar Porras contestó al recurrente: “Reciba un atento saludo. En atención a su denuncia recibida en nuestras oficinas (adjunta), con respeto manifiesto: Con fundamento en el artículo 111 de la Ley Orgánica del Ambiente, trasladamos 1 imagen adjunta, que constituye denuncia, al Tribunal Ambiental Administrativo, a quien hemos solicitado instruir el procedimiento, observando el debido proceso, para que determine el mérito de una posible infracción a la legislación tutelar del ambiente, y la consecuente adopción de medidas preventivas o correctivas. Lo anterior, conforme a las competencias conferidas en los artículos 1, 2, 98, 99, 101, 103, 106, 108 y 111 de la Ley Orgánica del Ambiente. También hemos trasladado dicha imagen de denuncia a la Municipalidad de Talamanca, de conformidad con lo que establecen los artículos 12, 13 y 20 de la Ley No. 6043”. Tal oficio le fue remitido al correo electrónico ...01 a las 18:10 horas del 21 de enero de 2026 (véase prueba aportada).
  • e)La resolución de curso del amparo fue notificada a la PGR el 30 de abril de 2026 (véase acta de notificación).

En cuanto al Ministerio de Salud:

  • f)El 16 de enero de 2026, el recurrente gestionó ante el Ministerio de Salud la siguiente denuncia: “(…) comparezco respetuosamente ante esa autoridad para poner en su conocimiento hechos de extrema gravedad sanitaria, ambiental y jurídica que ocurren en la zona pública de la Zona Marítimo Terrestre (ZMT), específicamente en Puerto Viejo centro y Cocles, cantón de Talamanca, provincia de Limón. En dicha zona pública operan múltiples chinamos y estructuras improvisadas desde donde se desarrollan actividades de preparación y venta de alimentos, bebidas, artesanías y servicios personales como masajes y corte de cabello, todo ello sin contar con permisos sanitarios, sin inspecciones, sin control alguno y al margen absoluto de la normativa de salud pública. Estas actividades se desarrollan en condiciones absolutamente insalubres, toda vez que: -No existen servicios sanitarios (baños) para la atención de las necesidades fisiológicas de quienes operan o visitan esos puestos. -Se generan desechos sólidos de manera constante, sin sistemas adecuados de recolección, almacenamiento ni disposición final. -Una parte significativa de los residuos sólidos y líquidos es arrojada directamente al ambiente, incluyendo la playa y el mar. -Otros desechos son tratados de forma improvisada, sin ningún criterio técnico, sanitario o ambiental, agravando la contaminación del suelo, las aguas y el entorno costero. -También se generan malos olores, que no son propios de una zona turística.

Esta situación no solo constituye una violación flagrante a la Ley General de Salud, sino que representa un riesgo real e inaceptable para la salud pública de la población local y de los turistas, así como un factor de degradación ambiental severa en un ecosistema costero frágil, ecológicamente trascendental y conectado a un corredor biológico de alta relevancia” (véase prueba aportada).

  • g)La resolución de curso del amparo fue notificada al director de la Dirección de Protección al Ambiente Humano del Ministerio de Salud el 30 de abril de 2026 (véase acta de notificación).
  • h)La denuncia del amparado fue remitida al área rectora de salud de Talamanca; sin embargo, no fue registrada formalmente por esa área local (véase informe rendido bajo juramento).

En cuanto al Ministerio de Ambiente y Energía:

  • i)El 16 de enero de 2026, el recurrente interpuso denuncia ante el Ministerio de Ambiente y Energía, en la que indicó: “(…) comparezco respetuosamente ante esa autoridad para poner en su conocimiento hechos de extrema gravedad ambiental y jurídica que ocurren en la zona pública de la Zona Marítimo Terrestre (ZMT), específicamente en Puerto Viejo centro y Cocles, cantón de Talamanca, provincia de Limón. En dichos sectores, de forma pública, notoria, permanente y tolerada, se han instalado múltiples chinamos y estructuras improvisadas dentro de la zona pública de la ZMT, desde donde se desarrollan actividades comerciales lucrativas tales como venta de alimentos, artesanías y prestación de servicios personales, todo ello sin concesión, sin autorización legal, sin viabilidad ambiental y en abierta violación del régimen jurídico demanial. Estas ocupaciones no solo constituyen una usurpación ilegítima del dominio público prohibida por la Ley sobre la Zona Marítimo Terrestre, Ley N.° 6043, sino que generan un grave daño ambiental al desarrollarse sobre un ecosistema costero de altísima relevancia ecológica.

En la zona pública afectada existe vegetación natural característica, incluyendo cocoteros, almendros de playa y sotobosque, los cuales cumplen funciones ecológicas esenciales como estabilización costera, refugio, alimentación y conectividad biológica para numerosas especies de fauna silvestre, entre ellas aves migratorias, perezosos, ardillas, monos congos y monos cariblancos. Dicha franja costera forma parte de un corredor biológico continuo que se extiende desde Puerto Viejo, Cocles y Punta Uva hasta Manzanillo, conectando funcionalmente con el Refugio Nacional de Vida Silvestre Gandoca – Manzanillo, y sus humedales, corredor indispensable para el desplazamiento seguro de la fauna y la conservación de la biodiversidad. La ocupación ilegal, la eliminación de vegetación, la compactación del suelo, la generación de residuos y la perturbación humana asociada a estas actividades fragmentan y degradan dicho corredor biológico, produciendo un impacto ambiental acumulativo, grave y potencialmente irreversible, sin destacar la afectación a la belleza escénica propia del caribe sur” (véase prueba aportada).

  • j)El 19 de enero de 2026, se trasladó la denuncia del tutelado a la Dirección Regional del Área de Conservación la Amistad Caribe (véase prueba aportada).
  • k)El 7 de marzo de 2026, por oficio CARTA-SINAC-ACLAC-PPCP-043-2026, se trasladó la denuncia a la Municipalidad de Talamanca (véase informe rendido bajo juramento y prueba aportada).
  • l)El 4 de mayo de 2026, mediante oficio CARTA-SINAC-ACLAC-PPCP-089-2026 se le comunicó al recurrente: ““En atención y seguimiento a la denuncia presentada ante el despacho del señor Ministro de Ambiente y Energía, señor Franz Tattenbach Capra, relacionada con presuntas ocupaciones, estructuras y actividades en la zona pública de la Zona Marítimo Terrestre en los sectores de Puerto Viejo y Cocles, cantón de Talamanca, y trasladada para atención mediante oficio CARTA-SINAC-ACLAC-DR-0044-2026, de fecha 20 de enero del 2026, se procede a brindar respuesta dentro del ámbito de competencias del SINAC-ACLAC. En su escrito, usted solicitó expresamente: “Que el MINAE ordene y ejecute de inmediato acciones de protección ambiental, recuperación, restauración y restitución de la zona pública de la ZMT en Puerto Viejo y Cocles”. “Que se coordine el desalojo inmediato de todas las personas, estructuras y actividades que ocupan ilegalmente dicha zona”.“Que se adopten medidas preventivas y correctivas eficaces para impedir la reinstalación de estas ocupaciones y la continuidad del daño ambiental”.

“Solicito obtener respuesta formal del trámite correspondiente a la presente denuncia”. Al respecto, se atienden sus solicitudes en el mismo orden planteado: Sobre la solicitud de protección, recuperación, restauración y restitución de la zona pública de la ZMT La Ley sobre la Zona Marítimo Terrestre, N.° 6043, establece que la Zona Marítimo Terrestre constituye parte del patrimonio nacional, pertenece al Estado y es inalienable e imprescriptible, siendo obligación del Estado, sus instituciones y todos los habitantes protegerla y conservar sus recursos naturales. Asimismo, dicha ley dispone que corresponde a las municipalidades velar directamente por el cumplimiento de las normas relativas al dominio, desarrollo, aprovechamiento y uso de la Zona Marítimo Terrestre, y que el usufructo y administración de la zona pública y la zona restringida corresponden a la municipalidad de la jurisdicción respectiva.

En ese sentido, para el caso concreto el sector de Puerto Viejo, la administración directa de la Zona Marítimo Terrestre corresponde a la Municipalidad de Talamanca, sin perjuicio de las competencias ambientales que puedan corresponder al SINAC cuando se identifiquen afectaciones a recursos naturales, ecosistemas, vida silvestre, cobertura boscosa, humedales, manglares, áreas de protección u otros elementos bajo tutela ambiental. Por lo anterior, mediante oficio CARTA-SINAC-ACLAC-PPCP-0432026, de fecha 07 de marzo del 2026, esta coordinación trasladó formalmente a la Municipalidad de Talamanca la denuncia presentada por su persona, con el fin de que dicha Municipalidad valore, dentro de sus competencias, la existencia o inexistencia de permisos, concesiones, autorizaciones municipales, actos administrativos, expedientes o cualquier otro antecedente relacionado con las estructuras y actividades denunciadas.

En ese mismo oficio, se manifestó la disposición del ACLAC para coordinar una eventual inspección conjunta en el sitio, a fin de facilitar una valoración integral del caso conforme a las competencias de cada institución. Sobre la solicitud de desalojo inmediato de personas, estructuras y actividades Con respecto a la solicitud de desalojo inmediato, resulta necesario indicar que la Ley N.° 6043 prohíbe, sin la debida autorización legal, levantar edificaciones o instalaciones, cortar árboles, extraer productos o realizar cualquier otro tipo de desarrollo, actividad u ocupación dentro de la Zona Marítimo Terrestre. Asimismo, dicha normativa establece que, cuando las autoridades competentes tengan noticia de infracciones, podrán proceder, previa información levantada al efecto si se estimare necesaria, al desalojo de infractores y a la destrucción o demolición de construcciones, remodelaciones o instalaciones realizadas al margen de la ley.

No obstante, para efectos de proceder válidamente con medidas de desalojo, demolición o remoción, resulta necesario que la autoridad competente determine previamente la ubicación exacta de las estructuras denunciadas, su relación con la zona pública o restringida, la existencia o inexistencia de autorizaciones, permisos, concesiones o actos administrativos, así como cualquier otra condición jurídica o técnica que resulte aplicable al caso concreto. En razón de lo anterior, corresponde a la Municipalidad de Talamanca, como administradora directa de la Zona Marítimo Terrestre en su jurisdicción, realizar el análisis administrativo correspondiente y determinar las acciones procedentes, sin perjuicio de la coordinación interinstitucional que pueda requerirse con el SINAC, Fuerza Pública, Ministerio Público u otras autoridades competentes, en caso de acreditarse una ocupación ilegal o una afectación ambiental asociada.

Sobre la adopción de medidas preventivas y correctivas. En relación con la adopción de medidas preventivas y correctivas para impedir la reinstalación de ocupaciones o la continuidad de un posible daño ambiental, esta coordinación considera indispensable que, en primera instancia, la Municipalidad de Talamanca determine la situación legal de las estructuras, actividades u ocupaciones denunciadas, así como la existencia de permisos, concesiones, autorizaciones, estudios previos o expedientes administrativos vinculados con el sitio. Una vez realizada dicha valoración municipal, y en caso de que se identifiquen posibles afectaciones ambientales, el SINAC-ACLAC podrá valorar, dentro de sus competencias técnicas, la elaboración de informes, criterios técnicos o peritajes ambientales, según corresponda. De comprobarse una posible infracción ambiental o un eventual daño a recursos naturales, dichos insumos podrán ser remitidos al Ministerio Público o a la autoridad administrativa competente, a efectos de que se valoren las acciones preventivas, correctivas, cautelares o judiciales que procedan conforme al debido proceso.

Asimismo, el SINAC-ACLAC mantiene la disposición de participar en una inspección conjunta con la Municipalidad de Talamanca, siempre que dicha diligencia sea coordinada formalmente y permita abordar el caso de manera integral, diferenciando los aspectos de administración de la Zona Marítimo Terrestre de aquellos estrictamente ambientales. Sobre el estado del trámite de la denuncia. En cuanto al trámite dado a su denuncia, se informa que, además del traslado interno realizado por la Dirección Regional del ACLAC mediante oficio CARTA-SINAC-ACLAC-DR-0044-2026, esta coordinación remitió el caso a la Municipalidad de Talamanca mediante oficio CARTASINAC-ACLAC-PPCP-043-2026, de fecha 07 de marzo del 2026. Posteriormente, con fecha viernes 17 de abril del 2026, el despacho de la Alcaldía Municipal de Talamanca comunicó, por medio de correo electrónico, la asignación de los funcionarios municipales Helmer Zumbado Edwards, Byron Marchena Esquivel y Jesús Alanís Nelson para la atención de la nota presentada por su persona y del oficio remitido por el SINAC-ACLAC.

En consecuencia, esta Área de Conservación se mantiene a la espera de las actuaciones, valoraciones o coordinación que disponga la Municipalidad de Talamanca, en su condición de administradora directa de la Zona Marítimo Terrestre en el cantón, para determinar si corresponde realizar una inspección conjunta o activar otras acciones técnicas dentro del ámbito de competencia del SINAC-ACLAC. Finalmente, se aclara que la presente respuesta se emite dentro del marco competencial del SINAC-ACLAC y no sustituye el pronunciamiento que corresponde emitir a la Municipalidad de Talamanca respecto de permisos, concesiones, ocupaciones, desalojos, demoliciones o recuperación administrativa de la Zona Marítimo Terrestre. No obstante, esta institución mantiene su disposición de atender, documentar y remitir a las autoridades correspondientes cualquier afectación ambiental verificable que sea constatada en el sitio” (véase informe rendido bajo juramento y prueba aportada).

En cuanto a la Municipalidad de Talamanca:

  • m)El 16 de enero de 2026, el recurrente interpuso una denuncia ante la Municipalidad de Talamanca (hecho incontrovertido).
  • n)La Procuraduría General de la República y el Ministerio de Ambiente y Energía trasladaron las denuncias de la recurrente a la Municipalidad de Talamanca (véase informes rendidos bajo juramento).
  • o)La Municipalidad de Talamanca realizó este cuadro de intervención ante la ocupación ilegítima en la zona:

  • p)El 16 de enero de 2026, el recurrente interpuso gestión ante la Dirección General de Migración y Extranjería en la que indicó: “(…) comparezco ante esta Dirección General para poner en su conocimiento y denunciar hechos de suma gravedad jurídica y administrativa, relacionados con la realización de actividades lucrativas por personas extranjeras en presunta condición migratoria irregular, en la zona pública de la Zona Marítimo Terrestre (ZMT), específicamente en Puerto Viejo centro y Cocles, cantón de Talamanca, provincia de Limón. Es un hecho público, notorio, permanente y fácilmente verificable que en dichos sectores operan múltiples estructuras improvisadas y chinamos ubicados dentro de la zona pública de la ZMT, desde los cuales se desarrollan actividades comerciales tales como venta de alimentos, bebidas, artesanías y prestación de servicios personales, sin concesión, sin autorización administrativa y en abierta violación del régimen jurídico del dominio público.

De manera concurrente, se ha constatado que una parte significativa de quienes ejercen dichas actividades son personas extranjeras que, según información de conocimiento público y observación directa, no cuentan con estatus migratorio regular ni autorización para el ejercicio de actividades remuneradas en el país, contraviniendo de forma directa la Ley General de Migración y Extranjería, Ley N.° 8764, así como su reglamento (…)” (véase prueba aportada).

V. Hecho no probado. No logra acreditarse el siguiente hecho, de importancia para la resolución de este asunto

ÚNICO. Que las autoridades del Ministerio de Salud y la Municipalidad de Talamanca hayan atendido las denuncias interpuestas por el recurrente el 16 de enero de 2026.

VI.Sobre el caso concreto. En el sub lite, el recurrente alega que el 16 de enero de 2026 gestionó denuncias formales ante el Ministerio de Salud, Ministerio de Ambiente y Energía, Procuraduría General de la República, Dirección General de Migración y Extranjería y la Municipalidad de Talamanca, pues en la zona pública de la Zona Marítimo Terrestre de Puerto Viejo y Cocles, cantón de Talamanca, se ha consolidado una ocupación ilegal mediante estructuras improvisadas tipo "chinamos". Añade que también algunos comercios como restaurantes privatizaron la zona, perjudicando el solaz, el paso y la belleza escénica propia del lugar. Señala que en dichas estructuras se desarrollan actividades comerciales lucrativas sin contar con concesión, permisos municipales, sanitarios ni ambientales, en abierta violación del ordenamiento jurídico. Afirma que esas actividades se realizan en condiciones absolutamente inadecuadas, sin controles sanitarios, sin manejo de residuos y sin infraestructura mínima, generando un riesgo evidente para la salud pública.

Alega que la ocupación ha provocado un grave daño ambiental, afectando la vegetación costera, incluyendo almendros de playa, cocoteros y sotobosque, que forman parte de un corredor biológico de alta relevancia ecológica, vinculado al Refugio Nacional de Vida Silvestre Gandoca-Manzanillo y al Parque Nacional Cahuita. Acusa que, pese al conocimiento efectivo de la situación, ninguna de las autoridades recurridas ha adoptado medidas eficaces, permitiendo la permanencia, expansión y consolidación de la ilegalidad. Solicita la intervención de la Sala.

Como primer aspecto, en cuanto al Ministerio de Salud, consta que el 16 de enero de 2026, el recurrente gestionó la siguiente denuncia: “(…) comparezco respetuosamente ante esa autoridad para poner en su conocimiento hechos de extrema gravedad sanitaria, ambiental y jurídica que ocurren en la zona pública de la Zona Marítimo Terrestre (ZMT), específicamente en Puerto Viejo centro y Cocles, cantón de Talamanca, provincia de Limón. En dicha zona pública operan múltiples chinamos y estructuras improvisadas desde donde se desarrollan actividades de preparación y venta de alimentos, bebidas, artesanías y servicios personales como masajes y corte de cabello, todo ello sin contar con permisos sanitarios, sin inspecciones, sin control alguno y al margen absoluto de la normativa de salud pública. Estas actividades se desarrollan en condiciones absolutamente insalubres, toda vez que: -No existen servicios sanitarios (baños) para la atención de las necesidades fisiológicas de quienes operan o visitan esos puestos. -Se generan desechos sólidos de manera constante, sin sistemas adecuados de recolección, almacenamiento ni disposición final. -Una parte significativa de los residuos sólidos y líquidos es arrojada directamente al ambiente, incluyendo la playa y el mar. -Otros desechos son tratados de forma improvisada, sin ningún criterio técnico, sanitario o ambiental, agravando la contaminación del suelo, las aguas y el entorno costero. -También se generan malos olores, que no son propios de una zona turística.

Esta situación no solo constituye una violación flagrante a la Ley General de Salud, sino que representa un riesgo real e inaceptable para la salud pública de la población local y de los turistas, así como un factor de degradación ambiental severa en un ecosistema costero frágil, ecológicamente trascendental y conectado a un corredor biológico de alta relevancia”. La resolución de curso del amparo fue notificada al director de la Dirección de Protección al Ambiente Humano del Ministerio de Salud el 30 de abril de 2026.

Al respecto, las autoridades recurridas no rechazan los hechos que se les atribuyen y se limitan a indicar que: “En enero del 2026 el recurrente interpuso una denuncia ante el Nivel Central, misma que fue remitida al Área Rectora de Salud de Talamanca, la cual por un error involuntario no fue registrada formalmente por esta área local. Sin embargo, este asunto se ha revisado en campo a través de las actuaciones propias de las autoridades de salud, dentro de nuestras potestades”.

Así las cosas, si bien las autoridades afirman que han “revisado en campo” la situación denunciada por el accionante, no consta que su gestión haya sido formalmente atendida. En consecuencia, se declara con lugar el recurso en cuanto a este extremo, según se indicará en la parte dispositiva de esta sentencia.

Por otra parte, en cuanto a la Municipalidad de Talamanca, si bien el recurrente no aportó copia con sello de recibido de la denuncia que asegura haber interpuesto el 16 de enero de 2026, lo cierto es que las autoridades recurridas no hicieron referencia a esa gestión, sino que se limitaron a informar que elaboraron una tabla con la propuesta de intervención ante la reclamada ocupación ilegítima en la zona, a saber:

Asimismo, el Ministerio de Ambiente y Energía también había canalizado la gestión del accionante desde el 7 de marzo de 2026, lo que evidencia que la Municipalidad de Talamanca tenía conocimiento de las gestiones incoadas.

Aclarado lo anterior, no consta que la Municipalidad de Talamanca haya comunicado al recurrente las gestiones realizadas para atender su reclamo, por lo que procede estimar el recurso de amparo en cuanto a este extremo.

En relación con Ministerio de Ambiente y Energía, consta que el 16 de enero de 2026, el recurrente interpuso denuncia ante el Ministerio de Ambiente y Energía, en la que indicó: “(…) comparezco respetuosamente ante esa autoridad para poner en su conocimiento hechos de extrema gravedad ambiental y jurídica que ocurren en la zona pública de la Zona Marítimo Terrestre (ZMT), específicamente en Puerto Viejo centro y Cocles, cantón de Talamanca, provincia de Limón. En dichos sectores, de forma pública, notoria, permanente y tolerada, se han instalado múltiples chinamos y estructuras improvisadas dentro de la zona pública de la ZMT, desde donde se desarrollan actividades comerciales lucrativas tales como venta de alimentos, artesanías y prestación de servicios personales, todo ello sin concesión, sin autorización legal, sin viabilidad ambiental y en abierta violación del régimen jurídico demanial.

Estas ocupaciones no solo constituyen una usurpación ilegítima del dominio público prohibida por la Ley sobre la Zona Marítimo Terrestre, Ley N.° 6043, sino que generan un grave daño ambiental al desarrollarse sobre un ecosistema costero de altísima relevancia ecológica. En la zona pública afectada existe vegetación natural característica, incluyendo cocoteros, almendros de playa y sotobosque, los cuales cumplen funciones ecológicas esenciales como estabilización costera, refugio, alimentación y conectividad biológica para numerosas especies de fauna silvestre, entre ellas aves migratorias, perezosos, ardillas, monos congos y monos cariblancos. Dicha franja costera forma parte de un corredor biológico continuo que se extiende desde Puerto Viejo, Cocles y Punta Uva hasta Manzanillo, conectando funcionalmente con el Refugio Nacional de Vida Silvestre Gandoca – Manzanillo, y sus humedales, corredor indispensable para el desplazamiento seguro de la fauna y la conservación de la biodiversidad.

La ocupación ilegal, la eliminación de vegetación, la compactación del suelo, la generación de residuos y la perturbación humana asociada a estas actividades fragmentan y degradan dicho corredor biológico, produciendo un impacto ambiental acumulativo, grave y potencialmente irreversible, sin destacar la afectación a la belleza escénica propia del caribe sur”. El 19 de enero de 2026, se trasladó la denuncia del tutelado a la Dirección Regional del Área de Conservación la Amistad Caribe. El 7 de marzo de 2026, por oficio CARTA-SINAC-ACLAC-PPCP-043-2026, se trasladó la denuncia a la Municipalidad de Talamanca. El 4 de mayo de 2026, mediante oficio CARTA-SINAC-ACLAC-PPCP-089-2026 se le comunicó al recurrente: ““En atención y seguimiento a la denuncia presentada ante el despacho del señor Ministro de Ambiente y Energía, señor Franz Tattenbach Capra, relacionada con presuntas ocupaciones, estructuras y actividades en la zona pública de la Zona Marítimo Terrestre en los sectores de Puerto Viejo y Cocles, cantón de Talamanca, y trasladada para atención mediante oficio CARTA-SINAC-ACLAC-DR-0044-2026, de fecha 20 de enero del 2026, se procede a brindar respuesta dentro del ámbito de competencias del SINAC-ACLAC.

En su escrito, usted solicitó expresamente: “Que el MINAE ordene y ejecute de inmediato acciones de protección ambiental, recuperación, restauración y restitución de la zona pública de la ZMT en Puerto Viejo y Cocles”. “Que se coordine el desalojo inmediato de todas las personas, estructuras y actividades que ocupan ilegalmente dicha zona”. “Que se adopten medidas preventivas y correctivas eficaces para impedir la reinstalación de estas ocupaciones y la continuidad del daño ambiental”. “Solicito obtener respuesta formal del trámite correspondiente a la presente denuncia”. Al respecto, se atienden sus solicitudes en el mismo orden planteado: Sobre la solicitud de protección, recuperación, restauración y restitución de la zona pública de la ZMT La Ley sobre la Zona Marítimo Terrestre, N.° 6043, establece que la Zona Marítimo Terrestre constituye parte del patrimonio nacional, pertenece al Estado y es inalienable e imprescriptible, siendo obligación del Estado, sus instituciones y todos los habitantes protegerla y conservar sus recursos naturales.

Asimismo, dicha ley dispone que corresponde a las municipalidades velar directamente por el cumplimiento de las normas relativas al dominio, desarrollo, aprovechamiento y uso de la Zona Marítimo Terrestre, y que el usufructo y administración de la zona pública y la zona restringida corresponden a la municipalidad de la jurisdicción respectiva. En ese sentido, para el caso concreto el sector de Puerto Viejo, la administración directa de la Zona Marítimo Terrestre corresponde a la Municipalidad de Talamanca, sin perjuicio de las competencias ambientales que puedan corresponder al SINAC cuando se identifiquen afectaciones a recursos naturales, ecosistemas, vida silvestre, cobertura boscosa, humedales, manglares, áreas de protección u otros elementos bajo tutela ambiental. Por lo anterior, mediante oficio CARTA-SINAC-ACLAC-PPCP-0432026, de fecha 07 de marzo del 2026, esta coordinación trasladó formalmente a la Municipalidad de Talamanca la denuncia presentada por su persona, con el fin de que dicha Municipalidad valore, dentro de sus competencias, la existencia o inexistencia de permisos, concesiones, autorizaciones municipales, actos administrativos, expedientes o cualquier otro antecedente relacionado con las estructuras y actividades denunciadas.

En ese mismo oficio, se manifestó la disposición del ACLAC para coordinar una eventual inspección conjunta en el sitio, a fin de facilitar una valoración integral del caso conforme a las competencias de cada institución. Sobre la solicitud de desalojo inmediato de personas, estructuras y actividades Con respecto a la solicitud de desalojo inmediato, resulta necesario indicar que la Ley N.° 6043 prohíbe, sin la debida autorización legal, levantar edificaciones o instalaciones, cortar árboles, extraer productos o realizar cualquier otro tipo de desarrollo, actividad u ocupación dentro de la Zona Marítimo Terrestre. Asimismo, dicha normativa establece que, cuando las autoridades competentes tengan noticia de infracciones, podrán proceder, previa información levantada al efecto si se estimare necesaria, al desalojo de infractores y a la destrucción o demolición de construcciones, remodelaciones o instalaciones realizadas al margen de la ley.

No obstante, para efectos de proceder válidamente con medidas de desalojo, demolición o remoción, resulta necesario que la autoridad competente determine previamente la ubicación exacta de las estructuras denunciadas, su relación con la zona pública o restringida, la existencia o inexistencia de autorizaciones, permisos, concesiones o actos administrativos, así como cualquier otra condición jurídica o técnica que resulte aplicable al caso concreto. En razón de lo anterior, corresponde a la Municipalidad de Talamanca, como administradora directa de la Zona Marítimo Terrestre en su jurisdicción, realizar el análisis administrativo correspondiente y determinar las acciones procedentes, sin perjuicio de la coordinación interinstitucional que pueda requerirse con el SINAC, Fuerza Pública, Ministerio Público u otras autoridades competentes, en caso de acreditarse una ocupación ilegal o una afectación ambiental asociada.

Sobre la adopción de medidas preventivas y correctivas. En relación con la adopción de medidas preventivas y correctivas para impedir la reinstalación de ocupaciones o la continuidad de un posible daño ambiental, esta coordinación considera indispensable que, en primera instancia, la Municipalidad de Talamanca determine la situación legal de las estructuras, actividades u ocupaciones denunciadas, así como la existencia de permisos, concesiones, autorizaciones, estudios previos o expedientes administrativos vinculados con el sitio. Una vez realizada dicha valoración municipal, y en caso de que se identifiquen posibles afectaciones ambientales, el SINAC-ACLAC podrá valorar, dentro de sus competencias técnicas, la elaboración de informes, criterios técnicos o peritajes ambientales, según corresponda. De comprobarse una posible infracción ambiental o un eventual daño a recursos naturales, dichos insumos podrán ser remitidos al Ministerio Público o a la autoridad administrativa competente, a efectos de que se valoren las acciones preventivas, correctivas, cautelares o judiciales que procedan conforme al debido proceso.

Asimismo, el SINAC-ACLAC mantiene la disposición de participar en una inspección conjunta con la Municipalidad de Talamanca, siempre que dicha diligencia sea coordinada formalmente y permita abordar el caso de manera integral, diferenciando los aspectos de administración de la Zona Marítimo Terrestre de aquellos estrictamente ambientales. Sobre el estado del trámite de la denuncia. En cuanto al trámite dado a su denuncia, se informa que, además del traslado interno realizado por la Dirección Regional del ACLAC mediante oficio CARTA-SINAC-ACLAC-DR-0044-2026, esta coordinación remitió el caso a la Municipalidad de Talamanca mediante oficio CARTASINAC-ACLAC-PPCP-043-2026, de fecha 07 de marzo del 2026. Posteriormente, con fecha viernes 17 de abril del 2026, el despacho de la Alcaldía Municipal de Talamanca comunicó, por medio de correo electrónico, la asignación de los funcionarios municipales Helmer Zumbado Edwards, Byron Marchena Esquivel y Jesús Alanís Nelson para la atención de la nota presentada por su persona y del oficio remitido por el SINAC-ACLAC.

En consecuencia, esta Área de Conservación se mantiene a la espera de las actuaciones, valoraciones o coordinación que disponga la Municipalidad de Talamanca, en su condición de administradora directa de la Zona Marítimo Terrestre en el cantón, para determinar si corresponde realizar una inspección conjunta o activar otras acciones técnicas dentro del ámbito de competencia del SINAC-ACLAC. Finalmente, se aclara que la presente respuesta se emite dentro del marco competencial del SINAC-ACLAC y no sustituye el pronunciamiento que corresponde emitir a la Municipalidad de Talamanca respecto de permisos, concesiones, ocupaciones, desalojos, demoliciones o recuperación administrativa de la Zona Marítimo Terrestre. No obstante, esta institución mantiene su disposición de atender, documentar y remitir a las autoridades correspondientes cualquier afectación ambiental verificable que sea constatada en el sitio”.

Así las cosas, consta que el Ministerio de Ambiente y Energía recibió la denuncia del recurrente desde el 16 de enero de 2026 y, si bien analizó el reclamo y decidió remitir la gestión a la Municipalidad de Talamanca por competencia, fue hasta el 4 de mayo de 2026 -con posterioridad de la resolución de curso del amparo- que se le comunicó al recurrente el oficio CARTA-SINAC-ACLAC-PPCP-089-2026 en el que constan las acciones realizadas en relación con su denuncia.

En consecuencia, como el plazo de espera para atender la gestión de la amparada fue excesivo y la medida correctiva no se tomó sino con posterioridad a la notificación del curso este amparo, procede estimar el recurso de amparo en cuanto a este extremo.

En otro orden de ideas, en cuanto a la Procuraduría General de la República, consta que el 16 de enero de 2026, el recurrente interpuso una gestión en la que indicó: “comparezco respetuosamente ante esta Procuraduría para denunciar formalmente una ocupación ilegal, sistemática y tolerada del dominio público, concretamente de la zona pública de la Zona Marítimo Terrestre en Puerto Viejo centro y Cocles, cantón de Talamanca, lo que impide el libre acceso de los ciudadanos a dicha franca para el solaz y disfrute. En dichas áreas se han instalado estructuras comerciales ilegales que desarrollan actividades lucrativas sin concesión ni autorización, en abierta contradicción con la Ley N.° 6043 y con los principios que rigen la defensa del patrimonio público. Estas ocupaciones generan además un grave daño ambiental, al afectar directamente la vegetación costera natural -almendros de playa, cocoteros y sotobosque- que sostiene un corredor biológico costero de enorme relevancia, utilizado por aves migratorias, perezosos, ardillas, monos congos y monos cariblancos, y conectando funcionalmente con el Refugio Nacional de Vida Silvestre Gandoca-Manzanillo y sus humedales y la belleza escénica propia del caribe sur.

La inacción prolongada de las autoridades competentes ha permitido la consolidación de esta situación ilegal, generando un precedente altamente lesivo para le Estado, el ambiente y el uso común de los bienes públicos. SOLICITO: 1. Que la Procuraduría intervenga de oficio en defensa del dominio público. 2. Que se inste formalmente a las instituciones competentes a proceder con el cierre y desalojo inmediato de las ocupaciones ilegales. 3. Que se analice la eventual responsabilidad administrativa por omisión de los funcionarios que han tolerado esta situación. 4. Solicito obtener respuesta formal del trámite correspondiente a la presente denuncia”. Posteriormente, por oficio DAA-OFI-65-2026 del 21 de enero de 2026 dirigido al Tribunal Ambiental Administrativo, la procuradora Natalia Aguilar Porras indicó: “Con fundamento en los artículos 111 y 112 de la Ley Orgánica del Ambiente, traslado 1 imagen que recibimos del Licenciado Nombre01 (...01), que corresponde a una denuncia por ocupación ilegal del dominio público y daño ambiental en la zona pública de la ZMT-Puerto Viejo y Cocles, la cual fue recibida en nuestras oficinas.

Ante ello, solicitamos instruir el procedimiento observando el debido proceso, para que se determine el mérito de una posible infracción a la legislación tutelar del ambiente, y la consecuente adopción de medidas preventivas o correctivas, conforme a las competencias conferidas en los artículos 1, 2, 98, 99, 101, 103, 106, 108 y 111 de la Ley Orgánica del Ambiente”. Además, por oficio DAA-OFI-66-2026 del 21 de enero de 2026 dirigido a la Municipalidad de Talamanca, la procuradora Natalia Aguilar Porras indicó: “Con fundamento en los artículos 12, 13 y 20 de la Ley No. 6043, traslado 1 imagen que recibimos de Licenciado Nombre01 (...01), que corresponde a una denuncia por ocupación ilegal del dominio público y daño ambiental en la zona pública de la ZMT- Puerto Viejo y Cocles la cual fue recibida en nuestras oficinas. Lo anterior, solicitando instruir lo procedente conforme a las competencias del ente municipal”.

Finalmente, por oficio DAA-OFI-67-2026 del 21 de enero de 2026, la procuradora Natalia Aguilar Porras contestó al recurrente: “Reciba un atento saludo. En atención a su denuncia recibida en nuestras oficinas (adjunta), con respeto manifiesto: Con fundamento en el artículo 111 de la Ley Orgánica del Ambiente, trasladamos 1 imagen adjunta, que constituye denuncia, al Tribunal Ambiental Administrativo, a quien hemos solicitado instruir el procedimiento, observando el debido proceso, para que determine el mérito de una posible infracción a la legislación tutelar del ambiente, y la consecuente adopción de medidas preventivas o correctivas. Lo anterior, conforme a las competencias conferidas en los artículos 1, 2, 98, 99, 101, 103, 106, 108 y 111 de la Ley Orgánica del Ambiente. También hemos trasladado dicha imagen de denuncia a la Municipalidad de Talamanca, de conformidad con lo que establecen los artículos 12, 13 y 20 de la Ley No. 6043”. Tal oficio le fue remitido al correo electrónico ...01 a las 18:10 horas del 21 de enero de 2026.

Así las cosas, véase que la Procuraduría General de la República sí tramitó la denuncia del recurrente, la derivó a la Municipalidad de Talamanca y al Tribunal Ambiental Administrativo y le comunicó al accionante las acciones realizadas, previo a la interposición del amparo. Ergo, en cuanto a la procuraduría recurrida, se desestima el recurso de amparo.

Finalmente, en cuanto a la Dirección General de Migración y Extranjería, se observa que el 16 de enero de 2026, el recurrente interpuso gestión ante la Dirección General de Migración y Extranjería en la que indicó: “(…) comparezco ante esta Dirección General para poner en su conocimiento y denunciar hechos de suma gravedad jurídica y administrativa, relacionados con la realización de actividades lucrativas por personas extranjeras en presunta condición migratoria irregular, en la zona pública de la Zona Marítimo Terrestre (ZMT), específicamente en Puerto Viejo centro y Cocles, cantón de Talamanca, provincia de Limón. Es un hecho público, notorio, permanente y fácilmente verificable que en dichos sectores operan múltiples estructuras improvisadas y chinamos ubicados dentro de la zona pública de la ZMT, desde los cuales se desarrollan actividades comerciales tales como venta de alimentos, bebidas, artesanías y prestación de servicios personales, sin concesión, sin autorización administrativa y en abierta violación del régimen jurídico del dominio público.

De manera concurrente, se ha constatado que una parte significativa de quienes ejercen dichas actividades son personas extranjeras que, según información de conocimiento público y observación directa, no cuentan con estatus migratorio regular ni autorización para el ejercicio de actividades remuneradas en el país, contraviniendo de forma directa la Ley General de Migración y Extranjería, Ley N.° 8764, así como su reglamento (…)”.

Al respecto, nótese que esa denuncia no se encuentra en los supuestos de excepción establecidos en el considerando I de esta sentencia, pues lo que reclama es que, en su criterio, existen personas extranjeras en situación irregular realizando actividades comerciales sin permiso.

En ese sentido, véase que la Presidencia de la Sala ni siquiera cursó el amparo en cuanto a este extremo, por cuanto la acusada falta de resolución de la gestión planteada por la parte recurrente, constituiría, de ser el caso, una violación a lo dispuesto en el artículo 41 de la Constitución Política, motivo por el cual el reclamo debe ser ventilado ante la jurisdicción contencioso-administrativa, de conformidad con las siguientes consideraciones:

“III.- NUEVA JUSTICIA ADMINISTRATIVA MECANISMO CÉLERE Y CUMPLIDO PARA LA PROTECCIÓN DE SITUACIONES JURÍDICAS SUSTANCIALES DE LOS ADMINISTRADOS. La Sala Constitucional, desde su fundación, ha utilizado criterios amplios de admisibilidad en vista de la ausencia de cauces procesales expeditos y céleres para la protección de las situaciones jurídicas sustanciales que tienen asidero en el ordenamiento jurídico infra-constitucional o parámetro de legalidad, que guardan conexión indirecta con los derechos fundamentales y el Derecho de la Constitución. Sobre el particular, no debe perderse de perspectiva que la Constitución por su supremacía, súper-legalidad y eficacia directa e inmediata da fundamento indirecto a cualquier situación jurídica sustancial imaginable de las personas. No obstante, bajo una mejor ponderación y ante la promulgación del Código Procesal Contencioso-Administrativo (Ley No. 8508 de 24 de abril de 2006) y su entrada en vigencia a partir del 1° de enero de 2008, ha quedado patente que ahora los justiciables cuentan con una jurisdicción contencioso-administrativa plenaria y universal, sumamente expedita y célere por los diversos mecanismos procesales que incorpora al ordenamiento jurídico esa legislación, tales como el acortamiento de los plazos para realizar los diversos actos procesales, la amplitud de la legitimación, las medidas cautelares, el numerus apertus de las pretensiones deducibles, la oralidad –y sus subprincipios concentración, inmediación y celeridad-, la única instancia con recurso de apelación en situaciones expresamente tasadas, la conciliación intra-procesal, el proceso unificado, el proceso de trámite preferente o “amparo de legalidad”, los procesos de puro derecho, las nuevas medidas de ejecución (multas coercitivas, ejecución sustitutiva o comisarial, embargo de bienes del dominio fiscal y algunos del dominio público), los amplios poderes del cuerpo de jueces de ejecución, la extensión y adaptación de los efectos de la jurisprudencia a terceros y la flexibilidad del recurso de casación.

Todos esos institutos procesales novedosos tienen por fin y propósito manifiesto alcanzar la economía procesal, la celeridad, la prontitud y la protección efectiva o cumplida de las situaciones jurídicas sustanciales de los administrados, todo con garantía de derechos fundamentales básicos como el debido proceso, la defensa y el contradictorio. En suma, la nueva jurisdicción contencioso-administrativa es un cauce idóneo, por sus nuevas características de simplicidad, celeridad y prontitud para el amparo y protección efectiva de las situaciones jurídicas sustanciales de los administrados en las que se requiera recabar prueba o definir algunas cuestiones de legalidad ordinaria.

IV. VERIFICACIÓN DE LOS PLAZOS PAUTADOS POR LEY PARA RESOLVER LOS PROCEDIMIENTOS ADMINISTRATIVOS

CUESTIÓN EVIDENTE DE LEGALIDAD ORDINARIA. Es evidente que determinar si la administración pública cumple o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –incoado de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes, es una evidente cuestión de legalidad ordinaria que, en adelante, puede ser discutida y resuelta ante la jurisdicción contencioso-administrativa con la aplicación de los principios que nutren la jurisdicción constitucional, tales como los de la legitimación vicaria, la posibilidad de la defensa material –esto es de comparecer sin patrocinio letrado- y de gratuidad para los recurrentes. Consecuentemente, se impone el rechazo de plano e indicarle a la parte gestionante que si a bien lo tiene puede acudir a la jurisdicción contencioso-administrativa” (sentencia nro. 2008002545 de las 8:55 horas de 22 de febrero de 2008).

Ergo, en cuanto a este extremo, se declara sin lugar el recurso.

VII.Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel u objetos o pruebas contenidos en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados en un plazo máximo de 30 días hábiles, contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo material que no sea recogido dentro de ese lapso, con base en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial" (aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 de 22 de agosto de 2011 y publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012) y en el artículo LXXXI de la sesión del Consejo Superior del Poder Judicial nro. 43-12 de 3 de mayo de 2012.

Por tanto:

Se declara parcialmente con lugar el recurso. Se les ordena a Rugeli Morales Rodríguez y Mariela de los Ángeles Marín Mena, cada uno en su respectiva condición de alcalde de Talamanca y directora general de salud con recargo de la Dirección de Salud Ambiental del Ministerio de Salud, o a quienes ocupen esos cargos, que dentro del plazo de QUINCE DÍAS, contado a partir de la notificación de esta sentencia, atiendan como en Derecho corresponde las denuncias del recurrente gestionadas desde el 16 de enero de 2026 y le notifiquen lo pertinente. Lo anterior, bajo el apercibimiento de que, con base en lo establecido en el artículo 71, de la Ley de esta Jurisdicción, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Talamanca y al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia ante la jurisdicción contencioso-administrativa. En lo demás, se declara sin lugar el recurso. Notifíquese.
