CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours thirty minutes on the nineteenth of June of two thousand twenty-six.

Writ of amparo (recurso de amparo) processed under case file number 26-018493-0007-CO, filed by Nombre01, national identity number CED01, against the MINISTERIO DE AMBIENTE Y ENERGÍA -MINAE-.

Background:

  1. 1By written submission received at the Chamber's Secretariat on May 25, 2026, the petitioner (parte recurrente) files a writ of amparo against MINAE. The petitioner sets forth literally the following:

"FIRST: On 20/6/2025 I sent to the Minister Official Letter No. CCZ-20-06-2025 requesting that faithful compliance be given to those resolutions of that Constitutional Chamber and that I be specifically informed as to:

"1- That this express request be granted as the law requires, and that a response be provided to me through the designated notification channel within the statutory time limit.

2. That the ICE be requested to demonstrate its legitimate property right prior to 1878; failing that, that the corresponding actions be coordinated with the MSRH and MH for the recovery of these areas through the immediate demolition of the infrastructure erected within the inalienable zone (zona inalienable) of Law No. 65.

3. That Centro Ecológico Pavo Real S.A. be requested to demonstrate its legitimate property right prior to 1878; failing that, that the corresponding actions be coordinated with the MSRH and MH for the recovery of these areas and the immediate demolition of the infrastructure erected within the inalienable zone of Law No. 65.

4. I was informed that that ministry held workshops or similar events yesterday and today with the Mayors of this area to take action regarding the protection of water resources; no action could go further than recovering the entirety of this inalienable area, and at most, with the approval of the Asamblea Legislativa, some infrastructure could be allowed to remain for academic research by the UCR, UNA, UNED, TEC, and even the ICE antenna to facilitate access to information for these entities." With respect to this matter, the Minister (MINAE) responded on July 29, 2025 through CARTA-SINAC-ACC-DR-0595-2025, stating that:

"The current status of each reported situation is detailed below:

1- Jaguarundi Sector:

a- Dirección01, whose presumption of legitimacy (presunción de legitimidad) case file was resolved negatively through document SINAC-ACC-PNE-3301-2023.

b- Property (finca) 4-34865-000, whose case file SINAC-ACC-ZI-016-2024 is pending and under analysis.

There are two properties geographically related to the polygon indicated by you:

2- Cerro Dantas (FUNDATAS):

Corresponds to Dirección02, registered in the name of Centro Ecológico El Pavo Real S.A. Said property is under study through case file SINAC-ACC-ZI-031-2024, which was resolved negatively, with no presumption of legitimacy being recognized.

3- Land where the ICE tower is located (Cerro Chompipe):

The constructions are located in an area that overlaps between two properties:

Property 4-156766-000, registered in the name of the Municipalidad de San Rafael, has no case file, as it is recorded as State Natural Heritage (patrimonio natural del Estado), which will be resolved pursuant to Article 13 of the Ley Forestal.

Property 4-42191-000, registered in the name of Monte de la Cruz S.A., is subject to case file SINAC-ACC-PNE-3244-2021, which has been reopened for legal analysis following the dismissal of the motion for reconsideration (recurso de revocatoria) filed by the interested party." (Not all bold text is from the original) As can be seen in this official letter, CARTA-SINAC-ACC-DR-0595-2025 from MINAE, it was established that property 4-75821-000, registered in the name of Centro Ecológico El Pavo Real S.A., was not recognized as having a valid title predating 1878, and therefore must be evicted from the inalienable zone of Law 65 and its illegally erected works demolished, particularly since an illegal "Refugio Cerro Dantas" operates there with rooms, a restaurant, restroom and bathroom facilities, and charges admission fees, illegally profiting from the forests protected under Law 65.

It is also clear from said MINAE letter that property Dirección03 in Jaguarundi was likewise unable to demonstrate its title; but, just as in the previous case, MINAE has not acted and has allowed the continued impact on that inalienable zone.

Regarding point 3 of said letter, MINAE responds that part of the ICE facilities are located on the property of the Municipalidad de San Rafael de Heredia (MSRH); however, there are multiple official letters and documentation showing that the MSRH has been unable to demonstrate its ownership of those lands, and in fact MINAE has urged it to transfer those lands to MINAE, an act that was materialized in a Municipal Agreement to that effect, although it was vetoed by the current mayor.

However, with respect to the facilities located within the jurisdiction of the Municipalidad de Heredia, this municipality acknowledges that the lands belong to MINAE, which is why they do not even have a property registry folio (folio real), so that those ICE facilities are within the inalienable zone and never had construction permits and must also be demolished in order to recover that area so it can naturally regenerate; but in this case MINAE has also failed to act.

SECOND: Through Official Letter No. CCZ-29-10-2025 of 29/10/2025, I responded to the foregoing, requesting compliance with the constitutional resolutions regarding the two properties that MINAE had already determined were unable to demonstrate their ownership, namely, property No. 4-118600-000 and property No. 4-75821-000, and further noting that:

"From our Official Letter No. CCZ-20-06-2025 we were only able to observe that in your official notice (edicto) published in the Official Gazette La Gaceta No. 160 of 28/8/2025, only property No. 4-34865-00 was served notice to submit, within a period of 10 business days, exculpatory evidence demonstrating ten-year prior possession (decenalidad) before Law 65 of 1888;" However, MINAE determined that these illegal occupants — for example, property No. 4-34865-000 — do not hold a valid title, and despite the official notice having also been published in the Official Gazette La Gaceta, it has not acted, has done nothing; the occupants have not been evicted nor the illegal constructions demolished, even though science and technology indicate that, in order to avoid causing further damage to those ecosystems beyond what has already been inflicted, the prudent and advisable course of action is to proceed with gradual demolitions so that the forest can naturally regenerate.

So great has been MINAE's inaction that, with respect to another property No. 4-156766-000 — where the ICE facilities are located and which is registered in the name of the MSRH — it has also failed to act in accordance with the resolutions of this Chamber; and regarding the part of those facilities located on property No. 4-42191-000, registered in the name of the company Monte de la Cruz S.A., which has also failed to prove legitimate ownership, no action has been taken either, as stated in the above-cited official letter:

"since it is very important, given that in addition to usurping the inalienable zone, it appears that the company could also be receiving conservation incentives for forest preservation from ESPH and possibly from FONAFIFO, and could even be collecting a lease fee for the space where the ICE tower is located, thereby potentially illegally profiting from an inalienable public asset" And to make matters worse with respect to this property, it appears that its owner is a politician and former Justice (magistrada) of this Chamber who had even recused herself from resolving matters related to Law 65 on account of being a party to the matter; yet, despite the resolutions of this Chamber, she continues to appear as the owner and, as stated, is possibly receiving tax incentives for something that does not belong to her, since MINAE in its CARTA-SINAC-ACC-DR-0595-2025 clearly states that:

"Property 4-42191-000, registered in the name of Nombre02.Nombre03., is subject to case file SINAC-ACC-PNE-3244-2021, which has been reopened for legal analysis following the dismissal of the motion for reconsideration filed by the interested party." (Not all bold text is from the original) This despite the fact that the Ley General de Administración Pública is very clear in specifying the remedies available to an individual under administrative law, and since the motion for reconsideration was already rejected, the appropriate next step was an appeal; yet nowhere is it indicated whether this company Monte de la Cruz S.A. — supposedly owned by a political figure — filed such an appeal; if not, then the appropriate course of action is to proceed with the eviction and demolition of any illegal works constructed there.

THIRD: In response to my Official Letter No. CCZ-29-10-2025 of 29/10/2025, MINAE responded in a confusing manner, since my request is from a citizen of the Republic; however, it replied through Official Letter No. DM-1015-2025 and DAJ-MINAE-2518-2025 dated November 11, 2025:

"Compliance with the orders issued by the Constitutional Chamber involves processes of different natures; it is respectfully recommended that you, as legal counsel, inform the client about the contexts in which official notices are used as a tool, as this is an explanation of a legal nature. It is important that the client understand that each case is addressed in the best possible manner, using the legal and technical tools available, taking into account its particular circumstances." (Bold text is ours) I have no idea where they got the idea that I am "legal counsel"; regardless, I am perfectly aware of the use of official notices, including the legal effects they produce once the statutory period has lapsed; however, as stated above, these periods have long since expired and MINAE continues to do nothing and to refrain from taking possession of those lands.

Regarding the lands registered in the name of the MSRH, MINAE states that the following has been sent to that municipality:

"Official Letter SINAC-ACC-D-712-2024 and CARTA-SINAC-ACC-DR-0485-2025. Currently, neither the Central Conservation Area (Área de Conservación Central) nor this Ministry is aware of a transfer of said property by the Municipalidad de San Rafael to the State." As also stated above, there is a Municipal Agreement to transfer those lands to MINAE, but the mayor vetoed that agreement. Yet what is most reprehensible is that, with respect to property No. 4-42191-000, MINAE states:

"Currently, the Regional Directorate (Dirección Regional) of the Central Conservation Area is awaiting the submission by the interested party of the documentation and requirements necessary to continue with the legal review of the case." We ask how this is possible — if, according to the current provisions of the LGAP, this company has already exhausted the administrative channels by failing to demonstrate its ownership, and MINAE pulls from thin air something that the law does not permit, namely, 'the Regional Directorate of the Central Conservation Area is awaiting the submission by the interested party of the documentation and requirements necessary to continue with the legal review of the case' — the law does not authorize them to wait for 'the interested party to submit the documentation and requirements necessary to continue with the legal review of the case,' since the party failed to demonstrate legitimate ownership and even had its motion for reconsideration rejected. Could this be because the owner is a political figure and former Justice of the Constitutional Chamber?

The same situation arises with the adjoining properties that appear to belong to the same economic interest group — we refer to properties No. 4-042189-000 and No. 4-042190-000 — regarding which MINAE states:

"as in the previous case, we are awaiting the submission of the necessary documentation by the interested parties in order to continue with the corresponding process" (Bold text is ours) This seems laughable: MINAE states that "we are awaiting the submission of the necessary documentation by the interested parties," failing in its duty to be the one that investigates whether or not a property was legitimately held prior to 1878, rather than sitting with arms crossed waiting for the occupants to provide the documentation — since it stands to reason that if they do not have it, they will never submit it, and MINAE will then take no action and will continue to wait.

And this is true, as MINAE itself acknowledges at the end of its letter:

"Regarding the additional remedies available to possessors prior to the recovery of the lands, this Office considers that the available recourse is the application of the procedure to demonstrate possession for 10 years prior to the declaration of Law 65 of 1888; otherwise, recovery of the lands must proceed; however, if you, as legal counsel, consider that there is some additional mechanism, it is recommended that you explain it to the client." (Bold text is ours) However, MINAE is not doing so, and days, weeks, months, and now years pass while MINAE continues without recovering a single square centimeter under Law 65.

FOURTH: For these reasons, I again sent Official Letter No. CCZ-04-03-2026 of 4/3/2026, in which I reiterate that their official letters DM-1015-2025 and DAJ-MINAE-2518-2025 dated November 11, 2025 are unacceptable, because they in no way address the failure to intervene with respect to all the properties that MINAE has already determined do not hold the required prior possession before 1888, and I further indicate that:

"I attach CARTA-MSRH-CART-014-2026 of January 19, 2026, showing the occupants within the boundaries of Law No. 65 without establishing whether they hold title prior to 1878, which according to the Municipalidad de San Rafael de Heredia (MSRH) falls within MINAE's purview; I also attach for now Official Letter No. MH-DST-SCV-0177-2026 of February 17, 2026, from the Municipalidad de Heredia (MH), but only with respect to the properties adjacent to properties No. 4-42189-000, No. 4-042190-000, and No. 4-042191-000, where the ICE facilities at Dirección04 are located within that municipality's jurisdiction, where even the MH indicates that the lands where part of the ICE facilities are located do not even have a property registry folio, so that MINAE must immediately proceed to demolish all those works, both those within the MSRH's jurisdiction and those within the MH's jurisdiction." In this CARTA-MSRH-CART-014-2026 of January 19, 2026, showing the occupants within the boundaries of Law No. 65 without establishing whether they hold title prior to 1878, approximately 500 occupants under Law 65 are identified — determined by the MSRH to be within the boundaries but without a determination as to whether they have possession prior to 1878 — and I forwarded this information to MINAE so that it could coordinate the relevant actions with the Catastro Nacional to determine which of them hold valid title and which do not; however, MINAE responded on March 17, 2026 through CARTA-SINAC-ACC-DR-193-2026 stating that:

"With regard to properties 4-42189-000, 4-042190-000, and 4-042191-000, in order to ensure a proper process and protect the rights of the parties, a reasonable period of time is being granted for the parties to remedy any deficiencies in the legitimacy demonstration process. These three properties are in the final stage of the technical analysis being conducted from our conservation area, to be passed to resolution of the proceeding at MINAE." (Bold text is ours) They once again repeat what they said in 2025 — "a reasonable period of time is being granted for the parties to remedy any deficiencies in the legitimacy demonstration process" — but on what basis? MINAE has already determined that they do not hold ownership and rejected their motion for reconsideration, so what legal basis do they have for granting "a reasonable period of time"? No such authority exists under the LGAP; they are making decisions outside the law and exceeding their powers.

Regarding the list of approximately 500 occupants within the boundaries of Law 65, MINAE states in the above-cited official letters:

"The properties mentioned in Official Letter CARTA-MSRH-CART-014-2026 are located in the third stage; we are currently awaiting the Registro Nacional to provide the necessary inputs, as it did in stages 1 and 2 of the process. Once that body provides the background studies, it will be possible to advance the corresponding process." (Bold text is ours) Article 11 of the Constitución Política de la República de Costa Rica establishes with respect to this matter:

"Public officials are mere custodians of authority and may not arrogate to themselves powers not conferred upon them by law. They must take an oath to observe and uphold this Constitution and the laws. The action to demand their criminal liability for their acts is a public right." (Bold text is ours) For this reason, we find it inconceivable to simply be "awaiting" — waiting is equivalent to doing nothing; it is taking on powers that the law does not grant. Our request for information was not answered with relevant information — for example, of the nearly 500 properties, x or y results have been obtained, or this information will be forwarded to the Registro Nacional within such a statutory or specific time frame, or within x deadline we will inform you, or of those approximately 500 properties we have already determined that x number hold or do not hold a valid title, or notices have already been published in La Gaceta for such and such properties. None of that was provided — merely a "we are currently awaiting the Registro Nacional to provide the necessary inputs" — in other words, absolutely nothing to recover the inalienable lands under Law 65, which must be transferred to the State Natural Heritage (patrimonio natural del Estado, PNE).

Given that MINAE has not responded to any of my information requests, on 7/4/2026 I sent my Official Letter No. CCZ-07-04-2026, in which I note that time and again what has been provided in response concerns procedures, without ever addressing which of all those properties must already pass to PNE and what MINAE is doing to recover them; I gave them the 10 business days required by law, which as of today have long since expired, and this is the reason I file this writ of amparo, because MINAE has been negligent and permissive in complying with the resolutions of this Chamber to recover the lands under Law 65."

  1. 2Article 9 of the Ley de la Jurisdicción Constitucional authorizes the Chamber to reject outright or on the merits, at any time, including from the moment of filing, any petition submitted to it that is manifestly inadmissible, or when it considers that there are sufficient grounds to reject it, or that it constitutes a mere repetition or reproduction of a prior identical or similar rejected petition.

Considering:

I.Subject matter of the writ. The petitioner states that he has submitted various petitions to MINAE requesting that actions be taken to recover lands located within the inalienable zone governed by Law No. 65, which he asserts form part of the State Natural Heritage. He indicates that he requested that ministry to verify the legitimacy of the property rights claimed by various occupants and to adopt the necessary measures to evict them and demolish the existing constructions in those cases where the required possession or title could not be established under the legal framework. He states that, through various official communications, MINAE itself informed him that several properties under study failed to demonstrate the legitimacy of their property rights predating 1878, or that the corresponding proceedings were resolved negatively against their titleholders. However, he claims that, notwithstanding such findings, the Administration has not recovered the disputed lands, has not taken concrete action to remove the existing buildings and infrastructure, and has not materially recovered the lands he considers to belong to the State Natural Heritage.

He also challenges the administrative actions taken with respect to other properties that remain under study, as well as the processing afforded to various case files related to the verification of property rights in the protected area.

II.Inadmissibility of the writ. In the present matter, the petitioner maintains that MINAE has failed to adopt the actions that, in his view, are required to recover various lands located within the inalienable zone governed by Law No. 65, despite the fact that certain administrative proceedings have concluded that some occupants failed to demonstrate the legitimacy of their property rights or possession. He asserts that the Administration has acknowledged, with respect to several specific properties, the absence of valid titles or the rejection of the proceedings initiated by their titleholders; however, he claims that MINAE has not proceeded with the eviction of the occupants, the demolition of existing constructions and infrastructure, or the material recovery of the lands he considers to belong to the State Natural Heritage. He also challenges the administrative actions taken with respect to other properties that remain under study, as well as the handling of various case files related to the verification of property rights in the protected area.

The examination of the case file reveals that the petitioner has received multiple responses from the respondent authority (autoridad recurrida) regarding the various petitions filed. Indeed, his allegations reveal broad disagreement with the content of the official letters sent by MINAE, with the explanations provided regarding the status of the administrative proceedings, with the decision to continue certain technical and legal studies, with the granting of time periods for the submission of documentation by interested parties, and, in general, with the manner in which the Administration has decided to conduct the proceedings relating to the determination of the legal status of the disputed lands.

Furthermore, the petitioner challenges the explanations provided by that ministry regarding the status of various administrative proceedings, as well as the statements concerning the need to continue certain studies, await information from other institutions, grant time periods for the submission of documentation by interested parties, or carry out further steps before adopting a final decision. He even expressly reproaches various recommendations and exhortations contained in the official letters issued by the Administration, on the grounds that they do not satisfactorily address his claims. However, such allegations demonstrate that the respondent authority did in fact respond to the multiple petitions filed by the petitioner, and that the true disagreement lies in the content of those responses and in the subsequent administrative actions, rather than in any absolute absence of a response or of information.

That being so, the complaint does not properly concern an absolute omission of response or a denial of access to public information, but rather the approach adopted by the Administration and the specific actions that, in the petitioner's view, ought to have been taken following the issuance of certain administrative resolutions. In reality, he seeks to have this Chamber determine whether the conclusions reached by MINAE are correct, whether certain administrative proceedings are concluded, whether it is appropriate to continue accepting documentation or submissions from third-party interested parties, and, in particular, whether an order for the immediate recovery of the lands, the eviction of their occupants, and the demolition of existing constructions should be issued. These questions involve technical, registral, administrative, and legality assessments that exceed the scope of summary proceedings under the writ of amparo.

Furthermore, with respect to the repeated allegations regarding the alleged non-compliance with resolutions issued by this Constitutional Chamber, it should be noted that the legal order provides specific mechanisms to verify and, where appropriate, sanction any eventual disobedience of a constitutional ruling. Accordingly, if the petitioner considers that any authority has failed to comply with an order issued by this jurisdiction, the appropriate course of action is to file the corresponding motion within the case file in which the resolution whose non-compliance is alleged was issued, and not by filing a new writ of amparo.

Consequently, as it is evident that what is sought consists of challenging the legality, advisability, and timeliness of specific administrative actions, as well as having this Chamber substitute itself for the competent authorities in the conduct and resolution of administrative proceedings related to the recovery of lands subject to the regime of Law No. 65, the writ is manifestly inadmissible and must therefore be rejected outright.

III.Documentation submitted to the case file. The parties are hereby notified that if any paper documents, objects, or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology-produced device have been submitted, these must be retrieved from the office within a maximum period of 30 business days from notification of this judgment. Otherwise, all material not retrieved within this period will be destroyed, pursuant to the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Corte Plena at session N° 27-11 of August 22, 2011, Article XXVI, and published in the Boletín Judicial number 19 of January 26, 2012, as well as pursuant to the agreement approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on May 3, 2012, Article LXXXI.

Therefore:

The writ is rejected outright.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del diecinueve de junio de dos mil veintiseis .

Recurso de amparo que se tramita en el expediente número 26-018493-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra el MINISTERIO DE AMBIENTE Y ENERGÍA -MINAE-.

Resultando:

  1. 1Por escrito recibido en la Secretaría de la Sala el 25 de mayo de 2026, la parte recurrente interpone recurso de amparo en contra del MINAE. Expone literalmente lo siguiente:

“PRIMERO: Con fecha 20/6/2025 le envié al Sr. Ministro el Oficio No. CCZ-20-06-2025 donde le solicite que se diera fiel cumplimiento de dichas resoluciones de esa Sala Constitucional y que se me informara específicamente a:

“1- Que se acoja esta solicitud expresa conforme a derecho corresponde y la misma me sea respondido al medio señalado para notificaciones dentro del plazo de ley.

2. Que se solicite al ICE demostrar su legítimo derecho de propiedad antes de 1878, caso contrario se proceda a coordinar las acciones correspondientes con las MSRH Y MH para la recuperación de estas áreas, por medio de la inmediata demolición de las infraestructuras levantadas dentro de la zona inalienable de la Ley No. 65. .

3. Que se solicite al Centro Ecológico Pavo Real S.A. demostrar su legítimo derecho de propiedad antes de 1878, caso contrario se proceda a coordinar las acciones correspondientes con las MSRH Y MH para la recuperación de estas áreas, la inmediata demolición de las infraestructuras levantadas dentro de la zona inalienable de la Ley No. 65.

4. Fui informado que ese ministerio realizó talleres o similares ayer y hoy con los Alcaldes de esta zona para la toma de acciones en relación a la protección del recurso hídrico, ninguna acción podría ir más allá que la de recuperar la totalidad de esta área inalienable, a lo sumo y contando con la aprobación de la Asamblea Legislativa se podrían dejar algunas infraestructuras para la investigación académica de la UCR, UNA, UNED, TEC y hasta la antena del ICE para facilitar acceso a la información de estas entidades.” Con respecto a este hecho el Sr. Ministro (MINAE) respondió el 29 de julio de 2025 mediante CARTA-SINAC-ACC-DR-0595-2025, indicando que:

“A continuación, se detalla el estado actual de cada situación denunciada:

1- Sector Jaguarundi:

a- La Dirección01, cuyo expediente de presunción de legitimidad fue resuelto negativamente mediante el documento SINAC-ACC-PNE-3301-2023.

b- La finca 4-34865-000, cuyo expediente SINAC-ACC-ZI-016-2024 está en trámite y análisis.

Existen dos propiedades relacionadas geográficamente con el polígono indicado por usted:

2-Cerro Dantas (FUNDATAS):

Corresponde a la Dirección02, inscrita a nombre de Centro Ecológico El Pavo Real S.A. Dicha propiedad es objeto de estudio mediante el expediente SINAC-ACC-ZI-031-2024, el cual fue resuelto negativamente, no reconociéndose presunción de legitimidad.

3- Terreno donde se ubica la torre del ICE (Cerro Chompipe):

Las construcciones se encuentran en una zona que presenta traslapes entre dos fincas:

La finca 4-156766-000, inscrita a nombre de la Municipalidad de San Rafael, no cuenta con expediente, al tratarse de un bien inscrito como patrimonio natural del Estado, el cual se resolverá según lo establecido en el artículo 13 de la ley forestal.

La finca 4-42191-000, inscrita a nombre de Monte de la Cruz S.A., se encuentra bajo el expediente SINAC-ACC-PNE-3244-2021, el cual ha sido reabierto para análisis legal, tras haberse declarado sin lugar el recurso de revocatoria presentado por el interesado.” (No todas las negritas son del original) Como se puede observar en este oficio, CARTA-SINAC-ACC-DR-0595-2025 del MINAE, quedo establecido que la finca 4-75821-000, inscrita a nombre de Centro Ecológico El Pavo Real S.A. no se le reconoce título de propiedad antes de 1878, por lo cual debe ser desalojado de la zona inalienable ley 65 y proceder con la demolición de las ilegales obras ahí levantadas máxime que ahí opera un ilegal “Refugio Cerro Dantas” con habitaciones, restaurant, baterías de servicios sanitarios y baños y además cobran sumas de dinero por ingresar, usufructuando ilegalmente de los bosques de la ley 65 […]

También queda claro en dicha Carta del Minae que la finca Dirección03 en Jaguarundi tampoco pudo demostrar su titularidad, pero al igual que la anterior el MINAE no ha actuado, permitiendo continuar con la afectación de dicha zona inalienable.

Con respecto al punto 3 de dicha carta el MINAE responde que una parte de las instalaciones del ICE están en la finca de la Municipalidad de San Rafael de Heredia (MSRH), sin embargo, existen múltiples oficios y documentación donde la MSRH no ha podido demostrar su titularidad de esos terrenos y por el contrario el MINAE lo ha instado a traspasar dichos terrenos al MINAE, acto que se concreto con un Acuerdo Municipal en esa dirección, aunque el mismo fue vetado por el actual alcalde.

Sin embargo, las instalaciones que se ubican en la jurisdicción de la Municipalidad de Heredia, este municipio acepta que son terrenos del MINAE y por eso ni siquiera poseen folio real, de forma tal que esas instalaciones del ICE están dentro de la zona inalienable y nunca contaron con permisos de construcción y también deben ser demolidas para recuperar esa área y se regenere naturalmente, pero en este caso el MINAE tampoco ha actuado.

SEGUNDO: Mediante Oficio No. CCZ-29-10-2025 del 29/10/2025 de di respuesta a la anterior solicitándole el cumplimiento de las resoluciones constitucionales en el caso de las dos propiedades que ya el MINAE había determinado que no pudieron demostrar su titularidad, a saber, la finca No. 4-118600-000 y la finca No. 4-75821-000, así como que:

“De nuestro Oficio No. CCZ-20-06-2025 solo logramos observar que en su edicto publicado en el Diario Oficial La Gaceta No. 160 del 28/8/2025 solo la finca No. 4-34865-00 fue apercibida para que, dentro del plazo de 10 días hábiles, presentara las pruebas de descargo que demostrara la decenalidad anterior a la Ley 65 de 1888;” Sin embargo, el MINAE comprobó que estos ocupantes ilegales, por ejemplo la finca No. 4-34865-000 no tienen título de propiedad válido y a pesar de que también se publico el edicto en el diario oficial La Gaceta, no ha actuado, no ha hecho nada, no han sido expulsados ni demolidas las ilegales construcciones, a pesar de que la ciencia y la técnica indica que para no afectar mas de lo que ya están esos ecosistemas, lo prudente y conveniente es proceder con las demoliciones paulatinamente de forma tal que el bosque vaya recuperándose naturalmente.

Tanto así ha sido la inoperancia del MINAE que por cita otra finca No. 4-156766-000 donde están las instalaciones del ICE que esta a nombre de la MSRH tampoco han actuado de acuerdo a las resoluciones de esa Sala; y la parte de estas instalaciones que están en la finca No. 4-42191-000, inscrita a nombre de la sociedad Monte de la Cruz S.A., que tampoco ha probado ser dueños legítimos, tampoco se ha actuado y como se indicó en el supra citado oficio:

“ya que es muy importante ya que además de estar usurpando zona inalienable, parece que también podría recibiendo incentivos por conservación de bosque por parte de la ESPH y posiblemente de FONAFIFO y hasta podría ser que también este recibiendo un canon por alquiler del espacio donde se ubica la torre del ICE, con lo cual podría estar usufructuando ilegalmente de un bien inalienable” Y para empeorar el asunto relativo a esta finca, parece que su propietaria es una política y además exmagistrada de esa Sala y que hasta se había inhibido de resolver temas relacionados con la ley 65, por ser parte del asunto, pero a pesar de las resoluciones de esa Sala, continúa apareciendo como propietaria y dijimos posiblemente recibiendo incentivos fiscales por algo que no le pertenece, ya que el MINAE en su CARTA-SINAC-ACC-DR-0595-2025, indica claramente que:

“La finca 4-42191-000, inscrita a nombre de Nombre02.Nombre03., se encuentra bajo el expediente SINAC-ACC-PNE-3244-2021, el cual ha sido reabierto para análisis legal, tras haberse declarado sin lugar el recurso de revocatoria presentado por el interesado.” (No todas las negritas son del original) Esto a pesar de que la Ley General de Administración Pública es muy clara en señalar los recursos a que tiene derecho el administrado y si ya se le rechazó el recurso de revocatoria, lo procedente era el de apelación, pero por ningún lado se indica si esta sociedad Monte de la Cruz S.A propiedad supuestamente de una figura política, presentó dicha apelación, caso contrario entonces lo pertinente es proceder con el desalojo y demolición de eventuales obras ilegales ahí construidas, TERCERO: En respuesta a mi oficio No. CCZ-29-10-2025 del 29/10/2025, el MINAE responde de manera confusa, ya que mi solicitud de respuesta corresponde a un ciudadano de la República sin embargo este responde mediante oficio No. DM-1015-2025 y DAJ-MINAE-2518-2025 de fecha 11 de noviembre, 2025:

“ El cumplimiento de lo ordenado por la Sala Constitucional implica procesos de diferente naturaleza, respetuosamente se recomienda a su persona como asesor jurídico, informar al usuario en qué contextos se utilizan los edictos como herramienta, ya que esto es una explicación de índole legal. Es importante que el usuario tenga claro que cada caso se aborda de la mejor forma posible, utilizando las herramientas legales y técnicas disponibles considerando sus particularidades.” (La negrita es nuestra) Desconozco de donde extrajeron que soy “asesor jurídico” de todas formas, conozco perfectamente la utilización de los edictos, entre ellos lo referente a los efectos legales que surten los mismos una vez transcurridos el plazo de ley, sin embargo, como se indicó supra, estos plazos vencieron sobradamente y el MINAE continua sin actuar y sin tomar posesión de esos terrenos.

Con respecto a los terrenos que la MSRH tiene registrados a su nombre el MINAE indica que se han enviado a dicho municipio:

“Oficio SINAC-ACC-D-712-2024 y CARTA-SINAC-ACC-DR-0485-2025.Actualmente, no se tiene conocimiento, en el Área de Conservación Central ni en este Ministerio, de un traspaso de dicha finca por parte de la Municipalidad de San Rafael al Estado” Como también se indicó supra, existe Acuerdo Municipal para traspasar esas tierras al MINAE, solo que el alcalde vetó dicho acuerdo; pero lo más reprochable es que con respecto a la finca No. 4-42191-000 el MINAE indica:

“Actualmente, la Dirección Regional del Área de Conservación Central se mantiene a la espera de que el interesado presente la documentación y requisitos necesarios, para continuar con el estudio legal del caso.” Nos preguntamos cómo es posible, si ya según la normativa vigente de la LGAP esta empresa ya agotó la vía administrativa por no poder demostrar su titularidad y el MINAE se saca de la manga algo que la ley no permite como es “la Dirección Regional del Área de Conservación Central se mantiene a la espera de que el interesado presente la documentación y requisitos necesarios, para continuar con el estudio legal del caso” la ley no los faculta para esperar que “el interesado presente la documentación y requisitos necesarios, para continuar con el estudio legal del caso” puesto que no pudo demostrar su legítima propiedad e incluso se le rechazo el recurso de revocatoria interpuesto, acaso será porque es una figura política y exmagistrada de la Sala Constitucional ?

Esto mismo sucede con las fincas aledañas que aparentemente son del mismo grupo de interés económico, nos referimos a las fincas No.4-042189-000 y No.4-042190-000 y que el MINAE indica:

“al igual que en el caso anterior, se está a la espera de la presentación de la documentación necesaria por parte de los interesados, para continuar con el trámite correspondiente” (La negrita es nuestra) Esto parece risible, el MINAE indica que “se está a la espera de la presentación de la documentación necesaria por parte de los interesados” incumpliendo con su deber de ser ellos los que deben investigar la propiedad legítima o no de una finca antes de 1878 y no cruzarse de brazos a esperar que los ocupantes les den la documentación, porque es de suponer que, si no la tienen, nunca la van a presentar y el MINAE entonces no actuara y seguirá esperando.

Y esto es cierto, tal como lo manifiesta el MINAE al final de su Carta:

“Sobre los recursos adicionales con que puedan contar los poseedores de previo a la recuperación de los terrenos, este Despacho considera que el recurso posible es la aplicación del procedimiento, para demostrar la posesión 10 años antes de la declaración de la Ley 65 de 1888, de lo contrario se debe proceder a la recuperación de los terrenos; no obstante, si su persona como asesor jurídico considera que existe algún mecanismo adicional, se recomienda explicarlo al usuario.” (La negrita es nuestra) Sin embargo, no lo está haciendo y pasan los días, semanas, meses y ahora años y el MINAE continua sin recuperar un solo centímetro cuadrado de la ley 65.

CUARTO: Por estas razones les volví a enviar el Oficio No. CCZ-04-03-2026 del 4/3/2026, donde les reitero que sus oficios DM-1015-2025 y DAJ-MINAE-2518-2025 de fecha 11 de noviembre, 2025 no son de recibo, porque no responden de manera alguna la no intervención de todas las fincas que ya el MINAE demostró que no tienen la decenalidad antes de 1888, y mas bien les indico que:

“les adjunto la CARTA-MSRH-CART-014-2026 del 19 de enero de 2026 donde se muestran los ocupantes dentro de los linderos de la Ley No. 65, sin definir si tienen título de propiedad antes de 1878, lo cual según la Municipalidad de San Rafael de Heredia (MSRH), es alcance del MINAE, también de momento le adjunto el oficio No. MH-DST-SCV-0177-2026 del 17 de febrero del 2026, de la Municipalidad de Heredia (MH); pero solo referente a los colindantes con las fincas No. 4-42189-000, con las fincas No.4-042190-000 y No.4-042191-000, que es donde se ubican las instalaciones del ICE en el Dirección04 que pertenecen a la jurisdicción de ese cantón, donde incluso la M.H. indica que los terrenos donde se ubican parte de las instalaciones del ICE ni siquiera tiene folio real, por lo que el MINAE debe proceder de inmediato a demoler todas esas obras, tanto las que están en la jurisdicción de la MSRH como las de la MH” En esta CARTA-MSRH-CART-014-2026 del 19 de enero de 2026 donde se muestran los ocupantes dentro de los linderos de la Ley No. 65, sin definir si tienen título de propiedad antes de 1878, se indican cerca de 500 ocupantes de la ley 65 que la MSRH determino que están dentro pero no pueden determinar si tienen la posesión antes de 1878, por lo que se las remití al MINAE para que ellos coordinen las acciones pertinentes con Catastro Nacional y determinen cuales lo tienen y cuales no, sin embargo el MINAE me responde el 17 de marzo de 2026 mediante CARTA-SINAC-ACC-DR-193-2026 donde me indica que:

“ En referencia a las fincas 4-42189-000, 4-042190-000 y 4-042191-000, en aras de garantizar un proceso adecuado y los derechos para las personas usuarias, se da un lapso prudencial para que las personas subsanen lo necesario en el proceso de demostración de legitimidad. Estas tres fincas se encuentran en recta final del análisis técnico que se realiza desde nuestra área de conservación para pasarlas a resolución de trámite en MINAE.” (La negrita es nuestra) Vuelven a repetir lo mismo que respondieron en el 2025 “se da un lapso prudencial para que las personas subsanen lo necesario en el proceso de demostración de legitimidad” pero basados en que, ya el MINAE demostró que no tienen la titularidad y les rechazo el recurso de revocatoria, entonces que fundamento legal tienen para “se da un lapso prudencial” no existe esa facultad dentro de la LGAP, están tomando decisiones fuera de la ley, se están extralimitando en sus facultades.

Con respecto al listado de cerca de 500 ocupantes dentro de los márgenes de la ley 65, el MINAE indica en los oficios supra citados:

“Las fincas mencionadas en el oficio CARTA-MSRH-CART-014-2026 se ubican en la tercera etapa, actualmente se está a la espera de que el Registro Nacional brinde los insumos necesarios, como lo hizo en las etapas 1 y 2 del proceso. Una vez que esta instancia aporte los estudios de antecedentes se podrá avanzar en el trámite correspondiente.” (La negrita es nuestra) El artículo 11 de la Constitución Política de la República de Costa Rica establece con relación a esta norma:

"Los funcionarios públicos son simples depositarios de la autoridad y no pueden arrogarse facultades que la ley no les concede. Deben prestar juramento de observar y cumplir esta Constitución y las leyes. La acción para exigirles la responsabilidad penal de sus actos es pública." (La negrita es nuestra) Por esto nos resulta inconcebible, estar a la espera, es equivalente a no hacer nada, es tomarse atribuciones que la ley no les otorga; no se nos respondió nuestra solicitud de información con información relevante, por ejemplo de las casi 500 fincas ya tenemos x o y resultados, o esta información se la pasaremos al Registro Nacional dentro de tal plazo de ley o x plazo le estaremos informando, o de esas cerca de 500 fincas ya hemos determinado que x cantidad tienen o no tienen título de propiedad valido o ya se ha notificado mediante edictos en La Gaceta tales y cuales, nada de eso respondieron un simple “actualmente se está a la espera de que el Registro Nacional brinde los insumos necesarios” o sea nada de nada para recuperar los terrenos inalienables de la ley 65, que deben ser trasladadas a Patrimonio Natural del Estado (PNE) En vista de que el MINAE no ha respondido ninguna de mis solicitudes de información el 7/4/2026 les envié mi oficio No. CCZ-07-04-2026, donde les indico que una y otra vez lo que me han respondido es acerca de los procedimientos, pero sin responder ni una sola vez de cuales todas esas fincas ya deben pasar a PNE y que esta haciendo el MINAE para recuperarlas, y les di los 10 días hábiles de ley los cuales al día de hoy están vencidos sobradamente y por esta razón es que presento este recurso de amparo porque el MINAE ha sido omiso y permisivo en cumplir con las resoluciones de esa Sala para recuperar los terrenos de la ley 65”.

  1. 2El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.

Redacta el Magistrado Castillo Víquez; y,

Considerando:

I.Objeto del recurso. El recurrente señala que ha presentado diversas gestiones ante el MINAE con el fin de que se ejecuten acciones dirigidas a recuperar terrenos ubicados dentro de la zona inalienable regulada por la Ley nro. 65 y que, según afirma, forman parte del patrimonio natural del Estado. Indica que solicitó a dicha cartera ministerial verificar la legitimidad de los derechos de propiedad alegados por distintos ocupantes y adoptar las medidas necesarias para desalojarlos y demoler las construcciones existentes en aquellos casos en que no se acreditara la posesión o titularidad exigida por el ordenamiento jurídico. Manifiesta que, mediante distintas respuestas oficiales, el propio MINAE le informó que varias fincas sometidas a estudio no lograron demostrar la legitimidad de sus derechos de propiedad anteriores a 1878 o que los procedimientos respectivos fueron resueltos negativamente para sus titulares.

No obstante, reclama que, pese a tales determinaciones, la Administración no ha recuperado los terrenos cuestionados ni ha adoptado acciones concretas para remover las edificaciones e infraestructuras existentes en esas áreas, incluyendo inmuebles utilizados por particulares y determinadas instalaciones vinculadas al Instituto Costarricense de Electricidad. Afirma además que, al reiterar sus solicitudes, el MINAE se ha limitado a indicar que algunos expedientes continúan en análisis, que se encuentra a la espera de documentación aportada por los interesados o de información proveniente de otras instituciones, así como que ha concedido nuevos plazos para acreditar la legitimidad de ciertos terrenos. Considera improcedente esa actuación, por estimar que en varios de esos casos ya se determinó la inexistencia de títulos válidos o incluso se rechazaron los recursos administrativos planteados por los interesados.

Asimismo, señala que remitió a la autoridad recurrida información relacionada con aproximadamente quinientos inmuebles ubicados dentro de los límites de la Ley nro. 65, respecto de los cuales solicitó conocer las acciones emprendidas para determinar su situación jurídica y, en su caso, proceder a su incorporación al patrimonio natural del Estado. Sin embargo, acusa que las respuestas recibidas no precisan qué terrenos han sido recuperados, cuáles procedimientos han concluido ni cuáles medidas concretas se han adoptado para ejecutar las resoluciones administrativas y constitucionales que invoca. Con fundamento en lo anterior, acusa una actuación omisiva del MINAE por la falta de acciones efectivas para recuperar los terrenos que considera indebidamente ocupados y por la ausencia de una respuesta concreta a las gestiones e información solicitadas.

II.Inadmisibilidad del recurso. En el presente asunto, el recurrente sostiene que el Ministerio de Ambiente y Energía ha omitido adoptar las acciones que, a su juicio, corresponden para recuperar diversos terrenos ubicados dentro de la zona inalienable regulada por la Ley nro. 65, pese a que en determinados procedimientos administrativos se habría concluido que algunos ocupantes no lograron acreditar la legitimidad de sus derechos de propiedad o posesión. Afirma que la Administración ha reconocido, respecto de varias fincas específicas, la inexistencia de títulos válidos o la improcedencia de los procedimientos promovidos por sus titulares; sin embargo, acusa que el MINAE no ha procedido al desalojo de los ocupantes, a la demolición de construcciones e infraestructuras existentes ni a la recuperación material de los terrenos que considera pertenecientes al patrimonio natural del Estado. Asimismo, cuestiona la actuación administrativa desplegada en relación con otros inmuebles que continúan en estudio, así como la tramitación otorgada a diversos expedientes vinculados con la acreditación de derechos de propiedad en la zona protegida.

Del examen del expediente se desprende que la parte recurrente ha recibido múltiples respuestas por parte de la autoridad recurrida respecto de las distintas gestiones formuladas. En efecto, sus alegatos revelan un amplio desacuerdo con el contenido de los oficios remitidos por el MINAE, con las explicaciones brindadas sobre el estado de los procedimientos administrativos, con la decisión de continuar determinados estudios técnicos y legales, con la concesión de plazos para la presentación de documentación por parte de interesados y, en general, con la forma en que la Administración ha decidido conducir los procedimientos relacionados con la determinación de la situación jurídica de los terrenos cuestionados.

Además, la parte accionante cuestiona las explicaciones brindadas por esa cartera ministerial acerca del estado de diversos procedimientos administrativos, así como las manifestaciones relativas a la necesidad de continuar determinados estudios, esperar información de otras instituciones, conceder plazos para la presentación de documentación por parte de interesados o realizar actuaciones posteriores antes de adoptar una decisión definitiva. Incluso, reprocha expresamente diversas recomendaciones y exhortaciones contenidas en los oficios remitidos por la Administración, al estimar que estas no atienden satisfactoriamente sus pretensiones. No obstante, tales alegatos evidencian que la autoridad recurrida sí emitió respuesta a las múltiples gestiones formuladas por el accionante, siendo que la verdadera inconformidad radica en el contenido de esas contestaciones y en las actuaciones administrativas subsecuentes, mas no en la ausencia absoluta de respuesta o de información.

Así las cosas, la inconformidad planteada no versa propiamente sobre una omisión absoluta de respuesta ni sobre la denegatoria del acceso a información pública, sino sobre el criterio adoptado por la Administración y sobre las actuaciones concretas que, según estima el recurrente, debieron ejecutarse una vez emitidas determinadas resoluciones administrativas. En realidad, pretende que esta Sala determine si las conclusiones alcanzadas por el MINAE son correctas, si determinados procedimientos administrativos se encuentran concluidos, si procede continuar admitiendo documentación o gestiones de terceros interesados y, especialmente, si corresponde ordenar la recuperación inmediata de los terrenos, el desalojo de sus ocupantes y la demolición de las construcciones existentes. Tales cuestiones involucran valoraciones técnicas, registrales, administrativas y de legalidad que exceden el ámbito de conocimiento sumario del recurso de amparo.

Por otra parte, en cuanto a los reiterados señalamientos relativos al supuesto incumplimiento de resoluciones dictadas por esta Sala Constitucional, debe indicarse que el ordenamiento jurídico prevé mecanismos específicos para verificar y, en su caso, sancionar una eventual desobediencia a lo resuelto en una sentencia constitucional. De esa manera, si el recurrente considera que alguna autoridad ha incumplido una orden emitida por esta jurisdicción, lo procedente es que formule la gestión correspondiente dentro del expediente en el que se dictó la resolución cuyo incumplimiento denuncia, y no mediante la interposición de un nuevo recurso de amparo.

En consecuencia, al evidenciarse que lo pretendido consiste en cuestionar la legalidad, conveniencia y oportunidad de actuaciones administrativas concretas, así como obtener que esta Sala sustituya a las autoridades competentes en la conducción y resolución de procedimientos administrativos relacionados con la recuperación de terrenos sujetos al régimen de la Ley nro. 65, el recurso resulta manifiestamente improcedente y, por ende, debe rechazarse de plano.

III.Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se rechaza de plano el recurso.
