Decision No. 2026022476 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours thirty minutes on the nineteenth of June of two thousand twenty-six.
Writ of amparo (recurso de amparo) filed under case number CED01, brought by Nombre01, national identity card (cédula de identidad) CED02, Nombre02, national identity card CED03, Nombre03, national identity card CED04, Nombre04, national identity card CED05, Nombre05, national identity card CED06, and Nombre06, national identity card CED07, against the INSTITUTO COSTARRICENSE DE ACUADUCTOS Y ALCANTARILLADOS (ICAA).
PROCEDURAL BACKGROUND:
"All of the undersigned are owners of a parcel of land located in the community of San Miguel, eighth district of Barranca, first canton of Puntarenas, the majority of whom have been requesting water availability (disponibilidad hídrica) over the course of twenty years, and ICAA has denied it to us, even though approximately three years ago a fire hydrant was installed 50 meters from where our properties begin, and approximately the last residence that has water service is located at a distance of 80 meters from where our properties begin. Honorable Justices; all of the undersigned, since we acquired said parcels, have wished to be able to build our homes, which we acquired with hope and effort; however, without water availability we cannot obtain any construction permit, nor a loan from any financial institution in order to build on the lots, leaving our land in a state of sterility, without a single drop of water, and those who have their small homes must find ways to bring water to their dwellings, hauled in large drums (estañones) and small plastic containers (pichingas), a group of residents that includes families of elderly persons. The Constitutional Principle being set aside is that of Non-Discrimination and Equality, since despite the fact that we are a significant group of citizens who own a lot in that location, the respondent institution has not treated us as it has treated people in other places, including those in locations with difficult access due to distance and poor accessibility. Nonetheless, and despite the refusal to grant that vital right for life, the Constitutional Chamber of the Supreme Court of Justice has been fair in upholding fundamental rights, such as the right to water and the principle of equality. Specifically, through Decision Number 2015014553 issued at fourteen hours thirty minutes on the twenty-second of September of two thousand fifteen, the Constitutional Chamber, as shown in Case Number 15-011802-0007-CO, in its operative section grants the writ and orders the Instituto Costarricense de Acueductos y Alcantarillados, along with a series of public authorities, to immediately take the appropriate steps to include the entire community of ISLA CABALLO in a potable water supply project, and, on a temporary basis while the potable water supply project is being implemented, orders the institution to carry out the necessary steps and appropriate actions to supply potable water to the residents of ISLA CABALLO through cisterns or other mechanisms that permanently guarantee access to potable water while the situation is definitively resolved. It is for this reason that the Instituto Costarricense de Acueductos y Alcantarillados implemented a project to bring potable water from the community of Lepanto to Isla Caballo by means of a submarine pipeline from the Peninsula to a storage tank located on the island; said conveyance and distribution pipeline has a length of 5,573 linear meters, to be buried at a depth of 1.00 meter, in full compliance with all technical standards of the Instituto Costarricense de Acueductos y Alcantarillados and applicable environmental regulations. Said project is designated GSD-UEN AP-2025-00029 of the Instituto Costarricense de Acueductos y Alcantarillados, with a preliminary cost of 3,376 million [colones]. Another similar case in which the State intervened to bring potable water internally is that of the community of La Islita, located in the Golfo de Nicoya area belonging to the district of Pitahaya, first canton of Puntarenas, situated in the mangroves at the mouth of the Estero de Puntarenas, 3 kilometers from the city of Puntarenas; in 2012, approximately twenty-three families lived there, and similarly, the residents of this wetland had to go before the Constitutional Chamber after 50 years in order to obtain the right to water, with their dream coming true on October 6, 2012, when the Instituto Costarricense de Acueductos y Alcantarillados, with an investment of 250,000,000.00 [colones], inaugurated the aqueduct in said wetland — a project similar to that of Isla Caballo — with a submarine pipeline of 3.5 kilometers from the city of Puntarenas to La Islita. This information appears in the publication issued by the Food and Agriculture Organization of the United Nations. Likewise, the Instituto Costarricense de Acueductos y Alcantarillados recently inaugurated a new aqueduct in Sarapiquí, benefiting approximately 17,700 residents of Sarapiquí at a construction cost of $10.2 million. This information was obtained from the Acueductos y Alcantarillados website. Despite all these constitutional rulings in favor of the right to water in the canton of Puntarenas, the Instituto Costarricense de Acueductos y Alcantarillados has made absolutely no effort, before the institution itself or before any other body, to grant us the privilege of enjoying that precious right, which places us in a state of discrimination and unequal treatment, given that it has brought water to residents located more than 5 kilometers from Puntarenas in the case of Isla Caballo, and to residents 3.5 kilometers away — even though that wetland is State Natural Heritage — while we, the undersigned residents who are located a mere 80 meters from the last residence served with potable water by the Instituto Costarricense de Acueductos y Alcantarillados, with a hydrant at 50 meters from where our properties begin, are being denied water on the alleged grounds of insufficient pressure. There are homes a mere 100 meters away that have water availability, yet in our cases the institution has not undertaken even the most minimal project to bring water to our lots. It is for this reason that we come before the Constitutional Chamber to present our case of inequality before the Law, before the Constitutional Principle of Equality, and its counterpart of Non-Discrimination — 'equality among equals and inequality among unequals' — to assert the right to water, so that we may enjoy the same right of access to water as any other resident of the Republic, and that we be given treatment equal to that afforded to the island residents of Isla Caballo and La Islita, Sarapiquí, and the many others that the institution reports it is inaugurating, and to the residents located a mere 80 meters from our properties who DO have potable water and even have a hydrant — and therefore we request treatment without any discrimination with respect to the fundamental human right essential for life, under the protection of the addition to Article 50 of the Political Constitution. Article 50: '...Every person has the fundamental, basic, and inalienable human right of access to potable water as an essential good for life. Water is a good of the Nation, indispensable for protecting such human right. Its use, protection, sustainability, conservation, and exploitation shall be governed by the law to be created for these purposes, which shall give priority to the supply of potable water for personal and community consumption.' (Sic)."
The petitioners consider that the facts set forth have injured their fundamental rights. They request that the writ be granted and that the supply of potable water to the affected community be ordered.
"FIRST. Having concluded the analysis of the facts alleged by the petitioners with regard to the request for new services, it is noted that, according to the Integrated System for Availability and Development Management (Sistema Integrado para la Gestión de Disponibilidades y Desarrollo, SIGDD), no requests for water availability for new connections exist in the sector under analysis. (See technical report No. GSP-RPC-PU-2026-00516 dated May 28, 2026). SECOND. Pursuant to the institutional technical analysis carried out by the Región Pacífico Central, system PC-A-19 is divided into three pressure zones: low, medium, and high, the last of which corresponds primarily to the communities of El Llano, Los Laureles, and San Miguelito. The hydraulic analysis (análisis hidráulico) determined that the system presents significant technical and operational limitations, particularly in the upper zone, resulting from: disorderly urban growth; expansion of the network beyond the hydraulic design elevations (cotas hidráulicas) originally established; insufficient storage capacity; dependency on re-pumping systems (sistemas de rebombeo); high rates of non-revenue water (agua no contabilizada); constant leaks and operational losses.
It was likewise determined that the available production from the existing wells is committed at practically 100% to supplying the current formal services. Similarly, the existing storage tank in the upper zone has a capacity of approximately only 12 m³, a condition insufficient to guarantee hourly regulation, hydraulic stability, and minimum coverage for fire protection. Furthermore, several properties are located even above the elevation of the existing tank, making gravity-fed supply technically impossible. (See technical report No. GSP-RPC-PU-2026-00516 dated May 28, 2026). THIRD. The petitioners state in their submission that they have been requesting water availability for approximately twenty years and that there are nearby infrastructure elements, such as a fire hydrant located approximately 50 meters away and residences with potable water service at a distance of approximately 80 meters from their properties.
However, upon reviewing the institutional records available in the SIGDD, no formal requests registered over the past twenty years by the petitioners were found that would allow this claim to be technically verified. It should likewise be clarified that the existence of nearby infrastructure — such as hydrants, pipelines, or previously connected residences — does not in and of itself constitute a sufficient technical criterion for determining water viability, nor does it automatically obligate the granting of new potable water availabilities. The viability of new services must be assessed holistically, taking into account technical factors such as: the system's hydraulic capacity; available pressure; elevation levels; storage capacity; continuity of existing service; production capacity; operational behavior of the network; and the future sustainability of the system. In the particular case of system PC-A-19 Carmen Lyra – La Guaria – Mojoncito – San Miguelito, institutional technical studies determined that the upper portion of the system, where the sectors of San Miguelito and El Llano are located, presents real hydraulic limitations associated primarily with topographic elevation, insufficient storage, and dependency on re-pumping, which is why there is currently no technical viability for granting new availabilities in those sectors without compromising the stability and continuity of the existing service.
It should likewise be noted that the installation of fire hydrants within a distribution system responds to operational criteria, sectorization, flushing, fire protection, and hydraulic operations, and therefore their existence does not necessarily imply available capacity to enable new residential connections. (See technical report No. GSP-RPC-PU-2026-00516 dated May 28, 2026). FOURTH. The updated water balance (balance hídrico) of system PC-A-19 determined the existence of an available flow rate (caudal disponible) of approximately 0.69 liters per second, equivalent to approximately 28 single-family connections. However, the same technical report clarifies that this remainder corresponds only to a macro-level analysis of the system and that the availability is located primarily in the middle and lower zones, where topographic and storage conditions are more favorable. Consequently, the Región Pacífico Central reached the following technical conclusion: 'For the upper portion of the system, there is no technical viability for granting additional water availabilities until an investment project is constructed or a public-private partnership (alianza público-privada) is secured that incorporates storage exceeding 20 m.c.a. above the last house in El Llano.' For the foregoing reasons, the existing restrictions are not the result of arbitrary or discriminatory actions on the part of the institution, but rather real technical limitations that would compromise the continuity, pressure, and stability of the current service in the event that new availabilities are authorized in the upper portion of the system.
(See technical report No. GSP-RPC-PU-2026-00516 dated May 28, 2026). FIFTH. Despite the current limitations, AyA continues to execute and plan various projects aimed at strengthening system PC-A-19. Project under Public-Private Partnership with 'La Bendición de Dios.' A project currently under development called 'La Bendición de Dios,' structured as a public-private partnership, contemplates: equipping a new well with a production capacity of 12 l/s; construction of a new 150 m³ storage tank; installation of approximately 890 linear meters of pipeline; and hydraulic reinforcement of the middle and upper-middle portions of the system. The technical progress report for the project confirms that the main conveyance line has already been installed and that work associated with civil, electromechanical, and interconnection works is ongoing. However, technical findings also established that these improvements will not fully resolve the limitations affecting properties located at the highest elevations of the El Llano and San Miguelito sector, as several remain above the hydraulic level of the new projected tank.
San Miguelito Pipeline Replacement Project. Through memorandum No. GSP-RPC-2026-00066, the Región Pacífico Central secured funding to execute an urgent project for the replacement of the San Miguelito distribution network, given that the current infrastructure consists of 50 mm piping with exhausted useful life, multiple leaks, and constant operational disruptions. The project involves the replacement of approximately 1,626 meters of 100 mm PEAD (high-density polyethylene) piping, along with the installation of valves and household service connections (previstas domiciliares), with the aim of comprehensively improving the hydraulic performance of the system. (See technical report No. GSP-RPC-PU-2026-00516 dated May 28, 2026). SIXTH. The petitioners reference Decision No. 2015014553, Case No. 15-011802-0007-CO, as well as projects developed in island communities such as Isla Caballo and La Islita, district of Pitahaya, Golfo de Nicoya.
In this regard, it is important to clarify that those cases involve geographic, social, and operational conditions different from those of system PC-A-19 — communities where potable water service is not provided and that fall outside the service coverage area; island communities served through special supply projects for sanitary, humanitarian, and public health reasons. In the specific case of system PC-A-19, the current restrictions stem from real technical limitations duly substantiated through institutional hydraulic studies, which determined that the upper portion of the system, corresponding to El Llano and San Miguelito, does not currently have the technical viability to support new availabilities without compromising the continuity and stability of the existing service — this in compliance not only with the regulatory framework governing the institution and with the general principles of science and technology, in accordance with Article 16, paragraph 1 of the General Law of Public Administration, which provides: 'In no case may acts be issued that are contrary to unequivocal rules of science or technology...' — but also with the ARESEP regulations; and the jurisprudence of the Honorable Constitutional Chamber has repeatedly recognized the so-called fundamental right to water, while clarifying that such right does not imply unrestricted access to water services, or an indiscriminate exercise thereof, such that the entities providing said service would be obligated to supply it under any conditions and at any time; the Chamber has recognized that the Instituto Costarricense de Acueductos y Alcantarillados and even Community Aqueduct and Sewerage Administration Associations (Asociaciones Administradoras de Acueductos y Alcantarillados) may deny potable water availability when there are technical reasons that so justify, as indicated in judgment No. 2009-003825 issued at 16:49 hours on March 10, 2009, and likewise in judgment No. 2020-019342.
Nonetheless, the institution maintains active efforts to strengthen the system through investment projects and hydraulic improvements, including initiatives at the level of both public investment and public-private partnerships to strengthen the system and guarantee the continuity and improvement of service. Therefore, it is reiterated that the institutional actions respond to strictly technical, operational, and system sustainability criteria, in compliance with the applicable regulatory framework, thereby ruling out any arbitrary or discriminatory conduct toward any individual or community. CONCLUSIONS. In the present case it is demonstrated that system PC-A-19 presents real technical and operational limitations, particularly in the upper zone corresponding to El Llano and San Miguelito; that the hydraulic water surplus of the system is technically viable for sectors in the middle and lower zones; and that there is currently no technical viability for granting new water availabilities in the upper portion of the system without compromising the continuity and stability of existing users. Accordingly, concrete improvement and investment actions are being maintained on several work fronts regarding pipeline replacement and hydraulic infrastructure reinforcement. It is likewise noted that the projects executed in island communities such as Isla Caballo and La Islita correspond to different geographic and operational conditions, and therefore do not constitute technically equivalent parameters to system PC-A-19.
The actions taken by AyA fall within technical, operational, and system sustainability criteria, and in compliance with the applicable regulations, thereby ruling out arbitrary or discriminatory conduct toward the petitioners. This notwithstanding, the institution continues to pursue comprehensive solutions to progressively strengthen the system and improve water supply conditions for the communities involved. AyA has therefore executed and carried out all actions falling within its area of competence and within the legal framework governing the institution. Based on the foregoing, it is concluded that this writ lacks technical, legal, and regulatory basis, as AyA has fulfilled the obligations imposed by force of law within the constitutional and legal framework under the principle of legality; consequently, no constitutional right of the petitioners has been violated." The respondent requests that the writ be denied.

WHEREAS:
The petitioning party states that they are owners of a parcel of land located in the community of San Miguel, eighth district of Barranca, first canton of Puntarenas. They state that they have been requesting water availability for twenty years; however, they allege that ICAA has denied it to them despite the fact that approximately three years ago a fire hydrant was installed fifty meters from where their properties begin. They detail that the last residence with water service is located eighty meters from where their properties begin. They contend that the principles of non-discrimination and equality are being violated, since despite the fact that they are a significant group of citizens who own a lot in that location, the respondent institution has not treated them as it has treated people in other places, including those in locations with difficult access due to distance and poor accessibility.
For purposes of deciding this matter, the following facts are deemed duly established, either because they have been substantiated or because the respondent failed to address them as required by the initial order:
In the present case, the petitioners allege that ICAA has denied potable water service to a parcel of land located in the community of San Miguel, eighth district of Barranca, first canton of Puntarenas. In light of the facts described, this Chamber, through judgment No. 07779-2019 issued at 09:15 hours on May 3, 2019, in addressing a matter similar to this case, ruled in the following terms:
The appellant states that she owns a plot of land for construction located in San Antonio de Puriscal. She notes that she initiated proceedings for the construction of a dwelling on that plot and approached the respondent institution to request drinking water (agua potable) service, which was denied on the grounds that there is no availability of drinking water and sewage system (alcantarillado) services in front of her property. She argues that this determination is incorrect, since a sewage system and drinking water service do in fact exist, given that the property is located on a main road where dozens of neighbors enjoy access to the water supply; she therefore requests that the appeal be granted. 18 II.- PROVEN FACTS. The following facts are considered duly established as relevant to the decision of this matter, either because they have been duly proven or because the respondent authorities failed to address them as required in the initial order: a) The appellant appeared before the respondent authority on February 5, 2019, to process drinking water service availability (disponibilidad) request No. 2019-1405, for the property registered under Folio Real Matricula (see electronic record). b) The availability request was denied by means of the certificate of non-availability of aqueduct (acueducto) and sewage services UND-GAM-0694-2019-1405, issued on February 28, 2019, which stated that in front of the property registered under Folio Real Matricula, there currently does not exist the production infrastructure necessary to approve the availability requested by the appellant (see electronic record). c) The respondent authority informed the appellant in the aforementioned resolution that, as a consequence of the lack of water capacity (capacidad hídrica) currently recorded by the Puriscal System, it is not feasible for AyA to approve any request for service availability in the sector where the appellant's property is located, since approving new requests would cause a deterioration in the quantity and continuity of service delivery to the existing customers of the Aqueduct (see electronic record). d) There are currently projects under way in the canton of Puriscal that will help resolve the lack of water capacity in the area indicated by the appellant (see electronic record).
III.- ON THE TECHNICAL IMPOSSIBILITIES THAT OBSTRUCT THE SUPPLY OF DRINKING WATER. This Tribunal has stated on repeated occasions that a technical, legal, or formal impossibility to provide drinking water service does not constitute a violation of fundamental rights; and that it is reasonable to deny service requests, or to require the interested party to bear the installation costs, when no drinking water distribution network exists and infrastructure construction is required. Thus, in these cases, it has been consistently held that this is not a refusal of access to drinking water service, but rather an impossibility of providing it, or the necessary participation of the interested party in overcoming a technical impossibility—namely, the lack of infrastructure. Of course, the responsible authorities have the obligation to continuously expand their infrastructure to guarantee the population's access to the service, but while gaps remain, the cooperation of interested parties is indispensable.
In other words, as long as the failure to provide drinking water service is not capricious, arbitrary, or unfounded, but is instead justified by a legal or material impossibility, a violation of fundamental rights is ruled out (see judgments 2010-001516, 2017-6701, 2007-11190, and 2006-014218, among others). 19 IV.- ON THE SPECIFIC CASE. In this regard, this Tribunal finds the appellant's claim to be inadmissible, since, according to the sworn report and the evidence submitted by the respondent authority, the challenged action is not arbitrary or illegitimate, given that the petitioner's request was duly addressed, and her substantive disagreement stems from the denial of the requested service. With respect to the arguments and claims set forth, it must be noted that this Court does not serve as a reviewer of the legality of administrative actions or resolutions, and therefore it does not have jurisdiction to determine whether the relief sought by the petitioner is appropriate or whether it conforms to the applicable legal framework—a task that belongs to the ordinary, administrative, or jurisdictional forum.
According to the information provided under oath, the availability request was denied by means of the certificate of non-availability of aqueduct and sewage services UND-GAM-0694-2019-1405, issued on February 28, 2019, and communicated to the appellant, which stated that in front of the property registered under Folio Real Matricula, there currently does not exist the production infrastructure necessary to approve the availability requested by the appellant in the administrative venue. The certificate of availability of aqueduct and sanitary sewage services is a prerequisite that Municipalities, INVU, and other competent entities require prior to approving the corresponding subdivision (fraccionamiento) and construction permits. In the specific case of the appellant, it was determined that the lack of water capacity currently recorded by the Puriscal System makes it unfeasible for AyA to approve any request for service availability in the sector where the appellant's property is located, since approving new requests would cause a deterioration in the quantity and continuity of service delivery to the existing customers of the Aqueduct.
It is also noted that there are currently projects under way in the canton of Puriscal that will help, in the short, medium, and long term, to resolve the lack of water capacity in the area indicated by the appellant. That said, whether the requested service is appropriate is not a matter to be decided in this forum, as it falls outside the scope of its jurisdiction. It should further be noted that this Tribunal has held on repeated occasions that it is appropriate to dismiss requests for the granting of drinking water service when technical impossibilities arise, when infraconstitutional (infraconstitucionales) requirements are not met, or when technical and/or legal criteria justify such a decision. Furthermore, this Court has repeatedly stated that in cases where a violation of Article 33 of the Constitución Política is alleged, it is not sufficient for the appellant to merely assert that two individuals have been treated differently in order to establish a breach of that constitutional provision, since whoever alleges a violation of this principle is obligated to present from the outset sufficient elements that suggest—with a reasonable degree of probability—that situations that are alike have been treated differently in an unjustified manner.
On the basis of the foregoing, and after reviewing the pleading, this Tribunal finds that in the present case there are insufficient elements to suggest a possible injury to the principle of equality alleged by the 20 appellant. In light of the foregoing, and should the petitioner's disagreement persist, she may raise her objections or claims before the respondent authority or before the competent jurisdictional forum, venues in which she will be able to fully discuss the merits of the matter and assert her claims. Consequently, the appeal is inadmissible and is so declared." (Emphasis not in the original).
This jurisdiction has repeatedly recognized that ICAA, ASADAS, and the municipalities that provide drinking water supply services are fully empowered, prior to approving or rejecting drinking water availability requests submitted to them, to require compliance with the requirements established in the legal order and to weigh legal and technical considerations. That being said, while a fundamental right to water exists that may be enforced against the corresponding Administration, the provision of the service may well be subject to compliance with the requirements established for its granting and to the material possibility of supply. In accordance with the foregoing, it is evident that the reason why drinking water availability has not been granted for the plot identified by the appellant is the existence of a technical impossibility, namely:
"System PC-A-19 presents real technical and operational limitations, especially in the upper zone corresponding to El Llano and San Miguelito, and the residual water reserve (remanente hídrico) of the system is technically viable only for the middle and lower sectors; therefore, there is currently no technical feasibility for granting new water availability allocations in the upper part of the system without jeopardizing the continuity and stability of existing users." Likewise, it must be noted to the petitioner that it is not appropriate to review in this forum whether the technical reasons provided conform to the circumstances of the respective aqueduct. In that regard, it follows from the account of proven facts that the denial being challenged has not been arbitrary. In addition to the foregoing, it must be noted that, under the solemnity of the oath, the respondent institution emphasized that no formal requests have been recorded from the appellants in twenty years.
Similarly, with respect to the alleged discrimination, it is worth noting that the principle of equality established in Article 33 of the Constitución Política does not in itself grant a right to be treated equally to any individual regardless of differing circumstances. For this reason, the Sala Constitucional has stated on numerous occasions that it is not sufficient for the appellant to simply allege that, in a given case, two individuals have been treated differently in order to establish a breach of the fundamental right to equality, since not every differential treatment, in itself, constitutes a violation of Article 33 of the Constitución Política. In this regard, determining when a difference does—or does not—carry the legal significance that makes different treatment reasonable and justifiable requires finding some basis for comparison that allows that question to be resolved; which is why whoever alleges this type of breach is obligated to present elements that allow a determination of whether the difference in treatment is arbitrary.
In the present case, however, the appellant not only fails to present any evidence to that effect, but also appears to assume that the mere fact that a fire hydrant was installed, that ICAA is developing projects in other communities to provide water, and/or that the last dwelling located 80 meters from her property has water service constitutes discrimination. On these terms, the claim is inadmissible, since, even though the petitioner alleges that she has been treated differently, the mere imposition of requirements and conditions for the granting of drinking water service is not discriminatory. Therefore, the appellant must raise her objections or claims through the ordinary legal channels—administrative or jurisdictional—where she will be able to fully discuss the merits of the matter and assert her claims. For the reasons set forth, the writ of amparo (amparo) is inadmissible and is so declared.
We dissent from the majority opinion. In the present case, the Administration's refusal to provide an essential service is upheld on the basis of technical considerations relating to the inadequacy of water infrastructure; however, this approach fails to adequately weigh the fact that access to drinking water constitutes a fundamental right, indispensable for life, health, and human dignity.
Article 21 of the Constitución Política protects human life, and this Tribunal has recognized that access to water for human consumption is a material prerequisite of that right. Likewise, Article 50 of the Constitución Política imposes on the State the duty to guarantee the well-being of all inhabitants, which necessarily includes effective, sufficient, and continuous access to drinking water. At the international level, instruments such as the International Covenant on Economic, Social and Cultural Rights—interpreted by the Committee on Economic, Social and Cultural Rights (Comité DESC) in its General Comment No. 15—recognize the human right to water, obligating States to adopt positive measures for its full realization. There is a reinforced obligation imposed on the State in a social and democratic rule of law, and for this reason the supply of water is a priority obligation of public authorities.
From this perspective, the invocation of technical limitations cannot serve as an absolute justification for disregarding a basic subsistence need. The Administration cannot simply acknowledge the inadequacy of the system; it has a legal duty to plan, anticipate, and carry out the measures necessary to progressively guarantee access to water service, especially when it concerns human consumption.
The majority approach normalizes a structural omission: it accepts that the lack of infrastructure exempts the State from its obligation, when precisely that deficiency evidences a failure of its duty of foresight. The issue is not about compelling the impossible, but about requiring the Administration to adopt reasonable, alternative, or progressive measures so as not to leave individuals without protection.
Water is not just any service; it is an essential human right. For this reason, the respondent authority cannot disregard its duty to guarantee it by shielding itself behind technical limitations without offering effective solutions.
For these reasons, we believe the appeal should have been granted, at least to order the Administration to adopt concrete and progressive measures that guarantee, within a reasonable period, the petitioner's effective access to drinking water. Water is a fundamental good and right whose effectiveness must be genuinely ensured; this is an inescapable duty.
The parties are hereby notified that if any paper documents, objects, or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device have been submitted, these must be retrieved from the office within a maximum period of 30 business days counted from the notification of this judgment. Otherwise, all material not retrieved within this period will be destroyed, pursuant to the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena in session N° 27-11 of August 22, 2011, Article XXVI, and published in the Boletín Judicial number 19 of January 26, 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial in session N° 43-12 held on May 3, 2012, Article LXXXI.
POR TANTO:
The appeal is denied. Magistrates Cruz Castro and Rueda Leal dissent and would grant the appeal.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del diecinueve de junio de dos mil veintiseis .
Recurso de amparo que se tramita en expediente número CED01, interpuesto por Nombre01, cédula de identidad CED02, Nombre02, cédula de identidad CED03, Nombre03, cédula de identidad CED04, Nombre04, cédula de identidad CED05, Nombre05, cédula de identidad CED06, y Nombre06, cédula de identidad CED07, contra el INSTITUTO COSTARRICENSE DE ACUADUCTOS Y ALCANTARILLADOS (ICAA).
RESULTANDO:
"Todos los suscribientes somos propietarios de un terreno ubicado en la comunidad de San Miguel del distrito octavo Barranca del cantón primero de Puntarenas, quienes en su mayoría hemos venimos (sic) a lo largo de veinte años solicitando la disponibilidad hídrica, y de lo cual el lnstituto Costarricense de Acueductos y Alcantarillados nos la han negado, sabiendo que aproximadamente (sic) tres años se instaló un hidrante a 50 metros de donde empiezan nuestras propiedades, y aproximadamente la última vivienda que cuenta con agua tiene una distancia donde empiezan nuestras propiedades de 80 metros. Señores Magistrados; todos los suscribientes desde que adquirimos dichos terrenos tenemos deseos de poder construir nuestras viviendas que con ilusión y esfuerzo las adquirimos, no obstante, sin disponibilidad hídrica no podemos contar con ningún permiso de construcción, ni préstamo en ninguna entidad financiera para poder construir en los lotes, dejando nuestros terrenos en un estado de esterilidad, ya no cuenta con una gota de agua, y los que tienen sus casitas tienen que buscar la forma de llevar el agua a sus viviendas, acarreadas con estañones y pichingas, grupo de habitantes de los cuales se encuentran familias de adultos mayores. El Principio Constitucional que se está soslayando es el de Discriminación e lgualdad, ya que a pesar que somos un grupo importante de ciudadanos que contamos con un lote en dicho lugar, dicha Institución no nos ha tratado como en otros lugares inclusive en condiciones de difícil acceso por la distancia y poca accesibilidad. No obstante, y a pesar de la negativa de conceder ese derecho vital para la vida, la Sala Constitucional de la Corte Suprema de Justicia, ha sido justa integrando los derechos fundamentales como lo es el derecho al agua y al principio de igualdad. A saber, mediante Resolución Número 2015014553 de las catorce horas treinta minutos del veintidós de setiembre de dos mil quince, la Sala Constitucional visible en el Expediente Número 15-011802 0007-CO en su parte dispositiva declara con lugar el recurso y le ordena al Instituto Costarricense de Acueductos y Alcantarillados, y una serie de autoridades públicas que de forma inmediata adopten las previsiones correspondientes para incluir a toda la comunidad de ISLA CABALLO en un proyecto de suministro de agua potable, y de manera temporal mientras se implementa el proyecto de suministro de agua potable se le ordena realizar las gestiones necesarias y las actuaciones pertinentes para abastecer de agua potable a los habitantes de ISLA CABALLO, mediante cisternas u otros mecanismos que garanticen permanentemente el acceso al agua potable mientras se resuelve la situación de forma definitiva. Es por ello que en este momento el Instituto Costarricense de Acueductos y Alcantarillados implementó un proyecto para llevar agua potable desde la comunidad de Lepanto hasta isla Caballo por medio de una tubería submarina desde la Península hasta un tanque de almacenamiento ubicado en la isla, dicha tubería de conducción y tubería de distribución tiene una longitud de 5.573 metros lineales, que irá enterrada a una profundidad de 1.00 con todos los estándares técnicos del Instituto Costarricense de Acueductos y Alcantarillados y normativa ambiental. Dicho proyecto se denomina GSD-UEN AP-2025-00029 del Instituto Costarricense de Acueductos y Alcantarillados, con un costo preliminar de 3.376 millones. Otro caso similar donde el Estado ha intervenido para llevar agua potable a interna lo es en la comunidad de la Islita que se encuentra en la parte del Golfo de Nicoya perteneciente al distrito de Pitahaya del cantón primero de Puntarenas, ubicada en los manglares de la desembocadura del Estero de Puntarenas a 3 kilómetros de la ciudad de Puntarenas, en ella en el año 2012 vivían veintitrés familias aproximadamente, en este caso, igualmente los pobladores de este humedal tuvieron que acudir a la Sala Constitucional después de 50 años para poder obtener el derecho al agua, concretándose su sueño el 06 de octubre de 2012 cuando el Instituto Costarricense de Acueductos y Alcantarillados con una inversión de 250.000.000,00 inaugura el acueducto en dicho humedal proyecto similar al de isla Caballo, con una tubería submarina de 3.5 kilómetros desde la ciudad de Puntarenas hasta La Islita. Información visible en la publicación realizada por la Organización de las Naciones Unidas para la Alimentación y la Agricultura. Asimismo, recientemente el Instituto Costarricense de Acueductos y Alcantarillados inauguró un acueducto nuevo en Sarapiquí beneficiando a aproximadamente 17.700 habitantes de Sarapiquí con un costo de la obra de $10,2 millones. Información sustraída en la página de Acueductos y Alcantarillados. Que a pesar de todas estas resoluciones constitucionales a favor del derecho al agua en el cantón de Puntarenas, el lnstituto Costarricense de Acueductos y Alcantarillados, no ha hecho absolutamente ninguna gestión ante el mismo Instituto o ante algún otro organismo para otorgarnos el privilegio de contar con el preciado derecho, lo que nos ubica en un estado de discriminación y trato desigual, toda vez que a habitantes que se ubican a más de 5 kilómetros de Puntarenas en el caso de isla Caballo, y a 3,5 kilómetros siendo Patrimonio Natural de Estado dicho humedal, el Instituto ha llevado el agua a dichos lugares, y nosotros los habitantes suscribientes que nos encontramos a escasos 80 metros de la última vivienda que cuenta con agua potable suministrada por el Instituto Costarricense de Acueductos y Alcantarillados, y un hidrante a 50 metros, de donde inician nuestras propiedades, nos niegan el agua, por presunta falta de presión. Tenemos vivienda (sic) escasos 100 metros que cuentan con disponibilidad hídrica, y en nuestros casos No han gestionado el más mínimo proyecto para poder llevarnos agua a nuestros lotes. Es por lo que acudimos a la Sala Constitucional a exponer nuestro caso de desigualdad ante la Ley, ante el Principio Constitucional de lgualdad, y su contrapartida de no Discriminación, "igualdad ante iguales y desigualdad ante desiguales", , para hacer valer el derecho al agua, en aras de contar con el mismo derecho del acceso al agua como cualquier otro habitante de la República tiene derecho, se nos haga un trato igual como los habitantes insulares de isla Caballo y la Islita, Sarapiquí, y muchos que indica dicho Instituto estar inaugurando, y a los habitantes que a escasos 80 metros de nuestras propiedades SI cuentan con agua potable, hasta cuentan con hidrante, por lo que solicitamos un trato sin discriminación alguna al derecho humano fundamental y esencial para la vida, bajo el amparo de la adición al artículo 50 de la Constitución Política. Artículo 50; "...Toda persona tiene el derecho humano, básico e irrenunciable de acceso al agua potable, como bien esencial para la vida. El agua es un bien de la Nación, indispensable para proteger tal derecho humano. Su uso, protección, sostenibilidad, conservación y explotación se regirá por lo que establezca esta Ley que se creará para estos efectos y tendrá prioridad el abastecimiento de agua potable para consumo de las personas y las poblaciones”. (Sic).
Consideran que con los hechos expuestos se han lesionado los derechos fundamentales. Solicitan se declare con lugar el recurso y se ordene el suministro de agua potable a la comunidad afectada.
“PRIMERO. Concluido el análisis de los hechos denunciados por los recurrentes, en lo que respecta a la solicitud de nuevos servicios, se indica que, según el Sistema Integrado para la Gestión de Disponibilidades y Desarrollo (SIGDD), no existen solicitudes de disponibilidades para nuevas conexiones en el sector objeto de análisis. (Ver informe técnico No. GSP-RPC-PU-2026-00516 de fecha 28 de mayo del 2026). SEGUNDO. Conforme al análisis técnico institucional realizado por la Región Pacífico Central, el sistema PC-A-19 se encuentra dividido en tres zonas de presión: zona baja, media y alta, siendo esta última la correspondiente principalmente a las comunidades de El Llano, Los Laureles y San Miguelito. El análisis hidráulico determinó que el sistema presenta limitaciones técnicas y operativas importantes, principalmente en la parte alta, producto de: crecimiento urbano desordenado; expansión de la red por encima de las cotas hidráulicas originalmente diseñadas; insuficiencia de almacenamiento; dependencia de sistemas de rebombeo; altos índices de agua no contabilizada; fugas constantes y pérdidas operativas.
Asimismo, se determinó que la producción disponible proveniente de los pozos existentes se encuentra comprometida prácticamente al 100% para el abastecimiento de los servicios formales actuales. De igual forma, el tanque existente en la parte alta posee una capacidad aproximada de apenas 12 m³, condición insuficiente para garantizar regulación horaria, estabilidad hidráulica y cobertura mínima para protección contra incendios. Además, varias propiedades se ubican incluso por encima de la cota del tanque existente, imposibilitando técnicamente el abastecimiento por gravedad. (Ver informe técnico No. GSP-RPC-PU-2026-00516 de fecha 28 de mayo del 2026). TERCERO. Los recurrentes señalan en su escrito que han venido solicitando disponibilidad hídrica desde hace aproximadamente veinte años y que existen elementos de infraestructura cercanos, tales como un hidrante ubicado aproximadamente a 50 metros y viviendas con servicio de agua potable a una distancia cercana a los 80 metros de sus propiedades.
No obstante, realizada la revisión de los registros institucionales disponibles en el Sistema Integrado para la Gestión de Disponibilidades y Desarrollo (SIGDD), no se localizaron solicitudes formales registradas desde hace veinte años por parte de los recurrentes que permitan acreditar técnicamente dicha afirmación. Asimismo, debe aclararse que la existencia de infraestructura cercana, tales como hidrantes, tuberías o viviendas previamente conectadas al sistema, no constituye por sí sola un criterio técnico suficiente para determinar viabilidad hídrica ni obliga automáticamente al otorgamiento de nuevas disponibilidades de agua potable. La viabilidad para nuevos servicios debe analizarse integralmente considerando factores técnicos tales como: capacidad hidráulica del sistema; presión disponible; cotas de elevación; capacidad de almacenamiento; continuidad del servicio existente; capacidad de producción; comportamiento operativo de la red; sostenibilidad futura del sistema.
En el caso particular del sistema PC-A-19 Carmen Lyra – La Guaria – Mojoncito – San Miguelito, los estudios técnicos institucionales determinaron que la parte alta del sistema, donde se ubican sectores de San Miguelito y El Llano, presenta limitaciones hidráulicas reales asociadas principalmente a elevación topográfica, insuficiencia de almacenamiento y dependencia de rebombeo, razón por la cual actualmente no existe viabilidad técnica para otorgar nuevas disponibilidades en dichos sectores sin comprometer la estabilidad y continuidad del servicio existente. De igual manera, debe indicarse que la instalación de hidrantes dentro de un sistema de distribución responde a criterios operativos, sectorización, purga, protección contra incendios y maniobras hidráulicas, por lo que su existencia no implica necesariamente capacidad disponible para habilitar nuevos servicios domiciliares. (Ver informe técnico No. GSP-RPC-PU-2026-00516 de fecha 28 de mayo del 2026).
CUARTO. El balance hídrico actualizado del sistema PC-A-19 determinó la existencia de un caudal disponible aproximado de 0,69 litros por segundo, equivalente a cerca de 28 servicios unifamiliares. No obstante, el mismo informe técnico aclara que dicho remanente corresponde únicamente a un análisis macro del sistema y que la disponibilidad se localiza principalmente en la parte media y baja, donde las condiciones topográficas y de almacenamiento son más favorables. En consecuencia, la Región Pacífico Central concluyó técnicamente que: “Para la parte alta del sistema no hay viabilidad técnica para otorgar más disponibilidades de agua, hasta que se construya un proyecto de inversión o se busque una alianza público-privada que incorpore almacenamiento por encima de 20 m.c.a. de la última casa del Llano.” Por lo anterior, las restricciones existentes no obedecen a actuaciones arbitrarias o discriminatorias por parte de la institución, sino a limitaciones técnicas reales que comprometerían la continuidad, presión y estabilidad del servicio actual en caso de autorizar nuevas disponibilidades en la parte alta del sistema.
(Ver informe técnico No. GSP-RPC-PU-2026-00516 de fecha 28 de mayo del 2026). QUINTO. Pese a las limitaciones actuales, AyA mantiene en ejecución y planificación diversos proyectos orientados al fortalecimiento del sistema PC-A-19. Proyecto bajo Alianza Publico-Privada con “La Bendición de Dios” Actualmente se desarrolla el proyecto denominado “La Bendición de Dios”, bajo la figura de alianza publico privados el cual contempla: equipamiento de un nuevo pozo con capacidad de producción de 12 l/s; construcción de un nuevo tanque de almacenamiento de 150 m³; instalación de aproximadamente 890 metros lineales de tubería; fortalecimiento hidráulico de la parte media y media-alta del sistema. El informe técnico de avance del proyecto confirma que ya se ejecutó la línea principal de conducción y continúan los trabajos asociados a obras civiles, electromecánicas e interconexión. No obstante, técnicamente también se determinó que estas mejoras no resolverán integralmente las limitaciones de las propiedades ubicadas en las cotas más altas del sector El Llano y San Miguelito, debido a que varias permanecen por encima del nivel hidráulico del nuevo tanque proyectado.
Proyecto de sustitución de tubería San Miguelito Mediante memorando No. GSP-RPC-2026-00066, la Región Pacífico Central gestionó recursos para ejecutar un proyecto urgente de sustitución de la red de distribución de San Miguelito, debido a que la infraestructura actual presenta tubería de 50 mm con vida útil agotada, múltiples fugas y afectaciones operativas constantes. El proyecto contempla la sustitución de aproximadamente 1.626 metros de tubería de PEAD de 100 mm, instalación de válvulas y previstas domiciliares, buscando mejorar integralmente el comportamiento hidráulico del sistema. (Ver informe técnico No. GSP-RPC-PU-2026-00516 de fecha 28 de mayo del 2026). SEXTO. Los recurrentes hacen referencia a la resolución N° 2015014553, expediente N° 15-011802-0007-CO, así como a proyectos desarrollados en comunidades insulares como Isla Caballo y La Islita, distrito de Pitahaya, Golfo de Nicoya.
Al respecto, es importante aclarar que dichos casos corresponden a condiciones geográficas, sociales y operativas distintas al sistema PC-A-19 comunidades donde no se brinda el servicio de agua potable y están fuera de cobertura; comunidades insulares atendidas mediante proyectos especiales de abastecimiento por razones sanitarias, humanitarias y de salud pública. En el caso particular del sistema PC-A-19, las restricciones actuales obedecen a limitaciones técnicas reales debidamente acreditadas mediante estudios hidráulicos institucionales, los cuales determinaron que la parte alta del sistema, correspondiente a El Llano y San Miguelito, no posee actualmente viabilidad técnica para soportar nuevas disponibilidades sin comprometer la continuidad y estabilidad del servicio existente, lo anterior en apego no solo de la normativa reglamentaria que nos rige y a los principios generales de la ciencia y la técnica; de conformidad con el artículo 16 inciso 1) de la ley General dela Administración Pública, que señala: “En ningún caso podrán dictarse actos contrarios a reglas unívocas de la ciencia o de la técnica…, sino también en el reglamento de ARESEP y la Jurisprudencia de la Honorable Sala Constitucional ha sido reiterada en reconocer el denominado derecho fundamental del agua pero aclarando que el mismo no implica un acceso irrestricto a los servicios de agua, o un ejercicio indiscriminado de éste, de manera que exista una obligación de los entes que prestan dicho servicio de brindarlo en cualesquiera condiciones y oportunidad , ha reconocido que el Instituto Costarricense de Acueductos y Alcantarillados e incluso las Asociaciones Administradoras de Acueductos y Alcantarillados pueden denegar la disponibilidad de agua potable si existen razones técnicas, que así lo justifiquen, tal y como se indicó en la y como se señala en la sentencia No. 2009-003825 de las 16:49 horas del 10 de marzo de 2009, así como también en la sentencia N°2020-019342: No obstante, la institución mantiene acciones activas para fortalecer el sistema mediante proyectos de inversión y mejoras hídricas he hidráulica, entre ellas iniciativas tanto a nivel de inversión pública como empleando alianza publicas privadas para fortalecer el sistema y garantizar la continuidad y mejora del servicio.
Por tanto, se reitera que las actuaciones institucionales responden a criterios estrictamente técnicos, operativos y de sostenibilidad del sistema, en apego a la normativa reglamentaria, descartándose cualquier actuación arbitraria o discriminatoria para una persona o comunidad. (Ver informe técnico No. GSP-RPC-PU-2026-00516 de fecha 28 de mayo del 2026).

CONCLUSIONES En el presente caso queda demostrado que el sistema PC-A-19 presenta limitaciones técnicas y operativas reales, especialmente en la zona alta correspondiente a El Llano y San Miguelito y que el remanente hídrico del sistema resulta técnicamente viable para sectores de la parte media y baja, por lo que actualmente no existe viabilidad técnica para otorgar nuevas disponibilidades de agua en la parte alta del sistema sin comprometer la continuidad y estabilidad de los usuarios existentes, de ahí que se mantienen acciones concretas de mejora e inversión en varios frentes de trabajo para la sustitución de tubería y fortalecimiento de infraestructura hidráulica, asimismo, indicar que los proyectos ejecutados en comunidades insulares como Isla Caballo y La Islita corresponden a condiciones geográficas y operativas distintas, por lo que no constituyen parámetros técnicos equivalentes al sistema PC-A-19, y que lo actuado por AyA se enmarcan en criterios técnicos, operativos y de sostenibilidad del sistema, y en apego a la normativa, descartándose actuaciones arbitrarias o discriminatorias hacia los recurrentes, sin que esto obste para que informar que se continúa gestionando soluciones integrales para fortalecer progresivamente el sistema y mejorar las condiciones de abastecimiento de las comunidades involucradas, por lo que AyA ha ejecutado y realizado todas las acciones que corresponden al ámbito de su competencia y dentro del marco de legalidad que nos rige, por lo que con fundamento en lo expuesto, se concluye que este Recurso carece de fundamento técnico, legal y reglamentario, ya que AyA ha cumplido con las obligaciones impuestas por imperio de ley en el marco constitucional y legal por el principio de legalidad, por ende, no se ha violentado ningún derecho constitucional a la recurrente”.
Solicita que se declare sin lugar el recurso.
Redacta la Magistrada Garro Vargas; y,
CONSIDERANDO:
La parte recurrente manifiesta que son propietarios de un terreno ubicado en la comunidad de San Miguel, distrito octavo Barranca del cantón primero de Puntarenas. Señalan que a lo largo de veinte años han solicitado la disponibilidad hídrica; empero, acusan que el ICAA se la ha negado pese a que aproximadamente tres años se instaló un hidrante a cincuenta metros de donde empiezan sus propiedades. Detallan que la última vivienda que cuenta con agua tiene una distancia donde empiezan sus propiedades de ochenta metros. Estiman que se les viola los principios de discriminación e igualdad, ya que a pesar de que son un grupo importante de ciudadanos que cuentan con un lote en dicho lugar y la institución recurrida no los ha tratado como en otros lugares, inclusive en condiciones de difícil acceso por la distancia y poca accesibilidad.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
En el caso de marras los recurrentes acusan que el ICAA ha denegado el servicio de agua potable en un lote en terreno ubicado en la comunidad de San Miguel, distrito octavo Barranca del cantón primero de Puntarenas. En virtud de los hechos descritos, esta Sala mediante sentencia No. 07779-2019 de las 09:15 horas del 03 de mayo de 2019, al conocer un asunto similar al de este expediente, se pronunció en los siguientes términos:
“I.- OBJETO DEL RECURSO. Señala la recurrente que posee un terreno para construcción ubicado en San Antonio de Puriscal. Acota que inició los trámites para la construcción en una casa de habitación en dicho terreno y acudió ante la institución recurrida para solicitar el servicio de agua potable, el cual le fue negado indicándole que no hay disponibilidad de agua potable y sistema de alcantarillado frente a su propiedad. Señala que lo anterior, no lleva razón debido a que sí existe un sistema de alcantarillado y agua potable ya que se trata de una carretera principal donde decenas de vecinos gozan de la disponibilidad del líquido, por lo que solicita se declare con lugar el recurso. 18 II.- HECHOS PROBADOS. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque las autoridades recurridas hayan omitido referirse según lo prevenido en el auto inicial: a) La recurrente se apersonó ante la autoridad recurrida el día 05 de febrero de 2019, para tramitar la solicitud de disponibilidad de agua potable N°2019-1405, para la Finca Folio Real Matricula (ver registro electrónico). b) La solicitud de disponibilidad fue denegada mediante la certificación de no disponibilidad de servicios de acueducto y alcantarillado UND-GAM- 0694- 2019-1405, emitida en fecha 28 de febrero de 2019, que detalló que frente a la Finca Folio Real Matricula , actualmente no existe la infraestructura de producción necesaria para aprobar la disponibilidad requerida por la recurrente (ver registro electrónico). c) La autoridad recurrida le informó en la anterior resolución que como consecuencia de la falta de capacidad hídrica que actualmente registra el Sistema Puriscal, no es factible para AyA, aprobar ninguna solicitud de disponibilidad de servicios en el sector en que se ubica la Finca de la recurrente, pues de aprobarse nuevas peticiones, se generaría un desmejoramiento en la cantidad y continuidad de prestación del servicio para los clientes actuales del Acueducto (ver registro electrónico). d) Actualmente existen proyectos en el cantón de Puriscal que ayudaran a solventar la falta de capacidad hídrica en la zona indicada por la recurrente (ver registro electrónico).
III.- SOBRE LAS IMPOSIBILIDADES TÉCNICAS QUE OBSTACULIZAN EL ABASTECIMIENTO DE AGUA POTABLE. Este Tribunal ha señalado en reiteradas ocasiones que la imposibilidad técnica, jurídica o formal para dotar el servicio de agua potable no es violatorio de derechos fundamentales; y que resulta razonable no atender las solicitudes de servicio o solicitar que el interesado asuma los costos de instalación cuando no exista red de distribución de agua potable y se necesite la construcción de infraestructura. Así, en estos casos se ha tenido claro que no es que se trate de una negativa al acceso al servicio de agua potable, sino de la imposibilidad para brindarlo o de la necesaria participación del interesado en el levantamiento de una imposibilidad técnica, cual es, la falta de infraestructura. Por supuesto, las autoridades encargadas tienen la obligación de ir expandiendo su infraestructura para garantizar a la población el acceso al servicio, pero mientras queden vacíos resulta indispensable la colaboración de los interesados.
En otras palabras, siempre que la falta de dotación del servicio de agua potable no sea una actuación antojadiza, arbitraria o sin fundamento, sino que esté justificada en una imposibilidad jurídica o material; se descarta la violación de derechos fundamentales (véanse las sentencias 2010-001516, 2017-6701, 2007-11190, y 2006-014218, entre otras). 19 IV.- SOBRE EL CASO CONCRETO. Al respecto, estima este Tribunal que el reclamo de la recurrente resulta improcedente toda vez que de acuerdo al informe rendido bajo la fe de juramento y a la prueba aportada por la autoridad recurrida, se tiene que la actuación impugnada no resulta arbitraria o ilegítima, dado que la solicitud de la amparada fue atendida, y su disconformidad de fondo radica en la denegatoria del servicio pretendido. En relación con los alegatos y pretensiones expuestas, se impone advertir que esta Sala no es un contralor de la legalidad de las actuaciones o resoluciones de la Administración, de modo que no le compete revisar si la pretensión requerida por la amparado es procedente, o si se ajusta o no a la normativa legal vigente, labor propia de la vía común, administrativa o jurisdiccional.
Según lo informado bajo la solemnidad de juramento, dicha solicitud de disponibilidad fue denegada mediante la certificación de no disponibilidad de servicios de acueducto y alcantarillado UND-GAM- 0694-2019-1405, emitida en fecha 28 de febrero de 2019, comunicada a la recurrente en la cual se detalló que frente a la Finca Folio Real Matricula , actualmente no existe la infraestructura de producción necesaria para aprobar la disponibilidad requerida por la recurrente en vía administrativa, la constancia de disponibilidad de servicios de acueducto y alcantarillado sanitario, es un requisito que las Municipalidades, INVU y demás entidades competentes, requieren de manera previa para la aprobación de los permisos de fraccionamiento y construcción correspondientes, en el caso concreto de la recurrente se determinó que la falta de capacidad hídrica que actualmente registra el Sistema Puriscal, no hace factible para el AyA, aprobar ninguna solicitud de disponibilidad de servicios en el sector en que se ubica la finca de la recurrente, pues de aprobarse nuevas peticiones, se generaría un desmejoramiento en la cantidad y continuidad de prestación del servicio para los clientes actuales del Acueducto, Indica que actualmente existen proyectos en el cantón de Puriscal que ayudaran a corto, mediano y largo plazo a solventar la falta de capacidad hídrica en la zona indicada por la recurrente.
Ahora bien, la procedencia o no del servicio solicitado no es un asunto que deba discutirse en esta Jurisdicción, ya que es ajeno al ámbito de su competencia, y cabe agregar que ya en reiteradas ocasiones este Tribunal ha sostenido que resulta posible desestimar las gestiones presentadas para el otorgamiento del servicio de agua potable, cuando se presenten imposibilidades técnicas, incumplimiento de requisitos infraconstitucionales o existan criterios técnicos y/o legales que así lo justifiquen. Por otro lado, adviértase que, en reiteradas ocasiones, esta Sala ha señalado que en aquellos casos en que se acuse vulneración al numeral 33 de la Constitución Política, no basta con que la parte recurrente afirme que se ha producido un trato distinto entre dos sujetos para tener por demostrado el quebranto a la norma constitucional, toda vez que quien alega la violación a este principio está obligado a aportar ab initio elementos suficientes que sugieran -con un grado de probabilidad razonable- que de modo injustificado se ha dado un trato diferenciado a situaciones iguales.
Partiendo de lo expuesto, y luego de revisado el escrito de interposición, este Tribunal estima que en el sub lite no se infieren elementos suficientes que permitan denotar una posible lesión al principio de igualdad alegado por la 20 recurrente. Con base en lo expuesto y de mantenerse la disconformidad de la amparada, esta podrá plantear sus inconformidades o reclamos ante la autoridad recurrida o en la vía jurisdiccional competente, vías en las cuales podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones. En consecuencia, el recurso es inadmisible y así se declara”. (El destacado no es del original).
Esta jurisdicción ha reconocido, reiteradamente, que el ICAA, las ASADAS y las municipalidades que prestan el servicio de suministro de agua potable, de previo a aprobar o rechazar las posibilidades de disponibilidad de agua potable que les sean formuladas, están en plena capacidad de exigir el cumplimiento de requisitos establecidos en el ordenamiento jurídico, y ponderar razones de orden legal y técnico. Así las cosas, si bien existe un derecho fundamental al agua que puede ser exigido a la Administración correspondiente, la prestación del servicio bien puede sujetarse al cumplimiento de los requisitos establecidos para su otorgamiento y a que exista posibilidad material de suministro. De acuerdo con lo señalado anteriormente, resulta evidente que la razón por la cual no se le ha brindado la disponibilidad de agua potable en el terreno que acusa la parte recurrente se debe a la existencia de una imposibilidad técnica, a saber:
“El sistema PC-A-19 presenta limitaciones técnicas y operativas reales, especialmente en la zona alta correspondiente a El Llano y San Miguelito y que el remanente hídrico del sistema resulta técnicamente viable para sectores de la parte media y baja, por lo que actualmente no existe viabilidad técnica para otorgar nuevas disponibilidades de agua en la parte alta del sistema sin comprometer la continuidad y estabilidad de los usuarios existentes”.
De igual manera, cabe advertirle a la parte amparada que no procede revisar en esta vía si las razones técnicas ofrecidas en ajustan o no a las circunstancias del acueducto respectivo. En ese sentido, se desprende de la relación de hechos probados que la denegatoria que se reclama no ha sido arbitraria. En adición a lo anterior, es preciso advertir que, bajo la solemnidad del juramento, la institución accionada subrayó que no existen solicitudes formales registradas desde hace veinte años por parte de los recurrentes. Igualmente, respecto a la discriminación alegada, conviene acotar que el principio de igualdad que establece el artículo 33 de la Constitución Política no concede propiamente un derecho a ser equiparado a cualquier individuo sin distinción de circunstancias. Por esta razón, la Sala Constitucional ha dicho en numerosas ocasiones que no basta que la parte recurrente afirme sin más que, en un caso dado, se ha producido un trato distinto entre dos sujetos para tener por demostrado un quebranto al derecho fundamental a la igualdad, puesto que no todo tratamiento diferente, en sí mismo, constituye una violación al artículo 33 de la Constitución Política.
En este sentido, el poder determinar cuándo una diferencia tiene —o no tiene— la trascendencia jurídica que haga razonable y justificable el trato diverso, requiere encontrar algún elemento de comparación que permita precisar esa cuestión; razón por la cual quien alega ese tipo de quebranto está obligado a aportar elementos que permitan establecer si la diferencia de trato es arbitraria o no. En la especie, empero, la parte recurrente no solo no presenta prueba alguna en ese sentido, sino que parece asumir que el mero hecho que instalara un hidrante, que el ICAA esté desarrollando proyectos en otras comunidades para dotar de agua y/o que la última vivienda ubicada a 80 metros de su propiedad cuente con agua denota una discriminación. En estos términos, el reclamo es inadmisible, pues, aun cuando la parte accionante alega que se les ha dado un trato diferenciado, la mera exigencia de requisitos y condiciones para el otorgamiento del servicio de agua potable no resulta discriminatorio.
Por consiguiente, deberá la parte recurrente plantear sus inconformidades o reclamos en las vías de legalidad ordinaria, administrativas o jurisdiccionales, sedes en las cuales podrán en forma amplia discutir el fondo del asunto y hacer valer sus pretensiones. En mérito de lo expuesto, el amparo resulta improcedente y así se declara.
Disentimos del criterio de mayoría. En el presente caso, se valida la negativa de la Administración de brindar un servicio esencial, con base en consideraciones técnicas relativas a la insuficiencia de la infraestructura hídrica; sin embargo, se omite ponderar adecuadamente que el acceso al agua potable constituye un derecho fundamental, indispensable para la vida, la salud y la dignidad humana.
El artículo 21 de la Constitución Política protege la vida humana, y este Tribunal ha reconocido que el acceso al agua para consumo humano es un presupuesto material de ese derecho. Asimismo, el artículo 50 constitucional impone al Estado el deber de garantizar el bienestar de todos los habitantes, lo cual incluye necesariamente el acceso efectivo, suficiente y continuo al agua potable. En el ámbito internacional, instrumentos como el Pacto Internacional de Derechos Económicos, Sociales y Culturales –interpretado por el Comité DESC en su Observación General No. 15– reconocen el derecho humano al agua, obligando a los Estados a adoptar medidas positivas para su plena realización. Hay una obligación reforzada impuesta al Estado en un estado social y democrático de derecho, por esta razón el suministro de agua, es una obligación prioritaria de los poderes públicos.
Desde esta perspectiva, la invocación de limitaciones técnicas no puede erigirse en una justificación absoluta para desatender una necesidad básica de subsistencia. La Administración no puede limitarse a constatar la insuficiencia del sistema; tiene el deber jurídico de planificar, prever y ejecutar las acciones necesarias para garantizar progresivamente el acceso al servicio al agua, especialmente cuando se trata de consumo humano.
El enfoque mayoritario normaliza una omisión estructural: acepta que la falta de infraestructura exonera al Estado de su obligación, cuando precisamente esa carencia evidencia un incumplimiento de su deber de previsión. No se trata de obligar a lo imposible, sino de exigir que la Administración adopte medidas razonables, alternativas o progresivas para no dejar en desprotección a las personas.
El agua no es un servicio cualquiera, es un derecho humano esencial, por ello, la autoridad accionada no puede desentenderse de su deber de garantizarlo, escudándose en limitaciones técnicas sin ofrecer soluciones efectivas.
Por estas razones, estimamos que el recurso debió declararse con lugar, al menos para ordenar a la Administración la adopción de medidas concretas y progresivas que garantice, en un plazo razonable, el acceso efectivo al agua potable de la parte amparada. El agua es un bien y un derecho fundamental cuya vigencia debe asegurarse efectivamente, es un deber ineludible.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
POR TANTO:
Se declara sin lugar el recurso. Los magistrados Cruz Castro y Rueda Leal salvan el voto y declaran con lugar el recurso.
