Document Review CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours thirty minutes on the nineteenth of June, two thousand twenty-six.
Constitutional writ of amparo (recurso de amparo) processed under file number 26-013821-0007-CO, filed by Nombre01, bar membership number 32779, against the MUNICIPALIDAD DE ASERRÍ and the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
Background:
Drafted by Magistrate Salazar Alvarado; and,
Considering:
I.Subject of the writ. The petitioner states that she is a resident of Aserrí, Dirección01, and that for twenty-two days she has not received potable water service at her home. She considers her fundamental rights to have been violated.
II.Proven facts. Of relevance to the decision in this matter, the following facts are deemed duly established, either because they have been demonstrated on the record or because the respondent failed to address them as required in the initial order:
SOLE FINDING. That for twenty-two days the protected party lacked potable water supply at her home, and that this situation was brought to the attention of the respondent authorities.
IV.On the right to potable water service. From the combined reading of Articles 21 and 50 of the Political Constitution, there arise the right of persons to life, health, and a healthy and ecologically balanced environment, which are intimately linked, inasmuch as life, as the supreme value enshrined in the Constitution, entails special protection—for without life, the protection of all other fundamental rights would serve little purpose. In this light, life must be protected in all its dimensions: physical, mental, and environmental, and it is precisely there that the importance of protecting the environment and natural resources arises, in order to promote the well-being of persons. This well-being is achieved, among other aspects, through the protection and conservation of the quality and quantity of water resources, so that water may be potable for human consumption and thereby protect public health—since, being a resource essential for hygiene, food, and drink, its contamination can cause serious harm to public health.
In that regard, the protection and conservation referred to must be provided by the State through the bodies it designates for that purpose, which must adopt the necessary measures to guarantee access to this resource for all persons and to ensure compliance with those measures. Under this framework, the right to water arises, which may be protected by this Constitutional Tribunal by way of the writ of amparo (Sentencia N° 2007-005482, at 14:39 hours on April 24, 2007, reiterated on multiple occasions, including N° 2007-005482, at 09:20 hours on January 31, 2025).
V.On the merits. In this case, based on the explanation provided by the Mayor of Aserrí and confirmed by the report submitted by the authorities of the Instituto Costarricense de Acueductos y Alcantarillados, this Chamber finds that no fundamental rights of the protected party have been violated. In this regard, it is established that the water deficit experienced by the community of Aserrí results from a decrease in the volume of the water storage tanks and the topography of the canton, and is not related to infrastructure problems. Consequently, the water utility authorities have been compelled to implement consumption-regulation measures in multiple sectors within the waterworks coverage area in order to guarantee continuity of service.
In similar cases, the Chamber has found it appropriate to adopt certain measures to distribute what is available and thereby guarantee the greatest possible supply to existing users, since such a situation cannot be attributed to the respondent institution (see in this regard Sentencias N° 2016-14465 at 9:05 hours on October 7, 2016, N° 2014-9134 at 14:05 hours on June 19, 2014, and N° 2016-7240 at 09:20 hours on May 27, 2017, among others).
In light of the foregoing, the situation reported is caused by difficulties of natural origin related to the availability of water resources and to the low flow pressure resulting from the dry season, which constitute circumstances of force majeure (fuerza mayor) not attributable to the Municipal Corporation (Corporación Municipal). Faced with this problem, the respondent Municipality has taken the necessary actions to minimize the situation and guarantee potable water to all persons living in the area, by means of rationing or temporary service suspensions for several hours during the day, and by supplying water through tanker trucks that travel through the affected areas. In addition, the rationing schedules have been communicated to residents of the affected sectors through publications on the Municipality's website and on social media, as have the tanker truck schedules. In this way, affected residents can take the appropriate measures and store water for their basic needs.
It should be noted that the respondent Municipality has not implemented prolonged or severe service interruptions; rather, the interruptions have been scheduled so as to ensure that the entire community has water at different hours of the day and can take advantage of those periods to collect and store water in tanks, etc.
Furthermore, there is no record that the petitioner reported going several days without potable water supply; it was only through the filing of this writ that the respondent authorities became aware of the situation and will proceed to visit her home to determine the cause of the problem, as a first step prior to sending a tanker truck.
On the other hand, given these particular circumstances, if the petitioner believes that the community where she resides has not been duly informed of the service suspensions, that constitutes a complaint that must be filed with the authorities of the respondent Municipality.
With respect to the Instituto Costarricense de Acueductos y Alcantarillados, no violation of any fundamental right of the petitioner is found, since it does not supply potable water to the canton of Aserrí and has not been responsible for the scheduled supply interruptions implemented by the Municipalidad de Aserrí.
VI.Conclusion. Based on the foregoing, it is established that due to difficulties of natural origin, the Municipal Corporation has been obliged to implement temporary rationing of the potable water service in the area where the user lives. The Chamber has endorsed rationing as a measure in response to water scarcity, provided that it does not neglect the basic needs of the population, that it is temporary in nature and limited to certain hours of the day, that it be communicated to residents, and, where applicable, that tanker trucks be dispatched.
Therefore, no violation of the petitioner's fundamental rights is found and the appropriate ruling is to deny the writ.
The parties are hereby advised that, should they have submitted any documents in paper form, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device, such materials must be retrieved from the court offices within a maximum period of thirty working days, counted from notification of this judgment. Otherwise, all material not retrieved within this period will be destroyed, pursuant to the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Corte Plena in Session N° 27-11 of August 22, 2011, Article XXVI, and published in Boletín Judicial N° 19 of January 26, 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial in Session N° 43-12, held on May 3, 2012, Article LXXXI.
Therefore:
The writ is denied.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del diecinueve de junio de dos mil veintiseis .
Recurso de amparo que se tramita en expediente número 26-013821-0007-CO, interpuesto por Nombre01, carné abogado/a 32779, contra la MUNICIPALIDAD DE ASERRÍ y el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
Resultando:
Redacta el Magistrado Salazar Alvarado; y,
Considerando:
I.Objeto del recurso. La recurrente manifiesta que, es vecina de Aserrí, Dirección01, y desde hace veintidós días no le llega el servicio de agua potable a su casa. Considera lesionado sus derechos fundamentales.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
ÚNICO. Que durante veintidós días, la tutelada no haya tenido suministro de agua potable en su vivienda y que dicha situación haya sido puesta en conocimiento a las autoridades recurridas.
IV.Sobre el servicio de agua potable. De la relación de los artículos 21 y 50, de la Constitución Política, se desprenden el derecho de las personas a la vida, la salud y a un medio ambiente sano y ecológicamente equilibrado, los cuales se encuentran íntimamente ligados, toda vez, que la vida como valor supremo de la constitución, implica una especial protección, pues sin vida, poca utilidad tendría la protección de los demás derechos fundamentales. Así las cosas, la vida debe ser protegida en todas sus vertientes, desde un aspecto físico, mental y de entorno, y es precisamente ahí donde surge la importancia en proteger el ambiente y los recursos naturales, a fin de procurar el bienestar de las personas. Ahora bien, entre otros aspectos, ese bienestar se logra, a través de la protección y conservación de la calidad y cantidad de los recursos hídricos, para que ésta sea potable para el consumo humano y de esta forma proteger la salud de las personas, ya que al tratarse de un recurso necesario para la higiene, alimento y bebida, su contaminación puede producir graves perjuicios en la salud pública.
En ese sentido, la protección y conservación a la que se hace referencia, debe ser brindada por el Estado a través de los órganos que designe al efecto, los cuales deberán adoptar las medidas necesarias para garantizar el acceso de ese recurso a todas las personas, así como velar por el cumplimiento de éstas. Bajo esa tesitura, surge el derecho al agua, el cual puede ser protegido por este Tribunal Constitucional mediante la vía de amparo (Sentencia N° 2007-005482, de las 14:39 horas del 24 de abril del 2007, reiterada en múltiples ocasiones, entre ellas la N° 2007-005482, de las 09:20 horas del 31 de enero de 2025).
V.Sobre el fondo. En este caso, de lo explicado por el Alcalde de Aserrí y lo confirmado por el informe rendido por las autoridades del Instituto Costarricense de Acueductos y Alcantarillados, esta Sala descarta que, se hayan quebrantado los derechos fundamentales de la amparada. Al respecto, se acredita, que el déficit de agua que presenta la comunidad de Aserrí es producto de la disminución en el volumen de los tanques de agua y de la topografía del cantón, y no relacionada con problemas en la infraestructura. De manera, que las autoridades del acueducto se han visto obligadas a implementar medidas de regulación del consumo en múltiples sectores dentro del área de cobertura del acueducto, con el fin de garantizar la continuidad del servicio.
En casos similares, la Sala ha estimado procedente adoptar determinadas medidas para distribuir lo obtenido, y así garantizar el suministro posible a los usuarios ya existentes, pues dicha situación no resulta imputable a la institución recurrida (ver en este sentido las Sentencias N° 2016-14465 de las 9:05 horas del 7 de octubre de 2016, N° 2014-9134 de las 14:05 horas del 19 de junio de 2014 y N° 2016-7240 de las 09:20 horas del 27 de mayo 2017, entre otras).
Así las cosas, la situación denunciada es provocada por inconvenientes de origen natural vinculados a la disponibilidad del recurso hídrico, y con la baja presión del caudal por la época seca, lo cual constituye circunstancias de fuerza mayor no atribuibles a la Corporación Municipal. Ante esta problemática, la Municipalidad recurrida ha tomado las acciones necesarias para minimizar la situación y garantizar el agua potable a todas las personas que habitan en la zona mediante de racionamiento o suspensiones del servicio, por algunas horas durante el día, y mediante el suministro de agua a través de camiones cisterna que hacen los recorridos por las zonas afectadas. Aunado a ello, los horarios de dichos racionamientos han sido comunicado a los vecinos de los sectores afectados mediante publicaciones en la página de la Municipalidad y en redes sociales, lo mismo que el horario de los camiones cisterna. De esta forma, los vecinos perjudicados pueden tomar las medidas pertinentes y almacenar el agua para las necesidades básicas.
Nótese que, la Municipalidad recurrida no ha efectuado interrupciones prolongadas o severas del servicio, sino que las mismas han sido programadas con el fin de garantizar que toda la comunidad tenga agua a diferentes horas y que aprovechen para recoger agua y almacenarla en tanques, etc.
Además, no consta que la recurrente haya denunciado que ha permanecido durante varios días sin la dotación del servicio de agua potable, siendo que fue con ocasión del presente recurso, que las autoridades recurridas tuvieron conocimiento de la situación y procederán a realizar una visita en su vivienda para determinar la causa del problema, esto como primer paso previo al envió de un camión cisterna.
Por otra parte, dadas esas particularidades, si la recurrente estima que la comunidad donde reside no ha sido debidamente informada de las suspensiones del servicio, ello constituye una queja que debe ser presentada, ante las autoridades de la Municipalidad accionada.
En cuanto al Instituto Costarricense de Acueductos y Alcantarillados, no se verifica que haya lesionado derecho fundamental alguno a la recurrente, toda vez que no abastece de agua potable al cantón de Aserrí ni ha sido responsable de los desabastecimientos programados por la Municipalidad de Aserrí.
VI.Conclusión. De lo expuesto, se verifica que debido a los inconvenientes de origen natural, la Corporación Municipal ha tenido la obligación de aplicar racionamientos temporales del servicio de agua potable en la zona donde vive la usuaria siendo que la Sala ha avalado como medida, el racionamiento debido a la escasez del recurso hídrico, siempre que con ello, no se desatienda las necesidades básicas de la población, que sea de carácter temporal y por algunas horas, lo cual debe ser informado a los pobladores, y si es el caso, y enviar camiones cisternas.
Por ende, no se constata lesión alguna a los derechos fundamentales del recurrente y lo procedente es declarar sin lugar el recurso.
Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles, contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11, del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19, del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12, celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
