Document Review SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine hours thirty minutes on the nineteenth of June of two thousand twenty-six.
Writ of amparo (recurso de amparo) filed under case file no. 26-013203-0007-CO, brought by Nombre01, national identification number CED01, against the MUNICIPALIDAD DE DESAMPARADOS.
Background:
The opinion is drafted by Justice Rueda Leal; and,
Considering:
In view of the fact that the head of the Departamento de Infraestructura Vial y Obras Públicas of the MUNICIPALIDAD DE DESAMPARADOS failed to submit the report within the deadline set by this Court in the admission resolution of the present case, the Court proceeds to resolve the appeal in accordance with Article 45 of the Ley de la Jurisdicción Constitucional and taking into consideration the evidentiary elements on record.
It should be clarified that, beginning with ruling no. 2008-002545 issued at 8:55 a.m. on February 22, 2008, this Sala has—with certain exceptions—referred to the contencioso-administrativa jurisdiction those matters in which it is debated whether a public authority has or has not complied with the time limits established by the Ley General de la Administración Pública (Articles 261 and 325) or by sector-specific statutes for special administrative proceedings, in order to resolve by a final act an administrative proceeding—initiated ex officio or at the request of a party—or to rule on available administrative appeals. This appeal presents precisely one of the recognized exceptions, since it involves a request related to alleged situations of risk to the petitioner and her family, which she claims have not been addressed within a reasonable time. In light of the foregoing, the Sala will proceed to resolve the appeal.
The petitioner explains that since 2022, her property has been affected by the flooding of the Cañas River. She argues that, while the respondent municipality has carried out some works, these have only benefited certain neighboring properties but not her own. She contends that at the time of filing the appeal, the problem affecting and endangering her property and family had not been resolved.
Of importance to the decision in this matter, the following facts are deemed duly established:
In the present proceeding, the petitioner explains that since 2022, her property has been affected by the flooding of the Cañas River. She argues that, while the respondent municipality has carried out some works, these have only benefited certain neighboring properties but not her own. She contends that at the time of filing the appeal, the problem affecting and endangering her property and family had not been resolved.
From the review of the record it is established that, on December 9, 2025, the protected party met with the mayor and an official from the Área de Infraestructura of the MUNICIPALIDAD DE DESAMPARADOS. At that meeting, the protected party was informed that works would be carried out in the river channel and that cleaning of the sector would subsequently be undertaken. On an exact date that is undetermined, but falling between December 9, 2025 and February 6, 2026, the respondent municipality performed works of "removal and redistribution of the sedimentary material accumulated in the central section of the channel, using the same material already present within the riverbed to promote the channeling of flow toward the central zone of the river and reduce the direct impact of the water on the lateral edges. As part of the intervention carried out, a riprap-type protection structure was constructed using natural riverbed material, with the objective of partially dissipating the hydraulic energy of the river during flood events, reducing the direct impact of the current on the exposed embankment slope, reducing undercutting and lateral erosion processes present on the left bank, and generating an elevation and shaping of the intervened edge, constituting a lateral protection barrier designed to reduce the risk of damage to the adjoining properties." On February 6, 2026, the respondent authority informed the protected party that the execution of the works had been completed and that a contracting process would be initiated for the entry of machinery to carry out cleaning in the river channel.
On March 16, 2026, the respondent municipality carried out works in the river using excavator machinery. The respondent authorities were notified of the admission resolution in this proceeding on May 21 and 22, 2026. In report no. AM-IF-152-2026 of May 25, 2026, the coordinator of the Área de Infraestructura of the respondent municipality detailed: "The interventions implemented respond exclusively to technical criteria of risk mitigation, hydraulic protection, and improvement of the channel's conveyance capacity, particularly in sectors historically affected by narrowing, sedimentation, and erosion processes. Consequently, it is not true, as the petitioner claims, that said works were carried out to protect specific private properties or particular adjoining parcels of land. The works were never conceived or developed for private purposes, but as comprehensive public-interest projects aimed at improving the hydraulic behavior of the river and reducing risks associated with flooding and downstream impacts (…)." From this perspective, prima facie any situation that would at this time warrant the intervention of this constitutional jurisdiction is ruled out.
In this regard, it is noted that the respondent municipality has addressed the situation raised by the petitioner, since beginning in December of the previous year she was informed that various works would be carried out in the river channel and that a cleaning of the sector would subsequently be undertaken, precisely to address the problem at issue. Accordingly, it is observed that, between that date and February 6, 2026, the respondent local government carried out various works, including the "removal and redistribution of the sedimentary material accumulated in the central section of the channel, using the same material already present within the riverbed to promote the channeling of flow toward the central zone of the river and reduce the direct impact of the water on the lateral edges"; likewise, "a riprap-type protection structure was constructed using natural riverbed material, with the objective of partially dissipating the hydraulic energy of the river during flood events, reducing the direct impact of the current on the exposed embankment slope, reducing undercutting and lateral erosion processes present on the left bank, and generating an elevation and shaping of the intervened edge, constituting a lateral protection barrier designed to reduce the risk of damage to the adjoining properties." Subsequently, on March 16 of the current year, cleaning works in the river were initiated.
Therefore, it is not possible to conclude that the respondent authority neglected the problem at issue, since, as was explained under oath, the necessary works have been carried out to mitigate the impacts in question.
In addition to the foregoing, the respondent municipality explains that, contrary to what the petitioner claims, the works in question were not intended to benefit any particular property. In that regard, in official communication no. AM-IF-152-2026 of May 25, 2026, the coordinator of the Área de Infraestructura detailed: "The interventions implemented respond exclusively to technical criteria of risk mitigation, hydraulic protection, and improvement of the channel's conveyance capacity, particularly in sectors historically affected by narrowing, sedimentation, and erosion processes. Consequently, it is not true, as the petitioner claims, that said works were carried out to protect specific private properties or particular adjoining parcels of land. The works were never conceived or developed for private purposes, but as comprehensive public-interest projects aimed at improving the hydraulic behavior of the river and reducing risks associated with flooding and downstream impacts." Therefore, no irregularity of the kind referred to by the petitioner is established.
It should be noted, however, that if the petitioner is dissatisfied with the works carried out, or if she believes that different works should be performed, she must present her arguments before the competent ordinary courts, since such a disagreement constitutes a matter of ordinary legality (legalidad ordinaria) that exceeds the summary nature of this amparo proceeding.
Consequently, the appeal is dismissed.
I have supported the position of this Court that when a party alleges a violation of the right to prompt and effective justice in administrative proceedings, the appropriate forum to hear the legal dispute is the Tribunales de lo Contencioso-Administrativo and not this Sala. However, with the recent enactment of Law no. 9097, Ley de Regulación del Derecho de Petición, it has been established that this right is subject to judicial protection by means of the writ of amparo provided for in Article 32 of the Ley de la Jurisdicción Constitucional, in relation to Article 27 of the Constitution of the Republic of Costa Rica, in those cases in which the petitioner considers that the material actions of the Administration, its administrative acts, or its response are affecting his or her fundamental rights. In my view, the recently enacted legislation does not imply that this Court must modify its jurisprudential line; this Court, pursuant to Article 7 of its Law, has the exclusive power to define its own jurisdiction.
Therefore, except for those constitutional and legal disputes that this very Sala has recognized as exceptions and that are properly heard in this jurisdiction through the constitutional amparo proceeding, in all other cases, and for the reasons given by this Court (ruling N° 2008-02545 issued at 8:55 a.m. on February 22, 2008), the competent courts are the Tribunales de lo Contencioso-Administrativo, all of which is consistent with Article 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and norms), and the corresponding legal provisions, based on a logical, systemic, and teleological interpretation of the legal system.
As a general principle, I consider that cases related to the inaction of the Public Administration in the repair, construction, modification, or demolition of any infrastructure works should be dismissed, since such omission constitutes a matter of legality whose discussion belongs to the ordinary jurisdiction, before which the interested party may argue its objections more extensively. However, when such administrative omission entails a violation of other fundamental rights protected in this constitutional jurisdiction, or when vulnerable groups are affected, I do proceed to rule on the merits, as this situation constitutes an exception to my general position on this matter, as is the case here, in which it is claimed that the respondent authorities have not carried out the works necessary to alleviate the flooding of the Cañas River, thereby placing the petitioner's property and family at risk.
The parties are hereby warned that if any document in paper form has been submitted, as well as any objects or evidence contained in any electronic, computer, magnetic, optical, telematic, or technology-produced device, these must be retrieved from the Court within a maximum period of 30 business days counted from the notification of this judgment. It is hereby noted that any such material not retrieved within this period will be destroyed, in accordance with the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena in Article XXVI of session no. 27-11 of August 22, 2011, published in the Boletín Judicial no. 19 of January 26, 2012, as well as pursuant to the agreement of the Consejo Superior del Poder Judicial, approved in Article LXXXI of session no. 43-12 held on May 3, 2012.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del diecinueve de junio de dos mil veintiseis .
Recurso de amparo que se tramita en expediente nro. 26-013203- 0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra la MUNICIPALIDAD DE DESAMPARADOS.
Resultando:
Redacta el Magistrado Rueda Leal; y,
Considerando:
En vista de que el jefe del Departamento de Infraestructura Vial y Obras Públicas de la Municipalidad de Desamparados omitió rendir el informe dentro del plazo fijado por este Tribunal en la resolución de curso del sub lite, se procede a resolver el recurso de acuerdo con el artículo 45 de la Ley de la Jurisdicción Constitucional y tomando en consideración los elementos probatorios que constan en los autos.
Debe aclararse que, a partir del voto nro. 2008-002545 de las 8:55 horas de 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso-administrativa con algunas excepciones - aquellos asuntos en los que se discute si la autoridad pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, a fin de resolver por acto final un procedimiento administrativo - incoado de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes. Precisamente, en este recurso se plantea un supuesto de excepción pues se está ante una gestión relacionada con presuntas situaciones de riesgo para la accionante y su familia, que se alega no ha sido atendida dentro de un plazo razonable. En virtud de lo anterior, la Sala entrará a resolver el recurso.
La recurrente explica que desde el 2022, su propiedad ha sido afectada por los desbordamientos del río Cañas. Esgrime que, si bien la municipalidad recurrida ha realizado algunos trabajos, estos solo han beneficiado a algunos inmuebles colindantes, pero no a su propiedad. Acusa que al momento de interposición del recurso no se ha solucionado el problema que afecta y pone en riesgo a su inmueble y familia.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
En el sub lite, la recurrente explica que desde el 2022, su propiedad ha sido afectada por los desbordamientos del río Cañas. Esgrime que, si bien la municipalidad recurrida ha realizado algunos trabajos, estos solo han beneficiado a algunos inmuebles colindantes, pero no a su propiedad. Acusa que al momento de interposición del recurso no se ha solucionado el problema que afecta y pone en riesgo a su inmueble y familia.
Del estudio de los autos se tiene por demostrado, que, el 9 de diciembre de 2025, la amparada se reunió con la alcaldesa y un funcionario del Área de Infraestructura de la Municipalidad de Desamparados. En tal reunión se le explicó a la tutelada que se realizarían trabajos en el cauce del río y que posteriormente se procedería con la limpieza del sector. En fecha exacta indeterminada, pero entre el 9 de diciembre de 2025 y el 6 de febrero de 2026, la municipalidad recurrida efectuó trabajos de “remoción y redistribución del material sedimentario acumulado en la parte central del cauce, utilizando el mismo material existente dentro del lecho para favorecer el encauzamiento del flujo hacia la zona central del río y reducir la incidencia directa del agua sobre los bordes laterales. Como parte de la intervención ejecutada, se realizó la conformación de una protección tipo enrocado utilizando material natural de lecho, con el objetivo de disipar parcialmente la energía hidráulica del río durante eventos de crecida, disminuir el impacto directo de la corriente sobre el talud expuesto, reducir procesos de socavación y erosión lateral presentes sobre la margen izquierda, así como generar una elevación y conformación del borde intervenido, constituyendo una barrera lateral de protección orientada a disminuir el riesgo de afectación hacia las propiedades colindantes.”.
El 6 de febrero de 2026, la autoridad recurrida le comunicó a la amparada que se había finalizado la ejecución de las obras y que se procedería con la contratación para el ingreso de maquinaría para limpieza en el cauce del río. El 16 de marzo de 2026, la municipalidad accionada efectuó labores en el río mediante una maquinaria tipo excavadora. Las autoridades recurridas fueron notificadas de la resolución de curso de este proceso el 21 y 22 de mayo de 2026. En el informe nro.AM-IF-152-2026 de 25 de mayo de 2026, el coordinador del Área de Infraestructura de la municipalidad recurrida detalló: “Las intervenciones implementadas responden exclusivamente a criterios técnicos de mitigación del riesgo, protección hidráulica y mejoramiento de la capacidad de conducción del cauce, particularmente en sectores históricamente afectados por estrechamientos, sedimentación y procesos erosivos. En consecuencia, no es cierto lo afirmado por la recurrente respecto a que dichas obras hayan sido ejecutadas para proteger propiedades privadas específicas o terrenos particulares colindantes.
Las obras nunca fueron concebidas ni desarrolladas con fines privados, sino como proyectos integrales de interés público orientados a mejorar el comportamiento hidráulico del río y reducir riesgos asociados a inundaciones y afectaciones aguas abajo (…)”. (Prueba documental).
Desde este panorama, prima facie se descarta alguna situación que en este momento amerite la intervención de esta jurisdicción constitucional.

En ese tanto, se observa que, entre esa fecha y el 6 de febrero de 2026, el gobierno local accionado efectuó distintas obras, como la “remoción y redistribución del material sedimentario acumulado en la parte central del cauce, utilizando el mismo material existente dentro del lecho para favorecer el encauzamiento del flujo hacia la zona central del río y reducir la incidencia directa del agua sobre los bordes laterales”; asimismo, “se realizó la conformación de una protección tipo enrocado utilizando material natural de lecho, con el objetivo de disipar parcialmente la energía hidráulica del río durante eventos de crecida, disminuir el impacto directo de la corriente sobre el talud expuesto, reducir procesos de socavación y erosión lateral presentes sobre la margen izquierda, así como generar una elevación y conformación del borde intervenido, constituyendo una barrera lateral de protección orientada a disminuir el riesgo de afectación hacia las propiedades colindantes.”.
Posteriormente, el 16 de marzo del año en curso se iniciaron labores de limpieza en el río. De modo que no es posible desprender que la autoridad accionada haya desatendido la problemática acusada, pues como se explicó bajo juramento, se han realizado las labores necesarias para mitigar las afectaciones de marras.
Aunado a lo anterior, la municipalidad recurrida explica que, contrario a lo aducido por la accionante, los trabajos en cuestión no pretendieron favorecer particularmente a ninguna propiedad. En tal sentido, en el oficio nro. AM-IF-152-2026 de 25 de mayo de 2026, el coordinador del Área de Infraestructura detalló: “Las intervenciones implementadas responden exclusivamente a criterios técnicos de mitigación del riesgo, protección hidráulica y mejoramiento de la capacidad de conducción del cauce, particularmente en sectores históricamente afectados por estrechamientos, sedimentación y procesos erosivos. En consecuencia, no es cierto lo afirmado por la recurrente respecto a que dichas obras hayan sido ejecutadas para proteger propiedades privadas específicas o terrenos particulares colindantes. Las obras nunca fueron concebidas ni desarrolladas con fines privados, sino como proyectos integrales de interés público orientados a mejorar el comportamiento hidráulico del río y reducir riesgos asociados a inundaciones y afectaciones aguas abajo.”. Ergo, no se verifica ninguna irregularidad en los términos referidos por la petente.
Ahora bien, cabe advertir que, si la accionante se encuentra inconforme con las obras realizadas, o si estima que deben efectuarse trabajos distintos, deberá formular sus alegatos ante las instancias comunes competentes, pues tal discrepancia constituye un conflicto de legalidad ordinaria que excede la naturaleza sumaria de este proceso de amparo.
En consecuencia, se declara sin lugar el recurso.
He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia.
Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.
En tesis de principio, considero que los casos relacionados con la inactividad de la Administración Pública en la reparación, construcción, modificación o demolición de cualquier obra de infraestructura, deben ser desestimados, por constituir, esa omisión, un tema de legalidad, cuya discusión corresponde a la jurisdicción ordinaria, ante la cual la persona interesada puede debatir, con mayor amplitud, sus disconformidades. Sin embargo, cuando de aquella conducta administrativa omisiva se derive alguna violación a otros derechos fundamentales tutelados en esta jurisdicción constitucional, o se afecten grupos considerados vulnerables, sí entro a conocer el fondo del asunto, por constituir esta situación una excepción a mi posición en esta materia, tal y como sucede en este caso, en que se reclama, que las autoridades recurridas no han realizado los trabajos necesarios para paliar los desbordamientos del río Cañas, por lo que se pone en riesgo a su inmueble y familia.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidos en algún dispositivo de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en el plazo máximo de 30 días hábiles contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo aquel material no retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 del 22 de agosto de 2011, publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012, así como en el acuerdo de Consejo Superior del Poder Judicial, aprobado en el artículo LXXXI de la sesión nro. 43-12 celebrada el 3 de mayo de 2012.
Por tanto:
Se declara sin lugar el recurso. El magistrado Castillo Víquez consigna nota. El magistrado Salazar Alvarado consigna nota.
