CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours and thirty minutes on the nineteenth of June of two thousand twenty-six.
Writ of amparo (recurso de amparo) filed under case number 26-012386-0007-CO, brought by Nombre01, national identity card (cédula de identidad) CED01, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
Recitals:
"…
FIRST: IT IS NOT TRUE that the community of Montaña Grande has a drinking water supply problem. Engineer Jorge Isaac Alfaro Carmona, UEN Gestión de Acueductos Rurales, of the Regional Office of Community Water Systems (Oficina Regional de Acueductos Comunales, ORAC), Pacific Central Region, through official communication No. GSD-UEN-GAR-2026-02472, dated June 4, 2026, titled Technical-Administrative Report in Response to Writ of Amparo No. 26-012386-0007-CO, states:
'Fact One. IT IS NOT TRUE. Regarding what the petitioner asserts, that: "Since December 2021, the community of Montaña Grande has faced a sustained deprivation of effective access to drinking water, a situation that remains without a real solution as of today." This point requires a fundamental technical clarification. The community of Montaña Grande has a supply system called the Acueducto Montaña Grande e Isla Venado, operated by the ASADA of Montaña Grande, which is duly formalized through a delegation agreement (convenio de delegación) with AyA and is currently in operation. The supply problem referred to by the petitioner does not affect the community of Montaña Grande as a whole, but specifically the sector known as "La Noguera," which does not form part of the service area (área de prestación de servicio) of the system administered by the ASADA of Montaña Grande, and whose supply is provided informally from a water source located on private property, without a water-use concession (concesión de aprovechamiento) granted by any authorized authority.
Therefore, it is not true that the entirety of the community of Montaña Grande is deprived of access to drinking water.' (emphasis in original) SECOND: IT IS NOT TRUE that a formal aqueduct associated with the "La Noguera" source has ever existed. In this regard, Engineer Jorge Isaac Alfaro Carmona, in official communication No. GSD-UEN-GAR-2026-02472, dated June 4, 2026, titled Technical-Administrative Report in Response to Writ of Amparo No. 26-012386-0007-CO, states:
'Fact Two. IT IS NOT TRUE. With respect to what the petitioner asserts, that: "Historically, the community was supplied through the source known as 'La Noguera' (an old communal intake with more than 35 years of use), which was de facto abandoned more than 12 years ago when the El Paraíso Aqueduct was inaugurated by the competent authorities, allowing a private individual to exercise undue material control over the water resource at La Noguera." This Regional Office has no documentation on record attesting to the existence of a formal, duly concession-granted communal aqueduct associated with the "La Noguera" source, nor the existence of a current or past delegation agreement between AyA and any operating entity for said system. A review of the systems registry available at this ORAC does not reflect that the so-called "Acueducto La Noguera" was ever at any time a system formalized under AyA's oversight.
Regarding the claim that "the competent authorities" de facto allowed private control of the source, this Office has no record of such. As of today, the source known as "La Noguera" is located within a private property and does not appear to be registered with any water-use concession.' (bold not in original) THIRD: IT IS NOT TRUE that the alleged neighbor disputes were caused by AyA's failure to intervene. On this matter, Engineer Jorge Isaac Alfaro Carmona, in official communication No. GSD-UEN-GAR-2026-02472, dated June 4, 2026, titled Technical-Administrative Report in Response to Writ of Amparo No. 26-012386-0007-CO, states:
'Fact Three. IT IS NOT TRUE. Regarding the fact that: "This private individual has imposed access conditions, generating arbitrary restrictions, neighbor disputes, and even situations of intimidation that have come before the Courts of Justice, creating a risk scenario for community integrity and coexistence, all of this with the knowledge of the ASADA and without effective State intervention." Matters related to interpersonal conflicts, situations of intimidation, and judicial proceedings between neighbors fall outside the scope of the technical-administrative competence of this Regional Office. Regarding the claim that the State has not intervened effectively, it is noted that AyA, through this ORAC, exercises oversight and technical support authority over aqueduct systems operated by duly constituted ASADAs with a current delegation agreement. The so-called "La Noguera" aqueduct does not meet these conditions, which is why it does not fall within the scope of direct supervision of this Office.
The regulation of the use and exploitation of water, as well as action against improper use by private individuals, falls under the jurisdiction of the Department of Water of MINAE, the entity with authority over water concessions and exploitation pursuant to the Ley de Aguas N° 276.' (emphasis not in original) FOURTH: IT IS NOT TRUE that the "La Noguera" sector is served by the ASADA of Montaña Grande. In this regard, Engineer Jorge Isaac Alfaro Carmona, in official communication No. GSD-UEN-GAR-2026-02472, dated June 4, 2026, titled Technical-Administrative Report in Response to Writ of Amparo No. 26-012386-0007-CO, states:
'Fact Four. IT IS NOT TRUE. Regarding the claim that: "The ASADA of Montaña Grande, despite having full knowledge of the problem, has acted with inaction and unjustified tolerance; has not guaranteed equitable access to the resource; and has permitted the consolidation of a de facto appropriation of a public domain asset." As noted above, the ASADA of Montaña Grande operates the system known as the Acueducto Montaña Grande e Isla Venado, whose service area and distribution network do not include the La Noguera sector. The obligations of an ASADA, pursuant to the Reglamento de Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales (Decreto N° 32529-S-MINAE) and its delegation agreement, are limited to the system that has been delegated to it and the previously defined service area. Accordingly, it is not legally enforceable against the ASADA of Montaña Grande to guarantee supply in a sector that does not form part of its delegated system, nor to intervene regarding a source located on third-party private property over which it holds no concession title or operational responsibility.
The allegation of "inaction and unjustified tolerance" is not applicable when the ASADA lacks the legal authority to act with respect to said private and informal system.' (emphasis in original) FIFTH: IT IS NOT TRUE that the Instituto Costarricense de Acueductos y Alcantarillados has incurred a structural omission with respect to oversight of the ASADA of Montaña Grande e Isla Venado. On this matter, Engineer Jorge Isaac Alfaro Carmona, in official communication No. GSD-UEN-GAR-2026-02472, dated June 4, 2026, titled Technical-Administrative Report in Response to Writ of Amparo No. 26-012386-0007-CO, states:
'Fact Five. IT IS NOT TRUE. Regarding what the petitioner asserts, that: "The Instituto Costarricense de Acueductos y Alcantarillados, as the governing body, has incurred a structural omission by failing to exercise its powers of direction, oversight, or intervention over the ASADA, despite the seriousness of the facts." This ORAC continuously carries out its oversight and technical support duties with respect to the ASADA of Montaña Grande within the framework of the current delegation agreement. The so-called "La Noguera" system does not form part of the delegated system or the service area of said ASADA; therefore, AyA's direction and oversight powers over the ASADA do not extend to this informal system. Nonetheless, far from incurring an omission, AyA has activated the specific institutional mechanism for this type of situation: the Technical Unit for Drinking Water Supply and Sanitation Services (Unidad Técnica de los Servicios de Abastecimiento de Agua Potable y de Saneamiento), which is the competent body to evaluate systems operating outside the formal delegation framework and to define the corresponding course of action.
This ORAC has already referred the case to said Technical Unit so that it may conduct a comprehensive analysis and establish the actions to be taken. Consequently, there is no structural omission on the part of AyA, but rather an institutional response properly channeled in accordance with the internal distribution of competences.' (emphasis not in original) SIXTH: IT IS NOT TRUE that it is technically feasible to interconnect the La Noguera sector with the "El Paraíso" system. In this regard, Engineer Jorge Isaac Alfaro Carmona, in official communication No. GSD-UEN-GAR-2026-02472, dated June 4, 2026, titled Technical-Administrative Report in Response to Writ of Amparo No. 26-012386-0007-CO, states:
'Fact Six. IT IS NOT TRUE. Regarding what the petitioner asserts, that: "There is also functional infrastructure at the intake known as 'El Paraíso,' with significant investment, which technically allows for the supply of the community through the extension of approximately 1.5 km of piping." The "El Paraíso" intake corresponds to the source of capture of the system currently operated by the ASADA of Montaña Grande. From a technical standpoint, the extension of the distribution network to the La Noguera sector cannot be considered viable based solely on the statement of an approximate distance; instead, it requires a detailed hydraulic analysis. The supply problem in that sector does not stem from a lack of available water in the ASADA's system, but from a hydraulic constraint: the piezometric level (nivel piezométrico) provided by the ASADA of Montaña Grande's storage tank is insufficient to guarantee minimum service pressures in the La Noguera sector, given the topographic conditions of the terrain…' (emphasis not in original).
SEVENTH: IT IS NOT TRUE that there has been discriminatory and arbitrary treatment against the La Noguera sector on the part of AyA. In this regard, Engineer Jorge Isaac Alfaro Carmona, in official communication No. GSD-UEN-GAR-2026-02472, dated June 4, 2026, titled Technical-Administrative Report in Response to Writ of Amparo No. 26-012386-0007-CO, states:
'Fact Seven. IT IS NOT TRUE. What the petitioner claims, that: "Notwithstanding the foregoing, the ASADA has unjustifiably refused to carry out said solution, while it does develop projects to supply communities outside the original scope of the Agreement known as 'Acueducto Montaña Grande e Isla Venado,' evidencing arbitrary and discriminatory conduct contrary to the public interest." The ASADA's refusal to carry out the network extension toward the La Noguera sector is not based on reasons of arbitrariness or discrimination, but on concrete technical and hydraulic limitations and the financial impossibility of unilaterally undertaking a project of that nature, as has been explained.
Regarding the claim that the ASADA develops projects to supply communities outside the original scope of its agreement, this is indeed the case and has been carried out with AyA's support; however, this conduct does not in any way evidence arbitrary or discriminatory behavior. The case in question corresponds to the community of La Ilusión, which faced a similar topographic elevation constraint that prevented supply from the ASADA's main system. In that case, the solution will be possible because the community actively organized itself, the landowner on whose property the spring (naciente) is located donated both that lot and an additional lot for the construction of a tank, and the community itself covered the cost of a comprehensive technical study. Said study was reviewed and approved by this ORAC and is currently in the process of seeking financing from INDER, which requires precisely that technical and legal framework to be in order as a prerequisite for investing its funds.
This same possibility has been presented to the community of the La Noguera sector, which has expressed opposition to the proposal. The foregoing demonstrates that the ASADA and AyA have applied the same criteria uniformly in technically similar situations, conditioning the advancement of projects on community organization, land management, and the preparation of technical studies as indispensable requirements for accessing external financing. Consequently, the difference in outcomes is not due to discrimination or arbitrariness on the part of the ASADA, but to the decision of the affected community itself not to follow the institutional route that has proven viable under comparable technical conditions.' (emphasis in original).
The Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales (ASADAs), Decreto Ejecutivo No. 42582-S-MINAE, establishes:
"Article 40.- Service area (Zona de competencia). The service area of the ASADA shall be determined by the respective delegation agreement, and said scope shall be defined based on technical capacity, system growth, social viability, and availability of the water resource, with these criteria prevailing in all cases..." Regarding the specific case of the sector known as "La Noguera," it is reiterated that Engineer Jorge Isaac Alfaro Carmona, ORAC Pacífico Central, through technical report No. GSD-UEN-GAR-2026-02472 cited above, states:
"… Regarding the claim that the ASADA develops projects to supply communities outside the original scope of its agreement, this is indeed the case and has been carried out with AyA's support; however, this conduct does not in any way evidence arbitrary or discriminatory behavior. The case in question corresponds to the community of La Ilusión, which faced a similar topographic elevation constraint that prevented supply from the ASADA's main system. In that case, the solution will be possible because the community actively organized itself, the landowner on whose property the spring is located donated both that lot and an additional lot for the construction of a tank, and the community itself covered the cost of a comprehensive technical study. (emphasis in original) The foregoing in accordance with the Reglamento para la prestación de servicios de AyA, Acuerdo de Junta Directiva No. 2020-442, published in the Diario Oficial La Gaceta No. 27, Alcance No. 29, of February 9, 2021, which establishes:
"Article 14.- Conditions for the provision of services. AyA shall provide its services once technical feasibility has been verified in built or planned structures dedicated to residential use or to commercial or industrial activities that meet the requirements and authorized uses set forth in this Regulation.
Drinking water and sanitation services shall be provided by AyA on public roads or rights-of-way, or on pipeline and access easements (servidumbres de tubería y de paso) registered in favor of AyA or registered in favor of third parties, as applicable pursuant to Article 16 of this Regulation. The foregoing applies only where AyA networks are in operation.
If the public network does not reach the connection point, AyA shall, within a period not exceeding 15 days, propose to the owner or occupant the construction of a branch-line extension or other components of the hydraulic system, in observance of the requirements detailed by AyA in Article 39 of this Regulation by means of the respective technical study…".
The respondent requests that the writ of amparo be dismissed.
Opinion drafted by Justice Salazar Nombre02; and,
Considering:
According to the certification on file, the General Manager of the Instituto Costarricense de Acueductos y Alcantarillados did not file any written submission or document in order to provide the report requested in the resolution of fifteen hours and thirty-eight minutes of April twenty-ninth, two thousand twenty-six. Pursuant to Article 45 of the Ley de la Jurisdicción Constitucional, if the report required from the respondent party is not submitted within the period granted for such purpose, as occurred in the present case, the alleged facts shall be deemed true and the writ of amparo shall be resolved without further proceedings. However, this circumstance alone is not sufficient grounds for the automatic granting of the writ, as the merits of the amparo must still be examined based on the arguments raised and the other evidentiary elements in the record.
II.Subject of the writ of amparo. In this matter, the petitioner turns to the constitutional jurisdiction for the purpose of protecting the fundamental rights to drinking water, health, housing, and human dignity of the inhabitants of the sector known as "La Noguera," belonging to the community of Montaña Grande. In essence, the petitioner directs his claim against the Instituto Costarricense de Acueductos y Alcantarillados (AyA), alleging a structural omission and inaction on the part of said governing body for failing to exercise its oversight, direction, or intervention powers over the ASADA of Montaña Grande.
III.Proven facts. The following facts, relevant to the resolution of this matter, are deemed duly established, either because they have been substantiated in the record or because the respondent failed to address them as required in the initial order:
This Constitutional Tribunal has addressed this issue as follows:
"In this manner, this character as a fundamental right does not imply unrestricted access to water services, as the administration may validly establish general requirements that each applicant must fulfil in order to have their particular need assessed; thus, it is recognized that the granting of new water service allocations (pajas de agua) may be limited for the purpose of ensuring the continuity of the public service of drinking water supply to current users and residences receiving said service — see judgments Nos. 2007-17475, of eleven hours and five minutes of November thirtieth, two thousand seven, and 2008-11390, of eleven hours and twenty-nine minutes of July twenty-second, two thousand eight —.
In this regard, in judgment No. 2006-1898, of nine hours and fifty-three minutes of February seventeenth, two thousand six — reaffirmed, among others, by judgment No. 2007-13310, of ten hours and fifty-seven minutes of September fourteenth, two thousand seven — the Chamber held that: 'The petitioner alleges (…) that despite the requests and efforts made, the respondent Institute has refused to provide drinking water service, claiming that the area is a squatter settlement and that its inhabitants do not have a subdivision survey plan (plano de segregación) establishing that they are owners of the properties. In this regard, it is established in the record, based on the sworn report submitted by the respondent authority, that there is an impossibility of installing domestic drinking water services in the community where the petitioner resides for two specific reasons: the lack of adequate infrastructure and the failure of those concerned to submit applications in compliance with the legal requirements (…).
This Chamber, in judgment No. 2004-12185 of 13:31 hours of October 29, 2004, in a case similar to this one, held that it was not possible to compel the Instituto Costarricense de Acueductos y Alcantarillados to circumvent the provisions of its Reglamento de Prestación de Servicios a los Clientes or the Ley General de Agua Potable. Therefore, to the extent that the petitioner does not meet the conditions and requirements set forth therein, although drinking water service must be accessible to every person as it is an essential service, it cannot be provided on a regular basis. Given the existence of these two objective grounds for which it is not possible to provide the petitioner with regular drinking water service — failure to meet the requirements for a new service connection, beginning with the submission of the application and the existence of adequate infrastructure in the area — there is no reason to conclude that the respondent Institute's refusal to provide regular service is due to the fact that the petitioner and his neighbors lack title deeds to the properties they occupy.
It should further be noted that, pursuant to Article 33 of the aforementioned Regulation, the lack of a title deed does not appear to be an obstacle to applying for a new drinking water service connection, provided that the requirements set forth in that provision are met. In any event, it has also been established that, although regular drinking water service has not been provided, the petitioner and other neighbors have access to a public source that the Institute installed so that they may supply themselves for their basic needs. This Tribunal therefore considers that it has been the petitioner's own omission, and that of the neighbors in the community — who have not shown that they have submitted applications for the installation of a new drinking water service in the community where they reside — that has prevented their situation from being assessed in order to determine whether, particularly by meeting the requirements of Article 33 of the Reglamento de Prestación de Servicios a los Clientes, the infrastructure limitations can be overcome in their case and they can be provided with regular drinking water service.' It is therefore understood that, while a fundamental right to water exists that may be enforced against the competent administration, the provision of the service may well be conditioned on compliance with the established requirements for its granting and on the material feasibility of supply — that is, the absence of technical circumstances that prevent or advise against the administration providing drinking water service.
This in turn means that the administration is not obligated to provide drinking water service when there are technical grounds that advise against or prevent it, and the administration must adequately inform the applicant of the reasons why the request cannot be addressed…". (Judgment No. 2009-009936 of fourteen hours and eight minutes of June nineteenth, two thousand nine).
V.On the merits. This Chamber has developed solid and extensive case law regarding access to drinking water as a fundamental human right, derived directly from the rights to health, life, and environmental well-being established in Articles 21 and 50 of the Constitución Política. Nevertheless, the exercise of this right is neither unrestricted nor detached from the technical, budgetary, and geographic realities of distribution systems.
Regarding the provision of water services through Community Aqueduct and Sewerage System Administrative Associations (Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales, ASADAS), the Costa Rican legal framework—particularly Decreto Ejecutivo No. 42582-S-MINAE (Reglamento de las ASADAS)—stipulates in its article 40 that the territorial jurisdiction (zona de competencia) of an ASADA is strictly delimited in the corresponding delegation agreement (convenio de delegación). This spatial scope is determined based on criteria of technical capacity, social viability, and actual availability of the resource.
In the present case, the technical reports of AyA confirm that the ASADA of Montaña Grande lacks territorial, operational, and legal jurisdiction over the "La Noguera" sector, as it is an informal settlement (asentamiento informal) located outside the authorized distribution network (red de distribución). Consequently, it is not legally viable to impute an "arbitrary omission" or "inaction" to that community organization, since ASADAS do not hold mandatory sovereign powers (potestades de imperio imperativas) nor the legal obligation to intervene in water sources located on private properties that have not been formally entrusted to them or granted in concession (concesión) by MINAE.
VI.Absence of Discrimination and Respect for the Principle of Technical Legality. The petitioner (recurrente) argues that there is flagrant discrimination in comparison with the development of projects in other localities outside the original delegation agreement, such as the "La Ilusión" sector. In this regard, the constitutional analysis of the equality principle requires verifying that identical factual situations receive identical treatment. However, from the sworn report submitted by the General Manager of AyA—which enjoys a presumption of truthfulness (presunción de veracidad) pursuant to article 44 of the Ley de la Jurisdicción Constitucional—it follows that the two scenarios are neither factually nor legally equivalent.
The development of the project in the "La Ilusión" community was the direct result of compliance with unavoidable technical and legal requirements: the active organization of the community, the formal donation of land for the catchment (captación) and storage of the resource, the financing of the corresponding technical studies, and the consequent approval of funding by the Instituto de Desarrollo Rural (INDER). In contrast, the record shows that when the governing body put forward the same proposal to the residents of the "La Noguera" sector, they openly opposed following the described institutional process.
The Costa Rican legal framework, through the Reglamento para la Prestación de Servicios del AyA (Board Resolution N° 2020-442), requires in its article 14 the mandatory verification of technical and hydraulic feasibility (factibilidad técnica e hidráulica) prior to granting connections and network extensions. This Constitutional Court is not a technical co-administration body empowered to overturn the piezometric and topographic engineering (ingeniería piezométrica y topográfica) criteria issued by the specialized State body. If ORAC's studies determine that interconnection with the "El Paraíso" water intake (toma) would generate supply shortages (desabastecimiento) or unsustainable pressure losses in the system, the ASADA's denial is not arbitrary but rather responds to criteria of prudence and technical legality aimed at safeguarding the overall stability of the public service (servicio público).
VII.Conclusion. Although the existence of the structural omissions or discriminatory conduct attributed to AyA and the respective ASADA is ruled out, this Court is not indifferent to the water access problem suffered by the residents of "La Noguera." Nevertheless, it is established that the Instituto Costarricense de Acueductos y Alcantarillados has moved to address the situation through its competent channels by referring the case file (expediente) to the Technical Unit for Drinking Water Supply and Sanitation Services, the internal body responsible for regularizing informal systems operating outside the delegation agreements. Likewise, disputes arising from the physical control of the water source by a private third party on private property, as well as complaints of threats or intimidation, must be resolved before the Dirección de Aguas of MINAE (under the terms of the Ley de Aguas N° 276) and before the ordinary courts in criminal or civil matters, as applicable, since such matters exceed the strictly constitutional scope of these proceedings.
For these reasons, having verified that the authorities named in the appeal have acted within the parameters of legality, technical reasonableness, and the appropriate regulatory framework for public services, the appeal (recurso) is found to be without merit and must be dismissed.
Article 21 of the Constitución Política protects human life, and this Court has recognized that access to water for human consumption is a material prerequisite of that right. Likewise, article 50 of the Constitution imposes on the State the duty to guarantee the well-being of all inhabitants, which necessarily includes effective, sufficient, and continuous access to drinking water (agua potable). In the international sphere, instruments such as the International Covenant on Economic, Social and Cultural Rights—interpreted by the Committee on Economic, Social and Cultural Rights (Comité DESC) in its General Comment (Observación General) No. 15—recognize the human right to water, obligating States to adopt positive measures for its full realization. The State bears an enhanced obligation in a social and democratic state governed by law (estado social y democrático de derecho); for this reason, the supply of water is a priority obligation of public authorities.
The provider of a public service cannot limit itself to identifying shortcomings in the system; it has the legal duty to plan, anticipate, and execute the necessary actions to progressively guarantee access to the water service, especially when it concerns human consumption.
This is not about demanding the impossible, but about requiring the adoption of reasonable, alternative, or progressive measures so as not to leave people without protection.
Water is not an ordinary service—it is an essential human right; therefore, the entity named in the appeal cannot shirk its duty to guarantee it by hiding behind technical limitations without offering effective solutions.
For these reasons, it must be underscored that the respondent entities must, through a comprehensive approach to the informal system, define a solution to the problem within a reasonable timeframe. Water is a fundamental asset and right whose effective enjoyment must be ensured—this is an inescapable duty.
The parties are hereby notified that any paper documents, as well as objects or evidence contained in any additional electronic, computer-based, magnetic, optical, telematic, or new-technology device that may have been submitted, must be retrieved from the court office (despacho) within a maximum period of thirty business days counted from the notification of this Judgment (Sentencia). Otherwise, all material not retrieved within this period will be destroyed, pursuant to the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Corte Plena at Session N° 27-11 of August 22, 2011, article XXVI, and published in the Boletín Judicial N° 19 of January 26, 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at Session N° 43-12, held on May 3, 2012, article LXXXI.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del diecinueve de junio de dos mil veintiseis .
Recurso de amparo que se tramita en expediente número 26-012386-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
Resultando:
“…
PRIMERO: NO ES CIERTO que la comunidad de Montaña Grande cuente con un problema de desabastecimiento de agua para consumo humano, el Ing. Jorge Isaac Alfaro Carmona, UEN Gestión de Acueductos Rurales, de la Oficina Regional de Acueductos Comunales (ORAC), Región Pacífico Central, mediante oficio No. GSD-UEN-GAR-2026-02472, de fecha 04 de junio del 2026, denominado Informe Técnico-Administrativo en respuesta al Recurso de Amparo No. 26-012386-0007-CO, señala:
“Hecho uno. NO ES CIERTO. En cuanto a lo que señala el recurrente, de que: "Desde diciembre del año 2021, la comunidad de Montaña Grande enfrenta una privación sostenida del acceso efectivo al agua potable, situación que se mantiene sin solución real a la fecha." Este extremo requiere una aclaración técnica fundamental. La comunidad de Montaña Grande cuenta con el sistema de abastecimiento denominado Acueducto Montaña Grande e Isla Venado, operado por la ASADA de Montaña Grande, el cual se encuentra debidamente formalizado mediante convenio de delegación con el AyA y se encuentra en operación. La problemática de abastecimiento referida por el recurrente no afecta a la comunidad de Montaña Grande en su conjunto, sino específicamente al sector denominado "La Noguera", el cual no forma parte del área de prestación de servicio del sistema administrado por la ASADA de Montaña Grande, y cuyo abastecimiento se realiza de manera informal a partir de una fuente hídrica ubicada en propiedad privada, sin contar con concesión de aprovechamiento otorgada por ningún ente autorizado.
Por lo que, no es cierto que la totalidad de la comunidad de Montaña Grande se encuentre privada del acceso al agua potable.” (el resaltado es nuestro) SEGUNDO: NO ES CIERTO que haya existido un acueducto formal asociado a la fuente “La Noguera”, en este sentido, el Ing. Jorge Isaac Alfaro Carmona, en el oficio No. GSD-UEN-GAR-2026-02472, de fecha 04 de junio del 2026, denominado Informe Técnico-Administrativo en respuesta al Recurso de Amparo No. 26-012386-0007-CO, indica:
“Hecho dos. NO ES CIERTO. Con respecto a lo que señala el recurrente, de que: "Históricamente, la comunidad se abastecía mediante la fuente denominada 'La Noguera' (antigua toma comunal por más de 35 años de uso), la cual fue abandonada hace más de 12 años cuando se inauguró el Acueducto de El Paraíso, de facto por las autoridades competentes, permitiendo que un particular ejerza control material indebido sobre el recurso hídrico de la Noguera." No consta a esta Oficina Regional documentación que acredite la existencia de un acueducto comunal formal y debidamente concesionado asociado a la fuente "La Noguera", ni tampoco la existencia de un convenio de delegación vigente o anterior entre el AyA y ningún ente operador para dicho sistema. La revisión del registro de sistemas disponible en esta ORAC no refleja que el denominado "Acueducto La Noguera" haya sido en ningún momento un sistema formalizado bajo la tutela del AyA.
Respecto a la afirmación de que "las autoridades competentes" permitieron de facto el control privado de la fuente, este extremo no consta a esta Oficina. A la fecha, la fuente denominada "La Noguera" se localiza dentro de una propiedad privada y no aparece registrada con concesión de aprovechamiento alguna.” (la negrita no corresponde al original) TERCERO: NO ES CIERTO que los supuestos conflictos vecinales hayan sido ocasionados por la no intervención del AyA, sobre este particular el Ing. Jorge Isaac Alfaro Carmona, en el oficio No. GSD-UEN-GAR-2026-02472, de fecha 04 de junio del 2026, denominado Informe Técnico-Administrativo en respuesta al Recurso de Amparo No. 26-012386-0007-CO, afirma:
“Hecho tres. NO ES CIERTO. Sobre el hecho de que: "Este particular ha impuesto condiciones de acceso, generando restricciones arbitrarias, conflictos vecinales e incluso situaciones de intimidación que incluso han estado en los Tribunales de Justicia, configurando un escenario de riesgo para la integridad y convivencia comunitaria, todo ello con conocimiento de la ASADA y sin intervención efectiva del Estado." Lo relacionado con conflictos interpersonales, situaciones de intimidación y procesos judiciales entre vecinos escapa al ámbito de competencia técnico-administrativa de esta Oficina Regional. En cuanto a la afirmación de que el Estado no ha intervenido efectivamente, se indica que el AyA, a través de esta ORAC, ejerce competencia de fiscalización y apoyo técnico sobre los sistemas de acueductos operados por ASADAS debidamente constituidas y con convenio de delegación vigente. El denominado acueducto "La Noguera" no reúne estas condiciones, razón por la cual no se encuadra dentro del ámbito de supervisión directa de esta Oficina.
La regulación del uso y aprovechamiento de aguas, así como la acción ante usos indebidos por parte de particulares, corresponde al Departamento de Aguas del MINAE, ente con competencia en materia de concesiones y aprovechamientos hídricos conforme a la Ley de Aguas N° 276.” (el resaltado no corresponde al original) CUARTO: NO ES CIERTO que el sector de “La Noguera” sea abastecido por la ASADA de Montaña Grande, en este sentido el Ing. Jorge Isaac Alfaro Carmona, en el oficio No. GSD-UEN-GAR-2026-02472, de fecha 04 de junio del 2026, denominado Informe Técnico-Administrativo en respuesta al Recurso de Amparo No. 26-012386-0007-CO, indica:
“Hecho cuatro. NO ES CIERTO. En cuanto a que: "La ASADA de Montaña Grande, pese a conocer plenamente la problemática: ha actuado con inacción y tolerancia injustificada; no ha garantizado acceso equitativo al recurso; ha permitido la consolidación de una apropiación de hecho de un bien de dominio público." Como se indicó supra, la ASADA de Montaña Grande opera el sistema denominado Acueducto Montaña Grande e Isla Venado, cuya área de prestación de servicio y red de distribución no incluye el sector de La Noguera. Las obligaciones de una ASADA, conforme al Reglamento de Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales (Decreto N° 32529-S-MINAE) y a su convenio de delegación, se circunscriben al sistema que le ha sido delegado y al área de servicio previamente definida. En ese sentido, no es jurídicamente exigible a la ASADA de Montaña Grande que garantice el abastecimiento en un sector que no forma parte de su sistema delegado, ni que intervenga sobre una fuente que se encuentra en propiedad privada ajena y sobre la cual no tiene ningún título de concesión ni responsabilidad operativa.
La afirmación de "inacción y tolerancia injustificada" no resulta procedente cuando la ASADA carece de potestad legal para actuar sobre dicho sistema privado e informal.” (el resaltado es nuestro) QUINTO: NO ES CIERTO que el Instituto Costarricense de Acueductos y Alcantarillados haya incurrido en una omisión estructural, en cuanto a la fiscalización de la ASADA de Montaña Grande e Isla Venado, sobre este particular el Ing. Jorge Isaac Alfaro Carmona, en el oficio No. GSD-UEN-GAR-2026-02472, de fecha 04 de junio del 2026, denominado Informe Técnico-Administrativo en respuesta al Recurso de Amparo No. 26-012386-0007-CO, señala:
“Hecho cinco. NO ES CIERTO. Sobre lo que señala el recurrente, de que: "El Instituto Costarricense de Acueductos y Alcantarillados, como ente rector, ha incurrido en una omisión estructural, al no ejercer sus potestades de dirección, fiscalización ni intervención sobre la ASADA, pese a la gravedad de los hechos." Esta ORAC ejerce de manera continua sus labores de fiscalización y acompañamiento técnico a la ASADA de Montaña Grande en el marco del convenio de delegación vigente. El denominado sistema "La Noguera" no forma parte del sistema delegado ni del área de servicio de dicha ASADA, por lo que las potestades de dirección y fiscalización del AyA sobre la ASADA no alcanzan este sistema informal. No obstante, lejos de incurrir en omisión, el AyA ha activado el mecanismo institucional específico para este tipo de situaciones: la Unidad Técnica de los Servicios de Abastecimiento de Agua Potable y de Saneamiento, que es la dependencia competente para valorar sistemas que operan al margen del marco formal de delegación y para definir la ruta de solución correspondiente.
Esta ORAC ya remitió el caso a dicha Unidad Técnica para que sea esta la instancia que lleve a cabo el análisis integral y establezca las acciones a seguir. En consecuencia, no existe omisión estructural por parte del AyA, sino una actuación institucional debidamente encauzada conforme a la distribución interna de competencias.” (el resaltado no corresponde al original) SEXTO: NO ES CIERTO que sea técnicamente factible interconectar el sector de la Noguera con el sistema de “El Paraíso”, en este sentido el Ing. Jorge Isaac Alfaro Carmona, en el oficio No. GSD-UEN-GAR-2026-02472, de fecha 04 de junio del 2026, denominado Informe Técnico-Administrativo en respuesta al Recurso de Amparo No. 26-012386-0007-CO, menciona:
“Hecho seis. NO ES CIERTO. Sobre lo que afirma el recurrente, en cuanto a: "Existe además una infraestructura funcional en la toma denominada 'El Paraíso', con inversiones significativas, la cual permite técnicamente el abastecimiento de la comunidad mediante la extensión de aproximadamente 1,5 km de tubería." La toma "El Paraíso" corresponde a la fuente de captación del sistema que actualmente opera la ASADA de Montaña Grande. Desde el punto de vista técnico, la extensión de la red de distribución hasta el sector de La Noguera no puede considerarse viable por la simple enunciación de una distancia aproximada, sino que requiere un análisis hidráulico detallado. El problema de abastecimiento en dicho sector no radica en una falta de agua disponible en el sistema de la ASADA, sino en una limitante hidráulica: el nivel piezométrico que confiere el tanque de almacenamiento de la ASADA de Montaña Grande resulta insuficiente para garantizar presiones mínimas de servicio en el sector de La Noguera, dadas las condiciones topográficas del terreno…" (el resaltado no corresponde al original).
SÉPTIMO: NO ES CIERTO que haya existido un trato discriminatorio y arbitrario contra el sector de La Noguera de parte del AyA, en este sentido el Ing. Jorge Isaac Alfaro Carmona, en el oficio No. GSD-UEN-GAR-2026-02472, de fecha 04 de junio del 2026, denominado Informe Técnico-Administrativo en respuesta al Recurso de Amparo No. 26-012386-0007-CO, indica:
“Hecho siete. NO ES CIERTO. Lo que afirma el recurrente de que: "No obstante lo anterior, la ASADA se ha negado injustificadamente a ejecutar dicha solución, mientras sí desarrolla proyectos para abastecer comunidades fuera del ámbito original del Convenio llamado 'Acueducto Montaña Grande e Isla Venado', evidenciando un actuar arbitrario, discriminatorio y contrario al interés público." La negativa de la ASADA a ejecutar la extensión de red hacia el sector de La Noguera no se fundamenta en razones de arbitrariedad o discriminación, sino en las limitaciones técnicas e hidráulicas concretas y en la imposibilidad financiera de asumir unilateralmente un proyecto de esa naturaleza, según se ha expuesto.
En cuanto a la afirmación de que la ASADA desarrolla proyectos para abastecer comunidades fuera del ámbito original de su convenio, esto es efectivamente así y ha contado con el acompañamiento del AyA, pero dicho proceder en modo alguno evidencia un actuar arbitrario o discriminatorio. El caso de referencia corresponde a la comunidad de La Ilusión, que enfrentaba una limitante similar de elevación topográfica que impedía el abastecimiento desde el sistema principal de la ASADA. En ese caso, la solución será posible gracias a que la comunidad se organizó activamente, el propietario del terreno donde se ubica la naciente donó tanto ese lote como un lote adicional para la construcción de un tanque, y la propia comunidad sufragó el costo de un estudio técnico integral. Dicho estudio fue revisado y aprobado por esta ORAC y se encuentra en proceso de gestión de financiamiento ante el Instituto de Desarrollo Rural (INDER), que requiere precisamente ese panorama técnico y jurídico en orden como requisito para invertir sus fondos.
Esta misma posibilidad ha sido presentada a la comunidad del sector de La Noguera, la cual ha manifestado oposición a la propuesta. Lo anterior evidencia que la ASADA y el AyA han aplicado el mismo criterio de manera uniforme ante situaciones técnicamente similares, condicionando el avance de los proyectos a la organización comunitaria, la gestión de terrenos y la elaboración de estudios técnicos como requisitos indispensables para acceder a fuentes de financiamiento externo. En consecuencia, la diferencia en los resultados no obedece a discriminación ni arbitrariedad por parte de la ASADA, sino a la decisión de la propia comunidad afectada de no seguir la ruta institucional que ha demostrado ser viable en condiciones técnicas comparables.” (el resaltado corresponde al original).
El Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales (ASADAS), Decreto Ejecutivo No. 42582-S-MINAE, establece:
“Artículo 40.- Zona de competencia. La zona de competencia de la ASADA será determinada por el respectivo convenio de delegación, y dicho ámbito se definirá a partir de la capacidad técnica, crecimiento del sistema, viabilidad social y disponibilidad del recurso hídrico, prevaleciendo estos criterios en todos los casos..." El caso particular del sector denominado “La Noguera”, reiterar que, el Ing. Jorge Isaac Alfaro Carmona, ORAC Pacífico Central, mediante informe técnico No. GSD-UEN-GAR-2026-02472 citado, indica:
“… En cuanto a la afirmación de que la ASADA desarrolla proyectos para abastecer comunidades fuera del ámbito original de su convenio, esto es efectivamente así y ha contado con el acompañamiento del AyA, pero dicho proceder en modo alguno evidencia un actuar arbitrario o discriminatorio. El caso de referencia corresponde a la comunidad de La Ilusión, que enfrentaba una limitante similar de elevación topográfica que impedía el abastecimiento desde el sistema principal de la ASADA. En ese caso, la solución será posible gracias a que la comunidad se organizó activamente, el propietario del terreno donde se ubica la naciente donó tanto ese lote como un lote adicional para la construcción de un tanque, y la propia comunidad sufragó el costo de un estudio técnico integral. Dicho estudio fue revisado y aprobado por esta ORAC y se encuentra en proceso de gestión de financiamiento ante el Instituto de Desarrollo Rural (INDER), que requiere precisamente ese panorama técnico y jurídico en orden como requisito para invertir sus fondos.
Esta misma posibilidad ha sido presentada a la comunidad del sector de La Noguera, la cual ha manifestado oposición a la propuesta. Lo anterior evidencia que la ASADA y el AyA han aplicado el mismo criterio de manera uniforme ante situaciones técnicamente similares, condicionando el avance de los proyectos a la organización comunitaria, la gestión de terrenos y la elaboración de estudios técnicos como requisitos indispensables para acceder a fuentes de financiamiento externo. En consecuencia, la diferencia en los resultados no obedece a discriminación ni arbitrariedad por parte de la ASADA, sino a la decisión de la propia comunidad afectada de no seguir la ruta institucional que ha demostrado ser viable en condiciones técnicas comparables.” (el resaltado es nuestro) Lo anterior de conformidad con el Reglamento para la prestación de servicios de AyA, Acuerdo de Junta Directiva No. 2020-442, publicado en el Diario Oficial La Gaceta No. 27, Alcance No. 29, del 09 de febrero del 2021, el cual establece:
“Artículo 14.- De las condiciones para la prestación de los servicios. AyA prestará sus servicios una vez comprobada la factibilidad técnica en inmuebles construidos o por edificar, dedicados a la residencia de personas, para actividades comerciales o industriales que cumplan con los requisitos y usos autorizados en este Reglamento.
Los servicios de agua potable y de saneamiento los otorgará el AyA sobre calle o vía pública o sobre servidumbre de tubería y de paso inscrita a favor del AyA o inscrita a favor de terceros, según aplique de acuerdo con lo establecido en el artículo 16 de este reglamento. Lo anterior, siempre que existan redes del AyA en funcionamiento.
Si la red pública no alcanza hasta el punto de conexión, el AyA en un plazo que no supere los 15 días propondrá al propietario o poseedor la construcción de una extensión de ramal u otros componentes del sistema hidráulico, en observancia de los requerimientos detallados por AyA en el artículo 39 de este reglamento mediante el estudio técnico respectivo…”.
Solicita que se desestime el recurso planteado.
Redacta el Magistrado Salazar Nombre02; y,
Considerando:
Según constancia agregada al expediente, el gerente general del Instituto Costarricense de Acueductos y Alcantarillados no presentó escrito o documento alguno, a fin de rendir el informe que se le solicitó en la resolución de las quince horas treinta y ocho minutos del veintinueve de abril de dos mil veintiséis. De conformidad con lo dispuesto en el artículo 45, de la Ley de la Jurisdicción Constitucional, si el informe requerido a la parte recurrida no es rendido dentro del plazo conferido a tal efecto, como sucedió en el presente caso, se tendrán por ciertos los hechos y se entrará a resolver el amparo sin más trámite. Sin embargo, dicha situación no es motivo suficiente para la estimatoria automática del recurso, toda vez que se debe entrar a estudiar la procedencia del recurso con base en los alegatos esgrimidos y demás elementos probatorios allegados a los autos.
II.Objeto del recurso. En el presente asunto, el accionante acude a la jurisdicción constitucional con el propósito de tutelar los derechos fundamentales al agua potable, a la salud, a la vivienda y a la dignidad humana de los habitantes del sector denominado "La Noguera", perteneciente a la comunidad de Montaña Grande. En esencia, el recurrente dirige su reclamo contra el Instituto Costarricense de Acueductos y Alcantarillados (AyA), aduciendo una omisión estructural e inacción por parte de dicho ente rector al no ejercer sus potestades de fiscalización, dirección ni intervención sobre la ASADA de Montaña Grande.
III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
Ese Tribunal Constitucional se ha referido sobre este tema en el siguiente sentido:
“De tal forma, este carácter de derecho fundamental no implica un acceso irrestricto a los servicios de agua, ya que la administración válidamente puede establecer requisitos generales de necesario cumplimiento por cada solicitante para valorar su particular requerimiento, por lo que se reconoce la posibilidad de limitar el otorgamiento de nuevas pajas de agua con el propósito de asegurar la continuidad de la prestación del servicio público de suministro de agua potable a los actuales usuarios y domicilios que reciben dicho servicio – ver sentencias números 2007-17475, de las once horas cinco minutos del treinta de noviembre de dos mil siete, y 2008 - 11390, de las once horas veintinueve minutos del veintidós de julio de dos mil ocho –.
En este sentido, en sentencia número 2006-1898, de las nueve horas cincuenta y tres minutos del diecisiete de febrero de dos mil seis – reiterada, entre otras, por sentencia número 2007-13310, de las diez horas cincuenta y siete minutos del catorce de setiembre de dos mil siete – estableció la Sala que: “El recurrente alega (…) que pese a las solicitudes y esfuerzos hechos, el Instituto recurrido se ha negado a brindarles el servicio de agua potable aduciendo que se trata de un precario y que sus habitantes no cuentan con un plano de segregación que establezca que son propietarios de los inmuebles. Al respecto, se encuentra acreditado en autos, con base en el informe rendido bajo juramento por la autoridad recurrida, que existe una imposibilidad para instalar servicios de agua potable domiciliaria en la comunidad que habita el recurrente por dos motivos específicos: la falta de una infraestructura adecuada y de presentación de solicitudes con cumplimiento de requisitos legales por parte de los interesados (...).
Esta Sala, en la sentencia No. 2004-12185 de las 13:31 horas del 29 de octubre del 2004, en un caso similar al presente, señaló que no era posible obligar al Instituto Costarricense de Acueductos y Alcantarillados a eludir lo dispuesto en su Reglamento de Prestación de Servicios a los Clientes ni en la Ley General de Agua Potable. De ahí que, en el tanto el amparado, no reúna las condiciones y requisitos ahí exigidos, aunque el servicio de agua potable debe estar al alcance de toda persona por tratarse de un servicio esencial, no se le puede proveer de manera regular. Dada la existencia de esos dos motivos objetivos por los cuales no es posible suministrar un servicio de agua potable regular al accionante: su falta de cumplimiento de requerimientos para la conexión de un servicio nuevo, empezando, por la presentación de la solicitud y la existencia de una infraestructura adecuada en la zona, no existe motivo alguno para entender que la denegatoria de la prestación del servicio regular por parte del Instituto recurrido se deba al hecho que el amparado y sus vecinos no cuentan con títulos de propiedad sobre los inmuebles que poseen.
A lo anterior cabe agregar que con base en el artículo 33 del Reglamento referido, la falta de un título de propiedad no parece ser un obstáculo para solicitar la conexión de un servicio nuevo de agua potable, en tanto se cumplan los requerimientos que indica esa norma. En todo caso, se encuentra acreditado también que, aunque no se ha suministrado el servicio regular de agua potable, el recurrente y demás vecinos cuentan con fuente pública que el Instituto instaló para que puedan abastecerse, para sus necesidades básicas. De ahí que considere este Tribunal que ha sido la propia omisión del recurrente y de los vecinos de la localidad, quienes no acreditan haber presentado las solicitudes para la instalación de un servicio nuevo de agua potable en la comunidad donde habitan, la que ha impedido que se valore su situación a efectos de determinar si, cumpliendo, sobre todo los requerimientos del artículo 33 del Reglamento de Prestación de Servicios a los Clientes, las limitaciones de infraestructura pueden ser superadas en su caso y se les puede proveer de un servicio regular de agua potable.” Se entiende entonces, que si bien existe un derecho fundamental al agua que puede ser exigido a la administración correspondiente, la prestación del servicio bien puede sujetarse al cumplimiento de los requisitos establecidos para su otorgamiento y a que exista posibilidad material de suministro, esto es, que no existan situaciones técnicas que imposibiliten o desaconsejen a la administración a brindar el servicio de agua potable, situación que determina que la administración carece de la obligación de prestar el servicio de agua potable en caso de existir razones técnicas que lo desaconsejen o imposibiliten, debiendo informar adecuadamente al gestionante las razones por las cuales no puede atenderse su solicitud…”. (Sentencia N° 2009-009936 de las catorce horas y ocho minutos del diecinueve de junio del dos mil nueve).
V.Sobre el fondo. Esta Sala ha desarrollado una sólida y profusa jurisprudencia respecto al acceso al agua potable como un derecho humano fundamental, derivado directo de los derechos a la salud, la vida y el bienestar ambiental establecidos en los numerales 21 y 50, de la Constitución Política. No obstante, el ejercicio de este derecho no es irrestricto ni desvinculado de las realidades técnicas, presupuestarias y geográficas de los sistemas de distribución.
En lo que respecta a la prestación de servicios hídricos por medio de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales (ASADAS), el ordenamiento jurídico costarricense -en especial el Decreto Ejecutivo No. 42582-S-MINAE (Reglamento de las ASADAS)- estipula en su artículo 40, que la zona de competencia de una ASADA se delimita de forma estricta en el respectivo convenio de delegación. Dicho ámbito espacial se determina con base en criterios de capacidad técnica, viabilidad social y disponibilidad real del recurso.
En la especie, se constata de los informes técnicos del AyA que la ASADA de Montaña Grande carece de competencia territorial, operativa y legal sobre el sector de "La Noguera", al ser este un asentamiento informal situado fuera de la red de distribución autorizada. Por consiguiente, no resulta jurídicamente viable reprochar una "omisión arbitraria" o una "inacción" a dicha organización vecinal, por cuanto las ASADAS no ostentan potestades de imperio imperativas ni la obligación legal de intervenir fuentes hídricas enclavadas en propiedades de carácter privado que no les han sido formalmente encomendadas ni otorgadas en concesión por el MINAE.
VI.Inexistencia de discriminación y respeto al principio de legalidad técnica. Sostiene el recurrente que existe una flagrante discriminación en comparación con el desarrollo de proyectos en otras localidades ajenas al convenio originario, como el sector de "La Ilusión". Al respecto, el análisis constitucional del principio de igualdad exige constatar que ante situaciones de hecho idénticas se brinde un trato idéntico. Sin embargo, del informe rendido bajo juramento por el Gerente General del AyA -el cual goza de presunción de veracidad conforme al artículo 44, de la Ley de la Jurisdicción Constitucional- se colige que los escenarios no guardan equivalencia fáctica ni jurídica.
El desarrollo del proyecto en la comunidad "La Ilusión" fue el resultado directo del cumplimiento de requisitos técnico-legales insoslayables: la organización activa de la comunidad, la donación formal de los terrenos para la captación y almacenamiento del recurso, el sufragio de los estudios técnicos correspondientes y la consecuente aprobación de financiamiento por parte del Instituto de Desarrollo Rural (INDER). Por el contrario, consta en autos que ante idéntica propuesta formulada por el ente rector, los habitantes del sector "La Noguera" manifestaron una abierta oposición a seguir la ruta institucional descrita.
El ordenamiento jurídico costarricense, mediante el Reglamento para la Prestación de Servicios del AyA (Acuerdo de Junta Directiva N° 2020-442), exige en su artículo 14 la comprobación obligatoria de la factibilidad técnica e hidráulica de previo al otorgamiento de conexiones y extensiones de red. Este Tribunal Constitucional no es una instancia técnica de coadministración apta para revocar los criterios de ingeniería piezométrica y topográfica emitidos por el órgano especializado del Estado. Si los estudios de la ORAC determinan que la interconexión con la toma "El Paraíso" generaría un desabastecimiento o una carencia de presión insostenible para el sistema, la denegatoria de la ASADA no es arbitraria, sino que responde a criterios de prudencia y legalidad técnica dirigidos a salvaguardar la estabilidad general del servicio público.
VII.Conclusión. Pese a que se descarta la existencia de las omisiones estructurales o conductas discriminatorias reprochadas al AyA y a la ASADA respectiva, esta Sala no es indiferente a la problemática de acceso al agua que padecen los vecinos de "La Noguera". No obstante, se constata que el Instituto Costarricense de Acueductos y Alcantarillados ha procedido a encauzar la situación mediante sus canales competentes, al remitir el expediente ante la Unidad Técnica de los Servicios de Abastecimiento de Agua Potable y de Saneamiento, órgano interno encargado de la normalización de sistemas informales que operan al margen de los convenios de delegación. Asimismo, los conflictos derivados del control material de la fuente hídrica por parte de un tercero particular en propiedad privada y las denuncias por amenazas o intimidación corresponden ser dilucidadas ante la Dirección de Aguas del MINAE (en los términos de la Ley de Aguas N° 276) y ante los Tribunales de Justicia ordinarios en materia penal o civil, según corresponda, al rebasar tales extremos la órbita estrictamente constitucional de este proceso.
Por tales motivos, al comprobarse que las autoridades recurridas han actuado bajo los parámetros de la legalidad, la razonabilidad técnica y el debido marco regulatorio de los servicios públicos, el recurso deviene en infundado, imponiéndose su desestimación.
El artículo 21 de la Constitución Política protege la vida humana, y este Tribunal ha reconocido que el acceso al agua para consumo humano es un presupuesto material de ese derecho. Asimismo, el artículo 50 constitucional impone al Estado el deber de garantizar el bienestar de todos los habitantes, lo cual incluye necesariamente el acceso efectivo, suficiente y continuo al agua potable. En el ámbito internacional, instrumentos como el Pacto Internacional de Derechos Económicos, Sociales y Culturales –interpretado por el Comité DESC en su Observación General No. 15– reconocen el derecho humano al agua, obligando a los Estados a adoptar medidas positivas para su plena realización. Hay una obligación reforzada impuesta al Estado en un estado social y democrático de derecho, por esta razón el suministro de agua, es una obligación prioritaria de los poderes públicos.
El proveedor del servicio público no puede limitarse a constatar insuficiencias del sistema; tiene el deber jurídico de planificar, prever y ejecutar las acciones necesarias para garantizar progresivamente el acceso al servicio al agua, especialmente cuando se trata de consumo humano.
No se trata de obligar a lo imposible, sino de exigir la adopción de medidas razonables, alternativas o progresivas para no dejar en desprotección a las personas.
El agua no es un servicio cualquiera, es un derecho humano esencial, por ello, la entidad accionada no puede desentenderse de su deber de garantizarlo, escudándose en limitaciones técnicas sin ofrecer soluciones efectivas.
Por estas razones, se debe subrayar que las entidades recurridas deben, mediante el abordaje integral del sistema informal, definir una solución al problema, en un plazo razonable. El agua es un bien y un derecho fundamental cuya vigencia debe asegurarse efectivamente, es un deber ineludible.
Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta Sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19, del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12, celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
