CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours and thirty minutes on the nineteenth of June of two thousand twenty-six.
Subsequent motion (gestión posterior) in relation to judgment no. 2026014056 of 09:20 hours on April 21, 2026, filed by Nombre01, identity card CED01, in the constitutional protection action (recurso de amparo) docketed under case no. 26-011787-0007-CO.
Whereas:
"I. PURPOSE OF THE MOTION The purpose of this motion is for this Court to clarify and supplement the aforementioned ruling, on the grounds that it omits an express pronouncement on essential issues raised in the constitutional protection action, which are determinative for the analysis of a possible violation of fundamental rights. II. FAILURE TO RULE ON MINIMUM ACCESS TO WATER In the constitutional protection action filed, the petitioner not only challenged the denial of a household connection to the drinking water service, but also expressly, repeatedly, and with documentary support, raised the absolute absence of minimum mechanisms of access to the water resource, including: • The nonexistence of public water taps (tomas públicas) throughout the entire community. • The absence of provisional supply solutions. • The refusal of the respondent ASADA to implement minimum measures, even when such measures were proposed by the undersigned.
These issues are expressly reflected in the initial filing and in the evidence submitted; however, the ruling issued contains no assessment whatsoever of this aspect, limiting itself to analyzing the possibility of connection to the service from the perspective of the system's technical capacity. Accordingly, clarification is requested as to whether the Chamber considered that the total absence of minimum access to drinking water—even in the absence of a household connection—does not constitute a possible violation of the essential content of the fundamental right to water, or whether, on the contrary, this issue was not analyzed in the ruling. III. FAILURE TO RULE ON THE ABSENCE OF PUBLIC WATER TAPS It was clearly stated that: • The ASADA itself acknowledges the nonexistence of public water taps in the community. • A commitment was made to install a public water tap as a temporary solution, which was never carried out. • There is no community mechanism whatsoever that allows basic access to drinking water.
This issue is of particular constitutional relevance, insofar as public water taps constitute a minimum mechanism of access to the water resource, particularly in scenarios where immediate connection to the household system is not possible. Nevertheless, the challenged ruling entirely omits any pronouncement on this point, and this Court is therefore asked to state expressly: • Whether it considered the nonexistence of public water taps as part of its analysis of the case. • And, if so, what is the applicable constitutional standard in the face of the total absence of minimum mechanisms of access to drinking water. IV. FAILURE TO RULE ON WATER INFRASTRUCTURE FOR EMERGENCIES (FIRE HYDRANTS) Likewise, in the constitutional protection action it was established that: • There have been multiple fire incidents in the area. • There are no fire hydrants (hidrantes) or water infrastructure for emergency response. • Emergency responders are materially unable to respond in a timely manner due to the lack of water resources on site.
This element extends beyond the individual sphere of the petitioner and has implications for collective safety, the right to life, and the physical integrity of persons, as well as for the flora and fauna in the so-called Zona de Conservación Cerros Escazú Santa Ana, all of which was expressly raised in the action. However, the ruling issued contains no assessment of this issue whatsoever, and clarification is therefore requested as to whether this aspect was considered in the constitutional analysis of the case, or whether it constitutes a failure to issue a ruling. V. CONSTITUTIONAL RELEVANCE OF THE OMITTED ISSUES The foregoing matters do not constitute ancillary arguments, but rather form part of the essential core of the action, insofar as they concern: • The minimum guarantee of the human right to drinking water. • The obligation of the Administration to ensure basic conditions of access to the water resource. • The protection of related fundamental rights such as the right to life, health, and safety.
Consequently, the absence of a ruling on these issues prevents a full understanding of the scope of the decision adopted by this Court, thereby undermining the requisite reasoning of the judgment. VI. PETITIONARY CLAUSE On the basis of the foregoing, I respectfully request: 1. That clarification be provided as to whether the issues relating to minimum access to drinking water, the nonexistence of public water taps, and the absence of water infrastructure for emergencies were assessed by this Court at the time of issuing ruling No. 2026014056. 2. That the ruling be supplemented with an express pronouncement on said issues, in order to ensure the requisite reasoning of the judgment and the effective protection of the fundamental rights invoked. Respectfully."
The opinion is authored by Justice Castillo Víquez; and,
Considering:
I.Preliminary matter. In accordance with the provisions of Article 11 of the Constitutional Jurisdiction Act (Ley de la Jurisdicción Constitucional), no appeal lies against the judgments issued by this Chamber. Likewise, it is pertinent to recall the provisions of Article 12 of said act:
"Article 12.- The judgments issued by the Chamber may be clarified or supplemented, at the request of a party, if such request is submitted within three days, and ex officio at any time, including in enforcement proceedings, to the extent necessary to give full effect to the content of the judgment." Accordingly, a supplementary ruling (adición) is appropriate when a point raised in the original petition was not resolved, and a clarification (aclaración) is appropriate when the matter was drafted in obscure or ambiguous terms that hinder its comprehension. Clarification and addition are, therefore, procedural remedies to supplement a judgment or to explain its scope.
II.On the ruling issued in this matter. In judgment no. 2026014056 of 09:20 hours on April 21, 2026, this Chamber summarily rejected the present constitutional proceeding. On that occasion, the following was decided:
"I.- SUBJECT MATTER OF THE ACTION. In the initial filing, the petitioning party seeks this Chamber's intervention with the respondent ASADA to obtain the drinking water connection that the petitioner so urgently needs.
The petitioning party is advised that this Chamber has long held that, while there exists a fundamental right to drinking water, its exercise is not unrestricted, as there is no obligation on the part of entities providing such service to supply it under any and all conditions and circumstances. For example, in judgment no. 2018-12838 of 09:30 hours on August 10, 2018, this Chamber established the following:
'IV.- On the specific case. In the sub lite, the petitioner considers her fundamental right of access to drinking water to have been violated. She states that she is the owner, together with her husband, of the property recorded under the real property registry folio (folio real) of the Partido de San José, cadastral plan No. SJ-1843630-2015. She indicates that through a request made by her husband to the Instituto Costarricense de Acueductos y Alcantarillados, service availability (disponibilidad) of water for the aforementioned plot was requested; however, by means of official communication No. UNDGAM-0583-2018-1803 of February 21, 2018, the respondent institution denied the request on the grounds that no availability exists (…) In the area indicated by the petitioner, the existing drinking water infrastructure in front of the property does not have sufficient capacity to supply the property.
The drinking water production that currently exists and supplies the infrastructure located in front of the property does not have sufficient capacity to supply the property. The population in the area has been increasing, generating high demand, which has caused the system supplying the sector to be currently insufficient. The situation is compounded by the topographic elevation of the area, the limited water intake sources in the sector, and the lack of cadastral control in the area by the competent municipality. Under these circumstances, the appropriate course of action is to dismiss the constitutional protection action. This Constitutional Court has stated in repeated judgments on the subject that the supply of drinking water is considered within the Costa Rican legal system as a public service, and that, as such, every public service provider—whether a public or private entity—is obligated to provide the service continuously, efficiently, under conditions of equality, and in a manner that adapts to technological changes (see Judgment No. 2001-09676 and No. 2004-08161).
It is therefore clear that the Instituto Costarricense de Acueductos y Alcantarillados, as one of the state entities responsible for the provision of the public drinking water service, is also obligated to provide this service continuously, in an adaptable manner, efficiently, and on an equal basis to all residents. That said, the case law of this Court has also indicated that, in the face of legal impossibility (i.e., failure to meet the requirements established in the applicable regulations) or formal impossibility (i.e., the absence of a distribution network), it is reasonable not to attend to service requests, or to require the interested party to bear the installation costs when no drinking water distribution network exists and construction of infrastructure is necessary. Thus, in such cases it has been clearly established that this does not constitute a denial of access to the drinking water service, but rather an inability to provide it or the necessary participation of the interested party in overcoming a technical obstacle, namely, the lack of infrastructure.
In other words, as long as the failure to supply the drinking water service is not arbitrary, capricious, or unfounded, but is instead justified by legal or material impossibility, there is no violation of fundamental rights. In this case, the respondent authority clearly states that the petitioner must comply with the requirements set forth in the Urban Planning Act (Ley de Planificación Urbana) and the Regulatory Plan. Moreover, the protected party was advised that there is no associated availability for the subdivision (fraccionamiento) of the parent property from which the property under review was generated, nor is there sufficient supply capacity in the sector. Finally, the respondent indicates that, in the area identified by the petitioner, the existing drinking water infrastructure in front of the property does not have sufficient capacity to supply the property. Thus, both a legal and a formal or technical impossibility exist, since the subdivision of the land was carried out without prior approval of availability and, additionally, because there is insufficient capacity in the sector where the property is located to provide the public service.
As a corollary, the Chamber considers that the constitutional protection action must be dismissed, since in accordance with the line of case law advanced by this Court in similar cases, it is permissible to deny the supply of drinking water when a legal and/or formal-technical impossibility is found to exist, as is the case here, such that the fundamental rights of the petitioning party would not be infringed. If the petitioner's disagreement lies with the denial itself and with the grounds supporting it, that is a matter of legality that cannot be adjudicated in these proceedings. Furthermore, the Chamber notes that the protected party was expressly informed of the reasons for which authorization of the service was not appropriate, and therefore her fundamental rights were not violated in that respect either.' (emphasis not in original).
By virtue of the foregoing, it has been recognized that service-providing entities may deny the provision of the drinking water service when there are technical reasons that justify such denial. Accordingly, the Chamber considers that the reasons for which the ASADA de Atorla has denied the drinking water service to the interested party are, in principle, not arbitrary, but rather stem from the existence of several technical and legal impossibilities to providing such service.
Therefore, if the grounds for the denial are not accurate or do not conform to the applicable technical and/or legal criteria, that is a dispute that must be resolved through infra-constitutional proceedings (vías infra constitucionales).
Under these circumstances, and in accordance with this Chamber's repeated precedents, the appropriate course of action is to reject the constitutional protection action, without prejudice to the interested party's right to submit their claims through the ordinary courts (vía ordinaria)."
III.On the motion filed. In the sub lite, the petitioning party requests the clarification and addition of judgment no. 2026014056 of 09:20 hours on April 21, 2026, on the grounds that this Chamber failed to rule on various aspects related to minimum access to drinking water, the nonexistence of public water taps, and the absence of water infrastructure for emergency response. However, upon a comprehensive reading of the ruling whose clarification and addition are sought, it is apparent that this Chamber identified that the central claim raised in the action concerned the refusal of the respondent ASADA to grant the drinking water service requested by the petitioner, and on that basis concluded that the dispute was grounded, in principle, in technical and legal reasons whose discussion exceeded the scope of this constitutional jurisdiction, which is why the constitutional protection action was summarily rejected.
In that context, the various arguments relating to alternative supply mechanisms, public water taps, or other measures proposed by the petitioning party were linked to the admissibility of the principal claim submitted to this Chamber. Consequently, having determined that the dispute raised was not susceptible of being resolved in this forum, it was not necessary to issue an individualized ruling with respect to each of the measures suggested by the petitioner. Under these circumstances, no issue that was timely raised but left unresolved is apparent; rather, the motion filed seeks to obtain a fresh analysis of matters already encompassed within the decision adopted, a purpose that exceeds the scope of the clarification and addition regulated under Article 12 of the Constitutional Jurisdiction Act. Accordingly, the appropriate course of action is to deny the motion filed.
IV.Documents submitted to the case file. The parties are hereby advised that, should they have submitted any documents on paper, as well as objects or evidence contained in any additional device of an electronic, computer-based, magnetic, optical, telematic, or new-technology nature, these must be retrieved from the court office within a maximum period of thirty business days counted from the notification of this judgment. Failing this, all material not retrieved within this period shall be destroyed, pursuant to the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Plenary Court in Session No. 27-11 of August 22, 2011, Article XXVI, and published in Boletín Judicial No. 19 of January 26, 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial in Session No. 43-12 held on May 3, 2012, Article LXXXI.
Therefore:

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del diecinueve de junio de dos mil veintiseis .
Gestión posterior en relación con la sentencia nro. 2026014056 de las 09:20 horas del 21 de abril de 2026, promovida por Nombre01, cédula de identidad CED01, en el recurso de amparo que se tramita en el expediente nro. 26-011787-0007-CO.
Resultando:
“I. OBJETO DE LA GESTIÓN La presente gestión tiene como finalidad que este Tribunal aclare y adicione la resolución indicada, en virtud de que la misma omite pronunciamiento expreso sobre extremos esenciales planteados en el recurso de amparo, los cuales resultan determinantes para el análisis de la posible vulneración de derechos fundamentales. II. OMISIÓN DE PRONUNCIAMIENTO SOBRE ACCESO MÍNIMO AL AGUA En el recurso de amparo interpuesto, no solo se cuestionó la denegatoria de una conexión domiciliaria al servicio de agua potable, sino que de forma expresa, reiterada y documentada, se planteó la ausencia absoluta de mecanismos mínimos de acceso al recurso hídrico, incluyendo: • La inexistencia de tomas públicas en toda la comunidad. • La ausencia de soluciones provisionales de abastecimiento. • La negativa de la ASADA recurrida a implementar medidas mínimas, aun cuando fueron propuestas por el suscrito.
Estos extremos constan de manera expresa en el escrito inicial del recurso y en la prueba aportada; sin embargo, la resolución emitida no realiza valoración alguna sobre este aspecto, limitándose a analizar la posibilidad de conexión al servicio desde una perspectiva de capacidad técnica del sistema. En consecuencia, se solicita aclarar si la Sala consideró que la inexistencia total de acceso mínimo al agua potable —aun en ausencia de conexión domiciliaria— no configura una posible vulneración al contenido esencial del derecho fundamental al agua, o si, por el contrario, dicho extremo no fue analizado en la resolución. III. OMISIÓN DE PRONUNCIAMIENTO SOBRE LA AUSENCIA DE TOMAS PÚBLICAS Se expuso de manera clara que: • La propia ASADA reconoce la inexistencia de tomas públicas en la comunidad. • Se adquirió un compromiso de instalar una toma pública como solución temporal, el cual no fue ejecutado. • No existe ningún mecanismo comunitario que permita el acceso básico al agua potable.
Este extremo reviste especial relevancia constitucional, en tanto las tomas públicas constituyen un mecanismo mínimo de acceso al recurso hídrico, particularmente en escenarios donde no es posible la conexión inmediata al sistema domiciliar. No obstante, la resolución recurrida omite completamente pronunciarse sobre este punto, por lo que se solicita a ese Tribunal que indique expresamente: • Si valoró la inexistencia de tomas públicas como parte del análisis del caso. • Y, en su caso, cuál es el criterio constitucional aplicable frente a la ausencia total de mecanismos mínimos de acceso al agua potable. IV. OMISIÓN DE PRONUNCIAMIENTO SOBRE INFRAESTRUCTURA PARA EMERGENCIAS (HIDRANTES) Asimismo, en el recurso de amparo se acreditó: • La existencia de múltiples incidentes de incendios en la zona. • La ausencia de hidrantes o infraestructura hídrica para atención de emergencias. • La imposibilidad material de respuesta oportuna por parte de cuerpos de emergencia debido a la carencia del recurso hídrico en sitio.
Este elemento trasciende el ámbito individual del recurrente y se proyecta sobre la seguridad colectiva, el derecho a la vida y la integridad de las personas así como la flora y fauna en la denominada Zona de Conservación Cerros Escazú Santa Ana , lo cual fue expresamente planteado en el recurso. Sin embargo, la resolución emitida no contiene valoración alguna sobre este extremo, por lo que se solicita aclarar si dicho aspecto fue considerado dentro del análisis constitucional del caso, o si se trata de una omisión de pronunciamiento. V. RELEVANCIA CONSTITUCIONAL DE LOS EXTREMOS OMITIDOS Los aspectos antes señalados no constituyen alegatos accesorios, sino que forman parte del núcleo esencial del recurso, en tanto se refieren a: • La garantía mínima del derecho humano al agua potable. • La obligación de la Administración de asegurar condiciones básicas de acceso al recurso hídrico. • La protección de derechos fundamentales conexos como la vida, la salud y la seguridad.
En consecuencia, la ausencia de pronunciamiento sobre dichos extremos impide comprender en su totalidad el alcance de la decisión adoptada por ese Tribunal, afectando la debida motivación del fallo. VI. PETITORIA Con fundamento en lo expuesto, respetuosamente solicito: 1. Se aclare si los extremos relativos al acceso mínimo al agua potable, la inexistencia de tomas públicas y la ausencia de infraestructura hídrica para emergencias fueron valorados por ese Tribunal al momento de dictar la resolución N.° 2026014056. 2. Se adicione la resolución, emitiendo pronunciamiento expreso sobre dichos extremos, en aras de garantizar la debida motivación del fallo y la tutela efectiva de los derechos fundamentales invocados. Respetuosamente”.
Redacta el Magistrado Castillo Víquez; y,
Considerando:
I.Cuestión previa. De acuerdo con lo dispuesto en el artículo 11 de la Ley de la Jurisdicción Constitucional contra las sentencias de esta Sala no procede recurso alguno. De igual manera, procede traer a colación lo dispuesto por artículo 12 de la referida ley:
“Artículo 12.- Las sentencias que dicte la Sala podrán ser aclaradas o adicionadas, a petición de parte, si se solicitare dentro de tercer día, y de oficio en cualquier tiempo, incluso en los procedimientos de ejecución, en la medida en que sea necesario para dar cabal cumplimiento al contenido del fallo”.
Así, la adición de un pronunciamiento procede cuando un punto del planteamiento original del recurso no fue resuelto y la aclaración cuando el asunto fue redactado en términos oscuros o ambiguos lo que dificulta su comprensión. La adición y la aclaración son, entonces, remedios procesales para complementar una sentencia o explicar sus alcances.
II.Sobre lo resuelto en este asunto. En la sentencia nro. 2026014056 de las 09:20 horas del 21 de abril de 2026, esta Sala rechazó de plano el presente proceso constitucional. Esa oportunidad, se resolvió lo siguiente:
“I.- OBJETO DEL RECURSO. En el escrito de interposición, la parte accionante pretende que esta Sala interceda ante la ASADA recurrida para que le conceda la conexión del agua potable que tanto necesita.
Se le aclara a la parte accionante que desde larga data la Sala ha considerado que, si bien existe un derecho fundamental al agua potable, su ejercicio no es indiscriminado, ya que no hay una obligación de los entes que prestan ese servicio de brindarlo en cualesquiera condiciones y oportunidad. Así, por ejemplo, esta Sala en la sentencia n.º 2018-12838 de las 09:30 horas del 10 de agosto de 2018 se estableció lo siguiente:
“IV.- Sobre el caso concreto. En el sub lite, la recurrente estima lesionado su derecho fundamental de acceso al agua potable. Indica que es propietaria, junto con su esposo, del inmueble matrícula folio real del Partido de San José, plano catastrado N° SJ-1843630-2015. Señala que mediante gestión realizada por su esposo ante el Instituto Costarricense de Acueductos y Alcantarillados, se solicitó la disponibilidad de agua para el terreno citado; empero, por medio del oficio N° UNDGAM-0583-2018-1803 del 21 de febrero de 2018, el instituto recurrido denegó la petición, bajo el argumento que no existe disponibilidad (…) En el sector indicado por la recurrente, la infraestructura de agua potable existente frente a la propiedad no tiene capacidad suficiente para abastecer el inmueble. La producción de agua potable que existe actualmente y abastece la infraestructura que se ubica frente a la propiedad no tiene capacidad suficiente para abastecer el inmueble.
La población en la zona ha ido aumentando y ello ha generado mucha demanda que ha provocado que, en la actualidad, el sistema que abastece el sector sea insuficiente. La situación se ve agravada por la elevación topográfica de la zona, las limitadas fuentes de captación en el sector y la falta de control catastral en la zona por parte de la municipalidad competente. Así las cosas, lo correspondiente es declarar sin lugar el recurso de amparo. Este Tribunal Constitucional ha indicado en reiteradas sentencias sobre el tema que el suministro de agua potable es considerado dentro del ordenamiento jurídico costarricense como un servicio público, y que como tal, todo prestador de servicios públicos -sea sujeto público o sujeto privado- está obligado a prestar el servicio de forma continua, eficiente, en condiciones de igualdad y debiendo adaptarse a los cambios tecnológicos (véase Sentencia N° 2001-09676 y N° 2004-08161).
Resulta claro entonces concluir que el Instituto Costarricense de Acueductos y Alcantarillados, al ser uno de los entes estatales encargados de la prestación del servicio público de agua potable, está obligado también a prestar este servicio de forma continua, adaptable, eficiente y por igual a todos los habitantes. Ahora bien, también la jurisprudencia de este Tribunal ha indicado que, frente a la imposibilidad jurídica (que es la falta de cumplimiento de requisitos establecidos en la reglamentación respectiva) o frente a la imposibilidad formal (que es la falta de una red de distribución de aguas), es razonable no atender las solicitudes de servicio o solicitar que el interesado asuma los costos de instalación cuando no exista red de distribución de agua potable y se necesite la construcción de infraestructura. Así, en estos casos se ha tenido claro que no es que se trate de una negativa al acceso al servicio de agua potable, sino de la imposibilidad para brindarlo o de la necesaria participación del interesado en el levantamiento de una imposibilidad técnica, cual es, la falta de infraestructura.
En otras palabras, siempre que la falta de dotación del servicio de agua potable no sea una actuación antojadiza, arbitraria o sin fundamento, sino que esté justificada en la imposibilidad jurídica o material no estamos frente a la violación de derechos fundamentales. En la especie, la autoridad recurrida es clara en indicar que la recurrente debe cumplir con lo estipulado en la Ley de Planificación Urbana y Plan Regulador. Además, a la amparada se le explicó que no existe disponibilidad asociada para el fraccionamiento de la propiedad madre de la que se generó la propiedad en análisis ni tampoco existe capacidad de abastecimiento en el sector. Por último, el recurrido señala que en el sector indicado por la recurrente, la infraestructura de agua potable existente frente a la propiedad no tiene capacidad suficiente para abastecer el inmueble. De manera tal, que existe una imposibilidad tanto jurídica como formal o técnica, ya que el fraccionamiento del terreno se realizó sin que previamente se haya obtenido la disponibilidad y, además, porque en el sector donde se encuentra la propiedad no existe capacidad suficiente para brindar el servicio públicos.
Corolario de lo expuesto, la Sala considera que se debe desestimar el recurso de amparo, ya que de conformidad con la línea jurisprudencial esgrimida por este Tribunal en casos similares, es posible denegar el suministro de agua potable cuando se determina la existente de una imposibilidad jurídica y/o formal técnica, como ocurre en la especie, de modo que no se estarían infringiendo los derechos fundamentales de la parte promovente. Si la recurrente lo que se encuentra es disconforme con la negatoria en sí, y con los motivos que la sustentan, ello corresponde a un extremo de legalidad que no puede ser ventilado en esta vía . Además, la Sala constata que a la amparada sí se le indicaron expresamente los motivos por los cuales no procedía la autorización del servicio, de ahí que tampoco en ese aspecto se hayan conculcado sus derechos fundamentales” (resaltado no es del original) .
En virtud de lo expuesto, se ha reconocido que las entidades prestatarias pueden denegar la prestación del servicio de agua potable si existen razones técnicas que así lo justifiquen. De tal manera, considera la Sala que las razones por las que la ASADA de Atorla le ha denegado el servicio de agua potable a la parte interesada -en tesis de principio- no es arbitraria, sino que se debe a la existencia de varias imposibilidades técnicas y legales para brindar tal servicio.
Por ende, si los motivos de la denegatoria no son ciertos o no conformes con los criterios técnicos y/o legales, ello es un diferendo que debe ser dirimido en las vías infra constitucionales.
Así las cosas, y de conformidad con los reiterados precedentes de esta Sala, lo correspondiente es rechazar el amparo, sin demérito que la parte interesada presente sus reclamos en la vía ordinaria”.
III.Sobre la gestión presentada. En el sub lite, la parte recurrente solicita la aclaración y adición de la sentencia nro. 2026014056 de las 09:20 horas del 21 de abril de 2026, por estimar que esta Sala omitió pronunciarse sobre diversos aspectos relacionados con el acceso mínimo al agua potable, la inexistencia de tomas públicas y la ausencia de infraestructura hídrica para la atención de emergencias. No obstante, de la lectura integral de la resolución cuya aclaración y adición se pretende, se constata que esta Sala identificó que el reclamo medular planteado en el recurso versaba sobre la negativa de la ASADA recurrida de otorgar el servicio de agua potable solicitado por el accionante y, a partir de ello, concluyó que tal controversia se encontraba sustentada, en tesis de principio, en razones técnicas y legales cuya discusión excedía el ámbito de conocimiento de esta jurisdicción constitucional, razón por la cual procedió a rechazar de plano el amparo.
En ese contexto, los distintos planteamientos relativos a mecanismos alternativos de abastecimiento, tomas públicas u otras medidas propuestas por la parte accionante se encontraban vinculados a la procedencia de la pretensión principal sometida a conocimiento de esta Sala. Por consiguiente, al haberse determinado que el diferendo planteado no era susceptible de ser dilucidado en esta sede, no resultaba necesario emitir un pronunciamiento individualizado respecto de cada una de las medidas sugeridas por el recurrente. Así las cosas, no se advierte la existencia de algún extremo oportunamente planteado que hubiese quedado sin resolver, sino que la gestión formulada procura obtener un nuevo análisis de cuestiones comprendidas dentro de la decisión ya adoptada, finalidad que excede los alcances de la aclaración y adición reguladas en el artículo 12 de la Ley de la Jurisdicción Constitucional. En consecuencia, lo procedente es declarar no ha lugar la gestión presentada.
IV.Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial No. 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
No ha lugar a la gestión formulada.
