Document Review SALA CONSTITUCIONAL OF THE SUPREME COURT OF JUSTICE. San José, at nine thirty in the morning on the nineteenth of June, two thousand twenty-six.
Writ of amparo (recurso de amparo) filed by Nombre01, national identification number CED01, against the SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN.
Whereas:
"I. On the status of the expropriation proceeding in question The Protected Wildlife Area (Área Silvestre Protegida) does not currently have any completed expropriation case files, since these have not been duly finalized, as they are still in the technical-legal analysis phase.
In this context, once the corresponding administrative case file is assembled, a field survey (levantamiento de campo) will be conducted in order to determine the actual physical condition of the properties, their location relative to the boundaries of the Protected Wildlife Area, and the possible existence of private rights that must be subject to analysis.
In those cases where the possible existence of subjective rights (derechos subjetivos) over properties located within the territory of the Protected Wildlife Area is identified, these must be analyzed in accordance with the applicable legal framework, particularly in light of the principles of environmental protection, administrative legality, legal certainty, and the supremacy of the public interest.
It is important to note that properties not registered in the national Real Property Registry (Registro Inmobiliario) must first fulfill the corresponding legal and procedural requirements before the agrarian jurisdiction (jurisdicción agraria), in order to determine whether any possessory or ownership rights (derechos posesorios o dominicales) may apply. Said analysis must be conducted while respecting at all times the constitutional duty of the State to protect natural resources and the environment, as set forth in Article 50 of the Political Constitution, as well as the applicable environmental, agrarian, and administrative regulations, especially in the case of land located within a Protected Wildlife Area.
In these proceedings, the Procuraduría General de la República (PGR) is the party called upon to represent the interests of the State, both judicially and extrajudicially, both prior to the eventual registration of a real property and in cases where there are registry registrations (inscripciones registrales) that must be challenged, whether through the filing of the corresponding judicial actions or, where appropriate under law, through the lesividad proceeding (proceso de lesividad).
The lesividad proceeding, within the framework of Costa Rican administrative law, constitutes the legal mechanism by which the Public Administration requests the Judicial Branch to annul a final administrative act (acto administrativo) that has generated rights in favor of a private party, when said act is contrary to the public interest, legality, or constitutional principles, such as environmental protection.
In accordance with the principle of inviolability of favorable administrative acts, the Administration may not unilaterally revoke an administrative act that has been validly notified and consented to by the party concerned, even if it subsequently discovers its illegality. In such cases, it must issue a declaration of lesividad, by means of a duly reasoned administrative act, and bring the matter before the contentious-administrative jurisdiction, so that the competent judicial authority may determine its validity or possible nullity.
In environmental matters and, particularly, regarding Protected Wildlife Areas, the lesividad proceeding is of special relevance, as it allows the State to correct consolidated legal situations that compromise assets in the public domain (dominio público), natural resources, or protected ecosystems, while simultaneously guaranteeing due process, the right to defense, and the legal certainty of the private parties involved.
In this way, the lesividad proceeding stands as an indispensable tool for the defense of the State Natural Heritage (Patrimonio Natural del Estado), ensuring that administrative acts or registry registrations incompatible with environmental, agrarian, or constitutional regulations may be reviewed and eventually annulled by the competent judicial authority, with the mandatory participation of the Procuraduría General de la República as representative of the public interest.
What is the status of the expropriation proceeding corresponding to the areas added to the Parque Nacional Manuel Nombre02 by means of Decreto Ejecutivo 29177-MINAE published in Gaceta N° 243 of December 19, 2000?
The lesividad proceeding, within the framework of Costa Rican administrative law, constitutes the legal mechanism by which the Public Administration requests the Judicial Branch to annul a final administrative act that has generated rights in favor of a private party, but which is contrary to the public interest, legality, or constitutional principles, such as environmental protection.

In environmental matters and regarding protected wildlife areas, the lesividad proceeding is of special importance, as it allows the State to correct consolidated legal situations that compromise assets in the public domain, natural resources, or protected ecosystems, while simultaneously guaranteeing due process, the right to defense, and the legal certainty of the private parties involved.
In this way, the lesividad proceeding stands as an indispensable tool for the defense of the State Natural Heritage, ensuring that administrative acts or registry registrations that prove incompatible with environmental, agrarian, or constitutional regulations may be reviewed and eventually annulled by the competent judicial authority, with the mandatory participation of the Procuraduría General de la República as representative of the public interest.
In order to carry out the process of acquiring land within Protected Wildlife Areas, SINAC must follow the official SINAC procedure published in La Gaceta 79 of Friday, April 24, 2009, REGLAMENTO Nº 4-2008 DEL AMBIENTE, ENERGÍA Y TELECOMUNICACIONES, SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN, SECRETARÍA EJECUTIVA, MANUAL DE PROCEDIMIENTOS PARA ADQUISIÓN DE TERRENOS DENTRO DE ÁREAS SILVESTRES PROTEGIDAS, and the Ley de Expropiaciones N° 7495.
However, in the case of lands located within the boundaries of the Parque Nacional Manuel Nombre02 that were added by means of Decreto Ejecutivo 29177-MINAE published in Gaceta N° 243 of December 19, 2000, the recitals of that decree indicate the types of land cover over which the national park was expanded:
Point 2 in particular indicates that the expanded sector is composed of the ZMT (State property) and mangrove-type wetlands (State property in the public domain, not subject to third-party registration). The expansion points are plotted on the official IGN cartographic sheets at a scale of 1:50,000, Quepos — edition 2-IGN-CR, and Savegre — edition 1-IGN-CR, essentially along the edges of the mangrove bodies indicated by the conventional symbols on those sheets. However, despite the fact that the expansion covers land that should not have registrations in the names of third parties, three types of possession exist:
• Registered properties (fincas inscritas) with cadastral surveys (planos catastrados).
• Lands with cadastral surveys only.
• Lands held by possession.
The following are the conclusions drawn by the products of the consulting studies:
• Report "Estudio de la tenencia de la Tierra Parque Nacional Manuel Nombre02 Sector Playa Rey," of April 2012.
• Report "Contratación de servicios técnicos y profesionales en topografía, agronomía y legal para realizar estudios El Parque Nacional Manuel Nombre02 Sector Playa Rey," of June 2020.
It is worth noting that the second consulting study is the source from which the information was drawn to assemble the case files that were updated in 2024. Both consulting studies also indicate that photointerpretive (fotointerpretativo) studies must be conducted to define the historical mangrove line, and thereby legally evaluate the case files that will proceed through lesividad proceedings.
Prior to the first consulting study, the trust fund (fideicomiso) of the PNMA paid in 2009 for the "ESTUDIO FOTOINTERPRETATIVO PARA COMPARAR AREAS DE MANGLAR Y HUMEDAL EN TRES PERIODOS DIFERENTES EN EL PARQUE NACIONAL MANUEL Nombre02 Y ÁREAS ALEDAÑAS A LOS LIMITES ACTUALES, UBICADO EN LA Dirección01," which uses aerial photographic images of the sector from the years 1947, 1949, 1961, and 2003. This input was used in that consulting study, but was not used in the 2020 study. It is important to note that this study lacked field verification by ACOPAC-SINAC.
Given this scenario of lacking verified photointerpretive input, the process of consolidating land tenure (tenencia de tierra) has been put on hold. However, as a result of another writ of amparo in which compliance is required with the terms set forth in Resolución No 2021002741 of the SALA CONSTITUCIONAL in its Por tanto, third item, which states: Additionally, Ingrid Campos Leiva, in her capacity as Head of the Aguirre Parrita Sub-regional Office of the Área de Conservación Pacífico Central of the Sistema Nacional de Áreas de Conservación; and Marta Aguilar Varela, in her capacity as Acting Director of the Instituto Geográfico Nacional, or whoever may hold those positions in their stead, were ordered to jointly and coordinatedly undertake the corresponding actions so that, within a maximum period of THREE MONTHS from the notification of this ruling, they delineate the mangrove ecosystem of the Quepos zone, from the writ of amparo processed under case file NO 20-021786-007CO.
As a result of the foregoing, the verification and determination of the public zone line (línea de zona pública) was carried out by means of the report "verificación de campo de ecosistemas de manglar y estero foto interpretados a partir de análisis de fotos aéreas del año 1947-19491953-1961-1974-2003 entre Rio Naranjo- Quebrada Matapalo, cantón Quepos, provincia Puntarenas, localizados entre Rio Naranjo Coord. CRTM05 Lat. 1037269, Long. 487198 y Quebrada Matapalo Coord. CRTM05 Lat. 1030977, Long. 503836." In addition, the tidal influence points of the Naranjo and Savegre rivers were defined, as well as the tidal influence of the estuarine system of Quebrada Barbudal. All of this work was completed by June 2024 and delivered to the ACOPAC supervisors so that it could be communicated to IGN for the corresponding publication of the public zone (zona pública).
By means of official letter CARTA-SINAC-ACOPAC-DR-0646-2025 addressed to Master Álvaro Alvarez Calderón, Director of the Instituto Geográfico Nacional, the ACOPAC directorate forwarded to IGN the technical verification reports on mangrove and estuary ecosystems identified through photointerpretation, entitled: Estudios de clasificación de Ecosistemas de Manglares y Esteros del Cantón de Quepos, so that that institution may process them in accordance with the procedure for the publication of the public zone; likewise, the Nombre03 report was sent under official letter CARTA-SINACACOPAC-DR-0646-2025 as indicated, to complete the technical inputs necessary to advance the process of assembling the various case files from the technical side, with the legal analysis still pending, which would determine the different courses of action — whether direct purchase, expropriation proceeding, or lesividad proceedings.
Once said line has been published and made available on the SIRI and SNIT platforms, trust fund resources will be used to hire lawyers for the review, assessment, and analysis of the information. The folders to be reviewed are those listed in the following table:

- What is the procedure for reviewing and photocopying said case file, and who is the contact person in the relevant office or which public officials can facilitate this process?
The Protected Wildlife Area does not currently have any completed expropriation case files, since these have not been duly finalized, as they are still in the technical-legal analysis phase.
In this context, once the corresponding administrative case file is assembled, a field survey will be conducted in order to determine the actual physical condition of the properties, their location relative to the boundaries of the Protected Wildlife Area, and the possible existence of private rights that must be subject to study.

"I.- Constitutional framework, scope of the amparo, and applicable standard of review The writ of amparo, set forth in Articles 10 and 48 of the Political Constitution and further developed by the Ley de la Jurisdicción Constitucional, constitutes an exceptional and subsidiary mechanism for the protection of fundamental rights, designed to remedy manifestly illegitimate actions or omissions by the Public Administration.
The consistent, repeated case law of the Sala Constitucional has established that amparo does not substitute ordinary administrative procedures, nor does it constitute a pathway to compel premature decisions, especially when those decisions require complex technical, legal, and patrimonial analyses, as occurs in matters related to expropriations, the determination of real rights, public domain, and the protection of the State Natural Heritage.
Accordingly, the mere dissatisfaction of a party with the pace, stages, or complexity of a procedure does not, in and of itself, constitute a violation of fundamental rights, when the Administration acts in a reasoned, reasonable manner in accordance with the legal framework.
The actions of SINAC and ACOPAC are governed by the principle of administrative legality, as well as by the constitutional mandate for enhanced protection of the environment, enshrined in Article 50 of the Political Constitution.
The Sala Constitucional has repeatedly recognized that, in environmental matters, the Administration is obligated to observe a high standard of diligence, which includes:
• Exhaustively verifying the legal status of the lands.
• Avoiding hasty decisions that lack registry, technical, or jurisdictional certainty.
• Acting in a progressive, prudent, and reasoned manner.
In this context, refraining from issuing conclusive acts without having complete legal inputs does not constitute illegitimate inaction, but rather a manifestation of compliance with the principle of legality, aimed at preventing irreversible harm to the environment, the public treasury (erario público), and the rights of third parties.
With respect to the facts alleged by the petitioner, all aspects of the report submitted to this Sala by means of official letter CARTA-SINAC-ACOPAC-DR-0182-2026, dated April 24, 2026, are hereby reiterated in their entirety, as that report remains fully in force and contains a detailed, clear, and documented description of the status of the corresponding administrative proceedings.
For the sake of clarity, the key aspects set forth therein are summarized below, without altering or expanding the content originally reported.
This circumstance is not due to a refusal or unjustified omission, but rather to strict compliance with the legal requirements governing this type of proceeding, the premature adoption of which could give rise to nullities, patrimonial liabilities, and irreversible environmental harm.
The repeated criteria of the Procuraduría General de la República have been clear in stating that:
• The State Natural Heritage is inalienable and enjoys enhanced protection.
• The Administration must refrain from issuing rulings when it lacks full legal certainty.
• Administrative action without a complete case file or without sufficient technical support may give rise to liability for the officials involved.
Far from justifying inaction, these criteria reinforce the duty of legal prudence that has guided the conduct of the respondent authorities.
Based on the foregoing, it is concluded that:
• The Administration has responded to the requests submitted.
• It has provided clear, technical, and legally reasoned explanations.
• It has objectively justified why it is not possible to issue final acts at this stage.
Therefore, there is no current or imminent harm to fundamental rights, but rather reasonable, progressive administrative action in accordance with the law, which is incompatible with the constitutional violation that would give rise to the admissibility of the amparo.
It is essential to highlight that the institutional authorities have acted with special prudence, precisely to avoid decisions contrary to the rule-of-law framework (bloque de legalidad) that could:
• Compromise the public environmental interest, • Give rise to administrative nullities, • Or result in personal or institutional liability.
This conduct is consistent with the constitutional case law that imposes on the Administration a special duty of care in environmental matters, even when this entails greater complexity or duration of the proceedings.
For all the foregoing reasons, this Honorable Sala Constitucional is respectfully requested to dismiss the writ of amparo filed, as no violation of fundamental rights attributable to the respondent authorities is evident.
The required response is hereby duly submitted, reiterating that the questioned administrative actions are fully consistent with the applicable legal framework and constitutional case law."
"PRELIMINARY MATTER Upon filing the response to the writ of amparo submitted by this office on April 30, 2026, a clerical error was subsequently noticed in the identification of one of the documents submitted as evidence.

The consistent, repeated case law of the Sala Constitucional has established that amparo does not substitute ordinary administrative procedures, nor does it constitute a pathway to compel premature decisions, especially when those decisions require complex technical, legal, and patrimonial analyses, as occurs in matters related to expropriations, the determination of real rights, public domain, and the protection of the State Natural Heritage.
Accordingly, the mere dissatisfaction of a party with the pace, stages, or complexity of a procedure does not, in and of itself, constitute a violation of fundamental rights, when the Administration acts in a reasoned, reasonable manner in accordance with the legal framework.
The actions of SINAC and ACOPAC are governed by the principle of administrative legality, as well as by the constitutional mandate for enhanced protection of the environment, enshrined in Article 50 of the Political Constitution.
The Sala Constitucional has repeatedly recognized that, in environmental matters, the Administration is obligated to observe a high standard of diligence, which includes:
• Exhaustively verifying the legal status of the lands.
• Avoiding hasty decisions that lack registry, technical, or jurisdictional certainty.
• Acting in a progressive, prudent, and reasoned manner.
In this context, refraining from issuing conclusive acts without having complete legal inputs does not constitute illegitimate inaction, but rather a manifestation of compliance with the principle of legality, aimed at preventing irreversible harm to the environment, the public treasury, and the rights of third parties.
With respect to the facts alleged by the petitioner, all aspects of the report submitted to this Sala by means of official letter CARTA-SINAC-ACOPAC-DR-0182-2026, dated April 24, 2026, are hereby reiterated in their entirety, as that report remains fully in force and contains a detailed, clear, and documented description of the status of the corresponding administrative proceedings.
For the sake of clarity, the key aspects set forth therein are summarized below, without altering or expanding the content originally reported.
This circumstance is not due to a refusal or unjustified omission, but rather to strict compliance with the legal requirements governing this type of proceeding, the premature adoption of which could give rise to nullities, patrimonial liabilities, and irreversible environmental harm.
v. Opinions of the Office of the Attorney General (Procuraduría General de la República, PGR) The repeated opinions of the Office of the Attorney General have clearly indicated that:
• The Natural Heritage of the State (Patrimonio Natural del Estado) is inalienable and enjoys heightened constitutional protection (tutela reforzada).
• The Administration must refrain from rendering decisions when it lacks complete legal certainty.
• Administrative action taken without a complete case file (expediente) or without sufficient technical support may give rise to liability for the officials involved.
Far from justifying inaction, these opinions reinforce the duty of legal prudence that has guided the conduct of the respondent authorities.
From the foregoing it is concluded that:
• The Administration has responded to the requests submitted.
• It has provided clear, technically grounded, and legally reasoned explanations.
• It has objectively justified why it is not possible to issue definitive administrative acts at this stage.
Por tanto, no current or imminent injury to fundamental rights has been established; rather, the administrative conduct has been reasonable, progressive, and in conformity with the law — conduct that is incompatible with the type of constitutional violation that would render an amparo proceeding (amparo) admissible.
It is essential to emphasize that the institutional heads (jerarcas) have acted with particular prudence, precisely in order to avoid decisions contrary to the legal framework (bloque de legalidad) that could:
• Compromise the public environmental interest, • Give rise to administrative nullities (nulidades administrativas), • Or result in personal or institutional liability.
This conduct is consistent with the constitutional case law that imposes on the Administration a special duty of care in environmental matters, even when this entails greater complexity or longer duration of the proceedings.
For all of the foregoing reasons, it is respectfully requested that this Honorable Sala Constitucional declare the amparo proceeding dismissed on the merits, as no violation of any fundamental right attributable to the respondent authorities has been shown.
The judicial notice (prevención) is deemed duly complied with, and it is reiterated that the challenged administrative actions are fully in conformity with the applicable legal order and constitutional case law."

Considering:
I.Subject matter of the proceeding. The petitioner alleges that on February 2, 2026, he sent to the electronic address ...01 an information request addressed to the Sistema Nacional de Áreas de Conservación (SINAC), in which he requested the following: "I request that I be informed of the following: — What is the status of the expropriation process corresponding to the areas added to Parque Nacional Manuel Nombre02 by Decreto Ejecutivo 29177-MINAE, published in Gaceta N° 243 of December 19, 2000? — What is the procedure for reviewing and photocopying that case file and who is the contact office or public officials that can assist with this matter?" He states that on February 3, 2026, the Executive Directorate of SINAC forwarded the information request to the Área de Conservación Pacífico Central (ACOPAC). He complains that as of the date of filing the present proceeding he had not received a response.
III.Unproven Fact. The following fact of relevance to this ruling is not considered established: Sole item. That the respondent authorities answered the request submitted by the petitioner on February 2, 2026.
IV.On the Merits. In the case under study, after analyzing the evidentiary elements submitted and the sworn report rendered by the respondent authority, with timely notice of the consequences set forth in article 44 of the Ley de la Jurisdicción Constitucional, it is established that on February 2, 2026, the petitioner sent to the electronic address ...01 an information request addressed to the Sistema Nacional de Áreas de Conservación (SINAC), in which he requested the following: "I request that I be informed of the following: — What is the status of the expropriation process corresponding to the areas added to Parque Nacional Manuel Nombre02 by Decreto Ejecutivo 29177-MINAE, published in Gaceta N° 243 of December 19, 2000? — What is the procedure for reviewing and photocopying that case file and who is the contact office or public officials that can assist with this matter?"
First, it should be noted that, notwithstanding the requirement set forth in the initial procedural order of the present proceeding directing the respondent authorities to report whether the electronic address to which the information request was sent is designated as an official mechanism for receiving communications from members of the public, they failed to address this point. Por tanto, in accordance with article 45 of the Ley de la Jurisdicción Constitucional, it is deemed established that the referenced electronic address is an official means of communication of the respondent authority.
It must now be noted that, although the SINAC respondent authorities appeared in the present proceeding, they did not specifically address whether they answered the request submitted by the petitioner on February 2, 2026, nor whether they communicated a corresponding response through the means designated for that purpose.
In this state of affairs, this Tribunal finds that since the submission of the request in question on February 2, 2026, more than two months have elapsed without the petitioner's request having been answered. This Chamber considers such a period to be excessive for responding to the petitioner's request — an omission that violates the right of petition and prompt response (derecho de petición y pronta respuesta) enshrined in article 27 of the Constitución Política. In light of the foregoing, the proceeding is granted in the terms set forth in the operative part (parte dispositiva) of this judgment.
V.Documentation Submitted to the Case File. The parties are advised that, should they have submitted any paper documents, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be retrieved from the chambers within a maximum period of thirty business days, counted from the notification of this judgment. Otherwise, all such material not retrieved within this period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Corte Plena in Session No. 27-11 of August 22, 2011, article XXVI, and published in Boletín Judicial No. 19 of January 26, 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial in Session No. 43-12, held on May 3, 2012, article LXXXI.
Por tanto:
The proceeding is declared well-founded. David Chavarría Morales and Carlos Cordero Valverde are hereby ordered, in their respective capacities as executive director and acting (a.i.) regional director of the Área de Conservación Pacífico Central, both within the Sistema Nacional de Áreas de Conservación, or whoever holds those positions, to issue the pertinent orders within the scope of their competencies so that, within FIVE DAYS from notification of this judgment, a response shall be provided to the request submitted by the petitioner on February 2, 2026, and communicated through the means designated for that purpose. This is to be done while safeguarding any sensitive or confidential data that may exist, in accordance with the Ley de Protección de la Persona frente al Tratamiento de sus Datos Personales (Ley No. 8968). The respondent party, or whoever holds that position, is advised that, pursuant to article 71 of the Ley de la Jurisdicción Constitucional, imprisonment of three months to two years or a fine of twenty to sixty days shall be imposed on whoever receives an order that must be complied with or enforced, issued within an amparo proceeding, and fails to comply with it or to cause it to be complied with, provided the offense is not more severely penalized.
The Sistema Nacional de Áreas de Conservación is ordered to pay the costs, damages, and losses (costas, daños y perjuicios) caused by the facts underlying this declaration, which shall be assessed in enforcement proceedings before the administrative court (ejecución de sentencia de lo contencioso administrativo). Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del diecinueve de junio de dos mil veintiseis .
Recurso de amparo promovido por Nombre01, cédula de identidad CED01, contra el SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN.
Resultando:
“I. Sobre el estado del proceso expropiatorio consultado El Área Silvestre Protegida no cuenta actualmente con expedientes de expropiación concluidos, toda vez que los mismos no se encuentran debidamente finalizados, al hallarse aún en fase de análisis técnico-jurídico.
En este contexto, una vez que se conforme el expediente administrativo correspondiente, se procederá a realizar el levantamiento de campo, con el fin de determinar la realidad física de los inmuebles, su ubicación respecto de los límites del Área Silvestre Protegida y la eventual existencia de derechos particulares que deban ser objeto de análisis.
En aquellos casos en que se identifique la posible existencia de derechos subjetivos sobre propiedades ubicadas dentro del territorio del Área Silvestre Protegida, se deberá proceder a su estudio conforme al ordenamiento jurídico vigente, particularmente a la luz de los principios de tutela ambiental, legalidad administrativa, seguridad jurídica y supremacía del interés público.
II.Sobre propiedades no inscritas y competencia de la jurisdicción agraria Es importante señalar que las propiedades que no se encuentren inscritas en el Registro Inmobiliario del territorio nacional deberán cumplir, de manera previa, con los requisitos legales y procesales correspondientes ante la jurisdicción agraria, a efectos de determinar la procedencia de eventuales derechos posesorios o dominicales. Dicho análisis deberá realizarse respetando en todo momento el deber constitucional del Estado de proteger los recursos naturales y el ambiente, conforme a lo dispuesto en el artículo 50 de la Constitución Política, así como la normativa ambiental, agraria y administrativa aplicable, especialmente tratándose de terrenos localizados dentro de un Área Silvestre Protegida.
III.Intervención de la Procuraduría General de la República En estos procesos, la Procuraduría General de la República (PGR) es la parte llamada a representar judicial y extrajudicialmente los intereses del Estado, tanto antes de la eventual inscripción de un bien inmueble, como en aquellos casos en que existan inscripciones registrales que deban ser objeto de impugnación, ya sea mediante la interposición de las acciones judiciales correspondientes o, cuando así proceda conforme a derecho, a través del proceso de lesividad.
IV.Sobre el proceso de lesividad en el ordenamiento jurídico costarricense El proceso de lesividad, en el marco del derecho administrativo costarricense, constituye el mecanismo jurídico mediante el cual la Administración Pública solicita al Poder Judicial la anulación de un acto administrativo firme que ha generado derechos a favor de un particular, cuando dicho acto resulta contrario al interés público, a la legalidad o a principios constitucionales, tales como la protección ambiental.
De conformidad con el principio de intangibilidad de los actos administrativos favorables, la Administración no puede revocar de oficio un acto válidamente notificado y consentido por el administrado, aun cuando posteriormente advierta su ilegalidad. En estos supuestos, debe emitir una declaratoria de lesividad, mediante un acto administrativo debidamente motivado, y acudir a la jurisdicción contenciosoadministrativa, para que sea la autoridad judicial competente la que determine su validez o eventual nulidad.
En materia ambiental y, particularmente, en lo relativo a Áreas Silvestres Protegidas, el proceso de lesividad reviste especial relevancia, en tanto permite al Estado corregir situaciones jurídicas consolidadas que comprometan bienes de dominio público, recursos naturales o ecosistemas protegidos, garantizando simultáneamente el debido proceso, el derecho de defensa y la seguridad jurídica de los particulares involucrados.
De esta forma, el proceso de lesividad se erige como una herramienta indispensable para la defensa del patrimonio natural del Estado, asegurando que los actos administrativos o inscripciones registrales incompatibles con la normativa ambiental, agraria o constitucional puedan ser revisados y eventualmente anulados por la autoridad judicial competente, con la intervención preceptiva de la Procuraduría General de la República como representante del interés público.
¿Cuál es el estado del proceso expropiatorio correspondiente las áreas agregadas al Parque Nacional Manuel Nombre02 mediante Decreto Ejecutivo 29177-MINAE publicado en la Gaceta N° 243 del 19 de diciembre del año 2000?
El proceso de lesividad, en el marco del derecho administrativo costarricense, constituye el mecanismo jurídico mediante el cual la Administración Pública solicita al Poder Judicial la anulación de un acto administrativo firme que ha generado derechos a favor de un particular, pero que resulta contrario al interés público, a la legalidad o a principios constitucionales, como la protección ambiental.
De conformidad con el principio de intangibilidad de los actos favorables, la Administración no puede revocar de oficio un acto administrativo válidamente notificado y consentido por el administrado, aun cuando advierta su ilegalidad. En estos supuestos, debe declarar previamente el acto como lesivo al interés público, mediante un acto administrativo debidamente motivado, y acudir posteriormente a la jurisdicción contencioso-administrativa, para que sea un juez quien determine su validez o nulidad.
En materia ambiental y de áreas silvestres protegidas, el proceso de lesividad reviste especial importancia, ya que permite al Estado corregir situaciones jurídicas consolidadas que comprometan bienes de dominio público, recursos naturales o ecosistemas protegidos, garantizando simultáneamente el debido proceso, el derecho de defensa y la seguridad jurídica de los particulares involucrados.
De esta forma, el proceso de lesividad se erige como una herramienta indispensable para la defensa del patrimonio natural del Estado, asegurando que los actos administrativos o inscripciones registrales que resulten incompatibles con la normativa ambiental, agraria o constitucional puedan ser revisados y eventualmente anulados por la autoridad judicial competente, con la intervención preceptiva de la Procuraduría General de la República como representante del interés público.
El SINAC para realizar el proceso de terrenos dentro de Áreas Silvestres Protegidas debe cumplir con el procedimiento oficial del SINAC publicado en La Gaceta 79 del viernes 24 de abril 2009, REGLAMENTO Nº 4-2008 DEL AMBIENTE, ENERGÍA Y TELECOMUNICACIONES, SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN, SECRETARÍA EJECUTIVA, MANUAL DE PROCEDIMIENTOS PARA ADQUISIÓN DE TERRENOS DENTRO DE ÁREAS SILVESTRES PROTEGIDAS y la Ley de Expropiaciones N° 7495.
No obstante, para el caso de los terrenos que se ubican dentro del límite del Parque Nacional Manuel Nombre02 adicionadas mediante el Decreto Ejecutivo 29177-MINAE publicado en la Gaceta N° 243 del 19 de diciembre del año 2000 en sus consideraciones indica sobre que coberturas de suelo se amplió el parque nacional:
Principalmente el punto 2, nos señala que el sector ampliado se compone de Zona Marítima terrestre (bien del estado) y humedales tipo manglar (bien demanial del estado no sujeto a inscripción). Los puntos de ampliación se realizan sobre las hojas cartográficas oficiales del IGN, escala 1: 50.000, Quepos-edición 2-IGN-CR, y Savegre- edición 1-IGN-CR, básicamente sobre el borde de los cuerpos de mangle que indica los signos convencionales de dichas hojas. Sin embargo, a pesar de que la ampliación se desarrolla sobre terrenos que no debería contar con inscripción de terceros, existe tres tipos de posesión:
• Terrenos con fincas inscritas y planos castrados.
• Terrenos solo con planos catastrados • Terrenos en posesión.
Esto son las conclusiones que realizan los productos de las consultorías:
• Informe “Estudio de la tenencia de la Tierra Parque Nacional Manuel Nombre02 Sector Playa Rey, de abril de 2012.
• Informe “Contratación de servicios técnicos y profesionales en topografía, agronomía y legal para realizar estudios El Parque Nacional Manuel Nombre02 Sector Playa Rey” de junio 2020.
Cabe mencionar que de la segunda consultoría es donde se toma la información para conformar los expedientes que fueron actualizados 2024. También ambas consultorías nos señalan que se debe realizar los estudios fotointerpretativos para definir la línea de manglar histórica y con ello valorar legalmente los expedientes que van a procesos de lesividad.
Antes de la primera consultoría del fidecomiso del PNMA pago en el 2009 el “ESTUDIO FOTOINTERPRETATIVO PARA COMPARAR AREAS DE MANGLAR Y HUMEDAL EN TRES PERIODOS DIFERENTES EN EL PARQUE NACIONAL MANUEL Nombre02 Y ÁREAS ALEDAÑAS A LOS LIMITES ACTUALES, UBICADO EN LA Dirección01” que utiliza imágenes fotográficas aéreas del sector de los años 1947, 1949, 1961 y 2003. Dicho insumo fue utilizado en dicha consultoría, pero en la del 2020 no se utiliza dicho insumo. Cabe destacar o resaltar que dicho estudio carecía de verificación de campo por parte de ACOPAC-SINAC.
Ante este escenario de falta de verificación del insumo foto interpretativo el proceso de consolidación de la tenencia de tierra se encuentra en pausa. Sin embargo a raíz de otro Recurso de Amparo donde se debe cumplir con lo indicado en la Resolución No 2021002741 de la SALA CONSTITUCIONAL en su POR TANTO tercero; el cual indica: Adicionalmente, se ordenó a Ingrid Campos Leiva, en su condición de Jefa de la Oficina Subregional Aguirre Parrita del Área de Conservación Pacífico Central del Sistema Nacional de Áreas de Conservación; y a Marta Aguilar Varela, en su condición de Directora a.i. del Instituto Geográfico Nacional, o a quienes en su lugar ejerzan esos cargos, que de manera conjunta y coordinada realicen las actuaciones correspondientes para que, en el plazo máximo de TRES MESES a partir de la notificación de esta sentencia, delimiten el ecosistema de manglar de la zona de Quepos, del Recurso de Amparo tramitado en el expediente NO 20-021786-007CO.
Producto de lo anterior se realizó la verificación y determinación de la línea de zona pública mediante el informe “verificación de campo de ecosistemas de manglar y estero foto interpretados a partir de análisis de fotos aéreas del año 1947-19491953-1961-1974-2003 entre Rio Naranjo- Quebrada Matapalo, cantón Quepos, provincia Puntarenas, localizados entre Rio Naranjo Coord. CRTM05 Lat. 1037269, Long. 487198 y Quebrada Matapalo Coord. CRTM05 Lat. 1030977, Long. 503836” además se definieron los puntos de influencia mareal de los ríos Naranjo y Savegre, también la influencia mareal del sistema estuarino de quebrada Barbudal. Todos los trabajos fueron culminados desde junio de 2024 y entregados a las jefaturas del ACOPAC para que fueran comunicados al IGN y ellos realicen la respectiva publicación de la zona pública.
Mediante el oficio CARTA-SINAC-ACOPAC-DR-0646-2025 dirigido al Máster Álvaro Alvarez Calderón, Director Instituto Geografico Nacional, la dirección del ACOPAC hace traslado al IGN de los informes técnicos de verificación de ecosistemas de manglar y estero foto interpretados denominados: Estudios de clasificación de Ecosistemas de Manglares y Esteros del Cantón de Quepos, para que esa institución procesada según corresponda con el procedimiento de publicación de la zona pública; igualmente se envió del informe de Nombre03 oficio CARTA-SINACACOPAC-DR-0646-2025 indicado para completar los insumos técnicos necesarios para avanzar en el proceso de la conformación de los diferentes expedientes desde la parte técnica, faltando el análisis jurídico legal en el cual se definiría los diferentes acciones ya sea de compra directa, proceso expropiatorio o recursos de lesividad.
A partir de que dicha línea ya este publicada y disponible en las plataformas SIRI y SNIT. Se utilizarán los recursos del fidecomiso para contratación de abogados para la revisión de información, su valoración y análisis. Las carpetas a revisión son las indicadas en el siguiente cuadro:

- ¿Cuál es el procedimiento para revisar y fotocopiar dicho expediente y cuál es el contacto del área o funcionarios públicos que pueden facilitar dicha gestión?
El Área Silvestre Protegida no cuenta actualmente con expedientes de expropiación concluidos, toda vez que los mismos no se encuentran debidamente finalizados, al hallarse aún en fase de análisis técnico-jurídico.
En este contexto, una vez que se conforme el expediente administrativo correspondiente, se procederá a realizar el levantamiento de campo, con el fin de determinar la realidad física de los inmuebles, su ubicación respecto de los límites del Área Silvestre Protegida y la eventual existencia de derechos particulares que deban ser objeto de estudio.
En aquellos casos en que se identifique la posible existencia de derechos subjetivos sobre propiedades ubicadas dentro del territorio del Área Silvestre Protegida, se deberá proceder a su análisis conforme al ordenamiento jurídico vigente, particularmente a la luz de los principios de tutela ambiental, legalidad administrativa y supremacía del interés público.
Es importante señalar que las propiedades que no se encuentren inscritas en el Registro Inmobiliario del territorio nacional deberán cumplir, de manera previa, con los requisitos legales y procesales correspondientes ante la jurisdicción agraria, a efectos de determinar la procedencia de eventuales derechos posesorios o dominicales, respetando en todo momento el deber constitucional del Estado de proteger los recursos naturales y el ambiente, conforme a lo dispuesto en el artículo 50 de la Constitución Política.
En dichos procesos, la Procuraduría General de la República será la parte llamada a representar judicial y extrajudicialmente los intereses del Estado, tanto antes de la eventual inscripción de un bien inmueble como en los casos en que existan inscripciones registrales que deban ser impugnadas, ya sea mediante la interposición de acciones judiciales correspondientes o a través del proceso de lesividad, cuando así proceda conforme a derecho”.
“I.- Marco constitucional, alcance del amparo y estándar de análisis aplicable El recurso de amparo, previsto en los artículos 10 y 48 de la Constitución Política y desarrollado por la Ley de la Jurisdicción Constitucional, constituye un mecanismo excepcional y subsidiario de tutela de derechos fundamentales, destinado a corregir actuaciones u omisiones manifiestamente ilegítimas de la Administración Pública.
La jurisprudencia reiterada de la Sala Constitucional ha establecido de forma consistente que el amparo no sustituye los procedimientos administrativos ordinarios, ni constituye una vía para forzar decisiones anticipadas, especialmente cuando estas requieren análisis técnicos, jurídicos y patrimoniales complejos, como ocurre en materias vinculadas con expropiaciones, determinación de derechos reales, dominio público y protección del Patrimonio Natural del Estado.
En consecuencia, la mera disconformidad del administrado con el ritmo, las fases o la complejidad de un procedimiento no configura, por sí misma, una violación a derechos fundamentales, cuando la Administración actúa de manera motivada, razonable y conforme al ordenamiento jurídico.
Il. Principio de legalidad y deber institucional de especial diligencia ambiental Las actuaciones del SINAC y del ACOPAC se encuentran regidas por el principio de legalidad administrativa, así como por el mandato constitucional de protección reforzada del ambiente, consagrado en el artículo 50 de la Constitución Política.
La Sala Constitucional ha reconocido de manera reiterada que, en materia ambiental, la Administración está obligada a observar un estándar elevado de diligencia, lo cual incluye:
• Verificar exhaustivamente la situación jurídica de los terrenos.
• Evitar decisiones precipitadas o carentes de certeza registral, técnica o jurisdiccional.
• Actuar de forma progresiva, prudente y motivada.
En este contexto, la abstención de emitir actos conclusivos sin contar con los insumos legales completos no constituye inactividad ilegítima, sino una manifestación de cumplimiento del principio de legalidad, orientada a prevenir afectaciones irreversibles al ambiente, al erario público y a derechos de terceros.
En relación con los hechos alegados por la parte recurrente, se reitera en todos sus extremos el informe rendido ante esa Sala mediante oficio CARTA-SINAC-ACOPAC-DR-0182-2026, de fecha 24 de abril de 2026, el cual mantiene plena vigencia y contiene una descripción detallada, clara y documentada del estado de los procedimientos administrativos correspondientes.
A efectos de claridad expositiva, se sintetizan a continuación los aspectos sustanciales allí expuestos, sin alterar ni ampliar el contenido originalmente informado.
Dicha circunstancia no obedece a una negativa ni a una omisión injustificada, sino al cumplimiento estricto de los requisitos legales que rigen este tipo de procedimientos, cuya adopción anticipada podría generar nulidades, responsabilidades patrimoniales y afectaciones ambientales irreversibles.
Los criterios reiterados de la Procuraduría General de la República han sido claros en señalar que:
• El Patrimonio Natural del Estado es inalienable y goza de tutela reforzada.
• La Administración debe abstenerse de resolver cuando carece de certeza jurídica plena.
• La actuación administrativa sin expediente completo o sin respaldo técnico suficiente puede generar responsabilidades para los funcionarios.
Lejos de justificar inactividad, estos criterios refuerzan el deber de prudencia jurídica que ha guiado la actuación de las autoridades recurridas.
De lo expuesto se concluye que:
• La Administración ha respondido a las solicitudes formuladas.
• Ha brindado explicaciones claras, técnicas y jurídicamente motivadas.
• Ha justificado objetivamente por qué no es posible emitir actos definitivos en esta fase.
Por tanto, no se configura lesión actual ni inminente a derechos fundamentales, sino una actuación administrativa razonable, progresiva y conforme a derecho, incompatible con el supuesto de violación constitucional que daría lugar a la procedencia del amparo.
VIl. Resguardo de la actuación jerárquica y responsabilidad funcional Resulta fundamental destacar que los jerarcas institucionales han actuado con especial prudencia, precisamente para evitar decisiones contrarias al bloque de legalidad que pudieran:
• Comprometer el interés público ambiental, • Generar nulidades administrativas, • O derivar en responsabilidades personales o institucionales.
Esta conducta es coherente con la jurisprudencia constitucional que impone a la Administración un especial deber de cuidado en materia ambiental, incluso cuando ello implique mayor complejidad o duración de los procedimientos.
Por todo lo expuesto, respetuosamente se solicita a esa Honorable Sala Constitucional declarar sin lugar el recurso de amparo interpuesto, al no evidenciarse vulneración alguna a derechos fundamentales atribuible a las autoridades recurridas.
Se tiene por debidamente evacuada la prevención, reiterándose que las actuaciones administrativas cuestionadas se encuentran plenamente ajustadas al ordenamiento jurídico vigente y a la jurisprudencia constitucional”.
“DE PREVIO Con ocasión de la contestación al recurso de amparo presentada por esta dependencia el día 30 de abril de 2026, se advirtió con posterioridad la existencia de un error material en la identificación de uno de los documentos aportados como prueba.
En concreto, se consignó erróneamente que uno de los insumos documentales correspondía al oficio SINAC-ACOPAC-PNMA-RBS-TT-037-2026, siendo lo correcto que dicho documento corresponde al oficio SINAC-ACOPAC-PNMA-RBS-TT-051-2026.
En virtud de lo anterior, y a fin de resguardar la debida claridad, precisión y corrección procesal, se solicita muy respetuosamente a su estimable Autoridad dejar sin efecto la contestación presentada por esta dependencia el día 30 de abril de 2026, Marco constitucional, alcance del amparo y estándar de análisis aplicable El recurso de amparo, previsto en los artículos 10 y 48 de la Constitución Política y desarrollado por la Ley de la Jurisdicción Constitucional, constituye un mecanismo excepcional y subsidiario de tutela de derechos fundamentales, destinado a corregir actuaciones u omisiones manifiestamente ilegítimas de la Administración Publica.
La jurisprudencia reiterada de la Sala Constitucional ha establecido de forma consistente que el amparo no sustituye los procedimientos administrativos ordinarios, ni constituye una vía para forzar decisiones anticipadas, especialmente cuando estas requieren análisis técnicos, jurídicos y patrimoniales complejos, como ocurre en materias vinculadas con expropiaciones, determinación de derechos reales, dominio público y protección del Patrimonio Natural del Estado.
En consecuencia, la mera disconformidad del administrado con el ritmo, las fases o la complejidad de un procedimiento no configura, por sí misma, una violación a derechos fundamentales, cuando la Administración actúa de manera motivada, razonable y conforme al ordenamiento jurídico.
Il. Principio de legalidad y deber institucional de especial diligencia ambiental Las actuaciones del SINAC y del ACOPAC se encuentran regidas por el principio de legalidad administrativa, así como por el mandato constitucional de protección reforzada del ambiente, consagrado en el artículo 50 de la Constitución Política.
La Sala Constitucional ha reconocido de manera reiterada que, en materia ambiental, la Administración está obligada a observar un estándar elevado de diligencia, lo cual incluye:
• Verificar exhaustivamente la situación jurídica de los terrenos.
• Evitar decisiones precipitadas o carentes de certeza registral, técnica o jurisdiccional.
• Actuar de forma progresiva, prudente y motivada.
En este contexto, la abstención de emitir actos conclusivos sin contar con los insumos legales completos no constituye inactividad ilegítima, sino una manifestación de cumplimiento del principio de legalidad, orientada a prevenir afectaciones irreversibles al ambiente, al erario público y a derechos de terceros.
En relación con los hechos alegados por la parte recurrente, se reitera en todos sus extremos el informe rendido ante esa Sala mediante oficio CARTA-SINAC-ACOPAC-DR-0182-2026, de fecha 24 de abril de 2026, el cual mantiene plena vigencia y contiene una descripción detallada, clara y documentada del estado de los procedimientos administrativos correspondientes.
A efectos de claridad expositiva, se sintetizan a continuación los aspectos sustanciales allí expuestos, sin alterar ni ampliar el contenido originalmente informado.
Dicha circunstancia no obedece a una negativa ni a una omisión injustificada, sino al cumplimiento estricto de los requisitos legales que rigen este tipo de procedimientos, cuya adopción anticipada podría generar nulidades, responsabilidades patrimoniales y afectaciones ambientales irreversibles.
v. Criterios de la Procuraduría General de la República (PGR) Los criterios reiterados de la Procuraduría General de la República han sido claros en señalar que:
• El Patrimonio Natural del Estado es inalienable y goza de tutela reforzada.
• La Administración debe abstenerse de resolver cuando carece de certeza jurídica plena.
• La actuación administrativa sin expediente completo o sin respaldo técnico suficiente puede generar responsabilidades para los funcionarios.
Lejos de justificar inactividad, estos criterios refuerzan el deber de prudencia jurídica que ha guiado la actuación de las autoridades recurridas.
De lo expuesto se concluye que:
• La Administración ha respondido a las solicitudes formuladas.
• Ha brindado explicaciones claras, técnicas y jurídicamente motivadas.
• Ha justificado objetivamente por qué no es posible emitir actos definitivos en esta fase.
Por tanto, no se configura lesión actual ni inminente a derechos fundamentales, sino una actuación administrativa razonable, progresiva y conforme a derecho, incompatible con el supuesto de violación constitucional que daría lugar a la procedencia del amparo.
Resulta fundamental destacar que los jerarcas institucionales han actuado con especial prudencia, precisamente para evitar decisiones contrarias al bloque de legalidad que pudieran:
• Comprometer el interés público ambiental, • Generar nulidades administrativas, • O derivar en responsabilidades personales o institucionales.
Esta conducta es coherente con la jurisprudencia constitucional que impone a la Administración un especial deber de cuidado en materia ambiental, incluso cuando ello implique mayor complejidad o duración de los procedimientos.
VIll. Petitoria Por todo lo expuesto, respetuosamente se solicita a esa Honorable Sala Constitucional declarar sin lugar el recurso de amparo interpuesto, al no evidenciarse vulneración alguna a derechos fundamentales atribuible a las autoridades recurridas.
Se tiene por debidamente evacuada la prevención, reiterándose que las actuaciones administrativas cuestionadas se encuentran plenamente ajustadas al ordenamiento jurídico vigente y a la jurisprudencia constitucional”.
Redacta la Magistrada Garro Vargas; y,
Considerando:
I.Objeto del recurso. El recurrente alega que el 02 de febrero de 2026 remitió a la dirección electrónica ...01 una solicitud de información dirigida al Sistema Nacional de Áreas de Conservación (SINAC), mediante la cual requirió lo siguiente: “solicito se me informe lo siguiente: - ¿Cuál es el estado del proceso expropiatorio correspondiente las áreas agregadas al Parque Nacional Manuel Nombre02 mediante Decreto Ejecutivo 29177-MINAE publicado en la Gaceta N° 243 del 19 de diciembre del año 2000? - ¿Cuál es el procedimiento para revisar y fotocopiar dicho expediente y cuál es el contacto del área o funcionarios públicos que pueden facilitar dicha gestión?”. Afirma que el 03 de febrero de 2026, la Dirección Ejecutiva del SINAC remitió la solicitud de información al Área de Conservación Pacífico Central (ACOPAC). Acusa que a la fecha de interposición del presente recurso no ha recibido respuesta.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
III.Hecho no probado. No se estima demostrado el siguiente hecho de relevancia para esta resolución: Único. Que las autoridades recurridas hayan contestado la gestión planteada por el 02 de febrero de 2026.
IV.Sobre el caso concreto. En el caso bajo estudio, después de analizar los elementos probatorios aportados y el informe rendido bajo juramento por la autoridad recurrida, con oportuno apercibimiento de las consecuencias previstas en el artículo 44 de la Ley de la Jurisdicción Constitucional, se tiene acreditado el 02 de febrero de 2026, el recurrente envió a la dirección electrónica ...01 una solicitud de información dirigida al Sistema Nacional de Áreas de Conservación (SINAC), mediante la cual requirió lo siguiente: “solicito se me informe lo siguiente: - ¿Cuál es el estado del proceso expropiatorio correspondiente las áreas agregadas al Parque Nacional Manuel Nombre02 mediante Decreto Ejecutivo 29177-MINAE publicado en la Gaceta N° 243 del 19 de diciembre del año 2000? - ¿Cuál es el procedimiento para revisar y fotocopiar dicho expediente y cuál es el contacto del área o funcionarios públicos que pueden facilitar dicha gestión?”.
Primeramente, cabe indicar que, pese a lo prevenido en el auto inicial de curso del presente proceso a las autoridades accionadas, a fin de que informaran si el correo electrónico al cual se remitió la solicitud de información está previsto como mecanismo oficial para la recepción de gestiones de los usuarios, omitieron referirse a este aspecto. Por tanto, de conformidad con lo previsto por el artículo 45 de la Ley de la Jurisdicción Constitucional se tiene por cierto que el correo electrónico referido es un medio oficial de comunicación de la autoridad accionada.
Ahora es menester indicar que, si bien las autoridades recurridas del SINAC se apersonan al presente proceso, lo cierto es que no se refirieron en concreto si contestaron la gestión planteada por el recurrente 02 de febrero de 2026, ni tampoco si le notificó la respuesta correspondiente al medio señalado para tales efectos.
Bajo tal estado de las cosas, este Tribunal determina que, desde la presentación de la gestión en cuestión el 02 de febrero de 2026 han transcurrido más de dos meses, sin que se le haya dado respuesta a la solicitud del recurrente, lo cual a criterio de esta Sala resulta un plazo excesivo para dar respuesta a la gestión del amparado, omisión que violenta el derecho de petición y pronta respuesta consagrado en el artículo 27 de la Constitución Política. En mérito de lo expuesto, se acoge el recurso en los términos que se establecen en la parte dispositiva de esta sentencia.
V.Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles, contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión No. 27-11, del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial No. 19, del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión No. 43-12, celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara con lugar el recurso. Se ordena a David Chavarría Morales y a Carlos Cordero Valverde, en sus respectivas condiciones de director ejecutivo y director regional a.i. del Área de Conservación Pacífico Central, ambos del Sistema Nacional de Áreas de Conservación, o a quienes ocupen ese cargos, que giren las órdenes pertinentes que estén dentro del ámbito de sus competencias para que, dentro del plazo de CINCO DÍAS contados a partir de la notificación de esta sentencia, se dé respuesta a la gestión planteada por el recurrente el 02 de febrero de 2026 y la comunique al medio señalado al efecto. Lo anterior, salvaguardando para tales efectos los datos sensibles o confidenciales, en caso de haberlos, de conformidad con la Ley de Protección de la Persona frente al Tratamiento de sus Datos Personales (Ley No. 8968). Se advierte a la parte recurrida, o a quien ocupe su cargo, que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo, y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.
Se condena al Sistema Nacional de Áreas de Conservación al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Notifíquese.
