Writ of amparo (recurso de amparo) filed by Nombre01, national identity card number CED01, on behalf of Nombre02, identity card number CED02, against the Ministerio de Ambiente y Energía (MINAE).
BACKGROUND:
"II. Legal Considerations: FIRST: The writ of amparo is a judicial proceeding conducted before the Sala Constitucional and constitutes what is known as the constitutional jurisdiction of liberty. Its existence guarantees the enforceability of the fundamental rights established in the Constitución Política and in the international human rights treaties in force in the country. The Ley de la Jurisdicción Constitucional provides in Article 29 that the writ of amparo guarantees the fundamental rights and liberties referred to therein, except those protected by habeas corpus. It further provides that the writ lies against any provision, agreement, or ruling and, in general, against any action, omission, or mere material act not grounded in an effective administrative act, by public servants and public bodies, that has violated, violates, or threatens to violate any of those rights. It is available not only against arbitrary acts, but also against actions or omissions based on erroneously interpreted or improperly applied norms.
SECOND: Article 48 of the Constitución Política establishes that every person has the right to the writ of amparo in order to maintain or restore the enjoyment of the rights enshrined in this Constitution, as well as those fundamental rights established in international human rights instruments applicable in the Republic. An entire title of this body of law sets forth a series of individual rights and guarantees, such as the right to life in Article 21, the right to privacy, liberty, and secrecy of communications in Article 24, the right to equality enshrined in Article 33, and many others established among social rights and guarantees, such as the right to work in Article 56 and following, the right to freedom of worship in Article 75, and the right to education in Article 77. THIRD: The Sala Constitucional is subject only to the Constitution and the law, and its jurisprudence and precedents are binding erga omnes, except as to itself. This provision is significant in that what is decided by the Sala is binding on all other public bodies, both administrative and judicial, as well as on all private parties.
III.Regarding the alleged facts, the undersigned states: FIRST: In view of the facts alleged by the petitioner, the undersigned, in compliance with the order of the Sala Constitucional de la Corte Suprema de Justicia pursuant to the ruling of eleven hours twenty-four minutes of the twenty-first of April, two thousand twenty-six, hereby reports to this honorable Constitutional Tribunal that, in order to comply with the present constitutional mandate, pursuant to Article 292 of the Ley General de la Administración Pública, a report was requested from the Dirección de Agua of the Ministerio de Ambiente y Energía, which is the competent authority in this matter under the Ley de Aguas and because the challenged acts fall within the exclusive jurisdiction of that body. That office, by means of Official Communication DA0903-2026, dated April 23, 2026, reported the following: '…1. It must be noted, with respect to what the petitioner states, that according to information on record at the Registro Nacional de la Propiedad, Ms.
Nombre02, identity card CED03, does not hold any real property registered in her name. It therefore appears that the well that was closed for illegal use is not located on any property owned by the protected party. 2. According to the Registro Nacional de Concesiones maintained by the Dirección de Agua, there is a water-use concession application (concesión de aprovechamiento de agua) on file for two dug wells under case file 27324-P, in the name of Mr. Nombre03. The concession application is being processed for agricultural and livestock use (uso agropecuario) of the water from the wells. 3. Prior to resolving the case file, an on-site inspection was conducted on March 27 to verify the condition of the wells and to determine whether they are in fact excavated (artisanal) or drilled wells (pozos perforados). Upon arriving at the site, the official from the Unidad Hidrológica Tempisque-Pacífico Norte of the Dirección de Agua confirmed that two dug wells do in fact exist on the property.
As stated in technical report DA-UHTPNOL-0514-2026 of April 22, 2026, both wells are located in concrete enclosures secured with chains and padlocks. At the property, the official was received by Mr. Juan María Bustos Caravaca, who indicated that he did not have the keys to the enclosure for well No. 1, but that the keys were at Hotel Bahía de Los Piratas, as that establishment is the one using the water. At the hotel, Mr. Jaime Enrique García Velásquez, who identified himself as the Hotel Administrator, stated that he holds a water-use concession application for both wells. Well No. 1 is managed by the hotel. The condition of the well was verified on site, and the corresponding official notice (prevención) was served on Mr. Jaime García Velásquez in the capacity described above. At the time of the inspection of the aforementioned well, Ms. Linsey García Chavarría appeared and stated that she is the owner of the property on which the hotel is located and which draws water from dug well No. 1.
The corresponding notice of unauthorized water use was served on both Ms. García Chavarría and Mr. García Velásquez, as the use constitutes an illegal appropriation given that no concession exists. For his part, Mr. Bustos Caravaca indicated that well No. 2 is used by two of his brothers on separate properties where other dug wells are located. At that moment, Mr. Bustos Caravaca placed a padlock on well No. 1 in order to avoid problems. Subsequently, on April 9, 2026, a second on-site inspection was conducted jointly with officials from the Municipalidad de Santa Cruz, the Asada de Matapalo, and the Ministerio de Salud, as well as officers from the Policía Turística de Flamingo and an official from the Regional Office of AyA. Also present at the meeting were Mr. Juan María Bustos Caravaca, Jaime García Velásquez, Sabino Quintanilla Medina, José Andrés García Chavarría, Linsey García Chavarría, and Angie Chavarría Chacón, the latter allegedly acting as legal representative of the properties comprising Hotel Bahía de los Piratas.
Ms. Chavarría Chacón submitted documentation of bank transfer payments for water service, as well as a letter signed by the petitioner authorizing use of the well. During an inspection of the hotel, with Ms. Chavarría's authorization, it was confirmed that the water use is for tourism purposes. The technical report concludes as follows: "- The existence of two dug wells (No. 01 and No. 02) was verified; both have equipment installed for water extraction and are located on the property identified in the water-use concession application being processed under administrative case file No. 27324-P in the name of Nombre03; however, the use of the water resource takes place on properties other than the one where said wells are located. - Dug well No. 01 is linked to tourism activities at Hotel Bahía de los Piratas, and the water use takes place on the properties with property registry folio (folio real de matrícula) and 85208, interests 01, 02, 03, and 04; however, no water-use concession has been granted in the name of the hotel or any of the legal entities owning those properties.
- Dug well No. 02 is used for domestic human consumption in dwellings that are not located within the property where the well is situated, which constitutes an irregular condition in the use of the resource. - A watercourse was identified near the dug wells, which was dry at the time of the inspection; however, follow-up monitoring during the rainy season is considered necessary for an adequate technical assessment. - It is placed on record that the action taken by Mr. Juan María Bustos Caravaca with respect to placing a padlock on the enclosure of dug well No. 01 was carried out of his own free will, without any intervention by the undersigned. - Documentation submitted by Ms. Chavarría Chacón relating to the use of dug well No. 01 was received, including proof of electricity bill payments, bank transfers for water supply payments, and an authorization for the use of dug well No. 01 issued by a relative of the former provisional administrator of the estate (albacea provisional). - Having determined that Mr.
Jaime Enrique García Velásquez and Ms. Linsey Elena García Chavarría do not hold legal representation over the properties with property registry folio, interests 01, 02, 03, and 04, Ms. Angie Chavarría Chacón was notified that she may not make any use whatsoever of the water from dug well No. 01, given that she does not hold the corresponding authorization from this Ministry. - Similarly, Mr. Juan María Bustos Caravaca was notified that he may not make any use whatsoever of the water from dug well No. 02, because that well is located on a property other than the one where the water use is taking place. - It is recommended that this administrative case file be transferred to the Dirección de Asesoría Jurídica of this Ministry for legal handling." REGARDING CONCESSIONS FOR DUG WELLS: Pursuant to Article 6 of the Ley de Aguas, any person may draw water on their own property to meet their basic needs.
The cited article reads: "Article 6.- Every property owner may freely open wells on their properties to draw water for domestic use and the ordinary necessities of life, without the need for a concession, even if this results in a reduction of water available to neighboring properties; however, a distance of two meters must be maintained between one well and another within populated areas, and fifteen meters in rural areas between the new excavation and the neighboring wells, reservoirs, springs, and permanent irrigation channels of neighbors." According to the foregoing, a dug well may be excavated for domestic use without a permit by the property owner to cover their domestic needs. A requirement of this provision is that the well must be located on the property where it will be used, which is not the case here. Furthermore, if the use is domestic, no concession is required for the well; but if the water is to be put to any other use, a concession must be processed by the owner of the property on which the well is located and will be used.
In other words, the use being made of well No. 1 by the owners or operators of Hotel Bahía de los Piratas is illegal, and therefore the well must be closed; the interested parties must seek another water source to supply the Hotel.
The same applies to well No. 2; those using it must seek another source or a public utility provider to supply them with drinking water. For the foregoing reasons, the Sala Constitucional must be requested to deny the writ of amparo, since the veracity of the facts alleged by the protected party Nombre02 has not been demonstrated; according to the attached documents, she is not the owner of any dug well. Attached are copies of technical reports DA-UHTPNOL-0515-2026 of April 23, 2026, and DA-UHTPNOL-0514-2026, as well as a water sales contract and water payment receipts made out to Mr. Nombre04, who was then the owner of the property on which the wells are located and whose probate proceeding (mortual) is in progress according to Mr. Juan María Bustos Caravaca.
Regarding the Right of Petition and Prompt Response: The right of petition and prompt response is enshrined in Articles 27 and 41 of the Constitution, which guarantee every person not only the freedom to submit petitions to any public official or official entity but also the right to receive a prompt response. In this regard, that honorable Chamber has been developing and giving substantive content to the said right of petition and prompt response, establishing that it encompasses the ability to submit and request various actions before the Public Administration, without this entailing an obligation to resolve in accordance with what the petitioner requests. In that regard, Ruling No. 2004-03538, issued at fourteen hours thirty minutes on the thirteenth of April, two thousand four, by that Sala Constitucional provided: "The right of petition, established in Article 27 of the Constitution, refers to the right of every citizen to address in writing any public official or official entity in order to present a matter of personal interest.
This guarantee is complemented by the right to obtain a prompt response, although the latter does not mean that the petitioner must receive a response favorable to their interests. In other words, it is the right to petition and not the right to obtain what is petitioned—even though the public official must decide in strict compliance with the law—since the freedom to petition is grounded in another principle; namely, that the Administration may not restrict the right of the governed to address public bodies." In the same vein, Ruling No. 2004-07296 of eight hours fifty-six minutes of the second of July, two thousand four, of that respected Tribunal stated: "In any event, the duty to decide does not imply obtaining a favorable response or otherwise, but does require necessary congruence between the subject matter of what is requested and the subject matter of the response." Furthermore, the doctrine developed in the light of constitutional jurisprudence holds that the right of petition and prompt response is realized not in the satisfaction of the petitioner's request but rather in the timely response to the petitioner by the Administration within a reasonable period; in such cases, the period for responding is strictly related to the particular characteristics and nature of the request, including its complexity and institutional consequences—which under no circumstances is to be interpreted as a license to violate the fundamental right of the petitioner.
On this point, the Sala Constitucional itself stated in its Ruling No. 2004-03538, cited above: "what is protected is the right of every person to have their matter resolved within a reasonable period; a period that must be established in each specific case, taking into account the technical complexity of the administrative matter in question, the breadth of the evidence to be gathered, the consequences for the parties of the delay or the degree of impact on the person or the environment of the challenged act, the conduct of the litigants and the authorities involved, the ordinary guidelines and timeframes of the type of procedure in question, and the average standard for resolution of similar matters by the authorities dealing with the same subject matter…" In summary, the right of petition and response encompasses, among other things, the following elements, which in turn serve as parameters for assessing the Administration's conduct toward the petitioner in each specific case: • The right of petition guarantees the right of the governed to address public bodies. • The right of petition does not guarantee the petitioner the receipt of what is requested. • The response provided by the Administration to the petitioner must be congruent, meaning that a logical relationship must exist between the subject matter of what is requested and the subject matter of the response. • The period available to the Administration to respond to the petitioner's request depends on the complexity of the petition, in light of which this honorable Tribunal has noted the need to attend to the request within a reasonable period, which logically varies for each particular case.
It is logical and reasonable that there cannot be immediate administrative justice, since the public administration and its bodies require a prudential period in which to adequately process the respective petition and issue the most accurate administrative ruling aligned with the true facts underlying the final act. The foregoing means that between the initial request made by the petitioner and its final resolution there must elapse a physiologically necessary period of time (vacatio o distantia temporis), imposed by observance of the petitioner's fundamental rights (due process, right of defense, bilateral hearing, or adversarial proceedings) and the best possible satisfaction of the public interest. It must not be lost from sight that the administrative procedure is defined as a series of acts—by the directing administrative body, the decision-making body, and the petitioner themselves—that are linked and teleologically connected and that require time to be carried out.
Consequently, the processing of requests submitted by petitioners requires such time as is necessary to guarantee respect for their fundamental rights, adequate weighing of the factual and legal elements of the individual interest, of third-party interests, and of the public interests involved…" The Sala Constitucional further issued Ruling No. 2008-017595, at eleven hours twenty-eight minutes on the fifth of December, two thousand eight, which states: "…On the right to prompt and effective administrative justice. In repeated pronouncements, the Sala has indicated that in the administrative sphere the provisions of Article 41 of the Constitución Política likewise apply, which literally states: 'Availing themselves of the laws, all persons are entitled to redress for injuries or damage suffered in their person, property, or moral interests. They must be given prompt and effective justice, without denial and in strict conformity with the laws.' As regards prompt justice, it is evident that the excessive and unjustified duration of administrative proceedings constitutes a clear violation of that principle, since claims and appeals brought before the Administration must, for reasons of legal certainty, be resolved within reasonably short periods.
However, this does not mean the constitutionalization of a right to specific time limits, but rather the right of every person to have their matter resolved within a reasonable period, which must be established on a case-by-case basis, taking into account the complexity of the matter, the conduct of the litigants and the authorities, the consequences for the parties due to the delay, and the ordinary guidelines and timeframes of the type of proceeding in question…".

Considering:
The petitioner alleged that the protected party is an elderly adult and the owner of a dug well located in Playa Real de Cabo Velas de Santa Cruz, Guanacaste. The petitioner alleges that the respondent authority illegally closed that well with padlocks, without guaranteeing due process, leaving the family without water.
Of importance for the decision in this matter, the following facts are deemed duly established:

IV.The Specific Case. In accordance with the reports submitted under oath, with the legal and criminal consequences provided for in Article 44 of the Law governing this Jurisdiction, it is established that the protected party, Nombre02, identity card CED03, does not hold any real property registered in her name. The well that was closed for illegal use is not located on any property owned by the protected party. According to the Registro Nacional de Concesiones maintained by the Dirección de Agua of MINAE, there is a water-use concession application on file for two dug wells under case file 27324-P, in the name of Mr. Nombre03. The concession application is being processed for agricultural and livestock use of the water from the wells. Prior to resolving the case file, an on-site inspection was conducted on March 27, 2026, in order to verify the condition of the wells and to determine whether they are in fact excavated (artisanal) or drilled wells.

Ms. Chavarría Chacón submitted documentation of bank transfer payments for water service, as well as a letter signed by the petitioner authorizing use of the well. During an inspection of the hotel, with Ms. Chavarría's authorization, it was confirmed that the water use is for tourism purposes. On the property there is another dug well, No. 02, which is used for domestic human consumption in dwellings not located within the property where the well is situated, which constitutes an irregular condition in the use of the resource. Similarly, Mr. Juan María Bustos Caravaca was notified that he may not make any use whatsoever of the water from dug well No. 02, because that well is located on a property other than the one where the water use is taking place.
From the foregoing picture, it is concluded that there is no basis for granting the writ of amparo. First, there is no evidentiary element from which it can be established that the closure of well No. 1 left the protected party without access to water. On the contrary, the report is very clear that the use is being made by a hotel. Furthermore, the report is equally clear that the person who received the MINAE official during the inspection placed a padlock: "At that moment, Mr. Bustos Caravaca placed a padlock on well No. 1 in order to avoid problems," which was duly placed on record. Additionally, the report explains that no concession of any kind exists, notwithstanding that the water is being used on a different property—where the hotel is located—from the property on which the well is situated. In sum, pursuant to the reasons set forth above, the writ of amparo must be denied.
The appealing party is hereby notified that, should it have submitted any paper documents, as well as objects or evidence contained in any additional electronic, computer-based, magnetic, optical, telematic, or new-technology device, it must retrieve such materials from the office within a maximum period of 30 business days counted from the notification of this judgment. Failing that, all materials not retrieved within this period will be destroyed, pursuant to the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Full Court (Corte Plena) in session number 27-11 of August 22, 2011, article XXVI, and published in Boletín Judicial number 19 of January 26, 2012, as well as the resolution approved by the Superior Council of the Judicial Branch (Consejo Superior del Poder Judicial) in session number 43-12 held on May 3, 2012, article LXXXI.
Por tanto:

Recurso de amparo interpuesto por Nombre01, cédula de identidad número CED01, a favor de Nombre02, cédula número CED02, contra el Ministerio de Ambiente y Energía (MINAE).
RESULTANDO:
“II. Consideraciones Jurídicas: PRIMERO: El recurso de amparo es un proceso judicial que se tramita en la Sala Constitucional y que constituye la denominada jurisdicción constitucional de la libertad, su existencia garantiza la vigencia de los derechos fundamentales establecidos en la Constitución Política y en los tratados internacionales de derechos humanos vigentes en el país. La Ley de la Jurisdicción Constitucional establece en su numeral 29 que el recurso de amparo garantiza los derechos y libertades fundamentales a que se refiere esta ley, salvo los protegidos por el de hábeas corpus, establece además que procede contra toda disposición, acuerdo o resolución y, en general, contra toda acción, omisión o simple actuación material no fundada en un acto administrativo eficaz, de los servidores y órganos públicos, que haya violado, viole o amenace violar cualquiera de aquellos derechos. No sólo procede contra los actos arbitrarios, sino también contra las actuaciones u omisiones fundadas en normas erróneamente interpretadas o indebidamente aplicadas.
SEGUNDO: El artículo 48 de la Constitución Política establece que toda persona tiene derecho al recurso de amparo para mantener o restablecer el goce de los derechos consagrados en esta Constitución, así como de los de carácter fundamental, establecidos en los instrumentos internacionales sobre derechos humanos, aplicables en la República. Existe todo un título dentro de este cuerpo normativo, donde se establecen una serie de derechos y garantías individuales tales como el derecho a la vida en el artículo 21, el derecho a la intimidad, libertad y secreto de las comunicaciones del artículo 24, el derecho de igualdad que se consagra en el artículo 33 y muchos otros establecidos dentro de los derechos y garantías sociales, tales como el derecho al trabajo en el artículo 56 y siguientes, el derecho a la libertad de culto en el artículo 75 y el derecho a la educación en el artículo 77. TERCERO: La Sala Constitucional sólo está sometida a la Constitución, a la Ley y su jurisprudencia y precedentes son vinculantes “erga omnes” salvo para si misma. Esta disposición es importante dado que lo resuelto por la Sala es vinculante para los demás órganos públicos, tanto administrativos como judiciales, así como para todos los particulares.
III.Sobre los hechos alegados se manifiesta que: PRIMERO: Que en virtud de los hechos alegados por el recurrente el suscrito, en atención a lo ordenado por la Sala Constitucional de la Corte Suprema de Justicia, conforme a la resolución de las once horas con veinticuatro minutos, del veintiuno de abril de dos mil veintiséis, procedo a informarle a este honorable Tribunal Constitucional, que para cumplir con el presente mandato constitucional, de conformidad con el artículo 292 de la Ley General de la Administración Pública, se solicitó un informe a la Dirección de Agua del Ministerio de Ambiente y Energía, que es el ente competente en la materia, según la Ley de Aguas y porque los hechos recurridos, son competencia exclusiva de esa instancia, quien mediante Oficio, DA0903-2026, de fecha 23 de abril del 2026, informó lo siguiente lo siguiente: “…1. Debemos señalar respecto a lo indicado por la recurrente que conforme la información que consta en el Registro Nacional de la Propiedad, la señora Nombre02, cédula CED03, no posee bienes inmuebles inscritos a su nombre.
De tal forma pareciera ser que el pozo que se clausuró por uso ilegal no se encuentra en algún inmueble propiedad de la recurrente. 2. Conforme el Registro Nacional de Concesiones que lleva la Dirección de Agua, se tiene solicitud de concesión de aprovechamiento de dos pozos artesanales bajo el expediente 27324- P, a nombre del señor Nombre03. La concesión se tramita para aprovechar el agua de los pozos en uso agropecuario. 3-Previo a resolver el expediente, se realizó el día 27 de marzo inspección al sitio, a fin de verificar la condición de los pozos y comprobar si efectivamente los mismos son excavados (artesanales) o si se trata de pozos perforados. Al llegar al sitio, la funcionaria de la Unidad Hidrológica Tempisque-Pacífico Norte de la Dirección de Agua, comprueba que en la propiedad efectivamente existen dos pozos artesanales. Que tal y como se indica en el informe técnico DA-UHTPNOL-0514-2026 del 22 de abril del 2026, ambos pozos se ubican en casetas de concreto protegidas con cadenas y candados.
En la propiedad la funcionaria es atendida por el señor Juan María Bustos Caravaca, quien le indica que no cuenta con las llaves de la caseta del pozo N°1, pero que en el hotel Bahía de Los Piratas, se encuentran las llaves pues son ellos quienes utilizan el agua. En el hotel, el señor Jaime Enrique García Velásquez quien se identificó como Administrador del Hotel, informó que posee una solicitud de concesión de aprovechamiento de agua de ambos pozos. El pozo N°1 es administrado por el hotel. Se verifica en el sitio la condición del pozo y se procede a notificar la prevención respectiva al señor Jaime García Velásquez en la condición antes señalada. Al momento de la inspección del pozo citado supra se presenta la señora Linsey García Chavarría, quien manifiesta ser propietaria del inmueble donde se ubica el hotel que aprovecha el agua del pozo artesanal N°1. Se procede a realizar la notificación correspondiente del no uso del agua tanto a la señora García Chavarría como al señor García Velásquez, por tratarse de un aprovechamiento ilegal al no contar con concesión alguna.
Por otra parte, el señor Bustos Caravaca indica que el pozo N° 2 es aprovechado por dos hermanos de éste en propiedades diferentes en donde se ubican los pozos artesanales. En ese acto el señor Bustos Caravaca procedió a poner candado al pozo N°1 a fin de evitarse problemas. Posteriormente con fecha 9 de abril del 2026, se realiza una segunda inspección al sitio, conjuntamente con funcionarios de la Municipalidad de Santa Cruz, de la Asada de Matapalo y del Ministerio de Salud así como de la Policía Turística de Flamingo y un funcionario de la Oficina Regional del AyA. En la reunión estuvo presente además el señor Juan María Bustos Caravaca, Jaime García Velásquez, Sabino Quintanilla medina, José Andrés García Chavarría, Linsey García Chavarría y Angie Chavarría Chacón, ésta última supuestamente como representante legal de los inmuebles que conforman el Hotel Bahía de los Piratas. La señora Chavarría Chacón, aporta documentación de pago de transferencias bancarias por concepto de pago del agua, así como una carta suscrita por la recurrente autorizando el uso del pozo.
En inspección al hotel con autorización de la señora Chavarría, se constató que el uso del agua es turístico. Concluye el informe técnico lo siguiente: “ -.Se verificó la existencia de dos pozos artesanales (01 y 02), ambos con equipo instalado para la captación de agua, ubicados en el inmueble indicado en la solicitud de concesión de aprovechamiento de agua en trámite bajo el expediente administrativo número 27324-P a nombre de Nombre03, no obstante, el aprovechamiento del recurso hídrico se realiza en propiedades distintas a aquella donde se localizan dichos pozos -El pozo artesanal 01 se encuentra vinculado al desarrollo de actividades de carácter turístico en el Hotel Bahía de los Piratas, y el aprovechamiento de agua se realiza en las fincas folios real de matrícula y 85208, derechos 01, 02, 03 y 04; sin embargo, no se cuenta con concesión de aprovechamiento de agua otorgada a nombre del hotel ni de ninguna de las personas jurídicas propietarias de dichos inmuebles.
-El pozo artesanal 02 es utilizado para consumo humano tipo doméstico en viviendas que no se ubican dentro de la propiedad donde este se localiza, lo cual constituye una condición irregular en el uso del recurso. -Se identificó un cauce cercano a los pozos artesanales, el cual se encontraba seco al momento de la inspección; no obstante, se considera necesario realizar seguimiento en época lluviosa para su adecuada valoración técnica. -Se deja constancia de que la actuación realizada por el señor Juan María Bustos Caravaca, respecto a la colocación de un candado en la caseta del pozo artesanal 01, ha sido efectuado por su propia voluntad, sin intervención de la suscrita. -Se recibió documentación aportada por la señora Chavarría Chacón, relacionada con el uso del pozo artesanal 01, la cual incluye comprobantes de pago de servicio de electricidad, transferencias bancarias por concepto de suministro de agua, así como una autorización para el uso del pozo artesanal 01, emitida por un familiar del anterior albacea provisional. -Al haberse determinado que el señor Jaime Enrique García Velásquez y la señora Linsey Elena García Chavarría no ostentan la representación legal de las propiedades con folio real matrícula , derechos 01, 02, 03 y 04, se procedió a notificar a la señora Angie Chavarría Chacón, que no puede realizar ningún tipo de aprovechamiento del agua del pozo artesanal 01, en virtud de no contar con la autorización correspondiente por parte de este Ministerio. -Asimismo, se notificó al señor Juan María Bustos Caravaca que no puede realizar ningún tipo de aprovechamiento del agua del pozo artesanal 02, debido a que dicho pozo se localiza en una propiedad distinta a aquella donde se realiza el aprovechamiento. -Se recomienda trasladar este expediente administrativo a la Dirección de Asesoría Jurídica de este Ministerio para la atención legal del caso.” DE LAS CONCESIONES DE POZOS ARTESANALES Conforme el artículo 6 de la Ley de Aguas, cualquier persona puede elevar aguas dentro de su propiedad para satisfacer sus necesidades básicas.
Indica el artículo citado: “Artículo 6º.- Todo propietario puede abrir libremente sin necesidad de concesión pozos para elevar aguas dentro de sus fincas para usos domésticos y necesidades ordinarias de la vida, aunque con ello resultaren amenguadas las aguas de sus vecinos; deberá, sin embargo, guardar la distancia de dos metros entre pozo y pozo, dentro de las poblaciones, y de quince metros en el campo entre la nueva excavación y los pozos, estanques, fuentes y acequias permanentes de los vecinos.” De acuerdo con lo transcrito se puede excavar un pozo artesanal para uso doméstico sin permiso, por parte del propietario del inmueble para cubrir sus necesidades domésticas. Requisito de esta norma es que el pozo se ubique en la propiedad donde se va a aprovechar, lo cual no ocurre. Ahora bien, si el uso es doméstico, el pozo no se concesiona, pero si se la va a dar otro uso si debe de tramitarse la concesión por parte del propietario del inmueble donde está el pozo y se vaya a utilizar.
En otras palabras, el uso que los propietarios o usuarios del Hotel Bahía de los Piratas están realizando del pozo N°1 deviene en ilegal, por lo que el mismo debe de ser cerrado, debiendo buscarse los interesados otra fuente de agua para proveer al Hotel.
Lo mismo ocurre con el pozo N°2, los señores que lo utilizan deberán de buscar otra fuente o ente prestatario del servicio público que les provea el servicio de agua potable. Es por lo expuesto, debe solicitarse a la Sala Constitucional, declare sin lugar el recurso de amparo, toda vez, que no se ha demostrado la veracidad de los hechos aducidos por parte de la señora amparada Nombre02, quien conforme los documentos adjuntos, no es propietaria de ningún pozo artesanal. Se adjuntan copia de los informes técnicos DA-UHTPNOL-0515-2026 de 23 de abril del 2026, DA-UHTPNOL-0514-2026, así como contrato de venta de agua y recibos de pago del agua al señor Nombre04 entonces propietario del inmueble donde se ubican los pozos, cuya mortual está en proceso según indicaciones del señor Juan María Bustos Caravaca.
Sobre el Derecho de Petición y Pronta Respuesta: El derecho de petición y pronta respuesta se encuentra consagrado en los numerales 27 y 41 constitucionales, mediante los cuales se garantiza a cualquier persona, no solo la libertad de petición ante cualquier funcionario público o entidad oficial sino el derecho a obtener pronta respuesta. En este aspecto esa honorable Sala ha venido desarrollando y dotando de contenido el referido derecho de petición y pronta respuesta, es así que se sostiene que el mismo comprende la posibilidad presentar y solicitar distintas gestiones ante la Administración Pública, sin que ello comporte la obligación de resolver de conformidad con lo requerido por el Administrado. En ese sentido, la resolución No. 2004-03538 de las catorce horas con treinta minutos del trece de abril del dos mil cuatro de esa Sala Constitucional dispuso: “El derecho de petición, establecido en el artículo 27 Constitucional, hace referencia a la facultad que posee todo ciudadano para dirigirse por escrito a cualquier funcionario público o entidad oficial con el fin de exponer un asunto de su interés.
Esta garantía se complementa con el derecho a obtener pronta respuesta, aunque esto último no significa que el administrado deba recibir una contestación favorable a sus intereses. En otras palabras, es el derecho a pedir y no el derecho a obtener lo que se pide —aún cuando el funcionario público deba resolver con estricta sujeción a la ley —, pues la libertad de petición se funda en otro principio; esto es, que la Administración no puede coartar el derecho de los gobernados para dirigirse a los órganos públicos.” En el mismo orden de ideas, la sentencia No. 2004-07296 de las ocho horas con cincuenta y seis minutos del dos de julio del dos mil cuatro de ese respetable Tribunal indicó: “En todo caso, el deber de resolver no implica la obtención de una respuesta favorable o no, pero sí la necesaria congruencia entre el objeto de lo pedido y el de lo contestado.” Por otra parte, la doctrina desarrollada a la luz de la jurisprudencia constitucional señala que el derecho de petición y pronta respuesta se concreta no en la satisfacción de la petición del solicitante sino en la oportuna contestación a aquel de parte de la Administración en un plazo razonable, en cuyo caso el plazo para contestar guarda estricta relación con las características propias de la naturaleza de la solicitud, en cuenta su complejidad y consecuencias institucionales, lo que bajo ninguna circunstancia se interpreta como una licencia para vulnerar el derecho fundamental del solicitante.
Sobre el particular la propia Sala Constitucional ha señalado en su sentencia No. 2004-03538 de previa cita: “lo que se tutela es el derecho que toda persona tiene a que su causa se resuelva dentro de un plazo razonable; plazo que ha de ser establecido en cada caso concreto, atendiendo a la complejidad técnica del asunto administrativo del que se trate, la amplitud de la prueba por evacuar, las consecuencias para las partes de la demora o el grado de afectación a la persona o al ambiente del acto impugnado, la conducta de los litigantes y de las autoridades involucradas, las pautas y márgenes ordinarios del tipo de procedimiento en cuestión y el estándar medio para la resolución de asuntos similares por las autoridades de la misma materia...” Recapitulando, el derecho de petición y respuesta comprende, entre otros, los siguientes elementos, los cuales a su vez sirven de parámetro para valorar la gestión de la Administración ante el administrado en cada caso concreto: • El derecho de petición garantiza el derecho de los gobernados para dirigirse a los órganos públicos. • El derecho de petición no garantiza al administrado la obtención de lo pedido. • La respuesta que la Administración le proporcione al administrado debe ser congruente, lo que implica que debe guardarse una relación lógica entre el objeto de lo pedido y el de lo contestado. • El plazo del que goza la Administración para contestar la petición del gobernado responde a la complejidad de la petición, en virtud de lo cual ese Honorable Tribunal ha apuntado la necesidad de atender la solicitud en un plazo razonable, el cual lógicamente varía para cada caso en particular.
Es lógico y sensato que no puede haber una justicia administrativa inmediata, puesto que la administración pública y sus órganos requieren de un plazo prudencial para tramitar de forma adecuada la respectiva petición y dictar la resolución administrativa más acertada y apegada a la verdad real de los hechos que constituyen el motivo del acto final. Lo anterior significa que entre el pedimento inicial formulado por el administrado y su resolución final debe medir un tiempo fisiológicamente necesario (vacatio o distantia temporis), impuesto por la observancia de los derechos fundamentales de aquel (debido proceso, defensa, bilateralidad de la audiencia o contradictorio) y la mejor satisfacción posible de los intereses públicos. No debe perderse la perspectiva que le procedimiento administrativo se define como un conjunto de actos-del órgano administrativo director, decisor y del propio gestionante- concatenados y teleológicamente vinculados o unidos que precisan de tiempo para verificarse.
Consecuentemente, la substanciación de las solicitudes formuladas por los administrados requiere de un tiempo necesario que garantice el respeto de los derechos fundamentales de éstos, una ponderación adecuada de los elementos fácticos, jurídicos del interés particular, de terceros y de los intereses públicos involucrados…” Ahora bien la Sala Constitucional emitió el voto No. 2008-017595, de las once horas con veintiocho minutos del cinco de diciembre del año dos mil ocho, el cual manifiesta lo siguiente: “…Sobre el derecho a obtener justicia administrativa pronta y cumplida. En reiterados pronunciamientos la Sala ha indicado que en sede administrativa también procede aplicar lo dispuesto en el Artículo 41 de la Constitución Política, que literalmente indica: ”Ocurriendo a las leyes, todos han de encontrar reparación para las injurias o daños que hayan recibido en su persona, propiedad o intereses morales.
Debe hacérseles justicia pronta y cumplida, sin denegación y en estricta conformidad con las leyes”. En cuanto a la justicia pronta, es evidente que la duración excesiva y no justificada de los procesos administrativos implican una clara violación a ese principio, pues los reclamos y recursos puestos a conocimientos de la Administración, deben ser resueltos, por razones de seguridad jurídica, en plazos razonablemente cortos. Sin embargo, esto no significa la constitucionalización de un derecho a los plazos, si no el derecho de toda persona que su causa sea resuelta en un plazo razonable, lo que ha de ser establecido casuísticamente, atendiendo a la complejidad del asunto, la conducta de los litigantes y las autoridades, las consecuencias para las partes por la demora, y las pautas y márgenes ordinarios del tipo de proceso del que se trata…”.
Redacta el Magistrado Cruz Castro; y,
Considerando:
El recurrente alegó que la amparada es una persona adulta mayor y es dueña de un pozo artesanal ubicado en Playa Real de Cabo Velas de Santa Cruz, Guanacaste. Acusa que la autoridad recurrida cerró ilegalmente ese pozo, con candados, sin garantizar el debido proceso quedando la familia sin agua.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
De importancia para resolver este proceso, se tiene por no demostrado el siguiente: Único.- Que la amparada no tenga acceso al agua debido al cierre de poso que indica el recurrente.
IV.Caso concreto. De conformidad con los informes bajo fe de juramento con las consecuencias legales, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción, se comprueba que, la amparada Nombre02, cédula CED03, no posee bienes inmuebles inscritos a su nombre. El pozo que se clausuró por uso ilegal no se encuentra en algún inmueble propiedad de la amparada. Conforme el Registro Nacional de Concesiones que lleva la Dirección de Agua del MINAE, se tiene solicitud de concesión de aprovechamiento de dos pozos artesanales bajo el expediente 27324-P, a nombre del señor Nombre03. La concesión se tramita para aprovechar el agua de los pozos en uso agropecuario. Previo a resolver el expediente, se realizó el día 27 de marzo del 2026 inspección al sitio, a fin de verificar la condición de los pozos y comprobar si efectivamente los mismos son excavados (artesanales) o si se trata de pozos perforados.
Al llegar al sitio, la funcionaria de la Unidad Hidrológica Tempisque-Pacífico Norte de la Dirección de Agua, comprueba que en la propiedad efectivamente existen dos pozos artesanales. En la propiedad la funcionaria es atendida por el señor Juan María Bustos Caravaca, quien le indica que no cuenta con las llaves de la caseta del pozo N°1, pero que en el hotel Bahía de Los Piratas, se encuentran las llaves pues son ellos quienes utilizan el agua. En el hotel, el señor Jaime Enrique García Velásquez quien se identificó como Administrador del Hotel, informó que posee una solicitud de concesión de aprovechamiento de agua de ambos pozos. El pozo N°1 es administrado por el hotel. Se verifica en el sitio la condición del pozo y se procede a notificar la prevención respectiva al señor Jaime García Velásquez en la condición antes señalada.
Al momento de la inspección del pozo citado supra se presenta la señora Linsey García Chavarría, quien manifiesta ser propietaria del inmueble donde se ubica el hotel que aprovecha el agua del pozo artesanal N°1. Se procede a realizar la notificación correspondiente del no uso del agua tanto a la señora García Chavarría como al señor García Velásquez, por tratarse de un aprovechamiento ilegal al no contar con concesión alguna. El señor Bustos Caravaca procedió a poner candado al pozo N°1 a fin de evitarse problemas. Se dejó constancia de “que la actuación realizada por el señor Juan María Bustos Caravaca, respecto a la colocación de un candado en la caseta del pozo artesanal 01, ha sido efectuado por su propia voluntad, sin intervención de la suscrita”, funcionaria del MINAE. Posteriormente con fecha 9 de abril del 2026, se realiza una segunda inspección al sitio, conjuntamente con funcionarios de la Municipalidad de Santa Cruz, de la Asada de Matapalo y del Ministerio de Salud así como de la Policía Turística de Flamingo y un funcionario de la Oficina Regional del AyA.
En la reunión estuvo presente además el señor Juan María Bustos Caravaca, Jaime García Velásquez, Sabino Quintanilla medina, José Andrés García Chavarría, Linsey García Chavarría y Angie Chavarría Chacón, ésta última supuestamente como representante legal de los inmuebles que conforman el Hotel Bahía de los Piratas. La señora Chavarría Chacón, aporta documentación de pago de transferencias bancarias por concepto de pago del agua, así como una carta suscrita por la recurrente autorizando el uso del pozo. En inspección al hotel con autorización de la señora Chavarría, se constató que el uso del agua es turístico. En la propiedad se encuentra otro pozo artesanal 02 que es utilizado para consumo humano tipo doméstico en viviendas que no se ubican dentro de la propiedad donde este se localiza, lo cual constituye una condición irregular en el uso del recurso. Asimismo, se notificó al señor Juan María Bustos Caravaca que no puede realizar ningún tipo de aprovechamiento del agua del pozo artesanal 02, debido a que dicho pozo se localiza en una propiedad distinta a aquella donde se realiza el aprovechamiento.
Del panorama expuesto se concluye que no hay razón para estimar el recurso. En primer término no hay ningún elemento de juicio conforme al cual se pueda tener por demostrado que el cierre del pozo 1 hubiera dejado a la amparada si acceso al agua. Al contrario, el informe es muy claro en cuanto a que el uso es por parte de un hotel. Por otra parte, el informe es también muy claro en cuanto a que quien atendió a la funcionario del MINAE en la inspección un candado: “En ese acto el señor Bustos Caravaca procedió a poner candado al pozo N°1 a fin de evitarse problemas”, de lo que se dejó constancia. Por otra parte, en el informe también se explica que no hay ninguna concesión, pese a que el agua se utiliza en una propiedad (donde está el hotel) distinta a la propiedad donde está el pozo. En suma, de conformidad con las razones expuestas, el recurso debe declararse sin lugar.
Se previene a la parte recurrente que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, deberá retirarlos del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión número 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión número 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
POR TANTO:
Se declara sin lugar el recurso.
