Document Review CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours thirty minutes on the ninth of June of two thousand twenty-six.
Writ of amparo (recurso de amparo) processed in case file number 25-033811-0007-CO, filed by [Nombre 001], national identification number [Valor 001], against the ASOCIACION DE PRODUCTORES DE SALINAS DOS, COMISION NACIONAL DE PREVENCION DE RIESGOS Y ATENCION DE EMERGENCIAS, INSTITUTO DE DESARROLLO RURAL, MINISTERIO DE AMBIENTE Y ENERGIA, MUNICIPALIDAD DE ESPARZA, SISTEMA NACIONAL DE AREAS DE CONSERVACION.
Background:
Having provided a brief account of the background of the situation in the APROSA sector and part of the Salinas II sector, and in order to address the claims made by [Nombre 001], the following is stated with respect to each of the alleged facts:
Regarding the first fact, it must be noted that it is partly accurate, since, as already set forth above, several meetings have indeed been held with residents of the area, who have reported being affected by the flooding that has occurred during the rainy season in recent years. However, the Institute clarifies that it cannot accept as accurate the claim that the flooding is caused by the lack of culvert maintenance and by the blockage of the river's natural channel, since to date there are no technical studies establishing this, and it is even known that in recent years rainy-season conditions have changed, with increased precipitation due to various natural phenomena.
Regarding the second fact, what is stated is partly accurate in that the specific stretch reported to be affected does fall within the Zona Protectora de Tivives; however, the claim of a lack of interinstitutional coordination to identify a possible solution cannot be accepted, at least on the part of the Institute, because the Institute has made the relevant inquiries to both SINAC and the Municipalidad to determine whether any intervention in the sector in question is possible, and to obtain technical guidance on the actions that could potentially be carried out in that area. In addition, as a means of achieving some temporary palliative improvement, the Institute also attempted to carry out procurement for the installation of some culverts for the rainy season, which could not be executed because the respective procurement process was tendered on two occasions without being completed, due to a lack of bidders, making it impossible to pursue any other process for this temporary solution.
- Publication of procurement 2025-LD-000013-0015500001, entitled Colocación de alcantarilla de 1,5m de diámetro, 6 m de longitud en Asentamiento Salinas II, sector APROSA del Centro de Población, corresponding to the Territorial Development Office of Orotina, published on 27-03-2025. 417 bidders were invited; on that occasion only one company made inquiries about the above-mentioned procurement, and its representatives visited the facilities on March 31, 2025, but no company submitted a bid, so the process was declared unsuccessful. This was processed through SICOP.
- A second publication was made under procurement number 2025LD-000054-001550001, published on June 18, 2025, inviting 419 suppliers. In this second publication, no companies attended the technical site visit, and no inquiries or bids were received, so it was also declared unsuccessful.
The matter raised in point three does not fall within the purview of this office, as it refers specifically to the Municipalidad de Esparza.
Regarding fact number four, it must be clarified that, although this matter is not directly related to the Institute, it is known from statements made by those affected (in this case, the owners of the land adjacent to the natural channel) that during the dry season producers have used that sector as a transit route for their products, since according to them it offers better trafficability conditions than the public road giving access to the parcels; and that once the harvest season ends and the rainy season begins, they do not remove the material they have placed there, thereby causing the reported harm. It is reiterated that this is known from statements made by those affected.
It is also important to note in this regard that, according to the reports of flooding impacts in this area, it was only last year that any kind of complaint was received, from which point this office has been seeking a possible response to the reported harm.
Regarding what is stated in the fifth fact, it must be clarified that, although the interventions in the area have taken place without the Institute's express authorization, it is not acceptable to claim that no measures have been taken on the matter to date, because, prior to making a final decision on the impact in the area and any possible intervention, a specific inquiry was made to SINAC about the possibility of carrying out any infrastructure work at the site, as well as requesting the technical opinion of the Municipalidad on what works could potentially be carried out and implemented at the site to prevent flood impacts. This was done pursuant to official communications INDER-GG-DRT-RDPC-OTOR-OFI-0609-2025, sent to SINAC by email on November 3, 2025, and INDER-GG-DRT-RDPC-OFI-0484-2025, sent on December 6, 2024, which are pending response.
Regarding the sixth fact, which reiterates that interinstitutional meetings were held and that these meetings documented the identification of the problem, recommended the cleaning and restoration of the channel and a hydrologist visit, without any action having been taken in this regard, it must be clarified that, at least during the site visits conducted by INDER officials, such matters were not documented in the minutes; it is not known whether what is described refers to other occasions or visits at which the Institute was not present. Nevertheless, it is reiterated that, at least on the part of the Institute, a temporary alternative to the possible harm has been sought.
The matters described in the seventh, eighth, and ninth facts do not refer to actions or situations related to the Institute, and therefore no comment will be made regarding them.
As for the tenth fact, it corresponds to what the petitioner considers a violation of her rights and does not in itself constitute a fact to be accepted or refuted, so no comment is made regarding it.
Based on the foregoing, and considering the alleged violation of the petitioner's rights, the Institute states that no action has been taken to date that affects those rights; on the contrary, it reiterates that from the moment the flooding impacts in that sector came to the attention of the Territorial Development Office of Orotina of INDER, various actions have been pursued, both with those affected and with other entities, to identify the problem and a possible solution, if one is feasible, given the implications of the affected sector being located within the Zona Protectora de Tivives. It is further reiterated that, to date, the Institute has made the necessary efforts to seek a possible temporary solution within the applicable regulatory framework, while matters falling within the competence of other authorities to determine and identify lie beyond the Institute's scope of action.
Finally, it should be noted that the sector subject to this amparo is located within the Zona Protectora de Tivives, considered State Natural Heritage (Patrimonio Natural del Estado), the conservation and administration of which is entrusted by law to the Ministerio de Ambiente y Energía through SINAC. Any possible interventions in that sector must be authorized by SINAC. With regard to the State Natural Heritage, the Sala Constitucional of the Corte Suprema de Justicia, in vote #16975-2008, stated the following: "…the State Natural Heritage is a public domain asset (bien de dominio público) whose conservation and administration are entrusted, by law, to the Ministerio del Ambiente y Energía, through the Sistema Nacional de Áreas de Conservación (Ley Forestal, arts. 6 inc. a and 13 pfo. 2°, and 14; Ley Orgánica del Ambiente, article 32, pfo. 2°). It comprises two important components: a) Protected Wildlife Areas (Áreas Silvestres Protegidas), regardless of their management category, declared by Law or Decreto Ejecutivo: forest reserves, protected zones, national parks, biological reserves, national wildlife refuges, wetlands, and natural monuments (Ley Forestal 7575, arts. 1°, pfo. 2°, 3° inciso i; Ley Orgánica del Ambiente 7554, article 32; Ley de Biodiversidad N° 7788, arts. 22 et seq. and 58; Ley del Servicio de Parques Nacionales N° 6084, article 3° incs. d and f, in relation to the Ley Orgánica del MINAE N° 7152 and its Regulations; Ley de Conservación de la Vida Silvestre N° 7317, article 82, inciso a). b) The remaining forests and forest lands or lands with forest potential (terrenos forestales o de aptitud forestal) belonging to the State and public institutions (article 13 of the Ley Forestal), which carry an immediate legal restriction.
For the maritime-terrestrial zone (zona marítimo terrestre), the same Ley 6043 (article 73) excludes Protected Wildlife Areas from its scope and subjects them to their own legislation. The remaining forested areas and lands with forest potential along the coastlines are also under the administration of the Ministerio del Ambiente and are governed by their specific regulations (Ley Forestal, article 13 and related provisions)…".
This decision is drafted by Magistrate Hess Herrera; and,
Whereas:
— The petitioner states that, since mid-2024, residents of the community of Salinas II, in the canton of Esparza, have sought solutions from INDER, SINAC, MINAE, and the Municipalidad de Esparza regarding the flooding problem caused by the blockage of the river's natural channel and by the lack of maintenance of culverts. Nevertheless, despite multiple meetings and interinstitutional commitments, no authority has taken concrete and effective action to resolve the problem. Specifically, she alleges: a) The Municipalidad de Esparza has failed in its duty to maintain roads and culverts, generating sedimentation, water stagnation, and property damage, with health and structural risks for residents; b) the Asociación de Productores de Salinas II (APROSA 2) has carried out blockages and diversions in the drainage channels within land belonging to INDER and the Zona Protectora de Tivives, without permits from SINAC, INDER, or MINAE; c) INDER has expressly stated that these interventions have not been authorized, but has neither adopted corrective measures nor filed the corresponding administrative or criminal complaints; and d) CNE has been alerted on several occasions without having provided a timely response or assistance to the affected families.
– For the purposes of deciding this matter, the following facts are deemed duly established, either because they have been substantiated as such or because the respondent authority failed to address them as required in the initial order:
REGARDING THE ACTIONS OF THE NATIONAL EMERGENCY COMMISSION (CNE):
The sector is drained by several unnamed streams (quebradas sin nombre) that are tributaries of the Río Jesús María and of the estero Salado. C. In the surroundings of the assessed site, no problems were observed with the management of stormwater and wastewater (aguas pluviales y servidas) or surface runoff (escorrentía superficial); however, the access roads lack roadside drainage ditches (cunetas) and channeling structures. D. During the visit carried out to the channel of the unnamed stream, the problem of flooding (desbordamiento) and waterlogging (anegamiento) of the settlement was evident, caused by a loss of hydraulic capacity (capacidad hidráulica) in the channel due to heavy sedimentation (sedimentación) and debris deposition. In addition, crossing structures (estructuras de paso) have been built over the channel that restrict the flow of water and contribute to the overflow and impact on the community.
V. Recommendations. A. It is recommended that an adequate system for the control, collection, and drainage of stormwater and wastewater be implemented at and around the assessed site, so that these do not cause instability problems and flooding in the sector due to the collapse of the drainage systems (sistemas de alcantarillado). B. The Municipality of Esparza must remain vigilant over high-risk areas susceptible to landslides (deslizamientos) and/or flooding, and must not issue construction permits or allow the development of informal housing settlements in these locations. C. The debris and sediments deposited in the channel of the unnamed stream that runs through Salinas II settlement (Asentamiento Salinas II) must be cleared, as these are responsible for causing flooding and material losses for the residents. D. The crossing structures over the channel of the unnamed stream, which cause blockages (taponamientos) and overflow of the watercourse, must be improved.
Owners of adjacent plots must refrain from modifying the channel morphology (morfología del cauce), given the impact such modifications can generate through overflow of the watercourse. E. INDER must carry out improvements to the roads and adjacent water channeling systems in order to prevent flooding problems in Salinas II settlement. F. Land use for residential or commercial purposes must be restricted in the protection zones of the watercourses adjacent to the assessed site, pursuant to Art. 33 of Ley Forestal 7575, as well as in the areas identified as having potential flood impact, according to the CNE's natural hazard maps. G. Proper territorial planning (Ordenamiento Territorial) and land use must be the responsibility of the Municipality of Esparza, in accordance with the current regulations on Territorial Planning (Ley Forestal N° 7575, Ley de Planificación Urbana N° 4240, Ley de Uso, Manejo y Conservación de Suelos N° 7779, Ley Orgánica del Ambiente N° 7554, Ley de Aguas N° 276, and others), taking into account the various hazards inherent to this territory.
H. The results of any studies deemed necessary must be taken into account in the design of the various construction and containment works. The works to be implemented must be supervised by a professional registered with the Costa Rica Federation of Engineers and Architects (Colegio Federado de Ingenieros y Arquitectos de Costa Rica), in accordance with the standards established by the Código Sísmico, Código de Cimentaciones, and Reglamento de Construcciones. I. Any irregularity in construction techniques or failure to comply with the recommendations set forth herein SHALL BE THE SOLE RESPONSIBILITY of the institutions that issue the construction permits, of the engineer or person responsible for the works, and of the respective Municipality for failing to request the corresponding reports, inspections, and corrections. (…)" (see documentation submitted).
REGARDING THE ACTIONS OF THE NATIONAL SYSTEM OF CONSERVATION AREAS (SINAC):
REGARDING THE ACTIONS OF THE SALINAS II PRODUCERS' ASSOCIATION (APROSA II):
– The following facts of interest are not considered established:
– From the reports submitted by the representatives of the respondent authorities —which are deemed to have been given under oath, with the consequences, including criminal ones, provided for in Art. 44 of the Law governing this Jurisdiction— and from the body of evidence, it is established that the affected area referred to by the petitioner is located in a sector of Salinas II settlement, in Esparza de Puntarenas, known as APROSA, which falls within the Zona Protectora de Tivives and is adjacent to an area of the settlement that lies outside this protected designation and is used for productive purposes. Regarding the problem at issue, on November 15, 2024, the Technical Director of ACOPAC, through official communication SINAC-ACOPAC-DT-192-2024, addressed to Lic. Bienvenido Venegas Porras, Mayor of the Municipality of Esparza, and the Local Emergency Commission of the Canton of Esparza, an incident response report on the Salinas II case was issued in response to National Emergency Declaration DE No. 44754-MP, setting forth the following conclusions and recommendations: "Conclusions: 1.
The canal drains water from the lower-lying parts of Salinas II; this structure is considered appropriate given that it is located in a flood-risk area, but its functionality is reduced by the blockage it suffers during the sugarcane harvest season. 2. The culverts have exceeded their useful service life, so their functionality is no longer adequate. 3. Silting up of the canal and the accumulation of plant material that impedes the free flow of water is evident. Recommendations. It is recommended that the canal be cleared, and that a subsequent evaluation be conducted by a Hydrogeologist in order to design a mitigation work better suited to the actual conditions faced by the community of Salinas II and local producers." Likewise, on December 13, 2024, the Risk Research and Analysis Unit of CNE, through technical report CNE-UIAR-INF-1332-2024 addressed to the CME of the Municipality of Montes de Oro, concluded, in the relevant part: "(…) IV.
Conclusions A. According to the CNE's Potential Natural Hazard Map, the area of interest falls within the zone subject to the influence of flash floods and overflow from the Río Jesús María, as well as from nearby tributaries and watercourses. Furthermore, the site is crossed by the trace of the Jesús María active geological fault, which has significant seismic potential according to the RSN-ICE-UCR. B. The assessed area, Salinas II, is located in a sector of low to gently rolling gradient and corresponds to the alluvial plain of the Río Jesús María. The sector is drained by several unnamed streams that are tributaries of the Río Jesús María and of the estero Salado. C. In the surroundings of the assessed site, no problems were observed with the management of stormwater and wastewater or surface runoff; however, the access roads lack roadside drainage ditches and channeling structures. D. During the visit carried out to the channel of the unnamed stream, the problem of flooding and waterlogging of the settlement was evident, caused by a loss of hydraulic capacity in the channel due to heavy sedimentation and debris deposition.
In addition, crossing structures have been built over the channel that restrict the flow of water and contribute to the overflow and impact on the community. V. Recommendations. A. (…)". Likewise, on December 06, 2024, INDER, through official communication INDER-GG-DRT-RDPC-OFI-0484-2024, requested that the Municipality of Esparza provide support for the conduct of technical studies to assess improvement solutions for access to two public roads in the community of Aprosa, Salinas 2.
Along the same lines, on January 09, 2025, an interagency coordination meeting was held between INDER and the Municipality of Esparza in the Salinas 2 settlement sector, APROSA sector, at which both INDER and the Municipality of Esparza committed to carrying out the necessary steps for the purchase and installation of reinforced culverts for the area. However, according to INDER's report, an attempt was made to contract the installation of certain culverts for the rainy season, which could not be executed because the procurement process was put out to tender on two occasions without being able to proceed, due to a lack of bidders. Subsequently, on January 15, 2025 and October 04, 2025, SINAC conducted inspections of the case in question, given that reports had been received regarding the installation of culverts in the protection zone, and no environmental damage was found. Finally, on December 09, 2025, the Central Pacific Region Liaison Officer, through official communication CNE-UG05-0383-2025, stated the following, in the relevant part: "A review was conducted of the incidents recorded this year, and in the Salinas II sector, reported impacts generally involve roads and some homes resulting from overwhelmed drainage systems and/or overflow of the Río Jesús María and its tributaries due to rainfall characteristic of the rainy season and the climatic conditions of the region; however, there is no specific record of incidents attributable to culverts installed on INDER plots by the Asociación de Productores de Salinas.
It is important to note that all such incidents are initially handled by the CME, and depending on the needs identified, when the case so warrants, it is referred to the appropriate body according to its jurisdiction. Last year, in the context of responding to the impacts caused by tropical storms Rafael and Sara, the CME of Esparza requested an inspection by the Risk Analysis and Research Unit in this sector of the INDER plots in Salinas II." In view of the foregoing, the violation of the fundamental rights of the protected party (amparada) is established. This is so because the existence of two technical reports is confirmed: the one dated November 13, 2024, issued by the Risk Research and Analysis Unit of CNE; and the one dated November 15, 2024, issued by ACOPAC. Both reports contain a series of recommendations addressed to INDER and the Municipality of Esparza for addressing and resolving the problem that is the subject of this appeal.
However, as of the date this appeal was filed, the authorities involved have been unable to definitively resolve the situation, nor do they have clarity regarding the actions they must take in order to address the situation in the Salinas II settlement sector. For the foregoing reasons, the appeal must be granted on the terms set forth in the operative part (parte dispositiva) of this judgment.
V.Finally, no actions or omissions are observed on the part of the National Commission for Risk Prevention and Emergency Response, SINAC, or APROSA II that would warrant the intervention of this Constitutional Chamber.
As a matter of principle, I consider that cases related to action or inaction by the Public Administration in the repair, construction, modification, or demolition of any infrastructure work should be dismissed, because such an omission is a matter of legality, the discussion of which belongs before the ordinary courts (jurisdicción ordinaria), where the interested party can contest their grievances more fully. However, when the administrative conduct (whether by omission or otherwise) gives rise to a violation of other fundamental rights protected under this constitutional jurisdiction, or affects groups considered vulnerable, I do proceed to rule on the merits, as this situation constitutes an exception to my position in such matters. That is precisely what occurs in this case, where the petitioner alleges that since mid-2024, residents of the community of Salinas II, in the canton of Esparza, have been approaching INDER, SINAC, MINAE, and the Municipality of Esparza seeking a solution to the flooding problem caused by the blockage of the natural river channel and the lack of maintenance of the culverts. However, despite numerous interagency meetings and commitments, no authority has taken concrete and effective action to resolve the problem.
Although I have concurred with the majority in cases involving similar grievances, upon further reflection I consider that this type of complaint should be raised through the ordinary channels of legality. This is especially so given that the record reflects allegations that can only be properly examined in a proceeding that allows for a full adversarial process (contradictorio) in order to determine with precision the respective jurisdictions of the various institutions involved. As this Court has repeatedly held, the summary nature of the amparo appeal (recurso de amparo) is incompatible with the conduct of slow and complex evidentiary proceedings, or with the need to first resolve legal questions that are properly matters of legality.
In the present case, what is appropriate is to challenge through the contentious-administrative courts (vía contencioso-administrativa) the inactivity of the various authorities that the petitioner considers competent and responsible for resolving the problem caused by flooding resulting from the blockage of the natural river channel and the lack of maintenance of the culverts, where the water passage is located—in part—within the Zona Protectora de Tivives. Moreover, there is no indication of an absolute inaction on the part of the authorities. That judicial forum, equipped with broader tools, will be able to examine in depth and with precision the complaint and the arguments raised by the parties, assess the administrative conduct, rule on the scope of the respective jurisdictions —relating to the national road network, the cantonal road network— and of the special environmental regulations, issue specific mandates to address the problem identified, and, of course, monitor the enforcement phase. Furthermore, it should be recalled that in that forum there is a robust system of interim relief (justicia cautelar) and far more effective mechanisms for monitoring the enforcement phase of matters of great scope such as this one.
In light of these considerations, I believe that the intervention of this Constitutional Court without the ability to conduct an adversarial process could prejudice due process (debido proceso) and the very effectiveness of any orders that might be issued in the event the appeal is granted.
For the foregoing reasons, I dissent and declare the amparo appeal without merit.
The petitioner is hereby notified that should any paper document, object, or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device have been submitted, such items must be retrieved from the office within a maximum period of 30 business days counted from the notification of this judgment. Otherwise, all material not retrieved within this period will be destroyed, pursuant to the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Full Court (Corte Plena) in session N° 27-11 of August 22, 2011, Article XXVI, and published in the Official Judicial Gazette (Boletín Judicial) number 19 of January 26, 2012, as well as the resolution approved by the Superior Council of the Judiciary (Consejo Superior del Poder Judicial) in session N° 43-12 held on May 3, 2012, Article LXXXI.
POR TANTO:
The appeal is granted, solely as against the Municipality of Esparza and the Rural Development Institute. Ricardo José Quesada Salas, Executive President of the Rural Development Institute; Bienvenido Venegas Porras, Mayor; and Fernando Villalobos Chacón, President of the Municipal Council, both of the Municipality of the Canton of Esparza, or whoever may hold those positions in their stead, are hereby ordered to carry out and coordinate the necessary actions within the scope of their respective jurisdictions so that, within a period of TWELVE MONTHS counted from the notification of this judgment, the problem that is the subject of this appeal is definitively resolved as appropriate. They are hereby warned that failure to comply with this order will constitute the criminal offense of disobedience (desobediencia) and that, pursuant to Art. 71 of the Law of this Jurisdiction, a sentence of three months to two years of imprisonment, or of twenty to sixty day-fines (días multa), shall be imposed on any person who receives an order that they must comply with or cause to be complied with, issued in an amparo appeal, and fails to comply with it or to cause it to be complied with, provided the offense is not more severely punishable under another provision.
The Municipality of Esparza and the Rural Development Institute are ordered to pay court costs (costas), damages (daños), and losses (perjuicios) caused by the acts that underlie this declaration, which shall be assessed in contentious-administrative enforcement proceedings (ejecución de sentencia de lo contencioso administrativo). In all other respects, the appeal is denied. Justice Salazar Alvarado appends a separate note. Justice Garro Vargas dissents and declares the appeal without merit on admissibility grounds. Notify.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del nueve de junio de dos mil veintiseis .
Recurso de amparo que se tramita en expediente número 25-033811-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra la ASOCIACION DE PRODUCTORES DE SALINAS DOS, COMISION NACIONAL DE PREVENCION DE RIESGOS Y ATENCION DE EMERGENCIAS, INSTITUTO DE DESARROLLO RURAL, MINISTERIO DE AMBIENTE Y ENERGIA, MUNICIPALIDAD DE ESPARZA, SISTEMA NACIONAL DE AREAS DE CONSERVACION.
Resultando:
Redacta la Magistrada Hess Herrera; y,
Considerando:
- Afirma la recurrente que, desde mediados del año 2024, los vecinos de la comunidad de Salinas II, en el cantón de Esparza, han gestionado ante el INDER, SINAC, MINAE y la Municipalidad de Esparza, la búsqueda de una solución al problema de las inundaciones provocadas por el taponamiento del canal natural del río y por la falta de mantenimiento de las alcantarillas. No obstante, a pesar de múltiples reuniones y compromisos interinstitucionales, ninguna autoridad ha ejecutado acciones concretas y efectivas para resolver el problema. Específicamente señala: a) La Municipalidad de Esparza ha incumplido con su deber de mantenimiento de caminos y alcantarillas, generando sedimentación, estancamiento de aguas y daños a propiedades, con riesgo sanitario y estructural para los vecinos; b) la Asociación de Productores de Salinas II (APROSA 2) ha realizado taponamientos y desviaciones en los canales de drenaje, dentro de terrenos que pertenecen al INDER y a la Zona Protectora de Tivives, sin contar con permisos del SINAC, del INDER ni del MINAE; c) el INDER ha manifestado expresamente que dichas intervenciones no cuentan con su autorización, pero no ha adoptado medidas correctivas ni presentado denuncias administrativas o penales correspondientes; y d) que, la Comisión Nacional de Emergencias (CNE) ha sido alertada en diversas ocasiones, sin que haya dado respuesta oportuna ni ha brindado asistencia a las familias afectadas.
– De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la recurrida haya omitido referirse a ellos según lo prevenido en el auto inicial:
SOBRE LAS ACTUACIONES DE LA COMISIÓN NACIONAL DE EMERGENCIAS (CNE):
C. En los alrededores del sitio evaluado no se observan problemas con el manejo de aguas pluviales o escorrentía superficial, sin embargo, en los caminos de acceso hay ausencia de cunetas y estructuras de canalización. D. En la visita realizada al cauce de la quebrada sin nombre, se evidencia la problemática de desbordamiento y anegamiento del poblado, generada por una pérdida en la capacidad hidráulica del cauce debido a la alta sedimentación y depositación de escombros. Además, existen estructuras de paso que se han construido sobre el cauce que limitan el flujo del caudal y ayudan a generar el desbordamiento y afectación de la comunidad. V. Recomendaciones. A. Se recomienda en el sitio evaluado y alrededores, un sistema adecuado para el control, la recolección y el drenaje de aguas pluviales y servidas, para que estas no generen problemas de inestabilidad y anegamientos en el sector por colapso en los sistemas de alcantarillado.
B. La Municipalidad de Esparza deberá permanecer vigilante de las zonas de alto riesgo, susceptibles al deslizamiento y/o inundación, y no otorgar permisos constructivos o desarrollo de asentamientos informales de viviendas en estos sitios. C. Se deberá realizar la limpieza de los escombros y sedimentos depositados en el cauce de la quebrada sin nombre que atraviesa el asentamiento Salinas II, la cual es la responsable de provocar anegamientos y pérdidas materiales en sus habitantes. D. Se deberá realizar la mejora en los pasos sobre el cauce de la quebrada sin nombre, los cuales provocan taponamientos y desbordamientos del caudal. Los propietarios de parcelas aledañas deberán abstenerse de realizar modificaciones a la morfología del cauce, debido a la afectación que pueden generar por desbordamientos del caudal. E. El INDER deberá realizar las mejoras en caminos y en los sistemas de canalización de aguas aledaños, con el fin de evitar problemas de anegamientos del asentamiento Salinas II.
F. Se deberá restringir el uso de suelo con fines habitacionales o de comercio en las zonas de protección de los cauces aledaños al sitio evaluado, según el artículo 33 de la ley forestal 7575, así como en las áreas identificadas con potencial afectación por inundaciones; según los mapas de amenazas naturales de la CNE. G. La planificación territorial adecuada y el uso de la tierra deberá estar bajo la responsabilidad de la Municipalidad de Esparza, acorde con lo que plantea la normativa vigente en materia de Ordenamiento Territorial (Ley Forestal N° 7575, Ley de Planificación Urbana, N° 4240, Ley de Uso, Manejo y Conservación de Suelos N° 7779, Ley Orgánica del Ambiente N° 7554, Ley de Aguas N° 276 y otras), considerando las diferentes amenazas implícitas en este territorio. H. Se debe tomar en cuenta en el diseño de las distintas obras constructivas y de contención, los resultados de los estudios que se consideren necesarios.
Las obras que se implementen deben ser supervisadas por un profesional agremiado al Colegio Federado de Ingenieros y Arquitectos de Costa Rica, con base en las normas establecidas por el Código Sísmico, Código de Cimentaciones y Reglamento de Construcciones. I. Cualquier anomalía en cuanto a técnicas de construcción u omisión a las recomendaciones aquí descritas, QUEDA BAJO TOTAL RESPONSABILIDAD de las instituciones que otorgan los permisos constructivos, del ingeniero o responsable de la obra y de la Municipalidad respectiva de no solicitar los informes, inspecciones y correcciones correspondientes. (…)” (ver documentación aportada).
SOBRE LAS ACTUACIONES DEL SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (SINAC):
SOBRE LAS ACTUACIONES DE LA ASOCIACIÓN DE PRODUCTORES DE SALINAS II (APROSA II):
- No se tienen por demostrados los siguientes hechos de interés:
- De los informes rendidos por los representantes de las autoridades recurridas -que se tiene dado bajo fe de juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y del elenco probatorio, se tiene por demostrado que el área afectada y referida por la recurrente, se ubica en un sector del Asentamiento Salinas II, en Esparza de Puntarenas, conocido como APROSA, el cual se encuentra dentro de la zona Protectora de Tivives y que colinda con un área del Asentamiento que se encuentra fuera de esta afectación (Zona Protectora de Tivives), que se utiliza con fines productivos. Ahora bien, respecto a la problemática que se acusa, se tiene que, el 15 de noviembre del 2024, el Director Técnico del Área de Conservación Pacífico Central (ACOPAC), mediante oficio SINAC-ACOPAC-DT-192-2024, dirigido al Lic. Bienvenido Venegas Porras, Alcalde Municipalidad de Esparza, Comisión Local de Emergencias Cantón de Esparza, se realiza informe de atención de incidente caso Salinas II en atención a la Emergencia Nacional Declaratoria de Emergencia DE No. 44754-MP, donde indica las siguientes conclusiones y recomendaciones: “Conclusiones: 1.
El canal drena agua de las partes más bajas de Salinas II esta obra es considerada apropiada en vista de que se ubica en un sitio con riesgo de inundaciones, pero su funcionabilidad se ve disminuida por el “taponamiento” que se ve objeto en la temporada de la cosecha de Caña de Azúcar. 2. Las alcantarillas ya cumplieron su vida útil por lo que la funcionabilidad no es la adecuada. 3. Se evidencia colmatación en el canal y acumulación de material vegetativo que impide el libre flujo de las aguas. Recomendaciones. Se recomienda intervenir el canal con una limpieza del mismo y posteriormente realizar una evaluación por medio de un Hidrogeólogo con el fin de hace una obra de mitigación más acorde a la realidad que vive la comunidad de Salinas II y los productores locales.”. De igual forma, el 13 de diciembre de 2024 la Unidad de Investigación y Análisis de Riesgo de la Comisión Nacional de Emergencias mediante informe técnico CNE-UIAR-INF-1332-2024 dirigido al Comité Municipal de Emergencias de la Municipalidad de Montes de Oro, concluyó en lo conducente: “(…) IV.
Conclusiones A. De acuerdo con el Mapa de Amenazas Naturales Potenciales de la CNE, la zona de interés se encuentra dentro del área con influencia por crecidas repentinas y desbordamientos del río Jesús María, así como de los afluentes y cauces cercanos. Además, el sitio es atravesado por la traza de la falla geológica activa Jesús María, con potencial sísmico importante de acuerdo con lo indicado por la RSN-ICE-UCR. B. La zona evaluada, Salinas II, se encuentra en un sector de pendiente baja a ondulada, corresponde con la llanura aluvial del río Jesús María. El sector es drenado por varias quebradas sin nombre que son afluentes del río Jesús María y del estero Salado. C. En los alrededores del sitio evaluado no se observan problemas con el manejo de aguas pluviales o escorrentía superficial, sin embargo, en los caminos de acceso hay ausencia de cunetas y estructuras de canalización. D. En la visita realizada al cauce de la quebrada sin nombre, se evidencia la problemática de desbordamiento y anegamiento del poblado, generada por una pérdida en la capacidad hidráulica del cauce debido a la alta sedimentación y depositación de escombros.
Además, existen estructuras de paso que se han construido sobre el cauce que limitan el flujo del caudal y ayudan a generar el desbordamiento y afectación de la comunidad. V. Recomendaciones. A. Se recomienda en el sitio evaluado y alrededores, un sistema adecuado para el control, la recolección y el drenaje de aguas pluviales y servidas, para que estas no generen problemas de inestabilidad y anegamientos en el sector por colapso en los sistemas de alcantarillado. B. La Municipalidad de Esparza deberá permanecer vigilante de las zonas de alto riesgo, susceptibles al deslizamiento y/o inundación, y no otorgar permisos constructivos o desarrollo de asentamientos informales de viviendas en estos sitios. C. Se deberá realizar la limpieza de los escombros y sedimentos depositados en el cauce de la quebrada sin nombre que atraviesa el asentamiento Salinas II, la cual es la responsable de provocar anegamientos y pérdidas materiales en sus habitantes.
D. Se deberá realizar la mejora en los pasos sobre el cauce de la quebrada sin nombre, los cuales provocan taponamientos y desbordamientos del caudal. Los propietarios de parcelas aledañas deberán abstenerse de realizar modificaciones a la morfología del cauce, debido a la afectación que pueden generar por desbordamientos del caudal. E. El INDER deberá realizar las mejoras en caminos y en los sistemas de canalización de aguas aledaños, con el fin de evitar problemas de anegamientos del asentamiento Salinas II. F. Se deberá restringir el uso de suelo con fines habitacionales o de comercio en las zonas de protección de los cauces aledaños al sitio evaluado, según el artículo 33 de la ley forestal 7575, así como en las áreas identificadas con potencial afectación por inundaciones; según los mapas de amenazas naturales de la CNE. G. La planificación territorial adecuada y el uso de la tierra deberá estar bajo la responsabilidad de la Municipalidad de Esparza, acorde con lo que plantea la normativa vigente en materia de Ordenamiento Territorial (Ley Forestal N° 7575, Ley de Planificación Urbana, N° 4240, Ley de Uso, Manejo y Conservación de Suelos N° 7779, Ley Orgánica del Ambiente N° 7554, Ley de Aguas N° 276 y otras), considerando las diferentes amenazas implícitas en este territorio.
H. Se debe tomar en cuenta en el diseño de las distintas obras constructivas y de contención, los resultados de los estudios que se consideren necesarios. Las obras que se implementen deben ser supervisadas por un profesional agremiado al Colegio Federado de Ingenieros y Arquitectos de Costa Rica, con base en las normas establecidas por el Código Sísmico, Código de Cimentaciones y Reglamento de Construcciones. I. Cualquier anomalía en cuanto a técnicas de construcción u omisión a las recomendaciones aquí descritas, QUEDA BAJO TOTAL RESPONSABILIDAD de las instituciones que otorgan los permisos constructivos, del ingeniero o responsable de la obra y de la Municipalidad respectiva de no solicitar los informes, inspecciones y correcciones correspondientes. (…)”. Igualmente, el 06 de diciembre de 2024 el INDER mediante oficio INDER-GG-DRT-RDPC-OFI-0484-2024 solicitó a la Municipalidad de Esparza, el apoyo para la realización de estudios técnicos para valorar soluciones de mejoras de acceso de dos caminos públicos en la comunidad de Aprosa, Salinas 2.
En esa misma línea, se tiene que, el 09 de enero de 2025 se realizó una reunión de articulación INDER-Municipalidad de Esparza, en el sector de Asentamiento Salinas 2, sector APROSA, en la cual, tanto el INDER como la Municipalidad de Esparza se comprometieron a realizar las gestiones necesarias para la compra e instalación de alcantarillas reforzadas para zona. Sin embargo, según refiere el INDER se trató de realizar la contratación para la colocación de algunas alcantarillas para la época de invierno, lo cual no fue posible de ejecutar, por cuanto se licitó en dos ocasiones el proceso de contratación respectivo, sin que se pudieran ejecutar los mismos, por falta de oferentes. Posteriormente, en fechas 15 de enero de 2025 y 04 de octubre de 2025, el SINAC realizó inspección sobre el caso en mención, toda vez que, se informó sobre la colocación de alcantarillas en la zona de protección, descartándose cualquier daño al medio ambiente.
Finalmente, se tiene que, el 09 de diciembre de 2025, el Oficial de Enlace Región Pacífico Central mediante oficio CNE-UG05-0383-2025, indicó en lo que interesa: “Se realizó una revisión de los incidentes que han ingresado en este año, y en el sector de Salinas II, de manera general se reportan afectaciones en caminos y algunas viviendas producto de saturación de alcantarillado y/o desbordamiento del río Jesús María y sus afluentes producto de las lluvias propias de la estación lluviosa y de las características climatológicas de la región, pero no hay registro específico de incidentes que refieran afectación provocada por alcantarillado instalado en parcelas del INDER por parte de la Asociación de Productores de Salinas; es importante indicar que todos estos incidentes son atendidos por el CME en primera instancia, y en función de las necesidades identificadas, cuando el caso lo amerite, se procede a referir el caso a la instancia correspondiente según su competencia.
El año pasado en el marco de la atención de las afectaciones provocadas por las tormentas tropicales Rafael y Sara; el CME de Esparza solicitó una inspección a la Unidad de Análisis e Investigación de Riesgo en este sector de las parcelas del INDER en Salinas II.” Así las cosas, se acredita la lesión a los derechos fundamentales de la amparada. Lo anterior, por cuanto se determina la existencia de dos informes técnicos, sea el de fecha el 13 de noviembre de 2024 emitido por la Unidad de Investigación y Análisis de Riesgo de la Comisión Nacional de Emergencias; así como, el de fecha 15 de noviembre del 2024, emitido por el Área de Conservación Pacífico Central (ACOPAC), en los cuales, se emiten una serie de recomendaciones al INDER y a la Municipalidad de Esparza para la atención y solución de la problemática objeto de este recurso; sin embargo, a la fecha de interposición del presente recurso, las autoridades involucradas no han podido solventar de manera definitiva y tampoco tienen claridad respecto a las actuaciones que deben realizar a fin de atender la situación del sector del Asentamiento Salinas II. Por lo expuesto, procede acoger el recurso en los términos que se indican en la parte dispositiva de esta sentencia.
V.Por último, no se observan acciones u omisiones por parte de la Comisión Nacional de Prevenciones de Riesgos y Atención de Emergencias, el Sistema Nacional de Áreas de Conservación y la Asociación de Productores de Salinas II (APROSA II) que ameriten la intervención de esta Sala.
En tesis de principio, considero que los casos relacionados con la actividad o inactividad de la Administración Pública en la reparación, construcción, modificación o demolición de cualquier obra de infraestructura, deben ser desestimados, por constituir, esa omisión, un tema de legalidad, cuya discusión corresponde a la jurisdicción ordinaria, ante la cual la persona interesada puede debatir, con mayor amplitud, sus disconformidades. Sin embargo, cuando de aquella conducta administrativa (omisiva o no) se derive alguna violación a otros derechos fundamentales tutelados en esta jurisdicción constitucional, o se afecten grupos considerados vulnerables, sí entro a conocer el fondo del asunto, por constituir esta situación una excepción a mi posición en esta materia, tal y como sucede en este caso, en que la parte recurrente acusa que, desde mediados del año 2024, los vecinos de la comunidad de Salinas II, en el cantón de Esparza, han gestionado ante el INDER, SINAC, MINAE y la Municipalidad de Esparza, la búsqueda de una solución al problema de las inundaciones provocadas por el taponamiento del canal natural del río y por la falta de mantenimiento de las alcantarillas. No obstante, a pesar de múltiples reuniones y compromisos interinstitucionales, ninguna autoridad ha ejecutado acciones concretas y efectivas para resolver el problema.
Pese a que he concurrido con la mayoría en asuntos donde se plantean similares agravios, bajo una mejor ponderación estimo que este tipo de reproches se deben plantear en las vías ordinarias de legalidad. Lo anterior, máxime si en los autos se verifica la existencia de alegatos que sólo pueden ser debidamente conocidos en un proceso que permita un contradictorio pleno con el fin de determinar con precisión las competencias de las diversas instituciones involucradas. Como reiteradamente lo ha dicho esta Sala, la naturaleza sumarísima del recurso de amparo no es compatible con la práctica de diligencias probatorias lentas y complejas o con la necesidad de entrar previamente a dilucidar aspectos jurídicos propios de la legalidad.
En el presente caso lo que procede es cuestionar en la vía contencioso-administrativa la inactividad de las diferentes autoridades que la parte recurrente estima competentes y responsables de dar solución a la problemática causada por las inundaciones provocadas por el taponamiento del canal natural del río y por la falta de mantenimiento de las alcantarillas, donde el paso de agua se ubica -en parte- dentro de la Zona Protectora de Tivives. Además, no se observa que haya una absoluta inactividad de las autoridades. Dicha instancia jurisdiccional, con mayores herramientas, podrá conocer con profundidad y precisión la denuncia y lo alegado por las partes, valorar la conducta administrativa, resolver sobre los alcances de las competencias ‒relativa a la red vial nacional, la red vial cantonal‒ y de las regulaciones ambientales especiales, dictar mandatos específicos para atender la problemática apuntada y, por supuesto, dar seguimiento a la fase de ejecución. Por lo demás, recuérdese que en dicha sede se cuenta con una justicia cautelar robusta y mecanismos mucho más eficaces para dar seguimiento en la fase de ejecución de asuntos de gran envergadura como el presente.
A la luz de tales elementos, considero que la intervención de este Tribunal Constitucional sin poder llevar a cabo un contradictorio podría lesionar el debido proceso y la eficacia misma de las órdenes que se pudiesen dictar en caso de que se acoja el recurso.
En virtud de lo expuesto, salvo el voto y declaro sin lugar el recurso de amparo.
Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
POR TANTO:
Se declara con lugar el recurso, únicamente en contra de la Municipalidad de Esparza y el Instituto de Desarrollo Rural. Se ordena a Ricardo José Quesada Salas, presidente ejecutivo del Instituto de Desarrollo Rural; a Bienvenido Venegas Porras, alcalde y a Fernando Villalobos Chacón, presidente del Concejo Municipal, ambos de la Municipalidad del Cantón de Esparza, o quienes en sus lugares ejerzan esos cargos, que realicen y coordinen las acciones necesarias dentro del ámbito de sus competencias para que en el plazo de DOCE MESES contados a partir de la notificación de esta sentencia, se solucione como corresponda de manera definitiva la problemática objeto de este recurso. Se les advierte que de no acatar la orden dicha, incurrirá en el delito de desobediencia y, que de conformidad con el artículo 71 de la Ley de esta jurisdicción, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.
Se condena a la Municipalidad de Esparza y al Instituto de Desarrollo Rural al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En lo demás, se declara sin lugar el recurso. El Magistrado Salazar Alvarado pone nota. La magistrada Garro Vargas salva el voto y declara sin lugar el recurso por razones de admisibilidad.
