Document Review CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours and thirty minutes on the fifth of June, two thousand twenty-six.

Amparo petition (recurso de amparo) filed under case number 26-017328-0007-CO, brought by Nombre01, national identity number CED01, against the SERVICIO NACIONAL DE SALUD ANIMAL.- Background:

  1. 1By written submission received at the Chamber's Secretariat on May 15, 2026, the petitioner files an amparo petition against the Servicio Nacional de Salud Animal (SENASA) and states, in summary, that on May 1, 2026, the petitioner entered the country through the Aeropuerto Internacional Juan Santamaría on a flight from Chile with a stopover in Panama, carrying marine shells originating from that country, which —as asserted— constitute instruments of a religious nature and part of a longstanding family heritage. The petitioner states that said items remained exclusively in international transit at the Aeropuerto de Tocumen, without having entered Panamanian customs territory, and that they are not of a commercial nature.

The petitioner states that a SENASA official proceeded to carry out the seizure (decomiso) of approximately 0.729 kilograms of said items, without —in the petitioner's view— being given a clear explanation of the applicable regulations that were breached, the specific health risk involved, or the technical basis for the action, which resulted in a state of defenselessness. The petitioner adds that an opportunity to file an immediate complaint was denied, and that, subsequently, the petitioner was informed that the case would be referred to SINAC, an entity which —the petitioner contends— lacks jurisdiction over religious items of foreign origin in transit.

The petitioner states that on May 3, 2026, a motion for reconsideration (recurso de revocatoria) was filed, alleging the religious nature of the items, their limited quantity for personal use, and their freedom from organic residue; however, the petitioner asserts that no response was received, thereby triggering administrative silence (silencio administrativo). The petitioner also states that Chilean authorities can certify that the objects do not correspond to species protected under international regulations, that their departure from Chile is lawful as personal or religious effects, and that they have no commercial purpose. Finally, the petitioner states that the seizure slip contains a material error in the recording of the passport number and argues that the potential destruction of the items would constitute an infringement of cultural heritage and religious beliefs.

  1. 2Article 9 of the Ley de la Jurisdicción Constitucional empowers the Chamber to summarily reject, on the merits or at any stage, including upon filing, any petition brought before it that proves to be manifestly inadmissible, or when the Chamber considers that sufficient grounds exist to reject it, or when the petition constitutes the mere reiteration or reproduction of a prior, identical or similar petition that was previously rejected.

The opinion is drafted by Magistrate Castillo Víquez; and,

Considering:

I. SUBJECT MATTER OF THE AMPARO PETITION

The petitioner challenges the actions of SENASA, on the grounds that the measures adopted —consisting of the seizure and order of destruction of marine shells originating from Chile, which the petitioner identifies as sacred instruments connected to religious beliefs— lack sufficient technical basis. The petitioner states that said decision was carried out without adequate analysis to justify the health risk, which —in the petitioner's view— constitutes an unlawful infringement of freedom of worship (libertad de culto) and undue State interference with items of a religious nature.

II. ON THE SPECIFIC CASE

The amparo petition serves the exclusive purpose of providing prompt and effective protection against the violation or threat to fundamental rights and freedoms, and is not intended to serve as a general mechanism to guarantee, in the abstract, the principle of constitutional supremacy or the principle of legality, nor to permit the challenge of any violation of a constitutional or merely statutory nature.

In the specific case at hand, the petitioner expresses disagreement with the proceedings conducted by SENASA in connection with the administrative procedure initiated as a result of the entry of material without the corresponding import permit. In particular, the petitioner argues that the decision to destroy the seized objects —which, as contended, form part of the petitioner's religious practices— constitutes a violation of fundamental rights.

It should be noted that the petitioner merely asserts that the seized objects are part of religious practices, without providing further arguments; that is, no explanation is given as to which religion uses them, what function these objects serve in the religious rite, or what value they hold in light of the external manifestations of religious beliefs —freedom of worship, etc.— and therefore the argument advanced is insufficient to allow the petition to proceed. Finally, it is the duty of every traveler entering a State who intends to bring in exotic or uncommon objects to inquire about the requirements that country imposes for their entry, in order to comply with those provisions and avoid unnecessary complications or seizures — a requirement that the petitioner has failed to demonstrate was fulfilled.

Accordingly, the petition is summarily rejected.

III. DOCUMENTATION SUBMITTED TO THE CASE FILE

The petitioner is hereby notified that if any paper documents, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or technology-produced device, have been submitted to the office, they must be retrieved within a maximum period of thirty business days counted from the notification of this judgment. Otherwise, all material not retrieved within this period will be destroyed, in accordance with the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Corte Plena in Session N° 27-11 of August 22, 2011, Article XXVI, and published in the Boletín Judicial N° 19 of January 26, 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial in Session N° 43-12 held on May 3, 2012, Article LXXXI.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del cinco de junio de dos mil veintiseis .

Recurso de amparo que se tramita en expediente número 26-017328-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra SERVICIO NACIONAL DE SALUD ANIMAL.-

Resultando:

  1. 1Por escrito recibido en la Secretaría de la Sala el 15 de mayo de 2026, la parte recurrente interpone recurso de amparo contra el Servicio Nacional de Salud Animal (SENASA) y manifiesta, en resumen que, el 1 de mayo de 2026 ingresó al país por el Aeropuerto Internacional Juan Santamaría, en un vuelo procedente de Chile con escala en Panamá, portando conchas marinas originarias de ese país, las cuales —según afirma— constituyen instrumentos de carácter religioso y parte de su patrimonio familiar de larga data. Señala que dichos bienes únicamente permanecieron en tránsito internacional en el Aeropuerto de Tocumen, sin haber ingresado al territorio aduanero panameño, y que no poseen naturaleza comercial.

Refiere que una funcionaria del Servicio Nacional de Salud Animal procedió al decomiso de aproximadamente 0,729 kilogramos de dichos objetos, sin que —a su juicio— se le explicara de manera clara la normativa infringida, el riesgo sanitario concreto ni el sustento técnico de la actuación, lo cual le generó un estado de indefensión. Añade que se le negó la posibilidad de formular un reclamo inmediato y que, posteriormente, se le indicó que el caso sería remitido al Sistema Nacional de Áreas de Conservación, entidad que —según sostiene— carece de competencia en relación con bienes religiosos de origen extranjero en tránsito.

Indica que, con fecha 3 de mayo de 2026, presentó recurso de revocatoria alegando el carácter religioso de los bienes, su cantidad limitada para uso personal y su condición libre de residuos orgánicos; no obstante, afirma que no obtuvo respuesta, operando así el silencio administrativo. Asimismo, señala que las autoridades chilenas pueden certificar que los objetos no corresponden a especies protegidas bajo normativa internacional, que su salida del país es lícita como efectos personales o religiosos y que no tienen finalidad comercial. Finalmente, indica que la boleta de decomiso presenta un error material en la consignación del número de pasaporte y sostiene que la eventual destrucción de los bienes implicaría una afectación a su patrimonio cultural y a sus creencias.

  1. 2El artículo 9 de la Ley de la Jurisdicción Constitucional, faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.

Redacta el Magistrado Castillo Víquez; y,

Considerando:

I. OBJETO DEL AMPARO

La parte recurrente cuestiona la actuación del Servicio Nacional de Salud Animal (SENASA), al estimar que las medidas adoptadas, consistentes en el decomiso y orden de destrucción de conchas marinas originarias de Chile —que identifica como instrumentos sagrados vinculados a sus creencias religiosas— carecen de sustento técnico suficiente. Señala que dicha decisión fue ejecutada sin un análisis adecuado que justifique el riesgo sanitario, lo cual —a su juicio— configura una afectación ilegítima a su libertad de culto y una intervención estatal indebida sobre bienes de carácter religioso.

II. SOBRE EL CASO CONCRETO

La acción de amparo tiene como finalidad exclusiva otorgar tutela pronta y efectiva frente a la vulneración o amenaza de los derechos y libertades fundamentales, y no la de erigirse en un mecanismo genérico destinado a garantizar, de manera abstracta, el principio de supremacía constitucional o el principio de legalidad, ni a permitir la impugnación de cualquier infracción de carácter constitucional o meramente legal.

En el caso concreto, la parte promovente manifiesta su inconformidad con el trámite seguido por el Servicio Nacional de Salud Animal en relación con el procedimiento administrativo instaurado con motivo del ingreso de material sin el correspondiente permiso de importación. En particular, sostiene que la decisión de destruir los objetos decomisados —los cuales, según afirma, forman parte de sus prácticas religiosas— constituye una vulneración a sus derechos fundamentales.

Cabe destacar que la recurrente se limita únicamente a afirmar que los objetos decomisados son parte de sus prácticas religiosas, sin aportar más argumentos, es decir, no expresa en qué religión se utilizan, qué función juegan esos objetos en el rito religioso, cuál es valor a partir de las manifestaciones externas de sus creencias religiosas -libertad de culto, etc., de ahí que el argumento que esbozan es insuficiente para darle curso al amparo. Finalmente, es un deber de todo viajero que ingresa a un Estado, y que pretende introducir objetos exóticos o poco comunes, informarse de los requerimientos que en ese país se exigen para su ingreso, con el fin de ajustarse a sus disposiciones y evitar contratiempos innecesarios o decomisos, situación que no logra demostrar haber cumplido la recurrente.

Por consiguiente, el recurso se rechaza de plano.

III. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

POR TANTO:
