Document PJEDITOR CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours thirty minutes on the fifth of June, two thousand twenty-six.
Writ of amparo (recurso de amparo) filed under case file number 26-009989-0007-CO, brought by Nombre01, national identification number (cédula de identidad) CED01, against the MUNICIPALIDAD DE COTO BRUS and the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS -ICAA-.
Background:
The opinion is authored by Justice Castillo Víquez; and,
Considering:
I.Subject of the writ. The petitioner states that she has resided for more than 13 years in Santa Teresa de Coto Brus, where she keeps her tax payments and garbage collection service fees current, yet the municipality does not provide that service in her community, compelling her over the years to transport waste to the center of town. She argues, however, that she is currently unable to do so on her own due to knee problems and the distance involved, so she must pay third parties to transport her garbage, while others opt to discard it on public roads or in forested areas in the absence of effective collection. She also indicates that her home lacks access to potable water and depends on a contaminated stream, whose quality worsens during the rainy season, which has caused health problems for her and for her grandmother, an elderly person in her care. In this context, she maintains that, despite the proximity of water distribution infrastructure and of homes that do have service, the ICAA has required her to bear a high installation cost that is beyond her means. Finally, she states that even though the collection truck travels at a certain distance from her home, the respondent authorities' failure to take measures to guarantee effective access to the basic services at issue sustains the described situation and violates her fundamental rights.
II.Preliminary matter. In view of the fact that the president of the Municipal Council of Coto Brus failed to respond to the hearing within the period set by this Tribunal in the admission order of the sub lite, the writ is resolved in accordance with Article 45 of the Ley de la Jurisdicción Constitucional and taking into account the evidentiary elements contained in the case record.
III.Proven facts. For the purposes of deciding this matter, the following facts are deemed to have been duly established, either because they have been so proven or because the respondent party failed to address them as required in the initial order:
IV.Regarding the solid-waste collection service. The petitioning party contends that, despite having resided for more than 13 years in Santa Teresa de Coto Brus and having kept all tax payments current, she does not receive solid-waste collection service, which has compelled her to transport her refuse by her own means or through third parties, given her physical limitations and the distance involved.
On this point, the Court found it established that the access road to the petitioner's property has an uncompacted gravel (lastre) surface, a width of less than four meters, steep grades, sharp curves, and irregular topography. The respondent municipality further clarified that the passage of a heavy vehicle along that road "…entails risks to the physical safety of municipal employees, neighboring residents, and institutional property." In view of this situation, it is apparent that the inability to provide the service to the protected party stems from physical or technical constraints that are not attributable to the respondent municipality. Accordingly, no infringement of her fundamental rights is established.
V.Regarding potable water service. The protected party also alleges that she lacks access to potable water and depends on a contaminated source, a situation that has caused harm to her health and that of her grandmother, and that, despite the proximity of infrastructure and homes with service, ICAA conditions access to service upon payment of a high fee, for which reason she attributes to the respondent authorities a failure to take steps to guarantee effective access to those basic services.
First, it should be noted that this Tribunal has recognized the so-called fundamental right to water, under which all persons must be granted the possibility of accessing potable water services on equal terms, since water is essential to human life and health. Nevertheless, this status as a fundamental right does not imply unrestricted access to water services, since the administration may establish general requirements that each applicant must fulfill in order to have their particular request assessed. Particularly with regard to the denial of a request for potable water availability due to non-compliance with requirements or legal, formal, technical, or material impossibility, this Tribunal, in judgment no. 2023-009594 of 09:15 hours of April 28, 2023, explained:
"[I]t is established that the respondent institution rejected the application for potable water service on the ground that there is no water or sewer system availability in front of the property. In this regard, this Tribunal has held that ICAA, associations that administer water and sewer systems, municipalities, and other institutions that provide potable water supply service, may validly reject — or make conditional — applications for potable water service submitted to them if there are technical or legal reasons that so justify it. Thus, in judgment No. 2016-006027 of 09:05 hours of May 6, 2016, this Court held:
'This Constitutional Tribunal, in judgment 2014-9134 of 14:05 hours of June 19, 2014, which addressed a matter very similar to that presented in this petition, ruled: "(...) This Court has stated in repeated judgments on this subject that the supply of potable water is regarded under Costa Rican law as a public service, and that, as such, every provider of public services — whether a public or private entity — is obligated to render the service continuously, efficiently, and on equal terms, and must adapt to technological changes (see in this regard judgment 2001-09676 of eleven hours and twenty-five minutes of the twenty-sixth of September of two thousand and one, and judgment 2004-08161 of ten hours and fifty-three minutes of the twenty-third of July of two thousand and four). It therefore follows clearly that ICAA, as one of the state entities responsible for the provision of the public potable water service, is likewise obligated to provide this service continuously, adaptably, efficiently, and equally to all inhabitants.
Moreover, the case law of this Constitutional Tribunal has also stated that, in the face of legal impossibility (that is, failure to comply with requirements established by the applicable regulations) or formal impossibility (that is, the absence of a Water Distribution Network), it is reasonable not to process service applications, or to require the interested party to assume installation costs when no potable water distribution network exists and the construction of infrastructure is required. Accordingly, in such cases it has been established that this does not constitute a denial of access to potable water service, but rather an inability to provide it, or the need for the interested party to participate in overcoming a technical obstacle — namely, the lack of infrastructure. In other words, provided that the failure to supply potable water service is not capricious, arbitrary, or without basis, but rather is justified by legal or material impossibility, no violation of fundamental rights exists.
In the specific case, the evidence submitted and the sworn report confirm that AyA has not arbitrarily rejected the application filed by the petitioner, but rather has done so due to failure to comply with all of the technical and legal requirements that the Reglamento de Prestación de Servicios a los Clientes de Instituto Costarricense de Acueductos y Alcantarillados establishes for the approval of new services." This ruling may be supplemented by judgment No. 2017-005245 of 10:00 hours of April 7, 2017, which, in the pertinent part, held:
"From the sworn report submitted by the authorities of the respondent municipality, it is indicated that the petitioner's claim — as to whether or not the location of Ms. Nombre50100's property falls within the water supply area — is a matter for ICAA to address, since the Municipality has no competence in that regard. For its part, ICAA states that it has acted in accordance with the regulations governing it, exercising its supervisory role as required, and that at all times its actions have been duly reasoned and well-founded, as described; it is thus evident that the Instituto has proceeded in accordance with the law, since, according to the technical report issued by the UEN Optimización de Sistemas Nuevos Desarrollos GAM, official communication UEN-OSND-GAM-2017-00082, it is clearly stated that potable water availability does not exist for the property cited by Ms. Nombre50101 in her writ of amparo (amparo).
The report further adds that, upon reviewing the history of this property, it appears to have belonged to the property with cadastral plan [Valor 005] and, upon consultation with the National Registry, the latter was subdivided (fraccionamiento) and four properties resulted therefrom without the availability procedure having been carried out for said subdivision. In light of the foregoing, this Court is unable to establish any omission or arbitrary action on the part of the respondent authority; consequently, it is appropriate to dismiss the writ of amparo, and to reiterate that, according to the evidence submitted, the failure to provide potable water service to the petitioner's lot is not a capricious, arbitrary, or unfounded action, but rather is justified by the non-existence of potable water availability in the area. (See in a similar vein judgments numbers 2014-9134 of 14:05 hours of June 19, 2014 and 2016007240 of 09:20 hours of May 27, 2017, among others).
Under this understanding, no infringement of fundamental rights exists and, therefore, the appropriate course is to dismiss the writ of amparo." Given this state of affairs, the respondent institution rejected the application of the protected party, fully informing her of the technical reasons why her request could not be granted — namely, that potable water availability does not exist in front of the property because there is no sewer system. Whether the requested service should be granted is not a matter to be decided in this jurisdiction, since it falls outside its scope of competence; and it should be noted that this Tribunal has held on repeated occasions that it is permissible to dismiss petitions seeking the granting of potable water service when technical impossibilities exist, when infraconstitutional requirements are not met, or when technical or legal criteria so justify it. Moreover, this Court should not act as an intermediary between a given natural or legal person — whether governed by public or private law — to intercede on behalf of a third party in order to obtain what the petitioning parties seek, as the applicant in this case requests.
The applicant must therefore raise any objections or claims before the respondent authority or in the competent judicial forum, venues in which the applicant will be able to fully litigate the merits of the matter and assert her claims. Accordingly, the writ of amparo is dismissed, as is hereby ordered." (Emphasis not in the original.)
On the denial of potable water service for objective reasons, mention must be made of judgment No. 2019-023102 of 08:50 hours of November 22, 2019, in which, upon hearing a similar petition, the Court ruled as follows:
"Furthermore, in the sworn report submitted by the respondent authority, it is explained that although there are properties adjacent to that of the petitioner that do have water service, this is because they present different characteristics. The report notes that the three plots derived from the parent property (finca madre) 2-254199-000, including that of the petitioner, were registered in the cadastre in April 2018, as verified from the plan submitted by the interested party — a date subsequent to opinions C-258-2017 of November 9, 2017 and C-300-2017 of December 13, 2017 issued by the Procuraduría General de la República (PGR), which confirm the continued full force of the obligations set forth in Article 10, paragraph 2) of the Ley de Planificación Urbana, while also recalling the need to obtain prior approval from AyA, pursuant to Article 21 of its constitutive law. In view of the foregoing, since it is not established that the lots segregated from the parent property of the plot owned by the petitioner were granted availability without having obtained AyA approval — required for subdivision in accordance with Article 21 of the Constitutive Law of AyA, No. 2726 — or the approval of INVU, pursuant to Article 10, paragraph 2) of the Ley de Planificación Urbana and Article 21 of the Constitutive Law of AyA; unequal treatment to the detriment of the protected party is ruled out, and it is evident that the denial of potable water availability was based on objective grounds.
As a corollary, arbitrary action on the part of the respondent authority is ruled out, and it is appropriate to dismiss the writ of amparo in all its aspects, as is hereby ordered, but not before advising the petitioner of her right to challenge the decision regarding her potable water application before the competent authority or before the contentious-administrative jurisdiction." Under this understanding, in the instant case it is established that ICAA informed the petitioner that potable water service is not available for the property at issue in her application, due to the impossibility of locating it spatially owing to the absence of geographic information in the corresponding cadastral survey plan. Accordingly, the denial of service does not result from arbitrary action but rather from the verification of conditions necessary to determine the viability of the filed application. In this vein, this Court has held that, although a fundamental right of access to potable water exists, its provision may be made subject to compliance with the established requirements for its granting and to the existence of a material possibility of supply, such that it cannot be demanded when circumstances arise that prevent or advise against its provision (see also in this regard judgment no. 2023-022230 of 09:15 hours of September 8, 2023).
As for the petitioner's assertion that she was required to assume a high cost for the installation of the service, the fact is that this allegation is not established in the case file, and moreover, the respondent institution denied having made any such indication; it is therefore not possible to consider as proven any specific action in that regard that would allow a finding of infringement of her fundamental rights.
Thus, since it is not established that the action of the respondent authority was capricious or without basis, no infringement of the petitioner's fundamental rights is configured on this point, and it is therefore appropriate to dismiss the writ of amparo in this respect, as is hereby done.
I consider that in environmental matters, once the Public Administration has already intervened, their review and resolution belongs to the contentious-administrative jurisdiction. Nonetheless, I do proceed to examine the merits of the matter when other rights of the persons affected by the source of contamination are at stake, including health, quality of life, and the right to enjoy a healthy environment free from contamination (Article 50 of the Political Constitution), as is the case here, in which the alleged suspension of solid-waste collection service by the Municipalidad de Coto Brus is at issue, affecting the right of the petitioning party and neighboring residents to enjoy a healthy, ecologically balanced environment and a dignified standard of living.
VII.Partial dissenting vote of Justices Cruz Castro and Rueda Leal. In the case under review, the petitioning party claims inadequate provision of potable water service in the place where she lives.
In this regard, as has occurred in other matters in which problems of water supply of this magnitude have been alleged (for example, case file no. 20-004883-0007-CO), we consider it essential to include as a party the Public Services Regulatory Authority (Autoridad Reguladora de Servicios Públicos, Aresep). Indeed, in the judgment issued in the aforementioned proceeding (no. 2020007754 of 9:45 hours of April 24, 2020), the Court took into account that Aresep, in its report, identified a series of problems with ICAA regarding infrastructure investment, losses from non-billed water, and project execution capacity. On that occasion, this Tribunal held: "In this regard, not only is it established that the water shortage (desabastecimiento) problem had been manifesting since 2017, but also that ARESEP pointed out that ICAA had a backlog in infrastructure investment and, in addition, significant losses on account of non-billed water. The regulatory body also stated that the project execution capacity of potable water service operators has not been what would be desired." Accordingly, we dissent and order the continuation of the processing of the petition for the purpose of requesting a report from the General Regulator of the Public Services Regulatory Authority.
VIII.Documentation submitted to the case file. The parties are hereby put on notice that any documents submitted in paper form, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device, must be retrieved from the clerk's office within a maximum period of thirty business days counted from the notification of this judgment. Otherwise, all material not retrieved within this period will be destroyed, pursuant to the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Plenary Court (Corte Plena) in Session No. 27-11 of August 22, 2011, Article XXVI, and published in Boletín Judicial No. 19 of January 26, 2012, as well as the resolution approved by the Superior Council of the Judiciary (Consejo Superior del Poder Judicial) in Session No. 43-12 held on May 3, 2012, Article LXXXI.

Justices Cruz Castro and Rueda Leal dissent and order the continuation of the processing of the petition for the purpose of requesting a report from the General Regulator of the Public Services Regulatory Authority. Recurso de amparo que se tramita en expediente número 26-009989-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra la MUNICIPALIDAD DE COTO BRUS y el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS -ICAA-.
Resultando:
Redacta el Magistrado Castillo Víquez; y,
Considerando:
I.Objeto del recurso. La recurrente señala que reside desde hace más de 13 años en Santa Teresa de Coto Brus, donde mantiene al día el pago de impuestos y del servicio de recolección de basura, pese a lo cual la municipalidad no brinda dicho servicio en su comunidad, obligándola durante años a trasladar los desechos hasta el centro del poblado; sin embargo, aduce que actualmente no puede realizar esa labor por sus propios medios debido a problemas en sus rodillas y a la distancia, por lo que debe pagar a terceros para el transporte de la basura, mientras que otras personas optan por desecharla en la vía pública o en zonas boscosas ante la ausencia de recolección efectiva. Asimismo, indica que en su vivienda no cuenta con acceso a agua potable y depende de una quebrada contaminada, cuya calidad se agrava en época lluviosa, lo que ha generado afectaciones en su salud y en la de su abuela, persona adulta mayor a su cargo.
En ese contexto, sostiene que, pese a la cercanía de infraestructura de distribución de agua y de viviendas que sí cuentan con el servicio, el ICAA le ha exigido asumir un costo elevado para su instalación, lo que resulta inaccesible. Finalmente, manifiesta que, aun cuando el camión recolector transita a cierta distancia de su vivienda, la falta de medidas por parte de las autoridades recurridas para garantizar el acceso efectivo a los servicios básicos denunciados mantiene la situación descrita y vulnera sus derechos fundamentales.
II.Cuestión preliminar. En vista de que el presidente del Concejo Municipal de Coto Brus omitió contestar la audiencia dentro del plazo fijado por este Tribunal en la resolución de curso del sub lite, se procede a resolver el recurso de acuerdo con el artículo 45 de la Ley de la Jurisdicción Constitucional y tomando en consideración los elementos probatorios que constan en los autos.
III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la parte recurrida haya omitido referirse a ellos según lo prevenido en el auto inicial:
IV.Sobre el servicio de recolección de basura. La parte recurrente sostiene que, pese a residir desde hace más de 13 años en Santa Teresa de Coto Brus y mantener al día el pago de tributos, no recibe el servicio de recolección de residuos sólidos, lo que le ha obligado a trasladar sus desechos por sus propios medios o mediante terceros ante sus limitaciones físicas y la distancia existente.
Sobre este particular, la Sala tuvo por probado que la vía de acceso a la propiedad de la promovente cuenta con una superficie de lastre sin compactación, un ancho inferior a cuatro metros, pendientes pronunciadas, curvas cerradas y topografía irregular. Incluso, la municipalidad accionada aclaró que el tránsito del vehículo pesado por esa vía “…implica riesgos para la integridad física de los funcionarios municipales, los vecinos y los bienes institucionales”.
Ante este panorama, se verifica que la imposibilidad de brindar el servicio a la parte tutelada responde a limitaciones físicas o técnicas, que no son atribuibles municipalidad accionada. En ese tanto, no se verifica una lesión a sus derechos fundamentales.
V.Respecto al servicio de agua potable. La amparada también alega que carece de acceso a agua potable y depende de una fuente contaminada, situación que ha generado afectaciones a su salud y a la de su abuela, y que, pese a la cercanía de infraestructura y de viviendas con servicio, el ICAA condiciona su acceso al pago de un costo elevado, por lo que atribuye a las autoridades recurridas la falta de acciones para garantizar el acceso efectivo a dichos servicios básicos.
En primer lugar, conviene destacar que este Tribunal ha reconocido el denominado derecho fundamental al agua por el cual debe concederse a todas las personas la posibilidad de acceder, en condiciones de igualdad, a los servicios de agua potable, toda vez que esta resulta esencial para la vida y la salud humanas. No obstante, este carácter de derecho fundamental no implica un acceso irrestricto a los servicios de agua, ya que la administración puede establecer requisitos generales de necesario cumplimiento por cada solicitante para valorar su particular requerimiento. Particularmente en lo que respecta a la denegatoria de una solicitud de disponibilidad de agua potable por incumplimiento de requisitos o imposibilidad jurídica, formal, técnica o material, este Tribunal en la sentencia nro. 2023-009594 de las 09:15 horas de 28 de abril de 2023, explicó:
“[S]e constata que el instituto recurrido rechazó la solicitud del servicio de agua potable bajo el argumento que no hay disponibilidad de agua y sistema de alcantarillado al frente de propiedad. Al respecto, este Tribunal ha señalado que el Instituto Costarricense de Acueductos y Alcantarillados, las asociaciones administradoras de acueductos y alcantarillados, las municipalidades y demás instituciones que prestan el servicio de suministro de agua potable, pueden rechazar válidamente las solicitudes de servicio de agua potable que les sean formuladas o condicionarlas si existen razones técnicas o legales que así lo justifican. De esta forma, en sentencia No. 2016-006027 de las 09:05 horas del 06 de mayo de 2016, esta Sala consideró:
“Este Tribunal Constitucional en la sentencia 2014-9134 de las 14:05 horas del 19 de junio de 2014, que abordó una cuestión muy similar a la expuesta en el presente recurso, dispuso: '(...) Esta Sala ha indicado en reiteradas sentencias sobre el tema que el suministro de agua potable es considerado dentro del ordenamiento jurídico costarricense como un servicio público, y que como tal, todo prestador de servicios públicos -sea sujeto público o sujeto privado- está obligado a prestar el servicio de forma continua, eficiente, en condiciones de igualdad y debiendo adaptarse a los cambios tecnológicos (véase al respecto la sentencia 2001-09676 de las once horas veinticinco minutos del veintiséis de setiembre del dos mil uno y la sentencia 2004-08161 de las diez horas con cincuenta y tres minutos del veintitrés de julio del dos mil cuatro). Resulta claro entonces concluir que el Instituto Costarricense de Acueductos y Alcantarillados, al ser uno de los entes estatales encargados de la prestación del servicio público de agua potable, está obligado también a prestar este servicio de forma continua, adaptable, eficiente y por igual a todos los habitantes.
Ahora bien, también la jurisprudencia de este Tribunal Constitucional ha indicado que, frente a la imposibilidad jurídica (que es la falta de cumplimiento de requisitos establecidos en la reglamentación respectiva) o frente a la imposibilidad formal (que es la falta de una Red de Distribución de Aguas), es razonable no atender las solicitudes de servicio o solicitar que el interesado asuma los costos de instalación cuando no exista red de distribución de agua potable y se necesite la construcción de infraestructura. Así, en estos casos se ha tenido claro que no es que se trate de una negativa al acceso al servicio de agua potable, sino de la imposibilidad para brindarlo o de la necesaria participación del interesado en el levantamiento de una imposibilidad técnica, cual es, la falta de infraestructura. En otras palabras, siempre que la falta de dotación del servicio de agua potable no sea una actuación antojadiza, arbitraria o sin fundamento, sino que esté justificada en la imposibilidad jurídica o material no estamos frente a la violación de derechos fundamentales.
En el caso concreto, de la prueba aportada y del informe rendido bajo juramento, se corrobora que el AyA no ha rechazado arbitrariamente la solicitud planteada por la recurrente, sino por la falta del cumplimiento de la totalidad de los requisitos técnico-legales que existe el Reglamento de Prestación de Servicios a los Clientes de Instituto Costarricense de Acueductos y Alcantarillados para aprobar nuevos servicios”.
Este pronunciamiento puede complementarse con la sentencia No. 2017-005245 de las 10:00 horas del 07 de abril de 2017, que en lo conducente dispuso:
“Del informe rendido por las autoridades de la municipalidad recurrida se indica que el reclamo de la recurrente, respecto de si el lugar donde tiene la propiedad la señora Nombre50100 está fuera o no del abastecimiento de agua, le corresponderá al Instituto Costarricense de Acueductos y Alcantarrillados referirse al respecto, ya que la Municipalidad no tiene competencia para ello. Y por su parte, el Instituto Costarricense de Acueductos y Alcantarillados menciona que han actuado conforme a la normativa que lo regula, ejerciendo su función rectora como corresponde, llevando a cabo en todo momento actuaciones debidamente fundamentadas y razonadas como se detalló, se evidencia así que el Instituto ha procedido conforme a derecho, ya que según el informe técnico emitido por la UEN Optimización de Sistemas Nuevos Desarrollos GAM, oficio UEN-OSND-GAM- 2017-00082, se indica claramente que para el inmueble que cita la señora Nombre50101 en su recurso de amparo, no existe la disponibilidad de agua potable.
Además agrega el informe, que en análisis de los antecedentes de este inmueble se tiene que pertenecía a la propiedad con catastro [Valor 005] y según consulta al Registro Nacional, ésta última fue fraccionada y de la misma resultaron cuatro propiedades sin mediar la gestión del trámite de disponibilidad para dicho fraccionamiento. Así las cosas, esta Sala no logra acreditar ninguna omisión o actuación arbitraria por parte de la autoridad recurrida, en consecuencia lo correspondiente es declarar sin lugar el amparo, y reiterar que según la prueba aportada, la falta de dotación del servicio de agua potable en el lote de la recurrente no es una actuación antojadiza, arbitraria o sin fundamento, sino que está justificada en la inexistencia de disponibilidad de agua potable en el sector. (Ver en similar sentido las sentencias números 2014-9134 de las 14:05 horas del 19 de junio de 2014 y 2016007240 de las 09:20 horas del 27 de mayo 2017, entre otras). Bajo esa inteligencia, no se está frente a la infracción de derechos fundamentales y, por ello, lo pertinente es desestimar el recurso de amparo”.
Sobre la denegatoria del servicio de agua potable por razones objetivas, se impone mencionar la sentencia No. 2019-023102 de las 08:50 horas del 22 de noviembre de 2019, al conocer de un amparo similar la Sala declaró lo siguiente:
“Por otro lado, en el informe dado bajo la gravedad de juramento por parte de la autoridad recurrida, se explica que si bien hay propiedades que colindan con la de la recurrente, que cuentan con el servicio de agua, ello se debe a que presentan características distintas. Distingue que, los tres fundos derivados de la finca madre 2-254199-000, entre los que se encuentra el de la recurrente, se catastraron en abril del año 2018, según se verifica en el plano aportado por la interesada, en fecha posterior a los pronunciamientos C-258-2017 del 9 de noviembre del 2017 y C-300-2017 del 13 de diciembre del 2017 de la Procuraduría General de la República (PGR), los cuales confirman la plena vigencia de las obligaciones contenidas en el artículo 10, inciso 2) de la Ley de Planificación Urbana, al tiempo que recuerda la necesidad de obtener la aprobación previa por parte del AyA, en respuesta a lo dispuesto en el artículo 21 de su ley constitutiva.
Así las cosas, al no desprenderse que a los lotes segregados de la finca madre del fundo propiedad de la recurrente, se les haya dado la disponibilidad pese a no contar con el visto del AyA - necesario para el fraccionamiento, de conformidad con lo señalado en el artículo 21 de la Ley Constitutiva del AyA, N° 2726- o con el visto bueno del Instituto Nacional de Vivienda y Urbanismo (INVU), de conformidad con lo señalado en el artículo 10, inciso 2) de la Ley de Planificación Urbana y el artículo 21 de la Ley Constitutiva del AyA; se descarta un trato desigual en perjuicio de la tutelada, y se aprecia que la denegatoria de disponibilidad de agua potable se fundamentó en razones objetivas. Corolario de lo anterior, se descarta que la actuación de la autoridad recurrida haya sido arbitraria y procede desestimar el recurso en todos sus extremos, como en efecto se dispone, no sin antes advertir a la recurrente su derecho de cuestionar lo resuelto en relación con su solicitud de agua potable, ante la autoridad o ante la jurisdicción contenciosa administrativa” Bajo tal estado de las cosas, el instituto recurrido rechazó la petición de la parte amparada, haciéndole saber cabalmente las razones de orden técnico por las cuales no procedía atender su solicitud, como es que no hay disponibilidad de agua potable al frente de la propiedad, pues no hay sistema de alcantarillado.
La procedencia o no del servicio solicitado no es un asunto que deba discutirse en esta jurisdicción, toda vez que es ajeno al ámbito de su competencia y cabe agregar que en reiteradas ocasiones este Tribunal ha sostenido que resulta posible desestimar las gestiones presentadas para el otorgamiento del servicio de agua potable, cuando se presenten imposibilidades técnicas, incumplimiento de requisitos infraconstitucionales o existan criterios técnicos o legales que así lo justifiquen. Por otra parte, este Sala no debe fungir como mediador ante una determinada persona física o jurídica ‒ya sea ésta última de derecho público o privado‒, para interceder por una tercera persona a fin de que se le conceda lo que las partes recurrentes pretenden, tal y como así lo solicita el gestionante que se proceda en este caso. Por ello, deberá plantear sus inconformidades o reclamos ante la autoridad recurrida o en la vía jurisdiccional competente, vías en las cuales podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones. En consecuencia, se desestima el recurso como en efecto se dispone” (el énfasis no pertenece al original).
Bajo ese entendido, en el sub lite se tiene por acreditado que el ICAA comunicó a la recurrente que no existe disponibilidad de agua potable para el inmueble objeto de su solicitud, debido a la imposibilidad de ubicarlo espacialmente por la ausencia de información geográfica en el plano catastrado correspondiente. De esta forma, la denegatoria del servicio no responde a una actuación arbitraria, sino a la verificación de condiciones necesarias para determinar la procedencia de la solicitud planteada. En esa línea, esta Sala ha señalado que, si bien existe un derecho fundamental al acceso al agua potable, su prestación puede sujetarse al cumplimiento de los requisitos establecidos para su otorgamiento y a la existencia de posibilidad material de suministro, de modo que no resulta exigible cuando concurren circunstancias que impiden o desaconsejan su prestación (ver en este sentido también la sentencia nro. 2023-022230 de las 09:15 horas del 08 de setiembre de 2023).
En cuanto a la manifestación de la recurrente relativa a que se le habría exigido asumir un costo elevado para la instalación del servicio, lo cierto es que tal extremo no se encuentra acreditado en el expediente, aunado a que el instituto recurrido negó haber realizado dicha indicación, por lo que no es posible tener por demostrada una actuación concreta en ese sentido que permita derivar una lesión a sus derechos fundamentales.
Así, al no acreditarse que la actuación de la autoridad recurrida sea antojadiza o carente de fundamento, no se configura en este extremo una lesión a los derechos fundamentales de la recurrente, por lo que corresponde desestimar el recurso en cuanto a este punto, como en efecto se hace.
Considero que en asuntos ambientales, si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que se acusa la aparente suspensión del servicio de recolección de basura por parte de la Municipalidad de Coto Brus, lo que afecta el derecho a disfrutar de un ambiente sano, ecológicamente equilibrado y de un nivel digno de calidad de vida de la parte recurrente y los vecinos del lugar.
VII.Voto salvado parcial de los magistrados Cruz Castro y Rueda Leal. En el sub examine, la parte accionante reclama la inadecuada prestación del servicio de agua potable en el lugar donde vive.
Al respecto, tal y como ha ocurrido en otros asuntos en los que se han alegado problemas de abastecimiento de esa magnitud (por ejemplo, el expediente nro. 20-004883-0007-CO), consideramos imprescindible tener como parte a la Autoridad Reguladora de Servicios Públicos (Aresep). Incluso, en la sentencia dictada en el proceso referido (nro. 2020007754 de las 9:45 horas de 24 de abril de 2020), la Sala valoró que Aresep, al rendir su informe, puntualizó una serie de problemas del Instituto Costarricense de Acueductos y Alcantarillados en relación con la inversión en infraestructura, pérdidas por agua no contabilizada y capacidad de ejecución. En esa oportunidad, este Tribunal consideró: “Al respecto, no solo consta que la problemática de desabastecimiento de agua se venía reflejando desde el 2017, sino que la ARESEP puntualizó que el ICAA tenía un rezago en la inversión en infraestructura y, además, significativas pérdidas por concepto de agua no contabilizada. Asimismo, el ente regulador también afirmó que la capacidad de ejecución de los proyectos por parte de los operadores del servicio de agua potable no ha sido la deseable”.
En consecuencia, salvamos el voto y ordenamos continuar la tramitación del recurso a los efectos de que se solicite informe al regulador general de la Autoridad Reguladora de los Servicios Públicos.
VIII.Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial No. 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara sin lugar el recurso. El Magistrado Salazar Alvarado consigna nota. Los magistrados Cruz Castro y Rueda Leal salvan el voto y ordenan continuar la tramitación del recurso a los efectos de que se solicite informe al regulador general de la Autoridad Reguladora de los Servicios Públicos. Notifíquese.
