CASE FILE N° 26-018566-0007-CO PROCEEDING: WRIT OF AMPARO (RECURSO DE AMPARO) RESOLUTION N° 2026020177 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours and twenty-five minutes on the third of June of two thousand twenty-six.

Writ of amparo filed by Nombre01, national identity document CED01, against the NATIONAL ANIMAL HEALTH SERVICE (SERVICIO NACIONAL DE SALUD ANIMAL, SENASA).

Whereas:

  1. 1By written submission incorporated into the Chamber's digital case file at 13:58 hours on May 25, 2026, the petitioner files a writ of amparo against SENASA. The petitioner states that on May 1, 2026, they entered the country through the Dirección01 airport, arriving from Chile. The petitioner affirms that they were carrying marine shells originating from Chile, sacred instruments of their faith and family heritage for the past 15 years. The petitioner notes that a layover was made in Panama. The petitioner details that the respondent seized the goods without explaining the legal provision violated or the risk involved. Subsequently, the petitioner was informed that the goods would be transferred to SINAC, despite being of a religious nature and in transit. The petitioner challenged the seizure on May 3, 2026, but SENASA remained silent. The petitioner mentions that Chile can certify that the goods are not CITES species, and that their removal from Chile was for religious purposes, which is lawful, and that the goods are non-commercial in nature.The petitioner considers the right to due process and freedom of worship to have been violated. Considering:

I. REGARDING CLOSURE OF THE CASE FILE

The facts raised herein are already under analysis before this Chamber, as the petitioner themselves filed another writ of amparo on behalf of the protected party, in which the same grievances alleged in these proceedings were set forth. It has been established that said proceeding is currently being processed under case file no. 26-017328-0007-CO and, according to information contained in the Costa Rican Judicial Case Management System (Sistema Costarricense de Gestión de Despachos Judiciales, S.G.D.J.), as of the date this amparo was filed, it remains pending resolution. For this reason, it is inadmissible to admit a new matter to litigate the same facts that are—in essence—already being considered in that case file, as this, beyond posing a serious risk of two contradictory rulings being issued, would cause unnecessary delay in the processing of the first proceeding, to the detriment of the protected party's own interests. For the foregoing reasons, the appropriate course of action is to order the closure of this matter.

II. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are hereby notified that if any document has been submitted in paper form, as well as any objects or evidence contained in additional electronic, computer, magnetic, optical, telematic, or new-technology-produced devices, these must be retrieved from the office within a maximum period of 30 business days counted from the notification of this judgment. Otherwise, all material not retrieved within this period will be destroyed, pursuant to the provisions of the "Regulations on the Electronic Case File before the Judicial Branch" (Reglamento sobre Expediente Electrónico ante el Poder Judicial), approved by the Full Court (Corte Plena) in session N° 27-11 of August 22, 2011, Article XXVI, and published in Judicial Bulletin (Boletín Judicial) number 19 of January 26, 2012, as well as the agreement approved by the Superior Council of the Judicial Branch (Consejo Superior del Poder Judicial) in session N° 43-12 held on May 3, 2012, Article LXXXI.

PROCESO: RECURSO DE AMPARO RESOLUCIÓN Nº 2026020177 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del tres de junio de dos mil veintiseis .

Recurso de amparo interpuesto por Nombre01, cédula de identidad CED01, contra el SERVICIO NACIONAL DE SALUD ANIMAL (SENASA).

Resultando:

  1. 1Por escrito incorporado al expediente digital de la Sala a las 13:58 horas del 25 de mayo de 2026, la parte recurrente interpone recurso de amparo contra SENASA. Indica que el 1 de mayo de 2026 ingresó al país por el aeropuerto Dirección01, procedente desde Chile. Afirma que portaba conchas marinas originarias de Chile, instrumentos sagrados de su fe y su patrimonio familiar desde hace 15 años. Comenta que la escala fue en Panamá. Detalla que el recurrido decomisó los bienes, sin explicar la norma lesionada o el riesgo. Posteriormente se le informó que los bienes pasaban a SINAC, aun cuando son religiosos y en tránsito. Impugnó el 3 de mayo de 2026, pero SENASA guardó silencio. Menciona que Chile puede certificar que los bienes no son especies CITES, y su salida es para fines religiosos, lo que es lícito, así como no tienen naturaleza comercial. Estima lesionado el debido proceso y la libertad de culto. Solicita que se ordene la suspensión de la destrucción o traslado de los bienes. También pide que se anule la bolea 66383, la cual, e todo caso, tiene un error material. Finalmente, requiere que se devuelvan los bienes.

Considerando:

Se ha constatado que dicho proceso actualmente se tramita en el expediente nro. 26-017328-0007-CO y, según la información contenida en el Sistema Costarricense de Gestión de Despachos Judiciales (S.G.D.J.), a la fecha de interposición de este amparo, se encuentra pendiente de resolución. II. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Archívese el expediente.
