CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours twenty minutes on the twenty-sixth of June, two thousand twenty-six.
Writ of amparo (recurso de amparo) filed by [Nombre 001], identity card number [Valor 001], against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA).
BACKGROUND:
Opinion authored by Justice Araya García; and,
CONSIDERING:
The petitioner alleges that ICAA, in an arbitrary and unjustified manner, conditioned the installation of the potable-water service at his home on the submission of a municipal building permit, even though the construction work was left incomplete due to lack of funding.
The following are found to be established as relevant to the resolution of this writ of amparo:
It was likewise established that "Property Registry Folio real matrícula 1-3519 has associated potable-water services NIS 3372960, billed in the name of Jose Joaquín Sanabria Marín, NIS 3372956 billed in the name of Jose Joaquín Sanabria Marín, NIS 5221444, billed in the name of Hermanos Sanabria Orozco, NIS 3372953 billed in the name of Jose Joaquín Sanabria Marín, NIS 5503042 billed in the name of Laura María Mora Hidalgo y Otros, and NIS 5516454, billed in the name of María Isabel Sanabria Orozco, and NIS 5551692 billed in the name of Victor Emilio Sanbria Orozco" (see report and evidence).
It is clarified that AyA grants services only to properties to be built or under development that present the corresponding municipal building permit (…)". This permit, as reported, must correspond to the project under construction in the field and to the purpose for which Service Availability Certificate for Aqueduct without Sewerage SIGDD-2025-00108188-1-2-SN was approved (see report).
"(…) I formally respond to notification UEN-SCMED-GAM-DYNS-2026-275 received on April 24, related to new service application B14132026020022. In that regard, I clarify and request the following: 1. Status of the Works: The existence of a completed construction and another closed shell structure (obra gris) (with no current technical activity) is confirmed. However, I clarify that the building permit was not originally applied for because AyA did not grant water availability at the appropriate time, which created an administrative blockage that prevented the formalization of the plans before the Municipalidad de Vásquez de Coronado. 2. Human Rights and Public Health: The completed building is already occupied. The refusal to connect service on the grounds of an urban planning requirement indefinitely postpones access to a fundamental human right, putting at risk the health and dignified life of those of us who reside in the property. Prayer for Relief: I request that, under the principle of the paramount interest of the human being and the rulings of the Sala Constitucional on access to water (such as Voto 2011-002704), the service connection be proceeded with in order to permit habitability and the subsequent municipal regularization process (…)" (see report and evidence).
III.On the Denial of an Application for Potable Water Service Due to Failure to Meet Requirements or Legal, Formal, Technical, or Material Impossibility. The jurisprudence of the Court has recognized the so-called fundamental right to water, by virtue of which all persons must be afforded the opportunity to access potable water services under conditions of equality, since water is essential to human life and health. Nevertheless, this character as a fundamental right does not entail unrestricted access to water services, as the administration may establish general requirements that each applicant must necessarily fulfill in order for their particular need to be assessed. Particularly with regard to the denial of an application for potable water service due to failure to meet requirements or legal, formal, technical, or material impossibility, this Tribunal, in ruling No. 2023-009594 of 09:15 hours of April 28, 2023, explained:
"(…) it is established that the respondent institute rejected the application for potable water service on the grounds that there is no water availability and no sewage system (alcantarillado) in front of the property. In this regard, this Tribunal has held that ICAA, the community water and sewer administration associations (asociaciones administradoras de acueductos y alcantarillados, ASADAS), municipalities, and other institutions that provide potable water supply services, may validly reject potable water service applications submitted to them, or condition them, where there are technical or legal reasons justifying such action. Thus, in ruling No. 2016-006027 of 09:05 hours of May 6, 2016, this Court held:
'This Constitutional Tribunal, in ruling 2014-9134 of 14:05 hours of June 19, 2014, which addressed a matter very similar to the one raised in the present appeal, ruled: '(...) This Court has stated in repeated rulings on the subject that the supply of potable water is recognized within the Costa Rican legal order as a public service, and that as such, every public service provider—whether a public or private entity—is obligated to provide the service continuously, efficiently, under equal conditions, and adapting to technological changes (see in this regard ruling 2001-09676 of eleven hours and twenty-five minutes of September twenty-sixth, two thousand one, and ruling 2004-08161 of ten hours and fifty-three minutes of July twenty-third, two thousand four). It is therefore clear to conclude that ICAA, as one of the state entities responsible for the provision of the public potable water service, is likewise obligated to provide this service continuously, adaptably, efficiently, and equally to all inhabitants.
Now, the jurisprudence of this Constitutional Tribunal has also indicated that, in the face of legal impossibility (meaning the failure to comply with requirements established in the relevant regulations) or formal impossibility (meaning the absence of a Water Distribution Network), it is reasonable not to fulfill service applications or to require the interested party to bear the installation costs when no potable water distribution network exists and construction of infrastructure is necessary. Thus, in such cases it has been clearly established that this is not a refusal of access to the potable water service, but rather an impossibility of providing it, or the necessary participation of the interested party in overcoming a technical impossibility—namely, the lack of infrastructure. In other words, as long as the failure to supply the potable water service is not a capricious, arbitrary, or unfounded act, but is instead justified by legal or material impossibility, we are not faced with a violation of fundamental rights.
In the specific case, from the evidence submitted and the report rendered under oath, it is confirmed that AyA has not arbitrarily rejected the application filed by the petitioner, but rather has done so on account of failure to comply with all of the technical and legal requirements established in the Reglamento de Prestación de Servicios a los Clientes de Instituto Costarricense de Acueductos y Alcantarillados for approving new services.' This ruling may be supplemented by ruling No. 2017-005245 of 10:00 hours of April 7, 2017, which in the relevant part provided:
'From the report rendered by the authorities of the respondent municipality, it is stated that as to the claim of the petitioner regarding whether the location where Ms. Nombre50100 owns her property falls within or outside the water supply area, it will be for ICAA to address that matter, as the Municipality does not have competence to do so. For its part, ICAA states that it has acted in accordance with the regulations governing it, exercising its coordinating function as appropriate, carrying out duly founded and reasoned actions at all times, as detailed; it is thus evident that the Institute has proceeded in accordance with the law, since, according to the technical report issued by the UEN Optimización de Sistemas Nuevos Desarrollos GAM, official letter UEN-OSND-GAM-2017-00082, it is clearly stated that there is no potable water availability for the property cited by Ms. Nombre50101 in her constitutional writ.
The report further adds that an analysis of the background of this property reveals that it originally formed part of the property with cadastral survey [Valor 005], and according to a query to the Registro Nacional, the latter was subdivided (fraccionada) and four properties resulted therefrom without any availability application having been processed for said subdivision (fraccionamiento). Under these circumstances, this Court is unable to find any omission or arbitrary action on the part of the respondent authority; accordingly, the appropriate course of action is to dismiss the writ, and to reiterate that, according to the evidence submitted, the failure to supply the potable water service to the petitioner's lot is not a capricious, arbitrary, or unfounded act, but rather is justified by the non-existence of potable water availability in the area. (See in a similar vein rulings Nos. 2014-9134 of 14:05 hours of June 19, 2014, and 2016007240 of 09:20 hours of May 27, 2017, among others).
Under that understanding, no infringement of fundamental rights exists, and therefore the appropriate course is to dismiss the constitutional writ in all its aspects, as is hereby ordered.' With regard to the denial of potable water service for objective reasons, mention must be made of ruling No. 2019-023102 of 08:50 hours of November 22, 2019, in which, upon hearing a similar writ, the Court ruled as follows:
'On the other hand, in the report rendered under oath by the respondent authority, it is explained that although there are properties adjacent to that of the petitioner that do have water service, this is because they present different characteristics. A distinction is made: the three parcels derived from the parent tract (finca madre) 2-254199-000, among which that of the petitioner is included, were surveyed in April 2018—as verified in the cadastral plan (plano catastrado) submitted by the interested party—at a date subsequent to opinions C-258-2017 of November 9, 2017, and C-300-2017 of December 13, 2017, of the Procuraduría General de la República (PGR), which confirm the full force and effect of the obligations contained in Article 10, paragraph 2) of the Ley de Planificación Urbana, while also recalling the necessity of obtaining prior approval from AyA, pursuant to the provisions of Article 21 of its constitutive law.
Under these circumstances, as it is not apparent that the lots segregated from the parent tract of the property owned by the petitioner were granted availability despite lacking the approval of AyA—required for subdivision (fraccionamiento), in accordance with Article 21 of the Ley Constitutiva del AyA, N° 2726—or the sign-off (visto bueno) of INVU, in accordance with Article 10, paragraph 2) of the Ley de Planificación Urbana and Article 21 of the Ley Constitutiva del AyA; unequal treatment to the detriment of the protected party is ruled out, and it is apparent that the denial of potable water availability was grounded in objective reasons. As a corollary to the foregoing, the action of the respondent authority is found not to have been arbitrary, and the writ is dismissed in all its aspects, as is hereby ordered—not without first advising the petitioner of her right to challenge the decision regarding her potable water application before the competent authority or before the contentious-administrative jurisdiction.' Under such a state of affairs, the respondent institute rejected the request of the protected party, fully informing her of the technical reasons for which her application could not be processed, namely the lack of potable water availability in front of the property due to the absence of a sewage system.
Whether the requested service is or is not warranted is not a matter to be discussed in this jurisdiction, as it falls outside its area of competence; it should further be added that this Tribunal has on repeated occasions held that it is possible to dismiss applications for the granting of the potable water service when there are technical impossibilities, failure to meet sub-constitutional requirements, or technical or legal criteria justifying such outcome. Furthermore, this Court should not act as an intermediary between a given natural or legal person—whether the latter be governed by public or private law—to intercede on behalf of a third party so that the latter is granted what the petitioning parties seek, as the applicant in this case so requests. Therefore, the applicant must present his objections or claims before the respondent authority or before the competent jurisdictional channels—venues where he will be able, in full, to discuss the merits of the matter and assert his claims. Accordingly, the writ is dismissed, as is hereby ordered (…)" (emphasis not in the original).
It is understood, then, that while there exists a fundamental right to water that may be asserted before ICAA or before the respective ASADAS, the provision of the service may also be subject to compliance with the requirements established for its granting and to the existence of a material possibility of supply—that is, the absence of technical circumstances that make providing it impossible or inadvisable (see in this regard also ruling No. 2023-022230 of 09:15 hours of September 8, 2023, among others).
The petitioner comes before the Court and states that in February 2026 he initiated proceedings before ICAA for the installation of a potable water service at a property owned by him located in Cascajal de Coronado. He explains that a completed dwelling, already occupied by himself, exists at said location.
He argues that, through resolution No. UEN-SCMED-GAM-2026-00749, ICAA conditioned the installation of the potable water service on the submission of a municipal building permit. However, he alleges that the Municipalidad de Coronado neither grants nor allows regularization of the work without a prior effective potable water connection.
He states that he has informed ICAA that the second structure existing on the property is a construction that has been halted for lack of funding and, concomitantly, has requested that the service connection proceed solely for the dwelling that is already occupied. However, he alleges that ICAA maintains its refusal (placing urban planning requirements above the fundamental right to life).
He therefore requests that the writ be granted and that the respondents be ordered to immediately install the potable water service for the occupied dwelling.
Upon reviewing the record, it is established that the property at folio real matrícula 1-3519-030 is registered in the name of the petitioner in the Registro Inmobiliario and has associated with it the Certificate of Waterworks Service Availability Without Sewage (Constancia de Disponibilidad de Servicio de Acueducto sin Alcantarillado) SIGDD-2025-00108188-1-2-SN, dated February 11, 2026, for the eventual provision of 2 potable water services associated with a housing project with 1 residential unit.
It is also established that on February 26, 2026, the protected party submitted to ICAA an application for a permanent potable water connection for the property at folio real matrícula 1-3519-030. This application was assigned number B14132026020022.
Application B14132026020022 was referred to the Feasibility Inspection Area of Zone 4 GAM of ICAA on March 31, 2026, to conduct the respective feasibility inspection. As verified, at the time the feasibility inspection was carried out, the inspector determined that a completed dwelling and another dwelling under construction already existed on said property; it was therefore recorded that the situation observed does not comply with the requirements established under Articles 67 and 68 of the Reglamento de Prestación de Servicios de AyA.
As reported, pursuant to Article 68, paragraph d), of the Reglamento para la Prestación de los Servicios de AyA, it was deemed necessary for the interested party to provide the "(…) Project Number processed through the CFIA's APC (Construction Project Management / Administración de Proyectos de Construcción) platform, duly approved, so that AyA may verify the existence of the required valid building permit, in the case of a property to be built. The permit must be consistent with the flow rate and intended use for which the availability was approved (…)," as this was not provided at the time the application was filed on February 26, 2026. It was likewise established that "the property (Finca Folio Real Matrícula 1-3519) has associated potable water services NIS 3372960, billed in the name of Jose Joaquín Sanabria Marín, NIS 3372956 billed in the name of Jose Joaquín Sanabria Marín, NIS 5221444 billed in the name of Hermanos Sanabria Orozco, NIS 3372953 billed in the name of Jose Joaquín Sanabria Marín, NIS 5503042 billed in the name of Laura María Mora Hidalgo y Otros, and NIS 5516454 billed in the name of María Isabel Sanabria Orozco, and NIS 5551692 billed in the name of Victor Emilio Sanbria Orozco." It is also established that on April 24, 2026, an official of the UEN Servicio al Cliente Medición GAM of ICAA issued official letter No. UEN-SCMED-GAM-DyNS-2026-275, by which the petitioner was notified of the need to cure the defects in Application B14132026020022 by providing the valid building permit for the structure being erected on the property at folio real matrícula 1-3519-030. This official letter expressly stated the following:
"(…) The application for granting new service for the property in the name of [Nombre 001], cadastral plan No. SJ-0383961-1980, folio real matrícula 1-3519-030, cannot be approved until the following is submitted: • Valid municipal building permit (indicating the date of approval, type of project, cadastral plan number, folio real matrícula number, and municipal stamp), which must be consistent with the project to be developed. The foregoing is based on the fact that, according to the inspection carried out on March 10, 2026, it was determined that the property has one completed house and another under construction, for which reason the granting of service is not warranted. It is clarified that AyA grants services exclusively to projects to be built or under development that present the respective municipal building permit (…)." This permit, as reported, must be consistent with the project being constructed on the ground and with the purpose for which the Certificate of Waterworks Service Availability Without Sewage SIGDD-2025-00108188-1-2-SN was approved.
It is likewise established that, in response to the foregoing, on May 12, 2026 (one day before the present writ was filed), the protected party sent an unsigned email to the respondent authority, in which he set out the reasons that, in his view, justify the absence of the required building permit, and requested that ICAA reconsider its decision, since he alleged that the structure under construction is halted and he requires only a single service. On that occasion, the applicant expressly stated:
"(…) I formally respond to notification UEN-SCMED-GAM-DYNS-2026-275 received on April 24, related to new service application B14132026020022. In that regard, I clarify and request the following: 1. Status of the Works: The existence of a completed construction and another closed shell structure (obra gris) (with no current technical activity) is confirmed. However, I clarify that the building permit was not originally applied for because AyA did not grant water availability at the appropriate time, which created an administrative blockage that prevented the formalization of the plans before the Municipalidad de Vásquez de Coronado. 2. Human Rights and Public Health: The completed building is already occupied. The refusal to connect service on the grounds of an urban planning requirement indefinitely postpones access to a fundamental human right, putting at risk the health and dignified life of those of us who reside in the property.
Prayer for Relief: I request that, under the principle of the paramount interest of the human being and the rulings of the Sala Constitucional on access to water (such as Voto 2011-002704), the service connection be proceeded with in order to permit habitability and the subsequent municipal regularization process (…)." Now, having analyzed all of the foregoing, this Constitutional Tribunal does not consider there to be merit to grant this constitutional writ of protection and, accordingly, the principal request made by the applicant. This is so for the specific reasons set out below.
First, insofar as it has been fully and conclusively established that the failure of ICAA's authorities to finally approve the application filed for the installation of the potable water service at said property owned by the petitioner was not due to any omission or arbitrary or unfounded action. As was apparent, underlying that decision is an objective and justified reason: the failure on the part of the administrative subject to comply with requirements expressly established in the legal order—in this particular case, the failure to submit a building permit for a structure under construction that was identified during an inspection of the property in March 2026. Said permit, despite the warning issued to the petitioner through official letter No. UEN-SCMED-GAM-DyNS-2026-275, was ultimately not submitted by him within the time granted; hence, as stated, the service was not ultimately installed. It is recalled that, according to the repeated criterion of this Court, in cases of failure to meet requirements, ICAA may validly oppose the installation of the public service in question.
In this manner, this Tribunal notes that the protected party's connection application was not denied, but rather was returned so that a defect found in its proper resolution could be cured. In that regard, it is established that, contrary to what the petitioning party alleges, this was not a capricious or arbitrary decision by ICAA, but rather one grounded in technical criteria established in the applicable sub-constitutional regulations in this specific case, so that the respondent authority may determine the feasibility of providing the service.
Second, because it is not within the purview of this Court, through the summary constitutional writ of protection, to examine whether the requirements notified to the protected party for compliance are or are not appropriate or timely (given the particular circumstances of the property); much less to order the installation of the requested service in contravention of the said state of affairs. It should be noted that, in this particular case, while the protected party asserts and insists that the aforementioned construction (with respect to which the said requirement is sought) is halted and that he requires the potable water service solely for the other dwelling being occupied by himself and his family, the fact remains that it was not demonstrated that these circumstances were communicated in a timely manner to the respondents (as a means of rectifying the situation). As the Executive President of ICAA reported under oath, there is no "record of any formal request submitted by the petitioner partially withdrawing the application," and she added that "if what he decides to manage is a single service, he must process the application in accordance with the aforementioned Article 30 of the Reglamento para la prestación de los servicios de AyA." Furthermore, as established, this precise clarification and request (for installation of the service solely for the occupied dwelling) was communicated to ICAA by the petitioner only on May 12, 2026, one day before the present writ was filed. As a result, no arbitrary omission in knowing of and ruling upon this last aspect could be attributed to the respondents.
Third, because if the protected party is dissatisfied with ICAA's determination, the appropriate course of action is for him to file the relevant claim—if he sees fit—before the ordinary administrative and jurisdictional channels of legality created specifically for that purpose; venues where he will be able, in full, to discuss the merits of the matter and assert his claims.
* Under such understanding, as no violation of fundamental rights is observed, the appropriate course of action is to dismiss the present constitutional writ of protection.
V.Now, without prejudice to what is set forth above, it is necessary to advise the respondents that, once the petitioner properly corrects his application, it must be resolved within a reasonable period of time, in protection of his fundamental rights.
VI.Documentation submitted to the case file. The parties are warned that should they have submitted any document on paper, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be retrieved from the office within a maximum period of 30 business days counted from notification of this ruling. Otherwise, all material not retrieved within this period will be destroyed, pursuant to the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Corte Plena in session No. 27-11 of August 22, 2011, Article XXVI, and published in Boletín Judicial No. 19 of January 26, 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial in session No. 43-12 held on May 3, 2012, Article LXXXI.
Por tanto:

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veintiseis de junio de dos mil veintiseis .
Recurso de amparo interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA).
RESULTANDO:
Redacta el Magistrado Araya García; y,
CONSIDERANDO:
El recurrente acusa que el ICAA, de forma arbitraria e injustificada, condicionó la instalación del servicio de agua potable en su casa de habitación a la presentación de un permiso de construcción municipal, pese a que dicha obra quedó inconclusa por falta de presupuesto.
De relevancia para dirimir el presente recurso de amparo, se tienen por acreditados los siguientes:
Igualmente, se constató que “la Finca Folio Real Matrícula 1-3519, tiene asociados los servicios de agua potable NIS 3372960, facturado a nombre de Jose Joaquín Sanabria Marín, NIS 3372956 facturado a nombre de Jose Joaquín Sanabria Marín, NIS 5221444, facturado a nombre de Hermanos Sanabria Orozco, NIS 3372953 facturado a nombre de Jose Joaquín Sanabria Marín, NIS 5503042 facturado a nombre de Laura María Mora Hidalgo y Otros, y NIS 5516454, facturado a nombre de María Isabel Sanabria Orozco y NIS 5551692 facturado a nombre de Victor Emilio Sanbria Orozco” (ver informe y prueba).
Se aclara que AyA, otorga servicios únicamente a proyectos por edificar o en desarrollo; que presenten el respectivo permiso municipal de construcción (…)”. Este permiso, según se informó, debe ser coincidente con el proyecto que se está construyendo en el campo y con el fin para el cual se aprobó la constancia de disponibilidad de servicio de acueducto sin alcantarillado SIGDD-2025-00108188-1-2-SN (ver informe).
“(…) respondo formalmente a la notificación UEN-SCMED-GAM-DYNS-2026-275 recibida el pasado 24 de abril, relacionada con el trámite de nuevo servicio B14132026020022 Al respecto, aclaro y solicito lo siguiente: 1. Estado de las Obras: Se confirma la existencia de una construcción terminada y otra obra gris cerrada (sin actividad técnica actual). Sin embargo, aclaro que el permiso de construcción no se tramitó originalmente debido a que el AyA no otorgó la disponibilidad de agua en el momento oportuno, lo que generó un bloqueo administrativo que impidió formalizar los planos ante la Municipalidad de Vásquez de Coronado. 2. Derecho Humano y Salud Pública: La edificación terminada ya se encuentra habitada. La negativa de conexión bajo el argumento de un requisito urbanístico posterga indefinidamente el acceso a un derecho humano fundamental, poniendo en riesgo la salud y la vida digna de quienes residimos en el inmueble. Pretensión: Solicito que, bajo el principio de interés superior del ser humano y los votos de la Sala Constitucional sobre el acceso al agua (como el Voto 2011- 002704), se proceda con la conexión del servicio para permitir la habitabilidad y el posterior proceso de regularización municipal (…)” (ver informe y prueba).
III.Sobre la denegatoria de una solicitud de disponibilidad de agua potable por incumplimiento de requisitos o imposibilidad jurídica, formal, técnica o material. La jurisprudencia de la Sala ha reconocido el denominado derecho fundamental al agua por el cual debe concederse a todas las personas la posibilidad de acceder, en condiciones de igualdad, a los servicios de agua potable, toda vez que esta resulta esencial para la vida y la salud humanas. No obstante, este carácter de derecho fundamental no implica un acceso irrestricto a los servicios de agua, ya que la administración puede establecer requisitos generales de necesario cumplimiento por cada solicitante para valorar su particular requerimiento. Particularmente en lo que respecta a la denegatoria de una solicitud de disponibilidad de agua potable por incumplimiento de requisitos o imposibilidad jurídica, formal, técnica o material, este Tribunal en la sentencia No. 2023-009594 de las 09:15 horas de 28 de abril de 2023, explicó:
“(…) se constata que el instituto recurrido rechazó la solicitud del servicio de agua potable bajo el argumento que no hay disponibilidad de agua y sistema de alcantarillado al frente de propiedad. Al respecto, este Tribunal ha señalado que el Instituto Costarricense de Acueductos y Alcantarillados, las asociaciones administradoras de acueductos y alcantarillados, las municipalidades y demás instituciones que prestan el servicio de suministro de agua potable, pueden rechazar válidamente las solicitudes de servicio de agua potable que les sean formuladas o condicionarlas si existen razones técnicas o legales que así lo justifican. De esta forma, en sentencia No. 2016-006027 de las 09:05 horas del 06 de mayo de 2016, esta Sala consideró:
“Este Tribunal Constitucional en la sentencia 2014-9134 de las 14:05 horas del 19 de junio de 2014, que abordó una cuestión muy similar a la expuesta en el presente recurso, dispuso: '(...) Esta Sala ha indicado en reiteradas sentencias sobre el tema que el suministro de agua potable es considerado dentro del ordenamiento jurídico costarricense como un servicio público, y que como tal, todo prestador de servicios públicos -sea sujeto público o sujeto privado- está obligado a prestar el servicio de forma continua, eficiente, en condiciones de igualdad y debiendo adaptarse a los cambios tecnológicos (véase al respecto la sentencia 2001-09676 de las once horas veinticinco minutos del veintiséis de setiembre del dos mil uno y la sentencia 2004-08161 de las diez horas con cincuenta y tres minutos del veintitrés de julio del dos mil cuatro). Resulta claro entonces concluir que el Instituto Costarricense de Acueductos y Alcantarillados, al ser uno de los entes estatales encargados de la prestación del servicio público de agua potable, está obligado también a prestar este servicio de forma continua, adaptable, eficiente y por igual a todos los habitantes.
Ahora bien, también la jurisprudencia de este Tribunal Constitucional ha indicado que, frente a la imposibilidad jurídica (que es la falta de cumplimiento de requisitos establecidos en la reglamentación respectiva) o frente a la imposibilidad formal (que es la falta de una Red de Distribución de Aguas), es razonable no atender las solicitudes de servicio o solicitar que el interesado asuma los costos de instalación cuando no exista red de distribución de agua potable y se necesite la construcción de infraestructura. Así, en estos casos se ha tenido claro que no es que se trate de una negativa al acceso al servicio de agua potable, sino de la imposibilidad para brindarlo o de la necesaria participación del interesado en el levantamiento de una imposibilidad técnica, cual es, la falta de infraestructura. En otras palabras, siempre que la falta de dotación del servicio de agua potable no sea una actuación antojadiza, arbitraria o sin fundamento, sino que esté justificada en la imposibilidad jurídica o material no estamos frente a la violación de derechos fundamentales.
En el caso concreto, de la prueba aportada y del informe rendido bajo juramento, se corrobora que el AyA no ha rechazado arbitrariamente la solicitud planteada por la recurrente, sino por la falta del cumplimiento de la totalidad de los requisitos técnico-legales que existe el Reglamento de Prestación de Servicios a los Clientes de Instituto Costarricense de Acueductos y Alcantarillados para aprobar nuevos servicios”.
Este pronunciamiento puede complementarse con la sentencia No. 2017-005245 de las 10:00 horas del 07 de abril de 2017, que en lo conducente dispuso:
“Del informe rendido por las autoridades de la municipalidad recurrida se indica que el reclamo de la recurrente, respecto de si el lugar donde tiene la propiedad la señora Nombre50100 está fuera o no del abastecimiento de agua, le corresponderá al Instituto Costarricense de Acueductos y Alcantarrillados referirse al respecto, ya que la Municipalidad no tiene competencia para ello. Y por su parte, el Instituto Costarricense de Acueductos y Alcantarillados menciona que han actuado conforme a la normativa que lo regula, ejerciendo su función rectora como corresponde, llevando a cabo en todo momento actuaciones debidamente fundamentadas y razonadas como se detalló, se evidencia así que el Instituto ha procedido conforme a derecho, ya que según el informe técnico emitido por la UEN Optimización de Sistemas Nuevos Desarrollos GAM, oficio UEN-OSND-GAM- 2017-00082, se indica claramente que para el inmueble que cita la señora Nombre50101 en su recurso de amparo, no existe la disponibilidad de agua potable.
Además agrega el informe, que en análisis de los antecedentes de este inmueble se tiene que pertenecía a la propiedad con catastro [Valor 005] y según consulta al Registro Nacional, ésta última fue fraccionada y de la misma resultaron cuatro propiedades sin mediar la gestión del trámite de disponibilidad para dicho fraccionamiento. Así las cosas, esta Sala no logra acreditar ninguna omisión o actuación arbitraria por parte de la autoridad recurrida, en consecuencia lo correspondiente es declarar sin lugar el amparo, y reiterar que según la prueba aportada, la falta de dotación del servicio de agua potable en el lote de la recurrente no es una actuación antojadiza, arbitraria o sin fundamento, sino que está justificada en la inexistencia de disponibilidad de agua potable en el sector. (Ver en similar sentido las sentencias números 2014-9134 de las 14:05 horas del 19 de junio de 2014 y 2016007240 de las 09:20 horas del 27 de mayo 2017, entre otras). Bajo esa inteligencia, no se está frente a la infracción de derechos fundamentales y, por ello, lo pertinente es desestimar el recurso de amparo”.
Sobre la denegatoria del servicio de agua potable por razones objetivas, se impone mencionar la sentencia No. 2019-023102 de las 08:50 horas del 22 de noviembre de 2019, al conocer de un amparo similar la Sala declaró lo siguiente:
“Por otro lado, en el informe dado bajo la gravedad de juramento por parte de la autoridad recurrida, se explica que si bien hay propiedades que colindan con la de la recurrente, que cuentan con el servicio de agua, ello se debe a que presentan características distintas. Distingue que, los tres fundos derivados de la finca madre 2-254199-000, entre los que se encuentra el de la recurrente, se catastraron en abril del año 2018, según se verifica en el plano aportado por la interesada, en fecha posterior a los pronunciamientos C-258-2017 del 9 de noviembre del 2017 y C-300-2017 del 13 de diciembre del 2017 de la Procuraduría General de la República (PGR), los cuales confirman la plena vigencia de las obligaciones contenidas en el artículo 10, inciso 2) de la Ley de Planificación Urbana, al tiempo que recuerda la necesidad de obtener la aprobación previa por parte del AyA, en respuesta a lo dispuesto en el artículo 21 de su ley constitutiva.
Así las cosas, al no desprenderse que a los lotes segregados de la finca madre del fundo propiedad de la recurrente, se les haya dado la disponibilidad pese a no contar con el visto del AyA - necesario para el fraccionamiento, de conformidad con lo señalado en el artículo 21 de la Ley Constitutiva del AyA, N° 2726- o con el visto bueno del Instituto Nacional de Vivienda y Urbanismo (INVU), de conformidad con lo señalado en el artículo 10, inciso 2) de la Ley de Planificación Urbana y el artículo 21 de la Ley Constitutiva del AyA; se descarta un trato desigual en perjuicio de la tutelada, y se aprecia que la denegatoria de disponibilidad de agua potable se fundamentó en razones objetivas. Corolario de lo anterior, se descarta que la actuación de la autoridad recurrida haya sido arbitraria y procede desestimar el recurso en todos sus extremos, como en efecto se dispone, no sin antes advertir a la recurrente su derecho de cuestionar lo resuelto en relación con su solicitud de agua potable, ante la autoridad o ante la jurisdicción contenciosa administrativa” Bajo tal estado de las cosas, el instituto recurrido rechazó la petición de la parte amparada, haciéndole saber cabalmente las razones de orden técnico por las cuales no procedía atender su solicitud, como es que no hay disponibilidad de agua potable al frente de la propiedad, pues no hay sistema de alcantarillado.
La procedencia o no del servicio solicitado no es un asunto que deba discutirse en esta jurisdicción, toda vez que es ajeno al ámbito de su competencia y cabe agregar que en reiteradas ocasiones este Tribunal ha sostenido que resulta posible desestimar las gestiones presentadas para el otorgamiento del servicio de agua potable, cuando se presenten imposibilidades técnicas, incumplimiento de requisitos infraconstitucionales o existan criterios técnicos o legales que así lo justifiquen. Por otra parte, este Sala no debe fungir como mediador ante una determinada persona física o jurídica ‒ya sea ésta última de derecho público o privado‒, para interceder por una tercera persona a fin de que se le conceda lo que las partes recurrentes pretenden, tal y como así lo solicita el gestionante que se proceda en este caso. Por ello, deberá plantear sus inconformidades o reclamos ante la autoridad recurrida o en la vía jurisdiccional competente, vías en las cuales podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones. En consecuencia, se desestima el recurso como en efecto se dispone (…)” (el énfasis no pertenece al original).
Se entiende, entonces, que si bien existe un derecho fundamental al agua que puede ser exigido ante el ICAA o ante las respectivas ASADAS, la prestación del servicio también puede sujetarse al cumplimiento de los requisitos establecidos para su otorgamiento y a que exista posibilidad material de suministro, esto es, que no existan situaciones técnicas que imposibiliten o desaconsejen brindarlo (ver en este sentido también la sentencia No. 2023-022230 de las 09:15 horas de 8 de setiembre de 2023, entre otras).
El recurrente acude a la Sala y señala que en febrero de 2026 inició el trámite ante el ICAA para la instalación de servicio de agua potable en un inmueble de su propiedad ubicado en Cascajal de Coronado. Explica que en dicho sitio existe una vivienda terminada que se encuentra habitada por su persona.
Aduce que, mediante la resolución No. UEN-SCMED-GAM-2026-00749, el ICAA condicionó la instalación del servicio de agua potable a la presentación de un permiso de construcción municipal. Sin embargo, acusa que la Municipalidad de Coronado no otorga ni permite la regularización de la obra, si no existe una conexión efectiva de agua potable previa.
Indica que ha informado al ICAA que la segunda estructura que existe en el inmueble es una obra en proceso frenada por falta de presupuesto y, concomitantemente, ha solicitado se proceda con la conexión del servicio únicamente para la vivienda ya habitada. No obstante, acusa que el ICAA mantiene su negativa (anteponiendo requisitos urbanísticos sobre el derecho fundamental a la vida).
Solicita, entonces, que se declare con lugar el recurso y se les ordene a los recurridos proceder a instalarle de forma inmediata el servicio de agua potable para la vivienda habitada.
Revisados los autos, se tiene por demostrado que el inmueble a folio real matrícula 1-3519-030 está inscrito a nombre del recurrente en el Registro Inmobiliario y tiene asociada la Constancia de Disponibilidad de Servicio de Acueducto sin Alcantarillado SIGDD-2025-00108188-1-2-SN, de fecha 11 de febrero de 2026, para la eventual dotación de 2 servicios de agua potable asociados al proyecto de vivienda con 1 unidad habitacional.
Consta también que el 26 de febrero de 2026, el tutelado presentó ante el ICCA solicitud de conexión permanente de agua potable para la finca folio real matrícula 1-3519-030. A esta gestión se le asignó el número B14132026020022.
La citada solicitud B14132026020022 fue remitida al Área de Inspección de Factibilidad de la Zona 4 GAM del ICAA el día 31 de marzo del 2026 para realizar la respectiva inspección de factibilidad. Según se verificó, al momento de realizarse la inspección de factibilidad, el inspector determinó que en el citado inmueble ya existía una vivienda edificada y otra vivienda en proceso de construcción, por lo que se consignó que la situación observada no cumple con los requisitos establecidos según los artículos 67 y 68 del Reglamento de Prestación de Servicios de AyA.
Según se informó, de acuerdo con el artículo 68, inciso d), del Reglamento para la Prestación de los Servicios de AyA, se estimó necesario que el interesado aportara el “(…) Número de Proyecto tramitado ante la plataforma Administración de Proyectos de Construcción (APC) del CFIA, debidamente aprobado con el fin de que AyA constate la existencia del requisito del permiso de construcción vigente, en caso de que se trate de un inmueble por Edificar. El permiso deberá ser coincidente con el caudal y fines para el que se aprobó la disponibilidad (…)”, pues este no fue aportado al momento de realizarse la solicitud del trámite en fecha 26 de febrero de 2026. Igualmente, se constató que “la Finca Folio Real Matrícula 1-3519, tiene asociados los servicios de agua potable NIS 3372960, facturado a nombre de Jose Joaquín Sanabria Marín, NIS 3372956 facturado a nombre de Jose Joaquín Sanabria Marín, NIS 5221444, facturado a nombre de Hermanos Sanabria Orozco, NIS 3372953 facturado a nombre de Jose Joaquín Sanabria Marín, NIS 5503042 facturado a nombre de Laura María Mora Hidalgo y Otros, y NIS 5516454, facturado a nombre de María Isabel Sanabria Orozco y NIS 5551692 facturado a nombre de Victor Emilio Sanbria Orozco”.
También, se demostró que el 24 de abril de 2026 una servidora de la UEN Servicio al Cliente Medición GAM del ICAA emitió el oficio No.UEN-SCMED-GAM-DyNS-2026-275, mediante el cual se le notificó al recurrente la necesidad de subsanar la Solicitud B14132026020022 aportando el permiso de construcción vigente de la edificación que se está levantando en la finca matrícula 1-3519-030. De forma expresa en este oficio se señaló lo siguiente:
“(…) La solicitud para otorgamiento del nuevo servicio para la propiedad a nombre de [Nombre 001], plano catastrado N° SJ-0383961-1980, matrícula 1-3519-030, no puede ser aprobada hasta que presente lo siguiente: • Permiso Municipal de construcción vigente (donde conste la fecha de aprobación, tipo de proyecto, número de plano de catastro, matrícula y sello municipal), el cual debe ser coincidente con el proyecto a desarrollar. Lo anterior se fundamenta en que, según la inspección realizada el 10 de marzo de 2026, se determinó que la propiedad cuenta con una casa construida y otra en proceso de construcción, por lo cual no se justifica el otorgamiento del servicio. Se aclara que AyA, otorga servicios únicamente a proyectos por edificar o en desarrollo; que presenten el respectivo permiso municipal de construcción (…)”.
Este permiso, según se informó, debe ser coincidente con el proyecto que se está construyendo en el campo y con el fin para el cual se aprobó la constancia de disponibilidad de servicio de acueducto sin alcantarillado SIGDD-2025-00108188-1-2-SN.
Igualmente, consta que, en respuesta a lo anterior, el 12 de mayo de 2026 (un día antes de formulado este amparo), el tutelado remitió un correo sin firma a la autoridad recurrida, en el cual expuso las razones que, a su criterio, justifican la ausencia del permiso de construcción requerido y solicitó al ICAA la reconsideración de lo resuelto, pues según alegó, la edificación en construcción se encuentra paralizada y solo requiere un único servicio. De manera expresa, en esta ocasión, el accionante señaló:
“(…) respondo formalmente a la notificación UEN-SCMED-GAM-DYNS-2026-275 recibida el pasado 24 de abril, relacionada con el trámite de nuevo servicio B14132026020022 Al respecto, aclaro y solicito lo siguiente: 1. Estado de las Obras: Se confirma la existencia de una construcción terminada y otra obra gris cerrada (sin actividad técnica actual). Sin embargo, aclaro que el permiso de construcción no se tramitó originalmente debido a que el AyA no otorgó la disponibilidad de agua en el momento oportuno, lo que generó un bloqueo administrativo que impidió formalizar los planos ante la Municipalidad de Vásquez de Coronado. 2. Derecho Humano y Salud Pública: La edificación terminada ya se encuentra habitada. La negativa de conexión bajo el argumento de un requisito urbanístico posterga indefinidamente el acceso a un derecho humano fundamental, poniendo en riesgo la salud y la vida digna de quienes residimos en el inmueble. Pretensión: Solicito que, bajo el principio de interés superior del ser humano y los votos de la Sala Constitucional sobre el acceso al agua (como el Voto 2011- 002704), se proceda con la conexión del servicio para permitir la habitabilidad y el posterior proceso de regularización municipal (…)”.
Ahora bien, analizado todo lo anterior, este Tribunal Constitucional no considera que exista mérito para acoger este proceso de amparo y, por ende, la petición principal formulada por el accionante. Esto, por los motivos puntuales que se dirán a continuación.
Primero, en el tanto ha quedo plena y contundentemente acreditado que si las autoridades del ICAA no han aprobado finalmente la solicitud formulada para la instalación del servicio de agua potable en el citado inmueble propiedad del recurrente no ha sido debido a una omisión u actuación arbitraria o infundada. Según se pudo apreciar, en dicha decisión media una razón objetiva y justificada, que es el incumplimiento de requisitos establecidos expresamente en el ordenamiento jurídico por parte del administrado, en este caso en particular, ante la falta de presentación de permiso de construcción de una obra en proceso de edificación que se identificó en inspección realizada en el inmueble en marzo de 2026. Dicho permiso, pese a la prevención girada al recurrente por oficio No.UEN-SCMED-GAM-DyNS-2026-275, no fue presentado finalmente por este dentro del plazo otorgado; de ahí que, como se dijo, el servicio no haya sido finalmente instalado. Recuérdese que, según criterio reiterado de esta Sala, ante la falta de cumplimiento de requisitos el ICAA puede válidamente oponerse a la instalación del servicio público de interés.
De esta manera, este Tribunal advierte que la gestión de conexión del tutelado no fue denegada, sino que fue devuelta para que se subsanara un defecto encontrado para su debida resolución. En ese sentido, se tiene que, contrario a lo alegado por la parte recurrente, no se trató de una decisión antojadiza o arbitraria del Instituto Costarricense de Acueductos y Alcantarillados, sino que se encuentra sustentada en criterios técnicos que se encuentran establecidos en la normativa infraconstitucional que resulta aplicable al caso concreto con el fin de que la autoridad recurrida pueda determinar la factibilidad de la prestación del servicio.
Segundo, dado que, no le corresponde a esta Sala, a través del recurso sumario de amparo, examinar si los requisitos notificados al tutelado para su cumplimiento resultan o no oportunos o adecuados (según las circunstancias propias del inmueble de su propiedad); mucho menos, para ordenar la instalación del servicio requerido, a contrapelo del referido estado de cosas. Nótese que, en este caso en particular, si bien el tutelado afirma e insiste que la referida construcción (respecto a la cual se pide el referido requisito), está paralizada y que el servicio de agua potable lo requiere únicamente para la otra vivienda que está siendo habitada por su persona y su familia, lo cierto es que no se demostró que esas circunstancias se le hayan hecho saber de forma oportuna a los recurridos (como medio para enderezar la situación). Según informó bajo juramento la Presidenta Ejecutiva del ICAA, no “existe registro de alguna solicitud formal presentada por el recurrente desistiendo parcialmente del trámite tal” y agregó que, “si lo que decide gestionar es un único servicio, deberá realizar el trámite conforme al referido artículo 30 del Reglamento para la prestación de los servicios de AyA.
Además, según se acreditó, esta precisa aclaración y petición (de instalación del servicio únicamente para la vivienda habitada) se le informó al ICAA por parte del recurrente hasta el 12 de mayo de 2026, un día antes de formulado este amparo. De ahí que, no podría imputársele a los recurridos alguna arbitraria omisión en conocer y pronunciarse respecto a este último aspecto.
Tercero, por cuanto, si el tutelado se encuentra disconforme con la determinación del ICAA, lo que corresponde es que formule el reclamo pertinente –si a bien lo tiene–, ante las vías ordinarias de legalidad administrativas y jurisdiccionales creadas especialmente al efecto; sedes donde podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones.
* Bajo dicha inteligencia, al no observarse quebrantados los derechos fundamentales, lo que procede es desestimar el presente proceso de amparo.
V.Ahora bien, sin demérito de lo consignado supra, resulta menester señalarles a los recurridos que, en cuanto el recurrente enderece correctamente su gestión, esta deberá resolverse dentro de un plazo razonable, en resguardo de sus derechos fundamentales.
Vi.- Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión número 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión número 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.
POR TANTO:
Se declara sin lugar el recurso. Tome nota la autoridad recurrida de lo dispuesto en el considerando V de la presente sentencia. Notifíquese.- Fernando Castillo V.
