Document Review CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE (Sala Constitucional de la Corte Suprema de Justicia). San José, at nine hours forty minutes on the seventeenth of June of two thousand twenty-six.
Constitutional challenge (acción de inconstitucionalidad) filed by [Nombre 001] and [Nombre 002], acting as representatives of the companies [Nombre 003], with corporate tax identification number (cédula de persona jurídica) [Valor 001]; [Nombre 006], corporate tax identification number [Valor 002]; and [Nombre 007], with corporate tax identification number [Valor 003]; against Articles 111(c) of the Ley Orgánica del Ambiente and 29 of the Rules of Procedure of the Tribunal Ambiental Administrativo.
Background:
Article 3 of the Ley de la Jurisdicción Constitucional establishes that a violation of the Constitution shall be found when the text of the challenged provision is compared against constitutional norms and principles, as is the case here.
THE PRINCIPLE OF EQUALITY BEFORE THE LAW (ARTICLE 33 CP AND ARTICLE 24 CADH) Article 33 of the Constitution enshrines the principle of equality before the law, establishing that every person is equal before the law and that no discrimination contrary to human dignity shall be practiced. In concordance, Article 24 of the Convención Americana sobre Derechos Humanos provides that all persons are equal before the law and are entitled, without discrimination, to equal protection of the law. This principle imposes on the legislature a duty of normative consistency: substantially identical situations must receive equal legal treatment, unless there exists an objective, reasonable, and proportionate justification.
The petitioners state that the constitutional principle of reasonableness or proportionality in the broad sense — according to German doctrine, a thesis adopted by the jurisprudence of the German Constitutional Court — establishes the obligation for the State that every provision or act restricting fundamental rights, in order to be constitutionally valid, must simultaneously be suitable, necessary, and proportionate. In line with the most authoritative doctrine of constitutional law and the jurisprudence of constitutional courts, the Sala Constitucional has clarified in its case law the content of the principles of reasonableness and proportionality. In repeated rulings, the Chamber has stated, regarding reasonableness, that the law cannot and must not be irrational, as the means selected must bear a real and substantial relationship to the objective pursued. From this perspective, technical rationality means proportionality between means and ends; legal rationality entails conformity with the Constitution in general and, in particular, with the rights and freedoms recognized and guaranteed therein and in the international human rights instruments in force in our country; and, finally, reasonableness with respect to personal effects means that no other limitations or burdens may be imposed on those rights beyond those that reasonably derive from their nature, nor greater than those strictly necessary for them to function reasonably in society.
In voto nro. 5236-99, the Sala Constitucional established the components of the reasonableness test for legislation. Article 111(c) of the Ley Orgánica del Ambiente imposes a clear limitation on the constitutional right to two-tier review, making it necessary to restate the aforementioned principles. With regard to proportionality, a necessary comparison must be made between the objective pursued by the act and the type of restriction imposed; in this case, the limitation is greater than the benefit sought for the community. Likewise, the challenged provisions also fail to satisfy the principle of suitability (idoneidad), since they limit the right to two-tier review and also create confusion and a direct conflict with the Constitution by declaring the resolutions of the Tribunal Ambiental Administrativo to be unappealable — which is absolutely discriminatory.
The petitioners state that the constitutional principle of reasonableness or proportionality in the broad sense — according to German doctrine, a thesis adopted by the jurisprudence of the German Constitutional Court — establishes the obligation for the State that every provision or act restricting fundamental rights, in order to be constitutionally valid, must simultaneously be suitable, necessary, and proportionate. The Sala Constitucional has developed a structured equality test, requiring that every normative differentiation respond to a legitimate aim and pass an examination of reasonableness and proportionality. Constitutional case law has consistently held that equality does not imply identical treatment, but rather justified treatment. The absolute exclusion of the hierarchical appeal (recurso jerárquico) in this administrative proceeding constitutes a discriminatory procedural differentiation that lacks sufficient objective justification.
Nothing justifies the suppression of this right to appeal before the Minister, nor the right to a motion for reconsideration against the Minister's final decision, because it is not a rule that hinders the exercise of the jurisdiction assigned to the Tribunal Ambiental Administrativo. The Tribunal Ambiental Administrativo retains its full jurisdiction to investigate and sanction environmental infractions, but there is no connection between this procedural rule and the substantive material jurisdiction of the Tribunal Ambiental Administrativo.
THE RIGHT TO DUE PROCESS — ARTICLES 39 AND 41 CP AND ARTICLE 8 CADH.
Article 39 of the Constitution guarantees due process of law. In the administrative forum, this guarantee entails the right of defense, the right to be heard, the right to present evidence, and the right to challenge a decision before a higher body. The elimination of the hierarchical appeal directly affects the essential content of the right of defense. The Inter-American Court of Human Rights has held that the right to appeal a judgment forms part of the minimum judicial guarantees under Article 8 of the Convención Americana. In Herrera Ulloa vs. Costa Rica (2004), the Court established that the remedy must permit a comprehensive review of the decision. In Mohamed vs. Argentina (2012), it stated that the remedy must be effective and accessible. The Court has also indicated that due process guarantees apply not only to judicial proceedings but also to administrative proceedings when they determine rights or obligations.
Inter-American jurisprudence has recognized that Article 8 of the Convención Americana applies to administrative sanctioning proceedings and to any state proceeding that determines rights or obligations of a civil, labor, fiscal, or other nature. In that context, the right to appeal implies that administrative decisions must also be subject to review by a higher authority when they affect individual rights. The exclusion of the hierarchical appeal must be subjected to the proportionality test developed by constitutional and comparative jurisprudence. The analysis requires verifying: (a) legitimacy of the aim: there is no social aim to be protected by the suppression of these means of defense. (b) suitability of the means: since the legitimacy of the aim does not exist, the means is also unconstitutional, as it consists of the prohibition of defense. (c) necessity: in this case, it appears to be more a matter of administrative convenience, by relieving the Minister's office of the burden of hearing appeals to which citizens are entitled.
(d) strict proportionality: if less restrictive alternatives exist that are capable of achieving the stated aim, the measure is unconstitutional for being disproportionate. There are no less restrictive measures. Either the right to appeal before the Minister is permitted, or it is not.
CONSTITUTIONAL BLOC AND CONVENTIONALITY REVIEW International human rights treaties ratified by [Nombre 008] form part of the parameter of constitutionality. The Sala Constitucional has recognized the obligation to conduct internal conventionality review (control de convencionalidad), which involves interpreting national legislation in conformity with the Convención Americana and the jurisprudence of the Inter-American Court. This does not involve substituting the jurisdiction of the Sala Constitucional in matters of constitutional review of legislation, but rather the adaptation, through interpretation, of lower-order provisions to the Convención Americana sobre Derechos Humanos and to other treaties. International human rights treaties ratified by Costa Rica form part of the parameter of constitutionality, by virtue of Article 7 of the Constitution, which declares them to be norms of a rank superior to legislation.
Therefore, in every case where a norm conflicts with an international convention, a violation of Article 7 of the Constitution occurs, and consequently the lower-order norm — whether a statute or a regulation — is unconstitutional. The Sala Constitucional has recognized the obligation to conduct internal conventionality review, which involves interpreting national legislation in conformity with the Convención Americana and the jurisprudence of the Inter-American Court. The maintenance of the challenged provision jeopardizes the international responsibility of the Costa Rican State for violation of Articles 8 and 24 of the Convención Americana. The absence of an effective remedy against final administrative acts constitutes a structural violation of the right to due process.
In accordance with the cited provisions and rulings, the petitioners request: a) That this constitutional challenge be admitted, because it is a reasonable means of defending the constitutional right to due process of law, which has been infringed by the challenged provisions. The requirement of Article 75 of the Ley de la Jurisdicción Constitucional is satisfied. b) That it be declared that Articles 111(c) of the Ley Orgánica del Ambiente and 29 of the Rules of Procedure of the Tribunal Ambiental Administrativo bar the appeal before the Minister and the motion for reconsideration against the final decision issued by the Minister. c) That this constitutional challenge be upheld and that Articles 111(c) of the Ley Orgánica del Ambiente and 29 of the Rules of Procedure of the Tribunal Ambiental Administrativo be annulled as unconstitutional.
The opinion is written by Magistrate Castillo Víquez; and,
Considering:
I.On the Formal Admissibility Requirements of the Action. The action of unconstitutionality (acción de inconstitucionalidad) is a proceeding subject to specific formal requirements, which must be satisfied in order for the Chamber to validly adjudicate the merits of the challenge. In this regard, Article 75 of the Ley de la Jurisdicción Constitucional sets forth the admissibility requirements (presupuestos de admisibilidad) for the action of unconstitutionality. First, it requires the existence of a prior pending matter (asunto previo pendiente de resolver), either in judicial proceedings or in the procedure to exhaust administrative channels (vía administrativa), in which the unconstitutionality has been invoked as a reasonable means of protecting the right or interest deemed to have been infringed. In the second and third paragraphs, the law exceptionally establishes situations in which no prior pending matter is required: when, by the nature of the issue, there is no individual and direct injury; when the action concerns the defense of diffuse or collective interests (intereses difusos o colectivos); or when it is filed directly by the Contralor General de la República, the Procurador General de la República, the Fiscal General de la República, or the Defensor de los Habitantes.
II.Now, regarding the requirement of a pending matter to be resolved, this Chamber, by means of judgment No. 1995-4190, issued at 11:33 a.m. on July 28, 1995, stated the following:
"First, this is a proceeding of an incidental nature (vía incidental), and not a direct or popular action, which means that the existence of a pending matter to be resolved—whether before the courts of justice or in the procedure to exhaust administrative channels—is required in order to access the constitutional jurisdiction, but in such a way that the action constitutes a reasonable means of protecting the right deemed to have been infringed in the main matter, so that what is decided by the Constitutional Tribunal has a positive or negative bearing on said pending proceeding, inasmuch as it rules on the constitutionality of the norms to be applied in that matter; and it is only by way of exception that the legislation permits direct access to this jurisdiction—under the conditions set forth in the second and third paragraphs of Article 75 of the Ley de la Jurisdicción Constitucional." That being so, the requirement of a prior pending matter to be resolved is not a merely formal prerequisite, since it is not sufficient merely to establish the existence of a base matter, nor to simply invoke unconstitutionality; it is further required that the action be a reasonable means of protecting the right or interest deemed to have been infringed.
This means that it is necessary to verify the existence of a matter in which the fundamental rights of individuals are at stake and in which the challenged norms have a direct bearing on the resolution of the case (see, in the same vein, judgments Nos. 1668-90, 4085-93, 798-94, 3615-94, 409-I-95, 851-95, 4190-95, and 791-96). Likewise, there are other formalities that must be met, namely: the explicit identification of the challenged norms, duly substantiated, with specific citation of the constitutional norms and principles considered to have been infringed; authentication by an attorney of the pleading in which the action is filed; proof of standing (powers of attorney and certificates); and a certified literal copy of the pleading in which the unconstitutionality of the norms was invoked in the base matter—requirements that, if not met by the petitioner, result in the inadmissibility (inadmisión) of the action.
III.On the Invocation of Unconstitutionality in the Base Matter. Article 75, first paragraph, in fine, of the Ley de la Jurisdicción Constitucional requires, for purposes of the admissibility of an action of unconstitutionality filed through the incidental procedure—as in the present case—the existence of a main pending matter to be resolved, whether before the courts—including habeas corpus or amparo courts—or in the procedure to exhaust administrative channels, in which such unconstitutionality is invoked as a reasonable means of protecting the right or interest deemed to have been infringed. These requirements do not translate into a merely formal question, since it is not sufficient to simply comply with them; it is further required that the challenged norm have a direct bearing on the matter serving as the base, such that what is resolved in the action serves as a reasonable means of protecting the right or interest infringed within the prior matter.
A contrario sensu, if there is no direct connection between the subject matter in dispute in the base matter and what is challenged in the action, it is not possible for this Chamber to rule thereon. For this reason, in accordance with Articles 75 and 79 of the Law governing this jurisdiction, the petitioners must demonstrate compliance and provide a certified literal copy of the pleading in which they invoked the unconstitutionality of the norms in the base matter, in order to verify its bearing on that matter. As regards the requirements that the aforementioned invocation pleading must meet, this Chamber has repeatedly held that:
"(…) although the invocation (invocatoria) of the unconstitutionality of the norm does not require extensive substantiation, it is nonetheless necessary that the base matter expressly invoke the unconstitutionality of the norm challenged in the action… and indicate the constitutional norms considered to have been infringed…". (Judgment No. 2014-000851, issued at 2:30 p.m. on January 22, 2014)." (Judgment No. 2017-007744, issued at 9:15 a.m. on May 24, 2017).
Likewise, by judgment No. 2022-5564, issued at 9:00 a.m. on March 9, 2022, this Tribunal also stated the following:
"(…) In this case, with respect to the content of Article 17 regarding confiscation, upon reviewing the pleading in which the unconstitutionality of the norm was invoked, that pleading is found to be insufficient. The potentially infringed constitutional articles are mentioned, but no reasons are given. Above all, the allegations concerning Article 45 of the Constitution are conspicuously absent—this being precisely the right alleged to have been infringed in the pleading filing the action. Lastly, as regards Article 20, it is not mentioned in the invocation pleading; accordingly, its challenge, lacking the minimum legal foundation, is inadmissible."
IV.On the Failure to Meet the Admissibility Requirements in This Action of Unconstitutionality. Having reviewed the pleading filing this proceeding, and after the Presidency of this Chamber issued a notice regarding certain initially missing requirements by resolution issued at 3:24 p.m. on May 15, 2026, it is concluded that this proceeding still suffers from certain deficiencies and the appropriate course of action is its outright dismissal (rechazo de plano).
a- First, the Chamber notes that, at the time this proceeding was filed on May 11 of this year, petitioner [Nombre 001] lacked any power of attorney to represent the interests of the petitioner companies [Nombre 003]., [Nombre 006]., and [Nombre 007]., since such power was granted afterward—namely, on May 19, 2026. That being so, although the petitioner currently holds the relevant power of attorney, the fact remains that at the time the action was filed, he did not hold one. Accordingly, his capacity as a petitioner on behalf of such companies in this proceeding cannot be recognized, and only petitioner [Nombre 002] shall be deemed a petitioner, as he did demonstrate his authority to represent from the time this proceeding was filed.
b- Furthermore, once the petitioner clarified that the challenged norms are Article 111(c) of the Ley Orgánica del Ambiente and Article 29 of the Reglamento de Procedimientos del Tribunal Ambiental Administrativo; and upon reviewing the pleading submitted in which the unconstitutionality of those norms was required to have been invoked prior to the filing of this proceeding, this Tribunal found that no such invocation was made with respect to Article 29 of the Reglamento de Procedimientos del Tribunal Ambiental Administrativo. Indeed, the following was stated verbatim:
"The undersigned [Nombre 002], in my capacity as general judicial attorney-in-fact (apoderado general judicial) of [Nombre 003], and of [Nombre 012]., hereby invoke the unconstitutionality of Article 111 of the Ley Orgánica del Ambiente, for the purposes of Article 79 of the Ley de la Jurisdicción Constitucional, on the grounds that it lacks a two-instance appeal, based on the reasons to be set forth below…". (Emphasis added by the Chamber).
Furthermore, with respect to Article 111(c), such invocation was made solely on the grounds of an alleged violation of the principles of reasonableness, proportionality, due process (debido proceso), and Article 8.2 of the American Convention on Human Rights—not on the grounds of the principle of equality, nor the alleged violation of Article 24 of the American Convention on Human Rights, both of which have also been alleged in this action. In that regard, given the failure to meet these requirements, the action would be admissible, in principle, only with respect to Article 111(c) of the Ley Orgánica del Ambiente and on the grounds of the alleged violation of the principles of reasonableness, proportionality, due process, and with respect to Article 8.2 of the American Convention on Human Rights.
c- In this proceeding, three corporations (sociedades anónimas) appear as petitioners: [Nombre 003]., [Nombre 008]., and [Nombre 007]. However, as set forth in the preceding section, the invocation of unconstitutionality was made only by [Nombre 003] and [Nombre 009]., and not by [Nombre 008] (page 3934 of the certified copy of the administrative file attached). In fact, this last company also does not appear as a signatory to the motion for reconsideration (recurso de revocatoria) filed against the final act in the base matter—which is an administrative procedure conducted under file No. 174-09-03-TAA, in which resolution No. 1403-2025-TAA, issued at 8:00 a.m. on November 25, 2025, was issued before the Tribunal Ambiental Administrativo—submitted to this file (see page 3929 of the certified copy of the administrative file attached). Consequently, the company [Nombre 008]. shall likewise not be deemed a petitioner in this proceeding, having failed to demonstrate compliance with the applicable admissibility requirements.
d- Finally, it must be noted that, upon setting aside the substantiation provided in relation to those aspects whose unconstitutionality was not invoked in the base matter, the action is left without the necessary foundation, since the remaining aspects are not sufficiently substantiated. While the allegations of unconstitutionality are cursorily mentioned, they are stated without developing a line of argument that would allow for a direct assessment of whether the provisions of Article 111(c) are unconstitutional, as the petitioner limits himself to making bare assertions without any extensive development, leaving it to the Chamber to perform the intellectual work that is the petitioner's responsibility. In this regard, it must be recalled that the Chamber cannot substitute for the absence of arguments that, in the petitioner's view, justify the unconstitutionality claim being raised, since that is a task belonging to the petitioner. In this connection, by judgment 2014-4239—reiterating judgment 184-95—this Tribunal held:
"IV.- On the Lack of Specificity in the Arguments of Unconstitutionality. The Ley de la Jurisdicción Constitucional, in its Article 3, provides that 'The Political Constitution shall be deemed to have been infringed when this results from a comparison of the text of the challenged norm or act, its effects, or its interpretation or application by public authorities, with constitutional norms and principles.' Now, in order for this Tribunal to find that the infringement is established and to declare the unconstitutionality of the challenged norm or act, with the consequent annulment and expulsion from the legal order, whoever promotes an action of unconstitutionality bears the burden of demonstrating how that provision infringes the constitutional norm or principle and, furthermore, must indicate why the claim should be upheld. This is referred to by this Chamber as the burden of argumentation (carga de la argumentación), that is, 'a norm that is facially contrary to the Constitution shifts the burden of argumentation to those who maintain that there is, in reality, no conflict between that norm and the Political Constitution; the opposite occurs when an action is brought against a norm that does not appear, on first examination, to be contrary to the Constitution, in which case it is the petitioner who must advance arguments capable of persuading the court of its unconstitutionality.'" Likewise, by judgment No. 2023-2386, reiterated, among many others, by judgment 2026-3342, the Chamber stated the following:
"II.- ON THE REQUIRED SUBSTANTIATION OF THE PLEADING IN WHICH AN ACTION OF UNCONSTITUTIONALITY IS FILED. As noted, the action of unconstitutionality is a proceeding subject to specific formalities which, if not met, prevent the Chamber from adjudicating the challenge sought. One of these requirements consists of the necessary substantiation of the pleading in which the action of unconstitutionality is filed. The Ley de la Jurisdicción Constitucional, in its Article 3, provides that 'The Political Constitution shall be deemed to have been infringed when this results from a comparison of the text of the challenged norm or act, its effects, or its interpretation or application by public authorities, with constitutional norms and principles.' Now, in order for this Tribunal to find that the infringement is established and to declare the unconstitutionality of the challenged norm or act, with the consequent annulment and expulsion from the legal order, whoever promotes an action of unconstitutionality bears the burden of demonstrating how that provision infringes Constitutional Law and, furthermore, must indicate why the claim should be upheld.
This is referred to by this Chamber as the burden of argumentation, that is, 'a norm that is facially [sic] contrary to the Constitution shifts the burden of argumentation to those who maintain that there is, in reality, no conflict between that norm and the Political Constitution; the opposite occurs when an action is brought against a norm that does not appear, on first examination, to be contrary to the Constitution, in which case it is the petitioner who must advance arguments capable of persuading the court of its unconstitutionality' (see judgment No. 0184-95, issued at 4:30 p.m. on January 10, 1995). In a subsequent judgment, this Chamber elaborated, with regard to the failure to set forth arguments of unconstitutionality in actions of unconstitutionality, as follows:
'The action of unconstitutionality is filed on the argument that the challenged Executive Decree is harmful, and infringes the fundamental rights to a healthy and ecologically balanced environment, the right to health, and international commitments undertaken under the Kyoto Protocol. Despite the opportunity afforded to the petitioners, what the Procurador General de la República indicates is confirmed: there is no concrete analysis of the provisions of the challenged Executive Decree considered to be unconstitutional; rather, the action merely raises discrepancies in a generic and abstract manner against the entirety of the Regulation, and further against all activities carried out by the sugar mills and estates, contending that they cause harm to the quality of life and health of neighboring residents, without specifying what constitutional arguments should be taken into account against each of the provisions or groups of norms of the challenged Regulation. […] The first paragraph of Article 78 of the Ley de la Jurisdicción Constitucional requires that the pleadings filing actions of unconstitutionality be authenticated, since it is considered necessary that the arguments be advanced by a legal professional, whose analysis this Tribunal does not discount as reflecting a serious study of the technical and scientific substance of a given subject matter, given the diversity and universality of the norms within the legal order.
Unlike guarantee proceedings—that is, habeas corpus and amparo motions, which any interested party may file directly before the constitutional jurisdiction in defense of their fundamental rights, generally against acts or omissions affecting them in their individual sphere (though not always, as in environmental cases)—in proceedings for the defense of the Political Constitution (such as the action of unconstitutionality), the legislature entrusted to the authenticating attorney a task whose demands are even greater, more elaborated and exhaustive, which must be reflected in the filing pleading by virtue of professional duty, in order to demonstrate to the Tribunal the infringement of the constitutional norm by a lower-ranking norm, thereby undermining the principle of constitutional supremacy enshrined in Article 10 of the Political Constitution. Precisely the material and formal drafting of laws, as well as of other secondary provisions, entails an enormously costly process for the State, in which organized civil society has participated in many ways, for and against, and whose procedures for drafting, approval, and promulgation must not be analyzed lightly.
In this regard, this Chamber must acknowledge that there is limited room for this Tribunal to remedy the manifest deficiencies of legal professionals who authenticate pleadings in this constitutional jurisdiction, without compromising the impartiality and analysis owed to each action of unconstitutionality.' (Judgment No. 2012-05285, issued at 3:03 p.m. on April 25, 2012).
Article 78 of the Ley de la Jurisdicción Constitucional requires, in this regard, that the pleading in which the action is filed set forth 'its grounds in a clear and precise manner.' In judgment No. 2013-016944, issued at 2:30 p.m. on December 18, 2013, this Chamber made express reference to the requirement of adequate substantiation of the filing pleading—as an essential admissibility requirement, pursuant to the aforementioned article—in the following terms:
'II.- INADMISSIBILITY FOR LACK OF SUBSTANTIATION. In accordance with Article 78 of the Ley de la Jurisdicción Constitucional, the pleading in which an action of unconstitutionality is filed must set forth the grounds in a clear and precise manner, with specific citation of the norms or principles considered to have been infringed. This requirement does not translate into a mere formality, but rather into an essential admissibility requirement, since, by virtue of the pro sentencia principle—developed on other occasions by this Chamber—according to which admissibility requirements must be interpreted in a manner favorable to the action; and since Constitutional Law is of preferential public order, and in guarantee of its supremacy and validity there is a public interest by virtue of which obstacles to the admission and adjudication on the merits of an action must be interpreted and applied restrictively.
That being so, all procedural rules must be interpreted and applied in a manner that leads to the delivery of a judgment; this not only facilitates the administration of justice, but also prevents the imposition of obstacles to achieving it (see, in the same vein, judgments Nos. 93-5175, 3041-97, 01-06, 2874-06, 1622-08, and 2887-08). Consequently, the lack of substantiation of the action prevents the delivery of a duly reasoned judgment consistent with what is sought. Likewise, it is inappropriate for this Chamber to rule on the merits of norms challenged in an action when the petitioner does not substantiate the reasons for which they are challenged, since this would entail conducting an abstract constitutional review as an academic exercise, which is incompatible with the purpose of a proceeding of this nature.'" More recently, in judgment No. 2020-319, issued at 12:15 p.m. on January 8, 2020, this Tribunal reiterated:
"(…) given the formalism legally prescribed for constitutional review proceedings, the argumentative burden in the processing of an action of unconstitutionality falls on the petitioner, who must explain, without ambiguity, the contradiction between an infra-constitutional norm and the constitutional block (bloque de constitucionalidad), as well as the standing that the petitioner possesses." In light of the foregoing, in the sub judice, it can be established that the pleading filing this action lacks adequate substantiation. As already noted, while the specific components of the constitutional block considered to have been infringed are identified—that is, the specific norms, values, or principles of Constitutional Law deemed to have been violated—no further development is provided regarding the content and scope of such components, nor is the necessary intellectual exercise of comparing such content against the challenged norms performed, which, it bears repeating, is the petitioner's responsibility. Consequently, no precise, sufficient, and duly specific argumentation is evident with respect to the surviving grievances and grounds of the alleged infringement of Constitutional Law.
That being so, although this Chamber could issue a notice to the petitioner to remedy compliance with this requirement, in the specific case, such a course of action is considered futile, not only because it would entail essentially re-drafting the action, but also because Article 9, first paragraph, of the Ley de la Jurisdicción Constitucional empowers the Chamber to outright dismiss any motion that is "manifestly improper or unfounded," as is the case here.
For all of the foregoing reasons, and given the failure to meet the legal requirements noted, the action must be dismissed outright, as is hereby ordered.
I depart from the opinion of the majority of this Tribunal and cast a dissenting vote (voto salvado) in this matter, because I consider the outright dismissal of the sub lite to be premature. Certainly, the action of unconstitutionality is a proceeding "established with the purpose of guaranteeing the supremacy of the Political Constitution against norms or other provisions of a general nature, and for that same reason a set of formalities must be met in order for the Chamber to validly adjudicate the merits of the challenge," as ample jurisprudence of this Chamber has repeatedly held. However, it is precisely the law governing this jurisdiction that establishes the treatment to be given to the various formalities and any eventual failure to comply with them. In this regard, Article 80 of the Ley de la Jurisdicción Constitucional expressly provides:
"Article 80.- If the formalities referred to in the two preceding articles are not met, the President of the Chamber shall indicate by resolution which requirements have been omitted and shall order that they be met within three days (…)" In the sub examine, among other requirements, adequate and sufficient substantiation—as required by Article 78 eiusdem—is precisely what is found to be missing, making it inexorable that the petitioner be notified with a view to remedying the omission identified. In addition, I underscore that, based on the pro homine principle, the literal text of Articles 78, 79, and 80 of the cited law makes such an interpretive approach plausible in favor of those who come before this Chamber, so that access to constitutional justice is not unnecessarily restricted.
I depart from the opinion of the majority of this Tribunal and cast a partial dissenting vote in this matter, on the grounds that the decision to outright dismiss this action of unconstitutionality is premature. As this Chamber has repeatedly held, the action of unconstitutionality is a proceeding "established with the purpose of guaranteeing the supremacy of the Political Constitution against norms or other provisions of a general nature, and for that same reason a set of formalities must be met in order for the Chamber to validly adjudicate the merits of the challenge." However, it is precisely Article 80 of the Ley de la Jurisdicción Constitucional itself that prescribes the treatment to be given to the various formalities and any eventual failure to comply with them:
"Article 80.- If the formalities referred to in the two preceding articles are not met, the President of the Chamber shall indicate by resolution which requirements have been omitted and shall order that they be met within three days (…)".
In this matter, adequate and sufficient substantiation regarding the alleged unconstitutionality of Article 111(c) of the Ley Orgánica del Ambiente is found to be missing, and I therefore consider that the petitioner should be notified to remedy the omission identified. Likewise—in my view—both the interpretation of Articles 78 and 79 and that of Article 80 itself of the aforementioned law must be broad in favor of those who come before this Chamber, so that access to constitutional justice is not unnecessarily restricted.
The parties are hereby notified that, if any document on paper, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device, has been submitted, these must be retrieved from the office within a maximum period of 30 business days counted from the notification of this judgment. Otherwise, all material not retrieved within this period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Corte Plena in session No. 27-11 of August 22, 2011, Article XXVI, and published in Boletín Judicial No. 19 of January 26, 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial in session No. 43-12 held on May 3, 2012, Article LXXXI.
Por tanto:
The action is dismissed outright. Justice Rueda Leal casts a dissenting vote and orders that the notice provided for under Article 80 of the Ley de la Jurisdicción Constitucional be issued. Justice Garro Vargas casts a partial dissenting vote and orders that the notice provided for under Article 80 of the Ley de la Jurisdicción Constitucional be issued.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas cuarenta minutos del diecisiete de junio de dos mil veintiseis .
Acción de inconstitucionalidad promovida por [Nombre 001] y [Nombre 002], en su condición de representantes de las empresas [Nombre 003]. con cédula de persona jurídica [Valor 001]; [Nombre 006]., cédula jurídica nro. [Valor 002]; y de [Nombre 007]., con cédula de persona jurídica [Valor 003]; contra los artículos 111.c) de la Ley Orgánica del Ambiente y 29 del Reglamento de Procedimientos del Tribunal Ambiental Administrativo.
Resultando:
Redacta el Magistrado Castillo Víquez; y,
Considerando:
I.Sobre los presupuestos formales de admisibilidad de la acción. La acción de inconstitucionalidad es un proceso con determinadas formalidades, que deben ser satisfechas a los efectos de que la Sala pueda válidamente conocer el fondo de la impugnación. En ese sentido, el artículo 75 de la Ley de la Jurisdicción Constitucional, establece los presupuestos de admisibilidad de la acción de inconstitucionalidad. En primer término, se exige la existencia de un asunto previo pendiente de resolver, sea en vía judicial, o bien, en el procedimiento para agotar la vía administrativa, en que se haya invocado la inconstitucionalidad como medio razonable para amparar el derecho o interés que se considera lesionado. En el párrafo segundo y tercero, la ley establece de manera excepcional, presupuestos en los que no se exige el asunto previo, cuando por la naturaleza del asunto, no exista una lesión individual y directa, o se trate de la defensa de intereses difusos o colectivos, o bien cuando es formulada en forma directa por el Contralor General de la República, el Procurador General de la República, el Fiscal General de la República y el Defensor de los Habitantes.
II.Ahora bien, en cuanto a la exigencia de un asunto pendiente de resolver, esta Sala por medio de la sentencia nro. 1995-4190, de las 11:33 horas del 28 de julio de 1995, señaló lo siguiente:
“En primer término, se trata de un proceso de naturaleza incidental, y no de una acción directa o popular, con lo que se quiere decir que se requiere de la existencia de un asunto pendiente de resolver -sea ante los tribunales de justicia o en el procedimiento para agotar la vía administrativa- para poder acceder a la vía constitucional, pero de tal manera que, la acción constituya un medio razonable para amparar el derecho considerado lesionado en el asunto principal, de manera que lo resuelto por el Tribunal Constitucional repercuta positiva o negativamente en dicho proceso pendiente de resolver, por cuanto se manifiesta sobre la constitucionalidad de las normas que deberán ser aplicadas en dicho asunto; y únicamente por excepción es que la legislación permite el acceso directo a esta vía -presupuestos de los párrafos segundo y tercero del artículo 75 de la Ley de la Jurisdicción Constitucional.” Así las cosas, la exigencia de un asunto previo pendiente de resolver, no constituye un requisito meramente formal, toda vez, que no basta con la sola existencia de un asunto base, ni con la simple invocación de la inconstitucionalidad, pues se requiere además, que la acción sea un medio razonable para amparar el derecho o interés que se considera lesionado.
Esto quiere decir, que es necesario que se verifique la existencia de un asunto en el que estén de por medio los derechos fundamentales de las personas y en el cual las normas impugnadas tengan una incidencia directa para la resolución del caso (ver en igual sentido las sentencias números 1668-90, 4085-93, 798-94, 3615-94, 409-I-95, 851-95, 4190-95 y 791-96). Asimismo, existen otras formalidades que deben ser cumplidas, a saber, la determinación explícita de la normativa impugnada, debidamente fundamentada, con cita concreta de las normas y principios constitucionales que se consideren infringidos, la autenticación por abogado del escrito en el que se plantea la acción, la acreditación de las condiciones de legitimación (poderes y certificaciones), así como la certificación literal del escrito en el que se invocó la inconstitucionalidad de las normas en el asunto base, requisitos todos que en caso de no ser cumplidos por el accionante, dan lugar a la inadmisión de la acción.
III.De la invocación de inconstitucionalidad en el asunto base. El artículo 75, párrafo primero, in fine, de la Ley de la Jurisdicción Constitucional exige, para efectos de la admisibilidad de una acción de inconstitucionalidad por la vía incidental -como la presente-, la existencia de un asunto principal pendiente de resolver, ya sea ante los tribunales –inclusive de habeas corpus o de amparo-, o en el procedimiento para agotar la vía administrativa, en que se invoque esa inconstitucionalidad como medio razonable para amparar el derecho o interés que se considere lesionado. Tales requisitos no se traducen en una cuestión meramente formal, pues no basta con el simple cumplimiento de los mismos, sino que se requiere, además, que la norma impugnada a través de esta vía tenga una incidencia directa sobre el asunto que sirve como base, de tal suerte, que lo resuelto en la acción sirva como un medio razonable para amparar el derecho o interés lesionado dentro del asunto previo.
A contrario sensu, si no existe una conexidad directa entre el objeto de discusión del asunto base y lo impugnado en la acción, no resulta posible que esta Sala se pronuncie al respecto. Es por lo anterior, que, de conformidad con los artículos 75 y 79 de la Ley que rige a esta Jurisdicción, los accionantes deben acreditar y aportar certificación literal del escrito en el que invocaron la inconstitucionalidad de las normas en el asunto base, a efecto de verificar su incidencia en tal asunto. En cuanto a los requisitos que debe cumplir el citado escrito de invocación, esta Sala ha señalado, de forma reiterada, que:
“(…) si bien, en la invocatoria de inconstitucionalidad de la norma, no se exige una extensa fundamentación, lo cierto es, que sí resulta necesario que en el asunto base se invoque expresamente, la inconstitucionalidad de la norma impugnada en la acción... y se indiquen las normas constitucionales que se consideren infringidas…”. (Sentencia No. 2014-000851 de las 14:30 hrs. del 22 de enero de 2014).” (Sentencia nro. 2017-007744 de las 9:15 hrs. del 24 de mayo de 2017).
Asimismo, por sentencia número 2022-5564, de las 9:00 horas del 9 de marzo de 2022, este Tribunal también señaló lo siguiente:
“(…)En este caso y relación con el contenido del artículo 17 referido al comiso, analizado el memorial en que se invocó la inconstitucionalidad de la norma, el mismo resulta insuficiente. Se mencionan los posibles artículos constitucionales lesionados, pero no se indican las razones. Sobre todo, se echa de menos los alegatos referidos al artículo 45 constitucional que es, precisamente, el derecho que se alega como lesionado en el escrito de interposición de la acción. Por último, en cuanto al artículo 20 referido, no es mencionado en el escrito de invocación, por lo que su cuestionamiento, carente del mínimo fundamento jurídico, es inadmisible.”
IV.Sobre el incumplimiento de los requisitos de admisibilidad en esta acción de inconstitucionalidad. Una vez analizado el escrito de interposición de este proceso y, luego de haberse realizado la prevención por parte de la Presidencia de esta Sala de algunos requisitos faltantes inicialmente por resolución de las 15:24 horas del 15 de mayo de 2026, se concluye que, este proceso sigue adoleciendo de algunos requisitos y lo procedente es su rechazo de plano.
a- En primer término, advierte esta Sala que, al momento de ser planteado este proceso el 11 de mayo pasado, el gestionante [Nombre 001] carecía de todo poder para representar los intereses de las empresas accionantes [Nombre 003]., [Nombre 006]. y de [Nombre 007]., toda vez que este fue conferido con posterioridad -sea el 19 de mayo de 2026-. Así las cosas, si bien actualmente ostenta el poder respectivo, lo cierto es que, para el momento en que se interpuso la acción carecía de este. De manera que, no es posible aceptarle su condición de accionante, a favor de tales sociedades en este proceso, y deberá tenerse como único accionante al gestionante [Nombre 002], quien sí acreditó su representación desde la interposición de este proceso.
b- De otro lado, una vez aclarado por la parte accionante que las normas impugnadas son los artículos 111.c) de la Ley Orgánica del Ambiente y 29 del Reglamento de Procedimientos del Tribunal Ambiental Administrativo; revisado el escrito aportado mediante el cual se debía invocar la inconstitucionalidad de esa normativa de previo a la interposición de este proceso, este Tribunal pudo constatar que no se realizó tal invocatoria respecto del ordinal 29 del Reglamento de Procedimientos del Tribunal Ambiental Administrativo. En efecto, literalmente se indicó lo siguiente:
“El suscrito [Nombre 002], en mi condición de apoderado general judicial de [Nombre 003], y de [Nombre 012]., procedo a invocar la inconstitucionalidad del artículo 111 de la Ley Orgánica del Ambiente, para los efectos del artículo 79 de la Ley de la Jurisdicción Constitucional, por carecer de recurso de doble instancia, con fundamento en los motivos que se expondrán a continuación...”. (El énfasis no es del original).
Asimismo, en relación con el artículo 111 inciso c), solo se realizó tal invocatoria por la acusada violación al principio de razonabilidad, proporcionalidad, debido proceso y al artículo 8.2 de la Convención Americana sobre Derechos Humanos, no por el principio de igualdad, ni por la aducida violación al artículo 24 de la Convención Americana sobre Derechos Humanos, que han sido alegados también esta acción. En ese sentido, al haberse incumplido tales requisitos, la acción solo resultaría admisible, en principio, en relación con el artículo 111 inciso c) de la Ley Orgánica del Ambiente y por la acusada violación principio de razonabilidad, proporcionalidad, debido proceso y respecto del ordinal 8.2 de la Convención Americana sobre Derechos Humanos.
c- En este proceso acuden como accionantes tres sociedades anónimas: [Nombre 003]., [Nombre 008]. y de [Nombre 007]. Sin embargo, tal como quedó expuesto en el punto anterior, la invocatoria de inconstitucionalidad solo fue realizada por [Nombre 003], y [Nombre 009]., no así por [Nombre 008] (folio 3934 de la copia certificada del expediente administrativo adjunto). De hecho, esta última sociedad tampoco aparece signando el recurso de revocatoria interpuesto contra el acto final en el asunto base que es un procedimiento administrativo tramitado en el expediente 174-09-03-TAA, en el cual se emitió la resolución nro. 1403-2025-TAA, de las 8:00 horas del 25 de noviembre de 2025, ante el Tribunal Ambiental Administrativo, aportado a este expediente (ver folio 3929 de la copia certificada del expediente administrativo adjunto). En consecuencia, tampoco procedería tener como accionante de este proceso a la sociedad [Nombre 008]., al haber omitido demostrar el cumplimiento de tales requisitos de admisibilidad.
d- Finalmente procede indicar que, al eliminarse la fundamentación dada en relación con los aspectos cuya inconstitucionalidad no fue invocada en el asunto base, la acción quedó sin el sustento necesario, pues los demás aspectos no están suficientemente fundamentados. Si bien las alegaciones de inconstitucionalidad son apuntadas someramente, lo son sin elaborar un hilo argumentativo que permita valorar de manera directa que lo dispuesto en el artículo 111.c sea inconstitucional, pues el gestionante se limita a realizar enunciados sin ningún desarrollo profuso dejando que sea la Sala la que realiza esa labor intelectiva que es responsabilidad del accionante. Sobre el particular, debe recordarse que la Sala no puede suplir la ausencia de argumentos que, para la parte accionante, justifican la solicitud de inconstitucionalidad que se plantea, pues esa es una labor de la persona accionante. En ese sentido, mediante sentencia 2014-4239 -que reitera sentencia 184-95-, este Tribunal indicó:
“IV.- Sobre la falta de concreción de los argumentos de inconstitucionalidad. La Ley de la Jurisdicción Constitucional, en su artículo 3, dispone que “Se tendrá por infringida la Constitución Política cuando ello resulte de la confrontación del texto de la norma o acto cuestionado, de sus efectos, o de su interpretación o aplicación por las autoridades públicas, con las normas y principios constitucionales”. Ahora bien, para que este Tribunal tenga por configurada la infracción y declarar la inconstitucionalidad de la norma o acto impugnado, con la consecuente anulación y expulsión del ordenamiento jurídico, quien promueva una acción de inconstitucionalidad tiene la carga de demostrar cómo esa disposición infringe la norma o principio constitucional y, además, debe indicar por qué debe estimarse la demanda. Ello es denominado por esta Sala como la carga de la argumentación, es decir, que “una norma que facialmente sea contraria a la Constitución, vuelca la carga de la argumentación a quienes sostengan que en realidad no hay conflicto entre esa norma y la Constitución Política; lo contrario sucede si se acciona contra una norma que en primer examen no parece contraria a la Constitución, en cuya hipótesis es el accionante el que debe avanzar con los argumentos que convenzan acerca de la inconstitucionalidad ” De igual manera, mediante sentencia número 2023-2386, reiterada, entre muchas otras, por sentencia 2026-3342, la Sala indicó lo siguiente:
“II.- SOBRE LA NECESARIA FUNDAMENTACIÓN DEL ESCRITO EN EL QUE SE FORMULE LA ACCIÓN DE INCONSTITUCIONALIDAD. Según se indicó, la acción de inconstitucionalidad es un proceso con determinadas formalidades, que, si no se reúnen, imposibilitan a la Sala conocer de la impugnación que se pretende. Uno de esos requisitos corresponde a la necesaria fundamentación del escrito en el que se formule la acción de inconstitucionalidad. La Ley de la Jurisdicción Constitucional, en su artículo 3, dispone que “Se tendrá por infringida la Constitución Política cuando ello resulte de la confrontación del texto de la norma o acto cuestionado, de sus efectos, o de su interpretación o aplicación por las autoridades públicas, con las normas y principios constitucionales”. Ahora bien, para que este Tribunal tenga por configurada la infracción y pueda declarar la inconstitucionalidad de la norma o acto impugnado, con la consecuente anulación y expulsión del ordenamiento jurídico, quien promueva una acción de inconstitucionalidad tiene la carga de demostrar cómo esa disposición infringe el Derecho de la Constitución y, además, debe indicar por qué debe estimarse la demanda.
Esto es denominado por esta Sala como la carga de la argumentación, es decir, que “una norma que facialmente (sic) sea contraria a la Constitución, vuelca la carga de la argumentación a quienes sostengan que en realidad no hay conflicto entre esa norma y la Constitución Política; lo contrario sucede si se acciona contra una norma que en primer examen no parece contraria a la Constitución, en cuya hipótesis es el accionante el que debe avanzar con los argumentos que convenzan acerca de la inconstitucionalidad” (véase la sentencia No. 0184-95 de las 16:30 horas del 10 de enero de 1995). En una sentencia posterior, esta Sala expuso, en cuanto a la falta de exposición de los argumentos de inconstitucionalidad en materia de acciones de inconstitucionalidad, lo siguiente:
“La acción de inconstitucionalidad se interpone con el argumento de que el Decreto Ejecutivo impugnado es nocivo, lesiona e infringe los derechos fundamentales a un ambiente sano y ecológicamente equilibrado, el derecho a la salud y a los compromisos internacionales suscritos con el Protocolo de Kyoto. Pese a la oportunidad otorgada a los accionantes, se confirma lo que indica la Procuraduría General de la República, de que no existe un análisis concreto de las disposiciones del Decreto Ejecutivo impugnado que se consideran inconstitucionales, sino que el mismo se limita a establecer discrepancias de forma genérica y en abstracto contra la totalidad del Reglamento, más aún contra toda actividad que desempeñan los ingenios Azucareros y Haciendas, pues sostienen que causan inconvenientes en la calidad de vida y en la salud de los habitantes circunvecinos, sin concretar qué argumentos de constitucionalidad se deben tomar en cuenta en contra de cada una de las disposiciones o grupos del normas del Reglamento impugnado. […] El párrafo primero del artículo 78 de la Ley de la Jurisdicción Constitucional establece la obligación de autenticar los escritos de interposición de acciones de inconstitucionalidad, toda vez que se estima necesario que existan argumentos esgrimidos por un profesional en Derecho, que no descarta este Tribunal responda a un serio estudio del fondo técnico y científico de una determinada materia, dada la diversidad y universalidad de las normas del ordenamiento jurídico.
A diferencia de los procesos de garantías, es decir, los recursos de hábeas corpus y de amparo, que los puede interponer directamente cualquier interesado ante la jurisdicción constitucional en defensa de sus derechos fundamentales, generalmente contra actos u omisiones que le lesionan en su esfera particular (aunque no siempre como en los casos ambientales), en los procesos de defensa de la Constitución Política (como la acción de inconstitucionalidad), el legislador confió al abogado autenticante una labor cuya exigencia es aún mayor, si se quiere más elaborada y exhaustiva que debe plasmar en el libelo de interposición en razón de su oficio profesional, para demostrar al Tribunal la lesión a la norma constitucional por parte de una norma de menor rango, socavando el principio de supremacía constitucional contenida en el artículo 10 de la Constitución Política. Precisamente la elaboración material y formal de la Ley, así como de las demás disposiciones secundarias, suponen un proceso sumamente costoso para el Estado, en la que de muchas maneras para su elaboración ha participado la sociedad civil organizada a favor o en contra, y cuyos procedimientos de formación, aprobación y promulgación no debe analizarse a la ligera.
En este sentido, debe reconocer esta Sala que existe un reducido espacio para este Tribunal para socorrer las ausencias manifiestas de los profesionales en derecho que autentican los escritos en esta jurisdicción constitucional, sin exponer la imparcialidad y análisis que se debe a cada una de las acciones de inconstitucionalidad.” (Sentencia nro.. 2012-05285 de 15:03 horas de 25 de abril de 2012).
El artículo 78 de la Ley de la Jurisdicción Constitucional exige, en tal sentido, que en el escrito en que se interponga la acción se expongan “sus fundamentos en forma clara y precisa”. En sentencia nro. 2013-016944 de las 14:30 horas del 18 de diciembre de 2013, esta Sala hizo expresa referencia a la exigencia de debida fundamentación del escrito de interposición –como requisito esencial de admisibilidad de la acción, a tenor de lo dispuesto el mencionado ordinal- en los siguientes términos:
“II.- INADMISIBILIDAD POR FALTA DE FUNDAMENTACIÓN. De conformidad con el artículo 78 de la Ley de la Jurisdicción Constitucional, en el escrito en que se interponga la acción de inconstitucionalidad, se deberán exponer los fundamentos en forma clara y precisa, con cita concreta de las normas o principios que se consideren infringidos. Dicho requisito no se traduce en una mera formalidad, sino en un requisito esencial de admisibilidad, pues en virtud del principio pro sentencia –desarrollado en otras ocasiones por esta Sala- según el cual, los requisitos de admisibilidad deben interpretarse en sentido favorable a la acción, además, el Derecho Constitucional es de orden público preferente y en garantía de su supremacía y vigencia hay un interés público en virtud del cual los obstáculos para la admisión y resolución de fondo de una acción, deben interpretarse y aplicarse restrictivamente. Así las cosas, todas las normas procesales deben ser interpretadas y aplicadas de manera tal que se obtenga el dictado de la sentencia, lo anterior, no solo facilita la administración de la justicia, sino que además, evita que se impongan obstáculos para no alcanzarla (ver en igual sentido, las sentencias números 93-5175, 3041-97, 01-06, 2874-06, 1622-08 y 2887-08).
En consecuencia, la falta de fundamentación de la acción, impide el dictado de una sentencia debidamente motivada y congruente con lo pretendido. Asimismo, resulta improcedente que esta Sala se pronuncie por el fondo de normas cuestionadas en una acción, cuando el que acciona no fundamenta las razones por las cuales impugna, toda vez, que ello implicaría efectuar un control constitucional en abstracto a manera de ejercicio académico, lo que no es compatible con la finalidad de un proceso de esta naturaleza.” Más recientemente, en la sentencia nro. 2020-319 de las 12:15 horas del 8 de enero de 2020, este Tribunal reiteró:
“(…) dado el formalismo dispuesto legalmente para los procesos de control de constitucionalidad. la carga argumentativa en el trámite de una acción de inconstitucionalidad recae en el accionante, quien debe explicar, sin ambages, la contradicción existente entre una normativa infraconstitucional y el bloque de constitucionalidad, así como la legitimación que le asiste”.
A partir de lo anterior, en el sub judice, se puede constatar que el escrito de interposición de esta acción carece de una debida fundamentación. Tal como ya se indicó, si bien se identifican los componentes específicos del bloque de constitucionalidad que se consideran como infringidos -sea, de las normas, valores o principios concretos del Derecho de la Constitución que se estiman como vulnerados-, no se realiza mayor desarrollo respecto del contenido y alcances de tales componentes, ni del necesario ejercicio intelectivo de contraposición entre tales contenidos y la normativa impugnada, lo cual, se reitera, es responsabilidad de la parte accionante. Por consiguiente, no se evidencia una argumentación precisa, suficiente y debidamente circunstanciada sobre los agravios y fundamentos subsistentes de la alegada infracción al Derecho de la Constitución.
Así las cosas, aunque se podría prevenir a la parte accionante en el sentido que subsane el cumplimiento de este requisito, en el caso concreto, dicho trámite se considera ocioso, no solo porque supone volver a elaborar la acción, sino, también, porque el artículo 9, párrafo 1º, de la Ley de la Jurisdicción Constitucional faculta a la Sala para rechazar de plano cualquier gestión “manifiestamente improcedente o infundada”, como ocurre en la especie.
En razón de todo lo expuesto y dado el incumplimiento de los requisitos legales señalados, procede rechazar de plano la acción, como en efecto se ordena.
Me separo del criterio de la mayoría de este Tribunal y salvo el voto en este asunto, porque considero prematuro el rechazo de plano del sub lite. Ciertamente, la acción de inconstitucionalidad es un proceso “instaurado con el propósito de garantizar la supremacía de la Constitución Política frente a normas u otras disposiciones de carácter general y que por esa misma razón deben cumplirse un conjunto de formalidades, a efecto de que la Sala pueda válidamente conocer el fondo de la impugnación” como de forma reiterada ha señalado amplia jurisprudencia de esta Sala. Sin embargo, precisamente, la propia ley que rige esta jurisdicción establece el tratamiento que debe darse a las distintas formalidades y su eventual incumplimiento. En tal sentido, de forma expresa estatuye el numeral 80 de la Ley de la Jurisdicción Constitucional:
“Artículo 80.- Si no se llenaren las formalidades a que se refieren los dos artículos anteriores, el Presidente de la Sala señalará por resolución, cuáles son los requisitos omitidos y ordenará cumplirlos dentro de tercero día (…)” En el sub examine, entre otros requisitos, justamente se echa de menos una fundamentación adecuada y suficiente, tal como exige el ordinal 78 eiusdem, por lo que resulta inexorable la prevención al accionante con miras a que remedie la omisión detectada. En adición, subrayo que, con base en el principio pro homine, la literalidad de los cánones 78, 79 y 80 de la ley de cita vuelve plausible una hermenéutica de tal índole en beneficio de quienes acuden a esta Sala, de modo que el acceso a la justicia constitucional no resulte limitado de modo innecesario.
Me separo del criterio de la mayoría de este Tribunal y salvo parcialmente el voto en este asunto, por considerar que la decisión de rechazar de plano esta acción de inconstitucionalidad es prematura. Es sabido, la acción de inconstitucionalidad es un proceso “instaurado con el propósito de garantizar la supremacía de la Constitución Política frente a normas u otras disposiciones de carácter general y que por esa misma razón deben cumplirse un conjunto de formalidades, a efecto de que la Sala pueda válidamente conocer el fondo de la impugnación”, como ha señalado de manera reiterada esta Sala. Sin embargo, es precisamente el artículo 80 de la propia Ley de la Jurisdicción Constitucional la que ordena el tratamiento que debe darse a las distintas formalidades y a su eventual incumplimiento:
“Artículo 80.- Si no se llenaren las formalidades a que se refieren los dos artículos anteriores, el Presidente de la Sala senalará por resolución, cuáles son los requisitos omitidos y ordenará cumplirlos dentro de tercero día (…)”.
En este asunto, se echa de menos una fundamentación adecuada y suficiente en cuanto a la presunta inconstitucionalidad del artículo 111. c) de la Ley Orgánica del Ambiente, por lo que estimo que procede prevenir al accionante para que remedie la omisión detectada. De igual forma –en mi criterio– tanto la interpretación de los artículos 78 y 79 como la del propio artículo 80 de la mencionada ley debe ser amplia en beneficio de quienes acuden a esta Sala, de modo que el acceso a la justicia constitucional no resulte innecesariamente limitado.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se rechaza de plano la acción. El magistrado Rueda Leal salva el voto y ordena hacer la prevención del artículo 80 de la Ley de la Jurisdicción Constitucional. La magistrada Garro Vargas salva parcialmente el voto y ordena realizar la prevención del artículo 80 de la Ley de la Jurisdicción Constitucional.
