CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine-thirty in the morning on the nineteenth of June, two thousand twenty-six.
Writ of amparo (recurso de amparo) filed by [Nombre 001], identity card [Valor 001], on behalf of 240 families of the Urbanización Don Chú in Upala, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, the MINISTERIO DE SALUD, and the MUNICIPALIDAD DE UPALA.
Background:
1. On the nature of the reported problem From the technical analysis of the record (folios 000001–000044 and 000034–000041), it is determined that the findings reported by the Ministerio de Salud correspond to seepage (afloramientos) and improper disposal of domestic wastewater (aguas residuales domésticas), associated primarily with:
• failed septic systems (sistemas sépticos); • absence or deterioration of private filtration drainage systems (drenajes filtrantes); • improper connections to the stormwater infrastructure; • irregular internal discharges within private properties (RCH-ARSU-ERS-IT-029-2025).
This type of impact falls technically within the domain of household sanitation (saneamiento sanitario domiciliario), which is the purview of the Ministerio de Salud — a situation extensively documented by those regulatory bodies (entes rectores) since 2020.
2. On the municipal stormwater infrastructure The technical analysis carried out by the CTE, as well as the Road Management Unit (Gestión Vial) reports (folios 000071–000077), confirm that:
• the Municipalidad de Upala does have stormwater infrastructure in the area; • said infrastructure has been improved and maintained in recent years; • no structural failures attributable to the municipal stormwater system have been found that generate wastewater or contribute to its seepage.
The stormwater infrastructure carries only rainwater, not wastewater. The record contains no document indicating any technical deficiency in the municipal stormwater system.
3. Technical actions taken (chronological order) Actions prior to legal opinion MU-GJ-CL-018-2025 (within a framework of inter-institutional cooperation and oriented toward community well-being) 2021 • Request for and granting of an extension for compliance with the sanitary orders (folios 000004–000009). • Submission of an action plan with sanitation promotion and community assistance measures (folios 000019–000028).
2022 • Receipt and analysis of a community petition (manifiesto vecinal) (folios 000011–000015).
2023 • Cleaning and improvement of the stormwater outlet system (sistema de desfogue pluvial) to prevent mixing with wastewater from homes (24/03/2023). • Operational intervention to redirect stormwater toward the rear drainage channel (March–April 2023). • Placement of urban waste containers in public walkways (alamedas) to prevent waste from entering the stormwater systems (April 2023). • Improvements to a public park: installation of a playground, improvements to a multipurpose sports court (April 2023). • Citizen education event via Facebook Live on the proper use of septic tanks (tanques sépticos) (23/06/2023).
2024 • Issuance of technical official communication MU-DCU-OF-012-2024 (folios 000019–000028) consolidating actions taken. • Participation in an inter-institutional assessment (folios 000016–000018). • Participation in coordination meetings between the Ministerio de Salud and the Municipalidad de Upala (March and April 2024).
2025 Actions (before and after the legal opinion) January – April 2025: • Inter-institutional coordination for monitoring of the action plan (folios 000045–000053). • Response to information requests from the Asamblea Legislativa (folios 000030–000033). • Technical updates submitted to the Legal Affairs Office (folios 000054–000070).
April 2025: • Improvement of the stormwater system in the Don Chú area by the Road Management Unit (folios 000071–000077).
June 2025: • Issuance of legal opinion MU-GJ-CL-018-2025 (folios 000111–000128), which expressly defined institutional competencies.
Actions subsequent to the legal opinion Since the date of the legal opinion, the Municipalidad de Upala has maintained: • participation in meetings convened by the Ministerio de Salud (folios 000129–000145); • formal responses to requests for extensions of the sanitary order (folios 000091–000107); • technical contributions related exclusively to public infrastructure; • technical support in gathering information for the amparo record; • preparation of the index, pagination (foliatura), and technical certification of the record submitted to the Legal Affairs Office (folios 000078–000080 and 000146–000151).
All of the foregoing without any intervention in private sanitary systems and without assuming functions belonging to the regulatory bodies.
4. On the prevailing legal opinion Legal opinion MU-GJ-CL-018-2025 establishes that: • the Municipalidad de Upala has no competence in the management or treatment of wastewater; • intervening in private sanitary systems would constitute an overreach of its functions; • competence over sanitation (saneamiento) lies with the Ministerio de Salud and AyA.
This technical report fully conforms to said opinion and precisely delimits the scope of municipal actions.
5. Information received in meetings • As reported in RCH-ARSU-ERS-IT-029-2025, the Ministerio de Salud is aware that the entire problem is caused by private users, who have already received sanitary orders to correct it — a follow-up process of which, as of today, this Commission has no knowledge.
The CTE, acting strictly within its technical functions and based on documentary analysis of the record, reports:
1. That the problem identified in the writ of amparo 2025-035396-0007-CO is associated primarily with deficiencies in private sanitary systems, according to the technical reports of the Ministerio de Salud contained in the record.
2. That the municipal actions taken from 2021 to the present correspond exclusively to actions within the framework of municipal technical competency (stormwater infrastructure, cleaning of public spaces, sanitation promotion, and inter-institutional coordination).
3. That prior to the legal opinion, the Municipalidad de Upala carried out actions oriented toward community well-being, without intervening in private sanitary systems or assuming competencies belonging to other entities.
4. That following the 2025 legal opinion, the Municipalidad de Upala has maintained full willingness to collaborate, strictly limited to its technical and administrative functions.
5. That no municipal action recorded in the file involves the exercise of competencies in the treatment, regulation, oversight, or sanitary intervention — functions that belong to the Ministerio de Salud.
6. That all requested information is delivered duly systematized, with the record paginated and organized chronologically, ready for use by the Legal Affairs Office in preparing the legal report to be submitted to the Sala Constitucional.
7. That, according to the first paragraph of the fifth page of official communication MU-GJ-OFIC-0041-2025, the Chamber orders "the design, implementation, and financing of a comprehensive solution to the wastewater treatment problem in the Urbanización Don Chu, within a period of 8 months" — processes in which this Commission has no authority to carry out any of those actions." Based on the proceedings carried out by each of the municipal departments, as detailed in report MU-CTE-OFIC-009-2025 of the Specialized Technical Commission for Monitoring the Sanitary Orders of the Wastewater Treatment System of the Barrio Don Chú, of the Municipalidad de Upala, given that said departments are responsible for the procedures, meetings, and inter-institutional efforts regarding the water situation — strictly insofar as our competencies allow, and exclusively with respect to stormwater, since any other water (wastewater) falls purely within the private domain — and as explained in its report by the Commission referred to in these proceedings, the Ministerio de Salud is already undertaking proceedings and issuing sanitary orders to each individual property owner, we once again reaffirm our commitment to the general population of our canton, provided that this commitment operates under the principle of legality and with a view to the efficient and lawful use of public resources, all of the foregoing in accordance with the superior public interest of our canton (…)
III PRAYER FOR RELIEF Having complied in a timely and proper manner with what was requested, I hereby request:
1. That the writ of amparo filed against the Municipalidad de Upala be declared Without Merit.
2. That the Municipalidad de Upala be absolved of all procedural liability."
1. The project is NOT within AyA's competency The project under analysis does not fall within the management of the Subgerencia de Sistemas Periféricos, as AyA does not provide services in this area. In this zone, according to current operational information, it is the Municipalidad de Upala that administers the drinking water supply system (sistema de abastecimiento de agua potable). Following sector governance and the national legal framework, the operator of the supply system must also be the natural operator of the sanitation system, as both are integral parts of the water cycle (ciclo del agua). For this reason, the Municipalidad de Upala is the competent entity to administer, operate, and resolve the sanitation problem at issue.
2. The water cycle principle: technical and legal basis The "water cycle principle," recognized by national sector policy and the regulatory frameworks for drinking water and sanitation, establishes that every supply system must be technically linked to a wastewater collection and treatment system, such that the water delivered to the population is returned to the environment under safe conditions. The urban water cycle comprises the stages of "catchment – purification – distribution – consumption – collection – treatment – final disposal." Under this principle, the drinking water operator is responsible for ensuring the continuity of the cycle, which includes sanitation. The Municipalidad de Upala, as the operator in the area, must provide, supervise, or require a wastewater collection and treatment solution, whether through collective or individual systems (sistemas colectivos o individuales). Supply and sanitation cannot be separated, as they constitute a single integrated system.
3. The Municipalidad de Upala's responsibility in connection with the approval of urban development The Municipalidad de Upala, in accordance with the Código Municipal, the Ley de Planificación Urbana, and the Reglamento para el Control Nacional de Fraccionamientos y Urbanizaciones, is the competent authority to approve the urban development project and verify that it complies with:
• A solution for the collection of sewage (aguas negras) • An adequate wastewater treatment system • Compliance with the Reglamento de Vertido y Reuso • Sanitary feasibility clearance (factibilidad sanitaria) from the Ministerio de Salud Acting as operator of the drinking water system and as the urban planning authority, the Municipalidad de Upala cannot detach itself from sanitation, but must ensure its proper management.
4. The Ministerio de Salud is a regulatory authority, not an operator The Ministerio de Salud issues sanitary permits, carries out oversight, and establishes minimum technical criteria; however, it neither administers nor operates sanitation systems, and therefore cannot be considered directly responsible for the operation or resolution of the problem at hand.
5. AyA's role: regulatory oversight and inter-institutional coordination While AyA is not the operator in the area, it does participate as the regulatory body (ente rector) for the drinking water and sanitation sector, in accordance with Ley 2726 and sector regulations. Within this framework:
• It may provide technical advice • Provide guidelines • Support verification processes • Coordinate with other institutions All of this within the principle of inter-institutional coordination, without implying any assumption of direct operation or responsibility for the system.
Technical Conclusions 1. The project does not fall within AyA's service coverage area, specifically that of Sistemas Periféricos, as the Municipalidad de Upala is the drinking water service operator in the zone.
2. In accordance with the water cycle principle, the supply operator must also assume responsibility for sanitation.
3. The Municipalidad de Upala is the competent authority to approve urban development and to require a wastewater collection and treatment solution.
4. The Ministerio de Salud regulates, but does not operate, sanitation systems.
5. AyA collaborates solely in its regulatory and advisory role, under the principle of inter-institutional coordination. (…)" Furthermore, the Unidad Técnica de los Servicios de Abastecimiento de Agua Potable y de Saneamiento, by memorandum No. PRE-UTSAPS-2025-00435, addressed the facts as follows: "(…) Analysis 1. On the facts alleged in the writ of amparo processed under case number 25-035396-0007-CO Pursuant to what was requested under sanitary order ARS-U-OS-030-2022, by which the Ministerio de Salud transmitted report MS-DRRCH-URS-IT-0147-20, AyA provided a technically grounded response, as set forth in official communication PRE-2021-00617 dated 24 May 2021 (which appears as documentary evidence 3 in the filing), for the following reasons:
a. The solution to address the wastewater sanitation problem in the Urbanización don Chú requires a comprehensive approach, since in addition to the wastewater treatment requested by the Ministerio de Salud under sanitary order ARS-U-OS-030-2022, its collection and disposal must also be resolved in compliance with the applicable technical regulations.
b. The comprehensive solution entailing a public wastewater sanitation service for various sectors of the canton of Upala is contained in the document "PLAN MAESTRO PARA LOS SISTEMAS DE ABASTECIMIENTO DE AGUA Y SANEAMIENTO DE UPALA, ALAJUELA," issued in June 2010, as the product of a joint effort among the Instituto de Fomento y Asesoría Municipal (IFAM), AyA, and the Banco Interamericano de Desarrollo (BID) through the "PROGRAMA DE AGUA POTABLE Y SANEAMIENTO PARA EL NIVEL SUBNACIONAL (CR-T1034)." c. The Urbanización don Chú is located within the project area analyzed in the referenced master plan, which is detailed in figure 3.1, specifically within the quadrant contained between coordinates 1206-1205 on the horizontal axis and 389-390 on the vertical axis (see page 59 of the document submitted as Anexo 1 to this report); this is consistent with the location of the urbanización as shown in the satellite photograph reproduced below (see the point in red); consequently, the solution set forth in the 2010 master plan included the Urbanización Don Chú (…)
d. In accordance with the cost summary contained in Table 9.6 of the 2010 wastewater sanitation master plan, the total cost to execute the works under the proposed solution — which of course included other sectors in addition to the Urbanización don Chú — was estimated at US$ 4,476,195.20; for this reason, AyA, in official communication PRE-2021-00617, details in section 5 the actions to be carried out by the Municipalidad de Upala, in its capacity as public provider of the drinking water supply service and, consequently, of the public wastewater sanitation service, when a comprehensive collective solution is required, following the logic of the complete water cycle, under which an operator that provides the drinking water supply service must also provide the service of collection, treatment, and disposal of wastewater resulting from the use of water for human consumption, particularly when individual wastewater collection and treatment solutions are not technically feasible, namely: (…)
e. AyA, within the scope of its competencies in the area of technical regulatory oversight over wastewater sanitation, considers the "PLAN MAESTRO PARA LOS SISTEMAS DE ABASTECIMIENTO DE AGUA Y SANEAMIENTO DE UPALA, ALAJUELA," issued in June 2010, as input for the municipal operator; however, as has been explained, in order to provide more targeted technical advice, the municipal operator must direct its human, material, and budgetary resources toward updating the master plan. In this regard, it is important to note that every project of public or private initiative that includes public works for drinking water supply systems, wastewater sanitation systems, and stormwater systems must comply with the provisions of the "Reglamento para el Trámite de Revisión de Planos" Decreto Ejecutivo Nº 36550-MPMIVAH-S-MEIC and N° 38441-MP-MIVAH-S-MEIC-TUR and their amendments, prior to which AyA may provide technical advice regarding the solution proposed by the Municipalidad de Upala as a collective wastewater sanitation solution.
It is noteworthy that, according to the records of the Área de Urbanizaciones of AyA's UEN de Programación y Control — the unit responsible for monitoring compliance with the aforementioned regulation, within the scope of AyA's technical regulatory oversight — no residential project under the name Urbanización don Chú is registered for review; said project should also have obtained AyA's approval. It is unknown whether the project received approval from the Ministerio de Salud, INVU, or the Municipalidad de Upala, as applicable (see Anexo 2 to this report), and if so, who approved the individual collection and treatment solution involving the use of septic tanks.
f. AyA, through document PRE-UTSAPS-2025-00163, reiterates that "…the Municipalidad de Upala, in its capacity as an authorized public operator for the provision of the aforementioned services, [must] formulate a SANITATION MASTER PLAN using as input the 'PLAN MAESTRO PARA LOS SISTEMAS DE ABASTECIMIENTO DE AGUA Y SANEAMIENTO DE UPALA, ALAJUELA' of June 2010, as part of its responsibilities and competencies." This also entails that the operator maintain an organizational structure that enables it to manage the wastewater sanitation service, supported by a sanitation master plan for the canton's residents who so require it; the master plan instrument must be accompanied by a service provision regulation instrument and a tariff structure that allows for the allocation and availability of the human, material, and budgetary resources needed to carry out its management efficiently.
g. By email dated 22 and 21 April 2025 (see Anexo 3 to this report), the Unidad Técnica de los Servicios de Abastecimiento de Agua Potable y de Saneamiento del AyA (UTSAPS), in response to a request from the Deputy Mayor of the Municipalidad de Upala, noted the existence of a municipal-level technical commission on the subject of wastewater treatment and an interest in establishing a roadmap; to that end, the need for the Municipalidad de Upala to identify financing sources to support the contracting process for the master plan was reiterated. However, as of the date of this report, the efforts made by the Municipalidad de Upala to carry out the update of the sanitation master plan are unknown. Nor do AyA's documentary records reflect any response to document PRE-UTSAPS-2025-00163.
Conclusions
AyA provided a timely response to sanitary order ARS-U-OS-030-2022 and has fulfilled its regulatory role in the area of wastewater sanitation, and is prepared to provide technical advice, the latter contingent upon the Municipalidad de Upala, in its capacity as an authorized public operator, assuming its responsibilities and managing the actions and resources necessary to advance the construction of a comprehensive wastewater sanitation solution. (…)" SUBSTANTIVE CONSIDERATIONS It is important to note that in Costa Rica there are two separate drainage systems: one called the "Sistema de Alcantarillado Pluvial" (stormwater drainage system), whose purpose is to carry rainwater from roofs, gutters, and downspouts of homes, as well as rainwater flowing along public roads; and the other, called the "Sistema de Alcantarillado Sanitario" (sanitary sewer system), whose purpose is to carry only wastewater generated from sinks, kitchen drains, showers, and toilets within homes.
Under current regulations, stormwater drainage systems are administered by the municipalities of each canton, while the sanitary sewer system is operated and maintained by the operator responsible for providing the drinking water service within its respective geographic coverage area. In the canton of Upala, the Municipalidad de Upala is currently the operator of the drinking water supply service and therefore is also responsible for administering, operating, and maintaining the sanitary sewer services, if any exist. In the absence of a sanitary sewer system, wastewater must be disposed of through individual systems, namely septic tanks together with their respective drainage, in accordance with the Código Municipal and the Ley General de Salud.
For their part, local governments have the authority to impose a series of restrictions on construction and development projects through urban planning; importantly, should the conditions they mandate be violated, they have a series of enforcement mechanisms at their disposal, which AyA lacks. In addition to the foregoing, it is clear that municipalities are the entities that collect the corresponding fees for the maintenance and proper functioning of the stormwater network, as provided for by Código Municipal No. 7794, in Title IV, Municipal Finance (Hacienda Municipal). In the present case, it must not be overlooked that when municipalities collect municipal taxes, they include the line item corresponding to the maintenance and operation of the stormwater network, which underscores municipal competency in this field; furthermore, it is evident that this line item should be used for the maintenance and operation of each municipality's stormwater network, as stated by the Sala Constitucional in Voto 2001-2320, in Considerando IV, which reads verbatim:
(…) The foregoing demonstrates the interrelated nature of municipal obligations regarding the stormwater drainage system and the obligation set forth above, which are linked and under the administration of Local Governments as part of the services they are obligated to provide (…)
Based on the cited legal provisions, it is concluded that the Municipalidad de Upala is directly responsible for determining the measures required to resolve the problem of wastewater management and sanitation, having previously approved the urban development project in that area; this is without prejudice to its coordinating with the entities that may act to ensure that the sewer system is adequate, and likewise ensuring that property owners make proper use of the system — having taken the system under its administration as the drinking water supply service operator — in application of and compliance with the water cycle principle, already recognized by national sector policy and the regulatory frameworks for drinking water and sanitation, which requires that every supply system be technically linked to a wastewater collection and treatment system, such that the water delivered to the population is returned to the environment under safe conditions.
In this regard, the Municipalidad de Upala has the obligation to enforce the applicable laws in the area of land-use planning and the obligation to guarantee the enjoyment by the area's residents of a healthy and ecologically balanced environment, given the health consequences arising from the nature of the sanitary problem affecting them. Despite being fully aware of the problem affecting the residents of its canton, the Municipalidad de Upala has limited itself to acknowledging its existence and evading its responsibility, without taking timely action to mitigate or control it.
Likewise, consideration must be given to the opinion already issued by the Procuraduría General de la República in C-257-2003, San José, 27 August 2003 (consistent with the substantive assessment made by the Sala Constitucional in case file 16-002436-0007-CO, resolution 2016-006368) regarding the requirement to verify the technical suitability of sewage treatment plants (plantas de tratamiento de aguas negras) by AyA and the Ministerio de Salud. In this regard, the aforementioned opinion states:
(…) PRAYER FOR RELIEF Based on the foregoing statements of fact and law, this report is hereby submitted and the corresponding evidence is provided. It is expressly stated that the actions of the Instituto Costarricense de Acueductos y Alcantarillados are in conformity with the law and with the fulfillment of its institutional purposes, as well as in due compliance with the applicable legal framework. It is thus evident that no constitutional norms, guarantees, or principles have been violated; rather, AyA has acted responsibly, within the scope of its competencies. Accordingly, it is requested that the writ filed against AyA in all its claims be declared WITHOUT MERIT."
The opinion is drafted by Magistrate Araya García; and,
Considering:
I.Preliminary Matter. Before analyzing the merits of the case—regarding the alleged violation of the right to a prompt and effective proceeding—it should be clarified that, beginning with Judgment No. 2008-02545 of 8:55 a.m. on February 22, 2008, this Chamber has referred to the administrative-law jurisdiction (jurisdicción contencioso administrativa)—with some exceptions—those matters in which the question is whether a public administration has or has not complied with the time limits established by the Ley General de la Administración Pública (Articles 261 and 325) or by sector-specific laws governing special administrative proceedings, for the purpose of resolving by a final administrative act (acto final) an administrative proceeding—initiated ex officio or at a party's request—or deciding upon the applicable administrative remedies. Precisely, this case presents an exceptional circumstance, as it concerns environmental complaints and situations that, allegedly, have not been resolved within a reasonable period by the respondent authorities. Having clarified this point, the Court proceeds to address the specific situation raised in this writ of amparo (amparo).
II.Subject of the petition. The petitioner (recurrente) alleges violations of the fundamental rights of 240 families of Urbanización Don Chú in Upala, stating that this social-housing development (Urbanización de Bien Social) suffers from severe unsanitary conditions due to the lack of an adequate wastewater treatment system, resulting in illegal discharges and serious public health risks. She asserts that the respondent institutions have failed to coordinate adequately to achieve a solution to said problems.
III.Established facts. The following facts are considered duly established as material to the decision in this matter, either because they have been proven or because the respondent (recurrido) failed to address them as required by the initial order (auto inicial):
Furthermore, very unpleasant odors are detected from the sidewalk and road. On the other hand, the number of occupants in some dwellings exceeds 6 inhabitants, which is typically considered the maximum occupancy when designing a septic tank (tanque séptico) and infiltration system (sistema de infiltración) for a social-housing unit. 8. Recommendations. The situations observed, to the extent they represent problems that may affect people's health, fall within the competencies of the Ministry of Health, which is responsible for guaranteeing and taking preventive actions in the interest of public health and on the basis of Articles 1, 2, 4, 7, 8, 39, 285, 286, 340, 341, 355, and 356 of the Ley General de la Salud" (see reports submitted and evidence on file).
It was observed that wastewater—which should be stormwater—flows from inside the dwellings into the stormwater conveyance system, making it impossible for the Municipality to carry out an intervention using its own budget to reverse this situation. However, the Municipality can implement awareness-raising and educational programs for property owners to improve the conditions of their infrastructure. In accordance with point 2 in official letter PRE-2021-00617 of May 24, 2021, AyA explains the planning process, which involves a series of phases resulting in a Master Plan (Plan Maestro) for a wastewater sanitation system in the center of Upala. While a master plan does exist from 10 years ago, the urban dynamics have changed sufficiently to warrant a completely new study—one that may use the existing plan as a basis but requires a budget that the Municipality currently does not have, hence the importance of support from AyA or any other entity that may participate in updating the Plan, which must include pre-feasibility and feasibility (prefactibilidad y factibilidad) phases, given the topographic, biophysical, and economic conditions of the canton. 4.
Finally, in order to comply with what was requested in the sanitary order, an action plan is included that incorporates measures aimed at improving wastewater treatment within the dwellings, with corresponding execution dates, and also incorporates—at the request of the residents of Barrio Don Chú—an urban intervention plan involving community participation and municipal budget resources" (see reports submitted and evidence on file).
As explained by AyA in official letter PRE-2021-00617 of May 24, 2021, a comprehensive solution is required that includes a system capable of collecting, conveying, and treating wastewater, and not merely a treatment system. Furthermore, this comprehensive solution is needed not only in Barrio Don Chú but throughout the urban center of Upala. 2. It was observed that wastewater—which should be stormwater—flows from inside the dwellings into the stormwater conveyance system, making it impossible for the Municipality to carry out an intervention using its own budget to reverse this situation. However, the Municipality can implement awareness-raising and educational programs for property owners to improve the conditions of their infrastructure. 3. In accordance with point 2 in official letter PRE-2021-00617 of May 24, 2021, AyA explains the planning process, which involves a series of phases resulting in a Master Plan for a wastewater sanitation system in the center of Upala.
While a master plan does exist from 10 years ago, the urban dynamics have changed sufficiently to warrant a completely new study—one that may use the existing plan as a basis but requires a budget that the Municipality currently does not have, hence the importance of support from AyA or any other entity that may participate in updating the Plan, which must include pre-feasibility and feasibility phases, given the topographic, biophysical, and economic conditions of the canton. 4. Finally, in order to comply with what was requested in the sanitary orders, an action plan was submitted that incorporates measures aimed at improving wastewater treatment within the dwellings, with corresponding execution dates, and also incorporates—at the request of the residents of Barrio Don Chú—an urban intervention plan involving community participation and municipal budget resources" (see reports submitted and evidence on file).
In addition, the following was agreed upon: 1. The Municipality will form a commission or technical team to address the matter. 2. Once the commission is formed, the action plan will be updated. 3. The Municipality will request an extension from the Ministry of Health for compliance with the updated action plan. 4. With the collaboration of the Ministry of Health, informational materials will be created and distributed to the population. 5. The officials responsible for the matter at the Instituto Costarricense de Acueductos y Alcantarillados (AyA) must be convened to provide technical advice and any relevant assistance. 6. All of the foregoing will be carried out in the short term. 7. The Health Regulatory Area of Upala must follow up on the steps and actions taken by the commission. Both the Municipality of Upala and AyA complied with sanitary orders ARS-U-OS-028-2021, ARS-U-OS-029-2021, and ARS-U-OS-030-2021, as both institutions submitted to the Health Regulatory Area of Upala what was ordered therein.
However, the proposed action plan has not been implemented (…) 8. CONCLUSION No comprehensive solution to the wastewater problem in Urbanización Don Chú has yet been achieved; consequently, wastewater (mainly greywater (aguas grises)) continues to be discharged into the curb-side drainage channel (cordón de caño) without any treatment. The Municipality of Upala has carried out some of the actions established in an action plan; however, that plan must be updated, a commission or technical team must be formed, and the corresponding steps must continue, with the collaboration of AyA. 9. RECOMMENDATIONS TO THE HEALTH REGULATORY AREA. The Director of the Health Regulatory Area of Upala must consult with higher levels of the Ministry of Health to determine the steps to be taken in this case, in light of the repeated failure to comply with the corrective action plan under sanitary orders ARS-U-OS-028-2021 and ARS-U-OS-029-2021" (see reports submitted and evidence on file).
According to the administrative file and information provided by municipal officials, the following is noted: 1. The Municipality formed a commission or technical team to address the matter; however, no official communication has been provided regarding its membership or the actions taken. 2. The action plan has not been updated. 3. No extension was requested from the Ministry of Health for compliance with the updated action plan. 4. With the collaboration of the Ministry of Health, informational materials were created and distributed to the population on June 6, 2024 (Barrio Matadero, Las Palmas, San Juan, La Carpa, and Los Ángeles); however, Barrio Don Chú was not included. 5. The officials responsible for the matter at the Instituto Costarricense de Acueductos y Alcantarillados (AyA) have not been convened to provide technical advice and any relevant assistance to the Municipality. In general, the agreements reached at the meeting of March 18, 2024, have not been fulfilled; therefore, the corrective action plan set out in official letters DAMU-0496-06-2021 and DCU-OF-013-2024, pursuant to sanitary orders ARS-U-OS-028-2021 and ARS-U-OS-029-2021, has not been complied with (…) 8.
CONCLUSION No comprehensive solution to the wastewater problem in Urbanización Don Chú has yet been achieved; consequently, wastewater (mainly greywater) continues to be discharged into the curb-side drainage channel without any treatment. In this way, the corrective action plan set out in official letters DAMU-0496-06-2021 and DCU-OF-013-2024, pursuant to sanitary orders ARS-U-OS-028-2021 and ARS-U-OS-029-2021, has not been complied with. 9. RECOMMENDATIONS TO THE HEALTH REGULATORY AREA. The Director of the Health Regulatory Area of Upala must consult with higher levels of the Ministry of Health to determine the steps to be taken in this case, in light of the repeated failure to comply with the corrective action plan under sanitary orders ARS-U-OS-028-2021 and ARS-U-OS-029-2021" (see reports submitted and evidence on file).
To date, there is no comprehensive solution to the existing wastewater problem at Urbanización Don Chú, and as a result, wastewater (primarily greywater (aguas grises)) is being discharged into the drainage channel (cordón de caño) without any treatment. This constitutes non-compliance with the corrective action plan submitted in memoranda DAMU-0496-06-2021 and DCU-OF-013-2024, pursuant to health orders ARS-U-OS-028-2021 and ARS-U-OS-029-2021. In light of the foregoing, this matter will be escalated to higher levels for appropriate assessment and any further action that may be warranted." The foregoing was communicated to the Municipality of Upala on March 7, 2025 (see the reports submitted and the evidence provided).
CONCLUSION AND RECOMMENDATIONS. Based on the results obtained from the analysis of the applicable regulations and the actions taken by DARS Upala regarding the case in question, it is concluded that health orders ARS-U-OS-028-2021 and ARS-U-OS-029-2021 have not been fully complied with, leaving unresolved the public health problem represented by the discharge of wastewater onto the public right-of-way from Urbanización Don Chú in Upala. In light of the foregoing, it is recommended to the Director of the Governing Health Area of Upala that the Municipality of Upala, the representatives of the commission that was formed, and the officials of this regional office—Ing. Carlos Morales Camacho and Licda. Laura Rodríguez Corrales—be convened, so that on that same day the wastewater commission may be formally established, the stakeholders who will compose it may be identified, and the plan of actions to be carried out may be defined." (see the reports submitted and the evidence provided).
However, it was made clear that the actions carried out have been minimal and that the public health problem persists, as no concrete solutions have been implemented. As a result, the following compliance commitments were established on the part of the Municipality of Upala: (…) By Thursday, June 5, 2025, the Municipality must submit a detailed report containing the official document establishing the Inter-institutional Wastewater Commission for the canton of Upala, evidencing the participation of the Municipality, the Ministry of Health, and AyA. In addition, the report must include the specific actions taken regarding the problem, along with an updated Master Sanitation Plan (Plan Maestro de Saneamiento) for Upala. In light of the foregoing, the request for an extension is not granted. Nevertheless, we remain attentive to the submission of the report agreed upon at the meeting of May 24, 2025, as requested by the regional level." The foregoing was communicated to the Municipality of Upala on June 10, 2025 (see the reports submitted and the evidence provided).
Homeowners are directly responsible for the proper management of their own wastewater, as required by the Ley General de Salud and the other decrees cited. If the Municipality has already carried out corrective works, it can demonstrate that it complied with the health order through the implementation of an action plan, execution of the works, and subsequent follow-up. Specifically, it can demonstrate that the infrastructure fulfills its purpose (draining stormwater) but may have been misused by third parties (residents connecting sewage lines). That it lacks the competency or coercive authority to sanction those property owners on health matters (which is the function of the Ministry of Health). Although the Ministry may argue that the sanitary problem has not been resolved, if the cause is external (illegal connections), the Municipality cannot be held responsible for omission when, lacking sanctioning powers in public health matters, it cannot compel property owners to carry out internal works in their homes, much less intervene with public funds in such works.
It is recommended to document everything that has been executed, attach the originally submitted action plan, attach public procurement contracts for the works, service orders, before-and-after photographs, and technical reports from the Road Management Department; and to attach technical reports (from the municipal engineer or contractor) indicating that the stormwater infrastructure is functioning properly. To submit a detailed report with a timeline for the execution of works and their completion date. To disclaim liability for the actions of third parties by stating in writing that any possible overflow of other wastewater (sewage) is not attributable to defects in the stormwater infrastructure, but rather to irregular actions by neighbors, and that the Ministry of Health, in accordance with its powers, should take action against violators. It is reiterated once again that the Municipality does not have the legal competency to intervene in the internal sanitary installations of residences.
To request closure for compliance with the sanitary procedure, or archiving of the matter, on the grounds that the health order was fully complied with by the Municipality, as well as to request the archiving of the administrative file or modification of the health order, by formally addressing the relevant area of the Ministry of Health." (see the reports submitted and the evidence provided).
aa) On November 21, 2025, the pending resolution was notified to the Ministry of Health and to the Costa Rican Institute of Aqueducts and Sewers (see notification records).
bb) By means of MEMORANDO No. SG-GSP-RT-2025-00172, dated November 24, 2025, the representative of the UEN Recolección y Tratamiento Periféricos of the Costa Rican Institute of Aqueducts and Sewers established the following: "Technical Conclusions 1. The project does not fall within the service coverage area of AyA, specifically of Peripheral Systems, as the Municipality of Upala is the water supply service operator in the area. 2. In accordance with the water cycle principle, the drinking water supply operator must also assume responsibility for sanitation. 3. The Municipality of Upala is the competent authority to approve urban development and to require a wastewater collection and treatment solution. 4. The Ministry of Health regulates, but does not operate sanitation systems. 5. AyA collaborates exclusively in its regulatory and advisory role, under the principle of inter-institutional coordination." (see the reports submitted and the evidence provided).
That prior to the legal opinion, the Municipality carried out actions oriented toward the well-being of the community, without intervening in private sanitary systems or assuming competencies belonging to others. 4. That following the 2025 legal opinion, the Municipality has maintained a full disposition to collaborate, limited strictly to its technical and administrative functions. 5. That no municipal action recorded in the file entails the exercise of competencies in the area of treatment, regulation, oversight, or sanitary intervention—functions that belong to the Ministry of Health. 6. That all requested information is duly systematized, with a folio-numbered and chronologically ordered file, ready to be used by Legal Management (Gestión Jurídica) in the preparation of the corresponding legal report to the Constitutional Chamber (Sala Constitucional). 7. That according to the first paragraph of the fifth page of memorandum MU-GJ-OFIC-0041-2025, reference is made to the Chamber's order 'to design, concretize, and finance a comprehensive solution to the wastewater treatment problem in Urbanización Don Chú, within a period of 8 months'—processes in which this commission has no authority to carry out any of those actions." (see the reports submitted and the evidence provided).
dd) On December 2, 2026, the pending resolution was notified to the Municipality of Upala (see notification record).
V.On the right to a healthy and ecologically balanced environment. It must be stated, in the first place, that the fundamental rights to health and to a healthy and ecologically balanced environment are recognized in the Constitution (articles 21, 50, 73, and 89 of the Constitución Política), as well as through the international legal instruments applicable in Costa Rica. In this regard, in judgment no. 2006-005928 of 15:00 hours on May 2, 2006, reiterated in judgment no. 2023-008920 of 09:20 hours on April 21, 2023, this Court ruled:
"The right to life recognized in article 21 of the Constitution is the cornerstone upon which all other fundamental rights of the inhabitants of the republic rest. Likewise, the right to health also finds its basis in that same provision of the Constitution, since life is inconceivable if the human person is not guaranteed the minimum conditions for an adequate and harmonious psychic, physical, and environmental balance. Now, public health and the right to a healthy and ecologically balanced environment are constitutionally recognized in articles 21, 50, 73, and 89 of the Constitución Política. Specifically, article 50 of the Constitution expressly recognizes the right of all inhabitants of the country to enjoy a healthy and perfectly balanced environment. That right is a fundamental guarantee for the protection of life and public health. In support of this, this Court has resorted to the notion of 'environmental quality' as a parameter, precisely, of people's quality of life, which is combined with other elements such as health, food, employment, and housing, reflecting the principle that every person has the right to make use of the environment for their own development, but not in an unlimited manner, since there also exists a duty to protect and preserve the environment for present and future generations—the principle of sustainable development." Likewise, from article 50 of the Constitución Política derives the State's obligation to protect the environment.
That provision establishes to that effect: "The State shall seek the greatest well-being for all inhabitants of the country, organizing and stimulating production and the most equitable distribution of wealth. Every person has the right to a healthy and ecologically balanced environment. For this reason, they are entitled to report acts that infringe upon that right and to claim reparation for damages caused. The State shall guarantee, defend, and preserve that right. The law shall determine the corresponding responsibilities and sanctions." This confirms that the various public authorities have the inescapable duty to preserve, defend, and guarantee every person's fundamental right to health and to a healthy and ecologically balanced environment.
VI.The coordination among public agencies for the protection of the environment. On various occasions, constitutional case law has indicated that the protection of the environment is a task that falls equally upon everyone; that is, there exists an obligation for the State—as a whole—to take the necessary measures to protect the environment, in order to prevent levels of pollution, deforestation, extinction of flora and fauna, or excessive or improper use of natural resources that would endanger the health of those subject to its jurisdiction. In this task, the term "public institution" must be understood to encompass both the central administration and the decentralized administration. It might therefore be thought that this multiple responsibility would produce chaos in public administration; however, this is not the case, since in order to prevent the simultaneous coexistence of spheres of power of different origin and nature, the duplication of efforts, and the confusion of rights and obligations among the various parties involved, it is necessary to establish a series of coordination relationships among the various agencies of the Executive Branch and the decentralized institutions, so as to enable them to carry out the functions entrusted to them.
This Court has previously—and quite clearly—addressed the principle of coordination among public agencies. Coordination is the ordering of relationships among these various independent activities, which takes account of their convergence upon the same object or entity in order to make it useful for an overall public plan, without suppressing the mutual independence of the acting subjects. Since there is no hierarchical relationship between decentralized institutions and the principal public entity, it is not possible to impose particular conduct upon them; this gives rise to the indispensable inter-institutional "concert," in the strict sense, in which the autonomous and independent centers of action reach agreement on that preventive and overall framework, in which each one fulfills a role with a view to a mission entrusted to the others.
Thus, relationships with public authorities can only be conducted on a plane of equality, yielding agreed-upon forms of coordination, to the exclusion of any form of imposition detrimental to their autonomy—a form that would allow corporate entities to be subjected to a coordination framework without or against their will; but which does permit the necessary subordination of these entities to the State and in the State's interest (through the State's administrative oversight, and specifically, in its function of reviewing legality, which falls within its purview, with general supervisory powers over the entire public sector) (see in that regard judgments no. 21258-2010 of 14:00 hours on November 22, 2010, no. 2913-2011 of 12:00 hours on March 4, 2011, and no. 2023-008920 of 09:20 hours on April 21, 2023).
VII.On the merits. After analyzing the evidentiary elements submitted, this Tribunal finds a violation of the fundamental rights of the protected parties (amparados). This is established because, in the reports filed by the representatives of the respondent authorities—deemed sworn statements, with the consequences, including criminal ones, set forth in article 44 of the Law governing this Jurisdiction—and in the evidence submitted for resolution of this matter, it has been duly established that Urbanización Don Chú is a Social Housing Development (Urbanización de Bien Social) comprising 240 dwellings, located in the first district of the canton of Upala, Alajuela. By means of report MS-DRRCH-URS-IT-0147-20 of 17 December 2020, the Health Regulatory Unit (Unidad de Rectoría de la Salud) of the Chorotega Region of the Ministerio de Salud communicated to the Área Rectora de Salud of Upala the following: "(…) it is concluded that the wastewater (aguas residuales), consisting primarily of domestic wastewater (aguas servidas) from laundry sinks, washing machines, and showers of the dwellings that make up Urbanización Don Chú, is being discharged into the public drainage channels (caños públicos) and routed into the stormwater drain (alcantarilla pluvial), causing environmental contamination and a risk to public health.
(…) In addition, very unpleasant odors are perceptible from the sidewalk and the roadway (…)". On 26 February 2021, the Área de Salud of Upala issued sanitary order (orden sanitaria) no. ARS-U-OS-028-2021, directing the mayor of the Municipalidad de Upala to: "1. Submit to the Área Rectora de Salud of Upala a corrective action plan (plan de acciones correctivas) for the installation and operation of a wastewater treatment system (sistema de tratamiento de aguas residuales) with optimal capacity, providing a comprehensive solution to the wastewater problem at Urbanización Don Chú, located in the first district of the canton of Upala. Said plan must include a schedule of the activities to be carried out and the timeline for their implementation, detailing the start and end dates of each activity and the person responsible for its execution. 2. The design, installation, and operation of the wastewater treatment system must be carried out in compliance with applicable technical regulations, and the respective permits and authorizations must be obtained from the competent institutions, as applicable." Notification date: 01 March 2021; expiration date: 27 May 2021.
On 26 February 2021, the Área de Salud of Upala issued sanitary order no. ARS-U-OS-029-2021, directing the president of the Council (Concejo) of the Municipalidad de Upala to: "1. Submit to the Área Rectora de Salud of Upala a corrective action plan for the installation and operation of a wastewater treatment system with optimal capacity, providing a comprehensive solution to the wastewater problem at Urbanización Don Chú, located in the first district of the canton of Upala. Said plan must include a schedule of the activities to be carried out and the timeline for their implementation, detailing the start and end dates of each activity and the person responsible for its execution. 2. The design, installation, and operation of the wastewater treatment system must be carried out in compliance with applicable technical regulations, and the respective permits and authorizations must be obtained from the competent institutions, as applicable." Notification date: 01 March 2021; expiration date: 27 May 2021.
On 26 February 2021, the Área de Salud of Upala issued sanitary order no. ARS-U-OS-030-2021, directing the Executive President of the Instituto Costarricense de Acueductos y Alcantarillados to: "1. Submit to the Área Rectora de Salud of Upala a corrective action plan for the installation and operation of a wastewater treatment system with optimal capacity, providing a comprehensive solution to the wastewater problem at Urbanización Don Chú, located in the first district of the canton of Upala. Said plan must include a schedule of the activities to be carried out and the timeline for their implementation, detailing the start and end dates of each activity and the person responsible for its execution. 2. The design, installation, and operation of the wastewater treatment system must be carried out in compliance with applicable technical regulations, and the respective permits and authorizations must be obtained from the competent institutions, as applicable." Notification date: 01 March 2021; expiration date: 27 May 2021.
By means of official letter no. PRE-2021-00617 of 24 May 2021, the Executive President of the Instituto Costarricense de Acueductos y Alcantarillados notified the Área de Salud of Upala and the Municipalidad de Upala that in 2010 the document "Plan Maestro para los Sistemas de Abastecimiento de Agua y Saneamiento de Upala, Alajuela" was submitted to the Municipalidad de Upala, and that it was to be implemented by the Municipality as the authorized public service operator (ente operador público) within the canton over a period of 10 years; that period had elapsed and, at that time, the cost was 4.5 million dollars. That same document sets out the steps the municipality must follow to begin the project, with AyA advising the process. By means of official letter no. DAMU-0400-05-2021 of 26 May 2021, the mayor of the Municipalidad de Upala requested that the Área Rectora de Salud of Upala grant an extension (prórroga) to sanitary order ARS-U-OS-030-2021 (sic).
By means of official letter MS-DRRSCH-DARSU-421-2021 of 08 June 2021, the Área de Salud of Upala notified the mayor of the Municipalidad de Upala that "a thirty-day extension is granted as of 28 May 2021." This was communicated to the Municipalidad de Upala on 10 June 2021. On 09 February 2022, the Área de Salud of Upala received an unnumbered letter signed by Mr. Gerardo Fonseca Obando and by residents of Urbanización Don Chú, reporting the contamination problem in the drainage channels caused by wastewater, the lack of maintenance by the municipality, and unpleasant odors, and requesting that the necessary steps be taken to eliminate the problem. By means of official letter MS-DRRSCH-DARSU-057-2022 of 17 February 2022, the director of the Área de Salud of Upala informed the complaining residents that the complaint would be forwarded to the Municipalidad de Upala. On 19 June 2023, the Municipalidad de Upala communicated to the Área Rectora de Salud of Upala official letter no. DAMU-0496-06-2021, which states the following: "(…) a comprehensive solution is required that encompasses a system capable of collecting, conveying, and treating wastewater—not merely a treatment system.
Furthermore, this comprehensive solution is needed not only in Barrio Don Chú but throughout the entire urban center of Upala. It was observed that the conveyance of what should be stormwater instead carries domestic wastewater from inside the dwellings through the stormwater conveyance system, which makes it impossible for the Municipality to intervene using its own budget to reverse this situation (…) In accordance with item 2 of official letter PRE-2021-00617 of 24 May 2021, AyA explains the planning process, which involves a series of phases leading to a Master Plan (Plan Maestro) for a wastewater sanitation system (saneamiento) in the center of Upala (…) 4. Finally, in order to comply with what is required by the sanitary order, an action plan is included that incorporates measures aimed at improving the treatment of wastewater within the dwellings, with their respective implementation dates; it also incorporates, at the request of residents of Barrio Don Chú, an urban intervention plan involving citizen participation and municipal budget resources." By means of technical inspection report (oficio técnico de inspección) no. RCH-ARSU-ERS-IT-271-2024 of 19 March 2024, the Health Regulation Team (Equipo Regulación de la Salud) of the Área Rectora de Salud of Upala communicated to the director of that Health Area the following: "On 18 March 2024, officials of the Área Rectora de Salud of Upala were convened to participate in a meeting with officials of the Municipalidad de Upala to address the matter.
At that meeting, a summary of the problem was presented, the status of compliance with the action plan previously submitted by the Municipalidad de Upala in official letter DAMU-0496-06-2021 was discussed, and the administration's difficulties in constructing a wastewater treatment plant for the urbanization were addressed, given that the problem essentially extends throughout the entire central district and the budget available for construction of a treatment plant is insufficient. In addition, the following agreements were reached: 1. The Municipality will form a commission or technical team to address the matter. 2. Once the commission is formed, the action plan will be updated. 3. The Municipality will request from the Ministerio de Salud an extension for compliance with the updated action plan. 4. With the collaboration of the Ministerio de Salud, informational materials will be created for distribution to the community. 5.
The officials responsible for this matter at the Instituto Costarricense de Acueductos y Alcantarillados (AyA) must be convened to provide technical advice and any relevant assistance. 6. All of the foregoing will be carried out in the short term. 7. The Área Rectora de Salud Upala must monitor the efforts and actions taken by the commission. Both the Municipalidad de Upala and AyA complied with sanitary orders ARS-U-OS 2021, ARS-U-OS-029-2021, and ARS-U-OS-030-2021, since both institutions submitted to the Área Rectora de Salud of Upala the documents required therein. However, the proposed action plan has not been implemented (…) 8. CONCLUSION No comprehensive solution to the wastewater problem at Urbanización Don Chú has yet been achieved; consequently, wastewater (primarily grey water (aguas grises)) continues to be discharged into the roadside drainage channel (cordón de caño) without any treatment.
The Municipalidad de Upala has carried out some of the actions set out in the action plan; however, that plan must be updated, a commission or technical team must be formed, and the relevant procedures must continue, with the collaboration of AyA. 9. RECOMMENDATIONS TO THE ÁREA RECTORA DE SALUD. The director of the Área Rectora de Salud Upala must monitor the updated action plan submitted by the Municipalidad de Upala, which must be implemented in the short term in order to achieve a comprehensive solution to the wastewater problem at Urbanización Don Chú (…)."
From the foregoing, it is evident—as reflected in the findings of that Ministerio de Salud meeting—that both the Municipalidad de Upala and ICAA partially complied with sanitary orders ARS-U-OS-028-2021, ARS-U-OS-029-2021, and ARS-U-OS-030-2021, since both institutions submitted to the Área Rectora de Salud of Upala the documents required therein. However, the proposed action plan has not been implemented, and consequently a comprehensive solution to the wastewater problem at Urbanización Don Chú has not been achieved.
Furthermore, by means of technical inspection report no. RCH-ARSU-ERS-IT-029-2025 of 20 January 2025, the Health Regulation Team of the Área Rectora de Salud of Upala communicated to the director of that Health Area the following: "To monitor the corrective action plan submitted by municipal officials in official letters DAMU-0496-06-2021 and DCU-OF-013-2024 (…) Inspection date: 15 January 2025. 6. INSPECTION RESULTS (FINDINGS) (…) Based on the administrative file and information provided by municipal officials, the following is noted: 1. The Municipality formed a commission or technical team to address the matter; however, there has been no official notification of its members or of the actions taken. 2. The action plan has not been updated. 3. No extension was requested from the Ministerio de Salud for compliance with the updated action plan. (…) 5. The officials responsible for this matter at the Instituto Costarricense de Acueductos y Alcantarillados (AyA) have not been convened to provide technical advice and relevant assistance to the Municipality.
In general, the agreements reached at the meeting of 18 March 2024 have not been fulfilled; therefore, the corrective action plan submitted in official letters DAMU-0496-06-2021 and DCU-OF-013-2024, pursuant to sanitary orders ARS-U-OS-028-2021 and ARS-U-OS-029-2021, has not been complied with (…) 8. CONCLUSION No comprehensive solution to the wastewater problem at Urbanización Don Chú has yet been achieved; consequently, wastewater (primarily grey water) continues to be discharged into the roadside drainage channel without any treatment. This constitutes non-compliance with the corrective action plan submitted in official letters DAMU-0496-06-2021 and DCU-OF-013-2024, pursuant to sanitary orders ARS-U-OS-028-2021 and ARS-U-OS-029-2021. 9. RECOMMENDATIONS TO THE ÁREA RECTORA DE SALUD. The director of the Área Rectora de Salud Upala must consult with senior levels of the Ministerio de Salud to determine what actions to take in this case, given the repeated non-compliance with the corrective action plan pursuant to sanitary orders ARS-U-OS-028-2021 and ARS-U-OS-029-2021." By means of official letter no. MS-DRRSCH-DARSU-0092-2025 of 26 February 2025, the Área de Salud of Upala communicated to the mayor of the Municipalidad de Upala the following: "(…) In the follow-up conducted by the health regulation team, it is evident that the agreements reached at the meeting of 18 March 2024 have not been fulfilled; therefore, the corrective action plan submitted in official letters DAMU-0496-06-2021 and DCU-OF-013-2024, pursuant to sanitary orders ARS-U-OS-028-2021 and ARS-U-OS-029-2021, has not been complied with.
At present, no comprehensive solution to the wastewater problem at Urbanización Don Chú has been achieved; consequently, wastewater (primarily grey water) continues to be discharged into the roadside drainage channel without any treatment. This constitutes non-compliance with the corrective action plan submitted in official letters DAMU-0496-06-2021 and DCU-OF-013-2024, pursuant to sanitary orders ARS-U-OS-028-2021 and ARS-U-OS-029-2021. In light of the foregoing, the matter will be elevated to higher authorities for their respective assessment and further action." This was communicated to the Municipalidad de Upala on 07 March 2025. By means of CARTA-MS-DRRSCH-DARSU-0118-2025 of 18 March 2025, the Área Rectora de Salud of Upala communicated to the Chorotega Regional Directorate of the Ministerio de Salud the following: "The technical report referenced in the subject line is hereby forwarded.
It is being transferred for assessment and guidance on the actions to be taken, given that since 2021, when those sanitary orders were issued, and despite outreach, follow-up, and agreements, the Municipalidad de Upala has not complied in a timely and proper manner; as a result, a comprehensive solution to the serious wastewater problem in the community of Don Chú has not been achieved. We request prompt intervention." By means of report MS-DRRSCH-URS-IT-14-2025 (in response to CARTA MS-DRRRSCH-DARSU-0018-20225) of 27 March 2025, the representatives of the Health Regulatory Unit of the Chorotega Region established the following: "(…): a. To date, there is clear non-compliance with the corrective action plan submitted by the Municipalidad de Upala, as well as non-compliance with the agreements reached at the in-person meeting of 18 March with the Municipality (…) The problem of the illegal discharge of wastewater into the public right-of-way at Urbanización Don Chú in Upala has not been resolved, affecting public health. 7.
CONCLUSION AND RECOMMENDATIONS (…) it is concluded that sanitary orders ARS-U-OS-028-2021 and ARS-U-OS-029-2021 have not been fully complied with, leaving unresolved the public health problem represented by the discharge of wastewater into the public right-of-way originating from Urbanización Don Chú in Upala." On 24 April 2025, a meeting was held with Lic. Laura Rodríguez, coordinator of the health regulation process at the Chorotega regional level, and officials of the Área Rectora de Salud of Upala and the Municipalidad de Upala, where guidance was once again provided on the topics of follow-up and documentation of actions taken, the importance of the inter-institutional commission (comisión interinstitucional), the preparation of a master plan, legal aspects and easements (servidumbres), and the coordination of files and communications between institutions. In addition, the following agreement was reached: the Municipalidad de Upala would submit a detailed report no later than 05 June 2025, containing the official composition of the Inter-Institutional Wastewater Commission (Comisión Interinstitucional de Aguas Residuales) of the canton of Upala, with participation from representatives of the Municipality (as process leader), AyA, and the Ministerio de Salud (at the regional and local levels), and that would include concrete actions with respect to the problem.
By means of official letter no. MU-ALM-OFIC-853-2025 of 04 June 2025, the mayor of the Municipalidad de Upala requested that the Área Rectora de Salud of Upala grant an "extension of sanitary order ARS-U-OS-028-2021, in order to update the action plan and be able to continue with the process in a timely and proper manner." By means of official letter no. CARTA-MS-DRRSCH-DARSU-0224-2025 of 10 June 2025, the Área Rectora de Salud of Upala communicated to the mayor of the Municipalidad de Upala the following: "In response to your request, (…) we inform you that it is not possible to grant an extension for an order whose deadline has already expired, for the following reasons (…) it was explained that sanitary order ARS-U-OS-028-2021 is considered to have been complied with as regards the submission of the Action Plan. However, it was made clear that the actions carried out have been minimal, and that the public health problem persists, since no concrete solutions have been implemented (…) Given the foregoing, the request for an extension cannot be granted.
We nonetheless remain attentive to the submission of the report agreed upon at the meeting of 24 May 2025, as requested by the regional level." By means of official letter no. MU-GJ-CL-18-2025 of 12 June 2025, the legal officer of the Municipalidad de Upala communicated to the Territorial Development coordinator of that same municipality the following: "Subject: Legal opinion regarding sanitary order ARS-U-OS-028-2021 issued by the Ministerio de Salud, as requested through official letter MU-CTE-OFIC-004-2025 (…) IV. RECOMMENDATION. Based on the cited regulations and in accordance with the principle of legality (principio de legalidad), the Municipalidad de Upala has the obligation to comply with those sanitary orders issued by the Ministerio de Salud that are consistent with Municipal competencies. The Costa Rican legal framework establishes that Municipalities are responsible for constructing and maintaining stormwater infrastructure (infraestructura pluvial) (i.e., rainwater drainage), not for other types of wastewater, such as sewage (aguas negras).
The Ministerio de Salud and AyA are the competent bodies for regulating, overseeing, and sanctioning improper wastewater discharges. Homeowners are directly responsible for the proper management of their wastewater, as mandated by the Ley General de Salud and the other Decrees cited. If the Municipality has already carried out corrective works, it can demonstrate compliance with the sanitary order through the implementation of an action plan, completion of the works, and follow-up. It should demonstrate that the infrastructure fulfills its purpose (draining stormwater) but may have been misused by third parties (residents connecting sewage lines). That the Municipality has no competence or coercive powers to sanction those property owners on public health grounds (which is the function of the Ministerio de Salud). Although the Ministerio de Salud may allege that the sanitary problem has not been resolved, if the cause is external (illegal connections), the Municipality cannot be held responsible for omission if, lacking sanctioning powers (potestades sancionatorias) in public health matters, it cannot compel homeowners to carry out internal works in their dwellings, let alone intervene with public funds in them.
It is recommended to document everything that has been carried out, to attach the originally submitted action plan, to attach public procurement contracts for the works, service orders, before-and-after photographs, and technical reports from the Road Management Department (Departamento de Gestión Vial), together with technical reports (from the municipal engineer or contractor) indicating that the stormwater infrastructure is functioning correctly. To submit a detailed report with a works implementation schedule and completion date. To distance the Municipality from liability for the actions of third parties by stating in writing that any possible overflow of other wastewater (sewage) is not attributable to defects in the stormwater infrastructure but to irregular actions by residents, and that it is the Ministerio de Salud, pursuant to its powers, that should take action against violators.
It is reiterated once again that the Municipality has no legal competence to intervene in the internal sanitary installations of dwellings. To request closure for compliance with the sanitary procedure or archiving of the file, on the grounds that the sanitary order was fully complied with by the Municipality; and to request that the administrative file be archived or the sanitary order be modified, through a formal communication to the relevant department of the Ministerio de Salud." By means of MEMORANDO No. SG-GSP-RT-2025-00172 of 24 November 2025, the representative of the Peripheral Collection and Treatment Business Unit (UEN Recolección y Tratamiento Periféricos) of the Instituto Costarricense de Acueductos y Alcantarillados established the following: "Technical Conclusions 1. The project does not fall within the service coverage area of AyA, specifically of Sistemas Periféricos (Peripheral Systems), since the Municipalidad de Upala is the drinking water service operator in the area. 2.
In accordance with the water cycle (ciclo del agua) principle, the entity responsible for water supply must also assume responsibility for sanitation. 3. The Municipalidad de Upala is the competent authority for approving urban development and for requiring a wastewater collection and treatment solution. 4. The Ministerio de Salud regulates but does not operate sanitation systems. 5. AyA collaborates solely in its regulatory and advisory role, pursuant to the principle of inter-institutional coordination." From the foregoing, it is reiterated that it is evident that both the Municipalidad de Upala and ICAA partially complied with sanitary orders ARS-U-OS-028-2021, ARS-U-OS-029-2021, and ARS-U-OS-030-2021, since both institutions submitted to the Área Rectora de Salud of Upala the documents required therein. However, the proposed action plan has not been implemented, and consequently a comprehensive solution to the wastewater problem at Urbanización Don Chú has not been achieved.
In other words, sanitary orders ARS-U-OS-028-2021, ARS-U-OS-029-2021, and ARS-U-OS-030-2021 remain unfulfilled in their entirety. On this point, it is confirmed that there is indeed a wastewater problem at Urbanización Don Chú, since wastewater is being discharged into the public drainage channels and routed into the stormwater drain, causing environmental contamination, unpleasant odors, and a risk to public health. Accordingly, despite the fact that the situation has been known since 2020, a comprehensive solution to the wastewater problem at Urbanización Don Chú has still not been achieved; consequently, wastewater (primarily grey water) continues to be discharged into the roadside drainage channel without any treatment, confirming the environmental contamination problem.
Moreover, this Tribunal considers that there has been a lack of coordination among the 3 respondent authorities, which has led to the current situation of environmental contamination and the absence of a comprehensive solution to the wastewater problem at Urbanización Don Chú.
This situation will be addressed in the following considerandos.
VIII.On the conduct of the Municipalidad de Upala. On this point, it is noted that since 26 February 2021, the Área de Salud of Upala has issued 2 sanitary orders against the Municipalidad de Upala: sanitary order no. ARS-U-OS-028-2021 addressed to the mayor and sanitary order no. ARS-U-OS-029-2021 addressed to the president of the Council, both requiring them to submit "a corrective action plan for the installation and operation of a wastewater treatment system with optimal capacity, providing a comprehensive solution to the wastewater problem at Urbanización Don Chú," as well as the "design, installation, and operation of the wastewater treatment system." On this matter, it is established that although the Municipalidad de Upala has taken several steps to address the indicated situation, those sanitary orders have nonetheless not been fully complied with, as the environmental contamination problem and the lack of a comprehensive solution to the wastewater problem at Urbanización Don Chú persist.
Thus, in one of the most recent official communications issued by the Ministerio de Salud (report MS-DRRSCH-URS-IT-14-2025 of 27 March 2025), it was established that "To date, there is clear non-compliance with the corrective action plan submitted by the Municipalidad de Upala, as well as non-compliance with the agreements reached at the in-person meeting of 18 March with the Municipality (…) The problem of the illegal discharge of wastewater into the public right-of-way at Urbanización Don Chú in Upala has not been resolved, affecting public health. (…) it is concluded that sanitary orders ARS-U-OS-028-2021 and ARS-U-OS-029-2021 have not been fully complied with, leaving unresolved the public health problem represented by the discharge of wastewater into the public right-of-way originating from Urbanización Don Chú in Upala." It is thus clear that the Municipalidad de Upala has not fully complied with the sanitary orders.
Furthermore, the respondent Municipality attempts to argue that it is not responsible for resolving this problem and that the sanitary orders should be deemed complied with. On this point, it must be noted that this position of the Municipalidad de Upala arose after the Ministerio de Salud declined to grant the requested extension of the issued sanitary order, specifically through official letter no. CARTA-MS-DRRSCH-DARSU-0224-2025 of 10 June 2025, whereby the Área Rectora de Salud of Upala communicated to the mayor of the Municipalidad de Upala the following: "In response to your request, (…) we inform you that it is not possible to grant an extension for an order whose deadline has already expired, for the following reasons (…) it is considered to have been complied with as regards the submission of the Action Plan. However, it was made clear that the actions carried out have been minimal, and that the public health problem persists, since no concrete solutions have been implemented (…) Given the foregoing, the request for an extension cannot be granted." Accordingly, it is confirmed that there are indeed 2 sanitary orders against the Municipalidad de Upala, under which the Ministerio de Salud, in the exercise of its regulatory competencies, has urged the Municipality to comply with a series of measures aimed at resolving the identified environmental problem.
The position taken by the Municipality in attempting to shed its regulatory responsibilities is therefore unacceptable. This Tribunal has noted that Article 169 of the Constitución Política establishes the duty of the country's municipalities to safeguard the interests of the inhabitants of their jurisdiction. Accordingly, in repeated rulings, this Tribunal has held that such corporations are obligated to eliminate any type of threat that jeopardizes the rights to health and to a healthy and ecologically balanced environment (medio ambiente sano y ecológicamente equilibrado) of the persons living in their canton (see Judgment No. 2008-11739 of 12:12 hours of 25 July 2008, reiterated in No. 2020-014753 of 9:15 hours of 7 August 2020).
Note that, in fact, the most recent report of the Municipal Council dated May 28, 2026, alleges that "this Presidency will advance the following actions: a) Formally convene before the Municipal Council the Specialized Technical Commission for Monitoring the Sanitary Orders (órdenes sanitarias) related to the Wastewater (aguas residuales) Treatment System of the Barrio Don Chú neighborhood, so that it may render a comprehensive and updated report on: • the current state of the problem; • actions taken; • pending agreements; • existing technical and administrative limitations; • interinstitutional coordination undertaken; • possible routes to a technical and administrative solution. b) Formally request from the Municipal Administration an updated report on: • compliance with action plans; • status of coordination with the Ministry of Health and AyA; • current status of the sanitary orders; • any budgetary, technical, or administrative needs that may arise; • possibilities for future institutional coordination. c) Place the matter on the agenda of an upcoming ordinary session of the Municipal Council, so that the collegiate body may formally take note of the situation described and evaluate possible mechanisms for institutional monitoring within the corresponding jurisdictional framework. d) Promote the formation or strengthening of spaces for interinstitutional coordination and joint work among the Municipality of Upala, the Ministry of Health, the Instituto Costarricense de Acueductos y Alcantarillados, the Municipal Administration, and other competent technical bodies, aimed at achieving effective coordination, information-sharing, and analysis of viable alternatives for the comprehensive resolution of the reported problem. e) Monitor, from the Municipal Council, the proceedings and reports generated in connection with this matter, in order to maintain up-to-date knowledge of the institutional progress of actions related to the situation described." Nevertheless, it has not been established that these actions have been carried out in connection with a problem that the Municipality has been aware of since 2021, which confirms that Municipality's failure to comply with what was ordered.
Now, if the Municipality considers that the Instituto Costarricense de Acueductos y Alcantarillados also bears responsibility in the matter, the appropriate course is to remind it of what was stated in Considerando VI regarding interinstitutional coordination in environmental matters. Specifically in the area of environmental protection (tutela ambiental), ruling number 2008-004790 underscored the duty of coordination among institutions involved in the subject and the impossibility of ignoring warnings about contamination risks issued by an institution legally empowered to protect the environment. In that regard, ruling no. 2020-018888 of 09:15 hours of October 2, 2020, reiterated in ruling no. 2025-023963 of 09:15 hours of August 1, 2025, stated, in the relevant part, the following:
"This Tribunal has recognized that local governments have, within the scope of their competencies and obligations, a high degree of responsibility in environmental matters, whether through the direct approval of permits or licenses for which prior compliance with requirements is demanded to demonstrate to other branches of public authority that environmental management is adequate, or through regular inspections and the referral of risk situations to bodies with greater intervention authority. It has already been established that local governments bear the obligation of coordination and prevention in environmental matters within the scope of their territorial jurisdiction, from which it follows that municipalities are indeed important actors in the task of environmental protection. As stated above, not only that municipal body, but all of the other respondent authorities, hold broad powers of action, and while they are subject to legality and reasonableness, the truth is that, given that this involves a threat to the environment and to public health, legality and formalities are displaced." Based on the foregoing, emphasis must be placed on the obligation of coordination and prevention in environmental matters that the respondent municipality holds within the scope of its territorial jurisdiction, which is why the arguments put forward by that Municipality in the reports submitted cannot be accepted, since it has not taken the appropriate actions to resolve the environmental problem for the benefit of the residents of the respective residential development (urbanización), despite the fact that the environmental problem in question has been duly established.
Additionally, it is reiterated what was stated regarding the obligations arising from Articles 169 and 170 of the Political Constitution, to the effect that municipalities are responsible for administering local services and interests with the aim of promoting the comprehensive development of the cantons (cantones) in harmony with national development, and that they must also safeguard the rights of their municipal residents (munícipes), such that a municipality cannot remain idle when fundamental rights of those residents are affected, as occurs in the present case.
In this way, a violation of the fundamental rights of the protected parties is noted, arising from the Municipality of Upala's established failure to resolve the respective environmental problem.
IX.On the conduct of the Instituto Costarricense de Acueductos y Alcantarillados. In this regard, as with the Municipality of Upala, it is verified that on February 26, 2021, the Upala Health Area issued sanitary order no. ARS-U-OS-030-2021, ordering the Executive President of the Instituto Costarricense de Acueductos y Alcantarillados to: "1. Submit to the Upala Health Governing Area (Área Rectora de Salud de Upala) an action plan for the installation and operation of a wastewater treatment system with optimal capacity, providing a comprehensive solution to the wastewater problem affecting the Urbanización Don Chú, located in the first district of the canton (cantón) of Upala. Said plan must include a schedule of activities to be carried out and the execution timeframe, specifying the start and end dates of each activity and the person responsible for its execution. 2. The design, installation, and operation of the wastewater treatment system must be carried out in compliance with applicable technical regulations, and must have the respective permits and authorizations from the competent institutions, as applicable." That is, the Upala Health Area also ordered that Institute to take various actions aimed at resolving the environmental problem that had been established, without, to date, as indicated in the preceding sections, said situation having been resolved.
This also confirms a failure on the part of ICAA to comply with what was ordered by the Ministry of Health to resolve the established environmental problem. Note that ICAA itself affirms that "the solution to address the wastewater sanitation problem in the Urbanización Don Chú requires a comprehensive approach, since in addition to wastewater treatment as requested by the Ministry of Health in Sanitary Order ARS-U-OS-030-2022, its collection and disposal must also be resolved, in compliance with the applicable technical regulations and standards in this area." In other words, it acknowledges that the problem requires a comprehensive solution, which, clearly, has not yet been achieved. Likewise, it is relevant to remind that respondent institute of its obligation to ensure the protection of a healthy and ecologically balanced environment, which unquestionably includes the proper collection, treatment, and final disposal of wastewater. This obligation is established by the Constitutive Law of the Instituto Costarricense de Acueductos y Alcantarillados itself, Ley nro. 2726, specifically in its Articles 1 and 2:
"ARTICLE 1.- For the purpose of directing, setting policy, establishing and applying standards, carrying out and promoting planning, financing, and development, and of resolving all matters related to the supply of potable water and the collection and disposal of sewage and liquid industrial waste, as well as the regulatory aspects of stormwater sewerage (alcantarillado pluvial) systems in urban areas, throughout the entire national territory, the Instituto Costarricense de Acueductos y Alcantarillados is hereby created as an autonomous institution of the State.
ARTICLE 2.- The following powers and duties are assigned to the Instituto Costarricense de Acueductos y Alcantarillados:
Under no circumstances may the administration of water supply and sanitary sewerage systems of the Metropolitan Area be delegated.
Nor may the administration of systems over which there is financial responsibility be delegated, for as long as such responsibility falls directly on the Institute.
The institution is authorized to enter into agreements with local bodies for the administration of such services or to administer them through mixed-membership administrative boards composed of the Institute and the respective communities, provided this is deemed best for service delivery and in accordance with the respective regulations.
For the same reasons and with the same characteristics, regional administrative boards involving several municipalities may also be created; h) To enforce the Ley General de Agua Potable, for which purpose the Institute shall be deemed the substitute body for the ministries and municipalities referred to in that law; i) To construct, expand, and reform water supply and sewerage systems in those cases where it is necessary and where the better satisfaction of national needs so advises; and j) To oversee the proper investment of all resources that the State allocates for water supply and sanitary sewerage works.
(*)k) The Instituto Costarricense de Acueductos y Alcantarillados is authorized to formalize, by means of an interinstitutional agreement with municipal corporations, the construction, expansion, and rehabilitation of works for the supply of potable water and sewerage services, with the aim of providing such services in those areas where ICAA does not have coverage, or where, despite having coverage, it cannot provide the service due to system construction limitations, but where technical availability of the water resource exists.
Prior studies and construction plans for the various potable water and sewerage systems carried out by the municipalities must receive prior technical and design approval from the Instituto Costarricense de Acueductos y Alcantarillados, to ensure their incorporation into the systems already in operation by the Institute upon completion of the works, in accordance with subsection b).
Municipalities are authorized to prepare, on their own or through third parties, the construction plans for water supply and sewerage systems.
Once the Institute has accepted the works constructed by the municipal corporation to its satisfaction, the corresponding line item for full payment to the municipal corporation for the previously approved works must be incorporated into the service tariff, along with the cost of expropriations and the establishment of easements (servidumbres) necessary for the construction and operation of the system. Both the works and the land shall become part of AyA's patrimony. The tariff model for payment of the works must be approved by the Public Services Regulatory Authority (Autoridad Reguladora de los Servicios Públicos) (Aresep).
(*) (Subsection k) was added by Article 1 of the Law to permit municipalities to construct water supply and sewerage works, N° 10595 of November 11, 2024)." From the analysis of the above-cited regulations, the duty of the Instituto Costarricense de Acueductos y Alcantarillados to exercise, in a coordinated manner, responsibility over the collection, treatment, and final disposal of wastewater is confirmed, in order to ensure the respective efficacy and efficiency (see ruling no. 2025-034701 of 09:20 hours of October 24, 2025). Therefore, no action can be observed within the scope of its competencies to attempt to mitigate, in coordination with the various relevant bodies, the collection, treatment, and final disposal of wastewater in the indicated residential development, which represents a violation of the protected parties' right to a healthy and ecologically balanced environment. Thus, ICAA's actions to resolve the indicated environmental problem are found to be lacking.
Likewise, as was stated to the Municipality of Upala, if ICAA considers that it is the Municipality of Upala that is obligated to resolve the problem, the fact remains that the sanitary order was also issued to that Institute. Therefore, it is also necessary to remind it of the obligation of interinstitutional coordination in environmental matters. Specifically in the area of environmental protection, ruling number 2008-004790 underscored the duty of coordination among institutions related to the subject and the impossibility of ignoring warnings about contamination risks issued by an institution legally empowered to protect the environment.
In this way, a violation of the fundamental rights of the protected parties is noted, arising from the Instituto Costarricense de Acueductos y Alcantarillados's established failure to resolve the respective environmental problem.
X.On the conduct of the Ministry of Health. Finally, regarding this Ministry, it is reiterated that it has acted in accordance with its competencies, issuing the respective sanitary orders and taking actions aimed at their compliance. However, those sanitary orders have not been fully complied with, and a forceful action by that Ministry to compel compliance is found to be lacking. Thus, it is reiterated that, according to technical inspection report no. RCH-ARSU-ERS-IT-029-2025 of January 20, 2025, the Health Regulation Team of the Upala Health Governing Area established that an inspection was conducted on January 15, 2025, in which it was found that "The Municipality formed a commission or technical team to address the issue; however, it has not been officially reported who its members are or what actions have been taken. 2. The action plan has not been updated. 3. No extension was requested from the Ministry of Health for compliance with the updated action plan.
(…) 5. The persons in charge of the matter at the Instituto Costarricense de Acueductos y Alcantarillados (AyA) have not been convened to provide technical advice and any relevant assistance to the Municipality. In general, the agreements reached at the meeting of March 18, 2024, have not been complied with, and therefore there is non-compliance with the corrective action plan submitted in official memoranda DAMU-0496-06-2021 and DCU-OF-013-2024, pursuant to sanitary orders ARS-U-OS-028-2021 and ARS-U-OS-029-2021 (…) 8. CONCLUSION: A comprehensive solution to the existing wastewater problem in the Urbanización Don Chú has not yet been achieved, such that wastewater (primarily greywater) is discharged into the street drainage channel without any treatment. In this way, there is non-compliance with the corrective action plan submitted in official memoranda DAMU-0496-06-2021 and DCU-OF-013-2024, pursuant to sanitary orders ARS-U-OS-028-2021 and ARS-U-OS-029-2021. 9.
RECOMMENDATIONS TO THE HEALTH GOVERNING AREA: The management of the Upala Health Governing Area must submit the appropriate inquiry to higher levels of the Ministry of Health so that the actions to be taken in this case may be determined, given the repeated non-compliance with the corrective action plan pursuant to sanitary orders ARS-U-OS-028-2021 and ARS-U-OS-029-2021." Subsequently, by means of CARTA-MS-DRRSCH-DARSU-0118-2025 of March 18, 2025, the Upala Health Governing Area communicated to the Chorotega Regional Directorate of the Ministry of Health the following: "I am forwarding the technical report referred to in the subject line. It is forwarded for assessment and guidance on the steps to be taken, since these sanitary orders were issued in 2021, and despite outreach efforts, follow-up, and agreements reached, the Municipality of Upala has not complied in a timely and proper manner, and to date there is no comprehensive solution to the serious wastewater problem affecting the Don Chú community.
We appreciate a prompt intervention." Subsequently, by means of report MS-DRRSCH-URS-IT-14-2025 (in response to CARTA MS-DRRRSCH-DARSU-0018-20225) of March 27, 2025, the representatives of the Health Governance Unit of the Chorotega Region stated the following: "(…): a. To date, there is evident non-compliance with the corrective action plan submitted by the Municipality of Upala and, furthermore, non-compliance with the agreements reached at the in-person meeting of March 18 with the Municipality (…) The problem of the illegal discharge of wastewater onto the public roadway of the Urbanización Don Chú in Upala has not been resolved, thereby affecting public health. 7. CONCLUSION AND RECOMMENDATIONS (…) it is concluded that sanitary orders ARS-U-OS-028-2021 and ARS-U-OS-029-2021 have not been fully complied with, leaving unresolved the public health problem posed by the discharge of wastewater onto the public roadway from the Urbanización Don Chú in Upala." That is, those documents, issued over one year ago, confirmed that the sanitary orders had not been complied with, leading to the matter being referred to higher levels of the Ministry of Health for determination of the actions to be taken in this case, given the repeated non-compliance with the corrective action plan pursuant to sanitary orders ARS-U-OS-028-2021 and ARS-U-OS-029-2021. However, it is not established that such actions were determined or implemented, which has allowed the established environmental problem to persist, a fact acknowledged by that Ministry.
Likewise, it is verified that it has not been established that complaint no. 023-2020, which led to the issuance of report MS-DRRCH-URS-IT-0147-20 of December 17, 2020, which confirmed the environmental problem and served as the basis for the issuance of the sanitary orders, has been duly resolved. Furthermore, it has also not been established that the complaint of February 9, 2022, filed by Mr. Gerardo Fonseca Obando and signed by residents of the Urbanización Don Chú before the Upala Health Area, has been resolved either. Note that while complaint no. 023-2020 did lead to the issuance of the sanitary orders, it is reiterated that those orders have not been fully complied with, and the problem reported in that 2020 proceeding persists.
Accordingly, this Constitutional Chamber finds that the Ministry of Health has displayed a lack of diligence in providing due follow-up to ensure compliance with the sanitary orders issued, which has allowed the environmental problem to persist, despite the fact that the respondent Ministry has been aware of the situation since 2020. Furthermore, it should be noted that the sanitary orders in question were served on March 1, 2021, with an expiration date of May 27, 2021. Therefore, it is established that said sanitary orders have already expired, yet compliance has not been verified. Consequently, it is established that, although the Ministry of Health possesses a series of legal tools to compel compliance with what was ordered in the sanitary orders, in the present case those tools have not been employed, and it is therefore observed that the health authority has been remiss in its handling of the follow-up to the problem raised herein.
Accordingly, a violation of the fundamental rights of the protected parties is noted, arising from the Ministry of Health's established failure to carry out the respective actions to resolve the environmental problem at issue.
XI.Conclusion. In light of the foregoing, a lack of adequate coordination is verified among the Ministry of Health, the Instituto Costarricense de Acueductos y Alcantarillados, and the Municipality of Upala in carrying out the appropriate actions aimed at resolving the established environmental problem with the wastewater of the Urbanización Don Chú. Accordingly, the present matter is declared with merit, with the consequences set forth in the operative part (parte dispositiva).
XII.Note of Justice Castillo Víquez, regarding prompt and effective administrative justice. I have supported the position of this Tribunal that when a party alleges a violation of the right to prompt and effective justice in administrative proceedings, the competent bodies to adjudicate the legal controversy are the Administrative Courts (Tribunales de lo Contencioso-Administrativo) and not this Chamber. However, with the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, it has been established that this right is susceptible to judicial protection through the amparo remedy (recurso de amparo) established by Article 32 of the Ley de la Jurisdicción Constitucional, in relation to Article 27 of the Political Constitution of the Republic of Costa Rica, in those cases where the petitioner considers that the Administration's material acts, its administrative acts, or its response are affecting his or her fundamental rights.
In my view, the recently enacted legislation does not imply that this Tribunal must modify its jurisprudential line, which, pursuant to Article 7 of its Law, is exclusively responsible for defining its own competence. Therefore, except for those legal-constitutional controversies that this very Chamber has recognized as exceptional cases that may properly be heard in this jurisdiction through the constitutional amparo proceeding, in all other cases, and for the reasons given by this Tribunal (ruling N° 2008-02545 of 8:55 hours of February 22, 2008), the competent bodies are the Judges of the administrative courts jurisdiction, all of which is consistent with Article 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and norms), and the corresponding statutory provisions, based on a logical, systemic, and teleological interpretation of the legal system.
In environmental matters, it is the opinion of the undersigned that if the Public Administration has already intervened, knowledge and resolution of the matter falls within the administrative courts jurisdiction. Nevertheless, I do enter into the merits of the matter when the fundamental rights of those affected by the source of contamination are at stake, including health, quality of life, and the right to enjoy a healthy and uncontaminated environment (Article 50 of the Political Constitution), as occurs in this case, in which sanitary deficiencies are alleged in the wastewater treatment system of a residential development, affecting the health of neighbors, the right to enjoy a healthy and ecologically balanced environment, and the right to a dignified quality of life.
XIV.PARTIAL DISSENTING VOTE OF JUSTICE GARRO VARGAS REGARDING EXECUTION OF THE ORDER ISSUED WITHIN THE SIX-MONTH PERIOD IN THE RULING.
I dissent with respect to the execution of the order issued within the six-month period in the ruling, so that, pursuant to art. 56 of the Ley de la Jurisdicción Constitucional (LJC), it may be lodged in the Execution Division of the Administrative Litigation and Civil Treasury Court (Tribunal Contencioso Administrativo y Civil de Hacienda).
The execution of orders issued by the Constitutional Chamber is, in principle, to be supervised by this same jurisdiction. However, that provision contemplates exceptional cases in which, at the determination of this Tribunal, execution of the ruling is ordered to be lodged in the administrative courts jurisdiction:
"Art. 56. Execution of rulings falls to the Constitutional Chamber, except with respect to the liquidation and fulfillment of compensation awards and financial liabilities, or in other respects that the Chamber itself considers appropriate, in which case execution shall proceed in the administrative courts venue through the judgment-execution procedure provided in the law governing that jurisdiction." (Emphasis not in the original.)
It should be recalled that the legislative bill for discussion of the LJC originally provided the following:
"Art. 56. Rulings favorable to the appellant shall be executed in the administrative courts venue through the judgment-execution procedure provided in the Law Governing that Jurisdiction." (Emphasis not in the original.)
However, the text was amended by motion to make the provision consistent with what is regulated in Article 153 of the Political Constitution, and the following explanation was offered:
"THE SECRETARY:
Motion No. 68 (32-19) by Representative Chacón Jiménez:
'Article 57 (formerly 56): so that the text reads as follows: "execution of rulings falls to the Constitutional Chamber, except with respect to the liquidation and fulfillment of compensation awards or financial liabilities, in other respects that the Chamber itself considers appropriate, in which case execution shall proceed in the administrative courts venue through the judgment-execution procedure provided in the law governing that jurisdiction."' THE PRESIDENT:

There was a contradiction here with the general thesis that Courts execute their own rulings, which was sending all execution to the Administrative Contentious Jurisdiction; as a result, the other articles that permitted the Chamber to execute them were left unresolved.

That part says: 'or in other respects that the Chamber itself considers appropriate…' — what does that refer to?
Dr. Piza Escalante:
The idea is that the Chamber, in the judgment-execution phase, resolves whatever it considers falls within its purview. Everything else it sends to the Administrative Contentious Jurisdiction.

Based on the foregoing, it is clear that the LJC itself authorizes this Chamber to assess and decide whether it is necessary to refer to the administrative courts jurisdiction all or some of the aspects related to the execution of the ruling.
In this specific case, given the nature of the orders being issued by this Tribunal, I consider that the appropriate course is to lodge the execution phase of the matter in the administrative courts jurisdiction. This is due to the absence of adequate mechanisms provided for by the regulations governing this constitutional jurisdiction to follow up on the orders set forth in this ruling, which entail highly complex technical matters.
In contrast, the provisions of the Código Procesal Contencioso-Administrativo governing enforcement (art. 155 et seq.) offer clear advantages, such as the ability to request schedules, impose fines, assign liability, monitor stages of compliance, etc. For this reason, in accordance with art. 56 of the LJC, I consider that the enforcement phase must be carried out before the Área de Ejecución of the Tribunal Contencioso Administrativo y Civil de Hacienda, under the judgment-enforcement rules of that Code.
The parties are hereby warned that if they have submitted any paper documents, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be retrieved from the office within a maximum period of 30 business days counted from notification of this judgment. Otherwise, all materials not retrieved within this period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by Corte Plena at session N° 27-11 of August 22, 2011, article XXVI, and published in Boletín Judicial number 19 of January 26, 2012, as well as in the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on May 3, 2012, article LXXXI.
Por tanto:
The writ of amparo is granted. Mary Denisse Munive Angermuller, in her capacity as Minister, and Gabriel Andrés Segura Torres, in his capacity as Director of the Área Rectora de Salud de Upala, both of the Ministerio de Salud, or whoever holds those positions, are hereby ordered to carry out the following within the scope of their respective competencies: a) that they immediately take the pertinent actions to ensure the effective enforcement of the following sanitary orders (órdenes sanitarias): no. ARS-U-OS-028-2021, no. ARS-U-OS-029-2021, no. ARS-U-OS-030-2021. Accordingly, they must continuously and permanently monitor compliance with said orders within the deadlines established therefor, working to ensure their fulfillment, and, in the event that they continue to go unenforced, promptly take the appropriate measures to hold delinquent officials accountable; b) that, within a maximum period of ONE MONTH counted from notification of this judgment, complaints 023-2020 and the complaint of February 9, 2022 be addressed as required by law, and that the respective notification be sent to the means indicated by the complainants.
Furthermore, Lourdes Sáurez Barboza, in her capacity as Executive President of the Instituto Costarricense de Acueductos y Alcantarillados (ICAA), as well as Aura Yamileth López Obregón, in her capacity as Mayor, and Luis Wilberto Tenorio García, in his capacity as President of the Concejo, both of the Municipalidad de Upala, or whoever holds those positions, are hereby ordered to immediately, and in accordance with the orders of the Ministerio de Salud, take the actions necessary to comply with the following sanitary orders: no. ARS-U-OS-028-2021, no. ARS-U-OS-029-2021, no. ARS-U-OS-030-2021, bearing in mind that said orders are past due. Finally, Mary Denisse Munive Angermuller, in her capacity as Minister, and Gabriel Andrés Segura Torres, in his capacity as Director of the Área Rectora de Salud de Upala, both of the Ministerio de Salud, Lourdes Sáurez Barboza, in her capacity as Executive President of ICAA, as well as Aura Yamileth López Obregón, in her capacity as Mayor, and Luis Wilberto Tenorio García, in his capacity as President of the Concejo, both of the Municipalidad de Upala, or whoever holds those positions, are hereby ordered to, IMMEDIATELY upon notification of this judgment, jointly and in a coordinated manner, take all necessary measures to temporarily ensure that no harm is caused to the health of the residents of Urbanización Don Chú in Upala, Alajuela, while a definitive solution to the problem underlying this proceeding is reached.
Furthermore, said authorities are ordered to coordinate with one another as needed, issue the pertinent orders, and carry out all actions within the scope of their respective competencies so that, within a maximum period of SIX MONTHS counted from the notification of this judgment, a comprehensive and definitive solution is provided to the environmental and public-health problem established with respect to wastewater (aguas residuales) treatment at Urbanización Don Chú in Upala, Alajuela. The respondent authorities are hereby warned that failure to comply with said order will constitute the criminal offense of contempt (desobediencia), and that, pursuant to article 71 of the law governing this jurisdiction, a sentence of three months to two years' imprisonment, or twenty to sixty day-fines (días multa), shall be imposed upon any person who receives an order that they must comply with or cause to be complied with, issued in a writ of amparo, and fails to comply with it or to cause it to be complied with, provided the offense is not more severely punishable under other provisions.
The Municipalidad de Upala, the State, and ICAA are condemned to pay costs, damages, and losses (costas, daños y perjuicios) arising from the acts underlying this declaration, which shall be assessed in administrative-court enforcement proceedings (ejecución de sentencia de lo contencioso administrativo). Magistrate Castillo Víquez appends a note. Magistrate Salazar Alvarado appends a note. Magistrate Garro Vargas files a dissenting vote with respect to the venue for enforcement of the six-month order issued in the judgment, and, in accordance with article 56 of the Ley de la Jurisdicción Constitucional, orders that that phase be vested in the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda. Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del diecinueve de junio de dos mil veintiseis .
Recurso de amparo interpuesto por [Nombre 001], cédula de identidad [Valor 001], a favor de 240 familias de la Urbanización Don Chú en Upala, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, MINISTERIO DE SALUD, MUNICIPALIDAD DE UPALA.
Resultando:
Redacta el Magistrado Araya García; y,
Considerando:
I.Cuestión Preliminar. De previo a analizar el fondo del asunto -por la presunta violación del derecho a un procedimiento pronto y cumplido- debe aclararse que, a partir de la sentencia No. 2008-02545 de las 8:55 horas de 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa -con algunas excepciones-, aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo -instruido de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes. Precisamente, en este caso, se plantea un supuesto de excepción, pues, se está ante unas denuncias y situaciones de índole ambiental, las cuales, presuntamente, no han sido resueltas dentro de un plazo razonable por parte de las autoridades recurridas. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.
II.Objeto del recurso. La recurrente reclama violación a los derechos fundamentales 240 familias de la Urbanización Don Chú en Upala, pues señala que en esa urbanización de bien social sufre de graves condiciones de insalubridad debido a la falta de un sistema adecuado de tratamiento de aguas residuales, provocando vertidos ilegales y riesgos sanitarios graves. Asegura que las instituciones recurridas no han coordinado de forma adecuada para lograr una solución a dicha problemática.
III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
Además, se perciben olores muy desagradables desde la acera y carretera. Por otro lado, la cantidad de ocupantes en algunas viviendas supera los 6 habitantes, que usualmente se toman en cuenta como ocupación máxima a la hora de diseñar un tanque séptico y sistema de infiltración para una vivienda de bien social. 8. Recomendaciones. Las situaciones observadas en medida representan problemas que pueden afectar la salud de las personas, por lo que de acuerdo con las competencias del Ministerio de Salud es su responsabilidad garantizar y tomar acciones preventivas en beneficio de la Salud Pública y bajo fundamento en los artículos 1, 2, 4, 7, 8, 39, 285, 286, 340, 341, 355 y 356 de la Ley General de la Salud” (ver los informes rendidos y la prueba aportada).
Se visualizó que la conducción de las aguas residuales que, deberían ser pluviales, salen de lo interno de las viviendas hacia el sistema de conducción de las aguas llovidas, lo cual imposibilita a la Municipalidad realizar una intervención con presupuesto propio para revertir esta situación. Sin embargo, la Municipalidad puede realizar procesos de promoción y educación a los propietarios, para mejorar las condiciones de su infraestructura. Conforme al punto 2 en el oficio PRE-2021-00617 del 24 de mayo de 2021, el AyA explica el proceso de planeación, el cual conlleva una serie de fases para dar resultado a un Plan Maestro para un sistema de saneamiento de aguas residuales en el centro de Upala. Si bien es cierto, existe un plan maestro que data de 10 años atrás, la dinámica urbana ha cambiado lo suficiente para creer que se necesita un estudio totalmente nuevo, que puede utilizar como base el señalado, pero que requiere de un presupuesto que en estos momentos el Municipio no cuenta, de ahí la importancia del apoyo del AyA o de cualquier otra entidad que pueda participar en la actualización del Plan, el cual debe contemplar una fase de prefactibilidad y factibilidad, dada las condiciones topográficas, biofisicas y económicas del cantón. 4.
Finalmente, con el fin de cumplir con lo solicitado en la Orden sanitaria, se incluye un Plan de acción que incorpora medidas atinentes a propiciar una mejora en el tratamiento de las aguas residuales a lo interno de las viviendas con su respectiva fecha de ejecución, pero también incorpora a solicitud de los habitantes del Barrio Don Chu, un plan de intervención urbana que involucre la participación ciudadana y presupuesto municipal” (ver los informes rendidos y la prueba aportada).
Tal cual lo explica el AyA en el oficio PRE-2021-00617 del 24 de mayo de 2021, se requiere de una solución integral que contemple un sistema que recolecte, conduzca y trate las aguas residuales, y no únicamente un sistema de tratamiento. Además, no solo se necesita esta solución integral en el barrio Don Chu sino en todo el centro urbano de Upala. 2. Se visualizó que la conducción de las aguas residuales que, deberían ser pluviales, salen de lo interno de las viviendas hacia el sistema de conducción de las aguas llovidas, lo cual imposibilita a la Municipalidad realizar una intervención con presupuesto propio para revertir esta situación. Sin embargo, la Municipalidad puede realizar procesos de promoción y educación a los propietarios, para mejorar las condiciones de su infraestructura. 3. Conforme al punto 2 en el oficio PRE-2021-00617 del 24 de mayo de 2021, el AyA explica el proceso de planeación, el cual conlleva una serie de fases para dar resultado a un Plan Maestro para un sistema de saneamiento de aguas residuales en el centro de Upala.
Si bien es cierto, existe un plan maestro que data de 10 años atrás, la dinámica urbana ha cambiado lo suficiente para creer que se necesita un estudio totalmente nuevo, que puede utilizar como base el señalado, pero que requiere de un presupuesto que en estos momentos el Municipio no cuenta, de ahí la importancia del apoyo del AyA o de cualquier otra entidad que pueda participar en la actualización del Plan, el cual debe contemplar una fase de prefactibilidad y factibilidad, dada las condiciones topográficas, biofísicas y económicas del cantón. 4. Finalmente, con el fin de cumplir con lo solicitado en las ordenes sanitarias, se remitió un Plan de acción que incorpora medidas atinentes a propiciar una mejora en el tratamiento de las aguas residuales a lo interno de las viviendas con su respectiva fecha de ejecución, pero también incorporar, a solicitud de los habitantes del Barrio Don Chu, un plan de intervención urbana que involucre la participación ciudadana y presupuesto municipal” (ver los informes rendidos y la prueba aportada).
Además, se acordó lo siguiente: 1. La Municipalidad conformará la comisión o equipo técnico para tratar el tema. 2. Conformada la comisión se actualizará el plan de acción. 3. La Municipalidad solicitará al Ministerio de Salud prórroga para el cumplimiento del plan de acción actualizado. 4. Con la colaboración del Ministerio de Salud, se creará material informativo para distribuirlo a la población. 5. Se debe convocar a los encargados del tema en el Instituto Costarricense de Acueductos y Alcantarillados (AyA) para que brinden asesoría técnica y cualquier colaboración pertinente. 6. Todo esto se realizará en el corto plazo. 7. El Área Rectora de Salud Upala deberá brindar seguimiento a las gestiones y acciones realizadas por la comisión. Tanto la Municipalidad de Upala como el AyA cumplieron con las órdenes sanitarias ARS-U-OS 2021, ARS-U-OS-029-2021 y ARS-U-OS-030-2021, ya que ambas instituciones presentaron ante el Área Rectora de Salud de Upala lo ordenado en las mismas.
Sin embargo, no se ha dado cumplimiento del plan de acción propuesto (…) 8. CONCLUSIÓN Aún no se cuenta con una solución integral al problema de aguas residuales existente en la Urbanización Don Chú, por lo que las aguas residuales (principalmente grises) son desfogadas al cordón de caño sin ningún tratamiento. La Municipalidad de Upala ha realizado algunas acciones establecidas en un plan de acción, sin embargo, dicho plan debe actualizarse, conformar la comisión o equipo técnico y continuar con las gestiones correspondientes y contando con la colaboración del AyA. 9. RECOMENDACIONES AL ÁREA RECTORA DE SALUD DE SALUD. La dirección de Área Rectora de Salud Upala deberá brindar seguimiento al plan de acción actualizado que presente la Municipalidad de Upala, el cual deberá realizarse en un corto plazo con el fin de obtener una solución integral al problema de aguas residuales de la Urbanización Don Chú (…)” (ver los informes rendidos y la prueba aportada).
En la reunión del día 18 de marzo de 2024 se había acordado que se realizarían ciertas acciones para el cumplimiento del plan indicado en los oficios DAMU-0496-06-2021 y DCU-OF-013-2024. Según el expediente administrativo e información de los funcionarios municipales se indica lo siguiente: 1. La Municipalidad conformó una comisión o equipo técnico para tratar el tema, sin embargo, no se ha informado oficialmente quienes lo conforman y las acciones realizadas. 2. No se ha actualizado el plan de acción. 3. No se solicitó la prórroga al Ministerio de Salud para el cumplimiento del plan de acción actualizado. 4. Con la colaboración del Ministerio de Salud, se creó material informativo y en fecha 06 de junio de 2024 fue distribuido a la población (Barrio Matadero, Las Palmas, San Juan, La Carpa y Los Ángeles), sin embargo, no fue tomado en cuenta el Barrio Don Chú. 5. No se ha convocado a los encargados del tema en el Instituto Costarricense de Acueductos y Alcantarillados (AyA) para que brinden asesoría técnica y cualquier colaboración pertinente a la Municipalidad.
En general no se ha cumplido con los acuerdos tomados en la reunión del pasado 18 de marzo de 2024, por lo tanto, se incumple el plan de acciones correctivas presentado en los oficios DAMU-0496-06-2021 y DCU-OF-013-2024, según las órdenes sanitarias ARS-U-OS-028-2021 y ARS-U-OS-029-2021 (…) 8. CONCLUSIÓN Aún no se cuenta con una solución integral al problema de aguas residuales existente en la Urbanización Don Chú, por lo que las aguas residuales (principalmente grises) son desfogadas al cordón de caño sin ningún tratamiento. De esta forma se incumple con el plan de acciones correctivas presentado en los oficios DAMU-0496-06-2021 y DCU-OF-013-2024, según las órdenes sanitarias ARS-U-OS-028-2021 y ARS-U-OS-029-2021. 9. RECOMENDACIONES AL ÁREA RECTORA DE SALUD DE SALUD. La dirección de Área Rectora de Salud Upala deberá hacer la respectiva consulta ante niveles superiores del Ministerio de Salud para que se determinen las acciones a seguir en este caso, por el incumplimiento reiterado del plan de acciones correctivas según las órdenes sanitarias ARS-U-OS-028- 2021 y ARS-U-OS-029-2021” (ver los informes rendidos y la prueba aportada).
A la actualidad, no se cuenta con una solución integral al problema de aguas residuales existente en la Urbanización Don Chú, por lo que las aguas residuales (principalmente grises) son desfogadas al cordón de caño sin ningún tratamiento. De esta forma se incumple con el plan de acciones correctivas presentado en los oficios DAMU-0496-06-2021 y DCU-OF-013-2024, según las órdenes sanitarias ARS-U-OS-028-2021 y ARS-U-OS-029-2021. Por lo anterior, se estará elevando el caso a niveles superiores para su respectiva valoración y lo que corresponda”. Lo anterior, le fue comunicado a la Municipalidad de Upala el 07 de marzo de 2025 (ver los informes rendidos y la prueba aportada).
CONCLUSIÓN Y RECOMENDACIONES. Según los resultados obtenidos del análisis de la normativa vigente, y las accione realizadas por DARS Upala respecto el caso en mención; se concluye que la ordenes sanitarias ARS-U-OS-028-2021 y ARS-U-OS-029-2021 no se han cumplido a cabalidad, dejando sin resolver la problemática de salud pública que representa la descarga de aguas residuales a la vía pública provenientes de la Urbanización Don Chú en Upala. Por lo anteriormente indicado, se le recomienda a la Dirección del Área Rectora de Salud de Upala convocar a la Municipalidad de Upala, a los representantes de la comisión que se conformó y a los funcionarios(as) de esta oficina regional: Ing. Carlos Morales Camacho y Licda. Laura Rodríguez Corrales; para que ese mismo día se formalice la comisión de aguas residuales, se definan los actores sociales que la integrarán y el plan de acciones a ejecutar” (ver los informes rendidos y la prueba aportada).
Sin embargo, se dejó claro que las acciones ejecutadas han sido mínimas, y que la problemática de salud pública persiste, ya que no se han implementado soluciones concretas. Como resultado, se establecieron los siguientes acuerdos de cumplimiento por parte de la Municipalidad de Upala: (…) Para el jueves 5 de junio de 2025, la Municipalidad deberá remitir un informe detallado con el documento oficial de conformación de la Comisión Interinstitucional de Aguas Residuales del cantón de Upala, en el que se evidencie la participación de la Municipalidad, el Ministerio de Salud y el AYA. Además, deberá incluir las acciones concretas realizadas respecto a la problemática, junto con un Plan Maestro de Saneamiento de Upala actualizado. Dado lo anterior, la solicitud de prórroga no procede. No obstante, quedamos atentos a la presentación del informe acordado en la reunión del 24 de mayo de 2025 solicitado por el nivel regional”. Lo anterior, le fue comunicado a la Municipalidad de Upala el 10 de junio de 2025 (ver los informes rendidos y la prueba aportada).
Los propietarios de las viviendas son responsables directos del manejo adecuado de sus aguas residuales como se ordena desde la Ley General de Salud y demás Decretos citados. Si la Municipalidad ya ejecutó obras correctivas, puede demostrar que acató la orden sanitaria mediante la implementación de un plan de acción. ejecución de las obras y seguimiento. Que la infraestructura cumple con su propósito (drenar aguas pluviales). pero que podría haber sido mal utilizada por terceros (vecinos conectando aguas negras). Que no tiene competencias ni facultades coercitivas para sancionar a esos propietarios en temas sanitarios (lo cual es función del Ministerio de Salud). Aunque el Ministerio puede alegar que no se ha resuelto el problema sanitario, si la causa es externa (conexiones ilegales). la Municipalidad no puede ser responsabilizada por omisión si, al no tener potestades sancionatorias en salud pública y no puede obligar a propietarios a hacer obras internas en sus viviendas, ni mucho menos intervenir con fondos públicos en ellas.
Se recomienda documentar todo lo ejecutado, adjuntar el plan de acción presentado originalmente, adjuntar los contratos de licitación pública respecto a las obras, órdenes de servicio, fotografías de antes y después. informes técnicos del Departamento de Gestión Vial, adjuntando informes técnicos (del ingeniero municipal o contratista) que indiquen que la infraestructura pluvial funciona correctamente. Presentar un informe detallado con cronograma de ejecución de las obras y fecha de finalización. Apartarse de responsabilidades por hechos de terceros, señalar por escrito que el posible rebalse de otras aguas residuales (aguas negras) no es atribuible a defectos de la infraestructura pluvial, sino a acciones irregulares de los vecinos y que sea el Ministerio de Salud, conforme a sus potestades que tome acciones contra los infractores Se reitera una vez más, que la Municipalidad no tiene competencia legal para intervenir instalaciones sanitarias internas de viviendas.
Solicitar el cierre por cumplimiento del procedimiento sanitario o archivo, debido a que la orden sanitaria fue acatada en su totalidad por parte de la Municipalidad, así como solicitar el archivo del expediente administrativo o la modificación de la orden sanitaria, dirigiéndose formalmente al área respectiva del Ministerio de Salud” (ver los informes rendidos y la prueba aportada).
aa) El 21 de noviembre de 2025, se notificó la resolución de curso al Ministerio de Salud y al Instituto Costarricense de Acueductos y Alcantarillados (ver actas de notificación).
bb) Mediante MEMORANDO No. SG-GSP-RT-2025-00172 del 24 de noviembre de 2025, el representante de la UEN Recolección y Tratamiento Periféricos del Instituto Costarricense de Acueductos y Alcantarillados estableció lo siguiente: “Conclusiones Técnicas 1. El proyecto no se encuentra dentro del área de cobertura del AyA, específicamente de Sistemas Periféricos, ya que la Municipalidad de Upala es operador del servicio de agua potable en la zona. 2. Conforme al principio del ciclo del agua, el operador del abastecimiento debe asumir también las responsabilidades del saneamiento. 3. La Municipalidad de Upala es la autoridad competente para aprobar el desarrollo urbano y exigir la solución de recolección y tratamiento de aguas residuales. 4. El Ministerio de Salud regula, pero no opera sistemas de saneamiento. 5. El AyA colabora únicamente desde su rol rector y asesor, bajo el principio de coordinación interinstitucional” (ver los informes rendidos y la prueba aportada).
Que antes del criterio legal, la Municipalidad realizó acciones orientadas al bienestar de la comunidad, sin intervenir sistemas sanitarios privados ni asumir competencias ajenas. 4. Que posterior al criterio legal de 2025, la Municipalidad ha mantenido disposición total de colaboración, limitada estrictamente a sus funciones técnicas y administrativas. 5. Que ninguna actuación municipal consignada en el expediente implica ejercicio de competencias en materia de tratamiento, regulación, fiscalización o intervención sanitaria, funciones que pertenecen al Ministerio de Salud. 6. Que toda la información solicitada se entrega debidamente sistematizada, con expediente foliado y ordenado cronológicamente, listo para ser utilizado por Gestión Jurídica en la elaboración del informe legal correspondiente a la Sala Constitucional. 7. Que según el primer párrafo de la quinta página del oficio MU-GJ-OFIC-0041-2025 hace mención de que la sala ordena "diseñar, concretar y financiar una solución integral al problema de tratamiento de aguas residuales en la urbanización Don Chu, dentro de un plazo de 8 meses" procesos en los cuales esta comisión no cuenta con injerencia para realizar ninguna de esas acciones” (ver los informes rendidos y la prueba aportada).
dd) El 02 de diciembre de 2026, se notificó la resolución de curso a la Municipalidad de Upala (ver acta de notificación).
V.Sobre el derecho a un ambiente sano y ecológicamente equilibrado. Debe indicarse, en primer lugar, que los derechos fundamentales a la salud y a un ambiente sano y ecológicamente equilibrado se encuentran reconocidos constitucionalmente (artículos 21, 50, 73 y 89 de la Constitución Política), así como, a través de la normativa internacional aplicable en Costa Rica. En este sentido, en sentencia nro. 2006-005928 de las 15:00 horas del 2 de mayo del 2006, reiterada en la sentencia nro. 2023-008920 de las 09:20 horas del 21 de abril de 2023, este Tribunal resolvió:
“El derecho a la vida reconocido en el numeral 21 de la Constitución es la piedra angular sobre la cual descansan el resto de los derechos fundamentales de los habitantes de la república. De igual forma, en ese ordinal de la carta política encuentra asidero el derecho a la salud, puesto que, la vida resulta inconcebible si no se le garantizan a la persona humana condiciones mínimas para un adecuado y armónico equilibrio psíquico, físico y ambiental. Ahora bien, la salud pública y el derecho a un ambiente sano y ecológicamente equilibrado se encuentran reconocidos constitucionalmente en los artículos 21, 50, 73 y 89 de la Constitución Política. Específicamente, el artículo 50 constitucional reconoce de forma expresa el derecho de todos los habitantes del país a disfrutar de un medio ambiente saludable y en perfecto equilibrio. Ese derecho es garantía fundamental para la protección de la vida y la salud pública.
En apoyo de lo anterior este Tribunal ha recurrido a la utilización de la noción de “calidad ambiental” como un parámetro, precisamente, de la calidad de vida de las personas, que se conjuga con otros elementos tales como la salud, la alimentación, el trabajo y la vivienda, haciendo referencia a que toda persona tiene derecho a hacer uso del ambiente para su propio desarrollo pero no de manera ilimitada, ya que, también, existe un deber de protección y preservación del medio ambiente para las generaciones presentes y futuras –principio de desarrollo sostenible– ”. Asimismo, del artículo 50 de la Constitución Política se deriva la obligación del Estado de proteger el ambiente. Norma que establece al efecto: "El Estado procurará el mayor bienestar a todos los habitantes del país, organizando y estimulando la producción y el más adecuado reparto de la riqueza. Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado.
Por ello está legitimada para denunciar los actos que infrinjan ese derecho y para reclamar la reparación del daño causado. El Estado garantizará, defenderá y preservará ese derecho. La ley determinará las responsabilidades y las sanciones correspondientes".
Con lo que se corrobora que las distintas autoridades públicas tienen el deber ineludible de preservar, defender y garantizar el derecho fundamental de toda persona a la salud y a un ambiente sano y ecológicamente equilibrado.
VI.La coordinación entre las dependencias públicas, para la protección del medio ambiente. En diversas oportunidades, la jurisprudencia constitucional ha indicado que la protección del ambiente es una tarea que corresponde a todos por igual, es decir, que existe una obligación para el Estado -como un todo- de tomar las medidas necesarias para proteger el medio, a fin de evitar grados de contaminación, deforestación, extinción de flora y fauna, uso desmedido o inadecuado de los recursos naturales, que pongan el peligro la salud de los administrados. En esta tarea, por institución pública, debe entenderse comprendida tanto la administración central, como la descentralizada. Es por ello, que podría pensarse que esta múltiple responsabilidad provocaría un caos en la gestión administrativa, lo cual no es cierto, por cuanto a fin de evitar la coexistencia simultánea de esferas de poder de diferente origen y esencia, la duplicación de los esfuerzos, así como la confusión de derechos y obligaciones entre las diversas partes involucradas, es que se hace necesario establecer una serie de relaciones de coordinación entre las diversas dependencias del Poder Ejecutivo y las instituciones descentralizadas, a fin de poder llevar a cabo las funciones que les han sido encomendadas.
Esta Sala con anterioridad -y en forma bastante clara- se ha referido al principio de coordinación de las dependencias públicas. De manera que la coordinación es la ordenación de las relaciones entre estas diversas actividades independientes, que se hace cargo de esa concurrencia en un mismo objeto o entidad, para hacerla útil a un plan público global, sin suprimir la independencia recíproca de los sujetos agentes. Como no hay una relación de jerarquía de las instituciones descentralizadas, con el ente público mayor, no es posible la imposición a éstas de determinadas conductas, con lo cual surge el imprescindible “concierto” interinstitucional, en sentido estricto, en cuanto los centros autónomos e independientes de acción se ponen de acuerdo sobre ese esquema preventivo y global, en el que cada uno cumple un papel con vista en una misión confiada a los otros.
Así, las relaciones con los poderes públicos, sólo pueden llevarse a cabo en un plano de igualdad, que den como resultado formas pactadas de coordinación, con exclusión de cualquier forma imperativa en detrimento de su autonomía, que permita sujetar a los entes corporativos a un esquema de coordinación sin su voluntad o contra ella; pero que sí admite la necesaria subordinación de estos entes al Estado y en interés de éste (a través de la tutela administrativa del Estado, y específicamente, en la función de control la legalidad que a éste compete, con potestades de vigilancia general sobre todo el sector público) (ver en ese sentido las sentencias nro. 21258-2010 de las 14:00 del 22 de noviembre de 2010, nro. 2913-2011 de las 12:00 horas del 4 de marzo de 2011 y nro. 2023-008920 de las 09:20 horas del 21 de abril de 2023).
VII.Sobre el fondo. Después de analizar los elementos probatorios aportados, este Tribunal verifica la violación a los derechos fundamentales de los amparados. Lo anterior, porque en los informes rendidos por los representantes de las autoridades recurridas -que se tiene por dado bajo fe de juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y la prueba aportada para la resolución del asunto, ha sido debidamente acreditado que la Urbanización Don Chú es una Urbanización de Bien Social compuesta por 240 viviendas, ubicada en el Distrito primero del cantón de Upala, Alajuela. Mediante informe MS-DRRCH-URS-IT-0147-20 del 17 de diciembre de 2020, la Unidad de Rectoría de la Salud de la Región de Chorotega del Ministerio de Salud le comunicó al Área Rectora de Salud de Upala lo siguiente: “(…) se concluye que las aguas residuales en su mayoría aguas servidas provenientes de piletas de lavado, lavadora y duchas de las viviendas que conforma la Urbanización Don Chú son descargadas a los caños públicos y desfogadas a la alcantarilla pluvial provocando contaminación ambiental y riesgo a la salud pública.
(…) Además, se perciben olores muy desagradables desde la acera y carretera (…)”. El 26 de febrero de 2021, el Área de Salud de Upala emitió la orden sanitaria no. ARS-U-OS-028-2021, en donde le ordenó al alcalde de la Municipalidad de Upala lo siguiente: “1. Presentar ante el Área Rectora de Salud de Upala un plan de acciones correctivas para la instalación y funcionamiento de un sistema de tratamiento de aguas residuales con capacidad optima, que brinde una solución integral al problema de las aguas residuales que presenta la Urbanización Don Chú, ubicada en el distrito primero del cantón de Upala. Dicho plan deberá adjuntar un cronograma de las actividades a realizar y el plazo de ejecución de estas, detallando fechas de inicio y final de cada actividad y el responsable de su ejecución. 2. El diseño, la instalación y el funcionamiento del sistema de tratamiento de aguas residuales deberá realizarse acatando la normativa técnica vigente, contando con los respectivos permisos y autorizaciones de las instituciones competentes, según sea el caso”.
Fecha de notificación: 01 de marzo de 2021; fecha de vencimiento: 27 de mayo de 2021. El 26 de febrero de 2021, el Área de Salud de Upala emitió la orden sanitaria no. ARS-U-OS-029-2021, en donde le ordenó al presidente del Concejo de la Municipalidad de Upala lo siguiente: “1. Presentar ante el Área Rectora de Salud de Upala un plan de acciones correctivas para la instalación y funcionamiento de un sistema de tratamiento de aguas residuales con capacidad optima, que brinde una solución integral al problema de las aguas residuales que presenta la Urbanización Don Chú, ubicada en el distrito primero del cantón de Upala. Dicho plan deberá adjuntar un cronograma de las actividades a realizar y el plazo de ejecución de estas, detallando fechas de inicio y final de cada actividad y el responsable de su ejecución. 2. El diseño, la instalación y el funcionamiento del sistema de tratamiento de aguas residuales deberá realizarse acatando la normativa técnica vigente, contando con los respectivos permisos y autorizaciones de las instituciones competentes, según sea el caso”.
Fecha de notificación: 01 de marzo de 2021; fecha de vencimiento: 27 de mayo de 2021. El 26 de febrero de 2021, el Área de Salud de Upala emitió la orden sanitaria no. ARS-U-OS-030-2021, en donde le ordenó al presidente Ejecutivo del Instituto Costarricense de Acueductos y Alcantarillados lo siguiente: “1. Presentar ante el Área Rectora de Salud de Upala un plan de acciones correctivas para la instalación y funcionamiento de un sistema de tratamiento de aguas residuales con capacidad optima, que brinde una solución integral al problema de las aguas residuales que presenta la Urbanización Don Chú, ubicada en el distrito primero del cantón de Upala. Dicho plan deberá adjuntar un cronograma de las actividades a realizar y el plazo de ejecución de estas, detallando fechas de inicio y final de cada actividad y el responsable de su ejecución. 2. El diseño, la instalación y el funcionamiento del sistema de tratamiento de aguas residuales deberá realizarse acatando la normativa técnica vigente, contando con los respectivos permisos y autorizaciones de las instituciones competentes, según sea el caso”.
Fecha de notificación: 01 de marzo de 2021; fecha de vencimiento: 27 de mayo de 2021. Mediante oficio no. PRE-2021-00617 del 24 de mayo de 2021, el presidente ejecutivo del Instituto Costarricense de Acueductos y Alcantarillados le comunicó al Área de Salud de Upala y a la Municipalidad de Upala que en el año 2010 se presentó a la Municipalidad de Upala el documento “Plan Maestro para los Sistemas de Abastecimiento de Agua y Saneamiento de Upala, Alajuela”, que debía ser ejecutado por la Municipalidad, como ente operador público autorizado dentro del cantón en un plazo de 10 años; ese plazo fue superado y costaba en ese momento 4,5 millones de dólares. Ese mismo documento indica los pasos que debe seguir el municipio para comenzar el proyecto y el AyA asesoraría el proceso. Mediante oficio no. DAMU-0400-05-2021 del 26 de mayo de 2021, la alcaldesa de la Municipalidad de Upala le solicitó al Área Rectora de Salud de Upala una prórroga a la orden sanitaria ARS-U-OS-030-2021 (sic).
Mediante oficio MS-DRRSCH-DARSU-421-2021 del 08 de junio de 2021, el Área de Salud de Upala le comunicó a la alcaldesa de la Municipalidad de Upala que “concede la prórroga por treinta días a partir del 28 de mayo de 2021”. Lo anterior, le fue comunicado a la Municipalidad de Upala el 10 de junio de 2021. El 09 de febrero de 2022, en el Área de Salud de Upala se recibió nota sin número de oficio suscrito por el señor Gerardo Fonseca Obando y firmado por vecinos de la Urbanización Don Chú, manifestando el problema de contaminación en los caños por aguas residuales, falta de mantenimiento por parte de la municipalidad y malos olores; para que se realizara lo necesario para eliminar el problema. Mediante oficio MS-DRRSCH-DARSU-057-2022 del 17 de febrero de 2022, la directora del Área de Salud de Upala les comunicó a los vecinos denunciantes que trasladará la denuncia a la Municipalidad de Upala.
El 19 de junio de 2023, la Municipalidad de Upala le comunicó al Área Rectora de Salud Upala el oficio no. DAMU-0496-06-2021, en donde se indica lo siguiente: “(…) se requiere de una solución integral que contemple un sistema que recolecte, conduzca y trate las aguas residuales, y no únicamente un sistema de tratamiento. Además, no solo se necesita esta solución integral en el barrio Don Chu sino en todo el centro urbano de Upala. Se visualizó que la conducción de las aguas residuales que, deberían ser pluviales, salen de lo interno de las viviendas hacia el sistema de conducción de las aguas llovidas, lo cual imposibilita a la Municipalidad realizar una intervención con presupuesto propio para revertir esta situación (…) Conforme al punto 2 en el oficio PRE-2021-00617 del 24 de mayo de 2021, el AyA explica el proceso de planeación, el cual conlleva una serie de fases para dar resultado a un Plan Maestro para un sistema de saneamiento de aguas residuales en el centro de Upala (…) 4.
Finalmente, con el fin de cumplir con lo solicitado en la Orden sanitaria, se incluye un Plan de acción que incorpora medidas atinentes a propiciar una mejora en el tratamiento de las aguas residuales a lo interno de las viviendas con su respectiva fecha de ejecución, pero también incorpora a solicitud de los habitantes del Barrio Don Chu, un plan de intervención urbana que involucre la participación ciudadana y presupuesto municipal”. Mediante oficio técnico de inspección no. RCH-ARSU-ERS-IT-271-2024 del 19 de marzo de 2024, el Equipo Regulación de la Salud del Área Rectora de Salud de Upala le comunicó a la directora de esa Área de Salud, lo siguiente: “En fecha 18 de marzo de 2024 se convoca a funcionarios del Área Rectora de Salud de Upala a participar en una reunión con funcionarios de la Municipalidad de Upala para tratar el tema. En dicha reunión se hizo un resumen de la problemática, se trató el tema del cumplimiento del plan de acción que en su momento entregó la Municipalidad de Upala en el Oficio DAMU-0496-06-2021, y los problemas que tiene la administración en la construcción de una planta de tratamiento de aguas residuales para la urbanización, ya que dicho problema existe básicamente en todo el distrito central y no se cuenta con un presupuesto lo suficientemente grande para la construcción de una planta de tratamiento.
Además, se acordó lo siguiente: 1. La Municipalidad conformará la comisión o equipo técnico para tratar el tema. 2. Conformada la comisión se actualizará el plan de acción. 3. La Municipalidad solicitará al Ministerio de Salud prórroga para el cumplimiento del plan de acción actualizado. 4. Con la colaboración del Ministerio de Salud, se creará material informativo para distribuirlo a la población. 5. Se debe convocar a los encargados del tema en el Instituto Costarricense de Acueductos y Alcantarillados (AyA) para que brinden asesoría técnica y cualquier colaboración pertinente. 6. Todo esto se realizará en el corto plazo. 7. El Área Rectora de Salud Upala deberá brindar seguimiento a las gestiones y acciones realizadas por la comisión. Tanto la Municipalidad de Upala como el AyA cumplieron con las órdenes sanitarias ARS-U-OS 2021, ARS-U-OS-029-2021 y ARS-U-OS-030-2021, ya que ambas instituciones presentaron ante el Área Rectora de Salud de Upala lo ordenado en las mismas.
Sin embargo, no se ha dado cumplimiento del plan de acción propuesto (…) 8. CONCLUSIÓN Aún no se cuenta con una solución integral al problema de aguas residuales existente en la Urbanización Don Chú, por lo que las aguas residuales (principalmente grises) son desfogadas al cordón de caño sin ningún tratamiento. La Municipalidad de Upala ha realizado algunas acciones establecidas en un plan de acción, sin embargo, dicho plan debe actualizarse, conformar la comisión o equipo técnico y continuar con las gestiones correspondientes y contando con la colaboración del AyA. 9. RECOMENDACIONES AL ÁREA RECTORA DE SALUD DE SALUD. La dirección de Área Rectora de Salud Upala deberá brindar seguimiento al plan de acción actualizado que presente la Municipalidad de Upala, el cual deberá realizarse en un corto plazo con el fin de obtener una solución integral al problema de aguas residuales de la Urbanización Don Chú (…)”.
De lo anterior, se denota que, de dicha reunión por parte del Ministerio de Salud, se evidencia que tanto la Municipalidad de Upala, como el ICAA cumplieron en parte con las órdenes sanitarias ARS-U-OS-028-2021, ARS-U-OS-029-2021 y ARS-U-OS-030-2021, ya que ambas instituciones presentaron ante el Área Rectora de Salud de Upala lo ordenado en las mismas. Sin embargo, no se ha dado cumplimiento del plan de acción propuesto y así brindar una solución integral al problema de aguas residuales de la Urbanización Don Chú.
Por otra parte, mediante oficio técnico de inspección no. RCH-ARSU-ERS-IT-029-2025 del 20 de enero de 2025, el Equipo Regulación de la Salud del Área Rectora de Salud de Upala le comunicó a la directora de esa Área de Salud, lo siguiente: “Brindar seguimiento al plan de acciones correctivas presentado por funcionarios de la Municipalidad en oficios DAMU-0496-06-2021 y DCU-OF-013-2024 (…) Fecha de inspección: 15 de enero de 2025. 6. RESULTADOS DE LA INSPECCION (HALLAZGOS) (…) Según el expediente administrativo e información de los funcionarios municipales se indica lo siguiente: 1. La Municipalidad conformó una comisión o equipo técnico para tratar el tema, sin embargo, no se ha informado oficialmente quienes lo conforman y las acciones realizadas. 2. No se ha actualizado el plan de acción. 3. No se solicitó la prórroga al Ministerio de Salud para el cumplimiento del plan de acción actualizado.
(…) 5. No se ha convocado a los encargados del tema en el Instituto Costarricense de Acueductos y Alcantarillados (AyA) para que brinden asesoría técnica y cualquier colaboración pertinente a la Municipalidad. En general no se ha cumplido con los acuerdos tomados en la reunión del pasado 18 de marzo de 2024, por lo tanto, se incumple el plan de acciones correctivas presentado en los oficios DAMU-0496-06-2021 y DCU-OF-013-2024, según las órdenes sanitarias ARS-U-OS-028-2021 y ARS-U-OS-029-2021 (…) 8. CONCLUSIÓN Aún no se cuenta con una solución integral al problema de aguas residuales existente en la Urbanización Don Chú, por lo que las aguas residuales (principalmente grises) son desfogadas al cordón de caño sin ningún tratamiento. De esta forma se incumple con el plan de acciones correctivas presentado en los oficios DAMU-0496-06-2021 y DCU-OF-013-2024, según las órdenes sanitarias ARS-U-OS-028-2021 y ARS-U-OS-029-2021. 9.
RECOMENDACIONES AL ÁREA RECTORA DE SALUD DE SALUD. La dirección de Área Rectora de Salud Upala deberá hacer la respectiva consulta ante niveles superiores del Ministerio de Salud para que se determinen las acciones a seguir en este caso, por el incumplimiento reiterado del plan de acciones correctivas según las órdenes sanitarias ARS-U-OS-028- 2021 y ARS-U-OS-029-2021”. Mediante oficio no. MS-DRRSCH-DARSU-0092-2025 del 26 de febrero de 2025, el Área de Salud de Upala le comunicó a la alcaldesa de la Municipalidad de Upala lo siguiente: “(…) En el seguimiento realizado por el equipo de regulación de la salud, se evidencia no se ha cumplido con los acuerdos tomados en la reunión del pasado 18 de marzo de 2024, por lo tanto, se incumple el plan de acciones correctivas presentado en los oficios DAMU-0496-06-2021 y DCU-OF-013-2024, según las órdenes sanitarias ARS-U-OS-028-2021 y ARS-U-OS-029-2021.
A la actualidad, no se cuenta con una solución integral al problema de aguas residuales existente en la Urbanización Don Chú, por lo que las aguas residuales (principalmente grises) son desfogadas al cordón de caño sin ningún tratamiento. De esta forma se incumple con el plan de acciones correctivas presentado en los oficios DAMU-0496-06-2021 y DCU-OF-013-2024, según las órdenes sanitarias ARS-U-OS-028-2021 y ARS-U-OS-029-2021. Por lo anterior, se estará elevando el caso a niveles superiores para su respectiva valoración y lo que corresponda”. Lo anterior, le fue comunicado a la Municipalidad de Upala el 07 de marzo de 2025. Mediante CARTA-MS-DRRSCH-DARSU-0118-2025 del 18 de marzo de 2025, el Área Rectora de Salud de Upala le comunicó a la Dirección Regional de Chorotega del Ministerio de Salud lo siguiente: “Traslado informe técnico indicado en el asunto. Se traslada para valoración y criterio sobre acciones a seguir, ya que desde el 2021 que se giraron dichas ordenes sanitarias y a pesar de acercamientos, seguimiento y acuerdos, la municipalidad de Upala no ha cumplido en tiempo y forma, por lo que actualmente no se cuenta con una solución integral al preocupante problema de aguas residuales de la comunidad Don Chu.
Agradecemos una pronta intervención”. Mediante informe MS-DRRSCH-URS-IT-14-2025 (respuesta a CARTA MS-DRRRSCH-DARSU-0018-20225) del 27 de marzo de 2025, los representantes de la Unidad de Rectoría de la Salud de la Región Chorotega establecieron lo siguiente: “(…): a. Hasta la fecha evidentemente se encuentra un incumplimiento al plan de acciones correctivas presentado por la Municipalidad de Upala y además, un incumplimiento a los acuerdos tomados en la reunión presencial del 18 de marzo con la Municipalidad (…) El problema sobre la descarga ilegal de aguas residuales en la vía pública de la Urbanización Don Chu en Upala no se ha resuelto, afectando la salud pública. 7. CONCLUSIÓN Y RECOMENDACIONES (…) se concluye que la ordenes sanitarias ARS-U-OS-028-2021 y ARS-U-OS-029-2021 no se han cumplido a cabalidad, dejando sin resolver la problemática de salud pública que representa la descarga de aguas residuales a la vía pública provenientes de la Urbanización Don Chú en Upala”.
El 24 de abril 2025 se realiza reunión con la Licda. Laura Rodríguez, coordinadora del proceso de regulación de la Salud del nivel regional Chorotega y funcionarios del Área Rectora de salud Upala y Municipalidad de Upala, donde nuevamente se instruye en los temas de seguimiento y documentación de las acciones, importancia de la comisión interinstitucional, la elaboración de un plan maestro, aspectos legales y servidumbres y la coordinación de expedientes y comunicaciones entre instituciones. Además, se llega al acuerdo que la Municipalidad de Upala remitiría un informe detallado a más tardar 05 de junio 2025, con la conformación oficial de la Comisión Interinstitucional de Aguas Residuales del cantón de Upala, con participación de representantes de la Municipalidad (líder del proceso), A Y A, y Ministerio de Salud (nivel regional y local), y que incluyera las acciones concretas con respecto a dicha problemática.
Mediante oficio no. MU-ALM-OFIC-853-2025 del 04 de junio de 2025, la alcaldesa de la Municipalidad de Upala le solicitó al Área Rectora de Salud de Upala “prórroga de la orden sanitaria ARS-U-OS-028-2021, con el fin de actualizar el plan de acción y poder continuar con el proceso en tiempo y en forma”. Mediante oficio no. CARTA-MS-DRRSCH-DARSU-0224-2025 del 10 de junio de 2025, el Área Rectora de Salud de Upala le comunicó a la alcaldesa de la Municipalidad de Upala lo siguiente: “En atención a su solicitud, (…) le informamos que no es posible otorgar una prórroga para una orden cuyo plazo ha vencido y por las siguientes razones (…) se explicó que la orden sanitaria ARS-U-OS-028-2021 se considera cumplida en cuanto a la presentación del Plan de Acciones. Sin embargo, se dejó claro que las acciones ejecutadas han sido mínimas, y que la problemática de salud pública persiste, ya que no se han implementado soluciones concretas (…) Dado lo anterior, la solicitud de prórroga no procede.
No obstante, quedamos atentos a la presentación del informe acordado en la reunión del 24 de mayo de 2025 solicitado por el nivel regional”. Mediante oficio no. MU-GJ-CL-18-2025 del 12 de junio de 2025, el gestor jurídico de la Municipalidad de Upala le comunicó a la coordinadora de Desarrollo Territorial de esa misma municipalidad lo siguiente: “Asunto: Criterio legal respecto referente a la orden sanitaria ARS-U-OS-028-2021 del Ministerio de Salud, a solicitud mediante oficio MU-CTE-OFIC-004-2025 (…) IV. RECOMENDACIÓN. Con fundamento en la normativa citada y conforme al principio de legalidad, la Municipalidad de Upala tiene la obligación de cumplir aquellas ordenes sanitarias interpuestas por el Ministerio de Salud que sean acordes con las competencias Municipales, el marco jurídico costarricense establece que las Municipalidades son responsables de construir y mantener la infraestructura pluvial (aguas de lluvia), no de otras aguas residuales. como por ejemplo aguas negras.
El Ministerio de Salud y AyA son los entes competentes para regular, fiscalizar y sancionar descargas indebidas de aguas residuales. Los propietarios de las viviendas son responsables directos del manejo adecuado de sus aguas residuales como se ordena desde la Ley General de Salud y demás Decretos citados. Si la Municipalidad ya ejecutó obras correctivas, puede demostrar que acató la orden sanitaria mediante la implementación de un plan de acción. ejecución de las obras y seguimiento. Que la infraestructura cumple con su propósito (drenar aguas pluviales). pero que podría haber sido mal utilizada por terceros (vecinos conectando aguas negras). Que no tiene competencias ni facultades coercitivas para sancionar a esos propietarios en temas sanitarios (lo cual es función del Ministerio de Salud). Aunque el Ministerio puede alegar que no se ha resuelto el problema sanitario, si la causa es externa (conexiones ilegales). la Municipalidad no puede ser responsabilizada por omisión si, al no tener potestades sancionatorias en salud pública y no puede obligar a propietarios a hacer obras internas en sus viviendas, ni mucho menos intervenir con fondos públicos en ellas.
Se recomienda documentar todo lo ejecutado, adjuntar el plan de acción presentado originalmente, adjuntar los contratos de licitación pública respecto a las obras, órdenes de servicio, fotografías de antes y después. informes técnicos del Departamento de Gestión Vial, adjuntando informes técnicos (del ingeniero municipal o contratista) que indiquen que la infraestructura pluvial funciona correctamente. Presentar un informe detallado con cronograma de ejecución de las obras y fecha de finalización. Apartarse de responsabilidades por hechos de terceros, señalar por escrito que el posible rebalse de otras aguas residuales (aguas negras) no es atribuible a defectos de la infraestructura pluvial, sino a acciones irregulares de los vecinos y que sea el Ministerio de Salud, conforme a sus potestades que tome acciones contra los infractores Se reitera una vez más, que la Municipalidad no tiene competencia legal para intervenir instalaciones sanitarias internas de viviendas.
Solicitar el cierre por cumplimiento del procedimiento sanitario o archivo, debido a que la orden sanitaria fue acatada en su totalidad por parte de la Municipalidad, así como solicitar el archivo del expediente administrativo o la modificación de la orden sanitaria, dirigiéndose formalmente al área respectiva del Ministerio de Salud”. Mediante MEMORANDO No. SG-GSP-RT-2025-00172 del 24 de noviembre de 2025, el representante de la UEN Recolección y Tratamiento Periféricos del Instituto Costarricense de Acueductos y Alcantarillados estableció lo siguiente: “Conclusiones Técnicas 1. El proyecto no se encuentra dentro del área de cobertura del AyA, específicamente de Sistemas Periféricos, ya que la Municipalidad de Upala es operador del servicio de agua potable en la zona. 2. Conforme al principio del ciclo del agua, el operador del abastecimiento debe asumir también las responsabilidades del saneamiento. 3.
La Municipalidad de Upala es la autoridad competente para aprobar el desarrollo urbano y exigir la solución de recolección y tratamiento de aguas residuales. 4. El Ministerio de Salud regula, pero no opera sistemas de saneamiento. 5. El AyA colabora únicamente desde su rol rector y asesor, bajo el principio de coordinación interinstitucional”.
De lo anterior, se reitera que se evidencia que tanto la Municipalidad de Upala, como el ICAA cumplieron en parte con las órdenes sanitarias ARS-U-OS-028-2021, ARS-U-OS-029-2021 y ARS-U-OS-030-2021, ya que ambas instituciones presentaron ante el Área Rectora de Salud de Upala lo ordenado en las mismas. Sin embargo, no se ha dado cumplimiento del plan de acción propuesto y así brindar una solución integral al problema de aguas residuales de la Urbanización Don Chú. Es decir, las órdenes sanitarias ARS-U-OS-028-2021, ARS-U-OS-029-2021 y ARS-U-OS-030-2021 siguen sin cumplirse en su totalidad. Sobre el particular, se verifica que efectivamente existe un problema con las aguas residuales de la Urbanización Don Chú, pues son descargadas a los caños públicos y desfogadas a la alcantarilla pluvial, provocando contaminación ambiental, malos olores y riesgo a la salud pública. Por ende, a pesar de que desde el 2020 se tiene conocimiento de la situación, actualmente no se cuenta con una solución integral al problema de aguas residuales existente en la Urbanización Don Chú, por lo que las aguas residuales (principalmente grises) son desfogadas al cordón de caño sin ningún tratamiento, constatándose el problema de contaminación ambiental.
Ahora bien, este Tribunal considera que ha existido una falta de coordinación entre las 3 autoridades recurridas que ha conlleva a que actualmente exista un problema de contaminación ambiental y la falta de una solución integral al problema de aguas residuales existente en la Urbanización Don Chú.
Dicha situación será abordada en los próximos considerandos.
VIII.Sobre la actuación de la Municipalidad de Upala. Sobre el particular, se denota que desde el 26 de febrero de 2021 el Área de Salud de Upala emitió 2 órdenes sanitarias en contra de la Municipalidad de Upala: la orden sanitaria no. ARS-U-OS-028-2021 al alcalde y la orden sanitaria no. ARS-U-OS-029-2021 al presidente del Concejo, en donde se les instauraba a presentar “un plan de acciones correctivas para la instalación y funcionamiento de un sistema de tratamiento de aguas residuales con capacidad optima, que brinde una solución integral al problema de las aguas residuales que presenta la Urbanización Don Chú”, así como el “diseño, la instalación y el funcionamiento del sistema de tratamiento de aguas residuales”. Sobre lo anterior, se comprueba que si bien es cierto la Municipalidad de Upala ha realizado varias gestiones para solventar la situación indicada, lo cierto es que dichas ordenes sanitarias no han sido cumplidas en su totalidad, ya que se mantiene el problema de contaminación ambiental y la falta de una solución integral al problema de aguas residuales existente en la Urbanización Don Chú.
Así, en uno de los últimos oficios emitidos por el Ministerio de Salud (informe MS-DRRSCH-URS-IT-14-2025 del 27 de marzo de 2025, se estableció que “Hasta la fecha evidentemente se encuentra un incumplimiento al plan de acciones correctivas presentado por la Municipalidad de Upala y además, un incumplimiento a los acuerdos tomados en la reunión presencial del 18 de marzo con la Municipalidad (…) El problema sobre la descarga ilegal de aguas residuales en la vía pública de la Urbanización Don Chu en Upala no se ha resuelto, afectando la salud pública. (…) se concluye que la ordenes sanitarias ARS-U-OS-028-2021 y ARS-U-OS-029-2021 no se han cumplido a cabalidad, dejando sin resolver la problemática de salud pública que representa la descarga de aguas residuales a la vía pública provenientes de la Urbanización Don Chú en Upala”. Así, queda claro que la Municipalidad de Upala no ha cumplido con las órdenes sanitarias en su totalidad.
Por otra parte, la Municipalidad recurrida intenta alegar que no le corresponde resolver esa problemática y que se tenga por cumplida dichas órdenes. En cuanto a este punto, es menester indicar que dicha postura de la Municipalidad de Upala acaeció posterior a que el Ministerio de Salud no aprobara la prórroga de la orden sanitaria emitida, esto mediante oficio no. CARTA-MS-DRRSCH-DARSU-0224-2025 del 10 de junio de 2025, en donde el Área Rectora de Salud de Upala le comunicó a la alcaldesa de la Municipalidad de Upala lo siguiente: “En atención a su solicitud, (…) le informamos que no es posible otorgar una prórroga para una orden cuyo plazo ha vencido y por las siguientes razones (…) se considera cumplida en cuanto a la presentación del Plan de Acciones. Sin embargo, se dejó claro que las acciones ejecutadas han sido mínimas, y que la problemática de salud pública persiste, ya que no se han implementado soluciones concretas (…) Dado lo anterior, la solicitud de prórroga no procede”.
Por consiguiente, se constata que sí existen 2 órdenes sanitarias en contra de la Municipalidad de Upala, en donde el Ministerio de Salud, en cumplimiento de sus competencias normativas, le ha instado a dicha Municipalidad a cumplir con una serie de puntos tendientes a solventar el problema ambiental constatado. Por lo que no es de recibo la posición de dicha Municipalidad de intentar suprimir sus responsabilidades normativas. Recordemos que este Tribunal ha mencionado que el artículo 169, de la Constitución Política, dispone el deber de las municipalidades del país de velar por los intereses de los habitantes de su jurisdicción, de ahí que, en reiterados pronunciamientos, este Tribunal ha señalado que, dichas corporaciones se encuentran en la obligación de eliminar cualquier tipo de amenaza que ponga en riesgo los derechos a la salud y a un medio ambiente sano y ecológicamente equilibrado de las personas que viven en su cantón (véase la Sentencia N° 2008-11739 de las 12:12 horas del 25 de julio de 2008, reiterada en la N° 2020-014753, de las 9:15 horas del 7 de agosto de 2020).
Nótese que, inclusive, en el último informe del Concejo Municipal del 28 de mayo de 2026 se alega que “esta Presidencia impulsará las siguientes acciones: a) Gestionar la convocatoria formal ante el Concejo Municipal de la Comisión Técnica Especializada de Seguimiento a las Órdenes Sanitarias del Sistema de Tratamiento de Aguas Residuales del Barrio Don Chú, con el fin de que rinda un informe integral y actualizado respecto de: • estado actual de la problemática; • acciones ejecutadas; • acuerdos pendientes; • limitaciones técnicas y administrativas existentes; • coordinación interinstitucional desarrollada; • posibles rutas de solución técnica y administrativa. b) Solicitar formalmente a la Administración Municipal un informe actualizado sobre: • cumplimiento de planes de acción; • estado de las coordinaciones efectuadas con el Ministerio de Salud y AyA •situación actual de las órdenes sanitarias; • eventuales necesidades presupuestarias, técnicas o administrativas; • posibilidades de articulación institucional futura. c) Incorporar el tema dentro de la agenda de una próxima sesión ordinaria del Concejo Municipal, con el propósito de que el órgano colegiado conozca formalmente la situación expuesta y valore eventuales mecanismos de seguimiento institucional dentro del marco competencial correspondiente. d) Promover la conformación o fortalecimiento de espacios de articulación y trabajo interinstitucional entre Municipalidad de Upala, Ministerio de Salud, Instituto Costarricense de Acueductos y Alcantarillados, Administración Municipal y demás instancias técnicas competentes, orientados a procurar coordinación efectiva, intercambio de información y análisis de alternativas viables para la atención integral de la problemática denunciada. e) Dar seguimiento desde el Concejo Municipal a las gestiones e informes que se generen en relación con este tema, a efectos de mantener conocimiento actualizado sobre el avance institucional de las acciones vinculadas a la situación expuesta”.
No obstante, no se tiene por demostrado que esas acciones se hayan ejecutado ante una problemática que la Municipalidad conoce desde el 2021, lo cual confirma la omisión de esa Municipalidad en cumplir con lo ordenado.
Ahora bien, si la Municipalidad estima que el Instituto Costarricense de Acueductos y Alcantarillados también tiene responsabilidad en el asunto, lo correspondiente es recordarle lo indicado en el considerando VI respecto a la coordinación interinstitucional en materia ambiental. Específicamente en materia de tutela ambiental, la sentencia número 2008-004790, subrayó el deber de coordinación entre las instituciones relacionadas con el tema y la imposibilidad de hacer caso omiso a las advertencias sobre el peligro de contaminación que emite una institución facultada por ley para proteger el ambiente. De ese modo, en la sentencia nro. 2020-018888 de las 09:15 horas del 2 de octubre de 2020, reiterada en la sentencia nro. 2025-023963 de las 09:15 horas del 1 de agosto de 2025, se indicó, en lo que interesa, lo siguiente:
“Este Tribunal ha reconocido que las corporaciones locales tienen, dentro del ámbito de sus competencias y obligaciones una alta cuota de responsabilidad en materia ambiental, sea mediante la aprobación directa de permisos o licencias para las cuales se exija el previo cumplimiento de requisitos que acrediten ante otras instancias del poder público el adecuado manejo ambiental, como mediante inspecciones regulares y canalización de situaciones de riesgo ante las instancias con mayor competencia de intervención. Ha quedado establecido ya que a los gobiernos locales les alcanza la obligación de coordinación y prevención en materia ambiental dentro del ámbito de su jurisdicción territorial, de donde resulta que ciertamente las municipalidades son actores importantes en la tarea de protección al ambiente. Como se indicó supra, no solo ese cabildo, sino todas las demás autoridades recurridas, cuentan con amplias facultades de actuación, y si bien se encuentran sujetas a la legalidad y la razonabilidad, lo cierto es que teniendo en cuenta que se trata de una amenaza al medio ambiente y a la salud pública, la legalidad y los formalismos se ven desplazados”.
A partir de lo expuesto, se debe hacer énfasis respecto a la obligación de coordinación y prevención en materia ambiental que posee el municipio accionado dentro del ámbito de su jurisdicción territorial, motivo por el cual no es de recibo los argumentos esgrimidos por esa Municipalidad en los informes rendidos, toda vez que no ha realizado las acciones pertinentes para solventar la problemática ambiental en beneficio de los habitantes de la urbanización respectiva, a pesar de que ha sido debidamente comprobado el problema ambiental mencionado. Adicionalmente, se reitera lo indicado respecto a las obligaciones derivadas de lo contemplando en los artículos 169 y 170 de la Constitución Política respecto a que a las municipalidades les corresponde la administración de los servicios e intereses locales, con el fin de promover el desarrollo integral de los cantones en armonía con el desarrollo nacional; así como también velar por los derechos de sus munícipes de manera que no puede permanecer inerte, cuando a los munícipes se les afectan derechos fundamentales como sucede en el caso concreto.
De esta forma, se denota una lesión a los derechos fundamentales de los amparados ante la omisión constatada de la Municipalidad de Upala en resolver el problema ambiental respectivo.
IX.Sobre la actuación del Instituto Costarricense de Acueductos y Alcantarillados. Al respecto, al igual que sucede con la Municipalidad de Upala, se verifica que el 26 de febrero de 2021, el Área de Salud de Upala emitió la orden sanitaria no. ARS-U-OS-030-2021, en donde le ordenó al presidente Ejecutivo del Instituto Costarricense de Acueductos y Alcantarillados lo siguiente: “1. Presentar ante el Área Rectora de Salud de Upala un plan de acciones correctivas para la instalación y funcionamiento de un sistema de tratamiento de aguas residuales con capacidad optima, que brinde una solución integral al problema de las aguas residuales que presenta la Urbanización Don Chú, ubicada en el distrito primero del cantón de Upala. Dicho plan deberá adjuntar un cronograma de las actividades a realizar y el plazo de ejecución de estas, detallando fechas de inicio y final de cada actividad y el responsable de su ejecución. 2.
El diseño, la instalación y el funcionamiento del sistema de tratamiento de aguas residuales deberá realizarse acatando la normativa técnica vigente, contando con los respectivos permisos y autorizaciones de las instituciones competentes, según sea el caso”. Es decir, el Área de Salud de Upala también le ordenó a dicho Instituto varias acciones tendientes a solventar la problemática ambiental constatada, sin que, a la fecha, según lo indicado en los considerandos anteriores, se haya resuelto dicha situación. Esto, confirma también una omisión por parte del ICAA en cumplir con lo ordenado por el Ministerio de Salud para solventar la problemática ambiental constatada. Nótese que, inclusive, el ICAA afirma que “la solución para atender la problemática de saneamiento de aguas residuales en la Urbanización don Chú requiere de un planteamiento integral, ya que además del tratamiento de las aguas residuales que solicitó el Ministerio de Salud en la Orden Sanitaria ARS-U-OS-030-2022, se debe resolver su recolección y disposición, cumplimiento con la normativa y reglamentación técnica vigente en esa materia”.
En otras palabras, admite que la problemática requiere de una solución integral, la cual, claramente, a la fecha no se ha logrado. Igualmente, resulta relevante recordarle a dicho instituto recurrido su obligación de velar por la protección a un ambiente sano y ecológicamente equilibrado lo que indudablemente incluye la debida recolección, tratamiento y disposición final de las aguas residuales. En ese sentido, lo establece la propia Ley Constitutiva Instituto Costarricense Acueductos y Alcantarillados, Ley nro. 2726, específicamente en sus artículos 1 y 2:
“ARTICULO 1º.- Con el objeto de dirigir, fijar políticas, establecer y aplicar normas, realizar y promover el planeamiento, financiamiento y desarrollo y de resolver todo lo relacionado con el suministro de agua potable y recolección y evacuación de aguas negras y residuos industriales líquidos, lo mismo que el aspecto normativo de los sistemas de alcantarillado pluvial en áreas urbanas, para todo el territorio nacional se crea el Instituto Costarricense de Acueductos y Alcantarillados, como institución autónoma del Estado.
ARTICULO 2º.- Corresponde al Instituto Costarricense de Acueductos y Alcantarillados:
Bajo ningún concepto podrá delegar la administración de los sistemas de acueductos y alcantarillado sanitario del Área Metropolitana.
Tampoco podrá delegar la administración de los sistemas sobre los cuales exista responsabilidad financiera y mientras ésta corresponda directamente al Instituto.
Queda facultada la institución para convenir con organismos locales, la administración de tales servicios o administrarlos a través de juntas administradoras de integración mixta entre el Instituto y las respectivas comunidades, siempre que así conviniere para la mejor prestación de los servicios y de acuerdo con los reglamentos respectivos.
Por las mismas razones y con las mismas características, también podrán crearse juntas administradoras regionales que involucren a varias municipalidades; h) Hacer cumplir la Ley General de Agua Potable, para cuyo efecto el Instituto se considerará como el organismo sustituto de los ministerios y municipalidades indicados en dicha ley; i) Construir, ampliar y reformar los sistemas de acueductos y alcantarillados en aquellos casos en que sea necesario y así lo aconseje la mejor satisfacción de las necesidades nacionales; y j) Controlar la adecuada inversión de todos los recursos que el Estado asigne para obras de acueductos y alcantarillado sanitario.
(*)k) Se autoriza al Instituto Costarricense de Acueductos y Alcantarillados, para que formalice, mediante convenio interinstitucional con las corporaciones municipales, la construcción, ampliación y rehabilitación de obras para el suministro de agua potable y servicio de alcantarillado, con el fin de proporcionar esos servicios en aquellas zonas en donde el Instituto Costarricense de Acueductos y Alcantarillados no tenga cobertura en determinadas zonas o que teniendo, no pueda brindar el servicio por limitaciones constructivas del sistema, pero que técnicamente existe disponibilidad del recurso hídrico.
Los estudios previos y los planos de las obras constructivas de los diferentes sistemas de agua potable y alcantarillado, que lleven a cabo las municipalidades, deben contar con la aprobación previa en sus aspectos técnicos y de diseño por parte del Instituto Costarricense de Acueductos y Alcantarillados, para asegurar su incorporación a los sistemas que ya tenga en operación el Instituto, una vez concluidas las obras, de conformidad con el inciso b).
Se autoriza a las municipalidades para que elaboren, por sí mismas o terceros, los planos constructivos de los sistemas de acueducto y alcantarillado.
Una vez recibida a satisfacción la obra que construye la corporación municipal, por parte del Instituto Costarricense de Acueductos y Alcantarillados, debe incorporarse en la tarifa del servicio el rubro correspondiente para efectuar el pago íntegro a favor de la corporación municipal, por la obra previamente aprobada por el Ay A, así como el costo de las expropiaciones y constitución de servidumbres necesarias para la construcción y operación del sistema. Tanto la obra como los terrenos pasarán a formar parte del patrimonio del AyA. El modelo tarifario para el pago de la obra debe ser aprobado por la Autoridad Reguladora de los Servicios Públicos (Aresep).
(*) (Así adicionado el inciso k) anterior por el artículo 1° de la Ley para permitir a las municipalidades la construcción de obra de acueducto y alcantarillado, N° 10595 del 11 de noviembre de 2024)”.
Del análisis de la normativa supracitada, se comprueba el deber del Instituto Costarricense de Acueductos y Alcantarillados en ejercer de forma coordinada la materia de recolección, tratamiento y disposición final de las aguas residuales para asegurar así la eficacia y eficiencia respectiva (ver la sentencia no. 2025-034701 de las 09:20 horas del 24 de octubre de 2025). Por ende, no se logra observar alguna acción dentro del ámbito de sus competencias para tratar de mitigar de forma coordinada con las diversas instancias respectivas la recolección, el tratamiento y la disposición final de las aguas residuales en la urbanización indicada, lo que representa un quebranto al derecho a un ambiente sano y ecológicamente equilibrado de los amparados. Así, se echa de menos las actuaciones del ICAA en solventar la problemática ambiental indicada.
Asimismo, tal y como se le indicó a la Municipalidad de Upala, si el ICAA estima que es la Municipalidad de Upala la obligada a resolver el problema, lo cierto es que la orden sanitaria también le fue emitida a ese Instituto. Por ende, también es menester recordarle sobre la obligación de coordinación interinstitucional en materia ambiental. Específicamente en materia de tutela ambiental, la sentencia número 2008-004790, subrayó el deber de coordinación entre las instituciones relacionadas con el tema y la imposibilidad de hacer caso omiso a las advertencias sobre el peligro de contaminación que emite una institución facultada por ley para proteger el ambiente.
De esta forma, se denota una lesión a los derechos fundamentales de los amparados ante la omisión constatada del Instituto Costarricense de Acueductos y Alcantarillados en resolver el problema ambiental respectivo.
X.Sobre la actuación del Ministerio de Salud. Por último, en cuanto a este Ministerio, se reitera que ha actuado conforme a sus competencias, emitiendo las órdenes sanitarias respectivas y realizando acciones tendientes para su cumplimiento. Sin embargo, dichas órdenes sanitarias no han sido cumplidas en su totalidad y se echa de menos una actuación contundente de ese ministerio para obligar su cumplimiento. Así, se reitera que, según el oficio técnico de inspección no. RCH-ARSU-ERS-IT-029-2025 del 20 de enero de 2025, el Equipo Regulación de la Salud del Área Rectora de Salud de Upala estableció que se realizó una inspección el 15 de enero de 2025, en donde se constató que “La Municipalidad conformó una comisión o equipo técnico para tratar el tema, sin embargo, no se ha informado oficialmente quienes lo conforman y las acciones realizadas. 2. No se ha actualizado el plan de acción. 3. No se solicitó la prórroga al Ministerio de Salud para el cumplimiento del plan de acción actualizado.
(…) 5. No se ha convocado a los encargados del tema en el Instituto Costarricense de Acueductos y Alcantarillados (AyA) para que brinden asesoría técnica y cualquier colaboración pertinente a la Municipalidad. En general no se ha cumplido con los acuerdos tomados en la reunión del pasado 18 de marzo de 2024, por lo tanto, se incumple el plan de acciones correctivas presentado en los oficios DAMU-0496-06-2021 y DCU-OF-013-2024, según las órdenes sanitarias ARS-U-OS-028-2021 y ARS-U-OS-029-2021 (…) 8. CONCLUSIÓN Aún no se cuenta con una solución integral al problema de aguas residuales existente en la Urbanización Don Chú, por lo que las aguas residuales (principalmente grises) son desfogadas al cordón de caño sin ningún tratamiento. De esta forma se incumple con el plan de acciones correctivas presentado en los oficios DAMU-0496-06-2021 y DCU-OF-013-2024, según las órdenes sanitarias ARS-U-OS-028-2021 y ARS-U-OS-029-2021. 9.
RECOMENDACIONES AL ÁREA RECTORA DE SALUD DE SALUD. La dirección de Área Rectora de Salud Upala deberá hacer la respectiva consulta ante niveles superiores del Ministerio de Salud para que se determinen las acciones a seguir en este caso, por el incumplimiento reiterado del plan de acciones correctivas según las órdenes sanitarias ARS-U-OS-028- 2021 y ARS-U-OS-029-2021”. Posteriormente, mediante CARTA-MS-DRRSCH-DARSU-0118-2025 del 18 de marzo de 2025, el Área Rectora de Salud de Upala le comunicó a la Dirección Regional de Chorotega del Ministerio de Salud lo siguiente: “Traslado informe técnico indicado en el asunto. Se traslada para valoración y criterio sobre acciones a seguir, ya que desde el 2021 que se giraron dichas ordenes sanitarias y a pesar de acercamientos, seguimiento y acuerdos, la municipalidad de Upala no ha cumplido en tiempo y forma, por lo que actualmente no se cuenta con una solución integral al preocupante problema de aguas residuales de la comunidad Don Chu.
Agradecemos una pronta intervención”. Subsiguientemente, mediante informe MS-DRRSCH-URS-IT-14-2025 (respuesta a CARTA MS-DRRRSCH-DARSU-0018-20225) del 27 de marzo de 2025, los representantes de la Unidad de Rectoría de la Salud de la Región Chorotega establecieron lo siguiente: “(…): a. Hasta la fecha evidentemente se encuentra un incumplimiento al plan de acciones correctivas presentado por la Municipalidad de Upala y además, un incumplimiento a los acuerdos tomados en la reunión presencial del 18 de marzo con la Municipalidad (…) El problema sobre la descarga ilegal de aguas residuales en la vía pública de la Urbanización Don Chu en Upala no se ha resuelto, afectando la salud pública. 7. CONCLUSIÓN Y RECOMENDACIONES (…) se concluye que la ordenes sanitarias ARS-U-OS-028-2021 y ARS-U-OS-029-2021 no se han cumplido a cabalidad, dejando sin resolver la problemática de salud pública que representa la descarga de aguas residuales a la vía pública provenientes de la Urbanización Don Chú en Upala”.
Es decir, desde dichos documentos emitidos desde hace más de 1 año se corroboró que las órdenes sanitarias no han sido cumplidas por lo que elevó la consulta ante niveles superiores del Ministerio de Salud para que se determinen las acciones a seguir en este caso, por el incumplimiento reiterado del plan de acciones correctivas según las órdenes sanitarias ARS-U-OS-028- 2021 y ARS-U-OS-029-2021. Sin embargo, no constata que se hayan establecido o determinado dichas acciones, lo que ha provocado que se mantenga el problema ambiental constatado, lo cual es aceptado por dicho Ministerio.
Igualmente, se verifica que no se tiene por demostrado que la denuncia no. 023-2020, que conllevó a la emisión del informe MS-DRRCH-URS-IT-0147-20 del 17 de diciembre de 2020, que corroboró la problemática ambiental y fue fundamento para la emisión de las órdenes sanitarias, haya sido debidamente resuelta. Además, tampoco se tiene por demostrado que la denuncia del 09 de febrero de 2022, interpuesto por el señor Gerardo Fonseca Obando y firmado por vecinos de la Urbanización Don Chú ante el Área de Salud de Upala también haya sido resulta. Nótese que si bien es cierto la denuncia no. 023-2020 conllevó a la emisión de las órdenes sanitarias, se reitera que las mismas no han sido cumplidas en su totalidad, manteniéndose el problema denunciado en esa gestión del 2020.
De esa forma, esta Sala Constitucional considera que ha existido una falta de diligencia del Ministerio de Salud en darle el debido seguimiento para el cumplimiento de las órdenes sanitarias emitidas, lo que ha conllevado que la problemática ambiental se mantenga, a pesar de que desde el 2020 el Ministerio recurrido tuvo conocimiento de dicha situación. Ahora bien, nótese que las órdenes sanitarias en cuestión fueron notificadas el 01 de marzo de 2021, con fecha de vencimiento del 27 de mayo de 2021. Por ende, se constata que dichas órdenes sanitarias ya vencieron, sin embargo, no se ha verificado su cumplimiento. Así las cosas, se acredita que, aunque el Ministerio de Salud cuenta con una serie de herramientas legales con el fin de exigir el cumplimiento de lo ordenado en las órdenes sanitarias, en el sub lite no se han implementado, por lo que se observa que la autoridad sanitaria ha sido omisa en su proceder en el seguimiento de la problemática aquí planteada.
Por consiguiente, se denota una lesión a los derechos fundamentales de los amparados ante la omisión constatada del Ministerio de Salud en llevar a cabo las acciones respectivas para que se resuelva el problema ambiental respectivo.
XI.Conclusión. En virtud de lo expuesto, se verifica una falta de coordinación adecuada entre el Ministerio de Salud, el Instituto Costarricense de Acueductos y Alcantarillados y la Municipalidad de Upala en realizar las acciones pertinentes tendientes a solventar el problema ambiental constatado con las aguas residuales de la Urbanización Don Chú. Por consiguiente, el presente asunto se declara con lugar con las consecuencias que se disponen en la parte dispositiva.
XII.Nota del magistrado Castillo Víquez, en cuanto a la justicia administrativa pronta y cumplida. He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales.
A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia. Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.
En asuntos ambientales, es criterio del suscrito, que si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que se acusan deficiencias sanitarias en el sistema de tratamiento de aguas residuales provenientes de una urbanización, lo que afecta la salud de los vecinos, el derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.
XIV.VOTO SALVADO PARCIAL DE LA MAGISTRADA GARRO VARGAS SOBRE LA EJECUCIÓN DE LA ORDEN GIRADA EN EL PLAZO DE SEIS MESES EN LA SENTENCIA.
Salvo el voto respecto de la ejecución de la orden girada en el plazo de seis meses en la sentencia, para que, de conformidad con el art. 56 de la Ley de la Jurisdicción Constitucional (LJC), sea residenciada en el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda.
La ejecución de las órdenes dictadas por la Sala Constitucional corresponde, en principio, ser fiscalizada por esta misma jurisdicción. Sin embargo, esa norma contempla supuestos de excepción en los que, por determinación de este Tribunal, se ordene residenciar la ejecución de la sentencia en la jurisdicción contencioso-administrativa:
“Art. 56. La ejecución de las sentencias corresponde a la Sala Constitucional, salvo en lo relativo a la liquidación y cumplimiento de indemnizaciones y responsabilidades pecuniarias, o en otros aspectos que la propia Sala considere del caso, en que se hará en la vía contencioso administrativa por el procedimiento de ejecución de sentencia previsto en la ley reguladora de esa jurisdicción.” (Lo destacado no corresponde al original).
Recuérdese que en el proyecto de ley de discusión de la LJC se preveía originalmente lo siguiente:
“Art. 56. Las sentencias favorables al recurrente se ejecutarán en la vía contencioso-administrativa por el procedimiento de ejecución de sentencia previsto en la ley Reguladora de esa Jurisdicción.” (Lo destacado no corresponde al original).
Sin embargo, el texto fue modificado vía moción para que la norma fuera coincidente con lo regulado en el art. 153 de la Constitución Política, pero se realizó la siguiente explicación:
“EL SECRETARIO:
Moción No. 68 (32-19) del diputado Chacón Jiménez:
“artículo 57 (antes 56): para que el texto se lea así: “la ejecución de las sentencias corresponde a la Sala Constitucional, salvo en lo relativo a la liquidación y cumplimiento de indemnizaciones o responsabilidades pecuniarias en otros aspectos que la propia Sala considere del caso, en que se hará en la vía contencioso administrativa por el procedimiento de ejecución de sentencia previsto en la ley reguladora de esa jurisdicción”.

Aquí había una contradicción con la tesis genérica de que son los Tribunales los que ejecutan sus sentencias y enviaba la Jurisdicción Contencioso Administrativo toda la ejecución; entonces quedaban al aire los otros artículos que le permitían a la Sala ejecutarlos.

En esa parte dice: “o en otros aspectos que la propia Sala considere del aso…”, a qué se está refiriendo?
Doctor Piza Escalante:
La idea es que la Sala, en la vía de ejecución de sentencia, resuelva lo que ella considere que le corresponde. Lo que demás, lo envía a la vía Contencioso Administrativa.

A partir de lo anterior, está claro que la propia LJC autoriza a esta Sala para que valore y decida si es preciso derivar a la jurisdicción contencioso-administrativa todos o algunos los aspectos relativos a la ejecución de la sentencia.
En este caso concreto, en virtud de la entidad de las órdenes que está girando este Tribunal, estimo que lo procedente es residenciar la fase de ejecución del asunto en la jurisdicción contencioso-administrativa. Lo anterior, debido a la inexistencia de mecanismos idóneos previstos por la normativa que rige a esta jurisdicción constitucional para dar seguimiento a las órdenes consignadas en esta sentencia que revisten aspectos técnicos de gran complejidad.
En cambio, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (art. 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el art. 56 de LJC, considero que la fase de ejecución debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara con lugar el recurso. Se le ordena a Mary Denisse Munive Angermuller, en su condición de ministra, y a Gabriel Andrés Segura Torres, en su condición de director del Área Rectora de Salud de Upala, ambos del Ministerio de Salud, o a quienes ocupen esos cargos que, procedan a realizar, en el ámbito de sus competencias, lo siguiente: a) que de forma inmediata realicen las acciones pertinentes para velar por el efectivo cumplimiento de las siguientes ordenes sanitarias: no. ARS-U-OS-028-2021, no. ARS-U-OS-029-2021, no. ARS-U-OS-030-2021. Por ende, deberán darle seguimiento continuo y permanente al cumplimiento de dichas ordenes emitidas en los plazos que así se disponga, procurando su cumplimiento y, en caso de que se continúen sin cumplir, tomar oportunamente las medidas pertinentes para sentar responsabilidades a los funcionarios omisos; b) que, en el plazo máximo de UN MES, contado a partir de la notificación de esta sentencia, se atienda las denuncias 023-2020 y la denuncia del 09 de febrero de 2022, como en derecho corresponda, y se le notifique lo respectivo a los medios señalados por los denunciantes.
Por otra parte, se le ordena a Lourdes Sáurez Barboza, en su condición de presidenta ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados, así como a Aura Yamileth López Obregón, en su condición de alcaldesa y a Luis Wilberto Tenorio García, en su condición de presidente del Concejo, ambos de la Municipalidad de Upala, o a quienes ocupen los cargos, que, de forma inmediata, y según las órdenes del Ministerio de Salud, realicen las acciones tendientes a cumplir con las siguientes ordenes sanitarias: no. ARS-U-OS-028-2021, no. ARS-U-OS-029-2021, no. ARS-U-OS-030-2021, tomando en cuenta que las mismas se encuentran vencidas. Por último, se le ordena a Mary Denisse Munive Angermuller, en su condición de ministra, y a Gabriel Andrés Segura Torres, en su condición de director del Área Rectora de Salud de Upala, ambos del Ministerio de Salud, a Lourdes Sáurez Barboza, en su condición de presidenta ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados, así como a Aura Yamileth López Obregón, en su condición de alcaldesa y a Luis Wilberto Tenorio García, en su condición de presidente del Concejo, ambos de la Municipalidad de Upala, o a quienes ocupen esos cargos, que de forma INMEDIATA, a partir de la notificación de esta sentencia, de manera conjunta y coordinada, dispongan lo necesario para asegurar temporalmente que no hayan afectaciones a la salud de las personas que habitan en la Urbanización Don Chú en Upala, Alajuela, mientras se da una solución definitiva del problema objeto de este proceso.
Asimismo, se les ordena a dichas autoridades que coordinen entre sí lo necesario, giren las órdenes pertinentes y lleven a cabo todas las actuaciones que estén dentro del ámbito de sus competencias para que, dentro del plazo máximo de SEIS MESES, contado a partir de la notificación de la presente sentencia, se brinde una solución integral y definitiva a la problemática ambiental y de salubridad acreditada respecto al tratamiento de las aguas residuales en la Urbanización Don Chú en Upala, Alajuela. Se advierte a las autoridades recurridas que, de no acatar la orden dicha, incurrirá en el delito de desobediencia y, que de conformidad con el artículo 71 de la Ley de esta jurisdicción, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.
Se condena a la Municipalidad de Upala, al Estado y al Instituto Costarricense de Acueductos y Alcantarillados al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. El magistrado Castillo Víquez consigna nota. El magistrado Salazar Alvarado consigna nota. La magistrada Garro Vargas salva el voto respecto de la sede de la ejecución de la orden girada en el plazo de seis meses en la sentencia y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que esa fase sea residenciada en el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda.
