Considering
Before analyzing the merits of the matter, it must be clarified that, following judgment number 2008-02545 of 08:55 hours on February 22, 2008, this Chamber has referred to the contentious-administrative jurisdiction -with some exceptions- those matters in which it is discussed whether the public administration has complied or not with the reasonably established deadlines to resolve the requests filed by the administered parties in light of the provisions of Article 41 of the Political Constitution. Precisely, in the sub lite case, an exception scenario is raised, since it is a matter of an alleged complaint for the absence of storm drainage in the community of Palmas del Sol, El Roble, Puntarenas, which allegedly has not been resolved within a reasonable period and that puts the integrity of the petitioners at risk, as well as a healthy environment. Given the nature of the subject matter dealt with by the proceeding, this Chamber will assess the possible delays in resolving the complaint filed. Having clarified this point, we proceed to resolve the specific situation raised in this amparo.
The petitioners seek to have the Municipality of Puntarenas ordered to carry out a technical inspection in the community of Palmas del Sol, assess the existing storm drainage, and adopt urgent and integral measures to prevent flooding. Likewise, they request that said municipality refrain from permitting works that affect the drainage without having a definitive hydraulic solution. In addition, they require the Ministry of Health to follow up on the sanitary order issued since 2022 and assess the current sanitary risk faced by the community.
Of importance for the decision in this matter, the following facts are deemed duly proven:

From the integral analysis of the proven facts, the reports rendered under oath, and the evidence incorporated into the case file, this Chamber concludes that the present amparo action must be granted. While it is noted that both the Municipality of Puntarenas and the Ministry of Health have carried out some administrative actions related to the reported problem, the truth is that such procedures have not been sufficient to effectively, timely, and definitively resolve the situation affecting the community of Palmas del Sol, in El Roble de Puntarenas.
Indeed, from the reports rendered by the respondent authorities themselves, it is apparent that there is a real problem related to the lack of an adequate system for channeling and drainage of stormwater (aguas pluviales) in the sector. The Ministry of Health acknowledged the existence of deficiencies in the channeling of stormwater (aguas pluviales), as well as the accumulation of water on public roads during rainy conditions, despite a sanitary order having been issued since 2022 directed to the Municipality of Puntarenas. In turn, the respondent Municipality acknowledged that the channel used for the evacuation of stormwater was closed and that this generates an imminent risk of flooding, with impact on both the surrounding dwellings and the community in general.
Under this factual framework, it is not enough for the authorities to indicate that they have carried out inspections, technical meetings, or preliminary efforts, because the purpose of the amparo is not exhausted by the mere formal activity of the Administration. What is relevant from the constitutional perspective is to determine whether the actions deployed have been suitable, effective, and sufficient to remove the reported threat or injury. In this case, the answer is negative, given that the problem persists, the drainage continues without a definitive solution, and the inhabitants of the community remain exposed to the risk of flooding, material damage, sanitary impact, and deterioration of their environment.
The situation described compromises fundamental rights linked to health, safety, personal integrity, the enjoyment of a healthy and ecologically balanced environment, as well as access to minimum conditions of community sanitation. The accumulation of stormwater on public roads and inhabited areas does not constitute a mere neighborhood nuisance, but an objective risk condition that can foster sources of contamination, bad odors, proliferation of vectors, and sanitary impacts, especially during the rainy season. Therefore, the lack of an effective and coordinated institutional response places the protected community in a situation of vulnerability that cannot be constitutionally tolerated.
In that sense, the Municipality of Puntarenas has a direct obligation in the attention of local infrastructure and of the services and interests specific to the canton, in accordance with Article 169 of the Political Constitution and the jurisdictional framework established in the Municipal Code. Said jurisdiction includes the adoption of reasonable, technical, and timely measures to address the problems arising from road infrastructure and stormwater drainage (drenaje pluvial) in the communities under its jurisdiction. For its part, the Ministry of Health, as the governing body in sanitary matters, cannot limit itself to verifying the existence of the problem, but must exercise its powers of surveillance, control, prevention, and follow-up, in order to order the appropriate sanitary measures and verify their effective compliance.
Thus, the solution of the case requires real inter-institutional coordination between both respondent authorities. The Municipality must execute the technical actions necessary to correct the absence or insufficiency of stormwater drainage, while the Ministry of Health must oversee, follow up on, and adopt the pertinent sanitary measures to prevent the accumulation of water from generating risks to public health. The existence of differentiated competencies does not justify inaction or administrative delay; on the contrary, it imposes a reinforced duty of coordination when institutional omission can affect the fundamental rights of a community.
Consequently, having accredited that the reported problem persists, that the authorities themselves recognize the existing risk, and that an effective solution has not been provided for the lack of stormwater drainage in the community of Palmas del Sol, it is appropriate to grant the recurso de amparo. To restore the violated rights, it is appropriate to order the Municipality of Puntarenas and the Ministry of Health to, within the scope of their competencies, coordinate and execute the actions necessary to comprehensively address the reported situation, guaranteeing the protection of the health, safety, and well-being of the inhabitants of the affected community.
I have supported this Court's thesis that when the petitioner alleges a violation of the right to prompt and complete justice in administrative proceedings, those who must hear the legal dispute are the Contentious-Administrative Courts and not this Chamber. However, with the recent promulgation of Law No. 9097, Law Regulating the Right of Petition, it has been established that this right is susceptible to judicial protection through the recurso de amparo established by Article 32 of the Law of Constitutional Jurisdiction, in relation to Article 27 of the Political Constitution of the Republic of Costa Rica, in those cases where the petitioner considers that the material actions of the Administration, its administrative acts, or its response are affecting their fundamental rights. In my view, the recently promulgated regulation does not imply that this Court must modify its jurisprudential line, since, based on numeral 7 of its Law, it corresponds exclusively to define its own jurisdiction.
Therefore, save for those legal-constitutional disputes that have been recognized by this same Chamber as exceptional cases, which do properly proceed to be heard in this jurisdiction through the constitutional process of amparo protection, in other cases, and for the reasons given by this Court (judgment No. 2008-02545 of 8:55 a.m. on February 22, 2008), those with jurisdiction are the Judges of the contentious-administrative jurisdiction, all of which is in accordance with numeral 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and norms), and the corresponding legal norms based on a logical, systemic, and teleological interpretation of the legal system.
In environmental matters, it is also the criterion of the undersigned that, if there has already been intervention by the Public Administration, I consider that its hearing and resolution corresponds to the contentious-administrative jurisdiction. However, I do proceed to hear the merits of the matter when other rights of the persons affected by the source of contamination are at stake, including health, quality of life, and the right to enjoy a healthy and pollution-free environment (Article 50 of the Political Constitution), as occurs in this case, in which the petitioner filed a complaint for the accumulation of water and flooding in the community of Palmas del Sol, Puntarenas, with environmental contamination, which involves the right to a healthy environment and the right to health, which the petitioner claims has not been definitively resolved, with a violation of the right to enjoy a healthy and ecologically balanced environment and a dignified level of quality of life.
Partial dissent regarding the execution of the judgment, so that, in accordance with Art. 56 of the Law of Constitutional Jurisdiction (LJC), it be assigned to the Execution Area of the Contentious-Administrative and Civil Treasury Court.
The execution of the orders issued by the Constitutional Chamber corresponds, in principle, to be supervised by this same jurisdiction. However, that norm contemplates exceptional cases in which, by determination of this Court, the execution of the judgment is ordered to be assigned to the contentious-administrative jurisdiction:
"Art. 56. The execution of the judgments corresponds to the Constitutional Chamber, except regarding the liquidation and fulfillment of indemnities and pecuniary liabilities, or in other aspects that the Chamber itself considers appropriate, in which case it will be carried out in the contentious-administrative venue through the judgment execution procedure established in the law regulating that jurisdiction." (Highlighting not in the original).
Recall that the bill for discussion of the LJC originally provided the following:
"Art. 56. Judgments favorable to the petitioner shall be executed in the contentious-administrative venue through the judgment execution procedure established in the Law Regulating that Jurisdiction." (Highlighting not in the original).
However, the text was modified via motion so that the norm would be consistent with what is regulated in Art. 153 of the Political Constitution, but the following explanation was given:
"THE SECRETARY: Motion No. 68 (32-19) by Deputy Chacón Jiménez: "Article 57 (formerly 56): so that the text reads as follows: "the execution of judgments corresponds to the Constitutional Chamber, except regarding the liquidation and fulfillment of indemnities or pecuniary liabilities in other aspects that the Chamber itself considers appropriate, in which case it will be carried out in the contentious-administrative venue through the judgment execution procedure established in the law regulating that jurisdiction." THE PRESIDENT: Is the motion read open for discussion?
Doctor Piza Escalante: Here there was a contradiction with the general thesis that it is the Courts that execute their judgments and it sent all execution to the Contentious-Administrative Jurisdiction; thus, the other articles that allowed the Chamber to execute them were left up in the air.
Deputy Corrales Bolaños: In that part, it says: "or in other aspects that the Chamber itself considers appropriate...", what is it referring to?
Doctor Piza Escalante: The idea is that the Chamber, in the judgment execution venue, resolves whatever it considers corresponds to it. The rest, it sends to the Contentious-Administrative venue.
THE SECRETARY: Is the motion considered sufficiently discussed?

Based on the foregoing, it is clear that the LJC itself authorizes this Chamber to evaluate and decide whether it is necessary to refer all or some of the aspects related to the execution of the judgment to the contentious-administrative jurisdiction.
In this specific case, by virtue of the nature of the orders this Court is issuing, I consider it appropriate to assign the execution phase of the matter to the contentious-administrative jurisdiction. This is due to the nonexistence of suitable mechanisms provided by the regulations governing this constitutional jurisdiction to follow up on the orders set forth in this judgment, which involve highly complex technical aspects.
In contrast, the provisions of the Contentious-Administrative Procedural Code regarding execution (Art. 155 et seq.) have evident advantages, such as the possibility of requesting schedules, imposing fines, establishing liabilities, supervising compliance stages, etc. Therefore, in accordance with the provisions of Art. 56 of the LJC, I consider that the execution phase must be carried out before the Execution Area of the Contentious-Administrative and Civil Treasury Court, under the judgment execution rules of said Code.
The parties are warned that, if any document on paper has been provided, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic device or produced by new technologies, these must be removed from the office within a maximum period of thirty business days, counted from the notification of this Judgment. Otherwise, all material not removed within this period will be destroyed, as provided in the "Regulation on the Electronic File before the Judiciary," approved by the Full Court in Session No. 27-11, of August 22, 2011, Article XXVI and published in Judicial Bulletin No. 19, of January 26, 2012, as well as in the agreement approved by the Superior Council of the Judiciary, in Session No. 43-12, held on May 3, 2012, Article LXXXI.
Therefore:
The recurso is granted. MARY DENISSE MUNIVE ANGERMÜLLER -known as Mery Denisse Munive Angermüller- and CAROLINA LIZETH GUILLÉN MELÉNDEZ, in their order as minister and acting director of the Directorate of the Health Governing Area of Puntarenas, Chacarita, both of the MINISTRY OF HEALTH, or whomever holds those positions, are ordered to coordinate and arrange all actions that fall within the scope of their competencies, to minimize the impact on the health, safety, sanitation, and environment of the inhabitants of the affected community. Likewise, RANDALL ALEXIS CHAVARRÍA MATARRITA and JEFFREY RAMÍREZ CASTRO, in their order as mayor and director of the Technical Road Management Unit, both of the MUNICIPALITY OF PUNTARENAS, or whomever holds those positions, must definitively solve -from the technical point of view- the management of stormwater (aguas pluviales) in the community of Palmas del Sol, in El Roble de Puntarenas.
In addition to this, the petitioners must be notified of the progress of the works from their start to their completion, all the above within a period of SIX MONTHS, counted from the notification of this judgment. The respondents, or whomever holds those positions, are warned that, in accordance with the provisions of Article 71 of the Law of Constitutional Jurisdiction, imprisonment of three months to two years or a fine of twenty to sixty days shall be imposed on anyone who receives an order that must be complied with or enforced, issued within a recurso de amparo, and does not comply with it or does not enforce it, provided that the crime is not more severely penalized. The Municipality of Puntarenas and the State are condemned to pay the costs, damages, and losses caused by the facts that serve as the basis for this declaration, which shall be liquidated in the process of execution of judgment in the contentious-administrative venue.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del veintidos de mayo de dos mil veintiseis .
Recurso de amparo que se tramita en expediente número 26-010991-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], [Nombre 002], cédula de identidad [Valor 005], [Nombre 006], cédula de identidad [Valor 002], [Nombre 003], cédula de identidad [Valor 003], [Nombre 004], cédula de identidad [Valor 004], [Nombre 005], cédula de identidad [Valor 006], [Nombre 007], cédula de identidad [Valor 007], a favor de la COMUNIDAD DE PALMAS DEL SOL, EL ROBLE, PUNTARENAS, contra el MINISTERIO DE SALUD, MUNICPALIDAD DE PUNTARENAS.
Resultando:

Antes de analizar el fondo del asunto debe aclararse que, a partir de la sentencia número 2008-02545 de las 08:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa -con algunas excepciones- aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos razonablemente pautados para resolver las solicitudes planteadas por los administrados a la luz de lo dispuesto por el artículo 41 de la Constitución Política. Precisamente, en el sub lite, se plantea un supuesto de excepción, pues se está ante una supuesta denuncia por la ausencia de drenaje pluvial en la comunidad de Palmas del Sol, El Roble, Puntarenas, que presuntamente no ha sido resuelta dentro de un plazo razonable y que pone en riesgo la integridad de los recurrentes, así como a un ambiente sano. Atendiendo a la naturaleza de la temática que trata la gestión, esta Sala valorará las posibles dilaciones en la resolución de la denuncia planteada. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.
La parte recurrente pretende que se ordene a la Municipalidad de Puntarenas realizar una inspección técnica en la comunidad de Palmas del Sol, valorar el drenaje pluvial existente y adoptar medidas urgentes e integrales para evitar inundaciones. Asimismo, solicita que dicha municipalidad se abstenga de permitir obras que afecten el drenaje sin contar con una solución hidráulica definitiva. Además, requiere que el Ministerio de Salud dé seguimiento a la orden sanitaria emitida desde el año 2022 y valore el riesgo sanitario actual que enfrenta la comunidad.
De importancia para la decisión de este asunto, se estima como debidamente demostrados los siguientes hechos:

Del análisis integral de los hechos acreditados, los informes rendidos bajo juramento y la prueba incorporada al expediente, esta Sala concluye que el presente recurso de amparo debe ser declarado con lugar. Si bien se advierte que tanto la Municipalidad de Puntarenas como el Ministerio de Salud han realizado algunas actuaciones administrativas relacionadas con la problemática denunciada, lo cierto es que tales gestiones no han sido suficientes para resolver de manera efectiva, oportuna y definitiva la situación que afecta a la comunidad de Palmas del Sol, en El Roble de Puntarenas.
En efecto, de los propios informes rendidos por las autoridades recurridas se desprende que existe una problemática real relacionada con la falta de un sistema adecuado de canalización y drenaje de aguas pluviales en el sector. El Ministerio de Salud reconoció la existencia de deficiencias en la canalización de aguas pluviales, así como la acumulación de aguas en la vía pública durante condiciones lluviosas, pese a haberse emitido desde el año 2022 una orden sanitaria dirigida a la Municipalidad de Puntarenas. A su vez, la Municipalidad accionada reconoció que el canal utilizado para la evacuación de aguas pluviales fue cerrado y que ello genera un riesgo inminente de inundación, con afectación tanto para las viviendas circundantes como para la comunidad en general.
Bajo ese cuadro fáctico, no basta con que las autoridades indiquen que han realizado inspecciones, reuniones técnicas o gestiones preliminares, pues el objeto del amparo no se agota con la sola actividad formal de la Administración. Lo relevante desde la perspectiva constitucional, es determinar si las actuaciones desplegadas han sido idóneas, eficaces y suficientes para remover la amenaza o lesión denunciada. En este caso, la respuesta es negativa, toda vez que la problemática persiste, el drenaje continúa sin una solución definitiva y las personas habitantes de la comunidad permanecen expuestas al riesgo de inundaciones, daños materiales, afectación sanitaria y deterioro de su entorno.
La situación descrita compromete derechos fundamentales vinculados con la salud, la seguridad, la integridad personal, el disfrute de un ambiente sano y ecológicamente equilibrado, así como el acceso a condiciones mínimas de salubridad comunitaria. La acumulación de aguas pluviales en vía pública y zonas habitadas no constituye una simple molestia vecinal, sino una condición objetiva de riesgo que puede favorecer focos de contaminación, malos olores, proliferación de vectores y afectaciones sanitarias, especialmente durante la época lluviosa. Por ello, la falta de una respuesta institucional efectiva y coordinada coloca a la comunidad amparada en una situación de vulnerabilidad que no puede ser tolerada constitucionalmente.
En ese sentido, la Municipalidad de Puntarenas tiene una obligación directa en la atención de la infraestructura local y de los servicios e intereses propios del cantón, conforme al artículo 169 de la Constitución Política y al marco competencial previsto en el Código Municipal. Dicha competencia comprende la adopción de medidas razonables, técnicas y oportunas para atender los problemas derivados de la infraestructura vial y del drenaje pluvial en las comunidades bajo su jurisdicción. Por su parte, el Ministerio de Salud, como rector en materia sanitaria, no puede limitarse a constatar la existencia del problema, sino que debe ejercer sus potestades de vigilancia, control, prevención y seguimiento, a fin de ordenar las medidas sanitarias que correspondan y verificar su efectivo cumplimiento.
Así las cosas, la solución del caso exige una coordinación interinstitucional real entre ambas autoridades recurridas. La Municipalidad debe ejecutar las acciones técnicas necesarias para corregir la ausencia o insuficiencia del drenaje pluvial, mientras que el Ministerio de Salud debe fiscalizar, dar seguimiento y adoptar las medidas sanitarias pertinentes para evitar que la acumulación de aguas genere riesgos para la salud pública. La existencia de competencias diferenciadas no justifica la inacción ni la dilación administrativa; por el contrario impone un deber reforzado de coordinación cuando la omisión institucional puede afectar derechos fundamentales de una comunidad.
En consecuencia, al haberse acreditado que la problemática denunciada subsiste, que las propias autoridades reconocen el riesgo existente y que no se ha brindado una solución efectiva a la falta de drenaje de aguas pluviales en la comunidad de Palmas del Sol, lo procedente es declarar con lugar el recurso de amparo. Para restablecer los derechos vulnerados, corresponde ordenar a la Municipalidad de Puntarenas y al Ministerio de Salud que, dentro del ámbito de sus competencias, coordinen y ejecuten las actuaciones necesarias para atender integralmente la situación denunciada, garantizando la protección de la salud, la seguridad y el bienestar de los habitantes de la comunidad afectada.
He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia.
Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.
En asuntos ambientales, es también criterio del suscrito, de que, si ya ha habido intervención de la Administración Pública, considero que su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que la parte recurrente presentó una denuncia por la acumulación de aguas e inundaciones en la comunidad de Palmas del Sol, Puntarenas, con contaminación ambiental, que involucra el derecho a un ambiente sano y el derecho a la salud, que alega la parte recurrente no ha sido resuelta en forma definitiva, con violación del derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.
Salvo el voto respecto de la ejecución de la sentencia, para que, de conformidad con el art. 56 de la Ley de la Jurisdicción Constitucional (LJC), sea residenciada en el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda.
La ejecución de las órdenes dictadas por la Sala Constitucional corresponde, en principio, ser fiscalizada por esta misma jurisdicción. Sin embargo, esa norma contempla supuestos de excepción en los que, por determinación de este Tribunal, se ordene residenciar la ejecución de la sentencia en la jurisdicción contencioso-administrativa:
“Art. 56. La ejecución de las sentencias corresponde a la Sala Constitucional, salvo en lo relativo a la liquidación y cumplimiento de indemnizaciones y responsabilidades pecuniarias, o en otros aspectos que la propia Sala considere del caso, en que se hará en la vía contencioso administrativa por el procedimiento de ejecución de sentencia previsto en la ley reguladora de esa jurisdicción.” (Lo destacado no corresponde al original).
Recuérdese que en el proyecto de ley de discusión de la LJC se preveía originalmente lo siguiente:
“Art. 56. Las sentencias favorables al recurrente se ejecutarán en la vía contencioso-administrativa por el procedimiento de ejecución de sentencia previsto en la ley Reguladora de esa Jurisdicción.” (Lo destacado no corresponde al original).
Sin embargo, el texto fue modificado vía moción para que la norma fuera coincidente con lo regulado en el art. 153 de la Constitución Política, pero se realizó la siguiente explicación:
“EL SECRETARIO:
Moción No. 68 (32-19) del diputado Chacón Jiménez:
“artículo 57 (antes 56): para que el texto se lea así: “la ejecución de las sentencias corresponde a la Sala Constitucional, salvo en lo relativo a la liquidación y cumplimiento de indemnizaciones o responsabilidades pecuniarias en otros aspectos que la propia Sala considere del caso, en que se hará en la vía contencioso administrativa por el procedimiento de ejecución de sentencia previsto en la ley reguladora de esa jurisdicción”.

Aquí había una contradicción con la tesis genérica de que son los Tribunales los que ejecutan sus sentencias y enviaba la Jurisdicción Contencioso Administrativo toda la ejecución; entonces quedaban al aire los otros artículos que le permitían a la Sala ejecutarlos.

En esa parte dice: “o en otros aspectos que la propia Sala considere del aso…”, a qué se está refiriendo?

La idea es que la Sala, en la vía de ejecución de sentencia, resuelva lo que ella considere que le corresponde. Lo que demás, lo envía a la vía Contencioso Administrativa.

A partir de lo anterior, está claro que la propia LJC autoriza a esta Sala para que valore y decida si es preciso derivar a la jurisdicción contencioso-administrativa todos o algunos los aspectos relativos a la ejecución de la sentencia.
En este caso concreto, en virtud de la entidad de las órdenes que está girando este Tribunal, estimo que lo procedente es residenciar la fase de ejecución del asunto en la jurisdicción contencioso-administrativa. Lo anterior, debido a la inexistencia de mecanismos idóneos previstos por la normativa que rige a esta jurisdicción constitucional para dar seguimiento a las órdenes consignadas en esta sentencia que revisten aspectos técnicos de gran complejidad.
En cambio, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (art. 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el art. 56 de LJC, considero que la fase de ejecución debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.
Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles, contados a partir de la notificación de esta Sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11, del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19, del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12, celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara con lugar el recurso. Se ordena a MARY DENISSE MUNIVE ANGERMÜLLER -conocida como Mery Denisse Munive Angermüller- y CAROLINA LIZETH GUILLÉN MELÉNDEZ, por su orden ministra y directora a.i. de la Dirección del Área Rectora de Salud de Puntarenas, Chacarita, ambas del MINISTERIO DE SALUD, o quienes ocupen esos cargos, coordinar y disponer todas las actuaciones que se encuentren dentro del ámbito de sus competencias, para minimizar las afectaciones a la salud, seguridad, salubridad y ambiente de las personas habitantes de la comunidad afectada. Asimismo, RANDALL ALEXIS CHAVARRÍA MATARRITA y JEFFREY RAMÍREZ CASTRO, por su orden alcalde y director de la Unidad Técnica de Gestión Vial, ambos de la MUNICIPALIDAD DE PUNTARENAS, o quienes ocupen esos cargos, deberán solucionar -desde el punto de vista técnico- de manera definitiva, el manejo de las aguas pluviales en la comunidad de Palmas del Sol, en El Roble de Puntarenas.
Aunado a ello, se le deberá notificar a los recurrentes los avances de las obras desde su inicio hasta su finalización, todo lo anterior dentro del plazo de SEIS MESES, contado a partir de la notificación de esta sentencia. Se advierte a los recurridos, o a quienes ocupen esos cargos, que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo, y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Puntarenas y al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a la presente declaratoria, los cuales se liquidarán en el proceso de ejecución de sentencia de lo contencioso administrativo.
El magistrado Castillo Víquez consigna nota. El magistrado Salazar Alvarado consigna nota. La magistrada Garro Vargas salva el voto respecto de la sede de la ejecución de la sentencia y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que esa fase sea residenciada en el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda.
