Before analyzing the merits of the appeal, it must be clarified that, based on Judgment No. 2008-02545 of 8:55 hours on February 22, 2008, this Chamber has referred to the contentious-administrative jurisdiction —with some exceptions— those matters in which it is disputed whether the public administration has complied with the deadlines established by the Ley General de la Administración Pública (Articles 261 and 325) or sectoral laws for special administrative procedures, to resolve by final act an administrative procedure —initiated ex officio or at the request of a party— or to hear the pertinent administrative remedies. Precisely, in this case, an exceptional situation is presented, as it involves requests seeking the safety and health of persons in the community of Calle Los Cerezos in Lomas del Sol in Curridabat, and which have allegedly not been addressed within a reasonable time.
The appellants state that they are residents of Calle Los Cerezos, in the Lomas del Sol urbanization in Curridabat. They explain that, for approximately 15 years, the trees and undergrowth located on a Conavi lot situated behind their homes have caused various adverse effects. They detail that leaves, branches, and roots from the trees cause structural damage to roofs, gutters, downspouts, zinc sheeting, ceiling linings, and walls, which has required constant and costly maintenance for a long time. They note that, during the 2025 rainy season, gutter cleaning in some homes had to be done every five days to prevent internal flooding. They relate that the undergrowth reaches heights exceeding the boundary walls, which causes the presence of insects, mosquitoes, rats, opossums, raccoons, snakes, and other animals, in addition to the accumulation of garbage. They also explain that there is a fire risk during the dry season due to the undergrowth and the presence of people entering the site.
They accuse Conavi of clearing the undergrowth only twice a year, while tree pruning has only been carried out in 2021 and in February 2025. They point out that institutions like the Municipalidad de Curridabat have intervened requesting cleaning and attention from Conavi; however, by January 2026 the matter had not been resolved. Given the foregoing, they request that the appeal be granted and that the respondents be ordered to carry out horizontal pruning of the tree crowns, so that their height does not exceed the boundary walls or the roofs of the houses. Furthermore, that periodic and permanent maintenance of the undergrowth be carried out throughout the entire year, and that an agreement be negotiated with the Municipalidad de Curridabat for its continuous attention.
Of importance for the decision in this matter, the following facts are deemed duly demonstrated, either because they have been thus accredited or because the respondent has omitted to refer to them, as provided in the initial order:
Of importance for the decision in this matter, it is deemed not proven that the Forest Engineering inspection agreed upon on February 6, 2025, has been carried out in order to determine the appropriateness of tree clearing (descuaje) in the sector.
In the sub lite, the appellants state that they are residents of Calle Los Cerezos, in the Lomas del Sol urbanization in Curridabat. They explain that, for approximately 15 years, the trees and undergrowth located on a Conavi lot situated behind their homes have caused various adverse effects. They detail that leaves, branches, and roots from the trees cause structural damage to roofs, gutters, downspouts, zinc sheeting, ceiling linings, and walls, which has required constant and costly maintenance for a long time. They note that, during the 2025 rainy season, gutter cleaning in some homes had to be done every five days to prevent internal flooding. They relate that the undergrowth reaches heights exceeding the boundary walls, which causes the presence of insects, mosquitoes, rats, opossums, raccoons, snakes, and other animals, in addition to the accumulation of garbage. From the study of the case file, it is taken as proven that, on July 6, 2020, in response to a request from the plaintiff [Name 011], Conavi carried out clearing (chapeo) work in the area. On July 22, 2020, following an inspection, the MOPT forest engineer issued a report detailing that the trees at the site posed no risk whatsoever to road users or neighboring properties. On June 28, 2021, Conavi and the Municipality of Curridabat conducted an inspection at the site, and clearing and vegetation maintenance actions were confirmed; likewise, any risk from the trees in the area was ruled out. In October 2021, Conavi performed maintenance work in the sector, which included clearing, weed collection, and general cleaning of the area. In June 2024, Conavi carried out new clearing work and collection of plant debris. On February 6, 2025, a meeting was held in which Conavi decided that it “would evaluate the execution of tree removal (descuaje de árboles) work, would request a new inspection by the MOPT Forest Engineer, and, additionally, the possibility of establishing a cooperation agreement with the Municipality of Curridabat was raised, in order to coordinate joint maintenance work in the sector.” On June 14, 2025, Conavi held a virtual meeting with the Municipality of Curridabat to discuss a possible cooperation agreement to address the area in question.
On August 28, 2025, Conavi carried out new cleaning work at the site. On October 31, 2025, the plaintiff [Name 011] was informed that the Forest Engineering inspection was within the inspection schedule and would be carried out according to the established order. On November 14, 2025, Conavi informed the plaintiff [Name 011] that “the clearing work corresponding to the National Route No. 2 (Florencio del Castillo) corridor was underway; however, this work is carried out in sections and, as of that date, the work crews had not yet reached the specific sector indicated.” In this regard, it is observed that, since 2020, Conavi has carried out various maintenance tasks and work in the area, precisely to prevent impacts resulting from the vegetation present at the site; however, it is not proven that, after August 28, 2025, the required work has continued, nor that an approach regarding the growth of the trees referred to by the plaintiffs has been defined.
Thus, with respect specifically to the trees at the site, although inspections and pertinent technical assessments were carried out in 2020 to determine that, at that time, such trees posed no risk to the neighbors, it is no less true that since February 6, 2025, the Conavi authorities decided that the “execution of tree removal work would be evaluated” once again, for which a “new inspection by the MOPT Forest Engineer would be requested.” However, it is not verified that such a specific inspection and assessment was ultimately carried out, in order to determine the course of action regarding this particular point alleged by the appellants. To that extent, what emerges, according to the information provided by the respondent party, is that on October 31, 2025, the protected party [Name 011] was informed that the Forest Engineering inspection was within the inspection schedule and would be carried out according to the established order.
Furthermore, as noted, after August 2025, the execution of subsequent general vegetation maintenance and cleaning work is not proven, but only a communication sent on November 14, 2025, to the aforementioned protected party, in which she was informed: “the clearing work corresponding to the National Route No. 2 (Florencio del Castillo) corridor was underway; however, this work is carried out in sections and, as of that date, the work crews had not yet reached the specific sector indicated.” Therefore, it should be clarified that, as a matter of principle, it is not for this Chamber to determine whether, in this specific case, it is appropriate to carry out the pruning or tree removal sought by the appellants; however, this Court may intervene regarding the delay incurred by the respondent authority in precisely carrying out the corresponding technical forestry assessment to determine whether or not such actions should be executed, and also regarding the delay in continuing the cleaning maintenance required by the area.
Consequently, the appeal is granted with respect to Conavi, on the terms indicated in the operative part of this ruling.
VI.Finally, in relation to the Municipality of Curridabat, it does not appear from the filing brief that the plaintiffs attribute specific actions or omissions to it, since it should be noted that the amparo was specifically directed against Conavi.
I have supported the thesis of this Court that when a claimant alleges a violation of the right to prompt and complete justice in administrative proceedings, the courts that must hear the legal dispute are the Contentious-Administrative Courts and not this Chamber. That said, with the recent enactment of Law No. 9097, the Law Regulating the Right of Petition, it has been established that this right is subject to judicial protection through the amparo remedy established by Article 32 of the Law of Constitutional Jurisdiction, in relation to Article 27 of the Political Constitution of the Republic of Costa Rica, in those cases where the petitioner considers that the material actions of the Administration, its administrative acts, or its response are affecting their fundamental rights. In my view, the recently enacted legislation does not imply that this Court must modify its jurisprudential line, which, based on numeral 7 of its Law, is exclusively responsible for defining its own competence.
Therefore, except for those juridical-constitutional disputes that have been recognized by this same Chamber as exceptional cases, which may properly be heard in this jurisdiction through the constitutional amparo protection process, in the remaining cases, and for the reasons given by this Court (Judgment No. 2008-02545 of 8:55 a.m. on February 22, 2008), the competent authorities are the Judges of the contentious-administrative jurisdiction, all of which is in accordance with numeral 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and norms), and the corresponding legal norms based on a logical, systemic, and teleological interpretation of the legal system.
In environmental matters, it is also the criterion of the undersigned that if there has already been intervention by the Public Administration, I consider that its knowledge and resolution corresponds to the contentious-administrative jurisdiction. However, I do proceed to hear the merits of the matter when other rights of the persons affected by the source of contamination are at stake, including health, quality of life, and the right to enjoy a healthy and pollution-free environment (Article 50 of the Political Constitution), as is the case here, in which the appellant party filed an environmental complaint that has not been definitively resolved, in violation of the right to enjoy a healthy and ecologically balanced environment and a dignified level of quality of life.
The parties are warned that if they have submitted any document in paper form, as well as objects or evidence contained in any electronic, computer, magnetic, optical, telematic device or produced by new technologies, these must be withdrawn from the office within a maximum period of 30 working days counted from the notification of this judgment. It is warned that any material not withdrawn within this period will be destroyed, pursuant to the provisions of the "Regulation on the Electronic Case File before the Judicial Branch," approved by the Full Court in Article XXVI of session no. 27-11 of August 22, 2011, published in Judicial Bulletin no. 19 of January 26, 2012, as well as the agreement of the Superior Council of the Judicial Branch, approved in Article LXXXI of session no. 43-12 held on May 3, 2012.
Therefore:
The appeal is partially granted, only with respect to the National Roads Council (Consejo Nacional de Vialidad). Mauricio Sojo Quesada, in his capacity as executive director of the National Roads Council, or whoever holds that position, is ordered to issue the pertinent orders, coordinate the corresponding actions, and carry out all actions within the scope of his powers, so that, within a maximum period of TWO MONTHS, counted from the notification of this judgment, 1) the respective technical forestry criteria regarding the situation of the trees referred to by the plaintiffs are issued, and the corresponding work is carried out according to such assessments, and; 2) the general cleaning, clearing (chapeo), and maintenance work of the site is carried out. The respondent authority is warned that, in accordance with the provisions of Article 71 of the Law of Constitutional Jurisdiction, a prison sentence of three months to two years, or a fine of twenty to sixty days, shall be imposed on anyone who receives an order that must be fulfilled or enforced, issued within an amparo proceeding, and fails to fulfill it or have it fulfilled, provided that the offense is not more severely punished.
The National Roads Council is ordered to pay the costs, damages, and losses caused by the facts that serve as the basis for this declaration, which shall be settled in the execution of the judgment in the contentious-administrative venue. Magistrate Castillo Víquez records a note. Magistrate Salazar Alvarado records a note. In all other respects, the appeal is dismissed. Notify.

Resultando:
Redacta el Magistrado Rueda Leal; y,
Considerando:
De previo a analizar el fondo del recurso, debe aclararse que, a partir de la sentencia No. 2008-02545 de las 8:55 horas de 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa – con algunas excepciones– aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo – instruido de oficio o a instancia de parte– conocer de los recursos administrativos procedentes. Precisamente, en este caso, se plantea un supuesto de excepción, pues, se está ante gestiones que procuran la seguridad y salud de personas de la comunidad de calle Los Cerezos de Lomas del Sol en Curridabat, y que presuntamente no han sido atendidas en un plazo razonable.
Los recurrentes manifiestan que son vecinos de calle Los Cerezos, en la urbanización Lomas del Sol en Curridabat. Explican que, desde hace aproximadamente 15 años, los árboles y maleza que se ubican en un lote del Conavi que se sitúa detrás de sus viviendas, han ocasionado distintas afectaciones. Detallan que las hojas, ramas y raíces de los árboles provocan daños estructurales en techos, canoas, bajantes, láminas de zinc, cielorrasos y paredes, lo que ha obligado a realizar mantenimientos constantes y costosos durante mucho tiempo. Señala que, durante el invierno de 2025, la limpieza de canoas en algunas viviendas debía realizarse cada cinco días para evitar inundaciones internas. Relatan que la maleza alcanza alturas superiores a las tapias, lo que ocasiona la presencia de insectos, zancudos, ratas, zarigüeyas, mapaches, culebras y otros animales, además de acumulación de basura. Exponen que también hay riesgo de incendio durante la época seca debido a la maleza y la presencia de personas que ingresan al lugar.
Acusan que el Conavi limpia la maleza solo 2 veces al año, mientras que la poda de árboles solo se ha efectuado en 2021 y en febrero de 2025. Señalan que instituciones como la Municipalidad de Curridabat han intervenido solicitando limpiezas y atención por parte de Conavi; empero, para enero de 2026 no se había solucionado el asunto. Por lo expuesto, solicitan que se declare con lugar el recurso y se ordene a la recurridas realizar la poda horizontal de las copas de los árboles, de manera que su altura no sobrepase las tapias ni los techos de las casas. Además, que se ejecute mantenimiento periódico y permanente de la maleza durante todo el año, y que se gestione un acuerdo con la Municipalidad de Curridabat para su atención continua.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos, según lo prevenido en el auto inicial:
De importancia para la decisión de este asunto, se estima como no demostrado que se haya efectuado la inspección de Ingeniería Forestal acordada el 6 de febrero de 2025 a fin de determinar la procedencia del descuaje de árboles en el sector.
En el sub lite, los recurrentes manifiestan que son vecinos de calle Los Cerezos, en la urbanización Lomas del Sol en Curridabat. Explican que, desde hace aproximadamente 15 años, los árboles y maleza que se ubican en un lote del Conavi que se sitúa detrás de sus viviendas, han ocasionado distintas afectaciones. Detallan que las hojas, ramas y raíces de los árboles provocan daños estructurales en techos, canoas, bajantes, láminas de zinc, cielorrasos y paredes, lo que ha obligado a realizar mantenimientos constantes y costosos durante mucho tiempo. Señala que, durante el invierno de 2025, la limpieza de canoas en algunas viviendas debía realizarse cada cinco días para evitar inundaciones internas. Relatan que la maleza alcanza alturas superiores a las tapias, lo que ocasiona la presencia de insectos, zancudos, ratas, zarigüeyas, mapaches, culebras y otros animales, además de acumulación de basura.
Exponen que también hay riesgo de incendio durante la época seca debido a la maleza y la presencia de personas que ingresan al lugar. Acusan que el Conavi limpia la maleza solo 2 veces al año, mientras que la poda de árboles solo se ha efectuado en 2021 y en febrero de 2025. Señalan que instituciones como la Municipalidad de Curridabat han intervenido solicitando limpiezas y atención por parte de Conavi; empero, para enero de 2026 no se había solucionado el asunto. Por lo expuesto, solicitan que se declare con lugar el recurso y se ordene a la recurridas realizar la poda horizontal de las copas de los árboles, de manera que su altura no sobrepase las tapias ni los techos de las casas. Además, que se ejecute mantenimiento periódico y permanente de la maleza durante todo el año, y que se gestione un acuerdo con la Municipalidad de Curridabat para su atención continua.
Del estudio de los autos se tiene por demostrado, que, el 6 de julio de 2020, ante una gestión de la accionante [Nombre 011], el Conavi realizó trabajos de chapeo en la zona. El 22 de julio de 2020, ante una inspección efectuada, el ingeniero forestal del MOPT emitió un informe en el que detalló que los árboles del sitio no implicaban riesgo alguno para los usuarios de la vía ni para las propiedades vecinas. El 28 de junio de 2021, el Conavi y la Municipalidad de Curridabat realizaron una inspección en el sitio y se constataron acciones de chapeo y mantenimiento de la vegetación; asimismo, se descartó algún riesgo por los árboles de la zona. En octubre de 2021, el Conavi realizó labores de mantenimiento en el sector, que incluyeron chapeo, recolección de maleza y limpieza general del área. En junio de 2024, el Conavi ejecutó nuevos trabajos de chapeo y recolección de residuos vegetales. El 6 de febrero de 2025, se realizó una reunión en la que el Conavi decidió “valoraría la ejecución de labores de descuaje de árboles, solicitaría una nueva inspección por parte del Ingeniero Forestal del MOPT y, adicionalmente, se planteó la posibilidad de establecer un convenio de cooperación con la Municipalidad de Curridabat, con el fin de coordinar labores de mantenimiento conjunto en el sector.”.
El 14 de junio de 2025, el Conavi realizó una reunión virtual con la Municipalidad de Curridabat, para analizar un posible convenio de cooperación para atender la zona en cuestión. El 28 de agosto de 2025, el Conavi efectuó nuevas labores de limpieza en el sitio. El 31 de octubre de 2025, se le comunicó a la accionante [Nombre 011] que la inspección de Ingeniería Forestal se encontraba dentro de la programación de inspecciones y que se haría de acuerdo con el orden establecido. El 14 de noviembre de 2025, el Conavi le informó a la accionante [Nombre 011] que “las labores de chapeo correspondientes al corredor de la Ruta Nacional No. 2 (Florencio del Castillo) se encontraban en ejecución; sin embargo, estas se realizan por tramos y, a esa fecha, las cuadrillas de trabajo aún no habían llegado al sector específico señalado.”.
Sobre el particular, se observa que, desde el 2020, el Conavi ha ejecutado distintas labores y trabajados de mantenimiento en la zona, precisamente para evitar afectaciones como consecuencia de la vegetación presente en el sitio; sin embargo, no se acredita que, con posterioridad al 28 de agosto de 2025, se haya continuado con las labores requeridas, ni tampoco que se haya definido el abordaje relativo al crecimiento de los árboles referidos por los accionantes.
Así, en lo que atañe específicamente a los árboles del sitio, si bien en 2020 se realizaron inspecciones y valoraciones técnicas pertinentes para determinar que, en ese momento, tales árboles no implicaban riesgo alguno para los vecinos, no menos cierto es que desde el 6 de febrero de 2025 las autoridades del Conavi decidieron que nuevamente se “valoraría la ejecución de labores de descuaje de árboles”, para lo cual se “solicitaría una nueva inspección por parte del Ingeniero Forestal del MOPT”. Empero, no se verifica que finalmente tal inspección y valoración concreta se haya materializado, para determinar el proceder respecto de este punto en particular alegado por los recurrentes. En ese tanto, lo que se desprende según lo informado por la parte accionada es que el 31 de octubre de 2025 se le comunicó a la amparada [Nombre 011] que la inspección de Ingeniería Forestal se encontraba dentro de la programación de inspecciones y que se haría de acuerdo con el orden establecido.
Además, como se apuntó, luego de agosto de 2025 no se acredita la ejecución de ulteriores trabajos generales de mantenimiento y limpieza vegetal, sino únicamente una comunicación remitida el 14 de noviembre de 2025 a la tutelada aludida, en la que se le indicó: “las labores de chapeo correspondientes al corredor de la Ruta Nacional No. 2 (Florencio del Castillo) se encontraban en ejecución; sin embargo, estas se realizan por tramos y, a esa fecha, las cuadrillas de trabajo aún no habían llegado al sector específico señalado.”.
De tal manera, cabe aclarar que en tesis de principio no le corresponde a esta Sala determinar si en este caso concreto corresponde realizar la poda o el descuaje de árboles pretendido por los recurrentes; sin embargo, sí puede intervenir este Tribunal respecto de la mora en la que ha incurrido la autoridad recurrida para precisamente realizar la valoración técnica forestal correspondiente que permita determinar si procede o no ejecutar tales acciones, y también respecto de la dilación para continuar el mantenimiento de limpieza que requiere la zona.
En consecuencia, se declara con lugar el recurso en cuanto al Conavi, en los términos que se indican en la parte dispositiva de este pronunciamiento.
VI.Finalmente, en relación con la Municipalidad de Curridabat, del escrito de interposición no se desprende que los accionantes le atribuyan acciones u omisión concretas, pues nótese que específicamente el amparo fue dirigido contra el Conavi.
He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia.
Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.
En asuntos ambientales, es también criterio del suscrito, de que si ya ha habido intervención de la Administración Pública, considero que su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que la parte recurrente presentó una denuncia ambiental que no ha sido resuelta en forma definitiva, con violación del derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidos en algún dispositivo de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en el plazo máximo de 30 días hábiles contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo aquel material no retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 del 22 de agosto de 2011, publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012, así como en el acuerdo de Consejo Superior del Poder Judicial, aprobado en el artículo LXXXI de la sesión nro. 43-12 celebrada el 3 de mayo de 2012.
Por tanto:
Se declara parcialmente con lugar el recurso, solo respecto del Consejo Nacional de Vialidad. Se ordena a Mauricio Sojo Quesada, en su condición de director ejecutivo del Consejo Nacional de Vialidad, o a quien ocupe ese cargo, que gire las órdenes pertinentes, coordine lo correspondiente y lleve a cabo todas las actuaciones que estén dentro del ámbito de sus competencias, para que, dentro del plazo máximo de DOS MESES, contado a partir de la notificación de esta sentencia, 1) se emitan los respectivos criterios técnicos forestales relativos a la situación de los árboles referidos por los accionantes, y se efectúen las labores que correspondan según tales valoraciones, y; 2) se realicen las labores generales de limpieza, chapeo y mantenimiento del sitio. Se advierte a la autoridad recurrida, que de acuerdo con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.
Se condena al Consejo Nacional de Vialidad al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de la vía contencioso-administrativa. El magistrado Castillo Víquez consigna nota. El magistrado Salazar Alvarado consigna nota. En lo demás, se declara sin lugar el recurso. Notifíquese.
