Res. No. 2026015754 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine twenty hours on the sixth of May of two thousand twenty-six.
Petition for non-compliance in the amparo action filed by [Nombre 001], identification card number [Valor 001] and [Nombre 002], identification card number [Valor 002], against the MINISTERIO DE SALUD.
**Findings:** **1.-** By a brief filed at the Secretariat of this Chamber on October 23, 2025, the petitioners filed a contempt petition regarding ruling number 2025026586 of nine fifteen hours on the twenty-second of August of two thousand twenty-five (see electronic record).
**2.-** By a resolution of fourteen thirty-two hours on the twenty-seventh of October of two thousand twenty-five, the instructing magistrate granted a hearing to Jennifer Jones Villiers, in her capacity as Director of the Área Rectora in Salud of Talamanca, or to whoever holds the office in her place, for her to address and provide the corresponding evidence regarding the acts and omissions attributed to her (see electronic record).
**3.-** Jennifer Jones Villiers reports under oath in her capacity as Director of the Área Rectora de Salud de Talamanca (see electronic record) in the following terms: "FIRST: That by way of CARTA-MS-DRRSHC-DARST-DARST-3363-2025, a response was provided to the Noble Chamber in attention to the request made by resolution of eleven thirty-seven hours on the day of the seventeenth of October two thousand twenty-four. SECOND: That for this purpose we were granted ONE MONTH from the notification, with the answer being sent on October 9, 2025, meaning that due to an involuntary error the granted response deadline was exceeded by 08 days, based on the fact that public administration, as a general and very logical rule, carries out administrative actions on business days and hours, in accordance with the fact that the Public Administration can only act through its officials, who are people with a specific work day and schedule. THIRD: That within the steps taken to remedy the dispute and in accordance with what was ordered, we proceeded on September 16, 2025, to visit the site: 1. It was not possible to establish communication or gain access to the property of Mr. [Nombre 003], the accused person. 2. It was not possible to establish communication or gain access to the property of Mrs. [Nombre 002] and Mr. [Nombre 001], the complainants. We do not fail to state and provide clarification to the Constitutional Chamber that one of the problems faced for the proper attention of the case has been that the complainant cannot be located, as he does not appear to attend our proceedings, which has made it impossible to carry out the sonic measurements (mediciones sónicas), requiring us to seek strategies, which has lengthened the deadline, preventing the administration from taking swift and effective action for prompt and complete attention. FOURTH: That in the follow-up for better resolution, on the past 30th of September of this year, a joint visit was carried out with officials from the Ministerio de Seguridad Pública of Talamanca, and we managed to contact the complainants, but not the infringer, Mr. [Nombre 003], the accused. We present what these coordinated proceedings entailed: 1. They were attended by Mrs. [Nombre 002] and Mr. [Nombre 001]. The reason for the visit corresponding to this day was explained to them, after which a new site assessment was carried out. Likewise, an attempt was made to contact the accused, Mr. [Nombre 003], in the presence of the officers; however, the attempt was unsuccessful. 2. Noise (music) was perceived coming from the accused's property, so a sound level meter was set up in the complainants' home. 3. We proceeded with the installation of the equipment to perform the sonic measurement (sonometría), using on this occasion a Larson Davis brand sound level meter. Likewise, the complainants were given a detailed explanation of the procedure that would be carried out to measure the noise coming from the complainant's property. 4. A wait of approximately two hours was undertaken in order to take a noise measurement in accordance with the provisions of current regulations. Said sonic measurement (medición sónica) with the duly calibrated and properly certified sound level meter recorded levels above 60 decibels in the home of the Nussbaumers, to whom the procedure to be used was explained in detail, supported by the regulations governing the matter. 5. It was not possible to establish communication or gain access to the property of Mr. [Nombre 003], the accused person, despite our enormous efforts, through phone calls, emails, neighbors, and looking for him on his property; we believe he is flouting our authority so as not to be notified of the sanitary order (orden sanitaria) and to have the law enforced, correcting the infractions he commits against his complaining neighbors. 6. Between both parties there exist domestic violence litigations, which has transcended into the personal, intimate, and privacy spheres, generating precautionary measures in a jurisdictional venue. 7. Furthermore, the direct lighting orientation towards the complainants' dwelling, the presence of a pole with cameras on the property of Mr. [Nombre 003], and a recent complaint related to the use of laser-type lights that, according to those affected, cause skin irritation. These have been the most prominent findings generated through our proceedings in the follow-up of the case, for better resolution with the known and noted limitation of not being able to locate the accused. Likewise, to reaffirm with certainty that the petitioners here have had all the information first-hand, and that they are well aware, as neighbors of the accused, that this gentleman does not appear anywhere and cannot be found, to which they can attest, a fact that can be elucidated through this Noble Chamber, in addition to our actions in favor, of which they have full knowledge. FIFTH: That, based on the background of our actions, as above, and in coordination with the complainants, we proceeded to carry out the pertinent sonic measurements (mediciones sónicas): "the sonic measurement (sonometría) test was carried out during a schedule from 17:38 hours to 18:08 hours, in accordance with Article 5, Table 1, maximum permissible limits in Leq dB(A) of the Reglamento para el control del ruido ambiental, No. 44486-S. Below, a comparison of the limits detected by the sound level meter is presented:
Of the three limits detected in the sonic measurement (sonometría) test, only one measurement of 69.8 dB was detected, which exceeds the 65 dB permitted during daytime hours. The canton of Talamanca does not have a regulatory plan (Plan Regulador); therefore, the Ministerio de Salud will determine the type of receiving (residential) zone according to the classification in Table 2 of this regulation, Article 6." In relation to the sonic measurements (mediciones sónicas), we must state within the scope of our competencies that the permissible noise limits are exceeded, meaning that annoying noise above the decibels permitted in the norm is being generated, which requires us to issue a sanitary order (orden sanitaria) to the accused, who to date has not been located, a situation that is the main limitation on our exercise of action, facts that were communicated through the response given to the Noble Constitutional Chamber in official communication CARTA-MS-DRRSHC-DARST-3363-2025 (OCTOBER 9, 2025). SIXTH: That for the purpose of notifying the accused, we will remain attentive, for which we will be available not only during the regular workday but also on non-business days for the purpose of locating him and subsequently notifying him of the sanitary order (orden sanitaria), due to the problems he is causing in terms of noise to the surrounding neighborhood, all as established by due process and so as not to leave him in a state of defenselessness." **4.-** The legal requirements have been observed in the proceedings followed.
Drafted by Magistrate Cruz Castro; and, **Considering:** **I.-** In ruling number 2025026586 of nine fifteen hours on the twenty-second of August of two thousand twenty-five, this Chamber ordered:
"The amparo action is granted. It is ordered to Jennifer Jones Villiers, in her capacity as Director of the Área Rectora en Salud of Talamanca, or whoever holds the office in her place, that, within a period of ONE MONTH counted from the notification of this ruling, all actions within the scope of her competence be carried out and necessary coordination be undertaken to perform the inspection and sonic measurements (mediciones sónicas) required in order to definitively resolve the issue denounced by the petitioner. The foregoing, under the warning that, in accordance with the provisions of Article 71, of the Ley de la Jurisdicción Constitucional, a prison sentence of three months to two years, or a fine of twenty to sixty days, shall be imposed on anyone who receives an order that must be complied with or enforced, issued in an amparo action, and does not comply with it or does not cause it to be complied with, provided that the crime is not more severely punished. The State is condemned to pay the costs, damages, and losses caused by the facts that serve as the basis for this declaration, which shall be liquidated in enforcement of the judgment in the administrative contentious jurisdiction. Magistrate Castillo makes a note. Magistrate Salazar Alvarado makes a note. Notify." **II.- ON THE PETITION FOR NON-COMPLIANCE:** In this petition, the petitioner states that "to this day 23/10/2025 the scandals persist every day, LED lights, cameras, WLAN interference devices, AND the constant attacks on our health; Causing us even more serious harm." For its part, the respondent authority stated that "on the past 30th of September of this year, a joint visit was carried out with officials from the Ministerio de Seguridad Pública of Talamanca, and we managed to contact the complainants, but not the infringer, Mr. [Nombre 003], the accused. We present what these coordinated proceedings entailed: 1. They were attended by Mrs. [Nombre 002] and Mr. [Nombre 001]. The reason for the visit corresponding to this day was explained to them, after which a new site assessment was carried out. Likewise, an attempt was made to contact the accused, Mr. [Nombre 003], in the presence of the officers; however, the attempt was unsuccessful. 2. This being the case, the petition is admissible, and therefore Jennifer Jones Villiers, in her capacity as Director of the Área Rectora de Salud de Talamanca, or whoever holds the office in her place, is ordered to immediately proceed with compliance with the provisions of ruling number 2025026586 of nine fifteen hours on the twenty-second of August of two thousand twenty-five.
**III.- DOCUMENTATION PROVIDED TO THE CASE FILE.** This Chamber must warn the petitioners that if any document has been provided, whether in paper form, as well as objects or evidence backed by any additional device, or by electronic, computer, magnetic, optical, telematic means, or produced by new technologies, these must be withdrawn from the office within a period of 30 business days after receiving notification of this ruling, otherwise all of it will be destroyed in accordance with the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Corte Plena in session No. 27-11 of August 22, 2011, Article XXVI and published in the Judicial Bulletin number 19 of January 26, 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial, in session No. 43-12 held on May 3, 2012, Article LXXXI.
**Therefore:** The non-compliance request is granted. Jennifer Jones Villiers, in her capacity as Director of the Área Rectora de Salud de Talamanca, or whoever holds the office in her place, is reiterated to immediately proceed with the compliance of the provisions in ruling number 2025026586 of nine fifteen hours on the twenty-second of August of two thousand twenty-five.

Likewise, the complainants were given a detailed explanation of the procedure that would be carried out to measure the noise coming from the accused's property. 4. A wait of approximately two hours was undertaken in order to take a noise measurement in accordance with the provisions of current regulations. This sonic measurement with the sound level meter, duly calibrated and certified, registered levels exceeding 60 decibels in the home of Mr. and Mrs. Nussbaumer, who were explained in detail about the procedure to be used, based on the regulations governing the matter. 5. It was not possible to establish communication with or gain access to the property of Mr. [Name 003], the accused person, despite our strenuous efforts through calls, emails, neighbors, and searching for him on his property; we believe he mocks our authority to avoid being notified with the sanitary order and to ensure the law is enforced, correcting the violations he commits against his complainant neighbors. 6. Between both parties there exists litigation for domestic violence, which has transcended into the personal sphere, intimacy, and privacy, generating precautionary measures in jurisdictional proceedings. 7. In addition, the orientation of direct lighting towards the complainants' dwelling, the presence of a pole with cameras on the property of Mr. [Name 003], and a recent complaint related to the use of laser lights that, according to the affected parties, cause skin irritation. These have been the most prominent findings generated through our diligence in following up on the case, to better resolve it given the well-known and noted limitations of being unable to locate the accused. Likewise, to reaffirm with certainty that the recurring complainants herein have had all the information firsthand, and that they are well aware, as neighbors of the accused, that this gentleman is nowhere to be found and cannot be located, to which they can attest regarding our comment, a fact that can be elucidated through this Noble Chamber, in addition to our actions in support thereof, all of which they have full knowledge. FIFTH: That, based on the background of our actions, outlined above, and in coordination with the complainants, we proceeded to carry out the pertinent sonic measurements: “the sound level test was carried out between 17:38 hours and 18:08 hours, in accordance with Article 5, table 1, maximum permissible limits in Leq dB(A) of the Regulation for the control of environmental noise, No. 44486-S.

Con base en el estudio preliminar presentado por el Instituto Costarricense de Electricidad (ICE), denominado “Estudio Preliminar de Impacto Ambiental para el PH Diquís”, de octubre de 2006, se evaluó el alcance del proyecto y se identificaron los posibles impactos ambientales significativos. Como resultado, mediante resolución № 2991-2007-SETENA del 16 de noviembre de 2007, se aprobó la Viabilidad (Licencia) Ambiental del PH Diquís, imponiendo una serie de condicionantes y medidas de mitigación y compensación ambiental.
CUERDO EN FIRME CONTRALORÍA GENERAL DE LA REPÚBLICA. División de Contratación Administrativa. San José, at thirteen hours and eight minutes of August twenty-third, two thousand and one.--- Based on the pronouncement in an advisory opinion and a previous internal analysis, it has been determined that the cartel was designed with a clear restrictive effect on competition, given that certain specifications indirectly excluded other potential suppliers with formally identical capacities. In accordance with the concept of functional equivalence established in the applicable regulations, the bidders had a duty to demonstrate the technical equivalence of the products offered, which they did not do. The Chamber indicates that the proposal to contract, in these terms, is null and contrary to the general principles that govern administrative contracting. SIXTH: That in the interest of notifying the person reported, we will remain on alert, for which purpose we will be available not only during regular working hours, but also on non-business days in order to locate him and subsequently notify him of the sanitary order, due to the noise problems he is causing to the surrounding neighborhood, all of which is established by due process and so as not to leave him in a state of defenselessness.” 4.- The legal requirements have been observed in the proceedings followed.

Considering:
I.- In judgment number 2025026586 of nine hours fifteen minutes of August twenty-second, two thousand twenty-five, this Chamber ordered:
“The appeal is granted. Jennifer Jones Villiers, in her capacity as Director of the Talamanca Health Area, or whoever holds that position, is ordered to, within the period of ONE MONTH from notification of this judgment, carry out all actions within the scope of her authority and coordinate what is necessary to perform the inspection and sonic measurements required to definitively resolve the problem reported by the appellant. The foregoing, under the warning that, in accordance with Article 71 of the Constitutional Jurisdiction Law (Ley de la Jurisdicción Constitucional), whoever receives an order that must be complied with or enforced, issued in an amparo appeal and fails to comply with it or enforce it, shall be subject to imprisonment of three months to two years, or a fine of twenty to sixty days, provided the crime is not more severely punished. The State is ordered to pay costs, damages and losses caused by the facts serving as the basis for this declaration, which shall be liquidated in the execution of sentence of the administrative contentious proceeding. Judge Castillo sets forth a note. Judge Salazar Alvarado sets forth a note. Notify.” II.- REGARDING THE CONTEMPT PROCEEDING: In the present proceeding, the appellant states that “as of today 23/10/2025 the scandals persist every day, LED lights, cameras, WLAN interference devices, AND the constant attacks on our health; Causing us even more serious harm”. For her part, the respondent authority stated that “on September 30 of this year, a joint visit was made with officials from the Ministry of Public Security of Talamanca, and we managed to contact the complainants, but not the offender Mr. [Name 003], the person reported. We present what such coordinated steps entailed: 1. They were attended by Mrs. [Name 002] and Mr. [Name 001]. The reason for the visit corresponding to this day was explained to them, after which a new site assessment was carried out. Likewise, an attempt was made to contact the person reported, Mr. [Name 003], in the presence of the officers; however, the attempt was unsuccessful. 2. The equipment was set up to perform the sound measurement, using on this occasion a Larson Davis brand sound level meter. Likewise, the complainants were given a detailed explanation of the procedure that would be carried out to measure the noise coming from the reported person's property. 4. A wait of approximately two hours was undertaken in order to take a noise reading in accordance with current regulations. Said sonic measurement with the duly calibrated and duly certified sound level meter registered levels exceeding 60 decibels in the Nussbaumers' home, which was explained to them in detail regarding the procedure to be used, based on the regulations governing the matter. 5. Communication or access to the property of Mr. [Name 003], the person reported, could not be established, despite our enormous efforts, through calls, emails, neighbors, looking for him on his property; we believe he evades our authority to avoid being notified with the sanitary order and to ensure the law is enforced, correcting the infractions he commits against his complaining neighbors. 6. There is litigation between both parties for domestic violence, which has transcended into the personal sphere, intimacy and privacy, which has generated precautionary measures in the jurisdictional venue” and that “in the interest of notifying the person reported, we will remain on alert, for which purpose we will be available not only during regular working hours, but also on non-business days in order to locate him and subsequently notify him of the sanitary order, due to the noise problems he is causing to the surrounding neighborhood, all of which is established by due process and so as not to leave him in a state of defenselessness”.

In full compliance with Law No. 8220 regarding the Protection of Citizens from the Excess of Requirements and Administrative Procedures, I have reviewed the contents of the present environmental feasibility file. This instrument, which regulates land-use change (cambio de uso del suelo) when it comes to Article 19 of the Forest Law (Ley Forestal), holds constitutional rank, according to Ruling No. 2005-13346 of Sala Constitucional, in both the administrative file and the environmental impact assessment (evaluación de impacto ambiental, EIA). It appears that the environmental impact assessment (EIA) was reviewed and that reference is made to its adjustment to specific requirements, for example, the Program for Forest Fire Control and to the treatment of environmental variables. In general, the managed document complies with the conditions of technical sufficiency and presents a clear expropriation for the publication of the environmental diagnosis on March 23, 2006, in the official newspaper La Gaceta. **Whereas:** **1.-** By a brief filed in the Secretariat of this Chamber on October 23, 2025, the petitioners filed a motion for contempt of judgment number 2025026586 of nine hours fifteen minutes on August twenty-second, two thousand twenty-five (see electronic record).
**2.-** By resolution of fourteen hours thirty-two minutes on October twenty-seventh, two thousand twenty-five, the investigating magistrate granted a hearing to Jennifer Jones Villiers, in her capacity as Director of the Talamanca Health Governing Area (Área Rectora en Salud de Talamanca), or to whoever may hold that position, so that she may address and provide the corresponding evidence regarding the actions and omissions attributed to her (see electronic record).
**3.-** **Jennifer Jones Villiers, in her capacity as Director of the Talamanca Health Governing Area (Área Rectora de Salud de Talamanca)** reports under oath (see electronic record) in the following terms: "FIRST: That by means of CARTA-MS-DRRSHC-DARST-DARST-3363-2025, a response was given to the Honorable Chamber in answer to the petition through the resolution of eleven hours and thirty-seven minutes on the seventeenth day of October, two thousand twenty-four. SECOND: That for this purpose, we were granted ONE MONTH from the notification, and the response was sent on October 9, 2025, whereby, due to an involuntary error, the granted response period was exceeded by 08 days, based on the fact that the public administration, as a general and very logical rule, performs administrative actions on working days and hours, in line with the fact that the Public Administration can only act through its officials, who are persons with a specific work schedule and hours. The reason for the visit that day was explained, after which a new site assessment was made. Likewise, an attempt was made to contact the person reported, Mr. [Name 003], in the presence of the officers; however, the attempt was unsuccessful. 2. Noise (music) was perceived coming from the property of the person reported, so the sound level meter (sonómetro) was set up in the dwelling of the complainants. 3. It was not possible to establish communication or access to the property of Mr. [Name 003], the person reported, despite our enormous efforts, through calls, emails, neighbors, and searching for him on his property; we believe he flouts our authority to avoid being notified of the sanitary order and to enforce the law, correcting the violations he commits against his complaining neighbors. 6. Between both parties, there are domestic violence disputes, which have transcended into the personal, intimacy, and privacy sphere, generating precautionary measures in the jurisdictional venue. 7. Additionally, the direction of direct lighting towards the complainants' dwelling, the presence of a pole with cameras on Mr. [Name 003]'s property, and a recent complaint related to the use of laser-type lights that, according to those affected, cause skin irritation. These have been the most prominent findings generated through our proceedings in the follow-up to the case, to better resolve it with the well-known and noted limitation of not being able to locate the person reported. Likewise, we can affirm with certainty that the petitioners here have had all the information first-hand, and that they, as neighbors of the reported party, are well aware that this gentleman does not appear anywhere, and cannot be found, which they can attest to regarding our comment, a fact that can be elucidated through this Honorable Chamber, in addition to our actions in favor, all of which they have full knowledge. Having been answered by the Environmental Technical Secretariat (Secretaría Técnica Nacional Ambiental, SETENA) and the National Institute of Housing and Urban Development (Instituto Nacional de Vivienda y Urbanismo, INVU), the excuse and absence of cause requested by the petitioner are rejected, and consequently, the procedure is ordered to continue.
In relation to the rest of the recitals (considerandos), this Chamber will thoroughly examine the issue in order to resolve this case, and it therefore proceeds with the order to open.
Wherefore, in accordance with the provisions set forth in arts. 9, 141 and following of the Law of the Constitutional Jurisdiction (Ley de la Jurisdicción Constitucional), the excuse of Judges Luis Fernando Solano Carrera and Armijo Sancho are not admissible, the absence of cause of the regulatory entities is rejected, and it is resolved: Report within ten days, under penalty set forth in the Law of the Constitutional Jurisdiction, the damages that the objecting party alleges, referring to the facts that motivate this process, and that are, in summary: a) The violation of the right to a healthy and ecologically balanced environment is alleged, with the authorization granted by the National Environmental Technical Secretariat and the Municipality of Desamparados for the execution of an urbanization in an area of 775,276 square meters, on a property located 100 meters south of the church of San Antonio de Desamparados, under the legal basis of the regulatory plan for the San Antonio area, which was approved by the National Institute of Housing and Urban Development, by Law 4240 of November 1968, which in the Recital II of the Development and Subdivision Regulations literally states: "the area known as San Antonio belongs to a water recharge zone". Despite this, the Urbanization is being developed under the legal basis of the Regulatory Plan, for land use, a plan dating back to the year 1968, and which did not have an environmental impact study (estudio de impacto ambiental). The Council of the National Institute of Housing and Urban Development, in its session 5255 dated 12/3/2002, ruled that the permit for the urbanization project is not feasible due to non-compliance with the Development and Subdivision Regulations (Reglamento de Fraccionamiento), and due to lack of environmental viability on the part of the Environmental Technical Secretariat, however, it is unknown why some modifications were to be made to the project, if the land has the same characteristics. This, notwithstanding the fact that the project was submitted to the Municipal Council of Desamparados, which in session 113-2001 gave its approval to the project without having seen the report from the National Institute of Housing and Urban Development and that the Environmental Technical Secretariat only had knowledge of a "shortened" Environmental Viability, without the guarantee that the area is provided with drinking water and sanitation, that the aquifers are safeguarded, analyzing the impact that the work will have on the environment, forgetting the existing forest cover (cobertura boscosa) in the area, which has a secondary forest (bosque secundario) of significant value, and that the property has springs (nacientes) that constitute a system of great importance for the community, as it supplies several populations, since the property is a recharge zone. The property in question is part of a territorial extension protected by the Forest Law (Ley Forestal) which declares that the areas that border springs are inalienable zones, to which the protection measures of Art. 33 and 34 of said law must be applied, in addition, the property is located in a landslide zone, and that on its perimeter line it borders the Loma Salitral Protected Area. The Environmental Technical Secretariat, according to Arts. 19, 20, 21 of the Environmental Organic Law (Ley Orgánica del Ambiente) has the power to order, through reasoned resolution, the suspension or cessation of works that threaten the environment; the applicable measure in this case is the precautionary measure provided for in Art. 99 of the same law. The precautionary principle is argued based on the fact that if the project is authorized, damage will be caused to the environment that could become "irreversible". I.- In judgment number 2025026586 of nine hours fifteen minutes of twenty-two August two thousand twenty-five this Chamber ordered:
"It is declared with merit the appeal. Jennifer Jones Villiers, in her capacity as Director of the Talamanca Health Governing Area (Área Rectora en Salud de Talamanca), or whoever holds the position in her stead, is ordered, within a period of ONE MONTH counted from the notification of this judgment, to carry out all actions within the scope of her competence and coordinate what is necessary to perform the inspection and sound measurements required in order to definitively resolve the issues reported by the appellant. The foregoing, under the warning that, in accordance with the provisions of article 71, of the Constitutional Jurisdiction Law, imprisonment of three months to two years, or a fine of twenty to sixty days, shall be imposed upon anyone who receives an order that must be complied with or enforced, issued in an amparo appeal and does not comply with it or does not have it complied with, provided that the crime is not more severely punished. The State is condemned to pay the costs, damages, and losses caused by the facts that serve as the basis for this declaration, which shall be liquidated in the execution of the judgment of the contentious-administrative proceeding. Magistrate Castillo adds a note. Magistrate Salazar Alvarado adds a note. Notify." II.- ON THE CONTEMPT PROCEEDING: In this proceeding, the appellant states that "as of today 23/10/2025 the scandals persist every day, LED lights cameras, WLAN interference devices, AND the constant attacks on our health; Causing us even more serious harm." For her part, the respondent authority asserted that "on September 30 of this year, a joint visit was made with officials from the Talamanca Ministry of Public Security, and we managed to contact the complainants, but not the offender Mr. [Name 003], the reported party. We present what entailed such coordinated proceedings: 1. They were attended to by Mrs. [Name 002] and Mr. [Name 001]. The reason for the visit, corresponding to this day, was explained to them, after which a new assessment of the site was carried out. Likewise, an attempt was made to contact the reported party, Mr. [Name 003], in the presence of the officers; however, the attempt was unsuccessful. 2. Noise (music) was perceived coming from the reported party's property, so we proceeded to install the sound level meter in the complainants' dwelling house. 3. We proceeded with the installation of the equipment to perform the sound measurement, using on this occasion a Larson Davis brand sound level meter. Likewise, the complainants were given a detailed explanation about the procedure that would be performed to measure the noise coming from the reported party's property. 4. A wait of approximately two hours was carried out in order to take a noise reading in accordance with the provisions of the current regulations. Said sound measurement with the sound level meter, duly calibrated and duly certified, recorded levels exceeding 60 decibels in the Nussbaumer residence, which was explained to them in detail regarding the procedure to be used, based on the regulations governing the matter. 5. Communication or access to the property of Mr. [Name 003], the reported person, was not achieved, despite our enormous efforts, in calls, emails, neighbors, looking for him on his property; we believe he evades our authority in order not to be notified with the sanitary order and to enforce the law, correcting the infractions he commits against his neighboring complainants. 6. Between both parties there are domestic violence litigations, which has transcended into the personal, intimacy, and privacy sphere, which has generated precautionary measures in the jurisdictional venue" and that "in the interest of notifying the reported party, we will be on standby, for which we will be available not only during regular working hours, but also on non-business days in order to locate him and subsequently notify him of the sanitary order, due to the problems he is causing in noise matters to the surrounding neighborhood, all of which is established by due process and so as not to leave him in a state of defenselessness." Thus, the proceeding becomes well-founded, and Jennifer Jones Villiers, in her capacity as Director of the Área Rectora de Salud de Talamanca, or whomever holds the position in her stead, is ordered to immediately proceed with compliance with the provisions set forth in judgment number 2025026586 of nine hours fifteen minutes on the twenty-second of August of two thousand twenty-five.
**III.- DOCUMENTATION PROVIDED TO THE CASE FILE.** This Chamber must warn the appellant that if any document has been provided, whether on paper, as well as objects or evidence supported by any additional device, or by electronic, computer-based, magnetic, optical, telematic means or produced by new technologies, these must be withdrawn from the office within a period of 30 business days after receiving notification of this judgment; otherwise, all of it will be destroyed in accordance with the provisions established in the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena in session No. 27-11 of August 22, 2011, article XXVI and published in Boletín Judicial number 19 of January 26, 2012, as well as in the agreement approved by the Consejo Superior del Poder Judicial, in session No. 43-12 held on May 3, 2012, article LXXXI.

Res. Nº 2026015754 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del seis de mayo de dos mil veintiseis .
Gestión de incumplimiento en el recurso de amparo presentado por [Nombre 001] , cédula de residencia [Valor 001] y [Nombre 002], cédula de residencia [Valor 002], contra el MINISTERIO DE SALUD.
Resultando:
1.- Por escrito presentado en la Secretaría de esta Sala el 23 de octubre de 2025 los recurrentes presentan gestión de desacato de la sentencia número 2025026586 de las nueve horas quince minutos del veintidós de agosto de dos mil veinticinco (ver registro electrónico).
2.- Por resolución de las catorce horas treinta y dos minutos del veintisiete de octubre de dos mil veinticinco el magistrado instructor brindó audiencia a Jennifer Jones Villiers, en calidad de Directora Área Rectora en Salud de Talamanca, o a quien en su lugar desempeñe el cargo, para que se refiera y aporte las pruebas correspondientes en relación con los hechos y omisiones que se le atribuyen (ver registro electrónico).
3.- Informa bajo juramento Jennifer Jones Villiers en su calidad de Directora del Área Rectora de Salud de Talamanca (ver registro electrónico) en los siguientes términos: “PRIMERO: Que mediante CARTA-MS-DRRSHC-DARST-DARST-3363-2025, se dio respuesta a la Noble Sala en atención a la petición mediante resolución de las once horas y treinta y siete minutos del día diecisiete de octubre dos mil veinticuatro. SEGUNDO: Que para lo cual se nos otorgó un MES a partir de la notificación, siendo que la respuesta se remitió en fecha 09 de Octubre 2025,lo que por un error involuntario se sobrepasó el plazo otorgado de respuesta en 08 días, partiendo que la administración pública como regla general y muy lógica las actuaciones administrativas se realizan en días y horas hábiles, en consonancia con el hecho de que la Administración Pública solo puede actuar a través de sus funcionarios que son personas que poseen una determinada jornada y horario laborales. TERCERO: Que dentro de las gestiones que se realizaron para remediar la litis y de acuerdo a lo ordenado, se procedió en fecha 16 de Setiembre 2025 a visitar el sitio: 1. No se logró establecer comunicación ni acceso a la propiedad del señor [Nombre 003], persona denunciada. 2. No se logró establecer comunicación ni acceso a la propiedad de la señora [Nombre 002] y el señor [Nombre 001], denunciantes. No se omite manifestar y aportar aclaración a la Sala Constitucional, que uno de los problemas que se han afrontado para la debida atención del caso, ha sido que no se localiza el denunciante, pues no aparece a atender nuestras diligencias, lo que ha sido imposible realizar las mediciones sónicas debiendo buscar estrategias lo que nos ha alargado el plazo, imposibilitando un actuar célere y eficaz de la administración para la atención pronta y cumplida. CUARTO: Que en el seguimiento para mejor resolver el pasado 30 de setiembre del presente año se realizó visita en conjunto con funcionarios del Ministerio de Seguridad Pública de Talamanca, y logramos contactar a los denunciantes, no así al infractor Señor [Nombre 003], denunciado. Presentamos lo que conllevó a tales diligencias en forma coordinada: 1. Fueron atendidos por la señora [Nombre 002] y el señor [Nombre 001]. Se les explicó el motivo de la visita correspondiente a este día, tras lo cual se procedió a realizar una nueva valoración del sitio. Asimismo, se intentó contactar al denunciado, el señor [Nombre 003], en presencia de los oficiales; sin embargo, el intento no fue exitoso. 2. Se percibió ruido (música) proveniente de la propiedad del denunciado por lo que se procedió a instalar el sonómetro en la casa de habitación de los denunciantes. 3. Se procedió con la instalación del equipo para realizar la sonometría, utilizando en esta ocasión un sonómetro de la marca Larson Davis. Asimismo, se brindó a los denunciantes una explicación detallada sobre el procedimiento que se realizaría para medir el ruido proveniente de la propiedad del denunciante. 4. Se realiza una espera de aproximadamente dos horas con el fin de efectuar una toma de ruido conforme a lo establecido en la reglamentación vigente. Dicha medición sónica con el sonómetro debidamente calibrado y certificado debidamente, se registraron niveles superiores a los 60 decibeles en la vivienda de los Señores Nussbaumer, lo cual se les explicó detalladamente sobre el procedimiento a utilizar sustentando en la normativa que rige la materia. 5. No se logró establecer comunicación ni acceso a la propiedad del señor [Nombre 003], persona denunciada, a pesar de nuestros ingentes esfuerzos, en llamadas, correos, vecinos, buscarlo en su propiedad, creemos que nos burla de nuestra autoridad para no ser notificado con la orden sanitaria y se haga cumplir la ley, corrigiendo las infracciones que comete en contra de sus vecinos denunciantes. 6. Entre ambas partes existe litigios por violencia doméstica, lo cual ha transcendido al ámbito personal, intimidad y privacidad, lo que ha generado medidas cautelares en sede jurisdiccional. 7. Además, la orientación de iluminación directa hacia la vivienda de los denunciantes, la presencia de un poste con cámaras en la propiedad del señor [Nombre 003], y una reciente denuncia relacionada con el uso de luces tipo láser que, según los afectados, provocan irritación en la piel. Estos han sido los hallazgos más prominentes que se han generado a través de nuestras diligencias en el seguimiento al caso, para mejor resolver con la limitantes consabida y apuntada de no lograrse localizar al denunciado. Asimismo, reafirmar con certeza, que los aquí recurrentes han tenido toda la información a primera mano, y que ellos están bien enterados como vecinos del denunciado que este Señor no aparece por ningún lado, y que no se logra encontrar, lo que pueden dar fé de nuestro comentario, hecho que puede ser dilucidado a través de tan Noble Cámara, además de nuestras acciones en pro, lo que tienen cabal conocimiento de todas ellas. QUINTO: Que, basado en los antecedentes de nuestras actuaciones, líneas arriba y en coordinación con los denunciantes, procedimos a realizar las mediciones sónicas pertinentes: “la prueba de sonometría se realizó en un horario de las 17:38 horas a las 18:08 horas, de acuerdo con el artículo 5 tabla1 límites máximos permisibles en Leq dB(A) del Reglamento para el control del ruido ambiental, Nº 44486-S. A continuación, se presenta una comparativa de los limites detectados por el sonómetro:
De los tres límites detectados en la prueba de sonometría se detectó solamente una medición de 69.8 dB, la cual sobrepasa los 65 dB permitidos en horario diurno. El cantón de Talamanca no cuenta con un Plan Regulador, por lo que el Ministerio de Salud determinará el tipo de zona receptora (residencial) según la clasificación de la Tabla 2 del presente reglamento, artículo 6. “ En relación a las mediciones sónicas hemos de manifestar en el ámbito de nuestras competencias, que los límites permisibles de ruido sobrepasan, lo que se está generando ruido molesto por encima de los decibeles permitidos en la norma, por lo que debemos girar la orden sanitaria al denunciado, que a la fecha no se ha podido localizar, situación que es la principal limitación en nuestro ejercicio de acción, hechos que fueron comunicados mediante la respuesta otorgada a la Noble Sala Constitucional en oficio CARTA-MS-DRRSHC-DARST-3363-2025 (09 DE OCTUBRE 2025). SEXTO: Que en aras de notificar al denunciado se estará al pendiente, para lo cual se estará en disponibilidad no solo en jornada ordinaria, sino además en días no hábiles con el fin de su localización y posterior notificación de la orden sanitaria, debido a los problemas que está causando en materia de ruido a la vecindad circundante, todo lo cual lo establece el debido proceso y no dejarlo en estado de indefensión”.
4.- En los procedimientos seguidos se han observado las prescripciones legales.
Redacta el Magistrado Cruz Castro; y,
Considerando:
I.- En la sentencia número 2025026586 de las nueve horas quince minutos del veintidós de agosto de dos mil veinticinco esta Sala dispuso:
“Se declara con lugar el recurso. Se ordena a Jennifer Jones Villiers, en calidad de Directora Área Rectora en Salud de Talamanca, o a quien en su lugar desempeñe el cargo, que, dentro del plazo de UN MES contado a partir de la notificación de la presente sentencia, se lleve a cabo todas las actuaciones que estén dentro del ámbito de su competencia y coordine lo necesario para realizar la inspección y mediciones sónicas que se requieren a fin de resolver en forma definitiva la problemática denunciada por la recurrente. Lo anterior, bajo la advertencia de que, de conformidad con lo establecido en el artículo 71, de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. El Magistrado Castillo pone nota. El Magistrado Salazar Alvarado pone nota. Notifíquese.” II.- SOBRE LA GESTIÓN DE DESACATO: En la presente gestión, la recurrente manifiesta que “hasta el día de hoy 23/10/2025 persisten los escándalos todos los días, luces led cámaras, dispositivos de interferencia WLAN, Y los ataques constante a nuestra salud; Causandonos daños aún más graves”. Por su parte la autoridad recurrida afirmó que “el pasado 30 de setiembre del presente año se realizó visita en conjunto con funcionarios del Ministerio de Seguridad Pública de Talamanca, y logramos contactar a los denunciantes, no así al infractor Señor [Nombre 003], denunciado. Presentamos lo que conllevó a tales diligencias en forma coordinada: 1. Fueron atendidos por la señora [Nombre 002] y el señor [Nombre 001]. Se les explicó el motivo de la visita correspondiente a este día, tras lo cual se procedió a realizar una nueva valoración del sitio. Asimismo, se intentó contactar al denunciado, el señor [Nombre 003], en presencia de los oficiales; sin embargo, el intento no fue exitoso. 2. Se percibió ruido (música) proveniente de la propiedad del denunciado por lo que se procedió a instalar el sonómetro en la casa de habitación de los denunciantes. 3. Se procedió con la instalación del equipo para realizar la sonometría, utilizando en esta ocasión un sonómetro de la marca Larson Davis. Asimismo, se brindó a los denunciantes una explicación detallada sobre el procedimiento que se realizaría para medir el ruido proveniente de la propiedad del denunciante. 4. Se realiza una espera de aproximadamente dos horas con el fin de efectuar una toma de ruido conforme a lo establecido en la reglamentación vigente. Dicha medición sónica con el sonómetro debidamente calibrado y certificado debidamente, se registraron niveles superiores a los 60 decibeles en la vivienda de los Señores Nussbaumer, lo cual se les explicó detalladamente sobre el procedimiento a utilizar sustentando en la normativa que rige la materia. 5. No se logró establecer comunicación ni acceso a la propiedad del señor [Nombre 003], persona denunciada, a pesar de nuestros ingentes esfuerzos, en llamadas, correos, vecinos, buscarlo en su propiedad, creemos que nos burla de nuestra autoridad para no ser notificado con la orden sanitaria y se haga cumplir la ley, corrigiendo las infracciones que comete en contra de sus vecinos denunciantes. 6. Entre ambas partes existe litigios por violencia doméstica, lo cual ha transcendido al ámbito personal, intimidad y privacidad, lo que ha generado medidas cautelares en sede jurisdiccional” y que “en aras de notificar al denunciado se estará al pendiente, para lo cual se estará en disponibilidad no solo en jornada ordinaria, sino además en días no hábiles con el fin de su localización y posterior notificación de la orden sanitaria, debido a los problemas que está causando en materia de ruido a la vecindad circundante, todo lo cual lo establece el debido proceso y no dejarlo en estado de indefensión”. Así las cosas la gestión deviene procedente por lo que se ordena a Jennifer Jones Villiers en su calidad de Directora del Área Rectora de Salud de Talamanca o a quien en su lugar ocupe el cargo proceder de manera inmediata al cumplimiento de lo dispuesto en la sentencia número 2025026586 de las nueve horas quince minutos del veintidós de agosto de dos mil veinticinco.
III.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Debe prevenir esta Sala a la parte recurrente que de haber aportado algún documento, ya sea en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho, en un plazo de 30 días hábiles, después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en Boletín Judicial número 19 del 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.
Por tanto:
Se acoge la solicitud de incumplimiento. Se le reitera a Jennifer Jones Villiers en su calidad de Directora del Área Rectora de Salud de Talamanca o a quien en su lugar ocupe el cargo proceder de manera inmediata al cumplimiento de lo dispuesto en la sentencia número 2025026586 de las nueve horas quince minutos del veintidós de agosto de dos mil veinticinco.
