Document Review 1 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours and twenty minutes on the thirtieth of April, two thousand twenty-six.
Writ of amparo (recurso de amparo) filed by [Nombre 001], [Valor 001], [Nombre 002], [Valor 002], [Nombre 003], [Valor 003], [Nombre 004], [Valor 004], against the MUNICIPALITY OF SAN RAMÓN, INSTITUTO COSTARRICENSE DE ELECTRICIDAD (ICE), AND SUPERINTENDENCIA DE TELECOMUNICACIONES (SUTEL).
Background:
In accordance with said regulatory framework, it is exclusively the responsibility of infrastructure owners to enter into shared-use agreements with telecommunications operators and service providers and to ensure orderly, coherent management in compliance with applicable legislation. Consequently, these owners bear an essential responsibility for supervising and controlling the proper use of their facilities, ensuring that usage practices comply with established technical and legal standards.
Furthermore, pursuant to Article 13 of the Reglamento sobre el uso compartido de infraestructura para el soporte de redes públicas de telecomunicaciones, the authority of this Superintendency (Superintendencia) to require telecommunications operators and/or service providers to remove any elements that are in a condition of disuse (ociosidad), that are not being utilized, or whose existence does not respond to duly supported technical planning, is unequivocally established. This regulatory authority is of particular importance in the management and organization of infrastructure, insofar as it seeks to prevent overcrowding, inefficient use, or the continued presence of facilities that lack operational justification. In the view of this Superintendency, said authority has been exercised fully and in accordance with the legal framework in the context of the actions taken to address the complaints described in the preceding sections. Accordingly, the measures adopted reflect the fulfillment of the institutional duty to ensure the rational, safe, and technically appropriate use of infrastructure dedicated to supporting public telecommunications networks.
Finally, regarding the assertion that Sutel has failed in its duty of oversight (fiscalización), control, environmental protection, and protection of the urban landscape (paisaje urbano) — since the appellants (recurrentes) consider that to date there has been neither removal nor comprehensive management of solid waste (residuos sólidos), which affects their quality of life and their right to live in a pollution-free environment — this is not so; this Superintendency has undertaken various measures before the ICE, in accordance with established procedures, in a coherent, reasoned manner and within the applicable legal framework. In addition to this, the proper handling of the complaint filed by the appellants has been demonstrated; indeed, the record contains — and is offered as evidence — the follow-up correspondence with the ICE and that institution's response regarding the steps taken to remove the idle solid waste identified by the appellants; therefore, the appeal (recurso) raised has no basis whatsoever (…)."
of causing an impact on the urban landscape of the city of San Ramón, it also causes an overload that puts residents at risk. On Thursday, September 25 of the current year, I conducted an inspection at each of the points identified by the complainants, with the purpose of evaluating each case individually; that assessment yielded the following results.
Point 1. Location: In front of the Washington Apartment Building. Georeference: 448676 / 1115356. Situation: An electrical system pole belonging to the Instituto Costarricense de Electricidad (ICE) that serves as a support and guide for the electrical and telecommunications networks, and that also serves as a support for the streetlights, which is additionally being used as a support for the cables and equipment of the cable companies providing service in the city. This has led to the formation of a disorganized network of cables within a relatively small space, generating a negative visual impact (impacto visual negativo) for people who live in and visit the city of San Ramón, as observed in the following photographs.
Point 2. Location: In front of the Librería Católica. Georeference: 448563 / 1115657. Situation: An electrical system pole belonging to ICE that serves as a support and guide for the electrical and telecommunications networks, and that also serves as a support for the streetlights, which is additionally being used as a support for the cables and equipment of the cable companies providing service in the city. This has led to the formation of a disorganized network of cables within a relatively small space, generating a negative visual impact for people who live in and visit the city of San Ramón, as observed in the following photographs.
Point 3. Location: Carniceria Feria Centro de Carnes. Georeference: 448623 / 1115648. Situation: An electrical system pole belonging to ICE that serves as a support and guide for the electrical and telecommunications networks, and that also serves as a support for the streetlights, which is additionally being used as a support for the cables and equipment of the cable companies providing service in the city. This has led to the formation of a disorganized network of cables within a relatively small space, generating a negative visual impact for people who live in and visit the city of San Ramón, as observed in the following photographs.
CONCLUSIONS AND RECOMMENDATIONS. Based on the information provided in the complaint filed by [Nombre 006], [Nombre 001], [Nombre 004], and [Nombre 005], and on the observations made during the field visit, this municipal department concludes that:
1. The complainants are correct in pointing out that, at the locations identified in their complaint, a serious problem of visual pollution (contaminación visual) exists, which manifests in the disorganized accumulation of cables and equipment of all kinds hanging from the utility poles, generating a negative visual impact in the urban spaces referenced above.
2. That although the role of the Autoridad Reguladora de los Servicios Públicos (ARESEP), ICE, and the municipalities themselves is to: ● Grant and oversee permits ● Control infrastructure ● Manage public space ● Develop cantonal regulations for telecommunications.
In light of the foregoing, this municipal department recommends the formation of an institutional commission tasked with establishing actions and regulations regarding the subject matter addressed in this report. Furthermore, we recommend facilitating outreach to ARESEP and ICE itself for a comprehensive response to this problem, which is not limited to the points identified by the complainants, but affects the entire city." (underlining is ours) Third: Given that this complaint is not specifically related to the direct actions of this Municipality, and given that various recommendations were provided in Official Communication MSR-AM-GM-DDU-SMA-194-2025, prepared by Licenciado [Nombre 009], Coordinator of the Natural Resources Area, this Municipal Mayor's Office commits to appointing an Institutional Commission responsible for reaching out to ARESEP, the Superintendencia de Telecomunicaciones (Sutel), ICE, and the Ministerio de Ciencia, Innovación, Tecnología y Telecomunicaciones (MICITT), in order to refer this complaint to those institutions. Likewise, this Commission will be responsible for regulating and establishing the corresponding actions to analyze and create the regulations necessary to govern and oversee the permits for cable installation on the electrical grid infrastructure (tendido eléctrico), in the event that existing permits need to be updated.
Fourth: Regarding the Requests set forth in the Complaint, the following is stated with respect to each:
1. That the Municipality conduct an inspection at the reported site in order to verify the state of disorder and accumulation of overhead cabling (cableado aéreo) and other unusable materials on the public right-of-way (vía pública), and that we be formally notified of the results of said inspection. With respect to this request, it is hereby informed that, through Official Communication MSR-AM-GM-DDU-SMA-194-2025, the inspection requested in the complaint was carried out, through which Licenciado [Nombre 009], Coordinator of the Natural Resources Area, effectively determined that there is indeed a disorganized accumulation of cables and equipment of all kinds hanging from the utility poles, generating a negative visual impact in the urban spaces.
2. That we be expressly informed of what corrective actions will be adopted to resolve the reported problem, indicating specific deadlines for implementation and the institutions or companies responsible for carrying them out. Additionally, we request that a clear schedule of activities be provided, with defined dates and responsible parties, to guarantee the effective and timely execution of the corrective actions needed to solve the reported problem. This Mayor's Office will proceed to appoint a Commission that will be responsible for referring these complaints to the institutions in charge of the telecommunications infrastructure of the Canton of San Ramón; however, we cannot commit to providing specific dates for the resolution of the reported problem, given that, as stated in this Official Communication, matters related to cabling on telecommunications towers are not within our jurisdiction. Nevertheless, we commit to referring this complaint so that the appropriate public institution may address the issues detailed herein, and to providing the corresponding follow-up.
3. That the Municipality, in its capacity as the local authority and as the hierarchical superior of the Mayor's Office, take the appropriate steps with ICE and Sutel in coordination with the electric utility service providers, cable companies, and telecommunications companies, so that these institutions adopt immediate measures for the removal and organization of disused or deteriorated cabling that generates urban visual pollution, thereby ensuring respect for urban aesthetics (ornato), public safety, and the collective right to the landscape. In Costa Rica, in the year 2023, Law No. 10.216, the Law to Incentivize and Promote the Construction of Telecommunications Infrastructure in Costa Rica, was enacted, and its article 4 states the following: "ARTICLE 4 — Municipalities. The Executive Branch, through the telecommunications sector regulator, shall establish, by regulation and with the corresponding technical criteria, the technical provisions related to the deployment of telecommunications infrastructure, which must be complied with by all municipalities in the country." The regulatory authority for telecommunications in the country is MICITT, which, through Executive Decree No. 44335, prepared the Regulations to the Law to Incentivize and Promote the Construction of Telecommunications Infrastructure in Costa Rica, governing the procedures and technical specifications for telecommunications infrastructure.
With the intention of complying with the provisions of article 4 referenced above, the Municipality of San Ramón, through Agreement No. [blank] of Ordinary Session No. 15 of July 12, 2024, adopted in its entirety Executive Decree No. 44335-MICITT, which in its article 14 regulates the following with respect to this request: "ARTICLE 8. Shared Use of Infrastructure. The competent institutions that design and build infrastructure susceptible to being used for the deployment of public telecommunications networks must facilitate the shared use of such infrastructure, provided that the continuity and safety of the services provided by the institution are not compromised. Under no circumstances may a preferential or exclusive right to shared use of the infrastructure be established in favor of a particular telecommunications operator or a specific telecommunications network. The shared use of such infrastructure must be facilitated under conditions of equality, transparency, and non-discrimination." As can be seen in this article, it is established that public telecommunications networks must be shared, for which an agreement shall be executed and a usage fee (canon) shall be charged for the enjoyment ...of this service, this regulation also specifies, no exclusive right to shared use of the infrastructure may be established.
Law No. 449, the Law Creating the Instituto Costarricense de Electricidad (ICE), specifically in Article 2, subsection h), establishes within the competencies of this Public Institution the administration of telecommunications networks, as set out below: Article 2. The purposes of the Institute, toward the achievement of which all its efforts and work programs shall be directed, shall be as follows: (...) h) To seek the establishment, improvement, extension, and operation of telecommunications networks in a sustainable manner, as well as to provide and commercialize telecommunications, infocommunications, and information products and services, along with others in convergence. The concessions that ICE and its subsidiaries require to fulfill these purposes shall be subject to the terms, duties, obligations, and other conditions established by applicable legislation. As can be seen in this subsection, it is established that ICE holds the competence to regulate the operation of telecommunications, the concessions currently granted in its favor and in use for the corresponding legal term, and to define new ones; furthermore, it holds the authority to establish a fee (canon) as remuneration for this granted service.
4. That we be provided with documentary justification of the existence or non-existence of permits and authorizations granted to service-provider companies for the maintenance of cabling at the reported site, including agreements or permits issued by the Municipality, the Ministry of Health, SUTEL, or any other competent authority. As indicated in the preceding claim (pretensión), this Municipality is not responsible for granting cabling installation authorizations to telecommunications service-provider companies; rather, Law No. 449, the Law Creating the Instituto Costarricense de Electricidad (ICE), establishes ICE as responsible for granting the corresponding permits, as well as agreements with Public and Private Institutions. Our competence is limited to granting the relevant construction permits for the installation of new structures. For this reason, we are unable to provide the requested documents.
5. That, in the event that regulatory non-compliance is established, the Mayor's Office (Alcaldía) issue a formal opinion on the visual pollution (contaminación visual) that these facts produce in the urban space, and that, in the exercise of its powers, it file joint complaints before ICE and SUTEL on behalf of the collective interests of the residents, and that the corresponding administrative sanctioning proceedings be initiated against the companies responsible for the abandonment and accumulation of cabling on public roads. With regard to this claim, the Inter-institutional Commission (Comisión Interinstitucional) that is intended to be created will be responsible for elevating and referring these complaints to the relevant Institutions.
6. That, in the event that the Municipality fails to carry out these actions or promote the corresponding complaints, we request that it expressly explain the reasons for its inaction, given that the municipal administration is called upon to ensure the protection of those it administers against the environmental and landscape damage resulting from visual pollution. Regarding this claim, this Mayor's Office notes that it is taking every possible measure to fulfill its responsibilities in connection with what is set forth in this complaint.
7. That the collective right to landscape and to a healthy and balanced environment be recognized, and that we be guaranteed that the measures adopted are not merely palliative, but represent structural and permanent solutions. With regard to this claim, it is hereby informed that through Official Letter (oficio) MSR-AM-GM-DDU-SMA-194-2025, the Environmental Management Office recognized the importance of maintaining a healthy and ecologically balanced environment, which is also regulated under Article 50 of the Constitución Política. It is important to advise the complainants that, in order to expedite the process, they have the option of filing the complaint directly with the respective Public Institutions, so that the timelines for action and response are not delayed — since the transfer of a complaint from one Office to another normally takes time. Official Letter MSR-AM-1117-2025 was notified to the email address indicated for this purpose in the complaint submitted via the email [email protected].
The Honorable Justices of this Constitutional Chamber (Sala Constitucional) are hereby informed that the requests related to municipal conduct submitted by the Petitioners, as well as the matters addressed in those requests, do not fall within the direct jurisdiction of this Municipality, given that the matter presented here falls under the competence of the Instituto Costarricense de Electricidad in accordance with the provisions of its Law Creating the Instituto Costarricense de Electricidad (ICE). The argument raised by the Petitioners claiming that this Administration has not responded to them is not acceptable, and it is important to note that our response indicated that the transfer process usually takes time; for this reason, through Official Letter MSR-AM-1117-2025, the Petitioners were advised to go directly to the offices of ICE to file the complaint. … As can be seen in this subsection, it is established that ICE holds the competence to regulate the operation of telecommunications, the concessions currently granted in its favor and in use for the corresponding legal term, and to define new ones; furthermore, it holds the authority to establish a fee as remuneration for this granted service, thereby demonstrating that before this type of complaint the Municipality holds no competence or authority to act (…)".

Considering:
I.Preliminary Matter. Prior to analyzing the merits of the allegation — regarding the alleged violation of the right to a prompt and effective procedure — it must be clarified that, as of judgment (sentencia) No. 2008-02545 of 8:55 a.m. on February 22, 2008, this Chamber has referred — with certain exceptions — to the administrative courts (jurisdicción contencioso administrativa) those matters in which it is debated whether the public administration has or has not complied with the deadlines set by the General Law of Public Administration (Ley General de la Administración Pública) (Articles 261 and 325) or by sector-specific laws for special administrative procedures, in order to resolve by final administrative act (acto final) an administrative proceeding — initiated ex officio or at the request of a party — or to hear the applicable administrative appeals. Precisely in the sub lite, an exceptional scenario is presented, since this involves a complaint filed by the petitioners in which they allege that the respondent authorities have failed to process an alleged environmental harm caused by visual pollution of the urban landscape and safety risks posed by the quantity of cabling placed on electrical poles.
II.Subject of the Writ. The petitioners allege that on September 9 and 17, 2025, they filed a complaint before the Municipality of San Ramón, the branch of the Instituto Costarricense de Electricidad in that locality, and SUTEL, due to the visual pollution generated by the excess and abandonment of aerial cabling (cableado aéreo) installed on electrical poles (postes eléctricos), and that to date the problem has not been resolved.
III.Proven Facts. Of importance to the resolution of this matter, the following facts are deemed duly established, either because they have been so certified or because the respondent has failed to address them as directed in the initial order (auto inicial):
Regarding the Instituto Costarricense de Electricidad:
These practices must be applied in all areas served by ICE, in order to ensure proper organization and adequate management of telecommunications networks. 3. Notify SUTEL, at the email address [email protected], of the actions taken for the purpose of controlling and organizing the telecommunications networks installed on the passive infrastructure supporting telecommunications networks (poles) (…)" (see evidence submitted to the record).
Regarding the Superintendencia de Telecomunicaciones:
Coordinate with network owners the necessary corrective actions to remedy the detected incidents and prevent recurrence of improper installation practices. 3. Submit to this Superintendency a detailed report containing: a) Results of the verifications carried out. b) List of acts or omissions detected and their precise location. c) Corrective measures agreed upon and the timeline for implementation. d) Documentary and photographic evidence supporting the actions taken. 4. Address the claim filed by the complainant, informing this Superintendency of the steps taken toward its resolution. (…)" (see evidence submitted to the case file).
Non-compliance with the violations indicated in the complaint was verified on-site, and the corresponding notifications to the Operators were issued. b) List of acts or omissions detected and their precise location. The identified violations are summarized as follows: — Failure to relocate networks. — Removal of disused elements and networks. The geolocated position of each of the violations is detailed in the photographs submitted in item no. 1 of this communication. c) Corrective measures agreed upon and timeline for implementation. In the notifications sent to each of the Operators present in the area covered by the complaint, in accordance with current regulations, a two-month implementation period was established from the date of receipt of the notification, and accordingly the Shared Infrastructure Use Division of the Telecommunications Management will carry out the corresponding follow-up aimed at ensuring compliance with the conditions established in the corresponding service contract (…)" (see evidence submitted to the case file).
Regarding the Municipalidad de San Ramón:
V.The Constitución Política, in its article 50, enshrines every person's right to a healthy and ecologically balanced environment. Constitutional jurisprudence has consistently held that the concept of "environment" is not limited to pristine nature but also encompasses the urban landscape (paisaje urbano). Visual contamination (contaminación visual) has been doctrinally defined as the change or disruption of the landscape that affects the living conditions and vital functions of living beings.
In the case at hand, the petitioners allege that they reported to the Municipalidad de San Ramón, ICE, and SUTEL the quantity of cabling placed on the electrical poles located at the following points: 1- Avenida 0, 24 meters east of the Club de Amigos, in front of the Departamentos Washington; 2- Avenida 05, 200 meters north and 25 east of the front of the Parroquia de San Ramón, alongside the Librería Católica de San Ramón, in front of Boutique Mova; and 3- Avenida 5, 25 meters from ASEMBIS, in front of PRO PLAN Concentrados, alongside D´Feria Centro de Carnes—on the grounds that the cables are disorganized, crossed, poorly tied, and exposed, generating visual contamination of the urban landscape and risks to public safety.
On this matter, it is pertinent to note that this Court, by judgment no. 2026008044, issued at 9:25 a.m. on March 6, 2026, examined and decided a matter substantially similar to the present case, relating to four other points in the canton of San Ramón, on which occasion the constitutional amparo petition (recurso de amparo) was declared partially granted against the respondent authorities, based on the considerations transcribed below:
"(…) VI.- On the Responsibility of Local Governments. Article 169 of the Constitución Política establishes the duty of the country's municipalities to protect the interests of the inhabitants of their jurisdiction. On that basis, this Court has repeatedly held that such bodies are obligated to eliminate any type of threat that endangers the rights to health and to a healthy and ecologically balanced environment of persons living in their canton (see Sentencia N° 2008-11739, issued at 12:12 p.m. on July 25, 2008, reiterated in N° 2020-014753, issued at 9:15 a.m. on August 7, 2020).
Although technical regulation of the telecommunications sector falls within the purview of specialized bodies of the Executive Branch and sectoral regulatory agencies, the fact remains that municipalities, pursuant to articles 169 and 170 of the Constitución Política and the municipal autonomy framework, hold competence in matters of territorial planning (ordenamiento territorial), management of public space (espacio público), and protection of local interests. Furthermore, pursuant to the Código Municipal, municipalities are responsible for urban planning and protection of the environmental surroundings within their jurisdiction.
In the present case, the Mayor acknowledges that, on September 18, 2025, the petitioners filed a complaint regarding the situation at issue here, and that, following the inspection conducted, it was found that there exists a "serious problem of visual contamination" and a "disorganized accumulation of cables and equipment" that negatively impacts the urban space, for which reason the creation of an institutional commission and outreach to ARESEP and ICE to address the situation comprehensively were recommended. Accordingly, on October 31, 2025, the Mayor's Office sent the complainants the response to each of the concerns raised in their complaint and explained to them that the Municipality is not the body responsible for granting authorizations for the installation of cabling by telecommunications service providers, but rather that this responsibility lies with ICE, which is responsible for issuing the corresponding permits as well as the agreements with public and private institutions, and therefore urged them to file the complaint with the competent public institutions.
Although, within a reasonable time and prior to the filing of the present petition, the Mayor resolved the complaint submitted and notified the claimants of the outcome—thereby not infringing upon the right to prompt and effective justice—the fact remains that the mere creation of a commission or acknowledgment of the problem is insufficient if it does not translate into concrete material actions of oversight and regulation that put an end to the violation of public space.
Municipal autonomy (autonomía municipal) is not limited to formal taxation or administrative powers, but entails a correlative duty of effective stewardship of the cantonal environment. In that regard, even though the respondent Municipality is not the competent body to directly order telecommunications operators to remove or reorganize the cabling, it does have the obligation to:
Accordingly, absolute inaction or failure to engage in interinstitutional management in the face of a well-known and prolonged situation of structural disorder in the cabling constitutes an indirect violation of the right to a healthy environment and of the duty of protection incumbent upon every public authority.
The reported problem demonstrates that the actions taken by the Municipalidad de San Ramón in the exercise of its oversight and supervisory powers in protection of health and the environment, within the framework of its competences, have been clearly insufficient, thereby incurring liability for omission in the exercise of those powers, which in turn infringes upon the constitutional right of citizens to receive efficient and effective public services.
In light of the foregoing, the respondent Municipality is responsible for the harm to the fundamental rights of the protected persons, by virtue of its failure to promptly and effectively safeguard public health and the environment.
Consequently, with respect to the Municipalidad de San Ramón, the petition is granted, and it is warned that, going forward, it must actively exercise its competences in matters of urban landscape protection, public safety, and public space management, under notice of liability for omission. Therefore, the appropriate measure is to order it to bring into effective operation the institutional commission mentioned in official communication MSR-AM-GM-DDU-SMA-197-2025, and to define a permanent work schedule to prevent the problem of infrastructure saturation from recurring in other sectors of the canton through coordinated work with ICE.
VII.On the Supervisory Duty of SUTEL and ICE. As the governing bodies and administrators of passive infrastructure (infraestructura pasiva), including poles and networks, SUTEL and ICE are obligated to ensure that private operators comply with the applicable technical installation standards.
Articles 77 of the Ley de la Autoridad Reguladora de los Servicios Públicos and 77 of the Reglamento de la Ley General de Telecomunicaciones provide that SUTEL is responsible for guaranteeing the right to joint or shared use of infrastructure, ducts, conduits, poles, towers, stations, and other facilities required for the installation and operation of public telecommunications networks, as well as for the provision of services available to the public and the co-location of equipment.
For its part, ICE, in this case as the owner of the infrastructure supporting public telecommunications networks, is obligated to grant rights of way, shared use, and co-location of equipment, to apply the applicable regulations and the guidelines issued by the Superintendencia de Telecomunicaciones. It is likewise ICE's duty to guarantee and provide the necessary maintenance of its scarce resource in order to ensure proper operation and the continuity of shared use (article 08 of the Reglamento sobre el uso compartido de infraestructura para redes públicas de telecomunicaciones, GCO-NRE-REG-00469-2016).
Specifically, the Reglamento sobre el uso compartido de infraestructura para el soporte de redes públicas de telecomunicaciones, in article 13, also provides that:
"Article 13. On the efficient use of network elements in the telecommunications infrastructure by infrastructure owners.
When owners of infrastructure supporting public telecommunications networks become aware of the underutilization or inefficient use of network elements in the space assigned to a telecommunications operator and/or service provider, they must notify such parties so that the removal and dismantling of those network elements may be carried out, unless a valid justification exists for retaining them in the infrastructure. For this purpose, a maximum period of 2 months shall be granted.
SUTEL, acting on its own initiative or at the request of a party, shall have the authority to require the telecommunications operator and/or provider to remove those idle or unused elements, or those that do not have a duly planned use." Accordingly, as set out above, once an intervention request is received, or acting on its own initiative, SUTEL is competent to require telecommunications operators and/or service providers to remove elements that are idle, not being used, or whose existence is not supported by duly substantiated technical planning. This regulatory power is of particular relevance in the management and organization of infrastructure, as it serves to prevent saturation, inefficient use, or the continued presence of facilities lacking operational justification.
In the case under review, it was established that on September 17, 2025, the petitioner filed a complaint with the Superintendencia de Telecomunicaciones (SUTEL) regarding the chaotic accumulation of cabling and visual contamination in the city center (casco central) of San Ramón, and that within a reasonable time, the complaint was transferred to ICE and it was asked to coordinate with the owners of the telecommunications networks making use of the passive infrastructure (poles) to adopt the necessary verification and corrective measures and to report on the actions taken.
In light of the foregoing, once SUTEL became aware of the actions taken by ICE and the operators and/or providers offering telecommunications services, on October 17, 2025, it proceeded to inform the complainants of the measures taken. Accordingly, the right to prompt and effective justice (justicia pronta y cumplida) was not violated in this regard, since the matter was resolved within a reasonable time and before the filing of the present appeal. Therefore, as to this issue, the appeal is denied.
On the other hand, it is not found that SUTEL has violated the right to health and a healthy environment of the protected parties, since, as a sector regulatory body (ente regulador sectorial), its function is to regulate the legal, technical, and economic conditions under which such infrastructure may be shared by operators and/or providers of publicly available telecommunications services. Note that it was from the complaint filed by the appellants that SUTEL became aware of the problem, and in order to provide a solution, it requested that ICE, as the owner of the utility poles in that locality, coordinate with the owners of telecommunications networks making use of the passive infrastructure (infraestructura pasiva) to adopt the necessary verification and corrective measures; it also requested that ICE implement monitoring and audit practices to ensure the orderly and proper management of the telecommunications networks.
To that end, SUTEL required ICE to report on the actions taken, and on October 6, 2025, ICE communicated that, as of that date, the removal of disused networks (redes en desuso) had already been carried out at 50%, and that operators had been granted a two-month period to complete the corrective measures. Ultimately, constitutional review cannot become a mechanism for automatically attributing liability in every dysfunctional situation when no arbitrary inaction or deliberate neglect on the part of the regulatory body has been established. Accordingly, SUTEL issued the necessary acts to provide a solution to the problem raised by the appellants.
It is noted that, without prejudice to criminal or civil liability, it shall be SUTEL's responsibility to intervene if the parties fail to reach an agreement on the shared use of the scarce resource or a conflict arises, and to proceed to sanction the administrative violations committed by operators or providers, as well as by those who operate telecommunications networks or provide telecommunications services in an unlawful manner. (Article 65 of the Ley General de Telecomunicaciones, Nº 8642, and Article 55 of the Reglamento sobre el uso compartido de infraestructura para redes públicas de telecomunicaciones) Without prejudice to the foregoing, this Court finds it appropriate to remind SUTEL of its ongoing duty to oversee and supervise compliance with technical obligations by operators, particularly when these affect the urban environment and may have environmental repercussions.
As a corollary of the foregoing, it has not been established, in the specific case at hand, that the Telecommunications Superintendency (Superintendencia de Telecomunicaciones) engaged in any arbitrary or unlawful action or omission that would violate the fundamental right to a healthy environment, and accordingly the appeal against this administrative body must be denied.
Take note. Although the present writ of amparo (recurso de amparo) must be denied as to SUTEL, SUTEL must follow up on the administrative proceedings initiated in connection with this amparo, within the framework of its legal competencies, in order to verify the operators' compliance with technical obligations and, where appropriate, adopt the corresponding measures.
VIII.Regarding the Instituto Costarricense de Electricidad (ICE). As to this body, like the previous ones, it received the complaint from the aggrieved parties and proceeded to execute the corresponding administrative acts, finding that there were disused connections (acometidas en desuso); dual networks (coaxial and fiber); duplicate pole infrastructure (doble postería); poorly organized reserve cable rolls (rollos de reserva); and a lack of space optimization on poles. ICE then proceeded to notify the operators — Liberty, Telecable, Tigo, Claro, and Ufinet — to carry out the relocation works for the disused networks, which was reiterated on several occasions, and granted each operator a two-month period to ensure compliance with the conditions stipulated in the corresponding service contracts, a deadline that expired on December 13, 2025, that is, after the date on which the present appeal was filed. It is noted that, by November 2025, some of the operators had already carried out the ordered actions, and that during the week of December 15 to 19, 2025, an inspection was scheduled by the staff of the Shared Infrastructure Use (Área de Uso Compartido de Infraestructura) division to verify the current condition of the reported pole infrastructure; however, the Court is unaware of the outcome of that inspection.
Even though the telecommunications operators own the installed cabling, the fact remains that ICE, in its capacity as the owner and administrator of the pole infrastructure, holds the legal position of guarantor with respect to the proper and safe use of that infrastructure. In that capacity, ICE cannot disregard the deterioration of public space resulting from the negligent use of the poles under its administration, as doing so would mean tolerating practices contrary to urban planning (ordenamiento urbano) regulations and technical standards on electrical safety and telecommunications.
In the sub lite, an administrative omission is found in the exercise of the police powers (potestades de policía), control, and supervisory authority that ICE holds over its own infrastructure, which has caused harm to the fundamental right to a healthy and balanced environment, as well as a real threat to the health and physical integrity of the appellants and the community at large.
The disorderly accumulation of cabling, the so-called "marañamiento" (tangling) of lines, and the continued presence of disused cable runs constitute a form of visual pollution (contaminación visual) that degrades the urban landscape (paisaje urbano) and undermines the inhabitants' right to a safe and aesthetically harmonious environment.
In this regard, the passivity of the respondent body does not constitute a mere aesthetic deficiency, but rather an omission of constitutional significance, insofar as it jeopardizes the health and physical safety of persons as well as the proper management of the public domain (dominio público). Inaction in the face of the operators' technical non-compliance makes the pole infrastructure administrator a co-responsible party for the harm caused to health and the environment, since the administration of public infrastructure cannot be carried out in disregard of the principles of legality, effectiveness, and protection of the general interest.
It is thus evident that the lack of effective oversight has produced a violation of the right to a healthy environment and a latent threat to the health and physical integrity of persons, in view of the risk of cable falls or electrical accidents. Consequently, ICE's omission in exercising its supervisory competencies violates the constitutional mandates of administrative efficiency and environmental protection.
Furthermore, there is no record that, as of the date the present appeal was filed, the authorities of the relevant branch office had communicated to the appellants the specific outcome of the proceedings undertaken, which also constitutes a violation of the right to prompt and effective justice. This right is not satisfied by the mere issuance of specific acts; rather, it requires a substantive and effective response that genuinely and timely addresses the problem raised.
In the specific case at hand, administrative ineffectiveness (inoperancia administrativa) is evident, since, despite approximately two months having passed since the complaints were filed and despite the authorities' express acknowledgment of the poor condition of the cabling, the urban landscape of San Ramón had not undergone substantial changes as of the date the present appeal was filed, leaving the aggrieved parties in a situation of risk and uncertainty. The persistence of the problem reveals that oversight has been lacking or ineffective. Public institutions cannot limit their actions to mere transfers of correspondence; they are obligated to ensure the effective removal of disused cabling or cabling installed in violation of the applicable technical regulations.
IX.Conclusion. It is evident that both the Municipalidad de San Ramón and the ICE branch in the canton of San Ramón have failed in their duty of inter-institutional coordination to resolve a fully identified problem of visual pollution. The failure to act and the persistence of technical disorder at the four reported locations justify the intervention of this Court to order the restoration of visual order and safety in the historic center (casco central) of San Ramón (…)
Por tanto:
The petition is granted. [Nombre 008] and [Nombre 009], in their respective capacities as Mayor and Head of the Municipal Environmental Services Unit, both of the Municipalidad de San Ramón, or whoever may hold those positions, are hereby ordered to, within FIFTEEN BUSINESS DAYS from notification of this judgment, bring into effective operation the institutional commission referred to in memorandum MSR-AM-GM-DDU-SMA-197-2025, and to define a permanent work schedule to prevent the problem of cable saturation on the infrastructure from recurring in other sectors of the canton (cantón). They shall also coordinate with the INSTITUTO COSTARRICENSE DE ELECTRICIDAD, jointly and effectively, within their respective spheres of competence, so that within ONE MONTH, counted from the date of notification of this ruling, the process of cleaning, organizing, and removing all telecommunications cabling that is disused, irregularly installed, or generating a chaotic accumulation at the four specific points reported by the petitioners is completed.
Furthermore, Alex Rodríguez Cambronero, in his capacity as Coordinator of the Agencia Integrada de San Ramón of the Instituto Costarricense de Electricidad, or whoever may hold that position, is ordered to take the necessary administrative and technical actions so that: a) Within SIX MONTHS, counted from the date of notification of this judgment, he coordinates with the telecommunications operators the organization and complete removal of all disused cabling in the affected area; b) He executes, together with the telecommunications operators, a plan for organizing and tensioning the remaining cables to eliminate the negative visual impact and ensure safety; c) He establishes a permanent oversight protocol to prevent the situation of visual chaos from recurring in the future; and d) He resolves and notifies the resolution of the complaint filed by the petitioning party on September 17, 2025.
The foregoing is issued with the warning that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, a prison term of three months to two years, or a fine of twenty to sixty days, shall be imposed on any person who receives an order that they must comply with or cause to be complied with, issued in a writ of amparo (recurso de amparo), and who fails to comply with it or to cause compliance therewith, provided the offense is not more severely penalized under another provision. The Municipalidad de San Ramón and the Instituto Costarricense de Electricidad are condemned to pay the costs, damages, and losses caused by the facts underlying this declaration, which shall be assessed in enforcement proceedings before the administrative-law courts. As regards the Superintendencia de Telecomunicaciones, the petition is denied, although it must take note of what is stated in the final paragraph of Considerando VII of this judgment.
Justice Castillo Víquez appends a separate note. Justice Salazar Alvarado partially dissents and votes to deny the petition with respect to the alleged violation of the right to a healthy and ecologically balanced environment, on the grounds that this aspect of the petition should be resolved through ordinary legality review (…)".
Regarding the foregoing, it is clarified that in this writ of amparo the petitioners report excessive cabling on poles located at: "a) Avenida 0, 24 meters east of the Club de Amigos, in front of the Departamentos Washington, b) Avenida 05, 200 meters north and 25 east of the front of the Parroquia de San Ramón, beside the Librería Católica de San Ramón, in front of the Boutique Mova, and c) Avenida 5, 25 meters from ASEMBIS, in front of PRO PLAN Concentrados, beside D´Feria Centro de Carnes." Likewise, the cited precedent also questions the cabling installed on electrical poles located at: "four points in the city, on the Avenida Segunda de San Ramón, over sidewalks and in front of various commercial establishments (Pizza Grace, Librería Eureka, The Corner Pub, and Sala de Juegos Mora)." Furthermore, as in the cited precedent, the Municipalidad de San Ramón refers to memorandum MSR-AM GM-DDU-SMA-197-2025, dated October 1, 2025, which establishes that an inspection was carried out at the indicated location and that the memorandum was issued with conclusions and recommendations (recommending the formation of the institutional commission).
Additionally, in the present matter, the petitioners allege the failure to respond to several complaints on this issue filed before the Municipalidad de San Ramón, the Superintendencia de Telecomunicaciones, and the Instituto Costarricense de Electricidad.
That is to say, it is considered proven that these are complaints regarding visual pollution (contaminación visual) in common areas of said canton, and accordingly this Court relies on that precedent to resolve this new writ of amparo.
VI.From a comprehensive review of the case file, the sworn reports submitted—with the consequences set forth in Article 44 of the Ley de la Jurisdicción Constitucional—and the body of evidence incorporated into the record, this Court finds it established that the petitioners reported, on September 9, 17, and 18, 2025, a persistent situation of visual pollution, structural disorder, and accumulation of disused electrical and telecommunications cabling, particularly in various urban sectors of the canton of San Ramón de Alajuela, which was generating a negative impact on the urban landscape and posing risks to public safety.
As follows from the established facts, said complaints were filed before the Instituto Costarricense de Electricidad (ICE), the Municipalidad de San Ramón, and the Superintendencia de Telecomunicaciones (SUTEL), each of which carried out actions within its respective sphere of competence. Nevertheless, the constitutional analysis requires determining whether such actions were timely, sufficient, and effective to guarantee the fundamental rights invoked.
With respect to the Instituto Costarricense de Electricidad, it is established that, in its capacity as owner and administrator of the passive infrastructure (infraestructura pasiva) — specifically, the pole network (postería) — it received the respective complaints and, following their referral by SUTEL as well, carried out various administrative procedures, including field inspections, notifications, and warnings issued to the telecommunications operators using said infrastructure — Liberty, Telecable, Tigo, Claro, Ufinet, and Kölbi — granting them deadlines for network relocation, removal of disused lines, and correction of multiple detected irregularities, among them idle service connections (acometidas ociosas), duplicate networks (doble red), duplicate pole runs (doble postería), improperly arranged spare cable coils (rollos de reserva), and unfinished work.
However, it was also demonstrated that, as of the date of filing of the present petition, relevant irregularities persisted in the reported areas, and the complete removal of disused cabling and the comprehensive correction of the problem had not been established, despite the existence of such anomalies having been expressly acknowledged. Likewise, there is no evidence that ICE had clearly and promptly communicated to the petitioners the specific outcome of the actions taken, which negatively affected their right to prompt and effective justice.
As this Court has consistently held, even when the operating companies are the owners of the installed networks, ICE, as administrator of the pole network, holds a legal position as guarantor with respect to the adequate, safe, and orderly use of said infrastructure. Consequently, it cannot distance itself from the negative effects that the negligent use of the poles generates on the public space, since this compromises the constitutional right to a healthy and balanced environment, as well as the health and physical integrity of persons. The omission or ineffective oversight in the exercise of its supervisory and control powers therefore constitutes an infringement of constitutional significance.
As for the Municipalidad de San Ramón, it is established that it received the complaint for visual pollution and that, through a technical inspection, it expressly acknowledged the veracity of the reported facts, concluding that there was a serious problem of visual pollution stemming from the disorder of cables and equipment on the urban pole network. Nevertheless, it is also noted that an excessive period elapsed — exceeding two months — without a formal response being provided to the complainants, which was only issued in connection with the processing of the present writ of amparo.
Additionally, although the municipality expressed its intention to form an institutional commission and to coordinate with other competent entities, there is no evidence that such measures were effectively implemented or translated into concrete and verifiable actions of oversight, organization, or mitigation of the reported problem. As this Court has held, municipal autonomy entails not only formal powers but also an active duty to protect the urban environment and the cantonal public space. Accordingly, even though it is not the municipality's responsibility to directly order the operators to remove the cabling, it is obligated to oversee, engage in interinstitutional coordination, and adopt reasonable measures to prevent environmental and urban risks. Inaction or purely declaratory management is insufficient and constitutes an omission that infringes upon fundamental rights.
Finally, with regard to the Superintendencia de Telecomunicaciones (SUTEL), it was established that this entity received multiple complaints of a similar nature and, within a reasonable period, proceeded to refer them to ICE as the owner of the passive infrastructure, issued clear directives for verifying and correcting the identified irregularities, and required detailed reports on the actions taken. Likewise, prior to the filing of the present petition, SUTEL communicated to the complainants the procedures carried out and the reports submitted by ICE, and no omissive, arbitrary, or unlawful conduct on the part of the regulatory body is evident.
It must be recalled that SUTEL's function is confined to the regulation, supervision, and oversight of the technical and legal conditions for the shared use of the infrastructure, and it is not responsible for the direct physical execution of cabling removal. Within that framework, this Court finds that SUTEL acted within its sphere of competence and did not infringe the fundamental rights of the petitioners, without prejudice to its ongoing duty of continuous supervision and its potential sanctioning authority in the event of future non-compliance (see, in a similar vein, judgment no. 2026014326 of 9:20 a.m. on April 24, 2026).
VII.Conclusion. In light of the foregoing, the appropriate course of action is to partially grant the petition solely against the Instituto Costarricense de Electricidad and the Municipalidad de San Ramón for the reasons stated. As regards the Superintendencia de Telecomunicaciones, the petition is denied. Nevertheless, as indicated in the cited precedent, said authority is reminded that it must follow up on the administrative procedures initiated in connection with this writ of amparo, within the framework of its legal competences, in order to verify compliance with the technical obligations of the operating companies and to adopt, as appropriate, the corresponding measures.
VIII.Note by Justice Castillo Víquez, regarding prompt and effective administrative justice (justicia administrativa pronta y cumplida). I have supported the position of this Court that when a litigant (justiciable) alleges a violation of the right to prompt and effective justice in an administrative venue (sede administrativa), it is the Contentious-Administrative Courts (Tribunales de lo Contencioso-Administrativo) — and not this Chamber — that have jurisdiction over the legal dispute. However, with the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, it has been established that this right is subject to judicial protection by means of the writ of amparo (recurso de amparo) provided for in artículo 32 of the Ley de la Jurisdicción Constitucional, read together with artículo 27 of the Constitución Política de la República de Costa Rica, in cases where the petitioner considers that the Administration's material actions, its administrative acts, or its response are affecting their fundamental rights (derechos fundamentales).
In my view, the recently enacted legislation does not require this Court to modify its jurisprudential line; this Court, pursuant to numeral 7 of its governing Law, has the exclusive authority to define its own jurisdiction. Therefore, except for those constitutional-legal disputes that this same Chamber has recognized as exceptional cases — which may properly be heard in this jurisdiction through the constitutional amparo guarantee proceeding — in all other cases, and for the reasons set forth by this Court (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), jurisdiction lies with the judges of the contentious-administrative jurisdiction, all of which is consistent with numeral 25 of the Convención Americana sobre Derechos Humanos, the Law of the Constitution (values, principles, and norms), and the corresponding statutory provisions, based on a logical, systemic, and teleological interpretation of the legal system (ordenamiento jurídico).
In environmental matters, it is the undersigned's view that if the Public Administration has already intervened, jurisdiction to hear and resolve the matter belongs to the contentious-administrative jurisdiction. Nevertheless, I do agree to examine the merits of the matter when other rights of persons affected by the source of contamination (foco de contaminación) are at stake, including the right to health, quality of life, and the right to enjoy a healthy environment free from contamination (artículo 50 of the Constitución Política), as is the case here, where the appellant states that they filed a complaint regarding urban landscape pollution (contaminación del paisaje urbano) and safety risks arising from the quantity of cabling (cableado) installed on electrical poles (postes eléctricos), which has not been definitively resolved.
X.Partial dissenting vote (voto salvado) by Justice Garro Vargas regarding the operative part (parte dispositiva) of this judgment. While I agree with the majority of the Chamber that the writ should be declared partially granted, I disagree on the proper venue for the enforcement phase (fase de ejecución) of the matter, given the absence of adequate mechanisms provided by the rules governing this constitutional jurisdiction to monitor compliance with a judgment that involves technical aspects of considerable complexity — as is the case here, which requires that, within the period to be set, counted from notification of this judgment, the Municipalidad de San Ramón and the Instituto Costarricense de Electricidad, through the respondent authorities, provide a definitive solution to the problem of visual pollution (contaminación visual) caused by the excess and disorder of cabling on poles in the reported areas of the urban center (casco urbano) of the canton (cantón).
By contrast, the provisions of the Código Procesal Contencioso-Administrativo on enforcement (artículo 155 and following) offer clear advantages, such as the ability to request compliance schedules, impose fines, establish liability, and oversee compliance stages, among other tools well-suited to supervising structural orders of this nature. For these reasons, pursuant to artículo 56 of the Ley de Jurisdicción Constitucional, I consider that the enforcement phase should be conducted before the Área de Ejecución of the Tribunal Contencioso Administrativo y Civil de Hacienda, under the judgment-enforcement rules of that Code.
XI.Documentation submitted to the case file. The parties are hereby notified that, should they have submitted any paper documents, as well as objects or evidence contained in any additional device of an electronic, computer-based, magnetic, optical, telematic, or new-technology nature, these must be retrieved from the office within a maximum period of 30 días hábiles counted from notification of this judgment. Otherwise, all material not retrieved within this period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena in session N° 27-11 of August 22, 2011, artículo XXVI, and published in Boletín Judicial número 19 of January 26, 2012, as well as pursuant to the agreement approved by the Consejo Superior del Poder Judicial in session N° 43-12 held on May 3, 2012, artículo LXXXI.

The writ is declared partially granted, solely as against the Municipalidad de San Ramón and the Instituto Costarricense de Electricidad. [Nombre 008] is hereby ordered, in her capacity as mayor of the Municipalidad de San Ramón, or whoever holds the position, to put into effective operation the institutional commission referenced in official memorandum MSR-AM-GM-DDU-SMA-197-2025, and to establish a permanent work schedule to prevent the problem of telecommunications cable saturation in the infrastructure from recurring in other sectors of the canton. Furthermore, she shall coordinate with the INSTITUTO COSTARRICENSE DE ELECTRICIDAD, jointly and effectively, within their respective spheres of competence, to complete the process of clearing, organizing, and removing all telecommunications cabling that is out of service, irregularly installed, or that creates a chaotic accumulation at the three specific locations reported by the appellants, all of the foregoing within the deadline set in sentencia no. 2026-008044 de las 09:25 horas del 06 de marzo de 2026.
In turn, Alex Rodríguez Cambronero is hereby ordered, in his capacity as coordinator of the Agencia Integrada de San Ramón of the Instituto Costarricense de Electricidad, or whoever holds the position, to take the necessary administrative and technical steps to: a) coordinate with telecommunications operators (operadoras de telecomunicaciones) the organized and complete removal of all out-of-service cabling in the affected area; b) implement, together with the telecommunications operators, a plan to organize and tension the remaining cables in order to eliminate the negative visual impact and ensure safety; and c) establish a permanent oversight protocol to prevent the situation of visual chaos from recurring in the future. All of the foregoing within the deadline set in sentencia no. 2026-008044 de las 09:25 horas del 06 de marzo de 2026. Furthermore, within a period of one month counted from notification of this judgment, he shall resolve and notify the resolution of the complaint filed by the appellant on 9 de setiembre de 2025.
The foregoing is issued with the warning that, pursuant to artículo 71 of the Ley de la Jurisdicción Constitucional, imprisonment of three months to two years, or a fine of twenty to sixty days, shall be imposed on any person who receives an order — issued in an amparo proceeding — that they are required to comply with or enforce, and who fails to comply with or enforce it, provided the offense is not more severely penalized under other law. The Municipalidad de San Ramón and the Instituto Costarricense de Electricidad are ordered to pay the costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed in contentious-administrative enforcement proceedings. With respect to the Superintendencia de Telecomunicaciones, the writ is denied, although it must take note of what is stated in Considerando VII of this judgment. Revisión del Documento 1 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del treinta de abril de dos mil veintiseis .
Recurso de amparo interpuesto por [Nombre 001], [Valor 001], [Nombre 002], [Valor 002], [Nombre 003], [Valor 003], [Nombre 004], [Valor 004], contra la MUNICIPALIDAD DE SAN RAMÓN, INSTUTO COSTARRICENSE DE ELECTRICIDAD (ICE) Y SUPERINTENDENCIA DE TELECOMUNICACIONES (SUTEL).
Resultando:
de generar una afectación del paisaje urbano de la ciudad de San Ramón, también provoca una saturación, que pone en riesgo a los habitantes. El día jueves 25 de septiembre del presente año, efectúe una inspección a cada uno de los puntos señalados por los denunciantes, con el propósito de evaluar cada caso de forma individual, valoración que arrojó los siguientes resultados. Punto 1. Ubicación: Frente a Departamento Washington Georeferenciación: 448676 / 1115356 Situación: Poste del sistema eléctrico del Instituto Costarricense de Electricidad (ICE) que funciona como sostén y guía de las redes eléctricas y telecomunicaciones y que además sirve de soporte para las luminarias, que también está sirviendo para el soporte para los cables cables y equipos de las empresas cableras que brindan su servicio en la ciudad. Esto ha propiciado la formación de una red desordenada de cables en un espacio relativamente pequeño, que genera un impacto visual negativo para las personas que viven y visitan la ciudad de San Ramón, como se observa en las siguientes fotografías.
Punto 2. Ubicación: Frente a Librería Católica Georeferenciación: 448563 / 1115657 Situación: Poste del sistema eléctrico del Instituto Costarricense de Electricidad (ICE) que funciona como sostén y guía de las redes eléctricas y telecomunicaciones y que además sirve de soporte para las luminarias, que también está sirviendo para el soporte para los cables cables y equipos de las empresas cableras que brindan su servicio en la ciudad. Esto ha propiciado la formación de una red desordenada de cables en un espacio relativamente pequeño, que genera un impacto visual negativo para las personas que viven y visitan la ciudad de San Ramón, como se observa en las siguientes fotografías. Punto 3. Carniceria Feria Centro de Carnes Georeferenciación: 448623 / 1115648 Situación: Poste del sistema eléctrico del Instituto Costarricense de Electricidad (ICE) que funciona como sostén y guía de las redes eléctricas y telecomunicaciones y que además sirve de soporte para las luminarias, que también está sirviendo para el soporte para los cables y equipos de las empresas cableras que brindan su servicio en la ciudad.
Esto ha propiciado la formación de una red desordenada de cables en un espacio relativamente pequeño, que genera un impacto visual negativo para las personas que viven y visitan la ciudad de San Ramón, como se observa en las siguientes fotografías. CONCLUSIONES Y RECOMENDACIONES. Con base a la información a la información aportada en la denuncia interpuesta por los (as) señores (as), [Nombre 006], [Nombre 001], [Nombre 004], [Nombre 005] y las observaciones hechas en la visita de campo, esta dependencia municipal concluye que: 1. Tiene razón los denunciantes, al señalar que en los puntos señalados en su denuncia, se está presentando un grave problema de contaminación visual, que se ve reflejado en la acumulación desordenada de cables y equipos de todo tipo que cuelgan de los postes, generando un impacto visual negativo en los espacios urbanos antes señalados. 2. Que aunque el papel de la Autoridad Reguladora de los Servicios Públicos (ARESEP), el Instituto Costarricense de Electricidad (ICE) y de las mismas Municipalidades es: ● Otorgar y fiscalizar permisos ● Controlar la infraestructura ● Gestionar el espacio público ● Generar una reglamentación cantonal. telecomunicaciones.
En virtud a lo antes señalado, esta dependencia municipal recomiendo la conformación de la comisión institucional, que se encargue de establecer acciones y regulaciones, referente al tema expuesto en este informe. Además, recomendamos propiciar un acercamiento con la ARESEP y el mismo ICE, para la atención integral a esta problemática, que no se limita a los puntos señalados por los denunciantes, sino que afecta a toda la ciudad.” (lo subrayado es nuestro) Tercero: que al no ser una denuncia relacionada específicamente con el actuar directo de esta Municipalidad y al brindándose diferentes recomendaciones en el Oficio MSR-AM-GM- DDU-SMA-194-2025, elaborado por el Licenciado [Nombre 009], Coordinador del Área de Recursos Naturales; esta Alcaldía Municipal se compromete a nombrar una Comisión Institucional que se encargue de realizar un acercamiento con la Autoridad Reguladora de los Servicios Públicos (Aresep), con la Superintendencia de Telecomunicaciones (Sutel), con el Instituto Costarricense de Electricidad (Ice) y con el Ministerio de Ciencia, Innovación, Tecnología y Telecomunicaciones (MICITT), para poder trasladar esta denuncia a estas Instituciones, así mismo, esta Comisión va a ser la encargada de regular y establecer las acciones correspondientes para analizar y crear la normativa necesaria para regular y fiscalizar los permisos de instalación del cableado en el tendido eléctrico, en caso de que los presentes se deban actualizar.
Cuarto: Sobre las Pretensiones de la Denuncia, se procede a manifestar lo siguiente con relación a cada una de ellas: 1. Que se realice una inspección por parte de la Municipalidad en el sitio denunciado, a fin de comprobar el estado de desorden y acumulación de cableado aéreo y demás materiales inservibles en la vía pública, y que de dicha inspección se nos notifique formalmente el resultado. Con respecto a esta pretensión, se le informa que mediante el Oficio MSR-AM-GM-DDU-SMA-194-2025, se realizó la inspección solicitada en la denuncia, mediante la cual efectivamente el Licenciado [Nombre 009], Coordinador del Área de Recursos Naturales, determina que efectivamente se evidencia una acumulación desordenada de cables y equipos de todo tipo que cuelgan de los postes, generando un impacto visual negativo en los espacios urbanos. 2. Que se nos señale expresamente qué acciones correctivas se adoptarán para resolver la problemática denunciada, indicando los plazos concretos de ejecución y las instituciones o empresas responsables de implementarlas.
Adicionalmente, solicitamos que se nos entregue un cronograma claro de actividades, con fechas y responsables definidos, que garantice la ejecución efectiva y en plazos razonables de las acciones correctivas necesarias para solucionar el problema denunciado. Esta Alcaldía va a proceder a nombrar una Comisión que será la encargada de trasladar estas denuncias a las Instituciones encargadas de la infraestructura de telecomunicaciones del Cantón de San Ramón, sin embargo, no nos podemos comprometernos a brindar fechas específicas sobre la solución de la problemática denunciada, motivo de que como se ha indicado en este Oficio, no es competencia nuestra lo relacionado con el cableado en las torres de telecomunicaciones, no obstante, nos comprometemos a trasladar su denuncia para que la Institución Pública correspondiente atienda lo acá detallado y a darle el seguimiento debido. 3. Que la Municipalidad, en su calidad de autoridad local y como superior jerárquico de la Alcaldía, gestione lo pertinente ante el ICE y la SUTEL en coordinación con las empresas prestatarias de servicios públicos eléctricos, compañías cableras y de telecomunicaciones, para que estas instituciones adopten medidas inmediatas para el retiro, ordenamiento del cableado en desuso o en mal estado que genera contaminación visual urbana, garantizando el respeto al ornato, la seguridad y el derecho colectivo al paisaje.
En Costa Rica para el año 2023 se creó la Ley N.º 10.216, Ley para incentivar y promover la construcción de infraestructura de telecomunicaciones en Costa Rica, en la cual en su artículo 4 señala lo siguiente: “ARTÍCULO 4- Municipalidades. El Poder Ejecutivo, a través del rector de Telecomunicaciones, con los criterios técnicos correspondientes, establecerá vía reglamento las disposiciones técnicas relacionadas con el despliegue de infraestructura de telecomunicaciones, las cuales deberán ser acatadas por todas las municipalidades del país.” El ente rector de las telecomunicaciones del País es el Ministerio de Ciencia, Invocación, Tecnológica y Telecomunicaciones (Micitt), el cual mediante el el Decreto Ejecutivo Número 44335, elaboró el Reglamento a la Ley para Incentivar Y Promover la Construcción de Infraestructura de Telecomunicaciones en Costa Rica, sobre los procedimientos y especificaciones técnicas de la infraestructura de telecomunicaciones.
Con la intención de cumplir con lo establecido en el artículo 4 antes mencionado, la Municipalidad de San Ramón, mediante el Acuerdo N.º de la Sesión Ordinaria N.º 15 del 12 de julio de 2024, adopto en todos sus extremos el Decreto Ejecutivo Número 44335 - MICITT, el cual en su artículo 14, reglamenta lo siguiente con respecto a esta pretensión: “ARTÍCULO 8. Uso compartido de la Infraestructura. Las instituciones competentes que diseñen y construyan infraestructuras susceptibles de ser utilizadas para el despliegue de redes públicas de telecomunicaciones, deben facilitar el uso compartido de dichas infraestructuras, siempre que no se comprometa la continuidad y seguridad de la prestación de los servicios que presta la institución. En ningún caso se puede establecer un derecho preferente o exclusivo de uso compartido de la infraestructura, en beneficio de un operador de telecomunicaciones determinado, o de una red concreta de telecomunicaciones.
El uso compartido de dicha infraestructura debe facilitarse en condiciones de igualdad, transparencia y no discriminación.” Como se puede observar en este artículo se señala que las redes públicas de telecomunicaciones, deben ser compartidos, para el cual se realizará un convenio por el mismo y se les procederá a cobrar un canon por el disfrute de este servicio, también señala este reglamento, no se puede establecer un derecho exclusivo de uso compartido de la infraestructura. En la Ley N.º 449, Ley de Creación del Instituto Costarricense de Electricidad (ICE), específicamente en su artículo segundo inciso h), establece dentro de las competencias de esta Institución Pública, la administración de las redes de telecomunicaciones, nótese a continuación: Artículo 2º.- Las finalidades del Instituto, hacia la consecución de las cuales se dirigirán todos sus esfuerzos y programas de trabajo, serán las siguientes: (...) h) Procurar el establecimiento, el mejoramiento, la extensión y la operación de las redes de telecomunicaciones de una manera sostenible, así como prestar y comercializar productos y servicios de telecomunicaciones e infocomunicaciones y de información, al igual que otros en convergencia.
Las concesiones que el ICE y sus empresas requieran para el cumplimiento de estos fines, estarán sujetas a los plazos, los deberes, las obligaciones y demás ondiciones que establezca la legislación aplicable. Como se puede apreciar en este inciso, se establece que el ICE posee la competencia de regular la operación de las telecomunicaciones, las concesiones otorgadas actualmente en su favor y en uso, por el plazo legal correspondiente y definir otras nuevas, además posee la potestad de establecer un canon como remuneración por este servicio otorgado. 4. Que se nos justifique documentalmente la existencia o inexistencia de permisos y autorizaciones otorgados a las empresas prestatarias de servicios para el mantenimiento del cableado en el sitio denunciado, incluyendo los convenios o permisos emitidos por la Municipalidad, el Ministerio de Salud, la SUTEL o cualquier otra autoridad competente.
Como se indicó en la pretensión anterior, esta Municipalidad no es la encargada de otorgar las autorizaciones de instalación de cableado a las empresas prestadoras de servicios de telecomunicaciones, sino que dentro de la Ley N.º 449, Ley de Creación del Instituto Costarricense de Electricidad (ICE), se establece al Instituto Costarricense de Electricidad (ICE) como responsable de otorgar los permisos correspondientes, así como los convenios con las Instituciones Públicas y Privadas. Nuestra competencia es otorgar los permisos de construcción pertinentes para la instalación de nuevas estructuras. Es por esta razón que nos encontramos imposibilitados de entregarles los documentos solicitados. 5. Que, en caso de comprobarse incumplimientos normativos, la Alcaldía emita un criterio formal sobre la contaminación visual que estos hechos producen en el espacio urbano, y que en ejercicio de sus potestades presente denuncias conjuntas ante el ICE y la SUTEL, en representación de los intereses colectivos de los habitantes y se proceda a iniciar los procedimientos administrativos sancionatorios correspondientes contra las empresas responsables del abandono y acumulación de cableado en la vía pública.
Con respecto a esta pretensión, la Comisión Interinstitucional que se pretende crear, va a ser la encargada de elevar y trasladar estas denuncias a las Instituciones pertinentes. 6. Que, en caso de que la Municipalidad no realice dichas gestiones ni promueva las denuncias correspondientes, solicitamos que explique expresamente las razones de su inacción, puesto que la administración municipal es la llamada a velar por la protección de los administrados frente a los daños ambientales y paisajísticos derivados de la contaminación visual. Sobre esta pretensión se le señala que esta Alcaldía está tomando las medidas posibles para cumplir con sus responsabilidades, en relación con lo señalado en esta denuncia. 7. Que se reconozca el derecho colectivo al paisaje y a un ambiente sano y equilibrado, y que se nos garantice que las medidas adoptadas no sean meramente paliativas, sino que representen soluciones estructurales y permanentes.
Con respecto a esta pretensión, se le informa que mediante el Oficio MSR-AM-GM-DDU-SMA-194-2025, se reconoció por parte de la Oficina de Gestión Ambiental, la importancia que posee el mantener un ambiente sano y ecológicamente equilibrado, el cual también se encuentra regulado dentro del artículo 50 de la Constitución Política. Es importante comentarle a los denunciantes, que para mayor celeridad en el proceso, poseen la posibilidad de interponer la denuncia directamente a las Instituciones Públicas respectivas, a fin de que los tiempos de acción y respuesta no sean demorados, motivo de que en el traslado de una denuncia a la otra Dependencia, normalmente toma su tiempo. El Oficio MSR-AM-1117-2025 fue notificado a la Dirección de correo electrónico señalado para este medio en la denuncia presentada mediante el correo [email protected], Se le indica a los Honorables Magistrados de esta Sala Constitucional, que las solicitudes relacionadas con el actuar municipal presentadas por los Recurrentes, así como también que los temas tratados en estas solicitudes no poseen injerencia directa con esta Municipalidad, motivo de que el tema acá presentado es competencia de Instituto Costarricense de Electricidad de acuerdo a lo señalado dentro de su Ley de Creación del Instituto Costarricense de Electricidad (ICE).
No es de Recibo lo señalado por los Recurrentes al indicar que esta Administración no le ha dado respuesta, y es importante señalar que en nuestra respuesta se le indica que el proceso de traslado suele demorarse su tiempo, es por esta razón que mediante el Oficio MSR-AM-1117-2025 se le recomienda a los Recurrentes acudir directamente ante las Oficinas del ICE a presentar la denuncia. … Como se puede apreciar en este inciso, se establece que el ICE posee la competencia de regular la operación de las telecomunicaciones, las concesiones otorgadas actualmente en su favor y en uso, por el plazo legal correspondiente y definir otras nuevas, además posee la potestad de establecer un canon como remuneración por este servicio otorgado, demostrando así que ante este tipo de denuncias la Municipalidad no posee competencia, ni potestad para actuar (…)”.
Redacta el Magistrado Araya García; y,
Considerando:
I.De previo. De previo a analizar el fondo del alegato –por la presunta violación del derecho a un procedimiento pronto y cumplido– debe aclararse que, a partir de la sentencia No. 2008-02545 de las 8:55 hrs. de 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones– aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– o conocer de los recursos administrativos procedentes. Precisamente, en el sub lite, se plantea un supuesto de excepción, pues, se está ante una denuncia presentada por los accionantes en la cual acusan que las autoridades recurridas no han tramitado una presunta afectación ambiental por contaminación del paisaje urbano y riesgos a la seguridad, por la cantidad de cableado colocado en los postes eléctricos.
II.Objeto del recurso. Los recurrentes alegan que el 9 y 17 de setiembre de 2025, presentaron una denuncia ante la Municipalidad de San Ramón, la sucursal del Instituto Costarricense de Electricidad en esa localidad y la SUTEL, debido a la contaminación visual que genera el exceso y abandono de cableado aéreo instalado en los postes de electricidad y a la fecha, el problema no ha sido resuelto.
III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
En relación con el Instituto Costarricense de Electricidad:
Estas prácticas deben aplicarse en todas las zonas atendidas por el ICE, con el fin de garantizar el ordenamiento y la adecuada gestión de las redes de telecomunicaciones. 3. Comunicar a Sutel, al correo electrónico [email protected], las actuaciones realizadas a efectos del control y ordenamiento de las redes de telecomunicaciones que se encuentran instaladas en la infraestructura pasiva para el soporte de redes de telecomunicaciones (postes) (…)” (ver prueba aportada al expediente).
En relación con la Superintendencia de Telecomunicaciones:
Coordinar con los propietarios de red las acciones correctivas necesarias para subsanar las incidencias detectadas y prevenir la recurrencia de las malas prácticas de instalación. 3. Remitir a esta Superintendencia un informe detallado que contenga: a) Resultados de las verificaciones realizadas. b) Listado de actos u omisiones detectados y su ubicación precisa. c) Medidas correctivas acordadas y plazo de ejecución. d) Evidencia documental y fotográfica que respalde las actuaciones realizadas. 4. Atender la reclamación formulada por el denunciante, informando a esta Superintendencia sobre las gestiones realizadas para la resolución de esta. (…)” (ver prueba aportada al expediente).
Los incumplimientos identificados se resumen en: -Falta de relocalización de redes. -Retiro de elementos y redes en desuso. La ubicación georreferenciada de cada uno de los incumplimientos se detalla en las fotografías aportadas en el punto n°1 del presente oficio. c) Medidas correctivas acordadas y plazo de ejecución. En las notificaciones enviadas a cada uno de los Operadores presentes en el Sector de la denuncia, de acuerdo con la normativa vigente, se estableció un plazo de ejecución de 2 meses a partir del recibido de la notificación, por lo que se realizara por parte del Área de Uso Compartido de Infraestructura de la Gerencia de Telecomunicaciones, el seguimiento respectivo tendiente a garantizar el cumplimiento de las condiciones establecidas en el contrato de servicios correspondiente (…)” (ver prueba aportada al expediente).
En cuanto a la Municipalidad de San Ramón:
V.La Constitución Política, en su artículo 50, consagra el derecho de toda persona a un ambiente sano y ecológicamente equilibrado. La jurisprudencia constitucional ha reiterado que el concepto de "ambiente" no se limita a la naturaleza virgen, sino que incluye el paisaje urbano. La “contaminación visual” doctrinariamente se ha establecido como el cambio o desequilibrio del paisaje, que afecta las condiciones de vida y las funciones vitales de los seres vivientes.
En el sub lite, los recurrentes alegan que, denunciaron ante la Municipalidad de San Ramón, el ICE y ante la SUTEL, la cantidad de cableado colocado en los postes eléctrico ubicados en los siguientes puntos: 1- Avenida 0, 24 metros al este del Club de Amigos, frente a los Departamentos Washington, 2- Avenida 05, 200 metros norte y 25 este del frente de la Parroquia de San Ramón, a un lado de la Librería Católica de San Ramón, frente la Boutique Mova, y 3- Avenida 5, 25 metros de ASEMBIS, frente a PRO PLAN Concentrados, a un costado de D´Feria Centro de Carnes, debido a que se encuentran desordenados, cruzados, mal amarrados y expuestos, lo que genera contaminación del paisaje urbano y riesgos a la seguridad de las personas.
Sobre el particular, conviene indicar que esta Sala, mediante sentencia no. 2026008044, de las 9:25 horas del 6 de marzo de 2026, conoció y resolvió un asunto sustancialmente similar al presente, referido a otros cuatro puntos del cantón de San Ramón, ocasión en la cual se declaró parcialmente con lugar el recurso de amparo interpuesto contra las autoridades accionadas, con base en las consideraciones que seguidamente se transcriben:
“(…) VI.- Sobre la Responsabilidad de los Gobiernos Locales. El artículo 169, de la Constitución Política, dispone el deber de las municipalidades del país de velar por los intereses de los habitantes de su jurisdicción, de ahí que, en reiterados pronunciamientos, este Tribunal ha señalado que, dichas corporaciones se encuentran en la obligación de eliminar cualquier tipo de amenaza que ponga en riesgo los derechos a la salud y a un medio ambiente sano y ecológicamente equilibrado de las personas que viven en su cantón (véase la Sentencia N° 2008-11739 de las 12:12 horas del 25 de julio de 2008, reiterada en la N° 2020-014753, de las 9:15 horas del 7 de agosto de 2020).
Si bien la regulación técnica del sector telecomunicaciones corresponde a órganos especializados del Poder Ejecutivo y entes reguladores sectoriales, lo cierto es que las municipalidades, conforme a los artículos 169 y 170, de la Constitución Política, y al régimen autonómico municipal, ostentan competencia en materia de ordenamiento territorial, gestión del espacio público y resguardo del interés local. A su vez, de conformidad con el Código Municipal, corresponde a las municipalidades la planificación urbana y la protección del entorno ambiental en su jurisdicción.
En el presente caso, la Alcaldesa reconoce que, el 18 de setiembre de 2025, los recurrentes interpusieron una denuncia por la situación aquí planteada y a raíz de la inspección realizada, se constató que existe un "grave problema de contaminación visual" y una "acumulación desordenada de cables y equipos" que impacta negativamente el espacio urbano, por lo que se recomendó la creación de una comisión institucional y el acercamiento con ARESEP e ICE para abordar la situación en forma integral. De manera que, el 31 de octubre de 2025, la Alcaldía remitió a los denunciantes la respuesta a cada una de las inquietudes formuladas en su queja y se les explicó que, la Municipalidad no es la encargada de otorgar las autorizaciones de instalación de cableado a las empresas prestadoras de servicios de telecomunicaciones, sino que le corresponde al Instituto Costarricense de Electricidad, el cual es el responsable de otorgar los permisos correspondientes, así como los convenios con las instituciones públicas y privadas, por lo que les instó a poner la denuncia ante las instituciones públicas competentes.
Si bien, dentro de un plazo prudencial y previo a la interposición del presente recurso, la Alcaldesa resolvió la denuncia planteada y les notificó a los gestionantes el resultado de la misma, con lo cual no se lesionó el derecho de una justicia pronta y cumplida, lo cierto es que la mera creación de una comisión o el reconocimiento del problema resulta insuficiente si no se traduce en acciones materiales concretas de fiscalización y ordenamiento que cesen la vulneración del espacio público.
La autonomía municipal no se reduce a potestades tributarias o administrativas formales, sino que comporta un deber correlativo de tutela efectiva del entorno cantonal. En ese sentido, aun cuando la Municipalidad recurrida no sea el órgano competente para imponer directamente a las operadoras de telecomunicaciones el retiro o reordenamiento del cableado, sí tiene la obligación de:
De modo, que la inactividad absoluta o la omisión de gestión interinstitucional frente a una situación notoria y prolongada de desorden estructural en el cableado constituye una vulneración indirecta del derecho a un ambiente sano y del deber de protección que incumbe a toda autoridad pública.
El problema denunciado demuestra que las acciones en ejercicio de la potestad de control o vigilancia desplegadas en tutela de la salud y del ambiente por parte Municipalidad de San Ramon dentro del marco de sus competencias, han sido claramente insuficientes, incurriendo así en responsabilidad por omisión en el ejercicio de esas potestades que, a su vez, lesiona el derecho constitucional de los ciudadanos a que les presten servicios públicos eficientes y eficaces.
En virtud de lo expuesto, la Municipalidad recurrida es responsable del daño a los derechos fundamentales de las personas amparadas, por la omisión en velar pronta y eficazmente por la salud de la población, y al ambiente.
En consecuencia, en cuanto a la Municipalidad de San Ramón se declara con lugar el recurso y se le previene que, en lo sucesivo, deberá ejercer activamente sus competencias en materia de protección del paisaje urbano, seguridad ciudadana y gestión del espacio público, bajo apercibimiento de incurrir en responsabilidad por omisión. Por ende, lo procedente es ordenarle poner en funcionamiento efectivo la comisión institucional mencionada en el oficio MSR-AM-GM-DDU-SMA-197-2025, debiendo definir un cronograma de trabajo permanente para evitar que la problemática de saturación de infraestructura se repita en otros sectores del cantón mediante un trabajo de coordinación con el Instituto Costarricense de Electricidad.
VII.Sobre el deber de Fiscalización de la SUTEL y el ICE. Como entes rectores y administradores de la infraestructura pasiva, entre ellos postes y redes, la SUTEL y el ICE tienen la obligación de garantizar que los operadores privados cumplan con las normas técnicas de instalación.
Los artículos 77, de la Ley de la Autoridad Reguladora de los Servicios Públicos, y 77, del Reglamento de la Ley General de Telecomunicaciones, señalan que le corresponde a la SUTEL, garantizar el derecho al uso conjunto o compartido de las infraestructuras, canalizaciones, ductos, postes, torres, estaciones y demás instalaciones requeridas para la instalación y operación de redes públicas de telecomunicaciones, así como para la provisión de los servicios disponibles al público y la coubicación de equipos.
Por su parte, el ICE, en este caso, como propietario de la infraestructura que soporta redes públicas de telecomunicaciones, se encuentra en la obligación de conceder derechos de paso, uso compartido y colocalización de equipos, aplicar la normativa vigente y los lineamientos emitidos por la Superintendencia de Telecomunicaciones. Asimismo es su deber garantizar y brindar el mantenimiento necesario a su recurso escaso para asegurar la operación adecuada y la continuidad del uso compartido (artículo 08, del Reglamento sobre el uso compartido de infraestructura para redes públicas de telecomunicaciones, GCO-NRE-REG-00469-2016).
Precisamente, el Reglamento sobre el uso compartido de infraestructura para el soporte de redes públicas de telecomunicaciones, en el artículo 13, también establece que:
“Artículo 13. Sobre el uso eficiente de los elementos de la red en la infraestructura de telecomunicaciones por parte de los propietarios de la infraestructura.
Cuando los propietarios de la infraestructura que soporten redes públicas de telecomunicaciones tengan conocimiento sobre subutilización o uso no eficiente de los elementos de red en el espacio asignado a un operador y/o proveedor de servicios de telecomunicaciones, deberán notificar a éstos, para que se realice la desinstalación y remoción de este tipo de elementos de red, salvo cuando exista una justificación válida para mantenerlos en la infraestructura. Para esto se deberá otorgar un plazo máximo de 2 meses.
La SUTEL de oficio o a solicitud de parte, tendrá la potestad de solicitarle al operador y/o proveedor de telecomunicaciones la remoción de estos elementos ociosos, no utilizados o que no tengan un uso debidamente planificado” De manera que, según lo expuesto una vez recibida la solicitud de intervención o de oficio la SUTEL es competente para requerir a los operadores y/o proveedores de servicios de telecomunicaciones, la remoción de aquellos elementos que se encuentren en condición de ociosidad, que no estén siendo utilizados o cuya existencia no responda a una planificación técnica debidamente sustentada. Esta atribución normativa reviste especial relevancia en la gestión y ordenamiento de la infraestructura, en tanto procura evitar la saturación, el uso ineficiente o la permanencia de instalaciones carentes de justificación operativa.
En el caso bajo estudio, se constató que el 17 de setiembre de 2025, la parte recurrente interpuso una denuncia ante la Superintendencia de Telecomunicaciones (SUTEL) por la acumulación caótica de cableado y contaminación visual en el casco central de San Ramón y dentro de un plazo prudencial, la queja fue trasladada al ICE y se le pidió coordinar con los propietarios de redes de telecomunicaciones que hacen uso de la infraestructura pasiva (postes) adoptar las medidas de verificación y corrección necesaria e informar de lo actuado.
En virtud de ello, una vez que la SUTEL tuvo conocimiento de lo actuado por parte del ICE y de los operadores y/o proveedores que brinden servicios de telecomunicaciones, el 17 de octubre de 2025, procedió a informar a los quejosos de lo actuado. De modo, que en ese sentido no se lesionó el derecho a una justicia pronta y cumplida, ya que la gestión fue resuelta en un plazo razonable y antes de la interposición del presente recurso. Por ende, en cuanto este extremo se declara sin lugar el recurso.
Por otra parte, no se estima que la SUTEL haya lesionado el derecho a la salud y al ambiente de los tutelados, ya que como ente regulador sectorial, lo que le corresponde es reglar las condiciones jurídicas, técnicas y económicas a partir de las cuales, dicha infraestructura puede ser utilizada de manera compartida por los operadores y/o proveedores de servicios de telecomunicaciones disponibles al público. Nótese que, fue a partir de la queja que presentaron los recurrentes, que tuvo conocimiento del problema y para brindar una solución, le solicitó al ICE, como propietario de los postes en dicha localidad, coordinar con los propietarios de redes de telecomunicaciones que hacen uso de la infraestructura pasiva la adopción de medidas de verificación y corrección necesarias, así como también le pidió a dicho órgano, disponer de prácticas en la vigilancia y auditoría con el fin de garantizar el ordenamiento y adecuada gestión de las redes de telecomunicaciones.
Para el cumplimiento de ello, le requirió al ICE informar de las acciones realizadas y el 06 de octubre de 2025, se le comunicó que, a esa fecha, ya se había ejecutado el retiro de redes en desuso en un 50%, y que se le había otorgado un plazo de dos meses a los operadores para concluir las acciones correctivas. En definitiva, el control constitucional no puede convertirse en un mecanismo para atribuir responsabilidad automática ante toda situación material disfuncional, cuando no se acredita inactividad arbitraria o desatención deliberada por parte del ente regulador. De modo, que la SUTEL dictó los actos necesarios para brindar una solución al problema planteado por los recurrentes.
Se advierte, que sin perjuicio de la responsabilidad penal o civil, será a la SUTEL que le corresponderá intervenir en caso de las partes no lleguen a un acuerdo sobre el uso compartido del recurso escaso o exista conflicto y proceder a sancionar las infracciones administrativas en que incurran los operadores o proveedores y también los que exploten redes de telecomunicaciones o presten servicios de telecomunicaciones de manera ilegítima. (artículo 65, de la Ley General de Telecomunicaciones, Nº 8642 y 55 del Reglamento sobre el uso compartido de infraestructura para redes públicas de telecomunicaciones) Sin perjuicio de lo anterior, esta Sala estima pertinente recordar a la SUTEL su deber permanente de fiscalización y supervisión del cumplimiento de las obligaciones técnicas por parte de los operadores, especialmente cuando estas incidan en el entorno urbano y puedan tener repercusiones ambientales.
Corolario de lo anterior, no se acredita, en el caso concreto, que la Superintendencia de Telecomunicaciones haya incurrido en una acción u omisión arbitraria o ilegítima que vulnere el derecho fundamental a un ambiente sano y lo que procede es declarar sin lugar el recurso en contra este órgano administrativo.
Tome nota. A pesar de que, el presente recurso de amparo debe ser declarado sin lugar en cuanto a la SUTEL, se deberá dar seguimiento a las gestiones administrativas iniciadas objeto de este amparo, dentro del marco de sus competencias legales, a efectos de verificar el cumplimiento de las obligaciones técnicas de las empresas operadoras y adoptar, en su caso, las medidas que correspondan.
VIII.En relación con el Instituto Costarricense de Electricidad (ICE). En cuanto a este ente, al igual que los anteriores, recibió la queja de los administrados y procedió a ejecutar los actos administrativos correspondientes y constató que, existían acometidas en desuso; doble red (coaxial y fibra); doble postería; rollos de reserva mal detallados; falta de optimización del espacio en postes y procedió a avisar a los operadores; Liberty, Telecable, Tigo, Claro y Ufinet para que efectuaran los trabajos de relocalización de las redes en desuso, lo cual fue reiterado en varias ocasiones y otorgó a cada operador el plazo de dos meses, con el propósito de garantizar el cumplimiento de las condiciones estipuladas en los contratos de servicio correspondientes, lo cual vencía el 13 de diciembre de 2025, es decir posterior a la fecha de interposición del presente recurso. Se advierte que, para el mes de noviembre de 2025, algunos de los operadores ya habían ejecutado las acciones ordenadas, siendo que de la semana del 15 al 19 de diciembre de 2025, se programó una inspección por parte del personal del Área de Uso Compartido de Infraestructura, para verificar el estado actual de la postería denunciada; no obstante, la Sala desconoce el resultado del mismo.
Aun cuando las empresas operadoras de telecomunicaciones sean propietarias del cableado instalado, lo cierto es que el Instituto Costarricense de Electricidad, en su condición de titular y administrador de la postería, ostenta una posición jurídica de garante respecto del uso adecuado y seguro de esa infraestructura. En tal carácter, no puede desentenderse del deterioro del espacio público derivado de la utilización negligente de los postes bajo su administración, pues ello implicaría tolerar prácticas contrarias a las normas de ordenamiento urbano y a los reglamentos técnicos en materia de seguridad eléctrica y telecomunicaciones.
En el sub lite se verifica una omisión administrativa en el ejercicio de las potestades de policía, control y supervisión que corresponden al ICE sobre su propia infraestructura, lo cual ha generado una afectación al derecho fundamental a un ambiente sano y equilibrado, así como una amenaza cierta a la salud e integridad física de los recurrentes y de la colectividad.
La acumulación desordenada de cableado, el denominado “marañamiento” de líneas y la permanencia de tendidos en desuso configuran una forma de contaminación visual que degrada el paisaje urbano y menoscaba el derecho de los habitantes a un entorno seguro y estéticamente armónico.
En tal sentido, la pasividad del ente recurrido no constituye una mera deficiencia estética, sino una omisión con relevancia constitucional, en tanto compromete la salud y la seguridad física de las personas así como la regularidad en la gestión del dominio público. La inacción frente al incumplimiento técnico de las operadoras convierte al administrador de la postería en corresponsable de la lesión a la salud y ambiental ocasionada, pues la administración de infraestructura pública no puede ejercerse al margen de los principios de legalidad, eficacia y tutela del interés general.
Se evidencia, entonces, que la falta de fiscalización efectiva ha producido una lesión al derecho al ambiente y una amenaza latente a la salud y a la integridad de las personas, ante el riesgo de desprendimientos o accidentes eléctricos. En consecuencia, la omisión del ICE en el ejercicio de sus competencias de control transgrede los mandatos constitucionales de eficiencia administrativa y protección del entorno.
Por otra parte, no consta que, a la fecha de interposición del presente recurso, las autoridades de la sucursal correspondiente hayan comunicado a los recurrentes el resultado concreto de las gestiones emprendidas, lo que también comporta una lesión al derecho a una justicia pronta y cumplida. Este derecho no se satisface con la mera emisión de actos concretos, sino que exige una respuesta sustantiva y eficaz que atienda de manera real y oportuna la problemática planteada.
En el caso concreto se advierte una inoperancia administrativa, pues, pese a haber transcurrido aproximadamente dos meses desde la interposición de las denuncias y a existir reconocimiento expreso del mal estado del tendido por parte de las autoridades, a la fecha de interposición del presente recursos el paisaje urbano de San Ramón no ha experimentado cambios sustanciales, manteniendo a los administrados en una situación de riesgo e incertidumbre. La persistencia del problema revela que la fiscalización ha sido omisa o ineficaz. Las instituciones públicas no pueden limitar su actuación a meros traslados de correspondencia; están obligadas a garantizar el retiro efectivo del cableado en desuso o instalado en contravención de la normativa técnica aplicable.
IX.Conclusión. Resulta evidente que tanto la Municipalidad de San Ramón, como la Sucursal del ICE en el cantón de San Ramón, han fallado en su deber de coordinación interinstitucional para resolver un problema de contaminación visual plenamente identificado. La falta de ejecución y la persistencia del desorden técnico en los cuatro puntos denunciados justifican la intervención de esta Sala para ordenar la restauración del equilibrio visual y la seguridad del casco central de San Ramón (…)
Por tanto:
Se declara con lugar el recurso. Se ordena a [Nombre 008] y a [Nombre 009], en su condición respectiva de Alcaldesa y Jefe de la Unidad de Servicios Ambientales Municipales, ambos de la Municipalidad de San Ramón, o a quienes ocupen dichos cargos, que dentro del plazo de QUINCE DIAS HÁBILES, a partir de la notificación de la presente sentencia, deben poner en funcionamiento efectivo la comisión institucional mencionada en el oficio MSR-AM-GM-DDU-SMA-197-2025, debiendo definir un cronograma de trabajo permanente para evitar que la problemática de saturación de cables de telecomunicaciones en la infraestructura se repita en otros sectores del cantón. Además, deberán coordinar con el INSTITUTO COSTARRICENSE DE ELECTRICIDAD, de manera conjunta y efectiva, dentro de sus respectivas esferas de competencia, para que dentro del plazo de UN MES, contado a partir de la notificación de esta resolución, se finalice el proceso de limpieza, ordenamiento y retiro de todo cableado de telecomunicaciones que se encuentre en desuso, instalado de manera irregular o que genere una acumulación caótica en los cuatro puntos específicos denunciados por los recurrentes.
A su vez, se ordena a Alex Rodríguez Cambronero, en su condición de Coordinador de la Agencia Integrada de San Ramón del Instituto Costarricense de Electricidad, o a quien ocupe dicho puesto que disponga las acciones administrativas y técnicas necesarias para que: a) Dentro del plazo de SEIS MES, contado a partir de la notificación de esta sentencia, coordine con las operadoras de telecomunicaciones, el orden y retiro en su totalidad del cableado en desuso en la zona afectada; b) Ejecutar, junto con las operadoras de telecomunicaciones un plan de ordenamiento y tensado de los cables remanentes para eliminar el impacto visual negativo y garantizar la seguridad; c) Establecer un protocolo de fiscalización permanente para evitar que la situación de caos visual se repita en el futuro y; d) Resolver y notificar la resolución de la denuncia interpuesta por la parte recurrente el día 17 de setiembre de 2025.
Lo anterior, bajo el apercibimiento que con base en lo establecido en el artículo 71, de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de San Ramón y al Instituto Costarricense de Electricidad al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En cuanto a la Superintendencia de Telecomunicaciones se declara sin lugar el recurso, aunque debe tomar nota de lo indicado en el párrafo final del considerando VII, de esta sentencia. El magistrado Castillo Víquez consigna nota.
El magistrado Salazar Alvarado salva el voto en forma parcial y declara sin lugar el recurso, en cuanto a la acusada violación del derecho a un ambiente sano y ecológicamente equilibrado, ya que este extremo del recurso corresponde ser dirimido en la vía de legalidad (…)”.
Al respecto, se aclara que en este recurso de amparo se denuncia el exceso de cableado en los postes ubicados en: “a) Avenida 0, 24 metros al este del Club de Amigos, frente a los Departamentos Washington, b) Avenida 05, 200 metros norte y 25 este del frente de la Parroquia de San Ramón, a un lado de la Librería Católica de San Ramón, frente la Boutique Mova, y c) Avenida 5, 25 metros de ASEMBIS, frente a PRO PLAN Concentrados, a un costado de D´Feria Centro de Carnes”. Asimismo, en el precedente citado se cuestiona el cableado colocado en los postes eléctrico ubicado en: “cuatro puntos de la ciudad, en la Avenida Segunda de San Ramón, sobre aceras y frente a diversos locales comerciales (Pizza Grace, Librería Eureka, The Corner Pub y Sala de Juegos Mora)”. Por otra parte, al igual que en el precedente citado, la Municipalidad de San Ramón hace mención del oficio MSR-AM GM-DDU-SMA-197-2025, fechado 01 de octubre de 2025, en donde se establece que realizó una inspección en el lugar señalado y emitió ese documento con conclusiones y recomendaciones (se recomienda la conformación de la comisión institucional). Por otra parte, en el presente asunto, los recurrentes alegan la falta de atención de varias denuncias al respecto presentadas ante la Municipalidad de San Ramón, Superintendencia de Telecomunicaciones e Instituto Costarricense de Electricidad.
Es decir, se tiene por probado que se trata de denuncias sobre contaminación visual en zonas comunes de dicho cantón, por lo que este Tribunal se fundamenta en ese precedente para la resolución de este nuevo recurso de amparo.
VI.De la revisión integral del expediente, de los informes rendidos bajo juramento -con las consecuencias previstas en el artículo 44 de la Ley de esta Jurisdicción- y del acervo probatorio incorporado, este Tribunal tiene por acreditado que los recurrentes denunciaron, el 9, 17 y 18 de setiembre de 2025, una situación persistente de contaminación visual, desorden estructural y acumulación de cableado eléctrico y de telecomunicaciones en desuso, particularmente en diversos sectores urbanos del cantón de San Ramón de Alajuela, lo cual generaba un impacto negativo en el paisaje urbano y riesgos para la seguridad ciudadana.
Conforme se desprende de los hechos demostrados, dichas denuncias fueron planteadas ante el Instituto Costarricense de Electricidad (ICE), la Municipalidad de San Ramón y la Superintendencia de Telecomunicaciones (SUTEL), siendo que cada una de estas entidades desplegó actuaciones dentro de su respectivo ámbito competencial. No obstante, el análisis constitucional exige determinar si tales actuaciones fueron oportunas, suficientes y eficaces para garantizar los derechos fundamentales invocados.
En lo que respecta al Instituto Costarricense de Electricidad, consta que, en su condición de propietario y administrador de la infraestructura pasiva (postería), recibió las denuncias respectivas y, trasladadas estas también por la SUTEL, ejecutó diversas gestiones administrativas, tales como inspecciones de campo, notificaciones y apercibimientos a los operadores de telecomunicaciones que utilizan dicha infraestructura -Liberty, Telecable, Tigo, Claro, Ufinet y Kölbi-, otorgándoles plazos para la relocalización de redes, el retiro de tendidos en desuso y la corrección de múltiples irregularidades detectadas, entre ellas acometidas ociosas, doble red, doble postería, rollos de reserva mal dispuestos y trabajos inconclusos.
Sin embargo, también quedó demostrado que, a la fecha de interposición del presente recurso, persistían irregularidades relevantes en las zonas denunciadas y no se había acreditado el retiro total del cableado en desuso ni la corrección integral del problema, pese a haberse reconocido expresamente la existencia de tales anomalías. Asimismo, no consta que el ICE hubiera comunicado de manera clara y oportuna a los recurrentes el resultado concreto de las gestiones realizadas, lo cual incidió negativamente en su derecho a una justicia pronta y cumplida.
Tal como ha sostenido reiteradamente esta Sala, aun cuando las empresas operadoras sean propietarias de las redes instaladas, el ICE, como administrador de la postería, ostenta una posición jurídica de garante respecto del uso adecuado, seguro y ordenado de dicha infraestructura. En consecuencia, no puede desentenderse de los efectos negativos que el uso negligente de los postes genera sobre el espacio público, pues ello compromete el derecho constitucional a un ambiente sano y equilibrado, así como la salud y la integridad física de las personas. La omisión o fiscalización ineficaz en el ejercicio de sus potestades de control y supervisión configura, por ende, una infracción con relevancia constitucional.
Por su parte, en cuanto a la Municipalidad de San Ramón, se encuentra acreditado que esta recibió la denuncia por contaminación visual y que, mediante inspección técnica, reconoció expresamente la veracidad de los hechos denunciados, concluyendo que existía un grave problema de contaminación visual derivado del desorden de cables y equipos en la postería urbana. No obstante, también se constata que transcurrió un plazo excesivo -superior a dos meses- sin que se brindara una respuesta formal a los denunciantes, la cual únicamente se produjo con ocasión de la tramitación del presente amparo.
Adicionalmente, aunque la municipalidad manifestó su intención de conformar una comisión institucional y de coordinar con otras entidades competentes, no consta que tales medidas se hayan materializado efectivamente ni que se hayan traducido en acciones concretas y verificables de fiscalización, ordenamiento o mitigación del problema denunciado. Como ha señalado este Tribunal, la autonomía municipal comporta no solo potestades formales, sino un deber activo de tutela del entorno urbano y del espacio público cantonal. En consecuencia, aun cuando no le corresponda imponer directamente a los operadores el retiro del cableado, sí está obligada a fiscalizar, coordinar interinstitucionalmente y adoptar medidas razonables para prevenir riesgos ambientales y urbanos. La inactividad o gestión meramente declarativa resulta insuficiente y configura una omisión lesiva de derechos fundamentales.
Finalmente, en lo atinente a la Superintendencia de Telecomunicaciones (SUTEL), se tuvo por demostrado que dicha entidad recibió múltiples denuncias de similar naturaleza y, dentro de un plazo razonable, procedió a trasladarlas al ICE como propietario de la infraestructura pasiva, emitió directrices claras para la verificación y corrección de las irregularidades señaladas y requirió informes detallados sobre las acciones ejecutadas. Asimismo, antes de la interposición del presente recurso, la SUTEL comunicó a los denunciantes las gestiones efectuadas y los informes rendidos por el ICE, sin que se evidencie una conducta omisiva, arbitraria o ilegítima por parte del ente regulador.
Debe recordarse que la función de la SUTEL se circunscribe a la regulación, supervisión y fiscalización de las condiciones técnicas y jurídicas del uso compartido de la infraestructura, sin que le corresponda la ejecución material directa del retiro del cableado. En ese marco, este Tribunal estima que la SUTEL actuó dentro de su ámbito competencial y no lesionó los derechos fundamentales de los recurrentes, sin perjuicio de su deber permanente de supervisión continua y eventual potestad sancionatoria ante incumplimientos futuros (ver en similar sentido la sentencia no. 2026014326 de las 9:20 horas del 24 de abril de 2026).
VII.Conclusión. En virtud de lo expuesto, lo que procedente es declarar parcialmente con lugar el recurso únicamente en contra del Instituto Costarricense de Electricidad y la Municipalidad de San Ramón por los puntos indicados. En cuanto a la Superintendencia de Telecomunicaciones, se declarar sin lugar el recurso. No obstante, tal y como se indicó en el precedente citado, se le recuerda a dicha autoridad que deberá dar seguimiento a las gestiones administrativas iniciadas objeto de este amparo, dentro del marco de sus competencias legales, a efectos de verificar el cumplimiento de las obligaciones técnicas de las empresas operadoras y adoptar, en su caso, las medidas que correspondan.
VIII.Nota del Magistrado Castillo Víquez, en cuanto a la justicia administrativa pronta y cumplida. He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales.
A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia. Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.
En asuntos ambientales, es criterio del suscrito, que si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que la parte recurrente indica que presentó una denuncia por contaminación del paisaje urbano y riesgos a la seguridad por la cantidad de cableado colocado en los postes eléctricos, que no ha sido resuelta en forma definitiva.
X.Voto salvado parcial respecto a la parte dispositiva de esta sentencia de la magistrada Garro Vargas. Si bien coincido con la mayoría de la Sala en que el recurso se debe declarar parcialmente con lugar, difiero sobre dónde residenciar la fase de ejecución del asunto, debido a la inexistencia de mecanismos adecuados previstos por la normativa que rige esta jurisdicción constitucional para dar seguimiento a una sentencia que reviste aspectos técnicos de cierta complejidad, como es en este caso que, dentro del plazo que se disponga, contado a partir de la notificación de esta sentencia, la Municipalidad de San Ramón y el Instituto Costarricense de Electricidad, por medio de las autoridades recurridas, brinden una solución definitiva al problema de contaminación visual generado por el exceso y desorden del cableado en postes en los sectores denunciados del casco urbano del cantón. En cambio, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (artículo 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, entre otras herramientas idóneas para supervisar órdenes estructurales de esta naturaleza.
Por ello, de conformidad con lo dispuesto por el artículo 56 de la Ley de Jurisdicción Constitucional, estimo que la fase de ejecución debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.
XI.Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara parcialmente con lugar el recurso, únicamente, en contra de la Municipalidad de San Ramón y el Instituto Costarricense de Electricidad. Se ordena a [Nombre 008], en su condición de alcaldesa de la Municipalidad de San Ramón, o a quien ocupe el cargo, que debe poner en funcionamiento efectivo la comisión institucional mencionada en el oficio MSR-AM-GM-DDU-SMA-197-2025, debiendo definir un cronograma de trabajo permanente para evitar que la problemática de saturación de cables de telecomunicaciones en la infraestructura se repita en otros sectores del cantón. Además, deberá coordinar con el INSTITUTO COSTARRICENSE DE ELECTRICIDAD, de manera conjunta y efectiva, dentro de sus respectivas esferas de competencia, para que se finalice el proceso de limpieza, ordenamiento y retiro de todo cableado de telecomunicaciones que se encuentre en desuso, instalado de manera irregular o que genere una acumulación caótica en los tres puntos específicos denunciados por los recurrentes, todo lo anterior, dentro del plazo fijado en la sentencia no. 2026-008044 de las 09:25 horas del 06 de marzo de 2026.
A su vez, se ordena a Alex Rodríguez Cambronero, en su condición de coordinador de la Agencia Integrada de San Ramón del Instituto Costarricense de Electricidad, o a quien ocupe el cargo, que disponga las acciones administrativas y técnicas necesarias para que: a) coordine con las operadoras de telecomunicaciones, el orden y retiro en su totalidad del cableado en desuso en la zona afectada; b) Ejecutar, junto con las operadoras de telecomunicaciones un plan de ordenamiento y tensado de los cables remanentes para eliminar el impacto visual negativo y garantizar la seguridad; y c) Establecer un protocolo de fiscalización permanente para evitar que la situación de caos visual se repita en el futuro. Todo lo anterior, dentro del plazo fijado en la sentencia no. 2026-008044 de las 09:25 horas del 06 de marzo de 2026. Asimismo, dentro del plazo de un mes, contado a partir de la notificación de esta sentencia, deberá resolver y notificar la resolución de la denuncia interpuesta por la parte recurrente el 9 de setiembre de 2025.
Lo anterior, bajo el apercibimiento que con base en lo establecido en el artículo 71, de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de San Ramón y al Instituto Costarricense de Electricidad al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En cuanto a la Superintendencia de Telecomunicaciones se declara sin lugar el recurso, aunque debe tomar nota de lo indicado en el considerando VII de esta sentencia. El Magistrado Castillo Víquez consigna nota. El Magistrado Salazar Alvarado pone nota.
La magistrada Garro Vargas salva el voto respecto a la ejecución de esta sentencia y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución, establecidos en los artículos 155 y siguientes del Código Procesal Contencioso Administrativo. Asimismo, ordena que se le remita copia de la sentencia para que se inicie los procedimientos de ejecución de este fallo. Notifíquese.- Fernando Castillo V.
