SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine hours and twenty minutes on the twenty-fourth of April, two thousand and twenty-six.

Writ of amparo (recurso de amparo) filed by [Nombre 001], attorney-at-law, national identity card (cédula de identidad) number [Valor 001], on behalf of [Nombre 002], national identity card number [Valor 002]; against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (AyA).

Background:

  1. 1By written submission filed through the Gestión en Línea platform at 10:51 hours on March 24, 2026, the petitioner files the writ of amparo and states: "FIRST: Mr. [Nombre 002] is a citizen of 92 years of age, living in extreme poverty and receiving a pension from the Caja Costarricense de Seguro Social under the Non-Contributory Pension Scheme (Régimen No Contributivo). He has no family support network. SECOND: Mr. [Nombre 002] lives on a property which, according to the Registro Nacional, is registered as parcel 5-026744-004. THIRD: He resides on a private property in the Guanacaste region, Nicoya, 400 meters west of the entrance to the Cristo Redentor, along the old road to Quirimán, where he serves as an unpaid caretaker, inhabiting a precarious structure on said land. FOURTH: The property has no potable water (agua potable) connection. AyA has not provided any technical solutions for access to this essential resource at the dwelling unit.FIFTH: Due to the lack of service, Mr. [Nombre 002] is forced to obtain water from a nearby stream that crosses the roadway, thereby exposing his health to contaminants, parasites, and disease — a situation aggravated by his advanced age and physical frailty. SIXTH: Due to his condition of extreme poverty, the protected party does not have the resources to finance major infrastructure works or network extensions on his own. LEGAL BASIS ➢ Article 50 of the Political Constitution: Recognizes the human, basic, and inalienable right of access to potable water as an essential resource for life. The State must guarantee it. ➢ Right to Health and Life (Art. 21 Const. Pol.): The lack of potable water for a 92-year-old elderly person constitutes a direct and critical threat to his physical integrity and to his life itself. ➢ Ley 7935 (Ley Integral para la Persona Adulta Mayor): Obliges the State to guarantee a dignified life and access to basic public services for elderly persons, especially those at social risk. ➢ Constitutional Court Jurisprudence: This Court has repeatedly held (Sentencia 2020-011858 and others) that lack of economic capacity or land-tenure status cannot constitute obstacles preventing AyA from supplying potable water through palliative or provisional measures (such as social-welfare water tap connections (pajas de agua de bien social)). PETITION With all due respect, I request the honorable justices of this Court to:1) Grant the present writ of amparo.2) Order AyA to immediately install a potable water tap connection (paja de agua) of a social character at the protected party's dwelling, or, in the alternative, to guarantee daily supply by water tanker truck or any effective means while the technical connection is resolved.3) That the protected party be exempted from bureaucratic procedures that impede immediate access to water, given his condition of poverty and age." (SIC).
  2. 2By order issued at 09:05 hours on April 13, 2026, the petitioner was instructed, within a period of three days and under penalty of outright dismissal of the writ in the event of non-compliance, to indicate: "• Whether she has formally and in writing submitted the request or petition of interest — namely, access to the potable water service — before the respondent authority; • If affirmative, she must provide complete, legible copies along with the corresponding acknowledgment of receipt or email transmission confirmation of the submission made; • If she has received any ruling, she must clearly indicate the result obtained and provide the documentation generated in connection with those proceedings; • Whether said petition is pending resolution as of the date of filing of this writ, which must also be expressly stated to this Court; • Likewise, if the petition has not been formally and in writing submitted, she must clarify this." That order was notified to the petitioner at 08:38 hours on April 14, 2026 to the address designated for such purpose.
  3. 3By written submission incorporated into the digital case file at 14:21 hours on April 14, 2026, the petitioner, in response to the instructions received, stated: "I. REGARDING PRIOR ADMINISTRATIVE PROCEEDINGS

With respect to the request for copies of the proceedings conducted before AyA of Nicoya, I state the following:

  • A)Material Impossibility: The beneficiary of the writ of amparo is a 92-year-old elderly person living in extreme poverty and isolation. Due to his advanced age, lack of economic resources, and complete lack of mobility, it has been impossible for him to formalize written requests before the Acueductos y Alcantarillados office in Nicoya, Guanacaste. Furthermore, the property where the protected party lives, in his capacity as caretaker, belongs to Ms. Sandra Iris del Carmen Li Orias, identity card 501000770, who resides in Nicoya, Guanacaste, Barrio San Martín, 150 meters east of Ferretería San Martín.
  • B)Exception Configuration Due to Imminent Danger: I request that this Court, applying the principle of favor debilis, dispense with the requirement to exhaust prior administrative proceedings. The gentleman currently obtains water from a pond near where he lives, which represents an immediate and serious risk to his health and life, constituting a flagrant violation of human dignity.
  • C)REGARDING STANDING AND THE LINK TO THE PROPERTY: I clarify to this Court that I am not the owner of the property nor do I maintain any contractual relationship with the elderly person. I act moved solely by ethical duty and social solidarity, as a witness to the absolute vulnerability of a person who has no voice or means to defend his fundamental rights on his own.

Constitutional jurisprudence has been clear in holding that access to water is an essential human right whose protection cannot be made subject to ownership formalities when life is at stake.

PETITION For the foregoing reasons, I respectfully request that this Court:

1. Accept the response to the instructions as duly filed.

2. Consider the critical vulnerability of the beneficiary (92 years of age, extreme poverty, consumption of non-potable water) in order to grant this writ.

3. Order AyA to immediately install a potable water service or, in the alternative, a provisional humanitarian solution (such as a water tanker truck or public water point) while the situation regarding the property is resolved." (SIC).
  1. 4Article 9 of the Ley de la Jurisdicción Constitucional authorizes this Court to dismiss outright or on the merits, at any time — even from the moment of filing — any petition brought before it that is manifestly inadmissible, or when the Court considers that there are sufficient grounds for dismissal, or when the matter constitutes a mere reiteration or reproduction of a prior identical or similar petition that was already rejected.

Opinion authored by Justice Castillo Víquez; and,

Considering:

I. SUBJECT OF THE WRIT

The petitioner argues that the protected party is a 92-year-old elderly person living in extreme poverty and receiving a pension under the Non-Contributory Pension Scheme. She states that he lives on a property in Nicoya, where he serves as an unpaid caretaker, and that the property has no potable water service, forcing him to obtain water from a nearby stream, which places his health at risk. Due to his advanced age, lack of economic resources, and complete lack of mobility, it has been impossible for him to formalize written requests before the Acueductos y Alcantarillados office in Nicoya, Guanacaste. Furthermore, the property where the protected party lives, in his capacity as caretaker, belongs to another person. For these reasons, she requests that he be dispensed from the requirement to exhaust proceedings before AyA and that AyA be ordered to provide him with access to potable water or, alternatively, to supply the resource by water tanker truck or public water point.

II. INADMISSIBILITY OF THE WRIT

On repeated occasions, this Court has held that, while the fundamental right to water and its access on equal terms is recognized — as it is an essential service for life and health — it has also indicated that this right does not entail unrestricted access to water, since the Administration may validly establish general conditions and requirements for accessing this service. Likewise, it is valid for the entities — public or private — that administer the service to reject water service requests, or requests for a water availability letter (carta de disponibilidad de agua), when the applicant does not meet the requirements or when there are technical or legal reasons that justify doing so.

Nevertheless, in the present case, as indicated by the petitioner in response to the instructions issued, the protected party has not even carried out the formal proceedings before AyA in compliance with the applicable requirements in order to be granted the potable water service. Likewise, it is acknowledged that he is not the registered owner of the property and therefore is not the person with standing to apply for the service. On the contrary, the petitioner is making a request for assistance so that this Court may intervene or use its good offices before AyA in order to exempt the protected party from legal proceedings and requirements and grant him access to water. However, the foregoing falls outside the scope of this Court's jurisdiction, as it is not the Court's role to intercede on his behalf before said institution in order to obtain what is sought. Nor may this Court replace the active Administration in the exercise of its competencies to verify his physical and socioeconomic status, as well as the impediments mentioned, for the purpose of ordering the provision of water to the protected party, as these are matters of ordinary legality that must be resolved through the appropriate administrative or judicial channels.

Regarding the petitioner's argument and her request for the installation of a public water point or water supply by tanker truck to provide water to the protected party on account of his vulnerable condition, it should be noted that this Court has guaranteed access to potable water through a public water point only in cases where there has been a suspension of service with respect to the holder of a formal, previously granted service — not in cases such as the present one, where the protected party has not had any service suspended, as he never had such service in the first place (see, in a similar vein, Sentencia No. 2019-2957 of 9:30 hours on February 20, 2019, and Sentencia No. 2019-7175 of 9:20 hours on April 26, 2019).

Therefore, should the petitioner see fit, she must raise her objections or claims before the respondent authorities or through the competent judicial channels, where she may fully argue the merits of the matter and assert her claims. Accordingly, the writ is inadmissible and is so declared.

III. DOCUMENTATION SUBMITTED TO THE CASE FILE

The petitioner is hereby instructed that, should she have submitted any document in paper form, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology-produced device, these must be retrieved from the court offices within a maximum period of 30 business days counted from notification of this judgment. Otherwise, all material not retrieved within this period shall be destroyed, pursuant to the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by Corte Plena at session N° 27-11 of August 22, 2011, article XXVI, and published in Boletín Judicial number 19 of January 26, 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on May 3, 2012, article LXXXI.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veinticuatro de abril de dos mil veintiseis .

Recurso de amparo interpuesto por [Nombre 001], abogada, cédula de identidad número [Valor 001], a favor de [Nombre 002], cédula de identidad número [Valor 002]; contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (AYA).

Resultando:

  1. 1Por escrito presentado por Gestión en Línea a las 10:51 horas del 24 de marzo de 2026, la parte recurrente interpone recurso de amparo y manifiesta que: “PRIMERO: El señor [Nombre 002], es un ciudadano de 92 años, en condición de pobreza extrema y pensionado de la Caja Costarricense de Seguro Social, por el Régimen No Contributivo. No cuenta con red de apoyo familiar. SEGUNDO: Que el señor [Nombre 002], vive en un inmueble, que según el Registro Nacional es la finca 5-026744-004 TERCERO: Habita en una propiedad privada en la zona de Guanacaste, Nicoya, 400 metros oeste de la entrada al Cristo Redentor, por el camino viejo a Quirimán, donde funge como cuidador sin remuneración salarial, habitando una estructura precaria en dicho terreno. CUARTO: La propiedad no cuenta con conexión de agua potable. El AyA no ha brindado soluciones técnicas para el acceso al líquido vital en esta unidad habitacional.QUINTO: Ante la carencia del servicio, el señor [Nombre 002], se ve obligado a abastecerse de un riachuelo cercano, que atraviesa la carretera exponiendo su salud a contaminantes, parásitos y enfermedades, situación agravada por su avanzada edad y fragilidad física. SEXTO: Debido a su condición de pobreza extrema, el amparado no cuenta con los recursos para costear obras de infraestructura mayor o extensiones de red por cuenta propia. FUNDAMENTOS DE DERECHO ➢Artículo 50 de la Constitución Política: Reconoce el derecho humano, básico e irrenunciable de acceso al agua potable, como bien esencial para la vida. El Estado debe garantizarlo. ➢Derecho a la Salud y Vida (Art. 21 Const. Pol.): La falta de agua potable para un adulto mayor de 92 años es una amenaza directa y crítica a su integridad física y a su vida misma. ➢Ley 7935 (Ley Integral para la Persona Adulta Mayor): Obliga al Estado a garantizar una vida digna y acceso a servicios públicos básicos a los adultos mayores, especialmente aquellos en riesgo social. ➢Jurisprudencia de la Sala Constitucional: La Sala ha reiterado (Sentencia 2020-011858 y otras) que la falta de capacidad económica o la situación de tenencia de la tierra no pueden ser obstáculos para que el AyA suministre agua potable mediante medidas paliativas o provisionales (como pajas de agua de bien social). PETICION Con todo respeto, solicito a los honorables magistrados de esta Sala:1) Declarar con lugar el presente recurso de amparo.2) Ordenar al AyA que, de forma inmediata y como medida cautelar, proceda a instalar una conexión de agua potable (paja de agua) de carácter social en la vivienda del amparado, o en su defecto, garantice el suministro diario mediante camión cisterna o cualquier medio efectivo mientras se soluciona la conexión técnica.3) Que se exonere al amparado de trámites burocráticos que impidan el acceso inmediato al agua, dada su condición de pobreza y edad.” (SIC).
  2. 2Por resolución de las 09:05 horas del 13 de abril de 2026, se le previno a la recurrente, que dentro del plazo de tres días y bajo apercibimiento de rechazar de plano el recurso en caso de incumplimiento indique: “• Si ha planteado de manera formal y por escrito la gestión o solicitud de su interés, es decir, el acceso al servicio de agua potable ante la autoridad accionada; • De ser afirmativa su respuesta, deberá aportar copias completas, legibles y con el respectivo comprobante de recibido o de remisión de correo electrónico de la gestión que formuló; • De haber recibido alguna resolución, deberá indicar claramente cuál fue el resultado obtenido y aportar la documentación generada con ocasión de tales diligencias; • Si dicha gestión se encuentran pendiente de resolución a la fecha de interposición de este recurso, también deberá indicarlo expresamente a esta Sala; • Igualmente si no ha planteado por escrito y de manera formal esa gestión, así deberá aclararlo.” Dicha resolución fue notificada a la recurrente a las 08:38 horas del 14 de abril de 2026 al medio señalado al efecto.
  3. 3Por escrito incorporado al expediente digital a las 14:21 horas del 14 de abril de 2026, la recurrente en atención a lo prevenido manifestó que: “I. SOBRE LAS GESTIONES ADMINISTRATIVAS PREVIAS

Con respecto a la solicitud de copias de las gestiones realizadas ante el AyA de Nicoya, manifiesto lo siguiente:

  • A)Imposibilidad Material: El beneficiario del amparo es un adulto mayor de 92 años que vive en condición de pobreza extrema y aislamiento. Debido a su avanzada edad, falta de recursos económicos y nula movilidad, le ha sido imposible formalizar gestiones escritas ante la oficina de Acueductos y Alcantarillados de Nicoya, Guanacaste. Además, la propiedad donde vive el amparado, en calidad de cuidador, pertenece a la señora Sandra Iris del Carmen Li Orias cédula 501000770, quien reside en Nicoya, Guanacaste, Barrio San Martín 150 mts este de Ferretería San Martín.
  • B)Configuración de Excepción por Peligro Inminente: Solicito a esta Sala que, en aplicación del principio de favor debilis, se dispense el agotamiento de gestiones administrativas previas. El señor se abastece actualmente de una charca que está cerca del lugar donde vive, lo cual representa un riesgo inmediato y grave para su salud y su vida, constituyendo una violación flagrante a la dignidad humana.
  • C)SOBRE LA LEGITIMACIÓN Y EL VÍNCULO CON EL INMUEBLE: Aclaro a este Tribunal que no soy la propietaria del inmueble ni mantengo relación contractual con el adulto mayor. Actúo movida únicamente por el deber ético y la solidaridad social, al ser testigo de la desprotección absoluta de una persona que no tiene voz ni medios para defender sus derechos fundamentales por sí misma.

La jurisprudencia constitucional ha sido clara en que el acceso al agua es un derecho humano esencial, cuya tutela no puede estar supeditada a formalismos de propiedad cuando la vida está de por medio.

PETITORIA Por lo expuesto, solicito respetuosamente a esta Sala:

1. Tener por evacuada la prevención.

2. Considerar la vulnerabilidad crítica del beneficiario (92 años, pobreza extrema, consumo de agua no potable) para declarar con lugar este recurso.

3. Ordenar al A y A la instalación inmediata de un servicio de agua potable o, en su defecto, una solución provisional humanitaria (como un camión cisterna o toma pública) mientras se resuelve la situación del predio.” (SIC).
  1. 4El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.

Redacta el Magistrado Castillo Víquez; y,

Considerando:

I. OBJETO DEL RECURSO

La recurrente aduce que el amparado es un adulto mayor de 92 años, en condición de pobreza extrema y pensionado por el Régimen No Contributivo. Afirma que vive en un inmueble en Nicoya, donde funge como cuidador sin remuneración salarial, la cual no cuenta con servicio de agua potable, por lo que se ve obligado a abastecerse de un riachuelo cercano, lo que pone su salud en riesgo. Debido a su avanzada edad, falta de recursos económicos y nula movilidad, le ha sido imposible formalizar gestiones escritas ante la oficina de Acueductos y Alcantarillados de Nicoya, Guanacaste. Además, la propiedad donde vive el amparado, en calidad de cuidador, pertenece a otra persona. Por ello solicita que se le dispense del agotamiento de gestiones ante el AyA y se ordene brindarle acceso al agua potable, o bien, suministrarle el recurso a través de un camión cisterna o fuente pública.

II. INADMISIBILIDAD DEL AMPARO

En reiteradas ocasiones, esta Sala ha sostenido que si bien se reconoce el derecho fundamental al agua y su acceso en igualdad de condiciones, por cuanto se trata de un servicio esencial para la vida y la salud; también, ha indicado que este derecho no implica un acceso irrestricto al agua, toda vez que, la Administración puede válidamente, establecer condiciones y requisitos generales para acceder a este servicio. Asimismo, resulta válido que las entidades -públicas o privadas- que administren el servicio, puedan rechazar las solicitudes de agua, o bien, de la carta de disponibilidad de agua, cuando el interesado no cumple los requisitos o cuando existen razones técnicas o legales que los justifiquen.

No obstante, en el caso concreto, tal como lo indicó la recurrente en atención a lo prevenido, el amparado ni siquiera ha realizado las gestiones formales ante el AyA, en cumplimiento de los requisitos exigidos al efecto, para que se le otorgue el servicio de agua potable. Asimismo, admite que no es el propietario registral del bien y por ende la persona legitimada para gestionar el servicio. Por el contrario, la recurrente formula una solicitud de ayuda para que este Tribunal intervenga o interponga sus buenos oficios ante el AYA, a fin de que se le exima al amparado de las gestiones y requisitos legales y se le otorgue al acceso al agua. Sin embargo, lo anterior no se encuentra dentro del ámbito de competencia de esta Jurisdicción, puesto que no le corresponde a la Sala interceder a su favor ante dicha institución para que se le conceda lo pretendido. Tampoco puede este Tribunal reemplazar a la Administración activa en la gestión de sus competencias para comprobar su estado físico y socioeconómico, así como las imposibilidades que menciona a efecto de ordenar el otorgamiento del agua a favor del amparado, pues se trata de extremos de legalidad ordinaria que deben ser dirimidos en la vía común, administrativa o jurisdiccional.

En cuanto al alegato de la recurrente y su pretensión para la instalación de una fuente pública o suministro de agua a través de cisterna para proveer agua al amparado en virtud de su condición de vulnerabilidad, se advierte que esta Sala ha garantizado el acceso al agua potable mediante fuente pública, únicamente, en los casos en los que existe una suspensión del servicio de agua a favor del titular de un servicio formal y previamente otorgado, no así, en casos como el del amparado, a quien no se le suspendió ningún servicio, por cuanto no contaban con este (véanse en similar sentido las sentencias No. 2019-2957 de las 9:30 horas de 20 de febrero de 2019 y No. 2019-7175 de las 9:20 horas de 26 de abril de 2019).

Por ello, deberá la recurrente si a bien lo tiene, plantear sus inconformidades o reclamos ante las autoridades recurridas o en la vía jurisdiccional competente, vías en las cuales podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones. En consecuencia, el recurso es inadmisible y así se declara.

III. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se rechaza de plano el recurso.
