Case: 26-006928-0007-CO Decision No. 2026012372 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine twenty a.m. on April ten, two thousand twenty-six.

Amparo proceeding (recurso de amparo) processed under case no. 26-006928-0007-CO, filed by [Name 001], passport [Value 001], and [Name 002], identity card [Value 002], on behalf of [...], against the MUNICIPALITY OF MATINA.

Findings of Fact:

  1. 1By a written submission entered into the case file on February 26, 2026, the petitioners filed this amparo proceeding. They state that on October 9, 2025, they submitted a request to the Municipality of Matina, seeking the following: “(…) a complete copy of the technical, legal, and budgetary file for the public works project carried out by the Municipality of Matina, namely, the Mawamba suspension bridge over the Tortuguero canal leading to property number 7-00023408-000. The request includes the following documents: • Construction plan and georeferenced location. • Approved budget, funding source, and expenditure. • Environmental and construction permits and legal endorsements. • Technical, administrative, and functional justification for the project. • Authorization, tendering, contracting, or agreement records, if any. • Any other document supporting the legality and traceability of the project.(…)”. Subsequently, on October 31, 2025, they submitted another request to the Road Management Technical Unit of the Municipality of Matina, seeking the following: “(…) Request for the technical, legal, and environmental file concerning tree felling (tala de árboles), construction of a bridge, parking area, and dock on state-owned land—Mawamba Dock. (...)”. They add that the request was officially received by the Municipality of Matina at 09:47 a.m., according to the receipt stamp, but that no response or formal notice had been issued as of the filing date of this proceeding. Therefore, on November 20, 2025, they submitted a written reiteration of the request “(...) previously submitted on October 9, 2025 and October 31, 2025, concerning delivery of the technical, legal, budgetary, and environmental files related to the projects in question; it is hereby placed on record that, despite the formal requests made on the dates indicated, the municipality has remained administratively silent (silencio administrativo) (…)”.They complain that, as of the filing date of this proceeding, they had received no response to the aforementioned requests and consequently had not been given access to the requested material. They consider their fundamental rights to have been violated.
  2. 2By a decision issued at 15:03 on March 9, 2026, the Presidency of the Chamber admitted the proceeding for consideration and requested a report from the mayor and the head of the Road Management Technical Unit, both of the Municipality of Matina.
  3. 3In a written submission entered into the case file on March 19, 2026, Jehostin Arceyut Villagra, director of the Infrastructure and Urban Development Department of the Municipality of Matina, states: “FIRST: Based on a preliminary analysis, this representation considers the present proceeding inadmissible because no current, actual, and effective violation of fundamental rights subject to protection through this remedy has been established. The petitioner bases the claim on an alleged infringement of the right to property, asserting that the pedestrian bridge was installed within a property under the petitioner’s ownership. Nevertheless, as demonstrated below, that assertion lacks technical and legal support, thereby precluding the existence of a constitutional grievance. Likewise, the alleged failure to provide an administrative response does not, in this specific case, constitute an independent violation of fundamental rights, since the information concerning the project is documented in public administrative acts that are accessible and were duly processed in accordance with the legal system.It should be emphasized that the interest invoked by the petitioner rests on an incorrect premise, namely, the assumption that the infrastructure at issue is located within the petitioner’s property. However, according to the technical analysis conducted by this Administration, the bridge site is not located within established private property, but rather within public-domain property (bien de dominio público). This negates the legitimate interest required to bring an action before this jurisdiction and consequently results in a lack of substantive standing (legitimación material), because the petitioner does not hold a subjective right directly affected by the administrative action. SECOND: The administrative intervention at issue in this proceeding is duly supported by Agreement number 9 of the Municipal Council of Matina, adopted at Ordinary Session number 208 of November 17, 2022, which authorized the Mayor’s Office to arrange for the relocation of the Chumico pedestrian suspension bridge, including its transfer to areas such as Mawamba and Barbilla.That agreement reflects the lawful exercise of municipal authority in matters of cantonal planning and development, in accordance with the principle of municipal autonomy and the public interest that must guide administrative management. In that regard, the challenged action constitutes the implementation of a final administrative act (acto administrativo firme), duly reasoned and intended to meet collective needs. THIRD: It is legally relevant to clarify that the action undertaken does not constitute new construction, but rather the transfer and relocation of existing infrastructure, categorized as minor works (obra menor) because it is a pedestrian suspension crossing. This precludes any interpretation that a new unlawful occupation of the territory has occurred. This circumstance further supports the legality of the administrative action and demonstrates the efficient use of public resources for the benefit of the community.FOURTH: To verify the accuracy of the petitioner’s allegation, this Department conducted a technical cartographic analysis, taking into account the boundaries of the Maritime-Terrestrial Zone (Zona Marítimo Terrestre), the certification of the State’s Natural Heritage (Patrimonio Natural del Estado) issued by SINAC, and the georeferenced location of the structure. Consistent with the reasoning set forth above and pursuant to Articles 9 and 10 of Law No. 6043 and the elements presented, the analysis clearly establishes that the bridge is located within the fifty-meter public zone, which forms part of the state public domain, because the property invoked by the petitioner does not encompass the bridge site and merely marginally overlaps the restricted zone. Therefore, there is no encroachment upon or impairment of private property, but rather the lawful use of public-domain property. FIFTH: The technical plan submitted demonstrates that the infrastructure is located within setback or protection areas, which form part of the public domain, are subject to state regulation, and cannot be privately appropriated.Accordingly, the petitioner’s allegation lacks technical support because it seeks to characterize a legally public-domain area as private. SIXTH: The decision to relocate the bridge was based on public-interest considerations, in view of the hazardous conditions faced by communities such as Mawamba and Barbilla, all of which is documented in the municipal agreement cited above. Residents had to cross rivers under unsafe conditions, which justified the intervention as a necessary measure to protect the population’s life and physical integrity. In every respect, the solution adopted by this Administration is clearly appropriate because it provides residents with a safe crossing, given the absence of less burdensome alternatives, and is proportionate because it does not infringe the fundamental rights of third parties. All of the foregoing is duly supported by technical studies that also substantiate the structural feasibility of this type of infrastructure, as in the case of the Barbilla bridge (60 meters in length), which are included in the public procurement administrative file 2022CD-000171-002010000 and may be viewed and verified in the Public Procurement System.”.
  4. 4In a written submission added to the case file on March 19, 2026, Walter Céspedes Salazar, mayor of the Municipalidad de Matina, reports: “With regard to the amparo proceeding (recurso de amparo) being processed, I must place on record that, as of this date, my Office has not received any note or request whatsoever from the appellant, an observation that I leave for the Court’s consideration; nevertheless, in compliance with the notification order, I hereby submit a report based on the information forwarded by the Directorate of the AIDU (Área de Infraestructura y Desarrollo Urbano), specifically concerning the assertion that construction of the pedestrian bridge over the Canal Tortuguero was carried out within the property identified by survey plan 700170201973, based on the regulations in force and the cartographic information available to this Municipality. FIRST: For purposes of the analysis, a cartographic overlay was prepared showing the location of the pedestrian bridge together with the boundaries of the Maritime-Terrestrial Zone (Zona Marítimo Terrestre, ZMT) applicable to the sector, distinguishing the fifty-meter public zone (zona pública) from the one-hundred-and-fifty-meter restricted zone (zona restringida), both measured from the ordinary high-tide line (línea de pleamar ordinaria).This analysis was also conducted on the basis of the certification of the State Natural Heritage (Patrimonio Natural del Estado) within the ZMT of the canton of Matina issued by the Sistema Nacional de Áreas de Conservación. SECOND: Pursuant to Article 9 of Ley N.° 6043, Ley sobre la Zona Marítimo Terrestre, the ZMT is the strip two hundred meters wide along the coastlines; and pursuant to Article 10 thereof, that strip is divided into two sections: the public zone, comprising the first fifty meters, and the restricted zone, comprising the remaining one hundred and fifty meters. THIRD: Furthermore, Article 20 of the same law expressly provides that the public zone may not be occupied under any title and that it is dedicated to public use, particularly the free movement of persons. Article 22, in turn, provides that only such infrastructure and construction works as are approved in each case by the Ministerio de Obras Públicas y Transportes, the Instituto Costarricense de Turismo, the Instituto Nacional de Vivienda y Urbanismo, and the respective municipality may be developed in the public zone, having regard to the public use for which they are intended.For its part, Article 39 of Ley N° 6043 provides that concessions (concesiones) relating to the Zona Marítimo Terrestre may be granted only within the restricted zone. This distinction is legally relevant because it makes clear that the possible overlap of a survey plan or property with the one-hundred-and-fifty-meter strip does not, in itself, render the entire site eligible for concession or displace the public-domain regime (régimen demanial) and public use applicable to the fifty-meter strip. Regarding the Caribbean region and, specifically, the canal system of the province of Limón, Article 75 of Ley N° 6043 provides as follows: “The Junta de Administración Portuaria y de Desarrollo Económico de la Vertiente Atlántica shall retain ownership of the lands transferred to it pursuant to Article 41(b) of Ley N.° 5337 of August 27, 1973, except within the maritime-terrestrial zone on both sides of the main canal system connecting the ports of Moín and Barra del Colorado.In that zone, the provisions of this law shall apply with full force.” Consequently, on both sides of the main canal system—which includes the Canal Tortuguero in the sector under analysis—the legal regime established by the Ley sobre la Zona Marítimo Terrestre applies in full. FOURTH: Additionally, certification SINAC-ACLAC-DRFVS-PNE-C-0108-2025 expressly states that the study area used to determine the State Natural Heritage within the ZMT of the canton of Matina includes both banks of the Canal de Tortuguero; it further states that the boundaries of the PNE are shown in the digital files and attached maps that form an integral part of that certification. Based on the cartographic overlay prepared by this Administration, the pedestrian bridge appears to be located within the fifty-meter strip corresponding to the public zone of the Canal Tortuguero. Likewise, it appears that the property identified by survey plan 700170201973 does not encompass the bridge’s point of placement within its full boundaries, but merely overlaps the one-hundred-and-fifty-meter strip corresponding to the restricted zone.From this perspective, the allegation that the bridge was constructed within the property identified by survey plan 700170201973 is inconsistent with the cartographic overlay performed, since the structure’s point of placement is located within the public zone of the ZMT, while the cited survey plan extends only marginally into the adjacent restricted zone. FIFTH: In legal terms, this means that the location under analysis is subject to the special public-domain regime governing the Zona Marítimo Terrestre and, based on the cartographic information used, cannot be regarded as an occupation carried out on established private property. Rather, the analysis performed supports the conclusion that this is an intervention situated within an area of public use subject to the regime established by Ley N° 6043 and, in the case of the coastline and canals of Limón, to the full application of Article 75 thereof.In light of the foregoing, subject to any more authoritative technical opinion from the competent authorities and without prejudice to any additional assessment that may be warranted on the basis of administrative case files, cadastral survey plans, topographic studies, or supplementary land-registry certifications, this Directorate finds that the cartographic information analyzed does not establish that the pedestrian bridge over the Canal Tortuguero was constructed within the property identified by survey plan 700170201973; on the contrary, it shows that the bridge is located within the fifty-meter public zone and that the referenced survey plan overlaps only partially with the one-hundred-and-fifty-meter restricted zone. This report is hereby issued for the corresponding legal purposes, with the reference plan attached.”
  5. 5The legal requirements have been observed in the proceedings conducted.

Justice Castillo Víquez drafts the opinion; and,

Considerations:

I. PRELIMINARY MATTER

Although official Jehostin Arceyut Villagra, in his capacity as director of the Área de Infraestructura y Desarrollo Urbano of the Municipalidad de Matina, appeared to submit the requested report, it is nonetheless true that, in the order commencing these proceedings, the head of the Unidad Técnica de Gestión Vial of that local government was warned that the requested report had to be submitted personally.

In connection with the foregoing, the Chamber, in judgment n.° 03484-98 at 16:51 on May 27, 1998, ruled:

“I. Preliminary matter. The report submitted by Eduardo Acuña Castro in place of the co-respondent Ejecutivo Municipal de Pococí is inadmissible because it is procedurally improper. First, it should be noted that—in view of the liability arising from the report, which is deemed to have been given under oath—it may be submitted only personally (Articles 43, 55, and 45 of the Ley de la Jurisdicción Constitucional). Second, the aforementioned official lacks legal authority to delegate a power vested in him under the cited law. Consequently, the report is deemed not to have been submitted, and the Chamber shall decide the matter without further proceedings and solely on the basis of the evidence contained in the record.” In the matter under examination (sub examine), neither the mayor nor the director of the Área de Infraestructura y Desarrollo Urbano of the respondent municipality has identified any circumstance making it materially impossible (absence, incapacity, etc.) for the head of the Unidad Técnica de Gestión Vial to submit the report personally within the time limit established by this Court in the order commencing these proceedings; therefore, that omission is not deemed justified. Accordingly, pursuant to Article 45 of the Ley de la Jurisdicción Constitucional, the constitutionality of the matter shall be analyzed on the basis of the other evidence entered into the record.

II. SUBJECT MATTER OF THE PROCEEDING

The appellants allege that on October 9 and 31, 2025, they submitted requests for information to the respondent municipality; however, when the proceeding was filed, they had not received a response.

III. PROVEN FACTS

The following facts relevant to the determination of this matter are deemed duly established, either because they have been substantiated or because the respondent authority failed to address them as directed in the initial order:

  • a)On October 9, 2025, the Unidad Técnica de Gestión Vial of the respondent municipality received a request from the protected party (tutelado), [Nombre 001], seeking: “(…) a complete copy of the technical, legal, and budgetary case file for the public works project carried out by the Municipalidad de Matina, namely the Mawamba suspension bridge over the canal de Tortuguero leading to property number 7-00023408-000. The request includes the following documents: • Construction plans and georeferenced location. • Approved budget, source of funding, and expenditure. • Environmental and construction permits and legal endorsements. • Technical, administrative, and functional justification for the intervention. • Records of authorization, bidding, procurement, or any agreement, if such records exist. • Any other document supporting the legality and traceability of said project.” (Documentary evidence).
  • b)On October 31, 2026, the Unidad Técnica de Gestión Vial of the respondent municipality received a request from appellant [Nombre 001], seeking: “(…) Request for the technical, legal, and environmental case file concerning tree felling (tala de árboles), construction of a bridge, a parking area, and a dock on state-owned land—Embarcadero de Mawamba. (...)” (Documentary evidence).
  • c)The respondent authority was notified of the order commencing these proceedings on March 16, 2026. (Notices of service added to the case file).

IV. UNPROVEN FACT

It is deemed unproven, as relevant to the determination of this matter, that the respondent authority addressed the requests submitted and provided the applicants with the requested information.

V. THE SPECIFIC CASE

In the matter at hand (sub lite), the appellants allege that on October 9 and 31, 2025, they submitted requests for information to the respondent municipality; however, when the proceeding was filed, they had not received a response.

The examination of the court record (autos) establishes that, on 9 de octubre de 2025, the Road Management Technical Unit (Unidad Técnica de Gestión Vial) of the respondent municipality received a request from the protected party [Nombre 001], in which he requested: “(…) a complete copy of the technical, legal, and budgetary case file for the public works project carried out by the Municipalidad de Matina, specifically the Mawamba suspension bridge over the Tortuguero canal leading to property number 7-00023408-000. The request includes the following documents: • Construction plans and georeferenced location. • Approved budget, source of financing, and budget execution. • Environmental and construction permits, and legal endorsements. • Technical, administrative, and functional justification for the intervention. • Authorization, bidding, contracting, or agreement records, if any. • Any other document supporting the legality and traceability of said project.” On 31 de octubre de 2026, the Road Management Technical Unit of the respondent municipality received a request from the petitioner (recurrente) [Nombre 001], in which he requested: “(…) Request for the technical, legal, and environmental case file concerning the felling of trees, construction of a bridge, parking area, and dock on State-owned land—Embarcadero de Mawamba.

(...)” The respondent authority was served with notice of the order admitting these proceedings (resolución de curso) on 16 de marzo de 2026. Moreover, it has not been established that the respondent authority addressed the requests filed or provided the applicants with the requested information.

Against this background, the violation of the protected party’s fundamental rights has been established.

In this regard, the court record does not show that the respondent municipality formally addressed the requests filed or provided the applicants with the requested information. Accordingly, in their report, the respondents merely justify the installation of a pedestrian bridge; however, they do not demonstrate that they responded to or provided the requested information, which is precisely the subject matter of the case under consideration (sub iudice).

Therefore, the petition is granted, under the terms set forth in the operative portion (parte dispositiva) of this judgment.

VI. JUSTICE RUEDA LEAL DISSENTS AND SUMMARILY DISMISSES THE PETITION

I maintain that this matter must be summarily dismissed because the petitioner filed the amparo petition (recurso de amparo) on behalf of a legal entity (persona jurídica). Of relevance to the matter under examination (sub examine), in the dissenting opinion (voto salvado) that I entered in judgment no. 2019-2355 at 9:30 on 12 de febrero de 2019, I stated:

“In Advisory Opinion 22-16 of 26 de febrero de 2016, the Inter-American Court of Human Rights indicated that, although some States recognize the right of petition (derecho de petición) of legal entities subject to special conditions, such as trade unions, political parties, or representatives of Indigenous peoples, Afro-descendant communities, or specific groups, the fact remains that ‘Article 1.2 of the American Convention recognizes rights only in favor of natural persons, and therefore legal entities are not holders of the rights enshrined in that treaty.’ Furthermore, in the same advisory opinion, the Inter-American Court held that, in certain particular contexts, natural persons may exercise their rights through legal entities (for example, through a media outlet, as occurred in Granier et al. v. Venezuela); nevertheless, for such rights to be protected under the inter-American system, ‘the exercise of the right through a legal entity must involve an essential and direct relationship between the natural person requiring protection from the inter-American system and the legal entity through which the violation occurred, since a mere connection between the two persons is insufficient to conclude that the rights of natural persons, rather than those of legal entities, are in fact being protected.

Indeed, more than the natural person’s mere participation in the legal entity’s activities must be proven; that participation must be substantially related to the rights alleged to have been violated.’ (emphasis added) (OC. 22/16).” In my view, a reading of the Ley de la Jurisdicción Constitucional requires the same rationale (ratio) under the foregoing treaty-based interpretation (hermenéutica convencional) with respect to every fundamental right. Thus, in constitutional proceedings (proceso de constitucionalidad) brought on behalf of a legal entity, admissibility for review requires an essential and direct relationship between the legal entity alleging that it has been affected by a violation of the constitutional order and the natural person whose fundamental right is thereby impaired indirectly but directly. For these purposes, a mere reference to a connection or link between the legal entity and the natural person is insufficient to infer that the constitutional proceedings are specifically seeking to safeguard the fundamental rights of the latter, rather than merely those of the former.

The foregoing requirement therefore constitutes an indispensable prerequisite (presupuesto sine qua non) for the admissibility of constitutional review (control de constitucionalidad) by this jurisdiction. Based on the foregoing, I conclude that this must be the standard under which the Ley de la Jurisdicción Constitucional is interpreted, such that constitutional judicial review (control jurisdiccional de constitucionalidad) is inadmissible in the case under consideration because, based on the evidence in the court record, no essential connection has been demonstrated between the protected legal entity and any particular natural person with respect to the right allegedly infringed.

VII. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are hereby advised that, if they have submitted any paper document, objects, or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, these must be retrieved within a maximum period of 30 business days from service of this judgment. They are advised that any material not collected within that period will be destroyed pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial" (approved by the Corte Plena in Article XXVI of session no. 27-11 of 22 de agosto de 2011 and published in Boletín Judicial no. 19 of 26 de enero de 2012) and Article LXXXI of session no. 43-12 of the Consejo Superior del Poder Judicial of 3 de mayo de 2012.

Por tanto:

The petition is granted. Walter Céspedes Salazar, Mayor of the Municipalidad de Matina, or whoever holds that office, as well as whoever serves as head of the Road Management Technical Unit of that same local government, are ordered to issue the appropriate instructions, undertake the corresponding coordination, and carry out all actions within the scope of their respective authority so that, within a maximum period of THREE DAYS from service of this judgment, the requests filed by the protected party on 9 and 31 de octubre de 2025 are addressed and the requested information is provided through the means designated for that purpose. The foregoing is ordered subject to the withholding of any sensitive and restricted-access data protected by the Ley de Protección de la Persona frente al Tratamiento de sus Datos Personales and other applicable legislation, should any such data exist. The respondent authority is advised that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in amparo proceedings that must be complied with or enforced, and who fails to comply with or enforce it, shall be punished by imprisonment for three months to two years or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.

The Municipalidad de Matina is ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment before the contentious-administrative jurisdiction (vía contencioso-administrativa). Justice Rueda Leal dissents and summarily dismisses the petition. Let notice be served.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del diez de abril de dos mil veintiseis .

Recurso de amparo que se tramita en el expediente nro. 26-006928-0007-CO, interpuesto por [Nombre 001], pasaporte [Valor 001] y [Nombre 002], cédula de identidad [Valor 002], a favor de [...], contra la MUNICIPALIDAD DE MATINA.

Resultando:

  1. 1Por escrito incorporado al expediente el 26 de febrero de 2026, los accionantes interponen recurso de amparo. Manifiestan que el 9 de octubre de 2025 plantearon gestión ante la Municipalidad de Matina, mediante la cual solicitaron lo siguiente: “(…) copia completa al expediente técnico, legal y presupuestario de la obra pública ejecutada por la Municipalidad de Matina, obra, puente colgante de Mawamba sobre el canal de Tortuguero a la finca número 7-00023408-000. La solicitud incluye los siguientes documentos: • Plano constructivo y ubicación georreferenciada. • Presupuesto aprobado, fuente de financiamiento y ejecución. • Permisos ambientales, constructivos y refrendos legales. • Justificación técnica, administrativa y funcional de la intervención. • Actas de autorización, licitación, contratación o convenio si existieran. • Cualquier otro documento que respalde la legalidad y trazabilidad de dicha obra.(…)”. Posteriormente, el 31 de octubre de 2025 plantearon otra gestión ante la Unidad Técnica de Gestión Vial de la Municipalidad de Matina, mediante la cual solicitaron lo siguiente: “(…) Solicitud de expediente técnico, legal y ambiental sobre tala de árboles, construcción de un Puente, parqueo y un embarcadero en terrenos estatales - Embarcadero de Mawamba. (...)". Agregan que la gestión fue recibida oficialmente por la Municipalidad de Matina a las 09:47 a.m., según sello de recepción, sin que a la fecha de interposición de este recurso se emitiera respuesta, ni notificación formal. Por ello el 20 de noviembre de 2025, plantearon escrito de reiteración de solicitud; “(...) previamente presentada en fechas 9 de octubre de 2025 y 31 de octubre de 2025, relativa a la entrega de los expedientes técnico, legal, presupuestario y ambiental vinculados a proyectos en cuestión, se hace constar que, pese a las solicitudes formales realizadas en las fechas indicadas, la municipalidad ha guardado silencio administrativo (…)”.Reclaman que a la fecha de interposición de este recurso no se les ha dado respuesta a las gestiones señaladas, y por ello no han tenido acceso a lo solicitado. Estiman lesionados sus derechos fundamentales.
  2. 2Mediante resolución de las 15:03 horas de 9 de marzo de 2026, la Presidencia de la Sala le dio curso al proceso y le solicitó informe al alcalde y al jefe de la Unidad Técnica de Gestión Vial, ambos de la municipalidad de Matina.
  3. 3Por escrito incorporado al expediente el 19 de marzo de 2026, Jehostin Arceyut Villagra, director del Área de Infraestructura y Desarrollo Urbano de la Municipalidad de Matina, expone: “PRIMERO: Desde un análisis preliminar, esta representación estima que el presente recurso deviene improcedente, por cuanto no se acredita la existencia de una lesión actual, real y efectiva a derechos fundamentales tutelables en esta vía. La parte recurrente fundamenta su pretensión en una supuesta afectación a su derecho de propiedad, alegando que la instalación del puente peatonal se realizó dentro de una finca de su titularidad. No obstante, como se demostrará infra, tal afirmación carece de sustento técnico y jurídico, lo que excluye la existencia de agravio constitucional. Asimismo, la alegada omisión de respuesta administrativa no configura, en el caso concreto, una vulneración autónoma de derechos fundamentales, en tanto la información relativa al proyecto se encuentra respaldada en actos administrativos públicos, accesibles y debidamente tramitados conforme al ordenamiento jurídico.Debe destacarse que el interés invocado por la parte recurrente parte de una premisa incorrecta, al asumir que la infraestructura cuestionada se ubica dentro de su esfera patrimonial, sin embargo, conforme al análisis técnico efectuado por esta Administración, el sitio de emplazamiento del puente no se encuentra dentro de propiedad privada consolidada, sino dentro de un bien de dominio público, lo cual desvirtúa el interés legítimo necesario para accionar en esta jurisdicción, teniendo en consecuencia, una falta de legitimación material, en tanto el recurrente no ostenta un derecho subjetivo afectado directamente por la actuación administrativa. SEGUNDO: La intervención administrativa objeto del presente recurso se encuentra debidamente respaldada en el acuerdo número 9 del Concejo Municipal de Matina, adoptado en Sesión Ordinaria número 208 del 17 de noviembre de 2022, mediante el cual se autorizó a la Alcaldía a gestionar la reubicación del puente peatonal colgante de Chumico, incluyendo su traslado a sectores como Mawamba y Barbilla .Dicho acuerdo responde al ejercicio legítimo de las competencias municipales en materia de planificación y desarrollo cantonal, conforme al principio de autonomía municipal y al interés público que debe orientar la gestión administrativa, y en ese sentido, la actuación cuestionada constituye la ejecución de un acto administrativo firme, debidamente motivado y orientado a satisfacer necesidades colectivas. TERCERO: Resulta jurídicamente relevante precisar que la actuación realizada no corresponde a una obra nueva, sino a un traslado y reubicación de infraestructura existente, categorizado como obra menor al ser un paso peatonal colgante, lo cual excluye la interpretación de que se haya generado una nueva ocupación irregular del territorio. Esta circunstancia refuerza la legalidad de la actuación administrativa y evidencia la optimización de recursos públicos en beneficio de la colectividad.CUARTO: Con el fin de verificar la veracidad del alegato del recurrente, esta Dirección realizó un análisis técnico-cartográfico, considerando la delimitación de la Zona Marítimo Terrestre, la certificación del Patrimonio Natural del Estado emitida por SINAC y la ubicación georreferenciada de la estructura. En la línea de pensamiento expuesta y de conformidad con los artículos 9 y 10 de la Ley N.° 6043 y los elementos expuestos, y del análisis efectuado permite concluir claramente que el puente se ubica dentro de la zona pública de cincuenta metros, correspondiente al dominio público estatal., toda vez que la finca invocada por el recurrente no comprende el sitio de emplazamiento, presentando únicamente un traslape marginal con la zona restringida, por lo que no existe una invasión ni afectación a propiedad privada, sino el uso legítimo de un bien demanial. QUINTO: El plano técnico aportado evidencia que la infraestructura se ubica dentro de áreas de retiro o protección, las cuales forman parte del dominio público, se encuentran sujetas a regulación estatal y no son susceptibles de apropiación privada.Así las cosas, el alegato del recurrente carece de sustento técnico, al pretender atribuir naturaleza privada a un espacio jurídicamente demanial. SEXTO: Que la decisión de reubicar el puente responde a criterios de interés público, en atención a las condiciones de riesgo que enfrentaban comunidades como Mawamba y Barbilla, todo lo cual consta en el acuerdo municipal mencionado supra, los habitantes debían cruzar ríos en condiciones inseguras, lo que justificó la intervención como una medida necesaria para proteger la vida e integridad física de la población, todo lo cual y a todas luces la solución adoptada por esta Administración resulta idónea, al permitir un cruce seguro para los habitantes, ante la inexistencia de alternativas menos lesivas y proporcional, a la no afectación de derechos fundamentales de terceros, todo lo anterior debidamente respaldado por estudios técnicos respaldan además la viabilidad estructural de este tipo de infraestructura, como en el caso del puente de Barbilla (60 metros de longitud), los cuales constan en el expediente administración de la contratación pública 2022CD-000171-002010000, visible y constatable en el Sistema de Compras Públicas.”.
  4. 4Por escrito incorporado al expediente el 19 de marzo de 2026, Walter Céspedes Salazar, alcalde de la Municipalidad de Matina, informa: “En atención al recurso de amparo tramitado, debo dejar constancia que a la fecha mi Despacho no ha recibido nota o solicitud alguna por parte del recurrente, lo cual dejo a consideración del Tribunal la observación, empero en cumplimiento de la resolución de notificación, procedo a rendir informe conforme a la información remitida por la Dirección de la AIDU (Área de Infraestructura y Desarrollo Urbano) y específicamente en cuanto al señalamiento de que la construcción del puente peatonal sobre el Canal Tortuguero se habría realizado dentro de la finca plano 700170201973, con fundamento en la normativa vigente y en la información cartográfica disponible para esta Municipalidad. PRIMERO: Para efectos del análisis, se realizó el montaje cartográfico de la ubicación del puente peatonal con la delimitación de la Zona Marítimo Terrestre aplicable al sector, distinguiendo la zona pública de cincuenta metros y la zona restringida de ciento cincuenta metros, ambas medidas a partir de la línea de pleamar ordinaria.Dicho análisis se efectuó además sobre la base de la certificación del Patrimonio Natural del Estado en la ZMT del cantón de Matina emitida por el Sistema Nacional de Áreas de Conservación. SGUNDO: De conformidad con el artículo 9 de la Ley N.° 6043, Ley sobre la Zona Marítimo Terrestre, la ZMT corresponde a la franja de doscientos metros de ancho a lo largo de los litorales; y conforme a su artículo 10, esa franja se divide en dos secciones: la zona pública, equivalente a los primeros cincuenta metros, y la zona restringida, constituida por los ciento cincuenta metros restantes. TERCERO: Asimismo, el artículo 20 de la misma ley establece expresamente que la zona pública no puede ser objeto de ocupación bajo ningún título y que está dedicada al uso público, particularmente al libre tránsito de las personas. A su vez, el artículo 22 dispone que en la zona pública únicamente se permitirá el desarrollo de obras de infraestructura y construcción que, en cada caso, aprueben el Ministerio de Obras Públicas y Transportes, el Instituto Costarricense de Turismo, el Instituto Nacional de Vivienda y Urbanismo y la respectiva municipalidad, atendiendo al uso público al que se destinen.Por su parte, el artículo 39 de la Ley N° 6043 dispone que solamente en la zona restringida podrán otorgarse concesiones referentes a la Zona Marítimo Terrestre. Esta distinción resulta jurídicamente relevante, pues permite advertir que la eventual superposición de un plano o finca con la franja de ciento cincuenta metros no convierte, por sí misma, la totalidad del sitio en un ámbito concesionable ni desplaza el régimen demanial y de uso público de la franja de cincuenta metros. En lo atinente a la vertiente Caribe y, concretamente, al sistema de canales de la provincia de Limón, el artículo 75 de la Ley N° 6043 establece lo siguiente: “La Junta de Administración Portuaria y de Desarrollo Económico de la Vertiente Atlántica continuará con el dominio sobre los terrenos que le fueron traspasados en virtud del artículo 41, inciso b) de la ley N.° 5337 de 27 de agosto de 1973, excepto en la zona marítimo terrestre correspondiente a ambos lados del sistema de canales principales que unen los puertos de Moín y Barra del Colorado.En esa zona regirán con pleno vigor las estipulaciones de esta ley”. En consecuencia, en ambos lados del sistema de canales principales -dentro del cual se enmarca el Canal Tortuguero en el sector analizado- rige plenamente el régimen jurídico de la Ley sobre la Zona Marítimo Terrestre. CUARTO: Adicionalmente, la certificación SINAC-ACLAC-DRFVS-PNE-C-0108-2025 indica expresamente que el área de estudio para determinar el Patrimonio Natural del Estado en la ZMT del cantón de Matina comprende ambos márgenes del Canal de Tortuguero; además, señala que la delimitación del PNE se visualiza en los archivos digitales y mapas anexos que forman parte integral de dicha certificación. Con base en el montaje cartográfico realizado por esta Administración, se observa que la ubicación del puente peatonal se sitúa dentro de la franja de cincuenta metros correspondiente a la zona pública del Canal Tortuguero.Del mismo modo, se aprecia que la finca identificada con plano 700170201973 no comprende el punto de implantación del puente dentro de su ámbito pleno, sino que apenas presenta traslape con la franja de ciento cincuenta metros correspondiente a la zona restringida. Desde esa perspectiva, el alegato según el cual el puente fue construido dentro de la finca plano 700170201973 no resulta consistente con la superposición cartográfica efectuada, ya que el punto de emplazamiento de la estructura se localiza en la zona pública de la ZMT, mientras que el citado plano únicamente alcanza de manera marginal la zona restringida adyacente. QUINTO: En términos jurídicos, ello implica que la ubicación analizada se encuentra sometida al régimen especial de dominio público de la Zona Marítimo Terrestre y no puede entenderse, con base en la información cartográfica utilizada, como una ocupación ejecutada en propiedad privada consolidada.Antes bien, el análisis practicado permite afirmar que se trata de una intervención emplazada en un ámbito de uso público sujeto al régimen de la Ley N° 6043 y, en el caso del litoral y canales de Limón, con plena aplicación de su artículo 75. Por lo anterior, salvo mejor criterio técnico de las autoridades competentes y sin perjuicio de cualquier valoración adicional que proceda con base en expedientes administrativos, planos catastrados, estudios topográficos o certificaciones registrales complementarias, esta Dirección estima que la información cartográfica analizada no acredita que el puente peatonal sobre el Canal Tortuguero haya sido construido dentro de la finca plano 700170201973; por el contrario, evidencia que su ubicación corresponde a la zona pública de cincuenta metros y que el referido plano apenas traslapa parcialmente con la zona restringida de ciento cincuenta metros. Se deja así extendido el informe, para los fines legales correspondientes, adjuntando el plano de referencia.”.
  5. 5En los procedimientos seguidos se han observado las prescripciones legales.

Redacta el Magistrado Castillo Víquez; y,

Considerando:

I. CUESTIÓN PRELIMINAR

Aun cuando el funcionario Jehostin Arceyut Villagra, en su condición de director del Área de Infraestructura y Desarrollo Urbano de la Municipalidad de Matina se apersonó a rendir el informe solicitado, no menos cierto es que, en la resolución de curso de este proceso, se le apercibió al jefe de la Unidad Técnica de Gestión Vial de ese gobierno localque el informe solicitado debía ser rendido de forma personal.

Atinente a lo anterior, la Sala, en la sentencia n.° 03484-98 de las 16:51 horas de 27 de mayo de 1998, resolvió:

“I. Asunto previo. No se admite, por improcedente, el informe que rinde Eduardo Acuña Castro en lugar del correcurrido Ejecutivo Municipal de Pococí. En primer término, cabe señalar que –en virtud de la responsabilidad que deriva del informe, el cual se tiene dado bajo juramento– no es admisible rendirlo más que personalmente (artículos 43, 55 y 45 de la Ley de la Jurisdicción Constitucional). En segundo lugar, el citado funcionario carece de competencia legal para delegar una competencia que le es propia, conforme a la citada ley. En consecuencia, se le tiene por no aportado y procede la Sala a resolver el asunto sin otro trámite y únicamente a partir de los elementos de juicio que constan en los autos”.

Ahora bien, en sub examine, el alcalde y el director el Área de Infraestructura y Desarrollo Urbano de la municipalidad accionada no exponen alguna situación de imposibilidad material (ausencia, incapacidad, etc.) por parte del jefe de la Unidad Técnica de Gestión Vial, que de alguna manera le haya impedido rendir el informe de manera personal, dentro del plazo fijado por este Tribunal en la resolución de curso de este proceso, de ahí que no se tenga por justificada tal omisión. Así las cosas, de conformidad con el artículo 45 de la Ley de la Jurisdicción Constitucional, se procede a analizar la constitucionalidad del asunto con base en los demás elementos aportados a los autos.

II. OBJETO DEL RECURSO

Los recurrentes alegan que el 9 y el 31 de octubre de 2025 plantearon solicitudes de información ante la municipalidad accionada; empero, al momento de interposición del recurso no habían obtenido respuesta.

III. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos, según lo prevenido en el auto inicial:

  • a)El 9 de octubre de 2025, la Unidad Técnica de Gestión Vial de la municipalidad accionada recibió una gestión del tutelado [Nombre 001], en la que solicitó: “(…) copia completa al expediente técnico, legal y presupuestario de la obra pública ejecutada por la Municipalidad de Matina, obra, puente colgante de Mawamba sobre el canal de Tortuguero a la finca número 7-00023408-000. La solicitud incluye los siguientes documentos: • Plano constructivo y ubicación georreferenciada. • Presupuesto aprobado, fuente de financiamiento y ejecución. • Permisos ambientales, constructivos y refrendos legales. • Justificación técnica, administrativa y funcional de la intervención. • Actas de autorización, licitación, contratación o convenio si existieran. • Cualquier otro documento que respalde la legalidad y trazabilidad de dicha obra.”. (Prueba documental).
  • b)El 31 de octubre de 2026, la Unidad Técnica de Gestión Vial de la municipalidad accionada recibió una gestión del recurrente [Nombre 001], en la que requirió: “(…) Solicitud de expediente técnico, legal y ambiental sobre tala de árboles, construcción de un Puente, parqueo y un embarcadero en terrenos estatales - Embarcadero de Mawamba. (...)". (Prueba documental).
  • c)La autoridad recurrida fue notificada de la resolución de curso de este proceso el 16 de marzo de 2026. (Actas de notificación agregadas al expediente).

IV. HECHO NO PROBADO

De importancia para la decisión de este asunto, se estima como no demostrado que la autoridad accionada haya atendido las gestiones incoadas y les haya proporcionado a los petentes la información requerida.

V. SOBRE EL CASO CONCRETO

En el sub lite, los recurrentes alegan que el 9 y el 31 de octubre de 2025 plantearon solicitudes de información ante la municipalidad accionada; empero, al momento de interposición del recurso no habían obtenido respuesta.

Del estudio de los autos se tiene por demostrado, que, el 9 de octubre de 2025, la Unidad Técnica de Gestión Vial de la municipalidad accionada recibió una gestión del tutelado [Nombre 001], en la que solicitó: “(…) copia completa al expediente técnico, legal y presupuestario de la obra pública ejecutada por la Municipalidad de Matina, obra, puente colgante de Mawamba sobre el canal de Tortuguero a la finca número 7-00023408-000. La solicitud incluye los siguientes documentos: • Plano constructivo y ubicación georreferenciada. • Presupuesto aprobado, fuente de financiamiento y ejecución. • Permisos ambientales, constructivos y refrendos legales. • Justificación técnica, administrativa y funcional de la intervención. • Actas de autorización, licitación, contratación o convenio si existieran. • Cualquier otro documento que respalde la legalidad y trazabilidad de dicha obra.”. El 31 de octubre de 2026, la Unidad Técnica de Gestión Vial de la municipalidad accionada recibió una gestión del recurrente [Nombre 001], en la que requirió: “(…) Solicitud de expediente técnico, legal y ambiental sobre tala de árboles, construcción de un Puente, parqueo y un embarcadero en terrenos estatales - Embarcadero de Mawamba.

(...)". La autoridad recurrida fue notificada de la resolución de curso de este proceso el 16 de marzo de 2026. Por su parte, no se tiene por demostrado que la autoridad accionada haya atendido las gestiones incoadas y les haya proporcionado a los petentes la información requerida.

Desde este panorama se acredita el quebranto a los derechos fundamentales de la parte tutelada.

Al respecto, de los autos no se desprende que la municipalidad accionada haya atendido formalmente las gestiones incoadas ni que haya brindado a los petentes la información solicitada. En ese tanto, en su informe los recurridos se limitan a justificar la instalación de un puente peatonal; sin embargo, no demuestran haber contestado ni proporcionado la información requerida, que justamente es el objeto del sub iudice.

Ergo, se declara con lugar el recurso, en los términos que se indican en la parte dispositiva de este pronunciamiento.

VI. EL MAGISTRADO RUEDA LEAL SALVA EL VOTO Y RECHAZA DE PLANO EL RECURSO

Sostengo que este asunto se debe rechazar de plano, por cuanto la parte accionante plantea el recurso de amparo a favor de una persona jurídica. De importancia para el sub examine, en el voto salvado que consigné en la sentencia nro. 2019-2355 de las 9:30 horas de 12 de febrero de 2019 sostuve:

“en la Opinión Consultiva 22-16 del 26 de febrero de 2016, la Corte Interamericana de Derechos Humanos indicó que si bien algunos Estados reconocen el derecho de petición a personas jurídicas con condiciones especiales, como lo son los sindicatos, partidos políticos o representantes de pueblos indígenas, comunidades afrodescendientes o grupos específicos, lo cierto es que “El artículo 1.2 de la Convención Americana sólo consagra derechos a favor de personas físicas, por lo que las personas jurídicas no son titulares de los derechos consagrados en dicho tratado”. Por otro lado, en la misma opinión consultiva, la Corte Interamericana dispuso que, en ciertos contextos particulares, las personas físicas pueden llegar a ejercer sus derechos a través de personas jurídicas (verbigracia, a través de un medio de comunicación, como acaeció en el caso Granier y otros contra Venezuela); empero, a efectos de que ello sea tutelable ante el sistema interamericano, “el ejercicio del derecho a través de una persona jurídica debe involucrar una relación esencial y directa entre la persona natural que requiere protección por parte del sistema interamericano y la persona jurídica a través de la cual se produjo la violación, por cuanto no es suficiente con un simple vínculo entre ambas personas para concluir que efectivamente se están protegiendo los derechos de personas físicas y no de las personas jurídicas.

En efecto, se debe probar más allá de la simple participación de la persona natural en las actividades propias de la persona jurídica, de forma que dicha participación se relacione de manera sustancial con los derechos alegados como vulnerados.” (énfasis agregado) (OC. 22/16)”.

En mi criterio, la lectura de la Ley de la Jurisdicción Constitucional obliga a la misma ratio de la hermenéutica convencional supracitada respecto a todo derecho fundamental. Así, en un proceso de constitucionalidad formulado a favor de una persona jurídica, su admisión para estudio exige una relación esencial y directa entre la persona jurídica que aduce verse afectada por alguna vulneración al orden constitucional y la persona natural que por tal lesión viene a ver menoscabado, de forma refleja pero directa, algún derecho fundamental. Ahora, para tales efectos es insuficiente la mera referencia a una conexión o vínculo entre la persona jurídica y la natural para poder colegir que, precisamente, por medio del proceso de constitucionalidad se esté procurando el resguardo de los derechos fundamentales de la última, no meramente los de la primera. El requerimiento antedicho deviene entonces un presupuesto sine qua non para la procedencia del control de constitucionalidad por parte de esta jurisdicción.

A partir de lo expuesto, colijo que esta debe ser la pauta con que se debe interpretar la Ley de la Jurisdicción Constitucional, de manera que en el sub iudice deviene improcedente la aplicación del control jurisdiccional de constitucionalidad, puesto que, con base en la prueba que consta en autos, no se ha demostrado el vínculo esencial entre la persona jurídica amparada y alguna natural, de modo específico, en relación con el presunto derecho agraviado.

VII. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que, de haber aportado algún documento en papel u objetos o pruebas contenidos en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados en un plazo máximo de 30 días hábiles, contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo material que no sea recogido dentro de ese lapso, con base en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial" (aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 de 22 de agosto de 2011 y publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012) y en el artículo LXXXI de la sesión del Consejo Superior del Poder Judicial nro. 43-12 de 3 de mayo de 2012.

Por tanto:

Se declara con lugar el recurso. Se ordena a Walter Céspedes Salazar, alcalde de la Municipalidad de Matina, o a quien ocupe ese cargo, así como a quien ejerza el puesto de jefe de la Unidad Técnica de Gestión Vial de ese mismo gobierno local, que giren las órdenes pertinentes, coordinen lo correspondiente y lleven a cabo todas las actuaciones que estén dentro del ámbito de sus competencias respectivas para que, dentro del plazo máximo de TRES DÍAS, contado a partir de la notificación de esta sentencia, se atiendan las gestión incoadas por la parte tutelada el 9 y 31 de octubre de 2025, y se les brinde la información solicitada al medio señalado para tales efectos. Lo anterior se dispone con la advertencia de reservar los datos sensibles y de acceso restringido, protegidos por la Ley de Protección de la Persona frente al Tratamiento de sus Datos Personales y demás normativa atinente, en caso de haberlos.

Se advierte a la autoridad recurrida, que de acuerdo con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Matina al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de la vía contencioso-administrativa. El magistrado Rueda Leal salva el voto y rechaza de plano el recurso. Notifíquese.
