Document Review Decision No. 2026009981 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, a las nueve horas veinte minutos del veinte de marzo de dos mil veintiseis .
Petition for constitutional relief processed under case number 25-035171-0007-CO, filed by [Name 001], identity card [Value 001], against the MUNICIPALITY OF ALAJUELA and the NATIONAL ROADWAY COUNCIL (CONAVI).
BACKGROUND:
Nevertheless, an inspection was conducted on Vistas de la Pradera Street, where there is a stormwater drainage system (sistema pluvial) that requires intervention to improve the management of stormwater runoff (aguas pluviales) from the roadway, in order to improve current conditions and preserve the road. The budget for this exceeds the capacity to carry out the work through ordinary operations, a situation known to the petitioner given the evidence that he himself submitted. Nevertheless, we must clarify to the Chamber that municipalities are dependent on budgetary matters, which entails an extensive process of budgeting, contracting, and awarding projects generally; therefore, consideration must also be given to the time frames involved in completing budgeting processes or even public procurement (contratación administrativa), the corresponding tendering procedures (licitación), and everything they entail.
Said intervention would be limited to the roadway’s stormwater runoff and improvements thereto, since the road has deficiencies with respect to surface runoff (escorrentía superficial), as stated in report N° CNEUIAR-INF-1541-2024. It is important to mention, however, that the affected properties are located in the block along avenida 1, whose northern boundary adjoins property N° 0363695, which is privately owned land measuring 6.566,16m². Said property could produce a volume exceeding 100.000 liters of water within a period of 10 minutes during a medium-to-high-intensity event, which could clearly cause substantial soil saturation and instability. The technical report issued by the professional in charge explained that, due to its area and slope, the land generates a fairly high flow rate (caudal), which may cause material to be swept away and substantial seepage into adjoining properties; however, this is a situation between owners of private properties and, legally and within the powers of the Municipalidad de Alajuela, is considered a matter between third parties, since we have no legal authority to intervene in situations of this nature.
Regarding proceeding N° 55359-2024, filed by the petitioner, it was presented to the Municipality in a different manner; it even contains the images that served as the basis for our analysis, which bear no relation to the matters set forth in the report of the Comisión Nacional de Emergencias or in this amparo proceeding (Recurso de Amparo). In light of the foregoing, the Chamber must clearly understand that the Sewerage Activity (Actividad de Alcantarillado) concerns improvements to stormwater channeling (canalización pluvial) on public roads, whereas the petitioner describes situations that, as already noted, arise between private properties. The foregoing establishes that the petitioner cannot allege any omission or inaction by the municipality, since the area is being addressed with respect to stormwater runoff from the street and improvements thereto; however, it is clear that private property not belonging to this Municipality is also involved, and the Administration therefore bears no responsibility in this regard.
In light of the foregoing, this Municipality does not understand why this amparo proceeding was filed in the terms stated, since there are no applications awaiting a response. Not only did it respond promptly to the application filed, but it is also appropriate to recall what the Constitutional Chamber itself has stated regarding the right of petition (derecho de petición): the right established in Article 27 of the Political Constitution refers to every citizen’s authority to address, in writing, any public official or government entity in order to present a matter of interest. That guarantee is supplemented by the right to receive a prompt response, but the latter does not mean a favorable response; in other words, what is guaranteed is the right to request, not the right to obtain what is requested, even though the public official must decide in strict accordance with the law, since freedom of petition is founded on another principle—namely, that the Administration may not restrict the right of governed persons to address public bodies.
This Municipality must point out that, even if the petitioner disagrees with the responses given, the truth is that his assertions merely reveal his dissatisfaction, discomfort, and even complete lack of knowledge regarding how this municipal entity operates and its respective powers, particularly considering that the matters stated in the proceeding filed with the Municipality bore no relation to those being adjudicated in this proceeding. Nevertheless, the petitioner decided to file this amparo proceeding to create confusion and have this Municipality found liable for alleged “inaction,” by complaining of a problem that was not caused by inaction on the Municipality’s part but also involves private property. Nevertheless, it has been shown that there has been no omission or “inaction” by the Municipality; rather, his subjective arguments reveal a clear lack of knowledge regarding the internal administrative procedures to be followed by this Municipality, procedures intended to comply with the applicable legal requirements while respecting the powers of each corresponding entity.
In this matter, the petitioner cannot claim that no response has been provided or that the Administration has failed to act on any application; however, it is clear and apparent that the petitioner disagrees with the terms of the response or, rather, it could be considered bad faith to state that he filed an application with the municipality in one set of terms while filing administrative applications in different terms. Nevertheless, it has been shown that our actions are fully consistent with the principle of legality (legalidad), and it is clear that the petitioner is without merit. In any event, the Municipality’s statements are corroborated by the evidence submitted, which shows that the Municipality has always acted within its authority. It has been demonstrated that the Municipalidad de Alajuela has acted diligently and performed the duties pertaining to its authority; nevertheless, we reiterate that the petitioner filed the amparo proceeding to create confusion, even omitting details from his subjective arguments, so that the Municipality would be found liable for inaction or omission even though it is taking all measures within its authority.
Based on the foregoing, we consider that the petitioner and the protected party (amparado) acted in bad faith by filing an amparo proceeding in the terms stated. The petitioner’s assertions that the problem occurring at that location resulted from some form of negligence or omission by this Municipality are without merit. In light of the foregoing, this Municipality considers that it has acted in accordance with the regulations currently in force and that there has been no inaction or violation of constitutional rights; nevertheless, we consider that the petitioners filed this proceeding in an attempt to misrepresent the information provided in their initiating pleading, whereas this Municipality acts within its powers. (…)”. They request that the proceeding be dismissed.
Justice Hess Herrera drafts the opinion; and,
Considering:
I.Preliminary clarification. Before analyzing the merits of the matter, it must be clarified that, since judgment number 2008-02545 at 8:55 hours on 22 de febrero de 2008, this Chamber has referred to the administrative litigation jurisdiction, with some exceptions, those matters in which it is disputed whether the public administration has complied with the deadlines established by the General Law of Public Administration (Articles 261 and 325) or by sector-specific laws governing special administrative proceedings, either to conclude, by means of a final act, an administrative proceeding initiated ex officio or at the request of a party, or to hear the applicable administrative appeals. Specifically, the sub lite presents an exceptional circumstance: the Administration’s alleged delay in addressing a complaint filed because of the poor condition of a sewer system, which places the physical integrity of the residents at risk. Having clarified this point, the Court proceeds to rule on the specific situation raised in this amparo proceeding.
The petitioner states that in the sector known as Vistas de la Pradera in La Guácima there is a stormwater system in poor condition, unpaved streets, deteriorated drains, and inadequate channeling of runoff, causing large volumes of water to descend the hillside when it rains and adversely affect the residents of the La Pradera Residential Development. He claims that complaints have been filed with the respondent Municipality; nevertheless, they were told that the system requires work for which the Municipality lacks the necessary budget. He adds that the CNE issued a technical report stating that the situation poses a risk to the area’s inhabitants, that landslides could occur during intense hydrometeorological events, and that the local government must repair the drainage system. However, he alleges that the respondent Municipality has neither followed the CNE’s recommendations nor carried out the corresponding repairs. He considers his fundamental rights to have been violated. He requests that the respondent be ordered to: a) conduct a comprehensive technical assessment of the area, incorporating the elements of the CNE report; b) submit a specific action plan; c) carry out the works and measures established in that plan within a reasonable period; and d) adopt provisional preventive measures to mitigate the risk.
The following facts are deemed duly established and relevant to the decision in this matter, either because they have been proven as such or because the respondent failed to address them as ordered in the initial ruling:
Regarding CONAVI.
Regarding the Municipality of Alajuela.
After analyzing the evidence provided, this Court finds no violation of the protected party’s fundamental rights by CONAVI. The report submitted by the representative of the respondent authority and the evidence provided for the resolution of the matter duly establish that, on 18 de noviembre de 2025, through report number CARTA-CONAVI-CA-DIE-PLI-SIG-004-2025, the CONAVI authority stated that the access roads, internal streets, and exit roads of the area in which the La Pradera Residential Development is located are not connected to national routes or through routes; therefore, the administration of these roads does not fall within its jurisdiction.
Accordingly, it is established that the respondent Council has not failed to perform its duties. Because the streets running through the La Pradera Residential Development—the area affected by the problem that is the subject of this action—are not national routes, and pursuant to Articles 1 and 4 of the Ley de Creación del CONAVI No. 7798, that body cannot be held responsible for the deterioration of public infrastructure works in the area. In view of the foregoing, the appropriate course is to deny the action with respect to CONAVI.
After analyzing the evidence provided, this Court finds that the respondent Municipality violated the fundamental rights of the protected person. The report submitted by the representatives of the respondent authority and the evidence provided for the resolution of the matter duly establish that, on 18 de noviembre de 2024, the petitioner, in his capacity as president of ADI La Pradera, sent a letter to the respondent authority reporting the problem caused by the lack of sewerage and stormwater management, alleging that this results in water flowing down the sloping land, ground instability, and landslides; and requesting that a study of the stormwater drainage system be conducted to provide a solution to the problem. It is likewise established that, on 24 de febrero de 2025, through official letter number MA-AAP-0163-2025, the respondent’s personnel replied to the petitioner as follows: “In response to the referenced matter, through which you report the adverse effects caused by the lack of a stormwater system in the community of Vistas de La Pradera, located in Rincón Chiquito de la Guácima, I must inform you that a site visit confirmed the existence of a stormwater system in the indicated sector.
That system requires extensive work exceeding our ordinary operational capacity, given the budget that would be required to carry out the corresponding works. For that reason, we will formulate a specific project so that the resources necessary to address the sector may be allocated in the medium term.” It is also established that, on 24 de marzo de 2025, through technical report number CNE-UIAR-INF-1541-2024, entitled “Risk assessments concerning improper stormwater management in the La Pradera Residential Development in La Guácima” and addressed to the petitioner, Juan Ignacio Chaves Salas, a geologist with the CNE Risk Research and Analysis Unit, made the following determination: “V. Conclusions A. The poor condition of the street and sewer system in the upper area poses a flood risk to the inhabitants of the lower portion of the hillside. B. In addition, the garbage and debris could cause mudflows and landslides if an intense hydrometeorological event occurs.
VI. Recommendations A. The street drainage system on the hillside must be repaired to reduce vulnerability to mudflows and flooding in the lower area. B. In addition, consideration must be given to the possibility of closing access to the vacant lot in the upper area to prevent its continued use as a dumpsite. C. The debris and remains of the cut tree trunk must be removed from the hillside to prevent them from sliding and affecting the structures in the lower area. D. The Municipality of Alajuela must be notified so that it may act within the scope of its jurisdiction and assist the residents in carrying out the necessary actions.” Finally, it is established that, on 24 de noviembre de 2025, through official letter number MA-AAP-1478-2025, Lawrence Chacón Soto, coordinator of the Stormwater Sewerage Activity of the respondent Municipality, stated the following: a) that the La Pradera Residential Development has a stormwater system throughout its entire extent, with some sectors showing a degree of deterioration; b) that work is required on Vistas de la Pradera Street to improve stormwater management; c) that the road has deficiencies in surface runoff management; and d) that one factor adversely affecting the most impacted properties is their proximity to a property that produces a high volume of water, causing high saturation, soil instability, and material displacement, which is a matter concerning third parties and not the Municipality.
It should be noted that this Court has already ruled on the authority of public institutions regarding the repair of sewerage problems, as follows:
“III.- Administrative authority concerning sanitary and storm sewerage systems. Before ruling on this matter, it is necessary to clarify what this Court has held regarding the authority of the various institutions associated with sanitary and storm sewerage systems (alcantarillados sanitario y pluvial). With respect to sanitary sewerage, in judgment number 2009-00152 at 9:06 on 13 de enero de 2009, the Chamber stated as follows:
“V.- Considerations regarding sanitary sewerage. Authority over sanitary sewerage, specifically with respect to the construction and operation of the infrastructure required for the proper disposal of wastewater (aguas residuales), has been established in Costa Rica by ordinary legislation. In this regard, the former Código Municipal (Ley número 4574 de cuatro de mayo de mil novecientos setenta y cuatro) specifically regulated the matter and expressly assigned such authority to municipal corporations in its Article 4, subsection 4:
‘the municipalities are responsible for administering local services and interests..., ensuring, among other things, adequate systems for supplying drinking water and disposing of sewage... through appropriate aqueduct and sewerage systems...’.
The current Código Municipal (Ley No. 7794 del treinta de abril de mil novecientos noventa y ocho) does not establish any specific provision on the matter. This does not relieve municipal entities of their obligation—obviously in coordination with the Instituto Costarricense de Acueductos y Alcantarillados, which is the foremost governing body in this field—to develop, among other community works, appropriate aqueduct and sewerage systems, because Article 4, subsection c), of the current Código Municipal establishes in general terms, as a municipal power, the administration and provision of municipal public services, which undoubtedly include aqueduct and sewerage systems. Specifically regarding the authority of municipal entities over sanitary sewerage, this Chamber, in judgment number 2001- 00591 at sixteen hours fifty-four minutes on 23 de enero del 2001, held that:
‘V.- As regards the Municipalidad de Curridabat, pursuant to Article 169 of the Constitución Política and the Código Municipal, municipalities are responsible for administering local services and interests in order to promote the comprehensive development of the cantons in harmony with national development. Consequently, the Municipality must establish a comprehensive urban-planning policy (planeamiento urbano) in accordance with the applicable law, pursuing the efficient and harmonious development of urban centers and ensuring—at a minimum—efficient electricity and communications services; adequate systems for supplying drinking water and disposing of sewage through appropriate aqueduct and sewerage systems; modern urban lighting and beautification systems; efficient services for constructing, repairing, and cleaning streets and other public roads; and, in general, concrete and practical plans to make life comfortable and safe for the population.’ Such authority regarding sanitary sewerage is supplemented by the provisions of the Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, número 2726 de 14 de abril de 1961, which expressly provides:
‘ARTICLE 2º.- The Instituto Costarricense de Acueductos y Alcantarillados shall be responsible for:
VI.It follows from the cited provisions that responsibility for creating and maintaining sanitary sewerage networks lies with the municipalities because, pursuant to Article 3 of the current Código Municipal, they bear primary responsibility for safeguarding cantonal interests and services within their respective jurisdictions and because this is expressly derived from Article 169 of the Constitución Política, which establishes the municipalities’ general authority in this area. However, under Article 2 of the Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, this obligation must be shared with the Instituto Nacional de Acueductos y Alcantarillados because, as the governing body in this field, it is responsible nationwide for directing, coordinating, and overseeing all matters concerning sewage disposal, sewerage systems, and water-resource pollution for the benefit of the inhabitants of the Republic.
VII.For its part, the Ministerio de Salud, within the scope of its authority, is also directly required to act in this area. In this regard, Article 341 of the Ley General de Salud número 5395 provides:
‘Article 341.- Within the aforementioned powers and jurisdictions, they may likewise order and take the special measures authorized by this law to prevent risks or harm to human health, to prevent such risks or harm from spreading or worsening, and to prevent private parties from continuing or repeating an infringement.’ Specifically regarding sewerage, Article 289 of that law provides as follows:
‘Every sewerage system shall be subject to the technical oversight of the Ministry and the Servicio Nacional de Acueductos y Alcantarillado, and the private-law or public-law persons that construct, administer, and operate such systems shall comply with the rules issued by the Executive Branch, in consultation with the Servicio Nacional de Acueductos y Alcantarillado, governing their construction and operation and the discharge and final treatment of effluents.’ Under this law, the Minister is responsible for issuing the technical health standards (normas técnicas de salud) that private-law or public-law natural or legal persons must follow in those matters for which the law itself so requires, which undoubtedly include sanitary sewerage.
The Chamber expressed the same criterion in judgment number 2008-006034 at 16:01 on 16 de abril de 2008. Based on that same legal reasoning, this Court now holds that, just as responsibility for creating and maintaining sanitary sewerage networks is shared by the municipalities and the Instituto Costarricense de Acueductos y Alcantarillados, with the Ministerio de Salud intervening in matters concerning technical health standards, the same allocation of authority applies to the creation and maintenance of storm sewerage systems. This expressly modifies the criterion previously adopted in judgment number 2008-017085 at 10:10 on 14 de noviembre de 2008, solely to the extent that it stated that the Instituto Costarricense de Acueductos y Alcantarillados bore no responsibility whatsoever in that regard. The Chamber notes that Article 1º of ley número 2726, Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, readily establishes that this entity was created as an autonomous State institution for, among other purposes, directing and establishing policies, establishing and applying standards, carrying out and promoting planning, financing, and development, and resolving all matters relating to the regulatory aspects of storm sewerage systems in urban areas.
More specifically, Article 2 of that body of law assigns the Instituto Costarricense de Acueductos y Alcantarillados, among other duties, the obligation to direct and oversee all matters necessary to provide the inhabitants of the republic with services for collecting and disposing of sewage and liquid industrial waste, as well as stormwater in urban areas. Certainly, in the first instance, responsibility for creating and maintaining storm sewerage networks lies with the municipalities because, pursuant to sections 3 of the Código Municipal and 169 of the Constitución Política, they bear primary responsibility for safeguarding cantonal interests and services within the corresponding jurisdiction. This accounts for the fact that those corporations collect municipal taxes that include an item for maintaining and operating the stormwater network.
Nevertheless, under sections 1 and 2 of the Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, this obligation must be shared with the Instituto Nacional de Acueductos y Alcantarillados because it is the governing body in this field and the entity with the greatest technical expertise to provide advice on the proper maintenance of that service. In this case, that circumstance is acknowledged by the Instituto Costarricense de Acueductos y Alcantarillados itself, as it has readily assumed a leading role in the sewerage project for Gran Puntarenas, which is intended to be financed with Spanish cooperation funds, as evidenced by official letter number SGG-2009-319 de 16 de febrero de 2009, in which the Institute’s General Manager informed the mayor of Puntarenas that the entity had prepared the corresponding project profile and that its own Executive President had already met with the Embajador de España to discuss it (see judgment number 2009-013161 at 10:47 on 21 de agosto de 2009).’ (see decision Nº 01015 – 2012 at 9:05 on 27 de enero del 2012).
Accordingly, this Chamber considers that the petition should be granted. The precedent cited above establishes that local governments are responsible for carrying out the necessary repairs when sanitary and storm sewerage systems experience problems. Therefore, because the issue underlying the principal claim in this petition concerns a stormwater system in deficient condition and the resulting consequences, responsibility in this case is attributable to the respondent Municipalidad.
At the outset, it should be noted that the municipal authority, in the report submitted to this Court, acknowledges the deterioration of certain sections of the stormwater drainage system (sistema pluvial) in Urbanización La Pradera, as well as deficiencies in surface runoff (escorrentía superficial) from the public roadway. Likewise, although it alleges that one factor aggravating the problem is that a property generates a high volume of water during rainfall and that this is a matter requiring coordination among third parties, this aggravating circumstance does not relieve the municipal entity of its responsibility to do its part by mitigating the problem that is the subject of this constitutional protection proceeding (recurso de amparo).
Along the same lines, it has been established that the CNE technical report, which warned of a risk arising from the poor condition of the street and sewer system and recommended i) repairing the street drains on the hillside, ii) closing access to the vacant lot used as a dumping ground, iii) removing debris from the hillside, and iv) prompt intervention by the Municipalidad de Alajuela, has not been complied with by the respondent authority.
In this regard, the local entity cannot disregard the fact that the intervention at issue in this constitutional protection proceeding concerns the safeguarding of cantonal interests for which it is responsible under Article 169 of the Constitución Política, which, insofar as relevant, provides that “The administration of local interests and services in each canton shall be entrusted to the Municipal Government…” In view of the foregoing, the appropriate course is to grant the petition as against the Municipalidad de Alajuela, as indicated in the operative part of the judgment.
I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and effective justice at the administrative level, the courts with jurisdiction to hear the legal dispute are the Administrative Litigation Courts, rather than this Chamber. However, with the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, it has been established that this right is eligible for judicial protection through the constitutional protection proceeding established by Article 32 of the Ley de la Jurisdicción Constitucional, in conjunction with Article 27 of the Constitución Política de la República de Costa Rica, in cases where the petitioner believes that the Administration’s material actions, administrative acts, or response are affecting the petitioner’s fundamental rights. In my view, the newly enacted legislation does not require this Court to modify its line of precedent, since, pursuant to section 7 of its Law, this Court has exclusive authority to define its own jurisdiction.
Therefore, except for those constitutional-law disputes that this Chamber itself has recognized as exceptional circumstances properly heard in this jurisdiction through the constitutional guarantee proceeding of constitutional protection, in all other cases, and for the reasons given by this Court (judgment N° 2008-02545 of 8:55 hours on February 22, 2008), jurisdiction lies with the judges of the administrative litigation jurisdiction. All of this is consistent with section 25 of the Convención Americana sobre Derechos Humanos, the Law of the Constitution (values, principles, and rules), and the corresponding statutory provisions, based on a logical, systemic, and purposive interpretation of the legal system.
On the other hand, this applies to those who consider that claims brought by inhabitants of the Republic concerning the lack of sidewalks, pedestrian bridges, and pedestrian walkways should not fall within this jurisdiction. Nevertheless, there are sufficient reasons for this jurisdiction to grant protection in disputes of this nature. Traffic accidents involving injuries or deaths are a worldwide problem. Indeed, traffic accidents are one of the leading causes of death worldwide—approximately 1.3 million people per year—and the leading cause of death among children and young people. Pedestrians are the most frequent victims in urban areas. Given the magnitude of the problem, the Organización de Naciones Unidas devoted two global road-safety weeks in 2013 to pedestrian safety and specifically dedicated that year to promoting pedestrian safety worldwide. As is well known, the pedestrian—a person traveling on foot along a public roadway—is the most vulnerable and fragile link in the traffic system because, in a collision between a pedestrian and a vehicle, the pedestrian, lacking bodily protection, suffers the greatest harm and thus places their life and physical integrity at risk.
It should be noted that, according to global statistics, pedestrians account for one-quarter of traffic fatalities. It is estimated that, in underdeveloped and developing countries, most victims are pedestrians. In our country, the following data appear in the statistics of the Consejo de Seguridad Vial.

Such duties include those established in section 75 of the Código Municipal, since separating pedestrians from the rest of traffic by means of sidewalks, pedestrian bridges, and pedestrian walkways, in addition to other measures, constitutes an appropriate approach to minimizing risks and thereby effectively safeguarding pedestrians’ lives and physical integrity. The matter is so important from the standpoint of pedestrian safety that, in 1988, the Parlamento Europeo adopted the Carta de los Derechos del Peatón—which logically has no binding effect on the Estado de Costa Rica—including the right to the adoption of specific measures—in our case by local governments and national authorities—so that pedestrians may stand on sidewalks—and, I would add, travel on them with due safety—which requires that such sidewalks exist.
For these reasons, the position of the majority of this Court that protection should be granted in these matters not only has enormous significance from the perspective of fundamental rights but also responds to a social need of the greatest magnitude, one that even has repercussions globally.
As a matter of principle, I consider that cases concerning the Public Administration’s failure to repair, construct, modify, or demolish any infrastructure project should be dismissed because such an omission is a matter of legality whose adjudication falls within the ordinary jurisdiction, before which the interested person may contest the matter more fully. However, when such administrative inaction results in a violation of other fundamental rights protected in this constitutional jurisdiction, or affects groups considered vulnerable, I do address the merits because this situation constitutes an exception to my position on this subject, as occurs in this case, in which the failure of the Municipalidad de Alajuela and the CONSEJO NACIONAL DE VIALIDAD (CONAVI) to maintain the stormwater drainage system, streets, and culverts in the area known as Vistas de la Pradera in La Guácima is challenged, because this failure causes large volumes of water to descend the hillside when it rains and adversely affect residents of Urbanización La Pradera.
It is stated that the corresponding complaints have been filed with the respondent authorities, but they claim that they lack the necessary budget. The situation described constitutes an exception to my general position on this subject; I therefore consider it necessary for this Constitutional Court to examine the merits of the matter in order to verify or reject the petitioner’s allegations.
Although I have joined the majority in cases raising similar grievances and seeking the performance of works such as paving a public road or constructing sidewalks (for example, judgments numbers 2022-006702 and 2022-018609), upon further consideration, I believe that grievances of this kind—in which no serious risk to the health, physical integrity, or lives of the protected persons can be discerned—must be brought through the ordinary legal channels. This is particularly true when the record does not establish the existence of a duly identified person who requires the protection of this jurisdiction because of threats to the aforementioned fundamental rights or who belongs to a vulnerable group requiring this Chamber’s intervention.
I consider that, in such circumstances, the inaction should first be challenged before the authorities responsible for maintaining the public road in question and then, if the omission persists, before the administrative litigation jurisdiction. That judicial forum, equipped with more extensive tools, can examine and weigh the underlying complaint in depth, assess the administrative conduct, rule on jurisdiction—national road network or cantonal road network—issue specific orders to address the identified problem and, of course, monitor compliance with the judgment.
In the case at bar (sub lite), the petitioner states that he is a resident of Alajuela and alleges that, in the upper portion of Urbanización "La Pradera", there is an incomplete and deteriorated stormwater drainage system, with unpaved streets, nonexistent culverts, and inadequate water channeling, a situation that causes large volumes of water to flow toward the lower area during the rainy season, resulting in flooding, slope erosion, garbage accumulation, and a risk of landslides. Accordingly, without identifying any particular person or making any individualized determination, he comes before this Chamber to report this problem. In my view, that element alone is sufficient to dismiss the constitutional protection proceeding. This Court has cautioned that, given the effects that the Ley de la Jurisdicción Constitucional assigns to the constitutional protection proceeding (arts. 41 and 49), it must be concluded that any person may file such a proceeding, provided that the person identifies the individuals whose fundamental rights they believe have been violated (see, for example, judgments numbers 2019-003879, 2021-017532, and 2022-009133, among others).
Consequently, respectfully and from my perspective, it does not appear valid, on the basis of a generic assertion such as the alleged existence of “large volumes of water” flowing “toward the lower area, resulting in flooding, slope erosion, garbage accumulation, and a risk of landslides,” for this forum to hear a claim of administrative inaction that more properly belongs before the administrative litigation jurisdiction.
In addition to the foregoing, in the specific case it is necessary to mention that, in the reports submitted under penalty of perjury by Roberto Hernán Thompson Chacón, mayor; Karen Bermúdez Fallas, coordinator of the Environmental Management Subprocess; and Lawrence Chacón Soto, coordinator of the Storm Sewer Activity, all of the Municipality of Alajuela, the following was emphasized: “…on Vistas de la Pradera Street there is a stormwater system that requires intervention to improve the management of roadway stormwater, for the purpose of improving current conditions and preserving the road, the budget for which exceeds our department’s capacity to carry it out through its ordinary operations. This intervention is limited solely to roadway stormwater and its improvement, since the road has deficiencies with respect to surface runoff, as indicated in report N° CNE-UIAR-INF-1541-2024, prepared by Juan Ignacio Chaves Salas, Geologist with the National Emergency Commission (…) according to the Basic Organization Manual, maintenance of the canton’s stormwater network is not among the functions of this Subprocess; when resources are available, when the need is technically demonstrated, or when it is a new project to be developed, this unit includes the stormwater component in the road budgets, provided that the Storm Sewer Activity does not have plans to intervene on the road in the short or medium term.
This means that, on many occasions, the allocated budget is insufficient to complete the works. That Urbanización la Pradera is coded in the cantonal road network inventory under street code 2-01-176-00, and has a length of 1,30Km. That, pursuant to the guidelines and policies of the Five-Year Road Plan 2024-2029 (PVQ 2024-2029), Urbanización La Pradera falls under the second policy, belonging to the urban road portfolio, with priority number 92. It is important to clarify that, when prioritizing the work under the Plan, consideration is given, for example, to the condition of the road surface, average daily traffic, social index, population vulnerability, tourist areas, among other characteristics, for all streets included in the aforementioned Plan, resulting in a projection of the roads requiring priority intervention. That, in addition to Urbanización La Pradera not being among this Subprocess’s immediate priorities, the road has no budget allocated for the execution of an asphalt paving project; however, routine maintenance has been performed through patching work.” Added to this is the fact that, according to those same Authorities, that department “…refers to improvements to stormwater channeling on public roads, while the petitioner describes situations that, as already mentioned, arise between private properties.” In light of these elements, I consider that a direct and imminent threat to the aforementioned fundamental rights has not been established.
Rather, intervention by this Court could disrupt the Local Government’s proper administrative planning for processing procedures and, eventually, the subsequent execution of works that are inherently costly and may affect the proper administration and allocation of the resources available to that entity for such purposes. Moreover, as already noted, administrative omissions of this kind that do not demonstrate an imminent threat or injury to the fundamental rights of any specific person must be raised and resolved through the ordinary legal channels.
In view of the foregoing, I dissent and deny the amparo petition.
The parties are hereby advised that, if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device or produced through new technologies, these must be collected from the Court within a maximum period of 30 business days counted from notice of this judgment. Otherwise, any material not collected within that period shall be destroyed, pursuant to the provisions of the “Regulation on Electronic Case Files before the Judiciary,” approved by the Full Court at session number 27-11 of 22 de agosto de 2011, article XXVI, and published in Judicial Bulletin number 19 of 26 de enero de2012, as well as the resolution approved by the Superior Council of the Judiciary at session number 43-12 held on 3 de mayo de 2012, article LXXXI.
POR TANTO:
The petition is granted solely against the Municipality of Alajuela. Roberto Hernán Thompson Chacón, mayor; Karen Bermúdez Fallas, coordinator of the Environmental Management Subprocess; and Lawrence Chacón Soto, coordinator of the Storm Sewer Activity, all of the Municipality of Alajuela, are ordered to: i) within a maximum period of THREE MONTHS, counted from notice of this judgment, promptly and timely arrange the actions and coordination necessary to resolve, comprehensively and definitively, the problem raised by the petitioners regarding the storm sewer system and the accumulation of garbage, in accordance with the provisions of technical report “Risk Assessments Due to Improper Stormwater Management in Urbanización La Pradera in La Guácima,” no. CNE-UIAR-INF-1541-2024 of 24 de marzo de 2025; and ii) within a maximum period of SIX MONTHS, counted from notice of this judgment, take the necessary measures and issue the corresponding orders within the scope of their authority so that the public street in the community of Urbanización La Pradera that is the subject of this petition is repaired and made passable again, in accordance with the provisions of the aforementioned technical report.
The respondent authorities are warned that, pursuant to article 71 of the Law on Constitutional Jurisdiction, imprisonment of three months to two years or a fine of twenty to sixty days shall be imposed upon anyone who receives an order issued in an amparo proceeding that they are required to comply with or enforce and who fails to comply with or enforce it, provided that the offense is not subject to a more severe penalty. The Municipality of Alajuela is ordered to pay the costs and damages caused by the acts underlying this ruling, which shall be assessed during enforcement of the judgment in contentious-administrative proceedings. As to CONAVI, the petition is denied. Justice Castillo Víquez files a separate note. Justice Salazar Alvarado files a separate note. Justice Garro Vargas dissents and denies the amparo petition. Let notice be served.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veinte de marzo de dos mil veintiseis .
Recurso de amparo que se tramita en expediente número 25-035171-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra la MUNICIPALIDAD DE ALAJUELA y el CONSEJO NACIONAL DE VIALIDAD (CONAVI).
RESULTANDO:
Redacta la Magistrada Hess Herrera; y,
Considerando:
I.Aclaración previa. Antes de analizar el fondo del asunto debe aclararse que, a partir de la sentencia número 2008-02545 de las 8:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa, con algunas excepciones, aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo, instruido de oficio o a instancia de parte, o conocer de los recursos administrativos procedentes. Precisamente, en el sub lite, se plantea un supuesto de excepción: la supuesta demora de la Administración en atender una denuncia planteada en virtud del mal estado de un sistema de alcantarillado, lo cual pone en riesgo la integridad física de los vecinos. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.
El recurrente manifiesta que en el sector conocido como Vistas de la Pradera en La Guácima hay un sistema pluvial en mal estado, calles sin asfaltar, alcantarillas deterioradas y canalización deficiente de aguas de escorrentía, provocando que, cuando llueve, grandes volúmenes de agua descienden por la ladera y generan afectaciones para los vecinos de Urbanización La Pradera. Acusa que se han presentado denuncias ante la Municipalidad recurrida; no obstante, les contestaron que el sistema requiere una intervención para la cual no tienen el presupuesto requerido. Añade que la CNE emitió un informe técnico en el que indicó que la situación representa un riesgo para los habitantes de la zona, que puede haber deslizamientos ante eventos hidrometeorológicos intensos y que el gobierno local debe reparar los drenajes. Sin embargo, alega que la Municipalidad accionada no ha atendido las recomendaciones de la CNE ni ejecutado las reparaciones respectivas. Estima lesionados sus derechos fundamentales. Solicita que se le ordene a la recurrida: a) realizar una evaluación técnica integral de la zona, incorporando los elementos del informe de la CNE; b) presentar un plan de acción concreto; c) ejecutar las obras y medidas establecidas en dicho plan en un plazo razonable; y d) adoptar medidas preventivas provisionales para mitigar el riesgo.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados, o bien, porque la recurrida haya omitido referirse a ellos según lo prevenido en el auto inicial:
En cuanto al CONAVI.
En cuanto a la Municipalidad de Alajuela.
Después de analizar los elementos probatorios aportados, este Tribunal descarta la lesión a los derechos fundamentales del amparado por parte del CONAVI. Del informe rendido por el representante de la autoridad recurrida y la prueba aportada para la resolución del asunto, ha quedado debidamente acreditado que el 18 de noviembre de 2025, mediante informe número CARTA-CONAVI-CA-DIE-PLI-SIG-004-2025, la autoridad del CONAVI hace constar que la zona en la que se encuentra la Urbanización La Pradera no está vinculada en sus accesos de ingreso, calles internas y salidas, a rutas nacionales o rutas de travesías, por lo que no es de su competencia la administración de estas vías.
Así las cosas, se verifica que el Consejo accionado no ha llevado a cabo un incumplimiento de sus funciones. En razón de que las calles que atraviesan la Urbanización La Pradera -zona afectada por la problemática que es objeto del presente recurso- no son rutas nacionales, y obedeciendo a los artículos 1 y 4 de la Ley de Creación del CONAVI No. 7798, no es posible imputarle a dicho órgano la responsabilidad por el deterioro que presentan las obras de infraestructura pública en la zona. Por lo expuesto, lo procedente es declarar sin lugar el recurso con respecto al CONAVI.
Después de analizar los elementos probatorios aportados, este Tribunal comprueba la lesión a los derechos fundamentales de la persona tutelada por parte de la Municipalidad accionada. Del informe rendido por los representantes de la autoridad recurrida y la prueba aportada para la resolución del asunto, ha quedado debidamente acreditado que el 18 de noviembre de 2024, el recurrente, en condición de presidente de la ADI La Pradera, envió una carta a la autoridad recurrida indicando la existencia de la problemática de la falta de alcantarillado y manejo de aguas pluviales, alegando que esto resulta en la caída de agua por los terrenos inclinados, falseamiento de terrenos y derrumbes; y solicitando la realización de un estudio del alcantarillado pluvial para brindar una solución a la problemática. Asimismo, se comprueba que el 24 de febrero de 2025, a través de oficio número MA-AAP-0163-2025, el personal de la accionada le respondió al recurrente en los siguientes términos: “En atención al trámite de referencia, mediante el cual denuncia la afectación provocada por la falta de sistema pluvial en la comunidad de Vistas de La Pradera, ubicada en Rincón Chiquito de la Guácima, debo indicarle que al realizar la visita al sitio se pudo comprobar la existencia de un sistema pluvial en el sector indicado, el cual requiere una intervención profunda que sobrepasa la capacidad de nuestra acción ordinaria, dado el presupuesto que se necesitaría para efectuar las obras correspondientes.
Por tal motivo, efectuaremos el planteamiento de un proyecto específico para que sean destinados los recursos necesarios para intervenir el sector en el mediano plazo.”. También, se verifica que el 24 de marzo de 2025, mediante informe técnico número CNE-UIAR-INF-1541-2024 denominado “Valoraciones de riesgo por mal manejo de aguas pluviales en la Urbanización La Pradera en la Guácima” y dirigido al recurrente, Juan Ignacio Chaves Salas, geólogo de la Unidad de Investigación y Análisis de Riesgo de la CNE, determinó lo siguiente: “V. Conclusiones A. El mal estado de la calle y el alcantarillado en la parta alta representa un riesgo, de inundación para los habitantes de la parte baja de la ladera. B. Además la basura y escombros podría formar flujos de lodo y deslizamientos; de darse un evento hidrometeorológico intenso. VI. Recomendaciones A. Se debe reparar los drenajes de la calle sobre la ladera para disminuir la vulnerabilidad de que se den flujos de lodo e inundaciones en la parte baja.
B. Por otra parte se debe valorar la posibilidad de cerrar el acceso al lote baldío de la parte alta para evitar que se siga usando como botadero. C. Los escombros y restos del troco cortado deberán ser removidos de la ladera para evitar que se deslicen y afecten las estructuras de la parte baja. D. Se debe dar parte a la Municipalidad de Alajuela para que actúe según sea su competencia y colabore con los vecinos con la ejecución de las acciones a realizar.”. Por último, se constata que el 24 de noviembre de 2025, mediante el oficio número MA-AAP-1478-2025, Lawrence Chacón Soto, coordinador de la Actividad de Alcantarillado Pluvial de la Municipalidad recurrida, indicó lo siguiente: a) que el sistema pluvial de Urbanización La Pradera cuenta con un sistema pluvial en toda su extensión y hay sectores donde presenta un grado de deterioro; b) que en la calle Vistas de la Pradera requiere una intervención para mejorar el manejo de aguas pluviales; c) que la vía presenta deficiencias en escorrentía superficial; y d) que un factor por el que las propiedades más afectadas se ven perjudicadas es porque colindan con un inmueble que produce un volumen de agua elevado, lo que provoca alta saturación, inestabilidad de los suelos y arrastre de material, lo cual es una situación que compete a terceros y no a la Municipalidad.
Es menester indicar que este Tribunal ya se ha pronunciado al respecto de las competencias de las instituciones públicas en materia de reparación de problemas de alcantarillado, de la siguiente manera:
“III.- Sobre las competencias administrativas en relación con los alcantarillados sanitario y pluvial. De previo a resolver este asunto, resulta necesario precisar lo que este Tribunal ha sostenido en cuanto a las competencias de las diversas instituciones relacionadas con los sistemas de alcantarillado sanitario y pluvial. Respecto del alcantarillado sanitario, en sentencia número 2009-00152 de las 9:06 horas del 13 de enero de 2009, la Sala señaló lo siguiente:
“V.- Consideraciones en materia de alcantarillado sanitario. La competencia en materia de alcantarillado sanitario, específicamente en cuanto a la construcción y operación de la infraestructura requerida para la adecuada disposición de las aguas residuales, ha sido establecida en Costa Rica por la legislación común. En ese sentido, el anterior Código Municipal (Ley número 4574 de cuatro de mayo de mil novecientos setenta y cuatro) regulaba concretamente el tema y le atribuía de manera expresa tal competencia a las corporaciones municipales en su artículo 4 inciso 4:
"corresponde a las municipalidades la administración de los servicios e intereses locales..., garantizando entre otros buenos sistemas de provisión de agua potable y de evacuación de aguas servidas... mediante adecuados sistemas de acueductos y alcantarillados...".
El actual Código Municipal (Ley No. 7794 del treinta de abril de mil novecientos noventa y ocho), no establece ninguna disposición específica en cuanto a la materia, lo cual no excluye la obligación de los entes municipales, obviamente en coordinación con el Instituto Costarricense de Acueductos y Alcantarillados que es el ente rector por excelencia en la materia, de desarrollar, entre otras obras de carácter comunal, lo relativo a adecuados sistemas de acueductos y alcantarillados pues el artículo 4 inciso c) del Código Municipal vigente establece en términos generales, como una atribución municipal, el administrar y prestar los servicios públicos municipales, dentro de los cuales, sin duda alguna, se encuentran los sistemas de acueductos y alcantarillados. Ahora bien, específicamente sobre la competencia de los entes municipales en materia de alcantarillado sanitario, esta Sala mediante sentencia número 2001- 00591 de las dieciséis horas cincuenta y cuatro minutos del 23 de enero del 2001, sostuvo que:
"V.- En cuanto a la Municipalidad de Curridabat, conforme lo establece el artículo 169 de la Constitución Política y el Código Municipal, corresponde a las municipalidades la administración de los servicios e intereses locales, con el fin de promover el desarrollo integral de los cantones en armonía con el desarrollo nacional. En consecuencia, la Municipalidad debe establecer una política integral de planeamiento urbano de acuerdo con la ley respectiva, que persiga el desarrollo eficiente y armónico de los centros urbanos y que garantice -al menos- eficientes servicios de electrificación y de comunicación; buenos sistemas de provisión de agua potable y evacuación de aguas servidas, mediante adecuados sistemas de acueductos y alcantarillado, modernos sistemas de iluminación y ornato de las ciudades; eficientes servicios de construcción, reparación y limpieza de calles y otras vías públicas; y en general planes concretos y prácticos para hacer confortable y segura la vida de la población" Tal competencia, en materia de alcantarillado sanitario, se complementa con lo dispuesto en la Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, número 2726 de 14 de abril de 1961, que expresamente establece:
“ARTICULO 2º.- Corresponde al Instituto Costarricense de Acueductos y Alcantarillados:
Queda facultada la institución para convenir con organismos locales, la administración de tales servicios o administrarlos a través de juntas administradoras de integración mixta entre el Instituto y las respectivas comunidades, siempre que así conviniere para la mejor prestación de los servicios y de acuerdo con los reglamentos respectivos. Por las mismas razones y con las mismas características, también podrán crearse juntas administradoras regionales que involucren a varias municipalidades;"
VI.De las normas citadas se colige que la atribución de crear y mantener las redes del alcantarillado sanitario, le corresponde a las municipalidades por cuanto éstas, según el artículo 3 del Código Municipal vigente, son las principales obligadas de velar por los intereses y servicios cantonales dentro de la jurisdicción que tengan a su cargo y porque expresamente así se deriva del artículo 169 de la Constitución Política que establece la competencia genérica de las Municipalidades en esta materia. Sin embargo, en atención a lo dispuesto por el artículo 2 de la Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, tal obligación debe ser compartida con el Instituto Nacional de Acueductos y Alcantarillados, ya que éste, como órgano rector de la materia, es el encargado a nivel nacional de dirigir, coordinar y vigilar todo lo concerniente a la evacuación de aguas negras, alcantarillados y contaminación de los recursos de agua en beneficio de los habitantes de la República.
VII.Por su parte, el Ministerio de Salud, dentro del ámbito de sus competencias, también se encuentra directamente obligado a actuar en esta materia. En ese sentido, la Ley General de Salud número 5395, en su artículo 341 establece:
"Artículo 341.- Podrán, asimismo, dentro de las atribuciones y jurisdicciones mencionadas, ordenar y tomar las medidas especiales que habilita esta ley para evitar el riesgo o daño a la salud de las personas o que éstos se difundan o se agraven y para inhibir la continuación o reincidencia en la infracción de los particulares" Específicamente en materia de alcantarillado, establece el artículo 289 de esa ley, lo siguiente:
"Todo sistema de alcantarillado, quedará bajo el control técnico del Ministerio y del Servicio Nacional de Acueductos y Alcantarillado y las personas de derecho privado o público que los construyan, administren y operen se sujetarán a las normas que el Poder Ejecutivo, en consulta con el Servicio Nacional de Acueductos y Alcantarillado, dicte para condicionar su construcción, funcionamiento y la evacuación y tratamiento final de los fluentes." De conformidad con esta ley, le corresponde al ministro dictar las normas técnicas de salud a que deben ceñirse las personas físicas o jurídicas de derecho privado o público en las materias que la propia ley lo requiera, entre las cuales, sin duda alguna, se encuentra lo relativo al alcantarillado sanitario.
Idéntico criterio fue expuesto por la Sala en la sentencia número 2008-006034 de las 16:01 horas del 16 de abril de 2008. Ahora bien, con base en ese mismo razonamiento jurídico, este Tribunal sostiene que así como existe una responsabilidad compartida entre las municipalidades y el Instituto Costarricense de Acueductos y Alcantarillados en la obligación de crear y mantener las redes del alcantarillado sanitario, con la intervención del Ministerio de Salud en lo concerniente a las normas técnicas de salud, de igual modo existe la misma distribución de competencias en la creación y mantenimiento del alcantarillado pluvial, lo que implica modificar expresamente el criterio sostenido con anterioridad en la sentencia número 2008-017085 de las 10:10 horas del 14 de noviembre de 2008, únicamente en la medida que ahí se indicó que el Instituto Costarricense de Acueductos y Alcantarillados no tenía responsabilidad alguna en ese punto.
La Sala advierte que efectivamente, del artículo 1º de la ley número 2726, Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, se colige con facilidad que esa entidad fue creada como institución autónoma del Estado, entre otros propósitos, con el objeto de dirigir, fijar políticas, establecer y aplicar normas, realizar y promover el planeamiento, financiamiento y desarrollo y de resolver todo lo relacionado con el aspecto normativo de los sistemas de alcantarillado pluvial en áreas urbanas. De manera más específica, el artículo 2 de ese cuerpo legal le asigna al Instituto Costarricense de Acueductos y Alcantarillados, entre otros deberes, la obligación de dirigir y vigilar todo lo concerniente para proveer a los habitantes de la república de un servicio de recolección y evacuación tanto de aguas negras y residuos industriales líquidos como de aguas pluviales en las áreas urbanas.
Ciertamente, en primera instancia, la obligación de crear y mantener las redes del alcantarillado pluvial le corresponde a las municipalidades por cuanto estas, de conformidad con lo regulado en los numerales 3 del Código Municipal y 169 de la Constitución Política, son las principales obligadas a salvaguardar los intereses y servicios cantonales dentro de la jurisdicción correspondiente, lo que justifica el hecho de que tales corporaciones cobren impuestos municipales, en los que se incluye el rubro correspondiente al mantenimiento y operación de la red pluvial.
No obstante, en atención a lo dispuesto en los numerales 1 y 2 de la Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, esa obligación debe ser compartida con el Instituto Nacional de Acueductos y Alcantarillados, ya que este es el órgano rector en la materia y la entidad técnicamente más especializada para asesorar en el debido mantenimiento del referido servicio. En la especie, tal situación resulta reconocida por el propio Instituto Costarricense de Acueductos y Alcantarillados, toda vez que este ha asumido con toda naturalidad un papel protagónico en el proyecto de alcantarillado para la Gran Puntarenas, que se pretende financiar con recursos de la cooperación española, según se desprende del oficio número SGG-2009-319 de 16 de febrero de 2009, en el que el Gerente General del instituto le comunica a la alcaldesa de Puntarenas que dicho ente había elaborado la respectiva ficha del proyecto en mención y que su propio presidente ejecutivo ya se había reunido con el Embajador de España para comentarlo (ver sentencia número 2009-013161 de las 10:47 horas del 21 de agosto de 2009).” (ver resolución Nº 01015 – 2012 de las 9:05 horas del 27 de enero del 2012).
Así las cosas, considera esta Sala que el recurso debe estimarse. Del precedente citado supra, se comprueba que es competencia de los gobiernos locales llevar a cabo las reparaciones necesarias cuando los sistemas de alcantarillado sanitario y pluvial presentan problemas. Entonces, siendo que la problemática que constituye la pretensión principal del presente recurso versa sobre un sistema pluvial en estado deficiente y las consecuencias generadas por ello, la responsabilidad del caso le es atribuible a la Municipalidad accionada.
En primera instancia, nótese que la autoridad municipal, en el informe rendido ante este Tribunal, reconoce la existencia de deterioro en ciertos sectores del sistema pluvial de Urbanización La Pradera, así como las deficiencias en escorrentía superficial de la vía pública. De igual forma, aunque alegan que uno de los factores por los cuales se agrava la problemática es que hay un inmueble que produce un volumen de agua elevado ante las lluvias y que esto es un asunto que debe coordinarse entre terceros, este agravante no exime la responsabilidad del ente municipal de llevar a cabo su parte mediante la mitigación del problema objeto de este amparo.
En la misma línea, se acredita que el informe técnico de la CNE que alertó la existencia de un riesgo por el mal estado de la calle y del alcantarillado, recomendando i) la reparación de los drenajes de la calle sobre la ladera, ii) el cierre del acceso al lote baldío que se utiliza como botadero, iii) la remoción de escombros de la ladera; y iv) la pronta intervención de la Municipalidad de Alajuela; no ha sido acatado por la autoridad recurrida.
En ese sentido, el ente local no puede obviar que la intervención que es objeto del presente amparo, se relaciona con la tutela de intereses cantonales que le corresponde realizar, bajo el tenor del artículo 169 de la Constitución Política, el cual, en lo que interesa, determina que “La administración de los intereses y servicios locales en cada cantón, estará a cargo del Gobierno Municipal…”.
Por lo expuesto, lo procedente es declarar con lugar el recurso en cuanto a la Municipalidad de Alajuela, según lo que se indica en la parte dispositiva de la sentencia.
He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia.
Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.
Por otra parte, a quienes consideran que no debería ser objeto de esta jurisdicción aquellas reclamaciones que presentan los habitantes de la República por la falta de aceras, puentes peatonales y pasarelas peatonales. Empero, hay razones suficientes para que esta jurisdicción ampare este tipo de controversias. Los accidentes de tránsito, cuando hay lesiones o muertes, son un problema mundial. En efecto, una de las principales causas de muerte en todo el mundo son los accidentes de tránsito –aproximadamente 1,3 millones de personas por año, y entre la población infantil y juvenil es la principal causa de muerte-. Ahora bien, los peatones son las víctimas más frecuentes en áreas urbanas. Dada la magnitud del problema, la Organización de Naciones Unidas dedicó dos semanas mundiales a la seguridad vial en el año 2013, a la seguridad de los peatones y destinó ese año especialmente a la promoción de la seguridad de los peatones en todo el mundo.
Como es bien sabido, el peatón –persona que transita a pie por una vía pública- es el eslabón más vulnerable y frágil del sistema de tránsito, pues ante un choque entre él y vehículo, a falta de protección corporal, es el que sufre el mayor daño y, por ende, pone en peligro su vida e integridad física. Nótese que de acuerdo con las estadísticas mundiales los peatones constituyen una cuarta parte de los muertos en el tránsito. Se estima que en los países subdesarrollados y en desarrollo la mayoría de las víctimas son peatones. En nuestro país, encontramos los siguientes datos, conforme las estadísticas del Consejo de Seguridad Vial.

Tipo de usuario 2017 2018 2019 2020 2021 Motociclista 170 177 186 113 155 Acompañante de motociclista 29 29 27 11 11 Peatón 95 58 64 53 60 Conductor carro 95 123 100 59 84 Acompañante carro 63 47 37 37 35 Ciclista 36 37 34 38 25 Otro 0 0 3 0 0 De ahí las necesidades que los gobiernos nacionales y locales desarrollen políticas públicas tendentes a su protección, así como que hagan cumplir las obligaciones y los deberes que el ordenamiento jurídico exige en aras de su protección. Dentro de tales deberes están los que se consagran en el numeral 75 del Código Municipal, toda vez que la separación entre peatones del resto del tráfico por las aceras, puentes peatonales y pasarelas peatonales, además de otras medidas, constituye un abordaje adecuado a fin de minimizar los riesgos y, por ende, garantizar efectivamente la vida y la integridad física de los peatones. El tema tiene tal relevancia desde la óptica de la seguridad del peatón, que el Parlamento Europeo, desde el año 1988, adoptó la Carta de los Derechos del Peatón –la que lógicamente no tiene ningún efecto vinculante para el Estado de Costa Rica-, dentro de los cuales se incluye el derecho de que se adopten medidas específicas – en nuestro caso por los gobiernos locales y las autoridades nacionales- para que él pueda pararse en las aceras –y agrego- de transitar con la debida seguridad por estas, para lo cual es necesario su existencia.
Por estas razones, la tesis de la mayoría de este Tribunal de amparar estos asuntos, no solo tiene una enorme trascendencia desde la óptica de los derechos fundamentales, sino que responde a una necesidad social de la mayor envergadura, la cual, incluso, tiene repercusión en el ámbito global.
En tesis de principio, considero que los casos relacionados con la inactividad de la Administración Pública en la reparación, construcción, modificación o demolición de cualquier obra de infraestructura deben ser desestimados, por constituir, esa omisión, un tema de legalidad, cuya discusión corresponde a la jurisdicción ordinaria, ante la cual la persona interesada puede debatir, con mayor amplitud, sus disconformidades. Sin embargo, cuando de aquella conducta administrativa omisiva se derive alguna violación a otros derechos fundamentales tutelados en esta jurisdicción constitucional, o se afecten grupos considerados vulnerables, sí entro a conocer el fondo del asunto, por constituir esta situación una excepción a mi posición en esta materia, tal y como sucede en este caso, en el que se reclama la omisión de la Municipalidad de Alajuela y del CONSEJO NACIONAL DE VIALIDAD (CONAVI), en dar mantenimiento al sistema pluvial, las calles, y alcantarillas, en el sector conocido como Vistas de la Pradera en La Guácima, provocando que, cuando llueve, grandes volúmenes de agua desciendan por la ladera y generen afectaciones para los vecinos de Urbanización La Pradera.
Se indica que se han presentado las denuncias correspondientes ante las autoridades recurridas, pero éstas alegan que no tienen presupuesto. La situación descrita constituye una excepción a mi posición general en esta materia, por lo que estimo necesario que este Tribunal Constitucional analizara por el fondo el asunto, con el fin de verificar o descartar los alegatos de la parte recurrente.
Pese a que he concurrido con el voto en asuntos donde se plantean similares agravios y se pretende la realización de obras como el asfaltado de algún camino público o la construcción de aceras (por ejemplo, las sentencias números 2022-006702 y 2022-018609), bajo una mejor ponderación estimo que este tipo de reproches ‒en los cuales no se aprecia un grave riesgo para la salud, integridad física o la vida de las personas amparadas‒ se deben plantear en las vías ordinarias de legalidad. Lo anterior, máxime si, de los autos, no se constata la existencia de una persona debidamente individualizada que requiera del amparo de esta jurisdicción por las amenazas a los derechos fundamentales ya indicados o que pertenezca a un grupo vulnerable que demanda la intervención de esta Sala.
Considero que en tales supuestos procede, en primer término, cuestionar la inactividad ante las autoridades competentes en el mantenimiento del camino público en cuestión y luego, de mantenerse la conducta omisa, ante la jurisdicción contencioso-administrativa. Dicha instancia jurisdiccional, con mayores herramientas, puede conocer con profundidad y sopesar la denuncia de fondo, valorar la conducta administrativa, resolver sobre la competencia ‒red vial nacional o red vial cantonal‒, dictar mandatos específicos para atender la problemática apuntada y, por supuesto, dar seguimiento a lo ordenado en sentencia.
En el sub lite, el recurrente manifiesta ser vecino de Alajuela y aduce que en la parte alta de la Urbanización "La Pradera" existe un sistema pluvial incompleto y deteriorado, con calles sin asfaltar, alcantarillas inexistentes y deficiente canalización de aguas, cuya situación provoca que durante la época lluviosa, grandes volúmenes de agua desciendan hacia la parte baja, ocasionando inundaciones, erosión de taludes, acumulación de basura y riesgo de deslizamientos. Por ello, sin ninguna determinación subjetiva o individualización, acude ante esta Sala para denunciar esta problemática. Ya solo ese elemento, en mi criterio, es suficiente para desestimar el recurso de amparo. Este Tribunal ha advertido que partiendo de los efectos que la Ley de la Jurisdicción Constitucional confiere al recurso de amparo (arts. 41 y 49) debe concluirse que cualquier persona puede interponerlo, siempre y cuando individualice a los sujetos cuyos derechos fundamentales considera fueron conculcados (ver, por ejemplo, las sentencias números 2019-003879, 2021-017532 y 2022-009133, entre otras).
En consecuencia, respetuosamente y desde mi perspectiva, no luce válido que a tenor de un argumento genérico como la supuesta existencia de “grandes volúmenes de agua” que descienden “hacia la parte baja, ocasionando inundaciones, erosión de taludes, acumulación de basura y riesgo de deslizamientos” se conozca en esta sede sobre una inactividad administrativa que más corresponde ser residenciada en la jurisdicción contencioso-administrativa.
Aunado a lo anterior, en el caso concreto se hace necesario mencionar que, en los informes rendidos bajo la gravedad del juramento por Roberto Hernán Thompson Chacón, alcalde, Karen Bermúdez Fallas, coordinadora del Subproceso de Gestión Ambiental, y Lawrence Chacón Soto, coordinador de la Actividad de Alcantarillado Pluvial, todos de la Municipalidad de Alajuela, se subrayó lo siguiente: “…en la calle Vistas de la Pradera existe un sistema pluvial que requiere de una intervención para mejorar el manejo de las aguas pluviales de la carretera, esto con la finalidad de mejorar las condiciones actuales y la conservación de la vía, cuyo presupuesto sobrepasa la capacidad de efectuarse mediante la actividad ordinaria de nuestra dependencia. Esta intervención, se circunscribe únicamente a las aguas pluviales de la carretera y su mejoramiento, puesto que la vía posee deficiencias en cuanto a la escorrentía superficial, tal y como se señala en el informe N° CNE-UIAR-INF-1541-2024, generado por Juan Ignacio Chaves Salas, Geólogo de la Comisión Nacional de Emergencias (…) según el Manual Básico de Organización, el mantenimiento de la red pluvial del cantón no se encuentra dentro de las funciones de este Subproceso; cuando se tienen los recursos, cuando técnicamente se refleja la necesidad, o bien, cuando es un proyecto nuevo por desarrollar, esta unidad calcula dentro de los presupuestos de las calles la parte pluvial; en el tanto la Actividad de Alcantarillado Pluvial no tenga planificado intervenir la vía a corto o mediano plazo.
Esto significa que en muchas ocasiones el presupuesto asignado no sea suficiente para completar las obras. Que, Urbanización la Pradera se encuentra codificada dentro del inventario de la red vial cantonal con el código de calle 2-01-176-00, y con una longitud de 1,30Km. Que, siguiendo los lineamientos y políticas del Plan Vial Quinquenal 2024-2029 (PVQ 2024-2029), Urbanización La Pradera se encuentra dentro de la segunda política, perteneciente al portafolio de caminos urbanos; con la prioridad número 92. Es importante aclarar que, al momento de priorizar los trabajos dentro del Plan, se toma en cuenta, por ejemplo, el estado de superficie de la vía, tránsito promedio diario, índice social, vulnerabilidad de la población, zonas turísticas entre otras características, de todas las calles incluidas dentro del Plan mencionado, dando como resultado una proyección de los caminos que necesitan una intervención prioritaria.
Que, este Subproceso además de no tener dentro de las prioridades inmediatas Urbanización La Pradera, la vía no cuenta con presupuesto asignado para ejecución de proyecto de asfaltado; sin embargo, sí se ha dado mantenimiento rutinario mediante trabajos de bacheo”. A ello se le suma que, según esas mismas Autoridades, esa dependencia “…se refiere a mejoramiento de la canalización pluvial en vía pública y el recurrente expone situaciones que, como ya se mencionó, se presentan entre propiedades privadas”.
A la luz de tales elementos, considero que no se encuentra acreditada una amenaza directa e inminente a los derechos fundamentales supra mencionados. Más bien, la intervención de este Tribunal podría alterar la debida planificación administrativa del Gobierno Local para la tramitación de procedimientos y, eventualmente, la posterior ejecución de unas obras de suyo onerosas y que pueden afectar la adecuada administración y previsión de los recursos con los que cuenta dicha corporación para tales efectos. Por lo demás, como ya se advirtió, este tipo de omisiones administrativas que no evidencian una amenaza o lesión inminente a los derechos fundamentales de alguna persona en concreto deben ser planteadas y resueltas en las sedes ordinarias de legalidad.
En virtud de lo expuesto, salvo el voto y declaro sin lugar el recurso de amparo.
Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión número 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero de2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión número 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.
POR TANTO:
Se declara con lugar el recurso, únicamente en contra de la Municipalidad de Alajuela. Se ordena a Roberto Hernán Thompson Chacón, alcalde, Karen Bermúdez Fallas, coordinadora del Subproceso de Gestión Ambiental, y Lawrence Chacón Soto, coordinador de la Actividad de Alcantarillado Pluvial, todos de la Municipalidad de Alajuela, que i) en el plazo máximo de TRES MESES, contado a partir de la notificación de esta sentencia, dispongan de manera pronta y oportuna las acciones y coordinaciones necesarias para resolver de forma integral y definitiva el problema planteado por los recurrentes al respecto del alcantarillado pluvial y la acumulación de basura, de conformidad con lo estipulado en el informe técnico “Valoraciones de riesgo por mal manejo de aguas pluviales en la Urbanización La Pradera en la Guácima” nro. CNE-UIAR-INF-1541-2024 del 24 de marzo de 2025; y ii) en el plazo máximo de SIES MESES, contado a partir de la notificación de esta sentencia, tomen las medidas necesarias y giren las órdenes que correspondan dentro del ámbito de sus competencias, para que se repare y se vuelva transitable la calle pública de la comunidad de Urbanización La Pradera que es objeto del presente recurso, de conformidad con lo estipulado en el informe técnico ya citado.
Se advierte a las autoridades recurridas que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Alajuela al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En cuanto al CONAVI, se declara sin lugar el recurso. El magistrado Castillo Víquez consigna nota. El magistrado Salazar Alvarado consigna nota. La magistrada Garro Vargas salva el voto y declara sin lugar el recurso de amparo. Notifíquese.
