Decision No. 2026009020 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine thirty in the morning on trece de marzo de dos mil veintiseis.

Writ of amparo (recurso de amparo) proceeding under case no. 25-036535-0007-CO, filed by [Name 001], identity card [Value 001], against the ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO Y ALCANTARILLADO SANITARIO (ASADA) DE VALLE VASCONIA DE PARRITA, EL INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA), AND EL MINISTERIO DE SALUD.

Findings:

  1. 1In a written submission entered into the case file on 21 de noviembre de 2025, the petitioner filed a writ of amparo. He states that the competent authorities have failed to guarantee access to drinking water in the community of Pirrís, located in the canton of Parrita, a situation that infringes fundamental rights relating to health and equality. He explains that, for more than thirty years, residents have unsuccessfully sought the installation of a water-supply system, without the Ministerio de Salud, Asada Valle Vasconia, or AyA showing any genuine interest in resolving the problem, even though the community has a school, community hall, and church, none of which has access to clean water sources. He states that children must bring water from their homes in order to attend classes and that, at times, they do not even have water with which to wash their hands, because the supply comes from an untreated spring (naciente) whose flow decreases during the dry season; this also prevents the community hall from being used for recreational activities that are essential to mental health.He indicates that residents consume water of questionable quality, with a risk of contamination by coliform bacteria and heavy metals, and that there is a well drilled with public funds by the company Zaragoza de Palmares, as recorded in the minute book of the community Association, but it has been abandoned and is in deplorable condition, even though it could meet part of the community’s water needs. He argues that the Asada claims it lacks sufficient water capacity (capacidad hídrica) to provide the service, although, based on territorial jurisdiction (jurisdicción territorial), it is responsible for serving Pirrís, which he considers unequal treatment and social exclusion that forces families to purchase bottled water, an unsustainable expense for persons of limited means. He believes that requiring the community to bear the costs of a water-supply project constitutes a disproportionate demand and an improper transfer of responsibility, given that this is a public investment for which the authorities are responsible.He requests that, until a permanent solution is available, the supply of water be guaranteed by means of tanker trucks or treated tanks that are refilled frequently; that the well drilled with public funds be investigated and restored; and that urgent measures be adopted to ensure dignified access to drinking water under conditions of equity, empathy, and respect for the community.
  2. 2By decision issued at 19:57 hours on 2 de diciembre de 2025, the Presidency of the Chamber ordered the petitioner to submit “CURRENT CERTIFICATION OF THE LEGAL STATUS (PERSONERÍA JURÍDICA) OF THE ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO Y ALCANTARILLADO SANITARIO DE VALLE VASCONIA DE PARRITA DE PUNTARENAS, as well as the EXACT ADDRESS of the location designated by its legal representative or registered agent for purposes of service.”
  3. 3In a written submission entered into the case file on 3 de diciembre de 2025, the petitioner provided the required documentation.
  4. 4By decision issued at 11:33 hours on 4 de diciembre de 2025, the Presidency of the Chamber admitted the proceeding and requested reports from the executive president and the head of the Unidad Cantonal de Parrita, both of the Instituto Costarricense de Acueductos y Alcantarillados, and from the director of the Área Rectora de Salud de Parrita; it also served notice on Gerardo Godínez Quesada, in his capacity as president of the respondent Asada.
  5. 5In a written submission entered into the case file on 10 de diciembre de 2025, Fernando Araya Araya, director of the Región Pacífico Central del ICAA, reports: “With regard to the circumstances underlying the writ of amparo filed by Mr. [Name 001] against the Instituto Costarricense de Acueductos y Alcantarillados, based on the technical report prepared by the undersigned in Memorandum N°GSP-RPC-PA-2025-00391 dated 9 de diciembre del 2025, which is attached as evidence supporting this report, and the scope of the applicable provision established in the Reglamento para la Prestación de los Servicios de AyA, the following has been demonstrated: 1. A review of the case file confirms that the community at issue in the writ of amparo is not within the service area of the system administered, operated, and marketed by AyA through the Cantonal de Parrita, according to the technical and operational boundaries established for that aqueduct (See report N°GSP-RPC-PA-2025-00391). 2.The community is located no less than 15 kilometers from the cantonal office, which further confirms that AyA is not responsible for providing the service in that area, because there is no public infrastructure, registered distribution network, or defined service area under this institution’s responsibility (See report N°GSP-RPC-PA-2025-00391). 3. The technical and legal analysis further indicates that responsibility for providing the water supply lies with the delegated systems (ASADAS) identified in the case file itself, which have territorial jurisdiction and authority to address that need, in accordance with the community-based model for administering water resources and the regulations in force (See report N°°GSP-RPC-PA-2025-00391). 4. The alleged omission by the Dirección Regional and the Jefatura Cantonal de Parrita does not fall within this Institute’s authority, because AyA is not the entity responsible for supplying water to the identified community; therefore, because it is not the service operator, it must be established that no legal or technical obligation exists on the basis of which responsibility could be assigned to AyA (See report N°°GSP-RPC-PA-2025-00391).”
  6. 6In a written submission added to the expediente on 10 de diciembre de 2025, Lourdes María Suárez Barboza, executive president of ICAA, reports: “SOLE: NOT TRUE. In this regard, Eng. Jorge Alfaro Carmona, an official with the Engineering Technical Area of the Oficina Regional de Acueductos Comunales (ORAC), Región Pacífico Central, states in official letter No. GSD-UEN-GAR-2025-04876, dated 08 de diciembre del 2025: “The community of Pirrís de Parrita is not part of the territory served by ASADA Valle Vasconia and does not have formal water-supply infrastructure (infraestructura formal de acueducto) administered by AyA or under delegated administration; therefore, its current water supply is self-managed through an untreated spring (naciente) and a well without a current concession (concesión). The Valle Vasconia water-supply system (acueducto) has neither the water capacity nor the hydraulic or topographical conditions necessary to incorporate Pirrís, and the recent works on Ruta 609 relate solely to internal improvements to the system.Likewise, the institutional water-tanker service has materially limited capacity and is used exclusively for emergencies affecting existing water-supply systems, making it impossible to serve communities without formal infrastructure. The community has no pending proceedings (trámites) before AyA.” In addition, Eng. Alfaro Carmona states in the “Informe respuesta Recurso de Amparo No. 25-036535-0007-CO” that: “I. Executive Summary Following the requested technical, administrative, and documentary analysis, it is determined that the community of Pirrís de Parrita is not part of the territory served by ASADA Valle Vasconia, that no administrative act (acto administrativo) establishes such territorial responsibility, and that no formal infrastructure administered by AyA or by a delegated ASADA exists through which the community could be supplied. The current supply is self-managed by residents through an untreated spring and a well drilled with IMAS funds more than two decades ago; the latter is not formally operational, and no evidence has been provided that it has a current concession, recent hydrogeological studies, or sanitary conditions suitable for human consumption.The community has no pending proceedings before AyA. Regarding supply by water tankers, AyA has materially and operationally limited capacity to provide this service, which is used exclusively to address emergencies in existing water-supply systems and not to serve communities lacking both a formal water-supply system and receiving infrastructure. II. Background 2.1. Territorial jurisdiction (competencia territorial) ORAC RPC reported in memorandum GSD-UEN-GAR-2025-01767 that Pirrís is not among the communities served by ASADAS within its jurisdiction; therefore, no service responsibility exists. There is no territorial-delimitation decision, administrative act, or infrastructure linking Pirrís to the Valle Vasconia water-supply system. The community is located more than two kilometers from the existing network, confirming the absence of formal coverage. 2.2. Water-supply situation in Pirrís The amparo petition indicates that the community obtains its water from: • An untreated spring, with a flow rate (caudal) that varies by season. • A well drilled with IMAS funds, according to community minutes (actas comunitarias), but which is abandoned, lacks a concession and maintenance, and has no current quality studies.AyA has no record of infrastructure, concessions, studies, or systems associated with this locality. 2.3. Water capacity of ASADA Valle Vasconia The Estudio Técnico de Evaluación Hidráulica prepared by ICEA and approved through official letter GSD-UEN-GAR-2023-00094 shows that: • ASADA operates with limited capacity. • The water intakes (captaciones) must be improved, bulk metering (macromedición) must be installed, and internal works must be carried out. • New water-supply sources must be sought, because the system cannot accommodate new services. This confirms that there is no technical or water-supply capacity to incorporate new communities. 2.4. Invitation AGPP-GDC-08-2024 Community letter AGPP-GDC-08-2024 was addressed to the Head of the Oficina Cantonal de AyA en Parrita, inviting that office to a working session. It is clarified that: • It does not constitute a formal proceeding. • There is no documentary evidence that the meeting took place. • ORAC Pacífico Central did not receive an invitation. • No administrative or technical process arose from that effort. 2.5.Regarding the installation of piping on Ruta 609 The petitioner states that he observed pipe-replacement work on highway 609. According to the approved Estudio Técnico: • These works are internal improvements to the existing system, intended to reduce losses and improve efficiency. • They are unrelated to expanding coverage or enabling new planned connections (previstas). • The study clearly establishes that new sources are required before any expansions may be considered. Therefore, the petitioner’s interpretation lacks a technical basis. (…) IV. Analysis Absence of infrastructure through which Pirrís could be supplied No transmission, storage, or distribution network reaches Pirrís. This makes it impossible to assess feasibility or establish temporary interconnections. Infeasibility of using the well drilled with IMAS funds The well lacks: • A current concession. • Current hydrogeological studies. • Water-quality analyses. • Hydraulic integration into a formal system.It therefore cannot be considered a potable-water supply source. Technical impossibility of supplying Pirrís due to the topography and configuration of the water-supply system In addition to the foregoing, from a strictly hydraulic standpoint it is impossible to supply Pirrís from the Valle Vasconia water-supply system because of: a) Difference in elevation Pirrís is located at a higher elevation than the tanks and distribution lines of the Valle Vasconia water-supply system. The system is designed to operate by gravity, carrying water from a higher to a lower elevation, not upward. b) Absence of pumping or force-main infrastructure (infraestructura de bombeo o impulsión) To supply an area at a higher elevation, the following are required: • Pumping stations. • Force mains designed to overcome the elevation difference. • Intermediate tanks or pressure-break chambers (cámaras de quiebragradiente).None of these components exists in ASADA’s water-supply system. c) Hydraulic design incompatible with expansion toward Pirrís The water-supply system was designed for its current territory. Any attempt to convey water to Pirrís would require: • Building a new, independent transmission line. • Designing a new pumping system. • Building a storage tank for that community. • Establishing a new distribution network. In other words, an entirely new water-supply system. Conclusion of this section Even if water were available (which it is not), supplying Pirrís with the current infrastructure is physically impossible for topographical and hydraulic reasons inherent in the design of the Valle Vasconia water-supply system. REGARDING SUPPLY BY WATER TANKER Water-tanker supply is used solely as an emergency mechanism for water-supply systems administered directly by AyA or for delegated systems experiencing operational failures. 5.1 Material limitations of the service AyA has a materially limited fleet, which must respond to: • Service interruptions in AyA systems • Emergencies affecting delegated ASADAS • Priority situations in areas with affected formal infrastructure This service is exceptional and is not used to supply communities without a water-supply system. 4.2 Limitations on external contracting Even external contracting is subject to restrictions: • High internal demand at AyA during emergencies • Limited availability of providers during critical periods • The need for safe receiving infrastructure, which Pirrís does not have 4.3 Reasons why Pirrís cannot be supplied by tanker • Pirrís has no formal water-supply system to support • There is no safe discharge point for potable water • Institutional logistics prioritize emergencies affecting existing systems For these reasons, the community cannot be supplied by water tankers. 5.PENDING PROCEEDINGS Following a review of institutional records: • There is no pending proceeding relating to Pirrís. • There are no pending requests for feasibility (factibilidad), coverage expansion, source studies, tanker support, or incorporation.” (emphasis added) It follows from the foregoing that the community of Pirris, where the petitioner’s property is located, has a private water-supply system created with funds from the Instituto Mixto de Ayuda Social, without any involvement by the Instituto Costarricense de Acueductos y Alcantarillados. The community currently has a self-supply system independent of the system supplying the community of Valle Vasconia; because of the geographical location of the two communities, it is “… technically impossible to supply Pirris due to the topography and configuration of the water-supply system…,” according to Eng. Jorge Alfaro Carmona, an official with ORAC Pacífico Central of AyA.Interconnecting the two systems is likewise impossible because of both the distance between the two communities and the current condition of the system managed by ASADA de Valle Vasconia, according to engineering technical report No. GSD-UENGAR-2023-00094, dated 17 de enero del 2023, addressed to the association’s Board of Directors. Lastly, it is important to note that Eng. Jorge Alfaro Carmona, in the “Informe respuesta Recurso de Amparo No. 25-036535-0007-CO,” transmitted with official letter No. GSD-UEN-GAR-2025-04876, dated 08 de diciembre del 2025, stated: “… V. Conclusions 1. Pirrís is not part of the territory served by ASADA Valle Vasconia. 2. The community obtains its water through a self-managed system. 3. There are no legal, technical, or infrastructural conditions that would allow Pirrís to be incorporated into the existing water-supply system. 4. The improvements on Ruta 609 are internal works, not an expansion. 5.The topography and hydraulic design make it impossible to supply Pirrís from Valle Vasconia. 6. There is no pending proceeding before AyA. 7. Pirrís cannot be supplied by water tanker because of AyA’s material and logistical limitations. VI. Recommendations 1. Send this report to Legal together with all supporting documents. 2. State that there is no territorial or physical capacity to supply Pirrís. 3. State that any solution must begin with a new comprehensive project, including hydrogeological studies, water-supply system designs, and designation of the entity responsible for administration, which may be assessed after the interested parties submit a formal request.”.
  7. 7In a written submission added to the case file (expediente) on 16 de diciembre de 2025, Gerardo Godínez Quesada, president of Asada Valle Vasconia de Parrita, states: “FIRST: The community of Pirrís is a neighboring community bordering the delegated service area (zona de competencia) of ASADA Valle Vasconia. When the ASADA was established, the community of Pirrís was consulted regarding its interest in becoming part of it, but at that time the leaders of that community decided not to participate in the efforts required for that purpose. Consequently, the community is not (and has never been) part of the service area delegated to this association, as also established in the delegation agreement entered into with the ICAA. SECOND: Articles 39 and 40 of the ‘Regulations Governing Associations that Administer Community Water Supply and Sewerage Systems’ clearly establish the scope of authority of the ASADAS: ‘Article 39.Provision of services. The ASADA shall provide and ensure the proper provision of drinking-water supply and wastewater sanitation services within the delegated service area, in accordance with the AyA Service Provision Regulations. Article 40. Service area. The ASADA’s service area shall be determined by the respective delegation agreement, and that area shall be defined on the basis of technical capacity, system growth, social feasibility, and water-resource availability, with these criteria prevailing in all cases.’ THIRD: Pursuant to the eighth clause of the Delegation Agreement entered into between this ASADA and the ICAA, it was lawfully established that ‘the jurisdiction of the operating entity shall be determined by the system’s technical capacity,’ with this technical criterion prevailing in all cases. FOURTH: Because the community of Pirrís lies outside the ASADA’s legal authority, and considering the implications for the financial sustainability of a private nonprofit association, this ASADA has never administered or managed water-supply or sanitation services for that community, since doing so would exceed the authority and capacities delegated by the Administration itself.FIFTH: Extending service to new communities does not fall within the authority of the ASADAS, because the ICAA is the governing technical entity. Pursuant to Articles 34 and 43 of the ASADAS Regulations, construction of the systems is the responsibility of the interested parties or the ICAA, which may construct drinking-water systems and turn them over for operation to duly registered ASADAS. SIXTH: Notwithstanding the foregoing, and despite the fact that the community of Pirrís is not included among the areas served by this association, ASADA Valle Vasconia has always been willing to incorporate it into its operations based on considerations of community and geographic proximity. To that end, this ASADA has made significant efforts to finance technical-capacity studies with the aim of improving the system it administers and potentially adding sufficient capacity to serve new applicants.Regarding the material and technical impossibility (water-supply and hydraulic incapacity): SEVENTH: The record shows that, at least since 2018, no water availability has existed for granting new services. At that time, the 2013 technical study did not permit service availability to be granted, so this ASADA approached the ICAA to seek solutions, resulting in a recommendation that a new technical study be conducted to determine the system’s updated technical capacity (official letter GSD-UEN-GAR-2020-01113 dated 19 de marzo de 2020). EIGHTH: As part of its efforts to improve the water-supply system and make service available, in 2022 this ASADA financed an updated technical study entitled ‘HYDRAULIC ASSESSMENT STUDY, DRINKING-WATER AND FIRE-HYDRANT SYSTEMS, INTEGRATED VALLE VASCONIA WATER-SUPPLY SYSTEM, PARRITA, PUNTARENAS,’ which was reviewed and approved by the ICAA through official letter GSD-UEN-GAR-2003-00094 dated 17 de enero del 2023.NINTH: Of the utmost importance to this argument, that technical study showed that the system is at the limit of its water-supply capacity and has hydraulic problems. Regarding water-supply capacity, pages 40 and 41 of the study conclude that the system was operating at its limit and that we could assign only 55 new service requests, all of which had already been assigned by that year: ‘Based on the data concerning source capacity, the water-supply system has an actual and current POSITIVE WATER BALANCE for the estimated demand, leaving an available amount for projected future demand of (7.41 – 6.80) = 0.61 liters/second, provided that conditions remain favorable. (...) Under the assessment conditions, the surplus flow is sufficient to supply 55 new service requests. (…) New supply sources must be sought, whether through other springs (nacientes) or wells, preferably near Storage Tank N°3.’ Regarding hydraulic capacity, page 56 of the same technical study concludes, among other things, as follows: ‘Based on the demand established for the Integrated Valle Vasconia Water-Supply System, the hydraulic assessment shows limitations, that is, insufficient capacity in certain branches, both along the transmission main and in all four systems.’ TENTH: In addition, the community of Pirrís is located at an elevation that makes it hydraulically infeasible to supply that location without a substantial investment in pumping equipment that this ASADA currently does not possess, compounding the lack of hydraulic technical capacity to provide it with service in the future under current technical conditions.ELEVENTH: In various verbal and written communications with the ICAA, particularly with Mr. Jorge Ramírez Rodríguez in his capacity as head of the Oficina Regional de Acueductos Comunales Región Pacífico Central, we have been informed, and it has been acknowledged, that this ASADA is currently unable to provide additional services due to a lack of technical capacity. Likewise, those communications have expressly requested assistance in meeting new demand for services. Regarding the possible extension of service to the community of Pirrís: TWELFTH: The record shows that the ICAA is aware that the community of Pirrís lacks a water-supply system and that the community previously approached the INDER to facilitate access to one. Nevertheless, it is unknown why those efforts failed or why the ICAA has not included the design and construction of a supply system for that community in its project portfolio, a highly sensitive matter that should have been handled under a principle of interinstitutional and/or intrainstitutional (departmental) coordination.In this regard, we attach documentary evidence (evidence #6) corroborating that the ICAA has had both the authority and the knowledge necessary to take the appropriate action, but we do not know whether the foregoing has been pursued or communicated to the protected party or members of the community. That evidence shows that on 05 de agosto de 2024, the officials (ICAA departments) stated, among other things: ‘As the AyA official who received the request, you may arrange with your supervisors for the design and construction of the supply system for that community to be included in the project portfolio, as was done in the case of Dos Bocas de Quepos, according to the processing-related official letters sent to you as an example.’ THIRTEENTH: Indeed, on 29 de abril de 2024, demonstrating this ASADA’s good faith and willingness to have the situation of the community of Pirrís resolved, this association filed a constitutional protection action (recurso de amparo) on behalf of that community and against the ICAA (ad effectum videndi et probandi expediente n.° 24-11252-0007-CO), describing in that action the specific efforts being made to increase the flow and the genuine intention to resolve this important matter for that community.The action was dismissed because, at that time, our legal counsel did not clearly advise us that we were required to submit evidence to this Court of communications or proof that the ICAA was aware of the problem in the community of Pirrís (and that, under the principle of coordination, those existing efforts should have been deemed known to the INDER authority and, even more so, to the ICAA). FOURTEENTH: On 07 de abril de 2025, the protected party sent a communication asking why this ASADA could not provide drinking-water service to his community. Although, pursuant to the case law of this Chamber, the right of petition may be exercised only before Public Administrations and not before private-law entities such as the ASADAS, this association, acting in good faith, responded through official letter VV-02-2025 dated 14 de abril de 2025, explaining the system’s material and technical inability and reiterating the recommendation that he apply to the ICAA as the competent administrative authority.FIFTEENTH: This ASADA continues its efforts to finance the improvements the system requires in order to increase its current capacity and flow and ensure the system’s future quality and availability. It already has the technical study endorsed by the ICAA and continues to hold meetings with the Oficina Regional de Acueductos Comunales (ORAC) to proceed with system improvements, including among the recommendations to be addressed an increase in flow and the allocation of sources. SIXTEENTH: This association is sensitive to and recognizes the existing problem in the community of Pirrís and remains willing and committed to undertake any necessary coordination with the Public Administration to ensure access to drinking water for its residents: whether through the potential construction of infrastructure within our ASADA that would overcome the current water-supply and hydraulic limitations, thereby allowing them to be incorporated in the future; or through whatever action the governing technical entity determines appropriate to resolve the problem at issue.”.
  8. 8In a written submission added to the case file on 17 de diciembre de 2025, Osvaldo Quirós Chacón, environmental manager of the Área Rectora de Salud de Parrita, states: “FIRST: On 10 de diciembre de 2025, a document review was conducted at the Área Rectora de Salud de Parrita, and it was determined that no application or proceeding had been filed by Mr. [Nombre 001] in connection with the case at hand. SECOND: On 15 de diciembre de 2025, Technical Inspection Report N°MS-DRRSPC-DARSPA-IT-0416-2025 (attachment N°1) was issued. Based on inspections conducted on 10 de diciembre de 2025 in the community of Pirris and at the offices of the ASADA de Valle Vasconia, the report concludes as follows: ‘…Based on the foregoing, it is concluded that the community of Pirrís does not receive a potable-water supply from the aqueduct operated by ASADA Valle Vasconia because of duly documented water-supply and hydraulic-capacity limitations known to the Instituto Costarricense de Acueductos y Alcantarillados.Furthermore, the verification conducted at the community school confirms that the available water resource is not potable, as it has a residual chlorine concentration of 0 mg/L, evidencing noncompliance with the parameters established by the health regulations currently in force, as verified through Inspection Records DARSPA-OQC-133-2025 and DARSPA-OQC-134-2025…’. THIRD: ASADA Valle Vasconia submitted a water study showing that the system lacks the water-supply and hydraulic capacity necessary to provide water to the community of Pirris (attachment N°2). It also submitted Official Letter N°GSD-UEN-GAR-2023-00094 (attachment N°3) from the Instituto Costarricense de Acueductos y Alcantarillados, approving the technical study conducted by the ASADA. FOURTH: On 16 de diciembre de 2025, the Área Rectora de Salud Parrita served Health Order (Orden Sanitaria) N°MS-DRRSPC-DARSPA-OS-0126-2025 (attachment N°4) on the executive presidency of the Instituto Costarricense de Acueductos y Alcantarillados, ordering it to: ‘Submit to the Área Rectora de Salud de Parrita an Action Plan, together with its corresponding implementation schedule and the persons responsible for its execution, to carry out the following activities: • Immediately implement interim measures to guarantee access to potable water for the community of Pirrís de Parrita. • Within no more than 12 calendar months, implement the water-supply, hydraulic, infrastructure, and administrative solutions necessary to provide the community of Pirrís de Parrita with permanent access to potable water.’ Proof of service is provided (attachment N°5).”
  9. 9In a written submission added to the case file on 17 de febrero de 2026, the appellant states: “(…) AyA has NOT submitted any plan or taken any meaningful action regarding the potable-water issue in Pirrís, thereby failing to comply with Health Order MS-DRRSPC-DARSPA-OS-0126-2025.”
  10. 10The legal requirements have been observed in the proceedings conducted.

Justice Rueda Leal drafts the opinion; and,

Considering:

I. SUBJECT MATTER OF THE APPEAL

The appellant alleges that the respondent authorities have failed to guarantee access to potable water in the community of Pirrís, located in the canton of Parrita. He states that, for more than thirty years, the residents have unsuccessfully sought the installation of a water-supply system, without the problem having been resolved. He claims that community residents consume water of questionable quality, with a risk of contamination by coliform bacteria and heavy metals, and that there is a well drilled with public funds by the company Zaragoza de Palmares, as recorded in the community Association’s minute book, but that it is abandoned and in deplorable condition, even though it could meet part of the community’s water needs. He argues that the Asada claims it lacks the water-supply capacity to provide the service, although its territorial jurisdiction requires it to serve Pirrís, which he considers unequal treatment and social exclusion that forces families to purchase bottled water.

He maintains that requiring the community to bear the costs of a water-supply project is a disproportionate demand. He requests that, until a permanent solution is available, the supply be guaranteed through tanker trucks or treated tanks that are refilled frequently; that the well drilled with public funds be investigated and restored; and that urgent measures be adopted to ensure dignified access to potable water.

II. PROVEN FACTS

The following facts, which are relevant to the resolution of this matter, are deemed duly established, either because they have been proven or because the respondent authority failed to address them, as directed in the initial order:

  • a)The community of Pirrís is not within the ICAA service area; consequently, that institution has no infrastructure or networks at the site. (ICAA Report).
  • b)The community of Pirrís is outside the area of authority delegated to Asada de Valle Vasconia, which lacks the water-supply and hydraulic capacity to provide new services. (Response of the respondent Asada).
  • c)The community of Pirrís obtains water from: “• An untreated spring (naciente), with a flow rate that varies according to the season. • A well drilled with IMAS funds, according to community records, but which is abandoned, lacks a concession, has not been maintained, and has no current water-quality studies.” (ICAA Report).
  • d)On 10 de diciembre de 2025, the Área Rectora de Salud de Parrita conducted an inspection in the community of Pirrís, and Technical Report no. MS-DRRSPC-DARSPA-IT-0416-2025 of 15 de diciembre de 2025 stated: “CONCLUSIONS Based on the foregoing, it is concluded that the community of Pirrís does not receive a potable-water supply from the aqueduct operated by ASADA Valle Vasconia because of duly documented water-supply and hydraulic-capacity limitations known to the Instituto Costarricense de Acueductos y Alcantarillados. Furthermore, the verification conducted at the community school confirms that the available water resource is not potable, as it has a residual chlorine concentration of 0 mg/L, evidencing noncompliance with the parameters established by the health regulations currently in force, as verified through Inspection Records DARSPA-OQC-133-2025 and DARSPA-OQC-134-2025. RECOMMENDATIONS It is recommended that the Área Rectora de Salud de Parrita issue the corresponding Health Order to the Instituto Costarricense de Acueductos y Alcantarillados, requiring it, within 5 business days, to submit to the Área Rectora de Salud de Parrita an Action Plan, together with its corresponding implementation schedule and the persons responsible for its execution, for the performance of the following activities: • Immediately implement interim measures to guarantee access to potable water for the community of Pirrís de Parrita. • Within 12 calendar months, implement the water-supply, hydraulic, infrastructure, and administrative solutions necessary to provide the community of Pirrís de Parrita with permanent access to potable water.” (Documentary evidence).
  • e)On 15 de diciembre de 2025, the Área Rectora de Salud de Parrita issued Health Order no. MS-DRRSPC-DARSPA-OS-0126-2025, addressed to ICAA, which ordered it to: “Submit to the Área Rectora de Salud de Parrita an Action Plan, together with its corresponding implementation schedule and the persons responsible for its execution, to carry out the following activities: • Immediately implement interim measures to guarantee access to potable water for the community of Pirrís de Parrita. • Within no more than 12 calendar months, implement the water-supply, hydraulic, infrastructure, and administrative solutions necessary to provide the community of Pirrís de Parrita with permanent access to potable water.” (Report of the respondent authority and documentary evidence).
  • f)Before filing the appeal, the appellant had not submitted any complaint or application to the Área Rectora de Salud de Parrita concerning the situation under examination (sub examine). (Report of the respondent authority).

III. THE SPECIFIC CASE

In the matter at hand (sub lite), the appellant alleges that the respondent authorities have failed to guarantee access to potable water in the community of Pirrís, located in the canton of Parrita. He states that, for more than thirty years, the residents have unsuccessfully sought the installation of a water-supply system, without the problem having been resolved. He claims that community residents consume water of questionable quality, with a risk of contamination by coliform bacteria and heavy metals, and that there is a well drilled with public funds by the company Zaragoza de Palmares, as recorded in the community Association’s minute book, but that it is abandoned and in deplorable condition, even though it could meet part of the community’s water needs. He argues that the Asada claims it lacks the water-supply capacity to provide the service, although its territorial jurisdiction requires it to serve Pirrís, which he considers unequal treatment and social exclusion that forces families to purchase bottled water.

He maintains that requiring the community to bear the costs of a water-supply project is a disproportionate demand. He requests that, until a permanent solution is available, the supply be guaranteed through tanker trucks or treated tanks that are refilled frequently; that the well drilled with public funds be investigated and restored; and that urgent measures be adopted to ensure dignified access to potable water.

The case record establishes that the community of Pirrís is not located within the ICAA service area, such that the institution has no infrastructure or networks at the site. The community of Pirrís is outside the area of authority delegated to the Asada de Valle Vasconia, which lacks the water-resource and hydraulic capacity to provide new services. The community of Pirrís obtains its water through: “• An untreated spring (naciente), with a flow rate that varies by season. • A well drilled with IMAS funds, according to community records, but which is abandoned, without a concession, without maintenance, and without current quality studies.” On 10 de diciembre de 2025, the Área Rectora de Salud de Parrita conducted an inspection in the community of Pirrís, and technical report no. MS-DRRSPC-DARSPA-IT-0416-2025 of 15 de diciembre de 2025 stated: “CONCLUSIONS Based on the foregoing paragraphs, it is concluded that the community of Pirrís does not receive a potable-water supply from the aqueduct operated by ASADA Valle Vasconia due to duly documented water-resource and hydraulic capacity limitations known to the Instituto Costarricense de Acueductos y Alcantarillados.

Likewise, the verification performed at the community school confirms that the available water resource is not potable, as it has a residual chlorine concentration of 0 mg/L, evidencing noncompliance with the parameters established in the health regulations currently in force, as confirmed through Inspection Records DARSPA-OQC-133-2025 and DARSPA-OQC-134-2025. RECOMMENDATIONS It is recommended that the Área Rectora de Salud de Parrita issue the corresponding health order (Orden Sanitaria) to the Instituto Costarricense de Acueductos y Alcantarillados, requiring it, within 5 business days, to submit to the Área Rectora de Salud de Parrita an Action Plan, together with its implementation schedule and the persons responsible for its execution, for the performance of the following activities: • Immediately implement interim measures to guarantee access to potable water for the community of Pirrís de Parrita. • Within 12 calendar months, implement the water-resource, hydraulic, infrastructure, and administrative solutions necessary to provide the community of Pirrís de Parrita with permanent access to potable water.” On 15 de diciembre de 2025, the Área Rectora de Salud de Parrita issued health order no. MS-DRRSPC-DARSPA-OS-0126-2025, addressed to ICAA, providing as follows: “Submit to the Área Rectora de Salud de Parrita an Action Plan, together with its implementation schedule and the persons responsible for its execution, for the performance of the following activities: • Immediately implement interim measures to guarantee access to potable water for the community of Pirrís de Parrita. • Within no more than 12 calendar months, implement the water-resource, hydraulic, infrastructure, and administrative solutions necessary to provide the community of Pirrís de Parrita with permanent access to potable water.” Before filing the petition, the petitioner had not submitted any complaint or request to the Área Rectora de Salud de Parrita concerning the situation at issue in the matter under examination (sub examine).

Against this background, the intervention of this constitutional jurisdiction is necessary in the matter before the Court (sub iudice).

In this regard, the case record establishes that the community of Pirrís de Parrita faces a problem involving the supply of potable water, since neither ICAA nor the Asada de Valle Vasconia provides service in the area because it lies outside their respective service areas, and there is no infrastructure or distribution network at the site.

Accordingly, the community obtains its water from “• An untreated spring, with a flow rate that varies by season. • A well drilled with IMAS funds, according to community records, but which is abandoned, without a concession, without maintenance, and without current quality studies.” However, according to the results of the inspection conducted by the Área Rectora de Salud de Parrita on the preceding 10 de diciembre, that supply system is inadequate, to the point that the water consumed by the population does not meet potability standards.

Indeed, technical report no. MS-DRRSPC-DARSPA-IT-0416-2025 of 15 de diciembre de 2025 states that the health authority explained: “(…) the verification performed at the community school confirms that the available water resource is not potable, as it has a residual chlorine concentration of 0 mg/L, evidencing noncompliance with the parameters established in the health regulations currently in force, as confirmed through Inspection Records DARSPA-OQC-133-2025 and DARSPA-OQC-134-2025 (…)”; this demonstrates a particular adverse effect on the community’s student population.

Based on the foregoing, it is established that the Área Rectora de Salud de Parrita issued health order no. MS-DRRSPC-DARSPA-OS-0126-2025 of 15 de diciembre de 2025, specifically addressed to ICAA, providing as follows: “Submit to the Área Rectora de Salud de Parrita an Action Plan, together with its implementation schedule and the persons responsible for its execution, for the performance of the following activities: • Immediately implement interim measures to guarantee access to potable water for the community of Pirrís de Parrita. • Within no more than 12 calendar months, implement the water-resource, hydraulic, infrastructure, and administrative solutions necessary to provide the community of Pirrís de Parrita with permanent access to potable water.” Thus, this Chamber finds that the matter at hand involves a problem that causes a particular adverse effect, including on minors attending the community school, to the point that intervention by the health authority was necessary so that ICAA, in its capacity as the governing entity in this field, would undertake actions aimed at resolving the identified health problem.

Consequently, the petition must be granted with respect to the ICAA authorities in order to ensure effective compliance with health order no. MS-DRRSPC-DARSPA-OS-0126-2025 of 15 de diciembre de 2025.

IV.Finally, with respect to the respondent Asada and the Área Rectora de Salud de Parrita, prima facie no irregularity capable of being declared through these proceedings is apparent. Nevertheless, the latter health authority shall take note of this decision in order to supervise effective compliance with the health order issued.

V. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are hereby advised that, if they submitted any paper document, object, or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced by new technologies, such materials must be retrieved within a maximum period of 30 business days from notification of this judgment. Notice is given that any material not collected within that period will be destroyed pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial” (approved by the Corte Plena in Article XXVI of session no. 27-11 of 22 de agosto de 2011 and published in Boletín Judicial no. 19 of 26 de enero de 2012) and Article LXXXI of the Consejo Superior del Poder Judicial session no. 43-12 of 3 de mayo de 2012.

Por tanto:

The petition is partially granted, solely with respect to the Instituto Costarricense de Acueductos y Alcantarillados. Lourdes María Suárez Barboza and Fernando Araya Araya, respectively the Executive President and Director of the Región Pacífico Central, both of the Instituto Costarricense de Acueductos y Alcantarillados, or whoever holds those positions, are ordered to issue the pertinent directives, undertake the appropriate coordination, and carry out all actions falling within the scope of their respective authority so that the provisions of health order no. MS-DRRSPC-DARSPA-OS-0126-2025 of 15 de diciembre de 2025 are fulfilled within the time limits specified in that administrative act. The respondent authority is advised that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo proceeding (recurso de amparo) that the person is required to comply with or enforce, and who fails to comply with or enforce it, shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.

The Instituto Costarricense de Acueductos y Alcantarillados is ordered to pay the costs and the damages arising from the facts underlying this ruling, which shall be assessed during enforcement of the judgment before the contentious-administrative jurisdiction (vía contencioso-administrativa). In all other respects, the petition is denied. The Área Rectora de Salud de Parrita shall take note of the matters stated in Considerando IV of this decision. Notice shall be served.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del trece de marzo de dos mil veintiseis .

Recurso de amparo que se tramita en el expediente nro. 25-036535-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra la ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO Y ALCANTARILLADO SANITARIO (ASADA) DE VALLE VASCONIA DE PARRITA, EL INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA) Y EL MINISTERIO DE SALUD.

Resultando:

  1. 1Por escrito incorporado al expediente el 21 de noviembre de 2025, el accionante interpone recurso de amparo. Manifiesta que las autoridades competentes han omitido garantizar el acceso al agua potable en la comunidad de Pirrís, ubicada en el cantón de Parrita, situación que vulnera derechos fundamentales relacionados con la salud y la igualdad. Expone que durante más de treinta años los vecinos han gestionado sin éxito la instalación de un sistema de abastecimiento, sin que el Ministerio de Salud, la Asada Valle Vasconia ni el AyA hayan mostrado interés real en resolver la problemática, pese a que la comunidad cuenta con escuela, salón comunal e iglesia, todos sin acceso a fuentes limpias de agua. Indica que los niños deben llevar agua desde sus hogares para asistir a clases y, en ocasiones, ni siquiera disponen de líquido para lavarse las manos, pues el suministro proviene de una naciente no tratada que disminuye su caudal en época seca, lo que también impide el uso del salón comunal para actividades recreativas esenciales para la salud mental.Señala que los vecinos consumen agua de dudosa calidad, con riesgo de contaminación por coliformes y metales pesados, y que existe un pozo perforado con fondos públicos por la empresa Zaragoza de Palmares, según consta en el libro de actas de la Asociación de la comunidad, pero se encuentra abandonado y en condiciones deplorables, pese a que podría suplir parte de la necesidad hídrica. Argumenta que la Asada alega falta de capacidad hídrica para brindar el servicio, aunque por jurisdicción territorial le corresponde atender a Pirrís, lo que considera un trato desigual y una exclusión social que obliga a las familias a comprar agua embotellada, gasto insostenible para personas con escasos recursos. Estima que exigir a la comunidad asumir los costos de un proyecto de abastecimiento constituye una pretensión desproporcionada y un acto de sobre atribución de responsabilidad, dado que se trata de una inversión pública que compete a las autoridades.Solicita que, mientras no exista una solución definitiva, se garantice el suministro mediante cisternas o tanques tratados y llenados con frecuencia, se investigue y recupere el pozo perforado con fondos públicos y se adopten medidas urgentes para asegurar el acceso digno al agua potable, en condiciones de equidad, empatía y respeto hacia la comunidad.
  2. 2Mediante resolución de las 19:57 horas de 2 de diciembre de 2025, la Presidencia de la Sala le previno al accionante aportar “CERTIFICACIÓN DE PERSONERÍA JURÍDICA VIGENTE DE LA ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO Y ALCANTARILLADO SANITARIO DE VALLE VASCONIA DE PARRITA DE PUNTARENAS, así como la DIRECCIÓN EXACTA del lugar señalado por su representante legal o agente residente para efectos de notificación”.
  3. 3Por escrito incorporado al expediente el 3 de diciembre de 2025, el accionante aporta la documentación requerida.
  4. 4Mediante resolución de las 11:33 horas de 4 de diciembre de 2025, la Presidencia de la Sala le dio curso al proceso y le solicitó informe a la presidenta ejecutiva y a la jefa de la Unidad Cantonal de Parrita, ambas del Instituto Costarricense de Acueductos y Alcantarillados y al director del Área Rectora de Salud de Parrita; asimismo, dio traslado a Gerardo Godínez Quesada, en su condición de presidente de la Asada recurrida.
  5. 5Por escrito incorporado al expediente el 10 de diciembre de 2025, Fernando Araya Araya, director de la Región Pacífico Central del ICAA, informa: “En atención a la situación objeto del amparo planteado por el señor [Nombre 001], contra el Instituto Costarricense de Acueductos y Alcantarillados, con fundamento en el informe técnico elaborado por el suscrito, mediante Memorando N°GSP-RPC-PA-2025-00391 de fecha 9 de diciembre del 2025, el cual se adjunta como prueba de este informe, y alcance de la norma que al efecto se regula en el Reglamento para la Prestación de los Servicios de AyA, queda demostrado: 1. Que, de la revisión del expediente se confirma que la comunidad objeto del recurso de amparo, no se encuentra dentro de la zona de cobertura del sistema administrado, operado y comercializado por el AyA en la Cantonal de Parrita, según los límites técnico y operativos establecidos para dicho acueducto (Ver informe N°GSP-RPC-PA-2025-00391). 2.Que, la comunidad se ubica a una distancia no menor de 15 kilómetros de la oficina cantonal, lo cual reafirma que no corresponde a AyA la prestación del servicio en ese sector, al no existir infraestructura pública, redes inscritas ni área de atención definida a cargo de esta institución (Ver informe N°GSP-RPC-PA-2025-00391). 3. Que, del análisis técnico y jurídico se desprende, además, que la atención del suministro corresponde a los sistemas delegados (ASADAS) indicados en el propio expediente, quienes poseen jurisdicción territorial y competencia para resolver dicha necesidad, de conformidad con el modelo de administración comunal del recurso hídrico y la normativa vigente (Ver informe N°°GSP-RPC-PA-2025-00391). 4. Que, la omisión atribuida a la Dirección Regional y a la Jefatura Cantonal de Parrita no es competencia de este Instituto, al no ser AyA el ente responsable del abastecimiento de agua en la comunidad señalada, por lo que al no ser el operador de los servicios, debe quedar acreditada la inexistencia de obligación legal o técnica que permita asignar responsabilidad al AyA (Ver informe N°°GSP-RPC-PA-2025-00391).”.
  6. 6Por escrito incorporado al expediente el 10 de diciembre de 2025, Lourdes María Suárez Barboza, presidenta ejecutiva del ICAA, informa: “ÚNICO: NO ES CIERTO. En este sentido el Ing. Jorge Alfaro Carmona, funcionario del Área Técnica de Ingeniería de la Oficina Regional de Acueductos Comunales (ORAC), Región Pacífico Central, mediante oficio No. GSD-UEN-GAR-2025-04876, de fecha 08 de diciembre del 2025, señala: “La comunidad de Pirrís de Parrita no forma parte del territorio servido por la ASADA Valle Vasconia ni cuenta con infraestructura formal de acueducto administrada por AyA o Delegada, por lo que su abastecimiento actual es autogestionado mediante una naciente sin tratamiento y un pozo sin concesión vigente. El acueducto de Valle Vasconia no dispone de capacidad hídrica ni condiciones hidráulicas o topográficas para integrar a Pirrís, y las obras recientes en Ruta 609 corresponden únicamente a mejoras internas del sistema.Asimismo, el servicio institucional de camiones cisterna es materialmente limitado y se destina exclusivamente a emergencias en acueductos existentes, lo que imposibilita atender comunidades sin infraestructura formal. No existen trámites pendientes de la comunidad ante AyA.” Además, el Ing. Alfaro Carmona señala en el “Informe respuesta Recurso de Amparo No. 25-036535-0007-CO”, que: “I. Resumen ejecutivo Tras el análisis técnico, administrativo y documental solicitado, se determina que la comunidad de Pirrís de Parrita no forma parte del territorio servido por la ASADA Valle Vasconia, no existe acto administrativo que establezca dicha responsabilidad territorial y tampoco existe infraestructura formal administrada por el AyA o por una ASADA delegada que permita abastecer a la comunidad. El abastecimiento actual es autogestionado por los vecinos mediante una naciente sin tratamiento y un pozo perforado con fondos del IMAS hace más de dos décadas, el cual no se encuentra en operación formal ni se aporta evidencia de que cuenta con concesión vigente, estudios hidrogeológicos recientes o condiciones sanitarias aptas para consumo humano.No existen trámites pendientes de la comunidad ante AyA. En cuanto al abastecimiento mediante camiones cisterna, se detalla que el AyA cuenta con una capacidad material y operativa limitada en este servicio, el cual se destina exclusivamente a atender emergencias en acueductos existentes, y no a comunidades sin acueducto formal ni infraestructura de recepción. II. Antecedentes 2.1. Competencia territorial La ORAC RPC informó mediante memorando GSD-UEN-GAR-2025-01767 que Pirrís no corresponde a comunidades atendidas por ASADAS bajo su ámbito, por lo que no existe responsabilidad de servicio. No existe resolución de delimitación territorial, acto administrativo o infraestructura que vincule a Pirrís con el acueducto de Valle Vasconia. La comunidad se ubica a más de dos kilómetros de la red existente, lo cual confirma la inexistencia de cobertura formal. 2.2. Situación del abastecimiento en Pirrís Del escrito del amparo se desprende que la comunidad se abastece mediante: • Una naciente sin tratamiento, con caudal variable según época. • Un pozo perforado con fondos del IMAS, según actas comunitarias, pero en estado de abandono, sin concesión, sin mantenimiento y sin estudios de calidad vigentes.AyA no tiene registro de infraestructura, concesiones, estudios o sistemas asociados a esta localidad. 2.3. Capacidad hídrica de la ASADA Valle Vasconia El Estudio Técnico de Evaluación Hidráulica elaborado por ICEA y aprobado mediante oficio GSD-UEN-GAR-2023-00094 evidencia que: • La ASADA opera con capacidad limitada. • Se requiere mejorar captaciones, instalar macromedición y ejecutar obras internas. • Es necesario buscar nuevas fuentes de abastecimiento, ya que el sistema no puede admitir nuevos servicios. Esto confirma que no existe posibilidad técnica ni hídrica de integrar nuevas comunidades. 2.4. Invitación AGPP-GDC-08-2024 El oficio comunitario AGPP-GDC-08-2024 fue dirigido a la Jefatura de la Oficina Cantonal de AyA en Parrita, invitando a una mesa de trabajo. Se aclara que: • No constituye un trámite formal. • No existe evidencia documental de realización de la reunión. • La ORAC Pacífico Central no recibió invitación. • No se generó ningún proceso administrativo o técnico derivado de dicha gestión. 2.5.Sobre la colocación de tubería en Ruta 609 El recurrente señala la observación de trabajos de reemplazo de tubería en carretera 609. De acuerdo con el Estudio Técnico aprobado: • Estas obras corresponden a mejoras internas del sistema existentes, para reducir pérdidas y mejorar la eficiencia. • No están relacionadas con expansión de cobertura ni habilitación de nuevas previstas. • El estudio establece claramente que se requieren nuevas fuentes antes de considerar ampliaciones. Por tanto, la interpretación del recurrente carece de fundamento técnico. (…) IV. Análisis Ausencia de infraestructura que permita abastecer a Pirrís No existe red de conducción, almacenamiento o distribución que llegue a Pirrís. Esto imposibilita evaluar factibilidad o realizar interconexiones temporales. Inviabilidad de utilizar el pozo perforado con fondos del IMAS El pozo carece de: • Concesión vigente. • Estudios hidrogeológicos actuales. • Análisis de calidad de agua. • Integración hidráulica a un sistema formal.Por lo tanto, no puede ser considerado como fuente de abastecimiento potable. Imposibilidad técnica de abastecer a Pirrís por razones topográficas y de configuración del acueducto Además de lo anterior, desde el punto de vista estrictamente hidráulico es imposible abastecer a Pirrís desde el acueducto de Valle Vasconia debido a: a) Diferencia de elevación Pirrís se encuentra a una cota superior respecto a los tanques y líneas de distribución del acueducto de Valle Vasconia. El sistema está diseñado para operar por gravedad, llevando el agua de mayor a menor elevación, no en sentido ascendente. b) Ausencia de infraestructura de bombeo o impulsión Para abastecer a una zona a mayor elevación se requieren: • Estaciones de bombeo. • Líneas de impulsión diseñadas para superar la altura. • Tanques intermedios o cámaras de quiebragradiente. Ninguno de estos elementos existe en el acueducto de la ASADA. c) Diseño hidráulico incompatible con expansión hacia Pirrís El acueducto fue diseñado para su territorio actual.Cualquier intento de llevar agua hacia Pirrís requeriría: • Construir una nueva línea de conducción independiente. • Diseñar un nuevo sistema de bombeo. • Construir un tanque de almacenamiento para esa comunidad. • Establecer una nueva red de distribución. Es decir, un acueducto completamente nuevo. Conclusión de esta sección Aun si existiera disponibilidad hídrica (que no la hay), no es físicamente posible abastecer a Pirrís con la infraestructura actual, por razones topográficas e hidráulicas inherentes al diseño del acueducto de Valle Vasconia. SOBRE EL ABASTECIMIENTO MEDIANTE CAMIÓN CISTERNA El abastecimiento mediante camión cisterna se utiliza únicamente como mecanismo de emergencia para acueductos administrados directamente por AyA o para sistemas Delegados que enfrentan fallas operativas. 5.1 Limitaciones materiales del servicio El AyA cuenta con una flota materialmente limitada, la cual debe atender: • Interrupciones de servicio en sistemas AyA • Emergencias en ASADAS delegadas • Situaciones prioritarias en zonas con infraestructura formal afectada Este servicio es excepcional y no se utiliza para abastecer comunidades sin acueducto. 4.2 Limitaciones de contratación externa Aun la contratación externa presenta restricciones: • Alta demanda interna del AyA en emergencias • Limitada disponibilidad de proveedores en épocas críticas • Necesidad de contar con infraestructura receptora segura, la cual Pirrís no posee 4.3 Razones por las que no es posible abastecer a Pirrís por cisterna • Pirrís no tiene acueducto formal al cual apoyar • No existe punto de descarga seguro para agua potable • La logística institucional prioriza emergencias en sistemas existentes Por estas razones, no es posible abastecer a la comunidad mediante camiones cisterna. 5.TRÁMITES PENDIENTES Luego de revisar los registros institucionales: • No existe trámite pendiente relacionado con Pirrís. • No hay solicitudes de factibilidad, ampliación de cobertura, estudios de fuentes, apoyo con cisterna o incorporaciones en curso.” (el resaltado es nuestro) De lo anterior se desprende que, la comunidad de Pirris, en la cual se ubica la propiedad del recurrente, es un acueducto privado creado con fondos del Instituto Mixto de Ayuda Social, sin ninguna intervención del Instituto Costarricense de Acueductos y Alcantarillados. Actualmente dicha comunidad tiene un sistema de auto abastecimiento, independiente del sistema que abastece la comunidad de Valle Vasconia, y el cual, por ubicación geográfica ente ambas comunidades, es “… técnicamente imposible de abastecer Pirris por razones topográficas y de configuración de acueducto…”, según lo indicado por el Ing. Jorge Alfaro Carmona, funcionario de la ORAC Pacífico Central del AyA.Así como también es imposible la interconexión de ambos sistemas tanto por la distancia entre ambas comunidades, como por las condiciones actuales del sistema que gestiona la ASADA de Valle Vasconia, según el informe técnico de ingeniería No. GSD-UENGAR-2023-00094, del 17 de enero del 2023, dirigido a la Junta Directiva de la asociación. Por último, es importante señalar que, el Ing. Jorge Alfaro Carmona, mediante “Informe respuesta Recurso de Amparo No. 25-036535-0007-CO”, remitido con el oficio No. GSD-UEN-GAR-2025-04876, de fecha 08 de diciembre del 2025, señaló: “… V. Conclusiones 1. Pirrís no forma parte del territorio servido por la ASADA Valle Vasconia. 2. La comunidad se abastece de manera autogestionada. 3. No existen condiciones legales, técnicas o infraestructurales que permitan integrar a Pirrís al acueducto existente. 4. Las mejoras en Ruta 609 corresponden a obras internas, no a expansión. 5.La topografía y el diseño hidráulico hacen imposible abastecer a Pirrís desde Valle Vasconia. 6. No existe trámite pendiente ante AyA. 7. No es posible abastecer a Pirrís mediante camión cisterna por limitaciones materiales y logísticas institucionales. VI. Recomendaciones 1. Enviar este informe a Legal con todos los documentos probatorios. 2. Señalar la inexistencia de competencia territorial y física para abastecer Pirrís. 3. Señalar que cualquier solución debe partir de un proyecto integral nuevo, incluyendo estudios hidrogeológicos, diseños de acueducto y definición de administración, mismos que podrán ser valorados previo a una solicitud formal de los interesados.”.
  7. 7Por escrito incorporado al expediente el 16 de diciembre de 2025, Gerardo Godínez Quesada, presidente de la Asada Valle Vasconia de Parrita, expone: “PRIMERO: La comunidad de Pirrís es una comunidad vecina que colinda con la zona de competencia de la ASADA Valle Vasconia. Cuando se constituyó la ASADA, la comunidad de Pirrís fue consultada sobre su interés en formar parte, pero en dicho momento los líderes de esa comunidad decidieron no participar en los esfuerzos necesarios para tal fin. En consecuencia, la comunidad no forma (ni nunca ha formado) parte de la zona de competencia delegada a esta asociación, según consta también en el convenio de delegación suscrito con el ICAA. SEGUNDO: Los artículos 39 y 40 del “Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales” establecen con claridad el ámbito de competencia de las ASADAS: “Artículo 39.Prestación de los servicios. Corresponde a la ASADA brindar y velar por la adecuada prestación de los servicios de abastecimiento de agua potable y saneamiento de aguas residuales en la zona de la competencia delegada, según el Reglamento de Prestación de Servicios del AyA. Artículo 40. Zona de competencia. La zona de competencia de la ASADA será determinada por el respectivo convenio de delegación, y dicho ámbito se definirá a partir de la capacidad técnica, crecimiento del sistema, viabilidad social y disponibilidad del recurso hídrico, prevaleciendo estos criterios en todos los casos”. TERCERO: De conformidad con la cláusula octava del Convenio de Delegación suscrito entre esta ASADA y el ICAA, se estableció conforme a derecho que “la jurisdicción del ente operador será determinada por la capacidad técnica del sistema”, prevaleciendo este criterio técnico en todos los casos. CUARTO: Al estar la comunidad de Pirrís fuera de la competencia legal de la ASADA, y considerando las implicaciones para la sostenibilidad financiera de una asociación privada sin fines de lucro, esta ASADA nunca ha administrado ni gestionado el servicio de acueducto o saneamiento de aguas para dicha comunidad, puesto que esto representaría exceder la competencia y las capacidades delegadas por la propia Administración.QUINTO: La ampliación del servicio a nuevas comunidades no es competencia de las ASADAS, ya que la entidad rectora en materia técnica es el ICAA. Conforme a los artículos 34 y 43 del Reglamento de ASADAS, la construcción de sistemas corresponde a los interesados o al ICAA, quien podrá construir sistemas de agua potable y darlos en operación a las ASADAS debidamente inscritas. SEXTO: No obstante lo anterior, y a pesar de que la comunidad de Pirrís no forma parte de los servicios que brinda esta asociación, la ASADA Valle Vasconia siempre ha estado anuente a incorporarlos a su gestión por una lógica de comunidad y colindancia territorial. En ese sentido, esta ASADA ha realizado esfuerzos importantes para financiar estudios de capacidad técnica, con el objetivo de mejorar el sistema administrado y eventualmente poder incorporar más capacidad para atender nuevos solicitantes. Sobre la imposibilidad material y técnica (incapacidad hídrica e hidráulica): SÉPTIMO: Consta que, al menos desde el año 2018, no existe disponibilidad hídrica para otorgar nuevos servicios.En dicha ocasión, el estudio técnico del 2013 no permitía brindar disponibilidad, por lo que esta ASADA se acercó al ICAA para buscar soluciones, lo que se tradujo en la recomendación de realizar un nuevo estudio técnico para conocer la capacidad técnica actualizada del sistema (oficio GSD-UEN-GAR-2020-01113 del 19 de marzo de 2020). OCTAVO: En los esfuerzos por mejorar el sistema de acueducto y poder brindar disponibilidad del servicio, en el año 2022 esta ASADA se financió un estudio técnico actualizado, denominado “ESTUDIO DE EVALUACIÓN HIDRÁULICO, SISTEMAS DE AGUA POTABLE E HIDRANTES, ACUEDUCTO INTEGRADO DE VALLE VASCONIA, DE PARRITA, DE PUNTARENAS”, el cual fue revisado y aprobado por el ICAA mediante oficio GSD-UEN-GAR-2003-00094 del 17 de enero del 2023. NOVENO: De suma importancia para este alegato, dicho estudio técnico evidenció que el sistema está al límite de su capacidad hídrica y presenta problemas hidráulicos.En cuanto a la capacidad hídrica, las páginas 40 y 41 del estudio concluyen que el sistema se encontraba al límite y sólo podíamos asignar 55 nuevas solicitudes, mismas que para dicho año ya tuvimos asignadas: “A partir de los datos de la capacidad de las fuentes, el acueducto tiene un BALANCE HÍDRICO POSITIVO real y actual para la demanda estimada, quedando un disponible para la proyección de demanda futura de (7.41 – 6.80) = 0.61 litros/segundo, siempre que las condiciones se mantengan favorables. (...) El caudal de superávit con las condiciones de evaluación permite abastecer a 55 nuevas solicitudes. (…) Se debe buscar nuevas fuentes de abastecimientos ya sean por medio de otras nacientes o por pozos preferiblemente cerca del Tanque de Almacenamiento N°3”. En cuanto a la capacidad hidráulica, la página 56 del mismo estudio técnico concluye, entre otras cosas, lo siguiente: “Con base en la demanda establecida en el Acueducto Integrado Valle Vasconia, la evaluación hidráulica muestra limitación, es decir, capacidad insuficiente en algunos ramales tanto en línea de conducción como en los cuatro sistemas”.DÉCIMO: Adicionalmente, la comunidad de Pirrís se encuentra a una elevación que hace inviable la generación hidráulica hacia dicho sitio sin una inversión importante en equipos de bombeo con los que actualmente está ASADA no cuenta, aunando el punto de la incapacidad técnica hidráulica para brindarles un servicio a futuro con las condiciones técnicas actuales. UNDÉCIMO: En sendas comunicaciones tanto verbales como escritas con el ICAA, y en especial con don Jorge Ramírez Rodríguez como jefe de la Oficina Regional de Acueductos Comunales Región Pacífico Central, se nos ha comunicado y reconocido que actualmente esta ASADA no puede brindar más servicios por falta de capacidad técnica. De la misma forma, en dichas comunicaciones se ha solicitado explícitamente ayuda para poder solventar nueva demanda de servicios. Sobre la posible ampliación del servicio a la comunidad de Pirrís: DUODÉCIMO: Consta que el ICAA tiene conocimiento de que la comunidad de Pirrís no cuenta con acueducto, y que anteriormente hubo acercamientos de dicha comunidad con el INDER para facilitar la disponibilidad de un acueducto.No obstante, se desconoce por qué dichos acercamientos fracasaron, o el motivo por el cual el ICAA no ha realizado la respectiva inclusión en su cartera de proyectos para el diseño y construcción del sistema de abastecimiento para dicha comunidad, tema altamente sensible que debió de ser tramitado bajo un principio de coordinación interinstitucional y/o intrainstitucional (departamental). Al respecto, adjuntamos prueba documental (prueba #6) que corrobora que el ICAA ha tenido en su potestad y conocimiento gestionar lo correspondiente, pero desconocemos si lo anterior se ha gestionado o comunicado al amparado o miembros de la comunidad. En dicha prueba se observa que el 05 de agosto de 2024 los funcionarios (departamentos del ICAA) expresan, entre otras cosas: “usted, como funcionaria del AyA que recibió la solicitud, puede tramitar con su Jefatura la inclusión, en la cartera de proyectos, del diseño y construcción del sistema de abastecimiento para dicha comunidad, tal y como se hizo en el caso de Dos Bocas de Quepos, según los oficios del trámite que se le enviaron como ejemplo.” DECIMOTERCERO: Incluso, en fecha 29 de abril de 2024, demostrando la buena fe y anuencia de esta ASADA para que la situación de la comunidad de Pirrís se resolviera, esta asociación interpuso un recurso de amparo a favor de dicha comunidad y en contra del ICAA (ad effectum videndi et probandi expediente n.° 24-11252-0007-CO), expresando en dicho recurso de amparo esfuerzos específicos que se estaban realizando por aumentar el caudal y la intención real de resolver este asunto importante para dicha comunidad.El amparo fue rechazado porque en ese momento la asesoría jurídica con la que contamos no nos asesoró claramente en que debíamos presentar ante este Tribunal prueba de comunicaciones o de que el ICAA tenía conocimiento de la problemática en la comunidad de Pirrís (y que por motivo del principio de coordinación se debían de tomar dichas gestiones existentes como conocidas por la autoridad del INDER, pero más aún del ICAA). DECIMOCUARTO: En fecha 07 de abril de 2025, la parte amparada envió una comunicación consultando los motivos por los cuales esta ASADA no le podría ofrecer el servicio de agua potable a su comunidad. A pesar de que, conforme a la jurisprudencia de esta Sala, el derecho de petición solo puede ejercerse frente a Administraciones Públicas y no frente a sujetos de derecho privado como las ASADAS, esta asociación, en su buena fe, respondió mediante oficio VV-02-2025 del 14 de abril de 2025, aclarando la imposibilidad material y técnica del sistema y reiterándoles la recomendación de acudir ante el ICAA como instancia administrativa competente.DECIMOQUINTO: Esta ASADA continúa con los esfuerzos de financiar las mejoras que requiere el sistema para poder aumentar la capacidad y el caudal actual y asegurar la calidad y disponibilidad futura del sistema. Ya se cuenta con el estudio técnico avalado por el ICAA, y se mantienen reuniones con la Oficina Regional de Acueductos Comunales (ORAC) para continuar con las mejoras en los sistemas, incluyendo dentro de las recomendaciones a atender el aumento de caudal y asignación de fuentes. DECIMOSEXTO: Esta asociación se sensibiliza y reconoce el problema existente en la comunidad de Pirrís, y se mantiene anuente y comprometida a cualquier coordinación necesaria con la Administración Pública para asegurarles acceso a agua potable: ya sea mediante la potencial construcción de infraestructura en nuestra ASADA que permita superar la limitante hídrica e hidráulica actual para así integrarlos en un futuro; o, en sí, lo que dicho ente rector técnico determine que procede para solventar la problemática en cuestión.”.
  8. 8Por escrito incorporado al expediente el 17 de diciembre de 2025, Osvaldo Quirós Chacón, gestor ambiental del Área Rectora de Salud de Parrita, expone: “PRIMERO: El 10 de diciembre de 2025 se realiza revisión documental en el Área Rectora de Salud de Parrita y se determina que no se cuenta con ninguna gestión o trámite por parte del señor [Nombre 001] relacionada con el caso que nos ocupa. SEGUNDO: El día 15 de diciembre de 2025 se emite el Informe Técnico de Inspección N°MS-DRRSPC-DARSPA-IT-0416-2025 (adjunto N°1), el cual, con base en inspecciones realizadas el día 10 de diciembre de 2025 en la comunidad de Pirris y en las Oficinas de la ASADA de Valle Vasconia se concluye lo siguiente: “…Con base en lo expuesto en los versos anteriores, se concluye que la comunidad de Pirrís no cuenta con abastecimiento de agua potable por parte del acueducto administrado por la ASADA Valle Vasconia debido a limitaciones de capacidad hídrica e hidráulica debidamente documentadas y de conocimiento del Instituto Costarricense de Acueductos y Alcantarillados.Asimismo, la verificación realizada en la escuela de la comunidad confirma la ausencia de potabilidad en el recurso hídrico disponible, al presentar una concentración de cloro residual de 0 mg/L, lo que evidencia el incumplimiento de los parámetros establecidos en la normativa sanitaria vigente, esto constatado mediante las Actas de Inspección DARSPA-OQC-133-2025 y DARSPA-OQC-134-2025…”. TERCERO: Se recibe por parte de la ASADA Valle Vasconia estudio hídrico donde evidencia falta de capacidad hídrica e hidráulica en el sistema para asumir el suministro de agua a la comunidad de Pirris (adjunto N°2), y así mismo, se aporta Oficio N°GSD-UEN-GAR-2023-00094 (adjunto N°3) del Instituto Costarricense de Acueductos y Alcantarillados mediante el cual se da visto bueno al estudio técnico realizado por la ASADA. CUARTO: El 16 de diciembre de 2025 por parte del Área Rectora de Salud Parrita se notifica a la presidencia ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados la Orden Sanitaria N°MS-DRRSPC-DARSPA-OS-0126-2025 (adjunto N°4) mediante la cual se le ordena lo siguiente: “Presentar ante el Área Rectora de Salud de Parrita un Plan de Acciones con su debido cronograma de implementación y los responsables de su ejecución, para la realización de las siguientes actividades: • De manera inmediata, ejecutar medidas provisionales para garantizar el acceso al agua potable a la comunidad de Pirrís de Parrita. • En un plazo no mayor a 12 meses calendario, ejecutar las soluciones hídricas, hidráulicas, de infraestructura y administrativas necesarias para brindar el acceso al agua potable a la comunidad de Pirrís de Parrita, de manera definitiva.” Se aporta evidencia de notificación (adjunto N°5).”.
  9. 9Por escrito incorporado al expediente el 17 de febrero de 2026, el recurrente manifiesta: “(…) el AyA, NO ha presentado ningún plan ni acción relevante sobre el tema del agua potable en Pirrís, incumpliendo de este modo con la orden sanitaria MS-DRRSPC-DARSPA-OS-0126-2025.”.
  10. 10En los procedimientos seguidos se han observado las prescripciones legales.

Redacta el Magistrado Rueda Leal; y,

Considerando:

I. OBJETO DEL RECURSO

El recurrente acusa que las autoridades accionadas han omitido garantizar el acceso a agua potable en la comunidad de Pirrís, ubicada en el cantón de Parrita. Expone que durante más de treinta años los vecinos han gestionado sin éxito la instalación de un sistema de abastecimiento, sin que se haya podido resolver la problemática. Alega que los habitantes de la comunidad consumen agua de dudosa calidad, con riesgo de contaminación por coliformes y metales pesados, y que existe un pozo perforado con fondos públicos por la empresa Zaragoza de Palmares, según consta en el libro de actas de la Asociación de la comunidad, pero se encuentra abandonado y en condiciones deplorables, pese a que podría suplir parte de la necesidad hídrica. Argumenta que la Asada alega falta de capacidad hídrica para brindar el servicio, aunque por jurisdicción territorial le corresponde atender a Pirrís, lo que considera un trato desigual y una exclusión social que obliga a las familias a comprar agua embotellada.

Estima que exigir a la comunidad asumir los costos de un proyecto de abastecimiento constituye una pretensión desproporcionada. Solicita que, mientras no exista una solución definitiva, se garantice el suministro mediante cisternas o tanques tratados y llenados con frecuencia, que se investigue y recupere el pozo perforado con fondos públicos y se adopten medidas urgentes para asegurar el acceso digno al agua potable.

II. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos, según lo prevenido en el auto inicial:

  • a)La comunidad de Pirrís no se encuentra dentro de la zona de cobertura del ICAA, no modo que no hay infraestructura ni redes de esa institución en el sitio. (Informe del ICAA).
  • b)La comunidad de Pirrís se encuentra fuera de la zona de competencia delegada de la Asada de Valle Vasconia, quien no cuenta con capacidad hídrica ni hidráulica para otorgar nuevos servicios. (Contestación de la Asada recurrida).
  • c)La comunidad de Pirrís se abastece de agua a través de: “• Una naciente sin tratamiento, con caudal variable según época. • Un pozo perforado con fondos del IMAS, según actas comunitarias, pero en estado de abandono, sin concesión, sin mantenimiento y sin estudios de calidad vigentes.”. (Informe del ICAA).
  • d)El 10 de diciembre de 2025, el Área Rectora de Salud de Parrita efectuó una inspección en la comunidad de Pirrís, y en el informe técnico nro. MS-DRRSPC-DARSPA-IT-0416-2025 de 15 de diciembre de 2025, se detalló: “CONCLUSIONES Con base en lo expuesto en los versos anteriores, se concluye que la comunidad de Pirrís no cuenta con abastecimiento de agua potable por parte del acueducto administrado por la ASADA Valle Vasconia debido a limitaciones de capacidad hídrica e hidráulica debidamente documentadas y de conocimiento del Instituto Costarricense de Acueductos y Alcantarillados. Asimismo, la verificación realizada en la escuela de la comunidad confirma la ausencia de potabilidad en el recurso hídrico disponible, al presentar una concentración de cloro residual de 0 mg/L, lo que evidencia el incumplimiento de los parámetros establecidos en la normativa sanitaria vigente, esto constatado mediante las Actas de Inspección DARSPA-OQC-133-2025 y DARSPA-OQC-134-2025.

RECOMENDACIONES Se recomienda al £rea Rectora de Salud de Parrita emitir la correspondiente Orden Sanitaria al Instituto Costarricense de Acueductos y Alcantarillados para que en un plazo de 5 días hábiles presenten ante el £rea Rectora de Salud de Parrita un Plan de Acciones con su debido cronograma de implementación y los responsables de su ejecución, para el desarrollo de las siguientes actividades: • De manera inmediata, ejecutar medidas provisionales para garantizar el acceso al agua potable a la comunidad de Pirrís de Parrita. • En un plazo de 12 meses calendario, ejecutar las soluciones hídricas, hidráulicas, de infraestructura y administrativas necesarias para brindar el acceso al agua potable a la comunidad de Pirrís de Parrita, de manera definitiva.”. (Prueba documental).

  • e)El 15 de diciembre de 2025, el Área Rectora de Salud de Parrita dictó la orden sanitaria nro. MS-DRRSPC-DARSPA-OS-0126-2025, dirigida al ICAA, en la que dispuso: “Presentar ante el Área Rectora de Salud de Parrita un Plan de Acciones con su debido cronograma de implementación y los responsables de su ejecución, para la realización de las siguientes actividades: • De manera inmediata, ejecutar medidas provisionales para garantizar el acceso al agua potable a la comunidad de Pirrís de Parrita. • En un plazo no mayor a 12 meses calendario, ejecutar las soluciones hídricas, hidráulicas, de infraestructura y administrativas necesarias para brindar el acceso al agua potable a la comunidad de Pirrís de Parrita, de manera definitiva.”. (Informe de la autoridad recurrida y prueba documental).
  • f)Previo a la interposición del recurso, el accionante no había interpuesto denuncia o gestión alguna ante el Área Rectora de Salud de Parrita por la situación objeto del sub examine. (Informe de la autoridad recurrida).

III. SOBRE EL CASO CONCRETO

En el sub lite, el recurrente acusa que las autoridades accionadas han omitido garantizar el acceso a agua potable en la comunidad de Pirrís, ubicada en el cantón de Parrita. Expone que durante más de treinta años los vecinos han gestionado sin éxito la instalación de un sistema de abastecimiento, sin que se haya podido resolver la problemática. Alega que los habitantes de la comunidad consumen agua de dudosa calidad, con riesgo de contaminación por coliformes y metales pesados, y que existe un pozo perforado con fondos públicos por la empresa Zaragoza de Palmares, según consta en el libro de actas de la Asociación de la comunidad, pero se encuentra abandonado y en condiciones deplorables, pese a que podría suplir parte de la necesidad hídrica. Argumenta que la Asada alega falta de capacidad hídrica para brindar el servicio, aunque por jurisdicción territorial le corresponde atender a Pirrís, lo que considera un trato desigual y una exclusión social que obliga a las familias a comprar agua embotellada.

Estima que exigir a la comunidad asumir los costos de un proyecto de abastecimiento constituye una pretensión desproporcionada. Solicita que, mientras no exista una solución definitiva, se garantice el suministro mediante cisternas o tanques tratados y llenados con frecuencia, que se investigue y recupere el pozo perforado con fondos públicos y se adopten medidas urgentes para asegurar el acceso digno al agua potable.

Del estudio de los autos se tiene por demostrado, que la comunidad de Pirrís no se encuentra dentro de la zona de cobertura del ICAA, no modo que no hay infraestructura ni redes de esa institución en el sitio. La comunidad de Pirrís se encuentra fuera de la zona de competencia delegada de la Asada de Valle Vasconia, quien no cuenta con capacidad hídrica ni hidráulica para otorgar nuevos servicios. La comunidad de Pirrís se abastece de agua a través de: “• Una naciente sin tratamiento, con caudal variable según época. • Un pozo perforado con fondos del IMAS, según actas comunitarias, pero en estado de abandono, sin concesión, sin mantenimiento y sin estudios de calidad vigentes.”. El 10 de diciembre de 2025, el Área Rectora de Salud de Parrita efectuó una inspección en la comunidad de Pirrís, y en el informe técnico nro. MS-DRRSPC-DARSPA-IT-0416-2025 de 15 de diciembre de 2025, se detalló: “CONCLUSIONES Con base en lo expuesto en los versos anteriores, se concluye que la comunidad de Pirrís no cuenta con abastecimiento de agua potable por parte del acueducto administrado por la ASADA Valle Vasconia debido a limitaciones de capacidad hídrica e hidráulica debidamente documentadas y de conocimiento del Instituto Costarricense de Acueductos y Alcantarillados.

Asimismo, la verificación realizada en la escuela de la comunidad confirma la ausencia de potabilidad en el recurso hídrico disponible, al presentar una concentración de cloro residual de 0 mg/L, lo que evidencia el incumplimiento de los parámetros establecidos en la normativa sanitaria vigente, esto constatado mediante las Actas de Inspección DARSPA-OQC-133-2025 y DARSPA-OQC-134-2025. RECOMENDACIONES Se recomienda al £rea Rectora de Salud de Parrita emitir la correspondiente Orden Sanitaria al Instituto Costarricense de Acueductos y Alcantarillados para que en un plazo de 5 días hábiles presenten ante el £rea Rectora de Salud de Parrita un Plan de Acciones con su debido cronograma de implementación y los responsables de su ejecución, para el desarrollo de las siguientes actividades: • De manera inmediata, ejecutar medidas provisionales para garantizar el acceso al agua potable a la comunidad de Pirrís de Parrita. • En un plazo de 12 meses calendario, ejecutar las soluciones hídricas, hidráulicas, de infraestructura y administrativas necesarias para brindar el acceso al agua potable a la comunidad de Pirrís de Parrita, de manera definitiva.”.

El 15 de diciembre de 2025, el Área Rectora de Salud de Parrita dictó la orden sanitaria nro. MS-DRRSPC-DARSPA-OS-0126-2025, dirigida al ICAA, en la que dispuso: “Presentar ante el Área Rectora de Salud de Parrita un Plan de Acciones con su debido cronograma de implementación y los responsables de su ejecución, para la realización de las siguientes actividades: • De manera inmediata, ejecutar medidas provisionales para garantizar el acceso al agua potable a la comunidad de Pirrís de Parrita. • En un plazo no mayor a 12 meses calendario, ejecutar las soluciones hídricas, hidráulicas, de infraestructura y administrativas necesarias para brindar el acceso al agua potable a la comunidad de Pirrís de Parrita, de manera definitiva.”.Previo a la interposición del recurso, el accionante no había interpuesto denuncia o gestión alguna ante el Área Rectora de Salud de Parrita por la situación objeto del sub examine.

Desde este panorama, en el sub iudice resulta necesaria la intervención de esta jurisdicción constitucional.

Al respecto, de los autos se constata que la comunidad de Pirrís de Parrita enfrenta una problemática relativa al suministro de agua potable, pues ni el ICAA ni la Asada de Valle Vasconia brindan el servicio en la zona, debido a que se encuentra fuera de sus respectivas áreas de cobertura, y en el sitio no hay infraestructura ni redes de distribución.

En virtud de lo anterior, la comunidad se abastece de “• Una naciente sin tratamiento, con caudal variable según época. • Un pozo perforado con fondos del IMAS, según actas comunitarias, pero en estado de abandono, sin concesión, sin mantenimiento y sin estudios de calidad vigentes.”. Sin embargo, de acuerdo con los resultados de la inspección efectuada por el Área Rectora de Salud de Parrita el 10 de diciembre anterior, dicho sistema de abastecimiento no es óptimo, al punto que el agua que consume la población no reúne los parámetros de potabilidad.

Justamente, véase que en el informe técnico nro. MS-DRRSPC-DARSPA-IT-0416-2025 de 15 de diciembre de 2025, la autoridad sanitaria detalló: “(…) la verificación realizada en la escuela de la comunidad confirma la ausencia de potabilidad en el recurso hídrico disponible, al presentar una concentración de cloro residual de 0 mg/L, lo que evidencia el incumplimiento de los parámetros establecidos en la normativa sanitaria vigente, esto constatado mediante las Actas de Inspección DARSPA-OQC-133-2025 y DARSPA-OQC-134-2025 (…)”; lo cual evidencia una afectación particular para la población estudiantil de la comunidad.

A partir de lo anterior, se constata que el Área Rectora de Salud de Parrita dictó la orden sanitaria nro. MS-DRRSPC-DARSPA-OS-0126-2025 de 15 de diciembre de 2025, dirigida específicamente al ICAA, en la que dispuso: “Presentar ante el Área Rectora de Salud de Parrita un Plan de Acciones con su debido cronograma de implementación y los responsables de su ejecución, para la realización de las siguientes actividades: • De manera inmediata, ejecutar medidas provisionales para garantizar el acceso al agua potable a la comunidad de Pirrís de Parrita. • En un plazo no mayor a 12 meses calendario, ejecutar las soluciones hídricas, hidráulicas, de infraestructura y administrativas necesarias para brindar el acceso al agua potable a la comunidad de Pirrís de Parrita, de manera definitiva.”.

Así las cosas, esta Sala constata que en la especie existe una problemática que ocasiona una especial afectación, incluso para menores estudiantes de la escuela de la comunidad, al punto que fue necesaria la intervención de la autoridad sanitaria para que el ICAA, en su condición de ente rector en la materia, ejecute acciones con miras a solucionar el problema sanitario constatado.

En consecuencia, corresponde declarar con lugar el recurso en relación con las autoridades del ICAA, a fin de garantizar el efectivo cumplimiento de la orden sanitaria nro. MS-DRRSPC-DARSPA-OS-0126-2025 de 15 de diciembre de 2025.

IV.Finalmente, respecto de la Asada recurrida y el Área Rectora de Salud de Parrita, prima facie se descarta alguna irregularidad susceptible de ser declarada en esta vía. Sin embargo, tome nota esta última autoridad sanitaria, a fin de supervisar el efectivo cumplimiento de la orden sanitaria dictada.

V. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que, de haber aportado algún documento en papel u objetos o pruebas contenidos en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados en un plazo máximo de 30 días hábiles, contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo material que no sea recogido dentro de ese lapso, con base en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial" (aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 de 22 de agosto de 2011 y publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012) y en el artículo LXXXI de la sesión del Consejo Superior del Poder Judicial nro. 43-12 de 3 de mayo de 2012.

Por tanto:

Se declara parcialmente con lugar el recurso, solo respecto del Instituto Costarricense de Acueductos y Alcantarillados. Se ordena a Lourdes María Suárez Barboza y Fernando Araya Araya, por su orden, presidenta ejecutiva y director de la Región Pacífico Central, ambos del Instituto Costarricense de Acueductos y Alcantarillados, o a quienes ocupen tales cargos, que giren las órdenes pertinentes, coordinen lo correspondiente y lleven a cabo todas las actuaciones que estén dentro del ámbito de sus competencias respectivas para que se cumpla lo dispuesto en la orden sanitaria nro. MS-DRRSPC-DARSPA-OS-0126-2025 de 15 de diciembre de 2025, dentro de los plazos señalados en dicho acto administrativo.Se advierte a la autoridad recurrida, que de acuerdo con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.

Se condena al Instituto Costarricense de Acueductos y Alcantarillados al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de la vía contencioso-administrativa. En lo demás, se declara sin lugar el recurso. Tome nota el Área Rectora de Salud de Parrita de lo consignado en el considerando IV de este pronunciamiento. Notifíquese.
