Document Review Decision No. 2026010086 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine twenty a.m. on veinte de marzo de dos mil veintiseis.

Amparo proceeding (recurso de amparo) processed under case number 26-004174-0007-CO, filed by [Name 001], identity card number [Value 001], against the MUNICIPALIDAD DE PUERTO JIMÉNEZ.

BACKGROUND:

  1. 1In a filing submitted to the Court Chamber’s Secretariat at 18:16 on 5 de febrero de 2026, the petitioner filed an amparo proceeding against the Municipalidad de Puerto Jiménez. The petitioner states that on 10 de octubre de 2025, they filed an administrative complaint (denuncia administrativa) with the Municipalidad de Puerto Jiménez concerning alleged violations of the Reglamento del Plan Regulador de Playa Delfines, Cañaza de Puerto Jiménez, including unauthorized use of concessions (concesiones) and possible damage to the protection zone (zona de protección). The petitioner states that the complaint requested an investigation of the case files of various concession-holding companies and verification of compliance with their contracts, as well as a field inspection (inspección de campo) by the Departamento de Zona Marítimo Terrestre to verify the alleged violations in the protected area and on the public road, access to which was restricted by gates.The petitioner asserts that the complaint was received and forwarded to the Concejo Municipal (see the evidence submitted with this proceeding). The petitioner indicates that the Concejo Municipal referred the complaint to the Legal Department of the respondent administration for issuance of the corresponding legal opinion (criterio), which was prepared. The petitioner complains that, despite the foregoing and in the absence of a response from the competent authority, on 21 de enero de 2026, the Council Secretariat certified that, as of 14 de enero de 2026, there was no formal notice concerning any notice of charges (traslado de cargos), requests for correction (prevenciones), or decisions related to the complaints filed, according to a review of the records and case files available in that Secretaría del Concejo Municipal. The petitioner asks the Court Chamber to grant the proceeding.
  2. 2By a decision of the Presidency issued at 11:29 on 20 de febrero de 2026, the present proceeding was admitted and notice thereof was served on the ALCALDE Y PRESIDENTE DEL CONCEJO MUNICIPAL DE PUERTO JIMÉNEZ.
  3. 3In a filing added to the digital case file at 14:49 on 26 de febrero de 2026, Ronny Montes Sorio, in his capacity as Presidente del Concejo Municipal de Puerto Jiménez, states under oath that the administrative complaint was filed on 10 de octubre de 2025. On 11 de octubre de 2025, the Concejo Municipal, through Agreement No. 10 adopted at Ordinary Session No. 64, considered the complaint, referred it to the Administration, and instructed the Legal Department to issue the corresponding technical-legal opinion, with that agreement being finally approved and becoming binding (en firme). On 14 de octubre de 2025, the Council Secretary issued Official Letter SCMPJ-0141-2025 to the municipal mayor’s office in implementation of the agreement; the complaint was analyzed by technical and legal bodies, including the Comisión de Zona Marítimo Terrestre (ZMT). On 13 de enero de 2026, a meeting was held among the Alcaldía Municipal, Comisión ZMT, and technical and legal personnel for a technical and legal analysis of the case.(This is recorded in the meeting minutes) by both secretariats: the Concejo Municipal and the mayor’s office. On 17 de enero de 2026, Official Letter SCMPJ-0008-2026 was issued, formally communicating the duly justified request for an extension of time (ampliación de plazo), which was accepted by the parties. On 14 de febrero de 2026, the Concejo Municipal received Official Letter AMPJ-0155-2026 from the municipal mayor’s office, containing the technical report prepared by surveyor Eng. David Prendas, which identifies an overlap between the Plan Regulador and a public road. The right of petition (derecho de petición) does not entail an obligation to decide immediately or conclusively, but rather to issue a reasoned response and ensure effective processing. The extension of time was express, written, justified, reasonable, and accepted by the petitioner; therefore, there was no administrative silence (silencio administrativo) or failure to perform official duties. He asks the Court Chamber to deny the proceeding.
  4. 4In a written submission added to the digital case file at 23:40 hours on 26 de febrero de 2026, Enrique Segnini Saballo, in his capacity as Mayor of Puerto Jiménez, states under oath that it is true that Mr. [Nombre 001] filed administrative complaints (denuncias administrativas) with this Municipalidad on 9 y 10 de octubre de 2025 concerning alleged irregularities in the Plan Regulador de Playa Delfines, Cañaza de Puerto Jiménez. It is true that those complaints were received, processed, and referred to the competent bodies of this Municipalidad for analysis and resolution in accordance with law. However, he denies that this Alcaldía Municipal violated the appellant’s right of petition and prompt resolution (derecho de petición y pronta resolución). On the contrary, as will be demonstrated below, this Administración Municipal has acted with absolute diligence, within the framework of legality, transparency, public disclosure, and expedition governing administrative activity, providing effective, timely, and duly reasoned attention to each of the submissions made by Mr. [Nombre 001].It is now imperative to clarify to appellant [Nombre 001] that, although he may address any municipal or state entity pursuant to his corresponding right, this does not mean that the Administration is obligated to grant everything requested for his convenience or invariably rule in his favor, because the right of petition may be exercised freely, but it does not mean that the Municipalidad must resolve every matter to the petitioner’s satisfaction. The complaints were received by this Municipalidad on 9 y 10 de octubre de 2025 and were immediately incorporated into the corresponding administrative proceedings (trámite administrativo). The Honorable Concejo Municipal considered both complaints at Sesión Ordinaria N° 64-2025 del 12 de octubre de 2025 and adopted Acuerdo N° 10, Artículo IV, whereby it was unanimously and finally agreed to refer the complaints to the Administración Municipal and instruct the Departamento Legal to issue the corresponding technical-legal opinion (criterio técnico-legal).Through Oficio SCMPJ-0141-2025 del 14 de octubre de 2025, the Secretaría del Concejo Municipal forwarded the complaints to the mayor. In turn, through Oficio AMPJ-1043-2025 del 15 de octubre de 2025, this Alcaldía referred the complete documentation (111 folios of complaints plus 2 folios of the Concejo’s official communication) to the Departamento Legal for analysis. Through Oficio AMPJ-1050-2025 del 15 de octubre de 2025, this Alcaldía formally informed Mr. [Nombre 001] that, due to the complexity of the matter, the volume of information, and the administrative steps necessary for a thorough analysis, an additional period of forty-five (45) business days was required to issue the corresponding opinions. Through this action, it fulfilled the constitutional obligation to inform the petitioner of the reasons for the delay, as required by the case law of this Honorable Chamber. The Departamento de Zona Marítimo Terrestre conducted a field inspection jointly with SINAC officials, documented in Informe INF-ZMTPJ-025-2025, which confirmed the existence of the reported gate.Subsequently, the Departamento de Catastro y Topografía issued Informe 002-DCTPJ-2025 del 27 de octubre de 2025, containing georeferenced verification using GNSS technology and the CR-SIRGAS system, which determined the gate’s exact location within the Maritime-Terrestrial Zone (Zona Marítimo Terrestre). Licda. Arelys Cascante Fernández, of the Departamento Legal, issued THREE complete and duly reasoned legal opinions (criterios legales): • Criterio Legal 004-2025 (19 de noviembre de 2025): It analyzed the complaint concerning delinquency in the payment of the tax on legal entities. It concluded that the complaint IS WITHOUT MERIT, because the concession-holding companies are current on their payments according to an independent verification in the Registro Nacional. It recommended closing the complaint as inadmissible and informing the interested party. • Criterio Legal 005-2025 (20 de noviembre de 2025): It analyzed the complaint concerning violations of land use (uso de suelo), zoning (zonificación), and environmental damage (daño ambiental).It concluded that the complaint HAS MERIT and that sufficient indications of possible serious violations exist, recommending the formation of an interdisciplinary committee to investigate the facts comprehensively. • Criterio Legal 006-2025 (8 de diciembre de 2025): It analyzed the situation of the gate in the Las Ramplas sector. It concluded that the gate constitutes an unauthorized occupation of the public domain (dominio público) and recommended its immediate removal. Through Oficio AMPJ-1152-2025 del 21 de noviembre de 2025, this Alcaldía forwarded Criterios Legales N° 004-2025 y 005-2025 to the Concejo Municipal for its consideration, assessment, and corresponding action. Through Oficio AMPJ-1187-2025 del 5 de diciembre de 2025, this Alcaldía FORMALLY NOTIFIED Mr. [Nombre 001] of the issuance and referral of Criterios Legales N° 004-2025 y 005-2025. That communication informed him that: • The opinions were issued pursuant to the agreement of the Concejo Municipal. • The opinions provide a legal analysis of the reported facts. • They were duly forwarded to the Alcaldía and the Concejo Municipal. • The issuance of the legal opinions forms part of the administrative review process and does not, in itself, constitute a final decision (resolución final), without prejudice to any additional actions, investigations, or proceedings that may subsequently be ordered. • Copies of the legal opinions were enclosed.This official communication was personally received by Mr. Mariano Murillo Chamorro on 5 de diciembre de 2025 at 2:50 p.m., as shown by the acknowledgment of receipt. The Departamento de Zona Marítimo Terrestre issued Resolución N° PJZMT-R-177-2025 del 12 de diciembre de 2025, whereby: • Rowayton Inversiones Costerras RICSA S.A. was ORDERED to voluntarily remove the gate installed in the ZMT. • A period of TEN BUSINESS DAYS was granted for voluntary removal. • It was warned that, in the event of noncompliance, the Municipalidad would proceed with administrative eviction and immediate removal proceedings (procedimiento administrativo de desocupación y retiro inmediato). At Sesión Ordinaria N° 73-2025 del 16 de diciembre de 2025, the Concejo Municipal adopted Acuerdo N° 07, requesting that the Administration supplement the technical opinion with an aerial map showing boundary markers and the gate’s location, to enable a better-informed decision.This demonstrates the diligence and seriousness with which the Concejo Municipal has addressed the matter. The Departamento de Catastro y Topografía issued Informe 001-DCTPJ-2026 del 11 de febrero de 2026, containing a detailed analysis of the overlaps in the Plan Regulador de Playa Delfines, demonstrating that the Administration continues to work actively on investigating the reported facts. Through Oficio AMPJ-0155-2026, this Alcaldía forwarded the additional technical reports of the Departamento de Catastro to the Concejo Municipal for its consideration and decision. The foregoing chronology makes it absolutely clear that this Alcaldía Municipal has fully, promptly, and satisfactorily complied with the appellant’s right of petition and prompt resolution, as summarized by the following actions: a) The complaints were received immediately. b) The Concejo Municipal considered them in an ordinary session TWO DAYS after they were filed. c) They were referred to the Departamento Legal within the following FIVE DAYS. d) The appellant was informed of the matter’s complexity and the need for additional time, thereby fulfilling the constitutional obligation to report the reasons for the delay. e) Field inspections were conducted with interinstitutional participation (Municipalidad, SINAC). f) THREE complete and duly reasoned legal opinions were issued. g) The appellant was formally notified of the legal opinions issued and was provided with copies thereof. h) An administrative decision was issued ordering removal of the illegal gate. i) Technical cadastral reports were prepared using GNSS and georeferencing methodology. j) The overlap analysis continued, and additional reports were issued. k) All documentation was forwarded to the Concejo Municipal for decision-making.The appellant seeks to have this Chamber grant the petition for relief, alleging a failure to respond. However, as has been conclusively demonstrated, a response was provided promptly, fully, and in accordance with law. What Mr. [Nombre 001] actually seeks is for the Administración Municipal to rule entirely to his satisfaction and according to his own timetable, which, as this Honorable Chamber has repeatedly held, is not what the right of petition guarantees. The complexity of the reported matter—which involves eight concession-holding companies, zoning analysis, land-use verifications, field inspections, interinstitutional coordination with SINAC, analysis of concession agreements recorded in the Registro Público, registry verifications, cadastral reports using GNSS technology, specialized legal opinions, and potential proceedings for absolute nullity (nulidad absoluta) before the Procuraduría General de la República—requires rigorous, technical processing in accordance with the legal system, not a hasty decision that would compromise legal certainty and the public interest.Requiring an administrative investigation of this magnitude to be resolved within abbreviated periods, without due technical and legal diligence, would be contrary to the principles of legality, substantive truth (verdad material), and legal certainty governing administrative activity. He requests that the Chamber deny the petition for relief.
  5. 5The statutory requirements were observed in the proceedings conducted.

Justice Salazar Alvarado authored the opinion; and,

WHEREAS:

I. PRELIMINARY CLARIFICATION

Before analyzing the merits, it must be clarified that, beginning with Sentencia N° 2008-02545 de las 08:55 horas del 22 de febrero de 2008, this Chamber has referred to the administrative litigation jurisdiction (jurisdicción contencioso administrativa)—with certain exceptions—those matters involving disputes over whether the Administration has complied with the time limits established by the Ley General de la Administración Pública (artículos 261 y 325) or by sector-specific laws for issuing a final administrative act (acto final) in an administrative proceeding—initiated ex officio or at the request of a party—or for considering the available administrative appeals (recursos administrativos). Specifically, the sub lite presents one such exception, because it concerns a complaint relating to apparent environmental damage to the protection zone (zona de protección) granted under concession by the respondent Municipalidad, as well as the installation of gates obstructing free passage, which has not been resolved within a reasonable period. In view of the fundamental rights invoked—the environment and freedom of movement—this Chamber assesses possible delays in resolving complaints of this kind. That point having been clarified, the Court proceeds to decide the specific situation raised in this amparo proceeding (amparo).

II. SUBJECT MATTER OF THE PETITION

The appellant states that, on 10 de octubre de 2025, he filed an administrative complaint with the Municipalidad de Puerto Jiménez concerning alleged violations of the Reglamento del Plan Regulador de Playa Delfines, including unauthorized use of concessions, installation of gates obstructing free passage, and possible environmental damage to the protection zone; nevertheless, as of 14 de enero de 2026, no formal notice had been provided concerning the filing of charges (traslado de cargos), compliance demands (prevenciones), or decisions relating to the complaints filed.

III. PROVEN FACTS

The following facts are deemed duly established and relevant to the decision in this matter, either because they have been proven as such or because the respondent failed to address them as ordered in the initial ruling:

  • a)The petitioner filed administrative complaints (denuncias administrativas) with the respondent municipality on 9 and 10 October 2025, concerning alleged irregularities in the Playa Delfines Regulatory Plan (Plan Regulador), Cañaza de Puerto Jiménez (see report rendered under oath).
  • b)At Ordinary Session N° 64-2025 of 12 October 2025, the Municipal Council considered both complaints and adopted Agreement N° 10, Article IV, whereby it was unanimously and finally agreed to refer the complaints to the Municipal Administration and instruct the Legal Department to issue the corresponding technical-legal opinion (see report rendered under oath).
  • c)By Official Letter AMPJ-1050-2025 of 15 October 2025, the Office of the Mayor informed the protected party (amparado) that, due to the complexity of the matter, the volume of information, and the administrative steps necessary for a thorough analysis, an additional period of forty-five (45) business days was required to issue the corresponding opinions (see report rendered under oath).
  • d)The Maritime-Terrestrial Zone Department conducted a field inspection jointly with SINAC officials, documented in Report INF-ZMT-PJ-025-2025, which confirmed the existence of the gate identified in the complaint (see report rendered under oath).
  • e)The Municipal Cadastre and Surveying Department issued Report 002-DCTPJ-2025 of 27 October 2025, containing georeferenced verification using GNSS technology and the CR-SIRGAS system, determining the exact location of the gate within the Maritime-Terrestrial Zone (Zona Marítimo Terrestre) (see report rendered under oath).
  • f)Legal Opinion 005-2025 of 20 November 2025 analyzed the complaint concerning violations of land use (uso de suelo), zoning (zonificación), and environmental damage (daño ambiental), and concluded that the complaint was well-founded and that sufficient indications existed of possible serious violations, recommending the establishment of an interdisciplinary commission to conduct a comprehensive investigation of the facts (see report rendered under oath).
  • g)Legal Opinion 006-2025 of 8 December 2025 analyzed the situation of the gate in the Las Ramplas sector and concluded that it constituted an unauthorized occupation of the public domain (dominio público), recommending its immediate removal (see report rendered under oath).
  • h)By Official Letter AMPJ-1187-2025 of 5 December 2025, the Office of the Mayor notified the protected party of the issuance and referral of Legal Opinions N° 004-2025 and 005-2025 (see report rendered under oath).
  • i)The Maritime-Terrestrial Zone Department issued Resolution N° PJ-ZMT-R-177-2025 of 12 December 2025, which ORDERED Rowayton Inversiones Costerras RICSA S.A. to voluntarily remove the gate installed in the Maritime-Terrestrial Zone, granted a period of TEN BUSINESS DAYS for its voluntary removal, and warned that, in the event of noncompliance, the Municipality would initiate the administrative procedure for eviction (procedimiento administrativo de desocupación) and immediate removal (see report rendered under oath).

IV. ON THE RIGHT TO PROMPT AND EFFECTIVE JUSTICE

In light of Article 41 of the Constitution, the Administration has an obligation to guarantee the public prompt and effective justice, without denial thereof. In the sphere of administrative justice, this entails its obligation to decide the claims submitted by administered persons (administrados) diligently and expeditiously, so that its decision is consistent with the matters alleged, and to notify the interested parties of its determination, all within a reasonable period. In this regard, the “reasonableness” of the duration of administrative activity is determined on a case-by-case basis according to various factors, such as the technical complexity of the administrative matter, the scope of the evidence to be taken, or the degree to which the challenged act affects a person or the environment. It follows that there is no strict right to constitutionalize procedural time limits, but rather a right to constitutional review of those actions by the Administration for which insufficient grounds exist to justify the time taken to resolve a given administrative matter.

V. ON THE SPECIFIC CASE

In the matter under review (sub examine), the petitioner alleges that, on 10 October 2025, the petitioner filed an administrative complaint with the Municipalidad de Puerto Jiménez concerning alleged violations of the Reglamento del Plan Regulador de Playa Delfines, including unauthorized use of concessions (concesiones), the installation of gates that obstruct free passage, and possible environmental damage to the protection zone (zona de protección); however, as of 14 January 2026, no formal notice had been given regarding the filing of charges, compliance orders (prevenciones), or decisions associated with the complaints filed. In this regard, the Chamber finds it proven that the petitioner filed administrative complaints with the respondent municipality on 9 and 10 October 2025 concerning alleged irregularities in the Playa Delfines Regulatory Plan, Cañaza de Puerto Jiménez. At Ordinary Session N° 64-2025 of 12 October 2025, the Municipal Council considered both complaints and adopted Agreement N° 10, Article IV, whereby it was unanimously and finally agreed to refer the complaints to the Municipal Administration and instruct the Legal Department to issue the corresponding technical-legal opinion.

By Official Letter AMPJ-1050-2025 of 15 October 2025, the Office of the Mayor informed the protected party that, due to the complexity of the matter, the volume of information, and the administrative steps necessary for a thorough analysis, an additional period of forty-five (45) business days was required to issue the corresponding opinions. The Maritime-Terrestrial Zone Department conducted a field inspection jointly with SINAC officials, documented in Report INF-ZMT-PJ-025-2025, which confirmed the existence of the gate identified in the complaint. The Municipal Cadastre and Surveying Department issued Report 002-DCTPJ-2025 of 27 October 2025, containing georeferenced verification using GNSS technology and the CR-SIRGAS system, determining the exact location of the gate within the Maritime-Terrestrial Zone. Legal Opinion 005-2025 of 20 November 2025 analyzed the complaint concerning violations of land use, zoning, and environmental damage, and concluded that the complaint was well-founded and that sufficient indications existed of possible serious violations, recommending the establishment of an interdisciplinary commission to conduct a comprehensive investigation of the facts.

Legal Opinion 006-2025 of 8 December 2025 analyzed the situation of the gate in the Las Ramplas sector and concluded that it constituted an unauthorized occupation of the public domain, recommending its immediate removal. By Official Letter AMPJ-1187-2025 of 5 December 2025, the Office of the Mayor notified the protected party of the issuance and referral of Legal Opinions N° 004-2025 and 005-2025. The Maritime-Terrestrial Zone Department issued Resolution N° PJ-ZMT-R-177-2025 of 12 December 2025, which ORDERED Rowayton Inversiones Costerras RICSA S.A. to voluntarily remove the gate installed in the Maritime-Terrestrial Zone, granted a period of TEN BUSINESS DAYS for its voluntary removal, and warned that, in the event of noncompliance, the Municipality would initiate the administrative procedure for eviction and immediate removal. In view of the foregoing, the Chamber considers that the amparo action (recurso de amparo) must be partially granted, as explained below.

As may be seen from the established facts, the respondent municipality did diligently process the complaints filed by the petitioner. Indeed, it is apparent that, initially, the protected party was asked for an extension of the time limit so that the complaint could be addressed in accordance with law, because numerous procedures, coordination efforts, inspections, and opinions were required to address the complaints fully. This is precisely what this Court has sought to establish as jurisprudential guidelines in cases of this kind. Accordingly, the municipality’s actions were appropriate and consistent with the protected party’s rights. No violation is therefore apparent in that respect. Furthermore, this Court notes that timely legal opinions were also issued, concluding that the removal of certain gates found in the Maritime-Terrestrial Zone should be ordered, for which purpose the corresponding administrative removal decision was issued.

Finally, the record also establishes the existence of a legal opinion analyzing the complaint concerning violations of land use, zoning, and environmental damage, which concluded that the complaint was well-founded and that sufficient indications existed of possible serious violations, recommending the establishment of an interdisciplinary commission to conduct a comprehensive investigation of the facts. Nevertheless, to date, it is not known what has occurred regarding the establishment of that interdisciplinary commission or what sanctions or agreements may be adopted to reverse and remedy the situation identified. This is so even though that legal opinion was issued on 20 November 2025, nearly four months ago. Accordingly, although the municipality’s actions have been proper, timely, diligent, and efficient with respect to most of the matters raised in the complaint, the Chamber cannot overlook the environmental damage that appears to have been caused in the Maritime-Terrestrial Zone.

For this reason alone, the amparo must be granted, so that the municipal authorities may issue the corresponding orders requiring the interdisciplinary commission to submit its conclusions and the corresponding administrative decisions to be issued to address the alleged environmental damage.

VI. NOTE BY JUSTICE CASTILLO VÍQUEZ REGARDING PROMPT AND EFFECTIVE ADMINISTRATIVE JUSTICE

I have supported this Court’s position that, when a litigant (justiciable) alleges a violation of the right to prompt and effective justice in administrative proceedings (sede administrativa), the courts that must hear the legal dispute are the Administrative Litigation Courts (Tribunales de lo Contencioso-Administrativo), rather than this Chamber. However, the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, established that this right is eligible for judicial protection through the amparo action provided for in Article 32 of the Ley de la Jurisdicción Constitucional, in conjunction with Article 27 of the Constitución Política de la República de Costa Rica, in those cases in which the petitioner believes that the Administration’s material conduct, its administrative acts (actos administrativos), or its response is affecting the petitioner’s fundamental rights.

In my view, the recently enacted legislation does not require this Court to alter its jurisprudential approach, because, pursuant to section 7 of its Law, it has exclusive authority to define its own jurisdiction. Consequently, except for those legal-constitutional disputes that this Chamber itself has recognized as exceptional circumstances that may properly be heard in this jurisdiction through the constitutional amparo proceeding (proceso constitucional de garantía del amparo), in all other cases—and for the reasons given by this Court (judgment N° 2008-02545 at 8:55 hours on 22 February 2008)—jurisdiction lies with the Judges of the administrative litigation jurisdiction (jurisdicción de lo contencioso-administrativo). All of this is consistent with section 25 of the Convención Americana sobre Derechos Humanos, the Law of the Constitution (values, principles, and rules), and the corresponding statutory provisions, based on a logical, systemic, and purposive interpretation of the legal system.

VII. DOCUMENTATION SUBMITTED TO THE CASE FILE

This Court must advise the parties that, should they have submitted any paper documents, as well as objects or evidence stored by means of any additional device, or by means of electronic, computer, magnetic, optical, telematic media, or media produced using new technologies, these must be collected from the Court’s offices within thirty business days after receipt of notice of this judgment; otherwise, all such materials shall be destroyed in accordance with the provisions of the “Regulations on Electronic Case Files before the Judiciary,” approved by the Full Court at session N°27-11 of 22 de agosto del 2011, article XXVI, and published in Judicial Bulletin N°19 of 26 de enero del 2012, as well as the resolution approved by the Superior Council of the Judiciary at session N°43-12 held on 03 de mayo del 2012, article LXXXI.

POR TANTO:

The application is partially granted, solely with respect to the complaint concerning environmental damage. Enrique Segnini Saballo, in his capacity as Mayor of Puerto Jiménez, and Ronny Montes Sorio, in his capacity as President of the Municipal Council of Puerto Jiménez, or whoever may hold those offices in their stead, are ordered to coordinate the issuance of such orders as fall within the scope of their respective powers, so that the interdisciplinary commission may submit its conclusions and the corresponding administrative decisions may be issued to address the reported environmental damage, all within a period of THREE MONTHS from notice of this ruling. The respondents are advised that, pursuant to article 71 of the Law Governing this Jurisdiction, anyone who receives an order issued in an amparo proceeding that they are required to comply with or enforce, and fails to comply with or enforce it, shall be punished by imprisonment for three months to two years, or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.

The Municipality of Puerto Jiménez is ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement proceedings before the contentious-administrative jurisdiction. Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veinte de marzo de dos mil veintiseis .

Recurso de amparo que se tramita en expediente número 26-004174-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra el MUNICIPALIDAD DE PUERTO JIMÉNEZ.

RESULTANDO:

  1. 1Por escrito presentado en la Secretaría de la Sala a las 18:16 horas del 5 de febrero de 2026, la parte recurrente interpone recurso de amparo contra la Municipalidad de Puerto Jiménez. Manifiesta que el 10 de octubre de 2025, interpuso denuncia administrativa ante la Municipalidad de Puerto Jiménez relacionada con presuntas violaciones al Reglamento del Plan Regulador de Playa Delfines, Cañaza de Puerto Jiménez, incluyendo uso no permitido de concesiones y posibles daños a la zona de protección. Refiere que en la denuncia solicitó la investigación de los expedientes de diversas empresas concesionarias y la verificación del cumplimiento de sus contratos; así como, una inspección de campo por parte del Departamento de Zona Marítimo Terrestre para constatar las presuntas violaciones en la zona protegida y en la vía pública cuyo acceso se encontraba restringido por portones. Asegura que la denuncia que fue recibida y trasladada al Concejo Municipal (véase la prueba aportada a este recurso).Señala que, el Concejo Municipal remitió al Departamento Legal de la administración recurrida la denuncia para la emisión del respectivo criterio, el cual fue elaborado. Reclama que pese a lo anterior y, ante la falta de respuesta de la autoridad competente, el 21 de enero de 2026, la secretaría del Concejo certificó que, al 14 de enero de 2026, no existía notificación formal relativa a traslado de cargos, prevenciones o resoluciones vinculadas con las denuncias presentadas, según revisión de los registros y expedientes disponibles en esa Secretaría del Concejo Municipal. Solicita a la Sala que declare con lugar el recurso.
  2. 2Por resolución de Presidencia de las 11:29 horas del 20 de febrero de 2026, se dio curso al presente proceso y se le dio traslado al ALCALDE Y PRESIDENTE DEL CONCEJO MUNICIPAL DE PUERTO JIMÉNEZ.
  3. 3Por escrito incorporado al expediente digital a las 14:49 horas del 26 de febrero de 2026, informa bajo juramento Ronny Montes Sorio, en su condición de Presidente del Concejo Municipal de Puerto Jiménez, que el 10 de octubre de 2025 se dio la presentación de la denuncia administrativa. El 11 de octubre de 2025, el Concejo Municipal, mediante Acuerdo N.º 10 adoptado en la Sesión Ordinaria N.º 64, conoció la denuncia, la trasladó a la Administración e instruyó al Departamento Legal para la emisión del criterio técnico-legal correspondiente, quedando dicho acuerdo definitivamente aprobado y en firme. El 14 de octubre de 2025 se emite por la secretaria del concejo el Oficio SCMPJ-0141-2025 para la alcaldía municipal en ejecución del acuerdo, la denuncia fue analizada por instancias técnicas y legales, incluida la Comisión de Zona Marítimo Terrestre (ZMT). El 13 de enero de 2026 se dio reunión entre la Alcaldía Municipal, Comisión ZMT y personal técnico y legal para análisis técnico y legal del caso.(costa en actas de reunión) por las dos secretarías; Concejo municipal y alcaldía. El 17 de enero de 2026 se emite oficio SCMPJ-0008-2026 mediante el cual se comunicó formalmente la solicitud de ampliación de plazo, debidamente motivada y aceptada por las partes. El 14 de febrero de 2026 se da la recepción ante el Concejo Municipal del Oficio AMPJ-0155-2026 de la alcaldía municipal el informe técnico del topógrafo Ing. David Prendas, que identifica traslape entre Plan Regulador y calle pública. El derecho de petición no implica la obligación de resolver de forma inmediata o definitiva, sino de emitir una respuesta razonada y dar trámite efectivo. La ampliación del plazo fue expresa, escrita, motivada, razonable y aceptada por el recurrente, por lo que no existió silencio administrativo ni omisión de deberes. Solicita a la Sala que declare sin lugar el recurso.
  4. 4Por escrito incorporado al expediente digital a las 23:40 horas del 26 de febrero de 2026, informa bajo juramento Enrique Segnini Saballo, en su condición de Alcalde de Puerto Jiménez, que es cierto que el señor [Nombre 001] presentó denuncias administrativas ante esta Municipalidad los días 9 y 10 de octubre de 2025, relacionadas con presuntas irregularidades en el Plan Regulador de Playa Delfines, Cañaza de Puerto Jiménez. Es cierto que dichas denuncias fueron recibidas, tramitadas y trasladadas a los órganos competentes de esta Municipalidad para su análisis y resolución conforme a derecho. Sin embargo, niega que esta Alcaldía Municipal haya violentado el derecho de petición y pronta resolución del recurrente. Por el contrario, como se demostrará de seguido, esta Administración Municipal ha actuado con absoluta diligencia, dentro del marco de legalidad, transparencia, publicidad y celeridad que rige la actividad administrativa, dando atención efectiva, oportuna y debidamente fundamentada a cada una de las gestiones planteadas por el señor [Nombre 001].Ahora bien, resulta imperativo aclarar al señor recurrente [Nombre 001] que, si bien puede dirigirse a cualquier entidad municipal o estatal conforme al derecho que le asiste, esto no significa que la Administración esté obligada a conceder todo lo solicitado a su conveniencia o a resolver invariablemente en su favor, pues el derecho de petición es libre, pero no implica que la municipalidad tenga que resolver todo a satisfacción del petente. Las denuncias fueron recibidas en esta Municipalidad los días 9 y 10 de octubre de 2025 y de inmediato incorporadas al trámite administrativo correspondiente. El Honorable Concejo Municipal, en Sesión Ordinaria N° 64-2025 del 12 de octubre de 2025, conoció ambas denuncias y adoptó el Acuerdo N° 10, Artículo IV, mediante el cual, por unanimidad de votos y en firme, se acordó trasladar las denuncias a la Administración Municipal e instruir al Departamento Legal para la emisión del criterio técnico-legal correspondiente.Mediante Oficio SCMPJ-0141-2025 del 14 de octubre de 2025, la Secretaría del Concejo Municipal remitió las denuncias al señor alcalde. A su vez, mediante Oficio AMPJ-1043-2025 del 15 de octubre de 2025, esta Alcaldía trasladó la documentación completa (111 folios de denuncias más 2 folios del oficio del Concejo) al Departamento Legal para su análisis. Mediante Oficio AMPJ-1050-2025 del 15 de octubre de 2025, esta Alcaldía comunicó formalmente al señor [Nombre 001] que, debido a la complejidad del asunto, la cantidad de información y las gestiones administrativas necesarias para un análisis exhaustivo, se requería un plazo adicional de cuarenta y cinco (45) días hábiles para la emisión de los criterios correspondientes. Con esta actuación se cumplió la obligación constitucional de comunicar al petente las causas de la demora, conforme lo exige la jurisprudencia de esta Honorable Sala. El Departamento de Zona Marítimo Terrestre realizó inspección de campo en conjunto con funcionarios del SINAC, documentada en el Informe INF-ZMTPJ-025-2025, que constató la existencia del portón denunciado.Posteriormente, el Departamento de Catastro y Topografía emitió el Informe 002-DCTPJ-2025 del 27 de octubre de 2025, con verificación georreferenciada mediante tecnología GNSS y sistema CR-SIRGAS, determinando la ubicación exacta del portón dentro de la Zona Marítimo Terrestre. La Licda. Arelys Cascante Fernández, del Departamento Legal, emitió TRES criterios legales completos y debidamente fundamentados: • Criterio Legal 004-2025 (19 de noviembre de 2025): Analizó la denuncia por morosidad en el pago del impuesto a personas jurídicas. Concluyó que la denuncia NO PROCEDE, por cuanto las sociedades concesionarias se encuentran al día según verificación independiente en el Registro Nacional. Se recomendó archivar la denuncia por improcedente e informar al administrado. • Criterio Legal 005-2025 (20 de noviembre de 2025): Analizó la denuncia por violación al uso de suelo, zonificación y daño ambiental.Concluyó que la denuncia ES PROCEDENTE y que existen indicios suficientes de posibles infracciones graves, recomendando la conformación de una comisión interdisciplinaria para investigar integralmente los hechos. • Criterio Legal 006-2025 (8 de diciembre de 2025): Analizó la situación del portón en sector Las Ramplas. Concluyó que constituye una ocupación no autorizada de dominio público y recomendó la remoción inmediata. Mediante Oficio AMPJ-1152-2025 del 21 de noviembre de 2025, esta Alcaldía trasladó los Criterios Legales N° 004-2025 y 005-2025 al Concejo Municipal para su conocimiento, valoración y el trámite correspondiente. Mediante Oficio AMPJ-1187-2025 del 5 de diciembre de 2025, esta Alcaldía NOTIFICÓ FORMALMENTE al señor [Nombre 001] sobre la emisión y traslado de los Criterios Legales N° 004-2025 y 005-2025. En dicha comunicación se le informó que: • Los criterios fueron emitidos conforme al acuerdo del Concejo Municipal. • Los criterios analizan jurídicamente los hechos denunciados. • Han sido debidamente trasladados a la Alcaldía y al Concejo Municipal. • La emisión de los criterios legales forma parte del trámite administrativo de análisis y no constituye, por sí misma, una resolución final, sin perjuicio de las actuaciones, investigaciones o procedimientos adicionales que puedan ordenarse posteriormente. • Se adjuntó copia de los criterios legales.Este oficio fue recibido personalmente por el señor Mariano Murillo Chamorro el 5 de diciembre de 2025 a las 2:50 p.m., como consta en la constancia de recibido. El Departamento de Zona Marítimo Terrestre emitió la Resolución N° PJZMT-R-177-2025 del 12 de diciembre de 2025, mediante la cual: • Se ORDENÓ a Rowayton Inversiones Costerras RICSA S.A. el retiro voluntario del portón instalado en la ZMT. • Se otorgó plazo de DIEZ DÍAS HÁBILES para el retiro voluntario. • Se advirtió que, de incumplir, la Municipalidad procedería con el procedimiento administrativo de desocupación y retiro inmediato. En Sesión Ordinaria N° 73-2025 del 16 de diciembre de 2025, el Concejo Municipal adoptó el Acuerdo N° 07, solicitando a la Administración ampliar el criterio técnico con un mapa aéreo que incluyera mojones y ubicación del portón, para mejor resolver. Esto demuestra la diligencia y seriedad con que el Concejo Municipal ha abordado el asunto.El Departamento de Catastro y Topografía emitió el Informe 001-DCTPJ-2026 del 11 de febrero de 2026, con un análisis detallado de los traslapes del Plan Regulador de Playa Delfines, demostrando que la Administración continúa trabajando activamente en la investigación de los hechos denunciados. Mediante Oficio AMPJ-0155-2026, esta Alcaldía trasladó al Concejo Municipal los informes técnicos adicionales del Departamento de Catastro para su conocimiento y decisión. De la cronología anterior se desprende con absoluta claridad que esta Alcaldía Municipal ha dado cumplimiento pleno, oportuno y satisfactorio al derecho de petición y pronta resolución del recurrente, lo cual se resume en las siguientes actuaciones: a) Se recibieron las denuncias de forma inmediata. b) El Concejo Municipal las conoció en sesión ordinaria a los DOS DÍAS de presentadas. c) Se trasladaron al Departamento Legal dentro de los CINCO DÍAS siguientes. d) Se comunicó al recurrente la complejidad del asunto y la necesidad de un plazo adicional, cumpliendo con la obligación constitucional de informar las causas de la demora. e) Se realizaron inspecciones de campo con participación interinstitucional (Municipalidad, SINAC). f) Se emitieron TRES criterios legales completos y debidamente fundamentados. g) Se notificó formalmente al recurrente sobre los criterios legales emitidos, con entrega de copia de los mismos. h) Se emitió resolución administrativa ordenando el retiro del portón ilegal. i) Se elaboraron informes técnicos de catastro con metodología GNSS y georreferenciación. j) Se continuó con análisis de traslapes y se emitieron informes adicionales. k) Se trasladó al Concejo Municipal toda la documentación para la toma de decisiones.El recurrente pretende que esta Sala declare con lugar el recurso alegando falta de respuesta. Sin embargo, como se ha demostrado fehacientemente, la respuesta ha sido dada de forma pronta, cumplida y conforme a derecho. Lo que en realidad pretende el señor [Nombre 001] es que la Administración Municipal resuelva a su entera satisfacción y según sus propios tiempos, lo cual, como ha señalado reiteradamente esta Honorable Sala, no es lo que garantiza el derecho de petición. La complejidad del asunto denunciado —que involucra ocho sociedades concesionarias, análisis de zonificación, verificaciones de uso de suelo, inspecciones de campo, coordinación interinstitucional con SINAC, análisis de contratos de concesión inscritos en el Registro Público, verificaciones registrales, informes de catastro con tecnología GNSS, criterios legales especializados y potenciales procedimientos de nulidad absoluta ante la Procuraduría General de la República— exige un trámite riguroso, técnico y conforme al ordenamiento jurídico, no una resolución apresurada que comprometa la seguridad jurídica y el interés público.Pretender que una investigación administrativa de esta magnitud se resuelva en plazos reducidos, sin la debida diligencia técnica y jurídica, sería contrario a los principios de legalidad, verdad material y seguridad jurídica que rigen la actividad administrativa. Solicita a la Sala que declare sin lugar el recurso.
  5. 5En los procedimientos seguidos se han observado las prescripciones legales.

Redacta el Magistrado Salazar Alvarado; y,

CONSIDERANDO:

I. ACLARACIÓN PREVIA

Antes de analizar el fondo del asunto, debe aclararse que, a partir de la Sentencia N° 2008-02545 de las 08:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones– aquellos asuntos en los que se discute, si la administración ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o por leyes sectoriales para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– o conocer de los recursos administrativos procedentes. Precisamente, en el sub lite, se plantea un supuesto de excepción, pues se está frente a una denuncia relacionada con el aparente daño ambiental a la zona de protección concesionada por parte de la municipalidad accionada, así como a la instalación de portones que impiden el libre tránsito, la cual no ha sido resuelta dentro de un plazo razonable. Atendiendo a los derechos fundamentales que se invocan (ambiente y libertad de tránsito), esta Sala valora las posibles dilaciones en la resolución de las denuncias de este tipo. Clarificado el punto, se entra a resolver la situación concreta planteada en este amparo.

II. OBJETO DEL RECURSO

La parte recurrente indica que el 10 de octubre de 2025, interpuso denuncia administrativa ante la Municipalidad de Puerto Jiménez relacionada con presuntas violaciones al Reglamento del Plan Regulador de Playa Delfines, incluyendo uso no permitido de concesiones, instalación de portones que impiden el libre tránsito y posibles daños ambientales a la zona de protección; empero, al 14 de enero de 2026, no existía notificación formal relativa a traslado de cargos, prevenciones o resoluciones vinculadas con las denuncias presentadas.

III. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:

  • a)El recurrente presentó denuncias administrativas ante la municipalidad accionada los días 9 y 10 de octubre de 2025, relacionadas con presuntas irregularidades en el Plan Regulador de Playa Delfines, Cañaza de Puerto Jiménez (ver informe rendido bajo juramento).
  • b)El Concejo Municipal, en Sesión Ordinaria N° 64-2025 del 12 de octubre de 2025, conoció ambas denuncias y adoptó el Acuerdo N° 10, Artículo IV, mediante el cual, por unanimidad de votos y en firme, se acordó trasladar las denuncias a la Administración Municipal e instruir al Departamento Legal para la emisión del criterio técnico-legal correspondiente (ver informe rendido bajo juramento).
  • c)Mediante Oficio AMPJ-1050-2025 del 15 de octubre de 2025, la Alcaldía comunicó al amparado que, debido a la complejidad del asunto, la cantidad de información y las gestiones administrativas necesarias para un análisis exhaustivo, se requería un plazo adicional de cuarenta y cinco (45) días hábiles para la emisión de los criterios correspondientes (ver informe rendido bajo juramento).
  • d)El Departamento de Zona Marítimo Terrestre realizó inspección de campo en conjunto con funcionarios del SINAC, documentada en el Informe INF-ZMT-PJ-025-2025, que constató la existencia del portón denunciado (ver informe rendido bajo juramento).
  • e)El Departamento de Catastro y Topografía Municipal emitió el Informe 002-DCTPJ-2025 del 27 de octubre de 2025, con verificación georreferenciada mediante tecnología GNSS y sistema CR-SIRGAS, determinando la ubicación exacta del portón dentro de la Zona Marítimo Terrestre (ver informe rendido bajo juramento).
  • f)Mediante Criterio Legal 005-2025 del 20 de noviembre de 2025, se analizó la denuncia por violación al uso de suelo, zonificación y daño ambiental y se concluyó que la denuncia era procedente, y que existen indicios suficientes de posibles infracciones graves, recomendando la conformación de una comisión interdisciplinaria para investigar integralmente los hechos (ver informe rendido bajo juramento).
  • g)Mediante Criterio Legal 006-2025 del 8 de diciembre de 2025, se analizó la situación del portón en sector Las Ramplas, y se concluyó que constituye una ocupación no autorizada de dominio público y recomendó la remoción inmediata (ver informe rendido bajo juramento).
  • h)Mediante Oficio AMPJ-1187-2025 del 5 de diciembre de 2025, la Alcaldía notificó al tutelado sobre la emisión y traslado de los Criterios Legales N° 004-2025 y 005-2025 (ver informe rendido bajo juramento).
  • i)El Departamento de Zona Marítimo Terrestre emitió la Resolución N° PJ-ZMT-R-177-2025 del 12 de diciembre de 2025, mediante la cual se ORDENÓ a Rowayton Inversiones Costerras RICSA S.A. el retiro voluntario del portón instalado en la Zona Marítimo Terrestre, se otorgó plazo de DIEZ DÍAS HÁBILES para el retiro voluntario y se advirtió que, de incumplir, la Municipalidad procedería con el procedimiento administrativo de desocupación y retiro inmediato (ver informe rendido bajo juramento).

IV. SOBRE EL DERECHO A UNA JUSTICIA PRONTA Y CUMPLIDA

La Administración, a la luz del artículo 41, Constitucional, tiene la obligación de garantizarle a la ciudadanía el cumplimiento de la justicia pronta y cumplida, sin denegación, lo que implica, en el ámbito de la justicia administrativa, su obligación de decidir con diligencia y celeridad los reclamos planteados por los administrados, de tal manera que su resolución sea congruente con los extremos alegados, así como de comunicarles a los interesados lo dispuesto, todo ello dentro de un plazo razonable. En este sentido, el carácter “razonable” de la duración de la actividad administrativa se determina casuísticamente con base en diversos elementos, tales como la complejidad técnica del asunto administrativo, la amplitud de la prueba por evacuar o el grado de afectación a la persona o al ambiente del acto impugnado, de lo cual se infiere que no existe un derecho estricto a la constitucionalización de los plazos, sino más bien un derecho a que se aplique el control de constitucionalidad sobre aquellas actuaciones de la Administración, en las cuales no existan motivos suficientes para justificar el tiempo demorado en la solución de algún tipo de gestión administrativa.

V. SOBRE EL CASO CONCRETO

En el sub examine, la parte recurrente aduce que el 10 de octubre de 2025, interpuso denuncia administrativa ante la Municipalidad de Puerto Jiménez relacionada con presuntas violaciones al Reglamento del Plan Regulador de Playa Delfines, incluyendo uso no permitido de concesiones, instalación de portones que impiden el libre tránsito y posibles daños ambientales a la zona de protección; empero, al 14 de enero de 2026, no existía notificación formal relativa a traslado de cargos, prevenciones o resoluciones vinculadas con las denuncias presentadas. Al respecto, la Sala tiene por demostrado que el recurrente presentó denuncias administrativas ante la municipalidad accionada los días 9 y 10 de octubre de 2025, relacionadas con presuntas irregularidades en el Plan Regulador de Playa Delfines, Cañaza de Puerto Jiménez. El Concejo Municipal, en Sesión Ordinaria N° 64-2025 del 12 de octubre de 2025, conoció ambas denuncias y adoptó el Acuerdo N° 10, Artículo IV, mediante el cual, por unanimidad de votos y en firme, se acordó trasladar las denuncias a la Administración Municipal e instruir al Departamento Legal para la emisión del criterio técnico-legal correspondiente.

Mediante Criterio Legal 005-2025 del 20 de noviembre de 2025, se analizó la denuncia por violación al uso de suelo, zonificación y daño ambiental y se concluyó que la denuncia era procedente, y que existen indicios suficientes de posibles infracciones graves, recomendando la conformación de una comisión interdisciplinaria para investigar integralmente los hechos.

Mediante Criterio Legal 006-2025 del 8 de diciembre de 2025, se analizó la situación del portón en sector Las Ramplas, y se concluyó que constituye una ocupación no autorizada de dominio público y recomendó la remoción inmediata. Mediante Oficio AMPJ-1187-2025 del 5 de diciembre de 2025, la Alcaldía notificó al tutelado sobre la emisión y traslado de los Criterios Legales N° 004-2025 y 005-2025. El Departamento de Zona Marítimo Terrestre emitió la Resolución N° PJ-ZMT-R-177-2025 del 12 de diciembre de 2025, mediante la cual se ORDENÓ a Rowayton Inversiones Costerras RICSA S.A. el retiro voluntario del portón instalado en la Zona Marítimo Terrestre, se otorgó plazo de DIEZ DÍAS HÁBILES para el retiro voluntario y se advirtió que, de incumplir, la Municipalidad procedería con el procedimiento administrativo de desocupación y retiro inmediato. Ante este panorama, estima la Sala que se debe declarar parcialmente con lugar el recurso, según se explicará de seguido.

Como puede apreciarse del elenco de hechos probados, la municipalidad accionada sí ha tramitado de manera diligente las denuncias incoadas por la parte recurrente. En efecto, se aprecia que, en primera instancia, al amparado se le solicitó la ampliación del plazo para poder atender la denuncia conforme a derecho, pues requería de muchos trámites, coordinaciones, inspecciones y criterios para poder atender a cabalidad las denuncias. Esto es precisamente lo que se ha procurado sentar como lineamientos jurisprudenciales por parte de este Tribunal en esta clase de casos. Y por ello es que la actuación municipal fue adecuada y acorde a los derechos del tutelado. En ese sentido no se observa infracción alguna. Por otra parte, aprecia este Tribunal que también se emitieron criterios legales oportunos donde se concluyó que sí se debía ordenar la remoción de unos portones detectados en la zona marítimo terrestre, para lo cual se giró la correspondiente resolución administrativa de remoción.

Finalmente, también se acredita un criterio legal donde se analizó la denuncia por violación al uso de suelo, zonificación y daño ambiental y se concluyó que la denuncia era procedente, y que existen indicios suficientes de posibles infracciones graves, recomendando la conformación de una comisión interdisciplinaria para investigar integralmente los hechos. No obstante, a la fecha, no se conoce qué ha pasado con la constitución de dicha comisión interdisciplinaria y cuáles serán las sanciones o acuerdos que se puedan tomar para revertir y corregir la situación detectada. Lo anterior a pesar de que dicho criterio legal fue emitido desde el pasado 20 de noviembre de 2025, es decir, hace casi cuatro meses. Así las cosas, a pesar de que las actuaciones municipales han sido correctas, oportunas, diligentes y eficientes, en la mayoría de los puntos objeto de la denuncia, la Sala no puede pasar por alto lo relativo al daño ambiental que, en apariencia, ha sido ocasionado en la zona marítimo terrestre.

Es por esta razón únicamente que procede la estimatoria del amparo, con el propósito que las autoridades municipales giren las órdenes correspondientes para que la comisión interdisciplinaria rinda sus conclusiones y se emitan las resoluciones administrativas correspondientes para atender lo relativo al daño ambiental denunciado.

VI. NOTA DEL MAGISTRADO CASTILLO VÍQUEZ, EN CUANTO A LA JUSTICIA ADMINISTRATIVA PRONTA Y CUMPLIDA

He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia.

Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.

VII. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Debe prevenir esta Sala a las partes que, de haber aportado algún documentos en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo de treinta días hábiles después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión N°27-11 del 22 de agosto del 2011, artículo XXVI y publicado en Boletín Judicial N°19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N°43-12 celebrada el 03 de mayo del 2012, artículo LXXXI.

POR TANTO:

Se declara parcialmente con lugar el recurso, solo en lo relativo a la denuncia por daño ambiental. Se ordena a Enrique Segnini Saballo, en su condición de Alcalde de Puerto Jiménez, y a Ronny Montes Sorio, en su condición de Presidente del Concejo Municipal de Puerto Jiménez, o a quienes ocupen en su lugar esos cargos, para que de manera coordinada se giren las órdenes que estén dentro del ámbito de sus competencias, para que la comisión interdisciplinaria rinda sus conclusiones y se emitan las resoluciones administrativas correspondientes para atender lo relativo al daño ambiental denunciado, todo lo cual dentro del plazo de TRES MESES, contados a partir de la notificación de este fallo. Se advierte a los recurridos que de conformidad con el artículo 71, de la Ley de esta Jurisdicción, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.

Se condena a la Municipalidad de Puerto Jiménez al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En lo demás, se declara sin lugar el recurso. El magistrado Castillo Víquez consigna nota.- Fernando Castillo V.
