Application for amparo (recurso de amparo) filed by THOMAS KERRY BAILEY BAILEY, identity card [Valor 007], on behalf of [Nombre 001], [Nombre 002], identity card [Valor 001], [Nombre 003], identity card [Valor 002], [Nombre 004], identity card [Valor 003], [Nombre 005], identity card [Valor 004], [Nombre 006], identity card [Valor 005], and [Nombre 007], identity card [Valor 006], against EL INSTITUTO GEOGRÁFICO NACIONAL, EL MINISTRO DE SALUD, LA MUNICIPALIDAD DE QUEPOS, and EL SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (SINAC).
Findings:
The boundary-demarcation procedure (procedimiento de deslinde) shall be established in the regulations to this law.” Decreto Ejecutivo N°36786-MINAET, Manual for the Classification of Lands Dedicated to the Conservation of Natural Resources within the Maritime-Terrestrial Zone in Costa Rica, dated 12 de agosto del 2011, establishes among its objectives: “To identify, within the Maritime-Terrestrial Zone (Zona Marítimo Terrestre), those lands classified as forests, lands suited for forestry (forest aptitude, aptitud forestal) (Class VII and VIII soils), and wetlands (humedales) (mangroves, estuaries, tidal inlets, marshes, coastal lagoons, swamps, flooded forests, salt flats), in order to certify them and incorporate them as part of the State Natural Heritage (Patrimonio Natural del Estado, PNE).” In addition, section III.—Powers for Delimitation and Certification of Decreto Ejecutivo N°36786-MINAET provides that: “III.—Powers for delimitation and certification.
The classification of lands within the ZMT shall be the responsibility of the Conservation Areas (Áreas de Conservación, AC) of the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC) and of private professionals duly accredited by their respective Professional Associations to classify forests, lands suited for forestry (Class VII and VIII soils), mangroves, estuaries, tidal inlets, marshes, coastal lagoons, swamps, flooded forests, salt flats, and wetlands. The validity of classification documents issued by private professionals shall be subject to approval by the AC with territorial jurisdiction. The SINAC AC with jurisdiction over the ZMT shall also be responsible for verifying, inspecting, demarcating, and certifying State Natural Heritage lands and protection zones (zonas de protección). The location and delimitation of State Natural Heritage areas within the Maritime-Terrestrial Zone must be carried out as part of the approval process for the Coastal Regulatory Plan (Plan Regulador Costero, PRC), as defined by Ley 6043, since the Coastal Regulatory Plan is the land-use planning instrument (instrumento de ordenamiento territorial) that defines and locates all zones to be granted under concession within the ZMT and classifies it at the cadastral-plan level.
Therefore, the Coastal Regulatory Plan must clearly and expressly identify the PNE areas so that they are not counted within the total area available for concession.” Decreto Ejecutivo N°42760-MINAE, Technical Criteria for the Location, Identification, Classification, and Delimitation of Wetland Ecosystems, dated 07 de marzo de 2022, sets forth in Article 14 the considerations for field verification of the existence of mangroves and the corresponding delimitation, as follows: “Article 14.—Supplementary technical considerations for mangroves. The respective Conservation Area, together with the National Geographic Institute (Instituto Geográfico Nacional), shall verify in the field the existence of mangroves and proceed with their delimitation, in accordance with each institution’s authority as provided by the legal system. For purposes of identifying a mangrove, the presence of trees belonging to any of the species listed in Annex I to this decree shall be used as a parameter; existing estuaries and channels shall also be included within these ecosystems.
The boundary shall be established up to the point where the vegetation associated with this ecosystem extends, in accordance with Annex II to this decree. In addition to the foregoing, the provisions of Annex III to this decree, entitled ‘List of Flora by Wetland Type According to the Landscape Classification of Estuarine Wetlands and Saltwater-Flooded Forests (Mangroves),’ must be taken into account. The mangrove-delimitation process must necessarily include areas that are degraded or undergoing recovery. Furthermore, within the scope of its authority, the respective Conservation Area shall implement the measures necessary to promote such recovery.” Accordingly, once the delimitation has been carried out by the competent entities, namely MINAE and IGN, the public zone (zona pública) of the Maritime-Terrestrial Zone is formally established through publication in the Official Gazette La Gaceta, in accordance with section 63 of Decreto Ejecutivo N°7841-P: “Article 63.—The National Geographic Institute shall publish a notice in the Official Gazette for each portion of the Maritime-Terrestrial Zone in which it has demarcated the public zone.
The General Directorate of the Cadastre shall not register any plan that does not bear the approval of the National Geographic Institute with respect to the delimitation of the public zone.” As a result of the actions undertaken by Área de Conservación Pacífico Central and IGN, the mangroves located in central Quepos were delimited, including the sectors of El Cocal, Boca Vieja and Damas, all pursuant to the powers established by law and supported by the following technical reports:
Finally, those delimitations were formally established in the Official Gazette La Gaceta, as follows: 1) Aviso N°003-2023 Maritime-Terrestrial Zone—Delimitation of a Public-Zone Sector Corresponding to Estero - Manglar Boca Vieja, in El Cocal, district 01º Quepos, canton 06º Quepos, province 06º Puntarenas; published in the Official Gazette La Gaceta N°32 on martes 21 de febrero del 2023. 2) Aviso N°009-2023 Maritime-Terrestrial Zone—Delimitation of a Public-Zone Sector Corresponding to the Estuary-Mangrove in the Central Quepos Sector, Sector 2 “Los Alfaro,” Sector 3 “Junta Naranjo,” Sector 4 “Cementerio,” district 01º Quepos, canton 06º Quepos, province 06º Puntarenas; published in the Official Gazette La Gaceta N°181 on martes 03 de octubre del 2023. 3) Aviso N°007-2024 Maritime-Terrestrial Zone—Delimitation of a Public-Zone Sector Corresponding to the Estuary-Mangrove between Río Paquita and Río Damas, district 01º Quepos, canton 06º Quepos, province 06º Puntarenas; published in the Official Gazette La Gaceta N°205 on viernes 01 de noviembre del 2024.
In conclusion, and in accordance with the foregoing, the appellant’s assertion is unfounded, because the delimitation work was carried out jointly by the relevant authorities. His allegation concerning the purported lack of joint interinstitutional work must therefore be rejected, given that Municipalidad de Quepos has no involvement whatsoever in the demarcation work performed by the Conservation Areas and IGN pursuant to the duties assigned to them by the legal system. Likewise, Mr. Bailey Bailey neither explains nor specifies which application remains pending resolution by IGN, and the appeal is similarly unclear in that regard, since the ordered delimitation has been completed. This leads to the conclusion that the appeal under consideration here must be dismissed with respect to any alleged failure by IGN to comply with the ruling of Sala Constitucional in resolution Nº02741-2021 at 09:15 hours on 12 de febrero del 2021 in Expediente N°20-021786-0007-CO.
Separately, but no less importantly, Mr. [Nombre 005] (who is listed among the appellants according to the resolution issued at 10:16 hours on 16 de setiembre del 2025 and served at 09:15 hours on 18 de setiembre del 2025) was provided, through official letter DIG-GDF-223-2025 dated 03 de julio de 2025, with the requested information, namely the technical and scientific studies concerning the criteria on which the delimitation of public-domain areas (áreas demaniales) in Quepos was based. In addition to attaching the reports requested in his submission, the letter clarified IGN’s powers regarding delimitation and the potential involvement of MINAE when areas belonging to the State Natural Heritage (PNE) are involved.
D. Request to Casa Presidencial to issue declarations of coastal urban zones by executive decree in its capacity as a member of CIZUL Mr. Bailey Bailey, on behalf of the residents of Barrio El Cocal, requests and recommends that Casa Presidencial assume its role on the CIZUL Government Commission by exercising Article 3 of Ley N°9221 in order to issue declarations of coastal urban zones (zonas urbanas litorales) by executive decree.
In this regard, this Honorable Sala Constitucional is respectfully requested to take into consideration that Ley marco para la declaratoria de zona urbana litoral y su régimen de uso y aprovechamiento territorial, Ley N°9221 of 27 de marzo del 2014, as amended, creates through Article 4 the Interinstitutional Commission on Coastal Urban Zones (Comisión Interinstitucional de Zonas Urbanas Litorales, CIZUL), as a technical body attached to Ministerio de Gobernación y Policía, whose function is to determine the technical feasibility of declaring a coastal urban zone; its Governing Council shall be composed of:
“Article 4.—(…) CIZUL shall have a Governing Council composed of:
The representatives of the ministers, executive presidents, or directors must be officials of the agency under the authority of the respective officeholder and shall serve ad honórem. (…)” (Emphasis supplied.)
Under that understanding, the opinions issued by CIZUL do not fall within the exclusive authority of Casa Presidencial; rather, they concern the determination of the technical feasibility of declaring coastal urban zones, in accordance with the conditions established in Articles 5 and 6 of Ley N°9221 and consistently with the provisions of Decreto Ejecutivo N°44100-MGP-TUR-MINAE-MJP-PLAN-MIVAH, Regulations to the Framework Law for the Declaration of Coastal Urban Zones and Their Land-Use and Development Regime, dated 24 de mayo del 2023.
Furthermore, in determining what does or does not fall within IGN’s authority, it is necessary to consider the provisions of that same Article 1 of Ley N°59, which expressly provides that IGN shall be:
“(…) the leading scientific and technical agency for national cartography, charged with producing the official basic map and the basic geographic description of República de Costa Rica, as well as conducting studies, research, or work and developing national policies of a cartographic, geographic, geodetic, geophysical, or similar nature related to those products, for the purpose of supporting planning processes.” (Emphasis supplied.) Likewise, section 2 of that same regulatory instrument (cuerpo normativo) provides that IGN shall be the official authority in the technical matters entrusted to it, namely: “Article 2.- The Instituto Geográfico Nacional shall permanently constitute, on behalf of the State, the official authority in all matters relating to the aforementioned technical fields; its authority being understood to extend to activities of any kind originating from the work entrusted to it or resulting therefrom.” (Emphasis supplied.) Accordingly, IGN’s role, as the permanent official authority and representative of the State, would be limited to developing national policies of a cartographic, geographic, geodetic, geophysical, or similar nature that make it possible to support such work, in order to assist planning processes.
The foregoing is consistent with section 59 of the Ley General de la Administración Púbica, Ley N°6227 of 02 de mayo de 1978, as amended, which provides: “Article 59.- 1. Jurisdiction (competencia) shall be regulated by law whenever it entails the conferral of sovereign powers (potestades de imperio). 2. The internal distribution of jurisdiction, as well as the creation of services without sovereign powers, may be established by autonomous regulation (reglamento autónomo), but such regulation shall be subordinate to any future law governing the matter. 3. Relations between bodies may be regulated by autonomous regulation, which shall likewise be subordinate to any future law.” (Emphasis supplied.) On that understanding, Ley N°59 is clear regarding IGN’s jurisdiction, and that regulatory instrument confers upon it neither suitability nor any sovereign power over urban-planning processes (procesos de planificación urbana) or regulatory plans (planes reguladores), beyond providing support for such processes, with that support being limited to the matters falling within its functions; the legal system having assigned jurisdiction over those matters to other public entities (entes públicos).
For its part, Decreto Ejecutivo N°44481-MJP Reglamento del Instituto Geográfico Nacional of 08 de mayo del 2024, published in Alcance N°111 to La Gaceta N°107 of 13 de junio del 2024, established IGN’s functions in Article 7, while section 8 further details the powers and obligations arising from each of IGN’s substantive fields—cartography, geography, geodesy, and geophysics—none of which includes participation in urban-planning processes or the promotion of regulatory plans.” It requests that the appeal (recurso) be denied.

FOURTH On 21 de mayo del 2021, the Sala Constitucional was notified by email, through Official Communication SINAC-ACOPAC-OSRAP-324-2021, of partial compliance with POR TANTO THIRD. FIFTH Through technical reports DIGTOT-INF-001-2023 dated 09 de enero de 2023 and SINACACOPAC-RT-PNE-098-2022 dated 20 de diciembre de 2022, prepared, respectively, by the Subproceso de Límites Oficiales del Departamento Topográfico y Observación del Territorio del Instituto Geográfico Nacional (IGN) and the Oficina Programas Información y Regularización del Territorio, Programa Patrimonio Natural del Estado de Área de Conservación Pacífico Central (ACOPAC), the Boca Vieja estuary/mangrove ecosystem was digitally delimited. SIXTH NOTICE N° 003-2023, ‘MARITIME-TERRESTRIAL ZONE: DELIMITATION OF A PUBLIC-ZONE SECTOR CORRESPONDING TO THE BOCA VIEJA ESTUARY-MANGROVE, DISTRICT 01° QUEPOS, CANTON 06° QUEPOS, PROVINCE 06° PUNTARENAS,’ was published in the official gazette La Gaceta Nº 32 on martes 21 de febrero del 2023, establishing the following.
Article 5—The public zone (zona pública) of the Maritime-Terrestrial Zone (Zona Marítimo Terrestre) pertaining to the mangrove ecosystem sector verified and delimited by the Área de Conservación Pacífico Central corresponds to the following coordinates in Costa Rica’s official CRTM05 cartographic projection system:
Article 6—The official technical data from the georeferenced digital delimitation of the public zone of the Maritime-Terrestrial Zone of the Boca Vieja estuary/mangrove ecosystem, located in Quepos, district 01° Quepos, canton 06° Quepos, province 06° Puntarenas, have been recorded in the Georeferenced Digital Geodatabase of the Maritime-Terrestrial Zone (ZMT) of IGN in a vector shape-format file under the code: RN/IGN_GDG-IGN-ZMT_líneas digitales. Por tanto, FOURTH: Likewise, Jong Kwan Kim Jim, in his capacity as Mayor; Kenneth Mauricio Perez Vargas, in his capacity as President of the Council, both of the Municipalidad de Quepos; the Head of the Oficina Subregional Aguirre Parrita of the Área de Conservación Pacífico Central of the Sistema Nacional de Áreas de Conservación; and Daniel Salas Peraza, in his capacity as Minister of Health, or whoever may hold those positions in their stead, are ordered to act jointly and in coordination, including with other competent institutions, to IMMEDIATELY adopt the measures necessary to mitigate and prevent the pollution caused by wastewater (aguas residuales) from the El Cocal settlement.
With respect to this matter, Por tanto, FOURTH: SINAC, through the Subregión Aguirre – Parrita of the Área de Conservación Pacífico Central, does not have direct authority to address it; such authority would lie with the Municipalidad de Quepos. Nevertheless, we are willing to cooperate in the process in accordance with our capabilities and areas of responsibility. Por tanto, FIFTH: The respondent authorities are likewise ordered, within a maximum period of SIX MONTHS from notification of this judgment, to define the legal nature and regulatory regime applicable to the territory where the settlement is located. With respect to this matter, Por tanto, FIFTH: SINAC, through the Subregión Aguirre – Parrita of the Área de Conservación Pacífico Central, does not have direct authority to address it; such authority would lie with the Municipalidad de Quepos. Nevertheless, we are willing to cooperate in the process in accordance with our capabilities and areas of responsibility.
Por tanto, SIXTH: Once the legal status and the regime applicable to the territory in question have been defined, the respondent authorities shall, within a maximum period of TWENTY-FOUR MONTHS from notification of this judgment and according to their respective powers, provide a definitive solution to the wastewater pollution problem occurring in the El Cocal settlement area, which affects the environment. With respect to this matter, Por tanto, SIXTH: SINAC, through the Subregión Aguirre – Parrita of the Área de Conservación Pacífico Central, does not have direct authority to address it; such authority would lie with the Municipalidad de Quepos and the Ministerio de Salud. Nevertheless, we are willing to cooperate in the process in accordance with our capabilities and areas of responsibility. RELIEF REQUESTED That the amparo appeal filed by Mr. THOMAS KERRY BAILEY BAILEY, processed under expediente 25-025088-0007-CO, be dismissed, because the Sistema Nacional de Áreas de Conservación has, within the scope of its powers, undertaken the actions aimed at complying with JUDGMENT N° 2021-2741, issued at 9:15 hours on 12 de febrero del 2021.”
Justice Cruz Castro drafts the opinion; and,
Whereas:
The petitioner alleges that the protected parties are residents of the El Cocal neighborhood, located in Quepos, Puntarenas. They state that, by judgment Nro. 2021-2741 issued at 9:15 hours on 12 de febrero de 2021 in expediente Nro. 20- 021786-0007-CO, this Sala partially granted the amparo proceeding filed by members of their community and ordered the respondent authorities to adopt specific measures to safeguard their rights; however, they complain that, as of the date on which this proceeding was filed, the authorities had not complied with that order. They state that the community wishes to be included in Quepos’s current land-use plan (plan regulador), but has been discriminated against through the actions of local governments, which have not included it in that plan. At present, the population’s low level of education is being exploited to persuade some residents by invoking laws and technical criteria that the community does not understand.
They contend that the community’s exclusion from updates to the urban land-use plan reflects the tacit interests of sectors interested in the beaches in this part of El Cocal, and that the community does not wish to be included in a land-use plan subject to a tourism fee because, as residents of modest means, they cannot afford it. They state that legally integrating the community into an existing urban land-use plan for the coastal area would enable them to attain optimal well-being as citizens whose fundamental rights are recognized, including a dignified life, the right to health, the right to be included in citizen participation, and access to community-development projects. They report that the documentation submitted to the Municipalidad de Quepos has not prompted active and decisive action to comply with the constitutional judgment and improve people’s quality of life. Projects such as the sanitary sewer system cannot be implemented because of the existing unlawful situation, which coexists with the ineffectiveness of government action in Quepos.
They further explain that they were surprised by the publication in La Gaceta of the IGN’s new georeferences, in compliance with the boundary delimitation ordered by the judgment. Nevertheless, nothing has been resolved to date. This was verified at the ATM department of the Municipalidad de Quepos, whose officials were not consulted regarding those delimitations, even though the judgment orders interinstitutional action. They reiterate that the statement of facts and documents submitted to support a territorial management plan, as well as the responses received, have produced nothing more than technical and dilatory arguments, without achieving any progress in resolving the human-environmental, socioeconomic, and territorial-legal conflict. They consider that the foregoing violates their fundamental rights. They request that the proceeding be granted and that, if it is granted, Casa Presidencial assume its duties in the role of the Comisión de Gobierno, pursuant to Ley Nro. 9024, exercising the authority under artículo 3, which authorizes the Executive Branch, through the Ministerio de Gobernación y Policía, to designate coastal urban zones by executive decree.
The following facts are deemed duly established and relevant to the disposition of this matter, either because they have been substantiated or because the respondent authority failed to address them, as directed in the initial order:
REGARDING THE MUNICIPALIDAD DE QUEPOS The sector known as Playa El Cocal de Quepos is unequivocally subject to the Zona Marítimo Terrestre regime, a legal status repeatedly recognized by the Instituto Geográfico Nacional (IGN), the Procuraduría General de la República (PGR), and the Contraloría General de la República (CGR) (see report of the respondent authority).
The cartographic delimitation published in La Gaceta N° 32 of 21 de febrero de 2023 did not entail an expansion of Quepos’s urban boundaries, but rather strict compliance with a court order to define the boundaries of the Boca Vieja mangrove ecosystem (see report of the respondent authority).
The residents of El Cocal de Quepos hold no title to property or similar instrument making them the lawful owners of the land they use (see report of the respondent authority).
The local government declared road access to the community of El Cocal to be of cantonal interest (see report of the respondent authority).
At Ordinary Session N.° 289-2023, held on 14 de noviembre de 2023, the Concejo Municipal considered the Opinion of the Comisión Especial de Zona Marítimo Terrestre, which analyzed the application of Ley N.° 6043 and the official delimitation of the mangrove in El Cocal (see report of the respondent authority).
At Ordinary Session N.° 024-2024, dated 21 de agosto de 2024, the Concejo Municipal considered the petitioner’s written submission and agreed to continue the measures concerning the Plan de Ordenamiento Socioeconómico del Cocal (see report of the respondent authority).
At Ordinary Session N.° 030-2024, held on 10 de septiembre de 2024 and ratified at S.O. N.° 031-2024, the Concejo considered Official Letter MQ-UZMT-327- 2024 concerning the road network, electricity, and delimitation of El Cocal. It agreed to refer the recommendations to the Administration and coordinate with MINAE-SINAC and ICE to reach a sustainable solution (see report of the respondent authority).
At Ordinary Session N.° 060-2025, held on 12 de febrero de 2025, the Concejo agreed to convene Interinstitutional Working Groups with the participation of SINAC-ACOPAC, IGN, Ministerio de Salud, AyA, ICE, and municipal departments, which met on 20 de febrero and 20 de marzo de 2025 (see report of the respondent authority).
At Ordinary Session N.° 069-2025, held on 19 de marzo de 2025 and ratified at S.O. N.° 071-2025, it was agreed to assign the Municipal Administration the obligation to report on all actions related to the delimitation of El Cocal (see report of the respondent authority).
At Ordinary Session N.° 075-2025, dated 01 de abril de 2025 and ratified at S.O. N.° 077-2025, the Concejo considered Official Letter DIG-GDF-111-2025 from the Instituto Geográfico Nacional, which certifies that the delimitation of the mangrove in El Cocal was conducted in coordination with SINAC and was published in La Gaceta (see report of the respondent authority).
At Extraordinary Session N.° 088-2025, held on 28 de mayo de 2025 and ratified at S.O. N.° 089-2025, the Concejo considered Opinion MQ-CMAJ-036- 2025 of the Comisión Permanente de Asuntos Jurídicos concerning written submissions filed in the constitutional proceeding, in which SINAC–IGN coordination was confirmed and the regulatory scope of the ZMT was analyzed (see report of the respondent authority).
At Ordinary Session N.° 092-2025, held on 17 de junio de 2025 and ratified at S.O. N.° 096-2025, it was agreed to reiterate the criteria issued by the Unidad de ZMT and order the compilation of all agreements related to the delimitation of El Cocal to ensure traceability (see report of the respondent authority).
Ordinary waste collection is not provided directly at the site because of the difficulty of access (see report of the respondent authority).
Collection vehicles cannot feasibly enter El Cocal because there is no adequate road infrastructure permitting the safe passage of compactor trucks (see report of the respondent authority).
That in the sector known as “Montecillos,” located at what is known as the landing area for travel to El Cocal, the Municipality constructed a community waste repository that is used by all residents of El Cocal (who transport the waste to the indicated site) (see report of the respondent authority).
That the waste is collected by the municipal service every day from Monday through Sunday (7 days a week), beginning at 7 in the morning, and is then transported to the Solid Waste Transfer Center located in Damas de Quepos, to be finally disposed of at the Sanitary Landfill located in Miramar de Montes de Oro in Puntarenas (see report of the respondent authority).
That an average of approximately 6 cleanup campaigns are conducted each year in the El Cocal area, and garbage collection bins have been provided and installed jointly with the Comité Local de Seguridad, for the purpose of contributing to improved waste management at the site (see report of the respondent authority).
REGARDING THE MINISTRY OF HEALTH That on 30 de enero del 2025, the Ministerio de Salud participated in a working group convened by the Municipalidad de Quepos, attended by personnel from ICE, AyA, ACOPAC, and ADEBACO (Asociación de Desarrollo del Barrio el Cocal), and it was agreed that a second working group would be convened on 20 de febrero del 2025 and a third on 20 de marzo del 2025—however, for reasons unknown to this Ministry, the latter two were not held—(see report of the respondent authority).
That on 22 de diciembre de 2025, the Ministerio de Salud conducted an inspection at the waste storage site used by the Municipalidad de Quepos for the residents of El Cocal and stated that “The solid-waste collection area is in a state of evident deterioration; the mesh that covered the walls has been torn away, the roof is broken, and it has no door; most of the metal structure is corroded by rust. In addition, leachate (lixiviados) can be seen flowing out of the collection center toward the estuary; this enclosure does not protect the waste against the entry of harmful fauna or inclement weather” (see report of the respondent authority).
REGARDING THE INSTITUTO GEOGRÁFICO NACIONAL That the relevant actions for the demarcation (delimitación) of the mangrove ecosystem (ecosistema de manglar) in the Quepos area are the responsibility of the Área de Conservación Pacífico Central of the Sistema Nacional de Áreas de Conservación and the Instituto Geográfico Nacional (see report of the respondent authority).
That if there is a demarcation involving areas belonging to the State Natural Heritage (Patrimonio Natural del Estado, PNE), the task of demarcating the relevant boundaries falls to the Ministerio de Ambiente y Energía (MINAE), in accordance with the Ley Forestal, Ley N°7575 de 13 de febrero de 1996 and its amendments (see report of the respondent authority).
That, as a result of the actions undertaken by the Área de Conservación Pacífico Central and IGN, the mangroves located in central Quepos were demarcated, including the sectors of El Cocal, Boca Vieja, and Damas—all supported by the following technical reports: 1) Report DIG-TOT-INF-001-2023 dated 09 de enero de 2023 and SINACACOPAC- IRT-PNE-098-2022 dated 20 de diciembre de 2022, issued by the Instituto Geográfico Nacional and the Área de Conservación Pacífico Central. 2) Report DIG-TOT-INF-104-2023 and SINAC-ACOPAC-OSRP-PNE-0058-2023 dated 19 de mayo de 2023, prepared by the Instituto Geográfico Nacional and the Área de Conservación Pacífico Central. 3) Report SINAC-ACOPAC-PNMA-RBS-TT-080 dated 21 de diciembre de 2023 of the Área de Conservación Pacífico Central, and DIG-GDF-0229-2024 Technical Review Report for the publication of the demarcation of the public zone (zona pública) of the Maritime-Terrestrial Zone (Zona Marítimo Terrestre) corresponding to the Estuary-Mangrove area in the sector between Rio Paquita and Rio Damas, dated 12 de junio de 2024—(see report of the respondent authority).
That the demarcations were officially published in the Official Gazette La Gaceta, as follows: 1) Notice N°003-2023 Maritime-Terrestrial Zone, Demarcation of a sector of the public zone corresponding to Estero - Manglar Boca Vieja, in El Cocal, district 01º Quepos, canton 06º Quepos, province 06º Puntarenas; published in the Official Gazette La Gaceta N°32 on martes 21 de febrero del 2023. 2) Notice N°009-2023 Maritime-Terrestrial Zone, Demarcation of a sector of the public zone corresponding to the Estero - Manglar in the Central Sector of Quepos, Sector 2 “Los Alfaro,” Sector 3 “Junta Naranjo,” Sector 4 “Cementerio,” district 01º Quepos, canton 06º Quepos, province 06º Puntarenas; published in the Official Gazette La Gaceta N°181 on martes 03 de octubre del 2023. 3) Notice N°007-2024 Maritime-Terrestrial Zone, Demarcation of a sector of the public zone corresponding to the Estero - Manglar between Río Paquita and Río Damas, district 01º Quepos, canton 06º Quepos, province 06º Puntarenas; published in the Official Gazette La Gaceta N°205 on viernes 01 de noviembre del 2024 (see report of the respondent authority).
This Chamber, by judgment number 2021002741 issued at nueve horas quince minutos on doce de febrero de dos mil veintiuno, ruled:
“III. Subject matter of the constitutional protection proceeding (recurso de amparo). The appellant considers that her fundamental rights have been violated because, on 21 de septiembre and 22 de septiembre de 2020, the pollution present in the El Cocal area was reported to the Municipalidad de Quepos and SINAC, respectively. In this regard, she complains of a failure to respond to the complaints filed concerning these facts. She states that the site lacks a community solid-waste disposal system (public garbage receptacles), causing local residents and visitors to deposit garbage on the ground along the island’s coastline, resulting in extensive pollution throughout the area and in the adjacent mangrove due to these illegal dumps. They indicate that the aforementioned area also lacks sewerage and proper wastewater treatment for the existing structures, such that most of the water ultimately flows into the sea, the estuary, and the mangrove, becoming an environmental problem that seriously damages biodiversity.

VI.Regarding the complaints filed by the appellant. In the case at bar (sub lite), the appellant alleges a failure to address the complaint that she filed on 21 de septiembre and 22 de septiembre de 2020 with the Municipalidad de Quepos and SINAC, respectively—identical complaints alleging a series of irregularities that have also been raised in this constitutional protection proceeding.
As regards the Municipalidad de Quepos, there is no evidence before this Court that any response was given to the complaint filed by the protected party (amparada). Thus, although the evidentiary record shows that the municipality was aware of the problem and had taken various steps concerning the matters reported, this does not cure its failure to provide a formal response to the submission made to it; accordingly, the complaint is deemed not to have been addressed.
However, it follows from the information provided under oath—as well as from the documentary evidence submitted in the proceeding—that, on 25 de septiembre de 2020, SINAC addressed the complaint through official letter SINAC-ACOPAC-OSRAP-519-2020. It is likewise established that the official letter was sent to the email address designated by the complainant for receipt of a response ([email protected]). Notwithstanding the foregoing, this Chamber observes that the response provided by the respondent authority was unsatisfactory because, disregarding its own jurisdiction over the matter as well as interinstitutional coordination (coordinación interinstitucional) on environmental issues, it replied that “for the purpose of redirecting her efforts toward the specified institutions, and not for the purpose of evading responsibility for the facts,” “Solid and Liquid Waste matters fall within the jurisdiction of the Ministerio de Salud and the Municipality of the Canton, as set forth in La Ley General de Salud No. 5395 and La Ley para la Gestión Integral de Residuos No. 8839.” In this regard, in response to the complaint filed, SINAC did not take proactive action to protect the environment, nor did it initiate coordination with the Ministerio de Salud or the Municipalidad de Quepos in accordance with the principle of interadministrative coordination (principio de coordinación interadministrativa), which constitutes one of the governing principles of administrative organization, requiring coordination among all public entities and bodies when exercising their powers and providing the services assigned to them by the legal system.
Elaborating on this point, coordination, insofar as it ensures administrative efficiency and effectiveness, is a virtual or implicit constitutional principle that permeates the entire body of administrative law and binds all public entities. In environmental matters, this principle takes on a distinct character, making relevant what this Court has repeatedly stated in its case law:
“VII.- Regarding interinstitutional coordination in environmental matters. Specifically with respect to environmental protection, judgment number 2008-004790 emphasized the duty of coordination among the institutions involved in the matter and the impossibility of disregarding warnings concerning the risk of pollution issued by an institution legally empowered to protect water resources:
III.Coordination among public agencies must ensure environmental protection. On various occasions, constitutional case law (jurisprudencia constitucional) has indicated that protecting the environment is a task incumbent on everyone equally; that is, the State—as a whole—is obligated to take the measures necessary to protect the environment in order to prevent levels of pollution, deforestation, extinction of flora and fauna, and excessive or improper use of natural resources that endanger the health of the governed. In this undertaking, the term public institution must be understood to include both the Central Administration—Ministries, such as the Ministerio del Ambiente y Energía and the Ministerio de Salud, which, by reason of the subject matter, have broad participation and responsibility regarding environmental conservation and preservation; these most often act through their specialized agencies in the field, such as the Dirección General de Vida Silvestre, the Dirección Forestal, and the Secretaría Técnica Nacional Ambiental (SETENA)—as well as decentralized institutions, such as the Instituto Nacional de Vivienda y Urbanismo, the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, the Instituto Costarricense de Turismo, and the Instituto Costarricense de Acueductos y Alcantarillados.
Municipalities, of course, bear significant responsibility for this undertaking within their territorial jurisdiction. One might therefore think that this multiple responsibility would cause chaos in administrative management, but this is not so. To prevent the simultaneous coexistence of spheres of authority of differing origin and nature, the duplication of national and local efforts, and confusion regarding the rights and obligations of the various parties involved, it is necessary to establish a series of coordination arrangements among the various agencies of the Executive Branch and decentralized institutions, and between them and the municipalities, so that they may perform the functions entrusted to them. This Chamber previously—and quite clearly—addressed the principle of coordination between public agencies and municipalities in pursuing common purposes—which must obviously be extended to the relationship between Central Administration institutions and decentralized institutions in performing this important function—and therefore refers to what it stated on that occasion (judgment number 5445-99, at fourteen hours thirty minutes on the fourteenth of July, nineteen ninety-nine):
“Accordingly, coordination is the ordering of the relationships among these various independent activities, accounting for their convergence upon the same object or entity so as to make that convergence useful to an overall public plan, without eliminating the mutual independence of the acting parties. Because no hierarchical relationship exists among decentralized institutions, or between the State itself and the municipalities, specific conduct cannot be imposed upon them. This gives rise to the indispensable interinstitutional ‘agreement,’ in the strict sense, whereby autonomous and independent centers of action agree upon that preventive and overall framework, within which each performs a role in view of a mission entrusted to the others. Thus, the relationships between municipalities and other public entities may be conducted only on a basis of equality, resulting in agreed forms of coordination and excluding any mandatory arrangement detrimental to their autonomy that would subject corporate entities to a coordination framework without or against their will.
It does, however, permit the necessary subordination of those entities to the State and in its interest (through the State’s ‘administrative oversight’ (tutela administrativa), and specifically through the function of reviewing legality entrusted to it, with powers of general supervision over the entire sector).” On the other hand, failures to fulfill the duty to protect the environment and comply with environmental regulations are constitutionally significant because the Administration’s inaction in this area may cause damage to the environment and natural resources, sometimes with consequences similar to or greater than those arising from the Administration’s actions. Examples include authorizing regulatory plans (planes reguladores) or construction without approval of the environmental impact study (estudio de impacto ambiental) by the Secretaría Técnica Nacional Ambiental; failing to monitor and supervise the implementation of management plans (planes de manejo) for protected areas by the Dirección General de Vida Silvestre del Ministerio del Ambiente y Energía; allowing companies to operate without health permits concerning the treatment of sewage or wastewater (Acueductos y Alcantarillados and Ministerio de Salud); or failing to verify sound-level controls in bars, karaoke establishments, and nightclubs (municipalities and Ministerio de Salud), among others (see in this regard judgment number 2006-005159 at thirteen hours four minutes on the seventh of April, two thousand six).” In other words, what matters is the technical cooperation that the various entities can provide one another, the technical input they can contribute, and respect for each entity’s powers, so as to ensure beyond doubt that the projects under evaluation will not have a negative impact and thereby guarantee the sustainable management of water resources and the full right to a healthy and ecologically balanced environment, as enshrined in the constitutional provision.
Thus, the precautionary principle (principio precautorio)—which seeks to prevent or suspend any activity that may adversely affect such management—requires the Administration, first, to notify the affected and interested parties and the institutions that may be involved. This is so they may submit the corresponding arguments and technical opinions and ensure the effective participation of the bodies with jurisdiction over the subject matter, for the purpose of protecting and preserving the environment and water resources. Second, it requires consideration of warnings issued by an institution legally empowered to protect water resources concerning the risk of contamination.” Thus, in the specific case, SINAC evaded its responsibilities, and it is particularly notable that this entity failed to undertake the proper and necessary coordination measures to ensure protection of the right to a healthy and ecologically balanced environment, that is, by immediately addressing situations such as those reported here. Under these circumstances, this portion of the claim must be granted.
VII.Concerning the alleged harm to the environment. After analyzing the evidence submitted and the reports provided under oath by the respondent authorities, this Court has concluded that, in the case under consideration (sub judice), a violation of the right to a healthy environment has been established for the reasons set forth below.
First, with respect to solid waste, this Chamber finds that the Municipalidad de Quepos does continuously collect the garbage generated by the community, despite the difficulty arising from the fact that El Cocal is an informal settlement whose only means of access is by boat across the estuary mouth. Along the same lines, the authorities reported that, at the landing for El Cocal—known as Montecillos—the respondent municipality constructed a community waste depository available to residents of the area. It was also reported that such waste “is collected by the municipal service every day from Monday through Sunday (7 days a week), beginning at 7 in the morning, and is then transported to the Centro de Transferencia de Residuos Sólidos located in Damas de Quepos, to be finally disposed of in the Relleno Sanitario located in Miramar de Montes de Oro in Puntarenas.” Accordingly, no omission or inadequate action is evident in the manner in which the respondent authority disposes of the solid waste collected in the community for the purpose of protecting the environment.
Regarding the petitioners’ allegation that the area is polluted and that illegal dumping sites arise in its vicinity—especially along the coast—this Court was informed that, on 16 de octubre de 2020, the Unidad de Desarrollo Ambiental de la Municipalidad de Quepos conducted an on-site inspection to visit areas near the beach, reporting the following: “a. The inspection was conducted from the community hall in El Cocal, coordinates 48123-1043421, to the sandy point of El Cocal located across from the city of Quepos, coordinates 481 703-1 042848 (Proyección CR TM05). b. The entire specified area was traversed in a Northwest-Southeast direction. c. During the inspection of the specified area, it was observed that the waste visible in the sandy beach sector consisted of organic debris such as coconuts, branches, logs, and assorted vegetation. d. Some scattered ordinary waste was observed, but it is considered that it may have reached the area through the action of ocean currents or waves and not necessarily through direct disposal by local residents.
This is common on all coasts worldwide. e. Along the beachfront of the aforementioned locality, there are a number of dwellings and various associated infrastructure.” The mayor of Quepos likewise stated that, in El Cocal, “an average of approximately 6 cleanup campaigns are conducted each year, and garbage collection bins have been supplied and installed together with the Comité Local de Seguridad in order to contribute to improved waste management in the area. Garbage containers and recycling stations have also been provided for public use to the public school located at the site in order to improve waste management there.” This, of course, does not mean that there are no possible irregularities in the management of such waste—indeed, those education and collection campaigns surely exist for that very reason—but such irregularities are among the numerous problems and anomalies arising from the existence of an informal settlement.
Accordingly, it follows that the Municipalidad de Quepos continually performs various tasks aimed at keeping solid-waste pollution in the area to the lowest possible level; therefore, this portion of the amparo proceeding (recurso de amparo) must be denied.
With respect to liquid waste—or wastewater—and in connection with the aforementioned complexity involved in managing or treating waste in an informal settlement, this Chamber finds it established that wastewater is plainly disposed of improperly in El Cocal, insofar as the authorities stated that the dwellings are constructed without obtaining the corresponding building permits and without meeting the minimum specifications required by the country’s legal framework governing buildings. Consequently, the area has no sewer system and lacks proper wastewater treatment, which constitutes a blatant affront to the environment, particularly considering the petitioners’ own allegation that such wastewater is even discharged directly into the estuary, the sea, and the area’s mangrove ecosystem. Accordingly, this portion of the amparo proceeding must be granted due to the violation of the right to a healthy and balanced environment protected by constitutional article 50.
VIII.On the failure of the competent authorities to delimit the territory. The environmental problems and the lack of effective action to mitigate pollution in the El Cocal area have been caused largely by the malfunctioning of the Public Administration, specifically: the failure to delimit the mangrove ecosystem, which must be carried out in coordination by SINAC—which is competent to define and delimit the ecosystem—and IGN—which must register it and publish it in La Gaceta—as well as the State’s permissiveness and tolerance regarding the establishment of an informal human settlement on public land with characteristics so sensitive to environmental protection and balance (the Maritime-Terrestrial Zone (Zona Marítimo Terrestre, ZMT) and mangrove); all of these omissions have led to many other instances of State inaction and lack of protection in this area.
In this specific case, the failure to delimit the territory belonging to the public domain has prevented the municipality and other authorities from knowing with certainty the cadastral status of the settlement (for example, determining which area lies within the ZMT or within the State Natural Heritage (Patrimonio Natural del Estado), etc.), thereby hindering the determination of the proper authorities with jurisdiction to act and intervene in the corresponding territory, whether to carry out evictions, grant concessions, prepare a land-use plan (plan regulador) for the site, designate public streets, provide public lighting, coordinate the provision of adequate water service, or construct sanitary sewerage, among other measures.
In this regard, the information submitted and the evidence provided show that, at least since 2018 and on repeated occasions, the Municipalidad de Quepos has requested that SINAC delimit the State Natural Heritage in the area. Thereafter, it is noted that in 2019, through report ACTO-DRFVS-PMF-075-2020, SINAC conducted preliminary work concerning the conditions at the site, as well as the identification of areas classified as State Natural Heritage. Likewise, on 16 de diciembre de 2020—after this amparo proceeding (recurso de amparo) had been filed—that entity began a series of inspections at the site to “verify certain very specific sites” and delimit the mangrove ecosystem in the area. Accordingly, following a request by this Court to SINAC for additional evidence to facilitate adjudication concerning the status of those inspections, on 06 de enero de 2021, through document SINAC-ACOPAC-PNE-001-2021, it was reported that “the fieldwork conducted on 16 de diciembre del 2020 is part of the technical process carried out by ACOPAC to issue a final report on the classification and preliminary delimitation of the mangrove ecosystem, in this case for the sector of the community of El Cocal de Quepos, which we expect to complete on the upcoming 12 de enero del presente.” The fact remains, however, that to date SINAC has not submitted to this Chamber any progress report in that regard or, more importantly, the final technical report for the delimitation of the mangrove and estuary areas of Quepos to IGN.
As this constitutional jurisdiction has long held, the declaration and delimitation of protected zones (zonas protectoras) constitute an extremely important mechanism for protecting the fundamental right to the environment (see, for example, judgment n.° 2019-16793 of 11:52 hours on 04 de septiembre de 2019). In this connection, the case at bar has demonstrated with absolute clarity why this Court has consistently upheld that criterion and, evidently, why in this case such passivity in delimiting the State Natural Heritage and, more generally, the limited action taken by the respondent authorities to mitigate the consequences of the informal settlement of El Cocal have not been sufficient to provide effective protection under Article 50 of our Political Constitution, a right of an intergenerational nature.

The amparo proceeding is partially granted. Accordingly:
From the reports submitted by the respondent authorities, which were given under oath with the legal consequences that this entails, it follows that the sector known as Playa El Cocal de Quepos is unequivocally subject to the Maritime-Terrestrial Zone (Zona Marítimo Terrestre) regime, a legal status repeatedly recognized by the Instituto Geográfico Nacional (IGN), the Procuraduría General de la República (PGR), and the Contraloría General de la República (CGR). It was established that the cartographic delimitation published in La Gaceta N° 32 del 21 de febrero de 2023 did not entail an expansion of the urban boundaries of Quepos, but rather strict compliance with a court order to specify the boundaries of the Boca Vieja mangrove ecosystem. It was demonstrated that the residents of Cocal de Quepos hold no property title or similar instrument making them the legal owners of the land they use, and that the local government declared road access to the community of El Cocal to be of cantonal interest.
It was found that, at Ordinary Session N.° 289-2023, held on 14 de noviembre de 2023, the Municipal Council considered the Opinion of the Special Commission on the Maritime-Terrestrial Zone, which analyzed the application of Ley N.° 6043 and the official delimitation of the mangrove in El Cocal, and that, at Ordinary Session N.° 024-2024, dated 21 de agosto de 2024, the Municipal Council considered the appellant’s submission and resolved to continue the proceedings concerning the Socioeconomic Planning Plan for Cocal. Subsequently, at Ordinary Session N.° 030-2024, held on 10 de septiembre de 2024 and ratified at S.O. N.° 031-2024, the Council considered Official Letter MQ-UZMT-327- 2024 concerning roads, electricity, and the delimitation of El Cocal. It was resolved to forward the recommendations to the Administration and coordinate with MINAE-SINAC and ICE to achieve a sustainable solution.
Thereafter, at Ordinary Session N.° 060-2025, held on 12 de febrero de 2025, the Council resolved to convene Interinstitutional Working Groups with the participation of SINAC-ACOPAC, IGN, Ministerio de Salud, AyA, ICE, and municipal departments; these meetings were held on 20 de febrero and 20 de marzo de 2025. On 19 de marzo de 2025, at Ordinary Session N.° 069-2025, held on 19 de marzo de 2025 and ratified at S.O. N.° 071-2025, it was resolved to assign the Municipal Administration the obligation to report on all actions related to the delimitation of El Cocal. On 01 de abril de 2025, at Ordinary Session N.° 075-2025, the Council considered Official Letter DIG-GDF-111-2025 from the Instituto Geográfico Nacional, certifying that the delimitation of the mangrove in El Cocal was conducted in coordination with SINAC and was published in La Gaceta. On 28 de mayo de 2025, at Extraordinary Session N.° 088-2025 and as ratified at S.O.
N.° 089-2025, the Council considered Opinion MQ-CMAJ-036- 2025 of the Standing Committee on Legal Affairs concerning submissions filed in the constitutional case file, which confirmed the coordination between SINAC and IGN and analyzed the regulatory scope of the ZMT. Finally, at Ordinary Session N.° 092-2025, held on 17 de junio de 2025 and ratified at S.O. N.° 096-2025, it was resolved to reiterate the opinions issued by the ZMT Unit and order the consolidation of all resolutions related to the delimitation of El Cocal in order to ensure traceability. It was established that ordinary waste is not collected directly on-site because of the difficulty of access; consequently, it is not feasible for collection vehicles to enter Cocal because there is no adequate road infrastructure permitting the safe passage of compactor trucks. It was stated that, in the sector known as “Montecillos,” located at what is known as the landing point for Cocal, the Municipality constructed a community waste collection facility that is used by all residents of Cocal, who transport their waste to that location.
It was indicated that the municipal service collects the waste every day from Monday through Sunday (7 dias a la semana), beginning at 7 in the morning, and transports it from there to the Centro de Transferencia de Residuos Sólidos located in Damas de Quepos, for final disposal at the Relleno Sanitario located in Miramar de Montes de Oro in Puntarenas; that an average of approximately 6 cleanup campaigns are conducted annually in the Cocal area; and that waste collection bins have been supplied and installed jointly with the Comité Local de Seguridad in order to contribute to improved waste management at the location. With respect to the Ministerio de Salud, it was established that on 30 de enero del 2025 the Ministerio de Salud participated in a working-group meeting convened by the Municipalidad de Quepos, attended by personnel from ICE, AyA, ACOPAC, and ADEBACO (Asociación de Desarrollo del Barrio el Cocal), and that the participants agreed to convene a second working-group meeting on 20 de febrero del 2025 and a third on 20 de marzo del 2025—although, for reasons unknown to the Ministry, the latter two were not held.
It was established that on 22 de diciembre de 2025 the Ministerio de Salud, in compliance with an evidentiary measure ordered by the reporting justice, conducted an inspection at the waste-storage site used by the Municipalidad de Quepos for the residents of El Cocal and stated: “The solid-waste collection area is in a visibly deteriorated condition; the mesh that covered the walls has been torn away, the roof is broken, and there is no door; most of the metal structure is corroded by rust. In addition, leachate can be seen flowing out of the collection facility toward the estuary; this enclosure does not protect the waste from harmful fauna or inclement weather.” With respect to the Instituto Geográfico Nacional, it was established that responsibility for the relevant actions to delimit the mangrove ecosystem in the Quepos area rests with the Área de Conservación Pacífico Central of the Sistema Nacional de Áreas de Conservación and the Instituto Geográfico Nacional.
It was found that, where a delimitation involves areas belonging to the State Natural Heritage (Patrimonio Natural del Estado, PNE), responsibility for delimiting the relevant boundaries rests with the Ministerio de Ambiente y Energía (MINAE), in accordance with the Ley Forestal, Ley N°7575 de 13 de febrero de 1996 and its amendments. It was established that, as a result of the actions undertaken by the Área de Conservación Pacífico Central and IGN, the mangroves located in central Quepos were delimited, including the sectors of El Cocal, Boca Vieja, and Damas—all supported by the following technical reports:
That the sector known as Playa El Cocal de Quepos is unequivocally subject to the Maritime-Terrestrial Zone regime.
That the cartographic delimitation published in La Gaceta N° 32 del 21 de febrero de 2023 did not entail an expansion of the urban boundaries of Quepos, but rather strict compliance with a court order to specify the boundaries of the Boca Vieja mangrove ecosystem.
That, in order to include the land in El Cocal in the zoning plan (plan regulador), a coastal zoning plan (plan regulador costero) must be prepared, supported by rigorous environmental studies, Environmental Fragility Indices (Índices de Fragilidad Ambiental, IFAS), impact assessments, and natural-heritage certifications.
That ordinary waste is not collected directly on-site because of the difficulty of access; however, in the sector known as “Montecillos,” located at what is known as the landing point for Cocal, the Municipality constructed a community waste collection facility that is used by all residents of Cocal, who transport their waste to that location.
That the municipal service collects the waste every day from Monday through Sunday (7 días a la semana), beginning at 7 in the morning, and transports it from there to the Centro de Transferencia de Residuos Sólidos located in Damas de Quepos, for final disposal at the Relleno Sanitario located in Miramar de Montes de Oro in Puntarenas.
That on 22 de diciembre de 2025 the Ministerio de Salud conducted an inspection at the waste-storage site used by the Municipalidad de Quepos for the residents of El Cocal and stated: “The solid-waste collection area is in a visibly deteriorated condition; the mesh that covered the walls has been torn away, the roof is broken, and there is no door; most of the metal structure is corroded by rust. In addition, leachate can be seen flowing out of the collection facility toward the estuary; this enclosure does not protect the waste from harmful fauna or inclement weather.” The petitioner (recurrente) claims that, to date, the orders issued in judgment number 2021002741 de las nueve horas quince minutos del doce de febrero de dos mil veintiuno have not been complied with, and adds that the El Cocal community needs “to be legally incorporated into an existing coastal urban zoning plan (plan regulador urbano)” and thereby improve the residents’ quality of life, as well as the sanitary sewerage system.
The petitioner adds that the new georeferences for the El COLCA maritime zone were published in La Gaceta even though the Municipalidad did not participate. The petitioner therefore requests that the incorporation of the El Cocal neighborhood into the urban zoning plan be ordered, along with the performance of basic sanitation works, optimal access, and garbage collection; that the maritime-terrestrial zone (zona marítimo terrestre) be demarcated in accordance with Ley 6043; and that public participation in the planning and implementation process be guaranteed. The municipal authorities acknowledge that “there is a need for a coastal zoning plan (plan regulador costero) in the Playa El Cocal sector, both to regularize the situation of the families residing in that territory and to ensure environmental protection of the coastal strip”; however, “as long as the inconsistencies arising from the estuary-mangrove demarcation (delimitación estero-manglar) of Boca Vieja published in 2023 persist, there is an impediment to initiating the planning process,” and that “in the sector known as ‘Montecillos,’ located at what is referred to as the landing point toward El Cocal, the Municipalidad constructed a community waste container that is used by all the residents of El Cocal (who transport their waste to the indicated site”—waste that, it asserts, is collected every day from Monday through Sunday.
For its part, the Ministerio de Salud states that on 30 de enero del 2025, the Ministerio de Salud participated in a working group convened by the Municipalidad de Quepos, which was attended by personnel from ICE, AyA, ACOPAC, and ADEBACO (Asociación de Desarrollo del Barrio el Cocal), and it was agreed that a second working group would be convened on 20 de febrero del 2025 and a third on 20 de marzo del 2025—however, for reasons unknown to the Ministerio, the latter two were not held. It stated that “The solid-waste collection area is in visibly deteriorated condition: the mesh covering the walls has been torn away, the roof is broken, there is no door, and most of the metal structure has been corroded by rust. In addition, leachate (lixiviados) can be seen flowing out of the collection center toward the estuary; this facility does not protect the waste from harmful fauna or inclement weather.” Finally, the authorities of the Instituto Geográfico Nacional indicated that, as a result of the actions undertaken by the Área de Conservación Pacífico Central and the IGN, the mangroves located in central Quepos were demarcated, including the sectors of El Cocal, Boca Vieja, and Damas.
Accordingly, the petition is well-founded solely with respect to the handling of solid waste by the respondent local government. Although it is true that, in the judgment cited by the petitioner, this Sala denied the petition with respect to that issue, it is also true that, at that time, it was not possible to demonstrate the existence of an omission or inadequate action regarding the disposal of the solid waste collected in the community. In the present case, however, the municipal authorities stated that a protocol has been implemented for collecting solid waste in the El Cocal community and that the Municipalidad continues to apply it with the same effectiveness as always; nevertheless, the inspection conducted by the authorities of the Ministerio de Salud on 22 de diciembre del 2025—an inspection requested as additional evidence for adjudication (prueba para mejor resolver) by means of the order issued at las quince horas veinticinco minutos del dieciséis de diciembre de dos mil veinticinco—demonstrated that “the site is a temporary solid-waste storage facility used by the Municipalidad de Quepos so that the residents of El Cocal may transport and deposit their waste there for subsequent collection by the garbage truck.
The solid-waste collection area is in visibly deteriorated condition: the mesh covering the walls has been torn away, the roof is broken, there is no door, and most of the metal structure has been corroded by rust. In addition, leachate can be seen flowing out of the collection center toward the estuary; this facility does not protect the waste from harmful fauna or inclement weather.” Based on the foregoing, it is evident that the current condition of the temporary solid-waste storage area used by the residents of El Cocal does not meet minimum sanitary requirements. On repeated occasions, this Tribunal Constitucional has addressed the constitutional principles governing the provision of public services and the fundamental right to their efficient provision, which requires that, regardless of the type of service, they be provided in accordance with high quality standards, necessarily corresponding to the obligation of public administrations to provide them continuously, regularly, promptly, effectively, and efficiently.
It must also be emphasized that the country’s Municipalidades must safeguard the interests of the inhabitants within their jurisdiction. Accordingly, in repeated rulings, this Tribunal has held that those entities are obligated to eliminate any type of threat that endangers the rights to health and to a healthy and ecologically balanced environment of the people living in their canton, including threats relating to solid-waste collection services (see, to similar effect, Judgments N° 2023-19610 de las 9:30 horas de 11 de agosto de 2023 and N° 2019-005623 de las 09:45 horas del 29 de marzo de 2019). Accordingly, the proper course is to grant the petition with respect to this issue, with the consequences set forth in the operative part (parte dispositiva) of this judgment.
V.Now, with respect to the failure to comply with the orders issued in judgment number 2021002741 de las nueve horas quince minutos del doce de febrero de dos mil veintiuno, the petition for relief (escrito de interposición) must be severed so that the alleged noncompliance with the cited judgment may be examined, and it must be forwarded to expediente número 20-021786-0007-CO.
I consider that, in environmental matters, if the Administración Pública has already intervened, jurisdiction to hear and decide the matter lies with the contentious-administrative jurisdiction (jurisdicción contenciosa administrativa). Nevertheless, I do address the merits of the matter when other rights of the persons affected by the source of contamination are at stake, including health, quality of life, and the right to enjoy a healthy and pollution-free environment (artículo 50, de la Constitución Política), as occurs in this case, in which the petitioner alleges an omission by the Municipalidad de Quepos in properly collecting and disposing of solid waste, thereby impairing the petitioners’ right to enjoy a healthy, ecologically balanced environment and a dignified standard of living, an issue that has not been definitively resolved.
The petitioner is hereby advised that, if any paper document was submitted, as well as any objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced through new technologies, such materials must be collected from the court office within a maximum period of 30 días hábiles counted from notification of this judgment. Otherwise, any material not collected within that period will be destroyed, pursuant to the «Reglamento sobre Expediente Electrónico ante el Poder Judicial», approved by the Corte Plena at session No. 27-11 del 22 de agosto del 2011, artículo XXVI, and published in Boletín Judicial No. 19 del 26 de enero del 2012, as well as pursuant to the agreement approved by the Consejo Superior del Poder Judicial at session No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
The petition is granted solely against the Municipalidad de Carrillo. Patricia Bolaños Murillo, in her capacity as Mayor, and Gilbert Cruz Jiménez, in his capacity as president of the Concejo, both of the Municipal de Quepos, or whoever may hold the corresponding offices in their stead, are ordered IMMEDIATELY to implement the most urgently needed mitigation measures (medidas paliativas) to correct the environmental problem complained of. They must arrange and coordinate whatever is necessary so that, within DOS MESES, counted from notification of this judgment, the problem created at the temporary solid-waste storage site used by the Municipalidad de Quepos in the community of the residents of El Cocal is definitively corrected. The respondents are warned that, pursuant to artículo 71 de la Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo proceeding (recurso de amparo), which that person is required to comply with or enforce, and who fails to comply with or enforce it, shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty.
The Municipalidad de Quepos is ordered to pay the legal costs, damages, and losses caused by the acts underlying this ruling, which shall be assessed during enforcement of judgment before the contentious-administrative jurisdiction. With respect to the failure to comply with the orders issued in judgment number 2021002741 de las nueve horas quince minutos del doce de febrero de dos mil veintiuno, the petition for relief must be severed so that the alleged noncompliance with the cited judgment may be examined, and it must be forwarded to expediente número 20-021786-0007-CO. Justice Salazar Alvarado files a note. Notice shall be given.

Recurso de amparo presentado por THOMAS KERRY BAILEY BAILEY, cédula de identidad [Valor 007], a favor de [Nombre 001], [Nombre 002], cédula de identidad [Valor 001], [Nombre 003], cédula de identidad [Valor 002], [Nombre 004], cédula de identidad [Valor 003], [Nombre 005], cédula de identidad [Valor 004], [Nombre 006], cédula de identidad [Valor 005] y [Nombre 007], cédula de identidad [Valor 006], contra EL INSTITUTO GEOGRÁFICO NACIONAL, EL MINISTRO DE SALUD, LA MUNICIPALIDAD DE QUEPOS Y EL SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (SINAC).
Resultando:
del manglar en el sector del Cocal, Quepos. CUARTO Que el día 21 de mayo del 2021 se notifica por medio de correo electrónico a la Sala Constitucional, el oficio SINAC-ACOPAC-OSRAP-324-2021, sobre el cumplimiento parcial del POR TANTO TERCERO. QUINTO Que mediante el informe técnico oficios DIGTOT-INF-001-2023 de fecha 09 de enero de 2023 y SINACACOPAC-RT-PNE-098-2022 de fecha 20 de diciembre de 2022, generados por el Subproceso de Límites Oficiales del Departamento Topográfico y Observación del Territorio del Instituto Geográfico Nacional (IGN) y la Oficina Programas Información y Regularización del Territorio, Programa Patrimonio Natural del Estado de Área de Conservación Pacífico Central (ACOPAC), respectivamente, se realiza la delimitación digital del ecosistema de estero/manglar Boca Vieja. SEXTO Que se publica en el diario oficial La Gaceta Nº 32 del martes 21 de febrero del 2023, el AVISO N° 003-2023 “ZONA MARÍTIMO TERRESTRE DELIMITACIÓN DE UN SECTOR DE ZONA PÚBLICA CORRESPONDIENTE AL ESTERO- MANGLAR BOCA VIEJA, DISTRITO 01° QUEPOS, CANTÓN 06° QUEPOS, PROVINCIA 06° PUNTARENAS”, donde se establece.
Artículo 5º—Que la zona pública de la Zona Marítimo Terrestre concerniente al sector del ecosistema de manglar verificado y delimitado por el Área de Conservación Pacífico Central corresponde a las siguientes coordenadas en el sistema de proyección cartográfica oficial de Costa Rica CRTM05:
Artículo 6º—Los datos técnicos oficiales de la delimitación digital georreferenciada de la zona pública de la Zona Marítimo Terrestre del ecosistema de estero/manglar Boca Vieja ubicado en Quepos, distrito 01° Quepos, cantón 06° Quepos, provincia 06° Puntarenas, han quedado registrados en la Geodatabase Digital Georreferenciada de la Zona Marítimo Terrestre (ZMT) del IGN en archivo con formato vectorial shape, bajo la codificación: RN/IGN_GDG-IGN-ZMT_líneas digitales. Por tanto, CUARTO: Asimismo, se ordena a Jong Kwan Kim Jim, en su condijo de Alcalde, a Kenneth Mauricio Perez Vargas, en su condición de Presiente del Consejo, ambos de la Municipalidad de Quepos, a la Jefa de la Oficina Subregional Aguirre Parrita del Área de Conservación Pacífico Central del Sistema Nacional de Áreas de Conservación, y a Daniel Salas Peraza, en su condición de Ministro de Salud o a quienes en su lugar ejerzan esos cargos, que de manera conjunta y coordinada, incluso con otras instituciones competente, adopten de forma INMEDIATA las medidas necesarias para mitigar y prevenir la contaminación generada por las aguas residuales del asentamiento el Cocal.
Con respecto de este punto, Por tanto, CUARTO: el SINAC en la Subregión Aguirre – Parrita del Área de Conservación Pacífico Central no cuenta con potestades directa para atenderlo, por potestad correspondería a la Municipalidad de Quepos, no obstante, estamos en la anuencia de acuerdo con nuestras posibilidades y atinencias a colaborar en el proceso. Por tanto, QUINTO: Igualmente, se ordena a las autoridades recurridas que, en el plazo máximo de SEIS MESES a partir de la notificación de esta sentencia, definan la naturaleza jurídica y el régimen normativo aplicable al territorio donde se encuentra el asentamiento. Con respecto de este punto, Por tanto, QUINTO: el SINAC en la Subregión Aguirre – Parrita del Área de Conservación Pacífico Central no cuenta con potestades directa para atenderlo, por potestad correspondería a la Municipalidad de Quepos, no obstante, estamos en la anuencia de acuerdo con nuestras posibilidades y atinencias a colaborar en el proceso.
Por tanto, SEXTO: Que una vez definida la situación legal y el régimen aplicable del territorio en cuestión, en el plazo máximo de VEINTICUATRO MESES contados a partir de la notificación de esta sentencia, deberán las autoridades recurridas, según sus respectivas competencias, brindar una solución definitiva al problema de contaminación por aguas residuales que se genera en la zona del asentamiento El Cocal, misma que afecta al medioambiente. Con respecto de este punto, Por tanto, SEXTO: el SINAC en la Subregión Aguirre – Parrita del Área de Conservación Pacífico Central no cuenta con potestades directa para atenderlo, por potestad correspondería a la Municipalidad de Quepos y Ministerio de Salud, no obstante, estamos en la anuencia de acuerdo con nuestras posibilidades y atinencias a colaborar en el proceso. PETITORIA Se declare sin lugar el recurso de amparo interpuesto por el señor THOMAS KERRY BAILEY BAILEY, tramitado en el expediente 25-025088-0007-CO, por cuanto el Sistema Nacional de Áreas de Conservación ha realizado, en el marco de sus competencias, las actuaciones tendientes a cumplir con lo establecido en la SENTENCIA N° 2021-2741 dictada a las 9:15 horas del 12 de febrero del 2021”.
Redacta el Magistrado Cruz Castro; y,
Considerando:
El recurrente alega que los amparados son vecinos del barrio El Cocal, ubicado Quepos, Puntarenas. Afirman que por sentencia Nro. 2021-2741 dictada a las 9:15 horas del 12 de febrero de 2021 en el expediente Nro. 20- 021786-0007-CO, esta Sala acogió parcialmente dicho recurso de amparo planteado por miembros de su comunidad y ordenó a las autoridades recurridas adoptar medidas concretas para garantizar sus derechos; sin embargo reclaman que a la fecha de la interposición del recurso no han cumplido con lo ordenado. Afirman que la comunidad anhela ser tomada en cuenta en el plan regulador vigente de Quepos, pero ha sido discriminada por las gestiones de los gobiernos locales, que no la han incluido en dicho plan. Actualmente, se aprovechan de la baja escolaridad de la población para convencer a algunos con leyes y criterios técnicos que la comunidad no comprende. Sostienen que la exclusión de la comunidad en las actualizaciones del plan regulador urbano responde a intereses tácitos de sectores interesados en las playas de esta parte del Cocal, y que la comunidad no desea formar parte de un plan regulador con canon turístico, por no poder solventarlo como pobladores humildes.
Refieren que la integración legal de la comunidad en un plan regulador urbano existente en el litoral permitiría alcanzar un bienestar óptimo como ciudadanos reconocidos en sus derechos fundamentales, tales como una vida digna, el derecho a la salud, el derecho a ser tomados en cuenta en la participación ciudadana y el acceso a proyectos de desarrollo comunitario. Reportan que la documentación aportada ante la Municipalidad de Quepos no ha generado una acción activa y decidida para cumplir con el fallo constitucional y mejorar la calidad de vida de las personas. Obras como el alcantarillado sanitario no pueden concretarse debido a la ilegalidad existente, la cual coexiste con la inoperancia de las gestiones de gobierno en Quepos. Además, aclaran que se han visto sorprendidos por la publicación en La Gaceta de las nuevas georreferencias del IGN, en cumplimiento de la delimitación ordenada por el fallo.
Sin embargo, a la fecha, no se ha resuelto nada. Este hecho fue constatado en el departamento de ATM de la Municipalidad de Quepos, cuyos funcionarios no fueron tomados en cuenta para dichas delimitaciones, pese a que el fallo ordena una actuación interinstitucional. Reiteran que la relación de hechos y documentos aportados para solventar un plan de manejo territorial, así como las respuestas recibidas, no han determinado más que argumentación técnica y dilatoria, sin lograr ningún avance en la resolución del conflicto humano ambiental, social-económico y territorial-legal. Consideran que lo expuesto viola sus derechos fundamentales. Solicitan que se declare con lugar el recurso y, de acogerse el recurso la Casa Presidencial asuma su labor en el rol de la Comisión de Gobierno, conforme a la Ley Nro. 9024, ejerciendo el artículo 3, que autoriza al Poder Ejecutivo, por medio del Ministerio de Gobernación y Policía, a realizar las declaratorias de zonas urbanas litorales mediante decreto ejecutivo.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos, según lo prevenido en el auto inicial:
EN CUANTO A LA MUNICIPALIDAD DE QUEPOS Que el sector denominado Playa El Cocal de Quepos se encuentra inequívocamente dentro del régimen de la Zona Marítimo Terrestre, condición jurídica reconocida de manera reiterada por el Instituto Geográfico Nacional (IGN), la Procuraduría General de la República (PGR), la Contraloría General de la República (CGR) (ver informe de la autoridad recurrida).
Que la delimitación cartográfica publicada en La Gaceta N° 32 del 21 de febrero de 2023 no implicó una ampliación de los limites urbanos de Quepos, sino el estricto cumplimiento de una orden judicial de precisar los linderos del ecosistema de manglar Boca Vieja (ver informe de la autoridad recurrida).
Que los moradores del Cocal de Quepos, no poseen ningún título de propiedad o similar que los haga dueños legales de los terrenos a los cuales dan uso (ver informe de la autoridad recurrida).
Que el gobierno local declaró de interés cantonal el acceso vial hacia la comunidad de El Cocal (ver informe de la autoridad recurrida).
Que en la Sesión Ordinaria N.° 289-2023, celebrada el 14 de noviembre de 2023, el Concejo Municipal conoció el Dictamen de la Comisión Especial de Zona Marítimo Terrestre, en el cual se analizó la aplicación de la Ley N.° 6043 y la delimitación oficial del manglar en El Cocal (ver informe de la autoridad recurrida).
Que en Sesión Ordinaria N.° 024-2024, de fecha 21 de agosto de 2024, el Concejo Municipal conoció el escrito del recurrente y acordó dar continuidad a las gestiones sobre el Plan de Ordenamiento Socioeconómico del Cocal (ver informe de la autoridad recurrida).
Que en la Sesión Ordinaria N.° 030-2024, celebrada el 10 de septiembre de 2024, y ratificada en la S.O. N.° 031-2024, el Concejo conoció el Oficio MQ-UZMT-327- 2024, relativo a la vialidad, electricidad y delimitación de El Cocal. Se acordó trasladar las recomendaciones a la Administración y coordinar con MINAE-SINAC e ICE para una solución sostenible (ver informe de la autoridad recurrida).
Que en la Sesión Ordinaria N.° 060-2025, celebrada el 12 de febrero de 2025, el Concejo acordó convocar a Mesas de Trabajo Interinstitucionales con la participación de SINAC-ACOPAC, IGN, Ministerio de Salud, AyA, ICE y dependencias municipales, las cuales se efectuaron el 20 de febrero y 20 de marzo de 2025 (ver informe de la autoridad recurrida).
Que en Sesión Ordinaria N.° 069-2025, celebrada el 19 de marzo de 2025, y ratificada en la S.O. N.° 071-2025, se acordó trasladar a la Administración Municipal la obligación de informar sobre todas las actuaciones relacionadas con la delimitación de El Cocal (ver informe de la autoridad recurrida).
Que en la Sesión Ordinaria N.° 075-2025, de fecha 01 de abril de 2025, y ratificada en la S.O. N.° 077-2025, el Concejo conoció el Oficio DIG-GDF-111-2025 del Instituto Geográfico Nacional, en el cual se certifica que la delimitación del manglar en El Cocal se realizó en coordinación con el SINAC y fue publicada en La Gaceta (ver informe de la autoridad recurrida).
Que en la Sesión Extraordinaria N.° 088-2025, celebrada el 28 de mayo de 2025, y ratificada en la S.O. N.° 089-2025, el Concejo conoció el Dictamen MQ-CMAJ-036- 2025 de la Comisión Permanente de Asuntos Jurídicos, relativo a escritos presentados en el expediente constitucional, en el cual se confirmó la coordinación SINAC–IGN y se analizaron los alcances normativos de la ZMT (ver informe de la autoridad recurrida).
Que en la Sesión Ordinaria N.° 092-2025, celebrada el 17 de junio de 2025, y ratificada en la S.O. N.° 096-2025, se acordó reiterar los criterios emitidos por la Unidad de ZMT y ordenar la integración de todos los acuerdos relacionados con la delimitación de El Cocal para garantizar trazabilidad (ver informe de la autoridad recurrida).
Que la recolección de residuos ordinarios no se brinda directamente en el sitio por la dificultad de acceso (ver informe de la autoridad recurrida).
Que el ingreso de unidades recolectoras al Cocal no es viable ya que no existe infraestructura vial adecuada que permita el tránsito seguro de camiones compactadores (ver informe de la autoridad recurrida).
Que en el sector conocido como "Montecillos", ubicado en lo que se denomina como el embarcadero hacia el Cocal la Municipalidad construyó un depósito comunitario de residuos que es utilizado por todos los vecinos del Cocal (los cuales trasladan los residuos hasta el sitio indicado) (ver informe de la autoridad recurrida).
Que los residuos son recolectados, por el servicio municipal todos los días de lunes a domingo (7 dias a la semana) a partir de las 7 de la mañana y de ahí trasladados hasta el Centro de Transferencia de Residuos Sólidos ubicado en Damas de Quepos, para finalmente ser dispuestos en el Relleno Sanitario ubicado en Miramar de Montes de Oro en Puntarenas (ver informe de la autoridad recurrida).
Que en la zona del Cocal se realizan en promedio unas 6 campañas de Iimpieza al año y se han entregado y colocado depósitos recolectores de basura en conjunto con el Comité Local de Seguridad, con el fin de contribuir a un mejor manejo de los residuos en el lugar (ver informe de la autoridad recurrida).
EN CUANTO AL MINISTERIO DE SALUD Que el 30 de enero del 2025 el Ministerio de Salud participó en una mesa de trabajo convocada por la municipalidad de Quepos a la cual asistió personal del ICE, AyA, ACOPAC y ADEBACO (Asociación de Desarrollo del Barrio el Cocal) y se generó como acuerdo convocar a una segunda mesa de trabajo el día 20 de febrero del 2025 y una tercera para el 20 de marzo del 2025 -sin embargo, por razones desconocidas para este Ministerio las dos últimas no se efectuaron- (ver informe de la autoridad recurrida).
Que el 22 de diciembre de 2025 el Ministerio de Salud realizó una inspección en el lugar de almacenamiento de residuos que utiliza la Municipalidad de Quepos para los vecinos de El Cocal e indicaron que “El espacio de acopio para residuos sólidos se encuentra en condiciones de evidente deterioro, la maya que cubría las paredes ha sido arrancada y el techo se encuentra roto y no cuenta con puerta, la mayor parte de la estructura metálica esta corroída por el óxido. Además, se observa la salida de lixiviados del centro de acopio que discurren hacia el estero, este recinto no protege los residuos contra el ingreso de fauna nociva ni las inclemencias del tiempo” (ver informe de la autoridad recurrida).
EN CUANTO AL INSTITUTO GEOGRÁFICO NACIONAL Que las acciones pertinentes para la delimitación del ecosistema de manglar de la zona de Quepos es responsabilidad del Área de Conservación Pacífico Central del Sistema Nacional de Áreas de Conservación y del Instituto Geográfico Nacional (ver informe de la autoridad recurrida).
Que en caso de existir una delimitación que involucre áreas pertenecientes al Patrimonio Natural del Estado (PNE), la tarea de delimitar los linderos pertinentes le corresponde al Ministerio de Ambiente y Energía (MINAE), de conformidad con la Ley Forestal, Ley N°7575 de 13 de febrero de 1996 y sus reformas (ver informe de la autoridad recurrida).
Que como resultado de las acciones realizadas por el Área de Conservación Pacífico Central y el IGN, se realizó la delimitación de los manglares ubicados en Quepos centro, que incluyó los sectores de El Cocal, Boca Vieja y Damas -todo en respaldo de los siguientes informes técnicos: 1) Informe DIG-TOT-INF-001-2023 de fecha 09 de enero de 2023 y SINACACOPAC- IRT-PNE-098-2022 de fecha 20 de diciembre de 2022 emitido por el Instituto Geográfico Nacional y el Área de Conservación Pacífico Central. 2) Informe DIG-TOT-INF-104-2023 y SINAC-ACOPAC-OSRP-PNE-0058-2023 de fecha 19 de mayo de 2023 elaborado por Instituto Geográfico Nacional y el Área de Conservación Pacífico Central. 3) Informe SINAC-ACOPAC-PNMA-RBS-TT-080 de fecha 21 de diciembre de 2023 del Área de Conservación Pacífico Central y DIG-GDF-0229-2024 Informe de Revisión Técnica para la publicación de delimitación de la zona pública de la Zona Marítimo Terrestre correspondiente al Estero-Manglar del sector entre Rio Paquita y Rio Damas del 12 de junio de 2024- (ver informe de la autoridad recurrida).
Que las delimitaciones fueron oficializadas en el Diario Oficial La Gaceta, como sigue: 1) Aviso N°003-2023 Zona Marítima Terrestre Delimitación de un sector de zona pública correspondiente al Estero - Manglar Boca Vieja, en El Cocal, distrito 01º Quepos, cantón 06º Quepos, provincia 06º Puntarenas; publicado en el Diario Oficial La Gaceta N°32 del martes 21 de febrero del 2023. 2) Aviso N°009-2023 Zona Marítima Terrestre Delimitación de un sector de zona pública correspondiente al Estero - Manglar en el Sector Central de Quepos, Sector 2 “Los Alfaro”, Sector 3 “Junta Naranjo”, Sector 4 “Cementerio”, distrito 01º Quepos, cantón 06º Quepos, provincia 06º Puntarenas; publicado en el Diario Oficial La Gaceta N°181 del martes 03 de octubre del 2023. 3) Aviso N°007-2024 Zona Marítima Terrestre Delimitación de un sector de zona pública correspondiente al Estero - Manglar entre Río Paquita y Río Damas, distrito 01º Quepos, cantón 06º Quepos, provincia 06º Puntarenas; publicado en el Diario Oficial La Gaceta N°205 del viernes 01 de noviembre del 2024 (ver informe de la autoridad recurrida).
Esta Sala mediante sentencia número 2021002741 de las nueve horas quince minutos del doce de febrero de dos mil veintiuno resolvió:
“III. Objeto del recurso. La parte recurrente considera que sus derechos fundamentales han sido lesionados en el tanto el 21 de septiembre y el 22 de septiembre de 2020 se denunció –respectivamente ante la Municipalidad de Quepos y el SINAC- la contaminación existente en la zona de El Cocal. Al respecto, reclama una falta de respuesta a las denuncias planteada sobre estos hechos. Expresa que en dicho sitio no se cuenta con un sistema comunal de depósito de residuos sólidos (basureros públicos), lo que genera que los lugareños y visitantes depositen la basura en el suelo de la costa de la isla, causando gran contaminación en todo el lugar y también en el manglar adyacente por dichos basureros clandestinos. Señalan que en la zona mencionada tampoco hay alcantarillado ni un correcto tratamiento de aguas residuales para las construcciones existentes, por lo que las aguas en su mayoría terminan en el mar, en el estero y en el manglar, convirtiéndose en una problemática medioambiental con graves daños a la biodiversidad.
(…)
VI.Sobre las denuncias planteadas por la parte recurrente. En el sub lite, la parte recurrente acusa una falta de atención a la denuncia que planteó el 21 de septiembre y el 22 de septiembre de 2020, respectivamente ante la Municipalidad de Quepos y el SINAC, denuncias idénticas que alegaban una serie de irregularidades que también han sido ventiladas en este recurso de amparo.
Sobre la Municipalidad de Quepos, no consta ante este Tribunal que se le haya dado ninguna respuesta a la denuncia planteada por la amparada. Así, aunque se evidencia del elenco probatorio que dicha municipalidad tenía conocimiento de la problemática y había realizado varias gestiones referentes a lo denunciado, esto no reivindica la omisión de dar una respuesta formal a lo planteado ante ella, por lo que se entiende como no atendida la denuncia.
Ahora bien, se desprende de lo informado bajo juramento -tanto como de la prueba documental aportada al proceso- que, el 25 de septiembre de 2020, la denuncia fue atendida por el SINAC mediante el oficio SINAC-ACOPAC-OSRAP-519-2020. Asimismo, se tiene por probado que dicho oficio fue enviado a la dirección de correo electrónico señalada por la denunciante para recibir respuesta ([email protected]). No obstante lo anterior, esta Sala advierte que la respuesta brindada por la autoridad recurrida no fue satisfactoria, ya que, ignorando su propia competencia para la materia, así como la coordinación interinstitucional en temas ambientales, respondieron que “con el objetivo de redireccionar sus esfuerzos hacia las instituciones indicadas, y no con el objetivo de evadir responsabilidad sobre los hechos” la “materia de Residuos Sólidos y Líquidos son competencia del Ministerio de Salud y la Municipalidad del Cantón, como lo expone La Ley General de Salud No. 5395 y La Ley para la Gestión Integral de Residuos No. 8839”.
Al respecto, ante la denuncia interpuesta, el SINAC no asumió un actuar proactivo y proteccionista del medioambiente, así como tampoco tendió las instancias de coordinación ante el Ministerio de Salud o la Municipalidad de Quepos de conformidad con el principio de coordinación interadministrativa, que constituye uno de los principios rectores de la organización administrativa, siendo que debe mediar coordinación entre todos los entes y órganos públicos al ejercer sus competencias y prestar los servicios que el ordenamiento jurídico les ha asignado.
Ahondando en este punto, la coordinación, en cuanto asegura la eficiencia y eficacia administrativas, es un principio constitucional virtual o implícito que permea el entero ordenamiento jurídico administrativo y obliga a todos los entes públicos. En materia ambiental, este principio toma un matiz diferenciado, resultando de relevancia lo dicho por este Tribunal reiteradamente en su jurisprudencia:
“VII.- Sobre la coordinación interinstitucional en materia ambiental. Específicamente en materia de tutela ambiental, la sentencia número 2008-004790 subrayó el deber de coordinación entre las instituciones relacionadas con el tema y la imposibilidad de hacer caso omiso a las advertencias sobre el peligro de contaminación que emite una institución facultada por ley para proteger el recurso hídrico:
III.La coordinación entre las dependencias públicas debe garantizar la protección del ambiente. En diversas oportunidades, la jurisprudencia constitucional ha indicado que la protección del ambiente es una tarea que corresponde a todos por igual, es decir, que existe una obligación para el Estado –como un todo- de tomar las medidas necesarias para proteger el medio, a fin de evitar grados de contaminación, deforestación, extinción de flora y fauna, uso desmedido o inadecuado de los recursos naturales, que pongan el peligro la salud de los administrados. En esta tarea, por institución pública, debe entenderse comprendida tanto la Administración Central –Ministerios, como el Ministerio del Ambiente y Energía y el Ministerio de Salud, que en razón de la materia, tienen una amplia participación y responsabilidad en lo que respecta a la conservación y preservación del ambiente; los cuales actúan, la mayoría de las veces, a través de sus dependencias especializadas en la materia, como por ejemplo, la Dirección General de Vida Silvestre, la Dirección Forestal, y la Secretaría Técnica Nacional Ambiental (SETENA); así como también las instituciones descentralizadas, caso del Instituto Nacional de Vivienda y Urbanismo, el Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, el Instituto Costarricense de Turismo o el Instituto Costarricense de Acueductos y Alcantarillados; tarea en la que, por supuesto, tienen gran responsabilidad las municipalidades, en lo que respecta a su jurisdicción territorial.
Es por ello, que podría pensarse que esta múltiple responsabilidad provocaría un caos en la gestión administrativa, lo cual no es cierto, por cuanto a fin de evitar la coexistencia simultánea de esferas de poder de diferente origen y esencia, la duplicación de los esfuerzos nacionales y locales, así como la confusión de derechos y obligaciones entre las diversas partes involucradas, es que se hace necesario establecer una serie de relaciones de coordinación entre las diversas dependencias del Poder Ejecutivo y las instituciones descentralizadas, y entre éstas con las municipalidades, a fin de poder llevar a cabo las funciones que les han sido encomendadas. Esta Sala con anterioridad –y en forma bastante clara- se refirió al principio de coordinación de las dependencias públicas con las municipalidades en la realización de fines comunes -lo cual, obviamente se debe hacer extensivo a la relación que en esta importante función realizan las instituciones de la Administración Central y las descentralizadas-, para lo cual se remite a lo indicado en aquella ocasión (sentencia número 5445-99, de las catorce horas treinta minutos del catorce de julio de mil novecientos noventa y nueve):
"De manera que la coordinación es la ordenación de las relaciones entre estas diversas actividades independientes, que se hace cargo de esa concurrencia en un mismo objeto o entidad, para hacerla útil a un plan público global, sin suprimir la independencia recíproca de los sujetos agentes. Como no hay una relación de jerarquía de las instituciones descentralizadas, ni del Estado mismo en relación con las municipalidades, no es posible la imposición a éstas de determinadas conductas, con lo cual surge el imprescindible «concierto» interinstitucional, en sentido estricto, en cuanto los centros autónomos e independientes de acción se ponen de acuerdo sobre ese esquema preventivo y global, en el que cada uno cumple un papel con vista en una misión confiada a los otros. Así, las relaciones de las municipalidades con los otros entes públicos, sólo pueden llevarse a cabo en un plano de igualdad, que den como resultado formas pactadas de coordinación, con exclusión de cualquier forma imperativa en detrimento de su autonomía, que permita sujetar a los entes corporativos a un esquema de coordinación sin su voluntad o contra ella; pero que sí admite la necesaria subordinación de estos entes al Estado y en interés de éste (a través de la «tutela administrativa» del Estado, y específicamente, en la función de control la legalidad que a éste compete, con potestades de vigilancia general sobre todo el sector).” Por otro lado, las omisiones al deber de protección del ambiente y de cumplimiento de la normativa ambiental son de relevancia constitucional, por cuanto a consecuencia de la inercia de la Administración en esta materia, se puede producir un daño al ambiente y a los recursos naturales, a veces, de similares o mayores consecuencias, que de las derivadas de las actuaciones de la Administración; como lo es la autorización de planes reguladores, o construcciones sin la aprobación del estudio de impacto ambiental por parte Secretaría Técnica Nacional Ambiental, o la falta de control y fiscalización en la ejecución de los planes de manejo de las áreas protegidas por parte de la Dirección General de Vida Silvestre del Ministerio del Ambiente y Energía, o el permitir el funcionamiento de empresas sin los permisos de salud en lo que respecta al tratamiento de aguas negras o residuales (Acueductos y Alcantarillados y Ministerio de Salud), o no verificar los controles sónicos en bares, karaokes y discoteques (municipalidades y Ministerio de Salud), entre otros (ver al respecto sentencia número 2006-005159 de las trece horas cuatro minutos del siete de abril del dos mil seis).” En otras palabras, interesan la cooperación técnica que puedan brindarse los distintos entes, los elementos técnicos que éstos puedan aportar y el respeto a las competencias de cada uno; a fin de garantizar sin lugar a dudas que la incidencia de los proyectos que se evalúen no sea negativa, y así garantizar la gestión sostenible de los recursos hídricos y el pleno derecho a un ambiente sano y ecológicamente equilibrado, tal como lo consagra la norma constitucional.
Así, el principio precautorio -que pretende evitar o suspender cualquier actividad que pueda incidir negativamente en dicha gestión- obliga a la Administración, en primer lugar, a emplazar a los afectados e interesados, y a las instituciones que puedan verse involucradas. Ello para que puedan hacer las alegaciones correspondientes y presentar los criterios técnicos correspondientes, y asegurar una efectiva participación de los órganos competentes en la materia en aras de proteger y preservar el ambiente y el recurso hídrico. Y obliga, en segundo lugar, a tomar en consideración las advertencias que haga una institución facultada por ley para proteger el recurso hídrico sobre el peligro de contaminación”.
Así, en el caso concreto el SINAC fue evasivo de sus responsabilidades, e inclusive se echa de menos que dicho ente haya efectuado las acciones de coordinación adecuadas y necesarias para garantizar la protección a un derecho al ambiente sano y ecológicamente equilibrado, esto es, atendiendo inmediatamente situaciones como las acá denunciadas. Bajo tal estado de las cosas, este extremo debe ser declarado con lugar.
VII.Sobre la alegada afectación al medioambiente. Tras analizar los elementos probatorios aportados y los informes que rindieron bajo juramento las autoridades recurridas, este Tribunal ha llegado a la conclusión de que, en el sub judice, se acredita una vulneración al derecho a un medioambiente sano por los motivos que a continuación se expondrán.
Primeramente, sobre los desechos sólidos, estima esta Sala que la Municipalidad de Quepos sí lleva a cabo una recolección constante de la basura generada por la comunidad, esto a pesar de la dificultad que supone que El Cocal es un asentamiento informal donde el único medio de acceso es por medio de bote cruzando la boca del estero. En esta misma línea, se informó por las autoridades que en el embarcadero hacia El Cocal -conocido como Montecillos-, la municipalidad recurrida construyó un depósito comunitario de residuos que está a la disposición de los vecinos de la zona. Asimismo, se informó que dichos residuos “son recolectados por el servicio municipal todos los días de lunes a domingo (7 días a la semana) a partir de las 7 de la mañana y de ahí trasladados hasta el Centro de Transferencia de Residuos Sólidos ubicado en Damas de Quepos, para finalmente ser dispuestos en el Relleno Sanitario ubicado en Miramar de Montes de Oro en Puntarenas”. Por lo anterior, no se observa una omisión o actuar insuficiente en cómo la autoridad recurrida dispone de los desechos sólidos que se recolectan en la comunidad en aras de proteger el medioambiente.
Sobre la acusación de los recurrentes en el sentido de que la zona está contaminada y que en sus alrededores -en especial en la costa- se generan basureros clandestinos, se indicó ante este Tribunal que el 16 de octubre de 2020 la Unidad de Desarrollo Ambiental de la Municipalidad de Quepos realizó una inspección en el sitio con el fin de visitar zonas cercanas a la playa, detallando lo siguiente: “a. la inspección se realiza desde el salón comunal del Cocal, coordenadas 48123-1043421, hasta la punta arenosa del Cocal ubicada frente a la ciudad de Quepos, coordenadas 481 703-1 042848 (Proyección CR TM05). b. Se recorre toda la zona indicada en dirección Noroeste-Sureste. c. En el recorrido del área indicada se pudo apreciar que los residuos que se pueden observar en el sector de la playa arenosa corresponden a restos orgánicos como cocos, ramas, troncos y vegetación variada. d. Se logró divisar algunos restos de residuos ordinarios dispersos, pero se considera que los mismos pudieron llegar a la zona por acción de las corrientes marinas u oleajes y no necesariamente por disposición directa de los residuos por parte de los vecinos del lugar.
Lo cual es común en todas las costas del mundo. e. Existen a lo largo del frente de la playa de la mencionada localidad una serie de viviendas y diversa infraestructura asociada”. Asimismo, aseveró el alcalde de Quepos que, en El Cocal, “se realizan en promedio unas 6 campañas de limpieza al año y se han entregado y colocado depósitos recolectores de basura en conjunto con el Comité Local de Seguridad con el fin de contribuir a un mejor manejo de los residuos en el lugar. También se han entregado, para su uso público, contenedores de basura y puntos ecológicos a la escuela pública ubicada en el sitio con el fin de mejorar el manejo de los residuos en el lugar”. Lo anterior, claro está, no implica que por ello no existan posibles irregularidades en el manejo de dichos residuos -ya que, con seguridad, por ello es que existen dichas campañas de educación y recolección-, pero las mismas son propias de los numerosos problemas y anomalías que acarrea la existencia de un asentamiento informal.
Congruentemente, se colige que la Municipalidad de Quepos realiza labores varias constantes en aras de mantener la zona con la menor cantidad posible de contaminación sólida, por lo que sobre este extremo el recurso de amparo debe de declararse sin lugar.
Ahora bien, sobre los residuos líquidos -o aguas residuales-, y unido con la comentada complejidad que conlleva el manejo o tratamiento de desechos en un asentamiento informal, esta Sala tiene por demostrado que en El Cocal existe una evidente mala disposición de las aguas residuales, esto en el tanto las autoridades aseveraron que las viviendas son construidas sin obtener los respectivos permisos constructivos y sin contar con las especificaciones mínimas solicitadas por el ordenamiento legal concerniente a edificaciones en el país. Consecuencia de lo anterior, la zona no cuenta con alcantarillado, ni posee un correcto tratamiento de aguas, lo que genera una afrenta flagrante al medioambiente, sobre todo si se toma en cuenta el mismo decir de los recurrentes al denunciar que dichas aguas incluso son depositadas directamente al estero, al mar, y al ecosistema de manglar de la zona. Por lo anterior, se debe estimar este extremo del recurso, por vulneración del derecho a un medioambiente sano y equilibrado amparado por el artículo 50 constitucional.
VIII.Sobre la falta de delimitación del territorio por las autoridades competentes. Ahora bien, la problemática medioambiental y la falta de acción efectiva para mitigar la contaminación en la zona de El Cocal ha sido en gran parte generada por un mal funcionamiento de la Administración Pública, en específico: la falta de delimitación del ecosistema de manglar que debe realizar en forma coordinada el SINAC -que son los competentes para definir y delimitar el ecosistema- y el IGN -que debe inscribirlo y publicarlo en La Gaceta-, tanto como la permisividad y tolerancia estatal frente al establecimiento de un asentamiento humano informal en dominio público con características tan sensibles para la protección y el equilibrio ambiental (ZMT y manglar); todas esas omisiones han desencadenado en muchas otras inacciones y desprotecciones estatales sobre la materia.
En el caso en concreto, la falta de delimitación patrimonial del territorio no ha permitido a la municipalidad y otras autoridades tener conocimiento cierto de la condición catastral del asentamiento (por ejemplo, determinar qué área de este se encuentra dentro de ZMT, o qué área se encuentra dentro de Patrimonio Natural del Estado, etcétera), lo que ha obstaculizado para determinar las debidas competencias para actuar e intervenir el territorio correspondiente: sea desalojar, dar concesiones, elaborar un plan regulador para el sitio, definir calles públicas, dotar de alumbrado público, coordinar el otorgamiento de un correcto servicio de agua o construir alcantarillado sanitario, entre otros.
Al respecto, se desprende de lo informado y aportado como prueba que, al menos desde el 2018 y en reiteradas ocasiones, la Municipalidad de Quepos ha solicitado al SINAC que efectúe la delimitación del Patrimonio Natural del Estado en la zona. Tras lo anterior, se observa que en el 2019, mediante informe ACTO-DRFVS-PMF-075-2020, el SINAC realizó trabajos preliminares sobre las condiciones del sitio, así como de identificación de áreas con condición de Patrimonio Natural del Estado. Asimismo, el 16 de diciembre de 2020 -y tras haberse presentado este recurso de amparo-, dicho ente inició una serie de inspecciones en el lugar para “verificar algunos sitios muy específicos” y delimitar el ecosistema de manglar en la zona. Por lo anterior, tras una prueba para mejor resolver que fue solicitada por este Tribunal al SINAC sobre el estado de dichas inspecciones, el 06 de enero de 2021, mediante documento SINAC-ACOPAC-PNE-001-2021, se informó que “el trabajo realizado en el campo el día 16 de diciembre del 2020 es parte del proceso técnico que realiza el ACOPAC para emitir un informe final de clasificación y delimitación preliminar del ecosistema de Manglar y en este caso para el sector de la comunidad del Cocal de Quepos el cual esperamos concluirlo el próximo 12 de enero del presente”.
Ahora, lo cierto es que, a la fecha, el SINAC no ha presentado ante esta Sala ninguna manifestación de avance al respecto, o aún más importante, el informe técnico final para la delimitación de las áreas de manglar y estero de Quepos ante el IGN.
Como ha sido posición de esta jurisdicción constitucional -desde larga data-, la declaratoria y delimitación de zonas protectoras representa un mecanismo sumamente importante para proteger el derecho fundamental al ambiente (véase, por ejemplo, voto n.° 2019-16793 de las 11:52 horas del 04 de septiembre de 2019). En relación con ello, en el sub lite se ha demostrado con una claridad meridiana el porqué este Tribunal ha sostenido a través del tiempo dicho criterio y, evidentemente, el motivo por el que en este caso dicha pasividad en la delimitación del Patrimonio Natural del Estado y, en sí, la poca acción de las autoridades recurridas para mitigar las consecuencias del asentamiento informal de El Cocal, no ha sido suficiente para lograr tutelar efectivamente el artículo 50 de nuestra Constitución Política, derecho de naturaleza intergeneracional.

Por tanto
Se declara parcialmente con lugar el recurso. En consecuencia:
De los informes rendidos por las autoridades recurridas los cuales son dados bajo la solemnidad del juramento con las consecuencias legales que ello implica se desprende que el sector denominado Playa El Cocal de Quepos se encuentra inequívocamente dentro del régimen de la Zona Marítimo Terrestre, condición jurídica reconocida de manera reiterada por el Instituto Geográfico Nacional (IGN), la Procuraduría General de la República (PGR), la Contraloría General de la República (CGR). Se acreditó que la delimitación cartográfica publicada en La Gaceta N° 32 del 21 de febrero de 2023 no implicó una ampliación de los limites urbanos de Quepos, sino el estricto cumplimiento de una orden judicial de precisar los linderos del ecosistema de manglar Boca Vieja. Se demostró que los moradores del Cocal de Quepos, no poseen ningún título de propiedad o similar que los haga dueños legales de los terrenos a los cuales dan uso y que el gobierno local declaró de interés cantonal el acceso vial hacia la comunidad de El Cocal.
Se constató que en la Sesión Ordinaria N.° 289-2023, celebrada el 14 de noviembre de 2023, el Concejo Municipal conoció el Dictamen de la Comisión Especial de Zona Marítimo Terrestre, en el cual se analizó la aplicación de la Ley N.° 6043 y la delimitación oficial del manglar en El Cocal y que, en Sesión Ordinaria N.° 024-2024, de fecha 21 de agosto de 2024, el Concejo Municipal conoció el escrito del recurrente y acordó dar continuidad a las gestiones sobre el Plan de Ordenamiento Socioeconómico del Cocal. Posteriormente en la Sesión Ordinaria N.° 030-2024, celebrada el 10 de septiembre de 2024, y ratificada en la S.O. N.° 031-2024, el Concejo conoció el Oficio MQ-UZMT-327- 2024, relativo a la vialidad, electricidad y delimitación de El Cocal. Se acordó trasladar las recomendaciones a la Administración y coordinar con MINAE-SINAC e ICE para una solución sostenible. Seguidamente en la Sesión Ordinaria N.° 060-2025, celebrada el 12 de febrero de 2025, el Concejo acordó convocar a Mesas de Trabajo Interinstitucionales con la participación de SINAC-ACOPAC, IGN, Ministerio de Salud, AyA, ICE y dependencias municipales, las cuales se efectuaron el 20 de febrero y 20 de marzo de 2025.
El 19 de marzo de 2025 en Sesión Ordinaria N.° 069-2025, celebrada el 19 de marzo de 2025, y ratificada en la S.O. N.° 071-2025, se acordó trasladar a la Administración Municipal la obligación de informar sobre todas las actuaciones relacionadas con la delimitación de El Cocal. En fecha 01 de abril de 2025 en la Sesión Ordinaria N.° 075-2025 el Concejo conoció el Oficio DIG-GDF-111-2025 del Instituto Geográfico Nacional, en el cual se certifica que la delimitación del manglar en El Cocal se realizó en coordinación con el SINAC y fue publicada en La Gaceta. El 28 de mayo de 2025 en la Sesión Extraordinaria N.° 088-2025 y ratificada en la S.O. N.° 089-2025, el Concejo conoció el Dictamen MQ-CMAJ-036- 2025 de la Comisión Permanente de Asuntos Jurídicos, relativo a escritos presentados en el expediente constitucional, en el cual se confirmó la coordinación SINAC–IGN y se analizaron los alcances normativos de la ZMT.
Finalmente en la Sesión Ordinaria N.° 092-2025, celebrada el 17 de junio de 2025, y ratificada en la S.O. N.° 096-2025, se acordó reiterar los criterios emitidos por la Unidad de ZMT y ordenar la integración de todos los acuerdos relacionados con la delimitación de El Cocal para garantizar trazabilidad. Quedó probado que la recolección de residuos ordinarios no se brinda directamente en el sitio por la dificultad de acceso; por lo que el ingreso de unidades recolectoras al Cocal no es viable ya que no existe infraestructura vial adecuada que permita el tránsito seguro de camiones compactadores. Se afirmó que en el sector conocido como "Montecillos", ubicado en lo que se denomina como el embarcadero hacia el Cocal la Municipalidad construyó un depósito comunitario de residuos que es utilizado por todos los vecinos del Cocal (los cuales trasladan los residuos hasta el sitio indicado). Se indicó que los residuos son recolectados, por el servicio municipal todos los días de lunes a domingo (7 dias a la semana) a partir de las 7 de la mañana y de ahí trasladados hasta el Centro de Transferencia de Residuos Sólidos ubicado en Damas de Quepos, para finalmente ser dispuestos en el Relleno Sanitario ubicado en Miramar de Montes de Oro en Puntarenas y que en la zona del Cocal se realizan en promedio unas 6 campañas de Iimpieza al año y se han entregado y colocado depósitos recolectores de basura en conjunto con el Comité Local de Seguridad, con el fin de contribuir a un mejor manejo de los residuos en el lugar.
En cuanto al Ministerio de Salud se tuvo por demostrado que el 30 de enero del 2025 el Ministerio de Salud participó en una mesa de trabajo convocada por la municipalidad de Quepos a la cual asistió personal del ICE, AyA, ACOPAC y ADEBACO (Asociación de Desarrollo del Barrio el Cocal) y se generó como acuerdo convocar a una segunda mesa de trabajo el día 20 de febrero del 2025 y una tercera para el 20 de marzo del 2025 -sin embargo, por razones desconocidas para este Ministerio las dos últimas no se efectuaron-. Se acreditó que el 22 de diciembre de 2025 el Ministerio de Salud realizó -en cumplimiento a una prueba ordenada por el magistrado instructor- realizó una inspección en el lugar de almacenamiento de residuos que utiliza la Municipalidad de Quepos para los vecinos de El Cocal e indicaron que “El espacio de acopio para residuos sólidos se encuentra en condiciones de evidente deterioro, la maya que cubría las paredes ha sido arrancada y el techo se encuentra roto y no cuenta con puerta, la mayor parte de la estructura metálica esta corroída por el óxido.
Además, se observa la salida de lixiviados del centro de acopio que discurren hacia el estero, este recinto no protege los residuos contra el ingreso de fauna nociva ni las inclemencias del tiempo”. En cuanto al Instituto Geográfico Nacional quedó probado que las acciones pertinentes para la delimitación del ecosistema de manglar de la zona de Quepos es responsabilidad del Área de Conservación Pacífico Central del Sistema Nacional de Áreas de Conservación y del Instituto Geográfico Nacional. Se constató que en caso de existir una delimitación que involucre áreas pertenecientes al Patrimonio Natural del Estado (PNE), la tarea de delimitar los linderos pertinentes le corresponde al Ministerio de Ambiente y Energía (MINAE), de conformidad con la Ley Forestal, Ley N°7575 de 13 de febrero de 1996 y sus reformas. Quedó probado que como resultado de las acciones realizadas por el Área de Conservación Pacífico Central y el IGN, se realizó la delimitación de los manglares ubicados en Quepos centro, que incluyó los sectores de El Cocal, Boca Vieja y Damas -todo en respaldo de los siguientes informes técnicos:
Que el sector denominado Playa El Cocal de Quepos se encuentra inequívocamente dentro del régimen de la Zona Marítimo Terrestre.
Que la delimitación cartográfica publicada en La Gaceta N° 32 del 21 de febrero de 2023 no implicó una ampliación de los límites urbanos de Quepos, sino el estricto cumplimiento de una orden judicial de precisar los linderos del ecosistema de manglar Boca Vieja.
Que para poder incluir los terrenos de El Cocal en el plan regulador se requiere la formulación de un plan regulador costero, sustentado en estudios ambientales rigurosos, índices de Fragilidad Ambiental (IFAS), evaluaciones de impacto y certificaciones del patrimonio natural.
Que la recolección de residuos ordinarios no se brinda directamente en el sitio por la dificultad de acceso; sin embargo en el sector conocido como "Montecillos", ubicado en lo que se denomina como el embarcadero hacia el Cocal la Municipalidad construyó un depósito comunitario de residuos que es utilizado por todos los vecinos del Cocal (los cuales trasladan los residuos hasta el sitio indicado).
Que los residuos son recolectados, por el servicio municipal todos los días de lunes a domingo (7 días a la semana) a partir de las 7 de la mañana y de ahí trasladados hasta el Centro de Transferencia de Residuos Sólidos ubicado en Damas de Quepos, para finalmente ser dispuestos en el Relleno Sanitario ubicado en Miramar de Montes de Oro en Puntarenas.
Que el 22 de diciembre de 2025 el Ministerio de Salud realizó una inspección en el lugar de almacenamiento de residuos que utiliza la Municipalidad de Quepos para los vecinos de El Cocal e indicaron que “El espacio de acopio para residuos sólidos se encuentra en condiciones de evidente deterioro, la maya que cubría las paredes ha sido arrancada y el techo se encuentra roto y no cuenta con puerta, la mayor parte de la estructura metálica esta corroída por el óxido. Además, se observa la salida de lixiviados del centro de acopio que discurren hacia el estero, este recinto no protege los residuos contra el ingreso de fauna nociva ni las inclemencias del tiempo”.
El recurrente reclama que a la fecha no se han cumplido las órdenes emitidas en la sentencia número 2021002741 de las nueve horas quince minutos del doce de febrero de dos mil veintiuno y agrega que existe una necesidad de la comunidad El Cocal “de ser integrada legalmente en un plan regulador urbano en litoral ya existente” y de esa forma mejorar la calidad de vida de los vecinos así como el alcantarillado sanitario. Agrega que las georreferencias de la zona marítima El COLCA nuevas fueron publicadas en La Gaceta a pesar de que no participar a la Municipalidad. Por lo que solicita que se ordene la incorporación del barrio El Cocal al plan regulador urbano, la ejecución de obras de saneamiento básico y acceso óptimo y recolección de basura, delimitar la zona marítimo terrestre conforme la Ley 6043; así como garantizar la participación ciudadana en el proceso de planificación y ejecución.
Las autoridades municipales reconocen que “existe la necesidad de contar con un plan regulador costero en el sector de Playa El Cocal, tanto para regularizar la situación de las familias que residen en dicho territorio como para asegurar la protección ambiental de la franja litoral”, sin embargo “mientas subsistan las inconsistencias derivadas de la delimitación estero-manglar Boca Vieja publicada en 2023, existe un impedimento para iniciar el proceso de planificación” y que “en el sector conocido como "Montecillos", ubicado en lo que se denomina como el embarcadero hacia el Cocal la Municipalidad construyó un depósito comunitario de residuos que es utilizado por todos los vecinos del Cocal (los cuales trasladan los residuos hasta el sitio indicado” -residuos que afirma son recolectados todos los días de lunes a domingo-. De otra parte el Ministerio de Salud afirma que el 30 de enero del 2025 el Ministerio de Salud participó en una mesa de trabajo convocada por la municipalidad de Quepos a la cual asistió personal del ICE, AyA, ACOPAC y ADEBACO (Asociación de Desarrollo del Barrio el Cocal) y se generó como acuerdo convocar a una segunda mesa de trabajo el día 20 de febrero del 2025 y una tercera para el 20 de marzo del 2025 -sin embargo, por razones desconocidas para este Ministerio las dos últimas no se efectuaron-.
Afirmó que “El espacio de acopio para residuos sólidos se encuentra en condiciones de evidente deterioro, la maya que cubría las paredes ha sido arrancada y el techo se encuentra roto y no cuenta con puerta, la mayor parte de la estructura metálica esta corroída por el óxido. Además, se observa la salida de lixiviados del centro de acopio que discurren hacia el estero, este recinto no protege los residuos contra el ingreso de fauna nociva ni las inclemencias del tiempo”. Finalmente las autoridades del Instituto Geográfico Nacional indicaron que como resultado de las acciones realizadas por el Área de Conservación Pacífico Central y el IGN, se realizó la delimitación de los manglares ubicados en Quepos centro, que incluyó los sectores de El Cocal, Boca Vieja y Damas. Así las cosas el recurso deviene procedente únicamente por el manejo de desechos sólidos por parte del gobierno local recurrido.
Si bien es cierto en la sentencia cita por el recurrente esta Sala declaró sin lugar el recurso en cuanto a ese extremo lo cierto es que en ese momento no se logró demostrar que existiera una omisión o actuar insuficiente en la disposición de los desechos sólidos recolectados en la comunidad. Sin embargo en el caso que nos ocupa las autoridades municipales afirmaron que existe implementado un protocolo para la recolección de desechos sólidos en la comunidad del Cocal, el cual se mantiene con la misma efectividad de siempre por parte de la Municipalidad; sin embargo en la inspección realizada por las autoridades del Ministerio de Salud el 22 de diciembre del 2025 -inspección requerida como prueba para mejor resolver mediante resolución de las quince horas veinticinco minutos del dieciséis de diciembre de dos mil veinticinco- se demostró que “el sitio es un lugar de almacenamiento temporal de residuos sólidos que utiliza la Municipalidad de Quepos para que los vecinos de El Cocal trasladen y depositen sus residuos para una posterior recolección por parte del camión recolector.
El espacio de acopio para residuos sólidos se encuentra en condiciones de evidente deterioro, la maya que cubría las paredes ha sido arrancada y el techo se encuentra roto y no cuenta con puerta, la mayor parte de la estructura metálica esta corroída por el óxido. Además, se observa la salida de lixiviados del centro de acopio que discurren hacia el estero, este recinto no protege los residuos contra el ingreso de fauna nociva ni las inclemencias del tiempo”. Partiendo de lo anterior es evidente que el estado actual del espacio de almacenamiento temporal de los residuos sólidos para los vecinos de El Cocal no cumple con condiciones sanitarias mínimas. En reiteradas ocasiones, este Tribunal Constitucional se ha referido a los principios constitucionales que rigen la prestación de servicios públicos y el derecho fundamental a la prestación eficiente de éstos, que implica que independientemente del tipo de servicio, deben ser prestados con elevados estándares de calidad, el cual tiene como correlato necesario la obligación de las administraciones públicas de prestarlos de forma continua, regular, célere, eficaz y eficiente.
Además, es necesario destacar que las Municipalidades del país deben velar por los intereses de los habitantes de su jurisdicción, de ahí que, en reiterados pronunciamientos, este Tribunal ha señalado que dichas corporaciones se encuentran en la obligación de eliminar cualquier tipo de amenaza que ponga en riesgo los derechos a la salud y a un medio ambiente sano y ecológicamente equilibrado de las personas que viven en su cantón, entre ellos el servicio de recolección de desechos sólidos (véase en similar sentido las Sentencias N° 2023-19610 de las 9:30 horas de 11 de agosto de 2023 y N° 2019-005623 de las 09:45 horas del 29 de marzo de 2019). Así las cosas lo procedente es declarar con lugar el recurso en cuanto a este extremo con las consecuencias que se indican en la parte dispositiva de esta sentencia.
V.Ahora bien en cuanto al incumplimiento de las órdenes emitidas en la sentencia número 2021002741 de las nueve horas quince minutos del doce de febrero de dos mil veintiuno deberá desglosarse el escrito de interposición a fin de que se analice el presunto incumplimiento de la sentencia citada y remitirse al expediente número 20-021786-0007-CO.
Considero que en asuntos ambientales, si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que la parte recurrente acusa la omisión, por parte de la Municipalidad de Quepos, en realizar una adecuada recolección y disposición de los desechos sólidos, lo que afecta el derecho a disfrutar de un ambiente sano, ecológicamente equilibrado y de un nivel digno de calidad de vida a los recurrentes, pero que no ha sido resuelta de forma definitiva.
Se previene a la parte recurrente que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, deberá retirarlos del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el «Reglamento sobre Expediente Electrónico ante el Poder Judicial», aprobado por la Corte Plena en sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial No. 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara con lugar el recurso únicamente en contra de la Municipalidad de Carrillo. Se ordena a Patricia Bolaños Murillo, en su condición de Alcaldesa y a Gilbert Cruz Jiménez en calidad de presidente del Concejo, ambos de la Municipal de Quepos o a quienes en su lugar ocupen los cargos que procedan DE FORMA INMEDIATA a implementar medidas paliativas de mayor urgencia para corregir el problema ambiental reclamado. Deberán disponer y coordinar lo necesario a efecto que, en el plazo de DOS MESES, contado a partir de la notificación de esta sentencia, se corrija de forma definitiva el problema generado en el sitio de almacenamiento temporal de residuos sólidos que utiliza la Municipalidad de Quepos en la comunidad de los vecinos de El Cocal. Se advierte a los recurridos que de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo, y no la cumpliere o hiciere cumplir, siempre que el delito no esté más gravemente penado.
Se condena a la Municipalidad de Quepos al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En cuanto al incumplimiento de las órdenes emitidas en la sentencia número 2021002741 de las nueve horas quince minutos del doce de febrero de dos mil veintiuno deberá desglosarse el escrito de interposición a fin de que se analice el presunto incumplimiento de la sentencia citada y remitirse al expediente número 20-021786-0007-CO. El magistrado Salazar Alvarado consigna nota. Notifíquese.
