Non-compliance dismissed — verifiable progress on stormwater drainage and sanitary works in San BoscoDesobediencia sin lugar — avance verificable de obras pluviales y sanitarias en San Bosco

Res. Nº 2026004797 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine thirty-six hours on the eleventh of February of two thousand twenty-six.

Amparo action processed under case file number 20-008297-0007-CO, filed by Nombre01, identity card CED01, AND OTHERS, against the MUNICIPALITY OF SANTA BÁRBARA DE HEREDIA.

Whereas:

1.- By document added to the case file at 15:04 hours on January 14, 2026, by the petitioner Nombre02, identity card CED02, she files a claim of disobedience of what was ordered by this Chamber in Judgment No. 2020-010461 at 9:50 hours on June 9, 2020, given that in that Judgment the following was ordered: “(…) The amparo action is granted. Víctor Manuel Hidalgo Solís, in his capacity as Municipal Mayor of the canton of Santa Bárbara de Heredia, as well as Garita Montoya, in her capacity as Acting Director of the Rector Health Area of Santa Bárbara de Heredia, are ordered, within a period not exceeding SIX MONTHS, counted from the notification of this judgment, to adopt the measures that are necessary within the scope of their respective competencies, in order to foresee and provide a definitive solution to the environmental problem reported by the petitioners, a period within which the Administration must take the appropriate measures to alleviate the situation (…)”.

2.- By resolution at sixteen hours twenty-one minutes on the twenty-second of January of two thousand twenty-six, an audience is granted to the respondent authorities, so that they may refer to and provide the corresponding evidence regarding the facts and omissions attributed to them.

3.- DAVID CORTÉS SÁNCHEZ, as Director of the Rector Health Area of Santa Barbara, reports under oath, as follows:

“…II. ACTIONS TAKEN BY THE AREA REGARDING THIS AMPARO:

Below, the actions taken by this Rector Health Area of Santa Barbara are reported, in compliance with the provisions of the Constitutional Chamber:

1). From the year 2020 to the year 2023, a total of 75 properties (fincas) with a total of 101 establishments (homes and businesses) were inspected.

2). 94 technical dye tests using fluorescein were carried out for the first time and 75 technical tests for the second time (verification of compliance with sanitary orders) in 94 buildings (businesses and homes) located from the San Bosco sports field, up to Dirección01, the place where the reported canal (acequia) passes. These homes are located on both sides of the road and on some secondary streets that, according to report UA-087-2019 issued by the Municipality of Santa Bárbara, and previous inspections, it was determined that due to the slope of the land and their location, they are the ones that channel the wastewater (aguas residuales) into the stormwater sewer system of that sector and the subsequent channeling to the reported canal (acequia).

3). Of the 94 tests performed, 16 yielded a negative result and 78 yielded a positive result.

4). Of the 78 homes with a positive result, 53 sanitary orders were served to the owners and tenants of the properties (fincas) where the homes are located (the difference between positive tests and sanitary orders served is because there are properties where several homes belonging to the same owner are located).

5). Of the 53 sanitary orders served, 44 orders are fulfilled, and there are 9 sanitary orders not fulfilled, which were presented to the Prosecutor's Office (Fiscalía) for the crime of disobedience to authority to be assessed.

6). Among the reported properties (fincas), in 6 there were no buildings that discharged wastewater (aguas residuales) onto the public thoroughfare.

7). Of the unfulfilled sanitary orders, 9 cases have been referred to the Prosecutor's Office (Fiscalía) to initiate the process for Disobedience to Authority.

8). According to the inspections indicated and the administrative acts issued, in which the properties indicated by the Municipality of Santa Bárbara in report UA-087-2019 were covered, in the year 2023 the inspections in the sector were concluded, pending the Municipality of Santa Bárbara carrying out the stormwater diversion process via Dirección02 and with this, preventing the flooding that affects the petitioner neighbors. However, in 2024, due to a complaint from a citizen of the area, a sector adjacent to the one already intervened was identified, through which wastewater (aguas residuales) was flowing; therefore, the inspection process in the sector restarted. In the months of April, May, and November of 2024, inspections were carried out in the sector, performing dye tests in commercial establishments and homes, ruling out the discharge of black water (aguas negras) in two establishments and one home. However, the discharge of greywater (aguas servidas) into the street gutter (cordón de caño) was demonstrated in one home and one commercial establishment, for which SANITARY ORDER MS-DRRSCN-DARSSB-1779-2024 was served, and according to report CARTA-MS-DARSSB-SB-176-2025 of February 4, 2025, the sanitary order was fulfilled.

9). On January 27, 2026, an inspection was carried out in San Bosco de Purabá, from the cemetery to Bar Bocas, which had been intervened since the year 2020. It was observed that, in some sectors that had already been inspected, there was the presence of water in the stormwater sewer system. On the main road, several potable water leaks were observed, so the presence of water in the stormwater sewer system could correspond to water from the aqueduct. However, in two homes that had already been intervened, the outflow of water into the stormwater sewer system was observed; these waters appear to be wastewater (aguas residuales), for which reason the technical dye test using fluorescein must be carried out again to identify the type of water being disposed of into the drain.

In this aspect, it is important to mention that, according to experience in handling complaints of this type, a pattern has been identified in which there are homes to which administrative acts had been served for the channeling of wastewater (aguas residuales) within their property, and these were fulfilled; over time, some re-offend and dispose of wastewater (aguas residuales) into the stormwater sewer system again. Therefore, according to the inspection schedule of the regulation process, a follow-up on this sector is scheduled starting February 4, 2026, and to carry out an inspection in the indicated homes.

10). In the inspection carried out on January 27, 2026, it was observed that, in the sector of Dirección02, the Municipality has already removed the fence that divided two easements (servidumbres), and this is where the stormwater will be channeled toward the Río Ciruelas. Engineer Mario Valerín, an official of the Municipality of Santa Bárbara, reported that on Monday, January 26, 2026, the agreement was signed in the Municipal Council for the stormwater discharge, so the next step is the installation of piping for the discharge of said waters. Furthermore, they coordinated with the ASADA for the replacement of the potable water pipe that passes through the sector and to take advantage for the installation of a hydrant. He also reported that, as the final part of the process, CONAVI must intervene to carry out the connection work from the National Route.

11). From the year 2020 to the year 2023, the Directorate of the Rector Health Area of Santa Bárbara fulfilled the technical work of identifying the homes that contaminate the bed of the canal (acequia) reported by the neighbors of San Bosco Purabá, Santa Bárbara, in addition to serving the corresponding administrative acts to resolve the described contamination problem, and it has provided the respective follow-up. Starting from the year 2024, the inspection of specific identified cases that could generate contamination of the reported canal (acequia) continued, and starting from February 4, 2026, the identification of cases will continue, according to what was observed in the inspection of January 27, 2026.

12). As can be observed in the photographs, the stormwater channels are mostly dry, and no wastewater (aguas residuales) is observed flowing through the drains. In some sectors, ponding of water from aqueduct leaks is observed (for which the sector's ASADA will be requested to proceed with their repair) and also wastewater (aguas residuales) from at least two homes that could be re-offenders in channeling wastewater (aguas residuales) to the stormwater sewer system.

III. REQUEST FOR DISMISSAL OF THE NON-COMPLIANCE CLAIM

In accordance with the Principle of Efficacy of Public Function and the duty to comply with constitutional resolutions, the actions ordered by the Constitutional Chamber were executed in a timely manner.

It must be emphasized that there is no omission or resistance, therefore the non-compliance claim lacks foundation.

It must be taken into account that this institution fully complied with what was ordered, and I must categorically reject that the re-offending by some citizens in channeling their water improperly should be considered as non-compliance in this disobedience proceeding.

I do not omit to state that these irregular acts of re-offending are already being duly processed by this rector health area…”.

4.- JACQUELINE SEGURA RODRÍGUEZ, as Acting Mayor of the MUNICIPALITY OF SANTA BÁRBARA, reports under oath, as follows:

“…REPORT FIRST: That on January 9, several technical visits were made to the community in order to address the problem and to make an approach, so that through socialization, all interested parties are duly informed of the actions that will be undertaken for the development of the project for the placement of stormwater piping, among which the following are cited:

I.Socialization with the Social Promoter of the Technical Road Management Unit (Unidad Técnica de Gestión Vial) (UTGV) Alejandro Garita, through which the ASADA, which provides potable water service in the area, was informed of the presence of pipes in the center of the road, in order to coordinate any eventual breakages due to the work to be carried out on the road and mitigate the impact on the community.

II.Socialization with the community, which was attended by Mayor Ing. Víctor Hidalgo Solís, Ing. Mario Valerín, Ing. Mario Fernández Mesén, head of the UTGV, and the Social Promoter of the UTGV, Alejandro Garita Murillo, and it was reported that the section from the beginning of the stormwater easement (servidumbre pluvial) to the entrance to Dirección04 (Dirección05) would be intervened by the Technical Road Management Unit “UTGV” for the installation of the piping and the construction of access to the property where it will be installed. An approach to the problem and a mapping of the factors to be addressed was carried out, and it was reported that the purpose of the project's development is the placement of stormwater piping. A direct conversation was held with the neighboring people, visiting house by house, indicating to them that on Monday, January 12, the work of removing the vegetation layer located in the center of the street would begin, in order to advance prior work for its placement.

SECOND: That on January 12, personnel from the Municipal Engineering Department and the UTGV, through the use of heavy machinery, began work to remove the dividing fence and clean vegetation and obstacles on the road, in order to recover the usable width of the road and improve traffic in the sector.

The foregoing was communicated on January 27, 2026, through official letter UTGVMSB-011-2026, to Engineer Andrea Madrigal, CONAVI, considering that technical data from said institution is required to be able to intervene Dirección06 from the Technical Road Management Unit and the Engineering Unit of the Municipality, and to carry out a timely technical development for the placement of piping for the discharge of stormwater coming from the national route 127. (See ANNEX I) THIRD: That on January 26 of this year, the viability of the Council was received to approve the width of the road, the installation of the piping, and the constitution of the stormwater easement (servidumbre pluvial), which was granted through a definitively approved agreement, which was a mandatory prerequisite for the Municipality to be able to commence the work.

FOURTH: That after the approval of the aforementioned Agreement, the following works are in the operational programming process, which will be executed according to the institutional availability of machinery and personnel:

- Installation of the stormwater discharge piping - Construction of the access to the intervened property - Intervention of the section of the stormwater easement (servidumbre pluvial) up to Dirección04 (Ruta Nacional 127).

SIXTH: By reason of the foregoing, and given that the Municipality required the approval of the Municipal Council, which has already been granted, we are in the finalization stage of the works, in which the stormwater discharge is being built, the piping is being installed, and the widening of the cross-section of Dirección07 in San Bosco is being built, thus providing a definitive solution in favor of the community.

That the Municipality of Santa Bárbara, as can be observed through the following images, has addressed the neighbors' requests in the shortest possible time and without delays, and technically explained the works being carried out to provide a definitive solution to the environmental problem reported, through concrete, coordinated, and sustained actions that include community and technical coordination, physical intervention of the road, legal formalization of the stormwater solution, and programming of definitive works; thereby demonstrating active compliance with what was ordered by this honorable Chamber, as well as the institutional commitment to provide a comprehensive and permanent solution to the community's situation. Images alluding to the site works are attached…".

Considering:

I.- Through Judgment No. 2020-010461 at 9:50 hours on June 9, 2020, this Constitutional Court ordered the following:

“(…) The amparo action is granted. Víctor Manuel Hidalgo Solís, in his capacity as Municipal Mayor of the canton of Santa Bárbara de Heredia, as well as Garita Montoya, in her capacity as Acting Director of the Rector Health Area of Santa Bárbara de Heredia, are ordered, within a period not exceeding SIX MONTHS, counted from the notification of this judgment, to adopt the measures that are necessary within the scope of their respective competencies, in order to foresee and provide a definitive solution to the environmental problem reported by the petitioners, a period within which the Administration must take the appropriate measures to alleviate the situation (…)”.

II.- Regarding the claim filed. By document filed at 15:04 hours on January 14, 2026, by the petitioner Nombre02, identity card CED02, she files a claim of disobedience of what was ordered by the Chamber on that occasion.

In this regard, it should be noted that by resolution at sixteen hours twenty-one minutes on the twenty-second of January of two thousand twenty-six, an audience was granted to the respondent authorities, so that they may refer to and provide the corresponding evidence regarding the facts and omissions attributed to them.

In response, the Acting Mayor of the MUNICIPALITY OF SANTA BÁRBARA de Heredia attended the audience granted by the Chamber and provides a breakdown of the actions taken to comply with what was ordered on that occasion. In this regard, she stated the following:

“…FIRST: That on January 9, several technical visits were made to the community in order to address the problem and to make an approach, so that through socialization, all interested parties are duly informed of the actions that will be undertaken for the development of the project for the placement of stormwater piping, among which the following are cited:

Images alluding to the site works are attached…” For his part, the Director of the Rector Health Area of Santa Barbara also attended the audience granted by the Chamber and stated the following:

II.- Based on the foregoing, and the attached evidence, this Chamber dismisses the non-compliance alleged by the petitioner in relation to what was ordered in Judgment No. 2020-010461 at 9:50 hours on June 9, 2020, as it is proven that both the respondent Municipality and the Ministry of Health have indeed been attending to what was ordered on that occasion, as far as their competencies are concerned. While it is true that a definitive solution to the problem raised has not yet been realized, the actions taken by the respondent authorities aimed at resolving this situation are clear and verifiable; however, it is evident that this is a very complex project, in which other public institutions must intervene. Even so, verified progress in the scheduled works already exists. The removal of the vegetation layer located in the center of the street was started to advance prior work for its placement. Personnel from the Municipal Engineering Department and the UTGV, through the use of heavy machinery, began work to remove the dividing fence and clean vegetation and obstacles on the road, in order to recover the usable width of the road and improve traffic in the sector. The viability was received to approve the width of the road, the installation of the piping, and the constitution of the stormwater easement (servidumbre pluvial), which was granted through a definitively approved agreement, which was a requirement for the Municipality to be able to commence the work.

Currently, the following works are in the operational planning stage:

- Installation of the storm drainage pipe - Construction of access to the property under intervention - Intervention of the stormwater easement (servidumbre pluvial) section up to Dirección04 (Dirección08).

In light of the above, this Chamber verifies the progress of the works, as well as the intervention schedule, and therefore the claim of non-compliance is unfounded, and is declared as such.

Recurso de amparo que se tramita en expediente número 20-008297-0007- CO, interpuesto por Nombre01, cédula de identidad CED01, Y OTROS, contra la MUNICIPALIDAD DE SANTA BÁRBARA DE HEREDIA.

Resultando:

1.- Por escrito incorporado al expediente a las 15:04 horas del 14 de enero de 2026, por la recurrente Nombre02, cédula de identidad CED02, presenta gestión de desobediencia de lo ordenado por esta Sala en la Sentencia N° 2020-010461 de las 9:50 horas del 09 de junio del 2020, toda vez que en esa Sentencia se dispuso lo siguiente: “(…) Se declara con lugar el recurso. Se ordena a Víctor Manuel Hidalgo Solís, en su condición de Alcalde Municipal del cantón de Santa Bárbara de Heredia, así como a Garita Montoya, en su condición de Directora a.i. del Área Rectora de Salud de Santa Bárbara de Heredia, que, dentro del plazo no mayor a SEIS MESES, contados a partir de la notificación de esta sentencia, adopten las medidas que sean necesarias dentro del ámbito de sus respectivas competencias, a fin de que prevean y brinden una solución definitiva a la problemática ambiental denunciada por los recurrentes, término dentro del cual la Administración deberá tomar las medias que correspondan para paliar la situación (…)”.

2.- Mediante resolución de las dieciséis horas veintiuno minutos del veintidós de enero de dos mil veintiséis, se confiere audiencia a las autoridades recurridas, para que se refieran y aporten las pruebas correspondientes respecto a los hechos y omisiones que se les atribuyen.

3.- Informa bajo juramento DAVID CORTÉS SÁNCHEZ, como Director del Área Rectora de Salud de Santa Barbara, lo siguiente:

“…II. ACCIONES REALIZADAS POR EL AREA RESPECTO DE ESTE AMPARO:

A continuación, se informan las acciones realizadas por esta Área Rectora de Salud de Santa Barbara, en acatamiento de las disposiciones de la Sala Constitucional:

1). Desde el año 2020 al año 2023 en total se inspeccionaron 75 fincas con un total de 101 establecimientos (viviendas y negocios).

2). Se realizaron 94 pruebas técnicas de coloración con fluoresceína, por primera vez y 75 pruebas técnicas de segunda vez (verificación de cumplimiento de órdenes sanitarias) en 94 edificaciones (negocios y viviendas) ubicadas desde la plaza de deportes de San Bosco, hasta el Dirección01, lugar por donde pasa la acequia denunciada. Estas viviendas están ubicadas en ambos lados de la carretera y en algunas calles secundarias que de acuerdo con el informe UA-087-2019 emitido por la Municipalidad de Santa Bárbara, e inspecciones previas se determinó que por el desnivel de los suelos y por su ubicación, son las que canalizan las aguas residuales, al alcantarillado pluvial de ese sector y la consecuente canalización a la acequia denunciada.

3). De las 94 pruebas realizadas, 16 dieron como resultado negativo y 78 dieron resultado positivo.

4). De las 78 viviendas con resultado positivo, se notificaron 53 órdenes sanitarias a los propietarios e inquilinos de las fincas donde se encuentran las viviendas (la diferencia entre pruebas positivas y órdenes sanitarias notificadas se debe a que hay fincas donde hay ubicadas varias viviendas que pertenecen a un mismo dueño).

5). De las 53 órdenes sanitarias notificadas, hay 44 órdenes cumplidas, 9 órdenes sanitarias no cumplidas, las cuales fueron presentadas ante la Fiscalía, para que se valore el delito de desobediencia a la autoridad.

6). Dentro de las fincas denunciadas, en 6 no había edificaciones, que depositaran aguas residuales a la vía pública.

7). De las órdenes sanitarias no cumplidas se han trasladado a la Fiscalía 9 casos para que se inicie el proceso por Desobediencia a la Autoridad.

8). De acuerdo con las inspecciones indicadas y los actos administrativos emitidos, en las cuales se abarcaron las propiedades indicadas por el Municipalidad de Santa Bárbara en el informe UA-087-2019, en el año 2023 se dieron por concluidas las inspecciones en el sector, a la espera de que la Municipalidad de Santa Bárbara, realizara el proceso de desvío de las aguas pluviales a través de Dirección02 y con esto, evitar las inundaciones que afectan a los vecinos recurrentes, sin embargo en el 2024 debido a una denuncia de un ciudadano de la zona, se identificó un sector aledaño al ya intervenido, y por el cual, estaban discurriendo aguas residuales, por tanto, se reinició con el proceso de inspección en sector. En los meses de abril, mayo, noviembre del año 2024, se realizaron inspecciones en el sector, realizando pruebas de coloración en establecimientos comerciales y viviendas, descartando la descarga de aguas negras en dos establecimientos y una vivienda. Sin embargo, se demostró la descarga de aguas servidas al cordón de caño en una vivienda y un establecimiento comercial, por lo cual se notificó la ORDEN SANITARIA MS-DRRSCN-DARSSB-1779-2024 y según informe CARTA-MS-DARSSB-SB-176-2025 del 4 de febrero de 2025 la orden sanitaria fue cumplida.

9). El día 27 de enero de 2026 se realizó inspección en San Bosco de Purabá, desde el cementerio hasta el Bar Bocas, el cual fue intervenido desde el año 2020. Se observó que, en algunos sectores, que ya se habían inspeccionado, había presencia de aguas en el alcantarillado pluvial. En la carretera principal, se observaron varias fugas de agua potable, por lo que, la presencia de aguas en el alcantarillado pluvial puede corresponder a agua del acueducto, sin embargo, en dos viviendas que ya habían sido intervenidas, se observó la salida de aguas hacia el alcantarillado pluvial, esas aguas, en apariencia corresponden a aguas residuales, por lo cual, se debe realizar nuevamente prueba técnica de coloración con fluoresceína para identificar el tipo de aguas que se están disponiendo en el alcantarillo.

En este aspecto es importante mencionar que, de acuerdo con la experiencia en atención de denuncias de este tipo, se ha identificado un patrón, en el cual, hay viviendas a las cuales, se les había notificado actos administrativos para canalización de aguas residuales dentro de su propiedad y éstas fueron cumplidos, con el paso del tiempo algunas reinciden y vuelven a disponer las aguas residuales al alcantarillado pluvial, por lo cual de acuerdo con el cronograma de inspecciones del proceso de regulación, se tiene programado dar seguimiento a este sector a partir del 04 de febrero de 2026 y realizar inspección en las viviendas indicadas.

10). En la inspección realizada el 27 de enero de 2026 se observó que, en el sector de Dirección02, ya la Municipalidad eliminó la cerca que dividía dos servidumbres y es por donde se van a canalizar las aguas pluviales hacia el Río Ciruelas. El Ingeniero Mario Valerín funcionario de la Municipalidad de Santa Bárbara, informa que el lunes 26 de enero de 2026 se firmó el convenio en el Concejo Municipal, para el desfogue de las aguas pluviales, por lo que, lo siguiente es la instalación de tubería para el desfogue de dichas aguas. Además, coordinaron con la ASADA para el cambio de tubería de agua potable que pasa por el sector y aprovechar para la instalación de un hidrante. Informa además que, como parte final del proceso el CONAVI debe intervenir para realizar el trabajo de conexión desde la Dirección03.

11). Desde el año 2020 hasta el año 2023 la Dirección de Área Rectora de Salud Santa Bárbara, cumplió con el trabajo técnico de identificar las viviendas que contaminan el cauce de la acequia denunciada por los vecinos de San Bosco Purabá de Santa Bárbara, además de notificar los actos administrativos correspondientes para que se resuelva el problema de la contaminación descrita y ha dado el seguimiento respectivo. A partir del año 2024 se continuó con la inspección de casos puntuales identificados que podrían generar contaminación de la acequia denunciada y a partir del 04 de febrero de 2026 se continuará con la identificación de casos, según lo observado en la inspección del 27 de enero de 2026 12). Como se puede observar en las fotografías, los canales aguas pluviales en su mayoría se observan secos y no se observan aguas residuales discurriendo por las alcantarillas. En algunos sectores se observa estancamiento de aguas provenientes de fugas del acueducto (para lo cual se solicitará a la ASADA del sector que proceda con la reparación de estas) y también aguas residuales provenientes de al menos dos viviendas que podrían ser reincidentes en la canalización de aguas residuales al alcantarillado pluvial.

III. SOLICITUD DE DESESTIMACION DE LA GESTION DE INCUMPLIMIENTO

Conforme al Principio de Eficacia de la Función Pública y al deber de acatamiento de las resoluciones constitucionales, las acciones ordenadas por la Sala Constitucional fueron ejecutadas en tiempo y forma.

Se debe destacar que no existe omisión ni resistencia, por lo que el alegato de incumplimiento carece de fundamente.

Debe tomarse en cuenta que esta institución cumplió a cabalidad con lo ordenado, siendo que debo rechazar categóricamente que la reincidentes en algunos ciudadanos de canalizar sus aguas en forma indebida, no debe ser tomada en cuenta como incumplimiento en esta gestión de desobediencia.

No omito manifestar que, dichas actuaciones irregulares de reincidencia, ya están siendo debidamente diligenciadas por esta área rectora de salud…”.

4.- Informa bajo juramento JACQUELINE SEGURA RODRÍGUEZ, como Alcaldesa a.i. de la MUNICIPALIDAD DE SANTA BÁRBARA, lo siguiente:

“…INFORME PRIMERO: Que el día 9 de enero se realizaron varias visitas técnicas a la comunidad, con el fin de abordar la problemática, y realizar un acercamiento, con el fin de que mediante la socialización se informe debidamente a todos los interesados las acciones que se abordarán para el desarrollo del proyecto de colocación de tubería pluvial, entre las cuales se cita:

I.Socialización con el Promotor Social de la Unidad Técnica de Gestión Vial (UTGV) Alejandro Garita, mediante el cual se informó a la ASADA, quien brinda el servicio de agua potable en la zona, la presencia de tuberías en el centro de la vía, con el fin de coordinar eventuales rupturas por los trabajos a desarrollar en la vía, y mitigar el impacto en la comunidad.

II.Socialización con la comunidad para la cual se contó con la presencia de los señores Alcalde Ing. Víctor Hidalgo Solís, el Ing. Mario Valerín, el Ing. Mario Fernández Mesén, encargado de la UTGV, y el Promotor Social de la UTGV, Alejandro Garita Murillo, y se informó que el tramo de inicio de la servidumbre pluvial y hasta el ingreso a Dirección04 (Dirección05) sería intervenido por la Unidad Técnica de Gestión Vial “UTGV", para la instalación de la tubería y la construcción de acceso a la propiedad donde será instalada. Se realizó un acercamiento con la problemática y un mapeo de los factores por abordar, y se informó, que la finalidad del desarrollo del proyecto lo es la colocación de tubería pluvial. Se conversó directamente con las personas vecinas, visitando casa por casa, indicándoles que el lunes 12 de enero se iniciaría el trabajo de remoción de la capa vegetal ubicada en el centro de la calle, con el fin de ir adelantando trabajos previos de colocación de la misma.

SEGUNDO: Que el día 12 de enero, el personal del Departamento de Ingeniería Municipal y la UTGV, mediante el uso de maquinaria pesada inició labores para el retiro de la cerca divisoria, y limpieza de vegetación y obstáculos en la vía, con el fin de recuperar el ancho útil de la vía, y mejorar el tránsito en el sector.

Lo anterior le fue comunicado en fecha 27 de enero de 2026, mediante oficio UTGVMSB-011-2026, en a la Ingeniera Andrea Madrigal, CONAVI, considerando que, se requieren datos técnicos de dicha institución, para poder intervenir la Dirección06 desde la Unidad Técnica de Gestión Vial y la Unidad de Ingeniería de la Municipalidad, y realizar un desarrollo técnico oportuno de colocación de tubería para el desfogue de las aguas pluviales prevenientes de la ruta nacional 127. (Ver ANEXO I) TERCERO: Que en fecha 26 de enero del presente, se recibió la vialidad del Concejo para aprobar el ancho de la vía, la instalación de la tubería, y la constitución de la servidumbre pluvial, el cual se otorgó mediante acuerdo definitivamente aprobado, lo cual era un requisito preceptivo para que la Municipalidad pudiese indiciar las labores.

CUARTO: Que posterior a la aprobación del Convenio citado, se encuentran en proceso de programación operativa las siguientes obras, las cuales se ejecutarán conforme a disponibilidad institucional de maquinaria y personal:

- Instalación de la tubería de desfogue pluvial - Construcción del acceso a la propiedad intervenida - Intervención del tramo de servidumbre pluvial hasta Dirección04 (Ruta Nacional 127).

SEXTO: En razón de lo anterior, y siendo que la Municipalidad requería de la aprobación del Concejo Municipal, el cual ya ha sido otorgado, nos encontramos en la etapa de finalización de las obras, en la cual se construye el desfogue pluvial, se instala la tubería, y se construye la ampliación de la sección transversal de Dirección07 en San Bosco, brindando así una solución definitiva en favor de la comunidad.

Que la Municipalidad de Santa Bárbara como se puede observar mediante las siguientes imágenes, ha atendido en el menor tiempo posible, y sin dilaciones, las solicitudes de los vecinos y explicado técnicamente las obras que se encuentra realizando para brindar una solución definitiva a la problemática ambiental denunciada, mediante acciones concretas, coordinadas y sostenidas que incluyen la coordinación comunitaria y técnica, intervención física de la vía, formalización legal de la solución pluvial, y programación de obras definitivas; con lo que se demuestra el cumplimiento activo de lo ordenado por esta honorable Sala, así como el compromiso institucional de brindar una solución integral y permanente a la situación de la comunidad. Se adjuntan imágenes alusivas a los trabajos en sitio…”.

Redacta el Magistrado Salazar Alvarado; y,

Considerando:

I.- Mediante la Sentencia N° 2020-010461 de las 9:50 horas del 09 de junio del 2020, este Tribunal Constitucional dispuso lo siguiente:

“(…) Se declara con lugar el recurso. Se ordena a Víctor Manuel Hidalgo Solís, en su condición de Alcalde Municipal del cantón de Santa Bárbara de Heredia, así como a Garita Montoya, en su condición de Directora a.i. del Área Rectora de Salud de Santa Bárbara de Heredia, que, dentro del plazo no mayor a SEIS MESES, contados a partir de la notificación de esta sentencia, adopten las medidas que sean necesarias dentro del ámbito de sus respectivas competencias, a fin de que prevean y brinden una solución definitiva a la problemática ambiental denunciada por los recurrentes, término dentro del cual la Administración deberá tomar las medias que correspondan para paliar la situación (…)”.

II.- Sobre la gestión planteada. Por escrito presentado a las 15:04 horas del 14 de enero de 2026, por la recurrente Nombre02, cédula de identidad CED02, presenta gestión de desobediencia de lo ordenado por la Sala en esa oportunidad.

Al respecto, cabe señalar que mediante resolución de las dieciséis horas veintiuno minutos del veintidós de enero de dos mil veintiséis, se confiere audiencia a las autoridades recurridas, para que se refieran y aporten las pruebas correspondientes respecto a los hechos y omisiones que se les atribuyen.

En atención a ello, Alcaldesa a.i. de la MUNICIPALIDAD DE SANTA BÁRBARA de Heredia, atendió la audiencia otorgada por la Sala, y hace un desglose de las acciones tomadas para dar cumplimiento a lo ordenado en esa oportunidad. Al respecto, indicó lo siguiente:

“…PRIMERO: Que el día 9 de enero se realizaron varias visitas técnicas a la comunidad, con el fin de abordar la problemática, y realizar un acercamiento, con el fin de que mediante la socialización se informe debidamente a todos los interesados las acciones que se abordarán para el desarrollo del proyecto de colocación de tubería pluvial, entre las cuales se cita:

I.Socialización con el Promotor Social de la Unidad Técnica de Gestión Vial (UTGV) Alejandro Garita, mediante el cual se informó a la ASADA, quien brinda el servicio de agua potable en la zona, la presencia de tuberías en el centro de la vía, con el fin de coordinar eventuales rupturas por los trabajos a desarrollar en la vía, y mitigar el impacto en la comunidad.

II.Socialización con la comunidad para la cual se contó con la presencia de los señores Alcalde Ing. Víctor Hidalgo Solís, el Ing. Mario Valerín, el Ing. Mario Fernández Mesén, encargado de la UTGV, y el Promotor Social de la UTGV, Alejandro Garita Murillo, y se informó que el tramo de inicio de la servidumbre pluvial y hasta el ingreso a Dirección04 (Dirección05) sería intervenido por la Unidad Técnica de Gestión Vial “UTGV", para la instalación de la tubería y la construcción de acceso a la propiedad donde será instalada. Se realizó un acercamiento con la problemática y un mapeo de los factores por abordar, y se informó, que la finalidad del desarrollo del proyecto lo es la colocación de tubería pluvial. Se conversó directamente con las personas vecinas, visitando casa por casa, indicándoles que el lunes 12 de enero se iniciaría el trabajo de remoción de la capa vegetal ubicada en el centro de la calle, con el fin de ir adelantando trabajos previos de colocación de la misma.

SEGUNDO: Que el día 12 de enero, el personal del Departamento de Ingeniería Municipal y la UTGV, mediante el uso de maquinaria pesada inició labores para el retiro de la cerca divisoria, y limpieza de vegetación y obstáculos en la vía, con el fin de recuperar el ancho útil de la vía, y mejorar el tránsito en el sector.

Lo anterior le fue comunicado en fecha 27 de enero de 2026, mediante oficio UTGVMSB-011-2026, en a la Ingeniera Andrea Madrigal, CONAVI, considerando que, se requieren datos técnicos de dicha institución, para poder intervenir la Dirección06 desde la Unidad Técnica de Gestión Vial y la Unidad de Ingeniería de la Municipalidad, y realizar un desarrollo técnico oportuno de colocación de tubería para el desfogue de las aguas pluviales prevenientes de la Dirección08. (Ver ANEXO I) TERCERO: Que en fecha 26 de enero del presente, se recibió la vialidad del Concejo para aprobar el ancho de la vía, la instalación de la tubería, y la constitución de la servidumbre pluvial, el cual se otorgó mediante acuerdo definitivamente aprobado, lo cual era un requisito preceptivo para que la Municipalidad pudiese indiciar las labores.

CUARTO: Que posterior a la aprobación del Convenio citado, se encuentran en proceso de programación operativa las siguientes obras, las cuales se ejecutarán conforme a disponibilidad institucional de maquinaria y personal:

- Instalación de la tubería de desfogue pluvial - Construcción del acceso a la propiedad intervenida - Intervención del tramo de servidumbre pluvial hasta Dirección04 (Dirección08).

SEXTO: En razón de lo anterior, y siendo que la Municipalidad requería de la aprobación del Concejo Municipal, el cual ya ha sido otorgado, nos encontramos en la etapa de finalización de las obras, en la cual se construye el desfogue pluvial, se instala la tubería, y se construye la ampliación de la sección transversal de Dirección07 en San Bosco, brindando así una solución definitiva en favor de la comunidad.

Que la Municipalidad de Santa Bárbara como se puede observar mediante las siguientes imágenes, ha atendido en el menor tiempo posible, y sin dilaciones, las solicitudes de los vecinos y explicado técnicamente las obras que se encuentra realizando para brindar una solución definitiva a la problemática ambiental denunciada, mediante acciones concretas, coordinadas y sostenidas que incluyen la coordinación comunitaria y técnica, intervención física de la vía, formalización legal de la solución pluvial, y programación de obras definitivas; con lo que se demuestra el cumplimiento activo de lo ordenado por esta honorable Sala, así como el compromiso institucional de brindar una solución integral y permanente a la situación de la comunidad. Se adjuntan imágenes alusivas a los trabajos en sitio…” Por su parte, el Director del Área Rectora de Salud de Santa Barbara, también atendió la audiencia otorgada por la Sala, e indicó lo siguiente:

“…II. ACCIONES REALIZADAS POR EL AREA RESPECTO DE ESTE AMPARO:

Informa además que, como parte final del proceso el CONAVI debe intervenir para realizar el trabajo de conexión desde la Ruta Nacional.

11). Desde el año 2020 hasta el año 2023 la Dirección de Área Rectora de Salud Santa Bárbara, cumplió con el trabajo técnico de identificar las viviendas que contaminan el cauce de la acequia denunciada por los vecinos de San Bosco Purabá de Santa Bárbara, además de notificar los actos administrativos correspondientes para que se resuelva el problema de la contaminación descrita y ha dado el seguimiento respectivo. A partir del año 2024 se continuó con la inspección de casos puntuales identificados que podrían generar contaminación de la acequia denunciada y a partir del 04 de febrero de 2026 se continuará con la identificación de casos, según lo observado en la inspección del 27 de enero de 2026 12). Como se puede observar en las fotografías, los canales aguas pluviales en su mayoría se observan secos y no se observan aguas residuales discurriendo por las alcantarillas. En algunos sectores se observa estancamiento de aguas provenientes de fugas del acueducto (para lo cual se solicitará a la ASADA del sector que proceda con la reparación de estas) y también aguas residuales provenientes de al menos dos viviendas que podrían ser reincidentes en la canalización de aguas residuales al alcantarillado pluvial.

II.- Con base en lo expuesto, y las evidencias adjuntas, esta Sala descarta el incumplimiento alegado por la recurrente, en relación con lo ordenado en la Sentencia N° 2020-010461 de las 9:50 horas del 09 de junio del 2020, al acreditarse que tanto la Municipalidad de recurrida, como el Ministerio de Salud, sí han venido dando atención a lo ordenado en esa oportunidad, en lo que a sus competencias se refiere. Si bien es cierto, aun no se ha concretado una solución definitiva al problema planteado, las acciones tomadas por las autoridades accionadas, dirigidas a solventar esa situación, son claras y verificables; sin embargo, resulta evidente que se trata de un proyecto muy complejo, en el cual deben intervenir otras instituciones públicas. Aun así, ya se cuenta con avances verificados en los trabajos programados. Se dio inicio a la remoción de la capa vegetal ubicada en el centro de la calle, con el fin de ir adelantando trabajos previos de su colocación. El personal del Departamento de Ingeniería Municipal y la UTGV, mediante el uso de maquinaria pesada, iniciaron labores para el retiro de la cerca divisoria, y limpieza de vegetación y obstáculos en la vía, con el fin de recuperar el ancho útil de la vía, y mejorar el tránsito en el sector. Se recibió la vialidad para aprobar el ancho de la vía, la instalación de la tubería, y la constitución de la servidumbre pluvial, el cual se otorgó mediante acuerdo definitivamente aprobado, lo cual era un requisito para que la Municipalidad pudiese indiciar las labores. Actualmente, se encuentran en proceso de programación operativa las siguientes obras:

- Instalación de la tubería de desfogue pluvial - Construcción del acceso a la propiedad intervenida - Intervención del tramo de servidumbre pluvial hasta Dirección04 (Dirección08).

Por lo anterior, esta Sala constata el avance de las obras, así como el cronograma de intervención, por lo que la gestión de incumplimiento resulta improcedente, y así se declara.
