Document Review CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours and thirty-four minutes on trece de febrero de dos mil veintiseis.

Amparo appeal (recurso de amparo) processed under expediente número 25-011764-0007-CO, filed by [Nombre 001], identity card [Valor 001], [Nombre 002], identity card [Valor 002], and [Nombre 003], identity card [Valor 003], against the CONSEJO NACIONAL DE VIALIDAD (CONAVI) and the MINISTERIO DE SALUD.

FINDINGS OF FACT:

  1. 1In a written submission received by this Chamber at 15:36 hrs. on 29 de abril de 2025, the appellants filed an amparo appeal and stated that the culverts (alcantarillas) on the National Highway between Alajuela and Heredia, near San Joaquín de Flores, Heredia, specifically upon reaching Clínica Jorge Volio, are obstructed by rubble, sediment, and garbage, preventing stormwater (aguas pluviales) from flowing. As a result, sewage (aguas negras) discharged into the culvert emits foul odors from the inspection chambers (cajas de registro) located in front of businesses and residences and overflows onto the highway; the situation worsens during the rainy season, when the foul odors are more intense. They allege that, as of the date the appeal was filed, the situation described above continued, even though the Ministerio de Salud had already notified CONAVI of resolución No. MS-DRRSCN-DARSBF-2023, together with sanitary order (orden sanitaria) No. MS-DRRSCN-DARSBF-OS-017-2023 (see evidence submitted). They consider that the foregoing violates their fundamental rights. They request that the appeal be granted, with the consequences established by law.
  2. 2By order issued at 20:06 hrs. on 12 de mayo de 2025, this appeal was admitted for processing, and the respondent authorities were notified on 13 de mayo de 2025.
  3. 3In a written submission filed on 20 de mayo de 2025, MAURICIO SOJO QUESADA, in his capacity as Interim Executive Director of the Consejo Nacional de Vialidad, reported under oath that: “(…) pursuant to the requirements of that sanitary order, the Consejo Nacional de Vialidad complied in a timely and proper manner with the instructions issued by the Ministerio de Salud in the corresponding sanitary order, for which purpose it prepared and submitted the required plan to the Ministerio de Salud. The plan prepared by this Council corresponds to report number DRC-10-2023-1980 (0653), dated 02 de noviembre del 2023, a document whose subject is entitled ‘Compliance with sanitary order No. MS- DRRSCN-DARSBF-OS-017-2023. National Route No.3’—which is attached—as shown in the following image: (…) That report was then sent to the Ministerio de Salud on 03 de noviembre del 2023, as shown in the following image: (…) By email sent at 14 hours 52 minutes on 03 de noviembre del 2023, the Ministerio de Salud approved that schedule, as shown below: (…) Furthermore, as documented in report number CARTA-CONAVI- DRC-10-2025-0664 (0259), dated 14 de mayo del 2025, this Council has acted diligently and has undertaken subsequent actions to address the existing problem, as follows: (…) Also on 14 de mayo de 2025, CONAVI conducted a new technical inspection (inspección técnica) at the site, which confirmed that, despite the cleaning work previously performed, the problems of standing water, accumulated solid waste, vegetation in the storm drains, and accompanying foul odors persisted; accordingly, another cleaning was scheduled for 19 de mayo del 2025.As can be seen, this Administration has at all times acted diligently, within its legal and technical powers, carrying out road-maintenance activities in accordance with the principle of legality (principio de legalidad) established in Article 11 of the Political Constitution and Article 11 of the General Law of Public Administration. It has also coordinated its actions with and notified the relevant entities and continues to actively monitor the area. It is also essential to note—as stated in report CARTA-CONAVI-DRC-10-2025-0664 (0259)—that ‘the reported situation does not concern only a stormwater obstruction problem. During the inspection, wastewater (aguas residuales) was detected in the stormwater drainage system (sistema de drenaje pluvial), suggesting improper connections or sanitary leaks. This type of discharge falls outside the powers of the Consejo Nacional de Vialidad and requires intervention by the Ministerio de Salud, A y A, and the Municipalidad de Flores, as the authorities having jurisdiction over environmental, public-health, and sewerage matters.Conavi has neither the legal authority nor contracts permitting it to intervene in sewage systems or address the source of foul odors caused by organic contamination. For this reason, compliance with the sanitary order has focused on structurally cleaning the stormwater system, but cannot extend to addressing illegal discharges or sources of contamination requiring other forms of technical, regulatory, and budgetary intervention.’ In light of the legal framework currently in force, it is clear that the management, treatment, and final disposal of sanitary wastewater (aguas residuales sanitarias) (sewage) is not the exclusive responsibility of the Consejo Nacional de Vialidad but falls primarily to the Instituto Costarricense de Acueductos y Alcantarillados (AyA), the Ministerio de Salud, and, in certain cases, the municipalities, according to their respective territorial and technical jurisdictions.These functions are governed by specific provisions, such as Ley N.º 2726, Ley General de Salud N.º 5395, Decreto Ejecutivo N.º 39887- S-MINAE, and Código Municipal N.º 7794, which assign those institutions responsibility for operating and supervising sanitary sewer networks, treatment plants, and discharge controls. Accordingly, and pursuant to the principle of legality, each institution must act within the scope of its powers, confirming that a comprehensive response to the problem requires coordinated action by the responsible entities and cannot rest solely with CONAVI. Consequently, in view of the foregoing, the appellants’ assertion that the Consejo Nacional de Vialidad has failed to comply with the instructions of the Ministerio de Salud is untrue because, as demonstrated above, compelling evidence shows that CONAVI has undertaken every action within its powers to address the problem; if additional measures are required, the other entities involved must undertake them, always within the scope of their respective powers.Based on the factual and legal arguments set forth above, it has been demonstrated that the Consejo Nacional de Vialidad has not violated any constitutional right of the appellants; accordingly, it is requested that the amparo appeal be denied.”
  4. 4In a written submission filed on 22 de mayo de 2025, GUSTAVO ESPINOZA CHAVES, in his capacity as Director of the Área Rectora de Salud de Belén Flores, reports under oath that: “(…) It is important to clarify to the Constitutional Chamber that none of the amparo petitioners (amparistas) appears as a complainant before the Área Rectora de Salud Belén Flores. However, Mr. [Nombre 003] (one of the amparo petitioners) is listed as the person in charge of the establishment accused in complaint 37-2023. A report on the facts is requested within the three business days following service of the ruling, for which purpose I state the following: • At 13 hours and 03 minutes on 16 de mayo del 2025, Lic. Diego Hidalgo Barrantes and Licda. Victoria Leiva Pereira, both officials of the Área Rectora de Salud Belén Flores, went to the public roadway and sidewalks at the following address: Ruta nacional 03, across from the Cosechas establishment, in San Joaquín de Flores, Heredia.The purpose was to conduct an inspection to verify the matters stated by the amparo petitioners. It was observed that it was not raining at the time of the inspection. Under these dry-weather conditions, no public-health problem was observed, at least not with the naked eye; no standing water was observed in the curb and gutter, or on the public roadway, nor were any foul odors detected. Although the officials are aware that, in rainy weather, there is usually an odor problem caused by water in the storm sewer (alcantarillado pluvial), because it becomes stagnant and putrefies at this location due to an obstruction in this section of the sewer. At the time of the visit, no water was surfacing from the inspection chambers (cajas de registro) or the storm sewer, nor was any water overflowing onto the sidewalks or public roadway. It therefore cannot be stated conclusively that the storm sewer remains obstructed, since this is not visible to the naked eye; however, according to the persons in charge of businesses in this area along ruta nacional 03, the storm sewer continues to have the same obstruction problem that has persisted for years.Lic. Diego Hidalgo Barrantes is familiar with the case from prior proceedings because, in response to complaints 37 and 119 of 2023, inspections were conducted and CONAVI was served with a sanitary order (orden sanitaria). The inspection concluded at 13 hours and 15 minutes, and a record was made in visual inspection report (acta ocular) 210-2025, which was incorporated at folio 00019 of complaint file 119-2023. In addition, it is appropriate to provide, as background, the actions taken by the Área Rectora de Salud Belén Flores in response to complaints 37-2023 and 119-2023. Complaint 37-2023 • On 24 de marzo 2023, the Área Rectora de Salud Belén Flores received 2 complaints against the establishment COSECHAS San Joaquín de Flores; this establishment is located on the main street next to Carnicería Muñoz (on ruta Nacional primaria 3). The complainants selected the anonymous-complaint category on the unified complaint form.The complaint description states only: “SINCE TUESDAY 29 DE NOVIEMBRE DEL PRESENTE AÑO, SEWAGE HAS BEEN OVERFLOWING ONTO THE SIDEWALK OF THE COSECHAS ESTABLISHMENT IN SAN JOAQUIN DE FLORES, WITH A TERRIBLE ODOR THROUGHOUT THE DAY.” Photographs were attached showing the cover of the inspection chamber and the water overflowing onto the sidewalk. Folios 0001-0008 of complaint files 37-2023 and 0045-2023. • On 11 de abril del 2023, Lic. Diego Hidalgo Barrantes, an official of the Área Rectora de Salud Belén Flores, went to the Cosechas establishment in San Joaquín de Flores, where he was assisted by Alejandra Rodríguez Vargas and subsequently by the person in charge of the establishment, [Nombre 003]. A dye test (prueba de coloración) was conducted in the restroom of the COSECHAS establishment; the result was negative. During the test, Mr. Víquez stated that the actual problem was upstream, explaining that these water overflows were caused by the blockage of the pipes that should channel stormwater, and identifying the section from Clínica Jorge Volio to Cosechas as the possibly obstructed area.He also stated that he had submitted requests concerning the matter to both CONAVI and the Municipalidad de Flores. This inspection ruled out the possibility that the reported water originated from the reported business, COSECHAS. The inspection concluded at 11 hours and 20 minutes. Inspection Report (Acta de Inspección) 88-2023. Folio 0009—complaint file 37-2023. • On 12 de abril 2023, the technical report concerning complaint 37-2023 was prepared as report MS-DRRSCN-DARSBF-451-2023. Among the findings mentioned in this report, it should be noted that: “Regarding this blockage of the storm sewer, it should be observed that it is obstructed by trash and that maintenance of the sewer is the responsibility of CONAVI because it is located within the national road network. Mr. [Nombre 003] (owner of the property where COSECHA is located) submitted a request to CONAVI and received the response that, under its current planning, it has no budget for the requested maintenance.Mr. [Nombre 003] informed the inspector during the visit that he was about to file an amparo action (recurso de amparo) because of the institution’s failure to act. In addition, Mr. [Nombre 003] has been requesting assistance from the Municipalidad and informed us that, on some occasions, the Municipalidad has performed maintenance and cleaning on sections of the route. Mr. Eduardo shared several photographs of the most recent cleaning work; see Anexo 1. It should also be observed that, within the authority of the Ministerio de Salud, a review could be conducted of the proper wastewater disposal by these homes and businesses near the section where this problem exists. However, an obstacle to an optimal review is already apparent: the storm sewer has very few inspection chambers for checking water inlets and outlets. This makes it difficult to conduct the corresponding dye tests, in addition to the sewer blockage problem, which may prevent the dye (sodium fluorescein) from flowing.” This report concludes that: “CONAVI must be informed of the need to clean and maintain the storm sewer along this section so that it may act in accordance with its authority.Under the Ley de Creación del Consejo de Vialidad (CONAVI), ‘CREACIÓN DEL CONSEJO NACIONAL DE VIALIDAD,’ ‘Routine maintenance’ and ‘Periodic maintenance’ of the national road network fall within the authority of this institution.” Folios 0010- 00012 of complaint file 37-2023. • On 12 de abril 2023, an initial technical response report, MS-DRRSCN-DARSBF-452-2023, was prepared and sent to the reported party (the person in charge of the COSECHAS establishment, Mr. [Nombre 003]) at the email address designated for service. Folios 0013- 00015 of complaint file 37-2023. • On 13 de abril 2023, technical response report MS-DRRSCN-DARSBF-451-2023 was sent to the complainant at the email address designated for service. Folio 0016 of complaint file 37-2023. • Sanitary order MS-DRRSCN-DARSBF-OS-17-2023 was then prepared and addressed to Mr./Ms. Mauricio Batalla Otárola, in his capacity as Executive Director of the Consejo Nacional de Vialidad, identification card No. 108380179, to be served at the following address: Edificio CONAVI, 50 metros este y 10 metros norte de la rotonda Betania, San José, Montes de Oca, Mercedes.The order states: “Within 25 business days, a corrective action plan must be submitted to resolve the problem described (blockage of the storm sewer located across from the COSECHAS business in San Joaquín de Flores). The plan must specify the starting and ending dates for the corrective actions—that is, a timeframe for resolving the problem—as well as the person responsible or the contact person. The foregoing is ordered of CONAVI because it is the entity responsible for road maintenance under Ley No. 7798: de Creación del Consejo de Vialidad.” (The order may be seen at folios 00018 through 00020.) • On 20 de abril 2023, through official letter MS-DRRSCN-DARSBF-501-2023, assistance was requested from the Región Central Norte in serving sanitary order MS-DRRSCN-DARSBF-OS-17-2023 on CONAVI because the address was outside the Belén Flores area of jurisdiction. Folio 0017 of complaint file 37-2023. • The sanitary order was served on 10 de mayo 2023, according to CONAVI’s received stamp appearing on the served order.The received stamp evidencing service may be seen at Folio 0020 of complaint file 37-2023. On 11 de mayo del 2023, official letter MS-DRRSCN-1083-2023 was received, through which the Región Central Norte reported that sanitary order MS-DRRSCN-DARSBF-OS-17-2023 had been successfully served ON CONAVI on 10 de mayo 2023. Folio 0021 of complaint file 37-2023. • To date, no response has been received from the complainant. Follow-up concerning the problem is being handled through complaint file 119-2023, described below. Complaint 119-2023 • On 20 de setiembre 2023, the Área Rectora de Salud Belén Flores received official letter MF-DIP-UTGV-CE-040-2023 from the Municipalidad de Flores. The letter reports that the Municipalidad received a complaint filed by Ms. Yorleny Pérez Víquez, who stated that her home is located across from servicentro San Joaquín on the main street, between the motorcycle business and the radiator shop, directly on Ruta Nacional 03.According to this official letter from the Municipalidad, the problem is the same one involving the obstruction of the storm drains along ruta nacional 03. Because coordinating with the appropriate entity is among the duties of the Unidad Técnica de Gestión Vial, they informed us that the case had been referred to CONAVI under service order 3868 so that the corresponding cleaning could be performed. The service order was attached. Folios 0001-0004 of complaint file 119-2023. • At 14 hours on 28 de setiembre del 2023, Lic. Diego Hidalgo Barrantes, accompanied by Licda. Claudia Mannix Sánchez, both officials of the Área Rectora de Salud Belén Flores, went to the Radiadores MV establishment. They were assisted by Mr. Vinicio Prado Bejarano, the person in charge of the establishment. Mr. Prado showed the officials the problem, explaining that his establishment was unable to discharge stormwater into the storm sewer along Ruta 3 and that this water “seeks an outlet,” partially flowing toward an adjoining home (where the mother of the complainant, Yorleny Pérez, resides).This situation is causing standing water at this location. The inspection concluded at 14 hours and 25 minutes and is documented in visual inspection report 261-2023. Folio 0004 of complaint file 119-2023. On 03 de octubre del 2023, inspection report MS-DRRSCN-DARSBF-1281-2023 was prepared and sent to Ana Yancy Pérez, in her capacity as complainant, and to Eng. Mariel Murillo and Mayor Eder Ramírez, both of the Municipalidad de Flores.

This report mentions that the problem had already been inspected by personnel from the Área Rectora de Salud Belén Flores in April 2023 in response to another complaint (number 37-2023), in which the Establecimiento COSECHAS de San Joaquín was reported. Accordingly, during previous inspections, testing ruled out the possibility that the COSECHAS business had improper sewage disposal (disposición de aguas negras), and it was concluded that the problem was an obstruction of the storm sewer system (alcantarillado pluvial). It is also noted that this Área Rectora de Salud had taken action: on May 10, 2023, the health order (orden sanitaria) MS-DRRSCN-DARSBF-OS-017-2023 was served on the Consejo Nacional de Vialidad; a scanned copy of the order is attached. It requested: “Within 25 business days, you must submit a corrective action plan to resolve the problem described (blockage of the storm sewer system located in front of the COSECHAS business in San Joaquín de Flores).

The plan must indicate the start and end dates of the corrective actions, that is, a deadline for resolving the problem, as well as the person responsible or contact person.” As of October 2023, no response had been received from CONAVI (as of the date report MS-DRRSCN-DARSBF-1281-2023 was prepared). Pages 0005-0007 of Complaint File 119-2023. • On October 09, 2023, Official Letter MS-DRRSCN-DARSBF-1285-2023 was sent to Mr. Mauricio Batalla Otárola (Executive Director of the Consejo Nacional de Vialidad, at the email addresses: [email protected];[email protected]). This official letter provided him with the background of the problem and gave CONAVI an update. It concluded by informing CONAVI: “A response is requested from CONAVI regarding health order MS- DRRSCN-DARSBF-OS-017-2023; if no response is received within 10 days, it is recommended that enforcement of the warning contained in the health order (apercibimiento de la orden sanitaria) proceed or that an amparo petition (recurso de amparo) be filed.

The 10-business-day period provided for in Article 32 of the LJC applies to responses to requests for information. ‘(…) In accordance with Article 32 of the Ley de la Jurisdicción Constitucional, when the amparo concerns the right to petition and to receive a prompt decision, established in Article 27 of the Constitución Política, and no deadline for responding has been specified, the violation shall be deemed to occur once 10 business days have elapsed from the date on which the request was submitted to the administrative office, without prejudice to the reasons asserted in the decision on the petition for considering that period insufficient, in view of the circumstances and the nature of the matter. (…)’” (Decision no. 643- 1993 of February 8, 1993). A response to [email protected] would be appreciated.” (The underlining and highlighting do not appear in the original.) Pages 0008-010 of Complaint File 119-2023. • On November 02, 2023, response Official Letter DRC-10-2023-1980(0653) was received from CONAVI regarding health order MS-DRRSCN-DARSBF- OS-17-2023.

The response stated that the situation had been reviewed and that most of the storm drains (tragantes) along the route from servicentro San Joaquín to Cosechas appeared to be filled with sediment. A corrective action plan was attached to the response, clarifying that this was not a matter of simple manual cleaning and that a more invasive intervention in the national route’s stormwater system, which collects water from cantonal routes, might be required. A schedule covering 8 /11/2023 through 14/11/2023 was attached to the response. Pages 0011-0013 of Complaint File 119-2023. • On November 03, 2023, a response was sent to CONAVI at the indicated email addresses: [email protected];[email protected];andrea.madrigal@co navi.go.cr; [email protected]. The response approved the corrective action plan submitted through Official Letter DRC-10-2023-1980 (0653) in response to Health Order No. MS-DRRSCN-DARSBF-OS-017- 2023.

Pages 0014 -00015 of Complaint File 119-2023. • On February 06, 2024, the Área Rectora de Salud Belén Flores sent an email to Eng. Mauricio Sojo, Director de Región Central, Gerencia de Conservación de Vías y Puentes, and Eng. Andrea Madrigal, Ingeniera de Zona 1-9 Heredia, Gerencia de Conservación de Vía y Puentes, both of CONAVI, at the email addresses: [email protected],[email protected],mauricio.sojo@cona vi.go.cr and [email protected]. • The email states: “With the approval of Dr. Gustavo Espinoza Chaves, in his capacity as director of the Área Rectora de Salud Belén Flores, and in follow-up to Official Letter MS-DRRSCN-DARSBF-1457-2023, which communicated the approval of the corrective action plan submitted through Official Letter DRC-10- 2023-1980 (0653) in response to Health Order No. MS-DRRSCN-DARSBF-OS- 017-2023, I hereby request a report on the actions taken, since the problem persists to date and has worsened because stagnant water at several points produces offensive odors, and we have several complaints that we cannot resolve because we cannot conduct dye tests (pruebas de coloración), as the obstruction of the storm sewer system means that there are points where we have no way to review the test results (see photo 1); clearly, there are other points where we have been able to review them and the responsible party is taking action.

I would appreciate confirmation of receipt of this update and that the Área Rectora de Salud Belén Flores be informed of the actions taken to implement the plan submitted under DRC-10-2023-1980 (0653), signed by Eng. Andrea Madrigal Quesada and Eng. Mauricio Sojo Quesada.” (The underlining and highlighting do not appear in the original.) Pages 0016-0017 of Complaint File 119-2023. On the same February 06, 2024, a copy was received of an email issued by Mr. David Barrantes Brenes, Profesional Asistente en Ingeniería Civil, Dirección Ejecutiva, CONAVI. It was addressed to Eng. Mauricio Sojo Quesada Mag, Director Región Central, Gerencia de Conservación de Vías y Puentes, CONAVI, and Eng. Andrea Madrigal Quesada, Ingeniera de Zona 1-9 Heredia, Gerencia de Conservación de Vías y Puentes, CONAVI, and stated: “In response to the email from Mr. Diego Hidalgo Barrantes dated February 5, 2024, concerning compliance with Health Order No. MS-DRRSCN-DARSBF-OS-017-2023.

Mr. Hidalgo Barrantes states that: ‘to date, the problem persists and has worsened because stagnant water at several points produces offensive odors, and we have several complaints that we cannot resolve because we cannot conduct dye tests, as the obstruction of the storm sewer system means that there are points where we have no way to review the test results (see photo 1); clearly, there are other points where we have been able to review them and the responsible party is taking corrective action (see photo 2).’ See images in the attached document. That being the case, and pursuant to instructions from higher authorities, you are requested to submit to the Área Rectora de Salud de Belén Flores the requested report on the actions taken, which must be communicated no later than February 13, 2024. Please copy this Dirección and the undersigned on any action taken concerning this specific matter.

Thank you in advance. Note: Mr. Hildalgo Barrantes is copied on this email. Kind regards.” • Since that date, no further information on the matter has been received from CONAVI or from the complainants. It is thus established that this Ministerio and the Dirección de Área Rectora de Salud Belén- Flores have acted diligently in arranging timely attention to the complaints and in accordance with the corresponding internal administrative procedure within this Organizational Unit. Likewise, in fulfillment of the duty of probity (deber de probidad) applicable in the Administración Pública, and with the objective of serving the public interest together with priority collective needs in safeguarding health, coordination measures have been undertaken with CONAVI, after first conducting MULTIPLE INSPECTIONS to address the problem identified by the amparo petitioners (amparistas) and to verify compliance with the Ley Orgánica del Ministerio de Salud, the Ley General de Salud, and related laws.

In addition, oversight actions were carried out, demonstrating that we have not exceeded reasonable time limits, that the appropriate actions have been taken in accordance with the authority of our Ministerio, and that there has been no excessive and unjustified delay. For all the reasons stated, this Dirección de Área Rectora de Salud rejects the alleged violation of constitutional rights, since it has acted diligently, within the scope of its authority, in addressing the complaints submitted regarding the underlying problem.”

  1. 5In the processing of these proceedings, the statutory requirements have been observed.

Justice Cruz Castro writes the opinion; and,

Whereas:

I. PRELIMINARY MATTER

Before examining the merits of the matter—concerning the alleged violation of the right to prompt and proper proceedings—it must be clarified that, since judgment No. 2008-02545 issued at 8:55 hours on 22 de febrero de 2008, this Chamber has referred to the administrative litigation jurisdiction (jurisdicción contencioso administrativa)—with certain exceptions—those matters in which it is disputed whether the public administration has complied with the time limits established by the Ley General de la Administración Pública (Articles 261 and 325) or by sector-specific laws governing special administrative proceedings, both for issuing a final decision in an administrative proceeding—initiated ex officio or at the request of a party—and for hearing the applicable administrative appeals. This case presents precisely such an exception, because it concerns complaints filed anonymously with the authorities of the Área Rectora de Salud de Belén Flores of the Ministerio de Salud regarding a sewerage problem affecting the environment and the health of neighboring residents. Having clarified this point, the Court proceeds to decide the specific situation raised in this amparo proceeding (amparo).

II. SUBJECT MATTER OF THE APPEAL

The petitioners file an amparo appeal (recurso de amparo) and state that, in the drains along the National Highway between Alajuela and Heredia, near San Joaquín de Flores, Heredia, specifically upon reaching Clínica Jorge Volio, there is an obstruction caused by rubble, sediment, and garbage, which prevents stormwater from flowing. As a result, in the inspection chambers located in front of businesses and homes, the sewage discharged into the sewer gives off foul odors and overflows onto the roadway; the situation worsens during the rainy season, and the foul odors become more intense. They complain that, as of the date on which the appeal was filed, the described situation persisted, even though the Ministerio de Salud had already served CONAVI with resolution No. MS-DRRSCN-DARSBF-2023, together with sanitary order (orden sanitaria) No. MS-DRRSCN-DARSBF-OS-017-2023 (see evidence submitted). They contend that the foregoing violates their fundamental rights. They request that the appeal be granted, with the consequences prescribed by law.

III. PROVEN FACTS

For purposes of deciding this matter, the following facts are deemed duly established, either because they have been substantiated or because the respondent authority failed to address them, as directed in the initial order:

Regarding the facts related to the Consejo Nacional de Vialidad:

On 02 de noviembre de 2023, the Consejo Nacional de Vialidad prepared report number DRC-10-2023-1980 (0653), concerning compliance with sanitary order No. MS-DRRSCN-DARSBF-OS-017-2023 relating to Ruta Nacional No. 3 (see report submitted by the respondent authorities).

On 03 de noviembre de 2023, the Consejo Nacional de Vialidad forwarded report DRC-10-2023-1980 (0653) to the Ministerio de Salud for purposes of complying with the aforementioned sanitary order (see report submitted by the respondent authorities).

On 03 de noviembre de 2023, at 14:52 hours, the Ministerio de Salud approved the schedule contained in the report submitted by the Consejo Nacional de Vialidad (see report submitted by the respondent authorities).

On 14 de mayo de 2025, the Consejo Nacional de Vialidad issued report CARTA-CONAVI-DRC-10-2025-0664 (0259), detailing the measures taken to address the reported problem (see report submitted by the respondent authorities).

On 14 de mayo de 2025, the Consejo Nacional de Vialidad conducted a technical inspection at the site and confirmed the continued pooling of water, accumulation of solid waste, presence of vegetation in storm drains, and foul odors, despite cleaning work previously performed (see report submitted by the respondent authorities).

On 19 de mayo de 2025, the Consejo Nacional de Vialidad scheduled a new cleaning of the stormwater drainage system at the inspected site (see report submitted by the respondent authorities).

Regarding the facts related to the Área Rectora de Salud de Belén Flores:

None of the petitioners appears as a complainant before the Área Rectora de Salud Belén Flores. However, Mr. [Nombre 003] (one of the petitioners) is listed as the person in charge of the establishment identified in complaint 37-2023 (see report submitted by the respondent authorities).

On 24 de marzo de 2023, the Área Rectora de Salud Belén Flores received two anonymous complaints against the establishment Cosechas in San Joaquín de Flores, reporting an overflow of foul-smelling sewage onto the sidewalk outside the premises (see report submitted by the respondent authorities).

On 11 de abril de 2023, officials from the Área Rectora de Salud Belén Flores conducted an inspection at the establishment Cosechas and performed a dye test in the restroom, which yielded a negative result; they therefore ruled out the possibility that the reported water originated from the business (see report submitted by the respondent authorities).

On 12 de abril de 2023, the Área Rectora de Salud Belén Flores prepared technical report MS-DRRSCN-DARSBF-451-2023, determining that the problem involved an obstruction of the stormwater drainage system and that its maintenance was the responsibility of the Consejo Nacional de Vialidad (see report submitted by the respondent authorities).

On 12 de abril de 2023, the Área Rectora de Salud Belén Flores prepared technical report MS-DRRSCN-DARSBF-452-2023 and forwarded it to the person in charge of the establishment Cosechas (see report submitted by the respondent authorities).

On 13 de abril de 2023, the Área Rectora de Salud Belén Flores forwarded technical report MS-DRRSCN-DARSBF-451-2023 to the complainant (see report submitted by the respondent authorities).

On 20 de abril de 2023, the Área Rectora de Salud Belén Flores requested assistance from the Región Central Norte in serving sanitary order MS-DRRSCN-DARSBF-OS-17-2023 on the Consejo Nacional de Vialidad (see report submitted by the respondent authorities).

On 10 de mayo de 2023, the Consejo Nacional de Vialidad received notice of sanitary order MS-DRRSCN-DARSBF-OS-17-2023 (see report submitted by the respondent authorities).

On 11 de mayo de 2023, the Región Central Norte reported that the sanitary order had been successfully served on the Consejo Nacional de Vialidad on 10 de mayo de 2023 (see report submitted by the respondent authorities).

On 20 de setiembre de 2023, the Área Rectora de Salud Belén Flores received an official communication from the Municipalidad de Flores forwarding a complaint regarding obstructed drains on Ruta Nacional 03, a matter referred to the Consejo Nacional de Vialidad for action (see report submitted by the respondent authorities).

On 28 de setiembre de 2023, officials from the Área Rectora de Salud Belén Flores conducted an inspection at the establishment Radiadores MV, during which they confirmed that stormwater could not drain into the sewer and that standing water was affecting an adjoining residence (see report submitted by the respondent authorities).

On 03 de octubre de 2023, the Área Rectora de Salud Belén Flores prepared report MS-DRRSCN-DARSBF-1281-2023, reiterating that the problem involved an obstruction of the stormwater drainage system and that a sanitary order had previously been served on the Consejo Nacional de Vialidad, without any response having been received as of that date (see report submitted by the respondent authorities).

On 09 de octubre de 2023, the Área Rectora de Salud Belén Flores forwarded official communication MS-DRRSCN-DARSBF-1285-2023 to the Consejo Nacional de Vialidad, requesting a response regarding compliance with the sanitary order and warning of possible measures in the absence of a response (see report submitted by the respondent authorities).

On 02 de noviembre de 2023, the Consejo Nacional de Vialidad forwarded official communication DRC-10-2023-1980 (0653), through which it submitted a corrective action plan and a schedule for addressing the stormwater drainage problem (see report submitted by the respondent authorities).

On 03 de noviembre de 2023, the Área Rectora de Salud Belén Flores approved the corrective action plan submitted by the Consejo Nacional de Vialidad (see report submitted by the respondent authorities).

On 06 de febrero de 2024, the Área Rectora de Salud Belén Flores requested a report from the Consejo Nacional de Vialidad concerning the measures taken, after observing that the problem persisted and had worsened (see report submitted by the respondent authorities).

On 06 de febrero de 2024, officials from the Consejo Nacional de Vialidad requested that its departments submit a report on the measures implemented to comply with the sanitary order, with a deadline of 13 de febrero de 2024 (see report submitted by the respondent authorities).

On 16 de mayo de 2025, officials from the Área Rectora de Salud Belén Flores conducted an inspection on Ruta Nacional 03, in front of the establishment Cosechas, during which they observed no sanitary problems or standing water due to dry weather conditions, although the report noted the history of stormwater drainage obstructions during the rainy season (see report submitted by the respondent authorities).

IV. ON THE FUNDAMENTAL RIGHT TO A HEALTHY AND ECOLOGICALLY BALANCED ENVIRONMENT

On numerous occasions, this Court has elaborated on the substance of this right, established in Article 50 of the Constitución Política. Environmental protection is an appropriate mechanism for safeguarding and improving everyone’s quality of life, making it necessary for the Public Authorities to intervene with respect to factors that may disturb its balance and hinder individuals from developing and living in a healthy environment. The State serves as the guarantor of the protection and preservation of the environment and natural resources. In this regard, oversight and enforcement in environmental matters and activities constitute an essential function of the State; therefore, with respect to environmental protection, the functions of governance, oversight, and enforcement in environmental matters belong to the State and are entrusted to its various administrative agencies.

V. REGARDING CONSTITUTIONAL JURISDICTION IN ENVIRONMENTAL MATTERS

As consistently reiterated in the case law of this Chamber, constitutional jurisdiction in environmental matters cannot be extended to the point of becoming a mechanism for verifying the technical criteria set forth in regulations or by administrative authorities in environmental matters; rather, it is limited to determining whether the competent state agencies have fulfilled the obligation imposed upon them by article 50 of the Political Constitution to act responsibly and promptly with respect to environmental protection. It has also been held that the admissibility of the remedy of amparo (recurso de amparo) is contingent upon proof of the existence of an infringement or threat to one or more of the rights or guarantees recognized in the Political Charter or in the international human rights instruments signed by the country. This latter circumstance underscores the inherently summary nature of amparo proceedings (proceso de amparo), whose procedure is ill-suited to the taking of slow and complex evidence or to the need to determine beforehand—with declaratory effect—whether rights below the constitutional level cited by the parties as part of the factual basis of the remedy of amparo or the statutory report (informe de ley), as applicable, actually exist, since it is evident that this Chamber lacks jurisdiction to make such a determination.

In these circumstances, it is not appropriate for the Chamber to issue any ruling, whether favorable or unfavorable, in such cases, because determining whether fundamental rights have been infringed first requires that the dispute be resolved at the level of ordinary law.

VI. REGARDING THE STATE’S OBJECTIVE OBLIGATION TO PROTECT HUMAN LIFE

This Constitutional Court has recognized the State’s objective obligation to protect human life and has ruled on administrative omissions that threaten road safety and the physical integrity of individuals. In this regard, reference should be made to the provisions of judgment Nº2008-18443, issued at 18:01 hours on 11 de diciembre de 2008, which stated:

“Before analyzing the specific case, it is appropriate to note what this Chamber has said regarding the State’s objective obligation to protect human life. The right to life, frequently analyzed together with the right to physical integrity, has traditionally been understood as a right with negative content; that is, its purpose was limited to asserting a claim against the State that it refrain from taking actions aimed at ending the physical existence of individuals, such as torture or the death penalty, or that it punish public and private persons who threaten the life and integrity of others through the criminal justice system. Nevertheless, the current trend is to impose various positive duties upon the State, in the sense that it must not interfere with the physical existence of individuals and must also act to protect them against the many dangers that threaten it, whether those dangers arise from actions by the State itself, from other persons, or even from nature itself.

Thus, for example, environmental matters have become, at least in our country, matters of a constitutional nature, since the right to a healthy and ecologically balanced environment was elevated to the status of a fundamental right. It must be clarified, however, that the objective existence of an obligation on the part of the State to protect the right to life does not necessarily entail a subjective right of individuals to demand through judicial bodies that a particular measure be taken, but it does entail a right to have appropriate measures taken to protect that right when public authorities are openly negligent. Accordingly, the State assumes the obligation to regulate those areas of social life from which dangers to the physical existence of the inhabitants of its territory may arise, whether through legislation, regulations, agreements, or other measures related to administrative organization and procedures, and individuals have the subjective right to have such action taken diligently.

Thus, the ability to judicially demand, through amparo, a specific type of affirmative action by the State in fulfillment of its duty to protect the life and physical integrity of its inhabitants is limited to cases in which an imminent danger to those rights is clearly established. Consequently, if, for example, a particular community considered it necessary to have a hospital to serve its residents, or any other public works project, it should not demand one through amparo but through the previously established mechanisms and before the competent bodies and entities, which must consider the request and determine its technical feasibility, a process that does not necessarily entail a favorable response. It follows from the foregoing that intervention by the constitutional jurisdiction is viable only when the State, acting through its competent bodies, has demonstrably failed to address the claims made by the country’s inhabitants in the exercise of their rights (see, to this effect, judgment number 2003-11519, issued at diez horas con treinta minutos on diez de octubre de dos mil tres).”

VII. REGARDING THE FACTS RELATED TO THE CONSEJO NACIONAL DE VIALIDAD

After analyzing the evidence submitted, this Court finds that the fundamental rights of the protected party have been infringed. The reports submitted by the representatives of the respondent authorities—which are deemed to have been given under oath, subject to the consequences, including criminal penalties, provided for in article 44 of the Law governing this Jurisdiction—and the evidence submitted for the resolution of the matter duly establish that, although the Ministerio de Salud issued and served sanitary order (orden sanitaria) No. MS-DRRSCN-DARSBF-OS-017-2023 upon the Consejo Nacional de Vialidad, and although that institution prepared a response plan and schedule (official letter DRC-10-2023-1980 (0653)), which was submitted to and approved by the governing health authority on 03 de noviembre de 2023, the reported problem was not effectively and promptly corrected. Objective conditions related to standing water, accumulated waste, functional obstruction of the stormwater drainage system, and foul odors persist and were even documented during CONAVI’s own technical inspection of 14 de mayo de 2025, with additional cleaning work scheduled for 19 de mayo de 2025.

Consequently, it is evident that the measures implemented were insufficient to achieve the result required under the protection afforded by constitutional article 50, insofar as this situation affects the environment and, by its very nature, has an impact on the health and quality of life of persons who live in or travel through the area.

The Chamber notes, however, that CONAVI itself stated that wastewater was detected in the stormwater system during the inspections, suggesting improper connections or sewage discharges that would exceed its strict jurisdiction over road maintenance. This clarification does not relieve the respondent authority of its constitutional duty to act diligently within the scope of its authority or to coordinate effectively with the entities responsible for intervening when the observed condition presents concurrent health or environmental dimensions. In this regard, the principle of legality requires each body to act within the scope of its authority; nevertheless, with respect to environmental protection and the protection of life and physical integrity, public institutions are required to adopt appropriate and coordinated measures to neutralize risks and to avoid fragmented responses that, in practice, perpetuate the reported harm. Under the case law cited in considerando VI, intervention by this jurisdiction is appropriate in the event of omissions or manifestly insufficient actions that demonstrate proven inertia or a lack of effectiveness in protecting fundamental rights.

Accordingly, the infringement arises because, despite the existence of a sanitary order and a plan formally approved since noviembre de 2023, the situation persists at the time the amparo is decided, with no comprehensive and verifiable solution shown to have been implemented along the reported section of Ruta Nacional 03. The remedy must therefore be granted, and the Consejo Nacional de Vialidad must be ordered, within the scope of its authority, to effectively carry out the actions necessary to maintain and rehabilitate the sector’s stormwater drainage system, ensuring the free flow of water and eliminating the conditions that cause standing water, obstructions, accumulated waste, and related harm. In addition, it must formally coordinate, with written documentation, with the Ministerio de Salud, AyA, and Municipalidad de Flores so that, within their respective areas of authority, they identify and address any improper connections or sewage discharges affecting the stormwater system and generating foul odors. It must report to this Chamber on the actions taken and the results obtained within the period specified in the operative portion of this judgment.

VIII. REGARDING THE FACTS RELATED TO THE ÁREA RECTORA DE SALUD DE BELÉN FLORES

After analyzing the evidence submitted, this Court finds that the fundamental rights of the protected party have been infringed. The reports submitted by the representatives of the respondent authorities—which are deemed to have been given under oath, subject to the consequences, including criminal penalties, provided for in article 44 of the Law governing this Jurisdiction—and the evidence submitted for the resolution of the matter duly establish that, in response to complaints received in 2023, the Área Rectora de Salud de BelÉN Flores carried out various verification and enforcement measures: it conducted inspections; used a dye test to rule out the establishment initially identified in the complaint as the source of the reported water; technically concluded that the problem was related to an obstruction of the storm sewer located on a national route; and, within the scope of its powers, issued sanitary order No. MS-DRRSCN-DARSBF-OS-017-2023 to CONAVI.

It also made subsequent requests and follow-up efforts, including formal communications in octubre de 2023 and requests for reports in febrero de 2024. Likewise, in mayo de 2025, it conducted an inspection at the site in front of the Cosechas establishment, documenting that, under dry weather conditions, the reported overflow or standing water was not visible to the naked eye, although it acknowledged the prior history showing that, during the rainy season, the problem tends to manifest itself through offensive odors caused by stagnation.

Nevertheless, the protection afforded by Article 50 of the Constitution requires not only the formal issuance of administrative actions (actuaciones administrativas), but also their effectiveness in ensuring real and timely protection of the environment and public health. In the case at hand (sub lite), the health authority itself has acknowledged, on the one hand, the persistence and worsening of the problem over time (as recorded in the follow-up actions) and, on the other, the existence of practical limitations on confirming sanitary responsibility through dye testing due to the obstruction of the system, which demonstrates an ongoing risk requiring a coordinated and effective institutional response. Within that framework, although the Ministerio de Salud does not replace the technical authority of the road agency or that of the sanitary sewerage operator, it does have duties of governance, control, and health oversight, as well as powers to require and verify compliance with corrective measures and, where appropriate, to activate the relevant administrative mechanisms to ensure the cessation of unsanitary conditions that jeopardize public health.

Thus, the established violation relates to the failure, over time, to provide an effective and verifiable solution to the reported condition, despite the health intervention undertaken since 2023 and the acknowledgment that the problem persists, particularly during the rainy season. Consequently, the amparo proceeding (recurso de amparo) must be granted, and the Área Rectora de Salud de Belén Flores must be ordered, within the scope of its authority, to strengthen and continue monitoring the case until the reported source of unsanitary conditions has been effectively eliminated, adopting the appropriate control and oversight measures to verify compliance with the corrective actions incumbent upon CONAVI, as well as requesting and coordinating, when necessary, the intervention of AyA and the Municipalidad de Flores to address the public-health dimension (possible wastewater discharges or improper connections) that may be affecting the stormwater system; the foregoing must be carried out through documented actions, with inspections under relevant conditions (including, if appropriate, during the rainy season), and the results must be reported to this Chamber within the period specified in the operative portion of this judgment.

VIII. NOTE BY JUSTICE CASTILLO VÍQUEZ REGARDING PROMPT AND EFFECTIVE ADMINISTRATIVE JUSTICE

I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and effective justice in administrative proceedings, the legal dispute must be heard by the Contentious-Administrative Courts and not by this Chamber. However, with the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, it has been established that this right is eligible for judicial protection through the amparo proceeding established by Article 32 of the Ley de la Jurisdicción Constitucional, in relation to Article 27 of the Constitución Política de la República de Costa Rica, in cases where the petitioner considers that the material actions of the Administration, its administrative acts, or its response are affecting the petitioner’s fundamental rights. In my view, the recently enacted legislation does not mean that this Court must modify its line of precedent, since, pursuant to section 7 of its Law, it alone is responsible for defining its own jurisdiction.

Therefore, except for those constitutional-law disputes that this Chamber itself has recognized as exceptional circumstances and that may indeed be heard in this jurisdiction through the constitutional amparo guarantee proceeding, in all other cases, and for the reasons given by this Court (judgment N° 2008-02545 of 8:55 hours on 22 de febrero de 2008), jurisdiction lies with the judges of the contentious-administrative jurisdiction, all of which is consistent with section 25 of the Convención Americana sobre Derechos Humanos, the Law of the Constitution (values, principles, and rules), and the corresponding statutory provisions, based on a logical, systemic, and purposive interpretation of the legal system.

IX. NOTE BY JUSTICE SALAZAR ALVARADO

In environmental matters, it is my view that, if the Public Administration has already intervened, consideration and resolution of the matter fall within the contentious-administrative jurisdiction. Nevertheless, I do consider the merits of the matter when other rights of the persons affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy a healthy, pollution-free environment (Article 50 of the Constitución Política), as occurs in this case, in which the appellant reports the obstruction of the drains located on the national highway near San Joaquin de Flores, causing sewage to overflow and emit foul odors, a situation that results in pollution, offensive odors, and a risk of disease. The appellant asserts that, despite having filed the corresponding complaints, the underlying problem has not been resolved. The situation described constitutes an exception to my general position on this subject; I therefore consider it necessary for this Constitutional Court to examine the merits of the matter in order to verify or reject the appellant’s allegations.

X. DISSENTING OPINION OF JUSTICE GARRO VARGAS

Although I have joined the majority in cases raising similar grievances, upon further consideration I believe that objections of this kind must be brought through the ordinary legal channels. This is especially so because the record shows that the complaints were filed anonymously, and therefore there is no duly identified person who requires the protection of this jurisdiction against the aforementioned threats to fundamental rights or who belongs to a vulnerable group requiring the intervention of this Chamber. In my view, that element alone is sufficient to deny the amparo proceeding. This Court has noted that, based on the effects that the Ley de la Jurisdicción Constitucional assigns to the amparo proceeding (Articles 41 and 49), it must be concluded that any person may file such a proceeding, provided that the person identifies the individuals whose fundamental rights the person believes were violated (see, for example, judgments numbers 2019-003879, 2021-017532, and 2022-009133, among others).

In the case at hand, the appellants seek amparo relief ordering the Consejo Nacional de Viabilidad to comply with the health measure issued by the Ministerio de Salud regarding the obstruction of drains that prevents stormwater from flowing. They assert that this has caused sewage to overflow onto the roads, with the aggravating circumstance that foul odors are produced.

I consider that, in such circumstances, the failure to act should first be challenged before the competent authorities and then, if the omission continues, before the contentious-administrative jurisdiction. That judicial forum, with more extensive tools at its disposal, can examine the underlying complaint in depth, assess the administrative conduct, rule on jurisdiction—national road network or cantonal road network—issue specific orders to address the identified problem, and, of course, monitor compliance with the judgment. Consequently, respectfully and from my perspective, it does not appear proper, on the basis of a generic allegation of supposed inaction by the respondent authority, for this jurisdiction to adjudicate administrative inaction that more appropriately belongs before the contentious-administrative jurisdiction.

In view of the foregoing, I dissent and deny the amparo proceeding.

XII. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are hereby advised that, if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computerized, magnetic, optical, or telematic device, or produced using new technologies, such materials must be collected from the Clerk’s Office within a maximum period of 30 business days counted from notification of this judgment. Otherwise, any material not collected within that period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, Article LXXXI.

THEREFORE:

The proceeding is GRANTED. Consequently, MAURICIO SOJO QUESADA, in his capacity as Acting Executive Director of the Consejo Nacional de Vialidad del Ministerio de Obras Públicas y Transportes, and GUSTAVO ESPINOZA CHAVES, in his capacity as Director of the Área Rectora de Salud de Belén Flores del Ministerio de Salud, or whoever holds those positions, are ordered, within SIX MONTHS counted from notification of this decision, with each authority acting within the scope of its powers, to coordinate and take the measures necessary to maintain and rehabilitate the stormwater drainage system in the area, so as to ensure the free flow of water and eliminate the conditions causing ponding, obstructions, waste accumulation, and related adverse effects; furthermore, if necessary, they must coordinate formally and through documented means with AyA and the Municipalidad de Flores so that, within their respective areas of authority, any improper connections or sanitary discharges affecting the stormwater system and generating foul odors are identified and addressed, and they must report to this Chamber on the actions taken and the results obtained within the aforementioned period.

The respondent authorities are advised that, pursuant to Article 71 of the Law governing this jurisdiction, anyone who receives an order issued in an amparo proceeding that the person must comply with or enforce, and who fails to comply with or enforce it, shall be punished by imprisonment for three months to two years, or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The State is ordered to pay the costs, damages, and losses caused by the facts underlying this ruling, which shall be quantified during enforcement of the judgment before the contentious-administrative jurisdiction. Justice Castillo files a note. Justice Salazar Alvarado files a note. Justice Garro Vargas dissents and denies the amparo proceeding. Let notice be given.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta y cuatro minutos del trece de febrero de dos mil veintiseis .

Recurso de amparo que se tramita en el expediente número 25-011764-0007-CO interpuesto por [Nombre 001], cédula de identidad [Valor 001], [Nombre 002], cédula de identidad [Valor 002] y [Nombre 003], cédula de identidad [Valor 003], contra el CONSEJO NACIONAL DE VIALIDAD (CONAVI) y el MINISTERIO DE SALUD.

RESULTANDO:

  1. 1Por escrito recibido en esta Sala a las 15:36 hrs. del 29 de abril de 2025, la parte recurrente interpone recurso de amparo y expone que, en las alcantarillas existentes en la carretera Nacional, Alajuela, Heredia, a la altura de San Joaquín de Flores, Heredia, específicamente, al llegar a la Clínica Jorge Volio hay obstrucción con escombro, sedimento y basura, lo que no permite que fluyan las aguas pluviales. Como consecuencia de lo expuesto, en las cajas de registro existentes frente a los comercios y casas de habitación, las aguas negras que vierten en la alcantarilla, emanan olores fétidos, y se desbordan sobre la carretera, y se agrava para la temporada de lluvia, y los malos olores se perciben con mayor intensidad. Reclaman que, a la fecha de la interposición del recurso, la situación descrita continuaba, pese a que el Ministerio de Salud ya le notificó al CONAVI la resolución No. MS-DRRSCN-DARSBF-2023, con la orden sanitaria No. MS-DRRSCN-DARSBF-OS-017-2023 (véase prueba aportada). Estiman que lo expuesto viola sus derechos fundamentales. Solicitan que se declare con lugar el recurso, con las consecuencias de ley.
  2. 2Mediante auto de las 20:06 hrs. del 12 de mayo de 2025 se cursó el presente recurso y se notificó a las autoridades recurridas el 13 de mayo de 2025.
  3. 3Por escrito presentado el 20 de mayo de 2025, informa bajo juramento MAURICIO SOJO QUESADA, en condición de Director Ejecutivo a.i del Consejo Nacional de Vialidad que: “(…) en virtud de lo ordenado por dicha orden sanitaria, el Consejo Nacional de Vialidad atendió en tiempo y forma lo indicado por el Ministerio de Salud en la orden sanitaria respectiva, para lo cual elaboró y presentó el plan requerido ante el Ministerio de Salud. El plan elaborado por este Consejo corresponde al informe número DRC-10-2023-1980 (0653) de fecha 02 de noviembre del 2023, documento denominado en su asunto “Atención de orden sanitaria No. MS- DRRSCN-DARSBF-OS-017-2023. Ruta Nacional No.3”-el cual se adjunta-, según la siguiente imagen: (…) Ahora bien, dicho informe fue remitido al Ministerio de Salud, el día 03 de noviembre del 2023, como consta en la siguiente imagen: (…) Y mediante correo de las 14 horas 52 minutos del 03 de noviembre del 2023 se dio la Aprobación del del dicho cronograma por parte del Ministerio de Salud, como de seguido se observa: (…) Ahora bien, este Consejo actuando diligentemente- como consta en informe número CARTA-CONAVI- DRC-10-2025-0664 (0259) de fecha 14 de mayo del 2025- ha realizado posteriores diligencias para atender la problemática que se presenta, según se detalla: (…) También en fecha 14 de mayo de 2025, el CONAVI realizó una nueva inspección técnica en el sitio, en la cual se constató que, a pesar de las labores de limpieza ejecutadas previamente, persistía el problema de empozamiento de aguas, acumulación de residuos sólidos y presencia de vegetación en tragantes, acompañado de malos olores; por ende, se programa una nueva limpieza para el 19 de mayo del 2025.Como se observa, en todo momento, esta Administración ha actuado con diligencia, apegada a sus competencias legales y técnicas, ejecutando las acciones propias del mantenimiento vial, conforme al principio de legalidad establecido en el artículo 11 de la Constitución Política y el artículo 11 de la Ley General de la Administración Pública. Además, ha coordinado y notificado sus actuaciones a las entidades correspondientes, y mantiene el monitoreo activo de la zona. Ahora es vital mencionar-como se indica en el informe CARTA-CONAVI-DRC-10-2025-0664 (0259)-que “la situación denunciada no se refiere únicamente a un problema de obstrucción pluvial. Durante la inspección se detectó la presencia de aguas residuales en el sistema de drenaje pluvial, lo que sugiere conexiones indebidas o fugas de carácter sanitario. Este tipo de descarga excede las competencias del Consejo Nacional de Vialidad y requiere la intervención del Ministerio de Salud, A y A y la Municipalidad de Flores, como autoridades con jurisdicción en materia ambiental, sanitaria y de alcantarillado.El Conavi no cuenta con potestades ni contratos para intervenir sistemas de aguas negras, ni para resolver el origen de los olores fétidos producto de la contaminación orgánica. Por esta razón, el cumplimiento de la orden sanitaria se ha enfocado en limpieza estructural del sistema pluvial, pero no puede, extenderse a resolver descargas ilegales o focos de contaminación que requieren otro tipo de intervención técnica, normativa y presupuestaria” . A la luz del ordenamiento jurídico vigente, resulta claro que la gestión, tratamiento y disposición final de las aguas residuales sanitarias (aguas negras) no constituye una responsabilidad exclusiva del Consejo Nacional de Vialidad, sino que corresponde, de forma principal, al Instituto Costarricense de Acueductos y Alcantarillados (AyA), al Ministerio de Salud y, en ciertos casos, a las municipalidades, según el ámbito territorial y técnico que les compete.Estas funciones están reguladas por normas específicas, como la Ley N.º 2726, la Ley General de Salud N.º 5395, el Decreto Ejecutivo N.º 39887- S-MINAE, y el Código Municipal N.º 7794, que asignan a dichas instituciones la operación y fiscalización de redes sanitarias, plantas de tratamiento y control de vertidos. En ese sentido, y conforme al principio de legalidad, cada institución debe actuar dentro del marco de sus competencias, lo que confirma que el abordaje integral de la problemática requiere la actuación coordinada de las entidades responsables, y no puede recaer únicamente sobre el CONAVI. Consecuentemente, en virtud de lo anterior, no es cierto, lo manifestado por los recurrentes, en cuanto a que el Consejo Nacional de Vialidad no ha atendido lo ordenado por el Ministerio de Salud, por cuanto, como se denota de lo expresado en líneas previas, existen pruebas contundentes que demuestra que el CONAVI a gestionado todo lo que se encuentre dentro de sus competencias para atender la problemática; ahora bien, si existen más acciones por realizar corresponderá a las demás entidades involucradas atenderlas siempre en apego a sus competencias.De conformidad con los argumentos de hecho y de derecho expuestos, se deja demostrado que el Consejo Nacional de Vialidad no ha violentado ningún derecho constitucional de los recurrentes, por lo cual se solicita se declare sin lugar el recurso de amparo.”
  4. 4Por escrito presentado el 22 de mayo de 2025, informa bajo juramento GUSTAVO ESPINOZA CHAVES, en condición de Director del Área Rectora de Salud de Belén Flores que: “(…) Es importante aclararle a la Sala Constitucional que ninguno de los amparistas aparece como denunciantes ante el Área Rectora de Salud Belén Flores. Sin embargo, el señor [Nombre 003] (uno de los amparistas) sí figura como encargado del Establecimiento acusado en la denuncia 37-2023. Se solicita rendir informe sobre los hechos en los tres días hábiles siguientes a la notificación de la resolución, para lo cual expongo: • Al ser las 13 horas con 03 minutos del 16 de mayo del 2025, el Lic. Diego Hidalgo Barrantes, y la Licda. Victoria Leiva Pereira, ambos funcionarios del Área Rectora de Salud Belén Flores se presentaron a la vía pública y aceras en la Dirección: Ruta nacional 03, frente al establecimiento Cosechas, en San Joaquín de Flores, Heredia.Lo anterior con el objetivo de efectuar una inspección para verificar lo expuesto por los amparistas. Se observa que al momento de la inspección no está lloviendo, con esta característica de clima seco, no se observó un problema sanitario, al menos no a simple vista, no se observan aguas estancadas en el cordón de caño, ni en la vía pública, ni se perciben malos olores. Aunque es conocido por los funcionarios que con condición climática de lluvia sí suele presentar un problema de olores que emanan de las aguas en el alcantarillado pluvial debido a que se estancan y se pudren en este punto, por la obstrucción que se presenta en esta zona del alcantarillado. Al momento de la visita no hay aguas aflorando de las cajas de registro, ni del alcantarillado pluvial, tampoco hay aguas que se desborden en las aceras o en la vía pública, por lo que no se puede afirmar de forma contundente que el alcantarillado pluvial siga estando obstruido ya que no es observable a simple vista; sin embargo según los encargados de los comercios de esta zona sobre la ruta nacional 03 el alcantarillado pluvial sigue presentando el mismo problema de obstrucción que se ha venido presentando por años.El Lic. Diego Hidalgo Barrantes conoce como antecedente el caso, ya que en atención a la denuncia 37 y 119 del año 2023 se efectuaron inspecciones, y se notificó al CONAVI una orden sanitaria. La inspección culmina al ser las 13 horas con 15 minutos y se deja constancia en el acta ocular 210-2025 que se incorporó en el folio 00019 del Expediente de denuncia 119-2023. Además, es de resorte aportar como antecedente, lo actuado por el Área Rectora de Salud Belén Flores en atención a las denuncias 37-2023 y 119-2023. Denuncia 37-2023 • El 24 de marzo 2023 el Área Rectora de Salud Belén Flores recibieron 2 denuncias contra el establecimiento COSECHAS San Joaquín de Flores, este local se ubica en la calle principal contiguo a la Carnicería Muñoz ( en la ruta Nacional primaria 3). Los denunciantes seleccionaron la categoría de denuncia anónima en el formulario unificado de denuncias. La descripción de la denuncia indica únicamente: “EN LA ACERA DEL LOCAL COSECHAS EN SAN JOAQUIN DE FLORES DESDE EL MARTES 29 DE NOVIEMBRE DEL PRESENTE AÑO SE DESBORDA AGUAS NEGRAS CON UN OLOR FATAL DURANTE TODO EL DIA” .Y se adjuntó fotografías de la tapa de la caja de registro con las aguas que se desbordan en la acera. Folios 0001-0008 de Expediente de denuncia 37-2023 y 0045-2023. • El 11 de abril del 2023 el Lic. Diego Hidalgo Barrantes, funcionario del Área Rectora de Salud Belén Flores se presentó al establecimiento Cosechas de San Joaquín de Flores, fue atendido por Alejandra Rodríguez Vargas y posteriormente por el encargado del establecimiento [Nombre 003]. Se procedió a efectuar prueba de coloración en servicio sanitario del establecimiento COSECHAS, el resultado fue negativo. Durante la prueba, el señor Víquez comentó que el verdadero problema está aguas arriba, indica que estos desbordamientos de aguas son provocados por el taponamiento de las tuberías que deberían canalizar las aguas pluviales, y señala como posible sector obstruido desde la Clínica Jorge Volio hasta Cosechas, también indica que es una gestión que este ha pedido tanto en CONAVI como a la Municipalidad de Flores.Con esta inspección se descartó que las aguas denunciadas provengan del comercio denunciado COSECHAS. La inspección culmina al ser las 11 horas con 20 minutos. Acta de Inspección 88-2023. Folio 0009- Expediente de denuncia 37-2023. • El 12 de abril 2023 se elabora el informe técnico de atención de la denuncia 37-2023 bajo informe MS-DRRSCN-DARSBF-451-2023, entre los resultados que se mencionan en este informe cabe destacar que “Respecto a este taponamiento del alcantarillado pluvial, cabe observar que el mismo está obstruido con basura, y que el mantenimiento de alcantarillado compete a CONAVI, por ubicarse en red vial nacional, el señor [Nombre 003] ( propietario de la propiedad donde se ubica COSECHA), planteó una solicitud al CONAVI y obtuvo la respuesta de que no tienen presupuesto para el mantenimiento solicitado según la planificación actual. El Señor [Nombre 003] indicó al inspector durante la visita que está próximo a interponer un recurso de amparo por esta inacción de la institución.Además, el señor [Nombre 003], ha venido solicitando apoyo a la Municipalidad, y nos indica que en ocasiones la Municipalidad ha efectuado mantenimiento y limpieza de sectores del trayecto, el señor Eduardo compartió algunas fotografías de las limpiezas más recientes, ver anexo 1. También cabe la observación que, como competencia del Ministerio de Salud, cabría una revisión de la debida disposición de aguas residuales de estas viviendas y comercios cercanos al trayecto que presenta este problema, sin embargo desde ya se puede observar un obstáculo para una revisión optima, el alcantarillado pluvial tiene muy pocos registros para revisar salidas y entradas de aguas, esto dificulta la labor de efectuar las pruebas de coloración respectivas, aunado al problema de taponamiento del alcantarillado el cual posiblemente no permita que fluya el colorante ( fluoresceína sódica).” Este informe concluye que “Se debe informar a CONAVI sobre la necesidad de limpieza y mantenimiento del alcantarillado pluvial de este trayecto para que actúen de acuerdo a sus competencias.Según la Ley de Creación del Consejo de Vialidad (CONAVI) “CREACIÓN DEL CONSEJO NACIONAL DE VIALIDAD” el “Mantenimiento rutinario” y “Mantenimiento periódico” de la red nacional vial son competencia de esta institución” . Folios 0010- 00012 del Expediente de denuncia 37-2023. • El 12 de abril 2023 se elabora un primer informe técnico de atención MS-DRRSCN- DARSBF-452-2023 dirigido al denunciado (encargado del establecimiento COSECHAS: Sr. [Nombre 003]) al correo señalado para notificaciones. Folios 0013- 00015 del Expediente de denuncia 37-2023. • El 13 de abril 2023 se envía a la denunciante el informe técnico de atención MS- DRRSCN-DARSBF-451-2023 al correo señalado para notificaciones. Folio 0016 del Expediente de denuncia 37-2023. • Se procede a la elaboración de la orden sanitaria MS-DRRSCN-DARSBF-OS-17- 2023, dirigida Sr(a): Mauricio Batalla Otárola en calidad de director ejecutivo del Consejo Nacional de Vialidad Cédula de identidad Nº 108380179, para notificarse a la Dirección: Edificio CONAVI, 50 metros este y 10 metros norte de la rotonda Betania, San José, Montes de Oca, Mercedes.La ordenanza indica “En un plazo de 25 días hábiles deberá presentar un plan de acciones correctivas para solventar la problemática descrita (taponamiento del alcantarillado pluvial ubicado frente al comercio COSECHAS en San Joaquín de Flores), en el plan debe señalarse la fecha de inicio y fin de acciones correctivas es decir un plazo para solventar el problema, así como la persona responsable o de contacto. Lo anterior se ordena al CONAVI por ser el ente encargado de conservación de carreteras de acuerdo con Ley No. 7798: de Creación del Consejo de Vialidad.” (la orden se puede ver en los folios 00018 al 00020) • El 20 de abril 2023, mediante oficio MS-DRRSCN-DARSBF-501-2023 se solicitó apoyo a la Región Central Norte para la notificación de la orden sanitaria MS- DRRSCN-DARSBF-OS-17-2023 a CONAVI, por tratarse de una dirección fuera del área de competencia Belén Flores. Folio 0017 del Expediente de denuncia 37-2023. • La orden sanitaria fue notificada el 10 de mayo 2023, según el sello de Recibido de CONAVI, que consta en la orden notificada.Se puede ver el sello de recibido de la notificación en el Folio 0020 del Expediente de denuncia 37-2023. El 11 de mayo del 2023, se recibió el oficio MS-DRRSCN-1083-2023, mediante el cual la Región Central Norte, informa que se logró la notificación de la orden sanitaria MS-DRRSCN-DARSBF-OS-17-2023 A CONAVI el día 10 de mayo 2023. Folio 0021 del Expediente de denuncia 37-2023 • A la fecha no se recibió respuesta de la denunciante. El seguimiento de la problemática se brinda a través del expediente de la denuncia 119-2023 que se presenta a continuación. Denuncia 119-2023 • El 20 de setiembre 2023 el área rectora de salud Belén Flores recibió el oficio MF- DIP-UTGV-CE-040-2023, de parte de la Municipalidad de Flores, en este oficio se informa que la Municipalidad recibió una denuncia interpuesta por la señora Yorleny Pérez Víquez, quien indica su vivienda está ubicada frente al servicentro San Joaquín en la calle principal, entre el negocio de Motos y el Taller de Radiadores, justamente en sobre la Ruta Nacional 03.Según este oficio de la Municipalidad el problema es el mismo referido a la obstrucción en las alcantarillas de la ruta nacional 03, y siendo parte de las funciones de la Unidad Técnica de Gestión Vial coordinar con el ente correspondiente, nos informan que se trasladó el caso a CONAVI con orden de servicio 3868 para que se realice la limpieza correspondiente. Y se adjunta la orden de servicio. Folios 0001-0004 de Expediente de denuncia 119-2023. • Al ser las 14 horas del 28 de setiembre del 2023 el licenciado Diego Hidalgo Barrantes, en compañía de la Licda. Claudia Mannix Sánchez, ambos funcionarios del Área Rectora de Salud Belén Flores se presentaron al establecimiento Radiadores MV. brindó atención el señor Vinicio Prado Bejarano, encargado del establecimiento. El señor Prado muestra el problema a los funcionarios, indicando que desde su establecimiento no está pudiendo disponer las aguas pluviales hacia el alcantarillado pluvial sobre Ruta 3, y esto agua “busca salida” parcialmente hacia una vivienda colindante (donde habita la mamá de la denunciante Yorleny Pérez), esta situación está provocando aguas estancadas en este sitio.La inspección culminó al ser las 14 horas con 25 minutos, y consta en el acta de inspección ocular 261-2023. Folio 0004 de Expediente de denuncia 119-2023. El 03 de octubre del 2023 se elaboró y se envió el informe de inspección MS- DRRSCN-DARSBF-1281-2023 el cual se dirigió a Ana Yancy Pérez, en calidad de denunciante, a la Ing. Mariel Murillo y al Alcalde Eder Ramírez, ambos de la Municipalidad de Flores. Este informe menciona que el problema ya había sido inspeccionado por personal del área rectora de Salud Belén Flores en abril 2023 en atención a otra denuncia (número 37-2023) en las que se denunció al Establecimiento COSECHAS de San Joaquín, por lo cual en inspecciones anteriores mediante la realización de la prueba se descarta que el comercio COSECHAS tenga una inadecuada disposición de aguas negras, y se llegó a la conclusión que el problema es la obstrucción del alcantarillado pluvial, también se señala que esta área Rectora de Salud había actuado, el pasado 10 de mayo 2023 se notificó al Consejo Nacional de Vialidad la orden Sanitaria MS-DRRSCN-DARSBF-OS-017-2023, se adjunta escaneada la orden, se solicitó “En un plazo de 25 días hábiles deberá presentar un plan de acciones correctivas para solventar la problemática descrita ( taponamiento del alcantarillado pluvial ubicado frente al comercio COSECHAS en San Joaquín de Flores), en el plan debe señalarse la fecha de inicio y de fin de acciones de correctivas es decir un plazo para solventar el problema, así como la persona responsable o contacto” para octubre 2023 no se había recibido respuesta de parte de CONAVI (a la fecha de la elaboración del informe MS-DRRSCN-DARSBF-1281-2023).Folios 0005-0007 de Expediente de denuncia 119-2023. • El 09 de octubre 2023 se envió Oficio MS-DRRSCN-DARSBF-1285-2023 al señor Sr(a) Mauricio Batalla Otárola (Director Ejecutivo del Consejo Nacional de Vialidad a los correos: [email protected];[email protected]). En este oficio se le da el antecedente del problema, y se brinda actualización al CONAVI. Se concluye indicando al CONAVI: “Se solicita respuesta al CONAVI respecto a la orden sanitaria MS- DRRSCN-DARSBF-OS-017-2023; si no se tuviera respuesta en 10 días se recomienda proceder con ejecución del apercibimiento de la orden sanitaria o interposición de un recurso de amparo. El plazo de 10 días hábiles previsto en el artículo 32 de la LJC es de aplicación para la respuesta de las solicitudes de información. “(…) De conformidad con lo dispuesto en el artículo 32 de la Ley de la Jurisdicción Constitucional, cuando el amparo se refiera al derecho de petición y de obtener pronta resolución, establecido en el artículo 27 de la Constitución Política y no hubiere plazo señalado para contestar, se entenderá que la violación se produce una vez transcurridos 10 días hábiles desde la fecha en que fue presentada la solicitud en la oficina administrativa, sin perjuicio de que en la decisión del recurso se aprecien las razones que se aduzcan para considerar insuficiente ese plazo, atendidas las circunstancias y la índole del asunto.(…)”. (Resolución n.° 643- 1993 del 8 de febrero de 1993). Se agradece respuesta al correo [email protected]” . (El subrayado y resaltado no corresponden al original) Folios 0008-010 de Expediente de denuncia 119-2023. • El 02 de noviembre 2023 se recibió respuesta oficio DRC-10-2023-1980(0653) por parte del CONAVI, en atención a la orden sanitaria MS-DRRSCN-DARSBF- OS-17-2023. En la respuesta se informa que se ha procedido con una revisión de la situación, observando que la mayoría de los tragantes se observan sedimentados en el trayecto desde el servicentro San Joaquín hasta Cosechas, se adjuntó a esta respuesta un plan de acciones correctivas, aclarando que no se trata de una simple limpieza manual, y que sería posible que se requiriera de una intervención más invasiva al sistema pluvial de la ruta nacional, la cual recolecta aguas de rutas cantonales. Se adjuntó a la respuesta un cronograma que consideró del 8 /11/2023 al 14/11/2023.Folios 0011-0013 de Expediente de denuncia 119-2023. • El 03 de noviembre del 2023 se brinda respuesta a CONAVI a los correos señalados: [email protected];[email protected];andrea.madrigal@co navi.go.cr; [email protected]. En la respuesta se brinda la Aprobación de plan de acciones correctivas presentado mediante oficio DRC-10-2023-1980 (0653) en atención a la Orden Sanitaria No. MS-DRRSCN-DARSBF-OS-017- 2023. Folios 0014 -00015 de Expediente de denuncia 119-2023. • El 06 de febrero 2024, el área rectora de Salud Belén Flores, envió un correo electrónico a los Ing. Mauricio Sojo, Director de Región Central, Gerencia de Conservación de Vías y puentes y a la Ing. Andrea Madrigal, Ingeniera de Zona 1-9 Heredia, Gerencia de Conservación de vía y Puentes, ambos de CONAVI, a los correos: [email protected],[email protected],mauricio.sojo@cona vi.go.cr y [email protected]. • En el correo se indica: “Con el visto bueno del Dr. Gustavo Espinoza Chaves, en calidad de director del Área Rectora de Salud Belén Flores, y en seguimiento al oficio MS-DRRSCN-DARSBF-1457-2023, en el cual se comunicó la aprobación del plan de acciones correctivas presentado mediante oficio DRC-10- 2023-1980 (0653) en atención a la Orden Sanitaria No. MS-DRRSCN-DARSBF-OS- 017-2023, me permito solicitarles informe sobre lo actuado, ya que a la fecha la problemática continúa y se ha agravado pues el agua estancada en varios puntos genera olores ofensivos, y tenemos varias denuncias que no podemos resolver, ya que no podemos hacer pruebas de coloración pues al estar el alcantarillado pluvial obstruido hay puntos en los que no tenemos como revisar los resultados de las pruebas ( ver foto 1), claramente hay otros puntos donde sí hemos podido revisar y el responsable está haciendo.Agradeceré me confirmen el recibido de esta actualización, y se informe al Área Rectora de Salud Belén Flores sobre lo actuado para atender el plan presentado por DRC-10-2023-1980 (0653) firmado por la Ing. Andrea Madrigal Quesada y el Ing. Mauricio Sojo Quesada” . (El subrayado y resaltado no corresponden al original) Folios 0016-0017 de Expediente de denuncia 119-2023. El mismo 06 de febrero del 2024, se recibió copia de un correo emitido por el señor David Barrantes Brenes, profesional Asistente en Ingeniería Civil, Dirección Ejecutiva, CONAVI. En el que se dirigió al Ing. Mauricio Sojo Quesada Mag, Director Región Central Gerencia de Conservación de Vías y Puentes, CONAVI y a la Ing. Andrea Madrigal Quesada, Ingeniera de Zona 1-9 Heredia, Gerencia de Conservación de Vías y Puentes, CONAVI y les indica: “En atención al correo del Sr. Diego Hidalgo Barrantes, del 5 de febrero de 2024, el cual refiere a la atención a la Orden Sanitaria No. MS-DRRSCN-DARSBF-OS-017-2023.El Sr Hidalgo Barrantes, menciona que: "a la fecha la problemática continúa y se ha agravado pues el agua estancada en varios puntos genera olores ofensivos, y tenemos varias denuncias que no podemos resolver, ya que no podemos hacer pruebas de coloración pues al estar el alcantarillado pluvial obstruido hay puntos en los que no tenemos como revisar los resultados de las pruebas ( ver foto 1), claramente hay otros puntos donde sí hemos podido revisar y el responsable está haciendo subsanando ( ver foto 2)." Ver imagenes en el documento adjunto. Siendo de esa forma, y con instrucciones superiores se les solicita que presenten al Área Rectora de Salud de Belén Flores, el informe de las acciones realizadas que requieren, el cual deberá de comunicarse a más tardar el próximo 13 de febrero de 2024. Se les ruega mantener copiada a esta Dirección y al suscrito, de cualquier gestión realizada de este tema en específico.Gracias de antemano. Nota: se le brinda copia de este correo al Sr. Hildalgo Barrantes. Saludos cordiales.” • Desde esta fecha no se ha recibido más información al respecto por parte del CONAVI, ni de los denunciantes. Queda evidenciado así que este Ministerio y la Dirección de Área Rectora de Salud Belén- Flores ha actuado de forma diligente en gestionar de forma oportuna la atención de las denuncias, y según el trámite interno administrativo correspondiente en esta Unidad Organizativa, así mismo por el deber de probidad presente en la Administración Pública y con el objetivo de satisfacer el interés público en conjunto con las necesidades colectivas prioritarias en resguardo de la salud, se han realizado diligencias de coordinación con el CONAVI no sin antes efectuar MÚLTIPLES INSPECCIONES para abordar la problemática indicada por los amparistas para corroborar el cumplimiento de Ley Orgánica del Ministerio de Salud, la Ley General de Salud y conexas, adicionalmente se ejecutaron actuaciones de control, por lo cual se evidencia que no nos hemos extralimitado en plazos irrazonables, que se han ejecutado las acciones correspondientes según la competencia de nuestro Ministerio, o en una duración excesiva e injustificada.Por todo lo señalado, rechaza esta Dirección de Área Rectora de Salud, una supuesta violación de derechos constitucionales, por cuanto se ha actuado de forma diligente, según nuestras competencias para la atender las denunciadas presentadas sobre la problemática de fondo.”
  5. 5En la substanciación de este proceso se han observado las prescripciones de ley.

Redacta el Magistrado Cruz Castro; y,

Considerando:

I. DE PREVIO

De previo a analizar el fondo del asunto –por la presunta violación del derecho a un procedimiento pronto y cumplido– debe aclararse que, a partir de la sentencia No. 2008-02545 de las 8:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones– aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos, pautados por la Ley General de la Administración Pública (artículos 261 y 325) o por las leyes sectoriales relativas a los procedimientos administrativos especiales, tanto para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– como para conocer de los recursos administrativos procedentes. Precisamente, en este caso se plantea un supuesto de excepción, pues se está ante una denuncias interpuestas de manera anónima ante las autoridades del Área Rectora de Salud de Belén Flores del Ministerio de Salud por un problema de alcantarillado que afecta el ambiente y la salud de los vecinos. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.

II. OBJETO DEL RECURSO

La parte recurrente interpone recurso de amparo y expone que, en las alcantarillas existentes en la carretera Nacional, Alajuela, Heredia, a la altura de San Joaquín de Flores, Heredia, específicamente, al llegar a la Clínica Jorge Volio hay obstrucción con escombro, sedimento y basura, lo que no permite que fluyan las aguas pluviales. Como consecuencia de lo expuesto, en las cajas de registro existentes frente a los comercios y casas de habitación, las aguas negras que vierten en la alcantarilla, emanan olores fétidos, y se desbordan sobre la carretera, y se agrava para la temporada de lluvia, y los malos olores se perciben con mayor intensidad. Reclaman que, a la fecha de la interposición del recurso, la situación descrita continuaba, pese a que el Ministerio de Salud ya le notificó al CONAVI la resolución No. MS-DRRSCN-DARSBF-2023, con la orden sanitaria No. MS-DRRSCN-DARSBF-OS-017-2023 (véase prueba aportada). Estiman que lo expuesto viola sus derechos fundamentales. Solicitan que se declare con lugar el recurso, con las consecuencias de ley.

III. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos, según lo prevenido en el auto inicial:

Sobre los hechos relacionados con el Consejo Nacional de Vialidad:

El 02 de noviembre de 2023, el Consejo Nacional de Vialidad elaboró el informe número DRC-10-2023-1980 (0653), correspondiente a la atención de la orden sanitaria No. MS-DRRSCN-DARSBF-OS-017-2023, relativa a la Ruta Nacional No. 3 (ver informe rendido por parte de las autoridades accionadas).

El 03 de noviembre de 2023, el Consejo Nacional de Vialidad remitió al Ministerio de Salud el informe DRC-10-2023-1980 (0653) para la atención de la orden sanitaria indicada (ver informe rendido por parte de las autoridades accionadas).

El 03 de noviembre de 2023, a las 14:52 horas, el Ministerio de Salud aprobó el cronograma contenido en el informe presentado por el Consejo Nacional de Vialidad (ver informe rendido por parte de las autoridades accionadas).

El 14 de mayo de 2025, el Consejo Nacional de Vialidad emitió el informe CARTA-CONAVI-DRC-10-2025-0664 (0259), en el cual detalló las diligencias realizadas para atender la problemática denunciada (ver informe rendido por parte de las autoridades accionadas).

El 14 de mayo de 2025, el Consejo Nacional de Vialidad realizó una inspección técnica en el sitio, en la cual constató la persistencia de empozamiento de aguas, acumulación de residuos sólidos, presencia de vegetación en tragantes y malos olores, pese a labores de limpieza efectuadas previamente (ver informe rendido por parte de las autoridades accionadas).

El 19 de mayo de 2025, el Consejo Nacional de Vialidad programó la ejecución de una nueva limpieza del sistema pluvial en el sitio inspeccionado (ver informe rendido por parte de las autoridades accionadas).

Sobre los hechos relacionados con el Área Rectora de Salud de Belén Flores:

Ninguno de los recurrentes aparece como denunciantes ante el Área Rectora de Salud Belén Flores. Sin embargo, el señor [Nombre 003] (uno de los recurrentes) sí figura como encargado del Establecimiento acusado en la denuncia 37-2023 (ver informe rendido por parte de las autoridades accionadas).

El 24 de marzo de 2023, el Área Rectora de Salud Belén Flores recibió dos denuncias anónimas contra el establecimiento Cosechas en San Joaquín de Flores, en las que se reportó el desbordamiento de aguas negras con malos olores en la acera del local (ver informe rendido por parte de las autoridades accionadas).

El 11 de abril de 2023, funcionarios del Área Rectora de Salud Belén Flores realizaron una inspección en el establecimiento Cosechas, efectuaron una prueba de coloración en el servicio sanitario, cuyo resultado fue negativo, y descartaron que las aguas denunciadas provinieran del comercio (ver informe rendido por parte de las autoridades accionadas).

El 12 de abril de 2023, el Área Rectora de Salud Belén Flores elaboró el informe técnico MS-DRRSCN-DARSBF-451-2023, en el que determinó que el problema correspondía a la obstrucción del alcantarillado pluvial y que su mantenimiento competía al Consejo Nacional de Vialidad (ver informe rendido por parte de las autoridades accionadas).

El 12 de abril de 2023, el Área Rectora de Salud Belén Flores elaboró el informe técnico MS-DRRSCN-DARSBF-452-2023 y lo remitió al encargado del establecimiento Cosechas (ver informe rendido por parte de las autoridades accionadas).

El 13 de abril de 2023, el Área Rectora de Salud Belén Flores remitió a la denunciante el informe técnico MS-DRRSCN-DARSBF-451-2023 (ver informe rendido por parte de las autoridades accionadas).

El 20 de abril de 2023, el Área Rectora de Salud Belén Flores solicitó apoyo a la Región Central Norte para notificar al Consejo Nacional de Vialidad la orden sanitaria MS-DRRSCN-DARSBF-OS-17-2023 (ver informe rendido por parte de las autoridades accionadas).

El 10 de mayo de 2023, el Consejo Nacional de Vialidad recibió la notificación de la orden sanitaria MS-DRRSCN-DARSBF-OS-17-2023 (ver informe rendido por parte de las autoridades accionadas).

El 11 de mayo de 2023, la Región Central Norte informó que se logró la notificación de la orden sanitaria al Consejo Nacional de Vialidad el 10 de mayo de 2023 (ver informe rendido por parte de las autoridades accionadas).

El 20 de setiembre de 2023, el Área Rectora de Salud Belén Flores recibió un oficio de la Municipalidad de Flores en el que se trasladó una denuncia por obstrucción de alcantarillas en la Ruta Nacional 03, caso remitido al Consejo Nacional de Vialidad para su atención (ver informe rendido por parte de las autoridades accionadas).

El 28 de setiembre de 2023, funcionarios del Área Rectora de Salud Belén Flores realizaron una inspección en el establecimiento Radiadores MV, en la que se constató la imposibilidad de evacuar aguas pluviales hacia el alcantarillado y la existencia de aguas estancadas que afectaban una vivienda colindante (ver informe rendido por parte de las autoridades accionadas).

El 03 de octubre de 2023, el Área Rectora de Salud Belén Flores elaboró el informe MS-DRRSCN-DARSBF-1281-2023, en el que reiteró que el problema correspondía a la obstrucción del alcantarillado pluvial y que previamente se había notificado una orden sanitaria al Consejo Nacional de Vialidad, sin haberse recibido respuesta a esa fecha (ver informe rendido por parte de las autoridades accionadas).

El 09 de octubre de 2023, el Área Rectora de Salud Belén Flores remitió el oficio MS-DRRSCN-DARSBF-1285-2023 al Consejo Nacional de Vialidad, solicitando respuesta respecto al cumplimiento de la orden sanitaria y advirtiendo sobre posibles medidas ante la falta de respuesta (ver informe rendido por parte de las autoridades accionadas).

El 02 de noviembre de 2023, el Consejo Nacional de Vialidad remitió el oficio DRC-10-2023-1980 (0653), mediante el cual presentó un plan de acciones correctivas y un cronograma para atender la problemática del alcantarillado pluvial (ver informe rendido por parte de las autoridades accionadas).

El 03 de noviembre de 2023, el Área Rectora de Salud Belén Flores aprobó el plan de acciones correctivas presentado por el Consejo Nacional de Vialidad (ver informe rendido por parte de las autoridades accionadas).

El 06 de febrero de 2024, el Área Rectora de Salud Belén Flores solicitó al Consejo Nacional de Vialidad un informe sobre las acciones realizadas, al advertir que la problemática persistía y se había agravado (ver informe rendido por parte de las autoridades accionadas).

El 06 de febrero de 2024, funcionarios del Consejo Nacional de Vialidad solicitaron a sus dependencias la presentación de un informe sobre las acciones ejecutadas para atender la orden sanitaria, con plazo al 13 de febrero de 2024 (ver informe rendido por parte de las autoridades accionadas).

El 16 de mayo de 2025, funcionarios del Área Rectora de Salud Belén Flores realizaron una inspección en la Ruta Nacional 03, frente al establecimiento Cosechas, en la que no observaron problemas sanitarios ni aguas estancadas debido a condiciones climáticas secas, aunque se consignó el antecedente de problemas de obstrucción del alcantarillado pluvial en época lluviosa (ver informe rendido por parte de las autoridades accionadas).

IV. SOBRE EL DERECHO FUNDAMENTAL A UN AMBIENTE SANO Y ECOLÓGICAMENTE EQUILIBRADO

En reiteradas ocasiones este Tribunal ha desarrollado el contenido de este derecho, contemplado en el artículo 50 de la Constitución Política. La protección del ambiente es un mecanismo adecuado para tutelar y mejorar la calidad de vida de todos, lo que hace necesaria la intervención de los Poderes Públicos sobre los factores que pueden alterar su equilibrio y obstaculizar que la persona se desarrolle y desenvuelva en un ambiente sano. El Estado se constituye en el garante en la protección y tutela del medio ambiente y los recursos naturales. En este sentido, el control y fiscalización de la materia y actividad ambiental se constituye en una función esencial del Estado, por lo que, tratándose de la protección ambiental, las funciones de rectoría, control y fiscalización de la materia ambiental, corresponden al Estado, a cargo de las diversas dependencias administrativas.

V. RESPECTO A LA COMPETENCIA CONSTITUCIONAL EN MATERIA AMBIENTAL

Tal y como ha sido reiterado en la jurisprudencia de esta Sala, la competencia constitucional en materia ambiental no puede extenderse al punto en que se convierta en un verificador de los criterios técnicos vertidos en las normas o por las autoridades administrativas en materia ambiental, sino que se limita a constatar si las dependencias estatales competentes han cumplido la obligación que les impone el artículo 50 de la Constitución Política, de asumir una actuación responsable y oportuna respecto a la protección del ambiente. Se ha sostenido también, que la procedencia del recurso de amparo está condicionada a que se acredite la existencia de una perturbación o amenaza a uno o más de los derechos o garantías contemplados en la Carta Política o en los instrumentos internacionales de derechos humanos suscritos por el país. Esta última circunstancia pone de relieve el carácter eminentemente sumario del proceso de amparo, cuya tramitación no se aviene bien con la práctica de diligencias probatorias lentas y complejas, o con la necesidad de entrar previamente a examinar -con carácter declarativo- si existen en realidad o no derechos de rango infra constitucional que las partes citen como parte del elenco fáctico del recurso de amparo o del informe de ley, según sea el caso, toda vez que es evidente que esa es una competencia de la que esta Sala carece.

Ante esta situación, no resulta procedente que la Sala vierta pronunciamiento alguno (positivo o negativo) en estos casos, porque para dilucidar si ha habido infracción o no de derechos fundamentales primero se debe resolver dicho conflicto en el plano de la legalidad.

VI. SOBRE LA OBLIGACIÓN OBJETIVA DEL ESTADO DE TUTELAR LA VIDA HUMANA

Este Tribunal Constitucional ha reconocido la obligación objetiva del Estado de tutelar la vida humana y se ha pronunciado sobre las omisiones administrativas que atentan contra la seguridad vial y la integridad física de las personas. Sobre el particular, cabe referir lo dispuesto en sentencia Nº2008-18443 de las 18:01 horas del 11 de diciembre de 2008, donde se indicó:

“Previo análisis del caso concreto, conviene indicar lo dicho por esta Sala en cuanto a la obligación objetiva del Estado de tutelar la vida humana, en el sentido que ha sido usual que el derecho a la vida, frecuentemente analizado junto con el derecho a la integridad física, haya sido entendido como un derecho de contenido negativo, es decir, que su objeto se limitaba a la pretensión contra el Estado de que se abstuviera de realizar acciones dirigidas a eliminar la existencia física de las personas, por ejemplo, la tortura o la pena de muerte, o bien, que castigara a las personas, públicas y privadas, que atentaran contra la vida e integridad de los otros, a través del sistema penal. No obstante, la tendencia actual es imponer al Estado diversas conductas positivas, en el sentido de que no debe perturbar la existencia física de las personas y, además, debe actuar en tutela de su protección, ante los múltiples peligros que la acechan, bien sea que ellos provengan de acciones del Estado mismo o de otras personas, e inclusive, de la misma naturaleza.

De ahí que, por ejemplo, los temas ambientales han pasado a ser, al menos en nuestro país, un asunto de índole constitucional, puesto que el derecho a un ambiente sano y ecológicamente equilibrado fue elevado a rango de derecho fundamental. Ahora bien, es menester aclarar que la existencia objetiva de una obligación del Estado en lo referente a la protección del derecho a la vida no apareja, ineludiblemente, un derecho subjetivo de las personas a exigir, a través de los organismos judiciales, que se tome una medida determinada, pero sí a que se tomen las medidas idóneas en tutela de ese derecho, ante actitudes abiertamente negligentes de las autoridades públicas. En consecuencia, se trata de que el Estado adquiere la obligación de regular las áreas de la vida social de las cuales puedan surgir peligros para la existencia física de los habitantes de su territorio, ya sea través de la ley, de reglamentos, de acuerdos o de otras medidas relacionadas con la organización y los procedimientos administrativos y del derecho subjetivo de las personas a que así se proceda, en forma diligente.

Así, la posibilidad de exigir judicialmente, a través de amparo, un tipo específico de actividad prestacional por parte del Estado en cumplimiento de su deber de protección a la vida e integridad física de sus habitantes, es restringida a la clara verificación de un peligro inminente contra esos derechos de las personas, de forma tal que si, por ejemplo, una determinada comunidad estimara necesario contar con un hospital para la atención de sus pobladores (o de cualquier otra obra pública) no es por la vía del amparo que se debe exigir, sino a través de los mecanismos previamente establecidos y ante los órganos y entes competentes, quienes deberán atender la petición y resolver su procedencia técnica, que no implica necesariamente una respuesta positiva. De lo anterior, se desprende que la injerencia de la jurisdicción constitucional solamente es viable ante la inercia comprobada del Estado, a través de sus órganos competentes en atender las demandas que en ejercicio de sus derechos realicen los habitantes del país (ver en este sentido la sentencia número 2003-11519 de las diez horas con treinta minutos del diez de octubre de dos mil tres)”.

VII. SOBRE LOS HECHOS RELACIONADOS CON EL CONSEJO NACIONAL DE VIALIDAD

Después de analizar los elementos probatorios aportados, este Tribunal acredita la lesión a los derechos fundamentales de la parte amparada. De los informes rendidos por los representantes de las autoridades recurridas -que se tienen dados bajo juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y la prueba aportada para la resolución del asunto ha sido debidamente acreditado que, pese a que el Ministerio de Salud emitió y notificó al Consejo Nacional de Vialidad la orden sanitaria No. MS-DRRSCN-DARSBF-OS-017-2023, y que esa institución elaboró un plan y cronograma de atención (oficio DRC-10-2023-1980 (0653), el cual fue remitido y aprobado por el órgano rector sanitario el 03 de noviembre de 2023, la problemática denunciada no fue corregida de forma efectiva y oportuna, pues persisten condiciones objetivas asociadas al empozamiento de aguas, acumulación de residuos, obstrucción funcional del sistema de drenaje pluvial y malos olores, incluso constatadas en inspección técnica del propio CONAVI del 14 de mayo de 2025, con programación de nuevas labores de limpieza para el 19 de mayo de 2025.

En consecuencia, se evidencia que las acciones ejecutadas resultaron insuficientes para materializar el resultado exigible en el marco de la tutela del artículo 50 constitucional, en tanto se trata de una situación que afecta el ambiente y, por su propia naturaleza, incide en la salud y calidad de vida de las personas que habitan o transitan en el área.

Ahora bien, la Sala advierte que el propio CONAVI indicó que durante las inspecciones se detectó presencia de aguas residuales en el sistema pluvial, lo cual sugiere conexiones indebidas o descargas sanitarias que excederían su competencia estricta de mantenimiento vial. Tal precisión no exime a la autoridad recurrida de su deber constitucional de actuación diligente dentro del ámbito de sus competencias, ni de coordinar eficazmente con las entidades llamadas a intervenir cuando el fenómeno observado revele aristas sanitarias o ambientales concurrentes. En este sentido, el principio de legalidad impone que cada órgano actúe dentro de su marco competencial; sin embargo, en materia de tutela ambiental y protección de la vida e integridad física, las instituciones públicas están obligadas a adoptar medidas idóneas y coordinadas para neutralizar riesgos, evitando respuestas fragmentarias que, en la práctica, perpetúen la afectación denunciada. Conforme a la jurisprudencia citada en el considerando VI, la intervención de esta jurisdicción es procedente ante omisiones o actuaciones manifiestamente insuficientes que traduzcan inercia comprobada o falta de eficacia en la protección de derechos fundamentales.

Así las cosas, la lesión se configura porque, a pesar de la existencia de una orden sanitaria y de un plan formalmente aprobado desde noviembre de 2023, al momento de resolverse el amparo la situación persiste, sin que conste una solución integral y verificable en el tramo denunciado de la Ruta Nacional 03. En consecuencia, corresponde estimar el recurso y ordenar al Consejo Nacional de Vialidad que, dentro del ámbito de sus competencias, ejecute de manera efectiva las acciones necesarias de mantenimiento y rehabilitación del sistema de drenaje pluvial del sector, de forma que se asegure el libre escurrimiento de aguas y se eliminen las condiciones que generan empozamientos, obstrucciones, acumulación de residuos y afectaciones conexas; además, deberá coordinar formalmente y de manera documentada con el Ministerio de Salud, el AyA y la Municipalidad de Flores, para que, en lo que a cada cual competa, se identifiquen y atiendan eventuales conexiones indebidas o descargas sanitarias que estén incidiendo en el sistema pluvial y generando olores fétidos, debiendo informar a esta Sala sobre lo actuado y los resultados obtenidos dentro del plazo que se indica en la parte dispositiva de esta sentencia.

VIII. SOBRE LOS HECHOS RELACIONADOS CON EL ÁREA RECTORA DE SALUD DE BELÉN FLORES

Después de analizar los elementos probatorios aportados, este Tribunal acredita la lesión a los derechos fundamentales de la parte amparada. De los informes rendidos por los representantes de las autoridades recurridas -que se tienen dados bajo juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y la prueba aportada para la resolución del asunto ha sido debidamente acreditado que, a partir de denuncias recibidas en 2023, el Área Rectora de Salud de Belén Flores desplegó diversas actuaciones de verificación y control: efectuó inspecciones, descartó que el establecimiento inicialmente denunciado fuese el origen de las aguas reportadas mediante prueba de coloración, concluyó técnicamente que el problema se vinculaba con la obstrucción del alcantarillado pluvial ubicado en ruta nacional, y, en el marco de sus potestades, emitió la orden sanitaria No. MS-DRRSCN-DARSBF-OS-017-2023 dirigida al CONAVI, además de realizar requerimientos y gestiones de seguimiento posteriores, incluyendo comunicaciones formales en octubre de 2023 y requerimientos de informe en febrero de 2024.

Asimismo, en mayo de 2025 practicó una inspección en el sitio frente al establecimiento Cosechas, dejando constancia de que, bajo clima seco, no era observable a simple vista el desbordamiento o empozamiento denunciado, aunque reconoció el antecedente de que en época lluviosa la problemática tiende a manifestarse con olores ofensivos por estancamiento.

Con todo, la tutela del artículo 50 constitucional exige no solo la emisión formal de actuaciones administrativas, sino su eficacia para garantizar una protección real y oportuna del ambiente y la salud pública. En el sub lite, la propia autoridad sanitaria ha reconocido, por un lado, la persistencia y agravamiento del problema en el tiempo (según se consignó en las gestiones de seguimiento) y, por otro, la existencia de limitaciones prácticas para corroborar responsabilidades sanitarias mediante pruebas de coloración debido a la obstrucción del sistema, lo cual evidencia un riesgo continuado que demanda una respuesta institucional coordinada y eficaz. En ese marco, si bien el Ministerio de Salud no sustituye las competencias técnicas del ente vial ni las del operador de alcantarillado sanitario, sí ostenta deberes de rectoría, control y fiscalización sanitaria, así como potestades para requerir y verificar el cumplimiento de medidas correctivas y, cuando corresponda, activar los mecanismos administrativos pertinentes para asegurar la cesación de condiciones insalubres que comprometan la salud colectiva.

De esta manera, la lesión acreditada se relaciona con la falta de una solución efectiva y verificable de la condición denunciada en el tiempo, pese a la intervención sanitaria desplegada desde 2023 y al reconocimiento de que la problemática persiste, particularmente en temporada lluviosa. En consecuencia, procede estimar el recurso y ordenar al Área Rectora de Salud de Belén Flores que, en el ámbito de sus competencias, refuerce y continúe el seguimiento del caso hasta la efectiva eliminación del foco insalubre denunciado, adoptando las medidas de control y fiscalización que correspondan para verificar el cumplimiento de las acciones correctivas a cargo del CONAVI, así como requiriendo y articulando, cuando resulte necesario, la intervención del AyA y de la Municipalidad de Flores para atender la dimensión sanitaria (eventuales descargas de aguas residuales o conexiones indebidas) que pudiera estar incidiendo en el sistema pluvial; lo anterior deberá realizarse mediante actuaciones documentadas, con inspecciones en condiciones pertinentes (incluida, si es del caso, época lluviosa) y con comunicación de resultados a esta Sala dentro del plazo que se indica en la parte dispositiva de esta sentencia.

VIII. NOTA DEL MAGISTRADO CASTILLO VÍQUEZ, EN CUANTO A LA JUSTICIA ADMINISTRATIVA PRONTA Y CUMPLIDA

He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia.

Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.

IX. NOTA DEL MAGISTRADO SALAZAR ALVARADO

En asuntos ambientales, es criterio del suscrito, que, si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que el recurrente denuncia la obstrucción de las alcantarillas que se ubican en la carretera nacional a la altura de San Joaquin de Flores lo que provoca que las aguas negras se desbordan y emanan olores fétidos, situación que provoca contaminación, malos olores, riesgo de enfermedades. Aduce que a pesar de haber gestionado las respectivas denuncias, la problemática que aqueja no ha sido solucionada. La situación descrita constituye una excepción a mi posición general en esta materia, por lo que estimo necesario que este Tribunal Constitucional analizara por el fondo el asunto, con el fin de verificar o descartar los alegatos de la parte recurrente.

X. VOTO SALVADO DE LA MAGISTRADA GARRO VARGAS

Pese a que he concurrido con el voto en asuntos donde se plantean similares agravios, bajo una mejor ponderación estimo que este tipo de reproches se deben plantear en las vías ordinarias de legalidad. Lo anterior, máxime si, de los autos, se constata que las denuncias se interpusieron de forma anónima, motivo por el cual no existe una persona debidamente individualizada que requiera del amparo de esta jurisdicción por las amenazas a los derechos fundamentales ya indicados o que pertenezca a un grupo vulnerable que demanda la intervención de esta Sala. Ya solo ese elemento, en mi criterio, es suficiente para desestimar el recurso de amparo. Este Tribunal ha advertido que partiendo de los efectos que la Ley de la Jurisdicción Constitucional confiere al recurso de amparo (arts. 41 y 49) debe concluirse que cualquier persona puede interponerlo, siempre y cuando individualice a los sujetos cuyos derechos fundamentales considera fueron conculcados (ver, por ejemplo, las sentencias números 2019-003879, 2021-017532 y 2022-009133, entre otras).

En el sub lite, los recurrentes acuden en amparo para que se le ordene al Consejo Nacional de Viabilidad cumplir con lo ordenado en la medida sanitaria emanada por el Ministerio de Salud, por la obstrucción de las alcantarillas que no permiten que fluya las aguas pluviales. Aduce que esto ha provocado que se desborden las aguas negras sobre las carreteras, con el agravante de que se crean malos olores fétidos.

Considero que en tales supuestos procede, en primer término, cuestionar la inactividad ante las autoridades competentes y luego, de mantenerse la conducta omisa, ante la jurisdicción contencioso-administrativa. Dicha instancia jurisdiccional, con mayores herramientas, puede conocer con profundidad y sopesar la denuncia de fondo, valorar la conducta administrativa, resolver sobre la competencia ‒red vial nacional o red vial cantonal‒, dictar mandatos específicos para atender la problemática apuntada y, por supuesto, dar seguimiento a lo ordenado en sentencia. En consecuencia, respetuosamente y desde mi perspectiva, no luce válido que a tenor de un argumento genérico de la supuesta inacción por parte de la autoridad recurrida se conozca en esta sede sobre una inactividad administrativa que más corresponde ser residenciada en la jurisdicción contencioso-administrativa.

En virtud de lo expuesto, salvo el voto y declaro sin lugar el recurso de amparo.

XII. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

POR TANTO:

Se declara CON LUGAR el recurso. Consecuentemente, se ordena a MAURICIO SOJO QUESADA, en condición de Director Ejecutivo a.i del Consejo Nacional de Vialidad del Ministerio de Obras Públicas y Transportes, así como, a GUSTAVO ESPINOZA CHAVES, en condición de Director del Área Rectora de Salud de Belén Flores del Ministerio de Salud o a quienes ocupen esos cargos que, en el plazo de SEIS MESES, contado a partir de la notificación de esta resolución, cada autoridad en el ejercicio de sus competencias, coordinen y tomen las medidas necesarias para dar el mantenimiento y rehabilitación del sistema de drenaje pluvial del sector, de forma que se asegure el libre escurrimiento de aguas y se eliminen las condiciones que generan empozamientos, obstrucciones, acumulación de residuos y afectaciones conexas; además, en caso de ser necesario, deberán coordinar formalmente y de manera documentada con el AyA y la Municipalidad de Flores, para que, en lo que a cada cual competa, se identifiquen y atiendan eventuales conexiones indebidas o descargas sanitarias que estén incidiendo en el sistema pluvial y generando olores fétidos, debiendo informar a esta Sala sobre lo actuado y los resultados obtenidos en el plazo ya señalado.

Se advierte a las autoridades recurridas que, de conformidad con el artículo 71 de la Ley de esta jurisdicción, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. El Magistrado Castillo pone nota. El Magistrado Salazar Alvarado consigna nota. La magistrada Garro Vargas salva el voto y declara sin lugar el recurso de amparo. Notifíquese.
