Document Review Decision No. 2026005212 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine thirty-four a.m. on February thirteenth, two thousand twenty-six.

Amparo proceeding (recurso de amparo) filed by [Name 001], identity card [Value 001], against the MINISTER OF ENVIRONMENT AND ENERGY (MINAE).

Findings of Fact:

  1. 1By means of the brief added to the digital case file at 15:50 on October 28, 2025, [Name 001] filed an amparo proceeding against MINAE. Through official letter No. MLV-00111-2025 of October 12, 2025, the petitioner urged the President of the Republic and the President of the National Environmental Council to issue an Executive Decree declaring Parque Nacional Cahuita to be the ancestral territory of the Afro-Costa Rican population, after consulting that population, thereby amending the regulations currently in force. He complained that on October 27, 2025, through official letter No. DVA-0138-2025, the Vice Minister of Environment denied the relief sought. He asked the Constitutional Chamber to declare Parque Nacional Cahuita to be an ancestral territory of Afro-descendants and to order the State to take the measures necessary for its delimitation, collective titling, and intercultural management. He requested that the proceeding be granted.
  2. 2By means of the brief added to the digital case file at 15:04 on November 11, 2025, Bentlin Villalobos Grant, an Afro-descendant citizen and President of the Asociación de Desarrollo Comunal de Cahuita, filed a motion to intervene in support of the petitioner (coadyuvancia activa).
  3. 3By means of the brief added to the digital case file at 15:27 on November 11, 2025, [Name 001] submitted official letter No. DVA-0147-2025 from the Viceministerio de Ambiente y Energía as evidence to assist the Court in reaching its decision (prueba para mejor resolver). He emphasized: “(…) That official letter, which I attach in full as Anexo 1, responds to my letter MLV-00113-2025 of October 27, 2025, in which I requested that the Afro-descendant population of Cahuita be afforded prior, free, and informed consultation (consulta previa, libre e informada, CPLI), in accordance with Convention 169 of the International Labour Organization (ILO), as well as clarification concerning the legal foundations of Parque Nacional Cahuita in relation to that international instrument. In the official letter sent to me, the Vice Minister reiterates prior positions, refers matters within the Legislative Branch’s jurisdiction to that Branch, and, most importantly, denies that I have standing (legitimación activa) to pursue such actions, arguing that only the Asociación de Desarrollo Integral de Cahuita (ADIC), acting on behalf of the Foro del Pueblo Tribal Afrocostarricense, has such capacity.As I will explain below, this position contravenes fundamental human rights principles and perpetuates historical structural discrimination against the Afro-descendant community. I. Incompatibility with ILO Conventions 107 and 169 and the Obligation of Direct Application ILO Conventions 107 (ratified by Costa Rica in 1959) and 169 (ratified in 1993) protect the rights of Indigenous and tribal peoples, including the right to prior, free, and informed consultation regarding measures that directly affect them (Article 6 of Convention 169). In the case of the Afro-Costa Rican population, recognized as a tribal people through Decreto Ejecutivo N° 43532-MP-MINAE-MCJ-MEP of May 5, 2022, these provisions are immediately applicable and binding, even in the absence of specific domestic regulations. That decree, which records the self-identification of the Afro-Costa Rican population as a tribal people, establishes the Foro del Pueblo Tribal Afrocostarricense as the consultative body, but does not limit individual standing to invoke collective rights.The Vice Minister’s official letter disregards this obligation by making any action contingent on the ADIC’s exclusive representation, overlooking the fact that Convention 169 requires the geographic delimitation of ancestral territories as a prerequisite for any effective consultation (Articles 13 to 19). It is illogical and contrary to legal reasoning to order consultations without a map locating the Afro-descendant community, as has been required by this Chamber’s recent case law, for example, in the judgment ordering consultation with the Afro-descendant population regarding the Plan Regulador Costero del Caribe Sur. II. Standing of Any Citizen to Invoke Human Rights, Pursuant to the American Convention on Human Rights, the Case Law of the Inter-American Court of Human Rights, and the Ley de Jurisdicción Constitucional Article 1 of the American Convention on Human Rights (ratified in 1969) requires the State to respect rights without discrimination, and the case law interpreting it, issued by the Inter-American Court of Human Rights (IACtHR), is directly applicable in Costa Rica by virtue of Article 7 of the Political Constitution, which gives international human rights treaties precedence.Articles 27 and 48 of the Ley de Jurisdicción Constitucional (N° 7135) permit any person to file an amparo proceeding to defend fundamental rights, without the need for exclusive representation when collective or diffuse interests are involved. In landmark cases such as Saramaka People v. Suriname (2007), Kichwa Indigenous People of Sarayaku v. Ecuador (2012), and Kaliña and Lokono Peoples v. Suriname (2015), the IACtHR has emphasized that States must guarantee prior consultation and protect the territorial rights of tribal peoples, recognizing individual and collective standing to defend those rights. The Vice Minister’s argument that only the ADIC has standing contravenes these principles and perpetuates historical structural discrimination against the Afro-descendant population, as manifested in the failure to apply Convention 169 despite precedents that have protected the rights of other minorities, such as the LGBTIQ+ population (for example, this Chamber’s 2018 judgment on marriage equality).I welcome this Chamber’s recent decisions, such as the one ordering consultation regarding the Plan Regulador Costero del Caribe Sur and judgment N° 2025- 029985, which reinforce the Afro-Costa Rican tribal people’s right to participate. However, the failure to order territorial delimitation, which is essential to prevent systematic violations, persists. III. Support of the Asociación de Desarrollo Integral de Cahuita and Reiteration of the Relief Sought I respectfully ask this Chamber to take note that this amparo proceeding has the ADIC’s endorsement and unrestricted support, as evidenced by the formal intervention in support submitted by its legal representative, which strengthens my standing and refutes the Vice Minister’s assertions regarding the absence of formal action by that entity. Accordingly, I reiterate my initial statements and request that this Honorable Chamber conduct a detailed and exhaustive analysis of the case, in accordance with ILO Convention 169, constitutional case law concerning the rights of Indigenous and tribal peoples, constitutional principles, and IACtHR case law, so as to cease discriminating against me and the Afro-descendant community.Specifically, I request: 1. Declare official letter DVA-0147-2025 incompatible with the cited provisions. 2. Order the geographic delimitation of the ancestral territory of Cahuita’s Afro-descendant population by means of an official map, as a prerequisite for any consultation. 3. Require the State to conduct immediate prior, free, and informed consultation regarding Parque Nacional Cahuita and environmental measures affecting the community. 4. Adopt interim measures (medidas cautelares) to suspend any intervention in the territory until a final decision is rendered (…)” (sic).
  4. 4By order issued at 23:08 on November 13, 2025, the amparo proceeding was admitted, and the Minister and Vice Minister of Environment, both of MINAE, were served and directed to respond.
  5. 5By means of the submission added to the digital case file at 20:36 hours on 18 de noviembre de 2025, Franz Tattenbach Capra and Jorge Mario Rodríguez Zúñiga, Minister of Environment and Energy and Vice Minister of Environment, respectively, reported: “(…) By means of Decreto Ejecutivo No. 1236-A, which entered into force on 24 de setiembre del 1970, the Cahuita National Monument (now Cahuita National Park) was established. The reasons, background, and scope of the Executive Branch’s provision are set forth in this legal instrument (…) By means of artículo 1° de la Ley N° 6794 de 25 de agosto de 1982, the Decree creating Cahuita National Park was ratified as a Law of the Republic (…) Cahuita National Park is a protected natural area located in the province of Limón, Costa Rica, 202 km south of the provincial capital. It encompasses 1067.9 terrestrial hectares and 22400 marine hectares. It was created by Decreto Ejecutivo 1236-A, del 7 de septiembre de 1970 and is administered by the La Amistad Caribe Conservation Area of the National System of Conservation Areas (…) The State’s authority to create this protected wilderness area 55 years ago (1970) has no connection with Mr.Levy’s claims alleging ‘structural discrimination’ against the tribal people. The Chamber should note that Mr. Levy does not even explain what this alleged ‘structural’ discrimination consists of, considering that this type of discrimination is defined as that attributable to ‘a system of exclusion and marginalization manifested through rules, policies, practices, and social structures that historically and continuously limit certain social groups’ enjoyment of rights.’ In this regard, this authority does not understand: What rights of any tribal people, non-tribal people, or individual has MINAE-SINAC infringed through the creation of Cahuita National Park 55 years ago? Protecting Cahuita National Park’s natural resources does not constitute structural discrimination; rather, it fulfills the mandate to protect natural resources and positively applies artículo 50 constitucional. Mr. Levy provides no reliable evidence of discrimination against himself or any third party.He does not demonstrate any connection between the creation of a protected wilderness area and this alleged ‘structural discrimination’ against a tribal group that he does not represent. The answer is simple: the creation of this protected area 55 years ago (1970) does not cause a constitutional violation or impinge upon the rights of tribal groups or groups of any other kind (…) Mr. [Nombre 001] forwarded note MLV-00111-2025 del 12 de octubre de 2025, addressed to Mr. Rodrigo Chaves Robles, President of the Republic of Costa Rica, and to the Minister of Environment and Energy, Franz Tattenbach (…) This note was addressed by the Office of the Vice Minister of Environment, Engineer Jorge Mario Rodriguez, and response DVA-0138- 2025 del 27 de octubre de 2025 was sent to him (…) Mr. Levy again sent a second note, MLV-00113-2025 del 27 de octubre de 2025, replying to Vice Minister of Environment’s response DVA-0138- 2025 (…) Once again, the Office of the Vice Minister of Environment responded to letter MIL 113-2025 by means of note DVA-0147-2025 del 10 de noviembre del 2025 (…) As ratified by the Constitutional Chamber in Voto 2025- 000480 and Decreto Ejecutivo No. 43532-MP-MINAE-MCJMEP, in force since 8 de mayo del 2022, Mr. [Nombre 001] lacks standing to act or assert claims belonging to the Forum of the Afro-Costa Rican Tribal People, represented by the Cahuita Integral Development Association, based on the contention that he is an ‘Afro-Costa Rican citizen and direct descendant of the tribal communities of Costa Rica’s southern Caribbean region.’ The Ministry of Environment and Energy is the administrator of Cahuita National Park, created by law 55 years ago (1970); therefore, at that historical procedural juncture, no mandatory consultation with tribal peoples prior to its creation had been established.Participatory processes are governed by the Biodiversity Law and are the mechanisms applicable to protected wilderness areas. Likewise, the creation of this protected wilderness area under the category of National Park does not violate any constitutional provision. Mr. Levy fails to substantiate what the possible violation of the Political Constitution consists of for purposes of filing this amparo proceeding, nor does he prove any type of discrimination. Everything appears to indicate that he is simply dissatisfied with the responses provided to him, which likewise does not constitute any violation of the right to a response, since his two notes, MLV 111- 2025 and 113-225, were answered in a timely manner by our Ministry (…) no petition has been officially filed with our Ministry by the Cahuita Integral Development Association concerning territorial claims in Cahuita National Park or consultations on any specific issue relating to tribal matters.MINAE’s relationship with ADI-Cahuita concerns a matter different from the tribal issue: efforts are under way to identify an administrative arrangement for shared governance of a sector of Cahuita National Park, subject to prior approval by the Ministry of Finance and the Office of the Comptroller General of the Republic. Mr. Levy has neither participation nor representation in that matter; therefore, his arguments on this subject bear no relation to any constitutional issue. Likewise, MINAE lacks jurisdiction to declare territorial rights for tribal groups; hence, Mr. Levy’s request that ‘an Executive Decree, based on ILO Conventions 107 and 169, declare Cahuita National Park to be the ancestral territory of the Afro-Costa Rican population as a tribal people’ (MLV 111-2025) is inadmissible; nor is it appropriate for him to demand a ‘public consultation with Cahuita’s Afro-descendant population and clarification regarding the legal grounds for Cahuita National Park in relation to ILO Convention 169’ (MLV 113-2025).Mr. Levy seeks to assume the representation of residents, citizens, and tribal peoples without any standing, in pursuit of benefits that are neither clear nor timely. The grounds cited by Mr. Levy in support of this amparo proceeding do not constitute a violation of any constitutional provision, when he states the following reasons as justification (…) Mr. Levy deliberately omits from his submission to this Chamber response DVA-0147-2025, de fecha 10 de noviembre de 2025, in which his petition is denied because he lacks standing to act on behalf of the Tribal Forum. That official communication expressly states why the requested public consultation is not warranted. Likewise, it is false that notes MLV-111-2025 and MLV-113- 2025 contain references to ‘the existence of an Afro-descendant cemetery within Cahuita National Park, known to the MINAE authorities, and the recent discovery of two slave ships of Danish origin, which reinforce the territory’s ancestral character.’ These assertions are introduced into the claims of the amparo proceeding solely to exaggerate his arguments, although they bear no causal relationship whatsoever to the alleged ‘structural discrimination.’ Similarly, no evidence whatsoever is provided to show that this Ministry engages in acts of discrimination against any tribal people by creating and administering Cahuita National Park.It is unreasonable for the mere assertion of a petitioner, unsupported by evidence, to require the activation of the administrative and judicial machinery to address baseless petitions whose true purpose appears to be evading the Courts of Justice. Such conduct allows him to litigate without significant financial cost and without satisfying the minimum requirements for admitting a complaint, solely to achieve personal objectives (…)” (sic).
  6. 6By means of the submission added to the digital case file at 16:25 hours on 19 de noviembre de 2025, [Nombre 001] addressed the information provided: “(…) Omission of historical and cultural evidence: The report ignores the existence of an Afro-descendant cemetery within Parque Nacional Cahuita, known to the MINAE authorities, as well as the recent discovery of two Danish slave ships in adjacent waters, which reinforce the territory’s ancestral character. This evidence, supported by anthropological and archaeological studies (such as those reported by the Museo Nacional de Costa Rica and UNESCO concerning Afro-Caribbean heritage sites), demonstrates that Cahuita is not merely a ‘protected wilderness area’ (área silvestre protegida) created in 1970, but rather a space ancestrally occupied by Afro-descendant communities since the siglo XIX, descended from enslaved Jamaicans and Africans. Ignoring this violates article 14 of ILO Convention 169, which requires the State to recognize rights of ownership and possession over traditionally occupied lands. 2.Denial of free, prior, and informed consultation (consulta previa, libre e informada, CPLI): Official letter DVA-0138-2025 dated 27 de octubre de 2025, cited in the report, omits any reference to prior consultation (consulta previa) with the Afro-descendant population, even though the district of Cahuita is recognized as tribal territory (territorio tribal) under Convention 169. This omission perpetuates structural discrimination (discriminación estructural), as this Chamber recognized in Voto N° 2023-023903 (Expediente 23-903), which ordered recognition of the Afro-descendant populations of the Costa Rican Caribbean as a tribal people (pueblo tribal), with rights to self-determination and consultation. Likewise, in Voto N° 2025- 00480 (Expediente 24-012620-0007-CO), the Chamber reiterated the need for consultation processes concerning matters affecting tribal territories, rejecting arguments based on lack of standing (falta de legitimación) when collective discrimination is invoked. 3.Failure to acknowledge international obligations: The report cites opinion PGR-C-153-2023 of the Procuraduría General de la República to allege an ‘incompatibility’ between the State’s natural heritage (patrimonio natural del Estado) and tribal rights, but this ignores the supremacy of international treaties (article 7 of the Constitución Política) and the case law of the Inter-American Court of Human Rights. In Saramaka v. Suriname (Series C N° 172, 2007), the Inter-American Court extended Indigenous territorial rights to Afro-descendant tribal peoples, recognizing their right to collective ownership (propiedad colectiva) of ancestral lands, including within environmentally protected areas, provided that CPLI and benefit-sharing are guaranteed (paras. 96-115). Similarly, in Kichwa de Sarayaku v. Ecuador (Series C N° 245, 2012), it emphasized that failure to conduct consultation violates articles 21 (right to property) and 1.1 (non-discrimination) of the American Convention on Human Rights.In Costa Rica, this Chamber has directly applied Convention 169 (Voto N° 2000-05290), declaring it immediately effective and binding and ordering consultations in analogous cases, such as Voto N° 2025-029240 (Expediente 25-020061- 0007-CO), in which it rejected mere ‘dissatisfaction’ as a basis for denying rights, emphasizing effective judicial protection (tutela efectiva) (…) The MINAE report wrongly invokes the Constitutional Jurisdiction Law (Ley de la Jurisdicción Constitucional, LJC) to justify its position, but omits that article 29 of that law permits an amparo proceeding (amparo) against omissions that perpetuate violations of fundamental rights, including those derived from international treaties (article 48 LJC). This Chamber, as guardian of constitutional supremacy (article 10 CP), has universally binding (erga omnes) precedents for correcting structural discrimination. 1. Structural discrimination against Afro-descendants: The report denies that discrimination exists, rhetorically asking, ‘Which rights have been restricted?’ However, this Chamber recognized structural discrimination in Voto N° 2025-029240, noting that the Chamber is not responsible for reviewing ordinary legality, but is responsible for protecting rights when omissions perpetuate inequalities.In Pueblo Garífuna de Punta Piedra v. Honduras (Series C N° 304, 2015), the Inter-American Court condemned structural discrimination against Afro-descendants and required the restitution of ancestral territories. In Costa Rica, Decreto Ejecutivo N° 43532-MP-MINAE-MCJMEP (2022) confirms the self-identification (auto-reconocimiento) of Afro-descendants as a tribal people, but MINAE uses it to deny standing, ignoring that article 3 of Convention 169 prohibits discrimination and requires affirmative measures. This discrimination is manifested in the failure to recognize the territory for 55 years, in violation of article 33 CP (equality) and article 50 (healthy environment, which must be balanced against cultural rights). 2. Standing (legitimación activa): The report alleges a lack of standing, citing Voto N° 2025-000480, but omits that I am acting in my personal capacity as an affected Afro-descendant, not as a representative of the Foro del Pueblo Tribal Afrocostarricense.The LJC (article 30) permits any person directly affected to bring an amparo proceeding, and this Chamber has expanded standing in cases involving collective rights (Voto N° 2013-016699, concerning minorities). In Comunidad Moiwana v. Suriname (Series C N° 124, 2005), the Inter-American Court recognized individual standing in tribal territorial claims, emphasizing that collective discrimination does not require formal representation. 3. Ancestral character of Parque Nacional Cahuita: As an innovative approach, I propose that the Chamber consider the park not as ‘natural heritage incompatible’ with tribal rights, but as a hybrid space in which environmental conservation coexists with tribal governance, as in UNESCO’s ‘biosphere reserve’ model. Article 15 of Convention 169 requires consultation before resources are exploited in tribal territories, and article 21 of the American Convention on Human Rights protects collective ownership.Evidence such as Afro-descendant human remains and slave-ship wrecks (documented in reports by the Instituto Nacional de Antropología) demonstrates ancestral occupation and requires restitution. III. SPECIFIC REBUTTAL OF THE SUBSTANCE OF THE REPORT • Background to the park’s creation: The report emphasizes Decreto N° 1236-A of 1970, but omits that Costa Rica had already ratified ILO Convention 107 at that time (Ley N° 3842 de 1965), the predecessor to Convention 169, which required respect for territorial rights. The ratification of Convention 169 in 1992 retroactively requires review of declarations that disregard CPLI. • Administrative responses: Official letters DVA-0138-2025 and DVA-0147-2025 are cosmetic rather than substantive, in violation of article 27 CP (right to a prompt and reasoned response). • Lack of evidence: To the contrary, I submit historical evidence; MINAE, not I, must prove compatibility (pro homine principle, article 29 of the American Convention on Human Rights) (…)” (sic).He asked the Constitutional Chamber: “(…) To order the Executive Branch to issue a Decree declaring Parque Nacional Cahuita an ancestral Afro-descendant tribal territory, with permanent CPLI and shared governance (…)” (sic).
  7. 7By means of the submission added to the digital case file at 13:02 hours on 21 de noviembre de 2025, [Nombre 001] submitted evidence to aid adjudication (prueba para mejor resolver), consisting of a letter signed by Valerie Rose Machore, apparently Vice President of the Asociación de Desarrollo Integral de Cahuita, which was submitted to the Minister of Environment and Energy on 29 de agosto de 2025. He requested that the Minister of Environment and Energy be granted a hearing for having lied under oath. He also submitted a press release. He requested a declaration that the Minister had committed the offense of making a false statement in a public document (falsedad ideológica).

  9. 9By means of the submission added to the digital case file at 15:00 hours on 21 de noviembre de 2025, [Nombre 001] submitted a press release as evidence to aid adjudication.
  10. 10By means of the filing added to the digital case file (expediente digital) at 11:56 hours on 25 de noviembre de 2025, [Nombre 001] stated: “(…) As the petitioner (recurrente) in the aforementioned case file, I reiterate that the primary purpose of this judicial action is to obtain a binding judicial declaration recognizing and declaring Parque Nacional Cahuita to be ancestral territory (territorio ancestral) and, consequently, Afro-descendant territory (territorio afrodescendiente), pursuant to the international obligations undertaken by the Costa Rican State under Conventions N° 107 (Indigenous and Tribal Populations Convention, 1957) and N° 169 (Indigenous and Tribal Peoples Convention in Independent Countries, 1989) of the International Labour Organization (ILO), ratified by Costa Rica through Ley N° 3048 del 27 de junio de 1962 (for Convention 107) and Ley N° 7316 del 16 de diciembre de 1992 (for Convention 169).This declaration is imperative to remedy a historical debt owed by the Costa Rican State to Costa Rica’s Afro-descendant population, particularly that of the district of Cahuita, which has been expressly recognized as Afro-descendant territory through Decreto Ejecutivo N° 43532-MP-MINAEMCJ-MEP del 5 de mayo de 2022, which confirms the self-identification (autoreconocimiento) of the Afro-Costa Rican population as a tribal people (pueblo tribal), in harmony with Decreto Ejecutivo N° 43191-MP-MCJ del 31 de agosto de 2021 on the Recognition of Afro-Costa Rican Tribal Peoples, and the Ley de Reconocimiento de Pueblo Tribal a la Población Afrocostarricense (published in La Gaceta N° 200 del 30 de octubre de 2023). This petition is based on the settled case law (jurisprudencia consolidada) of this Sala Constitucional, which has progressively recognized the collective rights (derechos colectivos) of tribal peoples, including Afro-descendant communities, as holders of ancestral territorial rights (derechos territoriales ancestrales) and of the right to prior, free, and informed consultation (derecho a la consulta previa, libre e informada).For example, in Resolución N° 2025-035746 (expediente similar 25-028937-0007-CO), this Sala ordered the Instituto Costarricense de Turismo to conduct prior consultation (consulta previa) with the Afro-descendant tribal people of Cahuita concerning the Master Tourism Plan for the Caribbean Coastal Sector, invoking artículo 6 of ILO Convention 169 and emphasizing the supra-constitutional status (carácter supra constitucional) of that instrument as a means of guaranteeing effective intercultural dialogue. Likewise, in judgment (sentencia) N° 2025-029985, this Sala extended that consultation obligation to the Afro-descendant population of Cahuita, Puerto Viejo, and Manzanillo with respect to the Coastal Land-Use Plan for the Southern Caribbean, recognizing that Convention 169 is directly applicable and binding upon non-Indigenous tribal peoples, in line with voto N° 2025-035746, which establishes the “supra-constitutional right of consultation for Afro-descendant communities and ancestral territories.” This case law, consistent with landmark decisions such as N° 2003-07777 (concerning Indigenous territorial rights) and N° 2012-01335 (concerning prior consultation for projects with impacts), imposes upon the State the obligation to protect ancestral territories traditionally occupied by tribal peoples, preventing historical dispossession and promoting redress for past violations.In addition, this request is supported by the case law of the Inter-American Court of Human Rights (IACtHR), which is binding upon Costa Rica by virtue of artículo 7 of the Constitución Política, which provides that duly approved international treaties have authority superior to that of statutes from the time of their promulgation. The IACtHR has developed an extensive body of case law extending the rights of Indigenous peoples to Afro-descendant tribal peoples and recognizing their right to collective ownership (propiedad colectiva) of ancestral territories under artículo 21 of the American Convention on Human Rights (Pact of San José, ratified by Ley N° 4534 del 23 de febrero de 1970). In Saramaka People v. Suriname (Judgment of 28 de noviembre de 2007, Series C N° 172), the IACtHR determined that Afro-descendant communities (Maroons) constitute tribal peoples with rights equivalent to those of Indigenous peoples, including the right to the delimitation, demarcation, and titling of their ancestral lands, based on their traditional possession (posesión tradicional) and on ILO Convention 169, which applies by analogy.Similarly, in Moiwana Community v. Suriname (Judgment of 15 de junio de 2005, Series C N° 124), the Court emphasized the State’s obligation to remedy historical violations of the territorial and cultural rights of Afro-descendant communities, recognizing their spiritual and cultural connection to the land. In Kichwa Indigenous People of Sarayaku v. Ecuador (Judgment of 27 de junio de 2012, Series C N° 245), the Court reiterated that the absence of formal recognition of ancestral territories constitutes a continuing violation (violación continua) of the right to collective ownership, obligating States to adopt remedial measures, including judicial declarations of territorial rights. Finally, in Kaliña and Lokono Peoples v. Suriname (Judgment of 25 de noviembre de 2015, Series C N° 309), the IACtHR confirmed that States must guarantee the effectiveness of the territorial rights of tribal peoples, including Afro-descendant peoples, through titling and protection against interference, failing which they incur international responsibility.In this context, I reiterate the non-deferrable responsibility of this honorable Sala Constitucional to effectively enforce the Constitución Política, particularly artículo 7 thereof, which has remained unobserved for more than 50 years with regard to the full recognition and application of ILO Convention 107 (ratified in 1962) and its revision through Convention 169. This failure to comply has perpetuated the historical marginalization of the Afro-descendant population in Cahuita, whose territory—including the area now known as Parque Nacional Cahuita, created by Ley N° 4462 del 27 de febrero de 1970—has been ancestrally occupied by Afro-descendant communities since the nineteenth century, as evidenced by historical records and Decreto Ejecutivo N° 43532-MPMINAE-MCJ-MEP, which defines Afro-Costa Rican ancestral territories as those “principally and traditionally occupied and developed” by those communities.The requested declaration would not only remedy this historical debt, consistent with the principle of progressive realization of human rights (principio de progresividad de los derechos humanos) (artículo 4 of the American Convention), but would also prevent future violations, such as those alleged in the case file, thereby guaranteeing the cultural, territorial, and environmental integrity of the Afro-descendant tribal people of Cahuita. In light of the foregoing, I request that this Sala, in exercise of its constitutional powers and pursuant to the Ley de la Jurisdicción Constitucional (artículo 48), declare Parque Nacional Cahuita to be Afro-descendant ancestral territory and order the State to adopt the measures necessary for its delimitation, collective titling (titulación colectiva), and intercultural management (gestión intercultural), in compliance with ILO Conventions 107 and 169, the American Convention on Human Rights, and the case law cited.This action is urgent and emphatic, given the ongoing threats to our collective rights, and will contribute to social justice and the strengthening of the rule of law (Estado de Derecho) in Costa Rica (…)” (sic) (emphasis not in the original).
  11. 11The statutory requirements have been observed in the proceedings conducted.

Justice Araya García drafts the opinion; and,

Whereas:

I.Subject matter of the petition (objeto del recurso). By oficio No. MLV-00111-2025 de 12 de octubre de 2025, the petitioner urged the Presidente de la República and the Presidente del Consejo Nacional Ambiental to issue an Executive Decree declaring Parque Nacional Cahuita to be ancestral territory of the Afro-Costa Rican population, following consultation with that population, thereby amending the regulations in force. He complained that on 27 de octubre de 2025, through oficio No. DVA-0138-2025, the Viceministro del Ambiente denied the requested relief. He asked the Sala Constitucional to declare Parque Nacional Cahuita to be Afro-descendant ancestral territory and to order the State to adopt the measures necessary for its delimitation, collective titling, and intercultural management.

II.Preliminary issue: the application for intervention as a supporting party (coadyuvancia). By means of the filing added to the digital case file at 15:19 hours on 7 de noviembre de 2025, Bentlin Villalobos Grant, identity card (cédula de identidad) No. 02-0697-0252, acting as an Afro-descendant citizen and President of the Asociación de Desarrollo Comunal Cahuita, filed an application for active intervention as a supporting party (coadyuvancia activa). Such intervention is a form of supporting intervention (intervención adhesiva) that occurs when a person participates in a proceeding by joining in the claims of one of the principal parties.

III.A person with a direct interest in the outcome of the petition has standing (legitimación) to act as a supporting party; however, because the supporting party is not a principal claimant, that party will not be directly affected by the judgment—that is, the judgment’s effect cannot extend to that party directly and immediately, nor will that party be affected by the res judicata effect (cosa juzgada) of the ruling (see, among others, Sentencia N° 2010-000254, de las 11:28 horas el 08 de enero de 2010, and N° 2018019952, de las 9:30 horas de 30 de noviembre de 2018).

IV.The applicant did not prove that he holds the position of President of the Asociación de Desarrollo Comunal Cahuita; accordingly, intervention in that capacity is denied, and he is admitted solely as an Afro-descendant citizen.

V.Proven facts (hechos probados). The following facts are deemed duly established and relevant to the decision in this matter:

By means of official letter No. MLV-00111-2025 of 12 de octubre de 2025, the appellant submitted the following to the President of the Republic and the President of the Consejo Nacional Ambiental: “(…) Subject: Urgent call for the issuance of an Executive Decree, grounded in ILO Conventions 107 and 169, declaring Parque Nacional Cahuita to be the ancestral territory (territorio ancestral) of the Afro-Costa Rican population as a tribal people; harmonization with Letter SINAC-SE-DE-1171-2025 and alignment with the international case law of the Inter-American Court of Human Rights and the domestic case law of the Sala Constitucional de la Corte Suprema de Justicia. Esteemed Mr. President and Mr. Minister: I address you in my capacity as an Afro-Costa Rican citizen, a direct descendant of the tribal communities of Costa Rica’s southern Caribbean region, and as the moral representative of the generations that have safeguarded the ancestral territory of Parque Nacional Cahuita since time immemorial.

As an active member of the national Afro-descendant community and in support of the Asociación de Desarrollo Integral de Cahuita (ADIC), founded in 1976 to safeguard our cultural and environmental heritage, I most respectfully and urgently request the immediate issuance of an Executive Decree declaring Parque Nacional Cahuita to be the ancestral territory of our Afro-Costa Rican tribal population. This measure, rigorously grounded in Conventions Nos. 107 and 169 of the International Labour Organization (OIT), ratified by Costa Rica, is consistent with the extensive international case law of the Inter-American Court of Human Rights (IACtHR) and the domestic case law of the Sala Constitucional de la Corte Suprema de Justicia, incorporating as key historical inputs Ley N° 9612 (Ley del Calipso) and the recent landmark ruling of the Sala Constitucional of septiembre de 2025 ordering consultation with the Afro-descendant population regarding the Plan Regulador Costero del Caribe Sur en Talamanca.

The primary purpose of this call is to harmonize the administrative and financial limitations set forth in Letter SINAC-SE-DE-1171-2025, dated 22 de agosto de 2025, signed by Mr. David Chavarría Morales, Interim Executive Director of the Sistema Nacional de Áreas de Conservación (SINAC), and addressed to Mr. Jorge Mario Rodríguez Zuñiga, Vice Minister of Environment of the Ministerio de Ambiente y Energía (MINAE), thereby promoting a sustainable shared-governance model that honors our collective rights to territory, prior consultation (consulta previa), and effective participation in its administration. I. Comprehensive Historical Context: The Ancestral Connection of the Afro-Costa Rican Population to the Territory of Parque Nacional Cahuita (…) II. Rigorous Legal Basis: ILO Conventions 107 and 169 as Binding State Obligations (…) III. Alignment with the Comprehensive International Case Law of the Inter-American Court of Human Rights (…) IV.

Harmonization with the Extensive Domestic Case Law of the Sala Constitucional: Landmark Precedents on the Protection of Indigenous and Tribal Peoples (…) V. Specific Proposal, Urgency, and Implementation Measures. I call upon both of you to jointly issue, within no more than 30 days, an Executive Decree that: (i) declares Parque Nacional Cahuita to be the ancestral territory of the Afro-Costa Rican population, demarcating its boundaries pursuant to Articles 14 and 17 of Convention 169; (ii) updates the SINAC-ADIC Agreement to include mechanisms for ongoing free, prior, and informed consultation (consulta previa, libre e informada, CPLI), autonomous transfer of revenues collected as earmarked funds (Ley N° 9635, art. 25), and tribal worldview protocols (protocolos de cosmovisión tribal); (iii) establishes a governance council with a community majority, incorporating Ley del Calipso and the ruling of septiembre de 2025; and (iv) directs MINAE and Hacienda to coordinate budgets to ensure its sustainability.

This action would not only resolve the limitations identified in the SINAC Letter but would also fulfill international obligations, prevent litigation before the IACtHR, and strengthen Costa Rica’s human-rights standing. I remain available for an immediate hearing at your offices and to provide input for the draft. I trust in your commitment to constitutional justice and international treaties and that you will act with the urgency demanded by our ancestral history (…)” (sic) (see the evidence submitted by the appellant and added to the digital case file).

Through official letter No. DVA-0138-2025 of 27 de octubre de 2025, Jorge Mario Rodríguez Zúñiga, Vice Minister of Environment, replied to the petitioner: “(…) In response to your letter MLV-00111-2025 of 12 de octubre de 2025, whereby I request that the Executive Branch issue an Executive Decree declaring Parque Nacional Cahuita to be the ancestral territory of the Afro-Costa Rican population, as well as updating the SINAC-ADI Cahuita Agreement, I hereby advise you as follows: a) Parque Nacional Cahuita, within the framework of Ley Orgánica del Ambiente, Ley de Biodiversidad, and Ley de Parques Nacionales, and pursuant to the powers assigned to MINAE in matters involving natural resources by Ley 7152, has been officially designated a protected wilderness area (área silvestre protegida) under the national park management category (categoría de manejo). b) By means of Executive Decree No. 1236 of 07 de setiembre de 1970, the Executive Branch established Monumento Nacional Cahuita.

Article 1 of Executive Decree No. 8489 of 27 de abril de 1978 changed its name to Parque Nacional Cahuita, and subsequently Article 1° of Ley No. 6794 of 25 de agosto de 1982 ratified Executive Decrees Nos. 1236-A of 7 de setiembre de 1970 and 8489-A of 27 de abril de 1978 as laws of the Republic. Consequently, and within the scope of our powers and authority, Parque Nacional Cahuita was officially created by law in compliance with the requirements established for designating a protected wilderness area. The designation of ‘Cahuita as the ancestral territory of the Afro-Costa Rican population’ does not fall within the authority of our Ministry because it is not a formally established management category, nor does our authority include recognizing or granting rights to indigenous or tribal peoples. To clarify this matter, it is important to review the opinion issued by the Procuraduría General de la Republica in opinion PGR-C-153-2023 (…) c) Regarding the SINAC-ADI Cahuita Agreement, our Ministry will undertake such actions as are financially and legally feasible, in coordination with the Contraloría General de la Republica and the Ministerio de Hacienda; therefore, this matter is unrelated to the issuance of an Executive Decree declaring ‘Cahuita to be the ancestral territory of the Afro-Costa Rican population.’ d) The Foro del Pueblo Tribal Afrocostarricense is currently administered by the Asociación de Desarrollo Integral de Cahuita; accordingly, our Ministry has no role in that Association’s decision-making, and you must submit your proposals to that organization (…)” (sic) (see the evidence submitted by the appellant and added to the digital case file).

By means of official letter No. MLV-00113-2025 of 27 de octubre de 2025, the appellant stated to the Vice Minister of the Environment: “(…) Subject: Request for public consultation (consulta pública) with the Afro-descendant population of Cahuita and clarification regarding the legal grounds governing Parque Nacional Cahuita in relation to ILO Convention 169 (…) I respectfully address you to raise the following matters, in the exercise of my fundamental rights and in fulfillment of the international obligations of the Costa Rican State, pursuant to Conventions 107 and 169 of the International Labour Organization (ILO), Article 7 of the Political Constitution of Costa Rica, and the binding case law of the Inter-American Court of Human Rights (IACtHR). 1. Request for prior consultation with the Afro-descendant population of Cahuita Your official letter DVA-0138-2025 states that Parque Nacional Cahuita is governed by the Organic Law of the Environment, the Biodiversity Law, the National Parks Law, and Executive Decrees No. 1236 of 1970 and No. 8489 of 1978, as well as Law No. 6794 of 1982, and that it is not for the Ministry of Environment and Energy (MINAE) to declare Cahuita an ancestral territory (territorio ancestral) of the Afro-descendant population because this is not an established management category (categoría de manejo) and does not fall within its authority.

Nevertheless, the district of Cahuita is recognized as a tribal territory (territorio tribal) under ILO Convention 169, ratified by Costa Rica through Law No. 7316 of 1992, Article 6 of which establishes the obligation to consult Indigenous and tribal peoples, including Afro-descendant communities, in a prior, free, and informed manner, regarding legislative or administrative measures that may directly affect them. Likewise, ILO Convention 107, ratified by Costa Rica through Law No. 2466 of 1959, strengthens the protection of the rights of tribal populations, including their right to territory. Article 7 of the Political Constitution of Costa Rica establishes the mandatory force of international treaties, granting them a rank superior to national laws and thereby making those provisions binding (…) The failure to consult the Afro-descendant population of Cahuita regarding the regulations mentioned in your official letter, including the Wildlife Law and the regulations applicable to Parque Nacional Cahuita, constitutes a breach of the international obligations undertaken by Costa Rica.

In cases such as Saramaka v. Suriname (2007) and Kichwa Indigenous People of Sarayaku v. Ecuador (2012), the Inter-American Court of Human Rights has established that States are obligated to consult tribal peoples regarding any measure affecting their ancestral territories, ensuring their effective participation and respecting their collective rights (derechos colectivos). These judgments are binding on Costa Rica as a State Party to the American Convention on Human Rights. In light of the foregoing, I respectfully request that I be informed by official letter whether the regulations mentioned in your response—the Organic Law of the Environment, the Biodiversity Law, the National Parks Law, and related decrees—were subject to prior, free, and informed consultation (consulta previa, libre e informada) with the Afro-descendant population of Cahuita, as required by ILO Conventions 107 and 169 and inter-American case law.

If they were not consulted, I demand that the corresponding public consultation be conducted, in compliance with the decisions of the Constitutional Chamber of Costa Rica, which, in judgments such as No. 2016-015350, has reiterated the mandatory nature of prior consultation with Indigenous and tribal peoples, as well as the decisions of the IACtHR. 2. Request for the factual and legal grounds for not declaring Cahuita an ancestral territory Your official letter argues that declaring Parque Nacional Cahuita an ancestral territory does not fall within MINAE’s authority, citing the opinion of the Office of the Attorney General of the Republic (PGR-C-153-2023) regarding the incompatibility between the State natural heritage regime (régimen del patrimonio natural del Estado) and Indigenous territories. However, this response fails to consider that the district of Cahuita, as a tribal territory recognized under ILO Convention 169, has a special status that extends beyond the management categories established in national legislation governing protected wild areas (áreas silvestres protegidas).

In cases such as Mayagna (Sumo) Awas Tingni v. Nicaragua (2001), the IACtHR has recognized the right of Indigenous and tribal peoples to collective ownership (propiedad colectiva) of their ancestral territories, even when those territories overlap protected areas. Likewise, in decisions such as judgment No. 2019-022079, the Constitutional Chamber has ordered the Costa Rican State to adopt measures to safeguard the territorial rights (derechos territoriales) of Indigenous and tribal peoples, including the demarcation (delimitación) of their ancestral territories. In this context, I request an explanation by official letter of the factual and legal grounds that prevent Parque Nacional Cahuita from being declared an ancestral territory of the Afro-descendant population, considering that this omission appears to disregard the international obligations of the Costa Rican State and the binding judgments of the IACtHR.

I also request details as to whether MINAE has coordinated with other institutions, such as the Asociación de Desarrollo Integral de Cahuita or the Office of the Comptroller General of the Republic, to advance recognition of the territorial rights of the Afro-descendant population. 3. Complaint of structural discrimination (discriminación estructural) The refusal to recognize Parque Nacional Cahuita as an ancestral territory and the lack of prior consultation with the Afro-descendant population constitute a form of structural discrimination against me and the Afro-descendant community of Cahuita. This omission perpetuates the historical exclusion of our territorial rights, in violation of the principles of equality and non-discrimination enshrined in Article 33 of the Political Constitution and in international instruments such as the International Convention on the Elimination of All Forms of Racial Discrimination (ratified by Costa Rica through Law No. 3844 of 1966).

The failure to demarcate our ancestral territory in accordance with ILO Conventions 107 and 169, and the failure to conduct prior consultation in the management of Parque Nacional Cahuita, violate our right to self-determination (autodeterminación) and to effective participation in decisions affecting us. I therefore demand that MINAE, in coordination with the competent institutions, immediately initiate a public consultation process with the Afro-descendant population of Cahuita, in accordance with international standards and the decisions of the Constitutional Chamber and the IACtHR, to end structural discrimination and ensure recognition of our territorial rights. 4. Final request In light of the foregoing, I respectfully request: 1. That I be informed by official letter whether the regulations mentioned in official letter DVA-0138-2025 were consulted with the Afro-descendant population of Cahuita, in accordance with ILO Conventions 107 and 169. 2.

That the factual and legal grounds preventing Parque Nacional Cahuita from being declared an ancestral territory be detailed, taking into account Costa Rica’s international obligations. 3. That a process of prior, free, and informed consultation with the Afro-descendant population of Cahuita be initiated immediately, in compliance with national and international law, to ensure recognition of our territorial rights and end structural discrimination. For any communication, I may be contacted at [email protected]. I remain available to complete any additional procedure necessary to process this request and request a response within the time limits established by the regulations in force (…)” (sic) (see the evidence submitted by the appellant and added to the digital case file).

By means of official letter No. DVA-0147-2025 of 10 de noviembre de 2025, the Vice Minister of the Environment replied to the appellant: “(…) In response to your letter MLV-00113-2025 of 27 de octubre de 2025, in which you request that a public consultation be conducted with the Afro-descendant population of Cahuita and seek clarification regarding the legal grounds governing Parque Nacional Cahuita in relation to ILO Convention 169, I hereby advise you as follows: This letter reiterates letter MLV-111-2025, which was addressed through DVA0138-2025; accordingly, the position expressed by this Vice Ministry remains unchanged. Regarding your inquiry as to whether the Organic Law of the Environment, the Biodiversity Law, and the National Parks Law had been subject to prior, free, and informed consultation with the Afro-descendant population of Cahuita, because the enactment of laws falls within the authority of the Legislative Branch, you must submit the inquiry to that body so that the legislative files for the bills may be reviewed, since this procedure does not fall within our authority and that information is not contained in our records.

Executive Decrees issued by the Executive Branch are adopted in accordance with the required procedure, and consultations are conducted as provided by the regulations of the Directorate of Regulatory Improvement of the Ministry of Economy, Industry and Commerce, as the governing body for Regulatory Improvement and Simplification of Procedures. That Directorate coordinates the implementation of projects for the simplification of procedures and the reform of laws and regulations, and advises public institutions on regulatory improvement. It is also responsible for ensuring compliance with the Law for the Protection of Citizens from Excessive Administrative Requirements and Procedures, Law No. 8220, and for promoting transparency and citizen participation in the process of creating and amending regulations. Regarding your request that consultations and actions related to the Afro-descendant population be undertaken, I advise you that, pursuant to Executive Decree No. 43532-MP-MINAE-MCJ-MEP, ‘Verification of the Self-Recognition of the Afro-Costa Rican Population as a Tribal People,’ the Afro-Costa Rican tribal people established the Foro del Pueblo Tribal Afrocostarricense as a forum for consultation, dialogue, and coordination between the Afro-Costa Rican tribal people and government institutions.

The Asociación de Desarrollo Integral de Cahuita is responsible for organizing the Foro del Pueblo Tribal Afrocostarricense. As established by Voto 2025-000480 of nine hours and twenty minutes on diez de enero de dos mil veinticinco, Expediente 24-012620-0007-CO, it was reiterated to you that you did not hold lawful representative authority (legítima representación) for this Forum (…) In accordance with the foregoing, our Ministry has not received any formal submission from the Asociación de Desarrollo Integral de Cahuita on behalf of the Foro del Pueblo Tribal Afrocostarricense concerning territorial rights in Parque Nacional Cahuita; consequently, granting your request to conduct a process of prior, free, and informed consultation with the Afro-descendant population of Cahuita is inadmissible due to lack of standing (falta de legitimación) (…)” (sic) (see the evidence submitted by the appellant and added to the digital case file).

VI.Regarding the specific case. In the case at hand, it has been established that, through official letter No. MLV-00111-2025 of 12 de octubre de 2025, the appellant submitted the following to the President of the Republic and the President of the National Environmental Council: “(…) Subject: Urgent call for the issuance of an Executive Decree, grounded in ILO Conventions 107 and 169, declaring Cahuita National Park to be ancestral territory of the Afro-Costa Rican population as a tribal people; harmonization with Letter SINAC-SE-DE-1171-2025 and alignment with the international case law of the Inter-American Court of Human Rights and the national case law of the Constitutional Chamber of the Supreme Court of Justice. Dear Mr. President and Mr. Minister: I am writing to you in my capacity as an Afro-Costa Rican citizen, a direct descendant of the tribal communities of Costa Rica’s southern Caribbean region, and as the moral representative of the generations that have safeguarded the ancestral territory of Cahuita National Park since time immemorial.

As an active member of the national Afro-descendant community and in support of the Cahuita Comprehensive Development Association (ADIC), founded in 1976 to safeguard our cultural and environmental heritage, I most respectfully and urgently request the immediate issuance of an Executive Decree declaring Cahuita National Park to be ancestral territory of our Afro-Costa Rican tribal population. This measure, firmly grounded in Conventions numbers 107 and 169 of the International Labour Organization (ILO), ratified by Costa Rica, is consistent with the extensive international case law of the Inter-American Court of Human Rights (IACtHR) and the national case law of the Constitutional Chamber of the Supreme Court of Justice, incorporating as key historical inputs Ley N° 9612 (Ley del Calipso) and the recent, historic ruling of the Constitutional Chamber of septiembre de 2025 ordering consultation with the Afro-descendant population concerning the Southern Caribbean Coastal Zoning Plan in Talamanca.

The primary purpose of this call is to reconcile the administrative and financial limitations set forth in Letter SINAC-SE-DE-1171-2025, dated 22 de agosto de 2025, signed by Mr. David Chavarría Morales, Acting Executive Director of the National System of Conservation Areas (SINAC), and addressed to Mr. Jorge Mario Rodríguez Zuñiga, Deputy Minister of Environment of the Ministry of Environment and Energy (MINAE), thereby promoting a sustainable shared-governance model that honors our collective rights to territory, prior consultation, and effective participation in its administration. I. Comprehensive Historical Contextualization: The Ancestral Connection of the Afro-Costa Rican Population to the Territory of Cahuita National Park (…) II. Rigorous Legal Basis: ILO Conventions 107 and 169 as Binding State Obligations (…) III. Alignment with the Comprehensive International Case Law of the Inter-American Court of Human Rights (…) IV.

Harmonization with the Extensive National Case Law of the Constitutional Chamber: Landmark Precedents Protecting Indigenous and Tribal Peoples (…) V. Specific Proposal, Urgency, and Implementation Measures I call upon both of you to jointly issue, within a period not exceeding 30 days, an Executive Decree that: (i) declares Cahuita National Park to be ancestral territory of the Afro-Costa Rican population, demarcating its boundaries in accordance with articles 14 and 17 of Convention 169; (ii) updates the SINAC-ADIC Agreement with mechanisms for ongoing FPIC, the autonomous transfer of funds collected as earmarked revenue (Ley N° 9635, art. 25), and tribal worldview protocols; (iii) establishes a governance council with a community majority, incorporating Ley del Calipso and the ruling of septiembre de 2025; and (iv) directs MINAE and the Ministry of Finance to coordinate budgets to ensure its sustainability.

This action would not only resolve the limitations identified in the SINAC Letter, but would also fulfill international obligations, prevent litigation before the IACtHR, and strengthen Costa Rica’s human-rights reputation. I remain available for an immediate hearing in your offices and to provide input for the draft. I trust in your commitment to constitutional justice and international treaties to act with the urgency demanded by our ancestral history (…)” (sic) (emphasis not in the original). Through official letter No. DVA-0138-2025 of 27 de octubre de 2025, the Deputy Minister of Environment explained to the petitioner: “(…) In response to your communication MLV-00111-2025 of 12 de octubre de 2025, through which you request that the Executive Branch issue an Executive Decree declaring Cahuita National Park to be ancestral territory of the Afro-Costa Rican population, as well as the updating of the SINAC-ADI Cahuita Agreement, I hereby advise you as follows: a) Cahuita National Park, within the framework of the Organic Law of the Environment, the Biodiversity Law, and the National Parks Law, and in accordance with the authority over natural resources assigned to MINAE by Ley 7152, has been officially designated as a protected wilderness area under the national park management category. b) Through Executive Decree No. 1236 of 07 de setiembre de 1970, the Executive Branch established Cahuita National Monument.

Article 1 of Executive Decree No. 8489 of 27 de abril de 1978 changed its name to Cahuita National Park, and subsequently, through article 1° of Ley No. 6794 of 25 de agosto de 1982, Executive Decrees Nos. 1236-A of 7 de setiembre de 1970 and 8489-A of 27 de abril de 1978 were ratified as laws of the Republic. Consequently, and within the scope of our powers and authority, Cahuita National Park was officially created by law, in compliance with the requirements established for designating a protected wilderness area. It is not within the authority of our Ministry to declare ‘Cahuita to be ancestral territory of the Afro-Costa Rican population,’ since this is not a formally established management category, nor does our authority encompass the recognition or assignment of rights to Indigenous or tribal peoples. For purposes of clarifying this matter, it is important to review the opinion issued by the Office of the Attorney General of the Republic in opinion PGR-C-153-2023 (…) c) With regard to the SINAC-ADI Cahuita Agreement, our Ministry will undertake such measures as are financially and legally feasible, in coordination with the Office of the Comptroller General of the Republic and the Ministry of Finance; therefore, this matter is unrelated to the issuance of an Executive Decree declaring ‘Cahuita to be ancestral territory of the Afro-Costa Rican population.’ d) The Afro-Costa Rican Tribal People’s Forum is currently administered by the Cahuita Comprehensive Development Association; therefore, our Ministry has no involvement in that Association’s decision-making, and you must direct your proposals to that organization (…)” (sic) (emphasis not in the original).

Through official letter No. MLV-00113-2025 of 27 de octubre de 2025, the appellant reiterated the following to the Deputy Minister of Environment: “(…) Subject: Request for public consultation with Cahuita’s Afro-descendant population and clarification concerning the legal bases of Cahuita National Park in relation to ILO Convention 169 (…) I respectfully write to raise the following matters, in the exercise of my fundamental rights and in fulfillment of the Costa Rican State’s international obligations under Conventions 107 and 169 of the International Labour Organization (ILO), article 7 of the Political Constitution of Costa Rica, and the binding case law of the Inter-American Court of Human Rights (IACtHR). 1. Request for prior consultation with Cahuita’s Afro-descendant population Your official letter DVA-0138-2025 states that Cahuita National Park is governed by the Organic Law of the Environment, the Biodiversity Law, the National Parks Law, Executive Decrees No. 1236 of 1970 and No. 8489 of 1978, and Ley No. 6794 of 1982, and that it is not for the Ministry of Environment and Energy (MINAE) to declare Cahuita to be ancestral territory of the Afro-descendant population because this is not an established management category and does not fall within its authority.

Nevertheless, the district of Cahuita is recognized as tribal territory under ILO Convention 169, ratified by Costa Rica through Ley No. 7316 of 1992, article 6 of which establishes the obligation to consult Indigenous and tribal peoples, including Afro-descendant communities, in a prior, free, and informed manner concerning legislative or administrative measures that may directly affect them. Likewise, ILO Convention 107, ratified by Costa Rica through Ley No. 2466 of 1959, strengthens the protection of the rights of tribal populations, including their right to territory. Article 7 of the Political Constitution of Costa Rica enshrines the binding nature of international treaties, granting them a higher rank than national laws and thereby making those provisions binding (…) The failure to consult Cahuita’s Afro-descendant population concerning the legislation and regulations cited in your official letter, including the Wildlife Law and the regulations applicable to Cahuita National Park, constitutes a breach of Costa Rica’s international obligations.

In cases such as Saramaka v. Suriname (2007) and Kichwa Indigenous People of Sarayaku v. Ecuador (2012), the Inter-American Court of Human Rights has established that States have an obligation to consult tribal peoples regarding any measure affecting their ancestral territories, ensuring their effective participation and respecting their collective rights. These judgments are binding upon Costa Rica as a State Party to the American Convention on Human Rights. Accordingly, I respectfully request that I be informed by official letter whether the legislation and regulations cited in your response (the Organic Law of the Environment, the Biodiversity Law, the National Parks Law, and related decrees) were subject to prior, free, and informed consultation with Cahuita’s Afro-descendant population, as required by ILO Conventions 107 and 169 and Inter-American case law. If no such consultation occurred, I demand that the corresponding public consultation be conducted in compliance with the judgments of Costa Rica’s Constitutional Chamber, which, in rulings such as No. 2016-015350, has reiterated the mandatory nature of prior consultation with Indigenous and tribal peoples, and with the decisions of the IACtHR. 2.

Request for the factual and legal grounds for not declaring Cahuita to be ancestral territory Your official letter argues that declaring Cahuita National Park to be ancestral territory does not fall within MINAE’s authority, citing the opinion of the Office of the Attorney General of the Republic (PGR-C-153-2023) concerning the incompatibility between the State natural heritage regime and Indigenous territories. However, this response fails to consider that the district of Cahuita, as tribal territory recognized under ILO Convention 169, has a special status that transcends the management categories established in national protected-wilderness-area legislation. In cases such as Mayagna (Sumo) Awas Tingni v. Nicaragua (2001), the IACtHR has recognized the right of Indigenous and tribal peoples to collective ownership of their ancestral territories, even when those territories overlap with protected areas. Likewise, the Constitutional Chamber, in decisions such as ruling No.

2019-022079 has ordered the Costa Rican State to adopt measures to guarantee the territorial rights (derechos territoriales) of Indigenous and tribal peoples, including the delimitation of their ancestral territories (territorios ancestrales). In this context, I request that the factual and legal grounds preventing Parque Nacional Cahuita from being declared an ancestral territory of the Afro-descendant population be explained to me by official letter (oficio), considering that this omission appears to disregard the international obligations of the Costa Rican State and the binding decisions of the Inter-American Court of Human Rights (Corte IDH). I further request details as to whether MINAE has coordinated with other institutions, such as the Asociación de Desarrollo Integral de Cahuita or the Contraloría General de la República, to advance recognition of the territorial rights of the Afro-descendant population. 3.

Complaint of structural discrimination (discriminación estructural) The refusal to recognize Parque Nacional Cahuita as an ancestral territory and the failure to conduct prior consultation (consulta previa) with the Afro-descendant population constitute a form of structural discrimination against me and the Afro-descendant community of Cahuita. This omission perpetuates the historical denial of our territorial rights, in contravention of the principles of equality and non-discrimination enshrined in Article 33 of the Constitución Política and in international instruments such as the International Convention on the Elimination of All Forms of Racial Discrimination (ratified by Costa Rica through Ley No. 3844 de 1966). The failure to delimit our ancestral territory, in accordance with ILO Conventions 107 and 169, and the omission of prior consultation in the management of Parque Nacional Cahuita violate our right to self-determination (autodeterminación) and to effective participation in decisions affecting us.

I therefore demand that MINAE, in coordination with the competent institutions, immediately initiate a public consultation process (proceso de consulta pública) with the Afro-descendant population of Cahuita, in accordance with international standards and the decisions of the Sala Constitucional and the Corte IDH, in order to end structural discrimination and guarantee recognition of our territorial rights. 4. Final request In light of the foregoing, I respectfully request: 1. That I be informed, by official letter, whether the regulations mentioned in official letter DVA-0138-2025 were the subject of consultation with the Afro-descendant population of Cahuita, in accordance with ILO Conventions 107 and 169. 2. That the factual and legal grounds preventing Parque Nacional Cahuita from being declared an ancestral territory be specified, taking into account Costa Rica’s international obligations. 3.

That a process of free, prior, and informed consultation (consulta previa, libre e informada) with the Afro-descendant population of Cahuita be initiated immediately, in compliance with national and international law, to guarantee recognition of our territorial rights and end structural discrimination. For any communications, I may be contacted at [email protected]. I remain available to complete any additional procedure necessary to process this request and request a response within the time limits established by the regulations in force (…)” (sic) (emphasis not in the original). By official letter No. DVA-0147-2025 of 10 de noviembre de 2025, the Vice Minister of Environment replied to the petitioner (recurrente): “(…) In response to your letter MLV-00113-2025 of 27 de octubre de 2025, in which you request that a public consultation be conducted with the Afro-descendant population of Cahuita and clarification of the legal grounds governing Parque Nacional Cahuita in relation to ILO Convention 169, I hereby inform you as follows: This letter reiterates letter MLV-111-2025, which was addressed through DVA0138-2025; accordingly, the position expressed by this Vice Ministry remains unchanged.

Regarding your inquiry as to whether the Ley Orgánica del Ambiente, the Ley de Biodiversidad, and the Ley de Parques Nacionales had been the subject of free, prior, and informed consultation with the Afro-descendant population of Cahuita, because the enactment of laws falls within the authority of the Poder Legislativo, you must submit the inquiry to that body so that the legislative files (expedientes legislativos) for the bills may be reviewed, since this procedure does not fall within our authority and that information is not contained in our records. Executive Decrees issued by the Poder Ejecutivo are adopted in accordance with the required procedure, and consultations are conducted as prescribed by the regulations of the Dirección de Mejora Regulatoria del Ministerio de Economía Industria y Comercio, as the governing body for Regulatory Improvement and Simplification of Procedures. That Directorate coordinates the implementation of projects to simplify procedures and reform laws and regulations, and advises public institutions on regulatory improvement.

It is also responsible for ensuring compliance with the Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Ley No. 8220, and for promoting transparency and public participation in the process of creating and amending regulations. Regarding your request that consultations and actions concerning the Afro-descendant population be undertaken, I inform you that, pursuant to Decreto Ejecutivo No. 43532-MP-MINAE-MCJ-MEP, “Constatación del auto reconocimiento de la población afrocostarricense como pueblo tribal,” the Afro-Costa Rican tribal people established the Foro del Pueblo Tribal Afrocostarricense as a forum for consultation, dialogue, and coordination between the Afro-Costa Rican tribal people and government institutions. The Asociación de Desarrollo Integral de Cahuita is responsible for organizing the Foro del Pueblo Tribal Afrocostarricense. As established by Voto 2025-000480 of nine twenty a.m. on diez de enero de dos mil veinticinco, Expediente 24-012620-0007-CO, it was reiterated to you that you did not hold lawful representation (legítima representación) of this Forum (…) In view of the foregoing, our Ministry has not received any formal application (gestión formal) from the Asociación de Desarrollo Integral de Cahuita, acting on behalf of the Foro del Pueblo Tribal Afrocostarricense, concerning territorial rights in Parque Nacional Cahuita; consequently, granting your request to conduct a process of free, prior, and informed consultation with the Afro-descendant population of Cahuita is inadmissible due to lack of standing (falta de legitimación) (…)” (sic) (emphasis not in the original).

VII.It is clear that, in essence, the petitioner (promovente) urged the Presidente de la República and the Presidente del Consejo Nacional Ambiental to issue an Executive Decree (Decreto Ejecutivo) which, following consultation, would declare Parque Nacional Cahuita to be ancestral territory of the Afro-Costa Rican population. The legal regime (régimen jurídico) governing Parque Nacional Cahuita is based on Ley No. 6794 de 25 de agosto de 1982, Article 1 of which ratified as Laws of the Republic Decretos Ejecutivos Nos. 1236-A del 7 de setiembre de 1970 Establece Monumento Nacional Cahuita (Ahora Parque Nacional Cahuita), and 8489-A del 27 de abril de 1978 Convierte Monumento Nacional Cahuita en Parque Nacional Cahuita. Consequently, the petitioner urged that an amendment be made by means of an Executive Decree so that the park would henceforth be recognized as Afro-descendant tribal territory, following consultation. This Sala Constitucional, in judgment No. 2020-09049 de las 09:15 horas de 15 de mayo de 2020, explained:

“(…) Certainly, the purpose of the appellant’s request was neither to request specific information nor to file an administrative claim (reclamo administrativo), but rather to issue an exhortation urging the respondent authority to act in accordance with the petitioner’s request; therefore, this submission was exhausted upon its mere filing, with no corresponding obligation on the respondent party to answer it (…)” (emphasis not in the original).

The foregoing is fully applicable to the matter sub examine. The petitioner’s submission was exhausted upon its mere filing, and therefore there is no corresponding obligation on the respondent party to answer it, to decide any specific matter, much less to grant what was sought through the exhortation or formal request (excitativa).

VIII.In any event, the record shows that in official letter No. DVA-0138-2025 de 27 de octubre de 2025, the Viceministro de Ambiente informed the appellant that Parque Nacional Cahuita was created through legislation having the force of law and that, accordingly, the Ministerio de Ambiente y Energía lacks authority to declare it ancestral territory of the Afro-Costa Rican population (a management category (categoría de manejo) that, moreover, has not been formally established). In official letter No. DVA-0147-2025 de 10 de noviembre de 2025, the response was supplemented by informing him that he should appear before the Asamblea Legislativa to determine whether or not the existing legislation had previously been the subject of consultation with the Afro-descendant population. Furthermore, with respect to the Convenio SINAC-ADI Cahuita, it was explained to him that such financially and legally feasible measures as may be available would be undertaken in coordination with the Contraloría General de la República and the Ministerio de Hacienda; and he was advised to submit his proposals to the Foro del Pueblo Tribal Afrocostarricense, currently administered by the Asociación de Desarrollo Integral de Cahuita, which serves as the coordinating body for these matters. No indication of any discrimination can be inferred from this.

IX.In the filing added to the digital case file (expediente digital) at 11:56 horas de 25 de noviembre de 2025, [Nombre 001] emphasized that the purpose of this proceeding is: “(…) to obtain a binding judicial declaration recognizing and declaring Parque Nacional Cahuita to be ancestral territory and, consequently, Afro-descendant territory, by virtue of the international obligations assumed by the Costa Rican State under Convenios N° 107 (Convenio sobre Poblaciones Indígenas y Tribales, 1957) y N° 169 (Convenio sobre Pueblos Indígenas y Tribales en Países Independientes, 1989) de la Organización Internacional del Trabajo (OIT), ratificados por Costa Rica mediante Ley N° 3048 del 27 de junio de 1962 (para el 107) y Ley N° 7316 del 16 de diciembre de 1992 (para el 169) (…)” (sic). The petitioner is advised that it is not for this Sala Constitucional to amend the legal system and issue the resulting declaration that he seeks. Doing so exceeds both the summary nature of the amparo proceeding (recurso de amparo) and the jurisdiction of this Court, as defined by law and by the Constitución Política itself.

X.If the appellant believes that the Ministro de Ambiente y Energía committed an offense when submitting his report, he must file a complaint with the Ministerio Público so that it may initiate the relevant investigations.

XI. Conclusion. Under these circumstances, the amparo proceeding is manifestly inadmissible, and must be so declared

XII.Note by Justice Garro Vargas. In this matter, I concur with the majority’s decision that the proceeding must be dismissed, but on the following grounds.

In the initial filing, the appellant asks the Sala Constitucional to declare Parque Nacional Cahuita to be ancestral Afro-descendant territory and to order the State to take the necessary measures for its demarcation, collective titling, and intercultural management. In light of this request, I consider it necessary to reiterate the position I expressed in judgments nro. 2025-032461 de las 13:56 horas del 3 de octubre de 2025 and nro. 2026-003395 de las 09:20 horas del 30 de enero de 2026, in which I stated, by way of summary, that recognition of such magnitude—the status of a particular community as a tribal people—is a matter for the legislature to undertake in accordance with the principle of statutory reservation (principio de reserva de ley) and the principle of reasonableness (principio de razonabilidad), so that it may clearly establish the conditions, effects, and scope of that legal category within the framework of the principle of participation (principio de participación) derived from art. 9 de la Constitución Política.

XIII.Documentation submitted to the case file. The parties are hereby advised that, if they submitted any paper document, as well as any objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, they must retrieve them from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not retrieved within that period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta y cuatro minutos del trece de febrero de dos mil veintiseis .

Recurso de amparo interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra el MINISTRO DE AMBIENTE Y ENERGÍA (MINAE).

Resultando:

  1. 1Por medio del escrito agregado al expediente digital a las 15:50 horas de 28 de octubre de 2025, [Nombre 001] presentó un recurso de amparo en contra del MINAE. El recurrente mediante el oficio No. MLV-00111-2025 de 12 de octubre de 2025, exhortó al Presidente de la República y al Presidente del Consejo Nacional Ambiental, para que emitieran un Decreto Ejecutivo, que declare el Parque Nacional Cahuita como territorio ancestral de la población afrocostarricense, previa consulta a esa población, modificando así la normativa vigente. Reclamó que el 27 de octubre de 2025, mediante el oficio No. DVA-0138-2025, el Viceministro del Ambiente denegó lo pretendido. Pidió a la Sala Constitucional que declare el Parque Nacional Cahuita como territorio ancestral afrodescendiente, ordenando al Estado las medidas necesarias para su delimitación, titulación colectiva y gestión intercultural. Solicitó que se declare con lugar el recurso.
  2. 2Por medio del escrito agregado al expediente digital a las 15:04 horas de 11 de noviembre de 2025, Bentlin Villalobos Grant, ciudadano afrodescendiente y Presidente de la Asociación de Desarrollo Comunal de Cahuita, presentó una solicitud de coadyuvancia activa.
  3. 3Mediante el escrito agregado al expediente digital a las 15:27 horas de 11 de noviembre de 2025, [Nombre 001], aportó como prueba para mejor resolver el oficio No. DVA-0147-2025 del Viceministerio de Ambiente y Energía. Destacó: “(…) Dicho oficio, que adjunto en su integridad como Anexo 1, responde a mi nota MLV-00113-2025 del 27 de octubre de 2025, en la cual solicité la realización de una consulta previa, libre e informada (CPLI) a la población afrodescendiente de Cahuita, conforme al Convenio 169 de la Organización Internacional del Trabajo (OIT), así como aclaraciones sobre los fundamentos legales del Parque Nacional Cahuita en relación con dicho instrumento internacional. En el oficio remitido, el Viceministro reitera posiciones previas, remite competencias al Poder Legislativo y, fundamentalmente, niega mi legitimación activa para impulsar tales gestiones, argumentando que solo la Asociación de Desarrollo Integral de Cahuita (ADIC), en representación del Foro del Pueblo Tribal Afrocostarricense, ostenta dicha capacidad.Esta postura, como expondré a continuación, contraviene principios fundamentales de derechos humanos y perpetúa una discriminación estructural histórica contra la comunidad afrodescendiente. I. Incompatibilidad con los Convenios 107 y 169 de la OIT y la Obligación de Aplicación Directa Los Convenios 107 (ratificado por Costa Rica en 1959) y 169 (ratificado en 1993) de la OIT protegen los derechos de pueblos indígenas y tribales, incluyendo el derecho a la consulta previa, libre e informada sobre medidas que les afecten directamente (artículo 6 del Convenio 169). En el caso de la población afrocostarricense, reconocida como pueblo tribal mediante el Decreto Ejecutivo N° 43532-MP-MINAE-MCJ-MEP del 5 de mayo de 2022, estas normas son de aplicación inmediata y vinculante, incluso en ausencia de normativa nacional específica. Dicho decreto, que constata el autoreconocimiento de la población afrocostarricense como pueblo tribal, establece el Foro del Pueblo Tribal Afrocostarricense como instancia de consulta, pero no limita la legitimación individual para invocar derechos colectivos.El oficio del Viceministro ignora esta obligación al condicionar cualquier gestión a una representación exclusiva de la ADIC, obviando que el Convenio 169 exige la delimitación geográfica de territorios ancestrales como paso previo a cualquier consulta efectiva (artículos 13 a 19). Resulta ilógico y contrario a la lógica jurídica ordenar consultas sin un mapa que ubique la comunidad afrodescendiente, como ha sido requerido en jurisprudencia reciente de esta Sala, por ejemplo, en la sentencia que ordena consultar el Plan Regulador Costero del Caribe Sur a la población afrodescendiente. II. Legitimación Activa de Cualquier Ciudadano para Invocar Derechos Humanos, conforme a la Convención Americana sobre Derechos Humanos, Jurisprudencia de la Corte IDH y Ley de Jurisdicción Constitucional La Convención Americana sobre Derechos Humanos (ratificada en 1969), en su artículo 1, obliga al Estado a respetar derechos sin discriminación, y su jurisprudencia, interpretada por la Corte Interamericana de Derechos Humanos (Corte IDH), es de aplicación directa en Costa Rica por virtud del artículo 7 de la Constitución Política, que otorga supremacía a los tratados internacionales sobre derechos humanos.La Ley de Jurisdicción Constitucional (N° 7135), en sus artículos 27 y 48, permite a cualquier persona interponer recursos de amparo para defender derechos fundamentales, sin necesidad de representación exclusiva cuando se trata de intereses colectivos o difusos. La Corte IDH, en casos emblemáticos como Pueblo Saramaka vs. Surinam (2007), Kichwa de Sarayaku vs. Ecuador (2012) y Pueblo Kaliña y Lokono vs. Surinam (2015), ha enfatizado que los Estados deben garantizar la consulta previa y la protección de derechos territoriales de pueblos tribales, reconociendo la legitimación individual y colectiva para su defensa. El argumento del Viceministro de que solo la ADIC está legitimada contraviene estos principios y perpetúa la discriminación estructural histórica contra la población afrodescendiente, manifestada en la falta de aplicación del Convenio 169 pese a precedentes que han amparado derechos de otras minorías, como la población LGBTIQ+ (por ejemplo, sentencia de esta Sala sobre matrimonio igualitario en 2018).Agradezco las recientes resoluciones de esta Sala, como la que ordena la consulta para el Plan Regulador Costero del Caribe Sur y la sentencia N° 2025- 029985, que refuerzan el derecho a la participación del pueblo tribal afrocostarricense. Sin embargo, persiste la omisión en ordenar la delimitación territorial, esencial para evitar violaciones sistemáticas. III. Apoyo de la Asociación de Desarrollo Integral de Cahuita y Reiteración de Pretensiones Ruego a esta Sala tomar nota de que el presente recurso de amparo cuenta con el aval y apoyo irrestricto de la ADIC, según coadyuvancia formal remitida por su representante legal, lo cual fortalece mi legitimación y desvirtúa las alegaciones del Viceministro respecto a la ausencia de gestiones formales por parte de dicha entidad. En consecuencia, reitero mis manifestaciones iniciales y solicito a esta honorable Sala realizar un análisis detallado y exhaustivo del caso, conforme al Convenio 169 de la OIT, la jurisprudencia constitucional sobre derechos indígenas y tribales, los principios constitucionales y la jurisprudencia de la Corte IDH, a fin de no continuar discriminando al suscrito y a la comunidad afrodescendiente.Específicamente, pido: 1. Declarar la incompatibilidad del oficio DVA-0147-2025 con las normas citadas. 2. Ordenar la delimitación geográfica del territorio ancestral de la población afrodescendiente de Cahuita mediante un mapa oficial, como paso previo a cualquier consulta. 3. Exigir al Estado la realización inmediata de la CPLI respecto al Parque Nacional Cahuita y medidas ambientales que afecten a la comunidad. 4. Adoptar medidas cautelares para suspender cualquier intervención en el territorio hasta la resolución definitiva (…)” (sic).
  4. 4Mediante el auto de las 23:08 horas de 13 de noviembre de 2025, se admitió el recurso de amparo y se dio traslado al Ministro y al Viceministro de Ambiente, ambos del MINAE.
  5. 5Por medio del escrito agregado al expediente digital a las 20:36 horas de 18 de noviembre de 2025, Franz Tattenbach Capra y Jorge Mario Rodríguez Zúñiga, Ministro de Ambiente y Energía, y Viceministro de Ambiente, informaron: “(…) Por medio del Decreto Ejecutivo No. 1236-A, que entró en vigor el 24 de setiembre del 1970 se establece Monumento Nacional Cahuita (Ahora Parque Nacional Cahuita). Los motivos, antecedentes y alcance de la disposición del Poder Ejecutivo se establecen en esta norma legal (…) Que mediante artículo 1° de la Ley N° 6794 de 25 de agosto de 1982, se ratifica como Ley de la República el Decreto de creación del Parque Nacional Cahuita (…) El Parque Nacional Cahuita es un área natural protegida, ubicada en la provincia de Limón, Costa Rica, a 202 km al sur de la capital de la provincia. Cuenta con un área de 1067.9 hectáreas terrestres y 22400 hectáreas marinas. Fue creado por el Decreto Ejecutivo 1236-A, del 7 de septiembre de 1970 y es administrado por el Área de Conservación La Amistad Caribe del Sistema Nacional de Areas de Conservación (…) La facultar del Estado de crear esta área silvestre protegida hace 55 años (1970) no tiene conexidad con los reclamos del señor Levy bajo alegatos de “discriminación estructural” al pueblo tribal.Note la Sala que el señor Levy ni siquiera explica en que consiste esa supuesta discriminación de orden “estructural”, partiendo que este tipo de discriminación se define como aquella atribuida a “un sistema de exclusión y marginación que se manifiesta a través de normas, políticas, prácticas y estructuras sociales que, de forma histórica y continua, limitan el goce de derechos de ciertos grupos sociales”. Sobre este particular, no comprende esta instancia ¿Cuáles son los derechos limitados a algún pueblo tribal, no tribal o algún particular que hay violentado el MINAE-SINAC con la creación del Parque Nacional Cahuita hace 55 años? La protección de los recursos naturales del Parque Nacional Cahuita no representa ninguna discriminación estructural, sino el cumplimiento del mandato de protección a los recursos naturales y la aplicación positiva del artículo 50 constitucional. El señor Levy no aporta ninguna prueba fehaciente de discriminación contra él o contra tercera persona.No demuestra la conexidad de la creación de un área silvestre protegida con esa supuesta “discriminación estructural” a un grupo tribal que no representa, la respuesta es sencilla: la creación de esta área protegida hace 55 años (1970) no provoca una violación constitucional ni roza con derechos a grupos tribales o de cualquier otra clase (…) El señor [Nombre 001] remite la nota MLV-00111-2025 del 12 de octubre de 2025 dirigida al señor Rodrigo Chaves Robles, Presidente de la República de Costa Rica y al Ministro de Ambiente y Energía, Franz Tattenbach (…) Esta nota fue atendida por el Viceministerio de Ambiente, Ing. Jorge Mario Rodriguez, y se le remitió la respuesta DVA-0138- 2025 del 27 de octubre de 2025 (…) El señor Levy, nuevamente envía una segunda nota MLV-00113-2025 del 27 de octubre de 2025, replicando la respuesta del señor Viceministro de Ambiente DVA-0138- 2025 (…) Nuevamente, el Viceministerio de Ambiente, responde la misiva MIL 113-2025 mediante la nota DVA-0147-2025 del 10 de noviembre del 2025 (…) Conforme lo ha ratificado la Sala Constitucional Voto 2025- 000480 y Decreto Ejecutivo No. 43532-MP-MINAE-MCJMEP que rige desde el 8 de mayo del 2022 el, el señor [Nombre 001] no está legitimado para actuar ni establecer pretensiones que corresponden al Foro del Pueblo Tribal Afro costarricense representado por la Asociación de Desarrollo Integral de Cahuita, bajo argumentos ser un “ciudadano afrocostarricense, descendiente directo de las comunidades tribales del Caribe sur de Costa Rica”.El Ministerio de Ambiente y Energía, es el administrador del Parque Nacional Cahuita, creado por Ley hace 55 años, (1970) por lo que en ese momento procesal histórico no estaba establecido ninguna consulta obligatoria a pueblos tribales, previa a su creación. Los procesos participativos se encuentran reglados en la Ley de Biodiversidad y son los mecanismos aplicables a las areas silvestre protegidas. En este mismo sentido, la creación de esta área silvestre protegida con categoría de Parque Nacional no violenta ninguna norma de rango constitucional. El señor Levy, no logra fundamentar en que consiste la posible violación a la Constitución Política para presentar este amparo ni prueba ningún tipo de discriminación, todo parece indicar que simplemente no está a gusto con las respuestas que se le brindan, lo cual no implica tampoco alguna violación al derecho de respuesta, pues sus dos notas MLV 111- 2025 y 113-225, fueron respondidas oportunamente por nuestro Ministerio (…) no existe ninguna gestión oficialmente presentada por ante nuestro Ministerio por parte de la Asociación de Desarrollo Integral de Cahuita sobre pretensiones territoriales en el Parque Nacional Cahuita ni consultas sobre algún tema específico relativo a situaciones tribales.La relación del MINAE con la ADI-Cahuita obedece a un tema diferente al asunto tribal, que se encuentra en proceso de buscar una figura de administración para una gobernanza compartida sobre un sector del Parque Nacional Cahuita, bajo previa aprobación del Ministerio de Hacienda y la Contraloría General de la República, situación en la cual el señor Levy no tiene ninguna participación ni representación, por lo que sus argumentos sobre este tema no tienen ninguna relación con algún tema constitucional. Igualmente, el MINAE no tiene competencia para declarar derechos territoriales a grupos tribales, de ahí que sea improcedente la solicitud del señor Levy de que se emita mediante “un Decreto Ejecutivo, sustentado en los Convenios 107 y 169 de la OIT, declarando el Parque Nacional Cahuita como territorio ancestral de la población afrocostarricense como pueblo tribal” (MLV 111-2025) ; así como tampoco le corresponde exigir una “consulta pública a la población afrodescendiente de Cahuita y aclaración sobre fundamentos legales del Parque Nacional Cahuita en relación con el Convenio 169 de la OIT” (MLV 113-2025).El señor Levy pretende atribuirse la representación de pobladores, ciudadanos y pueblos tribales sin ninguna legitimación para buscar beneficios que no resultan claros ni oportunos. Que los fundamentos que indica el señor Levy para presentar este recurso de Amparo no constituyen una violación a ninguna norma constitucional, cuando indica los siguientes motivos de justificación (…) El señor Levy omite deliberadamente aportar a esta Sala la respuesta DVA-0147-2025, de fecha 10 de noviembre de 2025, en la cual se rechaza su gestión por carecer de legitimación para actuar en nombre del Foro Tribal. En dicho oficio se le indica expresamente la razón por la cual no procede la consulta pública solicitada. Asimismo, es falso que las notas MLV-111-2025 y MLV-113- 2025 contengan referencias sobre “la existencia de un cementerio afrodescendiente dentro del Parque Nacional Cahuita, conocido por las autoridades del MINAE, y el reciente descubrimiento de dos barcos esclavistas de origen danés, los cuales refuerzan el carácter ancestral del territorio”.Estas afirmaciones son introducidas en las pretensiones del recurso de amparo con el único propósito de exagerar sus argumentos, sin que exista relación causal alguna con la supuesta “discriminación estructural”. De igual forma, no se aporta prueba alguna que demuestre que este Ministerio incurre en actos de discriminación contra algún pueblo tribal por el hecho de crear y administrar el Parque Nacional Cahuita. No resulta razonable que el simple dicho de un gestionante, sin respaldo probatorio, obligue a activar la maquinaria administrativa y judicial para atender gestiones infundadas, cuyo verdadero fin parece ser evadir los Tribunales de Justicia. Tal proceder le permite litigar sin costo económico significativo y sin cumplir con los requisitos mínimos para la admisión de una demanda, únicamente para alcanzar objetivos personales (…)” (sic).
  6. 6Por medio del escrito agregado al expediente digital a las 16:25 horas de 19 de noviembre de 2025, [Nombre 001], se refirió a lo informado: “(…) Omisión de la evidencia histórica y cultural: El informe ignora la existencia de un cementerio afrodescendiente dentro del Parque Nacional Cahuita, conocido por las autoridades del MINAE, así como el reciente descubrimiento de dos barcos esclavistas de origen danés en aguas adyacentes, que refuerzan el carácter ancestral del territorio. Esta evidencia, respaldada por estudios antropológicos y arqueológicos (como los reportados por el Museo Nacional de Costa Rica y la UNESCO en relación con sitios patrimoniales afrocaribeños), demuestra que Cahuita no es meramente un “área silvestre protegida” creada en 1970, sino un espacio ocupado ancestralmente por comunidades afrodescendientes desde el siglo XIX, descendientes de esclavizados jamaicanos y africanos.Ignorar esto viola el artículo 14 del Convenio 169 de la OIT, que obliga al Estado a reconocer derechos de propiedad y posesión sobre tierras tradicionalmente ocupadas. 2. Negación de la CPLI: El oficio DVA-0138-2025 del 27 de octubre de 2025, citado en el informe, omite cualquier referencia a la consulta previa con la población afrodescendiente, a pesar de que el distrito de Cahuita es reconocido como territorio tribal al amparo del Convenio 169. Esta omisión perpetúa la discriminación estructural, como ha reconocido esta Sala en el Voto N° 2023-023903 (Expediente 23-903), donde se ordenó el reconocimiento de las poblaciones afrodescendientes del Caribe costarricense como pueblo tribal, con derechos a la autodeterminación y consulta. Asimismo, en el Voto N° 2025- 00480 (Expediente 24-012620-0007-CO), la Sala reiteró la necesidad de procesos de consulta para temas que afecten territorios tribales, rechazando argumentos de falta de legitimación cuando se invoca discriminación colectiva. 3.Desconocimiento de obligaciones internacionales: El informe cita el criterio PGR-C-153-2023 de la Procuraduría General de la República para alegar “incompatibilidad” entre el patrimonio natural del Estado y derechos tribales, pero esto ignora la supremacía de los tratados internacionales (artículo 7 de la Constitución Política) y la jurisprudencia de la Corte IDH. En el caso Saramaka vs. Suriname (Serie C N° 172, 2007), la Corte IDH extendió los derechos territoriales indígenas a pueblos tribales afrodescendientes, reconociendo su derecho a la propiedad colectiva sobre tierras ancestrales, incluso en áreas protegidas ambientalmente, siempre que se garantice la CPLI y la participación en beneficios (párrs. 96-115). Similarmente, en Kichwa de Sarayaku vs. Ecuador (Serie C N° 245, 2012), se enfatizó que la omisión de consulta viola los artículos 21 (derecho a la propiedad) y 1.1 (no discriminación) de la CADH.En Costa Rica, esta Sala ha aplicado directamente el Convenio 169 (Voto N° 2000-05290), declarando su vigencia inmediata y vinculante, y ordenando consultas en casos análogos, como en el Voto N° 2025-029240 (Expediente 25-020061- 0007-CO), donde se rechazó la mera “inconformidad” como base para denegar derechos, enfatizando la tutela efectiva (…) El informe del MINAE invoca erróneamente la LJC para justificar su posición, pero omite que el artículo 29 de dicha ley permite el amparo contra omisiones que perpetúen violaciones a derechos fundamentales, incluyendo aquellos derivados de tratados internacionales (artículo 48 LJC). Esta Sala, como guardiana de la supremacía constitucional (artículo 10 CP), tiene precedentes vinculantes erga omnes para corregir discriminaciones estructurales. 1. Discriminación estructural contra afrodescendientes: El informe niega la existencia de discriminación, preguntando retóricamente “¿Cuáles son los derechos limitados?”.Sin embargo, esta Sala ha reconocido la discriminación estructural en el Voto N° 2025-029240, advirtiendo que no compete a la Sala revisar legalidad ordinaria, pero sí tutelar derechos cuando hay omisiones que perpetúan desigualdades. La Corte IDH, en el caso Pueblo Garífuna de Punta Piedra vs. Honduras (Serie C N° 304, 2015), condenó discriminaciones estructurales contra afrodescendientes, obligando a restituir territorios ancestrales. En Costa Rica, el Decreto Ejecutivo N° 43532-MP-MINAE-MCJMEP (2022) constata el auto-reconocimiento de afrodescendientes como pueblo tribal, pero el MINAE lo usa para denegar legitimación, ignorando que el artículo 3 del Convenio 169 prohíbe discriminación y obliga a medidas afirmativas. Esta discriminación se manifiesta en la falta de reconocimiento territorial durante 55 años, violando el artículo 33 CP (igualdad) y el artículo 50 (ambiente sano, que debe equilibrarse con derechos culturales). 2.Legitimación activa: El informe alega falta de legitimación, citando el Voto N° 2025-000480, pero omite que actúo en mi condición personal como afrodescendiente afectado, no como representante del Foro del Pueblo Tribal Afrocostarricense. La LJC (artículo 30) permite el amparo a cualquier persona afectada directamente, y esta Sala ha ampliado la legitimación en casos de derechos colectivos (Voto N° 2013-016699, sobre minorías). La Corte IDH, en el caso Comunidad Moiwana vs. Suriname (Serie C N° 124, 2005), reconoció legitimación individual en reclamos territoriales tribales, enfatizando que la discriminación colectiva no requiere representación formal. 3. Carácter ancestral del Parque Nacional Cahuita: Creativamente, propongo que la Sala considere el parque no como “patrimonio natural incompatible” con derechos tribales, sino como un espacio híbrido donde la conservación ambiental coexista con gobernanza tribal, como en el modelo de “reservas de biosfera” de la UNESCO.El artículo 15 del Convenio 169 obliga a consultar antes de explotar recursos en territorios tribales, y el artículo 21 CADH protege la propiedad colectiva. Pruebas como restos humanos afrodescendientes y naufragios esclavistas (documentados en informes del Instituto Nacional de Antropología) demuestran ocupación ancestral, exigiendo restitución. III. REFUTACIÓN ESPECÍFICA DEL FONDO DEL INFORME • Antecedentes de creación del parque: El informe enfatiza el Decreto N° 1236-A de 1970, pero omite que en esa época Costa Rica ya había ratificado el Convenio 107 de la OIT (Ley N° 3842 de 1965), precursor del 169, que obligaba a respetar derechos territoriales. La ratificación del 169 en 1992 obliga retroactivamente a revisar declaratorias que ignoren CPLI. • Respuestas administrativas: Las notas DVA-0138-2025 y DVA-0147-2025 son cosméticas, no substantivas, violando el artículo 27 CP (derecho a respuesta pronta y fundada). • Falta de prueba: Contrario, aporto evidencia histórica; el MINAE debe probar compatibilidad, no yo (principio pro homine, artículo 29 CADH) (…)” (sic).Pidió a la Sala Constitucional: “(…) Ordenar al Poder Ejecutivo emitir un Decreto declarando el Parque Nacional Cahuita como territorio ancestral tribal afrodescendiente, con CPLI permanente y gobernanza compartida (…)” (sic).
  7. 7Por medio del escrito agregado al expediente digital a las 13:02 horas de 21 de noviembre de 2025, [Nombre 001], aportó prueba para mejor resolver, una carta suscrita por Valerie Rose Machore, aparentemente Vicepresidenta de la Asociación de Desarrollo Integral de Cahuita presentada ante el Ministro de Ambiente y Energía el 29 de agosto de 2025. Pidió se le brinde audiencia al Ministro de Ambiente y Energía por haber mentido bajo juramento. Además aportó un comunicado de prensa. Pidió se declare la falsedad ideológica cometida por el Ministro.
  8. 8Mediante el escrito agregado al expediente digital a las 14:15 horas de 21 de noviembre de 2025, [Nombre 001], aportó el oficio No. CARTA-SINAC-SE-DE-1171-2025 como prueba para mejor resolver.
  9. 9Por medio del escrito agregado al expediente digital a las 15:00 horas de 21 de noviembre de 2025, [Nombre 001] aportó un comunicado de prensa como prueba para mejor resolver.
  10. 10Mediante el escrito agregado al expediente digital a las 11:56 horas de 25 de noviembre de 2025, [Nombre 001] señaló: “(…) Como recurrente en el referido expediente, reitero que el fin primordial de esta acción judicial es obtener una declaración judicial vinculante que reconozca y declare al Parque Nacional Cahuita como territorio ancestral y, consecuentemente, como territorio afrodescendiente, en virtud de las obligaciones internacionales asumidas por el Estado costarricense derivadas de los Convenios N° 107 (Convenio sobre Poblaciones Indígenas y Tribales, 1957) y N° 169 (Convenio sobre Pueblos Indígenas y Tribales en Países Independientes, 1989) de la Organización Internacional del Trabajo (OIT), ratificados por Costa Rica mediante Ley N° 3048 del 27 de junio de 1962 (para el 107) y Ley N° 7316 del 16 de diciembre de 1992 (para el 169). Esta declaración es imperativa para resolver una deuda histórica del Estado costarricense con la población afrodescendiente de Costa Rica, y particularmente con el distrito de Cahuita, el cual ha sido reconocido expresamente como territorio afrodescendiente mediante Decreto Ejecutivo N° 43532-MP-MINAEMCJ-MEP del 5 de mayo de 2022, que constata el autoreconocimiento de la población afrocostarricense como pueblo tribal, en armonía con el Decreto Ejecutivo N° 43191-MP-MCJ del 31 de agosto de 2021 sobre el Reconocimiento de Pueblos Tribales Afrocostarricenses, y la Ley de Reconocimiento de Pueblo Tribal a la Población Afrocostarricense (publicada en La Gaceta N° 200 del 30 de octubre de 2023).Esta petición se fundamenta en la jurisprudencia consolidada de esta Sala Constitucional, la cual ha reconocido de manera progresiva los derechos colectivos de los pueblos tribales, incluyendo a las comunidades afrodescendientes, como titulares de derechos territoriales ancestrales y al derecho a la consulta previa, libre e informada. Por ejemplo, en la Resolución N° 2025-035746 (expediente similar 25-028937-0007-CO), esta Sala ordenó al Instituto Costarricense de Turismo realizar una consulta previa al pueblo tribal afrodescendiente de Cahuita en relación con el Plan Maestro Turístico del Sector Costero del Caribe, invocando el artículo 6 del Convenio 169 de la OIT y enfatizando el carácter supra constitucional de dicho instrumento para garantizar un diálogo intercultural efectivo. Asimismo, en la sentencia N° 2025-029985, esta Sala extendió dicha obligación de consulta a la población afrodescendiente de Cahuita, Puerto Viejo y Manzanillo respecto al Plan Regulador Costero del Caribe Sur, reconociendo que el Convenio 169 es de aplicación directa y vinculante a pueblos tribales no indígenas, alineándose con el voto N° 2025-035746 que establece el “derecho supra constitucional de consulta a las comunidades afrodescendientes y territorios ancestrales”.Esta jurisprudencia, en concordancia con votos históricos como el N° 2003-07777 (sobre derechos territoriales indígenas) y el N° 2012-01335 (sobre consulta previa en proyectos de impacto), impone al Estado la obligación de proteger los territorios ancestrales ocupados tradicionalmente por pueblos tribales, evitando despojos históricos y promoviendo la reparación de violaciones pasadas. Adicionalmente, esta solicitud se ampara en la jurisprudencia de la Corte Interamericana de Derechos Humanos (Corte IDH), vinculante para Costa Rica en virtud del artículo 7 de la Constitución Política, el cual establece que los tratados internacionales debidamente aprobados tienen autoridad superior a las leyes desde su promulgación. La Corte IDH ha desarrollado un amplio cuerpo jurisprudencial que extiende los derechos de los pueblos indígenas a los pueblos tribales afrodescendientes, reconociendo su derecho a la propiedad colectiva sobre territorios ancestrales bajo el artículo 21 de la Convención Americana sobre Derechos Humanos (Pacto de San José, ratificado por Ley N° 4534 del 23 de febrero de 1970).En el caso Pueblo Saramaka vs. Surinam (Sentencia de 28 de noviembre de 2007, Serie C N° 172), la Corte IDH determinó que las comunidades afrodescendientes (maroons) constituyen pueblos tribales con derechos equivalentes a los indígenas, incluyendo el derecho a la delimitación, demarcación y titulación de sus tierras ancestrales, basándose en su posesión tradicional y en el Convenio 169 de la OIT, aplicable por analogía. Similarmente, en el caso Comunidad Moiwana vs. Surinam (Sentencia de 15 de junio de 2005, Serie C N° 124), la Corte enfatizó la obligación estatal de reparar violaciones históricas a los derechos territoriales y culturales de comunidades afrodescendientes, reconociendo su conexión espiritual y cultural con la tierra. En el caso Pueblo Indígena Kichwa de Sarayaku vs. Ecuador (Sentencia de 27 de junio de 2012, Serie C N° 245), la Corte reiteró que la ausencia de reconocimiento formal de territorios ancestrales constituye una violación continua al derecho a la propiedad colectiva, obligando a los Estados a adoptar medidas de reparación, incluyendo la declaración judicial de derechos territoriales.Finalmente, en el caso Pueblos Kaliña y Lokono vs. Surinam (Sentencia de 25 de noviembre de 2015, Serie C N° 309), la Corte IDH consolidó que los Estados deben garantizar la efectividad de los derechos territoriales de pueblos tribales, incluyendo afrodescendientes, mediante la titulación y protección contra interferencias, bajo pena de responsabilidad internacional. En este contexto, reitero la responsabilidad inaplazable de esta honorable Sala Constitucional en la aplicación efectiva de la Constitución Política, particularmente su artículo 7, el cual ha permanecido inobservado por más de 50 años en relación con el pleno reconocimiento y aplicación del Convenio 107 de la OIT (ratificado en 1962) y su revisión mediante el Convenio 169. Dicha inobservancia ha perpetuado la marginación histórica de la población afrodescendiente en Cahuita, cuyo territorio —incluyendo el área hoy denominada Parque Nacional Cahuita, creado por Ley N° 4462 del 27 de febrero de 1970— ha sido ocupado ancestralmente por comunidades afrodescendientes desde el siglo XIX, como consta en registros históricos y en el Decreto Ejecutivo N° 43532-MPMINAE-MCJ-MEP, que define como territorios ancestrales afrocostarricenses aquellos “principal y tradicionalmente ocupados y desarrollados” por dichas comunidades.La declaración solicitada no solo resolvería esta deuda histórica, alineándose con el principio de progresividad de los derechos humanos (artículo 4 de la Convención Americana), sino que evitaría futuras violaciones, como las denunciadas en el expediente, garantizando la integridad cultural, territorial y ambiental del pueblo tribal afrodescendiente de Cahuita. Por lo expuesto, solicito a esta Sala, en ejercicio de sus potestades constitucionales y conforme a la Ley de la Jurisdicción Constitucional (artículo 48), proceda a declarar el Parque Nacional Cahuita como territorio ancestral afrodescendiente, ordenando al Estado las medidas necesarias para su delimitación, titulación colectiva y gestión intercultural, en cumplimiento de los Convenios 107 y 169 de la OIT, la Convención Americana sobre Derechos Humanos y la jurisprudencia citada. Esta acción es urgente y vehemente, dada la persistencia de amenazas a nuestros derechos colectivos, y contribuirá a la justicia social y al fortalecimiento del Estado de Derecho en Costa Rica (…)” (sic) (el énfasis no pertenece al original).
  11. 11En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta el Magistrado Araya García; y,

Considerando:

I.Objeto del recurso. El recurrente mediante el oficio No. MLV-00111-2025 de 12 de octubre de 2025, exhortó al Presidente de la República y al Presidente del Consejo Nacional Ambiental, para que emitieran un Decreto Ejecutivo, que declare el Parque Nacional Cahuita como territorio ancestral de la población afrocostarricense, previa consulta a esa población, modificando así la normativa vigente. Reclamó que el 27 de octubre de 2025, mediante el oficio No. DVA-0138-2025, el Viceministro del Ambiente denegó lo pretendido. Pidió a la Sala Constitucional que declare el Parque Nacional Cahuita como territorio ancestral afrodescendiente, ordenando al Estado las medidas necesarias para su delimitación, titulación colectiva y gestión intercultural.

II.Cuestión preliminar: sobre la coadyuvancia planteada. Por medio del escrito agregado al expediente digital a las 15:19 horas de 7 de noviembre de 2025, Bentlin Villalobos Grant, cédula de identidad No. 02-0697-0252, como ciudadano afrodescendiente y Presidente de la Asociación de Desarrollo Comunal Cahuita, planteó una solicitud de coadyuvancia activa. La coadyuvancia es una forma de intervención adhesiva que se da, cuando una persona actúa en un proceso, adhiriéndose a las pretensiones de algunas de las partes principales.

III.Está legitimado para actuar como coadyuvante quien ostente un interés directo en el resultado del recurso; sin embargo, al no ser actor principal, el coadyuvante no resultará directamente afectado por la sentencia, es decir, la eficacia de ésta no podrá alcanzarle de manera directa e inmediata, ni le afecta la condición de cosa juzgada del pronunciamiento (véanse, entre otras, las Sentencia N° 2010-000254, de las 11:28 horas el 08 de enero de 2010, y la N° 2018019952, de las 9:30 horas de 30 de noviembre de 2018).

IV.El gestionante no demostró ostentar la condición de Presidente de la Asociación de Desarrollo Comunal Cahuita, por lo que la coadyuvancia se rechaza en cuanto tal, y se admite, solo como ciudadano afrodescendiente.

V.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

Por medio del oficio No. MLV-00111-2025 de 12 de octubre de 2025, el recurrente planteó al Presidente de la República y al Presidente del Consejo Nacional Ambiental, lo siguiente: “(…) Asunto: Exhorto urgente para la emisión de un Decreto Ejecutivo, sustentado en los Convenios 107 y 169 de la OIT, declarando el Parque Nacional Cahuita como territorio ancestral de la población afrocostarricense como pueblo tribal; armonización con la Carta SINAC-SE-DE-1171-2025 y alineación con la jurisprudencia internacional de la Corte Interamericana de Derechos Humanos y nacional de la Sala Constitucional de la Corte Suprema de Justicia. Estimado Señor Presidente y señor Ministro: Me dirijo a ustedes en mi condición de ciudadano afrocostarricense, descendiente directo de las comunidades tribales del Caribe sur de Costa Rica, y en representación moral de las generaciones que han custodiado el territorio ancestral del Parque Nacional Cahuita desde tiempos inmemoriales.

Como miembro activo de la comunidad afrodescendiente nacional y en apoyo a la Asociación de Desarrollo Integral de Cahuita (ADIC), fundada en 1976 para salvaguardar nuestra herencia cultural y ambiental, solicito con el mayor respeto y urgencia la emisión inmediata de un Decreto Ejecutivo que declare el Parque Nacional Cahuita como territorio ancestral de nuestra población tribal afrocostarricense. Esta medida, rigurosamente fundamentada en los Convenios números 107 y 169 de la Organización Internacional del Trabajo (OIT), ratificados por Costa Rica, se alinea con la extensa jurisprudencia internacional de la Corte Interamericana de Derechos Humanos (Corte IDH) y la nacional de la Sala Constitucional de la Corte Suprema de Justicia, incorporando como insumos históricos clave la Ley N° 9612 (Ley del Calipso) y el reciente e histórico voto de la Sala Constitucional de septiembre de 2025 que ordena la consulta a la población afrodescendiente respecto del Plan Regulador Costero del Caribe Sur en Talamanca.

El propósito primordial de esta exhortación es armonizar las limitaciones administrativas y financieras expuestas en la Carta SINAC-SE-DE-1171-2025, de fecha 22 de agosto de 2025, suscrita por el señor David Chavarría Morales, Director Ejecutivo interino del Sistema Nacional de Áreas de Conservación (SINAC), y dirigida al señor Jorge Mario Rodríguez Zuñiga, Viceministro de Ambiente del Ministerio de Ambiente y Energía (MINAE), promoviendo así un modelo de gobernanza compartida sostenible que honre nuestros derechos colectivos al territorio, a la consulta previa y a la participación efectiva en su administración. I. Contextualización Histórica Exhaustiva: El Vínculo Ancestral de la Población Afrocostarricense con el Territorio del Parque Nacional Cahuita (…) II. Fundamentación Normativa Rigurosa: Los Convenios 107 y 169 de la OIT como Obligaciones Estatales Vinculantes (…) III. Alineación con la Jurisprudencia Internacional Exhaustiva de la Corte Interamericana de Derechos Humanos (…) IV.

Armonización con la Jurisprudencia Nacional Amplia de la Sala Constitucional: Precedentes Emblemáticos en Protección de Pueblos Indígenas y Tribales (…) V. Propuesta Específica, Urgencia y Medidas de Implementación Exhorto a ambos señores a emitir, de manera conjunta y en un plazo no mayor a 30 días, un Decreto Ejecutivo que: (i) declare el Parque Nacional Cahuita como territorio ancestral de la población afrocostarricense, demarcando sus límites conforme a los artículos 14 y 17 del Convenio 169; (ii) actualice el Convenio SINAC-ADIC con mecanismos de CPLI permanente, transferencia autónoma de recursos recaudados como destino específico (Ley N° 9635, art. 25), y protocolos de cosmovisión tribal; (iii) establezca un consejo de gobernanza con mayoría comunitaria, integrando la Ley del Calipso y el voto de septiembre de 2025; y (iv) ordene al MINAE y Hacienda coordinar presupuestos para su sostenibilidad.

Esta acción no solo resolvería las limitaciones de la Carta SINAC, sino que cumpliría obligaciones internacionales, evitando litigios ante la Corte IDH y fortaleciendo la imagen de Costa Rica en derechos humanos. Quedo a disposición para una audiencia inmediata en sus despachos, aportando insumos para el borrador. Confío en su compromiso con la justicia constitucional y los tratados internacionales para actuar con la celeridad que nuestra historia ancestral demanda (…)” (sic) (ver la prueba aportada por el recurrente, agregada al expediente digital).

Mediante el oficio No. DVA-0138-2025 de 27 de octubre de 2025, Jorge Mario Rodríguez Zúñiga, Viceministro de Ambiente, contestó al promovente: “(…) En atención a su nota MLV-00111-2025 del 12 de octubre de 2025, mediante la cual solicito que el Poder Ejecutivo emita un Decreto Ejecutivo declare el Parque Nacional Cahuita como territorio ancestral de la población afrocostarricense, así como la actualización de Convenio SINAC-ADI Cahuita, me permito indicarle lo siguiente: a) El Parque Nacional Cahuita, en el marco de la Ley Orgánica del Ambiente, Ley de Biodiversidad y la Ley de Parques Nacionales, y de conformidad con las competencias asignadas al MINAE sobre la materia de recursos naturales que la Ley 7152, cuenta con la declaratoria oficial de área silvestre protegida, categoría parque nacional. b) El Poder Ejecutivo por medio del Decreto Ejecutivo No. 1236 del 07 de setiembre de 1970 estableció el Monumento Nacional Cahuita.

Mediante el artículo 1 del decreto ejecutivo No. 8489 del 27 de abril de 1978 se cambió su denominación por Parque Nacional Cahuita y posteriormente mediante artículo 1° de la Ley No. 6794 de 25 de agosto de 1982, se ratifican como Ley de la República los Decreto Ejecutivos Nos. 1236-A del 7 de setiembre de 1970 y 8489-A del 27 de abril de 1978. En consecuencia, y dentro de nuestras facultades y competencias, el Parque Nacional Cahuita se encuentra oficialmente creado por Ley, en cumplimiento de los requisitos que se establecen para la declaratoria de un área silvestre protegida. Siendo que no corresponde en el marco de las competencias de nuestro Ministerio la declaratoria de “Cahuita como territorio ancestral de la población afrocostarricense”, ya que no es una categoría de manejo formalmente establecida, ni forma parte de nuestras competencias el reconocimiento ni asignación de derechos a pueblos indígena o tribales.

Para efectos de aclarar este tema, es importante que se revise el criterio externado por la Procuraduría General de la Republica en el criterio PGR-C-153-2023 (…) c) Con relación al Convenio SINAC-ADI Cahuita, nuestro Ministerio realizará las gestiones que sean financiera y legalmente viables en coordinación con la Contraloría General de la Republica y el Ministerio de Hacienda; por lo tanto, este tema no tiene relación con la emisión de un Decreto Ejecutivo para declarar “Cahuita como territorio ancestral de la población afrocostarricense” d) El Foro del Pueblo Tribal Afrocostarricense actualmente se encuentra a cargo de la Asociación de Desarrollo Integral de Cahuita, por lo que nuestro Ministerio no tiene injerencia en la toma de decisión de esa Asociación, por lo que sus propuestas debe dirigirlas a esa organización (…)” (sic) (ver la prueba aportada por el recurrente, agregada al expediente digital).

Por medio del oficio No. MLV-00113-2025 de 27 de octubre de 2025, el recurrente indicó al Viceministro de Ambiente: “(…) Asunto: Solicitud de consulta pública a la población afrodescendiente de Cahuita y aclaración sobre fundamentos legales del Parque Nacional Cahuita en relación con el Convenio 169 de la OIT (…) me dirijo a usted con el debido respeto para plantear lo siguiente, en ejercicio de mis derechos fundamentales y en cumplimiento de las obligaciones internacionales del Estado costarricense, conforme a los Convenios 107 y 169 de la Organización Internacional del Trabajo (OIT), el artículo 7 de la Constitución Política de Costa Rica, y la jurisprudencia vinculante de la Corte Interamericana de Derechos Humanos (Corte IDH). 1. Solicitud de consulta previa a la población afrodescendiente de Cahuita En su oficio DVA-0138-2025, se indica que el Parque Nacional Cahuita está regulado por la Ley Orgánica del Ambiente, la Ley de Biodiversidad, la Ley de Parques Nacionales, y los decretos ejecutivos No. 1236 de 1970, No. 8489 de 1978, y la Ley No. 6794 de 1982, y que no corresponde al Ministerio de Ambiente y Energía (MINAE) declarar a Cahuita como territorio ancestral de la población afrodescendiente, por no ser una categoría de manejo establecida ni estar dentro de sus competencias.

No obstante, el distrito de Cahuita es reconocido como un territorio tribal al amparo del Convenio 169 de la OIT, ratificado por Costa Rica mediante Ley No. 7316 de 1992, el cual establece en su artículo 6 la obligación de consultar a los pueblos indígenas y tribales, incluyendo a las comunidades afrodescendientes, de manera previa, libre e informada, sobre medidas legislativas o administrativas que puedan afectarles directamente. Asimismo, el Convenio 107 de la OIT, ratificado por Costa Rica mediante Ley No. 2466 de 1959, refuerza la protección de los derechos de las poblaciones tribales, incluyendo su derecho al territorio. El artículo 7 de la Constitución Política de Costa Rica consagra la obligatoriedad de los tratados internacionales, otorgándoles jerarquía superior a las leyes nacionales, lo que hace vinculantes dichas disposiciones (…) La omisión de consultar a la población afrodescendiente de Cahuita respecto a las normativas mencionadas en su oficio, incluyendo la Ley de Vida Silvestre y las regulaciones aplicables al Parque Nacional Cahuita, constituye un incumplimiento de las obligaciones internacionales asumidas por Costa Rica.

La Corte Interamericana de Derechos Humanos, en casos como Saramaka vs. Surinam (2007) y Pueblo Indígena Kichwa de Sarayaku vs. Ecuador (2012), ha establecido que los Estados tienen la obligación de consultar a los pueblos tribales sobre cualquier medida que afecte sus territorios ancestrales, garantizando su participación efectiva y respetando sus derechos colectivos. Estas resoluciones son vinculantes para Costa Rica como Estado parte de la Convención Americana sobre Derechos Humanos. Por lo anterior, solicito respetuosamente que se me indique, mediante oficio, si las normativas mencionadas en su respuesta (Ley Orgánica del Ambiente, Ley de Biodiversidad, Ley de Parques Nacionales, y decretos relacionados) fueron objeto de consulta previa, libre e informada con la población afrodescendiente de Cahuita, conforme lo exigen los Convenios 107 y 169 de la OIT y la jurisprudencia interamericana.

De no haber sido consultadas, exijo que se realice la consulta pública correspondiente, en cumplimiento de las resoluciones de la Sala Constitucional de Costa Rica, que en votos como el No. 2016-015350 ha reiterado la obligatoriedad de la consulta previa a pueblos indígenas y tribales, y las decisiones de la Corte IDH. 2. Solicitud de fundamentos fácticos y legales sobre la no declaración de Cahuita como territorio ancestral En su oficio, se argumenta que declarar al Parque Nacional Cahuita como territorio ancestral no corresponde a las competencias del MINAE, citando el criterio de la Procuraduría General de la República (PGR-C-153-2023) sobre la incompatibilidad entre el régimen del patrimonio natural del Estado y los territorios indígenas. Sin embargo, esta respuesta omite considerar que el distrito de Cahuita, como territorio tribal reconocido al amparo del Convenio 169 de la OIT, tiene un estatus especial que trasciende las categorías de manejo establecidas en la legislación nacional de áreas silvestres protegidas.

La Corte IDH, en casos como Mayagna (Sumo) Awas Tingni vs. Nicaragua (2001), ha reconocido el derecho de los pueblos indígenas y tribales a la propiedad colectiva de sus territorios ancestrales, incluso cuando estos se superponen con áreas protegidas. Asimismo, la Sala Constitucional en resoluciones como el voto No. 2019-022079 ha ordenado al Estado costarricense adoptar medidas para garantizar los derechos territoriales de los pueblos indígenas y tribales, incluyendo la delimitación de sus territorios ancestrales. En este contexto, solicito que se me expliquen, mediante oficio, los fundamentos fácticos y legales que impiden declarar al Parque Nacional Cahuita como territorio ancestral de la población afrodescendiente, considerando que dicha omisión parece desconocer las obligaciones internacionales del Estado costarricense y las resoluciones vinculantes de la Corte IDH. Asimismo, solicito que se detalle si el MINAE ha coordinado con otras instituciones, como la Asociación de Desarrollo Integral de Cahuita o la Contraloría General de la República, para avanzar en el reconocimiento de los derechos territoriales de la población afrodescendiente. 3.

Denuncia de discriminación estructural La negativa a reconocer al Parque Nacional Cahuita como territorio ancestral y la falta de consulta previa a la población afrodescendiente constituyen una forma de discriminación estructural contra mí y la comunidad afrodescendiente de Cahuita. Esta omisión perpetúa la exclusión histórica de nuestros derechos territoriales, en contravención de los principios de igualdad y no discriminación consagrados en el artículo 33 de la Constitución Política y en instrumentos internacionales como la Convención Internacional sobre la Eliminación de Todas las Formas de Discriminación Racial (ratificada por Costa Rica mediante Ley No. 3844 de 1966). La falta de delimitación de nuestro territorio ancestral, conforme a los Convenios 107 y 169 de la OIT, y la omisión de consulta previa en la gestión del Parque Nacional Cahuita, vulneran nuestro derecho a la autodeterminación y a la participación efectiva en decisiones que nos afectan.

Por ello, exijo que el MINAE, en coordinación con las instituciones competentes, inicie de inmediato un proceso de consulta pública con la población afrodescendiente de Cahuita, conforme a los estándares internacionales y las resoluciones de la Sala Constitucional y la Corte IDH, para cesar la discriminación estructural y garantizar el reconocimiento de nuestros derechos territoriales. 4. Solicitud final En virtud de lo expuesto, solicito respetuosamente: 1. Que se me indique, mediante oficio, si las normativas mencionadas en el oficio DVA-0138-2025 fueron consultadas con la población afrodescendiente de Cahuita, conforme a los Convenios 107 y 169 de la OIT. 2. Que se detallen los fundamentos fácticos y legales que impiden declarar al Parque Nacional Cahuita como territorio ancestral, considerando las obligaciones internacionales de Costa Rica. 3. Que se inicie de inmediato un proceso de consulta previa, libre e informada con la población afrodescendiente de Cahuita, en cumplimiento de la normativa nacional e internacional, para garantizar el reconocimiento de nuestros derechos territoriales y cesar la discriminación estructural.

Quedo atento a cualquier trámite adicional que sea necesario para procesar esta solicitud y solicito una respuesta dentro de los plazos establecidos por la normativa vigente (…)” (sic) (ver la prueba aportada por el recurrente, agregada al expediente digital).

Mediante el oficio No. DVA-0147-2025 de 10 de noviembre de 2025, el Viceministro de Ambiente contestó al recurrente: “(…) En atención a su nota MLV-00113-2025 del 27 de octubre de 2025, mediante la cual solicita realizar la consulta pública a la población afrodescendiente de Cahuita y aclaración sobre fundamentos legales del Parque Nacional Cahuita en relación con el Convenio 169 de la OIT, me permito indicarle lo siguiente: Esta nota es una reiteración de la nota MLV-111-2025, la cual fue atendida por DVA0138-2025, por lo que se mantiene lo expresado por este Viceministerio. Con relación a su consulta respecto de si la Ley Orgánica del Ambiente, la Ley de Biodiversidad, la Ley de Parques Nacionales había sido consultada de forma previa, libre e informada con la población afrodescendiente de Cahuita, por tratarse de emisión de leyes bajo competencia del Poder Legislativo, deberá de remitir la consulta a ese órgano a efecto de que se revisen los expedientes legislativos de los proyectos de ley, toda vez que por competencia no nos corresponde este trámite ni esa información consta en nuestros archivos.

Con relación a la emisión de Decretos Ejecutivos por parte del Poder Ejecutivo, se realizan siguiendo el tramite de rigor y las consultas se realizan conforme lo dispone las regulaciones de la Dirección de Mejora Regulatoria del Ministerio de Economía Industria y Comercio, como ente rector en materia de Mejora Regulatoria y Simplificación de Trámites. Esa Dirección coordina la ejecución de proyectos de simplificación de trámites, reforma de leyes y reglamentos, y asesora a las instituciones públicas en materia de mejora regulatoria. Además, es responsable de velar por el cumplimiento de la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Ley No. 8220, y promover la transparencia y la participación ciudadana en el proceso de creación y modificación de regulaciones. Respecto a su pretensión para realizar consultas y gestiones relacionadas a la población afrodescendiente, le indico que conforme lo dispone el Decreto Ejecutivo No. 43532-MP-MINAE-MCJ-MEP de “Constatación del auto reconocimiento de la población afrocostarricense como pueblo tribal”, el pueblo tribal afrocostarricense estableció el Foro del Pueblo Tribal Afrocostarricense como una instancia de consulta, diálogo y articulación entre el pueblo tribal afrocostarricense e instituciones gubernamentales.

La organización del Foro del Pueblo Tribal Afrocostarricense se encuentra a cargo de la Asociación de Desarrollo Integral de Cahuita. Conforme lo estableció el Voto 2025-000480 de las nueve horas veinte minutos del diez de enero de dos mil veinticinco, Expediente 24-012620-0007-CO, le reiteró a su persona que no ostentaba la legitima representación de este Foro (…) Conforme a lo anterior, nuestro Ministerio no ha recibido ninguna gestión formal por parte de la Asociación de Desarrollo Integral de Cahuita en representación del Foro del Pueblo Tribal Afrocostarricense relacionada a derechos territoriales en el Parque Nacional Cahuita; en consecuencia, resulta improcedente por falta legitimación acceder a su solicitud de realizar un proceso de consulta previa, libre e informada con la población afrodescendiente de Cahuita (…)” (sic) (ver la prueba aportada por el recurrente, agregada al expediente digital).

VI.Sobre el caso concreto. En el sub lite está demostrado que por medio del oficio No. MLV-00111-2025 de 12 de octubre de 2025, el recurrente planteó al Presidente de la República y al Presidente del Consejo Nacional Ambiental, lo siguiente: “(…) Asunto: Exhorto urgente para la emisión de un Decreto Ejecutivo, sustentado en los Convenios 107 y 169 de la OIT, declarando el Parque Nacional Cahuita como territorio ancestral de la población afrocostarricense como pueblo tribal; armonización con la Carta SINAC-SE-DE-1171-2025 y alineación con la jurisprudencia internacional de la Corte Interamericana de Derechos Humanos y nacional de la Sala Constitucional de la Corte Suprema de Justicia. Estimado Señor Presidente y señor Ministro: Me dirijo a ustedes en mi condición de ciudadano afrocostarricense, descendiente directo de las comunidades tribales del Caribe sur de Costa Rica, y en representación moral de las generaciones que han custodiado el territorio ancestral del Parque Nacional Cahuita desde tiempos inmemoriales.

Como miembro activo de la comunidad afrodescendiente nacional y en apoyo a la Asociación de Desarrollo Integral de Cahuita (ADIC), fundada en 1976 para salvaguardar nuestra herencia cultural y ambiental, solicito con el mayor respeto y urgencia la emisión inmediata de un Decreto Ejecutivo que declare el Parque Nacional Cahuita como territorio ancestral de nuestra población tribal afrocostarricense. Esta medida, rigurosamente fundamentada en los Convenios números 107 y 169 de la Organización Internacional del Trabajo (OIT), ratificados por Costa Rica, se alinea con la extensa jurisprudencia internacional de la Corte Interamericana de Derechos Humanos (Corte IDH) y la nacional de la Sala Constitucional de la Corte Suprema de Justicia, incorporando como insumos históricos clave la Ley N° 9612 (Ley del Calipso) y el reciente e histórico voto de la Sala Constitucional de septiembre de 2025 que ordena la consulta a la población afrodescendiente respecto del Plan Regulador Costero del Caribe Sur en Talamanca.

El propósito primordial de esta exhortación es armonizar las limitaciones administrativas y financieras expuestas en la Carta SINAC-SE-DE-1171-2025, de fecha 22 de agosto de 2025, suscrita por el señor David Chavarría Morales, Director Ejecutivo interino del Sistema Nacional de Áreas de Conservación (SINAC), y dirigida al señor Jorge Mario Rodríguez Zuñiga, Viceministro de Ambiente del Ministerio de Ambiente y Energía (MINAE), promoviendo así un modelo de gobernanza compartida sostenible que honre nuestros derechos colectivos al territorio, a la consulta previa y a la participación efectiva en su administración. I. Contextualización Histórica Exhaustiva: El Vínculo Ancestral de la Población Afrocostarricense con el Territorio del Parque Nacional Cahuita (…) II. Fundamentación Normativa Rigurosa: Los Convenios 107 y 169 de la OIT como Obligaciones Estatales Vinculantes (…) III. Alineación con la Jurisprudencia Internacional Exhaustiva de la Corte Interamericana de Derechos Humanos (…) IV.

Armonización con la Jurisprudencia Nacional Amplia de la Sala Constitucional: Precedentes Emblemáticos en Protección de Pueblos Indígenas y Tribales (…) V. Propuesta Específica, Urgencia y Medidas de Implementación Exhorto a ambos señores a emitir, de manera conjunta y en un plazo no mayor a 30 días, un Decreto Ejecutivo que: (i) declare el Parque Nacional Cahuita como territorio ancestral de la población afrocostarricense, demarcando sus límites conforme a los artículos 14 y 17 del Convenio 169; (ii) actualice el Convenio SINAC-ADIC con mecanismos de CPLI permanente, transferencia autónoma de recursos recaudados como destino específico (Ley N° 9635, art. 25), y protocolos de cosmovisión tribal; (iii) establezca un consejo de gobernanza con mayoría comunitaria, integrando la Ley del Calipso y el voto de septiembre de 2025; y (iv) ordene al MINAE y Hacienda coordinar presupuestos para su sostenibilidad.

Esta acción no solo resolvería las limitaciones de la Carta SINAC, sino que cumpliría obligaciones internacionales, evitando litigios ante la Corte IDH y fortaleciendo la imagen de Costa Rica en derechos humanos. Quedo a disposición para una audiencia inmediata en sus despachos, aportando insumos para el borrador. Confío en su compromiso con la justicia constitucional y los tratados internacionales para actuar con la celeridad que nuestra historia ancestral demanda (…)” (sic) (el énfasis no pertenece al original). Mediante el oficio No. DVA-0138-2025 de 27 de octubre de 2025, el Viceministro de Ambiente explicó al promovente: “(…) En atención a su nota MLV-00111-2025 del 12 de octubre de 2025, mediante la cual solicito que el Poder Ejecutivo emita un Decreto Ejecutivo declare el Parque Nacional Cahuita como territorio ancestral de la población afrocostarricense, así como la actualización de Convenio SINAC-ADI Cahuita, me permito indicarle lo siguiente: a) El Parque Nacional Cahuita, en el marco de la Ley Orgánica del Ambiente, Ley de Biodiversidad y la Ley de Parques Nacionales, y de conformidad con las competencias asignadas al MINAE sobre la materia de recursos naturales que la Ley 7152, cuenta con la declaratoria oficial de área silvestre protegida, categoría parque nacional. b) El Poder Ejecutivo por medio del Decreto Ejecutivo No. 1236 del 07 de setiembre de 1970 estableció el Monumento Nacional Cahuita.

Mediante el artículo 1 del decreto ejecutivo No. 8489 del 27 de abril de 1978 se cambió su denominación por Parque Nacional Cahuita y posteriormente mediante artículo 1° de la Ley No. 6794 de 25 de agosto de 1982, se ratifican como Ley de la República los Decreto Ejecutivos Nos. 1236-A del 7 de setiembre de 1970 y 8489-A del 27 de abril de 1978. En consecuencia, y dentro de nuestras facultades y competencias, el Parque Nacional Cahuita se encuentra oficialmente creado por Ley, en cumplimiento de los requisitos que se establecen para la declaratoria de un área silvestre protegida. Siendo que no corresponde en el marco de las competencias de nuestro Ministerio la declaratoria de “Cahuita como territorio ancestral de la población afrocostarricense”, ya que no es una categoría de manejo formalmente establecida, ni forma parte de nuestras competencias el reconocimiento ni asignación de derechos a pueblos indígena o tribales.

Para efectos de aclarar este tema, es importante que se revise el criterio externado por la Procuraduría General de la Republica en el criterio PGR-C-153-2023 (…) c) Con relación al Convenio SINAC-ADI Cahuita, nuestro Ministerio realizará las gestiones que sean financiera y legalmente viables en coordinación con la Contraloría General de la Republica y el Ministerio de Hacienda; por lo tanto, este tema no tiene relación con la emisión de un Decreto Ejecutivo para declarar “Cahuita como territorio ancestral de la población afrocostarricense” d) El Foro del Pueblo Tribal Afrocostarricense actualmente se encuentra a cargo de la Asociación de Desarrollo Integral de Cahuita, por lo que nuestro Ministerio no tiene injerencia en la toma de decisión de esa Asociación, por lo que sus propuestas debe dirigirlas a esa organización (…)” (sic) (el énfasis no pertenece al original). Por medio del oficio No. MLV-00113-2025 de 27 de octubre de 2025, el recurrente reiteró al Viceministro de Ambiente: “(…) Asunto: Solicitud de consulta pública a la población afrodescendiente de Cahuita y aclaración sobre fundamentos legales del Parque Nacional Cahuita en relación con el Convenio 169 de la OIT (…) me dirijo a usted con el debido respeto para plantear lo siguiente, en ejercicio de mis derechos fundamentales y en cumplimiento de las obligaciones internacionales del Estado costarricense, conforme a los Convenios 107 y 169 de la Organización Internacional del Trabajo (OIT), el artículo 7 de la Constitución Política de Costa Rica, y la jurisprudencia vinculante de la Corte Interamericana de Derechos Humanos (Corte IDH). 1.

Solicitud de consulta previa a la población afrodescendiente de Cahuita En su oficio DVA-0138-2025, se indica que el Parque Nacional Cahuita está regulado por la Ley Orgánica del Ambiente, la Ley de Biodiversidad, la Ley de Parques Nacionales, y los decretos ejecutivos No. 1236 de 1970, No. 8489 de 1978, y la Ley No. 6794 de 1982, y que no corresponde al Ministerio de Ambiente y Energía (MINAE) declarar a Cahuita como territorio ancestral de la población afrodescendiente, por no ser una categoría de manejo establecida ni estar dentro de sus competencias. No obstante, el distrito de Cahuita es reconocido como un territorio tribal al amparo del Convenio 169 de la OIT, ratificado por Costa Rica mediante Ley No. 7316 de 1992, el cual establece en su artículo 6 la obligación de consultar a los pueblos indígenas y tribales, incluyendo a las comunidades afrodescendientes, de manera previa, libre e informada, sobre medidas legislativas o administrativas que puedan afectarles directamente.

Asimismo, el Convenio 107 de la OIT, ratificado por Costa Rica mediante Ley No. 2466 de 1959, refuerza la protección de los derechos de las poblaciones tribales, incluyendo su derecho al territorio. El artículo 7 de la Constitución Política de Costa Rica consagra la obligatoriedad de los tratados internacionales, otorgándoles jerarquía superior a las leyes nacionales, lo que hace vinculantes dichas disposiciones (…) La omisión de consultar a la población afrodescendiente de Cahuita respecto a las normativas mencionadas en su oficio, incluyendo la Ley de Vida Silvestre y las regulaciones aplicables al Parque Nacional Cahuita, constituye un incumplimiento de las obligaciones internacionales asumidas por Costa Rica. La Corte Interamericana de Derechos Humanos, en casos como Saramaka vs. Surinam (2007) y Pueblo Indígena Kichwa de Sarayaku vs. Ecuador (2012), ha establecido que los Estados tienen la obligación de consultar a los pueblos tribales sobre cualquier medida que afecte sus territorios ancestrales, garantizando su participación efectiva y respetando sus derechos colectivos.

Estas resoluciones son vinculantes para Costa Rica como Estado parte de la Convención Americana sobre Derechos Humanos. Por lo anterior, solicito respetuosamente que se me indique, mediante oficio, si las normativas mencionadas en su respuesta (Ley Orgánica del Ambiente, Ley de Biodiversidad, Ley de Parques Nacionales, y decretos relacionados) fueron objeto de consulta previa, libre e informada con la población afrodescendiente de Cahuita, conforme lo exigen los Convenios 107 y 169 de la OIT y la jurisprudencia interamericana. De no haber sido consultadas, exijo que se realice la consulta pública correspondiente, en cumplimiento de las resoluciones de la Sala Constitucional de Costa Rica, que en votos como el No. 2016-015350 ha reiterado la obligatoriedad de la consulta previa a pueblos indígenas y tribales, y las decisiones de la Corte IDH. 2. Solicitud de fundamentos fácticos y legales sobre la no declaración de Cahuita como territorio ancestral En su oficio, se argumenta que declarar al Parque Nacional Cahuita como territorio ancestral no corresponde a las competencias del MINAE, citando el criterio de la Procuraduría General de la República (PGR-C-153-2023) sobre la incompatibilidad entre el régimen del patrimonio natural del Estado y los territorios indígenas.

Sin embargo, esta respuesta omite considerar que el distrito de Cahuita, como territorio tribal reconocido al amparo del Convenio 169 de la OIT, tiene un estatus especial que trasciende las categorías de manejo establecidas en la legislación nacional de áreas silvestres protegidas. La Corte IDH, en casos como Mayagna (Sumo) Awas Tingni vs. Nicaragua (2001), ha reconocido el derecho de los pueblos indígenas y tribales a la propiedad colectiva de sus territorios ancestrales, incluso cuando estos se superponen con áreas protegidas. Asimismo, la Sala Constitucional en resoluciones como el voto No. 2019-022079 ha ordenado al Estado costarricense adoptar medidas para garantizar los derechos territoriales de los pueblos indígenas y tribales, incluyendo la delimitación de sus territorios ancestrales. En este contexto, solicito que se me expliquen, mediante oficio, los fundamentos fácticos y legales que impiden declarar al Parque Nacional Cahuita como territorio ancestral de la población afrodescendiente, considerando que dicha omisión parece desconocer las obligaciones internacionales del Estado costarricense y las resoluciones vinculantes de la Corte IDH.

Asimismo, solicito que se detalle si el MINAE ha coordinado con otras instituciones, como la Asociación de Desarrollo Integral de Cahuita o la Contraloría General de la República, para avanzar en el reconocimiento de los derechos territoriales de la población afrodescendiente. 3. Denuncia de discriminación estructural La negativa a reconocer al Parque Nacional Cahuita como territorio ancestral y la falta de consulta previa a la población afrodescendiente constituyen una forma de discriminación estructural contra mí y la comunidad afrodescendiente de Cahuita. Esta omisión perpetúa la exclusión histórica de nuestros derechos territoriales, en contravención de los principios de igualdad y no discriminación consagrados en el artículo 33 de la Constitución Política y en instrumentos internacionales como la Convención Internacional sobre la Eliminación de Todas las Formas de Discriminación Racial (ratificada por Costa Rica mediante Ley No. 3844 de 1966).

La falta de delimitación de nuestro territorio ancestral, conforme a los Convenios 107 y 169 de la OIT, y la omisión de consulta previa en la gestión del Parque Nacional Cahuita, vulneran nuestro derecho a la autodeterminación y a la participación efectiva en decisiones que nos afectan. Por ello, exijo que el MINAE, en coordinación con las instituciones competentes, inicie de inmediato un proceso de consulta pública con la población afrodescendiente de Cahuita, conforme a los estándares internacionales y las resoluciones de la Sala Constitucional y la Corte IDH, para cesar la discriminación estructural y garantizar el reconocimiento de nuestros derechos territoriales. 4. Solicitud final En virtud de lo expuesto, solicito respetuosamente: 1. Que se me indique, mediante oficio, si las normativas mencionadas en el oficio DVA-0138-2025 fueron consultadas con la población afrodescendiente de Cahuita, conforme a los Convenios 107 y 169 de la OIT. 2.

Que se detallen los fundamentos fácticos y legales que impiden declarar al Parque Nacional Cahuita como territorio ancestral, considerando las obligaciones internacionales de Costa Rica. 3. Que se inicie de inmediato un proceso de consulta previa, libre e informada con la población afrodescendiente de Cahuita, en cumplimiento de la normativa nacional e internacional, para garantizar el reconocimiento de nuestros derechos territoriales y cesar la discriminación estructural. Para cualquier comunicación, pueden contactarme al correo electrónico [email protected]. Quedo atento a cualquier trámite adicional que sea necesario para procesar esta solicitud y solicito una respuesta dentro de los plazos establecidos por la normativa vigente (…)” (sic) (el énfasis no pertenece al original). Mediante el oficio No. DVA-0147-2025 de 10 de noviembre de 2025, el Viceministro de Ambiente contestó al recurrente: “(…) En atención a su nota MLV-00113-2025 del 27 de octubre de 2025, mediante la cual solicita realizar la consulta pública a la población afrodescendiente de Cahuita y aclaración sobre fundamentos legales del Parque Nacional Cahuita en relación con el Convenio 169 de la OIT, me permito indicarle lo siguiente: Esta nota es una reiteración de la nota MLV-111-2025, la cual fue atendida por DVA0138-2025, por lo que se mantiene lo expresado por este Viceministerio.

Con relación a su consulta respecto de si la Ley Orgánica del Ambiente, la Ley de Biodiversidad, la Ley de Parques Nacionales había sido consultada de forma previa, libre e informada con la población afrodescendiente de Cahuita, por tratarse de emisión de leyes bajo competencia del Poder Legislativo, deberá de remitir la consulta a ese órgano a efecto de que se revisen los expedientes legislativos de los proyectos de ley, toda vez que por competencia no nos corresponde este trámite ni esa información consta en nuestros archivos. Con relación a la emisión de Decretos Ejecutivos por parte del Poder Ejecutivo, se realizan siguiendo el tramite de rigor y las consultas se realizan conforme lo dispone las regulaciones de la Dirección de Mejora Regulatoria del Ministerio de Economía Industria y Comercio, como ente rector en materia de Mejora Regulatoria y Simplificación de Trámites. Esa Dirección coordina la ejecución de proyectos de simplificación de trámites, reforma de leyes y reglamentos, y asesora a las instituciones públicas en materia de mejora regulatoria.

Además, es responsable de velar por el cumplimiento de la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Ley No. 8220, y promover la transparencia y la participación ciudadana en el proceso de creación y modificación de regulaciones. Respecto a su pretensión para realizar consultas y gestiones relacionadas a la población afrodescendiente, le indico que conforme lo dispone el Decreto Ejecutivo No. 43532-MP-MINAE-MCJ-MEP de “Constatación del auto reconocimiento de la población afrocostarricense como pueblo tribal”, el pueblo tribal afrocostarricense estableció el Foro del Pueblo Tribal Afrocostarricense como una instancia de consulta, diálogo y articulación entre el pueblo tribal afrocostarricense e instituciones gubernamentales. La organización del Foro del Pueblo Tribal Afrocostarricense se encuentra a cargo de la Asociación de Desarrollo Integral de Cahuita.

Conforme lo estableció el Voto 2025-000480 de las nueve horas veinte minutos del diez de enero de dos mil veinticinco, Expediente 24-012620-0007-CO, le reiteró a su persona que no ostentaba la legitima representación de este Foro (…) Conforme a lo anterior, nuestro Ministerio no ha recibido ninguna gestión formal por parte de la Asociación de Desarrollo Integral de Cahuita en representación del Foro del Pueblo Tribal Afrocostarricense relacionada a derechos territoriales en el Parque Nacional Cahuita; en consecuencia, resulta improcedente por falta legitimación acceder a su solicitud de realizar un proceso de consulta previa, libre e informada con la población afrodescendiente de Cahuita (…)” (sic) (el énfasis no pertenece al original).

VII.Es claro que, en esencia, el promovente exhortó al Presidente de la República y al Presidente del Consejo Nacional Ambiental, para que emitieran un Decreto Ejecutivo, el cual, previa consulta, declare el Parque Nacional Cahuita como territorio ancestral de la población afrocostarricense. El régimen jurídico del Parque Nacional Cahuita se sustenta en la Ley No. 6794 de 25 de agosto de 1982, que en su artículo 1 ratificó como Leyes de la República los Decretos Ejecutivos Nos. 1236-A del 7 de setiembre de 1970 Establece Monumento Nacional Cahuita (Ahora Parque Nacional Cahuita), y 8489-A del 27 de abril de 1978 Convierte Monumento Nacional Cahuita en Parque Nacional Cahuita. Por consiguiente, el promovente exhortó a que se efectúe una reforma mediante un Decreto Ejecutivo, para que el parque sea reconocido ahora como territorio tribal afrodescendiente, previa consulta. Esta Sala Constitucional en la sentencia No. 2020-09049 de las 09:15 horas de 15 de mayo de 2020, explicó:

“(…) Ciertamente, el propósito de la solicitud del recurrente no ha sido requerir determinada información ni plantear un reclamo administrativo, sino formular una exhortación a fin de que la autoridad recurrida actúe conforme a lo pretendido por el promovente, de modo que esta gestión se agotó con su sola presentación, sin que exista una obligación correlativa de la parte accionada de responderla (…)” (el énfasis no pertenece al original).

Lo citado es plenamente aplicable al sub examine. La gestión del promovente se agotó con su sola presentación, sin que exista entonces una obligación correlativa de la parte accionada de responderla, de resolver algo en específico, y mucho menos de acceder a lo pretendido mediante la exhortación o excitativa.

VIII.En todo caso, consta que en el oficio No. DVA-0138-2025 de 27 de octubre de 2025, el Viceministro de Ambiente indicó al recurrente que el Parque Nacional Cahuita fue creado mediante normativa de rango legal, por lo que no es competencia del Ministerio de Ambiente y Energía declararlo como territorio ancestral de la población afrocostarricense (categoría de manejo que, además, no ha sido formalmente establecida) (en el oficio No. DVA-0147-2025 de 10 de noviembre de 2025, se complementó lo respondido indicándole debía apersonarse ante la Asamblea Legislativa para dilucidar si la normativa existente había sido consultada o no de previo a la población afrodescendiente); además, en cuanto al Convenio SINAC-ADI Cahuita, se le explicó que se realizarían las gestiones financiera y legalmente viables en coordinación con la Contraloría General de la República, y el Ministerio de Hacienda; y se le sugirió planteara sus propuestas ante el Foro del Pueblo Tribal Afrocostarricense, actualmente a cargo de la Asociación de Desarrollo Integral de Cahuita, instancia de articulación para estos temas. No se deriva de esto indicio de discriminación alguna.

IX.Mediante el escrito agregado al expediente digital a las 11:56 horas de 25 de noviembre de 2025, [Nombre 001] subrayó que el objeto de este proceso: “(…) es obtener una declaración judicial vinculante que reconozca y declare al Parque Nacional Cahuita como territorio ancestral y, consecuentemente, como territorio afrodescendiente, en virtud de las obligaciones internacionales asumidas por el Estado costarricense derivadas de los Convenios N° 107 (Convenio sobre Poblaciones Indígenas y Tribales, 1957) y N° 169 (Convenio sobre Pueblos Indígenas y Tribales en Países Independientes, 1989) de la Organización Internacional del Trabajo (OIT), ratificados por Costa Rica mediante Ley N° 3048 del 27 de junio de 1962 (para el 107) y Ley N° 7316 del 16 de diciembre de 1992 (para el 169) (…)” (sic). Se aclara al promovente que no le corresponde a esta Sala Constitucional llevar a cabo la modificación al ordenamiento jurídico y consecuente declaratoria que pretende. Lo anterior excede tanto la naturaleza sumaria del recurso de amparo, como la competencia de este Tribunal, delimitada en la Ley y la propia Constitución Política.

X.Si el recurrente considera que el Ministro de Ambiente y Energía cometió un delito al rendir su informe, debe plantear la denuncia ante el Ministerio Público, para que inicie las pesquisas pertinentes.

XI.Conclusión. Bajo este orden de circunstancias el recurso de amparo deviene manifiestamente improcedente, y así debe declararse.

XII.Nota de la magistrada Garro Vargas. En la especie, concurro con el voto de la mayoría en cuanto a que el recurso debe ser declarado sin lugar, pero con las siguientes consideraciones.

En el escrito de interposición el recurrente pide a la Sala Constitucional que declare el Parque Nacional Cahuita como territorio ancestral afrodescendiente, ordenando al Estado las medidas necesarias para su delimitación, titulación colectiva y gestión intercultural. Por tal requerimiento, considero necesario reiterar el criterio que he vertido en las sentencias nro. 2025-032461 de las 13:56 horas del 3 de octubre de 2025 y nro. 2026-003395 de las 09:20 horas del 30 de enero de 2026, a través de la cuales a manera de síntesis señalé que un reconocimiento de tal envergadura –la condición de pueblo tribal de una comunidad determinada– es algo que le corresponde al legislador realizar respetando el principio de reserva de ley y el principio de razonabilidad, para que establezca con claridad los supuestos, efectos y alcances de esa categoría jurídica en el marco del principio de participación derivado del art. 9 de la Constitución Política.

XIII.Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:
