Document Review Case File: 25-039979-0007-CO Decision No. 2026004391 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine twenty a.m. on six February two thousand twenty-six.

Amparo proceeding (recurso de amparo) being processed under case file number 25-039979-0007-CO, filed by [Nombre 001], identity card [Valor 001], on behalf of [Nombre 002], identity card [Valor 002], against the ASOCIACIÓN DE ACUEDUCTO RURAL DE BUENOS AIRES SUR DE JIMÉNEZ and the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.

Findings of Fact:

  1. 1In a written submission filed with the Secretariat of the Chamber and added to the case file at 17:11 on 25 December 2025, the petitioner filed an amparo proceeding against the ASOCIACIÓN DE ACUEDUCTO RURAL DE BUENOS AIRES SUR DE JIMÉNEZ and the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS. She states, in summary, that in 2012, the protected party purchased a lot on the street known as Valle Verde, recorded in the Property Registry under real-property folio number N° 7-143459-000, with survey plan N° L-1572521-2012, located a few meters from the Poder Judicial building in Guápiles; and that since then, the struggle began to obtain the basic services that every Costa Rican deserves. She states that she requested a certificate of potable-water service availability (constancia de disponibilidad de servicio de agua potable) for the indicated property. She reports that they have spent years struggling against several administrations, with promise after promise, without achieving the objective of obtaining access to this precious resource on the property.She adds that they have submitted numerous requests and that, together with the organized group of residents, they succeeded in establishing the ASADA de Buenos Aires Sur, from which all residents would benefit; however, the AyA representative was categorical in restricting the service—without, in her view, any technical basis supporting the refusal to grant water availability—and offered completely illogical excuses. She recounts that he authorized water service only for forty houses belonging to the Comunidad de Valle Verde group. She adds that the protected party formally requested access to water service from the Asada Buenos Aires Sur, which has expressed its willingness to cooperate provided that it receives authorization from AyA, and it is at that stage that approval is denied, leaving them completely defenseless. She asserts that the application was rejected without service being provided and without any technical basis supporting the decision.She explains that the rejection was justified on the following grounds: “(…) 1. That the properties did not have municipal permits and endorsements of the plans, although the plans are duly endorsed and municipal taxes and all applicable declarations are paid on time. 2. That the land sold to him supposedly belonged to persons considered undesirable by the AyA institution, a completely illogical excuse amounting to personal discrimination. 3. That there was insufficient water to provide the service, although reports from the ASADA Buenos Aires Sur indicate that it has sufficient water to provide us with the service. 4. That they did not have the budget to construct the pipeline that would provide service to our homes, although several years ago the residents of Calle Valle Verde paid for those pipelines, which are already installed and ready to provide the service, but according to an AyA official letter, the ASADA is prohibited from releasing the water toward the location of the protected party’s property. 5.That there is a large AyA tank (photographs attached) only 700 meters away from the protected party’s property and, according to AyA, the water will not reach the property (…)”. She alleges that on various occasions AyA has offered the residents—including the protected party—the service on the condition that they bear certain costs, and that despite making a substantial financial effort and providing the requested money, potable-water service still has not reached his property. One example was the establishment of the Asada; to convey water from the Asada Buenos Aires de Jiménez to Buenos Aires Sur, they requested one hundred thousand colones from each family, only for the residents to discover that once the tank had been built, AyA issued an order that service would be provided only to forty houses, unfairly and arbitrarily leaving the remaining lots without service. She specifies that the protected party has endured this discrimination for years without any legal basis or technical study whatsoever, even though his lot is situated between an AyA tank and the ASADA Buenos Aires Sur pipeline.She requests that the proceeding be granted and that AYA be ordered to instruct the ASADA to issue the certificate of water availability (constancia de disponibilidad de agua) for the protected party’s property.
  2. 2By decision issued at 15:55 on 05 January 2026, the present proceeding was admitted for processing.
  3. 3Lourdes María Sáurez Barboza, Rafael Barboza Topping, and Randy Madrigal Rodríguez report under oath, in their respective capacities as Executive President, Director of the UEN Gestión de ASADAS, and head of the Pococí cantonal office, all of the Instituto Costarricense de Acueductos y Alcantarillados, that memorandum N° SG-GSD-2026-00014 of 8 January 2026, from the Subgerencia Gestión de Sistemas Delegados-AyA, states:

“It is not true that the ASADA Buenos Aires Sur was established specifically to supply the sector where the property is located. The records show that the ASOCIACIÓN DE ACUEDUCTO RURAL BUENOS AIRES SUR JIMÉNEZ, legal entity identification number 3-002-537213, commenced operations on 08/09/2007, having met the requirements for establishing associations set forth in Ley 218 and its Regulations, and has had a Delegation Agreement in force since 04/02/2009 for a defined jurisdictional area different from the northern sector near Colegio Green Valley.

Regarding the evidence attached in support of the statement ‘… the AyA representative was categorical in restricting the service without any technical basis supporting the refusal to grant water availability …’ The attached evidence, document No. GSD-UEN-GAR-2021-00953 dated 5 March 2021, states: ‘We clarify that, according to the registry information provided, 40 properties would be included in the project.

We also note that the arrangements for possible supply will be planned solely for the sector containing the homes identified in the documentation provided, and that no possibility is contemplated of extending the project toward sectors north of the community, specifically along the street leading toward the sector where Colegio Green Valley is located.’ In this regard, it is essential to clarify that the identified application pertains exclusively to a request submitted by the Valle Verde residents’ committee, a hamlet comprising approximately 40 existing homes and located at the southern end of the area. That application bears no relation whatsoever to the sector near Colegio Green Valley, where the complainant’s properties are located at the northern end of the same territorial area.

With respect to this latter sector, the record reflects that the UEN Gestión de ASADAS del AyA has received no specific technical study from the ASADA Buenos Aires Sur de Pococí concerning housing developments (urbanizaciones), lot developments (lotificaciones), or subdivision processes (procesos de segregación). Consequently, no technical validity can properly be attributed to the submitted document, since it does not constitute an analysis of water availability applicable to the northern sector of the community, where the petitioner’s properties are located.

AyA is currently conducting the relevant technical studies to address the formal request submitted by the ASADA de Buenos Aires, which seeks AyA’s institutional intervention so that the ASADA Buenos Aires Sur de Pococí may assume administration of the water-supply system currently operated by an unauthorized operator in the community of Valle Verde – Calle Vargas. In this context, binding environmental opinions (criterios ambientales vinculantes) have been issued and are determinative for decision-making purposes.

In particular, the duly attached document UEN-GA-2025-03793, issued by the UEN Ambiental, expressly states the following: Likewise, considering that the area of the ‘Zona del Comité de agua Valle Verde – Calle Vargas’ coincides with the area covered by an application for a housing development project known as ‘Nuevo Guápiles,’ seeking an exemption from sanitary sewerage requirements (exoneración de alcantarillado sanitario), processed under case file N.° 640 in 2014 and cadastral plan L-239023-95, which was denied by the UEN Gestión Ambiental because of technical inconsistencies of a hydrogeological nature that were never remedied by the interested party…” Likewise, in document SUB-AID-GA-2015-432, dated 28 April 2015, the Dirección Ambiental issued a categorical technical opinion in the following terms:

“… from the hydrogeological and geological standpoint and with regard to protection of the aquifer and the Fuentes Numancia del AyA, and based on all existing technical studies for the area, as well as the Diagnóstico del Plan Regulador de Pococí – Tomo I, this Dirección del Área Funcional de Hidrogeología does not recommend granting an exemption to the Proyecto Urbanización Nuevo Guápiles, located in Barrio Emilia, Guápiles, Pococí, Limón, cadastral plan L-239023-95, because it involves an aquifer that is highly vulnerable to contamination.” They add that the technical report submitted by the Unidad Cantonal RHC-Pococí-AyA through memorandum N° GSP-RHC-P-2026-00024 of 8 January 2026 states the following:

“With respect to the third point, as indicated in official letters GSP-RHC-P-2017-00781 and GSP-RA-P-2019-00843, the Valle Verde sector lies outside the service area of the water-supply systems directly administered by AyA. Specifically, these are systems HC-A-13 Cariari - Anita Grande and HC-A-14 Guápiles-La Rita-Roxana-Jiménez (see image number 2). In view of the foregoing, because the sector lies outside the jurisdiction of AyA – Región Huetar Caribe, no opinion has been issued regarding water availability for the land located in that sector.” They state that the technical report submitted through memorandum N° SG-GSD-2026-00014 of 8 January 2026 from the Subgerencia Gestión de Sistemas Delegados-AyA indicates:

“The petitioner lists five alleged justifications for the rejection: municipal permits, personal discrimination, lack of water, absence of a budget, and proximity to AyA infrastructure.

(…)

1.

Municipal permits and plans: AyA has no knowledge of all the alleged municipal applications and proceedings. In any event, Article 21 of the Ley Constitutiva del AyA (Ley N.º 2726) provides that every housing development or lot development project requires AyA’s prior approval, without which any municipal permit lacks legal effect.

2.

Allegation of personal discrimination: This institution has no knowledge of such an allegation. AyA’s decisions are based exclusively on technical, legal, and environmental criteria, never on subjective considerations concerning individuals.

Water availability: The UEN Gestión de ASADAS has no record of any formal application for water availability or sanitation services for the sector in which the petitioner owns his properties. Consequently, no technical analysis (specific technical studies for housing developments, lot developments, or subdivisions) has been conducted that would make it possible to assess the viability or feasibility of the ASADA Buenos Aires Sur providing potable-water and sanitation services to that sector.

4. Infrastructure and budget: There is no record of infrastructure belonging to the ASADA Buenos Aires Sur in the sector where the petitioner’s property is located, nor of any approved studies for its extension.

5. Proximity to the Numancia Tank: Mere physical proximity to AyA infrastructure does not automatically create a right to connection. Environmental criterion UEN-GA-2025-03793 establishes that the area lies partially within the absolute protection zone (zona de protección absoluta) of Pozo Numancia, which imposes severe restrictions on residential developments and new connections.” They add that, according to the technical report submitted by the Unidad Cantonal RHC-Pococí-AyA through memorandum N° GSP-RHC-P-2026-00024 dated 8 de enero del 2026, it states that:

“…no further observations are made, given that the protected party (amparado) indicates an intention to obtain drinking-water service (servicio de agua potable) from the ASADA de Buenos Aires Sur. AyA Región Huetar Caribe has jurisdiction only over systems administered by AyA. In this specific case, the nearest AyA aqueduct is HC-A-14 Guápiles-La Rita-Roxana-Jiménez, which, as already indicated, does not extend coverage to the Valle Verde sector. As the protected party indicates, the Numancia tank, which forms part of the AyA aqueduct, is located near the Valle Verde sector; however, according to official letters GSP-RHC-P-2017-00781 and GSP-RA-P-2019-00843, this tank is situated at a lower elevation than Valle Verde, which is why expanding coverage is not technically feasible. The appellant (recurrente) is aware of this condition, to the extent that he has sought to have the supply provided by the ASADA de Buenos Aires Sur, which is located at a higher elevation.” They further add that, according to the technical report submitted by the Subgerencia Gestión de Sistemas Delegados-AyA through memorandum N° SG-GSD-2026-00014 dated 8 de enero del 2026, it states that:

“The appellant maintains that he meets the conditions for receiving the service and that the denial violates fundamental rights […]

No assessments or technical feasibility studies (estudios de factibilidad técnica) have been submitted in accordance with Definition N.º 12 of the Reglamento de Prestación de Servicios del AyA, which requires verification of water-resource, hydraulic, environmental, and legal capacity. Without such an analysis, it is not legally possible to grant drinking-water availability (disponibilidad de agua potable).

“12. Technical feasibility analysis for the provision of services (Análisis de factibilidad técnica para el otorgamiento de los servicios): Process for verifying the actual and current existence of sufficient water, hydraulic, material, technical, legal, and environmental resources to grant availability and an eventual service connection. For such purposes, the following conditions must be observed:

a. That the distribution and collection networks run in front of the boundaries of the property or have direct access by means of a public road or right-of-way easement (servidumbre de paso) from the property for which a service is requested.

b. That the systems have sufficient water-resource, hydraulic, water-treatment, and treatment capacity to provide new services.

c. That the system meets the established quality standards.

d. That it complies with the applicable environmental regulations.” They note that, according to the technical report submitted by the Unidad Cantonal RHC-Pococí-AyA through memorandum N° GSP-RHC-P-2026-00024 dated 8 de enero del 2026, it states that:

“…the protected party does indeed have the right to seek a water supply, provided that he complies with the established procedures. It is reiterated that the Región Huetar Caribe has not issued any service availability certificates (constancias de disponibilidad de servicios), because the area is outside its coverage area.” They recount that, as stated by the appellant, the requirements established for issuing a favorable service availability certificate have not been met, because the interested parties have not completed the technical studies and improvement works necessary to qualify for service.

They explain that, according to the technical report submitted by the Subgerencia Gestión de Sistemas Delegados-AyA through memorandum N° SG-GSD-2026-00014 dated 8 de enero del 2026, it states that:

“…AyA has no knowledge of any arbitrary action. The appellant’s situation is not comparable to that of the 40 homes in the southern sector, which were the subject of a specific, clearly delimited, and duly evaluated technical project.” They assert that, likewise, the technical report submitted by the Unidad Cantonal RHC-Pococí-AyA through memorandum N° GSP-RHC-P-2026-00024 dated 8 de enero del 2026 states that:

“…it is reiterated that AyA – Región Huetar Caribe has taken no action approving or denying the water supply in the Valle Verde sector, because it is located outside the coverage area.” They quote the technical report submitted by the Subgerencia Gestión de Sistemas Delegados-AyA through memorandum N° SG-GSD-2026-00014 dated 8 de enero del 2026, which states that:

“Constitutional case law has consistently held that the right to water does not entail an obligation to provide service where a duly established technical, legal, or environmental impossibility exists. In the present case, the denial is based on objective technical and environmental criteria, particularly the protection of strategic supply sources.” They reiterate that the operator acting under delegation from AyA is the ASADA Buenos Aires Sur de Jiménez and that, for it to issue a favorable service availability certificate to the interested parties, they must comply with all requirements established for that purpose. In cases such as this one, in which no network exists, they must conduct the technical studies and improvement works necessary for such a service availability certificate to be issued for the area, pursuant to article 14 of the reglamento para la Prestación de los Servicios and article 46 of the Reglamento de ASADAS.

They state that, in response to the request for drinking-water service made by residents of the Valle Verde community, the Unidad Cantonal RHC-Pococí-AyA, through its official Miguel Badilla Ugalde, informed señora Maria Cecilia Bonilla Gómez, representative of the Comunidad de Valle Verde, by official letter N° GSP-RHC-P-2017-00781 dated 20 de julio del 2017, that: “There is no drinking-water network from the Guápiles system in this sector. Moreover, the Numancia tank is at a lower elevation than your community, which means that the sector where your community is located is higher than the Numancia tank that supplies Guápiles.” Furthermore, later, in the year 2021, in response to a request received from the comité de Valle verde regarding the possibility of having the drinking-water supply in the Valle Verde sector undertaken by ASADA Buenos Aires, they were informed through official letter N° GSD-UEN-GAR-2021-00953 dated 5 de marzo del 2021, prepared by Ing. José Antonio Arias Arias of the UEN Gestión de Acueductos Rurales- AyA, that ASADA Buenos is willing to undertake the water supply for the community in the Valle Verde sector.” They request that the appeal be dismissed.

  1. 4Juan Carlos Barquero López, in his capacity as Legal Representative of the Asociación de Acueducto Rural Buenos Airea Sur, Jiménez, responds that they are responsible for providing drinking-water service to the community of Buenos Aires Sur and part of the southern sector of the community known as Green Valley. He indicates that the aqueduct currently supplies approximately 650 active subscribers. He states that the aqueduct arose as a community initiative around the year 2000, due to the inability of the Instituto Costarricense de Acueductos y Alcantarillados to provide service in the area. He says that, subsequently, in septiembre de 2007, the constituent assembly was held to formalize the organization and, years later, the corresponding delegation agreement with AyA was executed, governing its operation. He relates that, in the year 2020, this ASADA conducted a comprehensive technical study to evaluate the water-resource and hydraulic condition of the aqueduct system and that this study considered part of the Green Valley community as a possible area for future development, specifically the sector extending from the quadrant to the vicinity of Colegio Green Valley, an area that historically has not had a formal drinking-water supply from AyA.He states that AyA reviewed and approved this analysis in due course and that it served as the basis for considering the possible expansion of service into part of that community. He clarifies that the entity he represents has never arbitrarily or unjustifiably denied residents of the Green Valley sector access to drinking-water service; on the contrary, it has repeatedly expressed its willingness and readiness to assist in finding solutions that would ensure such service. Nevertheless, the drinking-water supply does not depend exclusively on this ASADA’s willingness, but requires the involvement and approval of various competent institutions, such as the Instituto Costarricense de Acueductos y Alcantarillados. He cautions that, even though the aqueduct has sufficient water-resource and hydraulic capacity (there is no hydraulic network in the central sector of Green Valley) to serve the existing properties in the area, it is essential to coordinate the proper management of wastewater and compliance with current health and environmental regulations, particularly in connection with new housing developments or residential projects. He explains that the Green Valley community is clearly divided into three distinct sectors:

1. Southern sector, currently supplied by this ASADA.

2. Northern sector, supplied by AyA.

3. Central sector, which has no drinking-water service operator.

He states that this division demonstrates that the situation complained of is not attributable to an arbitrary omission by the respondent aqueduct (acueducto recurrido), but rather to a structural issue involving institutional coverage, the solution to which requires joint and planned action by several public entities. They state that this aqueduct does not oppose the appellants’ claims but, on the contrary, acquiesces to the requested relief, on the understanding that the need for institutional support to give effect to the right to drinking water is recognized. He respectfully requests that this Honorable Chamber: 1. Issue the corresponding order so that, with the support of the competent institutions, the measures necessary to guarantee drinking-water service to the existing properties are adopted and management plans are prepared for future subdivisions (lotificaciones) or development.

  1. 5The legal requirements have been observed in the proceedings conducted.

Justice Salazar Alvarado authored the opinion; and,

Whereas:

I.Subject matter of the appeal. The appellant alleges that, since the year 2012, he has been requesting a water availability certificate (constancia de disponibilidad de agua) for his property, which has been systematically denied despite the existence of water resources in the area. He adds that AyA provided service only to forty houses in the “Valle Verde” community, excluding his lot and other neighbors without any technical or legal criteria justifying that limitation. He states that he and the neighbors made financial contributions (approximately 100,000 colones per family) to finance infrastructure, such as the construction of a tank, with the expectation of receiving service. He considers the authorities’ conduct discriminatory and unjust, emphasizing that his property is geographically located between an AyA tank and the ASADA pipeline, making the exclusion even more unreasonable.

II.Admissibility (admisibilidad). Given its exceptional nature, an amparo proceeding (amparo) against private-law entities (sujetos de derecho privado) requires first examining whether this case falls within any of the circumstances that make it admissible and, subsequently, if so, determining whether it should be granted. In this regard, the Ley de la Jurisdicción Constitucional, in Article 57, stipulates that an amparo action against the acts or omissions of a private-law entity is admissible when such entities act or are required to act in the exercise of public functions or powers (funciones o potestades públicas), or when they are, as a matter of law or fact, in a position of power against which ordinary judicial remedies (remedios jurisdiccionales comunes) are clearly insufficient or untimely to guarantee the fundamental rights or freedoms referred to in Article 2°, subsection a), of the same body of law. In this specific case, it is clear that those requirements have been met with respect to the Associations Administering Water Supply Systems (Asociaciones Administradoras de los Acueductos), since they are private-law entities in a position of power against which ordinary judicial remedies may be plainly unsuitable for protecting the petitioner’s fundamental rights; therefore, the petition must be admitted for review by this Court.

III.Proven facts (Hechos probados). The following facts are deemed duly established and relevant to the resolution of this matter, either because they have been proven or because the respondent failed to address them as ordered in the initial ruling:

  • a)The protected party (amparado) appears as the owner of the property registered under real-property folio N° 143459-000, located in Limón, Guápiles, Pococí (see National Registry certification dated 08 de diciembre de 2025).
  • b)The aforementioned property is located 570 metros south of Centro Educativo Green Valley, in the Valle Verde sector of Guápiles, Pococí (see memorandum N° GSP-RHC-P-2026-00024).
  • c)The Valle Verde sector (Calle Vargas) is located two kilometers south of the population center of Guápiles, Pococí, Limón (see memorandum N° UEN-GA-2025-03793).
  • d)The Green Valley community is divided into three sectors: 1. Southern sector, currently supplied by this ASADA; 2. Northern sector, supplied by AyA; and 3. Central sector, which has no entity operating the drinking-water service (see response from the ASADA representative).
  • e)On 04 de febrero de 2009, the agreement delegating and administering the Buenos Aires Sur Jiménez rural water supply system was signed between Instituto Costarricense de Acueductos y Alcantarillados and Asociación de Acueducto Rural de Buenos Aires Sur Jiménez (see copy of the agreement).
  • f)Through official letter GSP-RHC-P-2017-00781, dated 20 de julio de 2017, the head of the RHC-Pococí Cantonal Unit of the respondent Institute informed the representative of Comunidad Valle Verde, located 1.5 kilómetros south of Colegio Green Valley, that the area was not covered by water supply systems directly administered by AyA, because the Guápiles system had already reached the end of its useful life and the Numancia tank was situated at a lower elevation than the community (see copy of the official letter).
  • g)Through memorandum N° GSP-RA-P-2019-00843, dated 15 de octubre de 2019, the head of the RA-Pococí Cantonal Unit informed the representatives of Comité Pro mejoras de Valle Verde that the sector south of Colegio Green Valley could not be connected to the drinking-water systems served by that cantonal unit because the Numancia Tank was at a lower elevation than the relevant sector and the area was outside AYA’s coverage; accordingly, they could consider the possibility of being supplied by an ASADA or rural water supply system (see copy of the official letter).
  • h)On 20 de marzo de 2024, Comité Pro Mejoras de Valle Verde, together with a group of residents that included the petitioner (recurrente), submitted a request for drinking water for their community to the AYA branch in Guápiles (see copy of the document bearing a receipt stamp and signature).
  • i)Through official letter GSP-RHC-P-2024-00681, dated 23 de mayo de 2024, the head of the RHC Pococí Cantonal Unit informed Comité Pro Mejoras Valle Verde that they did not have a drinking-water supply because the area was outside the coverage of the Institute’s supply systems and that of the Asada de Buenos Aires (see copy of the official letter).
  • j)On 19 de marzo de 2025, the residents of Calle Valle Verde, including the protected party, requested that the administrator of ASADA Buenos Aires arrange the supply of drinking water (see copy of the letter bearing a receipt stamp and signature).
  • k)In a document dated 26 de setiembre de 2025, the representative of comunidad Valle Verde requested the intervention of the Office of the President of the respondent Institute because a water supply system was then operating without legal personality or compliance with technical or health requirements, under the administration of an informal committee; they requested that Asada de Buenos Aires assume its operation, given the health risk posed by the existing situation (see copy bearing a receipt stamp).
  • l)The Valle Verde sector (calle Vargas) lies outside the service area of the water supply systems directly administered by AyA; consequently, it is not appropriate to issue an opinion on water availability for properties located in that sector (see memorandum N° GSP-RHC-P-2026-00024).
  • m)The area defined as “Zona del Comité de agua Valle Verde – Calle Vargas” coincides with the area covered by the application for a residential-development project seeking an exemption from sanitary sewerage, known as “Nuevo Guápiles,” processed under expediente N°640 in the year 2014 and shown on cadastral plan L-239023-95. The respondent Institute denied that application because of technical inconsistencies attributable to the applicant, which have never been remedied to date (see copy of memorandum UEN-GA-2025-03793).
  • n)The records of AyA’s UEN Gestión de ASADAS contain no application for drinking-water availability for the northern sector of the community, specifically the area where the petitioner’s property is located (see copy of memorandum No. SG-GSD-2026-00014).
  • o)Comité de vecinos de Valle Verde represents a hamlet comprising approximately forty existing homes, located at the southern end of the area, which has no connection whatsoever with the sector near Colegio Green Valley where the petitioner’s property is located. That sector has an evaluated technical project (see copy of memorandum No. SG-GSD-2026-00014).
  • p)AyA is currently conducting the corresponding technical studies to address the request submitted by ASADA de Buenos Aires, which sought AyA’s institutional intervention so that ASADA Buenos Aires Sur de Pococí may assume administration of the water supply system currently operated by an unauthorized provider in comunidad de Valle Verde – Calle Vargas (see copy of memorandum No. SG-GSD-2026-00014).
  • q)To date, the respondent Institute’s UEN Gestión de ASADAS has no record of any formal application for water availability or sanitation services for the sector in which the petitioner owns his properties (see copy of memorandum No. SG-GSD-2026-00014).

IV. Unproven facts (Hechos no probados). The following facts relevant to this decision are not deemed established

  • a)That ASADA Buenos Aires Sur de Pococí requested from the respondent Institute’s UEN Gestión de ASADAS a specific technical study concerning residential developments, lot divisions (lotificaciones), or parcel-severance processes (procesos de segregación) in the sector near Colegio Green Valley, where the complainant’s property is located.

V.The right to drinking-water service. Articles 21 and 50 of the Constitución Política, read together, establish the rights of persons to life, health, and a healthy and ecologically balanced environment. These rights are closely linked because life, as the supreme value of the Constitución Política, entails special protection, since without life the protection of all other fundamental rights would have little value. Accordingly, life must be protected in all its dimensions—physical, mental, and environmental—and it is precisely in this respect that protecting the environment and natural resources becomes important in order to promote human well-being. Among other things, that well-being is achieved through the protection and preservation of the quality and quantity of water resources so that the water is potable for human consumption, thereby protecting human health; because water is necessary for hygiene, food, and drinking, its contamination may cause serious harm to public health.

In this regard, the protection and preservation referenced above must be provided by the State through the bodies designated for that purpose, which must adopt the measures necessary to guarantee everyone access to that resource and ensure compliance with those measures. Against this background, the right to water arises and may be protected by this Constitutional Court through an amparo proceeding (Judgment N° 2007-005482, issued at 14:39 on 24 de abril del 2007, reiterated in N° 2021-005089, issued at 09:15 on 12 de marzo de 2021, and recently in N° 2025-002839, issued at 09:20 on 31 de enero de 2025).

VI.Merits (fondo). This Court’s case law has stated unequivocally that access to drinking water is a fundamental human right inseparable from human dignity, health, and life (Articles 21, 33, and 50 of the Constitución Política). Nevertheless, the effective enjoyment of this right depends on compliance with the constitutional principle that public services must function properly, which requires the Administration to act in accordance with standards of efficiency, effectiveness, continuity, and adaptability. In the case of services provided by delegation, as occurs with the ASADAS, the technical oversight of Instituto Costarricense de Acueductos y Alcantarillados (AyA) is not limited to mere supervision; rather, it requires active protection to prevent the administrative inaction of delegated entities from leaving service users unprotected.

Based on the body of proven facts, this Chamber notes with particular concern that the residents of comunidad de Valle Verde – Calle Vargas have sought access to drinking-water service since the year 2017. Although the Administration has invoked technical and geographical reasons to justify the absence of a network—specifically, the vulnerability of Pozo Numancia—the fact remains that nearly nine years have elapsed without either AyA or ASADA de Buenos Aires Sur completing the technical feasibility studies required by the applicable legal framework (Article 14 of Reglamento para la Prestación de los Servicios and 46 of Reglamento de ASADAS). The negative response provided in the year 2024, which lacked either a proposed solution or an intervention schedule, is insufficient and violates the fundamental rights of the petitioner and the other members of the community. The Administration cannot limit itself to confirming the absence of infrastructure; its constitutional duty is to actively seek a technical solution that guarantees provision of the service.

VII.On the shared responsibility of AyA and the ASADA. Pursuant to the Ley Constitutiva Instituto Costarricense Acueductos y Alcantarillados N° 2726 and the Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados comunales, Decreto Ejecutivo N° 42582-S-MINAE, dated 04 de setiembre de 2020, AyA holds absolute technical authority over the sector. The fact that the respondent ASADA did not submit requests for specific studies concerning the community of Valle Verde to the Institute’s UEN Gestión de ASADAS does not relieve the Institute of its responsibility. The relationship between the two entities must be based on the principle of cooperation and collaboration; the ASADA’s inaction should have been detected and corrected by AyA through its supervisory and technical-management powers, since it has been aware of the problem for many years. This situation has resulted in the residents of that community currently being exposed to contamination risks because they are dependent on an unauthorized operator, owing to the lack of official studies demonstrating the feasibility of providing potable water, which constitutes a serious administrative omission that violates the protected parties’ fundamental rights.

This Chamber concludes that the delay in conducting the technical analyses—which are essential for assessing the feasibility of the water supply in light of the area’s hydrogeological restrictions—is not attributable to the petitioner, but rather to a lack of coordination and diligence by the respondent authorities. The absence of a distribution network is not an excuse for perpetual inaction, but rather a circumstance requiring the Administration to carry out improvement works and water-capacity studies promptly. Because there is no evidence of joint and effective action to provide the community with potable water after years of requests, the violation of the fundamental rights to health and potable water, as well as the principle of efficiency in the provision of public services, is deemed established.

VIII.On the consideration of this case due to a violation of Article 41 of the Political Constitution (Constitución Política). Before analyzing the merits of the matter—concerning the alleged violation of the right to prompt and proper administrative proceedings (procedimiento administrativo pronto y cumplido)—it must be clarified that, since Voto N° 2008-02545 at 8:55 hours on 22 de febrero de 2008, this Chamber has referred to the administrative litigation jurisdiction (jurisdicción contencioso administrativa)—with certain exceptions—those matters involving disputes as to whether the public administration has complied with the time limits prescribed by the Ley General de la Administración Pública (Articles 261 and 325) or by sector-specific laws governing special administrative proceedings, whether for issuing a final administrative act concluding proceedings—initiated ex officio or at a party’s request—or for deciding the applicable administrative appeals. This amparo proceeding (recurso de amparo) presents precisely such an exception, because it concerns the failure to decide an application for potable-water availability. Having clarified this point, the Chamber proceeds to decide the specific situation raised in this aspect of the amparo proceeding.

In this case, the record shows that, on 19 de marzo de 2025, the petitioner and other residents of Calle Valle Verde once again applied to the ASADA de Buenos Aires for a potable-water supply, but as of the date this proceeding was filed, there was no evidence of a formal, duly served, and properly reasoned response. Based on the foregoing, this Chamber finds that the respondent ASADA has committed an unjustified omission, since the absence of a decision not only violates Article 41 of the Political Constitution but, given the nature of the service sought—potable water for human consumption—such inaction also jeopardizes the effectiveness of the right to health and access to water. It is unacceptable that eleven months after the application requesting installation of water service was submitted, no decision has been issued. Administrative justice must be prompt; the delay in addressing a community’s application for potable water constitutes negligence that this Chamber cannot ignore.

Accordingly, because the case record does not show that the respondent ASADA provided an effective, consistent, and timely decision on the application submitted in marzo de 2025, Article 41 of the Political Constitution has been violated.

As for the complaint filed on 26 de setiembre de 2025 with the Office of the President of the Instituto Costarricense de Acueductos y Alcantarillados, warning of an extremely serious situation—the operation of an informal supply system without legal personality or technical or sanitary controls, representing an ongoing risk to the community’s health—the fact remains that, as of the date this proceeding was filed, an excessive period had not elapsed for investigating and analyzing the reported facts, particularly considering that the public sector’s collective holiday closure began on 20 de diciembre de 2025. Accordingly, as to this authority, the petition is denied. Nevertheless, the respondent Institute is hereby advised that the Administration is obligated to exercise its enforcement and supervisory powers to ensure that supply systems comply with the legal system, and that silence is not a valid response to the violation of fundamental rights.

IX.Regarding discrimination: This Chamber has repeatedly stated that the right to equality, enshrined in Article 33 of the Political Constitution, does not entail mathematical parity or identical treatment for all persons subject to the Administration under every circumstance. Rather, constitutional equality requires equal treatment for those in substantially identical factual circumstances and different treatment for those in different circumstances. In the case of access to potable water, a fundamental human right accorded constitutional status under Article 50, its enforceability depends not only on the existence of the resource, but also on compliance with technical, environmental, and legal parameters that guarantee the system’s sustainability and public health.

In the case at hand, the petitioner alleges a violation of the right to equality, using as a comparator the situation of forty families in the southern sector of the community of Valle Verde who were granted service. Nevertheless, the technical report submitted under oath by the Instituto Costarricense de Acueductos y Alcantarillados (AyA) shows that the circumstances are not identical in a manner that would establish discriminatory treatment. The Chamber finds that:

Technical differentiation: the group of homes cited as the comparator was the subject of a specific, clearly delimited, and duly assessed technical project that successfully completed the water-resource and hydraulic feasibility stages.

Failure to satisfy requirements: unlike the comparator group, the sector in which the petitioner’s properties are located (northern sector) lacks assessments and technical feasibility studies submitted in accordance with the Reglamento de Prestación de Servicios del AyA. The absence of verification of water-resource and environmental capacity legally precludes granting the requested water availability.

Geographic and environmental restrictions: the record establishes that the area where the protected party’s property is located faces particular technical limitations, such as being at a higher elevation than the supply tank and lying within an absolute aquifer protection area, factors that do not apply in the same manner to the aforementioned group of 40 homes.

It should be noted that the different treatment is based on objective and reasonable criteria. The distinction applied by the respondent authority is neither arbitrary nor capricious, but instead arises from a technical impossibility and the interested parties’ failure to satisfy prior regulatory requirements. Because there is no suitable comparator, as the factual circumstances differ both technically and legally, the principle of equality has not been violated. For the petitioner to obtain water availability under conditions similar to those enjoyed by his neighbors in the southern sector, he must undergo the technical assessment procedure and remedy the deficiencies in infrastructure and environmental studies required by his specific location, pursuant to Articles 14 of the Reglamento de Prestación de Servicios and 46 of the Reglamento de ASADAS. Therefore, as to this aspect, the petition is denied.

X. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computerized, magnetic, optical, or telematic device, or produced through new technologies, these must be collected from the court office within a maximum period of thirty business days from service of this judgment. Otherwise, any material not collected within that period will be destroyed pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena in Sesión N° 27-11, dated 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial N° 19, dated 26 de enero del 2012, as well as pursuant to the resolution approved by the Consejo Superior del Poder Judicial in Sesión N° 43-12, held on 3 de mayo del 2012, Article LXXXI.

Por tanto:

The petition is partially granted with respect to the violation of the principle of proper functioning of public services, the right to drinking-water service, and the right to prompt and effective justice. Lourdes María Sáurez Barboza, Rafael Barboza Topping, and Randy Madrigal Rodríguez, in their respective capacities as Executive President, Director of the UEN Gestión de ASADAS, and person in charge of the Pococí cantonal office, all of Instituto Costarricense de Acueductos y Alcantarillados, and Juan Carlos Barquero López, as legal representative of Asociación de Acueducto Rural Buenos Airea Sur, Jiménez, or whoever holds their respective positions, are ordered, within ONE MONTH following notification of this judgment, to coordinate the corresponding actions so that the situation reported by the petitioner herein may be reviewed and a solution sought. In turn, within twelve months following notification of this judgment: a) all technical studies concerning water availability and hydraulic and environmental feasibility necessary to determine the viability of supplying drinking water to the Valle Verde – Calle Vargas sector shall be conducted and completed.

The foregoing includes: a) specific hydrogeological analyses regarding the protection zone of Pozo Numancia. b) Once those studies have been completed, and within ONE additional MONTH, they shall issue a duly reasoned technical decision and notify the petitioner thereof, establishing the roadmap, infrastructure schedule, and final requirements for formalizing the drinking-water service or, failing that, technically feasible alternatives for ensuring safe and permanent access to water resources. The foregoing is ordered with the warning that, pursuant to article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in an amparo proceeding (recurso de amparo) that they are required to comply with or enforce and fails to comply with or enforce it shall be punished by imprisonment for three months to two years, or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.

In all other respects, the petition is denied. Instituto Costarricense de Acueductos y Alcantarillados and Asociación Administradora del Acueducto Rural are ordered to pay the legal costs and the damages and losses caused by the events underlying this ruling, the amounts of which shall be determined during enforcement of the civil and administrative-law judgment.- Fernando Castillo V.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del seis de febrero de dos mil veintiseis .

Recurso de amparo que se tramita en expediente número 25-039979-0007-CO interpuesto por [Nombre 001], cédula de identidad [Valor 001], a favor de [Nombre 002], cédula de identidad [Valor 002], contra la ASOCIACIÓN DE ACUEDUCTO RURAL DE BUENOS AIRES SUR DE JIMÉNEZ y el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.

Resultando:

  1. 1Por escrito presentado en la Secretaría de la Sala y, agregado al expediente a las 17:11 horas del 25 de diciembre de 2025, la recurrente interpone recurso de amparo contra ASOCIACIÓN DE ACUEDUCTO RURAL DE BUENOS AIRES SUR DE JIMÉNEZ y el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS. Manifiesta en resumen, que en el 2012, el amparado compró un lote en la calle nombrada Valle Verde, inscrita en el Registro de la Propiedad, bajo el número de folio real N° 7-143459-000, con plano N° L-1572521-2012, ubicada a unos metros del edificio de Poder Judicial, en Guápiles; y desde entonces, empezó la lucha por obtener los servicios básicos que cualquier costarricense merece. Señala que, solicitó la constancia de disponibilidad de servicio de agua potable para la finca indicada. Refiere que, han sido años de luchar en contra de varias administraciones, promesa tras promesa sin lograr el objetivo de tener acceso al preciado líquido en su propiedad.Acota que, han planteado cantidades de solicitudes y que junto con el grupo de vecinos organizados se logró la constitución de la ASADA de Buenos Aires Sur, de la cual se beneficiarían todos los vecinos; sin embargo, el personero del AyA fue tajante en restringir el servicio, -a su juicio- sin fundamentación técnica que respaldara la negatoria del otorgamiento de disponibilidad de agua, y con unas excusas completamente ilógicas. Relata que, solo autorizó el servicio de agua a cuarenta casas pertenecientes al grupo Comunidad de Valle Verde. Agrega que, el amparado solicitó formalmente el acceso al servicio de agua a la Asada Buenos Aires Sur, la cual se ha mostrado anuente a colaborar siempre y cuando reciban la autorización del AyA y es ahí donde se les niega el pase, dejándoles en completa indefensión. Afirma que, le han rechazado la gestión sin brindar el servicio, sin ningún fundamento técnico que respalde la decisión.Explica que, como justificación del rechazo se basa en los siguientes puntos: "(…) 1. Que las propiedades no contaban con los permisos municipales y visados de los planos, cuando los planos están perfectamente visados, y se realizan los pagos puntualmente a los impuestos municipales y cada declaración que corresponde. 2. Que supuestamente los terrenos que le vendieron le pertenecían a personas no gratas para la institución del AyA, excusa totalmente ilógica, tratándose de una discriminación a título personal. 3. Que no había suficiente líquido para brindar el servicio, cuando los informes de la ASADA Buenos Aires Sur indican que tiene suficiente líquido para brindarnos el servicio. 4 .Que no tenían presupuesto para crear la tubería que nos diera el servicio hasta nuestras casas, cuando hace varios años ya los vecinos de Calle Valle Verde pagamos por esas tuberías y que ya están instaladas listas para brindar el servicio, pero según un oficio del AyA le prohíbe a la ASADA liberar el líquido hacia donde está la propiedad del amparado. 5.Que existe un gran tanque del AyA (fotos que se adjuntan) a escasos 700 metros de distancia de la propiedad del amparado y según el AyA el agua no va a llegar hasta la propiedad (…)". Acusa que en diferentes oportunidades el AyA les ha ofrecido a los vecinos -en cuenta al amparado- el servicio pero con la condición de que sean éstos quienes deben costear ciertos gastos, y a pesar que después de hacer un gran esfuerzo económico y dar el dinero que se le solicito el servicio de agua potable continua sin llegar a su propiedad, tal es el ejemplo de la constitución de la Asada y para movilizar el líquido de la Asada Buenos Aires de Jiménez a Buenos Aires Sur, les pidieron cien mil colones a cada familia, con la sorpresa que, una vez se construyó el tanque, el AyA generó la orden que sólo se le iba a brindar servicio a cuarenta casas y dejó al resto de lotes sin el servicio, de forma injusta y arbitraria.Concreta que, el amparado lleva años soportando esa discriminación sin fundamento jurídico ni estudio técnico alguno, estando su lote entre un tanque del AyA y la tubería de la ASADA Buenos Aires Sur. Solicita se declare con lugar el recurso y se obligue al AYA dar la orden a la ASADA a otorgar la constancia de disponibilidad de agua en la propiedad del tutelado.
  2. 2Por resolución de las 15:55 horas del 05 de enero de 2026, se dio curso al presente recurso.
  3. 3Informan bajo juramento Lourdes María Sáurez Barboza, Rafael Barboza Topping, y Randy Madrigal Rodríguez, en su condición respectiva de Presidenta Ejecutiva, Director de la UEN Gestión de ASADAS y encargado de la oficina cantonal de Pococí, todos de Instituto Costarricense de Acueductos y Alcantarillados que en el memorando N° SG-GSD-2026-00014 del 8 de enero del 2026, de la Subgerencia Gestión de Sistemas Delegados-AyA, se indica que:

“No es cierto que la ASADA Buenos Aires Sur se haya constituido específicamente para abastecer al sector donde se ubica el inmueble. Consta que la ASOCIACIÓN DE ACUEDUCTO RURAL BUENOS AIRES SUR JIMÉNEZ, cédula jurídica 3-002-537213, inició funciones el 08/09/2007, cumpliendo los requisitos para la conformación de asociaciones establecidos en la Ley 218 y su Reglamento y cuenta con Convenio de Delegación vigente desde el 04/02/2009, para una zona de competencia definida, distinta al sector norte cercano al Colegio Green Valley.

Sobre la prueba que adjuntan indicando “… el personero del AyA fue tajante en restringir el servicio sin fundamentación técnica que respalde la negatoria del otorgamiento de disponibilidad de agua …” En la prueba adjunta, documento No. GSD-UEN-GAR-2021-00953 con fecha 5 de marzo del 2021 se indica “Hacemos la aclaración de que de acuerdo con la información registral suministrada se trata de 40 propiedades las que estarían siendo incluidas en el proyecto.

No omitimos manifestar que la gestión para el posible abastecimiento será proyectada solamente para el sector de las viviendas indicadas en la documentación aportada y que no se considera la posibilidad de extensión del proyecto hacia sectores hacia el norte de la comunidad, específicamente sobre la calle hacia el sector donde se ubica el Colegio Green Valley.” Al respecto, es fundamental precisar que la gestión señalada corresponde exclusivamente a una solicitud presentada por el comité de vecinos de Valle Verde, caserío conformado por aproximadamente 40 viviendas existentes, ubicado en el extremo sur de la zona. Dicha gestión no guarda relación alguna con el sector cercano al Colegio Green Valley, donde se localizan las propiedades del denunciante, las cuales se sitúan en el extremo norte del mismo ámbito territorial.

En relación con este último sector, se deja constancia de que no se ha recibido, por parte de la ASADA Buenos Aires Sur de Pococí, ningún estudio técnico específico orientado a urbanizaciones, lotificaciones o procesos de segregación ante la UEN Gestión de ASADAS del AyA. En consecuencia, resulta improcedente atribuir validez técnica al documento aportado, toda vez que no constituye un análisis de disponibilidad hídrica aplicable al sector norte de la comunidad, donde se ubican las propiedades del recurrente.

Actualmente, el AyA se encuentra desarrollando los estudios técnicos correspondientes con el fin de atender la solicitud formal presentada por la ASADA de Buenos Aires, mediante la cual se solicita la intervención institucional del AyA para que la ASADA Buenos Aires Sur de Pococí asuma la administración del sistema de abastecimiento de agua que actualmente es operado por un gestor no autorizado en la comunidad de Valle Verde – Calle Vargas. En este contexto, se cuenta con criterios ambientales vinculantes, los cuales resultan determinantes para la toma de decisiones.

En particular, el documento UEN-GA-2025-03793, debidamente adjunto, emitido por la UEN Ambiental, señala expresamente lo siguiente: De igual manera, considerando que el área de la ‘Zona del Comité de agua Valle Verde – Calle Vargas’ coincide con el área de la solicitud de un proyecto urbanístico de exoneración de alcantarillado sanitario denominado ‘Nuevo Guápiles’, tramitado como expediente N.° 640 en el año 2014, en el plano catastrado L-239023-95, el cual fue denegado por la UEN Gestión Ambiental debido a inconsistencias técnicas de carácter hidrogeológico que nunca fueron subsanadas por el interesado…” Asimismo, en el documento SUB-AID-GA-2015-432, de fecha 28 de abril de 2015, la Dirección Ambiental emitió un criterio técnico categórico en los siguientes términos:

“… esta Dirección del Área Funcional de Hidrogeología, desde el punto de vista hidrogeológico, geológico, de protección del acuífero y de las Fuentes Numancia del AyA, y con base en la totalidad de los estudios técnicos existentes en la zona, así como en el Diagnóstico del Plan Regulador de Pococí – Tomo I, no recomienda la exoneración del Proyecto Urbanización Nuevo Guápiles, ubicado en Barrio Emilia, Guápiles, Pococí, Limón, plano catastrado L-239023-95, por tratarse de un acuífero altamente vulnerable a la contaminación.” Agregan que, según el informe técnico remitido mediante memorando N° GSP-RHC-P-2026-00024 del 8 de enero del 2026 por parte de la Unidad Cantonal RHC-Pococí-AyA, se señala lo siguiente:

“Con respecto al punto tercero, tal como se ha indicado en el oficio GSP-RHC-P-2017-00781 y GSP-RA-P-2019-00843, el sector de Valle Verde se encuentra fuera del área de cobertura de los acueductos administrados por AyA directamente. Específicamente los sistemas HC-A-13 Cariari - Anita Grande y HC-A-14 Guápiles-La Rita-Roxana-Jiménez (ver imagen número 2). Dado lo anterior, por estar ubicado fuera de las competencias del AyA – Región Huetar Caribe, no se ha emitido criterio sobre disponibilidades de agua para los terrenos ubicados en ese sector”.

Refieren que, según el informe técnico remitido mediante memorando N° SG-GSD-2026-00014 del 8 de enero del 2026 de la Subgerencia Gestión de Sistemas Delegados-AyA, se indica que:

“El recurrente enumera cinco supuestas justificaciones del rechazo: permisos municipales, discriminación personal, falta de agua, inexistencia de presupuesto, y cercanía de infraestructura del AyA.

(…)

1.

Permisos municipales y planos: No le consta al AyA la totalidad de gestiones municipales alegadas. En todo caso, el artículo 21 de la Ley Constitutiva del AyA (Ley N.º 2726) establece que todo proyecto de urbanización o lotificación requiere aprobación previa del AyA, sin la cual cualquier permiso municipal carece de eficacia jurídica.

Alegato sobre discriminación personal: No le consta a esta Institución tal afirmación, las decisiones del AyA se basan exclusivamente en criterios técnicos, legales y ambientales, nunca en consideraciones subjetivas sobre personas.

Disponibilidad hídrica: En la UEN Gestión de ASADAS, no consta el ingreso de ninguna gestión formal de solicitud de disponibilidad de agua, ni saneamiento para el sector donde el recurrente posee sus propiedades. En consecuencia, no se ha realizado análisis técnico (Estudios técnico específico para urbanizaciones, lotificaciones o segregaciones) que permita valorar la viabilidad o factibilidad del abastecimiento de agua potable y saneamiento para dicho sector por parte de la ASADA Buenos Aires Sur.

4. Infraestructura y presupuesto: No consta infraestructura de la ASADA Buenos Aires Sur en el sector donde se ubica el inmueble del recurrente, ni estudios aprobados para su extensión.

5. Cercanía del Tanque Numancia: La sola proximidad física a infraestructura del AyA no genera derecho automático a la conexión. El criterio ambiental UEN-GA-2025-03793 establece que el área se encuentra parcialmente dentro de la zona de protección absoluta del Pozo Numancia, lo cual impone severas restricciones para desarrollos habitacionales y nuevas conexiones.” Acotan que, según el informe técnico remitido mediante memorando N° GSP-RHC-P-2026-00024 del 8 de enero del 2026 por parte de la Unidad Cantonal RHC-Pococí-AyA, se indica que:

“…no se realizan mayores observaciones, siendo que el amparado indica la intención de acceder al servicio de agua potable de la ASADA de Buenos Aires Sur. AyA Región Huetar Caribe, ostenta competencia sólo para los sistemas administrados por AyA. En el caso específico el acueducto de AyA más cercano es el HC-A-14 Guápiles-La Rita-Roxana-Jiménez, que como ya se ha indicado no alcanza a cubrir el sector de Valle Verde. Tal como lo indica el amparado, el tanque de Numancia que forma parte del acueducto del AyA se ubica cercano al sector de Valle Verde, y que de acuerdo con lo indicado en los oficios GSP-RHC-P-2017-00781 y GSP-RA-P-2019-00843, este tanque se encuentra a una elevación menor en relación con Valle Verde, razón por la cual no resulta técnicamente viable ampliar la cobertura. Esta condición es conocida por el recurrente, al punto de gestionar que el abastecimiento se otorgue por la ASADA de Buenos Aires Sur, que se ubica a una elevación mayor.” Adicionan que, según el informe técnico remitido mediante memorando N° SG-GSD-2026-00014 del 8 de enero del 2026 de la Subgerencia Gestión de Sistemas Delegados-AyA, se indica que:

“El recurrente sostiene que cumple condiciones para recibir el servicio y que la negativa vulnera derechos fundamentales […]

No se cuenta con diagnósticos ni estudios de factibilidad técnica presentados conforme a la Definición N.º 12 del Reglamento de Prestación de Servicios del AyA, que exige verificar capacidad hídrica, hidráulica, ambiental y legal. Sin dicho análisis, no es jurídicamente posible otorgar disponibilidad de agua potable.

“12. Análisis de factibilidad técnica para el otorgamiento de los servicios: Proceso de verificación de la existencia real y actual de los recursos hídricos, hidráulicos, materiales, técnicos, legales y ambientales suficientes para otorgar la disponibilidad y eventual conexión del servicio. Para tales efectos se deberán de observar las siguientes condiciones:

a. Que las redes de distribución y de recolección pasan frente a linderos del inmueble o tenga acceso directo por vía pública o servidumbre de paso del inmueble para el cual se solicita un servicio.

b. Que los sistemas cuenten con capacidad hídrica, hidráulica, de potabilización y de tratamiento, suficientes para otorgar nuevos servicios.

c. Que el sistema cumple con los atributos de calidad establecidos.

d. Que cumple con la normativa ambiental correspondiente.” Apuntan que, según el informe técnico remitido mediante memorando N° GSP-RHC-P-2026-00024 del 8 de enero del 2026 por parte de la Unidad Cantonal RHC-Pococí-AyA, se indica que:

“…efectivamente el amparado tiene su derecho a gestionar el abastecimiento de agua, siempre y cuando cumpla con los procedimientos establecidos. Se reitera que la Región Huetar Caribe, no ha emitido constancias de disponibilidad de servicios, puesto que no se encuentra dentro de su área de cobertura.” Relatan que, tal como se ha manifestado por parte del recurrente no se han cumplido los requisitos establecidos para generar una constancia de disponibilidad de servicios de forma positiva, ya que, no se ha cumplido por parte de los interesados con los estudios técnicos y obras de mejora necesarios para optar por un servicio.

Detallan que, según el informe técnico remitido mediante memorando N° SG-GSD-2026-00014 del 8 de enero del 2026 de la Subgerencia Gestión de Sistemas Delegados-AyA, se indica que:

“…No le consta al AyA actuación arbitraria alguna. La situación del recurrente no es comparable con la de las 40 viviendas del sector sur, las cuales fueron objeto de un proyecto técnico específico y delimitado, debidamente evaluado.” Aseveran que, de igual forma, el informe técnico remitido mediante memorando N° GSP-RHC-P-2026-00024 del 8 de enero del 2026 por parte de la Unidad Cantonal RHC-Pococí-AyA indica que:

“…se reitera que AyA – Región Huetar Caribe, no ha realizado gestión alguna que apruebe o desapruebe el abastecimiento con agua en el sector de Valle Verde, puesto que se ubica fuera del área de cobertura.” Citan que lo expuesto en el informe técnico remitido mediante memorando N° SG-GSD-2026-00014 del 8 de enero del 2026 de la Subgerencia Gestión de Sistemas Delegados-AyA, en el que se indica que:

“La jurisprudencia constitucional ha sido consistente en señalar que el derecho al agua no implica obligación de otorgar el servicio cuando exista imposibilidad técnica, jurídica o ambiental debidamente acreditada. En el presente caso, la negativa se sustenta en criterios técnicos y ambientales objetivos, particularmente en la protección de fuentes estratégicas de abastecimiento.” Reitera que el operador por delegación del AyA, es la ASADA Buenos Aires Sur de Jiménez, y para que pueda brindar una constancia de disponibilidad de servicios positiva a favor de los interesados, estos deberán cumplir con todos los requisitos establecidos al efecto, y en los casos como el presente en los que no existe red, deberán realizar los estudios técnicos y obras de mejoras para generar dicha constancia de disponibilidad de servicios en la zona, según lo dispuesto en el artículo 14 del reglamento para la Prestación de los Servicios y artículo 46 del Reglamento de ASADAS.

  1. 4Contesta Juan Carlos Barquero López, en calidad de Representante legal de la Asociación de Acueducto Rural Buenos Airea Sur, Jiménez que son los encargados de brindar el servicio de agua potable a la comunidad de Buenos Aires Sur y a una parte del sector sur de la comunidad conocida como Green Valley. Indica que, actualmente, el acueducto abastece aproximadamente a 650 abonados activos. Señala que, el acueducto surge como una iniciativa comunal alrededor del año 2000, ante la imposibilidad del Instituto Costarricense de Acueductos y Alcantarillados de brindar el servicio en la zona. Dice que, posteriormente, en septiembre de 2007, se celebra la asamblea constitutiva que formaliza la organización y, años después, se suscribe el respectivo convenio de delegación con el AyA, mediante el cual se regula su operación. Refiere que, en el año 2020, esta ASADA realizó un estudio técnico integral, con el objetivo de evaluar la condición hídrica e hidráulica del sistema de acueducto siendo que dicho estudio contempló, como una posible área de desarrollo futuro, una parte de la comunidad de Green Valley, específicamente el sector comprendido desde el cuadrante hasta las cercanías del Colegio Green Valley, zona que históricamente no ha contado con abastecimiento formal de agua potable por parte del AyA.Afirma que, este análisis fue oportunamente conocido y aprobado por el AyA, y sirvió de base para considerar la eventual ampliación del servicio en una parte de dicha comunidad. Aclara que, su representada nunca ha negado de forma arbitraria o injustificada el acceso al servicio de agua potable a los habitantes del sector de Green Valley; por el contrario, se ha manifestado reiteradamente la anuencia y disposición para colaborar en la búsqueda de soluciones que permitan garantizar dicho servicio; no obstante, el abastecimiento de agua potable no depende exclusivamente de la voluntad de esta ASADA, sino que requiere la intervención y aprobación de diversas instituciones competentes, como el Instituto Costarricense de Acueductos y Alcantarillados. Advierte que, aun cuando el acueducto cuenta con capacidad hídrica e hidráulica (no se tiene red hidráulica en el sector central de Green Valley) para atender las propiedades existentes en el área, resulta indispensable articular de forma coordinada el manejo adecuado de aguas residuales y el cumplimiento de la normativa sanitaria y ambiental vigente, especialmente frente a nuevas urbanizaciones o desarrollos habitacionales. Explica que, la comunidad de Green Valley se encuentra claramente dividida en tres sectores diferenciados:

1. Sector sur, actualmente abastecido por esta ASADA.

2. Sector norte, abastecido por el AyA.

3. Sector central, que no cuenta con un ente operador del servicio de agua potable.

  1. 5En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta el Magistrado Salazar Alvarado; y,

Considerando:

I.Objeto del recurso. El recurrente alega que, desde el año 2012, ha venido solicitando la constancia de disponibilidad de agua para su propiedad, la cual ha sido denegada sistemáticamente, a pesar de que la existencia de recurso hídrico en la zona. Agrega que, el AyA otorgó el servicio únicamente a cuarenta casas de la comunidad "Valle Verde", excluyendo a su lote y otros vecinos sin que existan criterios técnicos o jurídicos que justifiquen dicha limitación. Señala que, junto con los vecinos se realizaron aportes económicos (aproximadamente 100,000 colones por familia) para financiar infraestructura, como la construcción de un tanque, con la expectativa de recibir el servicio. Considera que, el actuar de las autoridades es discriminatorio e injusto, resaltando que su propiedad se encuentra ubicada geográficamente entre un tanque del AyA y la tubería de la ASADA, lo que hace la exclusión aún más irrazonable.

II.Sobre la admisibilidad. Por su excepcional naturaleza, el amparo contra sujetos de derecho privado exige comenzar por examinar si nos encontramos o no ante alguno de los supuestos que lo hacen admisible, para - posteriormente y en caso afirmativo-, dilucidar si es estimable o no. Sobre el particular, la Ley de la Jurisdicción Constitucional, en su artículo 57, estipula que el recurso de amparo contra las acciones u omisiones de un sujeto de Derecho Privado es admisible cuando éstos actúen o deban actuar en ejercicio de funciones o potestades públicas o, se encuentren, de derecho o de hecho, en una posición de poder frente a la cual los remedios jurisdiccionales comunes resulten claramente insuficientes o tardíos para garantizar los derechos o libertades fundamentales a que se refiere el artículo 2°, inciso a), del mismo cuerpo normativo. En el caso concreto, es claro el cumplimiento de esos presupuestos, en lo que respecta a las Asociaciones Administradoras de los Acueductos, toda vez que se trata de sujetos de Derecho Privado que están en una situación de poder, frente a la cual los remedios jurisdiccionales comunes pueden resultar francamente impropios para tutelar los derechos fundamentales del recurrente, por lo que el recurso se debe admitir para su análisis por parte de este Tribunal.

III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:

  • a)El amparado aparece como propietario de la finca inscrita al folio real N° 143459-000, ubicada en Limón, Guápiles, Pococí (ver constancia del Registro Nacional de fecha 08 de diciembre de 2025).
  • b)La supra indicada propiedad se localiza 570 metros sur del Centro Educativo Green Valley, en el sector de Valle Verde, en Guápiles, Pococí (ver memorando N° GSP-RHC-P-2026-00024).
  • c)El sector de Valle Verde (Calle Vargas) se ubica a dos kilómetros al sur del centro poblacional de Guápiles, Pococí, Limón (ver memorando N° UEN-GA-2025-03793).
  • d)La comunidad de Green Valley se encuentra dividida en tres sectores: 1. Sector sur, actualmente abastecido por esta ASADA; 2. Sector norte, abastecido por el AyA; y 3. Sector central, que no cuenta con un ente operador del servicio de agua potable (ver contestación del representante de la ASADA).
  • e)El 04 de febrero de 2009, se firmó el convenio de delegación y administración de acueducto rural de Buenos Aires Sur Jiménez entre el Instituto Costarricense de Acueductos y Alcantarillados y la Asociación de Acueducto Rural de Buenos Aires Sur Jiménez (ver copia del contrato).
  • f)Mediante oficio GSP-RHC-P-2017-00781, del 20 de julio de 2017, el encargado de la Unidad Cantonal RHC -Pococí del Instituto recurrido le comunicó a la representante de la Comunidad Valle Verde ubicada a 1.5 kilómetros al sur del Colegio Green Valley que, en ese sector no existe cobertura de los acueductos administrados por AyA directamente siendo que el sistema de Guápiles ya cumplió su vida útil y el tanque Numancia se encuentra a una altura menor a la comunidad (ver copia del oficio).
  • g)Por memorial N° GSP-RA-P-2019-00843, del 15 de octubre de 2019, la encargada de la Unidad Cantonal RA-Pococí informó a los representante del Comité Pro mejoras de Valle Verde que, el sector sur del Colegio Green Valley no es posible conectarlo a los sistemas de agua potable atendido por esta cantonal debido a que el Tanque Numancia se encuentra en un nivel más bajo con respecto al sector de interés y no está dentro de la cobertura del AYA, por lo que podían valorar la posibilidad de ser abastecidos por una ASADA o acueducto rural (ver copia del oficio).
  • h)El 20 de marzo de 2024, el Comité Pro Mejoras de Valle Verde junto con un grupo de vecinos, incluido el recurrente, presentaron ante la Sucursal del AYA en Guápiles una solicitud de agua potable para su comunidad (ver copia del escrito con sello y firma de recibido).
  • i)Mediante oficio GSP-RHC-P-2024-00681, del 23 de mayo de 2024, la encargada de la Unidad Cantonal RHC Pococí le comunicó al Comité Pro Mejoras Valle Verde que, no cuentan con abastecimiento de agua potable debido a que la zona se encuentra fuera de cobertura de los sistemas de abastecimiento del Instituto y de la Asada de Buenos Aires (ver copia del oficio).
  • j)El 19 de marzo de 2025, los vecinos Calle Valle Verde, incluido el amparado, solicitaron al administrados de la ASADA Buenos Aires gestionaron el suministro de agua potable (ver copia de la carta con sello y firma de recibido).
  • k)Mediante escrito fechado 26 de setiembre de 2025, el representante de la comunidad Valle Verde solicitó a la Presidencia del Instituto recurrido la intervención debido a que actualmente opera un sistema de abastecimiento de agua sin personería jurídica ni cumplimiento técnico o sanitario, el cual es administrado por un comité informal y solicitan que sea asumido por la Asada de Buenos Aires, dado el riesgo para la salud que la situación actual representa (ver copia con sello de recibido).
  • l)El sector de Valle Verde (calle Vargas) se encuentra fuera del área de cobertura de los acueductos administrados por AyA directamente, por lo que no corresponde emitir criterio sobre disponibilidades de agua para los terrenos ubicados en ese sector (ver memorando N° GSP-RHC-P-2026-00024).
  • m)El área definida como “Zona del Comité de agua Valle Verde – Calle Vargas”, coincide con el área de la solicitud de un proyecto urbanístico de Exoneración de alcantarillado Sanitario denominado como “Nuevo Guápiles”, gestionado como expediente N°640 en el año 2014, en el plano catastro L-239023-95, el cual fue denegado por el Instituto recurrido debido a inconsistencias técnicas por parte del interesado , que a la fecha nunca fueron subsanadas (ver copia del memorando UEN-GA-2025-03793).
  • n)En los registros de la UEN Gestión de ASADAS del AyA no consta el ingreso de una solicitud de disponibilidad de agua potable para el sector norte de la comunidad, específicamente donde se ubica el inmueble del recurrente (ver copia del memorando No. SG-GSD-2026-00014) o) El comité de vecinos de Valle Verde, representa a un caserío conformado por aproximadamente cuarenta viviendas existentes, ubicado en el extremo sur de la zona, el cual no guarda relación alguna con el sector cercano al Colegio Green Valley, donde se localiza la propiedad del recurrente. Dicho sector cuenta con un proyecto técnico evaluado (ver copia del memorando No. SG-GSD-2026-00014).
  • p)Actualmente, el AyA se encuentra desarrollando los estudios técnicos correspondientes con el fin de atender la gestión presentada por la ASADA de Buenos Aires, mediante la cual se solicitó la intervención institucional del AyA para que la ASADA Buenos Aires Sur de Pococí asuma la administración del sistema de abastecimiento de agua que actualmente es operado por un gestor no autorizado en la comunidad de Valle Verde – Calle Vargas (ver copia del memorando No. SG-GSD-2026-00014).
  • q)A la fecha, en la UEN Gestión de ASADAS del Instituto accionando, no consta el ingreso de ninguna gestión formal de solicitud de disponibilidad de agua, ni saneamiento para el sector donde el recurrente posee sus propiedades (ver copia del memorando No. SG-GSD-2026-00014).

IV. Hechos no probados. No se estiman demostrados los siguientes hechos de relevancia para esta resolución

  • a)Que ASADA Buenos Aires Sur de Pococí haya solicitado a la UEN Gestión de ASADAS del Instituto accionado un estudio técnico específico orientado a urbanizaciones, lotificaciones o procesos de segregación en el sector cercano al Colegio Green Valley, donde se localiza la propiedad del denunciante.

V.Sobre el derecho al servicio de agua potable. De la relación de los artículos 21 y 50, de la Constitución Política, se desprenden el derecho de las personas a la vida, la salud y a un ambiente sano y ecológicamente equilibrado, los cuales se encuentran íntimamente ligados, toda vez, que la vida como valor supremo de la Constitución Política, implica una especial protección, pues sin vida, poca utilidad tendría la protección de los demás derechos fundamentales. Así las cosas, la vida debe ser protegida en todas sus vertientes, desde un aspecto físico, mental y de entorno, y es precisamente ahí donde surge la importancia en proteger el ambiente y los recursos naturales, a fin de procurar el bienestar de las personas. Ahora bien, entre otros aspectos, ese bienestar se logra, a través de la protección y conservación de la calidad y cantidad de los recursos hídricos, para que ésta sea potable para el consumo humano y de esta forma proteger la salud de las personas, ya que al tratarse de un recurso necesario para la higiene, alimento y bebida, su contaminación puede producir graves perjuicios en la salud pública.

En ese sentido, la protección y conservación a la que se hace referencia debe ser brindada por el Estado, a través de los órganos que designe al efecto, los cuales deberán adoptar las medidas necesarias para garantizar el acceso de ese recurso a todas las personas, así como velar por el cumplimiento de éstas. Bajo esa tesitura, surge el derecho al agua, el cual puede ser protegido por este Tribunal Constitucional mediante la vía de amparo (Sentencia N° 2007-005482, de las 14:39 horas del 24 de abril del 2007, reiterada en la N° 2021-005089, de las 09:15 horas del 12 de marzo de 2021 y recientemente en la N° 2025-002839, de las 09:20 horas del 31 de enero de 2025).

VI.Sobre el fondo. La jurisprudencia de este Tribunal ha sido contundente en señalar que, el acceso al agua potable es un derecho humano fundamental, indisociable de la dignidad humana, la salud y la vida (artículos 21, 33 y 50, de la Constitución Política). No obstante, la vigencia real de este derecho depende de la observancia del principio constitucional del buen funcionamiento de los servicios públicos, el cual obliga a la Administración a actuar bajo parámetros de eficiencia, eficacia, continuidad y adaptabilidad. En el caso de los servicios prestados por delegación, como ocurre con las ASADAS, la rectoría técnica del Instituto Costarricense de Acueductos y Alcantarillados (AyA) no se agota en la simple fiscalización, sino que exige una tutela activa para evitar que la inercia administrativa de los entes delegados se traduzca en una desprotección del administrado.

Del elenco de hechos probados, esta Sala constata con especial preocupación que, los vecinos de la comunidad de Valle Verde – Calle Vargas han gestionado el acceso al servicio de agua potable desde el año 2017. Si bien la Administración ha esgrimido razones técnicas y geográficas para justificar la falta de red -específicamente la vulnerabilidad del Pozo Numancia-, lo cierto es que ha transcurrido un lapso de casi nueve años sin que el AyA ni la ASADA de Buenos Aires Sur hayan concretado los estudios técnicos de factibilidad que el propio ordenamiento exige (artículo 14, del Reglamento para la Prestación de los Servicios y 46, del Reglamento de ASADAS). La respuesta negativa brindada en el año 2024, carente de una propuesta de solución o de un cronograma de intervención, resulta insuficiente y lesiva a los derechos fundamentales del recurrente y demás miembros de la comunidad. La Administración no puede limitarse a constatar la inexistencia de infraestructura; su deber constitucional es buscar activamente la solución técnica para garantizar la prestación del servicio.

VII.Sobre la coparticipación de responsabilidad entre el AyA y la ASADA. Conforme a la Ley Constitutiva Instituto Costarricense Acueductos y Alcantarillados N° 2726 y el Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados comunales, Decreto Ejecutivo N° 42582-S-MINAE, del 04 de setiembre de 2020, el AyA ostenta la rectoría técnica absoluta del sector. El hecho de que la ASADA recurrida no haya presentado ante la UEN Gestión de ASADAS del Instituto las solicitudes de estudios específicos para la comunidad de Valle Verde no exime al Instituto de su responsabilidad. La relación entre ambos entes debe basarse en el principio de cooperación y colaboración; la inacción de la ASADA debió ser detectada y corregida por el AyA mediante sus potestades de supervisión y dirección técnica, ya que es conocedor desde hace muchos años de la problemática. Dicha situación ha provocado que actualmente los vecinos de esa comunidad están expuestos a problemas de contaminación, ya que están supeditados a un gestor no autorizado por falta de estudios oficiales que demuestren que es factible tener disponibilidad de agua potable, lo cual constituye una omisión administrativa grave que fractura los derechos fundamentales de los tutelados.

Esta Sala concluye, que el retardo en la realización de los análisis técnicos -indispensables para valorar la viabilidad del abastecimiento frente a las restricciones hidrogeológicas de la zona- no es imputable al recurrente, sino a una falta de coordinación y diligencia de las autoridades recurridas. La carencia de red no es una excusa para la inacción perpetua, sino un presupuesto que obliga a la Administración a realizar las obras de mejora y estudios de capacidad hídrica con celeridad. Al no constar acciones conjuntas y efectivas para dotar de agua potable a la comunidad tras años de solicitudes, se tiene por acreditada la infracción a los derechos fundamentales a la salud y al agua potable, así como al principio de eficiencia en la prestación de los servicios públicos.

VIII.Sobre el conocimiento de este caso por lesión al artículo 41, de la Constitución Política. Previo a analizar el fondo del asunto -por la presunta violación del derecho a un procedimiento administrativo pronto y cumplido- debe aclararse que, a partir del Voto N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa -con algunas excepciones- aquellos asuntos en los que se discuta si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo -incoado de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes. Precisamente, en este recurso, se plantea un supuesto de excepción pues se está ante la falta de resolución de una solicitud de disponibilidad de agua potable. Aclarado el punto, se entra a resolver, la situación concreta planteada en este extremo del amparo.

En la especie, consta que el 19 de marzo de 2025, el recurrente y otros vecinos de Calle Valle Verde nuevamente gestionaron ante la ASADA de Buenos Aires el suministro de agua potable, sin que a la fecha de interposición de este recurso se haya acreditado una respuesta formal, notificada y debidamente fundamentada. De lo expuesto, esta Sala verifica que, la ASADA recurrida ha incurrido en una omisión injustificada, ya que la falta de una resolución no es solo una infracción al artículo 41, de la Constitución Política sino que, dada la naturaleza del servicio pretendido —agua potable para consumo humano—, dicha inercia compromete la efectividad del derecho a la salud y el acceso al agua. No es admisible que, habiendo transcurrido once meses desde la gestión planteada solicitando la instalación del servicio de agua no se haya resuelto. La justicia administrativa debe ser pronta; la dilación en atender una solicitud de agua potable para una comunidad constituye una negligencia que esta Sala no puede ignorar.

Así las cosas, al no constar en autos que la ASADA recurrida haya brindado una resolución efectiva, congruente y oportuna a la gestión planteada en el mes de marzo de 2025, se ha vulnerado el artículo 41 de la Constitución Política.

En cuanto a la denuncia presentada el 26 de setiembre de 2025, ante la Presidencia del Instituto Costarricense de Acueductos y Alcantarillados alertando sobre una situación de extrema gravedad: la operación de un sistema de abastecimiento informal, sin personería jurídica ni controles técnicos o sanitarios, lo que representa un riesgo latente para la salud de la comunidad; lo cierto es que a la fecha de que se interpuso el presente recurso, no había transcurrido un plazo desmedido para la investigación, análisis de los hechos denunciados, aunado a que a partir del 20 de diciembre de 2025, operó el cierre colectivo por vacaciones del sector público. Así las cosas, en cuanto esta autoridad, se declara sin lugar el recurso. No obstante, tome nota el Instituto recurrido que la Administración está obligada a desplegar sus potestades de imperio y supervisión para garantizar que los sistemas de abastecimiento cumplan con el ordenamiento jurídico, no siendo el silencio una respuesta válida frente a la vulneración de derechos fundamentales.

IX.En cuanto a la discriminación: Esta Sala ha reiterado de forma prolija que el derecho a la igualdad, consagrado en el artículo 33, de la Constitución Política, no implica una paridad matemática ni un trato idéntico para todos los administrados en cualquier circunstancia. Por el contrario, la igualdad constitucional exige que se otorgue un trato igual a quienes se hallen en situaciones de hecho sustancialmente idénticas, y desigual a quienes se encuentren en situaciones diversas. En el caso del acceso al agua potable, derecho humano fundamental elevado a rango constitucional en el artículo 50, su exigibilidad está supeditada no solo a la existencia del recurso, sino al cumplimiento de parámetros técnicos, ambientales y legales que garanticen la sostenibilidad del sistema y la salud pública.

En el sublite, el recurrente alega una vulneración al derecho de igualdad, tomando como parámetro de comparación la situación de cuarenta familias en el sector sur de la comunidad de Valle Verde, a quienes sí se les otorgó el servicio. No obstante, del informe técnico rendido bajo gravedad de juramento por el Instituto Costarricense de Acueductos y Alcantarillados (AyA), se desprende que no existe una identidad de circunstancias que permita configurar un trato discriminatorio. La Sala constata que:

Diferenciación técnica: el grupo de viviendas al que se alude como parámetro fue objeto de un proyecto técnico específico, delimitado y debidamente evaluado, que superó las etapas de factibilidad hídrica e hidráulica.

Omisión de requisitos: a diferencia del grupo de referencia, el sector donde se ubican las propiedades del recurrente (sector norte) no cuenta con diagnósticos ni estudios de factibilidad técnica presentados conforme al Reglamento de Prestación de Servicios del AyA. La ausencia de verificación de capacidad hídrica y ambiental impide, por imperativo legal, el otorgamiento de la disponibilidad solicitada.

Restricciones geográficas y ambientales: se acredita que la zona donde se ubica el inmueble del amparado enfrenta limitaciones técnicas particulares, tales como una elevación superior respecto al tanque de suministro y su ubicación dentro de un área de protección absoluta de acuíferos, factores que no concurren de igual forma en el grupo de las 40 viviendas mencionadas.

Nótese que, el trato diferenciado se asienta en criterios objetivos y razonables. La diferenciación aplicada por la autoridad recurrida no es arbitraria ni caprichosa, sino que responde a una imposibilidad técnica y al incumplimiento de requisitos normativos previos por parte de los interesados. Al no existir un término de comparación idóneo, puesto que las situaciones de hecho son técnica y jurídicamente distintas, no se produce la ruptura del principio de igualdad. Para que el recurrente pueda acceder a una disponibilidad de agua en términos similares a sus vecinos del sur, debe someterse al procedimiento de evaluación técnica y subsanar las carencias de infraestructura y estudios ambientales que su ubicación específica demanda, conforme a los artículos 14, del Reglamento de Prestación de Servicios y 46, del Reglamento de ASADAS. Por ende en cuanto este extremo, se declara sin lugar el recurso.

X. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles, contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11, del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19, del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12, celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara parcialmente con lugar el recurso, en cuanto a la violación del principio del buen funcionamiento de los servicios públicos, el derecho al servicio de agua potable y a una justicia pronta y cumplida. Se ordena a Lourdes María Sáurez Barboza, Rafael Barboza Topping, y Randy Madrigal Rodríguez, en su condición respectiva de Presidenta Ejecutiva, Director de la UEN Gestión de ASADAS y encargado de la oficina cantonal de Pococí, todos de Instituto Costarricense de Acueductos y Alcantarillados, y a Juan Carlos Barquero López, en calidad de Representante legal de la Asociación de Acueducto Rural Buenos Airea Sur, Jiménez, o a quien ocupe su cargo, que dentro del plazo de UN MES, a partir de la notificación de la presente sentencia, procedan a coordinar las acciones correspondientes para que se conozca y se busque una solución a la situación denunciada por el aquí recurrente. A su vez, dentro del plazo de doce meses, a partir de la notificación de esta sentencia: a) se realicen y concluyan todos los estudios técnicos de factibilidad hídrica, hidráulica y ambiental necesarios para determinar la viabilidad del suministro de agua potable en el sector de Valle Verde – Calle Vargas.

Lo anterior incluye: a) los análisis hidrogeológicos específicos respecto a la zona de protección del Pozo Numancia. b) Una vez concluidos dichos estudios, y dentro del plazo de un MES adicional, deberán emitir una resolución técnica debidamente fundamentada y notificarla al recurrente, en la que se establezca la hoja de ruta, el cronograma de infraestructura y los requisitos finales para la formalización del servicio de agua potable, o en su defecto, las alternativas técnicas viables para garantizar el acceso al recurso hídrico de forma segura y permanente. Lo anterior, bajo el apercibimiento que con base en lo establecido en el artículo 71, de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.

En los demás extremos se declara sin lugar el recurso. Se condena al Instituto Costarricense de Acueductos y Alcantarillados y a la Asociación Administradora del Acueducto Rural el pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo civil y contencioso administrativo.- Fernando Castillo V.
