Repeated Noncompliance with Creek Cleaning Orders in PuntarenasIncumplimiento reiterado de órdenes de limpieza de quebrada en Puntarenas

Constitutional Chamber Date of Resolution: January 9, 2026 at 09:20 Case File: 25-008866-0007-CO Type of Matter: Amparo Action Resolutions within the same case file Resolution with protected data, in accordance with current regulations CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours twenty minutes of the ninth of January of two thousand twenty-six.

Non-execution of judgment proceeding being processed within the amparo action under case file number 25-008866-0007-CO, filed by [Name 001], identity card [Value 001], against the MUNICIPALITY OF PUNTARENAS AND THE MINISTRY OF HEALTH.

WHEREAS:

1. 1Through a brief filed in the Secretariat of the Chamber at 14:30 hours on November 4, 2025, in which the petitioner alleges disobedience of what was ordered by this Chamber in resolution No. 2025-017101 of 10:15 hours on June 6, 2025, given that said judgment ordered the following: "The action is granted. Randall Alexis Chavarría Matarrita, mayor, and Mauricio Gutiérrez Villafuerte, director of Territorial and Urban Development, both of the Municipality of Puntarenas, or whomever occupies those positions, are ordered to take the corresponding measures and coordination actions deemed necessary, within the scope of their competence, so that within the period of ONE MONTH following the notification of this judgment, the complaint filed by the petitioner before said municipality on August 13, 2024, is definitively resolved. In turn, Jimmy Mauricio Méndez Vargas, director, and German Enrique Madrigal Duarte, environmental manager of the Health Regulation Process, both of the Barranca Health Area (Área Rectora de Salud de Barranca), or whomever occupies those positions, are ordered to take the corresponding measures and coordination actions deemed necessary, within the scope of their competence, so that within the period of ONE MONTH following the notification of this judgment, the complaint filed by the protected party before said health area on November 15, 2024 -within the processing of which health order (orden sanitaria) No. 231-PRSB-2024 was issued- is definitively resolved.In turn, within the same period, the petitioner must be informed of the outcome. (…)". Furthermore, by means of judgment 2025-026388 of 13:10 hours on August 20, 2025, it was ordered: "Randall Alexis Chavarría Matarrita, mayor, and Mauricio Gutiérrez Villafuerte, director of Territorial and Urban Development, both of the Municipality of Puntarenas, as well as Jimmy Mauricio Méndez Vargas, director, and German Enrique Madrigal Duarte, environmental manager of the Health Regulation Process, both of the Barranca Health Area (Área Rectora de Salud de Barranca), or whomever occupies those positions in their stead, are hereby reminded to proceed with the immediate execution of what was faithfully ordered in Judgment number 2025-017101 of 10:15 hours on June 6, 2025, under the warning that testimonies of pieces will be ordered -in the case of the mayor- and the opening of an administrative proceeding against them if they fail to do so -in the case of the other respondents-. Notify the respondents personally." Despite the foregoing, the petitioner claims that the respondent authorities have not complied with what was ordered.
2. 2By resolution of 12:25 hours on November 5, 2025, this disobedience proceeding was served for response.
3. 3Through a brief entered into the Legal System on November 17, 2025, Jimmy Mauricio Méndez Vargas, director of the Barranca Health Area (Área Rectora de Salud de Barranca) and German Enrique Madrigal Duarte, environmental manager of the Health Regulation Process, Barranca Health Area (Área Rectora de Salud de Barranca), both of the Central Pacific Health Governance Regional Directorate, report that: "II.- REGARDING THE ACTIONS OF THE HEALTH AREA (ÁREA RECTORA DE SALUD), we proceed to report. FIRST: On July 10, 2025, technical report No. MS-DRRSPC-DARSB-IT-753-2025 was prepared, setting forth the findings identified from the inspection of the creeks (quebradas) reported and the follow-up on the agreements adopted by the Municipality of Puntarenas, which were: * Accumulation of weeds and vegetation obstructing the channel in other sectors different from those initially inspected. * Accumulation of solid waste. * Cleaning of the clandestine dump diagonal to the Paca Loca establishment and cleaning of the bridge section diagonal to CTP Puntarenas up to the bridge located next to the Elizondo Bakery in El Progreso. * Cleaning of vegetation in the sector where the creeks join.Likewise, other points of the creeks requiring intervention were identified. The inspected points correspond to: 1. Point 1. Bridge next to the Elizondo Bakery in El Progreso. 2. Point 2. Bridge 50 m west of the El Progreso multi-use court. 3. Point 3. Bridge diagonal to the Chante de Fanny establishment, in the Las Parcelas sector. 4. Point 4. From the bridge located 25 m east of the former Los Conejos synthetic court, in the Las Parcelas sector 100 m south. 5. Point 5. Section of the creek starting next to the Empresarios Unidos bus terminal up to the Fiestas del Mar locality. In addition, accumulation of waste on public roads was identified in two sectors near the creek bank, therefore it is of interest to eliminate them, since this waste ends up being washed into water bodies. 1. Dump 1. Bridge 50 m west of the El Progreso multi-use court. 2. Dump 2. In front of the facilities of the 4x3 bus company on Boulevard.Pursuant to the provisions of Article 8 of the Integrated Waste Management Law (Ley para la Gestión Integral de Residuos) No. 8839, it is recommended to issue a health order (ordenamiento sanitario) to the Municipality of Puntarenas to address the identified findings. SECOND: On July 10, 2025, health order (ordenamiento sanitario) No. 099-PRSB-2025 was electronically notified to Mr. Randall Chavarría Matarrita, Municipal Mayor of the Municipality of Puntarenas, instructing him to: 1. Carry out vegetation cleaning and removal of accumulated solid waste in the following sectors of the Bomba Vieja creek and another creek that joins it, described in Technical Report MS-DRRSPC-DARSB-IT-753-2025: a. Point 1. Bridge next to the Elizondo Bakery in El Progreso. b. Point 2. Bridge 50 m west of the El Progreso multi-use court. c. Point 3. Bridge diagonal to the Chante de Fanny establishment, in the Las Parcelas sector. d. Point 4.From the bridge located 25 m east of the former Los Conejos synthetic court, in the Las Parcelas sector 100 m south. 3. Dispose of, in an adequate and sanitary manner, all waste collected at the points indicated above. This is ordered in order to safeguard the health of the population. THIRD: On September 18, 2025, follow-up on health order (ordenamiento sanitario) No. 099-PRSB-2025 was carried out, and after this inspection, technical report No. MS-DRRSPC-DARSB-IT-919-2025 was prepared, concluding that: Based on the foregoing, non-compliance with health order (orden sanitaria) No. 099-PRSB-2025 by Mr. RANDALL CHAVARRÍA MATARRITA is verified, as confirmed by ocular inspection record No. 546-PRSB-2025 that the cleaning and maintenance work on the Bomba Vieja creek and the channel that joins it in the Las Parcelas sector was not carried out. FOURTH: On September 26, 2025, health report (informe sanitario) No. MS-DRRSPC-DARSB-446-2025 was electronically notified to Mr.Randall Chavarría Matarrita, Municipal Mayor of the Municipality of Puntarenas, in which the payment of a fine of one base salary is imposed for non-compliance with the health order. FIFTH: On November 13, 2025, document CARTA-MS-DRRSPC-DARSB-511-2025 was notified by email to Ms. [Name 001], describing the actions taken by this Health Area (Área Rectora de Salud) subsequent to the last communication made. SIXTH: To date, the case file does not contain proof of payment corresponding to the fine imposed through Health Report (Informe Sanitario) No. MS-DRRSPC-DARSB-446-2025, dated September 26, 2025, nor evidence of compliance with the order. From all of the foregoing, it is evident that this health representation has acted diligently and in coordination at all times within the scope of the competencies corresponding to the officials of this Ministry."
4. 4Through a brief submitted on November 21, 2025, Randall Alexis Chavarría Matarrita, mayor of Puntarenas, reports that: "By official letter No. MP-DDTU-OF-0353-11-2025 dated November 20, 2025, the Territorial and Urban Development Unit of the Municipality of Puntarenas submitted a report to the Mayor's Office regarding the creek indicated in the Amparo Action, reporting the following: \"On Friday, October 3rd and Saturday, October 4th of the current year, the country experienced the onslaught of tropical storm No. 33-2025, which affected, among others, the community where the protected party [Name 001] resides. Heavy rainfall occurred, which caused an increase in the water level, however, this event did not cause flooding problems for the protected party, due to the work carried out in the year 2024. A nationwide Orange Alert No. 33-2025 was declared. Through the 911 system, countless incident reports and inspection requests came in due to the heavy rainfall that caused the event described above.LOCATION OF AFFECTATIONS REQUIRING A NEW INTERVENTION: PROVINCE 06 PUNTARENAS, CANTON No. 1 CENTRAL, DISTRICT 08 BARRANCA, ADDRESS, Las Parcelas (North side of the Los Conejos 5-a-side football field), in Bomba Vieja creek. (…) Based on the requests, they proceed to begin compiling information, prepare the report, submit it for validation by the Mayor, and send it via email to the CNE's initial impact unit along with the situation report generated by the Municipal Emergency Committee of the Municipality of Puntarenas. The C.N.E. diligently processed said request and, through the Undeclared Emergency Contracting No. 2025PX-0003 83-00065000012 Rental of heavy machinery to address emergency in the canton of Puntarenas, Barranca district, Bomba Vieja creek, El Progreso settlement. This procedure resulted in the award of said machinery contracting process to the company MAD CROSBY M & C SA, for the purpose of executing, for 300 machine hours, the cleaning of the Bomba Vieja creek channel (cauce) from the starting point at the Vado del Quebrador la Rioja upstream.On November 10, 2025, an inspection was carried out jointly with the contractor, in order to detail the expected scope, the intervention methodology, and the equipment storage site. The equipment formally began work on November 12, 2025, having executed 87 of the 300 contracted hours. Attached is a photographic record.\". "
5. 5The legal requirements have been observed in the proceedings followed.

Drafted by Judge Hess Herrera; and,

WHEREAS:

SOLE: The petitioner comes before this Constitutional Court alleging disobedience, for the second time, of the provisions of vote No. 2025-017101 of 10:15 hours on June 6, 2025, given that said judgment ordered the following: "The action is granted. Randall Alexis Chavarría Matarrita, mayor, and Mauricio Gutiérrez Villafuerte, director of Territorial and Urban Development, both of the Municipality of Puntarenas, or whomever occupies those positions, are ordered to take the corresponding measures and coordination actions deemed necessary, within the scope of their competence, so that within the period of ONE MONTH following the notification of this judgment, the complaint filed by the petitioner before said municipality on August 13, 2024, is definitively resolved. In turn, Jimmy Mauricio Méndez Vargas, director, and German Enrique Madrigal Duarte, environmental manager of the Health Regulation Process, both of the Barranca Health Area (Área Rectora de Salud de Barranca), or whomever occupies those positions, are ordered to take the corresponding measures and coordination actions deemed necessary, within the scope of their competence, so that within the period of ONE MONTH following the notification of this judgment, the complaint filed by the protected party before said health area on November 15, 2024 -within the processing of which health order (orden sanitaria) No. 231-PRSB-2024 was issued- is definitively resolved.

In turn, within the same period, the petitioner must be informed of the outcome. (…)". Said judgment was reiterated through Vote No. 2025-026388 of 13:10 hours on August 20, 2025. In this regard, Randall Alexis Chavarría Matarrita, mayor of Puntarenas, reported that according to official letter No. MP-DDTU-OF-0254-U3-2025 dated August 13, 2025, the Territorial and Urban Development Unit of the Municipality of Puntarenas explained the process carried out and the pending actions to be performed, among them, the process of requesting an undeclared emergency intervention before the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias which will last the remainder of 2025 -as they must request the respective intervention-, to then restart the process. Additionally, he added that due to tropical storm No. 33-2025, which affected the area between October 3rd and 4th, 2025, causing an increase in the water level, they had to rent heavy machinery to address the emergency.

This procedure resulted in the award of said machinery contracting process to the company MAD CROSBY M & C SA, and on November 10, 2025, an inspection was carried out jointly with the contractor in order to detail the expected scope, the intervention methodology, and the equipment storage site. The equipment formally began work on November 12, 2025. For their part, Jimmy Mauricio Méndez Vargas, director of the Barranca Health Area (Área Rectora de Salud de Barranca) and German Enrique Madrigal Duarte, environmental manager of the Health Regulation Process, Barranca Health Area (Área Rectora de Salud de Barranca), both of the Central Pacific Health Governance Regional Directorate, reiterated that they issued health order (orden sanitaria) No. 099-PRSB-2025 on July 10, 2025, ordering the respondent mayor to carry out a series of works in the area under discussion; however, there is no record of the follow-up performed on said administrative order, much less that the protected party was notified of the actions taken.

Additionally, they claim that on September 26, 2025, health report (informe sanitario) No. MS-DRRSPC-DARSB-446-2025 was electronically notified to Mr. Randall Chavarría Matarrita, mayor of Puntarenas, in which the payment of a fine of one base salary was imposed for non-compliance with the health order, and additionally, on November 13, 2025, document CARTA-MS-DRRSPC-DARSB-511-2025 was notified by email to Ms. [Name 001], describing the actions taken by this Health Area (Área Rectora de Salud) subsequent to the last communication made; however, there is no record of payment corresponding to the fine imposed through Health Report (Informe Sanitario) No. MS-DRRSPC-DARSB-446-2025, dated September 26, 2025, nor evidence of compliance with the order. As a consequence of the foregoing, it is deemed proven that the cited judgment was not fully complied with by the respondents within the established period, and upon being granted a hearing regarding this disobedience proceeding, they acknowledge the non-compliance with what was ordered and promise to carry out the pending actions.

Consequently, Randall Alexis Chavarría Matarrita, mayor, and Mauricio Gutiérrez Villafuerte, director of Territorial and Urban Development, both of the Municipality of Puntarenas, as well as Jimmy Mauricio Méndez Vargas, director, and German Enrique Madrigal Duarte, environmental manager of the Health Regulation Process, both of the Barranca Health Area (Área Rectora de Salud de Barranca), or whomever occupies those positions in their stead, are hereby reminded to proceed with the immediate execution of what was faithfully ordered in Judgments numbers 2025-017101 of 10:15 hours on June 6, 2025, and 2025-026388 of 13:10 hours on August 20, 2025, under the warning that testimonies of pieces will be ordered -in the case of the mayor- and the opening of an administrative proceeding against them if they fail to do so -in the case of the other respondents-. They must provide evidence demonstrating such compliance with what was ordered.

THEREFORE:

Randall Alexis Chavarría Matarrita, mayor, and Mauricio Gutiérrez Villafuerte, director of Territorial and Urban Development, both of the Municipality of Puntarenas, as well as Jimmy Mauricio Méndez Vargas, director, and German Enrique Madrigal Duarte, environmental manager of the Health Regulation Process, both of the Barranca Health Area (Área Rectora de Salud de Barranca), or whomever occupies those positions in their stead, are hereby reminded to proceed with the immediate execution of what was faithfully ordered in Judgments numbers 2025-017101 of 10:15 hours on June 6, 2025, and 2025-026388 of 13:10 hours on August 20, 2025, under the warning that testimonies of pieces will be ordered -in the case of the mayor- and the opening of an administrative proceeding against them if they fail to do so -in the case of the other respondents-. Notify the respondents personally.

Sentencias del mismo expediente Sentencia con datos protegidos, de conformidad con la normativa vigente SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del nueve de enero de dos mil veintiseis .

Gestión de inejecución de sentencia que se tramita dentro del recurso de amparo con expediente número 25-008866-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra la MUNICIPALIDAD DE PUNTARENAS Y EL MINISTERIO DE SALUD.

RESULTANDO:

1. 1Mediante memorial presentado en la Secretaría de la Sala a las 14:30 horas del 4 de noviembre de 2025, en donde el recurrente acusa desobediencia a lo ordenado por esta Sala en la resolución Nº 2025-017101 de las 10:15 horas del 6 de junio de 2025, toda vez que en esa sentencia se dispuso lo siguiente: “Se declara con lugar el recurso. Se ordena a Randall Alexis Chavarría Matarrita, alcalde y a Mauricio Gutiérrez Villafuerte, director de Desarrollo Territorial y Urbano, ambos de la Municipalidad de Puntarenas, o a quienes ocupen esos cargos, tomar las medidas correspondientes y las acciones de coordinación que se estimen, dentro del ámbito de su competencia, para que en el plazo de UN MES posterior a la notificación de esta sentencia, se resuelva de forma definitiva la denuncia presentada por la accionante ante dicho municipio el 13 de agosto de 2024. A su vez se ordena a Jimmy Mauricio Méndez Vargas, director y a German Enrique Madrigal Duarte, gestor ambiental del Proceso de Regulación de la Salud, ambos del Área Rectora de Salud de Barranca, o a quienes ocupen esos cargos, tomar las medidas correspondientes y las acciones de coordinación que se estimen, dentro del ámbito de su competencia, para que en el plazo de UN MES posterior a la notificación de esta sentencia, se resuelva de forma definitiva la denuncia presentada por la amparada ante dicha área rectora el 15 de noviembre de 2024 -dentro del trámite de la cual se dictó la orden sanitaria N°231-PRSB-2024-.A su vez, en el mismo plazo se le deberá comunicar a la recurrente lo resuelto. (…)”. Además, por medio de sentencia 2025-026388 de las 13:10 horas del 20 de agosto de 2025, se dispuso: “Se le reitera a Randall Alexis Chavarría Matarrita, alcalde y a Mauricio Gutiérrez Villafuerte, director de Desarrollo Territorial y Urbano, ambos de la Municipalidad de Puntarenas, así como a Jimmy Mauricio Méndez Vargas, director y a German Enrique Madrigal Duarte, gestor ambiental del Proceso de Regulación de la Salud, ambos del Área Rectora de Salud de Barranca, o a quienes en su lugar ocupen dichos cargos, que procedan al cumplimiento inmediato de lo fielmente dispuesto en la Sentencia número 2025-017101 de las 10:15 horas del 6 de junio de 2025, bajo la advertencia de ordenarse el testimonio de piezas -en el caso del alcalde- y la apertura de un procedimiento administrativo en su contra si no lo hicieren -en el caso de los otros recurridos-. Notifíquese a los accionados de forma personal.”. Pese a lo expuesto, acusa que las autoridades accionadas no han cumplido con lo ordenado.
2. 2Mediante resolución de las 12:25 horas del 5 de noviembre de 2025, se dio traslado a la presente gestión de desobediencia.
3. 3Mediante escrito incorporado al Sistema Jurídico el 17 de noviembre de 2025, Jimmy Mauricio Méndez Vargas, director del Área Rectora de Salud de Barranca y German Enrique Madrigal Duarte, gestor ambiental del Proceso de Regulación de la Salud, Área Rectora de Salud Barranca, ambos de la Dirección Regional Rectoría de la Salud Pacífico Central, informan que: “II.- SOBRE LA ACTUACIÓN DEL AREA RECTORA DE SALUD, se procede a informar. PRIMERO: El día 10 de julio del 2025, se procede a la confección del informe técnico N° MS-DRRSPC-DARSB-IT-753-2025, donde se expone los hallazgos identificados sobre la inspección en las quebradas denunciadas y el seguimiento a los acuerdos adquiridos por la Municipalidad de Puntarenas, los cuales fueron: * Acumulación de maleza y vegetación que obstruye el canal en otros sectores diferentes a los inspeccionados inicialmente. * Acumulación de residuos sólidos. * Limpieza del botadero clandestino diagonal al establecimiento Paca Loca y limpieza del tramo del puente diagonal al CTP Puntarenas hasta el puente ubicado a un costado de la Panadería Elizondo en El Progreso. * Limpieza de vegetación del sector donde se unen las quebradas.Asimismo, se identificaron otros puntos de las quebradas que requieren ser intervenidos. Los puntos inspeccionados corresponden: 1. Punto 1. Puente a un costado de la Panadería Elizondo en El Progreso. 2. Punto 2. Puente 50 m oeste de la cancha multiuso de El Progreso. 3. Punto 3. Puente diagonal al establecimiento Chante de Fanny, en el sector de Las Parcelas. 4. Punto 4. Del puente ubicado a 25 m este de antigua cancha sintética Los Conejos, en el sector de Las Parcelas 100 m sur. 5. Punto 5. Tramo de la quebrada iniciando a un costado de la terminal de buses de empresarios unidos hasta la localidad Fiestas del Mar. Se identificó, además, acumulación de residuos sobre la vía pública en dos sectores cerca del margen de la quebrada, por lo que resulta de interés eliminarlos, ya que estos residuos terminan siendo arrastrados en los cuerpos de agua. 1. Botadero 1. Puente 50 m oeste de la cancha multiuso de El Progreso. 2.Botadero 2. Frente al plantel de la empresa de buses 4x3 en Boulevard. Según lo dispuesto en el artículo 8 de la Ley para la Gestión Integral de Residuos N°8839 se recomienda emitir ordenamiento sanitario a la Municipalidad de Puntarenas para la atención de los hallazgos identificados. SEGUNDO: El día 10 de julio del 2025, se notifica de forma electrónica el ordenamiento sanitario N° 099-PRSB-2025, al señor Randall Chavarría Matarrita, Alcalde Municipal de la Municipalidad de Puntarenas, en el que se le indica: 1. Efectuar labores de limpieza de vegetación y remoción de residuos sólidos acumulados en los siguientes sectores de la quebrada Bomba Vieja y otra que se une a esta descritos en el Informe Técnico MS-DRRSPC-DARSB-IT-753-2025: a. Punto 1. Puente a un costado de la Panadería Elizondo en El Progreso. b. Punto 2. Puente 50 m oeste de la cancha multiuso de El Progreso. c. Punto 3. Puente diagonal al establecimiento Chante de Fanny, en el sector de Las Parcelas. d. Punto 4.Del puente ubicado a 25 m este de antigua cancha sintética Los Conejos, en el sector de Las Parcelas 100 m sur. 3. Disponer adecuada y sanitariamente la totalidad de los residuos recolectados indicados en los puntos anteriores. Se ordena con el fin de salvaguardar la salud de la población. TERCERO: El día 18 de setiembre del 2025, se realiza el seguimiento al ordenamiento sanitario N° 099-PRSB-2025 y posterior a esta inspección se confecciona el informe técnico N° MS-DRRSPC-DARSB-IT-919-2025, donde se concluye que: Con base en lo anterior se constata el incumplimiento a la orden sanitaria N°099-PRSB-2025 por parte del señor RANDALL CHAVARRÍA MATARRITA al constatarse mediante acta de inspección ocular N°546-PRSB-2025 que no se efectuaron las labores de limpieza y mantenimiento de la quebrada Bomba Vieja y el cause que se une a esta en el sector de Las Parcelas. CUARTO: El día 26 de setiembre del 2025, se notifica de forma electrónica el informe sanitario N° MS-DRRSPC-DARSB-446-2025, al señor Randall Chavarría Matarrita, Alcalde Municipal de la Municipalidad de Puntarenas, en el cual se le impone el pago de una multa de un salario base por incumplimiento en la orden sanitaria.QUINTO: El día 13 de noviembre del 2025, se notifica por correo electrónico el documento CARTA-MS-DRRSPC-DARSB-511-2025, a la señora [Nombre 001], donde se describen las actuaciones por parte de esta Área Rectora de Salud, posterior a la última comunicación realizada. SEXTO: A la fecha no consta en expediente el pago correspondiente a la multa impuesta mediante el Informe Sanitario N° MS-DRRSPC-DARSB-446-2025, del 26 de setiembre de 2025, ni tampoco evidencia del cumplimiento de la ordenanza. De todo lo anterior, se desprende que esta representación de salud ha actuado en todo momento con diligencia y coordinación dentro del ámbito de las competencias que corresponden a los funcionarios de este Ministerio.”.
4. 4Mediante escrito aportado el 21 de noviembre de 2025, Randall Alexis Chavarría Matarrita, alcalde de Puntarenas, informa que: “Mediante oficio No. MP-DDTU-OF-0353-11-2025 de fecha 20 de noviembre de 2025, la Unidad de Desarollo Territorial y Urbano de la Municipalidad de Puntarenas, presenta un informe a la Alcaldía en relación a la quebrada indicada en el Recurso de Amparo, informando en lo conducente: "En fecha viernes 03 y sábado 04 de octubre de los corrientes el país experimentó los embates de Ia tormenta tropical No. 33-2025, la cual afecto entre otras la comunidad donde reside la amparada [Nombre 001]. Se presentan fuertes precipitaciones, lo cual provocó aumento en el nivel del caudal, no obstante dicho evento no causó problemas de inundación a la amparada, debido a los trabajos realizados en año 2024. A nivel nacional se declara Alerta Naranja No. 33-2025. Mediante el sistema 911, ingresan innumerables reportes de incidentes y de inspección debido a las fuertes precipitaciones que provocaron el evento descrito anteriormente.UBICACIÓN DE AFECTACIONES QUE REQUIEREN UNA NUEVA INTERVENCIÓN: PROVINCIA 06 PUNTARENAS, CANTÓN NO. 1 CENTRAL, DISTRITO 08 BARRANCA, DIRECCION, Las Parcelas (Costado norte de la plaza de Futbol 5 Los Conejos), en quebrada Bomba Vieja. (…) De acuerdo a las solicitudes proceden a iniciar una recopilación de la información, la preparación del informe, someterlo a validación del señor Alcalde y enviarlo vía correo electrónico a primeros impactos de la CNE junto con el informe de situación Generado por el Comité Municipal de Emergencias de la Municipalidad de Puntarenas. La C.N.E de forma diligente tramitó dicha solicitud y por medio de la Contratación por Emergencia No Declarada N° 2025PX-0003 83-00065000012 Alquiler de maquinaria pesada para atender emergencia en el cantón de Puntarenas, distrito Barranca, quebrada Bomba Vieja poblado El Progreso. Dicho trámite logró la adjudicación de dicho procedimiento de contratación de maquinaria a la empresa MAD CROSBY M & C SA, a efectos de ejecutar por 300 horas maquina, la limpieza del cauce de la Quebrada Bomba Vieja desde el punto de inicio Vado del Quebrador la Rioja hacia aguas arriba.El día 10 de noviembre de 2025, se realizó inspección en conjunto con el contratista, a efectos de detallar los alcances esperados, la metodología de intervención y el sitio de resguardo del equipo. El equipo empezó formalmente labores el día 12 de noviembre de 2025 y a ejecución 87 horas de las 300 horas contratadas. Adjunto registro fotográfico.”.
5. 5En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta la Magistrada Hess Herrera; y,

CONSIDERANDO:

ÚNICO: La recurrente acude a este Tribunal Constitucional aduciendo la desobediencia por segunda ocasión a lo dispuesto en el voto Nº 2025-017101 de las 10:15 horas del 6 de junio de 2025, toda vez que en esa sentencia se dispuso lo siguiente: “Se declara con lugar el recurso. Se ordena a Randall Alexis Chavarría Matarrita, alcalde y a Mauricio Gutiérrez Villafuerte, director de Desarrollo Territorial y Urbano, ambos de la Municipalidad de Puntarenas, o a quienes ocupen esos cargos, tomar las medidas correspondientes y las acciones de coordinación que se estimen, dentro del ámbito de su competencia, para que en el plazo de UN MES posterior a la notificación de esta sentencia, se resuelva de forma definitiva la denuncia presentada por la accionante ante dicho municipio el 13 de agosto de 2024. A su vez se ordena a Jimmy Mauricio Méndez Vargas, director y a German Enrique Madrigal Duarte, gestor ambiental del Proceso de Regulación de la Salud, ambos del Área Rectora de Salud de Barranca, o a quienes ocupen esos cargos, tomar las medidas correspondientes y las acciones de coordinación que se estimen, dentro del ámbito de su competencia, para que en el plazo de UN MES posterior a la notificación de esta sentencia, se resuelva de forma definitiva la denuncia presentada por la amparada ante dicha área rectora el 15 de noviembre de 2024 -dentro del trámite de la cual se dictó la orden sanitaria N°231-PRSB-2024-.

A su vez, en el mismo plazo se le deberá comunicar a la recurrente lo resuelto. (…)”. Dicha sentencia fue reiterada por medio del Voto No. 2025-026388 de las 13:10 horas del 20 de agosto de 2025. Al respecto, Randall Alexis Chavarría Matarrita, alcalde de Puntarenas, informó que según el oficio No. MP-DDTU-OF-0254-U3-2025 de fecha 13 de agosto de 2025, la Unidad de Desarrollo Territorial y Urbano de la Municipalidad de Puntarenas, explicó el proceso llevado a cabo y las acciones pendientes a realizar, entre ellas, el proceso de solicitud de intervención por emergencia no declarada ante la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias el cual durará el resto del 2025 -pues deben solicitar la intervención respectiva-, para luego reiniciar el proceso. Adicional, agregó que debido a la tormenta tropical No. 33-2025, que afectó la zona entre los días 03 y 04 de octubre de 2025, se provocó un aumento en el nivel del caudal, debieron alquiler maquinaria pesada para atender emergencia.

Dicho trámite logró la adjudicación de dicho procedimiento de contratación de maquinaria a la empresa MAD CROSBY M & C SA, y el 10 de noviembre de 2025, realizó inspección en conjunto con el contratista, a efectos de detallar los alcances esperados, la metodología de intervención y el sitio de resguardo del equipo. El equipo empezó formalmente labores el día 12 de noviembre de 2025. Por su parte, Jimmy Mauricio Méndez Vargas, director del Área Rectora de Salud de Barranca y German Enrique Madrigal Duarte, gestor ambiental del Proceso de Regulación de la Salud, Área Rectora de Salud Barranca, ambos de la Dirección Regional Rectoría de la Salud Pacífico Central, reiteraron que emitieron la orden sanitaria N°099-PRSB-2025 del 10 de julio de 2025, en donde se le ordenó al alcalde accionado realizar una serie de obras en la zona en discusión; sin embargo, no consta el seguimiento efectuado a dicha orden administrativa, ni menos aún, que se le haya notificado a la parte amparada sobre lo actuado.

Adicional, alegan que el día 26 de setiembre del 2025, se notificó de forma electrónica el informe sanitario N° MS-DRRSPC-DARSB-446-2025, al señor Randall Chavarría Matarrita, alcalde de Puntarenas, en el cual se le impuso el pago de una multa de un salario base por incumplimiento en la orden sanitaria, y adicional, el día 13 de noviembre del 2025, se notificó por correo electrónico el documento CARTA-MS-DRRSPC-DARSB-511-2025, a la señora [Nombre 001], donde se describen las actuaciones por parte de esta Área Rectora de Salud, posterior a la última comunicación realizada; sin embargo, no consta el pago correspondiente a la multa impuesta mediante el Informe Sanitario N° MS-DRRSPC-DARSB-446-2025, del 26 de setiembre de 2025, ni tampoco evidencia del cumplimiento de la ordenanza. Como consecuencia de lo expuesto, se tiene por acreditado que la sentencia citada no fue cumplida a cabalidad por los accionados en el plazo previsto, y al concedérseles audiencia en razón de esta gestión de desobediencia, reconocen el incumplimiento de lo ordenado y prometen realizar las acciones faltantes.

En consecuencia, se le reitera a Randall Alexis Chavarría Matarrita, alcalde y a Mauricio Gutiérrez Villafuerte, director de Desarrollo Territorial y Urbano, ambos de la Municipalidad de Puntarenas, así como a Jimmy Mauricio Méndez Vargas, director y a German Enrique Madrigal Duarte, gestor ambiental del Proceso de Regulación de la Salud, ambos del Área Rectora de Salud de Barranca, o a quienes en su lugar ocupen dichos cargos, que procedan al cumplimiento inmediato de lo fielmente dispuesto en las Sentencia números 2025-017101 de las 10:15 horas del 6 de junio de 2025 y 2025-026388 de las 13:10 horas del 20 de agosto de 2025, bajo la advertencia de ordenarse el testimonio de piezas -en el caso del alcalde- y la apertura de un procedimiento administrativo en su contra si no lo hicieren -en el caso de los otros recurridos-. Deberán aportar prueba que demuestre dicho cumplimiento de lo ordenado.

POR TANTO:

Se le reitera a Randall Alexis Chavarría Matarrita, alcalde y a Mauricio Gutiérrez Villafuerte, director de Desarrollo Territorial y Urbano, ambos de la Municipalidad de Puntarenas, así como a Jimmy Mauricio Méndez Vargas, director y a German Enrique Madrigal Duarte, gestor ambiental del Proceso de Regulación de la Salud, ambos del Área Rectora de Salud de Barranca, o a quienes en su lugar ocupen dichos cargos, que procedan al cumplimiento inmediato de lo fielmente dispuesto en las Sentencia números 2025-017101 de las 10:15 horas del 6 de junio de 2025 y 2025-026388 de las 13:10 horas del 20 de agosto de 2025, bajo la advertencia de ordenarse el testimonio de piezas -en el caso del alcalde- y la apertura de un procedimiento administrativo en su contra si no lo hicieren -en el caso de los otros recurridos-. Notifíquese a los accionados de forma personal.
