Whereas:
Before analyzing the merits of the matter, it must be clarified that, beginning with judgment no. 2008002545 issued at 8:55 on 22 de febrero de 2008, this Chamber has referred to the administrative litigation jurisdiction (jurisdicción contencioso administrativa)—with certain exceptions—those matters involving disputes as to whether the Public Administration has complied with the time limits established by the Ley General de la Administración Pública (Articles 261 and 325) or by sector-specific laws governing special administrative proceedings, either to conclude an administrative proceeding—initiated ex officio or at the request of a party—by issuing a final administrative act (acto final), or to hear the applicable administrative appeals (recursos administrativos). Specifically, the matter sub judice (sub lite) presents an exception, because it concerns the alleged delay in resolving a complaint regarding an obstruction of a public roadway that, according to the petitioner, endangers the physical integrity and lives of pedestrians. Having clarified this point, the Chamber proceeds to rule on the specific situation raised in this constitutional rights action.
The petitioner alleges that on 4 de setiembre de 2025 he submitted by email a complaint concerning unlawful structures within National Route 160; however, it has not yet been resolved.
The following facts, which are relevant to the resolution of this matter, are deemed duly established:
Specifically, it requested the following: 1. Conduct an inspection at the reported sites to verify the illegality of the advertising installations and structures placed along National Route 160, in the Belén (Church)–Sámara section. 2. Proceed with the immediate demolition and removal of any advertisement or advertising structure placed along this section without the corresponding permits, in compliance with the Regulations on Rights-of-Way and Outdoor Advertising. 3. Conduct a thorough review of the area to ensure compliance with road-safety provisions and the protection of public-domain property. 4. Take the pertinent legal action against those who have violated the legal provisions by unlawfully occupying right-of-way land and adversely affecting safety and public order. 5. Coordinate actions with the Municipalidad de Nicoya. Page 1 of 13 Second: It is evident that this Ministry is fully aware of the existence of these unlawful occupations and, despite this, has failed to act diligently to safeguard the integrity of public property, road safety, and environmental public order, thereby failing to fulfill its constitutional, statutory, and regulatory duties.
The unlawful occupation of these public spaces directly affects the safety of pedestrians and drivers by obstructing visibility and hindering proper travel on public roads, and constitutes misuse of public property to the detriment of the general interest, thereby violating fundamental constitutional rights such as the rights to life, physical integrity, a healthy environment, and road safety. This situation constitutes misuse of public-domain property, whose intended purpose is common and unrestricted use for the benefit of the entire community. By allowing or tolerating such occupations, the general interest is harmed and fundamental rights enshrined in the Political Constitution, such as the rights to life and physical integrity, are violated. Third: By means of a notice dated July 7, 2025, this Ministry effectively refused to provide meaningful attention to Ms. Pochet Reyes’s complaint, relying on irrational criteria that violate my fundamental rights and thereby disregarding its constitutional and legal obligations.
In that communication, it states that it carried out limited interventions to remove certain small advertising structures along National Route N°160—but it is evident that it did not fully remove the unlawfully installed structures, leaving intact the largest and most visible elements, which continue to encroach upon the right-of-way and impair road safety. (…) The foregoing demonstrates a clear failure to fulfill its legal duty to safeguard and protect public-domain property and the fundamental rights involved. Moreover, the aforementioned communication acknowledges that the continued existence of these unlawful occupations gravely violates fundamental rights such as the rights to life, physical integrity, a healthy environment, and road safety, while also jeopardizing the general interest and the well-being of the community, stating as follows: ‘(…) It is understandable that you, as a community, are concerned about the situation; however, in an effort to improve matters and seek solutions and alternatives capable of having a more significant impact on this serious problem, we have approached Development Associations and Municipalities so that joint efforts may be undertaken to mitigate or somewhat alleviate this issue.
In addition, efforts are being made to raise awareness among businesses and business owners in the area that advertising within the right-of-way is absolutely ILLEGAL and that they must neither place advertisements nor pay any money that would encourage this type of unlawful business, which harms not only the area’s natural the (sic) environment but may also pose a danger to pedestrians and drivers (…)’ (Boldface does not appear in the original text.) However, this Ministry has not adopted corrective, preventive, or restorative measures to recover public-domain property or to guarantee the effective protection of the fundamental rights at stake, including life, physical integrity, road safety, and a healthy environment. Nor has it provided an effective response to the complaint filed by Ms. Pochet Reyes, and it has engaged in prolonged inaction evidencing a serious omission. The passage of time without concrete results constitutes an actual and ongoing violation of fundamental rights and the public interest (…) RELIEF REQUESTED 1.
Conduct an inspection at the sites reported on November 28, 2024—280 days ago—to verify the illegality of the advertising installations and structures placed along National Route 160, in the Belén (Church) section. I also request that I be provided with a copy of the inspection record and report. 2. Proceed with the immediate demolition and removal of any advertisement or advertising structure placed along this section without the corresponding permits, in compliance with the Regulations on Rights-of-Way and Outdoor Advertising. If the requested action is not taken, I ask to be expressly informed of the duly substantiated legal justification supporting that refusal. 3. Conduct a thorough review of the area along National Route 160—from La Bomba de Sámara to Playa Sámara—to ensure compliance with road-safety provisions and the protection of public-domain property (bienes demaniales), and provide me with a copy of the inspection record and report. 4.
Take the pertinent legal action against those who have violated the legal provisions by unlawfully occupying right-of-way land and adversely affecting safety and public order. If the requested action is not taken, I ask to be expressly informed of the duly substantiated legal justification supporting that refusal. 5. Coordinate actions with the Municipalidad de Nicoya in compliance with the principle of inter-institutional coordination (principio de coordinación interinstitucional).” That complaint was assigned reference no. 8186. In the case at bar, the appellant alleges that on September 4, 2025, he emailed a complaint concerning unlawful structures within National Route 160; nevertheless, it has not yet been resolved.
The record shows that, on 4 de setiembre de 2025, the petitioner sent an email to [email protected]. Attached to that email was a document stating: “First: On (sic) 28 de noviembre del año 2024, Ms. Tatiana Pochet Reyes formally filed a complaint with this Ministry in defense of public-domain property (bienes de dominio público), the integrity of the right-of-way (derecho de vía), and road safety, in strict compliance with articles 20 and 50 of the Political Constitution of the Republic of Costa Rica, the General Law on Public Roads, the Regulations on Rights-of-Way and Outdoor Advertising, and all other applicable regulations. That complaint requested an inspection of the site—which consists of a short section of the National Route—the demolition of irregular structures, the adoption of the appropriate administrative measures, and notification to the complainant regarding the progress of the proceedings.
Specifically, it requested the following: 1. Conduct an inspection at the reported sites to verify the illegality of the advertising installations and structures placed on National Route 160, in the Belén (Church)–Sámara section. 2. Proceed with the immediate demolition and removal of any advertisement or advertising structure placed along this section without the corresponding permits, in compliance with the Regulations on Rights-of-Way and Outdoor Advertising. 3. Conduct a thorough review of the area to ensure compliance with road-safety provisions and the protection of public-domain property (bienes demaniales). 4. Undertake the appropriate legal actions against those who have violated the legal provisions by unlawfully occupying right-of-way land and affecting public safety and order. 5. Undertake coordination efforts with the Municipalidad de Nicoya. By allowing or tolerating these occupations, the general interest is adversely affected and fundamental rights enshrined in the Political Constitution, such as the right to life and physical integrity, are violated. Third: Through a notice dated 7 de julio de 2025, this Ministry effectively refused to take effective action on Ms. Pochet Reyes’s complaint, relying on irrational criteria that violate my fundamental rights and thereby disregarding its constitutional and legal obligations.
In that communication, it states that it carried out limited interventions to remove certain small advertising structures along National Route N°160, but it is evident that it did not completely remove the illegally installed structures, leaving intact the largest and most visible elements, which continue to affect the right-of-way and road safety. In addition, efforts are being made to raise awareness among businesses and entrepreneurs in the area that advertising within the right-of-way is absolutely ILLEGAL and that no advertising should be purchased and no money should be paid to encourage this type of irregular business, which harms not only the (sic) natural environment of the area but may also pose a danger to pedestrians and drivers (…)’ (Boldface is not part of the original text.) Nevertheless, this Ministry has not adopted corrective, preventive, or restorative measures to recover public-domain property or to ensure the effective protection of the fundamental rights at stake, such as life, physical integrity, road safety, and a healthy environment. Nor has it provided an effective response to the complaint filed by Ms. Pochet Reyes, and it has engaged in prolonged inaction evidencing a serious omission. The passage of time without concrete results constitutes an actual and continuing violation of fundamental rights and the public interest (…) RELIEF SOUGHT 1.
Conduct an inspection at the sites reported on 28 de noviembre del año 2024—280 days ago—to verify the illegality of the advertising installations and structures placed on National Route 160, in the Belén (Church) section. I also request that you provide me with a copy of that inspection and report. 2. Proceed with the immediate demolition and removal of any advertisement or advertising structure placed along this section without the corresponding permits, in compliance with the Regulations on Rights-of-Way and Outdoor Advertising. If the requested action is not taken, I ask to be expressly informed of the duly substantiated legal justification supporting that refusal. 3. Conduct a thorough review of the area along National Route 160—from La Bomba de Sámara to Playa Sámara—to ensure compliance with road-safety provisions and the protection of public-domain property, and provide me with a copy of that inspection and report. 4.
Undertake the appropriate legal actions against those who have violated the legal provisions by unlawfully occupying right-of-way land and affecting public safety and order. If the requested action is not taken, I ask to be expressly informed of the duly substantiated legal justification supporting that refusal. 5. Undertake coordination efforts with the Municipalidad de Nicoya in compliance with the principle of interinstitutional coordination (principio de coordinación interinstitucional).” That complaint was assigned reference no. 8186. The email address [email protected] constitutes an official mechanism for submitting requests to the respondent authority.
Furthermore, although the respondents informed the Chamber that “Furthermore, the complaint submitted by email from the email address [email protected], dated 4 de septiembre del año en cuso, was answered, as may be verified in the attached file entitled emails,” and also stated that an operation on the route in question had been scheduled for marzo de 2026, it is nonetheless true that there is nothing in the record that would allow this Chamber to establish that the request at issue in this proceeding has in fact already been resolved or that the petitioner was notified of any formal response to his complaint, which amounts to a flagrant violation of constitutional provision 41. Accordingly, the proceeding must be granted with respect to this issue.
I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and effective justice in administrative proceedings (sede administrativa), jurisdiction over the legal dispute lies with the Contentious-Administrative Courts and not with this Chamber. However, with the recent enactment of Law no. 9097, Law Regulating the Right of Petition, it has been established that this right is eligible for judicial protection through an amparo proceeding (recurso de amparo) established under article 32 of the Law on Constitutional Jurisdiction, in relation to article 27 of the Political Constitution of the Republic of Costa Rica, in cases where the petitioner considers that the Administration’s material actions, administrative acts, or response are affecting the petitioner’s fundamental rights. In my view, the recently enacted legislation does not require this Court to modify its line of precedent, since, pursuant to provision 7 of its Law, it has exclusive authority to define its own jurisdiction.
Therefore, except for those constitutional-law disputes that this Chamber itself has recognized as exceptional circumstances and that may properly be heard in this jurisdiction through the constitutional amparo guarantee proceeding, in all other cases, and for the reasons stated by this Court (judgment N° 2008- 02545 at 8:55 hours on 22 de febrero de 2008), jurisdiction lies with the Judges of the contentious-administrative jurisdiction. All of this is consistent with provision 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and rules), and the corresponding statutory provisions, based on a logical, systemic, and teleological interpretation of the legal system.
The parties are hereby advised that, if they have submitted any paper document, objects, or evidence stored on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, these must be collected within a maximum period of 30 business days, counted from notification of this judgment. The parties are warned that any material not collected within that period will be destroyed pursuant to the “Regulations on Electronic Case Files before the Judiciary” (approved by the Full Court in article XXVI of session no. 27-11 of 22 de agosto de 2011 and published in Judicial Bulletin no. 19 of 26 de enero de 2012) and article LXXXI of session no. 43-12 of 3 de mayo de 2012 of the Superior Council of the Judiciary.
Therefore:
The petition is granted. Efraím Zeledón Leiva, Pablo Camacho Salazar, and Maurilio Hernández Zumbado, each in his capacity as minister, vice minister of Infrastructure, and acting head of the Road Inspection and Demolitions Department, respectively, all of the Ministerio de Obras Públicas y Transportes, or whoever holds those positions, are ordered to issue the pertinent instructions and make the necessary arrangements within the scope of their respective authority so that, within a maximum period of ONE MONTH from service of notice of this judgment, a final decision is rendered on the complaint filed by the petitioner that is the subject of this proceeding, and notice thereof is provided through the means designated for that purpose. The respondent authorities are advised that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo proceeding (recurso de amparo) that must be complied with or enforced and fails to comply with or enforce it shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.
The State is ordered to pay the legal costs, damages, and losses caused by the acts underlying this ruling, the amounts of which shall be determined during enforcement of the judgment in contentious-administrative proceedings (ejecución de sentencia de lo contencioso administrativo). Considerando:
Antes de analizar el fondo del asunto debe aclararse que, a partir de la sentencia nro. 2008002545 de las 8:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– o conocer de los recursos administrativos procedentes. Precisamente, en el sub lite se plantea un supuesto de excepción, pues se está ante la supuesta dilación en resolver una denuncia por obstrucción a la vía pública que, según alega el recurrente, pone en riesgo la integridad y vida de los transeúntes. Aclarado el punto, se entra a resolver, la situación concreta planteada en este amparo.
El recurrente acusa que el 4 de setiembre de 2025 remitió por correo electrónico una denuncia por estructuras ilegales dentro de la ruta nacional 160; empero, aún no ha sido resuelta.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
Textualmente solicitando lo siguiente: 1. Realicen una inspección en los sitios denunciados para verificar la ilegalidad de las instalaciones y estructuras publicitarias colocadas en la Ruta Nacional 160, en la sección Belén (Iglesia) - Sámara. 2. Procedan con la demolición inmediata y remoción de cualquier anuncio o estructura publicitaria que haya sido colocada en este tramo sin los permisos correspondientes, en cumplimiento del Reglamento de los Derechos de Vía y Publicidad Exterior. 3. Efectúen una revisión exhaustiva en la zona para garantizar que se cumpla con las disposiciones de seguridad vial y protección de los bienes demaniales. 4. Emprendan las acciones legales pertinentes contra quienes hayan incumplido las disposiciones legales, ocupando indebidamente terrenos de derecho de vía y afectando la seguridad y orden público. 5. Realicen acciones de coordinación con la Municipalidad de Nicoya.
Página 1 de 13 Segundo: Es manifiesto que este Ministerio tiene pleno conocimiento de la existencia de estas ocupaciones ilegales, y pese a ello, no ha actuado diligentemente para garantizar la integridad de los bienes públicos, la seguridad vial y el orden público ambiental, incumpliendo con sus deberes constitucionales, legales y reglamentarios. La ocupación ilegal de estos espacios públicos afecta directamente la seguridad de los peatones y conductores, al obstaculizar la visibilidad y entorpecer la adecuada circulación en la vía pública y representa un uso indebido de los bienes públicos en detrimento del interés general, con lo cual se vulneran derechos fundamentales de rango constitucional, como el derecho a la vida, la integridad física, el ambiente sano y la seguridad vial. Esta situación representa un uso indebido de bienes de dominio público, cuyo destino natural es el uso común y libre, en beneficio de toda la colectividad.
Al permitir o tolerar dichas ocupaciones, se configura una afectación al interés general y una violación de derechos fundamentales consagrados en la Constitución Política, tales como el derecho a la vida y a la integridad física. Tercero: Mediante una nota de fecha 7 de julio de 2025, este Ministerio efectivamente negó dar atención efectiva a la denuncia de la señora Pochet Reyes, basándose en criterios irracionales y violatorios de mis derechos fundamentales, desconociendo así las obligaciones constitucionales y legales que les competen. En dicha comunicación manifiesta haber realizado intervenciones limitadas para retirar ciertas estructuras publicitarias pequeñas en la Ruta Nacional N°160, - pero se evidencia que no se procedió a la remoción total de las estructuras instaladas ilegalmente, dejando intactos los elementos más grandes y visibles que continúan afectando el derecho de vía y la seguridad vial.
(…) Lo anterior demuestra una evidente omisión en el cumplimiento de su deber legal de tutela y protección de los bienes de dominio público y de los derechos fundamentales involucrados. Más aún, en la referida comunicación reconoce la persistencia de estas ocupaciones ilegales vulnera gravemente derechos fundamentales tales como el derecho a la vida, la integridad física, un ambiente sano y la seguridad vial, comprometiendo además el interés general y el bienestar de la comunidad, manifestando lo siguiente: “ (…) Es entendible para ustedes como comunidad que se encuentren preocupados, por la situación, sin embargo en aras de mejorar y en busca de soluciones y alternativas que sumen algún impacto más significativo en esta grave problemática hemos tenido acercamiento con Asociaciones de Desarrollo y Municipalidades, para que en conjunto se puedan realizar esfuerzos que mitiguen o aplaquen un poco este tema.
Aunado a esto se trata de hacer conciencia en el comercio y empresarios de la zona de que la publicidad en el derecho de vía es absolutamente ILEGAL y que no se debe pautar ni pagar dinero alguno que incentive este tipo de negocio irregular y que daña no solo lo el (sic) ambiente natural de la zona, sino que puede llegar a representar un peligro para peatones y conductores (…)” (La negrita no forma parte del texto original.) Sin embargo, este Ministerio no han adoptado acciones correctivas, preventivas ni restaurativas para recuperar los bienes de dominio público, ni para garantizar la protección efectiva de los derechos fundamentales comprometidos, tales como la vida, la integridad física, la seguridad vial y el ambiente sano. Tampoco ha dado respuesta efectiva a la denuncia presentada por la señora Pochet Reyes y han incurrido en una inacción prolongada que evidencia una omisión grave.
El paso del tiempo sin resultados concretos configura una vulneración real y sostenida de derechos fundamentales y del interés público (…) PRETENSIONES 1. Realicen una inspección en los sitios denunciados en fecha 28 de noviembre del año 2024, -hace 280 días-, para verificar la ilegalidad de las instalaciones y estructuras publicitarias colocadas en la Ruta Nacional 160, en la sección Belén (Iglesia). Asimismo solicito que me aporte una copia de esta inspección e informe. 2. Procedan con la demolición inmediata y remoción de cualquier anuncio o estructura publicitaria que haya sido colocada en este tramo sin los permisos correspondientes, en cumplimiento del Reglamento de los Derechos de Vía y Publicidad Exterior. En caso de que no procede con lo solicitada, que se me indique de manera expresa y debidamente fundamentada la justificación legal que respalde dicha negativa. 3. Efectúen una revisión exhaustiva en la zona sobre la Ruta Nacional 160 - desde La Bomba de Sámara hasta Playa Sámara -, para garantizar que se cumpla con las disposiciones de seguridad vial y protección de los bienes demaniales y que me aporte una copia de esta inspección e informe. 4.
Emprendan las acciones legales pertinentes contra quienes hayan incumplido las disposiciones legales, ocupando indebidamente terrenos de derecho de vía y afectando la seguridad y orden público. En caso de que no procede con lo solicitada, que se me indique de manera expresa y debidamente fundamentada la justificación legal que respalde dicha negativa. 5. Realicen acciones de coordinación con la Municipalidad de Nicoya en cumplimiento del principio de coordinación interinstitucional”. A tal denuncia se le asignó el nro. De referencia 8186. (Ver prueba documental).
En el sub lite, el recurrente acusa que el 4 de setiembre de 2025 remitió por correo electrónico una denuncia por estructuras ilegales dentro de la ruta nacional 160; empero, aún no ha sido resuelta.
De los autos se desprende que, el 4 de setiembre de 2025, el accionante remitió un correo electrónico a la cuenta [email protected]. En tal correo adjuntó un documento en el que indicó: “Primero: El (sic) fecha 28 de noviembre del año 2024, la señora Tatiana Pochet Reyes, presentó formalmente denuncia ante este Ministerio en defensa de los bienes de dominio público, la integridad del derecho de vía y la seguridad vial, en estricto apego a los artículos 20 y 50 de la Constitución Política de la República de Costa Rica, la Ley General de Caminos Públicos, el Reglamento de los Derechos de Vía y Publicidad Exterior, y demás normativa aplicable. En dicha denuncia se solicitó la inspección del sitio - el cual consiste de un tramo corto de la Ruta Nacional-, la demolición de estructuras irregulares y la adopción de las acciones administrativas pertinentes, así como la notificación al denunciante sobre el desarrollo de las actuaciones.
Textualmente solicitando lo siguiente: 1. Realicen una inspección en los sitios denunciados para verificar la ilegalidad de las instalaciones y estructuras publicitarias colocadas en la Ruta Nacional 160, en la sección Belén (Iglesia) - Sámara. 2. Procedan con la demolición inmediata y remoción de cualquier anuncio o estructura publicitaria que haya sido colocada en este tramo sin los permisos correspondientes, en cumplimiento del Reglamento de los Derechos de Vía y Publicidad Exterior. 3. Efectúen una revisión exhaustiva en la zona para garantizar que se cumpla con las disposiciones de seguridad vial y protección de los bienes demaniales. 4. Emprendan las acciones legales pertinentes contra quienes hayan incumplido las disposiciones legales, ocupando indebidamente terrenos de derecho de vía y afectando la seguridad y orden público. 5. Realicen acciones de coordinación con la Municipalidad de Nicoya.

La ocupación ilegal de estos espacios públicos afecta directamente la seguridad de los peatones y conductores, al obstaculizar la visibilidad y entorpecer la adecuada circulación en la vía pública y representa un uso indebido de los bienes públicos en detrimento del interés general, con lo cual se vulneran derechos fundamentales de rango constitucional, como el derecho a la vida, la integridad física, el ambiente sano y la seguridad vial. Esta situación representa un uso indebido de bienes de dominio público, cuyo destino natural es el uso común y libre, en beneficio de toda la colectividad.
Al permitir o tolerar dichas ocupaciones, se configura una afectación al interés general y una violación de derechos fundamentales consagrados en la Constitución Política, tales como el derecho a la vida y a la integridad física. Tercero: Mediante una nota de fecha 7 de julio de 2025, este Ministerio efectivamente negó dar atención efectiva a la denuncia de la señora Pochet Reyes, basándose en criterios irracionales y violatorios de mis derechos fundamentales, desconociendo así las obligaciones constitucionales y legales que les competen. En dicha comunicación manifiesta haber realizado intervenciones limitadas para retirar ciertas estructuras publicitarias pequeñas en la Ruta Nacional N°160, - pero se evidencia que no se procedió a la remoción total de las estructuras instaladas ilegalmente, dejando intactos los elementos más grandes y visibles que continúan afectando el derecho de vía y la seguridad vial.
(…) Lo anterior demuestra una evidente omisión en el cumplimiento de su deber legal de tutela y protección de los bienes de dominio público y de los derechos fundamentales involucrados. Más aún, en la referida comunicación reconoce la persistencia de estas ocupaciones ilegales vulnera gravemente derechos fundamentales tales como el derecho a la vida, la integridad física, un ambiente sano y la seguridad vial, comprometiendo además el interés general y el bienestar de la comunidad, manifestando lo siguiente: “ (…) Es entendible para ustedes como comunidad que se encuentren preocupados, por la situación, sin embargo en aras de mejorar y en busca de soluciones y alternativas que sumen algún impacto más significativo en esta grave problemática hemos tenido acercamiento con Asociaciones de Desarrollo y Municipalidades, para que en conjunto se puedan realizar esfuerzos que mitiguen o aplaquen un poco este tema.
Aunado a esto se trata de hacer conciencia en el comercio y empresarios de la zona de que la publicidad en el derecho de vía es absolutamente ILEGAL y que no se debe pautar ni pagar dinero alguno que incentive este tipo de negocio irregular y que daña no solo lo el (sic) ambiente natural de la zona, sino que puede llegar a representar un peligro para peatones y conductores (…)” (La negrita no forma parte del texto original.) Sin embargo, este Ministerio no han adoptado acciones correctivas, preventivas ni restaurativas para recuperar los bienes de dominio público, ni para garantizar la protección efectiva de los derechos fundamentales comprometidos, tales como la vida, la integridad física, la seguridad vial y el ambiente sano. Tampoco ha dado respuesta efectiva a la denuncia presentada por la señora Pochet Reyes y han incurrido en una inacción prolongada que evidencia una omisión grave.

En caso de que no procede con lo solicitada, que se me indique de manera expresa y debidamente fundamentada la justificación legal que respalde dicha negativa. 3. Efectúen una revisión exhaustiva en la zona sobre la Ruta Nacional 160 - desde La Bomba de Sámara hasta Playa Sámara -, para garantizar que se cumpla con las disposiciones de seguridad vial y protección de los bienes demaniales y que me aporte una copia de esta inspección e informe. 4.
Emprendan las acciones legales pertinentes contra quienes hayan incumplido las disposiciones legales, ocupando indebidamente terrenos de derecho de vía y afectando la seguridad y orden público. En caso de que no procede con lo solicitada, que se me indique de manera expresa y debidamente fundamentada la justificación legal que respalde dicha negativa. 5. Realicen acciones de coordinación con la Municipalidad de Nicoya en cumplimiento del principio de coordinación interinstitucional”. A tal denuncia se le asignó el nro. De referencia 8186. El correo electrónico [email protected] constituye un mecanismo oficial para plantear gestiones ante la autoridad recurrida.
Además, si bien los recurridos indicaron a la Sala que “Por otra parte la denuncia ingresada mediante correo electrónico por medio de la dirección de correo electrónico [email protected], con fecha del 4 de septiembre del año en cuso, fue respondida como se puede verificar en el archivo adjunto denominado correos” y además indican que se programó un operativo en la ruta en cuestión para marzo de 2026, no menos cierto es que no consta elemento alguno que permita a esta Sala acreditar que, en efecto, la gestión objeto de este recurso ya haya sido resuelta ni que al recurrente se le notificara alguna respuesta formal a su denuncia, lo que se traduce en una flagrante violación al numeral 41 constitucional. De ahí que proceda acoger el recurso en lo que a este extremo atañe.
He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia.
Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008- 02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.
Se previene a las partes que, de haber aportado algún documento en papel u objetos o pruebas contenidos en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados en un plazo máximo de 30 días hábiles, contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo material que no sea recogido dentro de ese lapso, con base en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial" (aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 de 22 de agosto de 2011 y publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012) y en el artículo LXXXI de la sesión del Consejo Superior del Poder Judicial nro. 43-12 de 3 de mayo de 2012.
Por tanto:
Se declara con lugar el recurso. Se les ordena a Efraím Zeledón Leiva, Pablo Camacho Salazar y Maurilio Hernández Zumbado, cada uno en su condición de ministro, viceministro de Infraestructura y jefe a.i. del Departamento de Inspección Vial y Demoliciones, todos del Ministerio de Obras Públicas y Transportes, o a quienes ocupen esos cargos, que giren las órdenes pertinentes y dispongan lo necesario dentro del ámbito de sus competencias respectivas, para que, en el plazo máximo de UN MES, contado a partir de la notificación de esta sentencia, resuelva en definitiva la denuncia formulada por la parte recurrente que es objeto de este recurso y le notifique lo correspondiente al medio señalado para ese fin. Se advierte a las autoridades recurridas que, de conformidad con el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a la presente declaratoria, los cuales se liquidarán en ejecución de sentencia de lo contencioso administrativo. El magistrado Castillo Víquez pone nota. Notifíquese.
