SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine twenty in the morning on January thirtieth, two thousand twenty-six.

Amparo proceeding (recurso de amparo) being processed under expediente número 25-039249-0007-CO, filed by [Nombre 001], identity card [Valor 001], and [Nombre 002], identity card [Valor 002], against the ASOCIACION ADMINISTRADORA DEL ACUEDUCTO -ASADA- RURAL DE CACAO DE NANDAYURE and the AUTORIDAD REGULADORA DE LOS SERVICIOS PÚBLICOS -ARESEP-.

Findings:

  1. 1By a written submission filed with this Chamber at 13:57 on December 16, 2025, the petitioners filed an amparo proceeding against the Asada Rural de Cacao de Nandayure and ARESEP. They state that on December 30, 2023, they sent their first formal request to the ASADA de Cacao de Nandayure by email to its official address for requests and proceedings, [email protected], seeking replacement of the pipeline network in Barrio "El Sur" because the infrastructure was more than thirty years old, a situation acknowledged by ARESEP. They state that they warned that the network could collapse at any time, causing a complete interruption of the drinking-water service; nevertheless, they report that, in response to that request, the ASADA stated that it would take five years to replace it, a period they considered unreasonable. They add that on June 5, 2024, the Instituto Costarricense de Acueductos y Alcantarillados (ICAA) issued official letter GSD-UEN-GAR-2024-02344, in which it recommended that the ASADA prepare a work plan to replace the network with 100 mm piping and valves and ordered it not to grant any new water-availability approvals (disponibilidades de agua) until those improvements had been completed.Consequently, on December 6, 2024, they filed a complaint with ARESEP, which resulted in Informe IN 0028-IA-2025, issued on February 13, 2025, in which the regulatory authority confirmed the age of the network, the need to replace it, and the ASADA’s obligation to implement a technical plan prioritizing Barrio "El Sur". They further state that on July 7, 2025, and October 5, 2025, they sent two additional requests to the email address [email protected], belonging to the respondent ASADA, requesting copies of the technical report, work plan, and implementation schedule for replacing the network in accordance with the directives of ICAA and ARESEP. In response, the ASADA merely stated in general terms that the matter “is under review,” without providing specific information or establishing deadlines. They indicate that almost two years have elapsed since that request, yet no section of the network has been replaced and they have received no response concerning their requests. They believe that their fundamental rights have been violated and therefore request that this amparo proceeding be granted and that the appropriate relief under the law be ordered.
  2. 2By order issued at 09:38 on December 22, 2025, the Presidency of the Chamber admitted this constitutional proceeding and requested reports concerning the facts alleged by the petitioners from the executive president and the director of the Región de Chorotega, both of ICAA, as well as from the general regulator of ARESEP.
  3. 3In a written submission added to the digital case file at 09:38 on December 22, 2025, Lourdes María Sáurez Barboza, Jenner Castrillo Ramírez, and Liany Alfaro García, under oath and in their respective capacities as executive president, head of the Región de Chorotega, and head of the Oficina Regional de Atención de Asadas Chorotega, all of ICAA, report as follows:

“Preliminary clarification: The cited decision states that the report must be submitted by the Director of the Chorotega Region; however, the water-supply system that is the subject of the amparo proceeding (recurso de amparo) is administered by the Asada de Cacao de Nandayure under a delegation from AyA. That system is not operated by AyA through the Chorotega Region. Nevertheless, in compliance with the Chamber’s order, the report is signed by the Acting Director of the Chorotega Region and is also submitted by the Head of the Office for Assistance to Asadas of the Chorotega Region, part of the Rural Water-Supply Management UEN, in accordance with the internal allocation of functions within AyA. FACTS FIRST: This is a fact pertaining to the petitioners and the Asada. SECOND: Denied as inaccurate. Although it is true that ARESEP and AyA technically determined that the Asada was required to take the appropriate steps to develop an improvement project for the replacement of pipes, in accordance with the priorities and needs of the water-supply system delegated to the Asada de Cacao de Nandayure, the petitioner does not demonstrate that there has been any impairment of the potable-water supply or any failure to provide that service in accordance with its governing principles, such as quantity and quality.

Instead, the petitioner alleges a future and uncertain event without technical support. In this regard, it must be taken into consideration that improvement, expansion, and modernization projects for water-supply systems administered by Asadas must comply with the applicable procurement procedures and that such projects must be included in the Asadas’ investment plans and budgets, with priorities established for their preparation and implementation. In addition, such projects must be approved by AyA pursuant to Article 45 of the Reglamento de Asadas, Decreto Ejecutivo N° 42582-S MINAE. It should also be noted that the Asadas’ investment plans strengthen the preventive implementation of projects in water-supply systems, and the timeframe established for carrying them out is defined according to technical criteria concerning their complexity, taking into account the budgets and priorities of the water-supply systems, as stated above.

Therefore, the petitioner’s assertion that his right of access to potable water is being violated because an improvement project for the replacement of pipes is being prepared and could take five years is untrue because, as stated, the continuity and quality of the service have not been affected, as explained in the technical report submitted in response to this proceeding and issued through official letter GSD-UEN-GAR-2026-00026. THIRD: Denied as uncertain. As with the second fact, the recommendation is indeed that water-supply system operators ensure that a pipe-replacement plan is in place; however, there are no technical criteria indicating that the water distributed by the ASADA in the sector or throughout the water-supply system is unfit for human consumption. Therefore, the right to health has not been violated, and the petitioner’s assertion concerns an uncertain event. Evidence of the foregoing is provided by the laboratory analyses of the quality of the water supplied by the Asada (see annex 2 to report GSD-UEN-GAR-2026-00026).

FOURTH: This is untrue. The aforementioned technical report states: “At present, the ASADA continuously distributes water throughout the water-supply system and in the southern sector. The petitioners proceed from the premise that the proposed pipe replacement constitutes a concrete violation of the right to life; however, the service is being provided in accordance with the Reglamento de Prestación de Servicios del AyA and the principles governing public services, in terms of both quality and quantity. The pipe replacement is part of the work plan that the ASADA administration must implement to guarantee the future provision of services and prevent conflicts that could jeopardize service delivery. This is demonstrated by the quality analyses contained in annex 2, and the reports cited by the petitioners and prepared by AyA state that the pressure complies with the aforementioned regulations.” In alleging this fact, the petitioner continues to speculate and assume that the rights of access to potable water, health, and life have been impaired.

Nevertheless, as explained in connection with facts two and three, this assertion concerns an uncertain event lacking technical support because the need to make improvements to the water-supply system—as is the case with all water-supply systems nationwide and as part of the operation, maintenance, and development of such systems—does not entail a violation of constitutional rights. FIFTH: Denied as inaccurate. The report submitted in response to this proceeding states the following regarding memorandum GSD-UEN-GAR-2024-02344 issued by ORAC Chorotega: “The ASADA was indeed advised to replace the pipes through official letter GSD-UEN-GAR-2024-02344. However, this statement omits the fact that the petitioners filed amparo proceeding N° 24-019675-0007-CO, in which they asserted that a fire hydrant was needed in the sector. The decision upheld that proceeding and required the ASADA to install the fire hydrant within one year.

This required logistical and budgetary changes to install that fire hydrant, which was successfully installed before the deadline, without any technical studies having been conducted to prioritize the needs of the entire system rather than those of only one sector. Therefore, this fact is partially denied because it is presented without the context that the ASADA had to address. Furthermore, although the recommendation does exist, it is considered appropriate to apply Article 44 of the Reglamento de ASADAS, which requires a technical study allowing for a comprehensive analysis of the entire ASADA system so that the improvements to be implemented can be prioritized according to the water-supply system’s financial capacity.” As may be seen, and as explained above, investment plans and budgets are prepared in accordance with established needs and priorities. In this specific case, the Asada must not only implement the pipe-replacement project, but must also fulfill, as one of its priority projects, the Honorable Constitutional Chamber’s order to install a fire hydrant in the area.

Accordingly, as explained in the cited technical report, the Asada is required to conduct a comprehensive technical study (estudio técnico integral) so that it has technical criteria regarding the needs and priorities for improvement projects involving the water-supply system delegated to it. SIXTH: Admitted with corrections. The technical report submitted in response to this proceeding states: “The report and the excerpts selected for this fact reinforce the notion that every improvement must be carried out in accordance with the necessary technical parameters. Although the matter concerns the southern sector of the water-supply system, we cannot disregard the fact that the system must be considered comprehensively and not solely by sector. Therefore, before an improvement is undertaken in the sector, a technical study of the entire system is required, and the results of that technical study must then be used to prioritize what must be addressed first for the entire population served by the Cacao water-supply system.” In this regard, it should be noted that, although AyA and ARESEP have issued recommendations for improvements to the Asada’s network in the southern sector, the project to be implemented for that purpose must be supported by a technical study that makes it possible to determine with certainty which improvement works must be carried out, in compliance with the applicable procedures, as stated in connection with the second fact.

SEVENTH: We have no knowledge of this. EIGHTH: This is a fact pertaining to the petitioners and the Asada. We have no knowledge of the steps taken. As the Honorable Constitutional Chamber can verify, the Instituto Costarricense de Acueductos y Alcantarillados has not violated any constitutional right of the petitioners because it has acted in compliance with its powers, issuing the relevant recommendations to the Asada and providing appropriate guidance so that the delegated operator may prepare and implement an improvement project to replace the pipes in question. That project must be carried out on the basis of a technical report that determines with certainty which improvement works must be undertaken, in compliance with the applicable procurement procedures, investment plans, and budget, and in accordance with the precautionary principle (principio precautorio). None of this has led to a determination that the service operator acting under delegation from AyA has failed to provide potable water in accordance with the governing principles, such as quantity, continuity, and quality.

Rather, the Asada must develop the project according to the priorities established pursuant to the Comprehensive Technical Study that it must conduct in compliance with Article 44 of the Reglamento de Asadas. In this specific case, the petitioners have not demonstrated the existence of any risk to health, life, or access to potable water because the Asada has supplied potable water in the area without interruption. Moreover, according to the petitioners’ own statements, the Asada informed them that the project is under analysis; therefore, there has been no inaction by the Asada. I. REGARDING FUTURE AND UNCERTAIN EVENTS In the case at issue, the petitioners refer only to future and uncertain events, and no violation of fundamental rights is apparent. In this regard, the Honorable Chamber stated the following in decision N° 06279 – 2023 of March 17, 2023: (…) “Furthermore, according to the facts recounted by the claimant herself, it follows that there is no injury or threat of real and imminent harm that the Chamber must address.

This is a future and uncertain event constituting a mere possibility that, at the time the amparo proceeding was filed, does not entail a current or imminent violation of or threat to her fundamental rights.” (…) In this specific case, according to the petitioners’ own statements, the Asada has specified a reasonable timeframe for carrying out the improvement works involving the replacement of the pipes. There has been no inaction or omission by the Asada in responding to the recommendations issued by ARESEP and AyA, nor has the service suffered any impairment or interruptions as a result of the project that the operator acting under delegation must implement. The petitioners’ allegation concerning a possible violation of fundamental rights therefore relates to a future and uncertain event.”

  1. 4In a written submission added to the digital case file at 16:56 on January 08, 2026, Eric Bogantes Cabezas, in his capacity as general regulator of ARESEP, reports under oath as follows:

“I.- RELEVANT BACKGROUND The following background is relevant to the specific case, as stated in the constitutional amparo action (recurso de amparo):

1. On December 30, 2023, Mr. [Nombre 001] sent a letter to the Asada el Cacao de Nandayure, Guanacaste, urgently requesting the modernization of the pipeline in Barrio El Sur.

2. On June 5, 2024, through memorandum GSD-UEN-GAR-2024-02344, Instituto Costarricense de Acueductos y Alcantarillados issued a report concerning the inspection visit to the Sistema de Cacao, Nandayure, Guanacaste, regarding pressure problems in Barrio del Sur.

3. On September 13, 2024, through official letter CBC-035511-2024-DGD-01183, Benemérito Cuerpo de Bomberos de Costa Rica responded to the appellant in connection with Expediente 24-019675-0007-CO—the Recurso de Amparo to which Aresep is not a party.

4. On September 27, 2024, through Resolución N°28064-2024, Sala Constitucional issued the judgment in expediente 24- 019675-0007-CO.

5. On December 6, 2024, through an email received from the account [email protected], Mr. [Nombre 001] filed a complaint expressing dissatisfaction with Aresep concerning the remediation plan proposed by ASADA de Cacao de Nandayure regarding the age of the pipeline network supplying the Barrio Sur sector.

II. REGARDING THE FACTS ALLEGED BY THE APPELLANT

The facts presented by the appellant are answered, in the manner and terms indicated, as follows:

FIRST: TRUE.

SECOND: DENIED AS INACCURATE, SUBJECT TO THE FOLLOWING CLARIFICATIONS.

First, Autoridad Reguladora had no direct knowledge of and did not participate in any way in the application submitted by the appellant to ASADA on December 30, 2023, nor is that action among the facts verified by Intendencia de Agua through report IN-0028-IA-2025 of February 13, 2025 (an action arising from the complaint that the appellant did not file until December 06, 2024).

However, according to the findings set forth in Regulatory Oversight Report (Informe de Fiscalización) IN-0028 IA-2025 of February 11, 2025, Intendencia de Agua deemed it established that the distribution network in the Barrio El Sur sector is considerably old, based on the information supplied during the regulatory oversight process (proceso de fiscalización). Nevertheless, ARESEP did not determine that there was any current, serious, or imminent adverse effect on service continuity, nor did it characterize the infrastructure as collapsed or unusable. The Report merely noted the need for technical analysis and planning of improvements within the scope of its regulatory authority.

Your Authority should bear in mind that the application submitted by the appellant on December 30, 2023, was addressed solely and exclusively to ASADA, as he himself states, as was the exchange of information between them. This Autoridad Reguladora had neither direct nor indirect involvement in that application.

ARESEP’s authority and involvement were triggered by the complaint filed by the appellant with the Institution on December 6, 2024, which gave rise to the regulatory oversight process and report IN-0028-IA-2025 of February 13, 2025.

THIRD: DENIED AS INACCURATE, SUBJECT TO THE FOLLOWING CLARIFICATIONS.

In section 5) of the conclusions of report IN-0028-IA-2025 of February 13, 2025, Intendencia de Agua stated the following:

“5. Inform Mr. Ugalde in his capacity as a user: i.(…) ii (…) iii. Based on the statements made by the account holder (abonado) and by the user, and taking into account the visit conducted by ORAC AYA (as documented in official letter GSD-UENGAR-2024 02344), it is concluded that the provision of the service complies with the minimum standards of continuity, pressure, and quality established in the regulations currently in force; iv. Although the account holder’s statement that the pipelines have been in use for a considerable period is accepted as true, ASADA, after complying with the provisions of Sala Constitucional, must, at the appropriate time, implement technical analysis and planning measures to replace the existing network line in the Barrio Sur de Cacao sector, in accordance with the statements made in official letter GSD-UEN-GAR- 2024-02344.” (underlining not in the original) It follows from the foregoing that the pipeline network has indeed been in use for a considerable period and that ASADA must, at the appropriate time, take the necessary measures to carry out the corresponding replacement.

It is also stated that, despite the considerable period during which the pipeline network has been in use, the provision of the service was found to comply with the minimum standards of continuity, pressure, and quality established in the regulations currently in force.

Accordingly, this Autoridad Reguladora issued a series of directives to both La ORAC regional Chorotega – AyA and ASADA, which were required to comply with them within 15 business days. Among those directives, the following are relevant to the subject matter of this Recurso de Amparo:

ORAC regional Chorotega – AyA was instructed to include in its work plan assistance, monitoring, and oversight to ensure that Asada, through its work proposal, complies with the mandate of Sala Constitucional, in addition to implementing the changes required by the distribution network in light of the statements made in its official letter GSD-UEN-GAR-2024-02344.

ASADA, in turn, was directed to plan, over the medium term, the changes necessary to begin upgrading the distribution network and to assess the technically appropriate improvements for the Barrio del sur sector. If ASADA receives donations of piping, it must prioritize its installation transparently, with justified accountability to the users and account holders of ASADA El Cacao.

FOURTH: DENIED AS INACCURATE, SUBJECT TO THE FOLLOWING CLARIFICATIONS.

As already stated in response to the preceding fact, report IN-0028-IA-2025 of February 13, 2025, deemed it established that the pipeline network had been in use for a considerable period and that ASADA was required, at the appropriate time, to take the necessary measures to carry out the corresponding replacement.

Furthermore, despite the considerable period during which the pipeline network has been in use, the provision of the service was found to comply with the minimum standards of continuity, pressure, and quality established in the regulations currently in force.

However, Report IN-0028-IA-2025 does not indicate that ASADA established a formal five-year period for replacing the network or that such a period was assessed or endorsed by Autoridad Reguladora.

It should be noted that any reference to time frames predating Aresep’s regulatory oversight (which arose from the complaint filed by the appellant on December 06, 2024) is not among the facts verified by this Autoridad Reguladora and has no bearing on the regulatory analysis performed.

FIFTH: DENIED BECAUSE THESE ACTIONS ARE UNRELATED TO ARESEP, SUBJECT TO THE FOLLOWING CLARIFICATIONS.

ARESEP became aware of AyA official letter GSD-UEN-GAR-2024-02344 because it was cited as background information in the regulatory oversight process conducted by this Autoridad Reguladora.

However, ARESEP neither interpreted nor characterized that official letter as an order for immediate replacement, but rather as technical input to be considered in the analysis and planning of improvements to be undertaken by the service provider. ICAA, for its part, must address the scope of and any other considerations concerning that official letter when submitting its report on this matter.

It should be noted that, as part of its conclusions, report IN-0028-IA-2025 of February 13, 2025, informed the appellant that the provision of the service complies with the minimum standards of continuity, pressure, and quality established in the regulations currently in force. It further stated that, in view of the considerable length of time the pipelines have been in use, as indicated by the appellant, ASADA, after complying with the provisions of Sala Constitucional (exp.24- 019675 0007-CO), must, at the appropriate time, implement technical analysis and planning measures to replace the existing network line in the Barrio Sur de Cacao sector, in accordance with the statements made in official letter GSD-UEN-GAR-2024-02344.

SIXTH: TRUE, SUBJECT TO THE FOLLOWING CLARIFICATIONS.

1. The network in the Barrio El Sur sector is considerably old.

2. The provider is required to conduct technical analyses to determine how the improvements should be addressed.

3. ASADA has financial resources that allow it to plan investments under the cost-of-service principle (servicio al costo).

It must be clarified, however, that ARESEP did not order the immediate performance of construction work; instead, it directed that a technically supported and duly approved work plan and schedule be prepared.

Likewise, it is incorrect to state that Report IN-0028-IA-2025 imposed an immediate and unconditional obligation on ASADA to replace the Barrio El Sur network.

The directives issued by Intendencia de Agua in the aforementioned report were limited to:

1. Submission of a work plan, 2. Medium-term planning of improvements, 3. Coordination with AyA as the governing authority, all within a gradual, technical, and auditable process in accordance with the regulations currently in force.

The foregoing is apparent from a plain reading of the referenced Report, which is attached as evidence supporting this report.

SEVENTH: TRUE.

EIGHTH: ARESEP HAS NO KNOWLEDGE OF THIS.

It should be borne in mind that the subsequent requests addressed directly by the appellant to ASADA do not fall within the scope of the direct authority of this Autoridad Reguladora, nor were they specifically assessed in the regulatory oversight process that resulted in Report IN-0028-IA-2025 following the complaint filed on December 06, 2024.

It is important to state that ARESEP’s lawful activities are limited to oversight of the service and issuance of regulatory directives, not the day-to-day management of communications between users and providers.

Accordingly, based on the facts answered above, it has been demonstrated that ARESEP’s actions have not violated any of the fundamental rights alleged by the appellant. It should also be noted that the subject matter of the proceeding neither concerns nor involves any acts or omissions by this Autoridad Reguladora.

III. REGARDING THE ACTIONS TAKEN BY ARESEP

Based on the complaint filed by the appellant on December 06, 2024, it may be stated that the complaint was addressed and, as a result, regulatory oversight report IN-0028-IA-2025 of February 13, 2025, was issued, in which ARESEP issued the following directives to Asada El Cacao de Nandayure, Guanacaste:

“(…) 2. To Asada El Cacao de Nandayure, Guanacaste.

It must address the following matters within 15 business days:

1. It must implement a work plan with a schedule approved by Junta Directiva and endorsed by ORAC regional Chorotega AyA with respect to the design and implementation of all matters related to compliance with the mandate of Sala Constitucional, in accordance with the three items required by Resolución N°28064-2024.

2. It must plan, over the medium term, the changes necessary to begin upgrading the distribution network and assess the technically appropriate improvements for the Barrio del sur sector. If ASADA receives donations of piping, it must prioritize its installation transparently, with justified accountability to the users and account holders of ASADA El Cacao.

a.

Provide the results and implementation of the ASADA’s comprehensive technical study regarding the location, installation, and technical requirements requested by Bomberos de Costa Rica. b. Provide justification for the actions and work implemented by ASADA El Cacao in connection with the installation item described in the amount of ₡ 7 592 748,95, as well as all other work performed that has received the appropriate endorsement and approval from the Board of Directors (…)” It can therefore be seen that the public utility provider (ente prestador del servicio público) was granted a period of 15 business days from notification of that Report to comply with the provisions set forth therein. This concerned the submission of a work plan or schedule to address the situation reported by the user regarding the installation of fire hydrants, followed by improvements to the aqueduct infrastructure.

It is important to note that ASADA El Cacao de Nandayure requested that Aresep grant an extension of the deadline for complying with the aforementioned provisions; accordingly, on 12 de marzo de 2025, through official letter OF-0173-IA-2025, the deadline was extended to 18 de marzo de 2025. On 7 de marzo de 2025, through official letter GG-2025-00674, AyA responded to the request made by the Intendencia in report IN-0028-IA-2025, attaching the corresponding work plan approved by the Board of Directors of ASADA Cacao de Nandayure, with the proper approval of the oficina Regional de Acueductos Comunales en la Región Chorotega. It should be emphasized that, as stated in the undated submission (which is attached) through which the ASADA responded to Aresep’s requirements, the following was indicated regarding the duty to plan the upgrading of the distribution network: “In response to this question, this ASADA has been working closely with AYA, and a meeting will therefore be held in May so that we may jointly develop this plan.” Accordingly, because the governing entity and the delegated system have complied with the request made by this Regulatory Authority and are jointly pursuing a solution to the distribution-network situation, the Intendencia de Agua, as part of the regulatory oversight (fiscalización) it conducts over various operators in the Región Chorotega and in accordance with its planning for 2026, has scheduled a field visit to the system operated by ASADA de El Cacao de Nandayure during the week of 2 al 6 de marzo del presente año.

The purpose of that visit is to verify compliance with the provisions contained in Report IN-0028-IA-2025, issued in connection with the inspection conducted the previous year, as reflected in official letter OF-0011-IA-2026, all for the purpose of verifying improvements in service quality, in the exercise of the powers conferred upon this Regulatory Authority by Ley N.° 7593 and its regulations. For purposes of this appeal (recurso), it must be borne in mind that, pursuant to artículo 5 de la Ley N°7593, ARESEP is empowered to set prices and rates for the provision of public services, including those provided by the ASADAS—water-supply service, sanitary sewerage, and the installation, operation, and maintenance of fire-hydrant service—as well as to ensure compliance with standards governing quality, quantity, reliability, continuity, timeliness, optimal provision, and other aspects of the provision of those services.

Likewise, the regulations implementing Ley N° 7593, Decreto Ejecutivo número 29732, state in artículo 3 that ARESEP may neither co-administer nor assume the functions of service providers or oversight entities whose functions are assigned by law. Accordingly, ARESEP’s actions arising from the complaint filed by the appellant on 06 de diciembre de 2024 were limited to fulfilling the mandate set forth in artículo 6 inciso a) de la Ley N° 7593, which consists of: “(...) Regulating and overseeing public-service providers in accounting, financial, and technical matters in order to verify the proper management of the factors affecting the cost of the service, including investments made, debt incurred, levels of income received, costs and expenses incurred or income received, and the profitability or profit obtained (...)” Therefore, it is incumbent upon the administration to fulfill its obligations concerning the provision of both the water-supply service and the fire-hydrant service; responsibility for doing so rests with the provider and service holder, and, in the case of the ASADAS, AYA must maintain its role as the legal entity responsible for the actions implemented by the ASADAS as entities delegated to provide the service under the legal framework of the delegation agreement (convenio de delegación).

It has thus been demonstrated in this particular case that ARESEP acted promptly, efficiently, and effectively in accordance with Ley N° 7593. Furthermore, it is clear that those actions have not impaired any fundamental right of the appellant; on the contrary, this Regulatory Authority has performed its oversight function in response to the complaint submitted by the appellant against the public utility provider.”

  1. 5By submission added to the digital case file (expediente digital) at 11:04 hours on January 20, 2026, Joseph Mauricio Duarte Sequeira, in his capacity as president and judicial and extrajudicial representative, with the authority of a general agent without limitation as to amount (apoderado generalísimo sin límite de suma), of the ASADA de Cacao de Nandayure, responded to the proceeding granted, as follows:

“FIRST: TRUE.

SECOND: UNCERTAIN. The petitioner (recurrente) does not demonstrate that there has been any impairment of the drinking-water supply or any failure to provide that service in accordance with the principles governing it, such as quantity and quality; indeed, the technical report prepared in response to this appeal, issued through official letter GSD-UEN-GAR-2026-00026, determines that the quantity and quality of the water received by residents of the sector comply with all legal requirements. The petitioner alleges a future and uncertain event without any technical basis.

The 5-year period is a considerable amount of time, taking into account all the other projects and administrative matters that the ASADA must carry out during the year; it would be dishonest and in bad faith to give the respondent (recurrido) a short-term deadline when, given the actual circumstances of the entity I represent, meeting such a deadline would not be possible.

THIRD AND FOURTH: UNCERTAIN. Once again, the petitioner alleges a future or uncertain event without any technical basis.

FIFTH: UNCERTAIN. While it is true that AYA made recommendations to the entity I represent concerning replacement of the pipeline discussed herein, it must also be taken into account that these recommendations were made with due consideration for, and in accordance with, the actual circumstances of the ASADA represented herein. To carry out any project of the magnitude described herein, the ASADA must conduct a comprehensive technical study (estudio técnico integral) to determine the priorities that the ASADA must establish for its projects and the allocation of its resources.

Once that study has been completed, the ASADA must decide which projects currently require a larger budget and are considerably more urgent to implement, without disregarding the recommendations made by AYA, as established in Articles 44 and 45 of the Reglamento de Asadas, Decreto Ejecutivo N° 42582-S-MINAE.

SIXTH: UNCERTAIN. It should be noted that portions of the recommendations made by ARESEP are selectively cited for the petitioner’s convenience, because although it is true that both AYA and ARESEP made recommendations concerning replacement of the ASADA’s pipeline in the southern sector, they also emphasized that the project to be carried out for that purpose must be supported by a technical study that makes it possible to determine with certainty which improvement works must be undertaken, in compliance with the procedures established for that purpose, including budgeting and implementation of the project in accordance with the work plan that must be approved by those same entities. SEVENTH: I HAVE NO KNOWLEDGE THEREOF.

EIGHTH: INACCURATE. At no time has the entity I represent intended to disregard the petitioner’s requests. However, the response given at the time was entirely appropriate, because the matter was undergoing both a budgetary review with our accountant and a planning review by the ASADA regarding the manner in which the project was to be implemented, as well as all other projects and needs that the ASADA must address.

We respectfully wish to make clear that, although we are obligated to account to subscribers for the ASADA’s management, we must also ensure its proper operation and safeguard against violating our subscribers’ rights. For that reason, there is no individual assigned solely to answering emails every day. Instead, emails are reviewed routinely and responses are provided.”

  1. 6By submission added to the digital case file at 20:05 hours on January 22, 2026, the petitioner refuted ARESEP’s report, as follows:

“I. REGARDING THE RECOGNITION OF THE AGE AND THE 5-YEAR PERIOD GRANTED BY ASADA CACAO In its response report, the respondent attempts to disclaim responsibility despite having express knowledge of the five-year period granted by ASADA Cacao for replacing the pipeline network (red de tuberías) in Barrio Sur, a period that was communicated without support from a technical study in Barrio Sur, in contravention of Articles 44 and 45 of the Reglamento de ASADAS. ARESEP was aware of that period, and it is expressly recorded in oversight report (informe de fiscalización) IN-0028-IA-2025, without that authority having timely exercised its regulatory powers to require a technical assessment that would guarantee effective protection of the human right to water. The foregoing is apparent from the study incorporated by ARESEP itself into its technical analysis, which describes, as part of the complaint, and ultimately establishes that the pipeline network in Barrio Sur is more than thirty years old, demonstrating its advanced age; it also acknowledges that the five-year period proposed by the ASADA is excessive and inadequate to address the urgency of the situation.

I quote below: A. Complaint by Mr. [Name 001]. The user expresses dissatisfaction with a remediation plan proposed by ASADA Cacao de Nandayure to address the apparent age of the pipeline network supplying the Barrio Sur sector of that community, which, according to him, is more than 30 years old and presents an ongoing risk of massive service leaks. Mr. Ugalde adds that the aqueduct infrastructure is obsolete and must be renewed within a shorter period than that offered in the plan (5 years, based on the remediation plan provided by the operator). Mr. [Name 001] considers that period excessive and inadequate to address the urgency of the situation. (…) This quotation demonstrates that the regulatory authority was not unaware of the problem and that the failure to take effective regulatory action allowed, and continues to allow, an ongoing risk to the fundamental rights of the users of Barrio Sur to persist.

II. REGARDING OFFICIAL LETTER GSD-UEN-GAR- 2024-02344 AND ITS INCORRECT INTERPRETATION BY ARESEP In its response report and report IN-0028-IA-2025, the respondent bases its conclusions on an interpretation of official letter GSD-UEN-GAR-2024 02344, issued by the Instituto Costarricense de Acueductos y Alcantarillados. However, that official letter merely records a measurement of service pressure at a single point in time and does not constitute a technical assessment of the Barrio Sur distribution system. Such a one-time measurement does not satisfy the technical criteria required by Articles 44 and 45 of the Reglamento de ASADAS, which establish that the actual condition of the distribution-system components may be assessed and scientifically determined only through a technical evaluation prepared by an engineering professional duly registered with the CFIA; such a study is essential for evaluating the structural condition of the network and the risks associated with its operation, particularly when it has been established that the pipeline network is considerably old.

These circumstances create an ongoing risk to the continuous and safe provision of the service; therefore, in the absence of this technical criterion, it is not legally valid to dismiss the appellant’s allegations or characterize them as inaccurate. For the time being, since this technical study does not exist, the appropriate course is to grant this application for amparo (recurso de amparo) in all respects. Accordingly, I quote below the most relevant conclusion contained in the aforementioned AyA technical input: It is recommended that the ASADA refrain from granting any additional water-availability approvals (disponibilidades de agua) in the southern sector, so as not to adversely affect the users of that sector in the medium and short term, until the distribution network has been replaced. The quotation from official letter GSD-UEN-GAR-2024-02344 demonstrates that AyA itself recognizes that the distribution network cannot support new water-availability approvals and that adding further services causes an immediate adverse impact, a situation attributable to the advanced age of the infrastructure, which directly compromises the exercise of fundamental rights associated with access to drinking water and existing services.

III. REGARDING THE FACTS ACCEPTED BY ARESEP 3 In its response report, the respondent accepts the following facts, which I quote below: 1. The network in the Barrio El Sur sector is considerably old. 2. The service provider must conduct technical analyses to determine how improvements should be addressed. 3. The ASADA has financial resources that allow it to plan investments under the service-at-cost principle (principio del servicio al costo). Recognition of the network’s advanced age and, moreover, of the risk involved in keeping Barrio Sur’s SUCH ANTIQUATED distribution system in operation demonstrates a direct threat to the fundamental right of access to drinking water, since that infrastructure is the sole means of guaranteeing supply to the entire user population of the Barrio Sur sector. The absence of a technical analysis in Barrio Sur, together with the negligent conduct of ASADA de Cacao de Nandayure, which is subject to ARESEP’s regulation and oversight, demonstrates an unjustified regulatory omission, particularly because ARESEP has regulatory and budgetary tools with which to impose non-extendable deadlines for replacing the pipeline.

Consequently, ARESEP’s failure to impose sanctions or institute administrative proceedings has allowed an ongoing risk to persist, compromising effective protection of the fundamental rights of the residents of Barrio Sur; the respondent therefore bears an enormous share of responsibility in this case. IV. 4 REGARDING OFFICIAL LETTER GSD-UEN-GAR-2025-00767 ISSUED BY AYA IN RESPONSE TO ARESEP’S DIRECTIVES In its response report, the respondent submits official letter GSD-UEN-GAR-2025 00767 issued by AyA. For purposes of this case, the most relevant portions of that document should be highlighted. In particular, AyA states the following in its conclusions: 2- In May, a meeting will be held with ASADA Cacao to implement the pipeline improvements for the southern sector and to remind the ASADA about transparency and that the actions improve the system throughout the community. The conclusion contained in official letter GSD-UEN-GAR-2025-00767, dated 4 de marzo de 2025, expressly recognizes the need to implement improvements to the Barrio Sur pipeline network in order to mitigate the risk involved in continuing to operate infrastructure of advanced and considerable age.

The conclusion was issued in marzo de 2025, with a meeting not scheduled until mayo de 2025, whereas the initial request for replacement dates from 30 de diciembre de 2023; accordingly, by 2026, the time elapsed without completing the replacement of the Barrio Sur pipeline is manifestly excessive. This recognition confirms that the situation cannot be minimized or treated as an isolated incident, but instead requires the adoption of specific corrective measures. Furthermore, the official letter itself demonstrates that the proposal entails implementing a pipeline replacement, which reinforces the need for timely and effective action. In this context, it is improper to downplay the existing risk when the legally correct course is to recognize it and apply the necessary measures against the operator. Nevertheless, ARESEP has not fully complied with its regulatory duties, allowing the required pipeline replacement to be delayed, a situation that compromises protection of the fundamental rights of the residents of Barrio Sur and limits the possibility of granting new water-availability approvals without adversely affecting existing users until the corresponding replacements are completed.”

  1. 7By a written submission added to the digital case file at 20:06 on 22 de enero de 2026, the appellant refutes the report of the respondent authorities of ICAA in the following terms:

“I. REGARDING THE RECOGNITION OF THE INFRASTRUCTURE’S AGE AND AyA’S RECOMMENDATIONS. Through Technical Report No. GSD-UEN-GAR-2026-00026, the respondent expressly acknowledges that the recommendations issued are attributable to the age of the infrastructure, admitting that the aqueduct’s distribution network (red de distribución) is excessively old, as ARESEP confirmed. Before ruling on this amparo proceeding (recurso de amparo), it is vitally important to bring to the attention of this Honorable Chamber a fact substantiated by evidence submitted by ARESEP itself, consisting of a document issued by ASADA Cacao de Nandayure in response to ARESEP’s directives. In that document, the ASADA expressly acknowledges that “(…) a section of pipeline spanning approximately 600 mts was replaced on an emergency basis because it had leakage problems and the pipes were bursting;” This fact cannot be regarded as an isolated case; rather, it constitutes a concrete manifestation of structural failures occurring within the same distribution network managed by the respondent ASADA.

This demonstrates that the respondent’s infrastructure has genuine vulnerabilities, which are addressed through emergency interventions rather than technical planning. The existence of these failures in another area near Barrio Sur reinforces the argument that there is a latent risk that could materialize at any time because of the infrastructure’s excessive age, as previously demonstrated by the authorities. In this context, only a technical study prepared by an engineering professional duly licensed by the CFIA can scientifically determine the works necessary to ensure the continuity, safety, and quality of service in Barrio Sur. For the time being, because this study does not exist, the ASADA cannot promptly carry out the required improvements; therefore, to protect the fundamental rights of Barrio Sur, the proper course is to grant this proceeding in all respects. Likewise, the current inability to grant new water-availability approvals (disponibilidades de agua) in that southern sector constitutes an additional indication of the system’s structural insufficiency, confirming that the reported problem is neither hypothetical nor prospective, but real and verifiable.

II. NONCOMPLIANCE WITH ARTICLE 44 OF THE REGLAMENTO DE ASADAS. The absence of the technical study constitutes a direct and objective violation of Article 44 of the Reglamento de las ASADAS and of fundamental rights; that article expressly and mandatorily imposes the duty to maintain an up-to-date technical study capable of determining the water-resource and hydraulic capacity (capacidad hídrica e hidráulica) of the managed system, as well as the condition of its components and infrastructure and the improvements required to protect the service. In particular, subsection c) of Article 44 provides: Scope of the Technical Study: The technical study must establish the system’s water-resource and hydraulic capacity and determine the condition of the system and its constituent components, as well as the improvements required in the production and quality of the flows available for use (caudales de aprovechamiento) from the sources and the improvements in infrastructure and operation required by the system.

The content of the Study shall be determined by the provisions issued by AyA for that purpose. This provision is clear that the technical study must determine the condition of the system’s components, infrastructure, and operation. Likewise, subsection b) of Article 44 provides as follows: Responsibility for the Technical Study: The ASADA and the responsible professional share responsibility for ensuring the proper application of the technical regulations, policies, and directives issued by AyA, which are mandatory both in conducting the study and in designing and constructing the resulting works. Likewise, subsection a) of Article 44 provides as follows: “Performance of Technical Studies: The technical studies of these systems must be performed by the ASADA with the technical support of a responsible professional duly admitted to the Professional Association for the respective field.” In this case, the complete absence of that study establishes not only the ASADA’s regulatory noncompliance but also AyA’s failure, as the governing authority, to require or ensure compliance with an essential regulatory obligation within a delegated public service.

This prolonged failure constitutes institutional negligence incompatible with the duty to provide effective protection of the fundamental right of access to drinking water. The proper course is to grant the proceeding in order to protect this right against its imminent violation, which would affect the public service and all the fundamental rights of the families living in Barrio Sur. III. AyA’S PRACTICES IN CASES OF THIS KIND. In expediente N.° 24-019675-0007-CO, filed by this same petitioner and concerning the same system managed by ASADA de Cacao de Nandayure and the same Barrio Sur sector, AyA arbitrarily maintained and argued that installing a fire hydrant was unnecessary, without any technical basis supporting that position. Nevertheless, that proceeding was granted, and during that proceeding the Benemérito Cuerpo de Bomberos de Costa Rica determined through a technical study that installing the fire hydrant was indeed necessary, demonstrating that AyA’s initial position lacked objective technical support.

This precedent is particularly relevant because it demonstrates a recurring pattern in AyA’s conduct toward this same ASADA and this same sector: dismissing or minimizing technical requirements without first obtaining the required studies, thereby shifting the consequences of that failure to the delegated operator and, ultimately, to the service users. Such practices reflect deficient supervision, oversight, and containment by AyA as the governing authority for the delegated public service, resulting in repeated failures that ultimately violate fundamental rights, particularly where essential public services such as access to drinking water are concerned. IV. REGARDING THE VIOLATION OF THE RIGHT TO HEALTH. The submitted report rejects my arguments on the basis of general water-quality control tests; however, it fails to assess the actual risk that may arise from sediment entering Barrio Sur’s distribution system.

That risk is not merely hypothetical; it has already materialized in another area near Barrio Sur, requiring an emergency intervention, as expressly stated in the ASADA operator’s own response to ARESEP. The following is taken from that response: “(…) a section of pipeline spanning approximately 600 mts was replaced on an emergency basis because it had leakage problems and the pipes were bursting;”. This precedent demonstrates that merely referring to general quality controls is insufficient to rule out a violation of the right to health when the infrastructure is at risk of failures that could compromise the potability of the water at any time, particularly in a network that is more than thirty years old. V. REGARDING AyA’S CONCLUSIONS. The report submitted by Instituto Costarricense de Acueductos y Alcantarillados contains relevant conclusions that must be assessed comprehensively by this Honorable Chamber because, far from refuting the arguments, they confirm them.

Although AyA states that the drinking-water supply service has not been interrupted in the southern sector, that assertion is insufficient to rule out a violation of or imminent threat to fundamental rights. AyA itself also acknowledges that, before replacing the pipeline, the ASADA must conduct a technical study of the Barrio Sur system and comply with Articles 44 and 45 of the Reglamento de ASADAS. This conclusion reaffirms what has been maintained since the beginning of the proceeding regarding the need for a technical and preventive assessment of the system, and it confirms that merely stating that the service is currently being provided is insufficient; instead, it is essential to establish that the infrastructure has adequate technical conditions to ensure safe and sustainable operation. As long as that technical study does not exist, the ASADA lacks a technical basis for rejecting the arguments and carrying out the structural improvements required in Barrio Sur, leaving the risk to the continuity and safety of service in Barrio Sur unresolved.

Therefore, to protect the fundamental rights of the service’s users, the proper course is to grant this proceeding in all respects and order the replacement of the infrastructure as recommended by AyA in Official Letter GSD-UEN-GAR-2024 02344”.

  1. 8Through a filing added to the digital expediente at 12:42 on January 23, 2026, the petitioner refutes the report of the respondent ASADA in the following terms:

“ON THE ADMISSIBLE ACKNOWLEDGMENT OF THE ABSENCE OF A TECHNICAL STUDY IN BARRIO SUR. The ASADA repeatedly maintains that the appellant’s allegations constitute ‘future and uncertain events’ while expressly acknowledging that, before replacing the Barrio Sur network, a comprehensive technical study (estudio técnico integral) must be conducted in the sector. This statement constitutes a direct admission that no such technical study currently exists. Consequently, it is legally contradictory for the ASADA to deny the existence of a risk when it admits that it lacks the only suitable technical instrument for ruling out that risk, thereby confirming the core claim of this amparo proceeding (amparo). II. REGARDING THE FIVE-YEAR PERIOD ASSERTED BY THE ASADA. The ASADA justifies the five-year period for replacing the network by citing budgetary and administrative constraints. Nevertheless, that period lacks technical support because it is not backed by any hydraulic, structural, or network service-life study concerning Barrio Sur, as required by Article 44 of the Reglamento de ASADAS.

Furthermore, ARESEP established that the ASADA has financial tools available to budget for the replacement of the piping. Moreover, a self-imposed deadline without technical support cannot prevail over the protection of fundamental rights or justify indefinitely prolonging the use of obsolete infrastructure that provides an essential public service. III. 2 REGARDING THE ANNUAL WORK PLAN AND BUDGET, WHICH DO NOT REPLACE THE TECHNICAL STUDY. As evidence, the ASADA submits its 2026 Annual Work Plan and its ordinary budget, documents of an administrative and financial nature that neither replace nor are equivalent to a comprehensive technical study in Barrio Sur. Neither of these instruments:  Assesses the structural condition of the Barrio Sur network,  Rules out the risk of failures occurring at any time. On the contrary, these documents confirm that replacement of the network has been postponed without a prior technical assessment (diagnóstico técnico), which further substantiates the alleged omission.

IV. REGARDING THE DIRECT BREACH OF ARTICLE 44 OF THE REGLAMENTO DE ASADAS. The ASADA’s conduct constitutes an objective breach of Article 44 of the Reglamento de ASADAS, which imposes an obligation to have an updated technical study in order to:  Determine the condition of the system’s components,  Determine its hydraulic capacity,  And identify the improvements required to protect and guarantee the service. The ASADA itself acknowledges that it has not conducted that study, which constitutes a regulatory violation that directly jeopardizes the safety and continuity of the service and whose consequences cannot be shifted to users. V. CONCLUSION. Far from refuting the amparo petition, the ASADA’s report confirms the alleged facts:  There is no technical study concerning Barrio Sur,  The network is of considerable age and has undergone very extensive use,  And its replacement has been postponed without a technical basis. This prolonged omission violates the fundamental right to drinking water by leaving the user population exposed to an unassessed structural risk.”

  1. 9The legal requirements have been observed in the proceedings conducted.

Justice Garro Vargas drafts the decision; and,

Considering:

I.Subject matter of the petition. The appellants state that, since 30 de diciembre de 2023, they have formally requested that the ASADA de Cacao de Nandayure replace the Barrio El Sur pipeline network, whose infrastructure is more than thirty years old and is at risk of collapse, a situation acknowledged by both the Instituto Costarricense de Acueductos y Alcantarillados and ARESEP. They indicate that, although ICAA recommended, through official letter GSD-UEN-GAR-2024-02344 of 5 de junio de 2024, that a work plan be prepared to replace the network and ordered that no new water-availability approvals (disponibilidades de agua) be granted, and although ARESEP confirmed, in Report IN 0028-IA-2025 of 13 de febrero de 2025, the need to carry out those improvements and prioritize the aforementioned neighborhood, the ASADA has neither prepared nor communicated a technical plan or implementation schedule. They assert that, nearly two years after the initial request, no section of the network has been replaced and no definite timeframe for intervention has been established, which they believe infringes their fundamental rights.

II.Preliminary matter. Before examining the merits of this amparo petition, it should be clarified that this Court will address only those matters with respect to which the appellant expressly states that no response has been received from the respondent authority. This follows from the party-disposition principle (principio dispositivo) governing constitutional proceedings, which prevents this Chamber from ruling on its own motion on matters that have not been alleged to have caused an infringement. Indeed, Article 8 of the Ley de la Jurisdicción Constitucional provides that proceedings are governed by the party-disposition principle, as this Chamber has reiterated in numerous rulings, including judgments N.° 2004-10021 at 08:47 on 10 de setiembre de 2004, N.° 017810-2006 at 15:32 on 12 de diciembre de 2006, N.° 2007-001147 at 14:31 on 31 de enero de 2007, N.° 2007-001610 at 09:22 on 9 de febrero de 2007, N.° 2007-001701 at 14:34 on 13 de febrero de 2007, N.° 2007-003233 at 11:35 on 9 de marzo de 2007, N.° 2007-003266 at 12:08 on 9 de marzo de 2007, N.° 2013005543 at 14:30 on 23 de abril de 2012, N.° 2021018726 at 09:15 on 20 de agosto de 2021, N.° 2021023558 at 09:30 on 19 de octubre de 2021, N.° 2022003709 at 09:30 on 11 de febrero de 2022, and N.° 2022020815 at 09:30 on 6 de setiembre de 2022.

For this reason, pursuant to the party-disposition principle, the Chamber will examine the case in light of the relief sought (pretensión) as set forth in the initiating pleading, namely: “a) Grant the amparo petition in all respects. b) Order the ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO RURAL (ASADA) DE CACAO DE NANDAYURE to replace the Barrio El Sur pipeline network by installing 100 mm (4”) piping with the corresponding valves, in accordance with the instructions issued by AyA in official letter GSD-UEN GAR-2024-02344 and reiterated by ARESEP in Report IN-0028-IA-2025; establish a reasonable period of one year for that purpose; and warn it that, should it fail to comply, criminal proceedings may be brought against it for the offense of disobedience of authority, which the law punishes by imprisonment for 15 days to one year pursuant to Article 307 of the Código Penal. c) Order the respondents to pay costs, damages, and losses.” Accordingly, this Court will confine its analysis solely to the relief transcribed above.

III.Proven facts. The following facts are deemed duly established and material to the resolution of this matter, either because they have been substantiated or because the respondent failed to address them as ordered in the initial ruling:

  • a)On 30 de diciembre de 2023, the claimant [Nombre 001] submitted a request to the ASADA de El Cacao de Nandayure for the priority modernization of the pipeline serving the Barrio El Sur sector (see the reports of the respondent authorities and the evidence submitted to the digital case file).
  • b)On 5 de junio de 2024, ICAA issued memorandum GSD-UEN-GAR-2024-02344 following an inspection visit to the Cacao de Nandayure water-supply system (sistema de acueducto) prompted by pressure problems in the Barrio El Sur sector. The report stated the following: “System update: 1. The ASADA has three storage tanks: one 40 m3 concrete tank and two 22 m3 high-density polyethylene (HDPE) tanks, for a total storage capacity of 84 m3. The tanks are located at approximately 89 meters above sea level. 2. The system’s piping has a variety of diameters. The diameters are 100 mm (4”), 50mm (2”), 25mm (1”), 38mm (11/2”), and 32mm (11/4”). During the survey, new branches that had not been mapped were found. Figure 1 presents the system map. 3. The ASADA has two wells: one legally registered with the Dirección de Aguas (without equipment), although it is awaiting a decision on registration of the flow rate for its use, and another that is operating (with equipment) but does not have a legally authorized flow rate. 4.

Because of the effects of the El Niño phenomenon, the production levels of the operating well experienced a slight decline in operating flow; therefore, the ASADA implemented rationing from 2 pm to 4 pm to mitigate the situation. Analysis of the Barrio del Sur sector: 1. One of the purposes of the visit was to inspect the system in response to a complaint by the son of a customer, which cited certain concerns regarding the ASADA’s management and the system’s operation because the service did not meet the required pressure. 2. During the inspection, the affected service location was visited to perform a pressure test. The test was conducted at 11:00 am, within the recommended hours of peak water demand, which range from 10 am to 2 pm. The test result was 35 PSI, equivalent to approximately 24 meters of water column, thereby meeting the minimum pressure required under the Reglamento para la Prestación de los Servicios del AyA. 3.

The meter was inspected to verify that it had no malfunction or leak, and it was found to be in optimal condition. 4. Because the static pressure is approximately 10 meters of water column (tank elevation of 89 m versus service elevation of 73 m), it is important to note that it meets the minimum static pressure specified in Article 9 of the Reglamento de Prestación de Servicios del AyA (RPS). Conclusions and Recommendations: 1. The ASADA has made certain improvements to its pipeline network, either by increasing the existing diameter or extending the network to new locations. 2. Regarding the affected service, it was verified that it complies with the Reglamento para la Prestación de los Servicios del AyA and exhibited no abnormalities. 3. As a recommendation, the ASADA was urged to repair certain visible leaks at various points in the network. 4. It was recommended that it prepare a Work Plan approved by the Board of Directors to equip the well that is duly registered with the Dirección de Agua, thereby remedying the Non-Feasibility status (No Factibilidad). 5.

It was recommended that it prepare a Work Plan approved by the Board of Directors to make gradual improvements to the water-supply system in different areas once the Technical Non-Feasibility status (No Factibilidad Técnica) has been resolved. 6. In the particular case of Barrio del Sur, the ASADA is advised to prepare a medium- and long-term work plan to replace the network with 100mm (4”) piping and the corresponding valves. 7. The ASADA is advised not to grant any further water-availability approvals in the El Sur sector, so as to avoid adversely affecting users in that sector in the medium and short term, until the distribution network has been modified” (see the reports of the respondent authorities and the evidence submitted to the digital case file).

  • c)On 6 de diciembre de 2024, the appellant filed a complaint of nonconformity with ARESEP concerning the age of the pipeline network supplying the Barrio El Sur sector (see the reports of the respondent authorities and the evidence submitted to the digital case file).
  • d)On 6 de diciembre de 2024, ARESEP exercised its supervisory authority (competencia fiscalizadora) in response to the complaint filed by the petitioner (see the reports of the respondent authorities and the evidence submitted to the digital case file).
  • e)On 11 de febrero de 2025, the Water Administration (Intendencia de Agua) of ARESEP issued Inspection Report (Informe de Fiscalización) IN-0028-IA-2025 as a result of the inspection process (proceso de fiscalización) concerning the water-supply system (sistema de acueducto) operated by the ASADA of El Cacao de Nandayure. That report determined as follows: III. CONCLUSIONS. 1. The complaint filed by Mr. [Nombre 001] was based on two points: i. The age of the pipeline and his rejection of 5 years as the deadline for compliance with the remediation plan (plan de remediación) provided by the operator, asserting that the ASADA prioritizes improvements to the water-supply infrastructure in other sectors while discriminating against Barrio Sur; ii. A request that the installation of fire hydrants be accompanied by an adequate pipeline network to ensure their functionality. 2. For its part, the Instituto Costarricense de Acueductos y Alcantarillados states in its official communication (oficio) GSD-UEN-GAR-2024-02344 that an inspection visit was conducted in the community.

It specifies that the Asada has three storage tanks; that the pipeline network has pipes of various diameters; and that it has two wells, one legally registered but lacking equipment and awaiting a decision on registration of its flow rate, while the other is operational and equipped but does not have a legally granted water-flow concession, a situation that should draw the attention of ORAC Región Chorotega, because wells must be legally registered for their proper use. In addition, AyA conducted pressure tests that comply with the regulations in force. It verified the meter and found it to be in optimal condition, and found that the static pressure at tank level complies with the regulations in force. AyA also recommended implementing a medium- and long-term work plan to replace the network in the described sector with 100mm (4”) pipe, together with the respective valves and fittings. 3.

The Sala Constitucional partially granted the appeal (recurso) filed by [Nombre 001] and ordered the President of the Asada, or whoever holds that office, to comply with three requirements, namely: i. ii. iii. a) Request a technical study from the Benemérito Cuerpo de Bomberos de Costa Rica within eight days, b) Implement a remedial plan addressing the issue raised by the lack of fire hydrants within two months, c) install the required fire hydrants in the Barrio El Sur de Cacao de Nandayure, Guanacaste sector, in accordance with the technical study provided by the Benemérito Cuerpo de Bomberos de Costa Rica, within one year. Those actions and compliance with them will be the priority focus of ARESEP’s follow-up in this case. 4. Regarding the field visit to both the residence of Mr. [Nombre 001] and the Asada: 5. Inform Mr. Ugalde, in his capacity as a user, of: i. ii. iii. the water-resource and hydraulic conditions that must govern the decision to increase pipe sizes in a particular sector of the network; the importance of the technical studies that must govern investment projects before technical decisions are made to improve the infrastructure of any water-supply system; Based on the statements made by the subscriber and user, and taking into account the visit conducted by ORAC AYA (documented in official communication GSD-UEN GAR-2024-02344), it is concluded that provision of the service complies with the minimum standards for continuity, pressure, and quality established by the regulations in force; iv.

Although the pipes may indeed have been in use for the considerable period described by the subscriber, the ASADA, after complying with the orders of the Sala Constitucional, must in due course undertake technical analysis and planning measures to replace the existing network line in the Barrio Sur de Cacao sector, in accordance with official communication GSD-UEN-GAR 2024-02344. v. The ASADA’s priority is to comply with the ruling of the Sala Constitucional in decision 28064-2024, according to expediente 24 019675-0007-CO. 6. The Board of Directors of ASADA El Cacao de Nandayure is instructed as follows: i. ii. iii. IV. Comply with the requirements of the ASADA technical study concerning the location, installation, and technical requirements established by Bomberos de Costa Rica, in order to ensure compliance with the Sala’s ruling; and likewise confirm that the fire-hydrant network provides 100% coverage to the subscribers receiving that service.

Ensure that all actions and all maintenance, operation, and network and infrastructure expansion work performed on the El Cacao water-supply system are duly coordinated with AyA and endorsed and approved by the Board of Directors, thereby demonstrating transparency and accountability. According to the financial information provided, it has the resources to implement a short- and medium-term work plan to address the improvements required by the water-supply system and comply with the mandate of the Sala Constitucional and the requirements established by ORAC Región Chorotega in official communication GSD-UEN-GAR-2024-02344 for the Barrio Sur de Cacao de Nandayure sector. The timing and prioritization of that implementation must be clearly justified. ORDERS (DISPOSICIONES). Based on the applicable laws and the policies empowering ARESEP to perform its functions, the following orders are issued, with regulated service providers being reminded that failure to comply with them would constitute a violation of article 33 of Ley 7593. 1.

To the Instituto Costarricense de Acueductos y Alcantarillados. It must address the following points within 15 business days: 1. ORAC regional Chorotega - AyA must include in its work plan assistance, follow-up, and oversight to ensure that, through its proposed work plan, the Asada complies with the mandate of the Sala Constitucional, as well as implementation of the changes required in the distribution network (red de distribución) in light of official communication GSD-UEN-GAR-2024-02344 for the Barrio Sur de Cacao de Nandayure sector. 2. Verify that all work undertaken by ASADA El Cacao de Nandayure concerning improvements to be implemented in the networks of the water-supply system it operates reflects transparency and accountability and takes into account the needs of all sectors of the system (including the Barrio Sur de Cacao sector). 2. To Asada El Cacao de Nandayure, Guanacaste.

It must address the following points within 15 business days: 1. It must implement a work plan with a schedule approved by the Board of Directors and endorsed by ORAC regional Chorotega AyA regarding the design and implementation of all measures related to compliance with the mandate of the Sala Constitucional, pursuant to the three requirements set forth in Decision N°28064-2024. 2. It must plan, over the medium term, the changes necessary to begin upgrading the distribution network and assess the technically appropriate improvements for the Barrio del sur sector. If the ASADA receives donations of pipe, it must prioritize their installation transparently, with justified accountability to the users and subscribers of ASADA El Cacao. a. Provide the results and implementation details of the ASADA’s comprehensive technical study concerning the location, installation, and technical requirements requested by Bomberos de Costa Rica. b. Provide justification for the actions and work performed by ASADA El Cacao under the installation line item described in the amount of ₡ 7 592 748,95, as well as for all other work performed, with the proper endorsement and approval of the Board of Directors. 3.

Provide the outstanding information concerning: a. The ASADA technical study concerning the location, installation, and technical requirements requested by Bomberos de Costa Rica. b. Justification for the actions and work performed by ASADA El Cacao with the proper endorsement and approval of the Board of Directors” (see the reports of the respondent authorities and the evidence submitted to the digital case file).

  • f)On 13 de febrero de 2025, the Intendencia de Agua of the Autoridad Reguladora de los Servicios Públicos deemed it established that the distribution network in the Barrio El Sur sector is considerably old, determined that the water-supply service provided in that sector complies with the minimum standards for continuity, pressure, and quality established in the regulations in force, found no evidence of a current, serious, or imminent impairment of the continuity of the drinking-water service, and did not classify the water-supply system’s infrastructure as collapsed or unusable (see the reports of the respondent authorities and the evidence submitted to the digital case file).
  • g)On 13 de febrero de 2025, the Autoridad Reguladora de los Servicios Públicos ordered the ASADA to plan a medium-term upgrade of the distribution network in the Barrio El Sur sector (see the reports of the respondent authorities and the evidence submitted to the digital case file).
  • h)On 13 de febrero de 2025, the Autoridad Reguladora de los Servicios Públicos neither endorsed nor verified the existence of a formal five-year period for replacing the pipeline network in the Barrio El Sur sector (see the reports of the respondent authorities and the evidence submitted to the digital case file).
  • i)On 7 de marzo de 2025, ICAA forwarded to ARESEP the work plan approved by the Board of Directors of the ASADA of El Cacao de Nandayure, with the endorsement of the Oficina Regional de Acueductos Comunales de la Región Chorotega (see the reports of the respondent authorities and the evidence submitted to the digital case file).
  • j)The Intendencia de Agua of ARESEP scheduled a field visit for the week of 02 al 06 de marzo de 2026 to the water-supply system operated by the ASADA of El Cacao de Nandayure to verify compliance with the orders in Report IN-0028-IA-2025 (see the reports of the respondent authorities and the evidence submitted to the digital case file).
  • k)On 10 de diciembre de 2025, ICAA, through the Environmental Water-Quality Analysis Report (reporte de Análisis Ambiental sobre la Calidad del Agua), established that the water-supply system operated by the Asada de Cacao de Nandayure provides drinking water continuously and with quality parameters suitable for human consumption, with no verified impairment of the quantity, continuity, or quality of the service (see the reports of the respondent authorities and the evidence submitted to the digital case file).

IV.Analysis on the Merits (Análisis por el fondo). The appellants state that, since 30 de diciembre de 2023, they have formally requested that the ASADA de Cacao de Nandayure replace the pipeline network in Barrio El Sur, whose infrastructure is more than thirty years old and at risk of collapse, a situation acknowledged by both the Instituto Costarricense de Acueductos y Alcantarillados and ARESEP. They state that, although ICAA, through official communication GSD-UEN-GAR-2024-02344 of 5 de junio de 2024, recommended preparing a work plan to replace the network and ordered that no new water-availability approvals (disponibilidades de agua) be granted, and although ARESEP, in Report IN 0028-IA-2025 of 13 de febrero de 2025, confirmed the need to carry out those improvements and prioritize the aforementioned neighborhood, the ASADA has neither prepared nor communicated a technical plan or an implementation schedule. They assert that, nearly two years after the initial request, no section of the network has been replaced and no definite timeframe for intervention has been established, which they contend violates their fundamental rights.

In this regard, it bears recalling that this Chamber has developed a clear and consistent line of case law concerning the fundamental right of access to drinking water (agua potable), as an indispensable prerequisite for the effective enjoyment of the rights to life and health, as well as for the proper operation of essential public services. Likewise, this Court has repeatedly held that access to drinking water constitutes a minimum and indispensable condition for guaranteeing individuals an adequate physical, psychological, and environmental balance, recognizing that the supply of water fit for human consumption forms part of the constitutionally protected content of the rights to life and health. Thus, by way of example, in judgment n.°2025-008608 at 09:30 hours on 21 de marzo de 2025, the following was held, insofar as relevant:

IV.On the right to consume drinking water. This Constitutional Court has recognized in its case law that the rights to life and health are fundamental rights whose enjoyment requires access to drinking water. For human beings to enjoy good health, they must be guaranteed a set of minimum conditions necessary to attain an adequate and harmonious psychological, physical, and environmental balance, as well as to prevent the emergence of dysfunctions that impair their full growth and development. One such condition is precisely the supply of water fit for human consumption. Accordingly, this Chamber has concluded that, as part of Constitutional Law (Derecho de la Constitución), there is a fundamental right to the supply of drinking water. Thus, in Judgment N° 2003-04654, at 15:44 hours on 27 de mayo del 2003, reiterated in N° 2018-014649, at 9:20 hours on 7 de setiembre de 2018, this Chamber held: “(…) The Chamber recognizes, as part of Constitutional Law, a fundamental right to drinking water, derived from the fundamental rights to health, life, a healthy environment, food, and decent housing, among others, as has also been recognized in international human-rights instruments applicable in Costa Rica: it is expressly set forth in the Convention on the Elimination of All Forms of Discrimination against Women (art. 14) and the Convention on the Rights of the Child (art. 24); it is also stated in the International Conference on Population and Development in Cairo (principle 2), and declared in numerous other instruments of International Humanitarian Law.

Within our Inter-American Human Rights System, the country is particularly bound in this area by the provisions of article 11.1 of the Additional Protocol to the American Convention on Human Rights in the Area of Economic, Social and Cultural Rights ("Protocol of San Salvador" of 1988), which provides: "Article 11. Right to a healthy environment 1. Everyone shall have the right to live in a healthy environment and to have access to basic public services." Furthermore, the UN Committee on Economic, Social and Cultural Rights recently reiterated that access to water is a human right that, in addition to being essential for leading a healthy life, is a prerequisite for the realization of all other human rights.”

V.Prior proceedings before this Court. Before analyzing the present matter, it is important to note that this Constitutional Chamber has already examined the conditions of the water service provided by the Esterillos water-supply system (acueducto). Thus, in 2018-021434 at 09:20 hours on 21 de diciembre de 2018, issued in expediente no. 18-018889-0007-CO, the following was established:

“IV.- On the specific case. In the present case, the evidence submitted to the case file, together with the statements made under oath by the authorities of the respondent Institute, establishes that there has been an unlawful threat to the protected party’s (persona amparada) right to health and to that of the other members of the Esterillos community, as well as a violation of her right to the proper operation of public services and to access to drinking water. The record shows that the Instituto Costarricense de Acueductos y Alcantarillados is the entity responsible for providing drinking-water service to the affected community and that, to date, it has been unable to resolve the problem that arose. Moreover, since 22 de diciembre de 2016, the date on which it assumed responsibility for the water-supply system, the respondent Institute has conducted various studies to identify a solution to the iron and manganese concentrations in the Esterillos-Bejuco system, which cause the water to appear dark.

According to the Head of the Institute’s Laboratorio Nacional de Aguas, ‘....the combined concentrations of Iron and Manganese do not comply with the Reglamento para la Calidad del Agua Potable 38924-8, which affects the water’s aesthetic characteristics and causes visual rejection by users of the water-supply system. Nevertheless, it is important to clarify that consuming the water does not cause any harm to Health.’ Therefore, although the water being distributed is not harmful to health, it nevertheless does not comply with the Reglamento para Calidad de Agua Potable. Accordingly, two years have elapsed and the respondent Institute has been unable either to resolve the problem with the water-supply system or to present the necessary corrective measures to guarantee its proper operation, despite the fact that the tests issued by the Laboratorio Nacional de Aguas are conclusive in this regard.

Accordingly, the appellant is correct regarding the quality of the water supplied to her by the respondent authority. In view of the foregoing, the AyA authorities have failed to fulfill their constitutional duty to guarantee the health of the inhabitants of that community and the proper operation of public services. These constitutional principles must be observed and respected at all times and without exception by the public officials responsible for managing and providing those services, and they constitute a non-waivable legal obligation imposed on every administrative entity or body by virtue of their direct and immediate normative effect, given that the body or standard of legality (bloque o parámetro de legalidad) (artículo 11, de la Constitución Política) with which their actions must comply includes, among other elements, the general principles of administrative law (artículo 6, de la Ley General de la Administración Pública).

In light of the foregoing, due to the prolonged violation of the fundamental right to drinking water and to efficient public service, the appropriate course is to grant the constitutional appeal (recurso) and, consequently, order the respondent Institute to implement the corresponding improvements to the water-supply system that it manages and that supplies the various communities of Esterillos, and to comply with the requirements of the Reglamento de Control de Calidad de Agua. This includes taking the necessary measures to reduce the degree of risk to public health and the vulnerability of the systems, as well as continuously monitoring the quality of the drinking water consumed by the inhabitants of the affected community. To that end, the respondent Institute must also perform the work required by that water-supply system to guarantee the quality of the water resource (recurso hídrico) and its maintenance.

The respondent is also reminded that, whenever the reported problem arises, it must ensure the distribution of drinking water by tanker trucks in the area.” (Emphasis and underlining not in the original).

In the present matter, the appellant contends that the age of the pipeline network in the Barrio El Sur sector of the water-supply system managed by the ASADA de Cacao de Nandayure constitutes, in itself, a violation of her fundamental rights of access to drinking water, health, and life, because she believes that the infrastructure poses a risk of collapse that the competent authorities have not addressed in a timely manner. However, a careful, comprehensive, and technically grounded examination of the evidence entered into the case file leads to a different conclusion.

First, it is decisive that the public drinking-water supply service currently provided in the Barrio El Sur sector complies with the minimum standards of continuity, pressure, and quality required by the regulations in force. Indeed, the pressure tests conducted by ICAA during its inspection visit to the system yielded values exceeding the minimum threshold established in the Reglamento para la Prestación de los Servicios del AyA, while subsequent laboratory analyses established that the water supplied is fit for human consumption and contains no parameters compromising its potability.

Those technical findings do not reveal any interruptions in supply, reductions in the quantity delivered, or adverse effects on water quality—elements that, according to this Chamber’s case law, are indispensable to establishing a current violation of the fundamental right of access to drinking water. On the contrary, the available objective data support the conclusion that the service is provided regularly and in accordance with the required standards, a circumstance that significantly undermines the claim that an ongoing constitutional violation exists.

It is true that the technical authorities have acknowledged that the distribution network is considerably old, which has prompted recommendations aimed at its progressive modernization. Nevertheless, that finding cannot, without more, be interpreted as synonymous with a real and imminent threat to users’ fundamental rights, because the age of the infrastructure is relevant for administrative planning but acquires constitutional significance only when it results in actual harm or in a technically substantiated risk to health or life, neither of which has been demonstrated in this case.

At this juncture, the actions taken by the competent authorities are particularly significant, because the case file shows that ICAA not only conducted technical inspections of the system but also issued specific recommendations for preparing a work plan to improve the water-supply system gradually, including replacement of the network over the medium and long term. In addition, ARESEP exercised its supervisory authority in response to the complaint filed, issued specific directives to the ASADA and the governing entity, verified the availability of financial resources to plan the improvements, and ultimately scheduled a field visit to confirm compliance with those directives. This sequence of actions rules out administrative inertia, neglect of the problem, or institutional refusal to adopt corrective measures. On the contrary, it demonstrates that the situation is being addressed technically and progressively, in accordance with the powers legally assigned to each body and the procedures governing the execution of improvement works on water-supply systems managed by community associations. Under these circumstances, there is no legally viable basis for holding that the Administration has failed to fulfill its duty to safeguard this essential public service.

From this perspective, the claim that this Court order the immediate and comprehensive replacement of the pipeline network within a mandatory time limit, under penalty of criminal sanctions, lacks constitutional basis, insofar as it would entail displacing the technical-administrative judgment (criterio técnico-administrativo) of the specialized authorities without a current violation of fundamental rights that would justify doing so. Constitutional jurisdiction (jurisdicción constitucional) is not intended to replace technical planning or impose structural solutions when the service is provided in accordance with the required minimum standards and administrative actions aimed at improving it are underway.

Finally, this conclusion is fully consistent with the constitutional case law cited by the petitioner, which has recognized the fundamental right of access to drinking water as an indispensable prerequisite for life and health. However, unlike those situations in which noncompliance with regulatory standards or a prolonged and verifiable disruption of service was established, in the case under review it has been expressly determined that the water supplied complies with the required technical parameters and that the competent authorities have adopted concrete measures to address the system’s improvement needs. Consequently, because no current, serious, or imminent harm has been demonstrated, nor any administrative omission requiring the immediate intervention of this Chamber, the petitioner’s allegations fall within the realm of future and uncertain events, the possible occurrence of which cannot be anticipated by this constitutional jurisdiction, particularly when verifiable administrative actions are underway to prevent and correct potential deficiencies in the aqueduct infrastructure.

In light of the foregoing considerations, the appropriate course is to dismiss the petition, as is hereby done.

V.Documentation submitted to the case file. The parties are hereby advised that, if they submitted any paper document, as well as any objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device or produced through new technologies, these must be collected from the court office within a maximum period of thirty business days from notification of this judgment. Otherwise, any material not collected within that period shall be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena in Session No. 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial No. 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at Session No. 43-12 held on 3 de mayo del 2012, Article LXXXI.

Por tanto:

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del treinta de enero de dos mil veintiseis .

Recurso de amparo que se tramita en expediente número 25-039249-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001] y [Nombre 002], cédula de identidad [Valor 002], contra la ASOCIACION ADMINISTRADORA DEL ACUEDUCTO -ASADA- RURAL DE CACAO DE NANDAYURE y la AUTORIDAD REGULADORA DE LOS SERVICIOS PÚBLICOS -ARESEP-.

Resultando:

  1. 1Por escrito presentado ante esta Sala a las 13:57 horas del 16 de diciembre de 2025, la parte recurrente interpone recurso de amparo en contra de la Asada Rural de Cacao de Nandayure y la ARESEP. Manifiestan que desde el 30 de diciembre de 2023 enviaron la primera solicitud formal a la ASADA de Cacao de Nandayure mediante correo electrónico remitido a la dirección electrónica oficial de solicitudes y gestiones: [email protected], solicitando la renovación de la red de tuberías del Barrio "El Sur", debido a que la infraestructura presenta más de treinta años de antigüedad, situación reconocida por la ARESEP. Señalan que advirtieron que la red podía colapsar en cualquier momento, generando una interrupción total del servicio de agua potable; no obstante, comentan que ante dicha solicitud la ASADA respondió que tardaría cinco años en efectuar el cambio, plazo que consideraron irrazonable.Agregan que el 5 de junio de 2024 el Instituto Costarricense de Acueductos y Alcantarillados (ICAA) emitió el oficio GSD-UEN-GAR-2024-02344, en el que recomendó a la ASADA elaborar un plan de trabajo para el cambio de la red a tubería de 100 mm con válvulas y ordenó no otorgar nuevas disponibilidades de agua hasta realizar dichas mejoras, por lo que posteriormente el 6 de diciembre de 2024 presentaron una denuncia ante la ARESEP, lo que dio lugar al Informe IN 0028-IA-2025 emitido el 13 de febrero de 2025 en el cual la autoridad reguladora confirmó la antigüedad de la red, la necesidad de su sustitución y la obligación de la ASADA de implementar un plan técnico para priorizar el Barrio "El Sur". Añaden que el 7 de julio de 2025 y el 5 de octubre de 2025 remitieron dos solicitudes adicionales a la dirección electrónica: [email protected] perteneciente a la ASADA accionada, solicitando copia del informe técnico, el plan de trabajo y el cronograma de ejecución para la sustitución de la red conforme a lo dispuesto por el ICAA y la ARESEP, ante lo que la ASADA respondió de manera genérica indicando que "se encuentra en análisis", sin aportar información concreta ni establecer plazos.Indican que han transcurrido casi dos años desde aquella solicitud y no se ha sustituido ningún tramo de la red, ni han obtenido respuesta sobre sus gestiones. Estiman que sus derechos fundamentales han sido lesionados, por lo que solicita se declare con lugar el presente recurso y se ordene lo que en derecho corresponda.
  2. 2Por resolución de las 09:38 horas del 22 de diciembre de 2025, la Presidencia de la Sala dio curso a este proceso constitucional y se le solicitó informe al presidente ejecutivo y al director de la Región de Chorotega, ambos del ICAA, así como al regulador general de la ARESEP, sobre los hechos alegados por la parte recurrente.
  3. 3Mediante escrito incorporado al expediente digital a las 09:38 horas del 22 de diciembre de 2025, informan bajo juramento Lourdes María Sáurez Barboza, Jenner Castrillo Ramírez, Liany Alfaro García, en sus respectivas condiciones de presidenta ejecutiva, jefe de la Región de Chorotega y jefa de la Oficina Regional de Atención de Asadas Chorotega, todos del ICAA, lo siguiente:

“Aclaración previa: La resolución de cita indica que el informe debe ser rendido por el Director de la Región Chorotega, sin embargo, el sistema de acueducto objeto del recurso de amparo es administrado por la Asada de Cacao de Nandayure, mediante delegación del AyA, dicho sistema no es operado por el AyA, mediante la Región Chorotega, sin embargo, en cumplimiento de lo ordenado por la Sala el informe es firmado por el Director a.i de la Región Chorotega, y, además, se rinde por parte de la Jefatura de la Oficina de Atención de Asadas Chorotega de la UEN Gestión de Acueductos Rurales, conforme a las competencias funcionales a lo interno del AyA. HECHOS PRIMERO: Es un hecho propio de los recurrentes y de la Asada. SEGUNDO: Se rechaza por inexacto. Si bien es cierto por parte de ARESEP y del AyA, técnicamente se determinó que la Asada debía realizar las gestiones correspondiente con el fin de generar un proyecto de mejora para sustitución de tubería, conforme las prioridades y necesidades del sistema de acueducto que le fue delegado a la Asada de Cacao de Nandayure, el recurrente no demuestra que haya existido alguna afectación en el suministro de agua potable o su incumplimiento de brindar dicho servicio según los principios que lo rigen, como por ejemplo cantidad y calidad; sino que, lo que expone es un hecho futuro e incierto sin fundamentos técnicos.

En ese sentido debe tomarse en consideración que, para la ejecución de proyectos de mejoras, ampliaciones y modernizaciones de los sistemas de acueductos administrados por las Asadas, se debe cumplir con los procedimientos de contratación establecidos al efecto, así como, que, tales proyectos deben encontrarse incorporados en los planes de inversión y presupuestos de las Asadas, estableciendo prioridades para su formulación y ejecución. Aunado a lo anterior, tales proyectos deben ser aprobados por parte de AyA según lo dispuesto en el artículo 45 del Reglamento de Asadas, Decreto Ejecutivo N° 42582-S MINAE. Cabe agregar que, los planes de inversión de las Asadas fortalecen la ejecución preventiva de proyectos en los sistemas de acueductos, donde el plazo determinado para su realización es definido de acuerdo con criterios técnicos en cuanto a su complejidad tomando en consideración el presupuesto y prioridades de los sistemas de acueducto, tal y como se indicó anteriormente.

Por lo tanto, lo expuesto por el recurrente sobre que se está vulnerando su derecho al acceso al agua potable por el hecho de que se está formulando un proyecto de mejora para sustitución de tubería que podría tardar cinco años, no es cierto, ya que, tal y como se indicó el servicio no ha sido afectado en cuanto a su continuidad y calidad, según se expone en el informe técnico rendido para la atención del presente recurso, emitido mediante oficio GSD-UEN-GAR-2026-00026. TERCERO: Se rechaza por incierto. Al igual que en el hecho segundo; en efecto la recomendación es que los operadores de acueductos garanticen un plan para el cambio de tubería; sin embargo, no hay criterios técnicos que indiquen que el agua que distribuye la ASADA en el sector y en el acueducto en general no sea apta para consumo humano. Por lo tanto, no se vulnera el derecho a la salud, siendo un hecho incierto lo expuesto por el recurrente.

Prueba de lo expuesto, son los análisis de laboratorio sobre la calidad de agua que suministra la Asada (ver anexo 2 del informe GSD-UEN-GAR-2026-00026). CUARTO: No es cierto. Según se desprende del informe técnico supra citado, “en este momento la distribución de agua en el acueducto y en el sector sur se realiza de manera constante por parte de la ASADA. Los recurrentes parten de la premisa que la propuesta de cambio de la tubería como un hecho concreto de vulneración de derecho a la vida; sin embargo, la prestación del servicio se está dando conforme a lo señalado en el Reglamento de Prestación de Servicios del AyA y los principios del servicio público, tanto en calidad y cantidad. El cambio de tubería es parte del plan de trabajo que debe realizar la administración de la ASADA para garantizar la prestación de servicios a futuro y evitar conflictos que pongan en riesgo la prestación del servicio.

Esto lo demuestran los análisis de calidad presentes en el anexo 2, y los informes que indican los recurrentes realizados por el AyA mencionan que la presión cumple con el reglamento supra citado.” El recurrente en el presente hecho, continúa especulando y asumiendo que existe una afectación al derecho de acceso al agua potable, a la salud y la vida, no obstante, tal y como se ha expuesto en los hechos dos y tres, lo manifestado es un hecho incierto que carece de fundamento técnico, ya que, por el hecho que se deban realizar mejoras al sistema de acueducto, como en todos los acueductos a nivel nacional, parte de la operación, mantenimiento, desarrollo en tales sistemas, no implica una violación a derechos constitucionales. QUINTO: Se rechaza por inexacto. Mediante informe rendido para la atención del presente recurso, sobre el memorando GSD-UEN-GAR-2024-02344 emitido por la ORAC Chorotega, se indica: “En efecto se le recomienda a la ASADA el cambio de tubería bajo el oficio GSD-UEN-GAR-2024-02344, sin embargo, se omite indicar en este hecho que las personas recurrentes presentaron el recurso de amparo N° 24-019675-0007-CO; en el cual se indicaba que era necesario un hidrante en el sector, el cual es tomado con lugar según la resolución y se obligó a la ASADA a colocar el hidrante en un año.

Esto significó un cambio en los aspectos logísticos y presupuestarios para poner dicho hidrante el cual se logra colocar previo al vencimiento del plazo otorgado, sin que mediara estudios técnicos que priorizarán las necesidades de todo el sistema y no solamente un sector. Por lo tanto, este hecho se rechaza parcialmente, puesto que se brinda sin el contexto que tuvo que afrontar la ASADA. Además, si bien la recomendación existe; se considera oportuno que se aplique lo indicado en el reglamento de ASADAS, bajo el artículo 44, de la ejecución de un estudio técnico que permita un análisis integral de todo el sistema de la ASADA y así se puedan priorizar las mejoras a ejecutar dependiendo de la capacidad financiera del acueducto.” Tal y como puede observarse y según se expuso anteriormente, los planes de inversión y presupuestos se formulan acorde con las necesidades y prioridades establecidos, donde, en el caso concreto, la Asada no solo debe ejecutar el proyecto de sustitución de tubería, sino que, dentro de sus proyectos prioritarios se encuentra el cumplimiento de lo ordenado por la honorable Sala Constitucional sobre la instalación de un hidrante en la zona.

En ese orden de ideas, tal y como se expone en el informe técnico citado, la Asada se encuentra obligada a realizar un estudio técnico integral, con el fin de contar con criterios técnicos sobre las necesidades y prioridades de proyectos de mejoras del sistema de acueducto que les fue delegado. SEXTO: Se admite con rectificaciones. Se desprende del informe técnico rendido para la atención del presente recurso: “El informe y los extractos escogidos para el hecho, refuerzan la idea que toda mejora debe realizar con los parámetros técnicos necesarios; y si bien, el tema es con el sector Sur del acueducto, no podemos obviar que el sistema debe verse de manera integral y no solo de un sector, es por esto, que, previo a la realización de una mejora en el sector, es requerido un estudio técnico de todo el sistema y desde allí priorizar, con los resultados del estudio técnico qué es lo primero que se debe atender para toda la población que abastece el acueducto de Cacao.” En ese sentido, cabe indicar que, si bien es cierto existen recomendaciones por parte de AyA y ARESEP para realizar mejoras en la red de la Asada en el sector Sur, el proyecto que al efecto deba ejecutarse debe contar con un estudio técnico que permita determinar a ciencia cierta las obras de mejoras que deben desarrollarse, donde se debe cumplir con los procedimientos establecidos al efecto, tal y como se mencionó en el hecho segundo.

SÉTIMO: No nos consta. OCTAVO: Es un hecho propio de los recurrentes con la Asada. No nos constan las gestiones realizadas. Como puede constatarlo la Honorable Sala Constitucional, el Instituto Costarricense de Acueductos y Alcantarillados no ha violentado derecho constitucional alguno a los recurrentes, ya que se ha ajustado al cumplimiento de sus competencias, donde ha emitido las recomendaciones correspondientes a la Asada y brindado la asesoría del caso, con el fin de que el operador delegado, formule y ejecute un proyecto de mejora para sustitución de la tubería en cuestión, lo cual deberá realizar amparado a un informe técnico que determine a ciencia cierta las obras de mejoras que deben desarrollarse, cumpliendo con los procedimientos de contratación establecidos al efecto, así como, planes de inversión y presupuesto, amparados al principio precautorio, sin que con ello, se haya determinado que el operador del servicio por delegación del AyA no esté brindando el suministro de agua potable conforme los principios que lo rigen, como por ejemplo cantidad, continuidad y calidad; sino que, la Asada deberá desarrollar el proyecto según las prioridades que sean establecidas conforme al Estudio Técnico Integral que debe realizar la Asada en cumplimiento de lo estipulado en el artículo 44 del Reglamento de Asadas.

En el caso concreto, los recurrentes no han demostrado que exista un riesgo a la salud, la vida o acceso al agua potable, dado que el servicio de abastecimiento de agua potable en la zona ha sido suministrado por la Asada sin que exista interrupciones; aunado al hecho de que, según se desprende de lo expuesto por los mismos recurrentes, la Asada les indicó que el proyecto se encuentra en análisis, no ha existido inercia de la Asada. I. SOBRE HECHOS FUTUROS E INCIERTOS En el caso que nos ocupa, los recurrentes solo hacen mención de hechos futuros e inciertos, no se visualiza una violación a derechos fundamentales, en ese sentido, la Honorable Sala mediante resolución N° 06279 – 2023 del 17 de marzo del 2023, expresó: (…) “Por otra parte, de acuerdo a (sic) los propios hechos narrados por la accionante, se desprende que no existe lesión o bien alguna amenaza de afectación real e inminente que deba abordar la Sala, se trata de un hecho futuro e incierto, el cual constituye una mera probabilidad que no implica -al momento de plantear el amparo-, una violación o amenaza actual o inminente a sus derechos fundamentales.” (…) En el caso concreto, según lo expuesto por los mismos recurrentes, por parte de la Asada se ha indicado un plazo prudencial para realizar las obras de mejoras en cuanto a la sustitución de la tubería, no ha existido inercia u omisión en la actuación por parte de la Asada sobre las recomendaciones brindadas por parte de ARESEP y del AyA, así como, que el servicio no ha sufrido afectaciones o interrupciones producto del proyecto que deberá ejecutar el operador por delegación; lo que resulta un hecho futuro e incierto lo alegado por los recurrentes en cuanto a una posible violación de derechos fundamentales”.

  1. 4Mediante escrito incorporado al expediente digital a las 16:56 horas del 08 de enero de 2026, informa bajo juramento Eric Bogantes Cabezas, en su condición de regulador general de la ARESEP, lo siguiente:

“I.- ANTECEDENTES DE INTERÉS Como antecedentes de interés al caso concreto, conforme a lo indicado en el recurso de amparo, se tienen los siguientes: 1. El 30 de diciembre de 2023, se emite nota a la Asada el Cacao de Nandayure, Guanacaste, por parte del señor [Nombre 001], en donde solicita de forma prioritaria la modernización de la tubería del Barrio El Sur. 2. El 5 de junio de 2024, mediante el memorando GSD-UEN-GAR-2024-02344, Instituto Costarricense de Acueductos y Alcantarillados, emite informe con relación a la visita de inspección del Sistema de Cacao, Nandayure, Guanacaste, para el caso de problemas de presión en Barrio del Sur. 3. El 13 de setiembre de 2024, mediante oficio CBC-035511-2024-DGD-01183, el Benemérito Cuerpo de Bomberos de Costa Rica, da respuesta al recurrente en atención al Expediente 24-019675-0007-CO -Recurso de Amparo del cual la Aresep no es parte-. 4. El 27 de setiembre de 2024, mediante Resolución N°28064-2024, la Sala Constitucional, emitió la sentencia dentro del expediente 24- 019675-0007-CO. 5.

El 6 de diciembre de 2024, mediante correo electrónico recibido de la cuenta [email protected], el Sr. [Nombre 001], presenta denuncia de inconformidad ante la Aresep, en relación al plan de remediación planteado por la ASADA de Cacao de Nandayure, sobre la longevidad de la red de tuberías que abastece el sector de Barrio Sur. II.- SOBRE LOS HECHOS ALEGADOS POR EL RECURRENTE En la forma y términos que se indican, se procede a contestar los hechos que expone el recurrente, de la siguiente manera: PRIMERO: ES CIERTO. SEGUNDO: SE RECHAZA POR INEXACTO, CON LAS SIGUIENTES ACLARACIONES. En primer lugar, la Autoridad Reguladora no tuvo conocimiento directo ni participó de alguna manera en la gestión realizada por el recurrente el 30 de diciembre de 2023 ante la ASADA, ni dicha actuación forma parte de los hechos verificados por la Intendencia de Agua mediante el informe IN-0028-IA-2025 del 13 de febrero de 2025 (actuación que se originó a raíz de la denuncia presentada por el recurrente hasta el 06 de diciembre de 2024).

Ahora bien, de conformidad con lo consignado en el Informe de Fiscalización IN-0028 IA-2025 del 11 de febrero de 2025, la Intendencia de Agua tuvo por acreditado que la red de distribución del sector Barrio El Sur presenta una antigüedad considerable, según la información suministrada durante el proceso de fiscalización. No obstante, la ARESEP no determinó la existencia de una afectación actual, grave o inminente a la continuidad del servicio, ni calificó la infraestructura como colapsada o inutilizable, limitándose a señalar en el Informe la necesidad de análisis técnico y planificación de mejoras, dentro de sus competencias regulatorias. Tome en cuenta su Autoridad, que la gestión realizada por el recurrente el 30 de diciembre de 2023 fue dirigida única y exclusivamente a la ASADA, tal como él mismo lo indica, así como también lo fue el intercambio de información entre ellas. No habiendo participación directa, ni indirectamente, de esta Autoridad Reguladora en esa gestión.

La competencia y participación de la ARESEP fue activada a partir de la denuncia interpuesta por el recurrente ante la Institución el 6 de diciembre de 2024, la cual dio origen al proceso de fiscalización, y al informe IN-0028-IA-2025 del 13 de febrero de 2025. TERCERO: SE RECHAZA POR INEXACTO, CON LAS SIGUIENTES ACLARACIONES. Mediante el informe IN-0028-IA-2025 del 13 de febrero de 2025, la ARESEP en el apartado de conclusiones en su punto 5), la Intendencia de Agua indicó lo siguiente: “5.Indicarle a señor Ugalde en condición de usuario: i.(…) ii (…) iii. Con base en lo señalado por el abonado y por usuario, y tomando en cuenta la visita realizada por la ORAC AYA (consta el oficio GSD-UENGAR-2024 02344), se concluye que la prestación del servicio cumple con los estándares mínimos de continuidad, presión y calidad establecida en la normativa vigente; iv. Si bien, dando por cierta la longevidad descrita por el señor abonado de que las tuberías tienen un tiempo de uso considerable, es requerido, que en su momento la ASADA, habiendo cumplido con las disposiciones de la Sala Constitucional, deberá implementar acciones de análisis técnico y definición para sustituir la línea de red existente en el sector Barrio Sur de Cacao y de conformidad con lo señalado en el oficio GSD-UEN-GAR- 2024-02344.” (lo subrayado no es del original) De lo anterior se extrae que efectivamente la red de tuberías tiene un tiempo de uso considerable, y que es necesario que en su momento la ASADA tome las acciones necesarias para realizar el remplazo correspondiente.

También se indica que, a pesar de ese tiempo considerable de uso que posee la red de tuberías, se concluyó que la prestación del servicio cumple con los estándares mínimos de continuidad, presión y calidad establecida en la normativa vigente. De ahí que, esta Autoridad Reguladora giró una serie de disposiciones tanto para La ORAC regional Chorotega – AyA, como para la ASADA las cuales tenían que ser atendidas en un plazo de 15 días hábiles, dentro de esas disposiciones se traen a colación las que tienen relevancia en atención al objeto del presente recurso de amparo, por ejemplo: A la ORAC regional Chorotega – AyA se le indicó que debía incluir en su plan de trabajo, un acompañamiento, seguimiento y control, para que la Asada a través de su propuesta de trabajo, cumpla con el mandato de la Sala Constitucional, además de la implementación de los cambios que requiere la red de distribución a la luz de lo señalado en su oficio GSD-UEN-GAR-2024-02344.

Por su parte, a la ASADA se le giró la disposición de que debía planificar a mediano plazo los cambios necesarios para iniciar la actualización de la red de distribución, valorar lo que corresponda técnicamente en la mejora del sector Barrio del sur. En el caso de que la ASADA reciba donaciones de tubería, deben priorizar su instalación de manera transparente, con una rendición de cuentas justificada para los usuarios y abonados de la ASADA El Cacao. CUARTO: SE RECHAZA POR INEXACTO, CON LAS SIGUIENTES ACLARACIONES. Tal como ya se indicó en el hecho anterior, el informe IN-0028-IA-2025 del 13 de febrero de 2025 tuvo por acreditado que la red de tuberías tiene un tiempo de uso considerable y que resultaba necesario, que en su momento la ASADA tomara las acciones necesarias para realizar el remplazo correspondiente. Además, a pesar de ese tiempo considerable de uso que posee la red de tuberías, se concluyó que la prestación del servicio cumple con los estándares mínimos de continuidad, presión y calidad establecida en la normativa vigente.

Ahora bien, en el Informe IN-0028-IA-2025 no consta que la ASADA haya establecido un plazo formal de cinco años para la sustitución de la red, ni que dicho plazo haya sido valorado o avalado por la Autoridad Reguladora. Vale indicar que, cualquier referencia a plazos anteriores a la fiscalización de la Aresep (que dio origen a partir de la denuncia formulada por el recurrente el 06 de diciembre de 2024) no forma parte de los hechos comprobados por esta Autoridad Reguladora, ni incide en el análisis regulatorio realizado. QUINTO: SE RECHAZA AL SER ACTUACIONES AJENAS A LA ARESEP, CON LAS SIGUIENTES ACLARACIONES. La ARESEP tuvo conocimiento del oficio GSD-UEN-GAR-2024-02344 del AyA, en tanto fue citado como antecedente dentro del proceso de fiscalización efectuado por esta Autoridad Reguladora. Sin embargo, la ARESEP no interpretó ni calificó dicho oficio como una orden de sustitución inmediata, sino como un insumo técnico que debía ser considerado dentro del análisis y planificación de mejoras que correspondía realizar al prestador del servicio, por su parte, los alcances y demás consideraciones en cuanto a dicho oficio, deberán ser desarrolladas por el ICAA al momento de rendir su informe para este asunto.

Véase que el informe IN-0028-IA-2025 del 13 de febrero de 2025 le indicó al recurrente como parte de sus conclusiones, que la prestación del servicio cumple con los estándares mínimos de continuidad, presión y calidad establecida en la normativa vigente; además de que, por la longevidad del tiempo de uso que tienen las tuberías según lo indicado por el recurrente, es requerido, que en su momento la ASADA, habiendo cumplido con las disposiciones de la Sala Constitucional (exp.24- 019675 0007-CO), deba implementar acciones de análisis técnico y definición para sustituir la línea de red existente en el sector Barrio Sur de Cacao, de conformidad con lo señalado en el oficio GSD-UEN-GAR-2024-02344. SEXTO: ES CIERTO CON LAS SIGUIENTES PRECISIONES. 1. La red del sector Barrio El Sur presenta una antigüedad considerable. 2. Se requiere que el prestador realice análisis técnicos para definir la atención de mejoras. 3.

La ASADA dispone de recursos financieros que permiten planificar inversiones, bajo el principio del servicio al costo. Ahora bien, debe precisarse que la ARESEP no ordenó la ejecución inmediata de obras, sino que dispuso la elaboración de un plan de trabajo técnicamente sustentado, con cronograma y debidamente aprobado. De igual forma, es incorrecto indicar que el Informe IN-0028-IA-2025 haya impuesto a la ASADA una obligación inmediata e incondicionada de sustituir la red del Barrio El Sur. Las disposiciones emitidas por la Intendencia de Agua en el informe brindado, se circunscribieron a: 1. La presentación de un plan de trabajo, 2. La planificación a mediano plazo de mejoras, 3. La coordinación con el AyA como ente rector, todo ello dentro de un proceso gradual, técnico y fiscalizable, conforme a la normativa vigente. Lo anterior se desprende de la simple lectura del Informe de referencia, el cual se adjunta como prueba del presente informe.

SÉTIMO: ES CIERTO OCTAVO: NO LE CONSTA A LA ARESEP. Téngase en cuenta que las solicitudes posteriores dirigidas por el recurrente directamente a la ASADA no forman parte del ámbito de competencia directa de esta Autoridad Reguladora, ni fueron objeto de valoración específica en el proceso de fiscalización que dio origen al Informe IN-0028-IA-2025 a raíz de la denuncia presentada el 06 de diciembre de 2024. Es importante decir, que la actuación legal de la ARESEP se limita a la fiscalización del servicio y a la emisión de disposiciones regulatorias, no a la gestión diaria de las comunicaciones entre usuarios y prestadores. Así las cosas, con fundamento en los hechos contestados, se ha podido demostrar que la actuación de la ARESEP, no ha vulnerado ninguno de los derechos fundamentales alegados por el recurrente, además obsérvese que el objeto del proceso no se circunscribe o involucra actuaciones u omisiones por parte de esta Autoridad Reguladora.

III. SOBRE LAS ACTUACIONES REALIZADAS POR LA ARESEP A partir de la denuncia presentada el 06 de diciembre de 2024 por el recurrente, es posible indicar que ésta fue atendida, y producto de ello se emitió el informe de fiscalización IN-0028-IA-2025 del 13 de febrero de 2025, en el que la ARESEP giro las siguientes disposiciones a la Asada El Cacao de Nandayure, Guanacaste: “(…) 2. A la Asada El Cacao de Nandayure, Guanacaste. En un plazo de 15 días hábiles debe de atender los siguientes puntos: 1. Debe implementar un plan de trabajo con su cronograma aprobado por la Junta Directiva y que cuente con el visto bueno de la ORAC regional Chorotega AyA del diseño e implementación de todo lo relacionado con el cumplimiento del mandato de la Sala Constitucional, según los tres puntos que solicita la Resolución N°28064-2024. 2. Deben planificar a mediano plazo los cambios necesarios para iniciar la actualización de la red de distribución, valorar lo que corresponda técnicamente en la mejora del sector Barrio del sur.

En el caso de que la ASADA reciba donaciones de tubería, deben priorizar su instalación de manera transparente, con una rendición de cuentas justificada para los usuarios y abonados de la ASADA El Cacao. a. Suministrar los resultados e implementación del estudio técnico integral de la ASADA para la ubicación, instalación y requisitos técnicos solicitados por Bomberos de Costa Rica. b. Aportar la Justificación de las acciones y labores implementadas por la ASADA El Cacao aplicado al rubro de instalación descrito en un monto por ₡ 7 592 748,95 y todas aquellas otras labores ejecutadas que cuente con el debido visto bueno y aprobación por parte de la Junta Directiva (…)” Se observa entonces que, se otorgó al ente prestador del servicio público un plazo de 15 días hábiles a partir de la notificación de ese Informe, para atender las disposiciones ahí señaladas. Esto, en lo referente a la presentación de la ruta de trabajo o cronograma para atender la situación denunciada por el usuario respecto a al tema de la instalación de hidrantes, y posteriormente mejoras en la infraestructura del acueducto.

Es importante indicar que la Asada El Cacao de Nandayure, solicitó ante la Aresep una ampliación de plazo para atender las disposiciones enunciadas; para lo cual, el 12 de marzo de 2025, mediante el oficio OF-0173-IA-2025, se concedió la extensión de plazo al 18 de marzo de 2025. El 7 de marzo de 2025 mediante el oficio GG-2025-00674, el AyA dio respuesta a lo solicitado por la Intendencia en el informe IN-0028-IA-2025, donde se adjunta el respectivo plan de trabajo aprobado por la Junta Directiva de la Asada Cacao de Nandayure con la debida aprobación de la oficina Regional de Acueductos Comunales en la Región Chorotega. Cabe resaltar que tal y como se indicó en el escrito sin fecha (el cual se adjunta) con el que la Asada contestó los requerimientos de la Aresep, con respecto al deber de planificar la actualización de la red de distribución, se indicó lo siguiente: “En respuesta a esta pregunta esta ASADA ha venido trabajando de la mano con el AYA, por el cual se hará una reunión en el mes de mayo para juntos generar este plan.” Así las cosas, en virtud de que el ente rector y el sistema delegado atendieron lo solicitado por esta Autoridad Reguladora y se encuentran gestionando de manera conjunta una solución respecto de la situación de la red de distribución, la Intendencia de Agua, como parte del seguimiento de fiscalización que realiza a diversos operadores de la Región Chorotega y conforme a su planificación para el año 2026, ha previsto efectuar una visita de campo al sistema operado por la ASADA de El Cacao de Nandayure, durante la semana comprendida del 2 al 6 de marzo del presente año.

Dicha visita tiene por finalidad constatar la atención de las disposiciones contenidas en el Informe IN-0028-IA-2025, emitido con ocasión de la inspección realizada el año anterior, según se desprende del oficio OF-0011-IA-2026, todo ello con el objetivo de verificar las mejoras en la calidad del servicio, en ejercicio de las facultades conferidas a esta Autoridad Reguladora por la Ley N.° 7593 y su reglamento Para efectos de este recurso, debe tenerse presente que de conformidad con el artículo 5 de la Ley N°7593, son atribuciones de la ARESEP fijar precios y tarifas por la prestación de los servicios públicos, incluyendo aquellos que prestan las ASADAS –acueducto, alcantarillado sanitario e instalación, operación y mantenimiento del servicio de hidrantes– así como el velar por el cumplimiento de las normas de calidad, cantidad, confiabilidad, continuidad, oportunidad y prestación óptima, entre otros, en la prestación de dichos servicios.

Asimismo, el reglamento a la Ley N° 7593, Decreto Ejecutivo número 29732, en su artículo 3 señala que la ARESEP no podrá coadministrar ni arrogarse funciones de los prestadores, ni de los entes fiscalizadores que tengan funciones asignadas por ley. De ahí que la actuación de la ARESEP a raíz de la denuncia presentada el 06 de diciembre de 2024 por parte del recurrente se limitó a atender lo señalado en el artículo 6 inciso a) de la Ley N° 7593 que consiste en: “(...) Regular y fiscalizar contable, financiera y técnicamente, a los prestadores de servicios públicos, para comprobar el correcto manejo de los factores que afectan el costo del servicio, ya sean las inversiones realizadas, el endeudamiento en que han incurrido, los niveles de ingresos percibidos, los costos y gastos efectuados o los ingresos percibidos y la rentabilidad o utilidad obtenida (...)” Por ello, es decisión de la administración atender sus obligaciones para con la prestación tanto del servicio de acueducto como el de hidrantes; el cual recae en el prestador y Titular del servicio, que, en el caso de las ASADAS, el AYA debe mantener su rol como figura jurídica responsable de las acciones que implementen las ASADAS como entes delegados en prestar el servicio bajo la figura legal del convenio de delegación.

De ahí que, en el caso concreto ha quedado demostrado que la actuación de la ARESEP ha sido, célere, eficiente y eficaz de conformidad con lo dispuesto en la Ley N° 7593, aunado a ello, es claro que dichas actuaciones no han mermado derecho fundamental alguno del recurrente, al contrario, esta Autoridad Reguladora ha realizado su función fiscalizadora a raíz de la disconformidad presentada por el recurrente en contra del prestador del servicio púbico”.

  1. 5Mediante escrito incorporado al expediente digital a las 11:04 horas del 20 de enero de 2026, Joseph Mauricio Duarte Sequeira, en su calidad de presidente y representante judicial y extrajudicial con facultades de apoderado generalísimo sin límite de suma de la ASADA de Cacao de Nandayure, contestó la audiencia conferida, en los siguientes términos:

“PRIMERO: CIERTO.

SEGUNDO: INCIERTO. El recurrente no demuestra que haya existido alguna afectación en el suministro de agua potable o su incumplimiento de brindar dicho servicio según los principios que lo rigen, como por ejemplo cantidad y calidad; incluso en el informe técnico rendido para la atención del presente recurso, emitido mediante oficio GSD-UEN-GAR-2026-00026 se determina que la cantidad y calidad de agua recibida por los vecinos del sector cumplo con todos los requisitos de ley. El recurrente expone un hecho futuro e incierto sin fundamentos técnicos.

El plazo de 5 años es un tiempo considerable tomando en cuenta todos los demás proyectos y gestiones que debe realizar la asada durante el transcurso del año, seria deshonesto y de mala fe indicar al recurrido un plazo a corto plazo cuando en la realidad de mi representada eso no sería posible de concretar.

TERCERO Y CUARTO: INCIERTO. Nuevamente el recurrente expone un hecho futuro o incierto sin ningún fundamento técnico.

QUINTO: INCIERTO. Si bien es cierto el AYA realizo recomendaciones a mi representada en cuanto a la sustitución de la tubería aquí expuesta, también debe tomarse en cuenta que estas recomendaciones se realizan tomando en cuenta y siguiendo la realidad de la ASADA aquí representada. Ya que para realizar cualquier proyecto de la magnitud del que aquí se expone la ASADA debe hacer un estudio técnico integral para poder determinar las prioridades que debe tener la ASADA en cuanto a sus proyectos y la distribución de sus recursos.

Una vez realizado dicho estudio la ASADA deberá tomar decisiones sobre cuales proyectos en este momento necesitan más presupuesto y mucha más urgencia en su ejecución. Sin dejar de tomar en cuenta las recomendaciones realizadas por el AYA tal y como lo establece el articulo 44 y 45 del Reglamento de Asadas, Decreto Ejecutivo N° 42582-S-MINAE.

SEXTO: INCIERTO. Cabe destacar que se toman en cuenta partes de las recomendaciones realizadas por el ARESEP a conveniencia del aquí recurrente, ya que si bien es cierto tanto el AYA como el ARESEP realizaron recomendación en cuanto a la sustitución de la tubería de la Asada en el sector Sur, también se realiza hincapié en que el proyecto que al efecto deba ejecutarse debe contar con un estudio técnico que permita determinar a ciencia cierta las obras de mejoras que deben desarrollarse, donde se debe cumplir con los procedimientos establecidos al efecto entre los que se encuentra la presupuestación y ejecución del proyecto de acuerdo al plan de trabajo que debe ser aprobado por estos mismos entes. SETIMO: NO ME CONSTA.

OCTAVO: INEXACTO. En ningún momento mi representada ha tenido la intención de ignorar las solicitudes del aquí recurrente, sin embargo, la respuesta que se dio en su momento fue exactamente la adecuada, ya que se encontraba tanto en análisis presupuestario con nuestro contador como en análisis de la planificación que debía darse para la ejecución del proyecto (así como todos los demás proyectos y necesidades que debe cubrir la ASADA) por parte de la ASADA.

Aquí de manera respetuosa queremos dejar claro que a pesar de tener la obligación de rendir cuentas a los abonados sobre la gestión de la ASADA, también debemos encargarnos del buen funcionamiento y velar por no violentar los derechos a nuestros abonados, es por esto, que no hay una persona encargada solamente de contestar correos electrónicos diariamente. Sino que se hace una revisión rutinaria y se da respuesta a los mismos”.

  1. 6Mediante escrito incorporado al expediente digital a las 20:05 horas del 22 de enero de 2026, la parte recurrente refuta el informe del ARESEP, en los siguientes términos:

“I. SOBRE EL RECONOCIMIENTO DE LA LONGEVIDAD Y EL PLAZO DE 5 AÑOS BRINDADO POR LA ASADA CACAO La recurrida, mediante su informe de contestación, intenta deslindar responsabilidad a pesar de tener conocimiento expreso del plazo de cinco años otorgado por la ASADA Cacao para la sustitución de la red del Barrio Sur, plazo que fue comunicado sin respaldo en un estudio técnico en el Barrio Sur, en contravención de lo dispuesto en los artículos 44 y 45 del Reglamento de ASADAS. Dicho plazo fue de conocimiento de la ARESEP y consta expresamente en el informe de fiscalización IN-0028-IA-2025, sin que esta autoridad haya ejercido oportunamente sus potestades regulatorias para exigir una valoración técnica que garantizara la protección efectiva del derecho humano al agua. Lo anterior se desprende del propio estudio incorporado por la ARESEP en su análisis técnico, en el cual se expone, como parte de la denuncia, y finalmente se acredita que la red de tuberías del Barrio Sur supera los treinta años de antigüedad, evidenciando su avanzada antigüedad; asimismo, se reconoce que el plazo de cinco años propuesto por la ASADA resulta excesivo e inadecuado para atender la urgencia de la situación.

Cito a continuación: A. Denuncia del Sr. [Nombre 001]. El usuario se muestra inconforme ante un plan de remediación planteado por la ASADA Cacao de Nandayure, para atender la aparente longevidad de la red de tuberías que abastece el sector de Barrio Sur de esa comunidad, las cuales, según señala, tienen más de 30 años de antigüedad y representa un riesgo latente de fugas masivas en el servicio. El señor Ugalde añade que la infraestructura del acueducto está obsoleta y debe ser renovada en un plazo menor al ofrecido en dicho plan (5 años, con base en el plan de remediación suministrado por el operador). El Sr. [Nombre 001] considera que el tiempo es excesivo e inadecuado para atender la urgencia de la situación. (…) Esta cita evidencia que la problemática no era desconocida para la autoridad reguladora, y que la omisión de acciones regulatorias efectivas permitió y permite la prolongación de un riesgo latente para los derechos fundamentales de la población usuaria del Barrio Sur.

II. SOBRE EL OFICIO GSD-UEN-GAR- 2024-02344 Y SU INCORRECTA INTERPRETACIÓN POR PARTE DE LA ARESEP La recurrida, mediante su informe de contestación y en el informe IN-0028-IA-2025, fundamenta sus conclusiones en una interpretación del oficio GSD-UEN-GAR-2024 02344, emitido por el Instituto Costarricense de Acueductos y Alcantarillados. No obstante, dicho oficio se limita a consignar la medición de la presión del servicio en un único momento, sin constituir una valoración técnica del sistema de distribución del Barrio Sur. Tal medición puntual no satisface los criterios técnicos exigidos por los artículos 44 y 45 del Reglamento de ASADAS, los cuales establecen que únicamente mediante una evaluación técnica elaborada por un profesional en ingeniería y debidamente colegiado ante el CFIA; es posible valorar el estado real de los componentes del sistema de distribución y determinar, con sustento científico; dicho estudio resulta vital para evaluar las condiciones estructurales de la red y los riesgos asociados a su operación, máxime cuando se ha acreditado que la red de tuberías presenta una longevidad considerable, estas circunstancias configuran un riesgo latente para la prestación continua y segura del servicio, por lo que, en ausencia de este criterio técnico, no resulta jurídicamente válido desestimar ni calificar como inexactos los alegatos del recurrente, por lo pronto al no existir este estudio técnico, lo procedente es que se declaré con lugar el presente recurso de amparo en todos sus extremos.

En consecuencia, cito a continuación la conclusión de mayor relevancia contenida en el referido insumo técnico del AyA: Se recomienda a la ASADA en el sector del Sur, no brindar más disponibilidades de agua con el fin de no afectar a los usuarios de dicho sector a mediano y corto plazo hasta que se realicen los cambios en la red de distribución. La cita del oficio GSD-UEN-GAR-2024-02344 evidencia que el propio AyA reconoce que la red de distribución no soporta nuevas disponibilidades de agua y que la incorporación de servicios adicionales genera una afectación inmediata, situación atribuible a la avanzada antigüedad de la infraestructura, la cual compromete directamente el ejercicio de derechos fundamentales vinculados al acceso al agua potable y servicios actuales III. SOBRE LOS HECHOS ACEPTADOS POR EL ARESEP 3 La recurrida, mediante su informe de contestación, acepta los siguientes hechos que cito a continuación: 1.

La red del sector Barrio El Sur presenta una antigüedad considerable. 2. Se requiere que el prestador realice análisis técnicos para definir la atención de mejoras. 3. La ASADA dispone de recursos financieros que permiten planificar inversiones, bajo el principio del servicio al costo. El reconocimiento de la antigüedad avanzada de la red y por otro lado el riesgo que implica mantener en operación el sistema de distribución TAN ANTIGUO del Barrio Sur evidencia una amenaza directa al derecho fundamental de acceso al agua potable, en tanto dicha infraestructura constituye el único medio para garantizar el abastecimiento a la totalidad de la población usuaria del sector Barrio Sur. La inexistencia de un análisis técnico en el barrio sur, aunada a la actuación negligente de la ASADA de Cacao de Nandayure, la cual se encuentra bajo la regulación y fiscalización de la ARESEP, demuestra una omisión regulatoria injustificada, máxime cuando esta última dispone de herramientas normativas y presupuestarias para exigir plazos improrrogables para la sustitución de la tubería.

En consecuencia, la falta de aplicación de sanciones o procedimientos administrativos por parte de la ARESEP ha permitido la continuidad de un riesgo latente, comprometiendo la protección efectiva de los derechos fundamentales de la población del Barrio Sur, por lo cual la recurrida tiene una cuota de responsabilidad enorme en este caso. IV. 4 SOBRE EL OFICIO GSD-UEN-GAR-2025-00767 EMITIDO POR EL AYA A LAS DISPOCISIONES DEL ARESEP La recurrida, mediante su informe de contestación, aporta el oficio GSD-UEN-GAR-2025 00767 emitido por el AyA. De dicho documento, y para efectos del presente caso, resulta pertinente destacar los extremos de mayor relevancia. En particular, el AyA señala en sus conclusiones lo siguiente: 2- En el mes de mayo se tendrá un espacio con la ASADA Cacao para la implementa-ción de las mejoras de tubería para el sector Sur y recordar a la ASADA sobre la transparencia y que las acciones mejoran el sistema en toda la comunidad.

De la conclusión contenida en el oficio GSD-UEN-GAR-2025-00767, de fecha 4 de marzo de 2025, se desprende un reconocimiento expreso de la necesidad de implementar mejoras en la red de tuberías del Barrio Sur, con el fin de mitigar el riesgo que implica mantener en operación una infraestructura con una antigüedad avanzada y considerable. La conclusión fue emitida en marzo de 2025, previéndose una reunión hasta el mes de mayo de 2025, mientras que la solicitud inicial de sustitución data del 30 de diciembre de 2023, por lo que el tiempo transcurrido para ejecutar el reemplazo de la tubería del Barrio Sur resulta manifiestamente excesivo al 2026. Dicho reconocimiento confirma que la situación no puede ser minimizada ni tratada como un hecho aislado, sino que requiere la adopción de medidas correctivas concretas. Asimismo, el propio oficio evidencia que lo planteado corresponde a una implementación de sustitución de tubería, lo cual refuerza la necesidad de actuar de manera oportuna y efectiva.

En este contexto, resulta improcedente relativizar el riesgo existente, cuando lo jurídicamente correcto es reconocerlo y aplicar las medidas necesarias contra el operador. No obstante, la ARESEP no ha sido cabal en el cumplimiento de sus disposiciones regulatorias, permitiendo la dilación en la sustitución de la tubería requerida, situación que compromete la protección de los derechos fundamentales de la población del Barrio Sur y limita la posibilidad de otorgar nuevas disponibilidades de agua sin afectar a los usuarios actuales, hasta realizar los cambios correspondientes”.

  1. 7Mediante escrito incorporado al expediente digital a las 20:06 horas del 22 de enero de 2026, la parte recurrente refuta el informe de las autoridades recurridas del ICAA, en los siguientes términos:

“ I. SOBRE EL RECONOCIMIENTO DE LA LONGEVIDAD Y SUS RECOMENDACIONES DEL AyA. El recurrido, mediante el informe técnico No. GSD-UEN-GAR-2026-00026, reconoce expresamente que las recomendaciones emitidas obedecen a la longevidad de la infraestructura, admitiendo que la red de distribución del acueducto cuenta con una longevidad excesiva como el ARESEP lo acreditó. Previo a resolver el presente recurso de amparo, resulta de vital importancia poner en conocimiento de esta Honorable Sala un hecho acreditado con prueba aportada por el propio ARESEP, consistente en un documento emitido por la ASADA Cacao de Nandayure, mediante el cual se responde a las disposiciones de la ARESEP. En dicho documento, la ASADA reconoce expresamente que “(…)se ha cambiado de emergencia un tramo de tubería que abarcaba 600 mts aproximadamente ya que este presentaba problemas de fugas y se reventaban los tubos;” Este hecho no puede considerarse un caso aislado, sino que constituye una manifestación concreta de fallas estructurales ocurridas dentro de la misma red de distribución administrada por la ASADA recurrida.

Ello evidencia que la infraestructura de la recurrida presenta vulnerabilidades reales, las cuales se materializan mediante intervenciones de emergencia y no a través de una planificación técnica. La existencia de estas fallas en otro sector cercano al Barrio Sur refuerza la tesis respecto a la presencia de un riesgo latente, susceptible de materializarse en cualquier momento por la longevidad excesiva y previamente demostrada por autoridades. En este contexto, únicamente un estudio técnico, elaborado por un profesional en ingeniería debidamente colegiado ante el CFIA, puede determinar con criterio científico las obras necesarias para garantizar la continuidad, seguridad y calidad del servicio en el Barrio Sur. Por lo pronto al no existir este estudio, la ASADA no puede realizar las mejoras que se requieren con celeridad; por tanto, en protección de los derechos fundamentales del Barrio Sur lo procedente es que se declarare con lugar el presente recurso en todos sus extremos Asimismo, la imposibilidad actual de otorgar nuevas disponibilidades de agua en dicho sector sur constituye un indicio adicional de la insuficiencia estructural del sistema, lo cual confirma que la problemática denunciada no es hipotética ni futura, sino real y verificable.

II. INCUMPLIMIENTO DEL ARTÍCULO 44 DEL REGLAMENTO DE ASADAS La inexistencia del estudio técnico constituye una violación directa y objetiva del artículo 44 del Reglamento de las ASADAS y de derechos fundamentales; el cual impone de manera expresa y obligatoria el deber de contar con un estudio técnico actualizado que permita determinar la capacidad hídrica e hidráulica del sistema administrado, así como el estado de sus componentes, la infraestructura y las mejoras requeridas para proteger el servicio. En particular, el inciso c) del artículo 44 establece que: Alcances del Estudio Técnico: El estudio técnico deberá establecer la capacidad hídrica e hidráulica del sistema, deberá determinar el estado y los componentes que lo integran, así como las mejoras que se requieran en la producción y la calidad de los caudales de aprovechamiento de las fuentes, así como en infraestructura y en funcionamiento que requiera el sistema.

El contenido del Estudio estará determinado por las disposiciones emitidas por AyA para tal efecto. Dicha disposición es clara en cuanto a que el estudio técnico debe determinar el estado de los componentes del sistema, la infraestructura y su funcionamiento. Asimismo, el inciso b) del artículo 44 dispone lo siguiente: Responsabilidad del Estudio Técnico: Es responsabilidad compartida de la ASADA y el profesional responsable velar por la correcta aplicación de la normativa técnica, políticas y directrices emitidas por AyA, siendo éstas de acatamiento obligatorio tanto en la ejecución del estudio, como en el diseño y construcción de las obras resultantes. Asimismo, el inciso a) del artículo 44 dispone lo siguiente: “Ejecución de los Estudios Técnicos: Los estudios técnicos de estos sistemas, deberán ser realizados por la ASADA con el respaldo técnico de un profesional responsable, debidamente incorporado al Colegio Profesional de su área respectiva.” En el presente caso, la ausencia total de dicho estudio no solo acredita el incumplimiento normativo de la ASADA, sino también la omisión del AyA como ente rector, al no exigir ni garantizar el cumplimiento de una obligación reglamentaria esencial dentro de un servicio público delegado.

Esta omisión prolongada configura negligencia institucional, incompatible con el deber de tutela efectiva del derecho fundamental al acceso al agua potable. Lo procedente es declarar con lugar el recurso para proteger este derecho ante su inminente vulneración, afectando el servicio público y todos los derechos fundamentales de las familias que viven en el Barrio Sur. III. PRÁCTICAS DEL AyA FRENTE A ESTE TIPO DE CASOS El AyA, dentro del expediente N.° 24-019675-0007-CO, promovido por este mismo recurrente, y referido al mismo sistema administrado por la ASADA de Cacao de Nandayure y al mismo sector del Barrio Sur, sostuvo y defendió de forma arbitraria que no era necesaria la instalación de un hidrante, sin contar con sustento técnico que respaldara dicha posición. No obstante, dicho recurso fue declarado con lugar, y en ese proceso el Benemérito Cuerpo de Bomberos de Costa Rica determinó, mediante estudio técnico, que la instalación del hidrante sí era necesaria, lo que dejó en evidencia que la posición inicial del AyA carecía de respaldo técnico objetivo.

Este antecedente resulta especialmente relevante, pues evidencia un patrón reiterado de actuación del AyA frente a esta misma ASADA y este mismo sector, consistente en descartar o minimizar requerimientos técnicos sin contar previamente con los estudios exigidos, trasladando las consecuencias de dicha omisión al operador delegado y, en última instancia, a los usuarios del servicio. Tales prácticas reflejan una deficiente labor de supervisión, control y contención por parte del AyA como ente rector del servicio público delegado, lo que deriva en omisiones reiteradas que terminan vulnerando derechos fundamentales, particularmente tratándose de servicios públicos esenciales como el acceso al agua potable. IV. SOBRE LA VULNERACIÓN AL DERECHO A LA SALUD En el informe rendido se rechazan mis alegatos con base en pruebas generales de control de calidad del agua; sin embargo, se omite valorar el riesgo real que puede derivarse del ingreso de sedimentos al sistema de distribución del Barrio Sur.

Dicho riesgo no es meramente hipotético, sino que ya se ha materializado en otro sector cercano al Barrio Sur, situación que obligó a realizar una intervención de emergencia, según consta expresamente en la propia contestación del operador ASADA al Aresep. En la cual se extrae lo siguiente: “(…)se ha cambiado de emergencia un tramo de tubería que abarcaba 600 mts aproximadamente ya que este presentaba problemas de fugas y se reventaban los tubos;”. La existencia de este antecedente demuestra que la sola referencia a controles generales de calidad no resulta suficiente para descartar la vulneración al derecho a la salud, cuando la infraestructura presenta riesgo de fallas que pueden comprometer la potabilidad del agua en cualquier momento, particularmente en una red con más de treinta años de antigüedad. V. SOBRE LAS CONCLUSIONES DEL AYA Del informe rendido por el Instituto Costarricense de Acueductos y Alcantarillados se desprenden conclusiones relevantes que deben ser valoradas de manera integral por esta Honorable Sala, pues lejos de desvirtuar los alegatos, los confirman.

Si bien el AyA señala que el servicio de abastecimiento de agua potable no se ha interrumpido en el sector Sur, dicha afirmación no resulta suficiente para descartar una vulneración o amenaza inminente a derechos fundamentales. Asimismo, el propio AyA reconoce que, previo a realizar el cambio de tubería, la ASADA debe ejecutar un estudio técnico del sistema del Barrio Sur y cumplir con lo dispuesto en los artículos 44 y 45 del Reglamento de ASADAS. Esta conclusión reafirma lo sostenido desde el inicio del proceso, en cuanto a la necesidad de una evaluación técnica y preventiva del sistema, y esto confirma que no basta con afirmar que el servicio se brinda actualmente, sino que resulta indispensable acreditar que la infraestructura cuenta con condiciones técnicas adecuadas para garantizar un funcionamiento seguro y sostenible. En tanto dicho estudio técnico no exista, la ASADA carece de sustento técnico para rechazar alegatos; y ejecutar las mejoras estructurales requeridas en el Barrio Sur, lo que mantiene latente el riesgo sobre la continuidad y seguridad del servicio en el Barrio Sur.

Por ello, en protección de los derechos fundamentales de la población usuaria, lo procedente es que se declararé con lugar el presente recurso en todos sus extremos, ordenando la sustitución de la infraestructura según lo recomendado por el AyA en el oficio GSD-UEN-GAR-2024 02344”.

  1. 8Mediante escrito incorporado al expediente digital a las 12:42 horas del 23 de enero de 2026, la parte recurrente refuta el informe de la ASADA recurrida, en los siguientes términos:

“SOBRE LA ADMISIBLE CONFESIÓN DE AUSENCIA DE ESTUDIO TÉCNICO EN ELBARRIO SUR La ASADA sostiene reiteradamente que los alegatos del recurrente constituyen “hechos futuros e inciertos” y, al mismo tiempo, reconoce expresamente que para ejecutar la sustitución de la red del Barrio Sur es necesario realizar previamente un estudio técnico integral en el sector. Tal afirmación constituye una admisión directa de que dicho estudio técnico no existe actualmente. En consecuencia, resulta jurídicamente contradictorio que la ASADA niegue la existencia de riesgo, cuando ella misma acepta que carece del único instrumento técnico idóneo para descartar dicho riesgo, confirmando así el núcleo del presente amparo. II. SOBRE EL PLAZO DE CINCO AÑOS ALEGADO POR LA ASADA La ASADA justifica el plazo de cinco años para la sustitución de la red argumentando limitaciones presupuestarias y administrativas. No obstante, dicho plazo carece de sustento técnico, pues no se encuentra respaldado por ningún estudio hidráulico, estructural o de vida útil de la red del Barrio Sur, tal como lo exige el artículo 44 del Reglamento de ASADAS.

Asimismo, el ARESEP acreditó que la ASADA cuenta con herramientas financieras para presupuestar la sustitución de tubería. Por otro lado, un plazo autoimpuesto, sin respaldo técnico, no puede prevalecer sobre la protección de derechos fundamentales, ni justificar la prolongación indefinida de una infraestructura obsoleta que abastece un servicio público esencial. III. 2 SOBRE EL PLAN ANUAL DE TRABAJO Y EL PRESUPUESTO NO SUPLEN EL ESTUDIO TÉCNICO La ASADA aporta como prueba su Plan Anual de Trabajo 2026 y su presupuesto ordinario, documentos de naturaleza administrativa y financiera que no sustituyen ni equivalen a un estudio técnico integral en el Barrio Sur. Ninguno de estos instrumentos:  Evalúa el estado estructural de la red del Barrio Sur,  Descarta riesgo de fallas en cualquier momento. Por el contrario, dichos documentos confirman que la sustitución de la red ha sido postergada, sin diagnóstico técnico previo, lo que refuerza la omisión denunciada.

IV. SOBRE EL INCUMPLIMIENTO DIRECTO DEL ARTÍCULO 44 DEL REGLAMENTO DE ASADAS La conducta de la ASADA configura un incumplimiento objetivo del artículo 44 del Reglamento de ASADAS, que impone la obligación de contar con un estudio técnico actualizado para:  Determinar el estado de los componentes del sistema,  Su capacidad hidráulica,  Y las mejoras requeridas para proteger y garantizar el servicio. La propia ASADA reconoce que no ha realizado dicho estudio, lo cual constituye una infracción reglamentaria que compromete directamente la seguridad y continuidad del servicio, y que no puede ser trasladada a los usuarios. V. CONCLUSIÓN Lejos de desvirtuar el recurso, el informe de la ASADA confirma los hechos denunciados:  No existe estudio técnico del Barrio Sur,  La red presenta una antigüedad avanzada y de uso muy considerable,  Y la sustitución ha sido postergada sin base técnica. Esta omisión prolongada vulnera el derecho fundamental al agua potable, al mantener a la población usuaria expuesta a un riesgo estructural no evaluado”.

  1. 9En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta la Magistrada Garro Vargas; y,

Considerando:

I.Objeto del recurso. Los recurrentes señalan que, desde el 30 de diciembre de 2023, han solicitado formalmente a la ASADA de Cacao de Nandayure la sustitución de la red de tuberías del Barrio El Sur, cuya infraestructura tiene más de treinta años de antigüedad y presenta riesgo de colapso, situación reconocida tanto por el Instituto Costarricense de Acueductos y Alcantarillados como por la ARESEP. Indican que, pese a que mediante el oficio GSD-UEN-GAR-2024-02344 de 5 de junio de 2024 el ICAA recomendó elaborar un plan de trabajo para la sustitución de la red y ordenó no otorgar nuevas disponibilidades de agua, y a que la ARESEP, en el Informe IN 0028-IA-2025 de 13 de febrero de 2025, confirmó la necesidad de ejecutar dichas mejoras y priorizar el citado barrio, la ASADA no ha elaborado ni comunicado un plan técnico ni un cronograma de ejecución. Afirman que, tras casi dos años desde la primera solicitud, no se ha sustituido ningún tramo de la red ni se ha definido un plazo cierto de intervención, lo que estiman lesiona sus derechos fundamentales.

II.Cuestión preliminar. Antes de entrar a analizar por el fondo el presente recurso de amparo, conviene precisar que este Tribunal únicamente se referirá a los extremos en los que la parte recurrente afirma expresamente que no ha recibido respuesta por parte de la autoridad recurrida. Ello en aplicación del principio dispositivo que rige el proceso constitucional, el cual impide a esta Sala pronunciarse de oficio sobre extremos que no hayan sido alegados como lesivos. En efecto, el artículo 8 de la Ley de la Jurisdicción Constitucional dispone que el procedimiento se rige por el principio dispositivo, lo cual ha sido reiterado por esta Sala en múltiples pronunciamientos, tales como las sentencias N.° 2004-10021 de las 08:47 horas del 10 de setiembre de 2004, N.° 017810-2006 de las 15:32 horas del 12 de diciembre de 2006, N.° 2007-001147 de las 14:31 horas del 31 de enero de 2007, N.° 2007-001610 de las 09:22 horas del 9 de febrero de 2007, N.° 2007-001701 de las 14:34 horas del 13 de febrero de 2007, N.° 2007-003233 de las 11:35 horas del 9 de marzo de 2007, N.° 2007-003266 de las 12:08 horas del 9 de marzo de 2007, N.° 2013005543 de las 14:30 horas del 23 de abril de 2012, N.° 2021018726 de las 09:15 horas del 20 de agosto de 2021, N.° 2021023558 de las 09:30 horas del 19 de octubre de 2021, N.° 2022003709 de las 09:30 horas del 11 de febrero de 2022 y N.° 2022020815 de las 09:30 horas del 6 de setiembre de 2022.

Por esta razón, en atención al principio dispositivo, la Sala estudiará el caso al tenor de la pretensión de interés consignada en el líbelo de interposición, siendo esta: “a) Declarar con lugar el Recurso de amparo en todos sus extremos. b) Que se ordene a la ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO RURAL (ASADA) DE CACAO DE NANDAYURE implementar la sustitución de la red de tuberías del Barrio El Sur, instalando tubería de 100 mm (4”), con sus respectivas válvulas. conforme a lo indicado por el AyA en el oficio GSD-UEN GAR-2024-02344 y reiterado por la ARESEP en el Informe IN-0028-IA-2025, estableciéndose un plazo prudente de un año para ello y advertir que, si es omiso, se le podrá incoar una causa penal por el delito de desobediencia a la autoridad, que la ley castiga con prisión de 15 días a un año, según el artículo 307 del Código Penal. c) Se condene al pago de costas, daños y perjuicios a los recurridos”. Por lo anterior, este Tribunal circunscribirá su análisis, únicamente, a la pretensión transcrita.

III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la parte recurrida haya omitido referirse a ellos según lo prevenido en el auto inicial:

  • a)El 30 de diciembre de 2023, el accionante [Nombre 001] presentó ante la ASADA de El Cacao de Nandayure una solicitud para la modernización prioritaria de la tubería del sector Barrio El Sur (véanse los informes de las autoridades recurridas y la prueba aportada al expediente digital).
  • b)El 5 de junio de 2024, el ICAA emitió el memorando GSD-UEN-GAR-2024-02344 con ocasión de una visita de inspección al sistema de acueducto de Cacao de Nandayure por problemas de presión en el sector Barrio El Sur. Dicho informe, se consignó lo siguiente: “Actualización del sistema: 1. La ASADA cuenta con tres tanques de almacenamiento, uno de concreto de 40 m3 y dos de Polietileno de Alta densidad (PEAD) de 22 m3, para un total de almacena miento de 84 m3. Los tanques se ubican aproximadamente a 89 msnm. 2. El sistema cuenta con variedad de diámetros en su tubería. Tiene diámetros de 100 mm (4”), 50mm (2”), 25mm (1”), 38mm (11/2”) y 32mm (11/4”). En el levantamiento realizado, se encontraron nuevos ramales que no se tenían mapeados. En la figura 1 se presenta el mapa de sistema. 3. La ASADA cuenta con dos pozos, uno legalmente inscrito ante la Dirección de Aguas (sin equipo), no obstante, se encuentra a la espera de resolución de la inscripción del caudal para su aprovechamiento y otro que está en funcionamiento (con equipo), pero, no tiene caudal legalmente concesionado. 4.

Debido a la afectación del fenómeno del niño, los niveles de producción del pozo en funcionamiento bajaron levemente su caudal de operación, por lo tanto, la ASADA implementó racionamiento de 2 pm a 4 pm mitigar la situación. Análisis del sector Barrio del Sur: 1. Parte de la intención de la visita se basó en inspeccionar el sistema en función de una denuncia de un hijo de un abonado en donde se indicaban algunos malestares con respecto a la gestión de la ASADA y al funcionamiento del sistema debido a que el servicio no cumplía con la presión requerida. 2. En dicha inspección se visitó la casa del servicio afectado para realizar una prueba de presión. La prueba se realizó a las 11:00 am, entre las horas recomendadas de mayor demanda del agua que oscila entre 10 am y 2 pm. El resultado de la prueba fue de 35 PSI, que equivalen a 24 m.c.a. aproximadamente, cumpliendo con la pre sión mínima del Reglamento para la Prestación de los Servicios del AyA. 3.

Se revisó el medidor para verificar que no tuviera algún mal funcionamiento o fuga, y se comprobó que estaba en óptimas condiciones. 4. Debido a la Presión estática es de aproximadamente 10 m.c.a. (nivel de tanques 89 m vs. nivel de servicio 73 m), es importante destacar que cumple con el mínimo de presión estática que indica el Reglamento de Prestación de Servicios del AyA (RPS) en su artículo 9. Conclusiones y Recomendaciones: 1. La ASADA ha realizado algunas mejoras en su red de tubería, ya sea aumentando el diámetro existente o extendiendo la red hacia nuevos lugares. 2. Con respecto al caso del servicio afectado, se pudo comprobar que este cumple con el Reglamento para la Prestación de los Servicios del AyA y no presentó ninguna anomalía. 3. A modo de recomendación para la ASADA, se les instó a reparar algunas fugas visibles en algunos puntos de la red. 4. Se les recomendó hacer un plan de trabajo con acuerdo de Junta Directiva para equipar el pozo que se encuentra debidamente inscrito ante la Dirección de Agua para salir de No Factibilidad. 5.

Se recomendó realizar un Plan de Trabajo con acuerdo de Junta Directiva para realizar mejoras paulatinas en el acueducto en diferentes zonas una vez superada la No Factibilidad Técnica. 6. Para el caso particular del caso del Barrio del Sur, se le recomienda a la ASADA realizar un plan de trabajo a mediano y largo plazo para el cambio de la red a 100mm (4”), con sus respectivas válvulas. 7. Se recomienda a la ASADA en el sector del Sur, no brindar más disponibilidades de agua con el fin de no afectar a los usuarios de dicho sector a mediano y corto plazo hasta que se realicen los cambios en la red de distribución” (véanse los informes de las autoridades recurridas y la prueba aportada al expediente digital).

  • c)El 6 de diciembre de 2024, el recurrente presentó una denuncia de inconformidad ante la ARESEP relacionada con la longevidad de la red de tuberías que abastece el sector Barrio El Sur (véanse los informes de las autoridades recurridas y la prueba aportada al expediente digital).
  • d)El 6 de diciembre de 2024, la ARESEP activó su competencia fiscalizadora a partir de la denuncia interpuesta por el promovente (véanse los informes de las autoridades recurridas y la prueba aportada al expediente digital).
  • e)El 11 de febrero de 2025, la Intendencia de Agua de la ARESEP emitió el Informe de Fiscalización IN-0028-IA-2025 como resultado del proceso de fiscalización del sistema de acueducto administrado por la ASADA de El Cacao de Nandayure. En dicho informe, se determinó lo siguiente: III. CONCLUSIONES. 1. La denuncia del Sr. [Nombre 001], se basó en dos puntos: i. Longevidad de la tubería y la no aceptación de los 5 años como plazo de cumplimiento del plan de remediación suministrado por el operador; señalando con ello, que la ASADA prioriza mejoras en la infraestructura del acueducto para otros sectores, mientras que discrimina al Barrio Sur; ii. Solicitar que la instalación de hidrantes debe ir acompañada por una red de tuberías adecuada para garantizar su funcionalidad. 2. El Instituto Costarricense de Acueductos y Alcantarillados, por su parte señala en su oficio GSD-UEN-GAR-2024-02344, sobre la realización de una visita de inspección a la comunidad.

Puntualiza que la Asada cuenta con tres tanques de almacenamiento, que la red de tubería cuenta con variedad de diámetros, cuentan con dos pozos, uno legalmente inscrito, pero sin equipo, pendiente resolución de la inscripción del caudal; el otro está en funcionamiento, con equipo, pero, no tiene caudal legalmente concesionado, situación que debe llamar la atención de la ORAC Región Chorotega, ya que los pozos, para su correcto uso, deben estar legalmente inscritos. Además, AyA realizó pruebas de presión que cumplen con la normativa vigente. Que verificaron el medidor y que se encuentra en óptimas condiciones; que la presión estática a nivel del tanque cumple con la normativa vigente. Asimismo, AyA recomendó implementar un plan de trabajo a mediano y largo plazo para el cambio de la red en el sector descrito a 100mm (4”), con sus respectivas válvulas y accesorios. 3. Que la Sala Constitucional acogió parcialmente el recurso presentado por [Nombre 001] y le ordena al Presidente de la Asada o quien ocupe el cargo, tres puntos a acatar, como lo son: i. ii. iii. a) Solicitud de estudio técnico al Benemérito Cuerpo de Bomberos de Costa Rica en un plazo de ocho días, b) Implementar un plan remedial a la problemática planteada por la falta hidrantes, en un plazo de dos meses, c) realizar la instalación de los hidrantes requeridos en el sector de Barrio El Sur de Cacao de Nandayure, Guanacaste, de acuerdo con el estudio técnico que suministre el Benemérito Cuerpo de Bomberos de Costa Rica, en un plazo de un año.

Dichas acciones y su cumplimiento son el seguimiento prioritario que brindará la ARESEP en atención a este caso. 4. Sobre la visita de campo tanto a la casa de habitación del Sr. [Nombre 001] como de la Asada: 5. Indicarle a señor Ugalde en condición de usuario: i. ii. iii. las condiciones hídricas e hidráulicas que deben regir para la toma de decisión de aumentar el tamaño de tuberías en un sector determinado de la red; la importancia de los estudios técnicos que deben imperar en obras de inversión, previo a decisiones técnicas para la mejora de la infraestructura de todo acueducto; Con base en lo señalado por el abonado y por usuario, y tomando en cuenta la visita realizada por la ORAC AYA (consta el oficio GSD-UEN GAR-2024-02344), se concluye que la prestación del servicio cumple con los estándares mínimos de continuidad, presión y calidad establecida en la normativa vigente; iv. Si bien, dando por cierta la longevidad descrita por el señor abonado de que las tuberías tienen un tiempo de uso considerable, es requerido, que en su momento la ASADA, habiendo cumplido con las disposiciones de la Sala Constitucional, deberá implementar acciones de análisis técnico y definición para sustituir la línea de red existente en el sector Barrio Sur de Cacao y de conformidad con lo señalado en el oficio GSD-UEN-GAR 2024-02344. v. que la atención prioritaria de la ASADA es cumplir con lo dictado por la Sala Constitucional en resolución 28064-2024 según expediente 24 019675-0007-CO. 6.

Se le indica a la Junta Directiva de la ASADA el Cacao de Nandayure: i. ii. iii. IV. Cumplir con la atención de lo que solicite el Estudio técnico de la ASADA para la ubicación, instalación y requisitos técnicos que establezca Bomberos de Costa Rica para garantizar el cumplimiento de lo señalado por la Sala; e igualmente confirmar que la red de hidrantes cubra el 100% de cobertura de los abonados que reciben dicho servicio. Justificar todas las acciones, obras de mantenimiento, operación y ampliación de la red e infraestructura ejecutadas en el acueducto El Cacao cuenten con la debida coordinación con AyA y visto bueno y aprobación por parte de la Junta Directiva; demostrando con ello transparencia y rendición de cuentas. De acuerdo con información financiera suministrada, dispone de recursos para implementar un plan de trabajo a corto y mediano plazo para hacerle frente a las mejoras que requiera el acueducto y cumplir con el mandato de la Sala Constitucional y con lo establecido por la ORAC Región Chorotega en su oficio GSD-UEN-GAR-2024-02344 para el sector Barrio Sur de Cacao de Nandayure.

El plazo y priorización de esa ejecución deberá estar claramente justificada. DISPOSICIONES. Con base en la normativa legal y en las políticas que facultan a la ARESEP en cumplimiento de sus funciones, se emiten las siguientes disposiciones, recordando a aquellos prestadores de servicios regulados, que la inobservancia de estas implicaría un incumplimiento al artículo 33 de la Ley 7593. 1. Al instituto Costarricense de Acueductos y Alcantarillados. En un plazo de 15 días hábiles debe de atender los siguientes puntos: 1. La ORAC regional Chorotega - AyA, deberá incluir en su plan de trabajo, un acompañamiento, seguimiento y control para que la Asada a través de su propuesta de trabajo, cumpla con el mandato de la Sala Constitucional, además de la implementación de los cambios que requiere la red de distribución a la luz de lo señalado en su oficio GSD-UEN-GAR-2024-02344 para el sector Barrio Sur de Cacao de Nandayure. 2.

Constatar que toda labor que atienda la ASADA El Cacao de Nandayure, respecto a mejoras por implementar en las redes del acueducto que opera, reflejen transparencia y rendición de cuentas y tomar en cuenta las necesidades de todos los sectores del sistema de acueducto (incluido el sector Barrio Sur de Cacao). 2. A la Asada El Cacao de Nandayure, Guanacaste. En un plazo de 15 días hábiles debe de atender los siguientes puntos: 1. Debe implementar un plan de trabajo con su cronograma aprobado por la Junta Directiva y que cuente con el visto bueno de la ORAC regional Chorotega AyA del diseño e implementación de todo lo relacionado con el cumplimiento del mandato de la Sala Constitucional, según los tres puntos que solicita la Resolución N°28064-2024. 2. Deben planificar a mediano plazo los cambios necesarios para iniciar la actualización de la red de distribución, valorar lo que corresponda técnicamente en la mejora del sector Barrio del sur.

En el caso de que la ASADA reciba donaciones de tubería, deben priorizar su instalación de manera transparente, con una rendición de cuentas justificada para los usuarios y abonados de la ASADA El Cacao. a. Suministrar los resultados e implementación del estudio técnico integral de la ASADA para la ubicación, instalación y requisitos técnicos solicitados por Bomberos de Costa Rica. b. Aportar la Justificación de las acciones y labores implementadas por la ASADA El Cacao aplicado al rubro de instalación descrito en un monto por ₡ 7 592 748,95 y todas aquellas otras labores ejecutadas que cuente con el debido visto bueno y aprobación por parte de la Junta Directiva. 3. Aporta la información pendiente referente a: a. Estudio técnico de la ASADA para la ubicación, instalación y requisitos técnicos solicitados por Bomberos de Costa Rica. b. Justificación de las acciones y labores implementadas por la ASADA El Cacao con el debido visto bueno y aprobación por parte de la Junta Directiva” (véanse los informes de las autoridades recurridas y la prueba aportada al expediente digital).

  • f)El 13 de febrero de 2025, la Intendencia de Agua de la Autoridad Reguladora de los Servicios Públicos tuvo por acreditado que la red de distribución del sector Barrio El Sur presenta una antigüedad considerable, determinó que la prestación del servicio de acueducto en dicho sector cumple con los estándares mínimos de continuidad, presión y calidad establecidos en la normativa vigente, no acreditó la existencia de una afectación actual, grave o inminente a la continuidad del servicio de agua potable y no calificó la infraestructura del sistema de acueducto como colapsada o inutilizable (véanse los informes de las autoridades recurridas y la prueba aportada al expediente digital).
  • g)El 13 de febrero de 2025, la Autoridad Reguladora de los Servicios Públicos ordenó a la ASADA planificar a mediano plazo la actualización de la red de distribución del sector Barrio El Sur (véanse los informes de las autoridades recurridas y la prueba aportada al expediente digital).
  • h)El 13 de febrero de 2025, la Autoridad Reguladora de los Servicios Públicos no avaló ni constató la existencia de un plazo formal de cinco años para la sustitución de la red de tuberías del sector Barrio El Sur (véanse los informes de las autoridades recurridas y la prueba aportada al expediente digital).
  • i)El 7 de marzo de 2025, el ICAA remitió a la ARESEP el plan de trabajo aprobado por la Junta Directiva de la ASADA de El Cacao de Nandayure, con el visto bueno de la Oficina Regional de Acueductos Comunales de la Región Chorotega (véanse los informes de las autoridades recurridas y la prueba aportada al expediente digital).
  • j)La Intendencia de Agua de la ARESEP programó una visita de campo para la semana comprendida del 02 al 06 de marzo de 2026 al sistema de acueducto administrado por la ASADA de El Cacao de Nandayure para verificar el cumplimiento de las disposiciones del Informe IN-0028-IA-2025 (véanse los informes de las autoridades recurridas y la prueba aportada al expediente digital).
  • k)El 10 de diciembre de 2025, el ICAA, a través del reporte de Análisis Ambiental sobre la Calidad del Agua, acreditó que el sistema de acueducto administrado por la Asada de Cacao de Nandayure suministra agua potable de manera continua y con parámetros de calidad aptos para consumo humano, sin que se haya constatado afectación en la cantidad, continuidad o calidad del servicio (véanse los informes de las autoridades recurridas y la prueba aportada al expediente digital).

IV.Análisis por el fondo. Los recurrentes señalan que, desde el 30 de diciembre de 2023, han solicitado formalmente a la ASADA de Cacao de Nandayure la sustitución de la red de tuberías del Barrio El Sur, cuya infraestructura tiene más de treinta años de antigüedad y presenta riesgo de colapso, situación reconocida tanto por el Instituto Costarricense de Acueductos y Alcantarillados como por la ARESEP. Indican que, pese a que mediante el oficio GSD-UEN-GAR-2024-02344 de 5 de junio de 2024 el ICAA recomendó elaborar un plan de trabajo para la sustitución de la red y ordenó no otorgar nuevas disponibilidades de agua, y a que la ARESEP, en el Informe IN 0028-IA-2025 de 13 de febrero de 2025, confirmó la necesidad de ejecutar dichas mejoras y priorizar el citado barrio, la ASADA no ha elaborado ni comunicado un plan técnico ni un cronograma de ejecución. Afirman que, tras casi dos años desde la primera solicitud, no se ha sustituido ningún tramo de la red ni se ha definido un plazo cierto de intervención, lo que estiman lesiona sus derechos fundamentales.

Sobre este particular, conviene recordar que esta Sala ha desarrollado una línea jurisprudencial clara y reiterada en torno al derecho fundamental de acceso al agua potable, en cuanto presupuesto indispensable para la efectividad de los derechos a la vida y a la salud, así como para el adecuado funcionamiento de los servicios públicos esenciales. De igual manera, este Tribunal ha reiterado que el acceso al agua potable constituye una condición mínima e indispensable para garantizar un adecuado equilibrio físico, psíquico y ambiental de las personas, reconociendo que el suministro de agua apta para el consumo humano forma parte del contenido constitucionalmente protegido del derecho a la vida y a la salud. Así, a modo de ejemplo, en la sentencia n.°2025-008608 de las 09:30 horas del 21 de marzo de 2025, se resolvió, en lo conducente, lo siguiente:

IV.Sobre el derecho a consumir agua potable. Este Tribunal Constitucional ha reconocido en su jurisprudencia que el derecho a la vida y a la salud son derechos fundamentales cuyo goce exige el acceso al agua potable. Para que el ser humano disfrute de salud requiere que se le garanticen un conjunto de condiciones mínimas necesarias para alcanzar un adecuado y armónico equilibrio psíquico, físico y ambiental, así como para impedir el surgimiento de disfunciones que alteren su pleno crecimiento y desarrollo. Una de esas condiciones es precisamente el suministro de agua apta para el consumo humano. Por lo que esta Sala ha concluido que, como parte del Derecho de la Constitución, existe un derecho fundamental al suministro de agua potable. Así, en Sentencia N° 2003-04654, de las 15:44 horas del 27 de mayo del 2003, reiterada en la N° 2018-014649, de las 9:20 horas del 7 de setiembre de 2018, esta Sala resolvió: “(…) La Sala reconoce, como parte del Derecho de la Constitución, un derecho fundamental al agua potable, derivado de los derechos fundamentales a la salud, la vida, al medio ambiente sano, a la alimentación y la vivienda digna, entre otros, tal como ha sido reconocido también en instrumentos internacionales sobre Derechos Humanos aplicables en Costa Rica: así, figura explícitamente en la Convención sobre la Eliminación de todas las formas de discriminación contra la mujer (art. 14) y la Convención sobre los Derechos del Niño (art. 24); además, se enuncia en la Conferencia Internacional sobre Población y el Desarrollo de El Cairo (principio 2), y se declara en otros numerosos del Derecho Internacional Humanitario.

En nuestro Sistema Interamericano de Derechos Humanos, el país se encuentra particularmente obligado en esta materia por lo dispuesto en el artículo 11.1 del Protocolo Adicional a la Convención Americana sobre Derechos Humanos en Materia de Derechos Económicos, Sociales y Culturales ("Protocolo de San Salvador" de 1988), el cual dispone que: "Artículo 11. Derecho a un medio ambiente sano 1. Toda persona tiene derecho a vivir en un medio ambiente sano y a contar con servicios públicos básicos". Además, recientemente, el Comité de Derechos Económicos, Culturales y Sociales de la ONU reiteró que disponer de agua es un derecho humano que, además de ser imprescindible para llevar una vida saludable, es un requisito para la realización de todos los demás derechos humanos”.

V.Antecedente ante este Tribunal. Previo del análisis del presente asunto, es importante mencionar que esta Sala Constitucional ya analizó las condiciones del servicio de agua en el acueducto de Esterillos. Así, mediante 2018-021434 de las 09:20 horas del 21 de diciembre de 2018, dictada dentro del expediente no. 18-018889-0007-CO, se estableció lo siguiente:

“IV.- Sobre el caso concreto. En el presente caso, de las pruebas aportadas al expediente, así como, de lo informado bajo juramento por las autoridades del Instituto recurrido, se constata que ha existido una amenaza ilegítima al derecho a la salud de la persona amparada y demás miembros de la comunidad de Esterillos, así como una violación a su derecho al buen funcionamiento de los servicios públicos y, al acceso al agua potable. De los autos se desprende que el Instituto Costarricense de Acueductos y Alcantarillados es la entidad responsable de brindar el servicio de agua potable a la comunidad afectada la cual, a la fecha no ha logrado solventar el problema gestado. Es más, desde el 22 de diciembre de 2016, fecha en que asumió el acueducto, el Instituto recurrido ha realizado diversos estudios, con el fin de establecer una solución a la problemática de la concentración de hierro y manganeso que presenta el sistema de Esterillos- Bejuco, lo que produce una coloración oscura en el agua, lo cual, según lo indicado por el Encargado del Laboratorio Nacional de Aguas del Instituto "....la suma de las concentraciones de Hierro y Manganeso, no cumplen con el Reglamento para la Calidad del Agua Potable 38924-8, lo cual afecta la estética del agua y el rechazo visual por parte de los usuarios del Acueducto.

No obstante, es importante aclarar que el consumo del agua no causa ningún daño a la Salud". De manera, que si bien el agua que se distribuye no es perjudicial para la salud, lo cierto es que no cumple con el Reglamento para Calidad de Agua Potable. Así las cosas, han transcurrido dos años y el Instituto recurrido no ha sido capaz de resolver el problema del acueducto, ni de presentar las medidas correctivas necesarias que garanticen un adecuado funcionamiento de este implemento, pese a que en las pruebas emitidas por el Laboratorio Nacional de Aguas, son contudentes al respecto. Así las cosas, lleva razón la recurrente en cuanto a la calidad del agua que le es abastecida por la autoridad recurrida. En virtud de lo anterior, las autoridades del AyA han omitido su deber constitucional de garantizar la salud de los habitantes de esa comunidad y el buen funcionamiento de los servicios públicos.

Estos principios constitucionales deben ser observados y respetados, en todo momento y sin excepción alguna, por los funcionarios públicos encargados de su gestión y prestación y constituyen una obligación jurídica de carácter indeclinable, impuesta a cualquier ente u órgano administrativo por su eficacia normativa directa e inmediata, habida cuenta que el bloque o parámetro de legalidad (artículo 11, de la Constitución Política) al que deben ajustarse en sus actuaciones está integrado, entre otros elementos, por los principios generales del derecho administrativo (artículo 6, de la Ley General de la Administración Pública). En mérito de lo expuesto, debido a la vulneración prolongada del derecho fundamental al agua potable y a un servicio público eficiente, lo procedente es declarar con lugar el recurso y, en consecuencia, ordenar al Instituto recurrido implementar las mejoras correspondientes en el sistema de acueducto que administra y abastece a las diferentes comunidades de Esterillos, y se ajuste a lo ordenado en el Reglamento de Control de Calidad de Agua.

Lo anterior, incluye tomar las medidas necesarias con el fin de disminuir el grado de riesgo, para la salud de la población, y vulnerabilidad de los sistemas, así como dar una vigilancia continua a la calidad del agua potable que consumen los habitantes de la comunidad afectada, para cuyo efecto también deberá el Instituto recurrido realizar los trabajos para garantizar la calidad del recurso hídrico de mantenimiento que ese acueducto requiera. Además, se le recuerda a la recurrida que cuando se presenta el problema denunciado, debe asegurar la repartición de agua potable con camiones cisterna en la zona”. (Lo destacado y subrayado no corresponde al original).

En el presente asunto, la parte recurrente sostiene que la antigüedad de la red de tuberías del sector Barrio El Sur del acueducto administrado por la ASADA de Cacao de Nandayure constituye, por sí misma, una vulneración a sus derechos fundamentales al acceso al agua potable, a la salud y a la vida, al estimar que dicha infraestructura presenta un riesgo de colapso que no ha sido atendido oportunamente por las autoridades competentes. Sin embargo, un examen cuidadoso, integral y técnicamente fundado del material probatorio incorporado al expediente conduce a una conclusión distinta.

En primer término, resulta determinante constatar que el servicio público de abastecimiento de agua potable que se brinda en el sector Barrio El Sur cumple, a la fecha, con los estándares mínimos de continuidad, presión y calidad exigidos por la normativa vigente. En efecto, las pruebas de presión realizadas por el ICAA, efectuadas durante la visita de inspección al sistema, reflejaron valores que superan el umbral mínimo establecido en el Reglamento para la Prestación de los Servicios del AyA, mientras que los análisis de laboratorio practicados con posterioridad acreditaron que el agua suministrada es apta para el consumo humano, sin presencia de parámetros que comprometan su potabilidad.

A partir de esos resultados técnicos, no se desprende la existencia de interrupciones en el suministro, disminuciones en la cantidad entregada ni afectaciones en la calidad del agua, elementos que, de conformidad con la jurisprudencia de esta Sala, resultan indispensables para tener por configurada una vulneración actual del derecho fundamental al acceso al agua potable. Por el contrario, los datos objetivos disponibles permiten afirmar que el servicio se presta de manera regular y conforme a los estándares exigidos, circunstancia que debilita de forma significativa la tesis de una lesión constitucional en curso.

Ahora bien, es cierto que las autoridades técnicas han reconocido que la red de distribución presenta una antigüedad considerable, lo cual ha motivado la emisión de recomendaciones orientadas a su modernización progresiva. No obstante, dicha constatación no puede ser interpretada, sin más, como sinónimo de una amenaza real e inminente a los derechos fundamentales de las personas usuarias, pues la longevidad de la infraestructura constituye un dato relevante para la planificación administrativa, pero solo adquiere relevancia constitucional cuando se traduce en una afectación efectiva o en un riesgo técnicamente acreditado para la salud o la vida, extremos que no han sido demostrados en este caso.

En este punto, cobra especial importancia el actuar desplegado por las autoridades competentes, pues del expediente se desprende que el ICAA no solo efectuó inspecciones técnicas al sistema, sino que además formuló recomendaciones específicas dirigidas a la elaboración de un plan de trabajo para la mejora gradual del acueducto, incluyendo la sustitución de la red a mediano y largo plazo. De forma complementaria, la ARESEP activó su potestad fiscalizadora a raíz de la denuncia presentada, emitió disposiciones concretas a la ASADA y al ente rector, verificó la existencia de recursos financieros para planificar las mejoras y, finalmente, programó una visita de campo para constatar el cumplimiento de dichas disposiciones. Este encadenamiento de actuaciones permite descartar la existencia de inercia administrativa, desatención del problema o negativa institucional a adoptar medidas correctivas. Por el contrario, lo que se observa es un abordaje técnico y progresivo de la situación, conforme a las competencias legalmente asignadas a cada órgano y a los procedimientos que rigen la ejecución de obras de mejora en sistemas de acueductos administrados por asociaciones comunales. En tales condiciones, no resulta jurídicamente viable sostener que la Administración haya incumplido su deber de tutela del servicio público esencial.

Desde esta óptica, la pretensión de que este Tribunal ordene la sustitución inmediata e integral de la red de tuberías dentro de un plazo perentorio, bajo apercibimiento penal, carece de sustento constitucional, en tanto supondría desplazar el criterio técnico-administrativo de las autoridades especializadas sin que exista una lesión actual a derechos fundamentales que lo justifique. La jurisdicción constitucional no está llamada a sustituir la planificación técnica ni a imponer soluciones estructurales cuando el servicio se presta conforme a los estándares mínimos exigidos y existen acciones administrativas en curso orientadas a su mejora.

Finalmente, esta conclusión se armoniza plenamente con la jurisprudencia constitucional invocada por la parte recurrente, en la cual se ha reconocido el derecho fundamental al acceso al agua potable como presupuesto indispensable para la vida y la salud. Sin embargo, a diferencia de aquellos supuestos, en los que se acreditó el incumplimiento de los estándares reglamentarios o una afectación prolongada y verificable del servicio, en el caso bajo examen se ha constatado expresamente que el agua suministrada cumple con los parámetros técnicos exigidos y que las autoridades competentes han adoptado medidas concretas para atender las necesidades de mejora del sistema. Por consiguiente, al no haberse demostrado una afectación actual, grave o inminente, ni una omisión administrativa que haga necesaria la intervención inmediata de esta Sala, lo alegado por la parte recurrente se ubica en el ámbito de hechos futuros e inciertos, cuya eventual materialización no puede ser anticipada por esta jurisdicción constitucional, máxime cuando existen actuaciones administrativas verificables orientadas a prevenir y corregir eventuales deficiencias en la infraestructura del acueducto.

En virtud de las consideraciones esgrimidas, lo procedente es declarar sin lugar el recurso, como en efecto se hace.

V.Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial No. 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara sin lugar el recurso.
