Document Review *CO* Decision No. 2025026093 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at twelve fifty p.m. on catorce de agosto de dos mil veinticinco.
Appeal for constitutional relief (recurso de amparo) processed under expediente número 25-008408-0007-CO, filed by Nombre01, identity card CED01, against MUNICIPALIDAD DE LIMÓN, EMPRESAS BERTHIER EBI DE COSTA RICA S.A., MINISTERIO DE SALUD, and SECRETARIA TÉCNICA NACIONAL AMBIENTAL.
FINDINGS OF FACT:
As can be seen from even a cursory reading of the narrative constituting the factual basis of the amparo proceeding filed, it contains a series of assertions wholly at odds with reality. Accordingly, with customary respect, we shall explain what actually occurred. The sanitary landfill known as “El Tomatal” is located within Cantón Central de Limón and is owned by my client, which manages it directly using cutting-edge technology and the best environmental practices available in the field. The current useful life of that landfill is approximately 29 years, according to an estimate made in 2023 by the Municipalidad de Limón itself in the aforementioned application for precautionary relief, in which it stated as follows: “…as of March 2023, with the tonnage at that time, which was substantially lower than what it is receiving today, its useful life was approximately 29 years….” It is therefore an asset of particular interest not only to the company, but also to the canton and the nation, due to the shortage of sanitary landfills in the country.
My client acknowledges that it made a few trips with its collection trucks, which are modern and designed to prevent leachate (lixiviados) from escaping and consequently contaminating the areas through which they travel, transporting solid waste from the GAM to the sanitary landfill (relleno sanitario) known as “El Tomatal,” so that such waste could receive the corresponding technical treatment. My client also acknowledges, as it did before the Tribunal Contencioso Administrativo y Civil de Hacienda when responding to the aforementioned precautionary measure (medida cautelar), that no request was made to the municipal authority for a permit or authorization to transport such solid waste, for the simple reason that none was required. For that same reason, no consultation or notification was made—as the appellant (recurrente) considers necessary—without her identifying any legal provision—of statutory or higher rank—on which she bases such an assertion.
The foregoing is highly relevant because, insofar as Costa Rica is a State governed by the rule of law, which the appellant also appears to disregard, under Article 18 of the Ley General de la Administración Pública—which codifies the Principle of Freedom of Will (Principio de Autonomía de la Voluntad)—my client is authorized to do anything that is not expressly prohibited. That statutory provision is a typical example of what are known as “echo” provisions (normas “eco”), insofar as their content reiterates, repeats, or restates a higher-ranking provision—in this case, a constitutional one. We refer specifically to Article 28 of our Constitution (Carta Magna), which likewise codifies the Principle of Freedom of Will. Accordingly, that Principle of Freedom of Will has both statutory and constitutional rank, which the appellant apparently does not understand, as she seems to believe—no one knows how or why, since she provides no explanation whatsoever—that there is a prohibition—which is, of course, entirely incorrect—against my client transporting solid waste from one canton to another in technologically advanced trucks designed precisely to eliminate the risk of contamination from leachate.
Moreover, the amount of solid waste that was transported at the time to the sanitary landfill known as El Tomatal has no material impact on that sanitary landfill’s useful life. For the appellant’s further clarification, the sanitary project known as El Tomatal does not belong to any of the cantons of the Provincia de Limón; it is owned by my client, and therefore to believe that my client is barred from transporting solid waste from other regions to that landfill under special circumstances is to fail to understand that the issue of “garbage” transcends the merely local or cantonal sphere and is undeniably a matter of national interest. Indeed, the claimant’s own statements reveal her selfishness and complete lack of solidarity with the other Costa Rican cantons, insofar as she asserts that “the imminent closure of the La Carpio sanitary landfill is a problem that falls exclusively within the responsibility of the municipalities of the Gran Área Metropolitana (GAM), and the people of Limón bear no responsibility for this situation, since the Ley para la Gestión Integral de Residuos (Ley N° 8839) and the Código Municipal (artículo 8) clearly establish that each local government must independently manage its own waste.” The appellant’s statement demonstrates her lack of awareness that the aforementioned sanitary landfill is not owned by any of the Municipalidades del Cantón de Limón.
Thus, if we adhere to the text she reproduces in her appeal (Recurso), we would have to conclude that the cantón de Limón does not have its own sanitary landfill because, as stated and reiterated, the landfill known as El Tomatal is privately owned by my client and, under the model adopted by the State in the broad sense for more than thirty years, solid-waste treatment has been handled by private enterprise through what is known as a delegated public service (servicio público delegado). Faced with that reality, then, what are we to do? Are we to let the cantón de Limón drown in garbage by applying the “why should I care?” attitude that the claimant expresses toward the cantons of the GAM? Thus, the appellant’s narrative that an environmental burden that it is not required to bear is being imposed on Limón not only demonstrates the aforementioned lack of awareness regarding ownership of the landfill, but also makes it clear that she cares about nothing in this country other than the canton, or perhaps also the Provincia de Limón, and that the remaining cantons may drown in solid waste.
By way of example, we have selected solid-waste procurement contracts (contratación de desechos sólidos) entered into by several of the country’s Municipalidades, demonstrating that transporting waste to other cantons or provinces is a current practice used to address solid-waste treatment in Costa Rica. The preceding table demonstrates through documentary evidence (prueba documental) that the Municipalidades de Alajuela, Atenas, Heredia, Liberia, Los Chiles, Sarapiquí y Tilarán currently dispose of their waste in Miramar, Puntarenas, at the sanitary landfill operated by TECNO AMBIENTE; therefore, the claimant Municipality’s contention that EBI has a singular obligation to transport all solid waste from the municipalities located in the Gran Área Metropolitana solely to projects located within that same area is irrational, when the reality is that there is no legal impediment to transporting waste from one province to another and that, were any provision to that effect to exist or be enacted, garbage collection throughout the country would collapse.
As the example cited in the preceding table shows, other provincial-capital Municipalidades contracted with another company that must transfer the waste to another province in order to provide a solution for treating the solid waste of the respective municipalities. Along those lines, it goes without saying that such transportation is clearly of undeniable public interest, as it contributes to protecting the environment, public health, and human life.
In addition, the vehicle has substantial tonnage capacity, making transportation more efficient; that is, a single trip can accommodate a significant volume, thereby requiring fewer trips and further reducing the already minimal or nonexistent risk of any type of leachate or liquid spill. For further detail, the specifications of one of EBI’s units are set out below:
1V) There is no statutory or constitutional prohibition whatsoever against the intercantonal transportation of solid waste. Just as the issue of authorization was addressed in the preceding section, if the claimant municipal entity believes that my client’s actions are prohibited by any provision—which must necessarily be of statutory or constitutional rank—it must not only say so but prove it by identifying the applicable provision or provisions. This is absolutely necessary not only because of the aforementioned Principle of Legality (Principio de Legalidad), but also because of the Principle of Freedom of Will, which is regulated both statutorily and constitutionally in our country. In that regard, the Ley General de la Administración Pública provides: “Article 18.- 1. In dealings with the Administration, an individual shall be entitled to do anything that is not prohibited. 2. Anything that prevents or disrupts the lawful exercise of administrative powers or individual rights, as well as anything that violates public order, morality, or accepted standards of conduct, shall be deemed prohibited.” The constitutional regulation of that Principle is found in Article 28 of our Constitution, which states: “ARTICLE 28.- No one may be harassed or persecuted for expressing their opinions or for any act that does not violate the law.
Private actions that do not harm morality or public order or prejudice third parties are beyond the reach of the law. Nevertheless, clergy members or laypersons may not engage in political propaganda in any manner by invoking religious grounds or using religious beliefs as a means.” The foregoing provisions are nothing other than the codification of the Principle of Freedom of Will, under which my client, like any other private party subject to the Administration (administrado), may engage in any conduct with complete freedom and without consequence, provided that it is not expressly prohibited. As noted above, the Local Government cannot merely make assumptions because, in a State governed by the rule of law such as Costa Rica, it is not legally permissible to assume or presume that particular conduct or an activity is prohibited; it must necessarily be proven that it is expressly prohibited.
In this regard, it is important to note that, as stated in the response to the allegations of fact (contestación de los hechos) in this action, the existing provision specifically governing waste transportation is the Reglamento sobre el manejo de residuos sólidos ordinarios, which is decreto número 36093 and provides for such transportation in its artículos 29 a 32. My client complies with it fully and even meets standards higher than those required by the regulation.
For this purpose, it is important to review those regulations in detail: “On the Transportation of Ordinary Solid Waste. Article 29.-Vehicles used for the collection and transportation of ordinary solid waste must ensure proper provision of the service and prevent the discharge of liquids and leachate. If open-bed or stake-bed vehicles are used, a cover or tarpaulin that completely covers the waste must be placed over it during collection and transportation. Such vehicles may not be used to transport persons or food. Leachate stored in the vehicle and generated during the collection and transportation of ordinary solid waste shall be deposited at the final disposal site or at a wastewater treatment plant duly authorized by the Ministry of Health. Article 30.-Vehicles and equipment used for the collection and transportation of ordinary solid waste must be maintained in proper operating condition.
Article 31.-At the end of the workday, the vehicles and equipment shall be washed so as to maintain them in a condition that does not endanger human health. Wash water from vehicles and equipment used for collection and transportation must be conveyed to a collection and treatment system. Article 32.-Vehicles and equipment used for the transportation of ordinary solid waste must comply with the provisions of the Ley de Tránsito por Vías Públicas Terrestres.” The legislation is clear in this regard: it requires those who transport solid waste to use properly equipped vehicles that transport it without spillage and without any discharge of liquids or leachate, a situation that the petitioner Municipality has at no time shown to have occurred. Moreover, as explained in the preceding section, the type of trailer used by EBI for this kind of transportation has the special features necessary to convey the waste safely to its final destination.
IV.- APPLICATION OF THE PRINCIPLE OF THE NECESSARY CONNECTION BETWEEN SCIENCE AND TECHNOLOGY. In this regard, this Constitutional Chamber has interpreted the necessary connection between science and technology when asserting the existence of an environmental hazard. To that end, we cite the ruling in Resolution No. 12716-2012 of the Constitutional Chamber, issued at 16:01 on 12 de setiembre del 2012: “…this translates into the need to support decision-making in this area with technical studies, both with respect to acts and to provisions of a general nature—whether statutory or regulatory—from which derives the requirement of ‘adherence to science and technology,’ thereby constraining the Administration’s discretion in this area.” “The environmental principle of ‘adherence to science and technology,’ which governs environmental matters, inasmuch as administrative decisions that may affect the environment require technical support, and, as such, limit and constrain the Administration’s discretion in its actions.” “This proceeds from the principle that environmental rules must have a technical basis, because their application must begin with limits that determine the conditions governing the use and exploitation of natural resources.” To understand it otherwise, that is, as the appellant does, would give any natural or legal person carte blanche to invoke that principle and file thousands of complaints within a short period without further support, thereby overwhelming the justice system, whether administrative or judicial.
But that is not so; the principle under discussion is not intended to provide complete exemption from the burden of proof borne by every complainant. And in this case, as stated, the municipal entity does not meet even that minimum burden, since, as noted, it does not submit so much as a photograph into the record. An example may help explain my client’s position concerning the application of this principle. Let us imagine that, merely because the idea occurs to them or because they think it might be happening, an individual decides to file environmental complaints against every public institution in the Cantón de Limón—including, of course, the municipal entity that is the petitioner here. In those complaints, the individual alleges that the sanitary facilities of the public institutions contaminate the soil and subsoil and, consequently, the groundwater, because their discharges flow directly into them, as they are not connected to the corresponding sewer system.
The individual then invokes the precautionary principle (Principio Precautorio) as the basis for the complaint but, as in this case, provides not the slightest evidence in support of the allegation. What would be done in such a case? Would a precautionary measure (medida cautelar) prohibiting the use of sanitary facilities be ordered on the basis of the precautionary principle? Of course not; that would be an utterly absurd legal proposition. It would be an untenable hypothesis to understand, as the appellant does, that it may come forward and make absurd assertions such as those contained in its appeal in order to prevent an activity that is not only lawful but, as explained, necessary and indispensable precisely to protect the environment and people’s health and lives. The inter-cantonal transportation of solid waste is indispensable, considering that, as demonstrated by the evidence offered, dozens of cantons without a sanitary landfill (Relleno Sanitario) are beginning to be inundated with garbage, insects, vultures, rodents, etc., thereby endangering public health.” It requests that the appeal be denied.
BREAKDOWN OF TABLE PROVIDED:
“REPORT: MS-DRRSHC-ARSL-IT 06210-2024. INSPECTION DATE: 21 de noviembre 2024. FINDINGS AND/OR ACTIONS: CONCLUSION. During the visit and inspection conducted, no deficiencies were identified that warranted the issuance of a sanitary order (orden sanitaria); however, upon identifying a lack of maintenance in the green areas of the self-service fuel area, the accompanying person was informed at that time, and he explained that this was included in the green-area maintenance work plan. Likewise, monitoring and control visits by this Área Rectora will continue. REPORT: MS-DRRSHC-ARSL-IT 06365-2024. INSPECTION DATE: 11 de diciembre DEL 2024. FINDINGS AND/OR ACTIONS: CONCLUSION. During the visit and inspection conducted, no deficiencies were identified that warranted the issuance of a sanitary order; likewise, monitoring and control visits by this Área Rectora will continue. REPORT: MS-DRRSHC-ARSL 00535-2025.
INSPECTION DATE: SUBJECT: “ANALYSIS OF THE 2024 SIXTH QUARTER SOLID WASTE REPORT / EBI CR SANITARY LANDFILL.” FINDINGS AND/OR ACTIONS: CONCLUSION. Therefore, it is recommended that the Area Directorate approve this report submitted by the regulated party. Furthermore, it is reported that the total amount of waste received during this quarter was recorded. REPORT: CARTA-MS-DRRSHC-ARSL-00481-2025. INSPECTION DATE: 30 de enero del 2025. FINDINGS AND/OR ACTIONS: CONCLUSION. Given that the main aeration chamber is still not operating because it has been undergoing maintenance since the end of 2024, and given the limited progress identified in the execution of the work due to the unforeseen circumstances described above, the company is temporarily using one sedimentation tank as an aeration chamber and the other as a sedimentation tank. In view of the foregoing, and given the increase in solid waste received from the GAM for treatment by that company as a result of the technical closure, there is concern that this measure may impair or affect its operating capacity.
Therefore, it is respectfully requested that you use your good offices to arrange an inspection visit by Ingeniería Regional in order to obtain a technical opinion regarding this situation. REPORT: CARTA-MS-DRRSHC-ARSL-00683-2025. INSPECTION DATE: 17 de febrero del 2025. FINDINGS AND/OR ACTIONS: CONCLUSION. As a result of the inspection, no inconsistencies were detected in Cell 3 at the time of the visit, nor in other process areas of Parque Tecnología Ambienta; however, no progress has been made on maintenance work for the wastewater treatment system, which is why it is not advisable for the facility to be considered an option for receiving solid waste from the GAM under the circumstances described. In view of the foregoing, sanitary order MS-DRRSHC-ARSL-00046-2025 is served on the regulated party, granting a period of 10 business days for the facility’s wastewater treatment system’s main aeration chamber to become operational, as it forms part of the water purification process and is necessary to ensure the system’s proper operation.
Furthermore, no quantities of solid waste other than those included in the initial proposal submitted to this Governing Authority may be admitted. A joint follow-up visit with Ingeniería Regional is recommended to verify compliance with the notified administrative act once the period granted has expired. Sanitary order MS DRRSHC-ARSL-00046-2025-OS was issued, ordering as follows: “The facility shall take the necessary actions to place the main aeration chamber of the facility’s wastewater treatment system into operation, as it forms part of the water purification process and is necessary to ensure the system’s proper operation. Furthermore, no quantities of solid waste other than those included in the initial proposal submitted to this Governing Authority may be admitted” (the Nombre02 is not in the original). FINDINGS AND/OR ACTIONS: CONCLUSIONS. 1. Regulatory noncompliance was found in the management of solid waste within Parque de Tecnología Ambiental EBI, specifically regarding the compaction, covering, and disposal of contaminated material, which could cause environmental and public-health impacts. 2. The accumulation of waste without proper covering has fostered the proliferation of scavenging wildlife, posing a risk to public health and the environment. 3. The company must implement immediate corrective actions to ensure compliance with the Reglamento de parques ambientales para la separación, tratamiento, aprovechamiento y disposición final de residuos sólidos (Decreto N° 44421). Por tanto, the Área Rectora de Salud de Limón, as the Governing Health Authority, is advised to: I. By applying the applicable special measures prescribed by law, require the administration of Parque de Tecnología Ambiental EBI to provide the following: 1.
A detailed intervention plan, together with its corresponding schedule of activities, which must be submitted to this Unidad de Rectoría de la Salud within a maximum period of 8 business days from the corresponding notice. At a minimum, the plan must include: a. Corrective actions for the proper compaction and covering of solid waste, in compliance with current regulations. b. Proper disposal of the contaminated material or soil, ensuring that it is not used as cover material, ensuring its treatment, and providing a stockpile of cover material in accordance with the applicable regulations. c. A proposal for measures to control scavenging wildlife, considering options such as optimizing waste covering and implementing strategies to prevent its presence. 2. If the intervention plan specified in the preceding paragraph is approved, implementation of the required actions must begin immediately upon the corresponding notice.
II. Continue periodic joint inspections by Nivel Local and Nivel Regional, as coordinated before this report was prepared, to monitor compliance with health and environmental requirements and ensure continuous improvement in site management. Accordingly, sanitary order MS-DRRSHC-ARSL-00062-2025 OS is issued, ordering as follows: I. By applying the applicable special measures prescribed by law, require the administration of Parque de Tecnología Ambiental EBI to provide the following: 1. FINDINGS AND/OR ACTIONS: CONCLUSIONS. 1. Significant progress has been observed in removing soil contaminated with waste, with a focus on its proper final disposal in the corresponding cells. 2. Waste compaction and covering work continues in accordance with regulations, with an estimated 80% progress in closing the cells currently in use. 3. A reduction in the presence of scavenging birds has been recorded, although strengthening control measures is recommended. 4.
Construction of the new cell is progressing according to schedule, with the installation of the geomembrane being particularly noteworthy. 5. Areas for improvement have been identified, including the need to record the Wastewater Treatment System’s outlet flow daily and to eliminate mosquito larvae from stored tires. RECOMMENDATIONS. 1. Continue and expedite the complete removal of contaminated material and its transfer to the corresponding cell. 2. Strengthen actions to reduce scavenging birds and evaluate the effectiveness of the measures implemented. 3. Ensure that the outlet flow is recorded daily in the Wastewater Treatment System logbook. 4. Implement preventive measures to avoid water accumulating in tires or other materials that could serve as mosquito breeding sites. 5. Continue periodically monitoring progress and compliance with the Reglamento de Parques Ambientales, ensuring that all activities are carried out in accordance with current regulations.” “It is important to indicate that health order MS-DRRSHC-ARSL-00046-2025-OS, issued pursuant to report CARTA-MS-DRRSHC-ARSL-00683-2025, ordered as follows: “The establishment shall take the necessary actions to place the main aeration chamber of the facility’s wastewater treatment system into operation, as this forms part of the water purification process, in order to ensure the system’s proper operation.
Furthermore, no additional quantities of solid waste shall be admitted beyond those contemplated in the initial proposal submitted to this Governing Authority” (the Nombre02 is not in the original).” The restriction on the admission of waste concerns the need to ensure that the system operates optimally and not the origin of the waste, since, under the legislation currently in force, there is no rule establishing such a restriction. A motion for reconsideration and, subsidiarily, an appeal were filed against health order MS-DRRSHC-ARSL-00046-2025-OS; by Resolution MS-DRRSHC-0379-2024, the motion for reconsideration was denied, and the appeal was referred to the Minister of Health for resolution. By official report CARTA-MS-DRRSHC-0402-2025, signed by Dr. Yorleny Molina Retana, acting director, report MS-DPRSA-USA-260-2025 was received, signed by Eng. Ricardo Morales Vargas, head of the Environmental Health Unit, and Eng.
Lourdes Sánchez Delgado, Civil Engineer, both from the Central-Level Directorate of Radiation Protection and Environmental Health, concerning the State Inspection conducted on 11 de setiembre del 2024, on the basis of which health order MS-DRRSHC-ARSL-00063-2025-OS was issued, with a compliance deadline of 16 de abril of the current year. A motion for reconsideration was filed against that order, which was denied by resolution MS-DRRSHC-0592-2025 and referred for consideration of the appeal. By email dated 12 de marzo of the present year, the annual inspection schedule for monitoring the Technology Park, with the participation of the regional level, was forwarded to this organizational unit as follows (it may vary in the event of unforeseen circumstances): DATE: 30 de abril at 09:00am; 20 de mayo at 03:00pm; 10 de junio at 10:00am; 22 de julio at 09:00 am; 26 de agosto at 09:00am; 16 de setiembre at 07:00am; 07 de octubre at 03:00 pm; 25 de noviembre at 10:00am.
All inspections at the EBI Environmental Technology Park, Limón. “By technical report MS-DRRSHC-URS-IT-0030-2025, signed by Eng. Rosibel Villafuerte, it is reported: “CONCLUSIONS • Based on the information available to date, the estimated useful life of the Limón Sanitary Landfill is approximately 29 years, according to the latest operational report. • The Ministry of Health is currently awaiting the technical documents requested from the operating company in order to conduct a detailed verification of that projection. • No significant increase has been identified in the volume of incoming waste that could affect the landfill’s projected useful life. • The site is monitored quarterly, enabling possible changes in its disposal capacity to be detected and assessed. • Technical and regulatory monitoring will continue in order to ensure compliance with current regulations and proper management of the site.” By technical report MS-DRRSHC-URS-IT-0034-2025, prepared by Eng.
Rosibeth Villafuerte Rodríguez, the intervention plan submitted by Mr. Julien Charbonneau and Eng. Gustavo Acuña Solano, representatives of the company, was approved in response to health order health order MS-DRRHSC-ARSL-00062-2025. In addition to the follow-up inspections conducted by the local and regional levels of this Ministry, the Technology Park is also subject to State Inspections such as that conducted pursuant to report MS-DPRSA-USA-260-2025, which is scheduled to take place from 28 al 30 de abril of the present year. In addition to inspections, this Ministry reviews and ensures compliance with the requirement to submit solid-waste management reports. According to official communication MS-DRRSHC-ARSL 00535-2025, corresponding to the IV quarter of 2024, the report concludes: “Por tanto, it is recommended that the Area Directorate approve this report submitted by the regulated party.
Furthermore, it is reported that the total amount of waste admitted during the present quarter was recorded.” Por tanto, it can be established that this Ministry has diligently fulfilled the powers conferred upon it by law; that there is currently no rule permitting the operation of the Technology Park, as a private enterprise, to be restricted solely on account of the origin of the waste, provided that it is operating properly. This Ministry has periodically conducted inspections on its own initiative and has already scheduled on-site inspections for the purpose of monitoring and overseeing the activity. As is abundantly clear from report MS-DRRSHC-URS-IT-0030-2025, there is no evidence of the “damage or adverse effects” alleged by the appellant. Regarding the request that “Likewise, the local authorities must be ordered to immediately implement corrective and remedial measures to contain the environmental and health effects caused by the improper accumulation of such waste, and the officials must design and implement a contingency plan to prevent a health and environmental crisis similar to that of La Carpio,” the foregoing is extensively addressed in report MS-DRRSHC-URS IT-0030-2025.
Regarding the request to “submit to this Chamber a certified copy of any contract, administrative authorization, or permit by means of which EMPRESAS BERTHIER EBI DE COSTA RICA SOCIEDAD ANONIMA was allowed to transport waste from the GAM to Limón, it is reported that no such document exists, since it would likewise not fall within this Ministry’s purview to issue such documentation. As stated supra, the activity has the corresponding Sanitary Operating Permit, which, under the current regulatory framework, does not establish limitations concerning the origin of the waste to be received…” Based on the foregoing, it is imperative to clarify that Ley N°8839 “Ley para la Gestión Integral de Residuos” does not establish that municipalities may not contract for the services provided by the various industrial parks (landfills) for waste treatment; rather, they must have a comprehensive waste-management plan consistent with national policy and the National Plan.
As correctly noted by Dr. Lucas Bolívar, Director of the Limón Health Governing Area, the landfill located in the province of Limón is a suitable site for receiving solid waste and possesses a sanitary operating permit. The report submitted shows that the health authorities of the Limón Health Governing Area continuously oversee the operation of the landfill in question and that it has a useful life of 29 years. The fact cannot be overlooked that sanitary landfills are built for the purpose of receiving waste and eliminating empirical final-disposal practices, such as open-air dumps, all in order to safeguard human health and prevent environmental pollution. In her allegations, the protected party does not specify which environmental problems are allegedly being caused that would warrant the honorable justices’ immediate intervention in the proper operation, to date, of the Technology Park (sanitary landfill) managed by “EBI DE COSTA RICA S. A.” in the province of Limón.
The protected party does not reliably indicate how the fundamental rights of individuals are being violated, as her submission is subjective and poorly reasoned, whereas the reality is that, in protection of the fundamental right to life, the competent authorities, including this Ministry, authorize the construction and operation of sanitary landfills in order to prevent the irregular storage and dumping of solid waste that could endanger the environment and human health. This office considers that the construction of sanitary landfills provides safe and controlled locations for waste disposal, thereby yielding, among many other benefits, clean cities free of illegal solid-waste dumps and therefore free of pollution, improving the cleanliness and appearance of cities and thereby protecting the environment and human life, among other positive effects. Accordingly, it disagrees with the assertions made by the appellant herein.
CONCLUSION. Based on the foregoing, it is determined that the actions of the Ministry of Health authorities are fully consistent with the legal system currently in force, since the El Tomatal Environmental Technology Park, managed by EBI de Costa Rica S.A., possesses a sanitary operating permit and has an approximate useful life of 29 years. It has been demonstrated that the authorities of the Limón Health Governing Area have provided timely and ongoing oversight of the operation of the aforementioned sanitary landfill, which operates properly and can receive solid waste, constituting an indisputable contribution to health and the environment. It must be understood that the Ministry of Health must safeguard the fundamental rights to health and life, pursuant to Articles 21 and 50 of the Political Constitution, which are consistent in stating that “Human life is inviolable” and that the State must seek “the greatest well-being for all inhabitants of the country.” The Executive Branch, with the Ministry of Health as the governing authority, is therefore required to protect the population by adopting measures that defend it against every risk, threat, or danger, as provided by the General Health Law.
As a corollary to the foregoing and in relation to the amparo proceeding at issue, no infringement by this representation of any person’s fundamental rights is apparent.” It requests that the proceeding be dismissed.
Justice Hess Herrera drafts the opinion; and,
CONSIDERING:
Given its exceptional nature, the ordinary processing of amparo proceedings against private-law parties (sujetos de derecho privado) requires first examining whether the matter falls within any of the circumstances under which such a proceeding is admissible and, if so, subsequently determining whether it should be granted. In this regard, Article 57 of the Ley de la Jurisdicción Constitucional establishes the circumstances under which amparo is admissible against the actions or omissions of private-law parties: when they act or are required to act in the exercise of public functions or powers, or when they are, as a matter of law or fact, in a position of power in relation to which ordinary judicial remedies would clearly be insufficient or untimely to protect the fundamental rights or freedoms referred to in Article 2(a) of the same Law. In the specific case, those requirements have clearly been met, because this concerns a private-law party in a position of power in which it could infringe the right to health and to a healthy and ecologically balanced environment of the inhabitants of the province of Limón, due to the transfer of solid waste from the GAM to that province. The Court therefore proceeds to analyze the merits of the amparo petition.
The petitioner seeks amparo relief and alleges that, since November 2024, EMPRESAS BERTHIER E B I DE COSTA RICA SOCIEDAD ANONIMA has transferred significant quantities of solid waste each week from the Gran Área Metropolitana (GAM) to the sanitary landfill located in the province of Limón, specifically at Parque Tecnológico Ambiental El Tomatal. She states that this large-scale transfer of waste is being carried out without the Municipalidad de Limón or other local authorities having first been notified or consulted, as publicly stated by the mayor of Limón. She alleges that the described transfer directly endangers the constitutional right to a healthy environment and adversely affects the region’s reputation as a tourist destination, an essential source of employment and economic development for Limón. She further alleges that environmental deterioration would increase health risks and harm the public health of the province’s residents, thereby directly affecting public health; contamination by leachate (lixiviados) and gases produced by waste decomposition will impair air quality and water sources, with a corresponding increase in the risk of respiratory and gastrointestinal illnesses; and tourism and the economy will be directly affected.
She explains that, by law, each local government is responsible for managing solid waste and that transferring waste from other regions violates the legal and constitutional obligation of the municipalities of the Área Metropolitana to properly manage their own solid waste. She states that this problem has been accompanied by a lack of State oversight by the Ministerio de Salud and SETENA, a situation that constitutes a direct violation of the State’s duty of supervision and control. Based on the foregoing, she requests that this Court intervene and order: a) the Ministerio de Salud to immediately and permanently prohibit the transfer, storage, or disposal of waste from the GAM to the province of Limón at any of its sanitary landfills; b) the Ministerio de Salud, SETENA, and the Municipalidad de Limón to conduct an immediate technical and sanitary inspection of the Limón sanitary landfill to determine its current condition and the damage caused by the unlawful transfer of waste from the GAM or any other region, and the local authorities to immediately implement corrective and remedial measures to contain the environmental and health effects caused by the improper accumulation of such waste; and c) the Ministerio de Salud and SETENA to submit to this Chamber a certified copy of any contract, administrative authorization, or permit under which EMPRESAS BERTHIER E B I DE COSTA RICA SOCIEDAD ANONIMA was allowed to transfer waste from the GAM to Limón.
The following facts are deemed duly established and relevant to the resolution of this matter:
The project in question corresponds to expediente FEAP-0242-2004-SETENA, the “Relleno Sanitario de Limón” project, Cadastral Plan No.: L-689751-87 Project Description: “Construction of a sanitary landfill with a capacity of 80 ton of waste per day, on a 45 ha property (cadastral plan L-689751-87). The landfill will occupy 86 177 m2. It has held environmental viability since 2008, when the environmental impact studies for the development of said project were approved; environmental viability was granted through resolution No. 0914-2008-SETENA.” (report submitted by SETENA); EMPRESAS BERTHIER EBI DE COSTA RICA SOCIEDAD ANONIMA holds a sanitary operating permit (permiso sanitario de funcionamiento) valid through April 28, 2026, which was issued in accordance with the reglamento general para permisos sanitarios de funcionamiento, permisos de habilitación y autorización para eventos temporales de concentración masiva de personas, granted by the Ministerio de Salud, Decreto 43432-S; Ley 8839.
(report submitted and evidence entered into the case record by the Ministerio de Salud); That, prior to 2023, the Ministerio de Salud conducted an average of one to three inspections per year at the landfill (relleno sanitario) in question, and beginning in 2024, inspections became monthly, while during February and March of the current year, the frequency of inspections ranged from biweekly to weekly. (report submitted and evidence entered into the case file by the Ministerio de Salud); The actions carried out by the Ministerio de Salud from November 2024 through the date on which the report concerning this appeal was submitted—April 2025—are described as follows: “REPORT: MS-DRRSHC-ARSL-IT 06210-2024. INSPECTION DATE: 21 de noviembre 2024. FINDINGS AND/OR ACTIONS: CONCLUSION. During the visit and inspection, no deficiencies were identified that required issuance of a sanitary order (orden sanitaria); however, upon identifying a lack of maintenance in the green areas surrounding the on-site fuel-consumption area, the accompanying representative was informed at that time, and he explained that this had been included in the green-area maintenance work plan.
Likewise, surveillance and oversight visits by this Governing Health Area (Área Rectora) will continue. REPORT: MS-DRRSHC-ARSL-IT 06365-2024. INSPECTION DATE: 11 de diciembre DEL 2024. FINDINGS AND/OR ACTIONS: CONCLUSION. During the visit and inspection, no deficiencies were identified that required issuance of a sanitary order; likewise, surveillance and oversight visits by this Governing Health Area will continue. REPORT: MS-DRRSHC-ARSL 00535-2025. INSPECTION DATE: SUBJECT: ‘ANALYSIS OF THE SIXTH QUARTER 2024 SOLID-WASTE REPORT / EBI CR LANDFILL.’ FINDINGS AND/OR ACTIONS: CONCLUSION. Therefore, it is recommended that the Area Directorate approve this report submitted by the regulated party (administrado). Furthermore, it is reported that the total amount of waste received during this quarter was recorded. REPORT: CARTA-MS-DRRSHC-ARSL-00481-2025. INSPECTION DATE: 30 de enero del 2025. FINDINGS AND/OR ACTIONS: CONCLUSION.
Given that the main aeration chamber is still not operating because it has been undergoing maintenance since late 2024, and that little progress in the execution of the work could be identified due to the unforeseen circumstances noted above, the company is temporarily using one settling tank as an aeration chamber and the other as a settling tank. In view of the foregoing and the increase in solid waste received from the GAM for treatment by that company as a result of the technical closure (cierre técnico), it is concerning that this measure may impair or affect operating capacity; therefore, it is respectfully requested that you use your good offices to arrange an inspection visit by Regional Engineering in order to obtain a technical assessment of this situation. REPORT: CARTA-MS-DRRSHC-ARSL-00683-2025. INSPECTION DATE: 17 de febrero del 2025. FINDINGS AND/OR ACTIONS: CONCLUSION. As a result of the inspection, no inconsistencies were detected in Cell 3 at the time of the visit, nor in other operational areas of the Parque Tecnología Ambienta; however, no progress has been made on maintenance work for the wastewater treatment system, and it is therefore not advisable for the facility to be considered an option for receiving solid waste from the GAM under the circumstances described.
Accordingly, sanitary order MS-DRRSHC-ARSL-00046-2025 is served on the regulated party, granting a period of 10 business days for the facilities’ wastewater treatment system’s main aeration chamber to become operational, as it forms part of the water-purification process and is necessary to ensure the system’s proper operation. Furthermore, no quantities of solid waste beyond those contemplated in the initial proposal submitted to this Governing Authority (Ente Rector) shall be admitted. A joint follow-up visit with Regional Engineering is recommended to verify compliance with the administrative act (acto administrativo) served once the period granted has elapsed. Sanitary order MS DRRSHC-ARSL-00046-2025-OS is issued, ordering as follows: ‘The facility shall take the necessary actions to place the facilities’ wastewater treatment system’s main aeration chamber into operation, as it forms part of the water-purification process and is necessary to ensure the system’s proper operation.
Furthermore, no quantities of solid waste beyond those contemplated in the initial proposal submitted to this Governing Authority shall be admitted’ (the Nombre02 is not in the original). Continue periodically monitoring progress and compliance with the Reglamento de Parques Ambientales, ensuring that all activities are conducted in accordance with current regulations.” By technical report MS-DRRSHC-URS-IT-0034-2025 dated 01 de abril de 2025, signed by Rosibeth Villafuerte Rodríguez, civil engineer with the Health Regulation Process of the Health Governance Unit of Región Huetar Caribe, and addressed to Dr. Yorleny Molina Retana, head of the Health Governance Unit of Región Huetar Caribe, the following was indicated: “Subject: RESPONSE ASSESSMENT REGARDING THE INTERVENTION PLAN, EBI ENVIRONMENTAL TECHNOLOGY PARK – FINCA TOMATAL, SANTA ROSA, MATAMA, LIMÓN. BACKGROUND. In response to official letter N° GF-081-2025, issued on 18 de marzo de 2025 by Mr.
Julien Charbonneau, Legal Representative, and Eng. Gustavo Acuña Solano, Operations Director, the intervention plan required by sanitary order (orden sanitaria) N° MS-DRRHSC-ARSL-00062-2025, issued by the Área Rectora de Salud de Limón, has been received. This requirement is based on follow-up report N° MS-DRRSHC URS-IT-0018-2025, dated 04 de marzo de 2025, prepared by the undersigned, which set forth observations to be addressed by the Parque de Tecnología Ambiental (PTA) of Berthier de Costa Rica EBI S.A. DISCUSSION. Although the document submitted by the representatives of PTA EBI does not include a detailed schedule of activities, it does describe the methodological actions to address the observations set forth in report N° MS-DRRSHC-URS-IT-0018 2025 and sanitary order N° MS-DRRHSC-ARSL-00062-2025. Compliance with the points required in the sanitary order is analyzed below: a. Corrective actions for the proper compaction and covering of solid waste (residuos sólidos), in compliance with the regulations in force. • It is reported that the exposed areas identified during the inspection of 28 de febrero have been covered, leaving only the main working face open for operations. • To ensure daily covering when operations at the main working face close, schedules will be adjusted so that heavy-machinery personnel remain available until 6:00 pm or until operations have fully closed. • The machinery and personnel assigned to complete the covering will be as follows: o 2 excavators o 1 articulated vehicle o 1 tractor o 1 laborer to provide assistance whenever chains are required to pull the machinery during critical conditions on the surface of the cell due to a lack of dry waste needed to shape the driving surface and provide it with consistency. b. Proper disposal of contaminated material or soil, ensuring that it is not used as cover, as well as ensuring its treatment and providing a stockpile of cover material in accordance with the established regulations.
It is clarified that all contaminated soil entering the project is disposed of in the secure cells. • The material observed at the entrance to the Parque Ambiental cells, which was identified in the site-visit report, will be used as a base layer for the cover, and clean material will be placed over it, thereby complying with the requirement. This material was excess cover excavated during construction of the new cell when the membrane of the previous cell was joined to that of the new cell, a normal activity in this type of project. • The prescribed action is being taken, and the relocation of this type of recycled soil directly to the PTA secure cells is being reinforced. c. Proposal of measures to control scavenging fauna, considering options such as optimizing waste covering and implementing strategies to prevent their presence. • To mitigate this direct impact from our operations, we will reinforce operations by assigning additional personnel to control the fauna and thus prevent them from descending onto the main working face during operating hours.
In addition, the daily covering will be adjusted to minimize the contributing area of uncovered waste. • Staffing for bird control will be adjusted as follows: o 2 persons from 6:00 am to 7:00 am (outside waste-receiving hours) o 2 persons during operating hours from 7:00 am to 4:30 pm 2 persons during the lunch period from 12:00 md to 1:00 pm o 2 persons from 4:30 pm to 6:00 pm (outside waste-receiving hours) • This will cover operations both during waste-receiving hours and outside receiving hours, preventing birds from descending onto the main working face. • Following this stage, the protective perimeter around the main working face in the operating cells will be expanded, increasingly forcing the birds farther away from the area. CONCLUSION Based on the foregoing analysis, the intervention plan submitted by Mr. Julien Charbonneau and Eng. Gustavo Acuña Solano is approved. It is recommended that the Área Rectora de Salud de Limón continue monitoring compliance with and progress under the submitted intervention plan.

In the case at bar (sub lite), the petitioner alleges that, since noviembre de 2024, EMPRESAS BERTHIER E B I DE COSTA RICA SOCIEDAD ANONIMA has transported significant quantities of solid waste each week from the Gran Área Metropolitana (GAM) to the sanitary landfill (relleno sanitario) located in the province of Limón, specifically at the Parque Tecnológico Ambiental “El Tomatal.” She alleges that this transportation of waste has occurred without prior notice to or consultation with the Municipalidad de Limón or other local authorities. She contends that the described transportation jeopardizes the right to a healthy environment, adversely affects the region’s image as a tourist destination—an essential source of employment and economic development for Limón—and that environmental degradation would increase health risks and affect the public health of the province’s inhabitants as a direct public-health impact; contamination from leachate (lixiviados) and gases resulting from waste decomposition will affect air quality and water sources, with a corresponding increase in the risk of respiratory and gastrointestinal illnesses; and it will directly affect tourism and the economy.
She explains that, by law, solid-waste management is the responsibility of each local government and that transporting waste from other regions breaches the legal and constitutional obligation of the municipalities of the Área Metropolitana to properly manage their own solid waste. She states that this situation has been compounded by a lack of government oversight by entities such as the Ministerio de Salud and SETENA, which constitutes a direct violation of the State’s duty of inspection and control.
In this regard, the analysis of the reports submitted under oath by the respondent authorities, subject to the warnings—including criminal penalties—set forth in section 44 of the Ley de la Jurisdicción Constitucional, and of the documentation submitted to the case file establishes that the project in question is being processed under expediente FEAP-0242-2004-SETENA, corresponding to the project “Relleno Sanitario de Limón,” Nro. de Plano Catastrado: L-689751-87 Project Description: “Construction of a sanitary landfill with a capacity of 80 ton of waste per day on a 45 ha property (cadastral plan L-689751-87). The landfill will occupy 86 177 m2.” It is also established that the project has held environmental viability (viabilidad ambiental) since 2008, when the environmental impact studies (estudios de impacto ambiental) for its development were approved; environmental viability was granted through resolution No. 0914-2008-SETENA. The record likewise shows that BERTHIER EBI DE COSTA RICA SOCIEDAD ANONIMA holds a sanitary operating permit (permiso sanitario de funcionamiento), issued by the Ministerio de Salud, that is valid through 28 de abril del 2026.
It is likewise established that, because of the deficiencies occurring at the Parque de Tecnología Ambiental EBI, the Ministerio de Salud issued sanitary order MS-DRRSHC-ARSL-00062-2025-OS, directing the administration of that project to implement a series of measures and a schedule of activities to resolve the problems identified: proper compaction and covering of solid waste in compliance with the regulations in force; proper disposal of contaminated material or soil, ensuring that it is not used as cover, ensuring its treatment, and providing a stockpile of cover material in accordance with the established regulations; and the proposal of measures to control scavenging fauna, considering options such as optimizing waste covering and implementing strategies to prevent their presence. Accordingly, through technical report MS-DRRSHC-URS-IT-0034-2025 dated 01 de abril de 2025, the civil engineer with the Health Regulation Process of the Health Governance Unit of Región Huetar Caribe informed the head of that unit that the intervention plan required by sanitary order N° MS-DRRHSC-ARSL-00062-2025 had been received.
The document, submitted by representatives of the respondent company, describes the methodological actions for addressing the observations made and was approved by the regulatory authority, which also recommended that the Área Rectora de Salud de Limón continue monitoring compliance with and progress under the submitted intervention plan.
In view of the foregoing, the Chamber finds that the petitioner’s contention is without merit. This is because it was demonstrated that, contrary to her allegations, the project is regulated and supervised by the appropriate authorities, specifically the Ministerio de Salud, which has maintained continuous oversight, as shown by the facts established in this judgment. Indeed, it was established that the sanitary landfill located in the province of Limón, specifically at the Parque Tecnológico Ambiental “El Tomatal,” has environmental impact studies approved by SETENA in favor of BERTHIER EBI DE COSTA RICA SOCIEDAD ANONIMA and holds a sanitary operating permit, issued by the Ministerio de Salud, that is valid through 28 de abril del 2026. The representative of the respondent ministry did indicate, however, that the project exhibited operational deficiencies; consequently, that ministry has been carrying out the appropriate interventions so that the respondent company may correct the problems identified during the on-site inspections.
As of the date on which the reports were rendered, the record shows that the respondent ministry had continued monitoring the situation and that the respondent company had been complying with that ministry’s requirements. During the most recent inspection, the intervention plan submitted by the company in question was approved, and recommendations were issued to ensure that actions promoting the proper management of the sanitary landfill are maintained over the long term.
Finally, according to the information provided under oath by the representative of the Ministerio de Salud, subject to the warnings—including criminal penalties—set forth in section 44 of the Ley de la Jurisdicción Constitucional, before 2023 that ministry conducted an average of one to three inspections per year at the sanitary landfill in question. Beginning in 2024, inspections became monthly, and during febrero and marzo of the current year their frequency ranged from biweekly to weekly; that is, all these actions were taken before the authorities became aware of this appeal (recurso). For the foregoing reasons, this Chamber finds no violation of fundamental rights and, accordingly, denies the appeal with respect to this claim.
V.Furthermore, Dr. Mariela de los Ángeles Marín Mena, in her capacity as Acting Minister of Health, shall take note of her duty to safeguard public health and shall coordinate with the corresponding authorities to ensure the constant inspection and monitoring of the environmental conditions generated by the landfill in question, in order to protect the health of the population of the province of Limón, as well as the right to a healthy environment.
VI.Furthermore, the petitioner asks the Chamber to order the respondent company to provide a certified copy of any contract, administrative authorization, or permit under which EMPRESAS BERTHIER E B I DE COSTA RICA SOCIEDAD ANONIMA has been allowed to transport waste from the GAM to Limón. In this regard, the evidence submitted with the petition does not show that the interested party requested the information she alleges from the competent authority; consequently, the petition is also denied with respect to this claim.
In environmental matters, it is also the undersigned’s view that, if the Public Administration has already intervened, jurisdiction to hear and decide the matter lies with the administrative litigation courts. Nevertheless, I do consider the merits of the matter when other rights of persons affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy a healthy and pollution-free environment (Article 50 of the Political Constitution), as occurs in this case, in which the petitioner alleges that, since November 2024, EMPRESAS BERTHIER E B I DE COSTA RICA SOCIEDAD ANÓNIMA has transported significant quantities of solid waste each week from the Greater Metropolitan Area (GAM) to the landfill located in the province of Limón, specifically the “El Tomatal” Environmental Technology Park, without the Municipality of Limón or other local authorities having been previously notified or consulted, and that the described transportation endangers a healthy environment and negatively affects the region’s tourism image, an essential source of employment and economic development for Limón, in violation of the right to enjoy a healthy and ecologically balanced environment and a dignified standard of living.
The petitioner is advised that, if she submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, these must be collected from the court office within a maximum period of 30 business days from the date notice of this judgment is served. Otherwise, any material not collected within that period shall be destroyed, pursuant to the “Regulations on Electronic Case Files before the Judiciary,” approved by the Full Court at session N° 27-11 of August 22, 2011, Article XXVI, and published in Judicial Bulletin number 19 of January 26, 2012, as well as the resolution approved by the Superior Council of the Judiciary at session N° 43-12 held on May 3, 2012, Article LXXXI.
POR TANTO:

Res. 2025026093 JUSTICE RUEDA LEAL DISSENTS AND ORDERS THAT THE PROCESSING OF THE PETITION CONTINUE.
In the sub lite, the petitioner states that the respondent company transports solid waste each week from the GAM to the “Parque Tecnológico Ambiental El Tomatal” landfill, located in Limón.
In this regard, in their report, the Ministry of Health authorities detail the result of an inspection conducted in February of the current year and the information recorded in official letter no. CARTA-MS-DRRSHC-ARSL-00683-20 of February 17, 2025.
Specifically, they state that “there has been no progress on the maintenance work for the wastewater treatment system, and therefore it is not advisable for the facility to be considered an option for receiving solid waste from the GAM under the circumstances described. Accordingly, sanitary order MS-DRRSHC-ARSL-00046-2025 is served on the regulated party, granting a period of 10 business days to place the wastewater treatment system’s main aeration chamber at the facilities into operation, as it is part of the water-purification process, in order to guarantee the system’s proper operation. Furthermore, no additional quantities of solid waste beyond those contemplated in the initial proposal submitted to this Governing Authority shall be admitted.” In this regard, it should be noted that the sanitary order concerning the issue of receiving waste from the GAM was precisely no. MS-DRRSHC-ARSL-00046-2025, cited ut supra.
Subsequently, in report no. MS-DRRSHC-URS-IT-0022-2025, concerning an inspection conducted in March 2025, the health authority states: “It was verified that the work to replace the base material in the main aeration chamber remains in progress, under conditions similar to those reported during the previous inspection.” However, the respondent authority does not specify whether the issued order was ultimately complied with, stating only that it was challenged.
Accordingly, with a view to issuing a duly supported decision in the sub iudice, I consider it essential for the respondent authority to clarify whether the aforementioned sanitary order (MS-DRRSHC-ARSL-00046-2025) was in fact complied with and, specifically, whether the situation that led to the conclusion that it was not “advisable for the facility to be considered an option for receiving solid waste from the GAM” was resolved.
Consequently, I dissent and direct that the processing of the sub lite continue, requiring, as evidence to assist in adjudicating the matter, that the respondent authority clarify the foregoing.

Recurso de amparo que se tramita en expediente número 25-008408-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra la MUNICIPALIDAD DE LIMÓN, EMPRESAS BERTHIER EBI DE COSTA RICA S.A., MINISTERIO DE SALUD, Y LA SECRETARIA TÉCNICA NACIONAL AMBIENTAL.
RESULTANDO:
DESGLOSE DE CUADRO APORTADO:
“INFORME: MS-DRRSHC-ARSL-IT 06210-2024. FECHA DE INSPECCIÓN: 21 de noviembre 2024. HALLAZGOS Y/O ACCIONES: CONCLUSIÓN. Durante la visita y recorrido realizado no se identificaron debilidades que fuera necesaria la notificación de una orden sanitaria, no obstante, al identificar falta de mantenimiento en zonas verdes del área de autoconsumo de combustible se le informó al acompañante en el momento y este nos explica que se encuentra contemplado en el plan de trabajo de cuido de zonas verdes. Así mismo, se mantendrán las visitas de vigilancia y control por parte de esta Área Rectora. INFORME: MS-DRRSHC-ARSL-IT 06365-2024. FECHA DE INSPECCIÓN: 11 de diciembre DEL 2024. HALLAZGOS Y/O ACCIONES: CONCLUSIÓN. Durante la visita y recorrido realizado no se identificaron debilidades que fuera necesaria la notificación de una orden sanitaria, así mismo, se mantendrán las visitas de vigilancia y control por parte de esta Área Rectora.
INFORME: MS-DRRSHC-ARSL 00535-2025. FECHA DE INSPECCIÓN: ASUNTO: “ANALISIS REPORTE VI TRIMESTRE 2024 DE RESIDUOS SOLIDOS / RELLENO SANITARIO EBI CR”. HALLAZGOS Y/O ACCIONES: CONCLUSION. Por lo tanto, se recomienda a la Dirección de Área, otorgar el visto bueno al presente reporte presentado por el administrado. Por otra parte, se informa que fueron registrados el total de ingresado de desechos del presente trimestre. INFORME: CARTA-MS-DRRSHC-ARSL-00481-2025. FECHA DE INSPECCIÓN: 30 de enero del 2025. HALLAZGOS Y/O ACCIONES: CONCLUSIÓN En vista de que la cámara de aireación principal aún no está funcionando, esto debido a que se encuentra en proceso de mantenimiento desde finales del año 2024 y logrando identificar pocos avances en la ejecución de obras, debido a los imprevistos indicados líneas arriba, la empresa esta utilizado como medida temporal un sedimentador como cámara de aireación y el otro sedimentador como tal.
Por lo anterior, y ante el incremento de residuos sólidos recibidos de la GAM para ser tratados por dicha empresa por el cierre técnico, es preocupante que dicha medida perjudique o pueda afectar la capacidad de operación, motivo por el cual, muy respetuosamente se solicita interponga sus buenos oficios para que se realice visita de inspección de Ingeniería Regional para contar con un criterio técnico ante dicha situación. INFORME: CARTA-MS-DRRSHC-ARSL-00683-2025. FECHA DE INSPECCIÓN: 17 de febrero del 2025. HALLAZGOS Y/O ACCIONES: CONCLUSIÓN Como resultado de la inspección se identificó que en la Celda 3 no se detectaron inconsistencias en el momento de visita, como tampoco en otras áreas de los procesos del Parque Tecnología Ambienta, no obstante, en el sistema de tratamiento de aguas residuales no hay avances en las obras de mantenimiento de esta, razón por la cual, no es recomendable que el establecimiento sea una opción para que reciba residuos sólidos de la GAM por la situación indicada.
Por lo anterior, se notifica orden sanitaria MS-DRRSHC-ARSL-00046-2025 al administrado con un plazo de 10 días hábiles para que entre en funcionamiento la cámara de aireación principal del sistema de tratamiento de aguas residuales de las instalaciones, siendo esta parte del proceso de depuración del agua con el fin de garantizar la adecuada operación de este. Por otra parte, no se deberá dar ingreso de otras cantidades de residuos sólidos que no estén contempladas en la propuesta inicial planteada ante este Ente Rector. Se recomienda realizar visita de seguimiento conjunta con Ingeniería Regional para verificar el cumplimiento del acto administrativo notificado una vez cumplido el plazo otorgado. Se gira orden sanitaria MS DRRSHC-ARSL-00046-2025-OS la cual ordenaba: “El establecimiento deberá realizar las acciones necesarias para que entre en funcionamiento la cámara de aireación principal del sistema de tratamiento de aguas residuales de las instalaciones, siendo esta parte del proceso de depuración del agua con el fin de garantizar la adecuada operación de este.
Por otra parte, no se deberá de dar ingreso de otras cantidades de residuos sólidos que no estén contempladas en la propuesta inicial planteada ante este Ente Rector" (la Nombre02 no es del original) Fecha de vencimiento: 04/03/2025. INFORME: MS-DRRSHC-URS-IT 0018-2025. FECHA DE INSPECCIÓN: 28 de febrero. HALLAZGOS Y/O ACCIONES: CONCLUSIONES. 1. Se evidenciaron incumplimientos normativos en la gestión de residuos sólidos dentro del Parque de Tecnología Ambiental EBI, específicamente en la compactación, cobertura y disposición del material contaminado, lo que podría generar impactos ambientales y sanitarios. 2. La acumulación de residuos sin la debida cobertura ha propiciado la proliferación de fauna carroñera, lo que representa un riesgo para la salud pública y el medio ambiente. 3. Es necesario que la empresa implemente acciones correctivas inmediatas para garantizar el cumplimiento del Reglamento de parques ambientales para la separación, tratamiento, aprovechamiento y disposición final de residuos sólidos (Decreto N° 44421).
Por tanto, Se recomienda al Área Rectora de Salud de Limón como ente Rector en salud: I. Solicitar mediante la aplicación de las medidas especiales correspondientes que dicta la Ley, a la administración del Parque de Tecnología Ambiental EBI, lo siguiente: 1. Plan de intervención detallado, con su respectivo cronograma de actividades, el cual, deberá ser remitido a esta Unidad de Rectoría de la Salud en un período máximo de 8 días hábiles otorgados a partir de la respectiva notificación, dicho plan deberá contemplar como mínimo: a. Acciones correctivas para la adecuada compactación y cobertura de residuos sólidos, en cumplimiento con la normativa vigente. b. Correcta disposición del material o suelo contaminado, garantizando que no se utilice como cobertura, y asegurar su tratamiento y proveer acopio de material de cobertura conforme a la regulación establecida c. Planteamiento de medidas de control de fauna carroñera, considerando opciones como la optimización de la cobertura de residuos y la implementación de estrategias para evitar su presencia. 2.
En caso de aprobarse el plan de intervención indicado en el punto anterior, deberá implementarse de forma inmediata a partir de la respectiva notificación, la puesta en marcha de las acciones requeridas. II. Continuar inspecciones periódicas conjuntas entre Nivel Local y Nivel Regional, tal y como se coordinó previo a la elaboración del presente informe, para monitorear el cumplimiento de las disposiciones sanitarias y ambientales, asegurando la mejora continúa en la gestión del sitio. Por lo que se gira orden sanitaria MS-DRRSHC-ARSL-00062-2025 OS, mediante la cual se ordena: I Solicitar mediante la aplicación de las medidas especiales correspondientes que dicta la Ley, a la administración del Parque de Tecnología Ambiental EBI, lo siguiente: 1. Plan de intervención detallado, con su respectivo cronograma de actividades, el cual, deberá ser remitido a esta Unidad de Rectoría de la Salud en un período máximo de 8 días hábiles otorgados a partir de la respectiva notificación, dicho plan deberá contemplar como mínimo: A. Acciones correctivas para la adecuada compactación y cobertura de residuos sólidos, en cumplimiento con la normativa vigente.
B. Correcta disposición del material o suelo contaminado, garantizando que no se utilice como cobertura, y asegurar su tratamiento y proveer acopio de material de cobertura conforme a la regulación establecida. C. Planteamiento de medidas de control de fauna carroñera, considerando opciones como la optimización de la cobertura de residuos y la implementación de estrategias para evitar su presencia 2. En caso de aprobarse el plan de intervención indicado en el punto anterior, deberá implementarse de forma inmediata a partir de la respectiva notificación, la puesta en marcha de las acciones requeridas. INFORME: MS-DRRSHC-URS-IT-0022-2025. FECHA DE INSPECCIÓN: -Inspección N° 1 – 7 de marzo de 2025 (tarde) - Inspección N° 2 – 11 de marzo de 2025 (mañana) - Inspección N° 3 – 11 de marzo de 2025 (tarde). HALLAZGOS Y/O ACCIONES: CONCLUSIONES. 1. Se han observado avances significativos en la eliminación del suelo contaminado con residuos, con un enfoque en su disposición final adecuada en las celdas correspondientes. 2.
Las labores de compactación y cobertura de residuos continúan conforme a la normativa, logrando un avance estimado del 80% en el cierre de las celdas en uso. 3. Se ha registrado una reducción en la presencia de aves carroñeras, aunque se recomienda reforzar las medidas para su control. 4. La construcción de la nueva celda avanza según lo programado, destacando la instalación de la geomembrana. 5. Se han identificado áreas de mejora, como la necesidad de registrar diariamente el caudal de salida del Sistema de Tratamiento de Aguas Residuales y la eliminación de larvas de mosquitos en llantas almacenadas. RECOMENDACIONES 1. Mantener y acelerar la eliminación total del material contaminado y su traslado a la celda correspondiente. 2. Fortalecer las acciones para la reducción de aves carroñeras y evaluar la eficacia de las medidas implementadas. 3. Garantizar el registro diario del caudal de salida en la bitácora del Sistema de Tratamiento de Aguas Residuales. 4.
Implementar medidas preventivas para evitar la acumulación de agua en llantas u otros materiales que puedan servir como criaderos de mosquitos. 5. Continuar con el monitoreo periódico de los avances y cumplimiento del Reglamento de Parques Ambientales, asegurando que todas las actividades se realicen conforme a la normativa vigente”.
“Es importante indicar que la orden sanitaria MS-DRRSHC-ARSL-00046-2025-OS, emitida según informe CARTA-MS-DRRSHC-ARSL-00683-2025, en la cual se ordenó: “El establecimiento deberá realizar las acciones necesarias para que entre en funcionamiento la cámara de aireación principal del sistema de tratamiento de aguas residuales de las instalaciones, siendo esta parte del proceso de depuración del agua con el fin de garantizar la adecuada operación de este. Por otra parte, no se deberá de dar ingreso de otras cantidades de residuos sólidos que no estén contempladas en la propuesta inicial planteada ante este Ente Rector" (la Nombre02 no es del original)” La restricción en el ingreso de residuos versa en la necesidad de garantizar que el sistema funcione de manera óptima y no en el origen de los residuos, lo anterior por cuanto según la legislación vigente no hay norma que establezca este tipo de restricción.
Que, contra de la orden sanitaria MS-DRRSHC-ARSL-00046-2025-OS ingresa recurso de revocatoria y apelación en subsidio, el cual mediante Resolución MS-DRRSHC-0379-2024 fue declarado sin lugar la revocatoria y la Apelación es elevada ante la Ministra de Salud para resolución. Que, mediante informe oficio CARTA-MS-DRRSHC-0402-2025, suscrito por la Dra. Yorleny Molina Retana, directora ai, se recibe informe MS-DPRSA-USA-260-2025, suscrito por el Ing. Ricardo Morales Vargas jefe, Unidad de Salud Ambiental y la Ing. Lourdes Sánchez Delgado Ingeniera Civil, ambos de la dirección de protección radiológica y Salud Ambiental de Nivel Central, correspondiente al Control Estatal realizado el 11 de setiembre del 2024 basado en el cual se gira la orden sanitaria MS-DRRSHC-ARSL-00063-2025-OS con fecha de vencimiento del 16 de abril de los corrientes y contra de la cual se presenta recurso de revocatoria el cual fue declarado sin lugar mediante resolución MS-DRRSHC-0592-2025 y elevado para atención de la Apelación.
Mediante correo electrónico del 12 de marzo de los del presente año, se traslada a esta unidad organizativa el cronograma anual de inspecciones para seguimiento al Parque Tecnológico, con el acompañamiento del nivel regional a saber: (el mismo podría variar ante alguna situación imprevista): FECHA: 30 de abril a las 09:00am; 20 de mayo a las 03:00pm; 10 de junio a las 10:00am; 22 de julio a las 09:00 am; 26 de agosto a las 09:00am; 16 de setiembre a las 07:00am; 07 de octubre a las 03:00 pm; 25 de noviembre a las 10:00am. Todas las inspecciones en el Parque Tecnología Ambiental EBI, Limón. “Que, mediante informe técnico MS-DRRSHC-URS-IT-0030-2025, suscrito por la Ing. Rosibel Villafuerte se informa: “CONCLUSIONES • Con base en la información disponible hasta la fecha, la vida útil del Relleno Sanitario de Limón se estima en aproximadamente 29 años, según el último reporte operacional. • Actualmente, el Ministerio de Salud está a la espera de los documentos técnicos solicitados a la empresa operadora para realizar una verificación detallada de dicha proyección. • No se ha identificado un aumento significativo en el volumen de ingreso de residuos que pueda afectar la proyección de la vida útil del relleno. • El monitoreo del sitio se realiza trimestralmente, lo que permite detectar y evaluar posibles cambios en su capacidad de disposición. • Se continuará con el seguimiento técnico y regulatorio para garantizar el cumplimiento de la normativa vigente y la adecuada gestión del sitio.” Que, mediante informe técnico MS-DRRSHC-URS-IT-0034-2025, elaborado por la Ing. Rosibeth Villafuerte Rodríguez, se aprueba el plan de intervención presentado por el Sr. Julien Charbonneau y el Ing. Gustavo Acuña Solano representantes de la empresa en atención a orden sanitaria orden sanitaria MS-DRRHSC-ARSL-00062-2025.
Que, además de las inspecciones de seguimiento realizadas por el nivel local y regional de este Ministerio, el Parque Tecnológico también es sujeto de inspecciones de Control Estatal como la realizada según informe MS-DPRSA-USA-260-2025, la cual está programada para ejecutarse del 28 al 30 de abril del presente año. Que, además de las inspecciones este ministerio analiza y vela por el cumplimiento de la presentación de reportes de gestión de residuos sólidos, el cual según oficio MS-DRRSHC-ARSL 00535-2025, correspondiente al IV trimestre 2024, concluye: “Por lo tanto, se recomienda a la Dirección de Área, otorgar el visto bueno al presente reporte presentado por el administrado. Por otra parte, se informa que fueron registrados el total de ingresado de desechos del presente trimestre.” Por tanto, se logra evidenciar que, desde las competencias conferidas por Ley a este ministerio, se ha cumplido de manera diligente; que, no existe ninguna norma en la actualidad que permita limitar la operación del parque tecnológico como empresa privada, por motivo único de origen de los residuos, siempre y cuando la misma se encuentre operando de forma correcta.
Que, este ministerio viene realizado de oficio de manera periódica y tiene ya programadas inspecciones in situ con el objetivo de dar seguimiento y controlar el desarrollo de la actividad. Que, según se desprende con meridiana claridad del informe MS-DRRSHC-URS-IT-0030-2025, no se evidencian “daños o afectaciones” según afirma la recurrente. Que, en cuanto a la solicitud “Asimismo, requiere se ordene a las autoridades locales implementar de manera inmediata medidas correctivas y remediales para contener los efectos ambientales y sanitarios causados por la acumulación indebida de esos residuos, funcionarios que deberán diseñar e implementar un plan de contingencia para evitar una crisis sanitaria y ambiental similar a la de La Carpio”, lo anterior es ampliamente abordado mediante informe MS-DRRSHC-URS IT-0030-2025. Que, en cuanto a la solicitud de “presentar ante esta Sala copia certificada de cualquier contrato, autorización administrativa o permiso mediante el cual se haya permitido el traslado de residuos desde la GAM hacia Limón por parte de EMPRESAS BERTHIER EBI DE COSTA RICA SOCIEDAD ANONIMA, se informa que lo anterior no existe por cuanto tampoco sería atinente a este ministerio emitir tal documentación, tal y como ya se refirió supra, la actividad cuenta con el respectivo Permiso Sanitario de Funcionamiento, el cual no establece según marco normativo vigente limitaciones con relación al origen de los residuos por recibir… ” De lo expuesto, es imperativo aclarar que la Ley N°8839 “Ley para la Gestión Integral de Residuos”, no establece que las Municipalidades no puedan contratar los servicios que brindan los diferentes parques industriales (rellenos) para el tratamiento de residuos, sino que debe contar con un plan para la gestión integral de residuos, en concordancia con la política y el Plan Nacional, siendo como bien lo advierte la Dra. Lucas Bolívar, Directora del Área Rectora de Salud de Limón, el relleno ubicado en la provincia de Limón un sitio adecuado para recibir residuos sólidos y que cuenta con el permiso sanitario de funcionamiento.
Puede evidenciarse del informe rendido, que las autoridades de salud del Área Rectora de Salud de Limón realizan fiscalización continua del funcionamiento del relleno sanitario en cuestión y que el mismo cuenta con una vida útil de 29 años. No puede soslayarse el hecho de que los rellenos sanitarios son construidos con el fin de poder recibir residuos, y que se eliminen prácticas empíricas de disposición final de estos, como son los vertederos a cielo abierto, todo en resguardo de la salud de las personas y con el fin de evitar contaminaciones al ambiente. En lo alegado por la amparada no refiere cuales son los problemas ambientales que se están generando como para que se intervenga de manera inmediata por parte de los honorables magistrados el correcto funcionamiento que a la fecha tiene el Parque Tecnológico (relleno sanitario) que administra “EBI DE COSTA RICA S. A.” en la provincia de Limón.
No indica de manera fehaciente la amparada, cómo se vulneran los derechos fundamentales de las personas, pues su planteamiento es subjetivo y poco razonado, cuando la realidad es que en protección al derecho fundamental de la vida, las autoridades correspondientes y entre ellas este Ministerio, autoriza la construcción y funcionamiento de los rellenos sanitarios, con el fin de evitar almacenamiento y vertido irregular de los residuos sólidos, que comprometan el medio ambiente y la salud de las personas. Considera este despacho que la construcción de rellenos sanitarios ofrece lugares seguros y controlados para el vertido de residuos, con lo que se obtienen, entre muchos otros beneficios, el tener ciudades limpias y libres de botaderos clandestinos de residuos sólidos y por ende de contaminación, mejorando así la limpieza y ornato de las ciudades, protegiendo con ello el medio ambiente y la vida de las personas, entre otras acciones positivas, por lo que no se concuerda con las aseveraciones hechas por la aquí recurrente.
CONCLUSIÓN. De lo expuesto se determina que la actuación de las autoridades del Ministerio de Salud se encuentra en todo conforme al ordenamiento jurídico vigente, ya que el Parque Tecnológico Ambiental El Tomatal, administrado por la empresa EBI de Costa Rica S.A., cuenta con permiso sanitario de funcionamiento y tiene una vida útil aproximada de 29 años, quedando demostrado que las autoridades del Área Rectora de Salud de Limón han brindado, de manera oportuna y constante, fiscalización de la operación del citado relleno sanitario, el cual funciona adecuadamente y puede recibir residuos sólidos, lo cual resulta un aporte indiscutible para la salud y el ambiente. Es de comprender que el Ministerio de Salud debe velar por los derechos fundamentales a la salud y a la vida, de conformidad con los ordinales 21 y 50 de la Constitución Política, los cuales son contestes al señalar que “La vida humana es inviolable” y el Estado debe procurar “el mayor bienestar a todos los habitantes del país”, el Poder Ejecutivo, con el Ministerio de Salud como ente rector, está obligado a proteger a la población mediante la adopción de medidas que les defienda de todo riesgo, amenaza o peligro, según lo dispone la Ley General de Salud.
Como corolario de lo anterior y en relación con el recurso de amparo que nos ocupa, no se observa que esta representación haya incurrido en alguna infracción a los derechos fundamentales de las personas”. Solicita se declare sin lugar el recurso.
Redacta la Magistrada Hess Herrera; y,
CONSIDERANDO:
Por su excepcional naturaleza, el trámite ordinario de los recursos de amparo contra sujetos de derecho privado exige comenzar por examinar si, en la especie, estamos o no ante alguno de los supuestos que lo hacen admisible, para -posteriormente y en caso afirmativo- dilucidar si es estimable o no. En ese particular, la Ley de la Jurisdicción Constitucional, en su artículo 57, estipula bajo qué supuestos es admisible el amparo contra las acciones u omisiones de sujetos de derecho privado, es decir, cuando éstos actúen o deban actuar en ejercicio de funciones o potestades públicas, o, se encuentren, de derecho o de hecho, en una posición de poder frente a la cual los remedios jurisdiccionales comunes resultarían claramente insuficientes o tardíos para garantizar los derechos o libertades fundamentales a que se refiere el artículo 2, inciso a), de la misma Ley. En el caso concreto, es claro el cumplimiento de esos presupuestos, pues se trata de un derecho de sujeto privado que está en una situación de poder en la cual podría quebrantar al derecho a la salud y a un ambiente sano y ecológicamente equilibrado, de las personas habitantes de la provincia de Limón, debido al traslado de residuos sólidos provenientes de la GAM hacia esa provincia, razón por la cual, se entra a analizar el fondo del amparo.
La recurrente acude en amparo y alega que desde noviembre de 2024, EMPRESAS BERTHIER E B I DE COSTA RICA SOCIEDAD ANONIMA, ha trasladado semanalmente cantidades importantes de residuos sólidos provenientes de la Gran Área Metropolitana (GAM) hacia el relleno sanitario ubicado en la provincia de Limón, específicamente en el Parque Tecnológico Ambiental El Tomatal. Expresa que este traslado masivo de residuos se realiza sin que la Municipalidad de Limón ni otras autoridades locales hayan sido previamente notificadas o consultadas, según lo señalado públicamente por la alcaldesa de Limón. Acusa que el traslado descrito pone en peligro directo el derecho constitucional a un ambiente sano, afecta negativamente la imagen turística de la región, fuente esencial de empleo y desarrollo económico para Limón. Asimismo, el deterioro ambiental incrementaría el riesgo sanitario y afectaría la salud pública de los habitantes de la provincia, como impacto directo en la salud pública; la contaminación por lixiviados y gases derivados de la descomposición de residuos afectará la calidad del aire y las fuentes de agua, con el correspondiente incremento del riesgo de enfermedades respiratorias y gastrointestinales; afectación directa al turismo y la economía.
Explica que el manejo de residuos sólidos corresponde por ley a cada gobierno local, por lo que trasladar residuos de otras regiones incumple la obligación legal y constitucional de las municipalidades del Área Metropolitana de gestionar adecuadamente sus propios residuos sólidos. Señala que ante tal problemática, se ha dado falta de supervisión estatal, como es del Ministerio de Salud y SETENA; situación que constituye una violación directa al deber de fiscalización y control que pesa sobre el Estado. Por lo expuesto, solicita la intervención de este Tribunal a fin de que se ordene: a) al ministerio de salud para que se prohíba manera inmediata y permanente el traslado, almacenamiento o disposición de residuos desde la GAM hacia la provincia de Limón, en cualquiera de sus rellenos sanitarios; b) que se ordene al Ministerio de Salud, a SETENA y a la Municipalidad de Limón la realización de una inspección técnica y sanitaria inmediata en el relleno sanitario de Limón, para determinar el estado actual y los daños ocasionados por el traslado ilegal de residuos desde la GAM o cualquier otra región y se ordene a las autoridades locales implementar de manera inmediata medidas correctivas y remediales para contener los efectos ambientales y sanitarios causados por la acumulación indebida de esos residuos; c) se ordene al Ministerio de Salud y a SETENA presentar ante esta Sala copia certificada de cualquier contrato, autorización administrativa o permiso mediante el cual se haya permitido el traslado de residuos desde la GAM hacia Limón por parte de EMPRESAS BERTHIER E B I DE COSTA RICA SOCIEDAD ANONIMA.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
Que el proyecto en cuestión corresponde al expediente FEAP-0242-2004-SETENA, proyecto “Relleno Sanitario de Limón”, Nro. de Plano Catastrado: L-689751-87 Descripción del Proyecto: “Construcción de un relleno sanitario con una capacidad de 80 ton de basura por día, a finca de 45 ha (plano catastrado L-689751-87). El Relleno ocupará 86 177 m2. Cuenta con viabilidad ambiental desde el año 2008, momento en que se aprobaron los estudios de impacto ambiental para el desarrollo de dicho proyecto; la aprobación de la viabilidad ambiental se otorgó mediante la resolución No. 0914-2008-SETENA”. (informe rendido por SETENA); Que la Empresa BERTHIER EBI DE COSTA RICA SOCIEDAD ANONIMA, cuenta con permiso sanitario de funcionamiento vigente al 28 de abril del 2026, el cual se emitió en apego al reglamento general para permisos sanitarios de funcionamiento, permisos de habilitación y autorización para eventos temporales de concentración masiva de personas, otorgados por el Ministerio de Salud, Decreto 43432-S; Ley 8839.
(informe rendido y prueba aportada al expediente por el Ministerio de Salud); Que el Ministerio de Salud antes del año 2023 realizaba en promedio de una a tres inspecciones al año al relleno sanitario en cuestión, y a partir del año 2024, las inspecciones pasaron a ser mensuales y durante los meses de febrero y marzo de los corrientes, la frecuencia de inspecciones fue de quincenal a semanal. (informe rendido y prueba aportada al expediente por el Ministerio de Salud); Se describen las acciones ejecutadas por el Ministerio de Salud desde noviembre 2024, a la fecha de presentar el informe a este recurso – abril 2025: “INFORME: MS-DRRSHC-ARSL-IT 06210-2024. FECHA DE INSPECCIÓN: 21 de noviembre 2024. HALLAZGOS Y/O ACCIONES: CONCLUSIÓN. Durante la visita y recorrido realizado no se identificaron debilidades que fuera necesaria la notificación de una orden sanitaria, no obstante, al identificar falta de mantenimiento en zonas verdes del área de autoconsumo de combustible se le informó al acompañante en el momento y este nos explica que se encuentra contemplado en el plan de trabajo de cuido de zonas verdes.
Así mismo, se mantendrán las visitas de vigilancia y control por parte de esta Área Rectora. INFORME: MS-DRRSHC-ARSL-IT 06365-2024. FECHA DE INSPECCIÓN: 11 de diciembre DEL 2024. HALLAZGOS Y/O ACCIONES: CONCLUSIÓN. Durante la visita y recorrido realizado no se identificaron debilidades que fuera necesaria la notificación de una orden sanitaria, así mismo, se mantendrán las visitas de vigilancia y control por parte de esta Área Rectora. INFORME: MS-DRRSHC-ARSL 00535-2025. FECHA DE INSPECCIÓN: ASUNTO: “ANALISIS REPORTE VI TRIMESTRE 2024 DE RESIDUOS SOLIDOS / RELLENO SANITARIO EBI CR”. HALLAZGOS Y/O ACCIONES: CONCLUSION. Por lo tanto, se recomienda a la Dirección de Área, otorgar el visto bueno al presente reporte presentado por el administrado. Por otra parte, se informa que fueron registrados el total de ingresado de desechos del presente trimestre. INFORME: CARTA-MS-DRRSHC-ARSL-00481-2025.
FECHA DE INSPECCIÓN: 30 de enero del 2025. HALLAZGOS Y/O ACCIONES: CONCLUSIÓN En vista de que la cámara de aireación principal aún no está funcionando, esto debido a que se encuentra en proceso de mantenimiento desde finales del año 2024 y logrando identificar pocos avances en la ejecución de obras, debido a los imprevistos indicados líneas arriba, la empresa esta utilizado como medida temporal un sedimentador como cámara de aireación y el otro sedimentador como tal. Por lo anterior, y ante el incremento de residuos sólidos recibidos de la GAM para ser tratados por dicha empresa por el cierre técnico, es preocupante que dicha medida perjudique o pueda afectar la capacidad de operación, motivo por el cual, muy respetuosamente se solicita interponga sus buenos oficios para que se realice visita de inspección de Ingeniería Regional para contar con un criterio técnico ante dicha situación. INFORME: CARTA-MS-DRRSHC-ARSL-00683-2025.
FECHA DE INSPECCIÓN: 17 de febrero del 2025. HALLAZGOS Y/O ACCIONES: CONCLUSIÓN Como resultado de la inspección se identificó que en la Celda 3 no se detectaron inconsistencias en el momento de visita, como tampoco en otras áreas de los procesos del Parque Tecnología Ambienta, no obstante, en el sistema de tratamiento de aguas residuales no hay avances en las obras de mantenimiento de esta, razón por la cual, no es recomendable que el establecimiento sea una opción para que reciba residuos sólidos de la GAM por la situación indicada. Por lo anterior, se notifica orden sanitaria MS-DRRSHC-ARSL-00046-2025 al administrado con un plazo de 10 días hábiles para que entre en funcionamiento la cámara de aireación principal del sistema de tratamiento de aguas residuales de las instalaciones, siendo esta parte del proceso de depuración del agua con el fin de garantizar la adecuada operación de este.
Por otra parte, no se deberá dar ingreso de otras cantidades de residuos sólidos que no estén contempladas en la propuesta inicial planteada ante este Ente Rector. Se recomienda realizar visita de seguimiento conjunta con Ingeniería Regional para verificar el cumplimiento del acto administrativo notificado una vez cumplido el plazo otorgado. Se gira orden sanitaria MS DRRSHC-ARSL-00046-2025-OS la cual ordenaba: “El establecimiento deberá realizar las acciones necesarias para que entre en funcionamiento la cámara de aireación principal del sistema de tratamiento de aguas residuales de las instalaciones, siendo esta parte del proceso de depuración del agua con el fin de garantizar la adecuada operación de este. Por otra parte, no se deberá de dar ingreso de otras cantidades de residuos sólidos que no estén contempladas en la propuesta inicial planteada ante este Ente Rector" (la Nombre02 no es del original) Fecha de vencimiento: 04/03/2025.
INFORME: MS-DRRSHC-URS-IT 0018-2025. FECHA DE INSPECCIÓN: 28 de febrero. HALLAZGOS Y/O ACCIONES: CONCLUSIONES. 1. Se evidenciaron incumplimientos normativos en la gestión de residuos sólidos dentro del Parque de Tecnología Ambiental EBI, específicamente en la compactación, cobertura y disposición del material contaminado, lo que podría generar impactos ambientales y sanitarios. 2. La acumulación de residuos sin la debida cobertura ha propiciado la proliferación de fauna carroñera, lo que representa un riesgo para la salud pública y el medio ambiente. 3. Es necesario que la empresa implemente acciones correctivas inmediatas para garantizar el cumplimiento del Reglamento de parques ambientales para la separación, tratamiento, aprovechamiento y disposición final de residuos sólidos (Decreto N° 44421). Por tanto, Se recomienda al Área Rectora de Salud de Limón como ente Rector en salud: I. Solicitar mediante la aplicación de las medidas especiales correspondientes que dicta la Ley, a la administración del Parque de Tecnología Ambiental EBI, lo siguiente: 1.
Plan de intervención detallado, con su respectivo cronograma de actividades, el cual, deberá ser remitido a esta Unidad de Rectoría de la Salud en un período máximo de 8 días hábiles otorgados a partir de la respectiva notificación, dicho plan deberá contemplar como mínimo: a. Acciones correctivas para la adecuada compactación y cobertura de residuos sólidos, en cumplimiento con la normativa vigente. b. Correcta disposición del material o suelo contaminado, garantizando que no se utilice como cobertura, y asegurar su tratamiento y proveer acopio de material de cobertura conforme a la regulación establecida c. Planteamiento de medidas de control de fauna carroñera, considerando opciones como la optimización de la cobertura de residuos y la implementación de estrategias para evitar su presencia. 2. En caso de aprobarse el plan de intervención indicado en el punto anterior, deberá implementarse de forma inmediata a partir de la respectiva notificación, la puesta en marcha de las acciones requeridas.
II. Continuar inspecciones periódicas conjuntas entre Nivel Local y Nivel Regional, tal y como se coordinó previo a la elaboración del presente informe, para monitorear el cumplimiento de las disposiciones sanitarias y ambientales, asegurando la mejora continúa en la gestión del sitio. Por lo que se gira orden sanitaria MS-DRRSHC-ARSL-00062-2025-OS, mediante la cual se ordena: I Solicitar mediante la aplicación de las medidas especiales correspondientes que dicta la Ley, a la administración del Parque de Tecnología Ambiental EBI, lo siguiente: 1. Plan de intervención detallado, con su respectivo cronograma de actividades, el cual, deberá ser remitido a esta Unidad de Rectoría de la Salud en un período máximo de 8 días hábiles otorgados a partir de la respectiva notificación, dicho plan deberá contemplar como mínimo: A. Acciones correctivas para la adecuada compactación y cobertura de residuos sólidos, en cumplimiento con la normativa vigente.
B. Correcta disposición del material o suelo contaminado, garantizando que no se utilice como cobertura, y asegurar su tratamiento y proveer acopio de material de cobertura conforme a la regulación establecida. C. Planteamiento de medidas de control de fauna carroñera, considerando opciones como la optimización de la cobertura de residuos y la implementación de estrategias para evitar su presencia 2. En caso de aprobarse el plan de intervención indicado en el punto anterior, deberá implementarse de forma inmediata a partir de la respectiva notificación, la puesta en marcha de las acciones requeridas. INFORME: MS-DRRSHC-URS-IT-0022-2025. FECHA DE INSPECCIÓN: -Inspección N° 1 – 7 de marzo de 2025 (tarde) - Inspección N° 2 – 11 de marzo de 2025 (mañana) - Inspección N° 3 – 11 de marzo de 2025 (tarde). HALLAZGOS Y/O ACCIONES: CONCLUSIONES. 1. Se han observado avances significativos en la eliminación del suelo contaminado con residuos, con un enfoque en su disposición final adecuada en las celdas correspondientes. 2.
Las labores de compactación y cobertura de residuos continúan conforme a la normativa, logrando un avance estimado del 80% en el cierre de las celdas en uso. 3. Se ha registrado una reducción en la presencia de aves carroñeras, aunque se recomienda reforzar las medidas para su control. 4. La construcción de la nueva celda avanza según lo programado, destacando la instalación de la geomembrana. 5. Se han identificado áreas de mejora, como la necesidad de registrar diariamente el caudal de salida del Sistema de Tratamiento de Aguas Residuales y la eliminación de larvas de mosquitos en llantas almacenadas. RECOMENDACIONES 1. Mantener y acelerar la eliminación total del material contaminado y su traslado a la celda correspondiente. 2. Fortalecer las acciones para la reducción de aves carroñeras y evaluar la eficacia de las medidas implementadas. 3. Garantizar el registro diario del caudal de salida en la bitácora del Sistema de Tratamiento de Aguas Residuales. 4.
Implementar medidas preventivas para evitar la acumulación de agua en llantas u otros materiales que puedan servir como criaderos de mosquitos. 5. Continuar con el monitoreo periódico de los avances y cumplimiento del Reglamento de Parques Ambientales, asegurando que todas las actividades se realicen conforme a la normativa vigente”.
Por informe técnico MS-DRRSHC-URS-IT-0034-2025 de fecha 01 de abril de 2025, suscrito por Rosibeth Villafuerte Rodríguez, ingeniera civil de Proceso de Regulación de la Salud de la Unidad de Rectoría de la Salud Región Huetar Caribe y dirigido a la Dra. Yorleny Molina Retana, jefe de la Unidad Rectoría de la Salud Región Huetar Caribe, se le indica lo siguiente: “Asunto: CRITERIO DE RESPUESTA A PLAN DE INTERVENCIÓN, PARQUE DE TECNOLOGÍA AMBIENTAL EBI – FINCA TOMATAL, SANTA ROSA, MATAMA, LIMÓN. ANTECEDENTES. En atención al oficio N° GF-081-2025, emitido el 18 de marzo de 2025 por el Sr. Julien Charbonneau, Representante Legal, y el Ing. Gustavo Acuña Solano, Director de Operación, se ha recibido el plan de intervención, requerido mediante la orden sanitaria N° MS-DRRHSC-ARSL-00062-2025, emitida por el Área Rectora de Salud de Limón. Dicho requerimiento se fundamenta en el informe de seguimiento N° MS-DRRSHC URS-IT-0018-2025, del 04 de marzo de 2025, elaborado por la suscrita, en el cual se establecieron observaciones a subsanar por parte del Parque de Tecnología Ambiental (PTA) de la empresa Berthier de Costa Rica EBI S.A. DESARROLLO.
El documento presentado por los representantes del PTA EBI, si bien no incluye un cronograma detallado de actividades, sí describe las acciones metodológicas para atender las observaciones indicadas en el informe N° MS-DRRSHC-URS-IT-0018 2025 y en la orden sanitaria N° MS-DRRHSC-ARSL-00062-2025. A continuación, se analiza el cumplimiento de los puntos requeridos en la orden sanitaria: a. Acciones correctivas para la adecuada compactación y cobertura de residuos sólidos, en cumplimiento con la normativa vigente. • Se informa que las áreas expuestas identificadas en la inspección del 28 de febrero han sido cubiertas, dejando únicamente el corte principal para la operación. • Para garantizar la cobertura diaria a la hora del cierre de la operación del corte principal, se ajustarán horarios para contar con personal de maquinaria pesada hasta las 6:00 pm o bien hasta el cierre completo. • La maquinaria y el personal para el cierre de la cobertura será el siguiente: o 2 dragas o 1 articulada o 1 tractor o 1 peón para apoyo en los momentos que se requiera el uso de cadenas para jalar la maquinaria, en momentos críticos que se dan en la superficie de la celda por falta de residuos seco para darle forma y consistencia a la superficie de rodamiento. b. Correcta disposición del material o suelo contaminado, garantizando que no se utilice como cobertura, y asegurar su tratamiento y proveer acopio de material de cobertura conforme a la regulación establecida.
Se aclara que todo suelo contaminado que ingresa al proyecto se dispone en las celdas de seguridad. • Respecto al material observado al ingreso de las celdas del Parque Ambiental, mismo indicado en el informe de la visita, se utilizará como base de cobertura y sobre este se colocará material limpio, cumpliendo con lo solicitado. Este material fue exceso de cobertura que se extrajo en la construcción de la nueva celda, cuando generamos la unión de la membrana de la celda anterior con la nueva, actividad normal en este tipo de proyectos. • Se procede con lo indicado y se refuerza la actividad de reubicación de ese tipo de tierra reciclada directo en las cedas de seguridad del PTA. c. Planteamiento de medidas de control de fauna carroñera, considerando opciones como la optimización de la cobertura de residuos y la implementación de estrategias para evitar su presencia. • Para ajustar este impacto directo en nuestra actividad, vamos a reforzar la operación contando con más personal para el control y así evitar que bajen al corte principal en la jornada operativa.
Adicionalmente, ajustando la cobertura diaria minimizando el área tributaria de residuos abiertos. • El personal se ajustará de la siguiente manera para el control de aves: o 2 personas de 6:00 am a 7:00 am (horario fuera de ingreso de residuos) o 2 personas en horario operativo de 7:00 am a 4:30 pm 2 personas en horario de almuerzos de 12:00 md a 1:00 pm o 2 personas de 4:30 pm a 6:00 pm (horario fuera de ingreso de residuos) • Así, se abarca la operación tanto en horas de ingreso de residuos como fuera de horario de recepción, evitando las aves bajen al corte principal. • Posterior a esta etapa, se aumentará el anillo de protección del corte principal en las celdas de operación, haciendo que cada vez se vean obligadas a alejarse más de la zona. CONCLUSIÓN Con base en el análisis anterior, se aprueba el plan de intervención presentado por el Sr. Julien Charbonneau y el Ing. Gustavo Acuña Solano.
Se recomienda al Área Rectora de Salud de Limón continuar con el seguimiento del cumplimiento y avance del plan de intervención presentado. (informe rendido y prueba aportada al expediente por el Ministerio de Salud); El Ministerio de Salud fue notificado de la resolución que dio curso al proceso el 07 de abril de 2025. (ver acta de notificación).
En el sub lite, la recurrente alega que desde noviembre de 2024, EMPRESAS BERTHIER E B I DE COSTA RICA SOCIEDAD ANONIMA, ha trasladado semanalmente cantidades importantes de residuos sólidos provenientes de la Gran Área Metropolitana (GAM) hacia el relleno sanitario ubicado en la provincia de Limón, específicamente en el Parque Tecnológico Ambiental “El Tomatal”. Alega que dicho traslado de residuos se realiza sin que la Municipalidad de Limón ni otras autoridades locales hayan sido previamente notificadas o consultadas. Acusa que el traslado descrito pone en peligro el ambiente sano, afecta negativamente la imagen turística de la región, fuente esencial de empleo y desarrollo económico para Limón. Asimismo, el deterioro ambiental incrementaría el riesgo sanitario y afectaría la salud pública de los habitantes de la provincia, como impacto directo en la salud pública; la contaminación por lixiviados y gases derivados de la descomposición de residuos afectará la calidad del aire y las fuentes de agua, con el correspondiente incremento del riesgo de enfermedades respiratorias y gastrointestinales; afectación directa al turismo y la economía.
Explica que el manejo de residuos sólidos corresponde por ley a cada gobierno local, por lo que trasladar residuos de otras regiones incumple la obligación legal y constitucional de las municipalidades del Área Metropolitana de gestionar adecuadamente sus propios residuos sólidos. Señala que ante tal problemática, se ha dado falta de supervisión estatal, como es del Ministerio de Salud y SETENA; situación que constituye una violación directa al deber de fiscalización y control que pesa sobre el Estado.
Al respecto, del análisis de los informes rendidos bajo fe de juramento por las autoridades accionadas, bajo los apercibimientos, incluso penales, señalados en el numeral 44 de la Ley de la Jurisdicción Constitucional, y la documentación aportada al expediente, se tiene por acreditado que el proyecto en cuestión se tramita bajo el expediente FEAP-0242-2004-SETENA, que corresponde al proyecto “Relleno Sanitario de Limón”, Nro. de Plano Catastrado: L-689751-87 Descripción del Proyecto: “Construcción de un relleno sanitario con una capacidad de 80 ton de basura por día, a finca de 45 ha (plano catastrado L-689751-87). El Relleno ocupará 86 177 m2. Asimismo, que cuenta con viabilidad ambiental desde el año 2008, momento en que se aprobaron los estudios de impacto ambiental para el desarrollo de dicho proyecto; la aprobación de la viabilidad ambiental se otorgó mediante la resolución No. 0914-2008-SETENA”. Igualmente, consta que la Empresa BERTHIER EBI DE COSTA RICA SOCIEDAD ANONIMA, cuenta con permiso sanitario de funcionamiento vigente al 28 de abril del 2026, otorgado por el Ministerio de Salud.
De igual forma, se tiene por acreditado que debido a las inconsistencias que se estaban presentando en el Parque de Tecnología Ambiental EBI, el Ministerio de Salud dictó la orden sanitaria MS-DRRSHC-ARSL-00062-2025-OS, donde se le ordenó a la administración de dicho proyecto, realizar una serie de medidas y un cronograma de actividades, a fin de solucionar la problemática encontrada, para la adecuada compactación y cobertura de residuos sólidos, en cumplimiento con la normativa vigente; la correcta disposición del material o suelo contaminado, garantizando que no se utilice como cobertura, y asegurar su tratamiento y proveer acopio de material de cobertura conforme a la regulación establecida; planteamiento de medidas de control de fauna carroñera, considerando opciones como la optimización de la cobertura de residuos y la implementación de estrategias para evitar su presencia. Por lo anterior, mediante informe técnico MS-DRRSHC-URS-IT-0034-2025 de fecha 01 de abril de 2025, la ingeniera civil de Proceso de Regulación de la Salud de la Unidad de Rectoría de la Salud Región Huetar Caribe, pone en conocimiento al jefe de esa unidad, que fue recibido el plan de intervención requerido en la orden sanitaria N° MS-DRRHSC-ARSL-00062-2025, documento presentado por los representantes de la empresa accionada, donde se describe las acciones metodológicas para atender las observaciones realizadas, mismo que es aprobado por el ente regulador, quien además recomienda al Área Rectora de Salud de Limón continuar con el seguimiento del cumplimiento y avance del plan de intervención presentado.
Así de lo expuesto, la Sala estima que no lleva razón la recurrente en su alegato. Esto por cuanto se demostró que contrario a lo alegado por la misma, dicho proyecto si cuenta con la regulación y la supervisión por parte de las autoridades correspondientes, específicamente por parte del Ministerio de Salud quien se ha mantenido en constante vigilancia tal como se aprecia en los hechos probados de esta sentencia. En efecto, se logró acreditar que el relleno sanitario ubicado en la provincia de Limón, específicamente en el Parque Tecnológico Ambiental “El Tomatal”, si cuenta con los estudios de impacto ambiental aprobado por SETENA, a favor de la Empresa BERTHIER EBI DE COSTA RICA SOCIEDAD ANONIMA, y con permiso sanitario de funcionamiento vigente al 28 de abril del 2026, otorgado por el Ministerio de Salud. Ahora bien, la representante del ministerio recurrido indicó que dicho proyecto presentó falencias en su funcionamiento, por lo que ese ministerio ha venido realizando las intervenciones correspondientes a fin de que la empresa accionada solucione los problemas encontrados en las inspecciones realizadas in situ; situación que a la fecha en que se rinden los informes, consta que el ministerio recurrido le ha venido dado seguimiento a la problemática y que la empresa accionada ha venido cumpliendo con lo requerido por ese ministerio; siendo que en la última inspección realizada se aprobó el plan de intervención aportado por la empresa en cuestión y se emitieron recomendaciones a fin de que se mantenga a largo plazo acciones para el buen manejo del relleno sanitario.
Finalmente, según lo informado bajo fe de juramento por la representante del Ministerio de Salud, bajo los apercibimientos, incluso penales, señalados en el numeral 44 de la Ley de la Jurisdicción Constitucional, antes del año 2023 ese ministerio realizaba en promedio de una a tres inspecciones al año al relleno sanitario en cuestión, y a partir del año 2024 las inspecciones pasaron a ser mensuales y durante los meses de febrero y marzo de los corrientes la frecuencia de inspecciones fue de quincenal a semanal; es decir, todas estas actuaciones han sido realizadas antes de tener conocimiento del presente recurso. Por lo expuesto, esta Sala descarta la afectación a los derechos fundamentales y en consecuencia el recurso se declara sin lugar en cuanto a este extremo.
V.Por otra parte, deberá tomar nota la Dra. Mariela de los Ángeles Marín Mena, en calidad de ministra a.i. de Salud, sobre su deber de vigilante en la protección de la salud pública, quien deberá coordinar con las autoridades correspondientes para que se mantenga en constante inspección y control de las condiciones ambientales generadas por el relleno sanitario en cuestión, a fin de proteger la salud de la población de la provincia de Limón, así como, la tutela al derecho a un ambiente sano.
VI.Por otra parte, la recurrente solicita a la Sala que se ordene a la empresa recurrida que aporte copia certificada de cualquier contrato, autorización administrativa o permiso mediante el cual se haya permitido el traslado de residuos desde la GAM hacia Limón por parte de EMPRESAS BERTHIER E B I DE COSTA RICA SOCIEDAD ANONIMA. Sobre este particular, de la prueba aportada al recurso, no consta que la interesada haya gestionado ante la autoridad competente la información que alega; en consecuencia, en cuanto a este reclamo también se declara sin lugar el recurso.
En asuntos ambientales, es también criterio del suscrito, de que si ya ha habido intervención de la Administración Pública, considero que su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que la parte recurrente acusa que desde noviembre de 2024, EMPRESAS BERTHIER E B I DE COSTA RICA SOCIEDAD ANÓNIMA, ha trasladado semanalmente cantidades importantes de residuos sólidos provenientes de la Gran Área Metropolitana (GAM) hacia el relleno sanitario ubicado en la provincia de Limón, específicamente en el Parque Tecnológico Ambiental “El Tomatal”, lo cual se realiza sin que la Municipalidad de Limón ni otras autoridades locales hayan sido previamente notificadas o consultadas, siendo que el traslado descrito pone en peligro a un ambiente sano, afecta negativamente la imagen turística de la región, fuente esencial de empleo y desarrollo económico para Limón, con violación del derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.
Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
POR TANTO:
Se declara sin lugar el recurso. Tome nota la ministra de Salud a.i., de lo indicado en el considerando V de esta sentencia. El Magistrado Salazar Alvarado pone nota. El magistrado Rueda Leal salva el voto y ordena continuar con la tramitación del asunto. Notifíquese.- Fernando Castillo V.

Res. 2025026093 EL MAGISTRADO RUEDA LEAL SALVA EL VOTO Y ORDENA CONTINUAR CON LA TRAMITACIÓN DEL RECURSO.
En el sub lite, la parte accionante señala que la empresa accionada semanalmente traslada residuos sólidos del GAM al relleno sanitario “Parque Tecnológico Ambiental El Tomatal”, ubicado en Limón.
Al respecto, en su informe, las autoridades del Ministerio de Salud detallan el resultado de una inspección efectuada en febrero del año en curso y lo consignado en el oficio nro. CARTA-MS-DRRSHC-ARSL-00683-20 de 17 de febrero de 2025.
En concreto, señalan que “en el sistema de tratamiento de aguas residuales no hay avances en las obras de mantenimiento de esta, razón por la cual, no es recomendable que el establecimiento sea una opción para que reciba residuos sólidos de la GAM por la situación indicada. Por lo anterior, se notifica orden sanitaria MS-DRRSHC-ARSL-00046-2025 al administrado con un plazo de 10 días hábiles para que entre en funcionamiento la cámara de aireación principal del sistema de tratamiento de aguas residuales de las instalaciones, siendo esta parte del proceso de depuración del agua con el fin de garantizar la adecuada operación de este. Por otra parte, no se deberá dar ingreso de otras cantidades de residuos sólidos que no estén contempladas en la propuesta inicial planteada ante este Ente Rector”. Al respecto, cabe destacar que la orden sanitaria concerniente a la problemática con la recepción de residuos provenientes de la GAM fue justamente la nro. MS-DRRSHC-ARSL-00046-2025, destacada ut supra.
Posteriormente, en el informe nro. MS-DRRSHC-URS-IT-0022-2025, relativo a una inspección efectuada en marzo de 2025, la autoridad sanitaria expone: “Se verificó que las labores de sustitución del material base en la cámara de aireación principal siguen en proceso, con condiciones similares a las reportadas en la inspección anterior”. Sin embargo, la autoridad accionada no precisa si finalmente se cumplió con la orden dictada, pues solo apunta que fue impugnada.
Así las cosas, con miras a resolver de manera fundada el sub iudice, considero indispensable que la autoridad recurrida aclare si en concreto se acató o no la orden sanitaria antedicha (MS-DRRSHC-ARSL-00046-2025) y, en específico, precise si la situación, a causa de la cual se concluyó que no era “recomendable que el establecimiento sea una opción para que reciba residuos sólidos de la GAM”, fue solucionada o no.
Por consiguiente, salvo el voto y dispongo que continúe la tramitación del sub lite, requiriendo, como prueba para mejor resolver, que la autoridad recurrida clarifique lo antedicho.
