San José, at nine twenty in the morning on catorce de noviembre de dos mil veinticinco.
Amparo proceeding being heard under case file number 25-027239-0007-CO, filed by Nombre49065, identity card CED24715, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (AyA) and the ASOCIACIÓN ADMINISTRADORA DE SISTEMAS DE ACUEDUCTOS Y ALCANTARILLADOS PARCELAS QUEBRADA AZUL.
WHEREAS:
As an additional point, disinfection is carried out from the ASADA’s main tanks; therefore, discontinuing use of the storage tank in the Tilawa sector would not affect the water quality or current supply services,” meaning that the system complies with the water quality standards established in the Ministerio de Salud’s Reglamento de Calidad de Agua potable. Given that the storage tank concerning which the Sanitary Order (Orden Sanitaria) was issued has been taken out of service (Tilawa sector) and will no longer be used by the Asada, it is unnecessary to implement the recommendation issued by the Asesoría Legal de Sistemas Delegados, since it was aimed at compliance with that Sanitary Order and at regularizing the legal status of the storage tank and the pipeline rights-of-way (servidumbres de paso). Regarding the fire hydrant, pursuant to the Ley de hidrantes del Benemérito Cuerpo de Bomberos de Costa Rica (BCBCR), Article 7 states that fire hydrants must meet a minimum pressure and an established flow rate, neither of which is tied to specific storage matters.
Nevertheless, it is recommended that Asada Parcelas de Quebrada Azul arrange a new inspection with the BCBCR to assess compliance with the Reglamento de Hidrantes, taking into account the suitability (factibilidad) of its current location. In its report N° GSD-UEN-GAR-2025-04023, Orac Región Chorotega concludes: “Once the bypass is installed in the area known as the Tilawa tank, it will be situated within a right-of-way in favor of the ASADA, thereby ensuring the legal viability of the works. The system meets water-quality standards, and the ASADA is taking steps to install pressure-regulating valves because the tank also served as a pressure-break tank (tanque quiebra gradiente). Por tanto, the proposed bypass meets the requirements for providing potable-water supply service under optimal conditions and thereby ensuring the best service conditions in terms of quantity, quality, and legality.
As for new requests for service availability in the sector, the system does not meet the technical-feasibility requirements (factibilidad técnica); therefore, it is recommended that a technical study be conducted to determine the system’s current conditions, the improvements needed, and the legal requirements it must meet before new service availability may be granted.” AyA has carried out the required actions and provided the necessary technical advice to Asada Parcelas de Quebrada Azul. As demonstrated by the report issued by Orac Región Chorotega, removing the storage tank and distribution network in the Tilawa sector does not affect service provision and, in fact, resolves legal issues. Consequently, compliance with the Sanitary Order is not required for a tank that is no longer in use and will not be used again by the Asada. As for the fire hydrant, it is not considered to be technically affected by the storage tank being out of use, although the respondent Asada could coordinate an inspection with the BCBCR to determine its technical condition. It requests that the Chamber dismiss the appeal.
Justice Salazar Alvarado is the reporting Justice; and,
WHEREAS:
With respect to amparo actions (acciones de amparo) brought against private parties, as is the case here, the Chamber has clearly stated: “Because of their exceptional nature, the ordinary processing of amparo petitions against private-law parties requires first examining whether the case falls within any of the circumstances that render such a petition admissible and—subsequently, if so—determining whether it should be granted” (Judgment N° 1997-000151). Article 57 of the Ley de la Jurisdicción Constitucional establishes that this type of action may be brought against acts or omissions of private-law parties when they exercise or are required to exercise public functions or powers, or when they are, as a matter of law or fact, in a position of power against which ordinary judicial remedies are clearly insufficient or untimely to safeguard the fundamental rights or freedoms referred to in Article 2(a) of that same law. In the case at bar (sub judice), the Chamber finds that Asociación Administradora del Acueducto Parcelas de Quebrada Azul is acting in the exercise of a public function; the amparo petition is therefore proper (see Judgment N° 2010-005400 at 10:15 hours on 19 de marzo de 2010).
The petitioner states that on 25 de febrero de 2025, Ministerio de Salud issued Health Order N° MS-DRRSRCH-DARST-OS-0007-2025, ordering the ASADA to do the following: “(…) 1. Install protective fencing around the tank known as Hotel Tilawa. 2. Repair leaks in the tank known as Hotel Tilawa. 3. Perform exterior painting and maintenance work on the tank known as Hotel Tilawa (…)”; however, those directives have not been complied with to date. Furthermore, in febrero de 2025, AyA ordered the Asada as follows: “(…) to: Increase storage capacity, without including the fire-suppression volume, which will require an independent study by Benemérito Cuerpo de Bomberos de Costa Rica (…)”; however, this order has not been complied with either.
The following facts are deemed duly established and relevant to the determination of this matter, either because they have been proven or because the respondent failed to address them as directed in the initial order:
In Judgment N° 2010-001516 at 18:36 hours on 26 de enero de 2010, this Chamber addressed technical or legal impediments (imposibilidades técnicas o legales) to providing drinking-water service. On that occasion, it held as follows:
“IV.- On how the legal or formal impossibility of providing drinking-water service does not violate fundamental rights.- This Chamber’s settled case law has indicated that the supply of drinking water is regarded under the Costa Rican legal system as a public service and that, as such, every public-service provider—whether a public or private entity—is required to provide the service continuously, efficiently, under equal conditions, and in a manner that adapts to technological changes (see, in this regard, judgment 2001-09676, issued at eleven twenty-five on the twenty-sixth of September, two thousand one, and judgment 2004-08161, issued at ten fifty-three on the twenty-third of July, two thousand four). In this regard, it is clear that the Instituto Costarricense de Acueductos y Alcantarillados, as one of the State entities responsible for providing the public drinking-water service, is likewise required to provide this service continuously, adaptably, efficiently, and equally to all inhabitants.
Nevertheless, notwithstanding all that has just been established, the case law of this Constitutional Court has also indicated that, where there is a legal impossibility (meaning failure to satisfy the requirements established in the applicable regulations) or a formal impossibility (meaning the absence of a Water Distribution Network), it is reasonable not to grant service applications or to require the interested party to bear the installation costs when no drinking-water distribution network exists and infrastructure must be constructed. Thus, in such cases, it has been made clear that this is not a denial of access to drinking-water service, but rather an inability to provide it or the necessary participation of the interested party in overcoming a technical impediment, namely, the lack of infrastructure. Of course, AyA, as a State entity primarily responsible for providing drinking-water service, is under an obligation to continue expanding its infrastructure so that more and more people have access to this precious resource; however, while gaps remain, the cooperation of interested parties is essential (see resolutions Nº 2006-014218, issued at fifteen hours and four minutes on the twenty-sixth of September, two thousand six, and Nº 2007-11190, issued at fourteen hours and thirty-six minutes on the seventh of August, two thousand seven).
In other words, provided that the failure to supply drinking-water service is not capricious, arbitrary, or without basis, but is justified by a legal or material impossibility, there is no violation of fundamental rights.”
In the sub lite matter, the petitioner complains that on 25 de febrero de 2025, the Ministerio de Salud issued sanitary order N° MS-DRRSRCH-DARST-OS-0007-2025, whereby it ordered the ASADA to do the following: “(…) 1. Install protective fencing around the tank known as Hotel Tilawa. 2. Repair leaks in the tank known as Hotel Tilawa. 3. Perform exterior-paint maintenance work on the tank known as Hotel Tilawa (…)”; however, those instructions have not been followed to date. Furthermore, in febrero de 2025, AyA ordered the Asada to do the following: “(…) a: Increase storage capacity, without counting the fire-suppression volume, which will require a separate study by the Benemérito Cuerpo de Bomberos de Costa Rica (…)”; however, this has not been done either. In this regard, the Chamber finds it proven that the respondent ASADA has a delegation agreement signed with AyA on 09 de agosto del 2004, which was endorsed by the Presidencia Ejecutiva and the Dirección Jurídica on that same date and by the Contraloría General de la República on 29 de noviembre del 2004; consequently, it is authorized under the legal system to provide water-supply and/or sewerage service in the community.
The petitioner, in his capacity as developer, failed to satisfy the requirement of conducting a technical study. Nevertheless, in order to avoid leaving good-faith third parties who had purchased properties from the petitioner in a state of defenselessness and unsanitary conditions, ASADA Parcelas de Quebrada Azul proceeded to connect the service and supply them with drinking water even though the technical and legal requirements had not been met, which is improper. The respondent ASADA must address and report compliance with the improvements specified in official letter N° GSD-UEN-GAR-2025-00708, a technical opinion that was forwarded to ASADA Parcelas de Quebrada Azul through official letter GSD-UEN-GAR-2022-0711. ASADA Parcelas de Quebrada Azul lacks technical feasibility (factibilidad técnica); moreover, in the Hotel Tilawa sector, the developer must prepare a Technical Study, together with any works arising therefrom.
The storage tank that was the subject of the sanitary order challenged in this amparo proceeding (amparo) was taken out of service (Tilawa sector) and will no longer be used by the ASADA; therefore, there is no need to apply the recommendation issued by the Asesoría Legal de Sistemas Delegados, because it was directed toward compliance with that sanitary order and regularization of the status of the storage tank and the pipeline rights-of-way (servidumbres de paso). As the respondents explained to this Chamber, compliance with the sanitary order is not required for a tank that is neither in use nor will be used again by the ASADA. According to the report of the Área Rectora de Salud de Tilarán, Technical Report MS-DRRSRCH-DARST-IT-00200-2025, dated 26 de septiembre de 2025, its conclusions and recommendations clearly state: “Based on the findings identified in this technical analysis, it is concluded that sanitary order MS-DRRSRCH-DARST-OS-007-2025, served on Asada Parcelas de Quebrada Azul, must be rescinded, given that the tank known as Hotel Tilawa will no longer be managed or operated by Asada de Parcelas de Quebrada Azul.
It is recommended that complaint 033-2024 be closed and archived.” Accordingly, the Chamber considers that the petitioner’s right of access to drinking water has not been infringed because, as can be seen from the established facts, the petitioner is a project developer who was required to conduct a technical study so that the adequate provision of drinking-water service could be assessed. However, he did not do so, and ASADA Parcelas de Quebrada Azul, in order to avoid leaving good-faith third parties who had purchased properties from the petitioner in a state of defenselessness and unsanitary conditions, proceeded to connect the service and supply them with drinking water even though the technical and legal requirements had not been met, which is improper. Thus, the developer is asking the Chamber, through this amparo proceeding, to order certain improvements requested by public offices to the tank supplying the service provided by the respondent ASADA.
However, after an exhaustive analysis of the evidence in the record, it is confirmed that, according to the report of the Área Rectora de Salud de Tilarán, Technical Report MS-DRRSRCH-DARST-IT-00200-2025, dated 26 de septiembre de 2025, its conclusions and recommendations clearly state: “Based on the findings identified in this technical analysis, it is concluded that sanitary order MS-DRRSRCH-DARST-OS-007-2025, served on Asada Parcelas de Quebrada Azul, must be rescinded, given that the tank known as Hotel Tilawa will no longer be managed or operated by Asada de Parcelas de Quebrada Azul. It is recommended that complaint 033-2024 be closed and archived” (emphasis not in the original). Accordingly, the relief sought by the petitioner in this amparo proceeding cannot be granted, because the improvements he sought to have made to the water tank have become obsolete since, as noted, the sanitary order in question was rescinded because the tank will no longer be managed or operated by the ASADA; that is, the tank is not in use and will not be used again by the ASADA, and therefore the recommended improvements are unnecessary. Consequently, the appeal must be dismissed because the alleged infringement of the fundamental right of access to drinking water has not been established.
The parties are advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be collected from the court office within a maximum period of thirty business days following notice of this judgment. Otherwise, any material not collected within that period will be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at Session N° 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial N° 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at Session N° 43-12 held on 3 de mayo del 2012, Article LXXXI.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del catorce de noviembre de dos mil veinticinco .
Recurso de amparo que se tramita en expediente número 25-027239-0007-CO, interpuesto por Nombre49065, cédula de identidad CED24715, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (AyA) y la ASOCIACIÓN ADMINISTRADORA DE SISTEMAS DE ACUEDUCTOS Y ALCANTARILLADOS PARCELAS QUEBRADA AZUL.
RESULTANDO:
Redacta el Magistrado Salazar Alvarado; y,
CONSIDERANDO:
Tratándose de acciones de amparo dirigidas contra sujetos privados, como es aquí el caso, la Sala ha sido clara al decir: "Por su excepcional naturaleza, el trámite ordinario de los recursos de amparo contra sujetos de derecho privado exige comenzar por examinar si, en la especie, estamos o no ante alguno de los supuestos que lo hacen admisible, para –posteriormente y en caso afirmativo– dilucidar si es estimable o no" (Sentencia N° 1997-000151). Establece el artículo 57, de la Ley de la Jurisdicción Constitucional, que esta clase de demandas se conceden contra las acciones u omisiones de sujetos de derecho privado cuando estos actúen o deban actuar en ejercicio de funciones o potestades públicas, o se encuentren, de derecho o de hecho, en una posición de poder frente a la cual los remedios jurisdiccionales comunes resulten claramente insuficientes o tardíos para garantizar los derechos o libertades fundamentales a que se refiere el artículo 2, inciso a), de la misma ley. En el sub judice, considera la Sala que la Asociación Administradora del Acueducto Parcelas de Quebrada Azul está actuando en ejercicio de una función pública por lo que resulta procedente el amparo (ver Sentencia N° 2010-005400 de las 10:15 horas del 19 de marzo de 2010).
La parte recurrente indica que el 25 de febrero de 2025, el Ministerio de Salud emitió la orden sanitaria N° MS-DRRSRCH-DARST-OS-0007-2025, mediante la cual ordenó a la ASADA realizar lo siguiente: "(…) 1. Además, en febrero de 2025, el AyA ordenó a la Asada lo siguiente: "(…) a: Aumentar la capacidad de almacenamiento, sin contabilizar el volumen de incendios, este último requerirá de un estudio independiente por el Benemérito Cuerpo de Bomberos de Costa Rica (…)"; empero, tampoco se ha cumplido.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
Esta Sala, en Sentencia N° 2010-001516 de las 18:36 horas del 26 de enero de 2010, se refirió a lo relativo a las imposibilidades técnicas o legales para brindar el servicio de agua potable. En esa oportunidad estableció lo siguiente:
“IV.- Sobre como la imposibilidad jurídica o formal para dotar del servicio de agua potable no es violatorio de derechos fundamentales.- Reiterada jurisprudencia de esta Sala ha indicado que el suministro de agua potable es considerado dentro del ordenamiento jurídico costarricense como un servicio público, y que como tal, todo prestador de servicios públicos –sea sujeto público o sujeto privado- está obligado a prestar el servicio de forma continua, eficiente, en condiciones de igualdad y debiendo adaptarse a los cambios tecnológicos (véase al respecto la sentencia 2001-09676 de las once horas veinticinco minutos del veintiséis de setiembre del dos mil uno y la sentencia 2004-08161 de las diez horas con cincuenta y tres minutos del veintitrés de julio del dos mil cuatro). En este sentido, resulta claro concluir que el Instituto Costarricense de Acueductos y Alcantarillados, al ser uno de los entes estatales encargado de la prestación del servicio público de agua potable, está obligado también a prestar este servicio de forma continua, adaptable, eficiente y por igual a todos los habitantes.
Ahora bien, a pesar de todo lo que se acaba de establecer, también la jurisprudencia de este Tribunal Constitucional ha indicado que, frente a la imposibilidad jurídica (que es la falta de cumplimiento de requisitos establecidos en la reglamentación respectiva) o frente a la imposibilidad formal (que es la falta de una Red de Distribución de Aguas), es razonable no atender las solicitudes de servicio o solicitar que el interesado asuma los costos de instalación cuando no exista red de distribución de agua potable y se necesite la construcción de infraestructura. Así, en estos casos se ha tenido claro que no es que se trate de una negativa al acceso al servicio de agua potable, sino de la imposibilidad para brindarlo o de la necesaria participación del interesado en el levantamiento de una imposibilidad técnica, cual es, la falta de infraestructura. Por supuesto, el AyA como un ente estatal encargado mayormente de la prestación del servicio de agua potable, tiene la obligación de ir expandiendo su infraestructura para que tengan acceso a este preciado líquido cada vez más y más personas, pero mientras queden vacíos resulta indispensable la colaboración de los interesados (véase las resoluciones Nº 2006-014218 de las quince horas y cuatro minutos del veintiséis de septiembre del dos mil seis y Nº 2007-11190 de las catorce horas y treinta y seis minutos del siete de agosto del dos mil siete).
En otras palabras, siempre que la falta de dotación del servicio de agua potable no sea una actuación antojadiza, arbitraria o sin fundamento, sino que esté justificada en la imposibilidad jurídica o material no estamos frente a la violación de derechos fundamentales”.
En el sub lite, la parte recurrente reclama que el 25 de febrero de 2025, el Ministerio de Salud emitió la orden sanitaria N° MS-DRRSRCH-DARST-OS-0007-2025, mediante la cual ordenó a la ASADA realizar lo siguiente: "(…) 1. Colocar malla de protección del tanque denominado Hotel Tilawa. 2. Reparar filtraciones en tanque denominado Hotel Tilawa. 3. Realizar labores de mantenimiento pintura exterior del tanque denominado Hotel Tilawa (…)"; empero, a la fecha no se ha cumplido con dichas indicaciones. Además, en febrero de 2025, el AyA ordenó a la Asada lo siguiente: "(…) a: Aumentar la capacidad de almacenamiento, sin contabilizar el volumen de incendios, este último requerirá de un estudio independiente por el Benemérito Cuerpo de Bomberos de Costa Rica (…)"; empero, tampoco se ha cumplido. Al respecto, la Sala tiene por demostrado que la ASADA accionada cuenta con convenio de delegación firmado con el AyA el día 09 de agosto del 2004, el cual fue refrendado por la Presidencia Ejecutiva y la Dirección Jurídica en la misma fecha y por la Contraloría General de la República el 29 de noviembre del 2004, por lo cual, se encuentra legitimada por el ordenamiento jurídico para prestar el servicio de acueducto y/o alcantarillado en la comunidad.
El recurrente, en su condición de desarrollador, no cumplió con el requisito de la realización de un estudio técnico, aun así, la ASADA Parcelas de Quebrada Azul con el fin de no colocar a terceros de buena fe en un estado de indefensión e insalubridad, por haber comprado propiedades al recurrente, procedió a conectar el servicio para abastecerlos de agua potable sin que se cumplieran los requisitos técnicos y legales, lo cual no es procedente. La ASADA recurrida debe atender y reportar el cumplimiento de las mejoras conforme a lo señalado en el oficio N° GSD-UEN-GAR-2025-00708, criterio técnico que fue trasladado a la ASADA Parcelas de Quebrada Azul con el oficio GSD-UEN-GAR-2022-0711. La ASADA Parcelas de Quebrada Azul no cuenta con factibilidad técnica, además, en el sector del Hotel Tilawa es necesario la elaboración de un Estudio Técnico por parte del desarrollador, así como las obras que del mismo se desprendan.
El tanque de almacenamiento sobre el cual se emitió la orden sanitaria objeto de este amparo salió de operación (sector Tilawa) y no será utilizado más por la ASADA, de manera que no se requiere aplicar la recomendación emitida por la Asesoría Legal de Sistemas Delegados, pues estaba dirigida al cumplimiento de dicha orden sanitaria y la legalización de la situación del tanque de almacenamiento y las servidumbres de paso de las tuberías. De conformidad con lo explicado por los recurridos a esta Sala, no es requerido el cumplimiento de la orden sanitaria en un tanque que no está en uso ni se volverá a utilizar por la ASADA. Según informe del Área Rectora de Salud de Tilarán, Informe Técnico MS-DRRSRCH-DARST-IT-00200-2025, de fecha 26 de septiembre de 2025, claramente indica en sus conclusiones y recomendaciones: “A partir de los hallazgos determinados en el presente análisis técnico, se concluye resulta preciso dejar sin efecto la orden sanitaria MS-DRRSRCH-DARST-OS-007-2025, notificada a la Asada Parcelas de Quebrada Azul, en vista de que el tanque denominado Hotel Tilawa, ya no será administrado ni operado por la Asada de Parcelas de Quebrada Azul.
Se recomienda proceder con cierre y archivo de denuncia 033-2024”. Así las cosas, estima la Sala que no se ha conculcado el derecho de acceso al agua potable en perjuicio del recurrente, pues como se logra apreciar del elenco de hechos probados, el recurrente es un desarrollador de proyectos que debía realizar un estudio técnico para poder evaluar la adecuada prestación del servicio de agua potable; no obstante, no lo hizo así y la ASADA Parcelas de Quebrada Azul con el fin de no colocar a terceros de buena fe en un estado de indefensión e insalubridad, por haber comprado propiedades al recurrente, procedió a conectar el servicio para abastecerlos de agua potable sin que se cumplieran los requisitos técnicos y legales, lo cual no es procedente. Entonces, se trata de un desarrollador que está pidiendo por medio de este amparo a la Sala que se ordene realizar algunas mejoras solicitadas por algunas oficinas públicas al tanque que abastece el servicio brindado por la ASADA accionada.
Sin embargo, luego de un análisis exhaustivo de los elementos que constan en los autos, se constata que según informe del Área Rectora de Salud de Tilarán, Informe Técnico MS-DRRSRCH-DARST-IT-00200-2025, de fecha 26 de septiembre de 2025, claramente indica en sus conclusiones y recomendaciones: “A partir de los hallazgos determinados en el presente análisis técnico, se concluye resulta preciso dejar sin efecto la orden sanitaria MS-DRRSRCH-DARST-OS-007-2025, notificada a la Asada Parcelas de Quebrada Azul, en vista de que el tanque denominado Hotel Tilawa, ya no será administrado ni operado por la Asada de Parcelas de Quebrada Azul. Se recomienda proceder con cierre y archivo de denuncia 033-2024” (lo destacado no corresponde al original). Así las cosas, no es posible acceder a las pretensiones del recurrente en este amparo, pues precisamente las mejoras que buscaba realizar en el tanque de agua están obsoletas, ya que como se vio, se dejó sin efecto la orden sanitaria aludida toda vez que el tanque ya no será administrado ni operado por la ASADA; es decir, el tanque no está en uso ni se volverá a usar por parte de la ASADA, motivo por el cual no existe la necesidad de las mejoras recomendadas. En consecuencia, procede la desestimatoria del recurso por no haberse logrado comprobar la aducida lesión al derecho fundamental de acceso al agua potable.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
