Petition for habeas corpus (recurso de habeas corpus) being processed under expediente nro. 25-036808-0007-CO, filed by Nombre87592, identity card CED48213, on behalf of Nombre91426, identity card CED22584, against the MINISTERIO DE SEGURIDAD PÚBLICA.
Findings of Fact:
“Note that, although the protected party was instructed on several occasions to leave the site where the operation was being carried out, she disregarded those instructions and became violent toward the officers involved; she even entered a property that did not belong to her, causing fear among its occupants. EIGHTH: Regarding the appellant’s allegation that the protected party’s telephone was seized, the above-cited report states: ‘... The Fuerza Pública did not seize the protected party Nombre91426’s cellular telephone; it was held temporarily in the custody of the Fuerza Pública as part of the accused person’s belongings (the protected party in proceeding 25-036808-0007-CO), such custody being undertaken in compliance with the Protocolo Para el abordaje, Conducción, Custodia y Traslado de aprehendidos de los Cuerpos Policiales Adscritos al Ministerio de Seguridad Pública. According to information provided by the Fiscalía de Flagrancias del II Circuito Judicial de Alajuela (San Carlos), that prosecution office opened expediente 25-001026-1261-PE against the protected party Nombre91426 for the offense of resisting authority and other offenses; likewise, on 25 de noviembre del año 2025, she was questioned as an accused person by that judicial authority and was notified of a hearing scheduled for 10 de diciembre del año 2025 at the Fiscalía de Flagrancias de San Carlos ...’ In other words, the protected party was placed at the disposal of the competent judicial authority, which determined her legal status and set a date for the corresponding hearing.
The Honorable Justices should take into consideration that, during enforcement of the judgment, the authority representing the Ministerio Público was present at the site, supervising the various activities of both the judicial and administrative authorities and providing functional direction based on the presumption, arising from the existing facts, that a publicly prosecutable offense (delito de acción pública) had been committed against the police authority; see case file 25-001026-1261-PE. NINTH: As for the police operation conducted on the stated date, it was carried out in response to SINAC’s request for assistance concerning the encroachment by persons irregularly occupying the Refugio Nacional de Vida Silvestre Corredor Fronterizo, located in Chorreras and Las Crucitas de Cutris, San Carlos. The Fuerza Pública acted in accordance with its constitutional and statutory functions and powers to safeguard and preserve public order, namely, to prevent manifestations of criminal activity and cooperate in suppressing them as prescribed by the legal system.
These functions are established in Articles 11, 12, and 50 of the Political Constitution and Articles 8, 10, and 22 of the Ley General de Policía N° 7410. The police officers acted under Costa Rican law, and there was no unlawful or arbitrary apprehension (aprehensión), abuse of authority, or other infringement of the protected party’s constitutional rights. TENTH: It is important to mention that heavy machinery was present at the site and was demolishing the structures (see annexes); consequently, the continued presence of persons there could endanger their physical safety. Therefore, the actions and statements of Ms. Nombre91426, who was telling people not to leave the site, placed not only herself but also the other persons remaining in the area at risk. Through this conduct, she sought to obstruct compliance with the judgment issued by a judicial authority, which must be obeyed by both the authorities and residents, since it is a judicial judgment issued in proceedings in which all parties had the opportunity to use the remedies established for such purposes under Costa Rican criminal procedure.
ON THE MERITS According to the appellant, who states that: ‘... the protected party is a social activist and was arbitrarily detained by the Fuerza Pública in the community of Chorreras, in Cutris, San Carlos, Alajuela, without any reason. The appellant asserts that, as of the date the proceeding was filed, the whereabouts of the represented party were unknown, which the appellant considers “the first documented disappearance of a social activist in Costa Rica under the current government’s regime.” The appellant explains that a process of demolition, destruction, and eviction (desalojo) of the community that has been settled in Las Chorreras for decades is being carried out, and that Ms. Nombre91426 was documenting it and broadcasting it live to the country. The appellant states that the protected party informed the Fuerza Pública of the existence of two amparo proceedings (recursos de amparo) against those actions, and that it was at that moment that they subdued her, unlawfully seized the cellular telephone she was using to inform the community, detained her, and transported her in a police transport vehicle to an unknown destination.
The appellant considers the represented party’s fundamental rights to have been violated ...’ For this Dirección General, and based on the evidence submitted, the police actions taken were duly grounded, reasoned, and in accordance with law. They were carried out with respect for due process (debido proceso) and the protected party’s constitutional guarantees, pursuant to the powers granted by law, as previously stated. The police measures were undertaken to safeguard public order and the safety of the persons present at the eviction site, the persons unlawfully occupying public property, SINAC workers, and personnel from other institutions who appeared at the site to ensure proper enforcement of the judicial judgment.
In this case, as previously stated, the property subject to eviction is part of the Refugio Nacional de Vida Silvestre del Corredor Fronterizo. Because it is a protected wildlife area (área silvestre protegida), it forms part of the State’s forest heritage (patrimonio forestal del Estado). Accordingly, in compliance with the Ley de Conservación de la Vida Silvestre N° 7317, the Fuerza Pública assisted the Sistema Nacional de Áreas de Conservación (SINAC) in enforcing the judgment to recover the property, as required by law, while safeguarding public order and public safety. Because the actions perpetrated by the protected party herein interfered with the proper conduct of the proceedings, she was apprehended in accordance with the Fiscalía’s functional direction and was subsequently brought before the competent judicial authority, which determined her legal status.
With all due respect, because Ms. Nombre91426’s fundamental rights were not violated, it is important to state that, as of the date the operation concluded, the only violent act recorded was the criminal conduct of the protected party, who, as of today, is subject to criminal proceedings being handled by the Fiscalía de Flagrancia de la Jurisdicción de San Carlos. With all due respect, I request that the Habeas Corpus Action be declared WITHOUT MERIT and that the case file be closed. (…) RELIEF REQUESTED 1. Your Honorable Authority is requested to declare WITHOUT MERIT the Habeas Corpus Action processed under expediente 25-036808-0007-CO, filed by Nombre87592, identity card CED48213, on behalf of Nombre91426, identity card CED22584, against the MINISTERIO DE SEGURIDAD PÚBLICA, so that the case file may be closed.”
Justice Alvarado Paniagua drafts the opinion; and,
Considering:
I.Subject matter of the application. The applicant states that, arbitrarily and without grounds, the Fuerza Pública detained the protected person (persona tutelada) in the community of Chorreras, in Cutris de San Carlos de Alajuela. The applicant asserts that the whereabouts of the amparo-protected person (amparada) are unknown. The applicant explains that, in connection with the eviction, razing, and demolition of the community of Las Chorreras, the litigant (justiciable), who was present at the location, “informed the State’s repressive forces of the existence of two applications for amparo (recursos de amparo) against those actions, and it was at that moment that they subdued her, illegally confiscated the cell phone with which she was keeping the country informed of what was happening in Chorreras, and she was detained and transported in a police transport vehicle to an unknown destination” (sic).
a. The protected person is 42 years old. (Search conducted on the website of the Tribunal Supremo de Elecciones).
b. Fuerza Pública Report No. 199641-25 of 25 de noviembre de 2025 recorded the following police actions: “1. AT 08:10, WHILE AN EVICTION WAS BEING CARRIED OUT IN THE SECTOR Dirección5913 PURSUANT TO RULING NUMBER 967-2025, CASE NUMBER 25-000857-0306-PE, WHILE THE POLICE WORK WAS BEING PERFORMED, A WOMAN NAMED Nombre91426 , IDENTITY CARD CED25412, ARRIVED AT THE LOCATION, BEHAVING AGGRESSIVELY AND INCITING THE PEOPLE AT THE LOCATION, WHO DID NOT IDENTIFY THEMSELVES, NOT TO LEAVE AND TO DISOBEY THE ORDER TO LEAVE VOLUNTARILY, INSULTING THE FUERZA PÚBLICA OFFICERS BY SAYING SHAMELESS COPS, STARVING WRETCHES, YOU DON’T KNOW WHAT YOU’RE DOING, DAMN YOU; SHE ALSO STATED THAT SHE WAS A LAWYER REPRESENTING THEM, BUT SHE DID NOT PRODUCE ANY DOCUMENT IDENTIFYING HER AS SUCH NOR DID SHE CARRY ANY DOCUMENT SUPPORTING HER STATEMENT, SO SHE WAS ASKED TO LEAVE THE LOCATION FOR THE SAFETY OF EVERYONE PRESENT DURING THE EVICTION WORK; SHE DEFIANTLY REFUSED AND STATED THAT SHE WOULD NOT LEAVE UNDER ANY CIRCUMSTANCES, FOR WHICH REASON SHE WAS APPREHENDED, WHEREUPON SHE BECAME AGGRESSIVE TOWARD THE POLICE; AT THE TIME OF HER APPREHENSION, AN ODOR OF ALCOHOL WAS DETECTED; SHE WAS INFORMED OF THE REASON FOR HER APPREHENSION, NAMELY OBSTRUCTING POLICE WORK; SHE WAS INFORMED THAT SHE HAD THE RIGHT TO REMAIN SILENT, TO REPORT HER LEGAL STATUS, AND TO AN ATTORNEY, WHICH SHE UNDERSTOOD PROPERLY; AT 08:24, LEGAL SUPPORT COUNSEL BERNY ABARCA VEGA INSTRUCTED THAT SHE BE KEPT IN CUSTODY AT THE DISPOSAL OF THE PROSECUTOR ON DUTY, ADRIANA RODRIGUEZ CÓRDOBA, ASSISTANT PROSECUTOR OF SAN CARLOS, FOR THE OFFENSE 2. OF OBSTRUCTION OF POLICE WORK; AT 09:00 HOURS, A POLICE REPORT WAS PREPARED FOR REFERRAL TO THE CORRESPONDING AUTHORITY” (sic). (Evidence submitted by the Director General de la Fuerza Pública).
c. Commander Junier Villalta Rubí, Deputy Regional Director of the Dirección Chorotega Norte de la Fuerza Pública, recorded the following in official letter MSP-DM-DVURFP-DGFP-DROHN-2619-2025 of 26 de noviembre de 2025: “On martes 25 de noviembre del año 2025, at approximately 06:00 hours, the eviction ordered in expediente 25-000857-0306- PE began, an operation in which authorities such as SINAC, Municipalidad de San Carlos, SENASA, PANI, Cruz Roja, Fuerza Pública, Ministerio Publico, Bomberos de Costa Rica, Coopelesca, Policía de Migración, and Dirección de Inteligencia y Seguridad del Estado participated. During its execution, the (sic) Fuerza Pública, among other actions, established a perimeter in the area to be cleared, controlled the entry and exit of persons, identified persons, inspected structures, and undertook other measures aimed at ensuring the safety of the persons to be evicted, as well as that of the participating authorities (…) At approximately 07:30 hours, inside the secured area where the judicial eviction was being carried out, a group of approximately five persons (unconnected with the eviction) was observed; Fuerza Pública personnel approached them and asked them to leave the area to be cleared.
One of these persons stated that she was a lawyer and incited the others not to leave the location voluntarily; she shouted that she had documents authorizing them to remain at the location; SHE PRODUCED NO DOCUMENTATION WHATSOEVER (sic) SUPPORTING HER STATEMENT. She identified herself as Nombre91426, and for that reason she was asked to leave the location. It was even explained to her repeatedly that this was an area being cleared and that, for safety reasons, they needed to leave. She failed to comply with the instructions of the Fuerza Pública while continuing to shout to the persons at the location not to leave, that they could not be removed; she obstructed police work by inciting people not to leave their homes voluntarily, stating that she was the representative of the persons being evicted. She was therefore escorted by Fuerza Pública personnel out of the area where the eviction was being carried out.
However, while passing one of the structures used as a small neighborhood grocery store (pulpería) (without any permit), she attempted to enter it and even sat on a bench immediately outside and told one of the occupants to bring her coffee. Fuerza Pública personnel therefore attempted to remove her from the location using the minimum necessary force, at which point she attempted to assault Police Officer Nombre91428, identity card CED51670. She was consequently apprehended in the act at 08:05 hours and informed of her rights, namely: to know the reason for her apprehension; the right to communicate her apprehension to the person, group of persons, association, organization, or entity of her choosing; to be assisted, from the first procedural act, by counsel designated by her, her relatives, or the organization notified of her capture and, in the absence thereof (sic), by a public defender; to refrain from testifying and, if she agreed to do so, to have her counsel present when giving her statement and during other proceedings requiring her presence.
Likewise, Lic. Berny Abarca Vega, Police Legal Advisor for Región Chorotega Norte, informed Lic. Adriana Rodríguez Córdoba, Assistant Prosecutor of San Carlos (who was participating in the enforcement of the aforementioned eviction), of the events, and at 08:15 hours she ordered that the detainee be held at her disposal for the offense of resistance (resistencia), to be processed under the expedited procedure for offenses committed in flagrante delicto (procedimiento expedito para los delitos en Flagrancia), and that the corresponding police report, together with the records verifying domicile, health status, and notification of the accused’s rights, be forwarded to the Fiscalía de Flagrancias del II Circuito Judicial de Alajuela (San Carlos). In this regard, police report number 0199641-2025 was prepared. (…) The amparo-protected person Nombre91426 was detained under the functional direction (dirección funcional) of Lic. Adriana Rodríguez Córdoba, Assistant Prosecutor of San Carlos, for the offense of resistance and other offenses.
(…) According to information provided by the Fiscalía de Flagrancias del II Circuito Judicial de Alajuela (San Carlos), that office opened expediente 25-001026-1261-PE against the amparo-protected person Nombre91426 for the offense of resistance and other offenses; likewise, on 25 de noviembre del año 2025, she was formally questioned as an accused person (indagada) by that judicial authority and was notified of a hearing scheduled for 10 de diciembre del año 2025 at the Fiscalía de Flagrancias de San Carlos.” (Evidence submitted by the Director General de la Fuerza Pública).
III.Regarding the specific case. In the matter at hand (sub lite), the applicant states that, arbitrarily and without grounds, the Fuerza Pública detained the protected person in the community of Chorreras, in Cutris de San Carlos de Alajuela. The applicant asserts that the whereabouts of the amparo-protected person are unknown. The applicant explains that, in connection with the eviction, razing, and demolition of the community of Las Chorreras, the litigant, who was present at the location, “informed the State’s repressive forces of the existence of two applications for amparo against those actions, and it was at that moment that they subdued her, illegally confiscated the cell phone with which she was keeping the country informed of what was happening in Chorreras, and she was detained and transported in a police transport vehicle to an unknown destination” (sic).
The record demonstrates that the protected person (persona tutelada) is 42 years old. Public Force Report No. 199641-25 dated 25 de noviembre de 2025 recorded the following police actions: “1. WHILE THE POLICE OPERATION WAS BEING CONDUCTED, A WOMAN NAMED Nombre91426 , IDENTITY CARD CED25412, ARRIVED AT THE SCENE, ACTING AGGRESSIVELY AND INCITING THE PEOPLE THERE, WHO DID NOT IDENTIFY THEMSELVES, NOT TO LEAVE AND TO DISOBEY THE ORDER TO DEPART VOLUNTARILY, INSULTING THE PUBLIC FORCE OFFICERS BY SAYING, ‘YOU SHAMELESS, STARVING POLICE OFFICERS, YOU DON’T KNOW WHAT YOU’RE DOING, DAMN YOU.’ SHE ALSO STATED THAT SHE WAS THE ATTORNEY REPRESENTING THEM, BUT SHE DID NOT PRODUCE ANY DOCUMENT IDENTIFYING HER AS SUCH, NOR DID SHE HAVE ANY DOCUMENT SUPPORTING HER STATEMENT.
SHE WAS THEREFORE ASKED TO LEAVE THE AREA FOR THE SAFETY OF EVERYONE PRESENT DURING THE EVICTION OPERATION. SHE DEFIANTLY REFUSED AND STATED THAT SHE WOULD NOT LEAVE UNDER ANY CIRCUMSTANCES, FOR WHICH REASON SHE WAS APPREHENDED, AT WHICH POINT SHE BECAME AGGRESSIVE TOWARD THE POLICE OFFICERS. AT THE TIME OF HER APPREHENSION, AN ODOR OF ALCOHOL WAS DETECTED ON HER. SHE WAS INFORMED THAT THE REASON FOR HER APPREHENSION WAS OBSTRUCTION OF POLICE DUTIES. SHE WAS ADVISED THAT SHE HAD THE RIGHT TO REMAIN SILENT, TO REPORT HER LEGAL STATUS, AND TO AN ATTORNEY. SHE UNDERSTOOD THESE RIGHTS FULLY. AT 08:24, LEGAL SUPPORT COUNSEL BERNY ABARCA VEGA INSTRUCTED THAT SHE BE HELD IN CUSTODY AT THE DISPOSAL OF THE PROSECUTOR ON DUTY, ADRIANA RODRIGUEZ CÓRDOBA, ASSISTANT PROSECUTOR OF SAN CARLOS, FOR THE OFFENSE 2. OF OBSTRUCTION OF POLICE DUTIES. AT 09:00, A POLICE REPORT WAS PREPARED FOR REFERRAL TO THE APPROPRIATE AUTHORITY” (sic).
Commander Junier Villalta Rubí, Regional Deputy Director of the Dirección Chorotega Norte of the Public Force, stated in official letter MSP-DM-DVURFP-DGFP-DROHN-2619-2025 dated 26 de noviembre de 2025: “On Tuesday, 25 de noviembre del año 2025, at approximately 06:00, the eviction ordered in expediente 25-000857-0306- PE began. The authorities participating in the operation included SINAC, Municipalidad de San Carlos, SENASA, PANI, Cruz Roja, Fuerza Pública, Ministerio Publico, Bomberos de Costa Rica Coopelesca, Policía de Migración, and Dirección de Inteligencia y Seguridad del Estado. During its execution, the Public Force, among other actions, established a perimeter in the area to be cleared, controlled the entry and exit of persons, identified persons, inspected structures, and undertook other actions aimed at ensuring the safety of the persons being evicted and the participating authorities (…) At approximately 07:30, a group of approximately five persons (unconnected with the eviction) was observed inside the secured area where the judicial eviction was being carried out.
Public Force personnel approached them and asked them to leave the area to be cleared. One of these persons stated that she was an attorney and incited the others not to leave the premises voluntarily. She shouted that she had documents authorizing them to remain there; SHE PRODUCED NO DOCUMENTATION WHATSOEVER SUPPORTING HER CLAIM (sic). She identified herself as Nombre91426. Accordingly, she was asked to leave, and it was repeatedly explained to her that this was an area being cleared and that, for safety reasons, they needed to depart. She failed to comply with the Public Force’s instructions while continuing to shout to the persons who were there that they should come out and that they could not be removed. She obstructed police duties by inciting people not to leave their homes voluntarily and claiming that she represented the persons being evicted. Public Force personnel therefore escorted her out of the area where the eviction was being conducted.
Nevertheless, while passing one of the structures used as a small grocery shop (pulpería) (without any permit), she attempted to enter it and even sat on a bench immediately outside it and told one of the occupants to bring her coffee. Public Force personnel therefore attempted to remove her from the premises using the minimum necessary force, at which point she attempted to assault Police Officer Nombre91428, identity card CED51670. She was therefore apprehended in the act at 08:05 and advised of her rights, namely: to know the reason for her apprehension; to have her apprehension communicated to any person, group of persons, association, organization, or entity of her choosing; to be assisted, from the first procedural act onward, by counsel designated by her, her relatives, or the organization notified of her arrest and, in the absence thereof (sic), by a public defender; and to refrain from making a statement or, should she agree to make one, to have her counsel present when giving her statement and during other proceedings requiring her presence.
Likewise, Lic. Berny Abarca Vega, Police Legal Advisor for the Región Chorotega Norte, informed Lic. Adriana Rodríguez Córdoba, Assistant Prosecutor of San Carlos (who was participating in the execution of the aforementioned eviction), of the events. At 08:15, she ordered that the woman be detained at her disposal for the offense of resisting authority (resistencia), to be processed under the expedited procedure for offenses committed in flagrante delicto (procedimiento expedito para los delitos en Flagrancia), and that the relevant police report, together with the records verifying her address, state of health, and notification of the accused’s rights, be forwarded to the Fiscalía de Flagrancias del II Circuito Judicial de Alajuela (San Carlos). Police report number 0199641-2025 was prepared in this regard. (…) The protected party (amparada), Nombre91426, was detained pursuant to the functional direction (dirección funcional) of the Assistant Prosecutor of San Carlos, Lic. Adriana Rodríguez Córdoba, for the offense of resisting authority and others.
(…) According to information provided by the Fiscalía de Flagrancias del II Circuito Judicial de Alajuela (San Carlos), that office opened expediente 25-001026-1261-PE against the protected party Nombre91426 for the offense of resisting authority and others. Furthermore, on 25 de noviembre del año 2025, she was questioned as a defendant (indagada) by that judicial authority and was notified of a hearing scheduled for 10 de diciembre del año 2025 at the Fiscalía de Flagrancias de San Carlos.” Against this background, in view of the terms in which the petition was filed, the Court finds no situation that currently warrants its intervention.
In particular, the petitioner does not describe any disproportionate use of force, nor does the petitioner allege that any physical injury of constitutional significance was caused. In that regard, the petitioner merely asserts that she was “rendered powerless,” while the police authorities state that “minimum force” was used.
Although it is alleged that the detention was arbitrary and unfounded, it is nonetheless true that, according to the police report, the Public Force responded to a conflict involving the protected party, as a result of which she was apprehended and subsequently placed at the disposal of the Fiscalía de Flagrancia del II Circuito Judicial de Alajuela (San Carlos), which opened a case against her “for the offense of resisting authority,” questioned her that same day, and even notified her of another proceeding scheduled for the following 10 de diciembre. In other words, for the purposes of this constitutional jurisdiction, the Court finds no manifest arbitrariness or any action exceeding the scope of Article 235 of the Code of Criminal Procedure (Código Procesal Penal), without prejudice to a determination in the ordinary proceedings as to whether or not she committed an offense. It is precisely through those ordinary procedural channels that the party with standing may, if deemed appropriate, submit her position to adversarial examination and present evidence fully.
Moreover, the petitioner did not demonstrate the existence of any legal relationship requiring the Public Force to inform him of the protected person’s whereabouts, nor did he state that he had requested such information; therefore, prima facie, no violation is apparent in that regard. As of the filing date of the petition, and based on what the petitioner knew at the time of the apprehension, no infringement capable of being declared in habeas corpus proceedings is established.
Finally, it is not for the Court to determine whether the protected party’s cell phone was unlawfully seized. Rather, the police authorities stated that it “was temporarily held in custody” pursuant to the “Protocol for the Handling, Escort, Custody, and Transportation of Apprehended Persons by Police Forces Attached to the Ministerio de Seguridad Pública.” Likewise, the petitioner did not describe any specific and individualized harm suffered by the protected person during her transport. Nor did the petitioner mention that any personal circumstance or medical condition requiring consideration had been communicated.
With regard to the matter sub examine, the Court ruled in judgment No. 2025011242 at 9:20 on 10 de abril de 2025, in a case whose reasoning is applicable here:
“First, regarding the grounds for and manner of the apprehension, the Court preliminarily finds no violation of the protected person’s fundamental rights capable of being declared in these summary habeas corpus proceedings.
In this regard, the evidence submitted in the record establishes that on 13 de marzo de 2025, the protected person was apprehended by officers of the OIJ de Santa Cruz because, while in the waiting room of that office, he behaved violently, to the point of striking one of the officials with whom he had previously been speaking. This situation, as shown in the videos entered into the record, justified the police action, which this Chamber does not find excessive or disproportionate, since the officers merely placed security restraints (metal handcuffs) on his hands and transferred him to the holding cells. Thus, in the sub iudice matter, it has not been established that the judicial police officers used force of such magnitude as to warrant intervention by this Constitutional Court.
The petitioner challenges the apprehension on the ground that, in his view, he committed no offense. However, it is established that the protected person is being prosecuted in connection with the events at issue for the offense of resisting authority, in expediente nro. 25-000139-1260-PE before the Tribunal de Flagrancia de Santa Cruz. In this regard, it bears emphasizing that section 236 of the Code of Criminal Procedure provides:
ARTICLE 235.—Apprehension of persons. Police authorities may apprehend any person, even without a judicial warrant, when:
In turn, Article 236 eiusdem provides:
“ARTICLE 236.—Flagrante delicto. Flagrante delicto shall exist when the perpetrator of a punishable act is caught while committing it or immediately thereafter, while being pursued, or when the perpetrator possesses objects or bears traces giving rise to a strong presumption that the perpetrator has just participated in an offense.” Thus, contrary to the claimant’s assertions, the challenged police action arose from facts being investigated as a criminal offense in summary criminal proceedings (sumaria penal) conducted under the flagrante delicto procedure (procedimiento de flagrancia); therefore, for purposes of this constitutional jurisdiction (jurisdicción constitucional), it does not constitute an unlawful action. The appellant should note that it is not for this Chamber to determine whether the facts ultimately constitute a criminal offense, nor to establish their classification under substantive criminal law (normativa penal sustantiva). Accordingly, any disagreement with such matters must be raised in the criminal proceedings themselves, through the mechanisms established for such purposes by procedural law (legislación procesal).
Consequently, with respect to these issues, the appeal is denied.” Ergo, the appeal is denied.
IV.Documentation submitted to the case file (expediente). The parties are hereby advised that, if they submitted any paper document or any objects or evidence contained on an additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, such materials must be retrieved within a maximum period of 30 business days from notification of this judgment. The parties are advised that any material not retrieved within that period will be destroyed pursuant to the “Regulations on Electronic Case Files before the Poder Judicial” (“Reglamento sobre Expediente Electrónico ante el Poder Judicial”) (approved by the Corte Plena in artículo XXVI de la sesión nro. 27-11 de 22 de agosto de 2011 and published in Boletín Judicial nro. 19 del 26 de enero de 2012) and artículo LXXXI de la sesión del Consejo Superior del Poder Judicial nro. 43-12 de 3 de mayo de 2012.
Por tanto:

Recurso de habeas corpus que se tramita en el expediente nro. 25-036808-0007-CO, interpuesto por Nombre87592, cédula de identidad CED48213, a favor de Nombre91426, cédula de identidad CED22584, contra el MINISTERIO DE SEGURIDAD PÚBLICA.
Resultando:
Redacta la Magistrada Alvarado Paniagua; y,
Considerando:
I.Objeto del recurso. La parte accionante indica que, de forma arbitraria e infundada, la Fuerza Pública detuvo a la persona tutelada en la comunidad de Chorreras, en Cutris de San Carlos de Alajuela. Afirma que se desconoce el paradero de la amparada. Expone que, con ocasión del desalojo, derribo y demolición de la comunidad de Las Chorreras, la justiciable, quien se encontraba presente en el lugar, “puso en conocimiento de las fuerzas represivas del Estado de la existencia de dos recursos de amparo contra tales actos y fue en ese momento que la redujeron a la impotencia , le decomisaron ilegalmente su celular con el que ponia al pais al tanto de lo que ocurria en Chorreras y fue detenida, y traslada en una perrera con rumbo desconocido” (sic).
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
a. La persona tutelada tiene 42 años. (Consulta en la página web del Tribunal Supremo de Elecciones).
b. El Informe de la Fuerza Pública nro. 199641-25 de 25 de noviembre de 2025, consignó las siguientes diligencias policiales: “1. AL SER LAS 08:10 SE REALIZANDO DESALOJO EN EL SECTOR Dirección5913 BAJO RESOLUCION NUMERO 967-2025 CAUSA NÚMERO 25-000857-0306-PE A LA HORA DE ESTAR REALIZANDO LA LABOR POLICIAL SE APERSONA AL LUGAR UNA FEMENINA DE NOMBRE Nombre91426 CEDULA CED25412 CON UNA CONDUCTA AGRESIVA AGITANDO LAS PERSONAS DEL LUGAR A QUE NO SALGAN LAS CUALES NO SE IDENTIFICAN Y QUE DESOVEDESCA LA ORDEN DE SALIR VULUMTARIAMENTE, OFENDIENDO A LA FIGURA DE LOS OFICIALES DE FUERZA PÚBLICA DICIENDO SINVERGÜENZAS POLICÍAS MUERTOS DE HAMBRE USTEDES NO SEBEN LO QUE HACEN MALDITOS, TAMBIEN INDICA QUE ELLA ES ABOGADA QUE LOS REPRESENTA PERO LA. MISMA NO PRESENTA NINGÚN DOCUMENTO QUE LA ACREDITE COMO TAL NI PORTA NINGUN DOCUMENTO QUE AVALE SU MANIFESTACION POR LO QUE SE LE INVITA A SALIR DEL LUGAR POR SEGURIDAD DE TODOS PRESENTES EN LA EN LA LABOR DE DESALOO ESTA SE NIEGA DE FORMA DESAFIANTE Y MANIFIESTA NO VA SALIR DE NINGUNA MANERA POR LO QUE APREHENDE Y ESTA SE TORNA AGRESIVA HACIA LA FIGURA POLÍCIAL, A LA HORA DE LA APREHENCION SE LE.
PERSIBE UN OLOR A ALCOHOL SE LE INDICA EL MOTIVO DE LA APREHENCION AL OSTRUIR LA LABOR POLICIAL, SE LE INDICA QUE TIENE DERECHO A NO DECLARAR, A INFORMAR SU CONDICIÓN JURIDICA Y DERECHO A UN ABOGADO ESTA LOS. COMPRENDE DE BUENA FORMA AL SER LAS 08:24 INDICA LICENCIADO DE APOYO LEGAL BERNY ABARCA VEGA DEJAR DETENIDA DETENIDA A LA ORDEN LA FISCAL DE TURNO ADRIANA RODRIGUEZ CÓRDOBA FISCAL AUXILIAR DE SAN CARLOS POR EL DELITO 2. DE OBSTRUCCION A LA LABOR POLICIAL AL SER LAS 09:00 HORAS SE. CONFECCIÓNA INFORME POLICIAL PARA REMITIRLO A LA AUTORIDAD CORRESPONDIENTE” (sic). (Prueba aportada por el director general de la Fuerza Pública).
c. El comandante Junier Villalta Rubí, subdirector regional de la Dirección Chorotega Norte de la Fuerza Pública, mediante oficio MSP-DM-DVURFP-DGFP-DROHN-2619-2025 de 26 de noviembre de 2025, consignó: “El martes 25 de noviembre del año 2025 al ser aproximadamente las 06:00 horas dio inicio el desalojo ordenado en expediente 25-000857-0306- PE dispositivo en el cual participan autoridades como SINAC, Municipalidad de San Carlos, SENASA, PANI, Cruz Roja, Fuerza Pública, Ministerio Publico, Bomberos de Costa Rica Coopelesca, Policía de Migración, Dirección de Inteligencia y Seguridad del Estado. Durante su ejecución La (sic) Fuerza Pública entre otras diligencias estableció un perímetro en el área a desalojar, control de ingreso y salida de personas, identificación de personas, registro de estructuras, y otras enfocadas a garantizar la seguridad de las personas a desalojar, así como de las autoridades participantes (…) Al ser aproximadamente las 07:30 horas en el interior del área asegurada y en la cual se ejecutaba el desalojo judicial se observa a un grupo de aproximadamente cinco personas (ajenas al desalojo), se abordan por parte de personal de la Fuerza Pública y se les invita a salir de la zona a desalojar, una de estas personas indica que ella es abogada e incita a las demás personas para que no desalojen el lugar en forma voluntaria, grita que ella tiene documentos que autorizan a mantenerse el lugar, NO PRESENTO (sic) DOCUMENTACIÓN ALGUNA QUE ACREDITARA SU DECIR, se identifica como Nombre91426, en razón de ello se le solicita que se retire del lugar e incluso se le explica en reiteradas ocasiones que esa corresponde a un área que se está desalojando y que por razones de seguridad es necesario que se retiren, omite acatar las disposiciones de la Fuerza Pública mientras continúa gritando a las personas que estaban en el lugar que salieran, que no los podían sacar, obstruye la labor policial incitando a la gente a no salir de sus casas de forma voluntaria indicando que ella es representante de las personas desalojadas, por lo que es escoltada por parte de personal de la Fuerza Pública hacia fuera de la zona donde se ejecutaba el desalojo, no obstante, al pasar por una de las estructuras utilizada como pulpería (sin contar con permiso alguno), intenta introducirse a su interior e incluso se sienta en una banca ubicada en la parte inmediata externa y le dice a una de las ocupantes que le alcance café, por lo cual personal de la Fuerza Pública utilizado la Fuerza mínima y necesaria la intenta sustraer del lugar, momento en el cual intenta agredir a la figura de Policía Nombre91428, cédula de identidad CED51670, por lo cual a las 08:05 horas es aprehendida en el acto, se le comunica los derechos que le asisten; sea: conocer el motivo de su aprehensión, que le asiste el derecho a comunicarla a la persona, grupo de personas, asociación, agrupación o entidad a la que desee comunicar su aprehensión, ser asistido, desde el primer acto del procedimiento, por el defensor que designe él, sus parientes o la agrupación a la que se comunicó su captura y, en su defecto de éste (sic), por un defensor público, abstenerse de declarar y si acepta hacerlo, de que su defensor esté presente en el momento de rendir su declaración y en otras diligencias en las cuales se requiera su presencia.
Asimismo, el Licdo. Berny Abarca Vega; Asesor Legal Policial de la Región Chorotega Norte pone en conocimiento de los hechos a la Licda. Adriana Rodríguez Córdoba; Fiscal Auxiliar de San Carlos (misma que se encontraba participando en la ejecución del citado desalojo), e indica a las 08:15 horas, que se detenga a su orden por el delito de Resistencia para ser tramitado por el procedimiento expedito para los delitos en Flagrancia y se remita informe policial al respecto, así como las actas de verificación de domicilio, estado de salud, información de derechos del imputado a la Fiscalía de Flagrancias del II Circuito Judicial de Alajuela (San Carlos). Al respecto se confeccionó el informe policial con el consecutivo 0199641-2025. (…) La amparada Nombre91426 fue detenida por dirección funcional de la Fiscal Auxiliar de San Carlos Licda. Adriana Rodríguez Córdoba, por el delito de resistencia y otros.
(…) Según información proporcionada por la Fiscalía de Flagrancias del II Circuito Judicial de Alajuela (San Carlos), contra la amparada Nombre91426 dicha fiscalía abrió el expediente 25-001026-1261-PE por el delito de resistencia y otros, asimismo el 25 de noviembre del año 2025 fue indagada por dicha autoridad judicial y se le notificó audiencia para el 10 de diciembre del año 2025 en la Fiscalía de Flagrancias de San Carlos”. (Prueba aportada por el director general de la Fuerza Pública).
III.Sobre el caso concreto. En el sub lite, la parte accionante indica que, de forma arbitraria e infundada, la Fuerza Pública detuvo a la persona tutelada en la comunidad de Chorreras, en Cutris de San Carlos de Alajuela. Afirma que se desconoce el paradero de la amparada. Expone que, con ocasión del desalojo, derribo y demolición de la comunidad de Las Chorreras, la justiciable, quien se encontraba presente en el lugar, “puso en conocimiento de las fuerzas represivas del Estado de la existencia de dos recursos de amparo contra tales actos y fue en ese momento que la redujeron a la impotencia , le decomisaron ilegalmente su celular con el que ponia al pais al tanto de lo que ocurria en Chorreras y fue detenida, y traslada en una perrera con rumbo desconocido” (sic).
Del estudio de los autos se tiene por demostrado, que la persona tutelada tiene 42 años. El Informe de la Fuerza Pública nro. 199641-25 de 25 de noviembre de 2025, consignó las siguientes diligencias policiales: “1. AL SER LAS 08:10 SE REALIZANDO DESALOJO EN EL SECTOR Dirección5913 BAJO RESOLUCION NUMERO 967-2025 CAUSA NÚMERO 25-000857-0306-PE A LA HORA DE ESTAR REALIZANDO LA LABOR POLICIAL SE APERSONA AL LUGAR UNA FEMENINA DE NOMBRE Nombre91426 CEDULA CED25412 CON UNA CONDUCTA AGRESIVA AGITANDO LAS PERSONAS DEL LUGAR A QUE NO SALGAN LAS CUALES NO SE IDENTIFICAN Y QUE DESOVEDESCA LA ORDEN DE SALIR VULUMTARIAMENTE, OFENDIENDO A LA FIGURA DE LOS OFICIALES DE FUERZA PÚBLICA DICIENDO SINVERGÜENZAS POLICÍAS MUERTOS DE HAMBRE USTEDES NO SEBEN LO QUE HACEN MALDITOS, TAMBIEN INDICA QUE ELLA ES ABOGADA QUE LOS REPRESENTA PERO LA. Durante su ejecución La (sic) Fuerza Pública entre otras diligencias estableció un perímetro en el área a desalojar, control de ingreso y salida de personas, identificación de personas, registro de estructuras, y otras enfocadas a garantizar la seguridad de las personas a desalojar, así como de las autoridades participantes (…) Al ser aproximadamente las 07:30 horas en el interior del área asegurada y en la cual se ejecutaba el desalojo judicial se observa a un grupo de aproximadamente cinco personas (ajenas al desalojo), se abordan por parte de personal de la Fuerza Pública y se les invita a salir de la zona a desalojar, una de estas personas indica que ella es abogada e incita a las demás personas para que no desalojen el lugar en forma voluntaria, grita que ella tiene documentos que autorizan a mantenerse el lugar, NO PRESENTO (sic) DOCUMENTACIÓN ALGUNA QUE ACREDITARA SU DECIR, se identifica como Nombre91426, en razón de ello se le solicita que se retire del lugar e incluso se le explica en reiteradas ocasiones que esa corresponde a un área que se está desalojando y que por razones de seguridad es necesario que se retiren, omite acatar las disposiciones de la Fuerza Pública mientras continúa gritando a las personas que estaban en el lugar que salieran, que no los podían sacar, obstruye la labor policial incitando a la gente a no salir de sus casas de forma voluntaria indicando que ella es representante de las personas desalojadas, por lo que es escoltada por parte de personal de la Fuerza Pública hacia fuera de la zona donde se ejecutaba el desalojo, no obstante, al pasar por una de las estructuras utilizada como pulpería (sin contar con permiso alguno), intenta introducirse a su interior e incluso se sienta en una banca ubicada en la parte inmediata externa y le dice a una de las ocupantes que le alcance café, por lo cual personal de la Fuerza Pública utilizado la Fuerza mínima y necesaria la intenta sustraer del lugar, momento en el cual intenta agredir a la figura de Policía Nombre91428, cédula de identidad CED51670, por lo cual a las 08:05 horas es aprehendida en el acto, se le comunica los derechos que le asisten; sea: conocer el motivo de su aprehensión, que le asiste el derecho a comunicarla a la persona, grupo de personas, asociación, agrupación o entidad a la que desee comunicar su aprehensión, ser asistido, desde el primer acto del procedimiento, por el defensor que designe él, sus parientes o la agrupación a la que se comunicó su captura y, en su defecto de éste (sic), por un defensor público, abstenerse de declarar y si acepta hacerlo, de que su defensor esté presente en el momento de rendir su declaración y en otras diligencias en las cuales se requiera su presencia.
Asimismo, el Licdo. Berny Abarca Vega; Asesor Legal Policial de la Región Chorotega Norte pone en conocimiento de los hechos a la Licda. Adriana Rodríguez Córdoba; Fiscal Auxiliar de San Carlos (misma que se encontraba participando en la ejecución del citado desalojo), e indica a las 08:15 horas, que se detenga a su orden por el delito de Resistencia para ser tramitado por el procedimiento expedito para los delitos en Flagrancia y se remita informe policial al respecto, así como las actas de verificación de domicilio, estado de salud, información de derechos del imputado a la Fiscalía de Flagrancias del II Circuito Judicial de Alajuela (San Carlos). Al respecto se confeccionó el informe policial con el consecutivo 0199641-2025. (…) La amparada Nombre91426 fue detenida por dirección funcional de la Fiscal Auxiliar de San Carlos Licda. Adriana Rodríguez Córdoba, por el delito de resistencia y otros.
(…) Según información proporcionada por la Fiscalía de Flagrancias del II Circuito Judicial de Alajuela (San Carlos), contra la amparada Nombre91426 dicha fiscalía abrió el expediente 25-001026-1261-PE por el delito de resistencia y otros, asimismo el 25 de noviembre del año 2025 fue indagada por dicha autoridad judicial y se le notificó audiencia para el 10 de diciembre del año 2025 en la Fiscalía de Flagrancias de San Carlos”.
Desde este panorama, en los términos planteados en el escrito de interposición, se descarta alguna situación que, en este momento, amerite la intervención de la Sala.
Sobre el particular, la parte accionante no describe alguna situación de uso desproporcionado de la fuerza ni tampoco alega que se haya causado alguna lesión física de relevancia constitucional. En ese sentido, únicamente sostiene que fue “reducida a la impotencia” y, por su parte, las autoridades policiales señalan que se utilizó la “fuerza mínima”.
Ahora, aun cuando se acusa se la detención fue arbitraria e infundada, no menos cierto es que la Fuerza Pública, según el informe policial, abordó una situación de conflicto en la que estuvo involucrada la amparada, en virtud de la cual fue aprehendida y, posteriormente, puesta a la orden de la Fiscalía de Flagrancia del II Circuito Judicial de Alajuela (San Carlos), la cual le abrió una causa “por el delito de resistencia” y la indagó el mismo día e, incluso, le notificó la fecha de otra diligencia a realizarse el 10 de diciembre siguiente. Es decir, a los efectos de esta jurisdicción constitucional no constata alguna arbitrariedad manifiesta ni alguna actuación que haya desbordado el contenido del artículo 235 del Código Procesal Penal, sin perjuicio de que en la vía ordinaria se determine si ella cometió o no algún delito. Justamente, es en tal cauce procesal ordinario es donde la parte legitimada puede, si lo estima pertinente, someter a contradictorio su posición y evacuar prueba de forma amplia.
Por otro lado, el recurrente no demostró contar con algún vínculo jurídico que obligara a la Fuerza Pública a comunicarle a él el paradero de la tutelada, ni tampoco expuso haber solicitado tal información, por lo que prima facie no se observa alguna vulneración en ese sentido. A la fecha de interposición del recurso y hasta donde tuvo conocimiento el accionante (momento de la aprehensión), no se configura alguna transgresión susceptible de ser declarada en la vía del habeas corpus.
Finalmente, no corresponde a la Sala determinar si hubo o no algún decomiso ilegal del celular de la amparada. Más bien, las autoridades policiales señalaron que “se mantuvo provisionalmente en custodia” como parte “del Protocolo Para el abordaje, Conducción, Custodia y Traslado de aprehendidos de los Cuerpos Policiales Adscritos al Ministerio de Seguridad Pública”. De igual manera, la recurrente no se expuso alguna afectación concreta e individualizada que le haya ocurrido a la tutelada durante su traslado. Tampoco mencionó que haya comunicado alguna situación personal o condición médica que ameritaran ser tomadas en consideración.
Atinente al sub examine, la Sala, en la sentencia nro. 2025011242 de las 9:20 horas de 10 de abril de 2025, resolvió en un asunto cuyas consideraciones resultan aplicables:
“En primer lugar, respecto del motivo y dinámica de la aprehensión, a priori se descarta alguna situación lesiva de los derechos fundamentales del tutelado, susceptible de ser declarada en esta vía sumaria de habeas corpus.
Al respecto, de los elementos de prueba aportados a los autos se verifica que el 13 de marzo de 2025 el tutelado fue aprehendido por agentes del OIJ de Santa Cruz, toda vez que, en la sala de espera de esa dependencia, el justiciable se comportó de manera violenta, al punto que propició un golpe a uno de los funcionarios con el que se encontraba previamente dialogando. Esta situación, evidenciada en los videos incorporados a los autos, justificó el actuar policial, el cual no observa esta Cámara que haya sido desmedido o desproporcionado, pues simplemente los agentes le colocaron los dispositivos de seguridad (esposas metálicas) en sus manos y lo trasladaron a las celdas. De manera que en el sub iudice no se tiene por acreditado que los agentes judiciales hayan utilizado una fuerza de tal magnitud como para justificar la intervención de este Tribunal Constitucional.
Ahora bien, el recurrente cuestiona que la aprehensión se haya efectuado pese a que, a su juicio, no cometió ningún delito; sin embargo, se constata que por los hechos en cuestión al tutelado se le sigue un proceso penal por el delito de resistencia, que se tramita en el expediente nro. 25-000139-1260-PE ante el Tribunal de Flagrancia de Santa Cruz. En tal sentido, conviene resaltar que el ordinal 236 del Código Procesal Penal estatuye:
ARTICULO 235.-Aprehensión de las personas Las autoridades de policía podrán aprehender a toda persona, aun sin orden judicial, cuando:
Por su parte, el artículo 236 eiusdem dispone:
“ARTICULO 236.-Flagrancia Habrá flagrancia cuando el autor del hecho punible sea sorprendido en el momento de cometerlo o inmediatamente después, o mientras sea perseguido, o cuando tenga objetos o presente rastros que hagan presumir vehementemente que acaba de participar en un delito.”.
De tal manera, contrario a lo alegado por el accionante, la actuación policial cuestionada obedeció a hechos que se investigan como delito en una sumaria penal tramitada bajo el procedimiento de flagrancia, de modo que a los efectos de esta jurisdicción constitucional no se trata de una actuación ilegítima. Ahora, advierta el recurrente que no le compete a esta Cámara determinar si finalmente los hechos resultan constitutivos o no de un delito, ni tampoco establecer la calificación según la normativa penal sustantiva. Así, cualquier inconformidad con tales aspectos deberá formularla en la propia vía penal, a través de los mecanismos que la legislación procesal establece para tales efectos.
En consecuencia, en relación con estos extremos se declara sin lugar el recurso”.
Ergo, se declara sin lugar el recurso.
IV.Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel u objetos o pruebas contenidos en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados en un plazo máximo de 30 días hábiles, contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo material que no sea recogido dentro de ese lapso, con base en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial" (aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 de 22 de agosto de 2011 y publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012) y en el artículo LXXXI de la sesión del Consejo Superior del Poder Judicial nro. 43-12 de 3 de mayo de 2012.
Por tanto:
Se declara sin lugar el recurso.
