Writ of amparo (recurso de amparo) proceeding under case file number 25-029824-0007-CO, filed by Nombre91132, identity card CED51369, against the MUNICIPALIDAD DE BAGACES and the MUNICIPALIDAD DE LIBERIA.
Findings:
Along the same lines, the Environmental Management Unit has stated in official letter SGA-281-10-2025 as follows: “Regarding this case, my unit reports that it has provided solid waste collection services in the El Salto neighborhood of the canton of Liberia since June 2025. The specific case of this settlement known as “Salto Viejo,” consisting of approximately 35 single-family homes and located in a rural area far from urban centers, where solid waste collection service is not currently provided, will be analyzed. The analysis consists of a study of possession of the properties to determine whether they are registered, so that when solid waste collection service is provided in the future, the corresponding fee may be charged. The condition of the access roads to that locality and all financial aspects involved in expanding the service will likewise be analyzed to ensure the financial sustainability of the service.
A rate-updating study is currently being conducted, in which the future expenses to be incurred in municipal solid waste collection activities in the canton of Liberia will ultimately be included.” It has thus been demonstrated that this Municipal corporation has not violated the rights of the appellant (recurrente), since it has acted in accordance with law. SIXTH: With respect to the appellant’s assertion that the residents of the community of Nombre91133 have repeatedly and desperately requested that the roads be repaired, without receiving any response, it is important to clarify to this Chamber that such an assertion is inconsistent with the facts, because, according to the report of the Technical Road Management Unit, official letter PUTGV-1355-10-2025, the relevant portion states: “Although the records of the Technical Road Management Unit contain no formal request submitted by Mr.
Nombre91132, they do contain petition No. 169- 2025, submitted by Ms. Nombre91135, a resident of El Salto Viejo. Through official letter PUTGV-0613-05-2025, it was communicated that the maintenance work is scheduled for the second half of the year, specifically the first half of November. The Municipalidad de Liberia, mindful of its financial and operational limitations, conducts strategic planning that allows resources to be distributed equitably and efficiently. Road improvement projects are carried out based on technical prioritization established by professionals from the Technical Unit, the Junta Vial Cantonal, and the Concejo Municipal. This prioritization is based on socioeconomic assessments that consider criteria such as: • Connectivity and road-network concept • Average daily traffic • Access to basic services • Population density • Production volume In addition, the Technical-Social Feasibility Index (Índice de Viabilidad Técnico-Social, IVTS), established by the Sectoral Planning Secretariat of MOPT, may be applied.
Road infrastructure investment projects are carried out in accordance with the Road Conservation and Development Plan (Plan Vial de Conservación y Desarrollo, PVQCD) 2023–2027. Under this plan, the following work has been performed on the road connecting to El Salto Viejo: • 2023: Road clearing along 4 km of road C5-01-001. (…) It has thus been demonstrated that this Municipal corporation has not violated the appellant’s rights, since it has acted in accordance with law. SEVENTH: In addition to the foregoing, and with respect to the requests made by the appellant, the Technical Road Management Unit states in the relevant portion of its commentary report: “1. Comprehensively repair the public roads connecting the community of El Salto Viejo. The road is included in the Municipality’s maintenance plan, and work is performed annually; for 2025, it was scheduled (sic) for the last quarter of the year. 2.
That the Municipalidad de Liberia reconstruct the existing vehicular bridge and properly and safely repair the road connecting the community of El Salto Viejo, thereby ensuring its connection to the public road (sic) and allowing the safe passage of vehicles. Regarding the request to reconstruct the bridge, it is clarified that this is not a structural bridge but rather a ford-type crossing (paso tipo vado), specifically designed to withstand river flooding. This crossing has no structural damage posing a risk to users. The observed damage is located at the approaches to the ford and will be addressed as part of the maintenance work scheduled for November. In addition, improvements to signage on the approaches to the crossing are planned in order to enhance road safety in the area and provide greater clarity to drivers traveling through it. 3. Order immediate interim measures (medidas cautelares), such as the construction of Bailey bridges, to provide safe temporary passage for pedestrians and vehicles while the permanent works are carried out.
Regarding the request to order immediate interim measures, such as the construction of Bailey-type bridges to ensure safe temporary passage for pedestrians and vehicles, it is reported that this request is inadmissible at this time. This is because: • There are insufficient financial resources to carry out a project of that magnitude immediately. • The necessary technical studies, such as soil, hydraulic, and structural analyses, have not been conducted to determine the feasibility of installing a temporary bridge at the site. • Infrastructure projects require planning, budgeting, and institutional approval; therefore, immediate solutions cannot be implemented without compromising the project’s safety, legality, and sustainability. The Municipalidad de Liberia recognizes the need to improve access conditions for the community of Nombre91133 and remains committed to seeking viable alternatives within the applicable technical, legal, and budgetary framework.
In that regard, specific actions have already been carried out, such as the construction of a vehicular crossing over the El Salto River and a ford-type crossing over the Montañita stream, with the aim of facilitating residents’ travel and improving connectivity in the area. A bridge more than 50m long is preliminarily contemplated, with an estimated cost of more than $1.200.000. CONCLUSION: Based on the foregoing considerations, the cited legal grounds and constitutional precedents, it is concluded that the Municipalidad de Liberia has acted in accordance with law, fulfilling the powers and obligations imposed upon it by law and adopting progressive measures to ensure that users can travel under conditions of safety, accessibility, and inclusion. In this case, the Municipalidad de Liberia has taken the necessary action to address the needs of the community of El Salto Viejo through work planned and carried out in accordance with available resources and current regulations.
Therefore, no omission or inaction may be attributed to the administration, since the problem has been addressed responsibly and within a reasonable period. Finally, although the appellant states that no response was received to the requests submitted by the community, all of them were duly addressed in a timely and proper manner. The stated needs have been addressed in accordance with resource availability, with the projects incorporated into the canton’s process for prioritizing work. Nevertheless, the construction of a bridge over the El Salto River is currently beyond this municipality’s capabilities due to a lack of resources, the absence of prior technical studies, and the project’s limited economic feasibility, considering the relationship between its high implementation cost and the number of direct beneficiaries.” It has thus been demonstrated that this Municipal corporation has not violated the appellant’s rights, since it has acted in accordance with law.
EIGHTH: The appellant’s allegation that no effective action has been taken to resolve the reported problem is therefore untrue, since the appropriate measures have been undertaken as required and within the Municipality’s authority, as we have demonstrated to this Honorable Constitutional Chamber. Accordingly, the appellant’s constitutional rights have not been violated, and it is therefore requested that it be declared (…) RELIEF REQUESTED: From the foregoing considerations, legal grounds, and cited documents, it can be determined that the fundamental rights alleged by the appellant have not been violated, because the Municipalidad de Liberia has acted in accordance with law, within its authority and with the financial and human resources available to it, consistent with the powers and obligations imposed upon it by Law. Based on the foregoing, I request that this application for constitutional relief (recurso de amparo) against the party I represent be dismissed in its entirety and that the appellant be ordered to pay the costs of this action.”
Justice Rueda Leal drafts the decision; and, Whereas (Considerando):
It must be clarified that, since judgment no. 2008-02545 issued at 08:55 hours on 22 de febrero de 2008, this Chamber has referred to the contentious-administrative jurisdiction (jurisdicción contenciosa‑administrativa) those matters in which the issue is whether the Public Administration has complied with the time limits established by the General Law on Public Administration (Ley General de la Administración Pública) (Articles 261 and 325) or by sector-specific laws governing special administrative proceedings (procedimientos administrativos especiales), for issuing a final administrative act (acto final) deciding an administrative proceeding—initiated ex officio or at the request of a party—or for deciding the corresponding administrative appeals (recursos administrativos). Nevertheless, it has also recognized exceptions to the foregoing, as in the present case, since the grievance concerns alleged complaints regarding circumstances that endanger the life and physical integrity of the persons residing in the community of El Salto Viejo. In matters of this type, constitutional case law has deemed constitutional review (control de constitucionalidad) appropriate; accordingly, the matter sub judice is hereby decided.
II-. SUBJECT MATTER OF THE APPEAL. The appellant states that the community of Nombre91133 is located along the boundary between Liberia and Bagaces. He states that the access route through Bagaces allows only pedestrian passage, because there is no vehicular bridge and the road has never been asphalted. He explains that the access route through Liberia provides only a vehicular crossing in poor condition, and its bridge is in critical condition. He complains that when it rains, both access routes are impossible to use except by 4x4 vehicles. He alleges that this situation restricts public transportation, waste collection, and access by emergency vehicles. He maintains that they have raised the problem with the local governments of Liberia and Bagaces; however, they have received no response.
The following facts are deemed duly established and relevant to the determination of this matter:
The cantonal road network (red vial cantonal) of Liberia includes roads C5-01-001: Dirección5850- Nombre91133 and C5-01-094: Route no. 1 – Salto Viejo intersection. (See documentary evidence).
The cantonal road network of Bagaces includes road 5-04-026, which begins at the junction with National Route no. 1, passes through the community of El Salto de Bagaces, and ends at the cantonal boundary with Liberia, Río El Salto. (See documentary evidence).
By a memorial bearing the Municipalidad de Liberia’s received stamp dated 28 de enero de 2018, residents of the community of Nombre91133 requested graveling work (trabajos de lastreados) to address the problem caused during the dry season by dust rising from the road. (See documentary evidence).
In 2018, residents of the community of Nombre91133 submitted requests to the Municipalidad de Liberia for the construction of a pedestrian bridge over the Río El Salto. (See documentary evidence).
The pedestrian bridge over the Río El Salto was built between 2018 and 2019. (See documentary evidence).
By official letter MB-UTGV-0246-2018 of 26 de junio de 2018, the UTGV of Bagaces informed female residents of Nombre91133 that the needs concerning construction of a vehicular bridge at Dirección5851– would be presented to the Junta Vial Cantonal for analysis. (See documentary evidence).
By a memorial bearing a received date of 27 de junio de 2018, residents of Nombre91133 submitted a request to the Municipalidad de Liberia asking that the vehicular bridge project in the Salto Viejo-Quebrada La Montañita sector be included in the supplementary budget (presupuesto extraordinario), because the community faced an access problem that left it practically isolated from both Liberia and Bagaces. (See documentary evidence).
By OFICIO-UTGV-640-2018 of 17 de julio de 2018, the UTGV of the Municipalidad de Liberia stated that the request would be presented to the Comité Municipal de Emergencias so that it could be submitted to the CNE to assess the feasibility of constructing the bridges. (See documentary evidence).
In 2019, the Municipalidad de Liberia constructed a ford-type crossing (paso tipo vado) in the Montañita sector. (See documentary evidence).
By a document bearing the Municipalidad de Liberia’s received stamp dated 28 de febrero de 2019, the Comité de Caminos Nombre91133 stated that the lack of adequate infrastructure, due to the absence of vehicular bridges over the Quebrada La Montañita and the Río El Salto, kept the community isolated, and therefore requested their construction. (See documentary evidence).
By memorial UTGV:270-2019 of 22 de abril de 2019, the UTGV of the local government of Liberia informed the Comité de Caminos de Nombre91133 that construction of a ford in the Quebrada La Montañita sector was planned for 2019. (See documentary evidence).
By an official letter bearing the Municipalidad de Liberia’s received stamp dated 18 de junio de 2019, the Comité de Caminos Nombre91133 reported that the road from Quebrada La Montañita toward their community required graveling because it was eroded by rainfall and was impassable. They also stated that drainage work was urgently needed. (See documentary evidence).
By an official letter bearing the Municipalidad de Bagaces’s received stamp dated 27 de julio de 2019, the Comité de Caminos de Nombre91133 reported the poor condition of four culvert crossings (cruces de alcantarillas) along the route between the eastern corner of the sports field and the pedestrian bridge. (See documentary evidence).
In 2024, the Municipalidad de Liberia carried out a regraveling project (proyecto de relastreo) on the section between the Puente La Arena and the Quebrada La Caraña. (See documentary evidence).
In 2025, approximately 4 km of the road serving as the main access route to El Salto Viejo was improved. (See documentary evidence).
On 16 de octubre de 2025, the respondent authorities (autoridades recurridas) of the Municipalidad de Liberia were served with notice of the order admitting this proceeding (resolución de curso). (See certificates of service).
By official letter (oficio) SGA-281-10-2025 dated October 17, 2025, the Environmental Manager of the Municipality of Liberia stated: “The specific case of this settlement called “salto viejo,” consisting of approximately 35 single-family homes located in a rural area far from urban centers and currently not receiving solid-waste collection service, will be analyzed. The analysis consists of a study of possession of the properties to determine whether they are registered and so that, when solid-waste collection service is provided in the future, the corresponding fee may be charged. The condition of the access roads to that locality and all the financial aspects involved in expanding the service will likewise be analyzed in order to ensure the financial sustainability of the service. A rate-update study is currently being (sic) conducted, which is where the future expenses to be incurred in municipal solid-waste collection activities in the canton of Liberia will ultimately be included.” (See documentary evidence).
On October 17, 2025, the Municipality of Liberia inspected the condition of the ford (vado) and determined that it was in fair condition but passable by all types of vehicles, and that the observed damage was consistent with conditions typical of a gravel road during the rainy season. It was also recorded that the damage was located at the approaches to the ford, for which maintenance work was scheduled for November 2025. (See documentary evidence).
On October 30, 2025, the mayor of Bagaces was served with notice of the order initiating these proceedings. (See certificate of service).
On November 3, 2025, the head of the UTGV of Bagaces was served with notice of the order initiating these proceedings. (See certificate of service).
By official letter MB-UTGV-OFI-625-2025 dated November 3, 2025, the UTGV of the Municipality of Bagaces explained: “2- That the road segment located within the boundaries of Bagaces has a length of 1,43km, of which the first 666m are paved and the remaining 764m have a gravel road surface in good condition (…) That, as may be seen in the following images, within that segment located at Dirección5849, the works under SICOP procurement 2023LE-000002-0040100001 were carried out in 2024, including construction of a double culvert crossing to improve stormwater management for an intermittent stream and improvement of a 120m road segment through the placement of granular material and application of a bituminous surface treatment. This project had been requested by the community of El Salto de Bagaces to improve conditions for persons traveling to the neighboring canton (El Salto Viejo), as may be seen in the attached request, and involved an investment of ₡18 195 086,00 (…) 6- That, on that gravel road segment located between Dirección5849 and the cantonal boundary, work was performed in late October 2025 under the Force Account Works modality (Obras por Administración), at a cost exceeding 10 million colones solely for materials and machinery, excluding labor.
In that sector, earthen ditches were mechanically cleared, the road surface was graded, a culvert crossing was installed, and 705 cubic meters of granular material were placed and compacted as a wearing course, as may be seen in detail in the following photographs (…)”. (See documentary evidence).
By official letter PUTGV-1575-11-2025 dated November 17, 2025, the UTGV of Liberia stated that maintenance had been performed in the sector at issue in this petition during the first half of November 2025 and explained: “Road C5-01-001: Dirección5850 - Nombre91133 The road is in good condition, with a stable surface suitable for vehicular traffic. No significant damage, such as subsidence, erosion, or loss of material, is observed. Signage and drainage systems are functioning properly, allowing safe traffic flow. Road C5-01-094: Route No. 1 - Salto Viejo Junction This segment is likewise in optimal condition, with a uniform road surface and no damage compromising safety. · The road has a surface treatment that has not been affected. · Regarding the condition of the crossings over quebrada La Montañita and río El Salto, the following is reported: Crossing over quebrada La Montañita: Work was performed on the crossing on the dates indicated, and it is currently open and in good condition, with no obstructions or damage to the structures.
Incidents: No overflows or deterioration of the protective works have been reported. · Crossing over río El Salto: As indicated, this river is crossed directly through the channel, and therefore work cannot be performed on it. To ensure connectivity in the sector, the Municipality constructed a pedestrian bridge, which is fully operational and in optimal condition. It is clarified at this point that vehicular access continues to be provided by roads C5-01-001: urbanización Daniel Oduber- Nombre91133 and C5-01-094: route no. 1 Salto Viejo junction (…)”. In the sub lite, the petitioner states that the community Nombre91133 is located along the boundary between Liberia and Bagaces. The petitioner indicates that the access route to Bagaces permits pedestrian passage only because there is no vehicular bridge and the road has never been paved. The petitioner asserts that the access route to Liberia has only one vehicular crossing, which is in poor condition and whose bridge is in critical condition. The petitioner complains that when it rains, it is impossible to use either access route, except with 4x4 vehicles. The petitioner alleges that this situation restricts public transportation, waste collection, and access by emergency vehicles. The petitioner maintains that they have raised the issue with the local governments of Liberia and Bagaces but have received no response.
The evidence shows that the cantonal road network (red vial cantonal) of Liberia includes roads C5-01-001: urbanización Daniel Oduber- Nombre91133 and C5-01-094: Dirección5852– . By a submission bearing a receipt stamp from the Municipality of Liberia dated January 28, 2018, residents of the community Nombre91133 requested gravel-surfacing work to address the problem caused during the dry season by dust rising from the road. In 2018, residents of the community Nombre91133 submitted requests to the Municipality of Liberia for the construction of a pedestrian bridge over río El Salto. Between 2018 and 2019, the pedestrian bridge over río El Salto was constructed. By a submission received on June 27, 2018, residents of Nombre91133 filed a request with the Municipality of Liberia seeking the inclusion of the vehicular bridge project in the Salto Viejo-quebrada La Montañita sector in the supplemental budget, because the community faced an access problem that left it practically isolated from both Liberia and Bagaces.
By OFICIO-UTGV-640-2018 dated July 17, 2018, the UTGV of the Municipality of Liberia stated that the request would be presented to the Municipal Emergency Committee so that it could be referred to the CNE for an assessment of the feasibility of constructing the bridges. By a document bearing a receipt stamp from the Municipality of Liberia dated February 28, 2019, the Road Committee of Nombre91133 stated that the lack of adequate infrastructure resulting from the absence of vehicular bridges over quebrada la Montañita and río El Salto kept the community isolated, and therefore requested their construction. By submission UTGV:270-2019 dated April 22, 2019, the UTGV of the local government of Liberia informed the Road Committee of Nombre91133 that construction of a ford in the quebrada La Montañita sector was planned for 2019. By an official letter bearing a receipt stamp from the Municipality of Liberia dated June 18, 2019, the Road Committee of Nombre91133 reported that the road from quebrada la Montañita toward their community required gravel surfacing because it suffered rain erosion and was impassable.
They also stated that work on the drainage systems was urgently required. In 2019, the Municipality of Liberia constructed a ford-type crossing in the Montañita sector. In 2024, the Municipality of Liberia carried out a gravel-resurfacing project on the segment between puente La Arena and quebrada La Caraña. In 2025, approximately 4 km of the road serving as the main access route to El Salto Viejo was improved. On October 17, 2025, the Municipality of Liberia inspected the condition of the ford and determined that it was in fair condition but passable by all types of vehicles, and that the observed damage was consistent with conditions typical of a gravel road during the rainy season. It was also recorded that the damage was located at the approaches to the ford, for which maintenance work was scheduled for November 2025. By official letter PUTGV-1575-11-2025 dated November 17, 2025, the UTGV of Liberia stated that maintenance had been performed in the sector at issue in this petition during the first half of November 2025 and explained: “Road C5-01-001: Dirección5850 - Nombre91133 The road is in good condition, with a stable surface suitable for vehicular traffic.
No significant damage, such as subsidence, erosion, or loss of material, is observed. Signage and drainage systems are functioning properly, allowing safe traffic flow. Road C5-01-094: Route No. 1 - Salto Viejo Junction This segment is likewise in optimal condition, with a uniform road surface and no damage compromising safety. · The road has a surface treatment that has not been affected. · Regarding the condition of the crossings over quebrada La Montañita and río El Salto, the following is reported: Crossing over quebrada La Montañita: Work was performed on the crossing on the dates indicated, and it is currently open and in good condition, with no obstructions or damage to the structures. Incidents: No overflows or deterioration of the protective works have been reported. · Crossing over río El Salto: As indicated, this river is crossed directly through the channel, and therefore work cannot be performed on it.
To ensure connectivity in the sector, the Municipality constructed a pedestrian bridge, which is fully operational and in optimal condition. It is clarified at this point that vehicular access continues to be provided by roads C5-01-001: urbanización Daniel Oduber- Nombre91133 and C5-01-094: route no. 1 Salto Viejo junction (…)”.
Accordingly, although the petitioner alleges inaction by the local government of Liberia in providing adequate maintenance to the roads at issue in this matter, the record shows that the municipal government has indeed performed maintenance and improvement work. Moreover, through the evidence requested by this Chamber to better adjudicate the matter (prueba para mejor resolver), the Municipality of Liberia clarified in official letter PUTGV-1575-11-2025 dated November 17, 2025, that those roads are in good condition. Therefore, the petition is denied as to this claim.
V.On the other hand, it should be recalled that the petitioner also alleges that waste-collection service is not provided in the community of El Salto Viejo.
In view of the foregoing, it is appropriate to refer to judgment no. 2025024083 issued at 9:15 a.m. on August 1, 2025, which addressed a claim similar to the one raised in the sub iudice:
“III.- REGARDING THE GARBAGE COLLECTION SERVICE. This Chamber has repeatedly held that service users should not have to bear the deficiencies of the Administration. Accordingly, by judgment number 2019-5623 at 09:45 hours on 29 de marzo de 2019, in a similar matter concerning the failure of a municipal district council to provide garbage collection services, this jurisdiction ruled:
“V.- Regarding the garbage collection service. On repeated occasions, this Constitutional Court has addressed the constitutional principles governing the provision of public services and the fundamental right to their efficient provision, which entails that, regardless of the type of service, they must be provided to high quality standards, the necessary corollary of which is the obligation of public administrations to provide them continuously, regularly, promptly, effectively, and efficiently (see, to that effect, judgments numbers 2003-11382 at 15:11 hours on 07 de octubre de 2003 and 2011-003043 at 16:03 hours on 08 de marzo de 2011). Likewise, Article 169 of the Political Constitution establishes the duty of the country’s Municipalities to safeguard the interests of the inhabitants within their jurisdiction; hence, in repeated rulings, this Court has stated that those corporations are obligated to eliminate any type of threat that endangers the rights to health and to a healthy and ecologically balanced environment of the people living in their canton (see, to that effect, judgments 2008-11739 at 12:12 hours on 25 de julio de 2008 and 2011-003043 at 16:03 hours on 08 de marzo de 2011).
In the case at bar (sub lite), based on the report submitted under oath and the evidence entered into the case record (expediente), this Chamber established that garbage is not currently collected in the locality of Santa Fe de Cóbano, thereby demonstrating an infringement of the appellant’s fundamental rights. This is because it was verified that the appellant must travel up to 4 kilometers to find a location where garbage is collected so that he can leave his waste there. Furthermore, according to the respondent authority, the information needed to determine the most appropriate way to provide the service in that community beginning in the final quarter is being gathered. Although the respondent authority attempts to justify the lack of garbage collection in that locality on the grounds that, since June, the Ministerio de Salud ordered the closure of the Vertedero Municipal, requiring solid waste to be transported to the community of Montes de Oro in Miramar de Puntarenas, the fact remains that this situation does not release it from its obligation to provide garbage collection services to users in its communities.
On the contrary, it should take measures to resolve that situation, especially since it has been aware of it since June de 2017. This Chamber has repeatedly held that service users should not have to (sic) bear the deficiencies of the Administration. Accordingly, the Chamber established that the garbage collection service in the locality of Santa Fe de Cóbano is not stable; therefore, the appropriate course is to grant the application for constitutional relief (recurso), as to this issue and as will be stated in the operative portion (parte dispositiva) of this judgment” (emphasis not in the original).
The report submitted under oath by the respondent authority establishes an infringement of the protected party’s fundamental rights for the reasons set forth below. In this regard, it is established that, in a written request dated 27 de marzo de 2025, the appellant asked the Mayor of the respondent authority to provide garbage collection service at his property. However, he was verbally told that, because his neighbors within a radius of 300 meters do not wish to pay for the service, it was being denied to him, which he does not consider valid. He further states that his wife has a disabling condition, receives a pension under the IVM system, and cannot perform tasks involving extreme physical exertion. He requests the technical and legal grounds for not collecting his garbage from his home. Furthermore, it is established that, in official letter MU-MA-OFIC-049-2025 of 10 de abril de 2025, Luis Diego Mora Jimenez (sic), an official of the Unidad de Gestión Ambiental of the respondent Municipalidad, informed the appellant that, once the survey (levantamiento) of the area in which he was requesting garbage collection service had been completed, he would be notified of the date on which the service would begin, in accordance with Article 11 of the Reglamento para la Gestión Integral de Residuos Sólidos del cantón de Upala.
It should be noted that, to date, more than three months have elapsed since the respondent municipal corporation informed the appellant that, once the survey of the area in which he was requesting garbage collection service had been completed, he would be notified of the date on which the service would begin. There is no evidence that this has yet been done, to the detriment of the appellant’s fundamental rights.
Regarding garbage collection and the proper disposal of waste, this Court has repeatedly held in its case law that, pursuant to Article 169 of the Political Constitution, municipalities are responsible for administering the local interests and services of their respective cantons. This authority includes the collection, final disposal, and treatment of solid waste generated within those territorial jurisdictions. Indeed, this is an unavoidable duty that, beyond protecting a healthy and ecologically balanced environment, directly affects people’s health. From that perspective, the problems caused by the improper disposal and management of solid waste transcend the local sphere and become a public health problem, in relation to which budgetary and financial justifications cannot be accepted to validate any omission or unjustified delay by those municipal corporations in protecting these rights (see judgment No. 2011010416 at twelve hours and forty-nine minutes on cinco de agosto del dos mil once). In view of the foregoing, the authorities of the Municipalidad de Upala must exercise greater diligence, pursuant to Article 169 of the Political Constitution, in their capacity as administrators of local interests and services. Accordingly, the present application must be granted, with the consequences set forth in the operative portion (…)
POR TANTO: The application is granted. Aura Yamileth López Obregón, in her capacity as Mayor, and Adilia Reyes Calero, in her capacity as President of the Concejo Municipal, both officials of the Municipalidad de Upala, or whoever may hold those positions in their stead, are ordered to adopt the appropriate and necessary measures so that, within 1 month from notification of this judgment, actions are arranged to expand the availability of garbage collection services to the appellant’s residence. The respondents are advised that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in an application for constitutional relief (recurso de amparo), which they are required to comply with or enforce, and fails to comply with or enforce it, shall be sentenced to imprisonment for three months to two years, or twenty to sixty day-fines (días multa), provided that the offense is not subject to a more severe penalty.
The Municipalidad de Upala is ordered to pay the legal costs, damages, and losses caused by the acts forming the basis of this ruling, which shall be quantified in enforcement proceedings before the contentious-administrative jurisdiction (ejecución de sentencia de lo contencioso administrativo). Let notice be served.” The Court considers that the precedent quoted above applies to the matter under examination (sub examine), since there are no grounds for departing from the view expressed therein or reasons for assessing the situation presented differently.
In the case under review, by official letter SGA-281-10-2025 of 17 de octubre de 2025, the Environmental Manager of the Municipalidad de Liberia stated: “The specific case of this hamlet called “salto viejo,” consisting of approx. 35 single-family dwellings, which is located in a rural area far from urban centers and which currently does not receive solid-waste collection service, will be analyzed. The analysis consists of a study of possession of the properties to determine whether they are registered and so that, when solid-waste collection service is provided in the future, the corresponding fee may be charged. The condition of the roads providing access to that locality and all financial aspects involved in expanding the service will likewise be analyzed to ensure the service’s financial sustainability. A rate-update study is currently being (sic) conducted, in which the future expenses to be incurred in municipal solid-waste collection activities in the canton of Liberia will ultimately be included” (emphasis added).
Accordingly, in the case before the Court (sub iudice), it is deemed established that the community of Nombre91133 is not provided with waste collection service, a situation that affects not only the protection of a healthy and ecologically balanced environment but also people’s health. For that reason, the application must be granted as against the Municipalidad de Liberia with respect to this issue.
VI.As regards the Municipalidad de Bagaces, it has been established that road 5-04-026 is part of the cantonal road network (red vial cantonal) of Bagaces; it begins at the junction with National Route No. 1, passes through the community of El Salto de Bagaces, and ends at the cantonal boundary with Liberia, Río El Salto. By official letter MB-UTGV-0246-2018 dated 26 de junio de 2018, the Bagaces UTGV informed residents of Nombre91133 that the needs concerning the construction of a vehicular bridge (puente vehicular) at Dirección5851– would be submitted to the Cantonal Road Board (Junta Vial Cantonal) for analysis. By official letter bearing the Municipalidad de Bagaces receipt stamp dated 27 de julio de 2019, the Nombre91133 Road Committee reported the poor condition of four culvert crossings (cruces de alcantarillas) along the section between the eastern corner of the sports field and the pedestrian bridge.
Through official letter MB-UTGV-OFI-625-2025 dated 3 de noviembre de 2025, the UTGV of the Municipalidad de Bagaces explains: “2- That the section of road located within the boundaries of Bagaces is 1,43km long, of which the first 666m are paved with asphalt and the remaining 764m have a gravel wearing surface (superficie de ruedo en lastre) in good condition (…) That, as can be seen in the following images, the work under SICOP procurement contract 2023LE-000002-0040100001 was carried out in 2024 on that section located at Dirección5849, where a double culvert crossing (paso de alcantarilla doble) was built to improve stormwater management (manejo de aguas pluviales) for an intermittent stream, and a 120m section of road was improved by placing granular material and applying a bituminous surface treatment (tratamiento superficial bituminoso). This project had been requested by the community of El Salto de Bagaces to improve conditions for people traveling to the neighboring canton (El Salto Viejo), as can be seen in the attached request, and involved an investment of ₡18 195 086,00 (…) 6- That, at the end of octubre del 2025, work was performed on that gravel road section located between Dirección5849 and the cantonal boundary under the Direct Administration Works method (Obras por Administración), at a cost exceeding 10 million colones solely for materials and machinery, excluding labor.
The work in that area consisted of mechanically clearing unlined earth ditches, grading the wearing surface, installing a culvert crossing, and placing and compacting 705 cubic meters of granular material as a wearing course (capa de rodadura), as can be seen in detail in the following photographs (…)”.
In view of the foregoing, no violation of the protected party’s fundamental rights has been established with respect to the Municipalidad de Bagaces under the terms in which the matter was raised. It should be noted that the record shows that the Bagaces cantonal road connecting to the community of Nombre91133 is in good condition; indeed, a double culvert crossing was built in 2024, while in octubre de 2025 work was performed on the gravel section of the road, including “mechanically clearing unlined earth ditches, grading the wearing surface, installing a culvert crossing, and placing and compacting 705 cubic meters of granular material as a wearing course, as can be seen in detail in the following photographs (…)”. Accordingly, there is no indication of any omission by the local government of Bagaces that infringed the protected party’s fundamental rights in the manner alleged. Additionally, the appellant is advised that it is not for this Court to determine, based on the particular circumstances of the case under review and the subconstitutional legislation (normativa infraconstitucional) governing the matter, whether construction of a vehicular bridge over the Río El Salto is warranted as requested.
VII.NOTE BY JUSTICE CASTILLO VÍQUEZ REGARDING PROMPT AND EFFECTIVE ADMINISTRATIVE JUSTICE (JUSTICIA ADMINISTRATIVA PRONTA Y CUMPLIDA). I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and effective justice in administrative proceedings (sede administrativa), the legal dispute must be heard by the Administrative Litigation Courts (Tribunales de lo Contencioso-Administrativo), rather than by this Chamber. However, with the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, it has been established that this right is eligible for judicial protection through the amparo proceeding (recurso de amparo) established by Article 32 of the Ley de la Jurisdicción Constitucional, in conjunction with Article 27 of the Constitución Política de la República de Costa Rica, in those cases in which the petitioner considers that the Administration’s material actions, administrative acts, or response are affecting the petitioner’s fundamental rights.
In my view, the recently enacted legislation does not require this Court to alter its line of precedent, since, pursuant to section 7 of its Law, it has exclusive authority to define its own jurisdiction. Therefore, except for those constitutional-law disputes that this Chamber itself has recognized as exceptional cases and that may indeed be heard in this jurisdiction through the constitutional amparo protection proceeding (proceso constitucional de garantía del amparo), in all other cases, and for the reasons given by this Court (judgment N° 2008-02545 at 8:55 hours on 22 de febrero de 2008), jurisdiction lies with the judges of the administrative litigation jurisdiction (jurisdicción de lo contencioso-administrativo). All of this is consistent with section 25 of the Convención Americana sobre Derechos Humanos, the Law of the Constitution (Derecho de la Constitución)—its values, principles, and rules—and the corresponding statutory provisions, based on a logical, systemic, and purposive interpretation of the legal system.
As a matter of principle, I consider that cases relating to inaction by the Public Administration in the repair, construction, modification, or demolition of any infrastructure work should be dismissed because such an omission is a matter of statutory legality (legalidad), the discussion of which falls within the ordinary jurisdiction, where the interested person may present objections more fully. However, when such administrative failure to act results in a violation of other fundamental rights protected in this constitutional jurisdiction, or affects groups considered vulnerable, I do examine the merits of the matter, because that situation constitutes an exception to my position on this issue, as occurs in this case, in which the appellant alleges the apparent poor condition of the access road to El Salto Viejo, in Bagaces, placing at risk the safety of residents and persons traveling through the area, but which purportedly has not been addressed by the competent authority.
The parties are hereby advised that, if they have submitted any paper documents, objects, or evidence contained on any additional electronic, computerized, magnetic, optical, or telematic device, or produced using new technologies, such items must be retrieved within a maximum period of 30 business days from service of this judgment. The parties are warned that any material not collected within that period will be destroyed pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial” (approved by the Corte Plena in Article XXVI of session nro. 27-11 of 22 de agosto de 2011 and published in Boletín Judicial nro. 19 of 26 de enero de 2012) and Article LXXXI of session nro. 43-12 of the Consejo Superior del Poder Judicial dated 3 de mayo de 2012.
Por tanto:
The amparo petition is partially granted solely with respect to the Municipalidad de Liberia for its failure to collect waste. José Calvo Darcia and Dorian Ulate Elizondo, in their respective capacities as mayor and director of the Unidad Técnica de Gestión Vial, both of the Municipalidad de Liberia, or whoever holds those offices, are ordered to coordinate the necessary measures and undertake all actions within the scope of their respective authority so that, within a maximum period of ONE MONTH from service of this judgment, the availability of garbage collection service is extended to the community of El Salto Viejo. This order is issued with the warning that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo proceeding that the person is required to comply with or enforce, and who fails to comply with or enforce it, shall be subject to imprisonment for three months to two years or a fine of twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty.
The Municipalidad de Liberia is ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment in the administrative litigation jurisdiction. In all other respects, the petition is denied. Justice Castillo Víquez files a note. Justice Salazar Alvarado files a note. Let notice be given.

Recurso de amparo que se tramita en expediente número 25-029824-0007-CO, interpuesto por Nombre91132, cédula de identidad CED51369, contra la MUNICIPALIDAD DE BAGACES y la MUNICIPALIDAD DE LIBERIA.
Resultando:
Redacta el Magistrado Rueda Leal; y,
Considerando:
Debe aclararse que, a partir de la sentencia nro. 2008-02545 de las 08:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contenciosa‑administrativa aquellos asuntos, en los que se discute si la Administración Pública ha cumplido o no los plazos fijados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales en los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo ‑instruido de oficio o a instancia de parte‑ o conocer de los recursos administrativos correspondientes. Sin embargo, también ha contemplado casos de excepción a lo anterior, como sucede en la especie, toda vez que el agravio se refiere a presuntas denuncias sobre situaciones que ponen en riesgo la vida e integridad física de las personas que residen en la comunidad El Salto Viejo. En este tipo de materia, la jurisprudencia constitucional ha estimado procedente la aplicación del control de constitucionalidad, de modo que se procede a resolver el sub iudice.
II-. OBJETO DEL RECURSO. El recurrente indica que la comunidad Nombre91133 se ubica entre el límite entre Liberia y Bagaces. Señala que la vía de acceso con Bagaces solo permite el paso peatonal, ya que no existe un puente vehicular y el camino nunca ha sido asfaltado. Expone que el acceso con Liberia únicamente cuenta con paso vehicular en mal estado, cuyo puente se encuentra en estado crítico. Reclama que cuando llueve es imposible utilizar ambos accesos, el cual se limita a vehículos 4x4. Acusa que tal situación limita el transporte público, recolección de residuos y el ingreso de vehículos de emergencias. Sostiene que han planteado la problemática ante los gobiernos locales de Liberia y Bagaces; sin embargo, no han obtenido respuesta.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
En la red vial cantonal de Liberia se cuenta con los caminos C5-01-001: Dirección5850- Nombre91133 y C5-01-094: ruta nro. 1 – cruce Salto Viejo. (Ver prueba documental).
En la red vial cantonal de Bagaces se encuentra el camino 5-04-026 que inicia en el entronque con la ruta Nacional nro. 1, atraviesa a la comunidad de El Salto de Bagaces y finaliza en el límite cantonal con Liberia, Río El Salto. (Ver prueba documental).
Por memorial con sello de recibido de la Municipalidad de Liberia del 28 de enero de 2018, vecinos de la comunidad Nombre91133 solicitaron trabajos de lastreados para resolver la problemática sufrida en verano por el levantamiento de polvo de la calle. (Ver prueba documental).
En el año 2018, vecinos de la comunidad Nombre91133 plantearon gestiones ante la Municipalidad de Liberia a los efectos de que se construyera un puente peatonal sobre el río El Salto. (Ver prueba documental).
Entre los años 2018 y 2019 se construyó el puente peatonal sobre el río El Salto. (Ver prueba documental).
Mediante oficio MB-UTGV-0246-2018 del 26 de junio de 2018, la UTGV de Bagaces comunicó a vecinas de Nombre91133 que las necesidades respecto a la construcción de un puente vehicular en el Dirección5851– serían presentadas a la Junta Vial Cantonal para su análisis. (Ver prueba documental).
Por memorial con fecha de recibido 27 de junio de 2018, vecinos de Nombre91133 formularon una gestión ante la Municipalidad de Liberia, por medio de la cual requirieron que en el presupuesto extraordinario se incluyera el proyecto de puente vehicular en el sector Salto Viejo-Quebrada La Montañita, ya que en la comunidad existe una problemática de acceso que los mantiene prácticamente aislados tanto de Liberia como de Bagaces. (Ver prueba documental).
Por OFICIO-UTGV-640-2018 del 17 de julio de 2018, la UTGV de la Municipalidad de Liberia indicó que la solicitud sería presentada ante el Comité Municipal de Emergencias, a fin de que fuera elevada a la CNE para valorar la viabilidad de construcción de los puentes. (Ver prueba documental).
En el año 2019, la Municipalidad de Liberia construyó un paso tipo vado en el sector de la Montañita. (Ver prueba documental).
Mediante escrito con sello de recibido por la Municipalidad de Liberia del 28 de febrero de 2019, el Comité de Caminos Nombre91133 externó que la ausencia de infraestructura adecuada ante la inexistencia de puentes vehiculares en la quebrada la Montañita y el río El Salto mantienen a la comunidad aislada, por lo que se requirió su construcción. (Ver prueba documental).
Por memorial UTGV:270-2019 del 22 de abril de 2019, la UTGV de la corporación local de Liberia comunicó al Comité de Caminos de Nombre91133 que para el año 2019 se tiene planificada la construcción de un vado en el sector de la quebrada La Montañita. (Ver prueba documental).
Mediante oficio con sello de recibido de la Municipalidad de Liberia del 18 de junio de 2019, el Comité de Caminos Nombre91133 denunciaron que la calle desde quebrada la Montañita hacia su poblado requiere lastreado, dado que sufre de erosión por las lluvias y es intransitable. También señalaron que resulta urgente trabajar en los drenajes. (Ver prueba documental).
Por oficio con sello de recibido de la Municipalidad de Bagaces del 27 de julio de 2019, el Comité de Caminos de Nombre91133 denunció el mal estado de cuatro cruces de alcantarillas entre el trayecto de la esquina este de la plaza de deportes y el puente peatonal. (Ver prueba documental).
En el año 2024, la Municipalidad de Liberia efectuó un proyecto de relastreo del tramo entre el puente La Arena y la quebrada La Caraña. (Ver prueba documental).
En 2025 se mejoró aproximadamente 4 km de camino que sirve de acceso principal a El Salto Viejo. (Ver prueba documental).
El 16 de octubre de 2025, las autoridades recurridas de la Municipalidad de Liberia fueron notificados de la resolución de curso de este proceso. (Ver actas de notificación).
Mediante oficio SGA-281-10-2025 del 17 de octubre de 2025, el gestor Ambiental de la Municipalidad de Liberia indicó: “Se analizará el caso específico de este caserío llamado “salto viejo” de aprox. 35 viviendas unifamiliares que se encuentra en una zona alejada de los núcleos urbanos y que es de carácter rural al cual actualmente no se le presta el servicio de recolección de residuos sólidos. El análisis consiste en un estudio de la posesión de las fincas para saber si están inscritas y para que cuando a futuro se brinde el servicio de recolección de residuos sólidos, se pueda realizar el respectivo cobro. Igualmente se va a analizar el estado de las calles de ingreso a esa localidad y todos los aspectos financieros que implica la ampliación del servicio a fin de que haya sostenibilidad financiera del servicio. Actualmente se esta (sic) realizando un estudio de actualización de tarifas que es donde finalmente se incluyen los gastos a futuro que se van a realizar en las labores de recolección municipal de residuos sólidos en el cantón de Liberia”. El 17 de octubre de 2025, la Municipalidad de Liberia inspeccionó el estado del vado y determinó que se encuentra en estado regular, pero transitable para todo tipo de vehículos, así como que los daños observados corresponden a condiciones típicas de una calle de lastre en época lluviosa. También se consignó que los daños se localizan en los accesos al vado, cuyas labores de mantenimiento están programadas para noviembre de 2025. (Ver prueba documental).
El 30 de octubre de 2025, el alcalde de Bagaces fue notificado de la resolución de curso de este proceso. (Ver acta de notificación).
El 3 de noviembre de 2025, el jefe de la UTGV de Bagaces fue notificado de la resolución de curso de este proceso. (Ver acta de notificación).
Por medio del oficio MB-UTGV-OFI-625-2025 del 3 de noviembre de 2025, la UTGV de la Municipalidad de Bagaces explica: “2- Que el tramo de camino ubicado dentro de los límites de Bagaces tiene una longitud de 1,43km de los cuales los primeros 666m se encuentran en asfalto y los restantes 764m se encuentran con superficie de ruedo en lastre en buen estado (…) Que según se puede ver en las siguientes imágenes, en ese tramo ubicado en la Dirección5849, se realizó el año 2024 las obras de la contratación SICOP 2023LE-000002-0040100001, donde se construyó un paso de alcantarilla doble para mejorar el manejo de aguas pluviales de una quebrada intermitente y se mejoró un tramo de camino de 120m, con la colocación de material granular y aplicación de tratamiento superficial bituminoso. Este proyecto había sido solicitado por la comunidad de El Salto de Bagaces para mejorar las condiciones de la población que transita para el cantón vecino (El Salto Viejo), según se puede ver en la solicitud adjunta, donde se realizó una inversión de ₡18 195 086,00 (…) 6- Que en ese tramo de camino en lastre ubicado entre la Dirección5849 y el límite cantonal, se ejecutó a finales del mes de octubre del 2025 la intervención del tramo de camino con obras bajo la modalidad de Obras por Administración con un costo superior a los 10 millones de colones únicamente en materiales y maquinaria sin contemplar la mano de obra.
En ese sector se realizó la limpieza mecanizada de cunetas en tierra, conformación de la superficie de ruedo, colocación de un paso de alcantarillas y la colocación y compactación de 705 metros cúbicos de material granular como capa de rodadura como se puede detallar en las siguientes fotografías (…)”. (Ver prueba documental).
Mediante oficio PUTGV-1575-11-2025 del 17 de noviembre de 2025, la UTGV de Liberia indicó que en la primera quincena de noviembre de 2025 se llevó a cabo el mantenimiento en el sector objeto de este recurso y detalló: “Camino C5-01-001: Dirección5850 - Nombre91133 El camino se encuentra en buen estado, con superficie estable y adecuada para el tránsito vehicular. No se observan daños significativos como hundimientos, erosión o pérdida de material. La señalización y drenajes funcionan correctamente, permitiendo un flujo seguro. Camino C5-01-094: Ruta Nro. 1 - Cruce Salto Viejo Este tramo también presenta condiciones óptimas, con rodadura uniforme y sin afectaciones que comprometan la seguridad. · El camino tiene un tratamiento superficial el cual no se ha visto afectado. · Respecto al estado de pasos por la quebrada La Montañita y el río El Salto, se informa lo siguiente: Paso sobre la quebrada La Montañita: El paso fue intervenido en las fechas indicadas y actualmente se encuentra habilitado y en buen estado, sin obstrucciones ni daños en las estructuras.
Incidencias: No se reportan desbordamientos ni deterioro en las obras de protección. · Paso sobre el río El Salto: Tal como se indicó, el cruce por este río se realiza directamente por el cauce, por lo que no es posible intervenirlo. Para garantizar la conectividad en el sector, la Municipalidad construyó un puente peatonal, el cual se encuentra totalmente operativo y en óptimas condiciones. En este punto se hace la aclaración que el paso vehicular se mantiene por los caminos C5-01-001: urbanización Daniel Oduber- Nombre91133 y C5-01-094: ruta nro. 1 cruce Salto Viejo (…)”. (Ver prueba documental).
En el sub lite, el recurrente indica que la comunidad Nombre91133 se ubica entre el límite entre Liberia y Bagaces. Señala que la vía de acceso con Bagaces solo permite el paso peatonal, ya que no existe un puente vehicular y el camino nunca ha sido asfaltado. Expone que el acceso con Liberia únicamente cuenta con paso vehicular en mal estado, cuyo puente se encuentra en estado crítico. Reclama que cuando llueve es imposible utilizar ambos accesos, el cual se limita a vehículos 4x4. Acusa que tal situación limita el transporte público, recolección de residuos y el ingreso de vehículos de emergencias. Sostiene que han planteado la problemática ante los gobiernos locales de Liberia y Bagaces; sin embargo, no han obtenido respuesta.
De la prueba se desprende que en la red vial cantonal de Liberia se cuenta con los caminos C5-01-001: urbanización Daniel Oduber- Nombre91133 y C5-01-094: Dirección5852– . Por memorial con sello de recibido de la Municipalidad de Liberia del 28 de enero de 2018, vecinos de la comunidad Nombre91133 solicitaron trabajos de lastreados para resolver la problemática sufrida en verano por el levantamiento de polvo de la calle. En el año 2018, vecinos de la comunidad Nombre91133 plantearon gestiones ante la Municipalidad de Liberia a los efectos de que se construyera un puente peatonal sobre el río El Salto. Entre los años 2018 y 2019 se construyó el puente peatonal sobre el río El Salto. Por memorial con fecha de recibido 27 de junio de 2018, vecinos de Nombre91133 formularon una gestión ante la Municipalidad de Liberia, por medio de la cual requirieron que en el presupuesto extraordinario se incluyera el proyecto de puente vehicular en el sector Salto Viejo-Quebrada La Montañita, ya que en la comunidad existe una problemática de acceso que los mantiene prácticamente aislados tanto de Liberia como de Bagaces.
Por OFICIO-UTGV-640-2018 del 17 de julio de 2018, la UTGV de la Municipalidad de Liberia indicó que la solicitud sería presentada ante el Comité Municipal de Emergencias, a fin de que fuera elevada a la CNE para valorar la viabilidad de construcción de los puentes. Mediante escrito con sello de recibido por la Municipalidad de Liberia del 28 de febrero de 2019, el Comité de Caminos Nombre91133 externó que la ausencia de infraestructura adecuada ante la inexistencia de puentes vehiculares en la quebrada la Montañita y el río El Salto mantienen a la comunidad aislada, por lo que se requirió su construcción. Por memorial UTGV:270-2019 del 22 de abril de 2019, la UTGV de la corporación local de Liberia comunicó al Comité de Caminos de Nombre91133 que para el año 2019 se tiene planificada la construcción de un vado en el sector de la quebrada La Montañita. Mediante oficio con sello de recibido de la Municipalidad de Liberia del 18 de junio de 2019, el Comité de Caminos Nombre91133 denunciaron que la calle desde quebrada la Montañita hacia su poblado requiere lastreado, dado que sufre de erosión por las lluvias y es intransitable.
También señalaron que resulta urgente trabajar en los drenajes. En el año 2019, la Municipalidad de Liberia construyó un paso tipo vado en el sector de la Montañita. En el año 2024, la Municipalidad de Liberia efectuó un proyecto de relastreo del tramo entre el puente La Arena y la quebrada La Caraña. En 2025 se mejoró aproximadamente 4 km de camino que sirve de acceso principal a El Salto Viejo. El 17 de octubre de 2025, la Municipalidad de Liberia inspeccionó el estado del vado y determinó que se encuentra en estado regular, pero transitable para todo tipo de vehículos, así como que los daños observados corresponden a condiciones típicas de una calle de lastre en época lluviosa. También se consignó que los daños se localizan en los accesos al vado, cuyas labores de mantenimiento están programadas para noviembre de 2025. Mediante oficio PUTGV-1575-11-2025 del 17 de noviembre de 2025, la UTGV de Liberia indicó que en la primera quincena de noviembre de 2025 se llevó a cabo el mantenimiento en el sector objeto de este recurso y detalló: “Camino C5-01-001: Dirección5850 - Nombre91133 El camino se encuentra en buen estado, con superficie estable y adecuada para el tránsito vehicular.
No se observan daños significativos como hundimientos, erosión o pérdida de material. La señalización y drenajes funcionan correctamente, permitiendo un flujo seguro. Camino C5-01-094: Ruta Nro. 1 - Cruce Salto Viejo Este tramo también presenta condiciones óptimas, con rodadura uniforme y sin afectaciones que comprometan la seguridad. · El camino tiene un tratamiento superficial el cual no se ha visto afectado. · Respecto al estado de pasos por la quebrada La Montañita y el río El Salto, se informa lo siguiente: Paso sobre la quebrada La Montañita: El paso fue intervenido en las fechas indicadas y actualmente se encuentra habilitado y en buen estado, sin obstrucciones ni daños en las estructuras. Incidencias: No se reportan desbordamientos ni deterioro en las obras de protección. · Paso sobre el río El Salto: Tal como se indicó, el cruce por este río se realiza directamente por el cauce, por lo que no es posible intervenirlo.
Para garantizar la conectividad en el sector, la Municipalidad construyó un puente peatonal, el cual se encuentra totalmente operativo y en óptimas condiciones. En este punto se hace la aclaración que el paso vehicular se mantiene por los caminos C5-01-001: urbanización Daniel Oduber- Nombre91133 y C5-01-094: ruta nro. 1 cruce Salto Viejo (…)”.
Así las cosas, aun cuando se reclama la inacción del gobierno local de Liberia para dar adecuado mantenimiento a los caminos objeto de este asunto, lo cierto es que de los autos se colige que esa corporación municipal sí ha llevado a cabo labores de mantenimiento y mejora. Incluso, con la prueba para mejor resolver requerida por esta Cámara, la Municipalidad de Liberia aclaró, mediante el oficio PUTGV-1575-11-2025 del 17 de noviembre de 2025, que tales caminos se encuentran en buen estado. Por ende, no se acoge el recurso en cuanto a este agravio.
V.De otra parte, recuérdese que la parte recurrente también acusa que no se presta el servicio de recolección de basura en la comunidad El Salto Viejo.
Visto lo anterior, conviene traer a colación la sentencia nro. 2025024083 de las 9:15 horas del 1° de agosto de 2025, en el que se conoció un agravio similar al planteado en el sub iudice:
“III.- SOBRE EL SERVICIO DE RECOLECCIÓN DE BASURA. Esta Sala ha indicado reiteradamente que los usuarios de los servicios no tienen por qué soportar las deficiencias de la Administración. Por lo expuesto, mediante sentencia número 2019-5623 de las 09:45 horas de 29 de marzo de 2019, en un asunto similar relacionado con la falta de prestación del servicio de recolección de basura por parte de un concejo municipal de distrito, esta jurisdicción resolvió:
“V.- Sobre el servicio de recolección de basura. En reiteradas ocasiones, este Tribunal Constitucional se ha referido a los principios constitucionales que rigen la prestación de servicios públicos y el derecho fundamental a la prestación eficiente de éstos, que implica que independientemente del tipo de servicio, deben ser prestados con elevados estándares de calidad, el cual tiene como correlato necesario la obligación de las administraciones públicas de prestarlos de forma continua, regular, célere, eficaz y eficiente (véanse en ese sentido las sentencias números 2003-11382 de las 15:11 horas del 07 de octubre de 2003 y 2011-003043 de las 16:03 horas del 08 de marzo de 2011). Asimismo, el artículo 169, de la Constitución Política, dispone el deber de las Municipalidades del país de velar por los intereses de los habitantes de su jurisdicción, de ahí que, en reiterados pronunciamientos, este Tribunal ha señalado que dichas corporaciones se encuentran en la obligación de eliminar cualquier tipo de amenaza que ponga en riesgo los derechos a la salud y a un medio ambiente sano y ecológicamente equilibrado de las personas que viven en su cantón (véanse en ese sentido las sentencias 2008-11739 de las 12:12 horas del 25 de julio de 2008 y 2011-003043 de las 16:03 horas del 08 de marzo de 2011).
En el sub lite, del informe rendido bajo juramento y de la prueba aportada al expediente, esta Sala comprobó que actualmente en la localidad de Santa Fe de Cóbano no se realiza recolección de basura, con lo cual se acredita una afectación a los derechos fundamentales del recurrente. Lo anterior por cuanto, pudo verificarse que el recurrente debe trasladarse hasta 4 kilómetros para poder encontrar un punto en el que se recolecte basura, para poder dejar sus desechos. Por otro lado, según lo informado por la autoridad recurrida se está recabando la información necesaria para determinar la manera más adecuada de prestar el servicio en dicha comunidad a partir del último trimestre. Si bien la autoridad recurrida, intenta justificar la falta de recolección de basura en esa localidad, debido a que desde junio del Ministerio de Salud ordenó el cierre del Vertedero Municipal, teniendo que transportarse los desechos sólidos hasta la comunidad de Montes de Oro en Miramar de Puntarenas, lo cierto es que dicha situación no los exime de su obligación de brindar el servicio de recolección de basura a los usuarios de sus comunidades, y por el contrario, deberían tomar las medidas para solucionar dicha situación, máxime que desde junio de 2017, tienen conocimiento de ello.
Esta Sala ha indicado reiteradamente que los usuarios de los servicios no tienen porque (sic) soportar las deficiencias de la Administración. Así las cosas, la Sala pudo comprobar que el servicio de recolección de basura en la localidad de Santa Fe de Cóbano no es estable, con lo cual, lo procedente es declarar con lugar el recurso, en cuanto a este extremo y según se dirá en la parte dispositiva de esta sentencia” (el resaltado no es del original).
Del informe rendido bajo juramento por la autoridad recurrida se acredita una infracción a los derechos fundamentales de la parte amparada con fundamento en las razones que a continuación se exponen. Al respecto, se acredita que en escrito con fecha 27 de marzo de 2025, el recurrente solicitó a la Alcaldesa de la autoridad recurrida el servicio de recolección de basura en su propiedad, sin embargo, se le ha respondido de manera verbal que como sus vecinos aledaños a la ronda de 300 metros no desean pagar por el servicio, se le niegan, lo cual no considera valido. Además indica que su esposa presenta una condición de invalidez y es pensionada por el régimen IVM y no puede realizar labores que implique extrema fuerza. Solicita que se le brinde criterio técnico y legal para no recolectar su basura en su casa. Por otra parte, se constata que en oficio MU-MA-OFIC-049-2025 del 10 de abril de 2025, el funcionario Luis Diego Mora Jimenez (sic) de la Unidad de Gestión Ambiental de la Municipalidad recurrida le indicó al recurrente que una vez realizado el levantamiento en el sector donde solicita el servicio de recolección de basura se le estará comunicando la fecha de inicio de la prestación de este, conforme lo establecido en el artículo 11 del Reglamento para la Gestión Integral de Residuos Sólidos del cantón de Upala.
Nótese que a la fecha han transcurrido más de tres meses desde que la corporación municipal recurrida le indicó al recurrente que vez realizado el levantamiento en el sector donde solicita el servicio de recolección de basura se le estará comunicando la fecha de inicio de la prestación, lo cual no consta que a la fecha haya sido realizado, en detrimento de los derechos fundamentales de la parte recurrente.
Al respecto, sobre el tema de la recolección de basura y correcto depósito de desechos, en reiterada jurisprudencia, este Tribunal ha señalado que de conformidad con lo establecido en el artículo 169 de la Constitución Política, a las municipalidades les corresponde la administración de los intereses y servicios locales de su cantón. Dicha competencia incluye la recolección, la disposición final y el tratamiento de los desechos sólidos generados en esas circunscripciones territoriales. En efecto, se trata de un deber ineludible que más allá de la protección a un ambiente sano y ecológicamente equilibrado, repercute directamente en la salud de las personas. En esa perspectiva, los problemas generados por la inadecuada disposición y manejo de desechos sólidos trascienden la esfera local para convertirse en un problema de salud pública, ante el cual, no se admiten justificaciones de índole presupuestaria y económica para validar cualquier omisión o retraso injustificado por parte de esas corporaciones municipales en la protección de estos derechos (véase la sentencia No. 2011010416 de las doce horas y cuarenta y nueve minutos del cinco de agosto del dos mil once).
En virtud de lo anterior, es exigible a las autoridades de la Municipalidad de Upala una actitud más acuciosa, a tenor de lo dispuesto por el artículo 169 de la Constitución Política, como administradores de los intereses y servicios locales. Así las cosas, el presente recurso debe ser estimado, con las consecuencias que se indican en la parte dispositiva (…)
POR TANTO: Se declara con lugar el recurso. Se ordena a Aura Yamileth López Obregón, en su condición de Alcaldesa y Adilia Reyes Calero, en su calidad de Presidenta del Concejo Municipal, ambas funcionarias de la Municipalidad de Upala, o a quienes en sus lugares ocupen esos cargos, que adopten las medidas adecuadas y necesarias para que en el plazo de 1 mes, contado a partir de la notificación de esta sentencia, se dispongan las acciones para ampliar la oferta del servicio de recolección de basura en el domicilio del recurrente. Se advierte a los recurridos que, de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Upala al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Notifíquese”.
El Tribunal considera que el precedente transcrito resulta aplicable al sub examine, dado que no se encuentran motivos para variar el criterio vertido, ni razones para valorar de forma diferente la situación formulada.
Ahora bien, en el caso bajo estudio, mediante oficio SGA-281-10-2025 del 17 de octubre de 2025, el gestor Ambiental de la Municipalidad de Liberia indicó: “Se analizará el caso específico de este caserío llamado “salto viejo” de aprox. 35 viviendas unifamiliares que se encuentra en una zona alejada de los núcleos urbanos y que es de carácter rural al cual actualmente no se le presta el servicio de recolección de residuos sólidos. El análisis consiste en un estudio de la posesión de las fincas para saber si están inscritas y para que cuando a futuro se brinde el servicio de recolección de residuos sólidos, se pueda realizar el respectivo cobro. Igualmente se va a analizar el estado de las calles de ingreso a esa localidad y todos los aspectos financieros que implica la ampliación del servicio a fin de que haya sostenibilidad financiera del servicio. Actualmente se esta (sic) realizando un estudio de actualización de tarifas que es donde finalmente se incluyen los gastos a futuro que se van a realizar en las labores de recolección municipal de residuos sólidos en el cantón de Liberia” (el resaltado fue agregado).
Así las cosas, en el sub iudice se tiene por demostrado que a la comunidad Nombre91133 no se le brinda el servicio de recolección de residuos, situación que no solo repercute en la protección a un ambiente sano y ecológicamente equilibrado, sino también en la salud de las personas. Por tal motivo, procede estimar el recurso en cuanto a la Municipalidad de Liberia en lo que a este extremo atañe.
VI.En cuanto a la Municipalidad de Bagaces se comprueba que en la red vial cantonal de Bagaces se encuentra el camino 5-04-026 que inicia en el entronque con la ruta Nacional nro. 1, atraviesa a la comunidad de El Salto de Bagaces y finaliza en el límite cantonal con Liberia, Río El Salto. Mediante oficio MB-UTGV-0246-2018 del 26 de junio de 2018, la UTGV de Bagaces comunicó a vecinas de Nombre91133 que las necesidades respecto a la construcción de un puente vehicular en el Dirección5851– serían presentadas a la Junta Vial Cantonal para su análisis. Por oficio con sello de recibido de la Municipalidad de Bagaces del 27 de julio de 2019, el Comité de Caminos de Nombre91133 denunció el mal estado de cuatro cruces de alcantarillas entre el trayecto de la esquina este de la plaza de deportes y el puente peatonal. Por medio del oficio MB-UTGV-OFI-625-2025 del 3 de noviembre de 2025, la UTGV de la Municipalidad de Bagaces explica: “2- Que el tramo de camino ubicado dentro de los límites de Bagaces tiene una longitud de 1,43km de los cuales los primeros 666m se encuentran en asfalto y los restantes 764m se encuentran con superficie de ruedo en lastre en buen estado (…) Que según se puede ver en las siguientes imágenes, en ese tramo ubicado en la Dirección5849, se realizó el año 2024 las obras de la contratación SICOP 2023LE-000002-0040100001, donde se construyó un paso de alcantarilla doble para mejorar el manejo de aguas pluviales de una quebrada intermitente y se mejoró un tramo de camino de 120m, con la colocación de material granular y aplicación de tratamiento superficial bituminoso.
Este proyecto había sido solicitado por la comunidad de El Salto de Bagaces para mejorar las condiciones de la población que transita para el cantón vecino (El Salto Viejo), según se puede ver en la solicitud adjunta, donde se realizó una inversión de ₡18 195 086,00 (…) 6- Que en ese tramo de camino en lastre ubicado entre la Dirección5849 y el límite cantonal, se ejecutó a finales del mes de octubre del 2025 la intervención del tramo de camino con obras bajo la modalidad de Obras por Administración con un costo superior a los 10 millones de colones únicamente en materiales y maquinaria sin contemplar la mano de obra. En ese sector se realizó la limpieza mecanizada de cunetas en tierra, conformación de la superficie de ruedo, colocación de un paso de alcantarillas y la colocación y compactación de 705 metros cúbicos de material granular como capa de rodadura como se puede detallar en las siguientes fotografías (…)”.
En virtud de lo expuesto, no se acredita la lesión a los derechos fundamentales de la parte amparada en cuanto a la Municipalidad de Bagaces en los términos en que fue formulado el asunto. Nótese que de los autos se colige que la ruta cantonal de Bagaces que comunica con la comunidad Nombre91133 se encuentra en buen estado; incluso, en el año 2024 se construyó un paso de alcantarilla doble, mientras que en octubre de 2025 se intervino el tramo de lastre del camino lo que incluyó “la limpieza mecanizada de cunetas en tierra, conformación de la superficie de ruedo, colocación de un paso de alcantarillas y la colocación y compactación de 705 metros cúbicos de material granular como capa de rodadura como se puede detallar en las siguientes fotografías (…)”. Por lo que no se observa alguna omisión del gobierno local de Bagaces que haya conculcado los derechos fundamentales de la parte amparada en los términos acusados. Adicionalmente, advierta la parte recurrente que no corresponde a este Tribunal determinar, de acuerdo con las particularidades del caso bajo estudio y la normativa infraconstitucional que rige la materia, si resulta o no procede que se construya un puente vehicular sobre el río El Salto en los términos peticionados.
He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia.
Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.
En tesis de principio, considero que los casos relacionados con la inactividad de la Administración Pública en la reparación, construcción, modificación o demolición de cualquier obra de infraestructura deben ser desestimados, por constituir, esa omisión, un tema de legalidad, cuya discusión corresponde a la jurisdicción ordinaria, ante la cual la persona interesada puede debatir, con mayor amplitud, sus disconformidades. Sin embargo, cuando de aquella conducta administrativa omisiva se derive alguna violación a otros derechos fundamentales tutelados en esta jurisdicción constitucional, o se afecten grupos considerados vulnerables, sí entro a conocer el fondo del asunto, por constituir esta situación una excepción a mi posición en esta materia, tal y como sucede en este caso, en que la parte recurrente acusa el aparente mal estado del acceso a El Salto Viejo, en Bagaces, colocando en riesgo la integridad de los vecinos y de quienes transitan por la zona, pero que presuntamente no ha sido atendido por la autoridad competente.
Se previene a las partes que, de haber aportado algún documento en papel u objetos o pruebas contenidos en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados en un plazo máximo de 30 días hábiles, contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo material que no sea recogido dentro de ese lapso, con base en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial" (aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 de 22 de agosto de 2011 y publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012) y en el artículo LXXXI de la sesión del Consejo Superior del Poder Judicial nro. 43-12 de 3 de mayo de 2012.
Por tanto:
Se declara parcialmente con lugar el recurso solo en cuanto a la Municipalidad de Liberia por la falta de recolección de residuos. Se les ordena a José Calvo Darcia y Dorian Ulate Elizondo, por su condición respectiva de alcalde y director de la Unidad Técnica de Gestión Vial, ambos de la Municipalidad de Liberia, o a quienes ocupen esos cargos, coordinar lo necesario y llevar a cabo todas las actuaciones que estén dentro del ámbito de sus respectivas competencias para que, en el plazo máximo de UN MES, contado a partir de la notificación de esta sentencia, se amplie la oferta del servicio de recolección de basura a la comunidad El Salto Viejo. Lo anterior se dicta con el apercibimiento de que con base en lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quienes recibieren una orden que deban cumplir o hacer cumplir, dictada en un recurso de amparo y que no la cumplieren o no la hicieren cumplir, siempre que el delito no esté más gravemente penado.
Se condena a la Municipalidad de Liberia al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En lo demás, se declara sin lugar el recurso. El magistrado Castillo Víquez consigna nota. El magistrado Salazar Alvarado pone nota. Notifíquese.
