Amparo proceeding (recurso de amparo) processed under expediente number 25-033356-0007-CO, filed by Nombre91325, identity card CED24267, against the MUNICIPALIDAD DE LIBERIA and the MINISTERIO DE SALUD.

Considerations
Before addressing the merits, it must be clarified that, since judgment number 2008-02545 at 08:55 hours on 22 de febrero de 2008, this Chamber has referred to the administrative litigation jurisdiction (jurisdicción contencioso administrativa)—with certain exceptions—matters in which the issue is whether the public administration has complied with the reasonably established time limits for resolving requests submitted by persons subject to its administration, in light of Article 41 of the Constitución Política. Specifically, the sub lite presents such an exception because it concerns a complaint regarding an alleged exceedance of permitted noise levels originating from a commercial establishment, which could affect the appellant’s right to a healthy environment. Given the nature of the subject matter of the filing, this Chamber will assess any possible delays in resolving the complaint submitted. This point having been clarified, the Chamber proceeds to decide the specific situation raised in this amparo proceeding.
The petitioner files a writ of amparo (recurso de amparo) against the Municipalidad de Liberia and the Ministerio de Salud because, despite multiple complaints regarding noise pollution (contaminación sónica) caused by the restaurant El Callejero—located adjacent to his home in a residential area—the authorities have not taken effective action to remedy the situation. He states that official sound-level measurements (sonometrías) demonstrate that the establishment exceeds the permitted noise levels and that a health order (orden sanitaria) was issued and communicated to the Municipalidad, without any response or action being taken. He alleges that this prolonged inaction violates his fundamental rights and requests that the competent authorities be ordered to intervene in accordance with their legal duties and the Plan Regulador.
For purposes of deciding this matter, the following facts are deemed duly proven, either because they have been established as such or because the respondent failed to address them as directed in the initial order:
Regarding the Ministerio de Salud:
During the first week of October 2024, the Ministerio de Salud received complaint No. 261-2024 concerning noise coming from the restaurant El Callejero (see report submitted under oath and attached evidence).
On 19 de setiembre de 2025, officials from the Ministerio de Salud conducted an official sound measurement (medición sónica) at the complainant’s residence, detecting a noise level of 44.2 dB(A), above the permitted limit of 40 dB(A) for a residential area at night (see Technical Report MS-DRRSCH-URS-IT-073-2025).
On 06 de octubre de 2025, Health Order MS-DRRSCH-URS-OS-02-25 was issued, ordering the suspension of the noise-producing activity and the submission of an acoustic-containment plan (plan de confinamiento acústico) (see report submitted under oath and attached evidence).
On 07 de octubre de 2025, the health order was served on the restaurant’s legal representative, José Pablo Brenes López (see report submitted under oath and attached evidence).
On 10 de octubre de 2025, the regulated party (administrado) submitted the first acoustic-containment plan, signed by an architect but lacking the required engineering calculations (memoria de cálculo) (see report submitted under oath and attached evidence).
On 14 de octubre de 2025, the Ministerio de Salud rejected the plan due to technical deficiencies and granted 10 business days to submit a corrected plan (see Technical Report MS-DRRSCH-URS-IT-083-2025).
On 13 de octubre de 2025, a new complaint was received regarding alleged noncompliance with the health order (see report submitted under oath and attached evidence).
On 15 de octubre de 2025, an inspection (inspección) was conducted at the establishment. The exhaust fans were observed to be turned off, acoustic works were under way, and no perceptible noise was present. Partial compliance with the health order was confirmed (see Technical Report MS-DRRSCH-URS-IT-085-2025).
On 17 de octubre de 2025, the inspection findings were documented, and technical monitoring remains ongoing (see report submitted under oath and attached evidence).
On 27 de octubre de 2025, the regulated party submitted a new containment plan, this time including engineering calculations and purportedly signed by an engineer. Regarding that plan, the Ministerio de Salud asked the Colegio Federado de Ingenieros y Arquitectos (CFIA) to verify the signatory’s professional qualifications (see report submitted under oath and attached evidence).
During the last week of October 2025, the Ministerio de Salud renewed its inquiry to the CFIA due to the lack of a response (see report submitted under oath and attached evidence).
As of the date of the report (noviembre de 2025), the opinion of the CFIA remains pending (see report submitted under oath and attached evidence).
The partial suspension of noise-producing activities remains in effect (see report submitted under oath and attached evidence).
Regarding the Municipalidad de Liberia:
On 17 de octubre de 2002, the Plan Regulador de Liberia entered into force and classified the site as a residential area (see SPUCC-150-11-2025).
In December 2024, another local resident filed previous noise complaints against the same establishment (as stated by the petitioner and confirmed by the Municipalidad through the case-file record).
On 12 de febrero de 2025, the petitioner sent a letter to the Municipalidad reporting noise disturbances and alleged irregularities under the Plan Regulador (see report submitted under oath and attached evidence).
On 04 de noviembre de 2025, Planificación Urbana y Control Constructivo issued official letter SPUCC-150-11-2025, confirming that the restaurant El Callejero is located in a residential area and that its use is governed by the parameters for permitted and conditional uses (see report submitted under oath and attached evidence).
On 09 de octubre de 2025, the petitioner filed a request with the Municipalidad, attaching the health order issued by the Ministerio de Salud (see report submitted under oath and attached evidence).
On 10 de octubre de 2025, the Office of the Mayor referred the petitioner’s request to various municipal units for assessment (see institutional emails submitted as evidence).
On 14 de noviembre de 2025—by email—the petitioner was informed that his request was being processed and had been referred to the competent units (see report submitted under oath and attached evidence).
Through report APAT-256-2025 dated 14 de noviembre de 2025, the Departamento de Patentes informed the Unidad de Servicios Jurídicos that the petitioner’s complaint was being processed and was awaiting the corresponding technical report (see report submitted under oath and attached evidence).
In noviembre 2025, the Municipalidad determined that it lacked the technical jurisdiction (competencia técnica) to assess effects on public health (see report submitted under oath and attached evidence).
The restaurant cannot be sanctioned for improper parking by third parties (see official letter APAT-218-2025).
Based on a comprehensive analysis of the case file and the report submitted under solemn oath by the authorities of the Ministerio de Salud, this Court finds that the amparo proceeding should be granted as to this ministry because, despite the initial actions taken by the respondent authority, the administrative process intended to address the petitioner’s complaint remains incomplete, and there is no record that the protected party (tutelado) was timely informed of the current status of the proceeding or of the steps taken.
Indeed, it was fully established that the Ministerio de Salud has undertaken various technical actions since receiving the complaint—including official sound measurements, issuance of Health Order MS-DRRSCH-URS-OS-02-25, review of acoustic-containment plans, and on-site inspections—which demonstrate diligent intervention consistent with the applicable regulatory framework. However, the evidence also shows that a new containment plan with engineering calculations was submitted to the Ministerio on 27 de octubre de 2025, and that the authority asked the Colegio Federado de Ingenieros y Arquitectos (CFIA) to verify the signatory’s professional qualifications, in accordance with article 23 of the Reglamento para el Control del Ruido Ambiental.
Nevertheless, as of the date of the report submitted to this Chamber (noviembre de 2025), the administration continues to await the CFIA’s response, leaving final approval of the containment plan and the subsequent performance of a new sound measurement at the petitioner’s residence pending. The evidence submitted does not show that the protected party was informed of this procedural status or of the inquiry made to the CFIA, even though such information is essential for him to know the actual progress of the administrative measures required to mitigate the reported harm.
This failure to communicate effectively with the regulated party creates uncertainty regarding the status of the proceeding and placed the petitioner in a position of defenselessness (indefensión) with respect to an administrative process that directly affects the peaceful enjoyment of his property and his right to a healthy environment.
Consequently, this writ of amparo is granted, and the Ministerio de Salud is ordered to inform the petitioner fully, clearly, and with a statement of reasons regarding the current status of the proceeding, particularly concerning the inquiry made to the CFIA and the remaining steps required to complete verification of the acoustic containment. The authority must also continue processing the health order with the utmost diligence, following the procedure established by the legal system and taking all necessary steps to resolve the reported situation conclusively.
Based on a comprehensive analysis of the case file, the duly established facts, and the report submitted under solemn oath by the municipal authorities, this Court concludes that, with respect to the respondent local government, the amparo proceeding should be denied because there is no evidence of any current or actual violation attributable to that municipal authority in connection with the fundamental rights invoked by the petitioner.
Indeed, the proven facts demonstrate that the Municipalidad has acted within the scope of its legal authority, carrying out the measures within its purview and referring the remaining matters to the competent administrative bodies. The record shows that, on 12 de febrero de 2025, the petitioner filed a municipal complaint regarding disturbances caused by noise generated by the restaurant El Callejero, located in an area classified as residential under the Plan Regulador de Liberia in force since 17 de octubre de 2002. As a result, the municipal departments conducted the relevant verifications, including issuing official letter SPUCC-150-11-2025, through which the Unidad de Planificación Urbana confirmed the property’s classification under the Plan Regulador and the applicable use parameters.
It was also established that, on 09 de octubre de 2025, the petitioner filed a new request with the Municipalidad, attaching the health order issued by the Ministerio de Salud. The request was duly received and referred on 10 de octubre de 2025 to the competent units for assessment, in accordance with the principle of legality (principio de legalidad). On 14 de noviembre de 2025, the Municipalidad informed the petitioner of the processing status of his request, which is under review by the Proceso de Servicios Jurídicos, as shown by report APAT-256-2025 of the same date.
Likewise, according to the information provided by the Departamento de Patentes and other municipal units, the institution lacks the technical jurisdiction to assess effects on public health or to determine whether an establishment complies with the maximum environmental-noise limits, because such determinations fall exclusively to the Ministerio de Salud, the specialized agency and governing authority in this field. It was also established that the Municipalidad lacks the power to sanction the restaurant for possible violations committed by third parties—such as improper parking—for which penalties fall within the authority of the competent traffic authority. These limitations arise from the strict adherence to the principle of legality governing administrative action.
Consequently, the actions entrusted to the Municipality were carried out within the scope of its authority, and there is no evidence of any omission, arbitrariness, or inaction attributable to it that caused a violation of the appellant’s substantive rights. The alleged noise disturbance is currently under the technical oversight and jurisdiction of the Ministry of Health, which is the authority responsible for verifying, measuring, processing, and enforcing the corresponding health order (orden sanitaria).
For the foregoing reasons, this Court concludes that no violation of fundamental rights attributable to the Municipalidad de Liberia has been established. Therefore, the application for amparo relief (recurso de amparo) filed against it is denied.
I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and effective justice in administrative proceedings (sede administrativa), the legal dispute must be heard by the Contentious-Administrative Courts and not by this Chamber. However, with the recent enactment of Law No. 9097, Law Regulating the Right of Petition, it has been established that this right is eligible for judicial protection through the application for amparo relief provided for in Article 32 of the Law on Constitutional Jurisdiction, in relation to Article 27 of the Political Constitution of the Republic of Costa Rica, in those cases in which the petitioner considers that the Administration’s material actions, administrative acts, or response are affecting the petitioner’s fundamental rights. In my view, the recently enacted legislation does not mean that this Court must modify its line of precedent, since, pursuant to section 7 of its Law, it has exclusive authority to define its own jurisdiction.
Accordingly, except for those constitutional-law disputes that this Chamber itself has recognized as exceptional circumstances and that may properly be heard in this jurisdiction through the constitutional proceeding guaranteeing amparo relief, in all other cases, and for the reasons given by this Court (Judgment No. 2008-02545 at 8:55 on 22 de febrero de 2008), jurisdiction lies with the judges of the contentious-administrative jurisdiction. All of the foregoing is consistent with Article 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and rules), and the corresponding statutory provisions, based on a logical, systemic, and purposive interpretation of the legal system.
In environmental matters, it is also my view that, if the Public Administration has already intervened, the matter should be heard and decided by the contentious-administrative jurisdiction. Nevertheless, I do examine the merits when other rights of the persons affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy a healthy and pollution-free environment (Article 50 of the Political Constitution), as occurs in this case, in which the appellant alleges that, despite multiple complaints concerning noise pollution caused by the El Callejero restaurant—located adjacent to the appellant’s home in a residential area—the respondent authorities have not taken effective action to remedy the situation, to the detriment of a healthy and ecologically balanced environment and a dignified quality of life.
The appellant is hereby advised that, if any paper document, as well as any objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device or produced using new technologies, has been submitted, it must be collected from the court office within a maximum period of 30 business days from service of this judgment. Otherwise, any material not collected within that period shall be destroyed, pursuant to the “Regulations on Electronic Case Files before the Judiciary,” approved by the Full Court at session No. 27-11 of 22 de agosto del 2011, Article XXVI, and published in Judicial Bulletin number 19 of 26 de enero del 2012, as well as the resolution approved by the Superior Council of the Judiciary at session No. 43-12 held on 3 de mayo del 2012, Article LXXXI.
Por tanto:
The application is partially granted, solely with respect to the Ministry of Health. Mary Denisse Munive Angermüller, in her capacity as Minister of Health, or whoever holds that office in her stead, is ordered, within the scope of her authority, to issue the necessary directives so that, within CINCO DÍAS of service of this judgment: a) the appellant is informed fully, clearly, and with reasons stated of the current status of the proceeding, particularly regarding the consultation with CFIA and the steps still pending to complete verification of the acoustic containment; and b) the processing of the health order must also continue with the utmost diligence, in accordance with the procedure established by the legal system and with all measures necessary to resolve the reported situation conclusively. The foregoing is ordered subject to the requirement that sensitive and restricted-access data protected by the Law on the Protection of Individuals with regard to the Processing of their Personal Data and all other applicable regulations be withheld.
The respondent authority is warned that failure to comply with the foregoing order will constitute the offense of disobedience and that, pursuant to Article 71 of the Law governing this jurisdiction, any person who receives an order issued in an application for amparo relief that the person must comply with or enforce, and who fails to comply with or enforce it, shall be sentenced to imprisonment for three months to two years, or to a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The State is ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be quantified in proceedings to enforce the judgment before the contentious-administrative jurisdiction. Justice Castillo Víquez subscribes a note. Justice Salazar Alvarado files a note. With respect to the Municipalidad de Liberia, the application is denied. Let notice be served. - Fernando Castillo V.

Resultando:

Considerando
Antes de analizar el fondo del asunto debe aclararse que, a partir de la sentencia número 2008-02545 de las 08:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa -con algunas excepciones- aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos razonablemente pautados para resolver las solicitudes planteadas por los administrados a la luz de lo dispuesto por el artículo 41 de la Constitución Política. Precisamente, en el sub lite, se plantea un supuesto de excepción, pues se está ante una denuncia por supuesto exceso de los niveles de ruido permitidos, provenientes de un local comercial, lo que podría afectar el derecho a un ambiente sano del recurrente. Atendiendo a la naturaleza de la temática que trata la gestión, esta Sala valorará las posibles dilaciones en la resolución de la denuncia planteada. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.
El recurrente interpone amparo contra la Municipalidad de Liberia y el Ministerio de Salud porque, pese a múltiples denuncias por contaminación sónica causada por el restaurante El Callejero —ubicado contiguo a su vivienda en zona residencial— las autoridades no han adoptado acciones efectivas para corregir la situación. Señala que existen sonometrías oficiales que demuestran que el local excede los niveles de ruido permitidos y que se dictó una orden sanitaria, la cual fue comunicada a la Municipalidad sin que se emitiera respuesta ni actuación alguna. Alega que esta inacción prolongada vulnera sus derechos fundamentales y solicita que se ordene a las autoridades competentes intervenir conforme a sus deberes legales y al Plan Regulador.
De importancia para la decisión de este asunto, se estima como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
En cuanto al Ministerio de Salud:
En la primera semana de octubre de 2024 el Ministerio de Salud recibió la denuncia No. 261-2024 sobre ruido proveniente del restaurante El Callejero (ver informe rendido bajo juramento y prueba adjunta).
El 19 de setiembre de 2025, funcionarios del Ministerio de Salud realizaron medición sónica oficial en la vivienda del denunciante, detectando un nivel de ruido de 44.2 dB(A), superior al límite permitido de 40 dB(A) para zona residencial nocturna (ver informe Técnico MS-DRRSCH-URS-IT-073-2025).
El 06 de octubre de 2025, se emitió la Orden Sanitaria MS-DRRSCH-URS-OS-02-25 ordenando suspender la actividad ruidosa y presentar un plan de confinamiento acústico (ver informe rendido bajo juramento y prueba adjunta).
El 07 de octubre de 2025, la orden sanitaria es notificada al representante legal del restaurante, José Pablo Brenes López (ver informe rendido bajo juramento y prueba adjunta).
El 10 de octubre de 2025, el administrado presentó el primer plan de confinamiento acústico, firmado por un arquitecto, pero sin la memoria de cálculo requerida (ver informe rendido bajo juramento y prueba adjunta).
El 14 de octubre de 2025, el Ministerio de Salud rechazó el plan por deficiencias técnicas y otorga 10 días hábiles para presentar un plan corregido (ver informe técnico MS-DRRSCH-URS-IT-083-2025).
El 13 de octubre de 2025, se recibió una nueva denuncia por presunto incumplimiento de la orden sanitaria (ver informe rendido bajo juramento y prueba adjunta).
El 15 de octubre de 2025, se realizó inspección en el establecimiento. Se observó extractores apagados, obras acústicas en ejecución y ausencia de ruido perceptible. Se constató cumplimiento parcial de la orden sanitaria (ver informe técnico MS-DRRSCH-URS-IT-085-2025).
El 17 de octubre de 2025, se documentaron los hallazgos de inspección y se mantiene el seguimiento técnico (ver informe rendido bajo juramento y prueba adjunta).
El 27 de octubre de 2025, el administrado presentó un nuevo plan de confinamiento, esta vez con memoria de cálculo y firmado supuestamente por un ingeniero, respecto del cual el Ministerio de Salud solicitó al Colegio Federado de Ingenieros y Arquitectos (CFIA) verificar la competencia profesional del firmante (ver informe rendido bajo juramento y prueba adjunta).
En la última semana de octubre de 2025, el Ministerio de Salud reiteró consulta al CFIA por falta de respuesta (ver informe rendido bajo juramento y prueba adjunta).
A la fecha del informe (noviembre de 2025) se está a la espera del criterio del CFIA (ver informe rendido bajo juramento y prueba adjunta).
Se mantiene suspensión parcial de las actividades ruidosas (ver informe rendido bajo juramento y prueba adjunta).
En cuanto la Municipalidad de Liberia:
El 17 de octubre de 2002, entró en vigor el Plan Regulador de Liberia que clasificó el sitio como zona residencial (ver SPUCC-150-11-2025).
En diciembre de 2024, otra persona vecina presentó denuncias previas por ruido contra el mismo establecimiento (referido por el recurrente y confirmado por municipalidad mediante antecedentes de expediente).
El 12 de febrero de 2025, el recurrente envió nota a la Municipalidad denunciando molestias por ruido y presuntas irregularidades según el Plan Regulador (ver informe rendido bajo juramento y prueba adjunta).
El 04 de noviembre de 2025, Planificación Urbana y Control Constructivo emitió el oficio SPUCC-150-11-2025, confirmando que el restaurante El Callejero se ubica en zona residencial y que su uso se rige por parámetros de usos permitidos y condicionales (ver informe rendido bajo juramento y prueba adjunta).
El 09 de octubre de 2025, el recurrente presentó gestión ante la Municipalidad adjuntando la orden sanitaria emitida por el Ministerio de Salud (ver informe rendido bajo juramento y prueba adjunta).
El 10 de octubre de 2025, la Alcaldía remitió la gestión del recurrente a distintas unidades municipales para valoración (ver correos institucionales aportados).
El 14 de noviembre de 2025 -vía correo electrónico- se le informó al recurrente que su gestión se encuentra en trámite y que fue trasladada a las unidades competentes (ver informe rendido bajo juramento y prueba adjunta).
Mediante informe APAT-256-2025 de fecha 14 de noviembre de 2025, el Departamento de Patentes le indicó a la Unidad de Servicios Jurídicos que la denuncia del recurrente se encuentra en trámite, a la espera del informe técnico correspondiente (ver informe rendido bajo juramento y prueba adjunta).
En noviembre 2025, la Municipalidad determinó que no posee competencia técnica para evaluar afectaciones a la salud pública (ver informe rendido bajo juramento y prueba adjunta).
No se puede sancionar al restaurante por estacionamiento indebido de terceros (ver oficio APAT-218-2025).
Del análisis integral del expediente y del informe rendido bajo la solemne del juramento por parte de las autoridades del Ministerio de Salud, este Tribunal estima que el recurso debe ser declarado con lugar en cuanto a esta cartera ministerial, por cuanto se constata que, pese a las actuaciones iniciales de la autoridad recurrida, la gestión administrativa destinada a atender la denuncia del recurrente se encuentra inconclusa, sin que conste que se haya informado oportunamente al tutelado sobre el estado actual del procedimiento, ni sobre las gestiones realizadas.
En efecto, quedó plenamente acreditado que el Ministerio de Salud ha desarrollado diversas actuaciones técnicas desde la recepción de la denuncia —entre ellas, mediciones sónicas oficiales, emisión de la Orden Sanitaria MS-DRRSCH-URS-OS-02-25, revisión de planes de confinamiento acústico y verificaciones presenciales— las cuales revelan una intervención diligente y conforme al marco normativo aplicable. Sin embargo, también se evidencia que, desde el 27 de octubre de 2025 se entregó al Ministerio un nuevo plan de confinamiento con memoria de cálculo, respecto del cual la autoridad solicitó al Colegio Federado de Ingenieros y Arquitectos (CFIA) la verificación de la competencia profesional del firmante, conforme a lo dispuesto en el artículo 23 del Reglamento para el Control del Ruido Ambiental.
No obstante, a la fecha del informe presentado ante esta Sala (noviembre de 2025) la administración continúa a la espera de la respuesta del CFIA, situación que mantiene en suspenso la aprobación definitiva del plan de confinamiento y la consecuente realización de una nueva medición sónica en la vivienda del recurrente. De la prueba aportada no se desprende que el tutelado haya sido informado sobre este estado procesal, ni acerca de la consulta formulada ante el CFIA, a pesar de que dicha información resulta determinante para conocer el avance real de las gestiones administrativas requeridas para mitigar la afectación denunciada.
Tal omisión en la comunicación efectiva con el administrado genera incertidumbre respecto del estado del procedimiento y colocó al recurrente en una posición de indefensión frente a un trámite administrativo que directamente afecta el goce pacífico de su propiedad y su derecho a un ambiente sano.
En consecuencia, se declara con lugar el presente recurso de amparo, y se ordena al Ministerio de Salud informar al recurrente de forma completa, clara y motivada, sobre el estado actual del trámite, particularmente en lo relativo a la consulta ante el CFIA y los pasos pendientes para culminar la verificación del confinamiento acústico. Asimismo, la autoridad deberá continuar la tramitación de la orden sanitaria con la mayor diligencia, siguiendo el procedimiento establecido en el ordenamiento jurídico y realizando todas las gestiones necesarias para resolver en forma definitiva la situación denunciada.
Del análisis integral del expediente, de los hechos debidamente acreditados y del informe rendido bajo la solemnidad del juramento por parte de las autoridades municipales, este Tribunal concluye que en relación con el gobierno local accionado, el recurso debe ser declarado sin lugar, al no evidenciarse una lesión actual, real o imputable a dicha autoridad municipal en relación con los derechos fundamentales invocados por el recurrente.
En efecto, los hechos probados demuestran que la Municipalidad ha actuado dentro del ámbito de sus competencias legales, realizando las gestiones que le corresponden y trasladando las demás actuaciones a las instancias administrativas competentes. Consta que el 12 de febrero de 2025, el recurrente presentó una denuncia municipal por molestias derivadas del ruido generado por el restaurante El Callejero, ubicado en una zona clasificada como residencial según el Plan Regulador de Liberia vigente desde el 17 de octubre de 2002. A raíz de ello, las dependencias municipales realizaron las verificaciones pertinentes, incluyendo la emisión del oficio SPUCC-150-11-2025, mediante el cual la Unidad de Planificación Urbana confirmó la clasificación del inmueble conforme al Plan Regulador y los parámetros de uso aplicables.
Asimismo, quedó acreditado que el 09 de octubre de 2025 el recurrente presentó nueva gestión ante la Municipalidad, adjuntando la orden sanitaria emitida por el Ministerio de Salud, la cual fue debidamente recibida y trasladada el día 10 de octubre de 2025 a las unidades competentes para su valoración, conforme al principio de legalidad. El 14 de noviembre de 2025, la Municipalidad informó al recurrente del estado de trámite de su gestión, la cual se encuentra en análisis ante el Proceso de Servicios Jurídicos, según se desprende del informe APAT-256-2025 de la misma fecha.
De igual forma, según lo comunicado por el Departamento de Patentes y otras unidades municipales, la institución no posee competencia técnica para valorar afectaciones a la salud pública, ni para determinar, si un establecimiento cumple con los límites máximos de ruido ambiental, por cuanto tales determinaciones corresponden exclusivamente al Ministerio de Salud, organismo especializado y rector en la materia. También se acreditó que la Municipalidad carece de potestad para sancionar al restaurante por eventuales infracciones cometidas por terceros —como estacionamientos indebidos— cuyas sanciones corresponden a la autoridad de tránsito competente. Estas limitaciones responden a la estricta sujeción al principio de legalidad que rige la actuación administrativa.
En consecuencia, las actuaciones encomendadas a la Municipalidad fueron realizadas dentro del marco de sus atribuciones, sin que se evidencie omisión, arbitrariedad o inactividad imputable a esta que haya generado una lesión a los derechos sustantivos del recurrente. La eventual afectación por ruido denunciada se encuentra actualmente bajo la esfera de control técnico y competencia del Ministerio de Salud, el cual es la autoridad encargada de la verificación, medición, tramitación y ejecución de la orden sanitaria correspondiente.
Por las razones expuestas, este Tribunal concluye que no se acredita violación a derechos fundamentales atribuible a la Municipalidad de Liberia. Ergo, se declara sin lugar el recurso de amparo interpuesto en su contra.
He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia.
Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.
En asuntos ambientales, es también criterio del suscrito, de que si ya ha habido intervención de la Administración Pública, considero que su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que la parte recurrente acusa que pese a múltiples denuncias por contaminación sónica causada por el restaurante El Callejero —ubicado contiguo a su vivienda en zona residencial— las autoridades accionadas no han adoptado acciones efectivas para corregir la situación, en detrimento de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.
Se previene a la parte recurrente que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara parcialmente con lugar el recurso, únicamente en cuanto al Ministerio de Salud. Se ordena a Mary Denisse Munive Angermüller, en su condición de ministra de salud, o a quien en su lugar ejerza ese cargo, para que dentro del ámbito de sus competencias, gire las órdenes necesarias, a fin de que dentro del plazo de CINCO DÍAS contado a partir de la notificación de esta sentencia a) se informe al recurrente de forma completa, clara y motivada, sobre el estado actual del trámite, particularmente en lo relativo a la consulta ante el CFIA y los pasos pendientes para culminar la verificación del confinamiento acústico, b) asimismo, deberá continuar la tramitación de la orden sanitaria con la mayor diligencia, siguiendo el procedimiento establecido en el ordenamiento jurídico y realizando todas las gestiones necesarias para resolver en forma definitiva la situación denunciada. Lo anterior se dispone con la advertencia de reservar los datos sensibles y de acceso restringido, protegidos por la Ley de Protección de la Persona frente al Tratamiento de sus Datos Personales y demás normativa atinente.
Se le advierte a la autoridad recurrida que, de no acatar la orden dicha, incurrirá en el delito de desobediencia y, que de conformidad con el artículo 71, de la Ley de esta jurisdicción, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
