Findings of Fact:

  1. 1In a written submission entered into the court record at 11:44 on 8 de setiembre de 2025, the petitioners filed this amparo proceeding against the Municipalidad de San Mateo and the Consejo Nacional de Vialidad (CONAVI). They state that they are residents of Estanquillos, San Mateo. They indicate that, for many years, water flowing down from Ruta Nacional 713 has affected their property; however, since febrero de 2024, the situation has become substantially worse because of a residential development that has altered runoff patterns (patrones de escorrentía), diverting large volumes of stormwater (aguas pluviales) and wastewater (aguas residuales) toward their property. They report that this situation has caused severe and progressive damage to the only access road to their land, as well as a risk of landslides (derrumbes) threatening the safety and lives of persons traveling on that road; moreover, the increased flow entering their property through the drainage system (alcantarillado) of Ruta Nacional 713 is eroding the land, which could cause the access road to collapse completely.They contend that, since abril de 2024, they have submitted numerous requests to the Municipalidad de San Mateo; nevertheless, as of the date on which the proceeding was filed, they had received no concrete solutions, nor had any effective intervention been undertaken to stop or mitigate the threat. They mention that, in junio de 2025, they approached CONAVI, but were told that the matter falls under the responsibility of the Municipalidad de San Mateo. They request that the respondent authorities be ordered to take immediate, effective, and permanent measures to stop the damage and protect both the sole access to their property and their physical safety.
  2. 2By decision issued at 12:42 on 16 de setiembre de 2025, the amparo proceeding was admitted, and reports were requested from the Mayor and the Director de la Unidad Técnica de Gestión Vial, both of the Municipalidad de San Mateo, as well as from the Executive Director of the Consejo Nacional de Vialidad (CONAVI).
  3. 3In a written submission added to the digital case file at 16: 55 on 23 de setiembre de 2025, Karen Tatiana Alfaro Jiménez, in her capacity as Mayor, and Ana Silvia Castro González, in her capacity as Directora de Gestión Vial y Control Urbano, both of the Municipalidad de San Mateo, reported under oath as follows: “(…) The Municipalidad de San Mateo, through this Directorate, has closely followed up on the requests submitted by residents of Estanquillos concerning the management of stormwater originating from Ruta Nacional N.° 713 and the residential development identified in the area. In this regard, it should be clarified that the municipal administration has acted diligently, technically, and within the scope of its authority, conducting inspections, issuing official letters, and providing specific comments to the project developers; therefore, there can be no claim of any omission. The administrative record contains Oficio PS No. 015-2024 of 5 de agosto de 2024, through which the complaint submitted by the residents in abril de ese año was addressed and instructions were issued to the technical and surveying personnel to inspect the drainage works (obras de drenaje) performed at the site.This action resulted in Informe DTGV-TOPO-071-24 of 12 de agosto de 2024, which documented deficiencies in the stormwater-channeling works (trabajos de canalización pluvial): the use of undersized pipes, headwalls (cabezales) lacking appropriate geometric specifications, and low-strength materials. That report warned of possible impacts on neighboring homes and recommended removing the deficient works and submitting a redesign compliant with applicable regulations. Subsequently, through Oficio DTGV-INT-165/00-2024 of 28 de setiembre de 2024, this Directorate reiterated specific technical comments regarding the project, noting that discharges toward Ruta Nacional required express authorization from CONAVI, as well as the obligation to use pipes of the correct diameter, lined ditches (cunetas revestidas), appropriate compaction thicknesses, and road signage and safety measures. That same official letter placed on record that the drawing entitled ‘Obras de mejora vial e infraestructura de desfogue pluvial del Proyecto Estanquillos’ did not meet the technical requirements and therefore could not be approved by this Municipality.With respect to professional responsibilities, it should be emphasized that construction permit (permiso de construcción) N.° OC1193399 identifies engineer Mario Alberto Venegas Garita as responsible for the preliminary studies, plans, calculation reports (memorias de cálculo), and technical management of the project, and that he assumes the corresponding civil and professional liability in accordance with the applicable regulations. The Municipality established the minimum conditions for the work within the canton, whereas transitions toward Ruta Nacional 713 fall under the exclusive authority of CONAVI. As part of its subsequent follow-up, this Directorate participated in the joint inspection of 30 de junio de 2025 with CONAVI officials, during which it was found that there was no undermining (socavaciones) or imminent risk of collapse at the access road in question; the vegetation was observed to be stable, with no active erosion.These conclusions were confirmed during the technical visit of 22 de setiembre de 2025, when once again no current damage or extraordinary water flows were identified in the area. It must also be considered that this is an area of mountainous terrain and steep slopes, which naturally exposes properties located at lower elevations to stormwater runoff. This fact, however, cannot be attributed to any improper conduct by the Municipality, particularly because the inspections have demonstrated stability and an absence of direct impacts on the access road identified by the petitioners. It follows from the foregoing that the Municipalidad de San Mateo, through this Directorate, has acted in accordance with the law and reasonable technical criteria by issuing notices (prevenciones), providing specific comments, conducting inspections, and coordinating with CONAVI, the competent authority for national routes.There is no objective evidence establishing material damage attributable to municipal administration, and the claims in the proceeding are based on hypothetical risks that have not been corroborated by independent expert assessments (peritajes independientes). Accordingly, this Directorate reaffirms that there has been no omission, negligence, or violation of fundamental rights attributable to the Municipalidad de San Mateo, but rather diligent and documented action consistent with the principle of legality (principio de legalidad). (…)”. They request that the proceeding be dismissed.
  4. 4In a written submission added to the digital case file at 9:31 hours on 24 de setiembre de 2025, Jason Adrián Pérez Anchía, in his capacity as Acting Executive Director of the Consejo Nacional de Vialidad, reports under oath as follows: “(…) To properly address the situation raised in this amparo proceeding (recurso de amparo), the Gerencia de Conservación de Vías y Puentes of the Consejo Nacional de Vialidad was asked to issue the corresponding technical report regarding the reported facts. (…) The following elements relevant to the analysis of this case may be extracted and interpreted from that technical report: SITE LOCATION: The underlying problem identified by the residents of Estanquillos concerns the cantonal road (ruta cantonal) that connects to National Route No. 713 to the north, control section 21690, between stations 15+925 and 16+050 (300m north of the Escuela de Estanquillos), and its effects on National Route 713 and the properties south of that intersection.BACKGROUND: The Consejo Nacional de Vialidad (CONAVI) has received reports from residents of Estanquillos alleging potential future impacts on the community arising from the following circumstances: 1. Land-use changes (cambios de uso de suelo): A developer converted properties from forestry use to residential use, thereby increasing surface runoff (escorrentía superficial). 2. Modification of the roadway surface (carpeta de rodamiento): The cantonal road, which had previously consisted of gravel (lastre) or similar material, was replaced with an impermeable asphalt surface. 3. Inadequate stormwater management (manejo inadecuado de aguas pluviales): Drainage cuts (cortes de drenaje) within the cantonal road, which originally channeled water toward adjoining properties to the east and west (Calle División), were closed. The potential increase in runoff is now directed toward the adjacent national route.(…) DESCRIPTION OF THE DOCUMENTED FINDINGS: As a result of these reports and requests from the affected persons, and as part of the maintenance work on National Route 713, which adjoins the aforementioned cantonal road, the interventions and modifications to the impermeable surface have been monitored and photographed, as has the performance of the stormwater-management plan implemented on the cantonal road and on the adjoining properties with access to “Calle División.” On National Route No. 713, at station 15+925, there is a culvert crossing (paso de alcantarilla) measuring 1,00 meter in diameter, which receives the stormwater generated between stations 15+000 and 16+025. That culvert crossing, together with the formed ditch (cuneta conformada), is part of the existing stormwater system, which has operated properly through the periodic maintenance work performed by CONAVI’s Gerencia de Conservación de Vías y Puentes, consisting of brush cutting and cleaning.The stormwater system conveys the water generated by the national route toward the privately owned land south of the road, in accordance with article 20 of the Ley de Caminos Públicos (Ley N.º 5060), which provides: “Article 20.- All possessors of real property, under any title, are required to receive and allow water from roads to flow through their properties whenever the slope of the land so requires and, when their properties are adjacent to the drainage outlets of a road, they must keep such outlets clean, in perfect working order, and free of obstructions. The Ministry or the Municipalities shall order the work to be performed and shall charge the cost of the work plus a fifty percent (50%) surcharge if this obligation is not fulfilled. The Ministerio de Obras Públicas y Transportes and the Municipalities shall coordinate with the Ministerio de Agricultura on measures to protect roads in projects involving new road alignments or maintenance work on existing roads, in regions where such roads may cause or intensify erosion or divert the natural drainage of fields.” It is clarified that responsibility for water-management infrastructure located within private properties rests with the owner, under the supervision of the Municipality.CONAVI has no authority to intervene on private property; therefore, any internal development must comply with Municipal regulations. The Municipality is responsible for ensuring the continuity of stormwater outlets (desfogues pluviales) when reviewing construction permits and for overseeing compliance by designers and owners with article 20 of Ley 5060, ensuring that outlet points are properly mapped and functional. With respect to the complaint filed by the petitioners (recurrentes), the runoff affecting their properties is attributed to inadequate water management on the cantonal road. Although water flowing naturally from the national route must be received by owners of lower-lying properties, pursuant to article 20, it is essential that the amount of water entering their land be minimal. The remaining runoff must be managed efficiently along Calle División to ensure compliance with the regulations.The situation described is clearly shown in the sketches and satellite images (Image 2 and 3), which show how runoff functioned before and after the reported work, both on the cantonal road and on the adjoining land. Image 2 shows the condition of the stormwater system before febrero de 2024. During that period, stormwater from National Route No. 713 was efficiently captured by the earthen shoulder (espaldón en tierra) and conveyed toward culvert crossing 15+925. The excess inflow from the Cantonal Road “Calle División,” captured by the culvert crossings, did not flow onto the route, and its overall runoff was insufficient to disrupt the operation of the national route’s stormwater system. However, this condition changed beginning in febrero de 2024, when earthworks (movimientos de tierra) commenced on the identified land for the construction of homes. In addition: ➢ The cantonal road, which was previously gravel, now has an impermeable asphalt surface. ➢ Concrete-lined shoulders with poorly constructed energy dissipators (disipadores) were built; their distribution is inadequate, and they do not function properly. ➢ The existing grade produces higher runoff velocities, and the closure of the stormwater cuts (cortes de agua pluvial) increases the risk of damage to the national route.These interventions on the land and the cantonal road, together with the closure of the existing outlets, increase the stormwater flow discharged onto National Route No. 713. In addition, the water generated on the cantonal road is not efficiently captured by the national route’s existing stormwater system. Consequently, the complaint focuses on the water flowing uncontrolled over the roadway at the intersection with the National Route; the technical solution requires proper management of runoff within the cantonal road. (…) SUMMARY OF PROBLEMS IDENTIFIED ON THE CANTONAL ROAD: Various problems related to stormwater management on the cantonal road were identified, which affect the community and contribute to the increasing deterioration of National Route No. 713. The most significant findings include: 1. Grade of the cantonal road: The road has a steep grade, causing water to flow at high speed over the surface during heavy rainfall.The road crown and conveyance of water must be evaluated to mitigate this effect. 2. Stormwater management on “Calle División”: Given the amount of runoff and the existing grade, the water must be conveyed through ditches and water cuts (cortes de agua) toward controlled discharge areas, preventing it from flowing directly onto the National Route. 3. Runoff toward the National Route: Stormwater generated on the cantonal road must not be conveyed in its entirety to the national route, particularly at the intersection, because this results in uncontrolled flow. The flow currently reaching the national route exceeds what would be technically acceptable. 4. Safety at the intersection: A metal grate cannot be installed at the intersection of the cantonal road and the national route because of the grade and the risk of vehicles losing traction. Runoff from the cantonal road must be minimized and managed primarily through ditches and water cuts within the cantonal road itself. 5.Deficiencies in the cantonal road infrastructure: • It is unknown whether the construction was supported by a hydrologic and hydraulic study (estudio hidrológico e hidráulico) approved by the municipality. • Water cuts were closed without an adequate road-crown system. • Although dissipators were installed, they are poorly located and symmetrically arranged, producing concentrated flow without energy dissipation, which does not help mitigate runoff. 6. Municipal oversight: It is unknown whether the work performed was supervised by the municipal technical authority, because the asphalt has a vertical curve at the junction with the National Route, creating a significant road-safety risk. (…) ACTIONS TAKEN BY CONAVI: Although the reported problem originates on the Cantonal Road known as “Calle División” and in adjoining residential developments, CONAVI: 1. Responded to the residents’ requests by conducting inspections and monitoring in the area of National Route No. 713. 2.Kept the national route’s stormwater system operational by cleaning, brush cutting, and removing vegetation from the culvert crossing located at station 15+925. 3. Documented the variations in runoff originating from the cantonal road and the residential developments and prepared the technical report of the Gerencia de Conservación de Vías y Puentes (CARTA-CONAVI-DRC-05-2025-1426 de 18 de septiembre de 2025), which is attached as an annex. That report concludes that the increased flow is attributable to the modifications to Calle División and the urban development and that the municipality is responsible for ensuring proper stormwater management in residential developments and on cantonal roads. The report also documents the maintenance of the formed channel, performed under the current contracts of CONAVI’s Gerencia de Conservación de Vías y Puentes, Contrato 2022CD-000145-0006000001, pursuant to which the affected stormwater system has been cleaned.This work maintains an optimal hydraulic cross-section (sección hidráulica), conveying stormwater toward culvert crossing 15+925, as shown in Photograph 14, 15 and 16 of the aforementioned technical report. (…) IV. CONCLUSIONS: 1. CONAVI’s jurisdiction and functional framework: Pursuant to the Ley de Creación del CONAVI, Ley N.º 7798, this Council is responsible for the preservation, maintenance, and supervision of national routes, as well as the administration of the stormwater systems corresponding to those roads, as provided in articles 1 and 4 of the aforementioned law. Accordingly, the interventions performed by CONAVI are strictly limited to its jurisdiction and to national routes, and it has no authority to intervene directly on private properties or cantonal roads, the management of which falls to the municipalities. 2. Application of the Principle of Legality (Principio de Legalidad): Pursuant to article 11 of the Constitución Política and article 11 of the Ley General de la Administración Pública, public officials may perform only those acts expressly authorized by law.

Consequently, all actions taken by CONAVI have been carried out in strict compliance with the principle of legality, limited to performing maintenance, cleaning, and monitoring of the stormwater system within the right-of-way (derecho de vía) of National Route No. 713, without exceeding the powers conferred upon it by the regulations in force. 3. Response to the reported problem: CONAVI has responded to requests from local residents, keeping the stormwater system in optimal condition and documenting variations in runoff (escorrentía) through technical report CARTA-CONAVI-DRC-05-2025-1426, which demonstrates that the increase in stormwater flow (caudal pluvial) originates on Calle División and in adjacent urban developments, the management of which falls under the municipality’s jurisdiction (competencia). 4. Limitation of CONAVI’s liability: The discharge (desfogue) of stormwater onto private property and the proper management of runoff within cantonal streets do not fall within CONAVI’s jurisdiction.

Therefore, any impact resulting from modifications to Calle División or from housing developments cannot be attributed to this Council, since its role is limited to maintaining national routes and their corresponding stormwater systems. 5. Follow-up with the community: Notwithstanding the foregoing, CONAVI has assisted the community and followed up on its concerns on several occasions through the Ingeniería de Zona and the Contraloría de Servicios, thereby fulfilling its duty of oversight and maintenance within the national route’s right-of-way. 6. Technical recommendation: To mitigate the effects of runoff on National Route No. 713, the municipality must ensure stormwater management on Calle División and in the adjacent residential developments by maintaining the discharge outlets and water-diversion cuts (cortes de agua), and by overseeing any work that could affect the hydraulics of the national route.

The actions undertaken by CONAVI have been diligent, timely, and consistent with the regulatory framework. The institution has acted by channeling the case through the proper procedure and observing the principles of administrative coordination, reasonableness, efficient use of public resources, and compliance with the legal framework in force. CONAVI reaffirms its willingness to coordinate with the Municipalidad de San Mateo, always in strict compliance with the principle of legality, so that each institution acts within its respective regulatory framework, thereby avoiding any misuse of authority (desviación de poder) or assumption of powers beyond its jurisdiction. Consequently, there is no evidence of arbitrary action or any omission attributable to CONAVI that could be deemed a violation of the fundamental rights invoked by the appellants. On the contrary, it has been demonstrated that the institution has acted objectively, responsibly, and within the scope of its jurisdiction. (…)” It requests that the appeal (recurso) be dismissed.

  1. 5In the conduct of the proceedings, the legal requirements have been observed.

Justice Araya García drafts the opinion; and,

Considering:

I.Preliminary Matter. Before analyzing the merits of the case—concerning the alleged violation of the right to prompt and proper proceedings—it must be clarified that, since Judgment No. 2008-02545, issued at 8:55 hours on 22 de febrero de 2008, this Chamber has referred to the administrative-law jurisdiction—with some exceptions—those matters in which it is disputed whether the public administration has complied with the time limits established by the Ley General de la Administración Pública (Articles 261 and 325) or by sector-specific laws governing special administrative proceedings, either to conclude an administrative proceeding—initiated ex officio or at the request of a party—by issuing a final administrative act, or to hear the applicable administrative appeals. This case specifically presents an exception, because it concerns a complaint regarding circumstances that are creating a risk to the safety of the people living in the area and to the protection of their property, which the respondent authorities allegedly failed to resolve within a reasonable period. Having clarified this point, the Chamber proceeds to decide the specific situation raised in this writ of amparo (amparo).

II.Subject Matter of the Action. The petitioners—residents of Estanquillos, San Mateo—state that, since febrero de 2024, a residential development has diverted stormwater (aguas pluviales) and wastewater (aguas residuales) toward their properties, causing serious damage to the area’s only access road and creating a risk of landslides. They complain that, despite requests submitted to the Municipalidad de San Mateo and CONAVI, as of the date on which they sought amparo relief they had not received comprehensive solutions to the problem; accordingly, they request the intervention of this Chamber.

III. Proven Facts. The following facts are deemed duly established and relevant to the decision in this matter

  • 1)The petitioners are residents of Estanquillos, San Mateo (undisputed fact).
  • 2)On 10 de abril de 2024, the protected party [Nombre 008] submitted the following complaint to the Municipalidad de San Mateo: “(…) Please accept our cordial greetings. We are contacting you to request your assistance in reviewing a matter related to Route 713, specifically the road toward Zapote, Estanquillos. As the Development Association of our community has reported by telephone, work is currently underway on the development of several building sites located along Route 713, approximately 50 meters northwest of the Catholic church in Estanquillos. This work is altering the natural flow of water during the rainy season and blocking outlets, which could seriously affect both this national route and the homes of older adults and other persons, as well as neighboring residents’ coffee plantations. We assume that the owners of these building sites do not intend to cause problems. We approached them to seek options, and the workers present stated that they were complying with the permits but were not responsible for providing a solution concerning stormwater outlets.

Given this situation, we turn to you so that you may provide the technical assistance necessary to intervene and enable preventive work regarding earthworks (movimientos de tierra) and drainage. We trust in the work that you, as the municipal government, can perform. We submit this request on behalf of [Nombre 002] and the siblings ([Nombre 008]), [Nombre 021], [Nombre 022], [Nombre 023], [Nombre 024], and [Nombre 025], with the latter signing as the principal contact for follow-up (…)” (see evidence submitted by the respondent authorities).

  • 3)On 5 de agosto de 2024, the Social Outreach Officer of the Technical Road Management Department of the respondent municipality informed the Mayor of that canton as follows: “(…) In the hope of clarifying the matter addressed in the letter I received on 10 de abril of this year, I hereby report the following: – The Social Outreach Area of this Municipality received a letter from the residents of Estanquillos on 10-4-24. – The letter refers to the technical assistant and the surveyor conducting an inspection to determine whether the site is located on a national or cantonal route, or in Atenas or San Mateo. – The assistant issued a report on 11-4-24 stating that he did not observe any impact on the road itself, but that 5 clearly visible, recently constructed terraces could be seen. – To date, the surveyor has not issued a report. – Once the inspector’s inspection report was received, the case was referred to the department head, who was verbally informed of the case and provided with the report; likewise, my department head forwarded it to Urban Development because it involved earthworks. – I was informed that Urban Development has a case file on the matter, since the case was addressed as unauthorized earthworks. – Today, I contacted Mr.

Naranjo to inform him of what occurred at that time and of the current situation. – My department head informed me that this same case, which was addressed months ago, was addressed again today through interdisciplinary work by professionals from Urban Development and the DTGV surveying unit. – The surveyor was asked whether he had any report on the matter, and he stated that he did not. – The surveying unit was asked to prepare a report on water management and whether the water could cause damage to any type of nearby infrastructure. – A field visit will be conducted on Thursday at 10am to carry out social mapping in the affected area. With nothing further, we await the requested report, which will indicate the potential risks to existing infrastructure. The community spokesperson will be kept informed so that they are fully aware of the work performed, as will you. (…)” (see evidence submitted by the respondent authorities).

  • 4)On 12 de agosto de 2024, the Surveying Engineer of the respondent municipality issued Report DTGV-TOPO-071-24, documenting deficiencies in the stormwater channeling system (canalización pluvial), including the use of undersized pipes and low-strength materials, warning of possible impacts on homes, and recommending the following: “(…) 1. Removal of Deficient Drainage Works: It is recommended that the immediate removal of the improperly constructed drainage works be ordered. 2. If construction permits are sought, an appropriate stormwater-management design must be submitted, including at least: 1. Pipes measuring 18” in diameter. 2. Inspection boxes and headwalls with appropriate geometries in accordance with current standards. 3. Lined ditches with appropriate velocity dissipators. 4. Drainage works at the junction that ensure the proper diversion of water toward the National Route, preventing it from crossing the roadway and flowing uncontrolled toward the existing structures on the south side. 5.

Expansion of the space between the asphalt surface and the earthen wall to maintain an adequate hydraulic cross-section, ensuring that the water remains controlled within the roadway without overflowing toward the National Route until it reaches its discharge point in the existing pipe measuring 90 cm in diameter. (…)” (see the report submitted and the evidence provided by the respondent authorities).

  • 5)On 28 de setiembre de 2024, the Engineer from the Road and Internal Control Directorate of the Municipalidad de San Mateo issued Official Communication DTGV-INT-165/09 2024, reiterating the technical observations made since 12 de agosto, noting that discharges toward National Route No. 713 required the express authorization of CONAVI and the use of suitable pipes, in addition to signage and road-safety measures, and concluding that “(…) the ‘Road Improvement Works and Stormwater Discharge Infrastructure’ plan sheet for the Estanquillos Project does not comply with the technical specifications and/or details required for approval by this department. (…)” (see the report submitted and the evidence provided by the respondent authorities).
  • 6)On 30 de diciembre de 2024, the Engineer from the Road and Internal Control Directorate of the respondent municipality issued Official Communication DTGV- INT 212/12 2024, determining that the developer must reactivate and enable the stormwater system because it had closed it without authorization. It was also established that the works and the safety of the area are the developer’s responsibility and that the developer must maintain insurance policies and ensure regulatory compliance. In addition, it was recommended that an appropriate transition be made between the stormwater works on the cantonal route and those on the national route to prevent impacts on third parties and ensure stormwater drainage, concluding that “(…) the ‘Road Improvement Works and Stormwater Discharge Infrastructure’ plan sheet for the Estanquillos Project complies with the technical specifications and/or details required for approval by this department; in addition, the recommendation in item e. must be taken into consideration. (…)” (see the report submitted and the evidence provided by the respondent authorities).
  • 7)On 10 de enero de 2025, the petitioners filed a new complaint with the respondent municipality, stating that “(…) We have been following up on this process by contacting Licda. Karen Alfaro Jiménez, Mayor, and Siany Rodríguez Hidalgo of the Road Management Department, and by visiting the municipality’s offices, where we were told that we would be informed of the water-management plan that was to be followed. However, on 03 de enero del 2025, we observed that construction work had begun, and we were not informed, as we had been told we would be, of how the water-distribution system is to be arranged. We wish to receive this information and to know who is responsible for supervising compliance with the water-distribution plan, because, unfortunately, the project owners have not demonstrated a willingness to seek the best solutions, and therefore we were unable to pursue this process through community dialogue. We would appreciate receiving, through this written submission, a response to this courteous and necessary request for guidance from you in your capacity as municipal officials. (…)” (see evidence submitted by the respondent authorities).
  • 8)On 15 de enero de 2025, the Road Management and Urban Control Engineer of the respondent municipality sent an email to that municipality’s Urban Control Architect, requesting that he “(…) In view of the complaints and concerns of residents in the area, I request an inspection in the sector known as ‘la cuesta del diablo’ in Estanquillos, for the purpose of verifying whether the type and quantity of works, among other matters, correspond to the construction permits granted or, alternatively, whether any seals placed as a result of a prior closure order have been violated. Complaints regarding this project have been constant; therefore, I recommend documenting the inspections and verifications performed in order to maintain transparency in the case and including that documentation in the corresponding case file. Please provide copies of the documents generated for the appropriate follow-up. (…)” (see evidence submitted by the respondent authorities).
  • 9)On that same date—15 de enero de 2025—the Urban Control Architect of the Municipalidad de San Mateo responded to the request from that municipality’s Road Management and Urban Control Engineer, stating that “(…) I request that an official from the UTGV accompany me during the inspection, because the requested and approved permits include work on a public road, and part of the report must include a technical assessment from this Department. (…)” (see evidence submitted by the respondent authorities).
  • 10)On 16 de enero de 2025, the Urban Development and Cadastre Architect of the respondent municipality issued official letter DI-SM-OFIN/006-25, in which she stated that the inspection conducted at the specified property, as a follow-up to the permits granted—PC-1004-2024 (Gabion Wall), PC-1094-2024 (Road Improvement Works), and PC-1095-2025 (Earthworks (movimiento de tierra))—confirmed that the gabion wall had been completed in accordance with CFIA proceeding OC-1174302; the road improvement works had remained halted since the closure of 5 de agosto de 2024 (notice N.º 0609); and the earthworks had been completed. Machinery was also observed working on a future dwelling being processed under CFIA number 1193003 (see evidence submitted by the respondent authorities).
  • 11)On 31 de enero de 2025, the Engineer from the Technical Directorate of Road Management of the respondent municipality prepared an inspection report, in which she determined that the gutters did not comply with the technical specifications approved in the plans and recommended that “(…) The concrete must be mechanically, rather than manually, prepared. The concrete must have a mix design. The concrete must have the required strength. The base must be mechanically compacted. The gutters must comply with the dimensions approved in the plans. (…)” (see evidence submitted by the respondent authorities).
  • 12)On 20 de febrero de 2025, the Environmental Management Office of the Municipalidad de San Mateo, through an inspection report form, determined that construction work was being carried out on “Calle Cuesta del Diablo”—including the installation of pipes and work to make a dwelling habitable—and also verified that the interventions affected the gutter and the existing stormwater system, which could create a risk of runoff (escorrentía) onto the public roadway. The recommendation was to forward the report to the Global and Individual Lot Construction Licensing Office (Licencia de Construcción Global y de Lotes, LGC) to assess the connection and ensure that the work complied with regulations, thereby preventing harm to third parties (see evidence submitted by the respondent authorities).
  • 13)On that same date—20 de febrero de 2025—the Urban Control Architect of the respondent municipality sent an email to appellant [Nombre 026], stating that “(…) The Developer submitted all the documentation required to apply for a permit for the work on the street (Cantonal Route). It was reviewed by engineer Ana Silva, who is in charge of the Road Department and has also been conducting the inspections and making the relevant corrections. In the case of the National Route, the Developer deepened and cleaned the gutter to assist the flow of water running through it. As far as my Department is concerned, the appropriate procedures have been completed for the work within private property, namely the earthworks, gabion wall, and construction of a future dwelling, and all of these applications have a municipal license. The necessary inspections are conducted to assess whether the work conforms to what was approved in the permits. Likewise, the Road Engineer conducts inspections to verify matters concerning the street belonging to the cantonal route. I recommend that you carry out preventive work within your properties because, as we know, your property is at a lower elevation than the street, and this will always cause problems for you, both with this project and with future ones. (…)” (see evidence submitted by the respondent authorities).
  • 14)On 7 de marzo de 2025, the Engineering and Construction Department of the Municipalidad de San Mateo prepared a new inspection report, in which it determined that, at the time of the visit, the project covered by municipal permit PC-1122-2025, corresponding to the construction of a dwelling with a swimming pool, was at the trenching and reinforcement stage and that no irregularities or elements deviating from the approved plans were detected. It was recommended that “(…) our colleagues at the UTGV enter the observations they made in the field into the APC digital logbook (…)” (see evidence submitted by the respondent authorities).
  • 15)On 21 de abril de 2025, the Engineer from the Technical Directorate of Road Management of the respondent municipality prepared a new inspection report, in which she determined that the existing natural drainage outlet had to be restored before any other work was performed, for which they were given a period of 8 business days. She also found that the implementation of a low wall at the intersection with the RN and the channeling of water to ensure a proper transition remained pending. It was recommended that they “(…) a) Proceed with construction of the lateral outlet for water flowing along the right side of the station. b) Construct the measures recommended at the RN junction in order to provide an adequate transition without causing collateral damage within the project’s area of influence. (…)” (see evidence submitted by the respondent authorities).
  • 16)On 22 de abril de 2025, the Urban Control Architect of the respondent municipality sent an email to Mario Venegas, the Engineer responsible for the “Improvement of a Public Street” project, stating that “(…) I wish to advise you that the work performed does not correspond to what was approved by this municipality. Therefore, you must carry out the work corresponding and relevant to the project. (…)” (see evidence submitted by the respondent authorities).
  • 17)On 23 de abril de 2025, Mario Venegas, the Engineer responsible for the “Improvement of a Public Street” project, responded to the Municipalidad de San Mateo as follows: “(…) 1. This project concerns the construction of infrastructure works on the public road known as Cuesta de Diablo. 2. The work described in the design and approved by the Municipalidad de San Mateo under construction permit PC- 1094- 2024 concerns improvements to the road and the stormwater infrastructure adjacent to it. 3. Mr. Jonathan Bill Camacho Zamora, rather than the cited company (Crimex Desarrollo S.A), was registered as the owner of this project. 4. This project involves a road that is not included in the inventory of the Municipalidad de San Mateo. 5. The design of this project’s work includes EACH AND EVERY ONE of the recommendations proposed in official letter DTGV-INT165-09-2024. 6. The elements that this report requests be constructed were NEVER part of the recommendations made in official letter DTGV-INT165-09 2024. 7.

In that report, Ms. Ana Silvia requests the construction of hydraulic infrastructure elements for the discharge of stormwater that were NEVER considered during the design stage or included in the plans approved by the municipality under construction license PC-1094-2024. 8. Because the road known as “Cuesta del Diablo” is not included in the inventory records of the Municipalidad de San Mateo, any financial resources allocated to it cannot come from the Tax Simplification and Efficiency Law (Ley de simplificación y eficiencia tributaria); Ley 8114, and must therefore be provided for by the municipal administration. (…)” (see evidence submitted by the respondent authorities).

  • 18)On 24 de abril de 2025, the Head of Road Management and Urban Control of the Municipalidad de San Mateo sent an email to Mario Venegas, the Engineer responsible for the “Improvement of a Public Street” project, stating that “(…) We appreciate your contacting us and your stated willingness to seek a joint solution to the problem before us. The deadline proposed in document DGTV INT 073 04 2025 is suspended until the matter at issue has been resolved jointly. A meeting to address the case was scheduled for 22-05-2025 at 1:30 pm. (…)” (see evidence submitted by the respondent authorities).
  • 19)On 26 de mayo de 2025, the respondent Mayor’s Office sent an email to the appellants stating: “(…) Dear Naranjo family: I sent you a message via Whatsapp with the best intention of keeping you informed about the steps being taken at the administrative level. As you indicate, it was not an official communication but rather an informal conversation intended to keep the channel of communication open. Once the relevant work has been completed, you will receive a formal response through the appropriate channels. (…)” (see evidence submitted by the respondent authorities).
  • 20)On 30 de junio de 2025, the respondent municipality and CONAVI conducted a joint inspection, during which they confirmed the absence of scouring and of any imminent risk of collapse at the access point, observing stable vegetation and no active erosion in the area (see report submitted and evidence provided by the respondent authorities).
  • 21)On 17 de setiembre de 2025, the order initiating this proceeding was served on CONAVI (see certificate of service).
  • 22)On 18 de setiembre de 2025, the order initiating this proceeding was served on the authorities of the Municipalidad de Alajuela (see certificate of service).
  • 23)On 18 de setiembre de 2025, CONAVI issued technical report CARTA-CONAVI-DRC-05-2025-1426, in which it concluded that the increased flow was attributable to alterations to “Calle División” and urban development, the management of which, it stated, falls to the Municipalidad de San Mateo (see report submitted and evidence provided by the respondent authorities).
  • 24)On 22 de setiembre de 2025, the respondent municipality conducted a technical visit, during which it confirmed the findings of the visit carried out with CONAVI personnel in junio de 2025 (see report submitted and evidence provided by the respondent authorities).
  • 25)The CONAVI authorities state that: “In analyzing the specific case of the complaint filed by the ([Nombre 008]) family, an event affecting them is identified. This event concerns the improper management of runoff on the cantonal route. Although it is true that water naturally flowing from the national route must be received by downhill property owners (artículo 20, ley 5060), it is clear that the water flowing over the pavement at the intersection and entering their properties must be kept to the minimum possible, while the remaining runoff must be efficiently managed along the cantonal route known as ‘Calle División’ so that this requirement can be met. (…) The interventions on the land and the cantonal street, together with the closure of the drainage outlets within the cantonal street, will increase the stormwater flow discharging onto the National Route. This is compounded by the fact that the stormwater generated on the Cantonal Route is not efficiently captured by the National Route’s existing stormwater system, and the complaint concerns that water flowing uncontrolled over the roadway at the intersection with National Route No. 713. The technical solution is to manage it on the cantonal route (…)” (see report submitted and evidence provided by the respondent authorities).

III.The case at bar. In this case (sub lite), the appellants—residents of Estanquillos, San Mateo—state that, since febrero de 2024, a residential development has diverted stormwater and wastewater toward their properties, causing serious damage to the sole access to that area and creating a risk of landslides. They complain that, despite requests submitted to the Municipalidad de San Mateo and CONAVI, as of the date on which they filed this amparo proceeding (recurso de amparo), they had not received comprehensive solutions to the matter and therefore seek the intervention of this Chamber.

In this regard, the reports submitted under oath by the respondent authorities show that the protected parties did, in fact, file an initial complaint on 10 de abril de 2024 with the Municipalidad de San Mateo, warning of works on Ruta 713 that were altering the natural course of stormwater, creating risks to homes, crops, and road infrastructure. As a result of that filing, inspections were conducted that identified recently constructed terraces, with no apparent impact on the road but with indications of illegal earthworks (movimientos de tierra), and the case was therefore referred to Desarrollo Urbano. On 12 de agosto de 2024, a municipal technical report documented deficiencies in the stormwater-channeling works and recommended their removal, in addition to establishing technical specifications for future interventions. It was subsequently reiterated that the works required CONAVI authorization and did not meet the technical requirements.

In December of that year, another report determined that the developer had closed the stormwater system without a permit and was required to reactivate it and assume responsibility for the works, as well as ensure safety and provide an adequate transition between roads. On 10 de enero de 2025, they filed a new complaint, prompting an inspection in the area known as “la cuesta del diablo.” That inspection established that some works had been completed, others had been shut down, and deficiencies were detected in the drainage ditches. The Departamento de Gestión Ambiental de la Municipalidad de San Mateo therefore warned of impacts on the stormwater system and a risk of runoff (escorrentía). Although the works within private property were licensed, preventive measures were recommended because a home was located in a low-lying area.

In March and April 2025, further inspections were conducted, with recommendations to restore the natural discharge of water and construct adequate infrastructure to prevent damage. The respondent municipality notified the responsible engineer that the work did not conform to what had been approved. He replied that the works complied with the permits and that the affected road was not included in the inventory, and therefore funds under Ley 8114 did not apply. Subsequently, the deadline for complying with the technical recommendations was suspended, and a meeting was scheduled to resolve the situation. Throughout this process, the record shows that the respondent Mayor’s Office maintained informal communication with the petitioners and undertook to provide a formal response. In June of the current year, a joint inspection with CONAVI ruled out any risk of collapse or erosion. Finally, in September, CONAVI attributed the increased flow to modifications on “Calle División” and to urban development, stating that the matter falls under the responsibility of the Municipalidad de San Mateo.

The case certainly reveals a series of legitimate concerns on the part of the residents of Estanquillos—who are the petitioners in these proceedings—regarding interventions on Ruta 713 and “Cuesta del Diablo,” which they allege could jeopardize the safety of homes and crops because of alterations to the stormwater system. However, despite the multiple filings, inspections, and technical recommendations made by the respondent municipality, inconsistencies remain between the works performed and the permits granted, as does the lack of clarity concerning institutional responsibility, particularly with respect to the respective authority of the Municipalidad de San Mateo and CONAVI.

Furthermore, the record does not yet show that any action has been taken that could definitively resolve the reported problem, nor does it clearly indicate what additional steps the respondent authorities will take to resolve the underlying situation, because, as previously stated, the problem persists. It should be noted that, despite the inspections conducted and the findings made during them, as of the date this amparo proceeding (recurso de amparo) was filed—and although eighteen months had already elapsed since the petitioners submitted their complaint—no additional administrative acts (actos administrativos) had been issued to definitively resolve the stormwater situation that is causing them distress and harm. Moreover, although the respondent municipality conducted a new inspection in connection with this proceeding on 22 de septiembre de 2025 and stated that there was no erosion, it is equally true that, in the report submitted by the CONAVI authorities, they emphatically stated: “The interventions on the land and the cantonal road, together with the closure of the outlets within the cantonal road, will increase the stormwater flow discharged onto the National Route, with the aggravating circumstance that the stormwater generated on the Cantonal Route is not efficiently captured by the National Route’s existing stormwater system, and the complaint concerns that water flowing uncontrolled over the roadway at the intersection with National Route No. 713; the technical solution therefore lies in managing it on the cantonal route (…)” (emphasis not in the original).

Consequently, this Chamber finds that the time elapsed for the respondent authorities to resolve the complaint filed by the protected parties and inform them accordingly is disproportionate, since more than eighteen months have passed since the first complaint was filed without its having been fully resolved to date, compounded by the fact that the reported harm remains ongoing. Although the CONAVI authorities consider the situation to be a municipal matter, a national road is clearly involved, and the proper course is for both authorities to take the appropriate measures to resolve the situation. On this understanding, this Chamber considers that the petition must be granted, subject to the provisions set forth in the operative part of this judgment.

IV.Note by Justice Castillo Víquez concerning prompt and effective administrative justice. I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and effective justice in administrative proceedings (sede administrativa), the courts that must hear the legal dispute are the Administrative Litigation Courts (Tribunales de lo Contencioso-Administrativo), rather than this Chamber. However, with the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, it has been established that this right is eligible for judicial protection through the amparo proceeding established by artículo 32 de la Ley de la Jurisdicción Constitucional, in relation to artículo 27 de la Constitución Política de la República de Costa Rica, in those cases in which the petitioner considers that the Administration’s material actions, its administrative acts, or its response are affecting the petitioner’s fundamental rights.

In my view, the recently enacted legislation does not mean that this Court should modify its line of precedent, since, under section 7 of its Law, it has exclusive authority to define its own jurisdiction. Therefore, except for those constitutional-law disputes that this Chamber itself has recognized as exceptional circumstances that may properly be heard in this jurisdiction through the constitutional amparo guarantee proceeding, in all other cases—and for the reasons given by this Court (judgment N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008)—jurisdiction lies with the judges of the administrative-litigation jurisdiction. All of this is consistent with section 25 of the Convención Americana sobre Derechos Humanos, Constitutional Law (its values, principles, and rules), and the corresponding statutory provisions, based on a logical, systemic, and purposive interpretation of the legal system.

V.Note by Justice Salazar Alvarado. As a matter of principle, I consider that cases concerning the failure of the Public Administration to repair, construct, modify, or demolish any infrastructure work should be dismissed because such an omission is a matter of statutory legality whose adjudication belongs to the ordinary courts, before which the interested person may litigate their objections more fully. However, when such administrative inaction results in a violation of other fundamental rights protected in this constitutional jurisdiction, or affects groups considered vulnerable, I do examine the merits because such a situation constitutes an exception to my position on this matter, as occurs in this case, in which the petitioning party alleges the diversion of stormwater and wastewater onto their property, causing damage and risks of landslides, thereby threatening people’s physical integrity, but which the competent authorities have allegedly failed to address.

VI.Documentation submitted to the case file. The party is hereby advised that, if it submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, these must be collected from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not collected within that period shall be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session No. 27-11 de 22 de agosto de 2011, article XXVI, and published in Boletín Judicial number 19 de 26 de enero de 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session No. 43-12 celebrada el 3 de mayo de 2012, article LXXXI.

Por tanto:

The petition is granted. Karen Tatiana Alfaro Jiménez, in her capacity as Mayor, and Ana Silvia Castro González, in her capacity as Director of Gestión Vial y Control Urbano, both of the Municipalidad de San Mateo, as well as Jason Adrián Pérez Anchía, in his capacity as Acting Executive Director of the Consejo Nacional de Vialidad, or whoever may hold those positions, are ordered to take the actions within the scope of their authority so that, within a maximum period of six months from notification of this judgment, the appropriate interinstitutional verifications and coordination may be carried out to definitively resolve the problem raised, and the petitioning parties may be formally informed of the decision. The respondents are warned that failure to comply with this order will constitute the offense of disobedience and that, pursuant to article 71 of the Law governing this jurisdiction, anyone who receives an order issued in an amparo proceeding that they must comply with or cause to be complied with, and who fails to comply with it or cause it to be complied with, shall be sentenced to imprisonment for three months to two years or a fine of twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty.

The Municipalidad de San Mateo and the Consejo Nacional de Vialidad are ordered to pay the legal costs, damages, and losses caused by the facts forming the basis of this ruling, which shall be assessed during enforcement of the judgment before the administrative-litigation jurisdiction. Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del catorce de noviembre de dos mil veinticinco .

Resultando:

  1. 1Por escrito ingresado en el expediente judicial a las 11:44 horas de 8 de setiembre de 2025, los recurrentes interponen recurso de amparo contra la Municipalidad de San Mateo y el Consejo Nacional de Vialidad (CONAVI). Manifiestan que son vecinos de Estanquillos, San Mateo. Señalan que, desde hace muchos años, las aguas que bajan desde la Ruta Nacional 713 han afectado su propiedad; sin embargo, desde febrero de 2024, la situación se ha agravado severamente, debido a un desarrollo habitacional que ha alterado los patrones de escorrentía, desviando grandes volúmenes de aguas pluviales y residuales hacia su propiedad. Refieren que dicha situación ha generado daños severos y progresivos al único camino de acceso a su terreno, así como riesgo de derrumbes que amenazan la seguridad y la vida de las personas que transitan por esa vía; además, el incremento del caudal que baja por el alcantarillado de la Ruta Nacional 713 hacia su propiedad, está erosionando el terreno, lo que podría hacer colapsar el acceso por completo.Aducen que, desde abril de 2024, han realizado múltiples gestiones ante la Municipalidad de San Mateo; empero, al día de interposición del recurso no han recibido soluciones concretas ni se ha realizado una intervención efectiva que detenga o mitigue la amenaza. Mencionan que, en junio de 2025 acudieron al CONAVI, pero se les indicó que le corresponde a la Municipalidad de San Mateo. Solicitan que se ordene a las autoridades recurridas tomar medidas inmediatas, eficaces y definitivas para detener los daños y proteger el único acceso a su propiedad, así como su integridad.
  2. 2En resolución de las 12:42 horas de 16 de setiembre de 2025, se da curso al amparo y se solicita informe al Alcalde y el Director de la Unidad Técnica de Gestión Vial, ambos de la Municipalidad de San Mateo, así como el Director Ejecutivo del Consejo Nacional de Vialidad (CONAVI).
  3. 3Mediante escrito incorporado al expediente digital a las 16: 55 horas de 23 de setiembre de 2025, informan bajo juramento Karen Tatiana Alfaro Jiménez, en su condición de Alcaldesa y Ana Silvia Castro González, en su condición de Directora de Gestión Vial y Control Urbano, ambas de la Municipalidad de San Mateo, lo siguiente: “(…) La Municipalidad de San Mateo, a través de esta Dirección, ha dado puntual seguimiento a las gestiones planteadas por los vecinos de Estanquillos en relación con el manejo de aguas pluviales provenientes de la Ruta Nacional N.° 713 y el desarrollo habitacional identificado en la zona. En este sentido, corresponde aclarar que la administración municipal ha actuado de forma diligente, técnica y ajustada a sus competencias, realizando inspecciones, emitiendo oficios y formulando observaciones concretas a los desarrolladores del proyecto, sin que pueda hablarse de omisión alguna.Consta en el expediente administrativo el Oficio PS No. 015-2024 del 5 de agosto de 2024, mediante el cual se atendió la denuncia presentada por los vecinos en abril de ese año, girando instrucciones al personal técnico y topográfico para verificar en sitio las obras de drenaje ejecutadas. De esta diligencia derivó el Informe DTGV-TOPO-071-24 del 12 de agosto de 2024, en el que se documentaron deficiencias en los trabajos de canalización pluvial: uso de tuberías de diámetro reducido, cabezales sin condiciones geométricas adecuadas y materiales de baja resistencia. En dicho informe se advirtió sobre la posibilidad de afectación a viviendas colindantes y se recomendó la remoción de las obras deficientes y la presentación de un rediseño ajustado a normativa. Posteriormente, mediante el Oficio DTGV-INT-165/00-2024 del 28 de setiembre de 2024, esta Dirección reiteró observaciones técnicas específicas al proyecto, señalando la necesidad de que las descargas hacia la Ruta Nacional contaran con autorización expresa del CONAVI, así como la obligación de emplear tuberías de diámetro correcto, cunetas revestidas, espesores de compactación adecuados y medidas de señalamiento y seguridad vial.En ese mismo oficio se dejó constancia de que la lámina titulada “Obras de mejora vial e infraestructura de desfogue pluvial del Proyecto Estanquillos” no cumplía con los requisitos técnicos, por lo que no podía ser avalada por esta Municipalidad. En lo que respecta a las competencias profesionales, debe destacarse que el permiso de construcción N.° OC1193399 identifica al ingeniero Mario Alberto Venegas Garita como responsable de los estudios preliminares, planos, memorias de cálculo y dirección técnica del proyecto, quien asume la responsabilidad civil y profesional correspondiente, de conformidad con la normativa aplicable. La Municipalidad giró las condiciones mínimas para la obra en el ámbito cantonal, mientras que las transiciones hacia la Ruta Nacional 713 corresponden a la competencia exclusiva del CONAVI. En el seguimiento posterior, esta Dirección participó en la inspección conjunta del 30 de junio de 2025 con funcionarios del CONAVI, en la que se constató que no existían socavaciones ni riesgo inminente de colapso en el acceso referido, observándose estabilidad en la vegetación y ausencia de erosión activa.Estas conclusiones fueron confirmadas en la visita técnica del 22 de setiembre de 2025, donde nuevamente no se identificaron daños actuales ni flujos extraordinarios de agua en la zona. Debe considerarse también que se trata de un sector de topografía montañosa y fuertes pendientes, lo que naturalmente expone a las propiedades situadas en niveles inferiores a escorrentías pluviales. Este hecho, sin embargo, no puede imputarse a una actuación irregular de la Municipalidad, máxime cuando las inspecciones han demostrado estabilidad y ausencia de afectaciones directas en el camino de acceso señalado por los recurrentes. De lo anterior se desprende que la Municipalidad de San Mateo, a través de esta Dirección, ha actuado conforme a derecho y a criterios técnicos de razonabilidad, emitiendo prevenciones, formulando observaciones concretas, practicando inspecciones y coordinando con el CONAVI, autoridad competente en materia de rutas nacionales.No existe prueba objetiva que acredite daños materiales atribuibles a la gestión municipal, y los alegatos del recurso se fundamentan en riesgos hipotéticos no corroborados mediante peritajes independientes. En consecuencia, esta Dirección reafirma que no ha existido omisión, negligencia ni vulneración de derechos fundamentales atribuible a la Municipalidad de San Mateo, sino un actuar diligente, documentado y conforme al principio de legalidad. (…)”. Solicitan se declare sin lugar el recurso.
  4. 4Por escrito incorporado al expediente digital a las 9:31 horas de 24 de setiembre de 2025, informa bajo juramento Jason Adrián Pérez Anchía, en su condición de Director Ejecutivo a.i. del Consejo Nacional de Vialidad, lo siguiente: “(…) Para la debida atención de la situación planteada en el presente recurso de amparo, se solicitó a la Gerencia de Conservación de Vías y Puentes del Consejo Nacional de Vialidad la emisión del informe técnico correspondiente en relación con los hechos denunciados. (…) Del mencionado informe técnico, es posible extraer e interpretar los siguientes elementos de relevancia para el análisis del presente caso: UBICACIÓN DEL SITIO: El problema generador indicado por los vecinos de Estanquillos, corresponde a la ruta cantonal que conecta al norte con la Ruta Nacional No. 713, sección de control 21690, entre las estaciones 15+925 y 16+050 (300m norte de la Escuela de Estanquillos) y sus efectos en la Ruta Nacional 713 y las propiedades al sur de dicha intersección.ANTECEDENTES: El Consejo Nacional de Vialidad (CONAVI) ha recibido reportes de vecinos de Estanquillos, en los cuales se presumen futuras afectaciones a la comunidad, derivadas de las siguientes situaciones: 1. Cambios de uso de suelo: Un desarrollador modificó propiedades de uso forestal a habitacional, lo que incrementa la escorrentía superficial. 2. Modificación de la carpeta de rodamiento: La ruta cantonal, previamente conformada por lastre o material similar, fue sustituida por una carpeta asfáltica impermeable. 3. Manejo inadecuado de aguas pluviales: Se cerraron cortes de drenaje dentro de la ruta cantonal, que originalmente canalizaban las aguas hacia propiedades colindantes al este y oeste (Calle División). El posible aumento de escorrentía se dirige ahora hacia la ruta nacional adyacente. (…) DESCRIPCIÓN DE LOS HALLAZGOS EVIDENCIADOS: A raíz de estos reportes y solicitudes de los afectados, y como parte de las gestiones de mantenimiento de la Ruta Nacional 713, que colinda con la mencionada ruta cantonal, se ha llevado a cabo un monitoreo y registro fotográfico de las intervenciones y modificaciones en la carpeta impermeable, así como del desempeño de la propuesta de gestión de aguas pluviales implementada en la calle cantonal y en los terrenos colindantes con acceso a la “Calle División”.En la Ruta Nacional N.º 713, en la estación 15+925, se cuenta con un paso de alcantarilla de 1,00 metro de diámetro, el cual recibe las aguas pluviales generadas entre las estaciones 15+000 y 16+025. Dicho paso de alcantarilla, junto con la cuneta conformada, forma parte del sistema pluvial existente, que ha funcionado correctamente mediante los trabajos periódicos de mantenimiento ejecutados por la Gerencia de Conservación de Vías y Puentes del CONAVI, consistentes en chapeas y limpiezas. El sistema pluvial conduce las aguas generadas por la ruta nacional hacia el terreno al sur de la vía, propiedad privada, en conformidad con el artículo 20 de la Ley de Caminos Públicos (Ley N.º 5060), que establece: “Artículo 20.- Todos los poseedores de bienes raíces, por cualquier título, están obligados a recibir y dejar discurrir dentro de sus predios, las aguas de los caminos cuando así lo determine el desnivel del terreno y, cuando sus fundos estén inmediatos a los desagües de un camino, deberán mantener estos desagües limpios, en perfecto estado de servicio y libres de obstáculos.El Ministerio o las Municipalidades mandarán a ejecutar el trabajo y cobrarán el trabajo más el cincuenta por ciento (50%) de recargo, si esta obligación no se cumpliere. El Ministerio de Obras Públicas y Transportes y las Municipalidades deberán coordinar con el Ministerio de Agricultura las medidas de protección de los caminos en los proyectos de nuevos trazados o en los trabajos de conservación de los existentes, en las regiones donde los mismos puedan provocar o intensificar la erosión ó desviar el desagüe natural de los campos.” Se aclara que la infraestructura de manejo de aguas dentro de propiedades privadas es responsabilidad del propietario, bajo supervisión de la Municipalidad. El CONAVI no tiene competencia para intervenir en propiedades privadas, por lo que cualquier desarrollo interno debe ajustarse a las normativas Municipales. Corresponde a la Municipalidad garantizar la continuidad de los desfogues pluviales al revisar permisos de construcción y supervisar que los proyectistas y propietarios cumplan con las disposiciones del artículo 20 de la Ley 5060, asegurando que los puntos de desfogue estén correctamente mapeados y funcionales.En relación con la denuncia presentada por los recurrentes, el factor de escorrentía que impacta sus propiedades se atribuye a la gestión inadecuada de aguas en la ruta cantonal. Si bien el agua que escurre naturalmente por la ruta nacional debe ser recibida por los propietarios en desnivel, conforme al artículo 20, es fundamental que el agua que ingresa a sus terrenos sea mínima. El resto de la escorrentía debe ser gestionado eficientemente a lo largo de la Calle División, para garantizar el cumplimiento de la normativa. La situación descrita se evidencia claramente en los croquis y las imágenes satelitales (Imagen 2 y 3), que muestran el funcionamiento de la escorrentía antes y después de los trabajos denunciados, tanto en la ruta cantonal como en los terrenos colindantes. En la Imagen 2 se muestra la condición del sistema pluvial antes de febrero de 2024. En ese período, las aguas pluviales provenientes de la Ruta Nacional N.º 713 eran captadas de manera eficiente por el espaldón en tierra, conduciéndolas hacia el paso de alcantarilla 15+925.El aporte excedente de la Ruta Cantonal “Calle División”, captado por los pasos de alcantarilla, no filtraba sobre la ruta y su escorrentía general no era suficiente para distorsionar el funcionamiento del sistema pluvial de la ruta nacional. Sin embargo, esta condición cambió a partir de febrero de 2024, cuando se iniciaron movimientos de tierra en los terrenos indicados, con el fin de realizar construcciones de viviendas. Asimismo: ➢ La calle cantonal, que anteriormente era de lastre, ahora presenta una superficie con carpeta asfáltica impermeable. ➢ Se construyeron espaldones revestidos con concreto con disipadores mal ejecutados, cuya distribución es inadecuada y no funcionan correctamente. ➢ La pendiente existente genera mayores velocidades de escorrentía, y el cierre de los cortes de agua pluvial aumenta el riesgo de daños a la ruta nacional. Estas intervenciones en los terrenos y en la calle cantonal, junto con el cierre de los desfogues existentes, incrementan el caudal de aguas pluviales que desembocan en la Ruta Nacional N.º 713.Adicionalmente, las aguas generadas en la ruta cantonal no son captadas eficientemente por el sistema pluvial existente de la ruta nacional. Como consecuencia, la denuncia presentada se centra en el agua que escurre sobre la calzada sin control, en la intersección con la Ruta Nacional, cuya solución técnica requiere un manejo adecuado de la escorrentía dentro de la ruta cantonal. (…) RESUMEN DE PROBLEMAS IDENTIFICADOS EN LA RUTA CANTONAL: Se detectaron diversos problemas relacionados con la gestión de aguas pluviales en la ruta cantonal, los cuales afectan a la comunidad y contribuyen al incremento del deterioro de la Ruta Nacional N.º 713. Entre los hallazgos más relevantes destacan: 1. Pendiente de la ruta cantonal: La vía presenta una pendiente pronunciada, lo que provoca que, durante lluvias intensas, el agua escurra con gran velocidad sobre la carpeta. Es necesario evaluar el bombeo y conducción del agua para mitigar este efecto. 2.Gestión pluvial de la “Calle División”: Por el nivel de escorrentía y la pendiente existente, el agua debe ser conducida mediante cunetas y cortes de agua hacia zonas de descarga controladas, evitando que escurra directamente hacia la Ruta Nacional. 3. Escorrentía hacia la Ruta Nacional: El agua pluvial generada en la calle cantonal no debe ser trasladada en su totalidad a la ruta nacional, especialmente en la intersección, ya que esto genera escurrimiento sin control. Actualmente, el flujo que llega a la ruta nacional excede lo que sería técnicamente aceptable. 4. Seguridad en la intersección: La intersección entre la ruta cantonal y la ruta nacional no puede contar con parrilla metálica, debido a la pendiente y riesgo de pérdida de tracción de los vehículos. La escorrentía proveniente de la cantonal debe minimizarse, gestionándose principalmente por cunetas y cortes de agua dentro de la propia calle cantonal. 5.Deficiencias en la infraestructura de la calle cantonal: • Se desconoce si la construcción fue apoyada en un estudio hidrológico e hidráulico aprobado por la municipalidad. • Se cerraron cortes de agua sin un sistema de bombeo adecuado. • Aunque se colocaron disipadores, estos están mal ubicados y simétricos, generando un flujo concentrado sin disipación de energía, lo que no contribuye a mitigar la escorrentía. 6. Supervisión municipal: Se desconoce si los trabajos realizados fueron supervisados por el ente técnico municipal, ya que el asfalto presenta una curva vertical en el entronque con la Ruta Nacional, constituyendo un riesgo significativo para la seguridad vial. (…) ACTUACIONES REALIZADAS POR EL CONAVI: Pese a que la problemática denunciada se origina en la Ruta Cantonal denominada “Calle División” y en desarrollos habitacionales colindantes, el CONAVI: 1. Atendió las gestiones de los vecinos mediante inspecciones y monitoreo en el sector de la Ruta Nacional N.º 713. 2.Mantuvo en estado operativo el sistema pluvial de la ruta nacional, ejecutando labores de limpieza, chapea y descuaje en el paso de alcantarilla ubicado en la estación 15+925. 3. Documentó las variaciones de escorrentía originadas en la ruta cantonal y en las urbanizaciones, elaborando el informe técnico de la Gerencia de Conservación de Vías y Puentes (CARTA-CONAVI-DRC-05-2025-1426 de 18 de septiembre de 2025), el cual se adjunta como anexo. En dicho informe se concluye que el incremento de caudal responde a las modificaciones en la Calle División y al desarrollo urbanístico, siendo competencia municipal garantizar la correcta gestión pluvial en urbanizaciones y caminos cantonales. Asimismo, se evidencia el mantenimiento del canal conformado, ejecutado mediante las contrataciones vigentes de la Gerencia de Conservación de Vías y Puentes del CONAVI, Contrato 2022CD-000145-0006000001, mediante el cual se han realizado las limpiezas del sistema pluvial afectado.Estas labores permiten mantener una sección hidráulica óptima, conduciendo las aguas pluviales hacia el paso de alcantarilla 15+925, como se muestra en la Fotografía 14, 15 y 16 del informe técnico antes mencionado. (…) IV. CONCLUSIONES: 1. Competencia y marco funcional del CONAVI: Conforme a la Ley de Creación del CONAVI, Ley N.º 7798, este Consejo tiene a su cargo la conservación, mantenimiento y supervisión de las rutas nacionales, así como la administración de los sistemas pluviales correspondientes a dichas vías, según lo previsto en los artículos 1 y 4 de la mencionada ley. Por lo tanto, las intervenciones realizadas por el CONAVI se circunscriben estrictamente a su ámbito de competencia y a las rutas nacionales, sin que tenga facultad para intervenir directamente en propiedades privadas o calles cantonales, cuya gestión corresponde a las municipalidades. 2. Aplicación del Principio de Legalidad: De acuerdo con el artículo 11 de la Constitución Política y el artículo 11 de la Ley General de la Administración Pública, los funcionarios públicos únicamente pueden realizar actos expresamente autorizados por la ley.En consecuencia, todas las actuaciones del CONAVI han sido realizadas en estricto apego al principio de legalidad, limitándose a ejecutar labores de mantenimiento, limpieza y monitoreo del sistema pluvial dentro del derecho de vía de la Ruta Nacional N.º 713, sin exceder las facultades que le confiere la normativa vigente. 3. Actuación frente a la problemática denunciada: El CONAVI ha atendido las gestiones vecinales, manteniendo el sistema pluvial en óptimas condiciones y documentando las variaciones de escorrentía a través del informe técnico CARTA-CONAVI-DRC-05-2025-1426, que evidencia que el incremento del caudal pluvial se origina en la Calle División y en desarrollos urbanísticos colindantes, cuya gestión corresponde a la municipalidad. 4. Limitación de la responsabilidad del CONAVI: El desfogue de aguas pluviales en terrenos privados y la correcta gestión de escorrentías dentro de calles cantonales no forman parte de la competencia del CONAVI.Por lo tanto, cualquier afectación derivada de modificaciones en la Calle División o de desarrollos habitacionales no puede atribuirse a este Consejo, pues su función se limita al mantenimiento de rutas nacionales y sistemas pluviales correspondientes. 5. Seguimiento a la comunidad: A pesar de lo anterior, el CONAVI ha atendido a la comunidad y ha dado seguimiento a sus inquietudes en varias ocasiones, mediante la Ingeniería de Zona y la Contraloría de Servicios, cumpliendo con su deber de supervisión y mantenimiento dentro del derecho de vía de la ruta nacional. 6. Recomendación técnica: Para mitigar los efectos de escorrentía sobre la Ruta Nacional N.º 713, corresponde que la municipalidad garantice la gestión pluvial en la Calle División y en las urbanizaciones colindantes, manteniendo los desfogues y cortes de agua, y supervisando cualquier intervención que pueda afectar la hidráulica de la vía nacional.Las gestiones realizadas por el CONAVI han sido diligentes, oportunas y ajustadas al marco normativo. La actuación institucional se ha desarrollado canalizando el caso por la vía procedente y respetando los principios de coordinación administrativa, razonabilidad, eficiencia en el uso de recursos públicos y sujeción al marco legal vigente. El CONAVI reafirma su disposición a coordinar con la Municipalidad de San Mateo, siempre en estricto apego al principio de legalidad, de manera que cada institución actúe dentro del marco normativo que le corresponde, evitando incurrir en desviación de poder o asumir competencias que no le son propias. En consecuencia, no existe evidencia de una actuación arbitraria ni de una omisión atribuible al CONAVI que pueda considerarse violatoria de los derechos fundamentales invocados por los recurrentes. Por el contrario, se ha demostrado que la institución ha actuado con objetividad, responsabilidad y dentro del ámbito de sus competencias. (…)” Solicita se declare sin lugar el recurso.
  5. 5En la substanciación del proceso se ha observado las prescripciones legales.

Redacta el Magistrado Araya García; y,

Considerando:

I.Cuestión Preliminar. De previo a analizar el fondo del asunto -por la presunta violación del derecho a un procedimiento pronto y cumplido- debe aclararse que, a partir de la sentencia No. 2008-02545 de las 8:55 horas de 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa -con algunas excepciones-, aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo -instruido de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes. Precisamente, en este caso, se plantea un supuesto de excepción, pues, se está ante una denuncia por situaciones que están generando un riesgo para la integridad de las personas que habitan en la zona y por el resguardo de su propiedad, la cual, presuntamente, no ha sido resuelta dentro de un plazo razonable por parte de las autoridades recurridas. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.

II.Objeto del recurso. Los recurrentes -vecinos de Estanquillos, San Mateo-, manifiestan que desde febrero de 2024 un desarrollo habitacional ha desviado aguas pluviales y residuales hacia sus propiedades, causando graves daños al único acceso de dicha zona y generando riesgo de derrumbes. Reclaman que a pesar de gestiones presentadas ante la Municipalidad de San Mateo y el CONAVI, a la fecha en la que acuden en amparo no han recibido soluciones integras al respecto, por lo que solicitan la intervención de esta Sala.

III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

  • 1)Los recurrentes son vecinos de Estanquillos, San Mateo (hecho incontrovertido).
  • 2)El 10 de abril de 2024, el amparado [Nombre 008] presentó ante la Municipalidad de San Mateo la siguiente denuncia: “(…) Reciban un cordial saludo, nos permitimos contactarles con el fin de pedir su colaboración en la revisión de un asunto vinculado con la ruta 713 específicamente calle hacía Zapote, Estanquillos. Tal como se ha comunicado telefónicamente por la Asociación de Desarrollo de nuestra comunidad, actualmente se encuentran en trabajo el desarrollo de unos planteles, los cuales están desarrollándose sobre la ruta 713, aproximadamente 50 metros noroeste del templo católico de Estanquillos. Dichos trabajos están modificando el caudal natural de las aguas durante el invierno y tapando salidas, lo que podría afectar fuertemente tanto esta ruta nacional como las casas de habitación de adultos mayores y otras personas, así como los cafetales de las personas vecinas. Partimos del supuesto de que los dueños de estos planteles no buscan generar inconvenientes, nos acercamos para buscar opciones y los trabajadores presentes informan cumplir con los permisos, pero no tener vinculación con brindar solución al tema de las salidas de agua de lluvia.

Ante esta situación, recurrimos a ustedes para que puedan generar el apoyo técnico necesario para intervenir, para que se pueda hacer un trabajo preventivo en cuanto a los movimientos de tierra y desagües. Confiamos en el trabajo que ustedes como municipalidad pueden realizar. Hacemos llegar esta solicitud en nombre de [Nombre 002] y los hermanos ([Nombre 008]), [Nombre 021], [Nombre 022], [Nombre 023], [Nombre 024] y [Nombre 025], firmando este último como contacto principal para el seguimiento (…)” (ver prueba aportada por las autoridades recurridas).

  • 3)El 5 de agosto de 2024, la Promotora Social del Departamento Técnico de Gestión Vial del municipio recurrido le informó a la Alcaldesa de dicho cantón lo siguiente: “(…) Esperando poder aclarar lo referente a la nota recibida por mi persona, el día 10 de abril del año en curso, paso a informarle lo siguiente: -Área Promoción Social de esta Municipalidad, recibió nota de los vecinos de Estanquillos el día 10-4-24. – En la nota hace referencia al asistente técnico y al topógrafo al realizar la inspección para saber si el lugar se encuentra en ruta nacional, cantonal o en Atenas o San Mateo. – El asistente emite informe el día 11-4-24 donde indica que a nivel de camino no ve afectación, pero que si se ven 5 terrazas de manera clara recientemente construidas. – El topógrafo no emite informe hasta la fecha. – Una vez recibido el informe de inspección, del inspector, el caso se le pasa a la jefatura y verbalmente se le comenta el caso y facilita el informe, de la misma manera mi jefatura lo envió a desarrollo urbano por ser un movimiento de tierra. – Me indican que en desarrollo urbano existe expediente al respecto ya que el caso fue atendido por ser un movimiento de tierra ilegal. – El día de hoy me contacté con el señor Naranjo para informarle lo acontecido en ese momento y en la actualidad. – Me indica mi jefatura que este mismo caso atendido meses atrás, hoy fue atendido nuevamente de manera interdisciplinaria entre los profesionales de Desarrollo urbano y topografía del DTGV. – Se le pregunto al topógrafo si tenía algún informe al respecto y me indica que no. – Se le solicita a topografía un informe respecto al manejo de aguas y si las mismas pueden llegar a ocasionar daños en cualquier tipo de infraestructura cercana. – Se realizará visita en campo el jueves a las 10am para realizar un mapeo social en el área involucrada.

Sin más a la espera del informe solicitado, el cual nos indicará los posibles riesgos en la infraestructura existente. Se mantendrá informado al vocera de la comunidad para que conozca con amplitud lo realizado al igual que a su persona. (…)” (ver prueba aportada por las autoridades recurridas).

  • 4)El 12 de agosto de 2024, el Ingeniero Topógrafo de la municipalidad accionada, emitió el informe DTGV-TOPO-071-24 en el cual documentó deficiencias en la canalización pluvial, tales como el uso de tuberías de diámetro reducido y materiales de baja resistencia, advirtiendo posible afectación a viviendas y recomendando lo siguiente: “(…) 1. Remoción de las Obras de Drenaje Deficientes: Se recomienda ordenar la remoción inmediata de las obras de drenaje construidas de manera deficiente. 2. En caso de tramitar permisos de construcción, se deberá presentar un diseño adecuado para el manejo de aguas pluviales, que incluya como mínimo: 1. Tuberías de 18” de diámetro. 2. Cajas de registro y cabezales con geometrías adecuadas según las normas vigentes. 3. Cunetas revestidas con disipadores de velocidad apropiados. 4. Obras de drenaje en el entronque que aseguren el correcto desvío de las aguas hacía la Ruta Nacional, evitando que estas sobrepasen la vía y discurran sin control hacia las construcciones existentes en el costado sur. 5.

Ampliación del espacio entre la carpeta asfáltica y el muro de tierra para mantener una sección hidráulica adecuada, asegurando el control de las aguas dentro de la vía sin desbordarse hacia la Ruta Nacional hasta su punto de descarga en la tubería existente de 90 cm de diámetro. (…)” (ver informe rendido y prueba aportada por las autoridades recurridas).

  • 5)El 28 de setiembre de 2024, la Ingeniera de la Dirección Vial y de Control Interno de la Municipalidad de San Mateo emitió el Oficio DTGV-INT-165/09 2024 en el que reiteró observaciones técnicas realizadas desde el 12 de agosto anterior, señalando que las descargas hacia la Ruta Nacional N.º 713 requerían autorización expresa del CONAVI y uso de tuberías adecuadas, además de medidas de señalamiento y seguridad vial, concluyendo que “(…) la lámina “Obras de mejora vial e infraestructura de desfogue pluvial” del Proyecto Estanquillos, no cumple con las especificaciones técnicas y/o detalles para ser avaladas por este departamento. (…)” (ver informe rendido y prueba aportada por las autoridades recurridas).
  • 6)El 30 de diciembre de 2024, la Ingeniera de la Dirección Vial y de Control Interno del municipio recurrido emitió el Oficio DTGV- INT 212/12 2024 en el que se determinó que debe reactivarse y habilitarse el sistema pluvial por parte del desarrollador, dado que lo cerró sin autorización. También, se estableció que las obras y la seguridad de la zona son responsabilidad del desarrollador, quien debe contar con pólizas de seguro y garantizar el cumplimiento normativo, así como, además, se recomendó realizar la transición adecuada de las obras pluviales de la ruta cantonal hacia la ruta nacional para evitar afectaciones a terceros y asegurar la evacuación del agua pluvial, concluyendo que “(…) la lámina “Obras de mejora vial e infraestructura de desfogue pluvial” del Proyecto Estanquillos, cumple con las especificaciones técnicas y/o detalles para ser avaladas por este departamento, además, tomar en consideración la recomendación del punto e. (…)” (ver informe rendido y prueba aportada por las autoridades recurridas).
  • 7)El 10 de enero de 2025, los recurrentes interpusieron una nueva denuncia ante la municipalidad accionada, mediante la cual indicaron que “(…) Hemos estado dando seguimiento a este proceso mediante el contacto de la Licda. Karen Alfaro Jiménez, Alcaldesa y de Siany Rodríguez Hidalgo del Departamento de gestión vial y visita a las instalaciones de la municipalidad, donde nos han indicado que nos informarían del plan de manejo de aguas que se debería seguir. Sin embargo, este 03 de enero del 2025 hemos visto que los trabajos de construcción han iniciado y nosotros no hemos sido informados, como nos habían indicado que se haría, de cómo debe quedar la distribución de las aguas. Deseamos contar con esta información, además de conocer quién es el encargado de la supervisión de que se cumpla con el plan de distribución de las aguas, ya que lastimosamente los dueños del proyecto no han actuado con buena disposición para buscar las mejores soluciones, por lo que no pudimos hacer este proceso a través del diálogo comunal, Agradecemos que por medio de este escrito puedan darnos respuesta a esta amable y necesaria solicitud de guía como responsables municipales. (…)” (ver prueba aportada por las autoridades recurridas).
  • 8)El 15 de enero de 2025, la Ingeniera de Gestión Vial y Control Urbano de la municipalidad accionada remitió un correo electrónico al Arquitecto de Control Urbano de dicho municipio, mediante el cual le solicitó que “(…) Considerando las denuncias y preocupación de los vecinos en la zona, solicito inspección en el sector de “la cuesta del diablo” en Estanquillos, con la finalidad de verificar si el tipo de obras, cantidades y demás, coincide con los permisos de construcción otorgados, o en su defecto verificar si existe alguna violación de sellos por alguna clausura previa. Las quejas de este proyecto han sido constantes, por lo que recomiendo documentar las inspecciones y verificaciones realizadas para mantener la transparencia del caso e incluirlo en el expediente correspondiente. Facilitar copia de los documentos generados para el seguimiento correspondiente. (…)” (ver prueba aportada por las autoridades recurridas).
  • 9)En esa misma fecha -15 de enero de 2025-, el Arquitecto de Control Urbano de la Municipalidad de San Mateo le brindó respuesta a lo requerido por la Ingeniera de Gestión Vial y Control Urbano de dicho municipio, mediante el cual le señaló que “(…) Solicito acompañamiento de algún funcionario de la UTGV para realizar la inspección, ya que dentro de los permisos solicitados y aprobados se encuentra la intervención de una calle pública y parte de informe debe incluir criterio técnico de parte de este Departamento. (…)” (ver prueba aportada por las autoridades recurridas).
  • 10)El 16 de enero de 2025, la Arquitecta de Desarrollo Urbano y Catastro del municipio recurrido emitió el oficio DI-SM-OFIN/006-25, mediante el cual estableció que de la inspección efectuada en la propiedad indicada, en seguimiento a permisos otorgados: PC-1004-2024 (Muro de Gaviones), PC-1094-2024 (Obras de mejora vial) y PC-1095-2025 (Movimiento de tierra), se logró constatar que el muro de gaviones estaba terminado conforme al trámite CFIA OC-1174302; las obras de mejora vial permanecen detenidas desde la clausura del 5 de agosto de 2024 (boleta N.º 0609); y el movimiento de tierra está concluido, así como se observó maquinaria trabajando en una futura vivienda en trámite bajo el número CFIA 1193003 (ver prueba aportada por las autoridades recurridas).
  • 11)El 31 de enero de 2025, la Ingeniera de la Dirección Técnica de Gestión Vial de la municipalidad accionada efectuó el acta de inspección, mediante la cual determinó que las cunetas no cumplen con especificaciones técnicas aprobadas en planos y se recomendó que “(…) El concreto debe contar con elaboración mecánica no manual. El concreto debe contar con diseño de mezcla. El concreto debe contar con la resistencia solicitada. La base debe compactarse de manera mecánica. Las cunetas deben cumplir con las dimensiones aprobadas en planos. (…)” (ver prueba aportada por las autoridades recurridas).
  • 12)El 20 de febrero de 2025, la Gestión Ambiental de la Municipalidad de San Mateo, a través de la boleta de informe de inspección, determinó que en la “Calle Cuesta del Diablo” se ejecutan trabajos de construcción -incluyendo instalación de tuberías y obras para habilitar una vivienda- así como también se verificó que las intervenciones afectan la cuneta y el sistema pluvial existente, lo que podría generar riesgos de escorrentía hacia la vía pública. Como recomendación se indicó enviar el informe a la Licencia de Construcción Global y de Lotes (LGC) para evaluar la conexión y garantizar que las obras cumplan con la normativa, evitando afectaciones a terceros (ver prueba aportada por las autoridades recurridas).
  • 13)En esa misma fecha -20 de febrero de 2025-, la Arquitecta del Control Urbano del municipio recurrido le remitió un correo a la recurrente [Nombre 026], mediante el cual le indicó que “(…) El Desarrollador presentó toda la documentación para solicitar permiso para los trabajos de la calle (Ruta Cantonal), estos fueron revisados por la ingeniera Ana Silva encargada del Departamento Vial, la cual también a estado realizando las inspecciones y las correcciones pertinentes. En el caso de la Ruta Nacional, el Desarrollador realizó la profundización y limpieza de la cuneta para ayudar al flujo de agua que corre por ahí. En lo que a mi Departamento corresponde, se han realizado los trámites correspondientes a las obras dentro de propiedad privada, que serían las de movimiento de tierra, muro de gaviones y la construcción de una futura vivienda, de las cuales todas estas solicitudes cuentan con licencia municipal.

Se realizan inspecciones necesarias para valorar si las obras corresponden a lo aprobado en los permisos. Igualmente, la ingeniera Vial realiza las inspecciones para realizar las verificaciones sobre temas de la calle perteneciente a ruta cantonal. Les recomiendo realizar trabajos preventivos dentro de sus propiedades, ya que como sabemos su propiedad se encuentra a un nivel más bajo de la calle y esto siempre va a provocarles problemas, tanto este proyecto como venideros. (…)” (ver prueba aportada por las autoridades recurridas).

  • 14)El 7 de marzo de 2025, el Departamento de Ingeniería y Construcción de la Municipalidad de San Mateo efectuó una nueva acta de inspección, mediante la cual determinó que el proyecto con permiso municipal PC-1122-2025 correspondiente a la construcción de una vivienda con piscina, al momento de la visita, la obra se encontraba en la etapa de zanjeo y armadura, así como no se detectaron irregularidades ni elementos fuera de los planos aprobados. Se recomendó que “(…) a los compañeros de la UTGV realizar las observaciones que hicieron en campo a la bitácora digital del APC (…)” (ver prueba aportada por las autoridades recurridas).
  • 15)El 21 de abril de 2025, la Ingeniera de la Dirección Técnica de Gestión Vial del municipio recurrido efectuó una nueva acta de inspección, mediante la cual determinó que deben rehabilitar la descarga natural existente previo a todas las obras, para lo que se les otorgó un plazo de 8 días hábiles, así como constató que se encontraba pendiente la implementación murete en la intersección con la RN y canalización de aguas para garantizar transición. Se recomendó que “(…) a) Proceder a la construcción de la descarga lateral de aguas pendientes al margen derecho de la estación. b) Construir las acciones recomendadas en entronque RN, con la finalidad de realizar la transición adecuadamente sin causar daños colaterales en el área de incidencia del proyecto. (…)” (ver prueba aportada por las autoridades recurridas).
  • 16)El 22 de abril de 2025, la Arquitecta de Control Urbano de la municipalidad accionada le remitió un correo electrónico a Mario Venegas, Ingeniero responsable del proyecto de “Mejorar a calle pública”, mediante el cual le indicó que “(…) Me permito indicar que los trabajos realizados no corresponde a lo aprobado por esta municipalidad. Por lo tanto, debe realizar los trabajos correspondientes y atinentes al proyecto. (…)” (ver prueba aportada por las autoridades recurridas).
  • 17)El 23 de abril de 2025, Mario Venegas, Ingeniero responsable del proyecto de “Mejorar a calle pública”, le brindó respuesta a la Municipalidad de San Mateo de la siguiente manera: “(…) 1. Dicho proyecto corresponde a la construcción de obras de infraestructura en el camino público denominado Cuesta de Diablo. 2. Las obras descritas en el diseño y aprobadas por la Municipalidad de San Mateo mediante permiso de conducción PC- 1094- 2024 corresponden a mejoras en el camino así como la infraestructura pluvial aledaña a la vía. 3. En dicho proyecto fue registrado como propietario el señor Jonathan Bill Camacho Zamora, no la sociedad citada (Crimex Desarrollo S.A). 4. La intervención de este proyecto es sobre un camino que no se encuentra inventariado por la Municipalidad de San Mateo. 5. El diseño de las obras de este proyecto contemplan TODAS Y CADA UNA de las recomendaciones propuestas mediante oficio DTGV-INT165-09-2024. 6.

Los elementos solicitados a construir en este informe NUNCA fueron parte de las recomendaciones generadas mediante oficio; DTGV-INT165-09 2024. 7. En dicho informe la señora Ana Silvia solicita la construcción de elementos de infraestructura hidráulica para el desfogue de las aguas pluviales que NUNCA fueron considerados en la etapa de diseño ni incluidos en los planos aprobados por la municipalidad bajo la licencia de construcción PC-1094-2024. 8. Siendo el camino denominado “Cuesta del Diablo” un camino no inventariado en el registro de la Municipalidad de San Mateo, los recursos económicos que se destinen a este no pueden provenir de la Ley de simplificación y eficiencia tributaria; Ley 8114 y por consiguiente deber ser previstos por la administración municipal. (…)” ver prueba aportada por las autoridades recurridas).

  • 18)El 24 de abril de 2025, la Jefa de Gestión Vial y Control Urbano de la Municipalidad de San Mateo, le remitió un correo electrónico a Mario Venegas, Ingeniero responsable del proyecto de “Mejorar a calle pública”, mediante el cual le indicó que “(…) Se agradece ponerse en contacto con nosotros y por la disposición manifiesta para buscar una solución conjunta al problema que se nos presenta, se suspende el plazo propuesto en el documento DGTV INT 073 04 2025, hasta tanto resolver conjuntamente la situación que nos ocupa. Se agendó reunión correspondiente para atender el caso el día 22-05-2025 a las 1:30 pm. (…)” (ver prueba aportada por las autoridades recurridas).
  • 19)El 26 de mayo de 2025, la Alcaldía recurrida les remitió un correo electrónico a los recurrentes mediante el cual, les indicó “(…) Estimada familia Naranjo: Les envié un mensaje por Whatsapp con la mejor intención de mantenerles informados sobre las gestiones que se están llevando a cabo a nivel administrativo. Tal como ustedes indican, no se trató de un comunicado oficial, sino de una conversación informal para mantener el canal de comunicación abierto. Una vez se hayan concluido los trabajos correspondientes, se les brindará una respuesta formal por los medios adecuados. (…)” ver prueba aportada por las autoridades recurridas).
  • 20)El 30 de junio de 2025, el municipio recurrido y CONAVI realizaron una inspección conjunta mediante la cual constataron ausencia de socavaciones y riesgo inminente de colapso en el acceso, observando estabilidad en vegetación y ausencia de erosión activa en la zona (ver informe rendido y prueba aportada por las autoridades recurridas).
  • 21)El 17 de setiembre de 2025, la resolución de curso de este proceso fue notificada al CONAVI (ver acta de notificación).
  • 22)El 18 de setiembre de 2025, la resolución de curso de este proceso fue notificada a las autoridades de la Municipalidad de Alajuela (ver acta de notificación).
  • 23)El 18 de setiembre de 2025, el CONAVI emitió el informe técnico CARTA-CONAVI-DRC-05-2025-1426, mediante el cual concluyó que el incremento del caudal responde a modificaciones en la “Calle División” y desarrollo urbanístico, cuya gestión indican que corresponde a la Municipalidad de San Mateo (ver informe rendido y prueba aportada por las autoridades recurridas).
  • 24)El 22 de setiembre de 2025, la municipalidad accionada ejecutó una visita técnica, mediante la cual confirmó los hallazgos de la visita realizada junto a personeros del CONAVI en junio de 2025 (ver informe rendido y prueba aportada por las autoridades recurridas).
  • 25)Las autoridades del CONAVI aseguran que “Analizando el caso concreto de la denuncia por parte de la familia ([Nombre 008]), se menciona que existe un hito que los afecta. Este hito corresponde a la mala gestión de la escorrentía en la ruta cantonal. Y aunque bien es cierto que el agua que escurre naturalmente por la ruta nacional, debe ser recibida por los propietarios en desnivel (artículo 20, ley 5060), si es claro que el agua que escurre por encima de la carpeta en la intersección y entra a sus terrenos debe ser debe ser la mínima posible, y el resto de escorrentía debe ser gestionada eficientemente en el trayecto de la ruta cantonal “Calle División” para que esto se pueda cumplir (…) Las intervenciones en el terreno y en la calle cantonal, junto con el cierre de los desfogues dentro de la calle cantonal; incrementaran el caudal de aguas pluviales que desembocan en la Ruta Nacional, con el agravante que las aguas pluviales generadas en la Ruta Cantonal, no son captadas eficientemente al sistema pluvial existente de la Ruta Nacional, y la denuncia recae en esa agua que escurre sobre la calzada sin control en la intersección con la Ruta Nacional No. 713, lo cual su solución técnica es el manejo en la ruta cantonal (…)” (ver informe rendido y prueba aportada por las autoridades recurridas).

III.Sobre el caso concreto. En el sub lite, los recurrentes -vecinos de Estanquillos, San Mateo-, manifiestan que desde febrero de 2024 un desarrollo habitacional ha desviado aguas pluviales y residuales hacia sus propiedades, causando graves daños al único acceso de dicha zona y generando riesgo de derrumbes. Reclaman que a pesar de gestiones presentadas ante la Municipalidad de San Mateo y al CONAVI, a la fecha en la que acuden en amparo no han recibido soluciones integras al respecto, por lo que solicitan la intervención de esta Sala.

Al respecto, de los informes rendidos bajo juramento por las autoridades recurridas se desprende que, en efecto, los amparados presentaron una primer denuncia el 10 de abril de 2024 ante la Municipalidad de San Mateo, alertando sobre obras en la Ruta 713 que alteraban el cauce natural de aguas pluviales, generando riesgos para viviendas, cultivos y la infraestructura vial, siendo que, a raíz de esta gestión, se realizaron inspecciones que identificaron construcciones recientes de terrazas, sin afectación vial aparente, pero con indicios de movimientos de tierra ilegales, por lo que el caso fue trasladado a Desarrollo Urbano. El 12 de agosto de 2024, un informe técnico municipal evidenció deficiencias en las obras de canalización pluvial y recomendó su remoción, además de establecer especificaciones técnicas para futuras intervenciones. Posteriormente, se reiteró que las obras requerían autorización del CONAVI y no cumplían con los requisitos técnicos.

En diciembre de dicho año, otro informe determinó que el desarrollador había cerrado el sistema pluvial sin permiso, debiendo reactivarlo y asumir la responsabilidad de las obras, además de garantizar la seguridad y realizar una transición adecuada entre rutas. El 10 de enero de 2025 presentaron una nueva denuncia, lo que motivó una inspección en la zona conocida como “la cuesta del diablo”, y a raíz de esta se constató que algunas obras estaban concluidas, otras clausuradas, y se detectaron deficiencias en las cunetas, por lo que el Departamento de Gestión Ambiental de la Municipalidad de San Mateo advirtió sobre afectaciones al sistema pluvial y riesgo de escorrentía, siendo que, aunque las obras dentro de propiedad privada contaban con licencia, se recomendaron medidas preventivas por la ubicación de una vivienda en zona baja.

En marzo y abril de 2025 se realizaron nuevas inspecciones, recomendando rehabilitar la descarga natural de aguas y construir infraestructura adecuada para evitar daños y la municipalidad accionada notificó al ingeniero responsable que los trabajos no se ajustaban a lo aprobado, quien respondió que las obras cumplían con los permisos y que el camino intervenido no estaba inventariado, por lo que no aplicaban recursos de la Ley 8114. Posteriormente, se suspendió el plazo de cumplimiento de las recomendaciones técnicas y se agendó una reunión para resolver la situación. Durante todo este proceso, consta que la Alcaldía recurrida mantuvo comunicación informal con los recurrentes, comprometiéndose a brindar una respuesta formal y es en junio del presente año, que una inspección conjunta con CONAVI descartó riesgos de colapso o erosión. Finalmente, en septiembre, CONAVI atribuyó el aumento del caudal a modificaciones en la “Calle División” y al desarrollo urbanístico, indicando que la gestión corresponde a la Municipalidad de San Mateo.

Ciertamente, el caso expone una serie de preocupaciones legítimas por parte de los vecinos de Estanquillos -quienes figuran como recurrentes en este proceso- ante intervenciones en la Ruta 713 y la “Cuesta del Diablo”, que según alegan podrían afectar la seguridad de viviendas y cultivos por alteraciones en el sistema pluvial. Sin embargo, a pesar de múltiples gestiones, inspecciones y recomendaciones técnicas efectuadas por la municipalidad accionada, persisten inconsistencias entre las obras ejecutadas y los permisos otorgados, así como la falta de claridad sobre la responsabilidad institucional, especialmente en lo relativo a la competencia entre la Municipalidad de San Mateo y el CONAVI.

Aunado a lo anterior, de los autos no se evidencia aún que exista actuación alguna que pueda resolver la problemática denunciada de manera definitiva, ni tampoco se indica de manera clara cuáles actuaciones adicionales realizarán las autoridades recurridas para resolver la situación de fondo, debido a que, como se dijo de previo, el problema persiste. Nótese que, pese a las visitas de inspección realizadas y a los hallazgos allí encontrados, a la fecha de presentación de este recurso, y pese a que transcurrieron ya dieciocho meses desde la presentación de la denuncia por parte de los recurrentes, no se han emitido actos administrativos adicionales para solucionar definitivamente la situación que les aflige y afecta en cuanto a las aguas pluviales. Además, si bien el municipio recurrido realizó una nueva inspección con ocasión de este recurso el 22 de septiembre de 2025 y señalan que no hay erosión, no menos cierto es que, en el informe rendido por las autoridades del CONAVI son enfáticos en señalar que: “Las intervenciones en el terreno y en la calle cantonal, junto con el cierre de los desfogues dentro de la calle cantonal; incrementaran el caudal de aguas pluviales que desembocan en la Ruta Nacional, con el agravante que las aguas pluviales generadas en la Ruta Cantonal, no son captadas eficientemente al sistema pluvial existente de la Ruta Nacional, y la denuncia recae en esa agua que escurre sobre la calzada sin control en la intersección con la Ruta Nacional No. 713, lo cual su solución técnica es el manejo en la ruta cantonal (…)” (el resaltado no es del original).

En consecuencia, estima esta Sala que el plazo que ha transcurrido para resolver la denuncia planteada por las partes tuteladas y comunicarles lo respectivo por parte de las autoridades recurridas es desproporcionado, por cuanto, ha transcurrido un plazo de más de dieciocho meses desde la presentación de la primera denuncia apuntada, sin que a la fecha esta haya sido resuelta en su totalidad, con el agravante que la afectación denunciada continúa vigente y si bien las autoridades del CONAVI consideran que es una situación resorte del municipio, ciertamente, existe una calle nacional de por medio y lo correcto es que ambas autoridades gestionen lo que corresponda para solucionar la situación. Bajo esta inteligencia, considera esta Sala que el recurso debe ser declarado con lugar, con las consideraciones que se dirán en la parte dispositiva de esta sentencia.

IV.Nota del magistrado Castillo Víquez, en cuanto a la justicia administrativa pronta y cumplida. He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales.

A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia. Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.

V.Nota del magistrado Salazar Alvarado. En tesis de principio, considero que los casos relacionados con la inactividad de la Administración Pública en la reparación, construcción, modificación o demolición de cualquier obra de infraestructura deben ser desestimados, por constituir, esa omisión, un tema de legalidad, cuya discusión corresponde a la jurisdicción ordinaria, ante la cual la persona interesada puede debatir, con mayor amplitud, sus disconformidades. Sin embargo, cuando de aquella conducta administrativa omisiva se derive alguna violación a otros derechos fundamentales tutelados en esta jurisdicción constitucional, o se afecten grupos considerados vulnerables, sí entro a conocer el fondo del asunto, por constituir esta situación una excepción a mi posición en esta materia, tal y como sucede en este caso, en que la parte recurrente acusa el desvío de aguas pluviales y residuales hacia su propiedad, generando daños y riesgos de derrumbes, lo que amenaza la integridad de las personas, pero que presuntamente no ha sido atendido por las autoridades competentes.

VI.Documentación aportada al expediente. Se previene a la parte que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 de 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial número 19 de 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.

Por tanto:

Se declara con lugar el recurso. Se ordena a Karen Tatiana Alfaro Jiménez, en su condición de Alcaldesa y Ana Silvia Castro González, en su condición de Directora de Gestión Vial y Control Urbano, ambas de la Municipalidad de San Mateo, así como a Jason Adrián Pérez Anchía, en su condición de Director Ejecutivo a.i. del Consejo Nacional de Vialidad, o a quienes ocupen dichos cargos, que realicen las actuaciones que estén dentro del ámbito de sus competencias, para que en el plazo máximo de seis meses contados a partir de la notificación de esta sentencia, se realicen las verificaciones y coordinaciones interinstitucionales que correspondan para dar solución definitiva a la problemática planteada, y se informe de manera formal a las partes recurrentes de lo resuelto. Se les advierte a los recurridos que, de no acatar la orden dicha, incurrirán en el delito de desobediencia y, que de conformidad con el artículo 71 de la Ley de esta jurisdicción, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.

Se condena a la Municipalidad de San Mateo y al Consejo Nacional de Vialidad al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
