Document Review Decision No. 2025037542 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine twenty on catorce de noviembre de dos mil veinticinco.

Amparo proceeding (recurso de amparo) being processed under case number 25-025544-0007-CO, filed by Nombre91168, of legal age, identity card CED51386, against the Ministerio de Salud, the Instituto Costarricense de Acueductos y Alcantarillados, and the Municipalidad de Liberia.

Findings of Fact:

  1. 1By a filing received by the Office of the Clerk of the Chamber at 11:59 on 25 de agosto de 2025, the petitioner filed an amparo proceeding against the Ministerio de Salud and the Instituto Costarricense de Acueductos y Alcantarillados—ICAA—and states that in 2015 she filed an amparo proceeding decided under number 16-002436-0007-CO, in which she reported the improper management of a sewage storage pit (fosa de almacenamiento de aguas negras) belonging to Residencial El Río, located at Dirección5863. She states that, as a result, the Ministerio de Salud issued a health order (orden sanitaria) to the owner of the pit, who installed submersible pumps to transfer the fecal waste to the sanitary sewer (alcantarillado sanitario); however, she explains that the solution was only partial and that the problems have frequently recurred. She indicates that, since octubre de 2022, the pumping system and the pit have been completely abandoned, causing sewage to overflow directly into the río Liberia and adjacent lots, a situation that produces foul odors, noxious gases, the proliferation of insects and rodents, and further direct pollution of the river and the environment.She emphasizes that her home is the most severely affected because of its proximity, forcing the doors and windows to remain closed, which seriously affects the health and family life of her household and their right to a dignified life; her household consists of her husband, an 18-year-old adolescent, a 10-year-old girl, and herself. She adds that, on 11 de noviembre de 2022, she filed a formal complaint with the Ministerio de Salud de Liberia under number 354-2022; nevertheless, she complains that it has not been addressed to date, based on the asserted inability to serve notice on the owner. She adds that, in noviembre de 2023, she filed another complaint regarding the same situation, which was likewise not resolved, demonstrating a repeated failure to act by the health authorities. She states that the fecal material accumulated in the pit is currently removed in a makeshift and irregular manner by an unidentified person, without apparent official authorization, using an external manual pump to transfer the waste to the public sewer system; this procedure lasts approximately nine hours each day and entails simultaneously opening the pit and the sewer, releasing nauseating odors and noxious gases and exposing the community to vectors and the risk of spills that end up in the río Liberia.She states that, when the pump is not used, the fecal material overflows directly into the riverbed, and that this situation constitutes negligent management of highly polluting waste in a housing complex comprising more than 250 homes and a hotel, without minimum conditions of safety, sanitation, or environmental control. She further explains that, during the rainy season, the ICAA sanitary sewer adjacent to the pit overflows, further aggravating the environmental pollution. In view of the failure to act described above, she considers that her fundamental rights and those of the other residents of the affected area have been violated; she therefore requests that this proceeding be granted and that such measures as are appropriate under the law be ordered.
  2. 2By a decision issued at 21:00 on 29 de agosto de 2025, the Office of the President of the Chamber admitted this amparo proceeding and requested reports from the Director del Área Rectora de Salud de Liberia del Ministerio de Salud and the Jefe de la Oficina Cantonal de Liberia del ICAA regarding the facts alleged by the petitioner.
  3. 3Wander Cubero Hurtado, in his capacity as Jefe de la Oficina Cantonal de Liberia del ICAA, reports under oath (filing submitted at 17:36 on 08 de setiembre de 2025) as follows:

“FIRST. In connection with the amparo proceeding previously filed by Ms. Nombre91168, processed under case No. 16-002436-0007-CO, the Sala Constitucional issued decision No. 2016-006368, in which it ordered:

‘… The proceeding is granted solely against the Ministerio de Salud. Accordingly, Dr. Mario Enrique Calvo González, Director del Área de Salud de Liberia, is ordered to arrange the necessary measures and adopt the appropriate measures to eliminate the health problem existing along the boundary between Dirección5864, the Río Liberia, and Residencial El Río, within a period of two months from service of the judgment…

Likewise, the following is taken from report GSP-RCH-CL-2025-0729: ‘… For its part, the Chamber rejected the claim against AyA because it was established that the Residencial’s Wastewater Pumping Station (Estación de Bombeo de Aguas Residuales, EBAR) had not been formally accepted by this institution, a position reiterated in official letter GSP-RCH-CL-2016-00558 (4 de abril de 2016) and official letter GSP-RCH-CL-2016-01266 (12 de julio de 2016).’ The situation described remains unchanged to date, in that, pursuant to the regulations currently in force (Reglamento para la aprobación y recepción de sistemas de saneamiento por parte del Instituto Costarricense de Acueductos y Alcantarillados, Acuerdo de Junta Directiva No. 2022-0354), AyA has not accepted the works—specifically, in this case, the pumping station—a circumstance that legally prevents it from intervening in and investing resources in that system because it is privately owned, leaving it under the oversight and responsibility of the Ministerio de Salud.

In this case, AyA’s jurisdiction is limited to maintaining the manhole covers, repairing leaks in its sanitary-sewer collector (colector del alcantarillado sanitario), and filing complaints concerning possible unlawful connections to that system, which exacerbate the problem affecting the residents and, in turn, overload the public wastewater treatment system (sistema público de tratamiento de aguas residuales).

SECOND. This is not an act attributable to the institution I represent; however, it is clear that, once a health order has been issued, the Ministerio de Salud itself, acting through the Área Rectora, is responsible for monitoring and verifying compliance until the developer effectively implements it in this case.

THIRD. This is not an act attributable to the institution I represent.

FOURTH. This is not an act attributable to the institution I represent.

FIFTH. This is not an act attributable to the institution I represent.

SIXTH. This is not an act attributable to the institution I represent.

SEVENTH. As stated by the protected party, the fecal material accumulated in the pit at Residencial El Río is removed in a makeshift and wholly irregular manner. A person—whose identity is unknown and who acts without oversight or apparent official authorization—uses an external manual pump to transfer sewage from the pit to the public sanitary sewer.

Report UEN-GA-2024-02063 and the Informe de atención a solicitud de intervención situación desborde de aguas residuales EBAR Residencial y Condominio del Río, Liberia corroborate the account. During the field inspections conducted on 11 y 12 de septiembre de 2024, the existence of a makeshift pumping system (sistema de bombeo artesanal) was verified; it was used intermittently to transfer sewage from the Residencial’s tank to AyA’s public collector, a situation clearly not authorized by the institutional authorities.

It is reiterated that memorandum SG-GSP-RT-2024-00143 dated 18 de septiembre de 2024 confirms that these irregular practices compromise the operation of AyA’s public sewer system, causing overloads and risks of overflow, but that their root cause is the improper management of the abandoned private system.

This fact reinforces that, although AyA infrastructure—the sanitary sewer—is involved, the improper handling is carried out by unauthorized private parties.

EIGHTH. A situation caused by a third party is adversely affecting the operation of the public sanitary-sewer system administered by the institution. Reglamento de vertido y reuso de aguas residuales No. 33601-MINAE-S establishes the parameters under which treated water may be discharged into a sanitary-sewer system or into a receiving water body (cuerpo receptor); however, because a private party is carrying this out irregularly, compliance with those regulations is compromised, and wastewater overloads and overflow risks arise, further complicating the situation. The institution is concerned that the Ministerio de Salud has on several occasions sought to transfer responsibility for compliance with its acts to AyA by issuing health orders, instead of acting within its jurisdiction. Despite being aware of the legal impediments that the institution faces in intervening under such conditions, it persists in using that mechanism rather than acting in the manner stated by that same Chamber when it advised the Ministerio as follows: ‘(…) acted promptly, issued the health orders, and even filed criminal complaints; nevertheless, the fact remains that the health problem persists, as its representative indicates in the report submitted under oath.

The Chamber does not find that the Ministerio adopted extraordinary measures, such as closing the premises, obtaining the assistance of the law-enforcement authorities to secure the premises, or even potentially evacuating the Residencial, or any other effective measures. The provision of a public service such as the one entrusted to the Ministerio de Salud requires a degree of efficiency perhaps exceeding that required of other public bodies, because of the fundamental rights to health and a healthy environment, insofar as its jurisdiction is concerned. The Chamber considers that the actions taken by the Ministerio de Salud have been insufficient and violate the protected party’s fundamental rights to health and a healthy environment; accordingly, the proceeding against it must be granted, and it must be ordered to arrange the necessary measures, including radical measures, and adopt the appropriate decisions to eliminate the health problem existing along the boundary between Condominio Camino de Luna, the río Liberia, and Residencial El Río, within a period of two months from service of this judgment.’ (Emphasis added) For its part, Report UEN-GA-2024-02063 documented that, because of the makeshift pumping and the saturation of the Residencial’s pit, wastewater was being transferred to AYA’s collector, which may cause temporary overloads and overflows during the rainy season; this is consistent with the petitioner’s perception.

Nevertheless, it must be emphasized that any overflows occurring in the public network have as their root cause the irregular entry of wastewater from an abandoned private system, which exceeds the design specifications and capacity of the institution’s infrastructure. In the past, AYA has addressed specific issues affecting its collector—replacement of covers and repair of leaks, pursuant to official letter GSP-RCH-CL-2016-01266—but it cannot assume the extraordinary burdens arising from systems it has not accepted.

ON THE MERITS OF THE MATTER As a starting point, consideration must be given to the opinion issued by the Procuraduría General de la República in opinion C-257-2003 San José, 27 de agosto de 2003 (consistent with the substantive assessment conducted by the Sala Constitucional in Expediente 16-002436-0007-CO resolución 2016-006368) concerning the requirement that AyA and the Ministerio de Salud verify the technical suitability of sewage treatment plants (plantas de tratamiento de aguas negras). For the transfer to be authorized, the requirements established by the Instituto must be met so that the transfer of the corresponding portion of the public-use area (área de uso público) where the plant is located may be authorized, allowing the Instituto to administer and operate it. In this regard, the aforementioned Opinion states: “…The Instituto Costarricense de Acueductos y Alcantarillados is the entity that determines, based on the provisions of the transcribed rule, when housing developments (urbanizaciones) must have sewage treatment plants.

In this matter, municipalities are responsible for ensuring that housing development projects to be carried out in their canton comply with the standards specified by AyA concerning water-supply systems and sewers, including the provision of sewage treatment plants when AyA has so ordered. Once the works have been constructed and at the time of their acceptance, municipalities exercise oversight regarding compliance with the applicable regulatory provisions, including those concerning the drinking-water facilities and sewage collection and disposal facilities required by the Instituto Costarricense de Acueductos y Alcantarillados and other competent public entities, all in accordance with Article VI.6. of the Reglamento para el Control Nacional de Fraccionamientos y Urbanizaciones, which provides: “VI.6. Acceptance of works: Acceptance of the works and public areas shall be carried out in accordance with the regulatory provisions in force in the municipality of the canton and the other public agencies that exercise oversight functions in this regard.

No omission of details from the approved plans shall release the developer or the responsible professional from their obligations regarding the complete and satisfactory delivery of the works, pursuant to the provisions of these regulations. The developer and the responsible professional who sign the application for approval (visado) of the construction plans guarantee that the works strictly conform to the applicable regulatory requirements, as provided in the applicable laws.” In other words, although municipalities neither operate nor maintain sewage collection and disposal systems, they oversee compliance by housing developments, and by the buildings constructed within them, with the provisions established by the Instituto Costarricense de Acueductos y Alcantarillados and other competent public entities concerning those systems, thereby fulfilling their role of safeguarding health and the environment in their canton (…) (…) although section 40 of the Ley de Planificación Urbana states that municipalities may authorize the aforementioned transfer, the fact remains that, unless they are exercising the residual authority (competencia residual) discussed above and, consequently, directly administering and operating the respective drinking-water and sewage collection and disposal system, they are required to authorize that conveyance (cesión) in favor of the competent entity, which, as we have already stated and shall conclude below, is the Instituto Costarricense de Acueductos y Alcantarillados, so that it may administer and operate the system once it has been verified, when the builder—whether a public-law or private-law entity—delivers the works, that the technical provisions set forth in the regulations and issued by AyA itself and the Ministerio de Salud have been satisfied, as already explained.

That is, once AyA and the Ministerio de Salud have verified the technical suitability of the sewage treatment plants, the municipality must accept the works and authorize the transfer of the corresponding portion of the public-use area where the plant is located to the Instituto Costarricense de Acueductos y Alcantarillados, pursuant to the aforementioned rules that confer upon that Instituto authority to administer and operate drinking-water and sewage and wastewater collection and disposal systems, unless the municipality concerned will operate and administer it in exercise of the residual authority already referenced….” It must be taken into consideration that this Sala Constitucional previously determined, in (Exp: 11-010057-0007-CO Res. Nº 2012017743 a las nueve horas treinta minutos del catorce de diciembre de dos mil doce), that the Instituto assumes responsibility once the acceptance requirements (requisitos de recepción) have been verified and that, until those requirements are met, the Municipalidad—and, in this case, the Registered Owner–Project Developer—must continue to bear responsibility for correcting the outstanding operational deficiencies so that it may become feasible for the Instituto to assume administration: “…Among the preliminary requirements that the Municipalidad must observe are the provisions of Article 21 of the Ley Constitutiva del Instituto de Acueductos y Alcantarillados, Ley 2726 del 14 de abril de 1971, which grants ICAA authority to approve “Any project for the construction, expansion, or modification of public or private drinking-water supply and sewage and stormwater disposal systems (…) Such prior approval shall be mandatory in all cases involving the construction of subdivisions (fraccionamientos), housing developments, or lot divisions (lotificaciones) anywhere in the country, and no other state agency shall grant construction permits or approvals without such approval from the Instituto.

A violation of this mandate shall render null and void any construction permit granted in contravention of this prohibition (…)”; therefore, no public entity, including municipalities, may grant construction permits unless ICAA has first accepted to its satisfaction the water-supply and sanitary-sewer infrastructure works, in accordance with the approved plans and after compliance with all technical specifications required of developers by ICAA under the legislation and regulations in force…despite the fact that ICAA has not accepted the treatment-plant works to its satisfaction and the developer has not even complied with all the technical specifications identified in various memoranda by ICAA’s internal bodies as a prerequisite for approval of the project plans; this can only be explained by the failure of other institutions, including INVU and the Municipalidad, to comply with or observe the existing legal regulations.

Likewise, the fact that, although the Project is located in an environmentally sensitive area and INVU indicated from the outset that a sanitary-sewer system was necessary, permits were granted for the construction of homes with individual septic tanks and drainage systems, thereby placing groundwater at risk, can only be explained by the Municipalidad’s failure to comply with the legal and technical regulations in force. Consequently, the Sala grants the petition for constitutional relief (recurso de amparo) against the Municipalidad de San Isidro and orders as follows: Suspend the issuance of construction permits in the Proyectos Lomas Verdes del Zurquí y Lomas del Zurquí until ICAA has accepted to its satisfaction from the developer the water-supply and sanitary-sewer works…” Likewise, in the decision issued in Exp: 24-021588-0007-CO Res. Nº 2025002002, it was stated: “Against this backdrop, the alleged inaction of the municipal authorities is deemed established because, although they determined the actions they needed to undertake, the fact remains that the reported situation currently persists, in that they have neither taken the corresponding steps to resolve the treatment-plant problem nor arranged its transfer to the Instituto Costarricense de Acueductos y Alcantarillados—which they claim should be responsible for maintaining it.

This is despite their having known of the problem in question since 2023, with no evidence that any other measure has been taken, that any definitive solution to the problem reported by the petitioner has been found, or that a date has been set for resolving the problem. Under these circumstances, we are faced with a serious public-health problem that affects the environment and the health of the community’s residents, and it is established that the Municipalidad… has shown itself incapable of enforcing the applicable laws and fulfilling its obligation to guarantee the area’s residents the enjoyment of a healthy and ecologically balanced environment, with the resulting consequences for their health owing to the nature of the public-health problem afflicting them. In settled case law, the Sala has held that it is unacceptable for human beings to be denied the right to a healthy environment and the right to health because the corresponding public authorities are incapable of effectively exercising the oversight powers and problem-solving authority conferred upon them by law.

The persistence of the problem demonstrates that the few actions taken have clearly been insufficient. In light of the foregoing, the appropriate course is to grant the petition so that the authorities of the Municipalidad … issue the orders and undertake the corresponding actions within the scope of their authority in order to definitively resolve the problem reported by the petitioner and verified by the health authorities brought into the constitutional-relief proceedings. Although the treatment plant was placed into operation on 20 de diciembre del 2024, the fact remains that this was done by the community’s residents; this does not mean that the municipal authorities are relieved of the duty to take the corresponding steps to ensure that the situation described in these proceedings is definitively remedied, since they state that they must arrange for the treatment plant to be administered by the Instituto Costarricense de Acueductos y Alcantarillados.

VI.- Moreover, it should be noted that no act or omission is apparent on the part of the health authorities, which, being fully aware of the problem affecting the sector’s residents, have undertaken to follow up on the case, verify its existence, and issue the corresponding health order (orden sanitaria). The same applies to the Instituto Costarricense de Acueductos y Alcantarillados, since it cannot be inferred that it is responsible for maintaining the wastewater treatment plant (planta de tratamiento de aguas residuales). Accordingly, the petition must be denied as to those authorities…” Finally, it must be reiterated that, under the principle of legality (principio de legalidad), the actions in this case are governed by the provisions of the Reglamento de aprobación y recepción de sistemas de saneamiento por parte del Instituto Costarricense de Acueductos y Alcantarillados, which provides:

Article 22. Pumping Stations (Estaciones de Bombeo). The Instituto may assume the administration, operation, and maintenance of sanitary sewerage (alcantarillado sanitario) and ordinary-type wastewater pumping stations (estaciones de bombeo de aguas residuales), serving residential developments (urbanizaciones) and any type of residential construction development within the scope of application of these regulations. The foregoing shall be subject to prior compliance with the following requirements…” (emphasis added). Given that, in the case at issue, the developer has not, to date, complied with the regulatory requirements for AyA to accept and interconnect the Pumping Station to the public system it operates, the station, pursuant to Articles 285 through 292 of the Ley General de Salud, remains under the oversight and supervision of the Ministerio de Salud. LEGAL GROUNDS (FUNDAMENTOS DE DERECHO) We base our response on Articles 27 and 30 of the Constitución Política; Articles 32, 43 et seq. and related provisions of the Ley de la Jurisdicción Constitucional; Articles 113 et seq. and related provisions of the Ley General de la Administración Pública; and Articles 1 and 2 of the Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados N° 2726.

RELIEF REQUESTED (PETITORIA) Based on the factual and legal grounds stated above, I hereby submit the requested report. It is expressly noted, for consideration by this Honorable Sala Constitucional, not only that AyA has acted in fulfillment of its purposes, but also that it has in no way disobeyed or violated constitutional provisions, guarantees, or principles; rather, it has acted responsibly and with respect for the right to sanitation (derecho al saneamiento). I therefore request that this application for amparo relief (recurso de amparo) be dismissed in its entirety.

The persistence of the problem demonstrates the need for coordinated action among the Ministerio de Salud, the Municipalidad de Liberia, and the owners of Residencial El Río to establish a permanent solution. AyA has fulfilled its obligation to provide the required technical information and reports, but a substantive solution exceeds its authority.”

  1. 4According to a certification dated 13 de octubre de 2025, the Director del Área Rectora de Salud de Liberia del Ministerio de Salud did not submit the report requested of him in the order issued at 21:00 hours on 29 de agosto de 2025.
  2. 5By an order issued at 11:19 hours on 20 de octubre de 2025, the Reporting Justice (Magistrada Instructora) expanded the application to include the Ministra de Salud and the Alcalde de Liberia.
  3. 6Mariela de los Ángeles Marín Mena, in her capacity as Acting Ministra de Salud, reports under oath (filing submitted at 18:32 hours on 22 de octubre de 2025) as follows:

“STATUTORY REPORT (INFORME DE LEY) In accordance with the foregoing, this statutory report is submitted on the basis of Oficio N°MS-DRRSCH-DARSL-ER-IT-0315-2025, dated 21 de octubre de 2025, which states, in summary:

“…Regarding the matters alleged by the applicants (recurrentes) in this case, I hereby provide the following chronology of the actions taken:

First: On 23 de abril de 2015, complaint N°213-2015 was filed with the Unidad de Atención al Cliente de la Dirección de Área Rectora de Salud de Liberia, at folios N°0001 through 0008.

Second: On 13 de mayo de 2015, Lica Laura Rodríguez Corrales and Bach Armando Mendoza García, of the Equipo de Regulación del Área Rectora de Salud de Liberia, conducted a sanitary inspection (inspección sanitaria) of the wastewater storage tank (tanque de almacenamiento de aguas residuales) at residencial el Rio, at folios N°0015 through 0016.

Third: On 16 de junio de 2015, health order (orden sanitaria) N°161-2015 was served on Mr. Nombre91169, Administrator of residencial el Rio. On 19 de mayo, health order N°165-2015 was served on Mr. Edgar Chacón Villalobos, cantonal head of the Instituto Costarricense de Acueductos y Alcantarillados, at folios N°0013 through 0016.

Fourth: On 18 de mayo de 2015, Ms. Nombre91168 was informed about the sanitary inspection conducted at the wastewater storage tank at residencial el Rio, at folio N°0017.

Fifth: On 03 de julio de 2015, a follow-up sanitary inspection was conducted at the wastewater storage tank at residencial el Rio to verify compliance with health orders N°161-2015 and No. 165-2015. Report N°CH-ARS-L-ERS-629-2015 was prepared, at folios 0021 through 0023.

Sixth: On 14 de julio de 2015, complaint N°07-2015 was filed with the Tribunales de Justicia de Liberia against Nombre91169, Administrator of Residencial el Rio, and complaint N°08-2015 was filed against Mr. Edgar Chacón Villalobos, cantonal head of the Instituto Costarricense de Acueductos y Alcantarillados, both for disobeying the health authority, at folios 0024 through 0029.

Seventh: On 26 de febrero de 2016, Ms. Nombre91168 filed an application for amparo relief against the Área Rectora de Salud de Liberia with the Unidad de Atención al Cliente, expediente N°16-002436-0007-CO. Licda. Laura Rodríguez Corrales prepared report N°CH-ARS-L-ERS-0144-2016 in response to the application, at folios N°0042 through 0058.

Eighth: On 4 de abril de 2016, the Dirección del Área Rectoras de Salud de Liberia responded to request for intervention N°210606-2016-SI-PFA from the Defensoría de los Habitantes, at folios 0063 through 0071.

Ninth: On 18 de mayo de 2016, by fax at Telf7200, resolution 2016006368 in expediente N°16-002436-0007-CO was served on the parties, at folios 0081 through 0096.

Tenth: On 18 de mayo de 2016, pursuant to resolution N°2016006368 in expediente N°16- 002436-0007-CO, Licda. Laura Rodríguez Corrales conducted a sanitary inspection of the wastewater storage tank, resulting in report N°CH-ARS-L-ERS-465- 2016, which concluded that the pumping system did not ensure the efficient and effective final disposal of sewage (aguas negras) from residencial el Rio. Health orders N°192 and 197-2016 were then issued to Mr. Nombre91169, Legal Representative of Ganadera la Lilas S.A., Corporate Identification Number (Cedula jurídica) CED51387, according to certifications from the Registro nacional, at folios 0109 through 0128.

Eleventh: On 4 de julio de 2016, a follow-up inspection was conducted regarding orders N°192 and 197-2016 served on Mr. Nombre91169, Legal Representative of Ganadera la Lilas S.A., Cedula jurídica CED51387. It was concluded that a complaint should be filed with the Ministerio Publico for disobeying the health authority, at folios 0146 through 0156.

Twelfth: On 25 de julio de 2016, Doctor Mario Calvo González sent resolution N°2016006368 concerning the application for amparo relief arising from the wastewater-system problem at residencial el Rio by email, requesting that Comisionado Daniel Calderón Rodríguez, Director Regional de la Fuerza Pública de Guanacaste, provide support in the event that the residential development had to be evacuated. Folios 160-161 and 162.

Thirteenth: On 15 and 18 de julio de 2016, the Equipo de Regulación el Área Rectora de Salud de Liberia conducted follow-up inspections of the wastewater storage tank, concluding that, at the time of the visit, its pumping system was operational and the wastewater from residencial el Rio was being conveyed to the sanitary sewerage system administered by the Instituto Costarricense de Acueductos y alcantarilladlos de Liberia. Folios 0163 through 0171.

Fourteenth: On 2 de junio de 2017, the Equipo de Regulación del Área Rectora de Salud de Liberia conducted a follow-up sanitary inspection of the wastewater storage tank at residencial el Rio to verify the installation of an alternative pumping system. At the time of the visit, two automated pumps operating continuously were observed. Folio 232.

Fifteenth: On 22 de junio de 2017 at fourteen hours and forty minutes, notice of the request for a final dismissal (sobreseimiento definitivo) was ordered. Expediente 16-001250-0396-PE, against Nombre91169 AND Nombre91169. Folio 0235.

Sixteenth: On 11 de noviembre de 2022, complaint N°354-2022 was filed with the Unidad de Atención al Cliente de la Dirección de Área Rectora de Salud de Liberia against Nombre91169, Administrator of residencial el Rio, and AyA, concerning the collapsed wastewater storage tank, which was causing environmental contamination and harm to public health. AyA’s wastewater sewerage network in Liberia runs next to the storage tank, and its septic tanks (cajas sépticas) overflow during the rainy season. Folios 0001 through 0004.

Seventeenth: On 25 de noviembre de 2022, a sanitary inspection was conducted. I was received by Mr. Nombre91169, who allowed access to his property, where the wastewater storage tank of residencial el Rio is located. I must state that Ay A’s sewerage network crosses the same property; the right-of-way easement (servidumbre de paso) lies solely above the old and new networks. It was observed that the storage tank had overflowed and that the pumping system was not operating, thereby contaminating the environment and endangering public health. It was concluded that a health order should be served. Folio 0006.

Eighteenth: On 19 de diciembre de 2022, health orders MS-DRRSCHDARSL-ER-OS-0205 AND 0214-2022 were issued for service on Mr. Johnny Rafael Leiva Badilla and Nombre91169, representatives of Ganadera Las Lilas S.A. As of 23 de diciembre de 2022, it had not been possible to locate the representatives at their residences. Folios 0006 through 0013.

Nineteenth: On 10 de marzo de 2023, the application for amparo relief filed by Nombre91168 against the Ministerio de Salud, expediente N°23-004850-0007-CO, was submitted to the Unidad de Atención al Cliente de la Dirección de Área Rectora de Salud de Liberia, at folios 0014 through 0016.

Twentieth: On 10 de marzo de 2023, Mr. Nombre91169’s residence was visited in order to serve the health order. Ms. Nombre91170 (wife) responded, stated that it did not concern her, and left. Folio 0017.

Twenty-first: On 13 de marzo de 2023, Lic. Armando Mendoza García of the Equipo de Regulación del Área Rectora de Salud de Liberia prepared the report in expediente No. MS-DRRSCH-DARSL-ER-IT-075-2023 for resolution of the application. Folio 0018. Twenty-second: On 13 de marzo de 2023, the application was transferred from the Dirección de Área Rectora de Salud de Liberia to the Dirección Regional. Folio 0019.

Twenty-third: On 14 de marzo de 2023, Licda. Lena Rodríguez Aguirre, Attorney for the Dirección Regional, through oficio DR-CH-PSJ-L-039-2023, returned the original expediente concerning the application for amparo relief, Exp 23-004850-0007-CO, filed by Nombre91168, in response to oficio MS-DRRSCH-DARSL-0152-2023 signed by Dr. Luis Enrique Mayorga Diaz. Folios 0020 through 0025.

Twenty-fourth: On 14 de marzo de 2023, Dr. Enrique Jiménez Aragón, Jefe de Servicios de Salud de Dirección Regional de Rectoría de Salud Chorotega, returned to Dr. Luis Enrique Mayorga Diaz the expediente concerning the application for amparo relief filed by Ms. Nombre91168. Folio 0026.

Twenty-fifth: On 14 de marzo and 15 de marzo de 2023, the response to the application for amparo relief filed by Ms. Nombre91168, Exp. No. 23-004850-0007-CO, together with certified copies of DR-CH-PSJ-L-038-2023 from Dr. Luis Enrique Mayorga Diaz, was sent to Informes-SC (authorized to receive reports for the Sala Constitucional) ...106 Folios 0027 through 0033.

Twenty-sixth: On 15 de marzo de 2023, steps were taken to effect administrative service (notificación administrativa) of DRRSCH-DARSL-ER-IT-0348-2022. DRRSCH-DARSL-ER-OS-0214-2022. DRRSCH-DARSLER-OS-0204-2022. DRRSCH-DARSL-ER-OS-0205-2022 on Ganadera Las Lilas S.A. and its legal representatives, Nombre91169 and Johnny Rafael Leiva Badilla, at the address 50 m south of antiguo bar México or next to hotel Wilson N°3. Bo. Condega. Liberia. Guanacaste. Folios 0034 and 0035.

Twenty-seventh: On Tuesday, March 28, 2023, via email, Constitutional Chamber ruling granting relief at the regional level: notification system (case file N°23-004850-0007-CO) was received from Legal Affairs ...2613 for the Directorate of the Liberia Health Governing Area. Folios 0036 to 0045.

Twenty-eighth: On March 28, 2023, the Directorate of the Liberia Health Governing Area requested a joint visit with the Water Directorate from Eng. Leonardo Solano Romero, Coordinator, Tempisque–North Pacific Hydrological Unit. Folio 0046.

Twenty-ninth: On March 31, 2023, the Directorate of the Liberia Health Governing Area requested police assistance to serve a health order on representatives of Ganadera Las Lilas S.A. Folios from Telf7201 to 0054.

Thirtieth: On April 12, 2023, Mr. Anell González Rojas of Correos de Costa Rica delivered the latest notices processed. Folios 0055 to 0062.

Thirty-first: On April 12, 2023, in follow-up to decision N°2023007051, Exp 23-004850-0007-CO, amparo proceeding filed by Ms. Nombre91168, official letter MS-DRRSCH-DARSL-198-2023 was sent by email to Constitutional Chamber reports ...106. Folios 0064-0065 and 0066.

Thirty-second: On April 13, 2023, in follow-up to decision N°2023007051, Exp 23-004850-0007-CO, amparo proceeding filed by Ms. Nombre91168, official letter MS-DRRSCH-DARSL-203-2023 was sent by email to Mr. Paul Rueda L., Justice-Rapporteur, Constitutional Chamber, Supreme Court of Justice, San José. Folios 0067 and 0068.

Thirty-third: On April 13, 2023, health order No. DRRSCH-DARS-ER-OS-0204-2022 was served on Nombre91169, one of the legal representatives of Ganadera Las Lilas S.A. Folio 0069.

Thirty-fourth: On April 18, 2023, Mr. Nombre91169 submitted a response to health order N°DRRSCH-DARSL-ER-OS-0204-2022 to the Customer Service Unit of the Liberia Health Governing Area, stating that the wastewater-pumping system of the El Río residential development had been restored and requesting an inspection. Folio 0070.

Thirty-fifth: On April 20, 2023, a health inspection was conducted at the wastewater storage and treatment tank of the El Río residential development, with the following findings:

  1. 1The area surrounding the wastewater storage tank was cleaned.
  2. 2The electrical system was installed (meter, meter box, security box, conduit fitting, and reconnected cables).
  3. 3The grinder pump was cleaned and serviced.
  4. 4The pump was put into operation to convey the wastewater to AyA’s sanitary sewer system and for subsequent treatment at the wastewater treatment plant. Folios 0071, 0072 and 0073

Thirty-sixth: The Directorate of the Liberia Health Governing Area sent notice of compliance with decision 2023007051, Exp: 23-004850-0007-CO, by email through official letter No. MSDRRSCH-DARSL-221-2023 from Dr. Luis Enrique Mayorga Diaz, Director of the Liberia Health Governing Area, to Mr. Paul Rueda L., Justice-Rapporteur, Constitutional Chamber, Supreme Court of Justice, San José. Folios 0074-0075 and 0076.

Without further matter, respectfully yours. Lic. Armando Mendoza García. Regulatory Team: Liberia Health Governing Area…”.

CONCLUSION:

In accordance with the foregoing, the Ministry of Health, through the Liberia Health Governing Area and the Chorotega Regional Directorate for Health Governance, has duly followed up on, supervised, and monitored this proceeding from its inception, as evidenced since 2015. The relevant legally required reports have been submitted to this Honorable Constitutional Chamber, as have the corresponding criminal complaints before the appropriate judicial authorities, all for the purpose of responding promptly to the complaints filed and preventing harm to the health of the residents of the El Río Residential Development and to any natural resource that might be affected. The Ministry of Health has not turned a blind eye to this problem; over time, it has demonstrated compliance with the orders issued and, when circumstances changed, this Ministry acted promptly to safeguard public health by issuing new health orders.

The allegations made by the protected party that the Ministry of Health has been negligent and has abandoned the existing problem do not reflect the actual truth, since we have responded whenever our oversight has been required in connection with any complaint and have duly followed up on the orders issued, pursuing the parties involved in this problem even through judicial proceedings, as has been shown.

We ask this Honorable Constitutional Chamber to consider the communications provided and referenced over time in this Constitutional Report, namely N°CH-ARS-L-ERS-0144-2016, N°CH-ARS-L-ERS-465-2016, DR-CH-PSJ-L-038-2023, MSDRRSCH-DARSL-198-2023, MS-DRRSCH-DARSL-203-2023, and N°MS-DRRSCH-DARSL-221- 2023, and to deem substantiated the efforts made by the Ministry of Health before the Public Force, the Municipality of Liberia, and the persons implicated in the complaints filed, without neglecting our constitutional mission and mandate to safeguard health. Furthermore, as has been demonstrated over time, this Ministry will immediately address any complaint filed in this area, since, as has been shown, the condition of the wastewater storage tank of the El Río Residential Development may change due to vandalism, maintenance, or natural wear and tear RELIEF REQUESTED:

By virtue of the foregoing, the Honorable Constitutional Chamber is respectfully requested to DENY the present amparo proceeding, since the information provided clearly shows that we at the Ministry of Health have made and continue to make every effort necessary to satisfy all legal requirements, providing assistance and follow-up regarding the problem observed at the wastewater storage tank of the El Río Residential Development. We reiterate our respectful request that THE UNDERSIGNED, IN HER CAPACITY AS ACTING MINISTER OF HEALTH, AND THE MINISTRY OF HEALTH BE EXEMPTED FROM ALL LIABILITY.”

  1. 7José Javier Calvo Darcía, in his capacity as Mayor of Liberia, reports under oath (submission filed at 15:32 on October 27, 2025) as follows:

“FIRST: The Municipality of Liberia is an institution forming part of the Public Administration, whose objectives are embodied in its nature as a public entity serving the Municipality.

Given the legal nature of the MUNICIPALITY OF LIBERIA and the public function performed by the institution, it is governed by the body of administrative law, which requires it to direct its actions toward satisfying the public interest, subject to the principle of legality, which translates into acting efficiently and responsibly, in strict adherence to basic principles of justice, logic, and expediency (Articles 10, 11, and 16 subsection l. of the General Law of Public Administration).

It is of the utmost importance to clarify first to this Honorable Constitutional Chamber that the Municipality of Liberia has not violated the petitioner’s constitutional rights.

SECOND: Regarding the facts alleged by the petitioner, in summary: in 2015, she filed an amparo proceeding decided under number 16-002436-0007-CO, in which she reported the improper management of a sewage holding tank at the El Río Residential Development, located at Dirección5863. She states that, as a result, the Ministry of Health issued a health order to the owner of the tank, who installed submersible pumps to convey the fecal waste to the sanitary sewer; however, she asserts that the solution was partial and the problems frequently recurred. She indicates that since October 2022, the pumping system and tank have been completely abandoned, causing sewage to overflow directly into the Liberia River and adjoining lots, a situation that produces foul odors, noxious gases, an increase in insects and rodents, and further direct contamination of the river and the environment. She emphasizes that her home is the most affected because of its proximity, forcing the doors and windows to remain closed, which seriously affects the health, family life, and right to a dignified life of her family, consisting of her husband, an 18-year-old adolescent, a 10-year-old girl, and herself.

She adds that on November 11, 2022, she filed a formal complaint with the Ministry of Health in Liberia under number 354-2022; nevertheless, she complains that it has not been addressed to date, with the alleged reason being the inability to serve notice on the owner. She adds that in November 2023, she filed a new complaint regarding the same situation, which likewise was not resolved, evidencing repeated inaction by the health authorities. She states that the accumulated fecal matter is currently being removed from the tank in a makeshift and irregular manner by an unidentified person, apparently without official authorization, using an external manual pump to convey the waste to the public sewer. This procedure lasts approximately nine hours per day and entails opening the tank and sewer simultaneously, releasing nauseating odors and noxious gases and exposing the community to disease vectors and the risk of spills that ultimately enter the Liberia River.

She states that when the pump is not being used, the fecal matter overflows directly into the riverbed, and that this situation constitutes negligent management of highly contaminating waste in a residential complex comprising more than 250 homes and a hotel, without minimum safety, sanitation, or environmental-control conditions. She further states that, during the rainy season, the AyA sanitary sewer adjacent to the tank overflows, further aggravating the environmental contamination. In view of the alleged omission, she considers that her fundamental rights and those of the other inhabitants of the affected area have been violated; she therefore requests that the present proceeding be granted and that the relief warranted by law be ordered:

It should be clarified to this Honorable Chamber that the scope of action of the Public Administration, specifically regarding Municipalities, is governed by the Principle of Legality established in the Political Constitution and the General Law of Public Administration. In matters pertaining to Public Law, and specifically Administrative Law, the principle of legality represents one of the fundamental pillars upon which the Public Administration’s day-to-day work rests. It arose together with modern political institutions and with the development and expansion of Administrative Law as the body of law intended to regulate the Administration’s actions in the exercise of its administrative function. Affirmatively recognized in our legal system in Article 11 of the Political Constitution and in Articles 11, 12, 6, and 13 of the General Law of Public Administration, it is understood to mean that every act or conduct of the Public Administration must be regulated and permitted by the legal system, applying the longstanding maxim that the Administration may do only that which it is permitted to do. This is markedly different from the conduct of private persons, whose private activity is governed by the principle of freedom of will and who may perform acts or activities that are not prohibited.

With regard to municipalities, Article 169 of the Political Constitution establishes municipal powers by placing local interests and services under the responsibility of the local government, in conjunction with the Municipal Code, which sets forth municipal powers intended to promote the comprehensive development of the cantons and provides a very extensive list thereof. These include local public services, urban planning, administration of the maritime-terrestrial zone (zona marítimo terrestre), etc.

It should be clarified for this Honorable Chamber that, pursuant to Article 4 and the following and related provisions of the Municipal Code, the municipality possesses the political, administrative, and financial autonomy conferred upon it by the Political Constitution, within the scope of its powers. Therefore, in compliance with those provisions, this municipality cannot intervene in a matter that does not fall within the powers granted by the Municipal Code and the Political Constitution itself, because it is a matter under the jurisdiction of other state institutions, namely the Ministerio de Salud and Acueductos y Alcantarillados, and not this Municipalidad.

It should be clarified for this Honorable Authority that the appellant’s assertions concerning these facts are untrue, since no complaint has been received from the appellant. See official letter SGA-287-10-2025, dated 24 de octubre del 2025, attached as evidence and signed by Ing. Augusto Otárola Guerrero, Environmental Manager, Municipalidad de Liberia, which states as follows:

“With regard to this case, I hereby state that the unit under my supervision has received no complaints concerning this situation involving alleged problems with the overflow of sewage and fecal solids from the residential development’s fecal-waste holding tank into the river and toward the Liberia River, as asserted by the complainant. Nevertheless, this environmental unit will inspect the site together with the Construction Control Unit in order to follow up on the case and, within the scope of this municipality’s authority, take action if necessary.” (Emphasis added).

This municipality considers the appellant’s assertions concerning these facts to be untrue, since the alleged fundamental rights have not been violated; therefore, the amparo proceeding (recurso de amparo) filed must be dismissed.

THIRD: A certified copy of the documentation related to this amparo proceeding is submitted. RELIEF REQUESTED.

I request that this amparo proceeding be dismissed and that the appellant be ordered to pay both categories of costs arising from this action.”

Justice Castillo Víquez drafts the opinion; and,

Whereas:

I.Subject matter of the proceeding. The appellant alleges that in 2015 she filed an amparo proceeding, processed under expediente No. 16-002436-0007-CO, reporting the improper management of a sewage holding tank at the El Río residential development, located at Dirección1499 de Liberia. She states that, as a result, the Ministerio de Salud issued a health order (orden sanitaria) to the owner of the holding tank, who installed submersible pumps to transfer the fecal waste to the sanitary sewer system. However, the solution was only partial, and the problems have frequently recurred. She indicates that since octubre de 2022, the pumping system and holding tank have been completely abandoned, causing sewage to overflow directly into the Liberia River and adjacent lots, a situation that generates foul odors, putrid gases, proliferation of insects and rodents, and further direct pollution of the river and the environment.

She emphasizes that her home is the most severely affected because of its proximity, forcing the family to keep doors and windows closed, which seriously affects the health, family life, and right to a dignified life of her family, consisting of her husband, an 18-year-old adolescent, a 10-year-old girl, and herself. She adds that on 11 de noviembre de 2022 she filed a complaint with the Ministerio de Salud de Liberia under No. 354-2022; nevertheless, it has not been addressed to date, allegedly because it has been impossible to serve notice upon the owner. She adds that in noviembre de 2023 she filed a new complaint concerning the same situation, which was likewise not resolved. Currently, the fecal material accumulated in the holding tank is removed in a makeshift and irregular manner by an unidentified person, apparently without official authorization, using an external manual pump to transfer the waste to the public sewer system.

This process lasts approximately nine hours per day and requires the holding tank and sewer to be opened simultaneously, releasing nauseating odors and putrid gases and exposing the community to disease vectors and the risk of spills that ultimately enter the Liberia River. She states that when the pump is not in use, fecal material overflows directly into the riverbed, constituting negligent management of highly polluting waste in a residential complex comprising more than 250 homes and a hotel, without minimum safety, sanitation, or environmental-control measures. Moreover, during the rainy season, the ICAA sanitary sewer system adjacent to the holding tank overflows, further aggravating the environmental pollution.

II.Proven facts. The following facts are deemed duly established and relevant to the determination of this matter, either because they have been substantiated or because the respondent authorities failed to address them as ordered in the initial ruling:

  • 1)On 20 de abril de 2023, officials from the Ministerio de Salud conducted a health inspection of the wastewater storage and treatment tank at the El Río residential development, located at Dirección1499 de Liberia, with the following results: 1.- The area surrounding the wastewater storage tank was cleaned. 2.- The electrical system was installed (meter, meter housing, security box, conduit body, and cables, respectively). 3.- The grinder pump was cleaned and maintained. 4.- The pump was placed into operation to discharge the wastewater into the ICAA sanitary sewer network for subsequent treatment at the wastewater treatment plant (planta de tratamiento de aguas residuales, PTAR) (see the respondent minister’s report and the documentary evidence submitted).
  • 2)On 11 y 12 de septiembre de 2024, ICAA officials conducted field inspections and confirmed the existence of a makeshift pumping system, used intermittently, that transferred sewage from the El Río residential development’s tank to the ICAA public collector sewer. This situation had not been authorized by the institutional authorities and compromised the operation of the public sewer system by causing overloads and risks of overflow (see the report of the Head of the ICAA Oficina Cantonal de Liberia and the documentary evidence submitted).
  • 3)The sewage storage tank at the El Río residential development is currently overflowing directly into the Liberia River and adjacent lots, generating foul odors, putrid gases, and a proliferation of insects and rodents (see the petition initiating the proceeding and the photographic evidence submitted).
  • 4)The fecal material accumulated in the storage tank is removed in a makeshift manner using an external manual pump to transfer the waste to the public sewer system, causing nauseating odors and putrid gases (see the petition initiating the proceeding and the photographic evidence submitted).
  • 5)The wastewater pumping station at the El Río residential development has not been formally accepted by the ICAA; consequently, its operation remains under the supervision and responsibility of the Ministerio de Salud (see the report of the Head of the ICAA Oficina Cantonal de Liberia).

III.The right to a healthy and ecologically balanced environment. It must first be noted that the fundamental rights to health and to a healthy and ecologically balanced environment are constitutionally recognized (Articles 21, 50, 73, and 89 of the Political Constitution), as well as recognized through the international legal provisions applicable in Costa Rica. In this regard, in judgment No. 2006-005928 issued at 15:00 on 2 de mayo del 2006, this Court ruled: “The right to life recognized in Article 21 of the Constitution is the cornerstone upon which the remaining fundamental rights of the inhabitants of the Republic rest. Likewise, the right to health is grounded in that provision of the Political Constitution, since life is inconceivable unless human beings are guaranteed the minimum conditions necessary for proper and harmonious psychological, physical, and environmental well-being. Public health and the right to a healthy and ecologically balanced environment are constitutionally recognized in Articles 21, 50, 73, and 89 of the Political Constitution.

Specifically, Article 50 of the Constitution expressly recognizes the right of all inhabitants of the country to enjoy a healthy and perfectly balanced environment. That right is a fundamental guarantee for the protection of life and public health. In support of the foregoing, this Court has relied upon the concept of ‘environmental quality’ as a measure of people’s quality of life, in conjunction with other elements such as health, food, work, and housing, recognizing that every person has the right to use the environment for personal development, but not without limitation, since there is also a duty to protect and preserve the environment for present and future generations—the principle of sustainable development (principio de desarrollo sostenible).” Furthermore, Article 50 of the Political Constitution gives rise to the State’s obligation to protect the environment. That provision states: “The State shall seek the greatest welfare of all inhabitants of the country by organizing and encouraging production and the most appropriate distribution of wealth.

Every person has the right to a healthy and ecologically balanced environment. Accordingly, every person has standing to report acts that infringe that right and to seek compensation for the harm caused. The State shall guarantee, defend, and preserve that right. The law shall establish the corresponding liabilities and penalties.” This confirms that the various public authorities have an unavoidable duty to preserve, defend, and guarantee every person’s fundamental right to health and to a healthy and ecologically balanced environment.

IV.On the coordination of public institutions in the comprehensive protection of the environment. The State—as a whole—is under an obligation to take the measures necessary to protect the environment, in order to prevent levels of pollution, deforestation, extinction of flora and fauna, and excessive or improper use of natural resources that endanger the health of the governed public. For purposes of this task, public institution means both the Central Administration—the Ministries, such as the Ministerio del Ambiente y Energía and the Ministerio de Salud—which, by reason of their subject matter, have broad involvement and responsibility with respect to the conservation and preservation of the environment; these institutions act, in most cases, through their specialized agencies in the field. Likewise, the municipalities bear significant responsibility for this task within their territorial jurisdiction.

Given the diversity of actors that may become involved, one might think that this shared responsibility would cause chaos in administrative management. Therefore, in order to avoid the simultaneous coexistence of spheres of authority of different origins and natures, duplication of national and local efforts, and confusion regarding rights and obligations among the various parties involved, it is necessary to establish a series of coordination arrangements among the various agencies of the Executive Branch and decentralized institutions, and between those institutions and the municipalities, so that they may perform the functions entrusted to them. This Chamber has previously addressed the principle of coordination between public agencies and municipalities in pursuing common purposes, stating in judgment No. 1999-005445 of 14:30 hours on July 14, 1999, that: “Coordination is the ordering of the relationships among these various independent activities, which takes account of their concurrence with respect to the same object or entity so as to make it useful to an overall public plan, without eliminating the mutual independence of the acting entities.

Because there is no hierarchical relationship among decentralized institutions, or between the State itself and the municipalities, particular conduct cannot be imposed upon them; hence the indispensable interinstitutional ‘concerted action’ arises, in the strict sense, whereby autonomous and independent centers of action reach agreement on that preventive and overall framework, in which each performs a role with a view to a mission entrusted to the others. Thus, relations between municipalities and other public entities may be conducted only on an equal footing, resulting in agreed forms of coordination and excluding any mandatory arrangement detrimental to their autonomy that would subject corporate entities to a coordination framework without or against their consent; this does, however, permit the necessary subordination of those entities to the State and in the interest of the State (through the State’s ‘administrative oversight’ (tutela administrativa), and specifically through its function of reviewing legality, with powers of general supervision over the entire sector.”

V.On the previous amparo proceedings (recursos de amparo) filed by the appellant. On two occasions, the appellant has come before this Chamber concerning the same issue for which she is once again bringing an action. That situation is the environmental pollution caused by the malfunctioning of the wastewater storage and treatment tank at Residencial El Río, located at Dirección1499 de Liberia, near which she resides.

The first amparo proceeding was processed under expediente No. 16-002436-0007-CO, and the record shows that she alleged:

“I-. SUBJECT MATTER OF THE PROCEEDING. This amparo was directed against a natural person, in his capacity as the person in charge of a residential development, for failure to comply with a sanitary order (orden sanitaria) issued by the Ministerio de Salud in Liberia concerning alleged deficiencies in the wastewater management system of a private residential development.” That matter was upheld solely against the Ministerio de Salud by a majority of the Chamber, through judgment No. 2016-006368 of 09:30 hours on May 13, 2016, based on the following considerations:

“IV. THE AMPARO AGAINST THE MINISTERIO DE SALUD. REGARDING THE FACTS: With respect to the Ministerio de Salud, the report submitted under oath by Dr. Mario Enrique Calvo González, Director del Área Rectora de Salud de Liberia, establishes, insofar as relevant, that:

1. the appellant filed a complaint with the Ministerio de Salud concerning foul odors, sewage problems, and contamination of water sources on April 23, 2015, against Residencial El Río (see copy of the administrative record); 2. at 3:15 hours on May 15, 2015, the regulatory team of that Área Rectora conducted an on-site inspection, at which Nombre91169, the person in charge of the reported residential development, was present; 3. the regulatory team of the Ministerio de Salud issued Technical Report No. CH-ARS-L-ERS-349-2015 of May 2015, based on the inspections conducted, identifying deficiencies in the wastewater management system and, in particular, in the residential development’s wastewater storage tank, including, among others, that the wastewater had formed dry septic sludge that saturated the system and, because it was exposed and uncovered, generated extremely unpleasant odors; sludge residue was found around the tank, showing that the volume of septic sludge had exceeded the storage capacity in previous weeks and caused an overflow, which the Ministry attributed to a lack of system maintenance; the protection surrounding the tank area was insufficient; there was excessive grass in the surrounding area; and the AyA sewer network located in the residential development had no cover, among other deficiencies.

4. the same report states that the person in charge of the residential development attributed the problem to the lack of security at the site because the pump that conveys the wastewater to the AyA oxidation pond had been stolen; 5. on April 23, 2015, the Ministerio de Salud in Liberia issued sanitary order number 161-2015 of May 18, 2015, ordering the person in charge of Residencial El Río to repair the storage and pumping system and install covers, protective fencing around the site, and other items within 12 business days; 6. also on April 23, 2015, the Ministry issued sanitary order 165-2015 to AyA, requiring it to correct deficiencies and submit a mitigation plan; 7. after the deadlines set forth in the aforementioned sanitary orders had expired, the Ministry conducted a follow-up inspection, found virtually the same conditions, and filed criminal complaints against the person in charge of the residential development and the cantonal head of AyA; 8. the respective judicial complaints bear numbers 07-2015 and 08-2015 and were filed on July 14, 2015, for the offense of disobedience, against the person in charge of Residencial del Río and AyA official Edgar Chacón Villalobos. 9. the environmental problem has worsened.

V. THE AMPARO AGAINST THE MINISTERIO DE SALUD. REGARDING THE MERITS

It follows from the foregoing facts that, although the Ministerio de Salud acted promptly, issued the sanitary orders, and even filed criminal complaints, the fact remains that the public-health problem persists, as its representative states in the report submitted under oath. The Chamber does not find that the Ministry adopted extraordinary measures, such as closing the site, obtaining the assistance of the Fuerza Pública to secure the site, or even potentially evacuating the residential development, or any other effective measures. The provision of a public service such as that entrusted to the Ministerio de Salud requires a degree of efficiency and diligence perhaps exceeding that required of other public bodies, because of the fundamental rights to health and to a healthy environment, insofar as its jurisdiction is concerned. The Chamber considers the actions taken by the Ministerio de Salud insufficient and finds that they violate the protected party’s fundamental rights to health and to a healthy environment. The proceeding against it must therefore be upheld, and it must be ordered to implement the necessary measures, including radical measures, and adopt the pertinent decisions to eliminate the public-health problem existing along the boundary between Condominio Camino de Luna, Río Liberia, and Residencial El Río, within two months of service of the judgment.-

VI. THE AMPARO AGAINST AYA

The amparo against Instituto Costarricense de Acueductos y Alcantarillados must be dismissed because the report submitted by the Encargado de la Oficina Cantonal de Liberia and the Director de la Región Chorotega establishes that they complied with the directives of the Ministerio de Salud, insofar as their jurisdiction relating to AyA infrastructure was concerned (covers and elimination of leaks), because the public-health problem is being caused by a wastewater management system that has not been accepted by the institution. It is evident that AyA neither caused the problem nor violated the protected party’s fundamental rights.” Accordingly, the following was ordered:

“Por tanto: The proceeding is upheld solely against the Ministerio de Salud. Consequently, Dr. Mario Enrique Calvo González, Director del Área Rectora de Salud de Liberia, is ordered to implement the necessary measures and adopt the pertinent decisions to eliminate the public-health problem existing along the boundary between Dirección5865, Río Liberia, and Residencial El Río, within two months of service of the judgment. He is hereby warned that disobedience of the orders of this Chamber is subject to criminal penalties pursuant to Article 71 of the Ley de la Jurisdicción Constitucional. The State is ordered to pay the damages and losses caused by the facts giving rise to this ruling, which shall be assessed during enforcement of the judgment in the administrative-law proceedings. The amparo is declared inadmissible insofar as it is directed against Nombre91171. Justice Hernández López dissents and summarily dismisses the proceeding. Justice Salazar Alvarado appends a note.” The second amparo proceeding was processed under expediente No. 23-004850-0007-CO. The appellant raised the following complaint:

“II.- SUBJECT MATTER OF THE PROCEEDING. The petitioner states that her residence is located in Guanacaste, Liberia, Dirección5866, Residencial Camino de Luna, house number 52. She indicates that it borders the río Liberia to the north, which in turn borders the sewage pit (fosa de aguas negras) receiving sewage from Residencial El Río, and that this sewage should, in theory, be conveyed through pipes carrying the material to the Liberia sewage treatment plant. Nevertheless, she alleges that five months ago, the already limited care and maintenance provided to the storage pit and to the pump used to grind and convey the fecal matter to the Liberia sanitary sewer system ceased. Consequently, the pump stopped working and the system as a whole was abandoned; therefore, fecal matter continually overflows, discharging directly into the río Liberia and neighboring lots. In addition, foul odors persist, gases are released, flies, mosquitoes, and rodents proliferate, and the río Liberia and the environment in general are directly polluted, with her home being the most affected due to its proximity.

She further states that, as a second problem, the fecal matter flowing through the sanitary sewer pipes overflowed; during the season of heavy rains, fecal matter escapes and causes severe environmental pollution. In view of the foregoing, she indicates that she filed a complaint with the Ministerio de Salud, which is being processed under No. 354-2022. However, she alleges that, as of the date this proceeding was filed, it had not been addressed. She requests the intervention of the Chamber.” Likewise, the proceeding was upheld against the Ministerio de Salud. This was established in judgment No. 2023-0097051 at 09:30 hours on 24 de marzo de 2023, on the following grounds:

“V.- MERITS. In the case at hand (sub lite), it has been established that on 11 de noviembre de 2022, the unified complaint form submitted to the Ministerio de Salud under complaint reference No. 354-2022 was received by the Customer Service Unit of the Área Rectora de Salud de Liberia, in which the petitioner complained of foul odors emanating from the sewage pit at Residencial El Río. In that context, she alleged that problems with the operation of the pumps had occurred on multiple occasions, consequently causing sewage to overflow. She also reported an overflow of the fecal matter flowing through the sanitary sewer pipes, stating that during the season of heavy rains, fecal matter escapes and causes severe environmental pollution. In view of the foregoing, it follows that on 25 de noviembre de 2022, Lic. Armando Mendoza García, accompanied by Ing. Miguel Chaves López, both officials of the Regulatory Team of the Área Rectora de Salud de Liberia, inspected the wastewater storage and treatment tank at Residencial El Río and determined the following: ‘The El Río wastewater storage and pumping tank system was not operating; the wastewater is overflowing onto the land, causing environmental pollution (…) The owner must resolve the problems with the storage tank system, pumping system, electrical system, grinder pumps, and screening, and must properly discharge the wastewater into the wastewater treatment system network.’ Consequently, the record shows that on 19 de diciembre de 2022 the respondent authority issued health orders (órdenes sanitarias) Nos.

MS-DRRSCHDARSL-ER-OS-0204-2022, MS-DRRSCH-DARSL-ER-OS-0205-2022 and, MSDRRSCH-DARSL-ER-OS-0214-2022, addressed to Nombre91169, Nombre91169, and Johnny Leiva Badilla, who appear as the legal representatives of Ganadera las Lilas S.A., ordering them, within 15 days, to ‘repair the wastewater storage and treatment system at Residencial El Río (electrical system, grinder pumps, screening) and properly discharge the wastewater into the Acueductos y alcantarillados wastewater network.’ However, according to the attached report, those orders could not be served due to the following circumstances: On 20 de diciembre de 2022, Lic. Armando Mendoza García, accompanied by Ing. Miguel Chaves López, visited Residencial El Río, at the office next to the Cuadras de Caballos, to serve health order No. MS-DRRSCH-DARSL-ER-OS-0204-2022 on Nombre91169. Nevertheless, no one was found there. On 21 de diciembre de 2022, Lic. Armando Mendoza García, accompanied by Ing. Miguel Chaves López, visited Residencial El Río, at the office next to the Cuadras de Caballos, to serve health order No. MSDRRSCH-DARSL-EROS-0204-2022.

However, no one was found there. That same day, a message was sent to Nombre91169 through email address ...1639, asking him to indicate whether service of the health order could be made through that electronic means; however, no response was received. On 22 and 23 de diciembre de 2022, officials from the respondent health area visited Residencial El Río, owned by Nombre91169, to serve health order No. MS-DRRSCHDARSL-ER-OS-0204- 2022, but no one was found there. On 10 de marzo de 2023, a visit was made to the residence of Nombre91169, next to Hotel Wilson No. 3, to serve health order No. MS-DRRSCH-DARSL-ER-OS-0205-2022. On that occasion, the officials were received by Nombre91172, the wife of Nombre91169, who was informed of the service; however, she told them that ‘this has nothing to do with her.’ In this case, although the respondent authority argues that it will serve the health orders by certified mail through Correos de Costa Rica, the fact remains that it has not succeeded in definitively resolving the problem described by the petitioner; this is because the excuse that it has been unable to serve the health orders is insufficient for this Chamber, considering that there is a serious and substantiated problem involving improperly managed wastewater that is overflowing and running across the land, thereby causing environmental pollution.

In this regard, it should be noted that the Ministerio de Salud has broad authority to act pursuant to the Ley General de Salud and the corresponding regulations, as the governing body responsible for health oversight and control, since it is clear that, under articles 39 and 286 of the Ley General de Salud, every owner and person responsible for movable and immovable property has a duty to prevent nuisances and harm to health, as well as sources of pollution or infection, and must carry out drainage works; in the event of refusal, the administration may even perform such works at the expense of the noncompliant party, while safeguarding due process (debido proceso) (see, to similar effect, judgment No. 2022010613 at 09:40 hours on 13 de mayo de 2022). Accordingly, the proceeding must be upheld, with the consequences to be stated in the operative part.” Accordingly, the following was ordered in the operative part:

“POR TANTO: The proceeding is upheld. Luis Enrique Mayorga Díaz, in his capacity as Chief Medical Officer of the Área Rectora de Salud de Liberia, or whoever serves in that position in his stead, is ordered to take the appropriate measures within the scope of his authority so that: 1) within FIFTEEN DAYS from service of this judgment, health orders Nos. MS-DRRSCH-DARSL-ER-OS-0204-2022, MS-DRRSCH-DARSL-ER-OS-0205- 2022 and, MS-DRRSCH-DARSL-ER-OS-0214-2022 are served on the appropriate persons; and 2) within FIFTEEN DAYS from service of those health orders, they are effectively complied with. The respondent authority is advised that, pursuant to article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in a constitutional protection proceeding (recurso de amparo) that must be complied with or enforced, and who fails to comply with or enforce it, shall be subject to imprisonment for three months to two years, or a fine of twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty. The State is ordered to pay the costs and the damages and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment before the administrative-law jurisdiction. Justice Salazar Alvarado adds a separate note. Let notice be given.”

VI.The specific case. In the case at hand, as indicated, the petitioner has filed a constitutional protection proceeding for the third time, alleging the same problem that has affected her for more than nine years, since she filed the first proceeding on 22 de febrero de 2016. The matter concerns the environmental pollution caused by the malfunctioning wastewater storage and treatment tank at residencial El Río, located in barrio El Capulín de Liberia, near which she resides.

  • 1)Responsibility of the Ministerio de Salud for the alleged facts.

It follows from the petitioner’s application that this tank is currently discharging overflowing sewage directly into the río Liberia and neighboring lots, causing foul odors, noxious gases, and the proliferation of insects and rodents. In addition, the fecal matter accumulated in the storage tank is extracted by precarious means, using an external manual pump to convey the waste to the public sewer system, thereby causing nauseating odors and noxious gases. This latter complaint is corroborated by the ICAA, as the Head of the Oficina Cantonal de Liberia reports that officials from that institution conducted field inspections on 11 and 12 de septiembre de 2024 and verified the existence of a makeshift pumping system, used intermittently, that conveyed sewage from the Residencial El Río tank to the ICAA public sewer main. He adds that this was done without authorization from the institutional authorities, compromising the operation of the public sewer system by causing overloads and risks of overflow.

The Ministra de Salud does not address these current facts in her report, as she merely describes the response given to the complaints underlying the constitutional protection proceedings discussed above, as well as the actions taken in compliance with the decisions and orders issued therein. Indeed, as the most recent action taken, she states that a health inspection of the tank was conducted on 20 de abril de 2023, with the following results: 1.-The area surrounding the tank was cleaned. 2.- The electrical system was installed (meter, meter box, security box, conduit body, and reactively installed cables). 3.- The grinder pump was cleaned and serviced. 4.- The pump was placed into operation to discharge wastewater into the ICAA sanitary sewer network and subsequently treat it at the wastewater treatment plant (planta de tratamiento de aguas residuales, PTAR). This final point even conflicts with what was established by that institution, as shown by the report of the Head of the Oficina Cantonal de Liberia. In short, the respondent minister refers only to actions taken more than two years ago, omitting any account of the situation since then, even though the petitioner once again alleges the same persistent problem.

Certainly, it is not for the Chamber to determine which technical decisions must be adopted, but it is empowered to compel the respondent authority to adopt them, coordinate with the competent institutions, and solve the problem. For those purposes, it is noted that the Ministry of Health has legal authority to intervene and also the ability to coordinate with other State entities, such as the local municipality and the ICAA, in order to achieve a comprehensive solution to the problem through legal means and even against the will of private parties. For this Court, the mere fact that the respondent ministry had known of the sewage overflow and contamination for more than nine years, without taking the actions necessary to solve the problem definitively, necessarily entails that the petition must be granted. Hence, in the present case, the Ministry of Health is liable for failing to fulfill its duties to protect health and the environment. Consequently, in view of the lack of diligent and effective action, this Chamber deems that the petition against it must be granted.

Apart from the foregoing, the petitioner must raise in those proceedings any objection concerning the complaints filed (including lack of notice) that served as the basis for the previous amparo proceedings.

  • 2)Regarding the responsibility of the Municipality of Liberia for the facts alleged by the petitioner. Although it was not established in this matter that the petitioner had filed a complaint directly with the Municipality of Liberia concerning the alleged environmental problem, the fact remains that, given its position as guarantor of local interests and services under Article 169 of the Political Constitution, as well as the provisions of constitutional case law, it cannot disregard the situation affecting local residents and simply place all responsibility on the Ministry of Health and the ICAA. Undoubtedly, it was required to maintain much more thorough oversight and coordination among the various competent entities, since it participates in construction processes within its canton. It should be noted that the report transcribes the Environmental Manager’s statement that “this environmental unit will inspect the site jointly with the Construction Control Unit in order to follow up on the case and, within the scope of this municipality’s authority, take action if necessary.” Accordingly, the petition against the local government is deemed appropriate.
  • 3)Regarding the responsibility of the ICAA for the facts alleged. As stated in judgment No. 2016-006368, summarized above, the ICAA is not deemed responsible for the environmental problem affecting the petitioner, because that institution has not formally taken possession of the El Río residential development’s sewage pumping station. As explained, that situation legally limits its ability to intervene and invest resources in that system because it is privately operated, remaining under the oversight and responsibility of the Ministry of Health. Therefore, the ICAA’s authority is limited to two matters: 1) Maintaining the manhole covers and repairing leaks in the sewer collector that it owns. 2) Filing complaints regarding possible unlawful connections to that system. In this regard, no direct responsibility attributable to the ICAA has been established, and the petition must therefore be denied.

VII.Conclusion. In its settled case law, the Chamber has stated that human beings cannot be denied the right to a healthy environment or the right to health because the corresponding authorities are unable to exercise effectively the powers granted by law to monitor and solve problems. Indeed, this Court considers that State action must be coordinated and effective, since it is not simply a matter of identifying the problem and placing responsibility on others, as occurred in this case, nor is it for this Chamber to assign to each entity the solutions it must implement; rather, once the matter has been assessed, a comprehensive solution must be provided, for which purpose, under a State’s system for distributing powers and functions, all those involved must participate, each contributing what ultimately falls within its responsibility. In accordance with the foregoing, this Chamber determines that both the Municipality of Liberia and the Ministry of Health must coordinate a definitive solution to the sanitation problem that—for more than nine years—has affected the petitioner and concerning which this is the third ruling issued by this Court seeking its resolution. Consequently, the appropriate course is to grant the petition against both authorities, as set forth in the operative part of this judgment. With respect to the ICAA, the petition is denied on the grounds stated above.

VIII. NOTE BY JUSTICE SALAZAR ALVARADO

In environmental matters, it is also the undersigned’s view that, where the Public Administration has already intervened, jurisdiction to hear and decide the matter lies with the contentious-administrative courts. Nevertheless, I do consider the merits of the matter when other rights of persons affected by the source of contamination are at stake, including health, quality of life, and the right to enjoy a healthy environment free of contamination (Article 50 of the Political Constitution), as occurs in this case, in which the petitioner alleges environmental contamination caused by the malfunctioning of the sewage storage and treatment tank of a residential development in Liberia, to the detriment of a healthy and ecologically balanced environment and a decent standard of quality of life.

IX.Partial dissenting opinion of Justice Garro Vargas regarding the operative part of this judgment. Although I agree with the Chamber’s majority that the petition must be granted, I disagree as to the forum in which the enforcement phase of the matter should be conducted, given the absence of adequate mechanisms under the rules governing this constitutional jurisdiction to monitor a judgment involving technical matters of some complexity, as in this case, in which the Ministry of Health and the Municipality of Liberia are to provide a solution to the problem reported by the petitioner within six months from notice of this judgment. By contrast, the provisions of the Contentious-Administrative Procedure Code concerning enforcement (Article 155 et seq.) offer clear advantages, such as the ability to request schedules, impose fines, establish liability, monitor stages of compliance, etc. Therefore, pursuant to Article 56 of the Constitutional Jurisdiction Act, I consider that the enforcement phase must be conducted before the Enforcement Division of the Contentious-Administrative and Civil Court of the Treasury, under the judgment-enforcement rules of that Code.

X.Documents submitted to the case file. The parties are advised that, if they submitted any paper document, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be retrieved from the court office within a maximum period of thirty business days from notice of this judgment. Otherwise, all material not retrieved within that period shall be destroyed, pursuant to the “Regulations on Electronic Case Files before the Judiciary,” approved by the Full Court in Session No. 27-11 of 22 de agosto del 2011, Article XXVI, and published in Judicial Bulletin No. 19 of 26 de enero del 2012, as well as the resolution approved by the Superior Council of the Judiciary at Session No. 43-12 held on 3 de mayo del 2012, Article LXXXI.

Por tanto:

The petition is granted solely against the Ministry of Health and the Municipality of Liberia. Mariela de los Ángeles Marín Mena and José Javier Calvo Darcía, respectively, in their capacities as Acting Minister of Health and Mayor of Liberia, or whoever may hold those offices, are ordered to coordinate the issuance of the pertinent orders and carry out all actions within the scope of their authority so that, within six months from notice of this judgment, a comprehensive and definitive solution is provided to the contamination problem affecting petitioner Nombre91168. The respondents, or whoever may hold their offices, are warned that, pursuant to Article 71 of the Constitutional Jurisdiction Act, any person who receives an order issued in an amparo proceeding that they must comply with or enforce and who fails to comply with or enforce it shall be sentenced to imprisonment for three months to two years or to a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.

The State and the Municipality of Liberia are ordered to pay the costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment before the contentious-administrative courts. As to the Costa Rican Institute of Aqueducts and Sewers, the petition is denied. Justice Salazar Alvarado submits a note. Justice Garro Vargas dissents regarding enforcement of this judgment and, pursuant to Article 56 of the Constitutional Jurisdiction Act, directs that enforcement be conducted before the Enforcement Division of the Contentious-Administrative and Civil Court of the Treasury, under the enforcement rules established in Articles 155 et seq. of the Contentious-Administrative Procedure Code. She further orders that a copy of the judgment be forwarded to that Division so that proceedings to enforce this ruling may be initiated. Notice shall be given.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del catorce de noviembre de dos mil veinticinco .

Recurso de amparo que se tramita en expediente número 25-025544-0007-CO, interpuesto por Nombre91168, mayor, cédula de identidad CED51386, contra el Ministerio de Salud, el Instituto Costarricense de Acueductos y Alcantarillados y la Municipalidad de Liberia.

Resultando:

  1. 1Por escrito recibido en la Secretaría de la Sala a las 11:59 horas del 25 de agosto de 2025, la recurrente interpone recurso de amparo contra el Ministerio de Salud y el Instituto Costarricense de Acueductos y Alcantarillados -ICAA- y expresa que en el 2015 interpuso un recurso de amparo resuelto bajo el número 16-002436-0007-CO, en el que se denunció el mal manejo de una fosa de almacenamiento de aguas negras del residencial El Río, ubicado en Dirección5863. Señala que, como resultado, el Ministerio de Salud giró una orden sanitaria al propietario de la fosa, quien instaló bombas sumergibles para trasladar los desechos fecales al alcantarillado sanitario; sin embargo, comenta que la solución fue parcial y los problemas se han repetido con frecuencia. Indica que desde octubre de 2022 el sistema de bombeo y la fosa quedaron en completo abandono, provocando el desbordamiento de aguas negras directamente al río Liberia y a lotes aledaños, cuya situación genera malos olores, gases pestilentes, proliferación de insectos y roedores, más contaminación directa del río y del ambiente.Recalca que su vivienda es la más afectada por su cercanía, obligando a mantener puertas y ventanas cerradas, lo que afecta gravemente la salud, la convivencia y el derecho a una vida digna de su familia, conformada por su esposo, una adolescente de 18 años, una niña de 10 años y ella misma. Añade que desde el 11 de noviembre de 2022 presentó una denuncia formal ante el Ministerio de Salud de Liberia bajo el número 354-2022; no obstante, reclama que a la fecha no ha sido atendida, alegando la imposibilidad de notificar al propietario. Agrega que, en noviembre de 2023, presentó una nueva denuncia por la misma situación, la cual tampoco fue resuelta, evidenciando una omisión reiterada por parte de las autoridades sanitarias. Manifiesta que actualmente, la extracción del material fecal acumulado en la fosa se realiza de forma precaria e irregular por una persona no identificada, sin autorización oficial aparente, utilizando una bomba manual externa para trasladar los desechos al alcantarillado público, cuyo procedimiento se extiende por aproximadamente nueve horas diarias, lo que implica la apertura simultánea de la fosa y del alcantarillado, liberando olores nauseabundos y gases pestilentes y exponiendo a la comunidad a vectores y al riesgo de derrames que terminan en el río Liberia.Señala que cuando la bomba no se utiliza, el material fecal se desborda directamente al cauce del río, siendo que esta situación representa un manejo negligente de residuos altamente contaminantes en un complejo habitacional de más de 250 viviendas y un hotel, sin condiciones mínimas de seguridad, salubridad ni control ambiental. Además, comenta que, durante la época lluviosa, el alcantarillado sanitario del ICAA, colindante con la fosa, se desborda, agravando aún más la contaminación ambiental. En virtud de la omisión expuesta, considera que vulnerados sus derechos fundamentales y de los demás habitantes de la zona afectada, por lo que solicita se declare con lugar el presente recurso y se ordene lo que en derecho corresponda.
  2. 2Mediante resolución de las 21:00 horas del 29 de agosto de 2025, la Presidencia de la Sala dio curso a este amparo y se le solicitó informe al Director del Área Rectora de Salud de Liberia del Ministerio de Salud y al Jefe de la Oficina Cantonal de Liberia del ICAA, sobre los hechos alegados por la parte recurrente.
  3. 3Informa bajo juramento Wander Cubero Hurtado, en su condición de Jefe de la Oficina Cantonal de Liberia del ICAA (escrito presentado a las 17:36 horas del 08 de setiembre de 2025) en los siguientes términos:

“PRIMERO. Con ocasión del recurso de amparo que en su oportunidad interpuso la señora Nombre91168, seguido bajo el expediente No. 16-002436-0007-CO, la Sala Constitucional emitió la resolución No. 2016-006368, en la cual ordenó:

“… Se declara con lugar el recurso, únicamente contra el Ministerio de Salud. En consecuencia, se le ordena al Dr. Mario Enrique Calvo González, Director del Área de Salud de Liberia, que disponga las medidas necesarias y adopte las medidas pertinentes a fin de eliminar el problema sanitario existente en la colindancia entre el Dirección5864, el Río Liberia y el Residencial El Río, dentro de un término de dos meses, a partir de la notificación de la sentencia…

De igual manera, se extrae el informe GSP-RCH-CL-2025-0729: “… Por su parte, la Sala desestimó la pretensión contra el AyA, dado que se comprobó que la Estación de Bombeo de Aguas Residuales (EBAR) del residencial no había sido recibida formalmente por esta institución, criterio reiterado en el oficio GSP-RCH-CL-2016-00558 (4 de abril de 2016) y en el oficio GSP-RCH-CL-2016-01266 (12 de julio de 2016).” La situación expuesta se mantiene a la fecha, en el sentido de que conforme con la reglamentación vigente, (Reglamento para la aprobación y recepción de sistemas de saneamiento por parte del Instituto Costarricense de Acueductos y Alcantarillados, Acuerdo de Junta Directiva No. 2022-0354) el AyA no ha recibido las obras, en este caso la Estación de bombeo, situación que jurídicamente le limita a intervenir e invertir recursos en dicho sistema, por encontrarse en el ámbito privado, quedando bajo la tutela y responsabilidad del Ministerio de Salud. En este caso la competencia del AyA se circunscribe a dar mantenimiento a las tapas de registro y reparación de fugas del colector del alcantarillado sanitario de su propiedad, a presentar las denuncias por posibles conexiones ilícitas a dicho sistema, que vienen a exponenciar la problemática que aqueja a los vecinos y que a la vez generan una sobrecarga en el sistema público de tratamiento de aguas residuales.

SEGUNDO. No corresponde a un hecho de mi representada, sin embargo, es claro que al dictarse una orden sanitaria es el propio Ministerio de Salud a través del Área Rectora, a quien le corresponde el seguimiento y verificación hasta su efectiva materialización por parte del desarrollador en este caso.

TERCERO. No es un hecho de mi representada.

CUARTO. No es un hecho de mi representada.

QUINTO. No es un hecho de mi representada.

SEXTO. No es un hecho de mi representada.

SETIMO. Tal y como lo expone la amparada, la extracción del material fecal acumulado en la fosa del Residencial El Río se realiza de manera precaria y absolutamente irregular. Una persona -cuya identidad se desconoce y que actúa sin control ni autorización oficial aparente utiliza una bomba manual externa, para trasladar las aguas negras desde la fosa hacia el alcantarillado sanitario público.

El Informe UEN-GA-2024-02063 y el Informe de atención a solicitud de intervención situación desborde de aguas residuales EBAR Residencial y Condominio del Río, Liberia corroboran lo narrado. En las inspecciones de campo realizadas los días 11 y 12 de septiembre de 2024, se constató la existencia de un sistema de bombeo artesanal, utilizado por lapsos parciales, que trasladaba aguas negras desde el tanque del residencial hasta el colector público del AyA, situación claramente no autorizada por parte de las autoridades institucionales.

Se reitera que, el memorando SG-GSP-RT-2024-00143 de fecha 18 de septiembre de 2024, confirma que estas prácticas irregulares comprometen la operación del alcantarillado público del AyA, generando sobrecargas y riesgos de desbordes, pero que tienen como causa raíz el mal manejo del sistema privado en abandono.

Este hecho refuerza que, si bien existe interacción con infraestructura del AyA (alcantarillado sanitario), la manipulación indebida proviene de particulares no autorizados.

OCTAVO. Existe una situación causada por un tercero, que está impactando de forma negativa el funcionamiento del sistema público del alcantarillado sanitario administrado por la institución. El Reglamento de vertido y reuso de aguas residuales No. 33601-MINAE-S establece los parámetros bajo los cuales es posible verter las aguas tratadas en un sistema de alcantarillado sanitario o bien en un cuerpo receptor, sin embargo, al realizarse de esta forma irregular por un particular, compromete el cumplimiento de dicha normativa y genera sobrecargas y riesgos de desbordes de aguas residuales, complicando la situación. Resulta de preocupación de la institución el hecho de que el Ministerio de Salud, en varias ocasiones busca trasladar el cumplimiento de sus actos al AyA, mediante el dictado de órdenes sanitarias, en lugar de actuar conforme a sus competencias y a pesar de ser conocedor de los impedimentos legales que enfrenta la Institución para intervenir en esas condiciones, insiste en valerse de ese mecanismo, en lugar de actuar en los términos que lo ha expuesto esa misma Sala, al señalarle a ese Ministerio : “ (…) actúo oportunamente, emitió las órdenes sanitarias e incluso presentó denuncias penales, lo cierto es que el problema sanitario subsiste, como lo indica su representante en el informe rendido bajo juramento.

No observa la Sala que el Ministerio haya adoptado medidas extraordinarias, como la clausura del lugar, la colaboración de la fuerza pública para seguridad del lugar, e incluso el eventual desalojo del residencial o cualesquiera otras medidas efectivas. La prestación de un servicio público como el que esta en manos del Ministerio de Salud exige una eficiencia acaso más allá de la necesaria por parte de otros órganos públicos, por causa de los derechos fundamentales a la salud y ambiente sano, en lo que atañe a sus competencias. La Sala considera que lo actuado por el Ministerio de Salud ha sido insuficiente y viola el derecho fundamental a la salud y a un ambiente sano de la amparada, por lo que procede estimar el recurso en su contra y ordenar que se disponga medidas necesarias, incluso radicales, y adopte las decisiones pertinentes a fin de eliminar el problema sanitario existente en la colindancia entre el Condominio Camino de Luna, el río Liberia y residencial El Río, dentro de un término de dos meses, a partir de esta notificación de la sentencia.

“(Énfasis propio) Por su parte, en el Informe UEN-GA-2024-02063 se documentó que, debido al bombeo artesanal y la saturación de la fosa del residencial, las aguas residuales eran trasladadas al colector del AYA, lo que en temporada de lluvias puede provocar sobrecargas temporales y desbordes, esto coincide con la percepción de la recurrente. No obstante, debe enfatizarse que los desbordes que se produzcan en la red pública tienen como causa raíz, el ingreso irregular de aguas residuales desde un sistema privado en abandono, lo que sobrepasa el diseño y la capacidad de la infraestructura institucional. El AYA ha atendido en el pasado aspectos puntuales de su colector (reposición de tapas y corrección de fugas, conforme al oficio GSP-RCH-CL-2016-01266), pero no puede asumir las cargas extraordinarias derivadas de sistemas no recibidos.

SOBRE EL FONDO DEL ASUNTO Como punto de partida, debe considerarse el criterio externado por la Procuraduría General de la República mediante dictamen C-257-2003 San José, 27 de agosto de 2003 (concordante con la valoración de fondo realizada por la Sala Constitucional en el Expediente 16-002436-0007-CO resolución 2016-006368) respecto al requisito de constatación de idoneidad técnica de las plantas de tratamiento de aguas negras por el AyA y el Ministerio de Salud. Para que se habilite el traspaso deben cumplirse los requisitos que el Instituto ha definido, para autorizar el traspaso de la porción correspondiente del área de uso público donde se ubique la planta para que éste pueda administrarlo y operarlo. En este sentido, el Dictamen antes citado indica: “…El Instituto Costarricense de Acueductos y Alcantarillados es el ente que determina, con base en lo que dispone la norma transcrita, cuándo deben las urbanizaciones contar con plantas de tratamiento de aguas negras.

A las municipalidades les compete, en este tema, vigilar que los proyectos de urbanizaciones a realizar en su cantón cumplan con las normas indicadas por el AyA en materia de acueductos y cloacas, lo que incluye que tengan previstas las plantas de tratamiento de aguas negras, cuando el AyA así lo haya ordenado. Una vez construidas las obras y al momento de su aceptación, las municipalidades ejercen control en relación con el cumplimiento de las disposiciones normativas correspondientes, entre ellas, las que tienen que ver con las instalaciones de agua potable y de recolección y evacuación de aguas negras ordenadas por el Instituto Costarricense de Acueductos y Alcantarillados, y demás entidades públicas competentes, todo de conformidad con lo que establece el artículo VI.6. del Reglamento para el Control Nacional de Fraccionamientos y Urbanizaciones, el cual establece: “VI.6. Aceptación de obras: La aceptación de las obras y de las áreas públicas se efectuará conforme a las disposiciones reglamentarias que tengan en vigor la municipalidad del cantón y los demás organismos públicos que al respecto ejerzan funciones de control.

Ninguna omisión de detalles en los planos aprobados libera al urbanizador y al profesional responsable de las obligaciones que les conciernen en cuanto al total y satisfactoria entrega de las obras, al tenor de lo establecido en este reglamento. El urbanizador y el profesional responsable que firman la solicitud de visado de los planos de construcción, son garantes de la estricta conformidad de las obras con los requisitos reglamentarios exigible, conforme a lo indicado en las leyes aplicables.” En otras palabras, si bien las municipalidades no operan ni mantienen los sistemas de recolección y evacuación de aguas negras, controlan que las urbanizaciones, y las edificaciones que en ellas se construyan, cumplan con las disposiciones que el Instituto Costarricense de Acueductos y Alcantarillados, y demás entes públicos competentes, hayan establecido en relación con dichos sistemas, para así cumplir con su papel de tutelar la salud y el ambiente en su cantón (…) (…) aunque el numeral 40 de la Ley de Planificación Urbana señala que las municipalidades podrán autorizar el traspaso indicado, lo cierto es que, a menos que este ejerciendo aquella competencia residual de que se habló líneas arriba y, consecuentemente, administre y opere directamente el sistema de agua potable y recolección y evacuación de aguas negras respectivo, están obligadas a autorizar dicha cesión a favor del ente competente, que como ya hemos dicho y concluiremos de seguido, es el Instituto Costarricense de Acueductos y Alcantarillados, para que este pueda administrar y operar el sistema, una vez comprobada, al momento de entrega de la obra por el constructor, sea este un sujeto de derecho público o privado, que se cumplen las disposiciones técnicas contempladas en la normativa y dadas por el propio AyA y el Ministerio de Salud, tal y como ha sido explicado ya.

Es decir, que constatada la idoneidad técnica de las plantas de tratamiento de aguas negras por el AyA y el Ministerio de Salud, la municipalidad debe aceptar la obra y autorizar el traspaso de la porción correspondiente del área de uso público donde se ubique la planta al Instituto Costarricense de Acueductos y Alcantarillados en razón de lo que disponen las normas que atribuyen la competencia para administrar y operar los sistemas de agua potable y recolección y evacuación de aguas negras y residuales a dicho Instituto, que ya han sido citadas, si no se está en un caso en el cual la municipalidad de que se trate lo vaya a operar y administrar en ejercicio de la competencia residual a que ya se hizo referencia….” Debe considerarse que ya esta Sala Constitucional, en el (Exp: 11-010057-0007-CO Res. Nº 2012017743 a las nueve horas treinta minutos del catorce de diciembre de dos mil doce) determinó que el Instituto asume una vez constatados los requisitos de recepción y hasta que ellos no se cumplan, la Municipalidad y en este caso el Propietario Registral – Desarrollador del Proyecto debe continuar asumiendo su responsabilidad de corregir los faltantes operativos para que se pueda factibilizar que este Instituto pueda asumir la administración: “…Dentro de los requisitos previos que la Municipalidad debe observar, nos encontramos con lo dispuesto por el artículo 21 de la Ley Constitutiva del Instituto de Acueductos y Alcantarillados, Ley 2726 del 14 de abril de 1971, que le atribuye al ICAA la competencia para aprobar “Todo proyecto de construcción, ampliación o modificación de sistemas de abastecimiento de agua potable y disposición de aguas servidas y pluviales, público o privado (…) Dicha aprobación previa será obligatoria en todos los casos de construcción de fraccionamientos, urbanizaciones o lotificaciones en cualquier parte del país y ningún otro organismo estatal otorgará permisos o aprobaciones de construcción sin tal aprobación por parte del Instituto.

La infracción de este mandato ocasionará la nulidad de cualquier permiso de construcción otorgada en contravención de esta prohibición(…)”, de tal manera que ningún ente público, entre ellos las municipalidades podrán otorgar permisos de construcción, si previamente el ICAA no ha recibido a satisfacción las obras de infraestructura de acueductos y de alcantarillado sanitario, según los planos aprobados y previo cumplimiento de todas las especificaciones técnicas que conforme con la legislación y reglamentación vigente exija a los desarrolladores el ICAA…a pesar de que el ICAA no ha recibido a satisfacción las obras de la planta de tratamiento y el desarrollador ni siquiera ha cumplido con todas las especificaciones técnicas indicadas mediante diversas notas por los órganos internos del ICAA, como requisito previo para la aprobación de los planos del proyecto; solo se explica por el incumplimiento o inobservancia de otras instituciones entre ellas, el INVU y la Municipalidad de la normativa legal existente.

En igual sentido, el hecho de que a pesar de ubicarse el Proyecto en una zona ambientalmente sensible y de que el INVU señalara desde el principio la necesidad de que se contara con alcantarillado sanitario y se haya otorgado permisos para construcción de viviendas con tanque séptimo y drenaje individual, poniendo en riesgo las aguas subterráneas, solo se explica porque la Municipalidad ha incumplido la normativa legal y técnica vigente. En consecuencia, la Sala acoge el recurso de amparo respecto de la Municipalidad de San Isidro y ordena lo siguiente: Suspender el otorgamiento de permisos de construcción en los Proyectos Lomas Verdes del Zurquí y Lomas del Zurquí hasta tanto, el ICAA no haya recibido a satisfacción del desarrollador las obras de acueducto y alcantarillado sanitario…” De igual forma, mediante resolución dictada en el Exp: 24-021588-0007-CO Res. Nº 2025002002, se indicó: “Ante este panorama, se tiene por constatada la acusada inacción de las autoridades municipales, pues si bien determinaron las acciones que requieren realizar, lo cierto del caso es que actualmente la situación denunciada se mantiene, en el sentido que no han realizado las gestiones correspondientes para solucionar la problemática de la planta de tratamiento ni tampoco su traslado ante el Instituto Costarricense de Acueductos y Alcantarillados –a quienes afirman son los que deberían darle el manteamiento–.

Lo anterior, a pesar de que tienen conocimiento de la problemática en cuestión desde el 2023, sin que conste que se haya tomado ninguna otra medida, que exista ninguna solución con certeza del problema denunciado por la recurrente, o que se haya definido una fecha para resolver dicha problemática. Bajo tal estado de las cosas, nos encontramos ante un problema sanitario grave que afecta al medio ambiente y la salud de los habitantes de la comunidad, y se constata que la Municipalidad… ha mostrado incapacidad para hacer cumplir las leyes en la materia y su obligación de garantizar el disfrute de los habitantes de la zona a un ambiente sano y ecológicamente equilibrado, con las consecuencias para la salud de esas personas debido a la naturaleza del problema sanitario que les aqueja. En reiterada jurisprudencia la Sala ha dicho que no se puede aceptar que a los seres humanos se les niegue el derecho a un ambiente sano, el derecho a la salud, debido a la incapacidad de las autoridades públicas correspondientes para ejercer efectivamente las potestades de vigilancia y la solución a los problemas otorgadas por ley.

La persistencia del problema demuestra que las pocas acciones realizadas han sido claramente insuficientes. Debido a lo expuesto, lo procedente es la estimatoria del recurso a efecto que las autoridades de la Municipalidad … emitan las órdenes y lleven a cabo las actuaciones respectivas dentro del ámbito de sus competencias, a fin de solucionar de forma definitiva el problema denunciado por la parte recurrente y constatado por las autoridades sanitarias traídas al proceso de amparo. Ahora, si bien el 20 de diciembre del 2024 la planta de tratamiento fue puesta en funcionamiento, lo cierto es que fue por parte de los vecinos de la comunidad, lo cual no implica que las autoridades municipales deban de llevar las gestiones correspondientes para la situación expuesta en el presente proceso sea subsanada de forma definitiva, pues aluden que deben gestionar que la planta de tratamiento sea administrada por el Instituto Costarricense de Acueductos y Alcantarillados.

VI.- Por otra parte, es menester indicar que no se observa alguna acción u omisión por parte de las autoridades sanitarias, quienes por su parte teniendo pleno conocimiento de la problemática que afecta a los pobladores del sector, se han encargado de brindar seguimiento al caso, constatar su existencia y emitir la orden sanitaria del caso. De igual manera respecto al Instituto Costarricense de Acueductos y Alcantarillados, dado que no se colige que sean los responsables de darle el mantenimiento a la planta de tratamiento de aguas residuales. Así las cosas, lo que procede es desestimar el recurso en cuanto a tales autoridades…” Finalmente, reiterar que al amparo del principio de legalidad las actuaciones en este caso se rigen por lo dispuesto en el Reglamento de aprobación y recepción de sistemas de saneamiento por parte del Instituto Costarricense de Acueductos y Alcantarillados, que establece:

Artículo 22. Estaciones de Bombeo. El Instituto podrá asumir la administración, operación y mantenimiento de alcantarillado sanitario y estaciones de bombeo de aguas residuales de tipo ordinario , de urbanizaciones y cualquier tipo de desarrollo constructivo habitacional de conformidad con el ámbito de aplicación de este reglamento. Lo anterior, previo cumplimiento de los siguientes requisitos…” (énfasis propio). Siendo que en el caso que nos ocupa, no existe a la fecha el cumplimiento de los requisitos reglamentarios por parte del desarrollador para la recepción e interconexión de la Estación de Bombeo al sistema público operado por AyA, ésta de conformidad con lo dispuesto en la Ley General de Salud en los artículos 285 al 292, queda bajo la tutela y vigilancia del Ministerio de Salud. FUNDAMENTOS DE DERECHO Fundamentamos nuestra respuesta en los artículos 27 y 30 de la Constitución Política, artículos 32, 43 siguientes y concordantes de la Ley de la Jurisdicción Constitucional, artículos 113 siguientes y concordantes de la Ley General de la Administración Pública, artículos 1 y 2 de la Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados N° 2726.

PETITORIA Con fundamento en las razones de hecho y de derecho señaladas, dejo rendido el informe solicitado. Expresamente se señala, para que sea tomado en cuenta por parte de esa Honorable Sala Constitucional, no sólo las actuaciones que ha realizado AyA en cumplimiento de sus fines, sino que de ningún modo ha desobedecido, violentado normas, garantías o principios constitucionales, más bien ha tenido una conducta responsable en respeto al derecho al saneamiento. Por lo que solicito se declare sin lugar en todos sus extremos el presente recurso de amparo.

La persistencia de la problemática evidencia la necesidad de una acción coordinada entre el Ministerio de Salud, la Municipalidad de Liberia y los propietarios del Residencial El Río para establecer una solución definitiva. El AyA ha cumplido con brindar la información técnica y los reportes requeridos, pero la solución de fondo excede sus competencias”.

  1. 4Según constancia del 13 de octubre de 2025, el Director del Área Rectora de Salud de Liberia del Ministerio de Salud no rindió el informe que se le solicitó en la resolución dictada a las 21:00 horas del 29 de agosto de 2025.
  2. 5Mediante resolución de las 11:19 horas del 20 de octubre de 2025, la Magistrada Instructora amplió el recurso contra la Ministra de Salud y el Alcalde de Liberia.
  3. 6Informa bajo juramento Mariela de los Ángeles Marín Mena, en su condición de Ministra de Salud en ejercicio (escrito presentado a las 18:32 horas del 22 de octubre de 2025) en los siguientes términos:

“INFORME DE LEY De conformidad con lo expuesto, se rinde el presente informe de ley con sustento en el Oficio N°MS-DRRSCH-DARSL-ER-IT-0315-2025, de fecha 21 de octubre de 2025, mediante el cual en síntesis, se afirma:

“…En cuanto a los aspectos alegados por los recurrentes en el presente caso por este medio hago de conocimiento la siguiente cronología de acciones realizadas en el caso:

Primero: El día 23 de abril de 2015, se presentó ante la Unidad de Atención al Cliente de la Dirección de Área Rectora de Salud de Liberia la denuncia N°213-2015, con del folio N°0001 al 0008.

Segundo: El día 13 de mayo de 2015, se realizó inspección sanitaria por Lica Laura Rodríguez Corrales y Bach Armando Mendoza García, del Equipo de Regulación del Área Rectora de Salud de Liberia al tanque de almacenamiento de aguas residuales de residencial el Rio, con folios del N°0015 al 0016.

Tercero: El día 16 de junio de 2015, se notificó la orden sanitaria N°161-2015 al señor Nombre91169. Administrador de residencial el Rio. El día 19 de mayo se notifica la orden sanitaria N°165-2015 al señor Edgar Chacón Villalobos, jefe cantonal de Instituto Costarricense de Acueductos y Alcantarillados con folios del N°0013 al 0016.

Cuarto: El día 18 de mayo de 2015 se informa a la señora Nombre91168 sobre la inspección sanitaria realizada al tanque de almacenamiento de aguas residuales de residencial el Rio, con folio N°0017.

Quinto: El día 03 de julio de 2015 se realiza inspección sanitaria de seguimiento al tanque de almacenamiento de aguas residuales de residencial el Rio para la verificación del cumplimiento de las ordenes sanitarias sanitaria N°161-2015 y la orden sanitaria No. 165-2015. Se confecciona el informe N°CH-ARS-L-ERS-629-2015, del folio 0021 al 0023.

Sexto: El día 14 de julio de 2015 se presenta ante los Tribunales de Justicia de Liberia la denuncia N°07-2015 contra Nombre91169. Administrador de Residencial el Rio y la denuncia N°08-2015 al señor Edgar Chacón Villalobos, jefe cantonal de Instituto Costarricense de Acueductos y Alcantarillados, ambos por desobediencia a la autoridad de salud, del folio 0024 al 0029.

Séptimo: El día 26 de febrero de 2016 la señora Nombre91168 presenta recurso de amparo contra el Área Rectora de Salud de Liberia ante la Unidad de Atención al Cliente, expediente N°16-002436-0007-CO, se confecciona el informe N°CH-ARS-L-ERS-0144-2016 de Licda. Laura Rodríguez Corrales para dar respuesta al recurso, folios N°0042 al 0058 Octavo: El día 4 de abril de 2016, la dirección del Área Rectoras de Salud de Liberia da respuesta a solicitud de intervención N°210606-2016-SI-PFA de la Defensoría de los Habitantes, con folio 0063 al 0071.

Noveno: El día 18 de mayo de 2016 vía fax :Telf7200, se notifica la resolución 2016006368 del expediente N°16-002436-0007-CO, a las partes, con folios del 0081 al 0096.

Décimo: El día 18 de mayo de 2016, acorde a la resolución N°2016006368 del expediente N°16- 002436-0007-CO, se realiza inspección sanitaria por la Licda. Laura Rodríguez Corrales a al tanque de almacenamiento de aguas residuales generando el informe N°CH-ARS-L-ERS-465- 2016 concluyendo que el sistema de bombeo no garantiza la eficiencia y eficacia de la disposición final de las aguas negras de residencial el Rio y se procede a aplicar las ordenes sanitarias N°192 y 197-2016 al señor Nombre91169. Representante legal de Ganadera la Lilas S.A. Cedula jurídica CED51387, según certificaciones de Registro nacional, con folios de 0109 al 0128.

Décimo primero: El día 4 de julio de 2016 se realiza inspección de seguimiento de las ordenes N°192 y 197-2016 notificadas al señor Nombre91169. Representante legal de Ganadera la Lilas S.A. Cedula jurídica CED51387, concluyendo se procede a denunciar ante el Ministerio Publico por desobediencia a la autoridad de salud, con folios del 0146 al 0156 Décimo segundo: El día 25 de julio de 2016, Doctor Mario Calvo González vía correo electrónico remite la resolución N°2016006368 de recurso de amparo por el problema del sistema de aguas residuales del residencial el Rio, solicitando al director regional de la Fuerza Pública de Guanacaste, Comisionado Daniel Calderón Rodríguez el apoyo en caso de un eventual desalojo del residencial. Folios 160-161 y 162.

Décimo tercero: El día 15 y 18 de julio de 2016 se da seguimiento por el Equipo de Regulación el Área Rectora de Salud de Liberia al tanque de almacenamiento de aguas residuales concluyendo que en el momento de la visita el sistema de bombeo del tanque de almacenamiento de aguas residuales se encuentran en funcionamiento, las aguas residuales del residencial el Rio están siendo trasladadas hacia el alcantarillado sanitario que administra el Instituto Costarricense de Acueductos y alcantarilladlos de Liberia. Folio del 0163 al 0171.

Décimo cuarto: El día 2 de junio de 2017 se realizó inspección sanitaria de seguimiento por el Equipo de Regulación del Área Rectora de Salud de Liberia al tanque de almacenamiento de aguas residuales de residencial el Rio, para la verificación de la instalación un sistema de bombeo alternativo, en el momento de la visita se observan dos bombas automatizadas que trabajan de forma continua. Folio 232.

Décimo quinto: el día 22 de junio de 2017 a las catorce horas y cuarenta minutos se ordena comunicar solicitud de sobreseimiento definitivo. Expediente 16-001250-0396-PE, contra Nombre91169 Y Nombre91169. Folio 0235.

Décimo sexto: El día 11 de noviembre de 2022 se presentó ante la Unidad de Atención al Cliente de la Dirección de Área Rectora de Salud de Liberia la denuncia N°354-2022 contra Nombre91169. Administrador de residencial el Rio y AyA, por el tanque de almacenamiento de aguas residuales colapsado generando contaminación al medio y la salud pública, la red de alcantarillado de aguas residuales de del AyA de Liberia; pasa contiguo al tanque de almacenamiento y sus cajas sépticas en la época de invierno colapsan. Folios del 0001al 0004.

Décimo Séptimo: El día 25 de noviembre de 2022 se realiza inspección sanitaria, me atiende el señor Nombre91169, quien permite el paso a su propiedad donde se ubica el tanque de almacenamiento de aguas residuales de residencial el Rio, debo de manifestar que la red de alcantarillado de Ay A, pasa por la misma propiedad, la servidumbre de paso es únicamente por encima de la red vieja y red nueva. Se observa que el tanque de almacenamiento colapso, el sistema de bombeo no está funcionando, contaminando la salud pública y el ambiente. Se concluye notificar orden sanitaria. Folio 0006.

Décimo octavo: El día 19 de diciembre de 2022 se emiten las ordenes sanitarias MS-DRRSCHDARSL-ER-OS-0205 Y 0214-2022 para notificar al señor Johnny Rafael Leiva Badilla y Nombre91169, representantes de Ganadera Las Lilas S.A. hasta el 23 de diciembre de 2022 no fue posible localizar a los representantes en sus domicilios. Folios del 0006 al 0013.

Decimo noveno: El día 10 de marzo de 2023 se presentó ante la Unidad de Atención al Cliente de la Dirección de Área Rectora de Salud de Liberia el recurso de amparo, de Nombre91168, expediente N°23-004850-0007-CO, contra Ministerio de Salud, folios del 0014 al 0016.

Vigésimo: El día 10 de marzo de 2023, se visita la vivienda del señor Nombre91169 para la aplicación de la orden sanitaria, atiende la señora Nombre91170 (esposa) indica que no es con ella y se retira. Folio 0017.

Vigésimo primero: El día 13 de marzo de 2023 se confecciona el informe del expediente No. MS-DRRSCH-DARSL-ER-IT-075-2023 de Lic. Armando Mendoza García del Equipo de Regulación del Área Rectora de Salud de Liberia para resolver el recurso. Folio 0018. Vigésimo segundo: el día 13 de marzo de 2023, se traslada el recurso de la Dirección de Área Rectora de Salud de Liberia a la Dirección Regional. Folio 0019.

Vigésimo tercero: el Dia 14 de marzo de 2023, la Licda. Lena Rodríguez Aguirre, Abogada de Dirección Regional, con oficio DR-CH-PSJ-L-039-2023 hace a la devolución del expediente original del caso de recurso de amparo Exp 23-004850-0007-CO de Nombre91168, en atención al oficio MS-DRRSCH-DARSL-0152-2023 suscrito por Dr. Luis Enrique Mayorga Diaz. Folios del 0020 al 0025.

Vigésimo cuarto: El día 14 de marzo de 2023, el Dr. Enrique Jiménez Aragón. Jefe de Servicios de Salud de Dirección Regional de Rectoría de Salud Chorotega hace la devolución de expediente al Dr. Luis Enrique Mayorga Diaz de recurso de amparo caso señora Nombre91168, folio 0026.

Vigésimo quinto: El día 14 de marzo y 15 de marzo de 2023 se envía respuesta de recurso de Amparo Exp. No. 23-004850-0007-CO interpuesto por señora Nombre91168, con copias certificada de DR-CH-PSJ-L-038-2023 de Dr. Luis Enrique Mayorga Diaz a Informes-SC (autorizado para recibir informes de Sala Constitucional) ...106 Folios del 0027 al 0033.

Vigésimo sexto: El día 15 de marzo de 2023 se realiza gestión de notificación administrativa de DRRSCH-DARSL-ER-IT-0348-2022. DRRSCH-DARSL-ER-OS-0214-2022. DRRSCH-DARSLER-OS-0204-2022. DRRSCH-DARSL-ER-OS-0205-2022 a Ganadera Las Lilas S.A. Representantes legales Nombre91169 y Johnny Rafael Leiva Badilla, con dirección 50 m sur de antiguo bar México o contiguo a hotel Wilson N°3. Bo. Condega. Liberia. Guanacaste. Folios 0034 y 0035.

Vigésimo séptimo: El martes 28 de marzo de 2023 vía correo electrónico llega de Asuntos Jurídicos ...2613 para Dirección de Área Rectora de Salud de Liberia voto con lugar regional: sistema de notificaciones (expediente N°23-004850-0007-CO). Folio 0036 al 0045.

Vigésimo octavo: El día 28 de marzo de 2023, la Dirección del Área Rectora de Salud de Liberia solicita la visita conjunta con la dirección de aguas al Ing. Leonardo Solano Romero. Coordinador. Unidad hidrológica Tempisque-Pacifico Norte. Folio 0046.

Vigésimo noveno: el día 31 de marzo de 2023 la Dirección del Área Rectora de Salud de Liberia solicita auxilio policial para notificación de orden sanitaria a representantes de Ganadera Las Lilas S.A. Folios de Telf7201 a 0054.

Trigésimo: El día 12 de abril de 2023, el señor Anell González Rojas de Correos de Costa Rica hace entrega de las ultimas notificaciones tramitadas. Folios del 0055 al 0062.

Trigésimo primero: el día 12 de abril de 2023, en seguimiento resolución N°2023007051 Exp 23-004850-0007-CO Recurso de Amparo Interpuesto por señora Nombre91168, vía correo electrónico se envía a informes de Sala Constitucional ...106 el oficio MS-DRRSCH-DARSL-198-2023. Folios 0064-0065 y 0066.

Trigésimo segundo: El día 13 de abril de 2023, en seguimiento resolución N°2023007051 Exp 23-004850-0007-CO Recurso de Amparo Interpuesto por señora Nombre91168, vía correo electrónico se envía el oficio MS-DRRSCH-DARSL-203-2023 al señor Paul Rueda L. Magistrado Instructor. Sala Constitucional. Corte suprema de Justicia. San José. Folios 0067 y 0068.

Trigésimo tercero: El día 13 de abril de 2023, se notifica la orden sanitaria No. DRRSCH-DARS-ER-OS-0204-2022 a Nombre91169, uno de los representantes legales de Ganadera Las Lilas S.A. Folio 0069.

Trigésimo cuarto: El día 18 de abril de 2023, el señor Nombre91169, presenta en la Unidad de Atención al Cliente del Área Rectora de Salud de Liberia, respuesta a la orden sanitaria N°DRRSCH-DARSL-ER-OS-0204-2022 indicando que el sistema de bombeo de aguas residuales de residencial el Rio ya se restableció y solicita una inspección. Folio 0070.

Trigésimo quinto: El día 20 de abril de 2023, se realizó inspección sanitaria al tanque de almacenamiento y tratamiento de aguas residuales de residencial el Rio, encontrando lo siguiente:

  1. 1Se realizó limpieza del entorno del tanque de almacenamiento de aguas residuales.
  2. 2Se instalo el sistema eléctrico (medidor, caja porta medidor, caja de seguridad, conduleta y cables reactivamente).
  3. 3Se realiza limpieza y mantenimiento de bomba trituradora.
  4. 4Se puso a funcionar la bomba para la disposición de las aguas residuales hacia la red de alcantarillados sanitario de Ay A y posterior tratamiento de la PTAR. Folios 0071, 0072 y 0073

Trigésimo sexto: La Dirección del Área Rectora de Salud de Liberia vía correo electrónico envía cumplimiento de resolución 2023007051. Exp: 23-004850-0007-CO con el oficio No. MSDRRSCH-DARSL-221-2023 de Dr. Luis Enrique Mayorga Diaz. Director de Área Rectora de Salud de Liberia. al señor Paul Rueda L. Magistrado Instructor. Sala Constitucional. Corte Suprema de Justicia. San José. Folios 0074-0075 y 0076.

Sin otro particular, se suscribe de Usted. Lic. Armando Mendoza García. Equipo de Regulación: Área Rectora de Salud de Liberia…”.

CONCLUSIÓN:

De conformidad con lo aquí expuesto, el Ministerio de Salud, a través del Área Rectora de Salud Liberia y la Dirección Regional de la Rectoría de la Salud Chorotega ha dado el debido seguimiento, vigilancia y monitoreo al presente proceso desde su génesis, evidenciado así desde el 2015, siendo que se han aportado los informes de Ley pertinentes ante esa Honorable Sala Constitucional como las respectivas denuncias penales ante las instancias judiciales pertinentes, todo con lo finalidad de dar la atención oportuna a las denuncias presentadas y evitar problemas a la salud de la población del Residencial El Río, como al recurso natural que pudiera verse afectado, no apartando el Ministerio de Salud su vista a esta problemática, evidenciando en el transcurso del tiempo cumplimiento a lo ordenado y ante variantes en el mismo la acción oportuna de este Ministerio en salvaguardar la salud de la población mediante la emisión de nuevas órdenes sanitarias.

No resulta conforme a la verdad real los extremos expuestos por la amparada al decir que existe desidia y abandono por parte del Ministerio de Salud a la problemática existente, ya que hemos sido contestes cada vez que se requiere nuestra vigilancia ante alguna denuncia y con el debido seguimiento a las ordenes emitidas, buscando a las partes intervinientes en esta problemática hasta con recurso judicial como se ha evidenciado.

Rogando a esa Honorable Sala Constitucional, tomar en cuenta los comunicados suministrados y referidos en el presente Informe Constitucional en el transcurso del tiempo, como lo fueron los N°CH-ARS-L-ERS-0144-2016, N°CH-ARS-L-ERS-465-2016, DR-CH-PSJ-L-038-2023, MSDRRSCH-DARSL-198-2023, MS-DRRSCH-DARSL-203-2023, N°MS-DRRSCH-DARSL-221- 2023, así como tener por evidenciado los esfuerzos realizados por el Ministerio de Salud ante Fuerza Pública, Municipalidad de Liberia y a las personas implicadas en las denuncias interpuestas no siendo omisos a nuestra misión y mandato constitucional en salvaguardar el bien a la salud. No omitiendo, así como se ha evidenciado en el transcurso del tiempo, este ministerio de manera inmediata atenderá cualquier denuncia que se presente en este sector, como se ha demostrado puede cambiar la situación de tanque de almacenamiento de aguas residuales del Residencial el Rio, sea por vandalismo, mantenimientos o desgastes naturales PETITORIA:

En virtud de lo expuesto, respetuosamente se solicita a la Honorable Sala Constitucional, DECLARAR SIN LUGAR el presente recurso de amparo, pues resulta evidente de lo informado, que desde el Ministerio de Salud, hemos y seguimos realizando todos los esfuerzos necesarios para atender la totalidad de lo que nos exige la Ley, dando acompañamiento y seguimiento a la problemática vista en el tanque de almacenamiento de aguas residuales del Residencial el Río, reiteramos nuestra solicitud respetuosa, que se EXIMA DE TODA RESPONSABILIDAD A LA SUSCRITA EN CONDICIÓN DE MINISTRA DE SALUD a.i., Y AL MINISTERIO DE SALUD”.

  1. 7Informa bajo juramento José Javier Calvo Darcía, en su condición de Alcalde de Liberia (escrito presentado a las 15:32 horas del 27 de octubre de 2025) en los siguientes términos:

“PRIMERO: La Municipalidad de Liberia es una institución que forma parte de la Administración Pública, cuyos objetivos se encuentran plasmados en su naturaleza de ente público al servicio del Municipio.

Que la MUNICIPALIDAD DE LIBERIA dada la naturaleza jurídica y la función pública que desempeña la institución, se encuentra reguladas por el ordenamiento jurídico administrativo, lo que le obliga a sujetar su actuar a la satisfacción del interés público, sometida a1 principio de legalidad que se traduce en un actuar eficiente, responsable, en estricto apego a principios elementales de justicia, lógica y conveniencia (Artículos 10, 11 y 16 inciso l. de la Ley General de la Administración Pública).

Es de suma importancia aclarar en primer lugar a esta honorable Sala Constitucional, que la Municipalidad de Liberia, no ha violentado los derechos constitucionales al recurrente.

SEGUNDO: Sobre los hechos alegados por la parte recurrente, en resumen: que en el 2015 interpuso un recurso de amparo resuelto bajo el número 16-002436-0007-CO, en el que se denunció el mal manejo de una fosa de almacenamiento de aguas negras del Residencial El Río, ubicado en Dirección5863. Señala que, como resultado, el Ministerio de Salud giró una orden sanitaria al propietario de la fosa, quien instaló bombas sumergibles para trasladar los desechos fecales al alcantarillado sanitario; sin embargo, comenta que la solución fue parcial y los problemas se repitieron con frecuencia. Indica que desde octubre de 2022 el sistema de bombeo y la fosa quedaron en completo abandono, provocando el desbordamiento de aguas negras directamente al Río Liberia y a lotes aledaños, cuya situación genera malos olores, gases pestilentes, proliferación de insectos y roedores, más contaminación directa del río y del ambiente.

Recalca que su vivienda es la más afectada por su cercanía, obligando a mantener puertas y ventanas cerradas, lo que afecta gravemente la salud, la convivencia y el derecho a una vida digna de su familia, conformada por sum esposo, una adolescente de 18 años, una niña de 10 años y ella misma. Añade que desde el 11 de noviembre de 2022 presentó una denuncia formal ante el Ministerio de Salud de Liberia bajo el número 354-2022; no obstante, reclama que a la fecha no ha sido atendida, alegando la imposibilidad de notificar al propietario. Agrega que, en noviembre de 2023, presentó una nueva denuncia por la misma situación, la cual tampoco fue resuelta, evidenciando una omisión reiterada por parte de las autoridades sanitarias. Manifiesta que actualmente, la extracción del material fecal acumulado en la fosa se realiza de forma precaria e irregular por una persona no identificada, sin autorización oficial aparente, utilizando una bomba manual externa para trasladar los desechos al alcantarillado público, cuyo procedimiento se extiende por aproximadamente nueve horas diarias, lo que implica la apertura simultánea de la fosa y del alcantarillado, liberando olores nauseabundos y gases pestilentes, y exponiendo a la comunidad a vectores y al riesgo de derrames que terminan en el Río Liberia.

Señala que cuando la bomba no se utiliza, el material fecal se desborda directamente al cauce del río, siendo que esta situación representa un manejo negligente de residuos altamente contaminantes en un complejo habitacional de más de 250 viviendas y un hotel, sin condiciones mínimas de seguridad, salubridad ni control ambiental. Además, comenta que, durante la época lluviosa, el alcantarillado sanitario del AyA, colindante con la fosa, se desborda, agravando aún más la contaminación ambiental. En virtud de la omisión expuesta, considera que vulnerados sus derechos fundamentales y de los demás habitantes de la zona afectada, por lo que solicita se declare con lugar el presente recurso y se ordene lo que en derecho corresponda:

Cabe aclarar a esta respetable Sala que el ámbito de actuación de la Administración Pública concretamente con los Municipios, de acuerdo con el Principio de Legalidad estipulado en la Constitución Política y la Ley General de la Administración Pública, en la materia propia del Derecho Público, y concretamente en el Derecho Administrativo, el principio de legalidad representa uno de los pilares fundamentales sobre los cuales se asienta el quehacer diario de la Administración Pública. Su nacimiento se encuentra concomitantemente con el nacimiento de las instituciones políticas modernas, y con el desarrollo y extensión del Derecho Administrativo, como aquel derecho tendiente a regular las actuaciones de la administración en el ejercicio de su función administrativa. De referencia positiva en nuestro ordenamiento jurídico, en el numeral 11 de la Constitución Política , y en los artículos 11, 12, 6 y 13 de la Ley General de la Administración Pública, su conceptualización se da, en el sentido de que todo acto o comportamiento de la Administración Pública debe estar regulado y permitido por el ordenamiento jurídico, aplicando el viejo aforismo de que la Administración puede hacer únicamente aquello que le está permitido, muy al contrario de la actuación del particular, que en su actividad privada rige el dogma de la autonomía de la voluntad, y el mismo podrá hacer actos o actividades que no se encuentren prohibidas.

Con relación al tema de los Municipios, en el artículo 169 de la Constitución Política se fijan las atribuciones municipales, al poner a cargo del Gobierno local, los intereses y servicios locales, concomitantemente con el Código Municipal que señala las atribuciones municipales que atiendan al fin de promover el desarrollo integral de los cantones y dentro de los cuales señala una lista muy extensa de las mismas. Se pueden contar dentro de ellas, los servicios públicos locales, la planificación urbanística, la administración de la zona marítimo terrestre etc.

Cabe aclarar a esta respetable Sala, que en acatamiento al Código Municipal artículo 4 siguientes y concordantes, establece que la municipalidad posee la autonomía política, administrativa y financiera que le confiere la Constitución Política, dentro de sus atribuciones. Por lo que en acatamiento a dicha normativa no es posible para este municipio intervenir en un asunto que no se enmarca en las atribuciones otorgadas por el Código Municipal y por la misma Constitución Política, por ser un asunto que compete a otras instituciones estatales sean estas el Ministerio de Salud y Acueductos y Alcantarillados y no a esta Municipalidad.

Cabe aclarar a esta respetable autoridad que no es cierto lo que indica la recurrente con estos hechos ya que no se ha recibido ninguna denuncia por parte de la recurrente. Ver oficio SGA-287-10-2025, de fecha del 24 de octubre del 2025 que se adjunta como prueba suscrito por el Ing. Augusto Otárola Guerrero, Gestor Ambiental, Municipalidad de Liberia, se indica lo siguiente:

“Sobre este caso se responde que mi unidad a cargo no ha tenido denuncias sobre esa situación relacionada con supuestos problemas con desborde de aguas negras y solidos fecales del tanque de almacenamiento de residuos fecales de residencial del rio hacia el rio Liberia tal como lo manifiesta la denunciante. Sin embargo, esta unidad ambiental realizará inspección al lugar en conjunto con la unidad de Control Constructivo para darle seguimiento al caso y en las competencias de esta municipalidad proceder si fuese necesario.” (El resaltado es nuestro).

Considerando este municipio que no es cierto lo que indica la recurrente en estos hechos, ya que no se le vulneran los derechos fundamentales alegados, por lo que el recurso presentado debe declararse sin lugar.

TERCERO: Se remite copia certificada de la documentación relacionada con este recurso de amparo. PETITORIA.

Solicito se declare sin lugar este recurso de amparo y se condene a la recurrente al pago de ambas costas de esta acción”.

  1. 8En los procedimientos seguidos se han observado las prescripciones legales.

Redacta el Magistrado Castillo Víquez; y,

Considerando:

I.Objeto del recurso. La recurrente alega que en el 2015 interpuso un recurso de amparo que se tramitó en el expediente No. 16-002436-0007-CO, en el que se denunció el mal manejo de una fosa de almacenamiento de aguas negras del residencial El Río, ubicado en Dirección1499 de Liberia. Señala que, como resultado, el Ministerio de Salud giró una orden sanitaria al propietario de la fosa, quien instaló bombas sumergibles para trasladar los desechos fecales al alcantarillado sanitario. Sin embargo, la solución fue parcial y los problemas se han repetido con frecuencia. Indica que desde octubre de 2022 el sistema de bombeo y la fosa quedaron en completo abandono, provocando el desbordamiento de aguas negras directamente al río Liberia y a lotes aledaños, cuya situación genera malos olores, gases pestilentes, proliferación de insectos y roedores, más contaminación directa del río y del ambiente.

Recalca que su vivienda es la más afectada por su cercanía, obligando a mantener puertas y ventanas cerradas, lo que afecta gravemente la salud, la convivencia y el derecho a una vida digna de su familia, conformada por su esposo, una adolescente de 18 años, una niña de 10 años y ella misma. Añade que desde el 11 de noviembre de 2022 presentó una denuncia ante el Ministerio de Salud de Liberia bajo el No. 354-2022; no obstante, a la fecha no ha sido atendida, alegando la imposibilidad de notificar al propietario. Agrega que, en noviembre de 2023, presentó una nueva denuncia por la misma situación, la cual tampoco fue resuelta. Actualmente, la extracción del material fecal acumulado en la fosa se realiza de forma precaria e irregular por una persona no identificada, sin autorización oficial aparente, utilizando una bomba manual externa para trasladar los desechos al alcantarillado público, cuyo procedimiento se extiende por aproximadamente nueve horas diarias, lo que implica la apertura simultánea de la fosa y del alcantarillado, liberando olores nauseabundos y gases pestilentes y exponiendo a la comunidad a vectores y al riesgo de derrames que terminan en el río Liberia.

Señala que cuando la bomba no se utiliza, el material fecal se desborda directamente al cauce del río, lo que representa un manejo negligente de residuos altamente contaminantes en un complejo habitacional de más de 250 viviendas y un hotel, sin condiciones mínimas de seguridad, salubridad ni control ambiental. Además, durante la época lluviosa, el alcantarillado sanitario del ICAA, colindante con la fosa, se desborda, agravando aún más la contaminación ambiental.

II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque los recurridos hayan omitido referirse a ellos según lo prevenido en el auto inicial:

  • 1)El 20 de abril de 2023, funcionarios del Ministerio de Salud realizaron una inspección sanitaria al tanque de almacenamiento y tratamiento de aguas residuales del residencial El Río, ubicado en Dirección1499 de Liberia, con el siguiente resultado: 1.-Se realizó limpieza del entorno del tanque de almacenamiento de aguas residuales. 2.- Se instaló el sistema eléctrico (medidor, caja porta medidor, caja de seguridad, conduleta y cables reactivamente). 3.- Se realizó limpieza y mantenimiento de bomba trituradora. 4.- Se puso a funcionar la bomba para la disposición de las aguas residuales hacia la red de alcantarillado sanitario del ICAA y posterior tratamiento de la PTAR (véanse informe de la ministra recurrida y prueba documental aportada).
  • 2)El 11 y 12 de septiembre de 2024, funcionarios del ICAA realizaron inspecciones de campo y constataron la existencia de un sistema de bombeo artesanal, utilizado por lapsos parciales, que trasladaba aguas negras desde el tanque del residencial El Río hasta el colector público del ICAA, situación no autorizada por parte de las autoridades institucionales que comprometen la operación del alcantarillado público generando sobrecargas y riesgos de desbordes (véanse informe del Jefe de la Oficina Cantonal de Liberia del ICAA y prueba documental aportada).
  • 3)El tanque de almacenamiento de aguas negras del residencial El Río presenta en la actualidad desbordamiento de aguas negras directamente al río Liberia y a lotes aledaños, lo que genera malos olores, gases pestilentes, proliferación de insectos y roedores (véanse escrito de interposición del recurso y prueba fotográfica aportada).
  • 4)La extracción del material fecal acumulado en el tanque de almacenamiento se realiza de forma precaria utilizando una bomba manual externa para trasladar los desechos al alcantarillado público, lo que provoca olores nauseabundos y gases pestilentes (véanse escrito de interposición del recurso y prueba fotográfica aportada).
  • 5)La estación de bombeo de aguas residuales del residencial El Río no ha sido recibida formalmente por el ICAA, por lo que su operación queda bajo la tutela y responsabilidad del Ministerio de Salud (véase informe del Jefe de la Oficina Cantonal de Liberia del ICAA).

III.Sobre el derecho a un ambiente sano y ecológicamente equilibrado. Debe indicarse, en primer lugar, que los derechos fundamentales a la salud y a un ambiente sano y ecológicamente equilibrado se encuentran reconocidos constitucionalmente (artículos 21, 50, 73 y 89 de la Constitución Política), así como, a través de la normativa internacional aplicable en Costa Rica. En este sentido, en sentencia No. 2006-005928 de las 15:00 horas del 2 de mayo del 2006, este Tribunal resolvió: “El derecho a la vida reconocido en el numeral 21 de la Constitución es la piedra angular sobre la cual descansan el resto de los derechos fundamentales de los habitantes de la república. De igual forma, en ese ordinal de la carta política encuentra asidero el derecho a la salud, puesto que, la vida resulta inconcebible si no se le garantizan a la persona humana condiciones mínimas para un adecuado y armónico equilibrio psíquico, físico y ambiental.

Ahora bien, la salud pública y el derecho a un ambiente sano y ecológicamente equilibrado se encuentran reconocidos constitucionalmente en los artículos 21, 50, 73 y 89 de la Constitución Política. Específicamente, el artículo 50 constitucional reconoce de forma expresa el derecho de todos los habitantes del país a disfrutar de un medio ambiente saludable y en perfecto equilibrio. Ese derecho es garantía fundamental para la protección de la vida y la salud pública. En apoyo de lo anterior este Tribunal ha recurrido a la utilización de la noción de “calidad ambiental” como un parámetro, precisamente, de la calidad de vida de las personas, que se conjuga con otros elementos tales como la salud, la alimentación, el trabajo y la vivienda, haciendo referencia a que toda persona tiene derecho a hacer uso del ambiente para su propio desarrollo pero no de manera ilimitada, ya que, también, existe un deber de protección y preservación del medio ambiente para las generaciones presentes y futuras –principio de desarrollo sostenible–”.

Asimismo, del artículo 50 de la Constitución Política, se deriva la obligación del Estado de proteger el ambiente. Norma que establece al efecto: "El Estado procurará el mayor bienestar a todos los habitantes del país, organizando y estimulando la producción y el más adecuado reparto de la riqueza. Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. Por ello está legitimada para denunciar los actos que infrinjan ese derecho y para reclamar la reparación del daño causado. El Estado garantizará, defenderá y preservará ese derecho. La ley determinará las responsabilidades y las sanciones correspondientes". Con lo que se corrobora que las distintas autoridades públicas tienen el deber ineludible de preservar, defender y garantizar el derecho fundamental de toda persona a la salud y a un ambiente sano y ecológicamente equilibrado.

IV.Sobre la coordinación de las instituciones públicas en la protección integral al ambiente. Existe una obligación para el Estado -como un todo- de tomar las medidas necesarias para proteger el ambiente, a fin de evitar grados de contaminación, deforestación, extinción de flora y fauna, uso desmedido o inadecuado de los recursos naturales, que pongan en peligro la salud de los administrados. En esta tarea, por institución pública se entiende tanto a la Administración Central -Ministerios, como el Ministerio del Ambiente y Energía y el Ministerio de Salud-, que en razón de la materia, tienen una amplia participación y responsabilidad en lo que respecta a la conservación y preservación del ambiente; los cuales actúan, la mayoría de las veces, a través de sus dependencias especializadas en la materia. Del mismo modo, en esta tarea tienen gran responsabilidad las municipalidades en lo que respecta a su jurisdicción territorial.

Debido a la diversidad de actores que pueden intervenir, podría pensarse que esta múltiple responsabilidad provocaría un caos en la gestión administrativa. Por ello, a fin de evitar la coexistencia simultánea de esferas de poder de diferente origen y esencia, la duplicación de los esfuerzos nacionales y locales, así como la confusión de derechos y obligaciones entre las diversas partes involucradas, se hace necesario establecer una serie de relaciones de coordinación entre las diversas dependencias del Poder Ejecutivo y las instituciones descentralizadas, y entre éstas con las municipalidades, a fin de poder llevar a cabo las funciones que les han sido encomendadas. Esta Sala se ha referido ya al principio de coordinación de las dependencias públicas con las municipalidades en la realización de fines comunes, al señalar mediante sentencia No. 1999-005445 de las 14:30 horas del 14 de julio de 1999, que: "La coordinación es la ordenación de las relaciones entre estas diversas actividades independientes, que se hace cargo de esa concurrencia en un mismo objeto o entidad, para hacerla útil a un plan público global, sin suprimir la independencia recíproca de los sujetos agentes.

Como no hay una relación de jerarquía de las instituciones descentralizadas, ni del Estado mismo en relación con las municipalidades, no es posible la imposición a éstas de determinadas conductas, con lo cual surge el imprescindible «concierto» interinstitucional, en sentido estricto, en cuanto los centros autónomos e independientes de acción se ponen de acuerdo sobre ese esquema preventivo y global, en el que cada uno cumple un papel con vista en una misión confiada a los otros. Así, las relaciones de las municipalidades con los otros entes públicos, sólo pueden llevarse a cabo en un plano de igualdad, que den como resultado formas pactadas de coordinación, con exclusión de cualquier forma imperativa en detrimento de su autonomía, que permita sujetar a los entes corporativos a un esquema de coordinación sin su voluntad o contra ella; pero que sí admite la necesaria subordinación de estos entes al Estado y en interés de este (a través de la «tutela administrativa» del Estado, y específicamente, en la función de control la legalidad que a éste compete, con potestades de vigilancia general sobre todo el sector".

V.Sobre los anteriores recursos de amparo interpuestos por la recurrente. En dos oportunidades ha acudido la recurrente a esta Sala por la misma problemática por la cual acciona nuevamente. Dicha situación es la contaminación ambiental que provoca el mal funcionamiento del tanque de almacenamiento y tratamiento de aguas residuales del residencial El Río, ubicado en Dirección1499 de Liberia, del cual es vecina.

El primer recurso de amparo se tramitó en el expediente No. 16-002436-0007-CO y consta que alegó:

“I-. OBJETO DEL RECURSO. El presente amparo fue dirigido contra una persona física, en su condición de encargado de un residencial, por el hecho de incumplir una orden sanitaria dictada por el Ministerio de Salud en Liberia, por las presuntas deficiencias en el sistema de manejo de aguas residuales en un residencial privado”.

Ese asunto fue declarado con lugar, únicamente, contra el Ministerio de Salud, por la mayoría de la Sala, mediante sentencia No. 2016-006368 de las 09:30 horas del 13 de mayo de 2016 con sustento en las siguientes consideraciones:

“IV. DEL AMPARO CONTRA EL MINISTERIO DE SALUD. SOBRE LOS HECHOS: En lo que atañe al Ministerio de Salud, el informe rendido bajo la fe del juramento por el Dr. Mario Enrique Calvo González, Director del Área Rectora de Salud de Liberia, acredita, en lo que interesa, que:

1. la recurrente formuló una denuncia ante el Ministerio de Salud, por malos olores, problemas de aguas negras y contaminación de fuentes de agua el 23 de abril de 2015, en contra del Residencial El Río (v. copia del expediente administrativo); 2. a las 3:15 horas de 15 de mayo de 2015 se realizó inspección en el sitio, por parte el equipo de regulación de esa Área Rectora en la cual estuvo presente Nombre91169, encargado del Residencial denunciado; 3. el equipo de regulación del Ministerio de Salud emitió el Informe Técnico No. CH-ARS-L-ERS-349-2015 de mayo de 2015, producto de las inspecciones realizadas, en el cual se señalan las deficiencias en el sistema de manejo de aguas residuales y, en particular, del tanque de almacenamiento de esas aguas por parte del Residencial Del Río, consistentes, entre otras, en que el agua residual ha formado un lodo séptico seco que satura el sistema y, al encontrarse expuesto, sin tapa, genera olores muy desagradables; se encontraron residuos de lodos en los alrededores del tanque que evidencias que la cantidad de lodos sépticos sobrepasó la capacidad de almacenamiento en semanas anteriores, lo que ocasionó un desbordamiento, lo que el Ministerio atribuye a falta de mantenimiento del sistema; la protección del área del tanque es insuficiente; hay zacate en exceso en los alrededores y la red de alcantarillado del AyA que se encuentra en el Residencial no tiene tapa, entre otros.

4. el mismo informe indica que el encargado del Residencial atribuye el problema a la falta de seguridad en el sitio porque se han robado la bomba que envía las aguas residuales a la laguna de oxidación del AyA; 5. el 23 de abril de 2015, el Ministerio de Salud en Liberia emitió la orden sanitaria número 161-2015 de 18 de mayo de 2015, ordenando al encargado del Residencial El Río que en 12 días hábiles reparara el sistema de almacenamiento y bombeo, se instalaran tapas, malla de protección del lugar y otros; 6. el mismo 23 de abril de 2015, el Ministerio emitió orden sanitaria 165-2015 al AyA, para que corrigiera deficiencias y entregara un plan de mitigación; 7. vencidos los plazos de las órdenes sanitarias indicadas, el Ministerio realizó seguimiento, encontró prácticamente la misma situación e interpuso denuncias penales contra el encargado del residencial y el jefe cantonal del AyA; 8. las respectivas denuncias judiciales tienen los números 07-2015 y 08-2015 el 14 de julio de 2015, por el delito de desobediencia, contra el encargado del Residencial del Río y al funcionario Edgar Chacón Villalobos del AyA. 9. la problemática ambiental se ha agravado.

V. DEL AMPARO CONTRA EL MINISTERIO DE SALUD. SOBRE EL FONDO

De los hechos anteriores se desprende que el Ministerio de Salud, si bien actuó oportunamente, emitió las órdenes sanitarias e incluso presentó denuncias penales, lo cierto es que el problema sanitario subsiste, como lo indica su representante en el informe rendido bajo juramento. No observa la Sala que el Ministerio haya adoptado medidas extraordinarias, como la clausura del lugar, la colaboración de la Fuerza Pública para la seguridad del lugar, e incluso, el eventual desalojo del residencial o cualesquiera otras medidas efectivas. La prestación de un servicio público como el que está en manos del Ministerio de Salud exige una eficiencia y diligencias acaso más allá de la necesaria en por parte de otros órganos públicos, por causa de los derechos fundamentales a la salud y al ambiente sano, en lo que atañe a sus competencias. La Sala considera que lo actuado por el Ministerio de Salud ha sido insuficiente y viola el derecho fundamental a la salud y a un ambiente sano de la amparada, por lo que procede estimar el recurso en su contra y ordenar que se disponga las medidas necesarias, incluso radicales, y adopte las decisiones pertinentes a fin de eliminar el problema sanitario existente en la colindancia entre el Condominio Camino de Luna, el Río Liberia y el Residencial El Río, dentro de un término de dos meses, a partir de la notificación de la sentencia.-

VI. DEL AMPARO CONTRA EL AYA

Procede desestimar el amparo contra el Instituto Costarricense de Acueductos y Alcantarillados, por cuanto el informe rendido por el Encargado de la Oficina Cantonal de Liberia y el Director de la Región Chorotega acredita que actuaron lo dispuesto por el Ministerio de Salud, en lo que toca a sus competencias, con relación a la infraestructura del AyA (tapas y eliminación de fugas) porque el problema sanitario está generado por un sistema de manejo de aguas residuales que no ha sido recibido por la institución. Resulta evidente que el AyA no ha generado el problema ni vulnerado los derechos fundamentales de la amparada”.

De ahí se ordenó lo siguiente:

“Por tanto: Se declara con lugar el recurso, únicamente en contra del Ministerio de Salud. En consecuencia, se ordena al Dr. Mario Enrique Calvo González, Director del Área Rectora de Salud de Liberia, que disponga las medidas necesarias y adopte las decisiones pertinentes a fin de eliminar el problema sanitario existente en la colindancia entre el Dirección5865, el Río Liberia y el Residencial El Río, dentro de un término de dos meses, a partir de la notificación de la sentencia. Lo anterior, apercibido de que la desobediencia a las órdenes de esta Sala se encuentra sancionado penalmente según lo dispuesto en el artículo 71 de la Ley de la Jurisdicción Constitucional. Se condena al Estado al pago de los daños y perjuicios ocasionados por los hechos que han dado lugar a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Se declara inadmisible el amparo en cuanto se dirige contra Nombre91171. La Magistrada Hernández López salva el voto y rechaza de plano el recurso. El Magistrado Salazar Alvarado pone nota”.

El segundo recurso de amparo se tramitó en el expediente No. 23-004850-0007-CO. La recurrente reclamó lo siguiente:

“II.- OBJETO DEL RECURSO. La recurrente manifiesta que su casa de habitación se ubica en Guanacaste, Liberia, Dirección5866, Residencial Camino de Luna casa número 52. Señala que hacia el norte colinda con el río Liberia, que a su vez colinda con la fosa de aguas negras que provienen del Residencial El Río y dichas aguas negras deben en teoría ser trasladadas por tuberías que lleven dicho material a la planta de aguas negras de Liberia. No obstante, aduce que hace cinco meses la poca atención y mantenimiento que brindaban a la fosa de almacenamiento y la bomba que funcionaba para triturar y trasladar dicho material fecal al alcantarillado sanitario de Liberia se anuló. Por ende, la bomba dejó de funcionar y el sistema en general está en abandono, por lo tanto, el material fecal se desborda permanentemente, desaguando directamente al río Liberia y lotes aledaños. Además, la inmundicia de malos olores son perennes, así como la liberación de gases, igualmente proliferan moscas, zancudos, roedores y contaminación directa del río Liberia y ambiente en general, siendo su hogar el más afectado debido a su cercanía.

Asimismo, como un segundo problema, se presentó un desbordamiento del material fecal que transita por las tuberías del alcantarillado sanitario; ello, durante la época de fuertes lluvias, el material fecal se sale y genera fuerte contaminación ambiental. En atención a lo expuesto, indica que interpuso una denuncia ante el Ministerio de Salud, la cual se tramita bajo el No. 354-2022. No obstante, acusa que a la fecha en que se recurre, no ha sido atendida. Solicita la intervención de la Sala”.

Igualmente, se declaró con lugar contra el Ministerio de Salud. Lo anterior en la sentencia No. 2023-0097051 de las 09:30 horas del 24 de marzo de 2023 con el siguiente fundamento:

“V.- SOBRE EL FONDO. En el sub lite se tiene por acreditado que el 11 de noviembre de 2022 se recibió el formulario unificado para denuncias ante el Ministerio de Salud con el consecutivo de la denuncia No. 354-2022 en la Unidad de Atención al Cliente del Área Rectora de Salud de Liberia, en el cual la recurrente acusó la presencia de malos olores provenientes de la fosa de aguas negras del Residencial El Río. En ese contexto, alegó que en múltiples ocasiones se han presentado problemas con el funcionamiento de las bombas y, por ende, se provoca el desbordamiento de aguas negras. Asimismo, denunció que se presentó un desbordamiento del material fecal que transita por las tuberías del alcantarillado sanitario, siendo que durante la época de fuertes lluvias el material fecal se sale y genera fuerte contaminación ambiental. En atención a lo anterior, se colige que el 25 de noviembre de 2022 el Lic. Armando Mendoza García, en compañía del Ing. Miguel Chaves López, ambos funcionarios del Equipo de Regulación del Área Rectora de Salud de Liberia, realizaron una inspección en el tanque de almacenamiento y tratamiento de aguas residuales del Residencial El Río, determinando lo siguiente: “El sistema de tanque de almacenamiento y bombeo de as aguas residuales El Río no estaba funcionando, las aguas residuales están rebalsadas, cayendo en el terreno generando la contaminación al medio (…) El propietario debe de solucionar el problema del sistema del tanque de almacenamiento, bombeo, sistema eléctrico bombas trituradoras, tamizajes y disponer adecuadamente las aguas residuales a la red del sistema de tratamiento de aguas residuales”.

Consecuentemente, consta que el 19 de diciembre de 2022 la autoridad recurrida confeccionó las órdenes sanitarias Nos. MS-DRRSCHDARSL-ER-OS-0204-2022, MS-DRRSCH-DARSL-ER-OS-0205-2022 y, MSDRRSCH-DARSL-ER-OS-0214-2022, dirigidas a Nombre91169, Nombre91169 y Johnny Leiva Badilla, quienes figuran como representantes legales de Ganadera las Lilas S.A., en las cuales se ordena que dentro del plazo de 15 días procedan a “reparar el sistema de almacenamiento y tratamiento de aguas residuales de residencial El Río (sistema eléctrico, bombas trituradoras, tamizaje) y disponer adecuadamente a la red de aguas residuales de Acueductos y alcantarillados”.

Ahora bien, según el informe adjunto, dichas órdenes no se han podido notificar por las siguientes circunstancias: El 20 de diciembre de 2022 el Lic. Armando Mendoza García en compañía del Ing. Miguel Chaves López, realizaron una visita al Residencial El Río, en oficina contiguo a las Cuadras de Caballos para la aplicación de la orden sanitaria No. MS-DRRSCH-DARSL-ER-OS-0204-2022 a Nombre91169. No obstante, no se encontró a nadie. El 21 de diciembre de 2022 el Lic. Armando Mendoza García en compañía de Ing. Miguel Chaves López, realizaron una visita al Residencial El Río, en oficina contiguo a las Cuadras de Caballos para aplicar la orden sanitaria No. MSDRRSCH-DARSL-EROS-0204-2022. Sin embargo, no se encontró a nadie. Ese mismo día, se envió mensaje a Nombre91169 por medio del correo electrónico ...1639, solicitándole indicar si se podía enviar notificación de orden sanitaria por ese medio electrónico; empero, no se obtuvo respuesta alguna.

Los días 22 y 23 de diciembre de 2022 funcionarios del área de salud recurrida realizaron una visita al Residencial El Río, propiedad de Nombre91169, para notificar la orden sanitaria No. MS-DRRSCHDARSL-ER-OS-0204- 2022, pero no se encontró a nadie. El 10 de marzo de 2023 se realizó una visita a la vivienda de Nombre91169, contiguo a Hotel Wilson No. 3 para la notificación de la orden sanitaria No. MS-DRRSCH-DARSL-ER-OS-0205-2022. En esa ocasión, fueron atendidos por Nombre91172, esposa de Nombre91169, a quien se le informó de la notificación; empero, la misma les indicó que “eso no es con ella”.

En la especie, si bien la autoridad recurrida argumenta que procederá a notificar las órdenes sanitarias por medio de Correo Certificado por Correos de Costa Rica, lo cierto del caso es que no ha logrado resolver la problemática expuesta por la recurrente de manera definitiva; ello, por cuanto la excusa de que no ha podido notificar las órdenes sanitarias no resulta suficiente para esta Sala, tomando en cuenta que hay un problema serio comprobado de aguas residuales incorrectamente manejadas, las cuales están rebalsadas y discurren en el terreno generando la contaminación al medio. En ese orden de ideas, se advierte que el Ministerio de Salud tiene amplias potestades para actuar de conformidad con la Ley General de Salud y el Reglamento correspondiente, como ente rector encargado de la vigilancia y control de la salud, ya que es claro que de conformidad con la Ley General de Salud artículos 39 y 286 es deber de todo propietario y encargado de muebles e inmuebles evitar molestias y daños a la salud, así como focos de contaminación o infección debiendo efectuar obras de drenaje e incluso en caso de renuencia hacerlas la administración a costa del omiso, todo resguardando el debido proceso (véase en similar sentido la sentencia No. 2022010613 de las 09:40 horas del 13 de mayo de 2022. Así las cosas, lo procedente es declarar con lugar el recurso, con las consecuencias, que se indicaran en la parte dispositiva”.

Por ello, en la parte dispositiva se ordenó lo que a continuación se trascribe:

“POR TANTO: Se declara con lugar el recurso. Se ordena a Luis Enrique Mayorga Díaz, en su condición de Jefe Médico del Área Rectora de Salud de Liberia, o a quien en su lugar ejerza ese cargo, que tome las medidas correspondientes dentro del ámbito de sus competencias para que: 1) dentro del plazo de QUINCE DÍAS, contado a partir de la notificación de esta sentencia, se notifique las órdenes sanitarias Nos. MS-DRRSCH-DARSL-ER-OS-0204-2022, MS-DRRSCH-DARSL-ER-OS-0205- 2022 y, MS-DRRSCH-DARSL-ER-OS-0214-2022, a quienes correspondan y 2) dentro del plazo de QUINCE DÍAS, contado a partir del momento de notificación de dichas órdenes sanitarias, de manera efectiva se cumplan las mismas. Se advierte a la autoridad recurrida que, de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo, y no la cumpliere o hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a la presente declaratoria, los cuales se liquidarán en ejecución de sentencia de lo contencioso administrativo. El Magistrado Salazar Alvarado pone nota. Notifíquese”.

VI.Sobre el caso concreto. En el sub lite, como se indicó, la recurrente acude por tercera vez en amparo acusando la misma problemática que la aqueja desde hace más de nueve años, pues interpuso el primer recurso el 22 de febrero de 2016. Se trata de la contaminación ambiental que provoca el mal funcionamiento del tanque de almacenamiento y tratamiento de aguas residuales del residencial El Río, ubicado en barrio El Capulín de Liberia, del cual es vecina.

  • 1)Sobre la responsabilidad del Ministerio de Salud en los hechos acusados.

Se colige de lo que refiere la recurrente en el escrito de interposición del recurso que ese tanque presenta en la actualidad desbordamiento de aguas negras directamente al río Liberia y a lotes aledaños, lo que genera malos olores, gases pestilentes, proliferación de insectos y roedores. Además, la extracción del material fecal acumulado en el tanque de almacenamiento se realiza de forma precaria utilizando una bomba manual externa para trasladar los desechos al alcantarillado público, lo que provoca olores nauseabundos y gases pestilentes. Este último agravio es secundado por el ICAA, pues informa el Jefe de la Oficina Cantonal de Liberia que funcionarios de su representada realizaron inspecciones de campo el 11 y 12 de septiembre de 2024 y constataron la existencia de un sistema de bombeo artesanal, utilizado por lapsos parciales, que trasladaba aguas negras desde el tanque del residencial El Río hasta el colector público del ICAA. Agrega que ello sin autorización por parte de las autoridades institucionales, lo que comprometen la operación del alcantarillado público generando sobrecargas y riesgos de desbordes.

Sobre tales hechos actuales la Ministra de Salud no se refiere en el informe rendido, pues se limita a hacer saber la atención brindada a las denuncias que sustentaron los recursos de amparo antes reseñados, así como las acciones desplegadas en observanza a lo ahí resuelto y ordenado. Incluso, como último acto desplegado señala que el 20 de abril de 2023 se llevó a cabo una inspección sanitaria al tanque con el siguiente resultado: 1.-Se realizó limpieza del entorno del tanque. 2.- Se instaló el sistema eléctrico (medidor, caja porta medidor, caja de seguridad, conduleta y cables reactivamente). 3.- Se realizó limpieza y mantenimiento de bomba trituradora. 4.- Se puso a funcionar la bomba para la disposición de las aguas residuales hacia la red de alcantarillado sanitario del ICAA y posterior tratamiento de la PTAR. Último punto que hasta contraviene con lo estatuido por dicho instituto como consta en lo informado por el Jefe de la Oficina Cantonal de Liberia. En suma, la ministra recurrida únicamente refiere acciones de hace más de dos años, omitiendo toda situación desde entonces, a pesar de que la recurrente acusa de nuevo la misma problemática persistente en el tiempo.

Ciertamente, no corresponde a la Sala determinar cuáles decisiones técnicas deben adoptarse, pero sí compeler a la autoridad recurrida a adoptarlas, coordinar ante las instituciones competentes y solucionar el problema. Se acota a dichos efectos que el Ministerio de Salud tiene potestades legales para intervenir y también la posibilidad de coordinar con otras instancias estatales, como la municipalidad del lugar y el ICAA, a fin de lograr una solución integral del problema por vías legales y aun en contra de la voluntad de los particulares. Para este Tribunal, el solo hecho de que la situación de desbordamiento y contaminación por aguas residuales fuera conocida por el ministerio accionado desde hace más de nueve años, sin que realizara las acciones necesarias para solucionar el problema de manera definitiva, conlleva necesariamente que el recurso sea acogido. De ahí que, en el presente caso, existe responsabilidad del Ministerio de Salud por omisión en el cumplimiento de sus deberes en tutela de la salud y el medio ambiente. En consecuencia, ante la falta de actuación diligente y efectiva, es que esta Sala estima se debe acoger el recurso en su contra.

Aparte de lo anterior, cualquier inconformidad con las denuncias presentadas (incluyendo falta de notificación) y que sustentaron los anteriores recursos de amparo, deberá la recurrente reclamarlo en esos asuntos.

  • 2)Sobre la responsabilidad de la Municipalidad de Liberia en los hechos acusados por la recurrente. Si bien en el presente asunto no se acreditó que la recurrente haya formulado ante la Municipalidad de Liberia, directamente, una denuncia por el problema ambiental que acusa, lo cierto es que atendiendo a su posición como garante de los intereses y servicios locales, a partir de lo regulado por el artículo 169 de la Constitución Política, así como por lo dispuesto en la jurisprudencia constitucional, no puede desentenderse de la situación que afecta a los vecinos de la localidad, y descargar sin más, toda la responsabilidad sobre el Ministerio de Salud y el ICAA. Sin lugar a duda, le es exigible haber mantenido una fiscalización y coordinación muchísimo más acuciosa, entre las diversas instancias competentes, pues tiene participación en los procesos constructivos en su cantón. Nótese que en el informe se trascribe lo indicado por el Gestor Ambiental en el sentido de que “esta unidad ambiental realizará inspección al lugar en conjunto con la unidad de Control Constructivo para darle seguimiento al caso y en las competencias de esta municipalidad proceder si fuese necesario”. Así las cosas, se estima procedente el recurso contra el gobierno local.
  • 3)Sobre la responsabilidad del ICAA en los hechos acusados. Como se indicó en la sentencia No. 2016-006368 antes reseñada, se estima que el ICAA no tiene responsabilidad en la problemática ambiental que aqueja a la recurrente, por cuanto la estación de bombeo de aguas residuales del residencial El Río no ha sido recibida formalmente por esa institución. Según se explica, esa situación le limita jurídicamente a intervenir e invertir recursos en dicho sistema, por encontrarse en el ámbito privado, quedando bajo la tutela y responsabilidad del Ministerio de Salud. Por ello, la competencia del ICAA se circunscribe a dos extremos: 1) Dar mantenimiento a las tapas de registro y reparación de fugas del colector del alcantarillado sanitario de su propiedad. 2) Presentar las denuncias por posibles conexiones ilícitas a dicho sistema. En ese sentido, no se logra acreditar ninguna responsabilidad directa que le sea reprochable al ICAA, por lo que el recurso debe ser desestimado.

VII.Conclusión. En reiterada jurisprudencia la Sala ha dicho que no se puede aceptar que a los seres humanos se les niegue el derecho a un ambiente sano ni el derecho a la salud debido a la incapacidad de las autoridades correspondientes para ejercer efectivamente las potestades de vigilancia y la solución a los problemas otorgadas por ley. En efecto, considera este Tribunal que la actividad estatal debe darse de manera coordinada y efectiva, pues no se trata simplemente de determinar el problema y endilgarle la responsabilidad a otros, como ha sucedido en este caso, ni tampoco corresponde que sea esta Sala quien asigne a cada entidad las soluciones que deben implementar; sino que, una vez valorado el asunto se debe dar una solución integral, para lo cual, bajo el sistema de distribución de competencias y funciones de un Estado, deben participar todos los involucrados, cada una aportando lo que en definitiva le corresponde.

De conformidad con lo expuesto, esta Sala determina que tanto la Municipalidad de Liberia como el Ministerio de Salud deben coordinar una solución definitiva al problema sanitario que -desde hace más de nueve años- afecta a la recurrente y respecto del cual esta es la tercera resolución que emite este Tribunal para su solución. En consecuencia, lo procedente es declarar con lugar el recurso contra ambas autoridades, como se expondrá en la parte dispositiva de esta sentencia. Respecto al ICAA, con sustento en lo expuesto, se desestima el recurso.

VIII. NOTA DEL MAGISTRADO SALAZAR ALVARADO

En asuntos ambientales, es también criterio del suscrito, de que si ya ha habido intervención de la Administración Pública, considero que su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que la parte recurrente acusa contaminación ambiental que provoca el mal funcionamiento del tanque de almacenamiento y tratamiento de aguas residuales de un residencial en Liberia, en detrimento de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.

IX.Voto salvado parcial de la magistrada Garro Vargas respecto a la parte dispositiva de esta sentencia. Si bien coincido con la mayoría de la Sala en que el recurso se debe declarar con lugar, difiero sobre dónde residenciar la fase de ejecución del asunto, debido a la inexistencia de mecanismos adecuados previstos por la normativa que rige esta jurisdicción constitucional para dar seguimiento a una sentencia que reviste aspectos técnicos de cierta complejidad, como es en este caso que, en el plazo de seis meses, contado a partir de la notificación de esta sentencia, el Ministerio de Salud y la Municipalidad de Liberia brinden una solución al problema denunciado por la recurrente. En cambio, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (artículo 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el artículo 56 de la Ley de Jurisdicción Constitucional, estimo que la fase de ejecución debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.

X.Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial No. 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara con lugar el recurso, únicamente, contra el Ministerio de Salud y la Municipalidad de Liberia. Se ordena a Mariela de los Ángeles Marín Mena y a José Javier Calvo Darcía, respectivamente, en su condición de Ministra de Salud en ejercicio y de Alcalde de Liberia o a quienes ejerzan tales cargos. que en forma coordinada giren las órdenes pertinentes y lleven a cabo todas las actuaciones que estén dentro del ámbito de sus competencias para que, dentro del plazo de seis meses, contado a partir de la notificación de esta sentencia, se brinde una solución integral y definitiva al problema de contaminación que aqueja a la recurrente Nombre91168. Se advierte a los recurridos, o a quienes ocupen sus cargos, que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo, y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.

Se condena al Estado y a la Municipalidad de Liberia al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a la presente declaratoria, los cuales se liquidarán en ejecución de sentencia de lo contencioso administrativo. En cuanto al Instituto Costarricense de Acueductos y Alcantarillados, se declara sin lugar el recurso. El magistrado Salazar Alvarado pone nota. La magistrada Garro Vargas salva el voto respecto a la ejecución de esta sentencia y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución, establecidos en los artículos 155 y siguientes del Código Procesal Contencioso Administrativo. Asimismo, ordena que se le remita copia de la sentencia para que se inicie los procedimientos de ejecución de este fallo. Notifíquese.
