WHEREAS:

1. 1Through a document added to the Chamber's digital expediente at 19:45 hours on September 19, 2025, the appellants filed an amparo appeal against the Municipality of San José and the Municipality of Goicoechea, stating that they are residents of the Mata de Plátano district, canton of Goicoechea. They explain that property N° 347263 is located there, with plan N° SJ-2238346-2020, encompassing twelve hectares, called Finca El Maderal. They indicate that this Finca El Maderal contains secondary forest and, apparently, even primary forest; moreover, it features streams, creeks (quebradas) and a water spring (naciente), and borders the Torres River. They state that currently, Finca El Maderal belongs to the Municipality of San José. They note that in 2024, the "Municipal Plan for Integrated Solid Waste Management of the Canton of Goicoechea" for the years 2025 to 2030 was approved, in which the following was indicated: "300,000,000 of municipal budget 2025.This budget could be expanded with 700,000,000 from the Municipality of San José budget (through an agreement) for investment in Finca El Maderal in Mata de Plátano for the construction of a Composting Plant + Recovery Center for Valuable Waste (Centro de Recuperación de Residuos Valorizables)." They state that, in June 2025, the Operational Directorate of the Municipality of San José initiated a Reduced Tender process, under No. 2025-0803164, for tree felling at Finca El Maderal, which states: "Service for contracting maintenance and cleaning of green areas (grass, weeds, and cutting of trees and shrubs) of 12 Ha 2513.59 m2, at Finca El Maderal, one month after cleaning, in permitted areas apply chemical weed controller that complies with current environmental regulations." They argue that in this Reduced Tender process, the Municipality of San José itself acknowledges the existence of forest, springs (nacientes), streams, and creeks (quebradas), by stating: "The objective of this tender being the adequate management of green areas that contain within their confines secondary forest, passing of streams, as well as creeks and a water spring." They state that this means this Reduced Tender, by ordering tree felling without specifying which or how many, could be authorizing the felling of at least 1,400 trees at Finca El Maderal, of which at least one hundred twenty have trunks measuring over fifteen centimeters.They allege this is because, in reality, the Municipality of San José and the Municipality of Goicoechea intend to install a Recovery Center for Valuable Waste on that property. They argue that, as of the day they file the amparo appeal, according to an inventory conducted by area residents, the property hosts, among others, the following tree species: Aguacate, Anona, Bizarro, Burio, Cachito, Café, Capulín, Caraigre, Cedro Dulce, Cedro Nogal, Colpachi, Dama, Duraznillo, Fresno, Guayaba, Guisaro, Guitite, Quizarrá, Higuerón, Jaúl, Dama or Huele Noche, Anonillo, Iguano, Manzana Rosa, Chaperno, Zorrillo, Piloncillo, Lengua de Vaca, Raspaguacal, Roble Encino, Roble, Roble Blanco, Tuete, Uruca, Yas, and Matasano. They contend that all these species serve as shelter for a large number of birds in the area. They add that Finca El Maderal is a twelve-hectare property, where the Municipality of San José itself acknowledges the existence of at least one spring, streams, and secondary forest.They argue that doubt arises as to whether recent studies have been carried out that allow affirmation that only secondary forest exists, or whether primary forest could even already exist at the site. They explain this is based on an inventory conducted by area residents, where the previously mentioned species are recorded. They mention that Article 3 of the Forestry Law (Ley Forestal) defines forest as: "d) Forest: Native or autochthonous ecosystem, intervened or not, regenerated by natural succession or other forestry techniques, occupying an area of two or more hectares, characterized by the presence of mature trees of different ages, species and varied size, with one or more canopies covering more than seventy percent (70%) of that area and where there are more than sixty trees per hectare of fifteen or more centimeters in diameter." They argue that this means, in a forest, there are approximately 1,400 trees that manage to cover at least 70% of the ground across two hectares, of which at least one hundred twenty have trunks over fifteen centimeters.They reiterate that this Reduced Tender, by ordering tree felling without specifying, could be authorizing the felling of at least 1,400 trees at Finca El Maderal, of which at least one hundred twenty have trunks over fifteen centimeters, and that this is only because the respondent municipalities actually intend to install a Recovery Center for Valuable Waste on that property. For the reasons stated, they request the Chamber's intervention in this matter.
2. 2By Presidential ruling at 19:20 hours on October 9, 2025, this proceeding was commenced and a hearing was granted to the mayor, the council president, and the director of the Technical Unit for Road Management (Unidad Técnica de Gestión Vial), all of the Municipality of San José; also, to the mayor, the council president, and the director of the Technical Unit for Road Management, all of the Municipality of Goicoechea; as well as to the minister and the director of the Goicoechea Health Governing Area, both of the Ministry of Health, regarding the facts alleged by the appellants.
3. 3In the proceedings followed, the legal requirements have been observed.

Magistrate Salazar Alvarado drafts; and,

CONSIDERING:

I.Due to the evident connection that exists between the facts alleged in the filing brief of this matter and those raised in the amparo appeal processed before this Chamber under expediente No. 25-027760-0007-CO, since both are related to the tree felling and the intended use of Finca El Maderal, in Goicoechea, to build a Recovery Center for Valuable Waste; and which, according to the appellants' statement, violates the right to a healthy and ecologically balanced environment, in order to avoid contradictory rulings, let this matter be consolidated with the indicated appeal.

II. DOCUMENTATION PROVIDED TO THE EXPEDIENTE

The party is warned that, if any paper documents have been provided, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic device or produced by new technologies, these must be withdrawn from the office within a maximum period of thirty working days counted from the notification of this judgment. Otherwise, all material not withdrawn within this period will be destroyed, in accordance with the provisions of the "Regulation on the Electronic Expediente before the Judicial Branch," approved by the Full Court in session No. 27-11 of August 22, 2011, Article XXVI, and published in the Judicial Bulletin number 19 of January 26, 2012, as well as the agreement approved by the Superior Council of the Judicial Branch, in session No. 43-12 held on May 3, 2012, Article LXXXI.

THEREFORE:

Let this matter be consolidated with the amparo appeal processed under expediente No. 25-027760-0007-CO.- Fernando Cruz C.

RESULTANDO:

1. 1Por escrito agregado al expediente digital de la Sala a las 19:45 horas del 19 de septiembre de 2025, la parte recurrente interpone recurso de amparo contra la Municipalidad de San José y Municipalidad de Goicoechea, y manifiesta que son vecinos del distrito Mata de Plátano, cantón de Goicoechea. Explican que en ese lugar se ubica la finca N° 347263, con el plano N° SJ-2238346-2020, de doce hectáreas de extensión, llamada Finca El Maderal. Indican que esa Finca El Maderal posee bosque secundario e, incluso, aparentemente primario; además, cuenta con el paso de riachuelos, quebradas y una naciente de agua, y colinda con el río Torres. Señalan que actualmente la Finca El Maderal, pertenece a la Municipalidad de San José. Acotan que, en el año 2024 se aprobó el “Plan Municipal de Gestión Integral de Residuos Sólidos del Cantón de Goicoechea”, para los años 2025 al 2030, en el cual se indicó lo siguiente: “300 000 000 de presupuesto municipal 2025” Este presupuesto podría ampliarse con 700 000 000 del presupuesto de la Municipalidad de San José (mediante convenio) para inversión en Finca El Maderal en Mata de Plátano para la construcción de una Planta de Compostaje + Centro de Recuperación de Residuos Valorizables”.Manifiestan que en, junio de 2025, la Dirección Operativa de la Municipalidad de San José inició un proceso de Licitación Reducida, bajo el nro. 2025-0803164, para la tala de árboles en la Finca El Maderal, en la que se indica: “Servicio de contratación de mantenimiento y limpieza de zonas verdes (zacate, maleza y corta de árboles y arbustos) de 12 Ha 2513,59 m2, en Finca El Maderal, un mes después de la limpieza, en áreas permitidas aplicar controlador químico de malezas que cumpla con la normativa ambiental vigente”. Esgrimen que, en este proceso de Licitación Reducida, la propia Municipalidad de San José reconoce la existencia de bosque, nacientes, riachuelos y quebradas, al señalar: “Siendo el objetivo de este concurso, el adecuado manejo de áreas verdes que contienen en sus confines, bosque secundario, paso de riachuelos, así como quebradas y una naciente de agua.”. Manifiestan que eso significa que esa Licitación Reducida, al ordenar la tala de árboles, pero sin especificar cuáles ni cuántos, podría estar autorizando talar en la Finca El Maderal un mínimo de 1.400 árboles, de los cuales al menos ciento veinte tienen más de quince centímetros de tronco.Alegan que eso, porque en realidad la Municipalidad de San José y la Municipalidad de Goicoechea pretenden instalar en esa finca un Centro de Recuperación de Residuos Valorizables. Aducen que, al día en que acuden en amparado, según un inventario realizado por vecinos de la zona, en la finca se ubican, entre otras, las siguientes especies de árboles: Aguacate, Anona, Bizarro, Burio, Cachito, Café, Capulín, Caraigre, Cedro Dulce, Cedro Nogal, Colpachi, Dama, Duraznillo, Fresno, Guayaba, Guisaro, Guitite, Quizarrá, Higuerón, Jaúl, Dama o Huele Noche, Anonillo, Iguano, Manzana Rosa, Chaperno, Zorrillo, Piloncillo, Lengua de Vaca, Raspaguacal, Roble Encino, Roble, Roble Blanco, Tuete, Uruca, Yas y Matasano. Arguyen que todas estas especies sirven de refugio para una gran cantidad de aves de la zona. Añaden que la finca El Maderal es una propiedad de doce hectáreas, donde la propia Municipalidad de San José reconoce la existencia de al menos una naciente, riachuelos y un bosque secundario.Aducen que surge la duda de si se han realizado estudios recientes que permitan afirmar que existe únicamente un bosque secundario, o si incluso ya podría existir en el sitio un bosque primario. Explican que eso según un inventario realizado por vecinos de la zona, donde se registran las especies mencionadas anteriormente. Menciona que el artículo 3, de la Ley Forestal, define el bosque como: “d) Bosque: Ecosistema nativo o autóctono, intervenido o no, regenerado por sucesión natural u otras técnicas forestales, que ocupa una superficie de dos o más hectáreas, caracterizada por la presencia de árboles maduros de diferentes edades, especies y porte variado, con uno o más doseles que cubran más del setenta por ciento (70%) de esa superficie y donde existan más de sesenta árboles por hectárea de quince o más centímetros”. Arguyen que eso significa que, en un bosque, existen aproximadamente 1.400 árboles que logran cubrir al menos el 70% del suelo de dos hectáreas, de los cuales al menos ciento veinte tienen troncos de más de quince centímetros.Reiteran que esa Licitación Reducida, al orden la tala de árboles, pero sin especificar, podría estar autorizando talar en la Finca El Maderal un mínimo de 1.400 árboles, de los cuales al menos ciento veinte tienen más de quince centímetros de tronco y eso sólo porque en realidad las municipalidades recurridas pretenden instalar en esa finca un Centro de Recuperación de Residuos Valorizables. Por los motivos expuestos, solicitan la intervención de la Sala en el presente asunto.
2. 2Por resolución de Presidencia de las 19:20 horas del 09 de octubre de 2025, se dio curso al presente proceso y se concedió audiencia al alcalde, al presidente del concejo y al director de la Unidad Técnica de Gestión Vial, todos de la Municipalidad de San José; además, al alcalde, al presidente del concejo y al director de la Unidad Técnica de Gestión Vial, todos de la Municipalidad de Goicoechea; así como al ministro y al director del Área Rectora de Salud de Goicoechea, ambos del Ministerio de Salud, sobre los hechos alegados por los recurrentes.
3. 3En los procedimientos seguidos se ha observado las prescripciones legales.

I.Por la evidente conexidad que existe entre los hechos que se alegan en el libelo de interposición de este asunto, y los que se plantean en el recurso de amparo que se tramita ante esta Sala bajo el expediente N° 25-027760-0007-CO, ya que ambos se encuentran relacionados con la tala de árboles y el uso que se le dará a la Finca El Maderal, en Goicoechea, para construir un Centro de Recuperación de Residuos Valorizables; y que, según el dicho de los recurrentes, atenta contra el derecho a un ambiente sano y ecológicamente equilibrado, a fin de evitar resoluciones contradictorias, acumúlese este asunto al recurso indicado.

II. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a la parte que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión N° 27-11 de 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial número 19 de 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.

POR TANTO:

Acumúlese el presente asunto al recurso de amparo que se tramita bajo el expediente N° 25-027760-0007-CO.- Fernando Cruz C.
