Writ of amparo (recurso de amparo) filed by Nombre91390, identity card CED51628, in her capacity as President with powers of unlimited general power of attorney (Apoderada Generalísima sin límite de suma) of the ASOCIACIÓN DE DESARROLLO INTEGRAL DE LA GARITA, and Nombre91391, identity card CED51629, in his capacity as President with powers of unlimited general power of attorney (Apoderado Generalísimo sin límite de suma) of the ASOCIACIÓN DE DESARROLLO ESPECIFICA DE LAGOS DEL COYOL, against the MUNICIPALIDAD DE ALAJUELA.
Facts:
Actions undertaken • Official Letter MA-PPCI-0798-2012: channelization was proposed, and the procurement of environmental services (servicios ambientales) was requested. • Official Letter MA-PPCI-0896-2023: a request was made to declare the technical solution to be in the public interest. • Official Letter MA-SCM-2203-2023: the Public Works Commission recommended proceeding with the project, although the Council rejected the expropriation required to install the pipeline from the channel located in a public area, through private properties, to the discharge point in the Santa Marta stream. 3. Limitations encountered • The Municipal Council’s refusal to declare the expropriation to be in the public interest prevented progress on the implementation of the project. • Nevertheless, the administration has continued seeking technical and legal alternatives to resolve the problem. 4. Current situation • A partial diversion of the channel was carried out in 2025 as a temporary measure. • The award process is underway for the concrete barrier, a structure that will prevent stormwater from mixing with water at the intake sites (sitios de captación) of the springs (nacientes). • There remains a need for a comprehensive solution requiring interinstitutional coordination and extraordinary resources. 5.
Institutional commitment The Infrastructure Planning and Construction Process reiterates its commitment to protecting water resources and public health and stands ready to cooperate with the judicial and administrative authorities in implementing the appropriate measures. 6. Complementary actions underway Additionally, as indicated, it is reported that Engineer Jeffry Alvarado Cruz, the Cantonal Risk Prevention and Management Promoter, who is part of the Infrastructure Planning and Construction Process under this Directorate, has arranged a procurement process for the installation of a containment barrier, the purpose of which is to divert the stormwater currently affecting the Los Herrera springs. This measure seeks to significantly mitigate the immediate impact while progress is made toward implementing a comprehensive solution. The barrier is designed to redirect the flow toward less vulnerable areas, significantly reducing the risk of infiltration and direct contamination at the water intakes.
It is also reported that this Directorate is currently conducting a feasibility and cost-benefit analysis regarding whether to request the required expropriation again, in order to make implementation of the stormwater-channelization and spring-protection project viable or, failing that, to propose an equivalent solution. This action responds to the urgent need to guarantee safe access to drinking water and to address the previously issued technical recommendations.” The reports submitted establish that the situation reported by the petitioners was already being addressed many years before notice of this proceeding was served. This was demonstrated by the technical opinion issued by Engineer Delgado Alpízar, because the Municipality identified the need to channel the stormwater affecting the spring at issue in this proceeding. It is established that, for years, the Municipality has worked on hydrological studies and technical designs, and permits were sought from SETENA and MINAE to channel the course of the Santa Marta stream; the channelization of those waters was proposed, and the procurement of environmental services was requested at the time.
Subsequently, in 2023, the Municipal Council was asked to declare the technical solution to be in the public interest, whereupon, by resolution of the Municipal Council, Official Letter Nº MA-SCOP-51-2023 was accepted, but the request to declare the expropriation to be in the public interest was denied, as may be seen below (information available in ordinary minutes N° 35-2023celebrada by this Corporation of the Central Canton of Alajuela, at eighteen hundred hours on Tuesday, August 29, 2023) (…) However, it should be noted that the Municipal Council’s refusal to declare the expropriation to be in the public interest, according to the technical opinion issued, did not prevent the administration from continuing to seek alternatives to resolve the problem. Despite that setback, a partial diversion of the channel was carried out as a temporary measure, and the award process is currently underway for the concrete barrier, which is the structure that will prevent stormwater from mixing with water at the springs’ intake sites.
In addition, the Cantonal Risk Prevention and Management Promoter has arranged a procurement process for the installation of a containment barrier, the purpose of which is to divert the stormwater currently affecting the Los Herrera springs. The foregoing is being done with the aim of significantly mitigating the immediate impact while progress is made toward implementing a comprehensive solution, since that barrier is designed to redirect the flow toward less vulnerable areas, reducing the risk of infiltration and direct contamination at the water intakes. Furthermore, with the cooperation of the Infrastructure Planning and Construction Department, the Municipality is conducting a feasibility and cost-benefit analysis regarding whether to request the required expropriation again, in order to make implementation of the stormwater-channelization and spring-protection project viable, with the aim of guaranteeing safe access to drinking water and addressing the relevant technical recommendations.
The foregoing also establishes that the subjective assertions made by the petitioners are untrue insofar as they state that “(…) And currently the problem has worsened, and the authorities have not undertaken effective implementation efforts to resolve the problems involving contamination of the springs (…)” and that “(…) They presume that there has been technical, legal, and administrative incapacity on the part of the Municipality, as well as a lack of willingness to implement the necessary solutions, with the constant threat to the springs and the drinking-water supply continuing (…)”; rather, what this demonstrates is a complete lack of knowledge of the internal processes that must be carried out at the municipal level concerning these specific matters, which are extremely complex and exhaustive. It is established—and the petitioners themselves acknowledge—that the municipal administration has always kept them informed of the situation, making clear that actions have indeed been taken to remedy the problem that arose; however, circumstances beyond our control have occurred, which is why the administration declared itself “unable” to proceed.
It should be clarified, however, that this was not due to any arbitrary decision by the administration; rather, it is established that the Municipal Council rejected an important application required for the project to continue. It is important to mention that the evidence demonstrates there has been no omission or “inaction” by the Municipality. Nevertheless, through their subjective assertions, the petitioners once again demonstrate a clear lack of knowledge of the internal administrative procedures that must be followed within this Municipality—procedures intended to comply with the applicable legal requirements while respecting the authority of each corresponding body (…)”. They request that the petition be dismissed.
Justice Araya García delivers the opinion; and,
Whereas:
I.Preliminary Issue. Before analyzing the merits of the matter—concerning the alleged violation of the right to prompt and full proceedings (derecho a un procedimiento pronto y cumplido)—it must be clarified that, since judgment No. 2008-02545 at 8:55 on 22 de febrero de 2008, this Chamber has referred to the administrative-law jurisdiction (jurisdicción contencioso administrativa)—with some exceptions—those matters in which it is disputed whether the public administration has complied with the time limits established by the Ley General de la Administración Pública (articles 261 and 325) or by sector-specific laws governing special administrative proceedings, for the issuance of a final administrative decision in an administrative proceeding—initiated ex officio or at the request of a party—or for hearing the applicable administrative appeals (recursos administrativos). This case specifically presents an exceptional circumstance, because it concerns an environmental complaint regarding contamination of a spring (naciente), which allegedly has not been resolved within a reasonable time by the respondent authorities. Having clarified this point, the Chamber proceeds to rule on the specific situation raised in this amparo proceeding (amparo).
II.Subject Matter of the Appeal. The petitioners allege that, since 2012, they have filed complaints with the Municipalidad de Alajuela regarding the ongoing contamination of drinking water, springs, and water intakes supplied by the spring known as “Los Herrera.” They assert that, as of the date on which they filed this appeal, the complaint had not been definitively resolved by the respondent authorities, which they consider a violation of their fundamental rights.
Por tanto, to eliminate this risk, the existing chambers were repaired and raised so that the water levels during a possible flood would not exceed the height of those chambers. • Because some of the metal covers on the inspection chambers were in poor condition, they were repaired or completely replaced and were also secured with bolts. This prevents any unauthorized entry by surface water, animals, or persons. 4. However, the protective works completed allow the Municipalidad de Alajuela to ensure that the water from the Los Herrera Spring will not be contaminated by runoff from the area, vandalism, or animals approaching the stream to drink water. 5. Nevertheless, the present case involves a volume of stormwater that cannot be controlled solely through the works completed by the Acueducto, because, as I have indicated, this is a storm-sewer problem and one involving permits granted in the industrial zone without considering the capacity of the existing stormwater infrastructure. 6.
In addition, the Acueducto Municipal, through its civil-maintenance crew, performs annual preventive and corrective maintenance on the springs, including the Los Herreras Springs, pursuant to the attached work orders (see annexes, page 1 through page 60), copies of which are attached. 7. It is important to emphasize that, in agosto de 2024, this department began processing tender N° 2024LY-000004-0000500001, ‘Installation of Drinking-Water Transmission and Distribution Networks of Indeterminate Value,’ under which it was planned to replace the transmission pipelines from the Los Herreras Springs, since they had already reached the end of their useful life, in order to prevent any potential future risk of contamination. Accordingly, the requested reconsideration of the technical analysis was conducted by the comptroller’s office, and that document is currently with the Proveeduría Municipal for final preparation of the award process, to be forwarded to the Honorable Concejo Municipal for approval. 8.
Lastly, this department is willing and committed to providing quality service to our users in compliance with the regulations governing water quality currently in force; however, in response to the problem, the Acueducto Municipal has conducted physicochemical and microbiological analyses of the Los Herrera System, according to reports AG-351-2025 and AG-433-2025, which are attached” (see report submitted by the respondent authority and evidence submitted to the case file).
IV.The Specific Case. In the case at bar (sub lite), the petitioners allege that, since 2012, they have filed complaints with the Municipalidad de Alajuela regarding the ongoing contamination of drinking water, springs, and water intakes supplied by the spring known as “Los Herrera.” They assert that, as of the date on which they filed this appeal, the complaint had not been definitively resolved by the respondent authorities, which they consider a violation of their fundamental rights.
In this regard, this Chamber finds that, in the specific case, there is indeed evidence of a complaint filed with the Municipalidad de Alajuela by the petitioners on several occasions: first during 2012, and subsequently on 10 de mayo de 2020, 5 de enero de 2024, and 4 de junio de 2024, concerning the contamination affecting the “Los Herrera” spring, a situation of which the respondent municipal authorities have been fully aware for 13 years.
Indeed, it was verified that, although the respondent authorities had been aware of the reported situation since 2012 and had attempted to take action to correct the problem, it is nonetheless true that, as of the filing date of this proceeding, the complaint had not been definitively addressed. It was also established that the authorities are aware that the work performed in the past does not in any way resolve the problem at issue, since they acknowledge in the report submitted to this Chamber that: “1. Initially, the conflict arose because buildings in the El Coyol industrial zone discharge their stormwater (aguas pluviales) through a ‘drain’ (caño) that lacked the capacity for that purpose. 2. As previously reported, the problem is compounded because it also affects the service provided by the Municipal Water Utility to the residents of La Garita and Lagos del Coyol, since this stormwater reaches very close to the sources from which the Municipality draws water and, because the receiving water body (cuerpo receptor) lacks sufficient capacity to discharge it, the land floods precisely where the Los Herrera Spring (Naciente Los Herrera) is located, jeopardizing the potability of the water from the captured sources. 3.
This Municipal Water and Sewerage Department carried out a project to construct protective works for the Los Herrera Spring; the work was satisfactorily completed in accordance with the specifications of abbreviated tender N° 2011LA-00006-01. • This work consisted of providing protection both against unscrupulous persons and against possible surface contamination from stormwater or wastewater (aguas servidas). • To prevent persons from entering the inspection chambers (cajas de registro) of the water intakes (captaciones), concrete walls and chain-link fencing were constructed around them, with access permitted only through a gate secured by its corresponding padlock. • The most likely points of entry for surface runoff (escorrentía superficial) resulting from a flooding event were precisely the inspection chambers for the water intakes and collection tanks. Por tanto, to eliminate this risk, the existing chambers were repaired and raised so that water levels during a possible flood would not exceed the height of these chambers. • Because some of the metal covers on the inspection chambers were in poor condition, they were repaired or entirely replaced and were also secured with screws.
This prevents any improper entry of surface water, animals, or persons. 4. However, the protective works performed allow the Municipalidad de Alajuela to ensure that the water from the Los Herrera Spring will not be contaminated by runoff from the surrounding area, vandalism, or animals approaching the creek to drink water. 5. Nevertheless, the case before us involves a volume of stormwater that cannot be controlled solely through the works performed by the Water Utility because, as I have stated, this is a storm-sewer problem involving permits granted in the industrial zone without taking into account the capacity of the existing stormwater infrastructure. 6. Furthermore, through its civil-maintenance crew, the Municipal Water Utility performs annual preventive and corrective maintenance on the springs, including the Los Herreras Springs, pursuant to the attached work orders (see appendices, page 1 through page 60), copies of which are attached. 7.
It is important to emphasize that, in August 2024, this department began processing tender N° 2024LY-000004-0000500001, ‘Installation of Indeterminate-Value Potable-Water Conveyance and Distribution Networks,’ through which it planned to replace the conveyance pipelines originating at the Los Herreras Springs, since they have already reached the end of their useful life, in order to prevent any possible future risk of contamination. Accordingly, the technical analysis requested by the Office of the Comptroller was reconsidered, and that document is currently with the Municipal Procurement Office for final preparation of the award process so that it may be submitted to the Honorable Concejo Municipal for approval.” Additionally, it was established that the Infrastructure Planning and Construction Department of the Municipalidad de Alajuela “is in the process of awarding the contract for the concrete barrier, a structure that will prevent stormwater from mixing with water at the spring-intake sites. • There remains a need for a comprehensive solution requiring interinstitutional coordination and extraordinary resources” (emphasis not in the original).
In this regard, although this constitutional jurisdiction understands that this is a longstanding problem and that it has been addressed by the respondent authorities in the past, it is nonetheless true that the proceedings intended to provide a definitive solution to the complaint are currently in the contract-award and tendering stages, and the municipal authorities do not provide, in the report submitted to this Chamber, an estimate of when the described situation will be resolved. For this reason, this Constitutional Court must intervene to protect the residents of the area who are being affected by the contamination of the “Los Herrera” spring and the lack of potability of the water they consume.
Accordingly, this Chamber finds that the period that has elapsed for the respondent authorities to resolve the complaint filed by the protected party and provide the corresponding notice is disproportionate, since more than ten years have passed since the appellants filed their first complaint, without its having been resolved to date, with the aggravating circumstance that the alleged harm reported remains ongoing. Under this reasoning, this Chamber considers that the petition must be granted, subject to the considerations set forth in the operative portion of this judgment.
In environmental matters, it is the undersigned Justice’s view that, if the Public Administration has already intervened, jurisdiction to hear and decide the matter lies with the administrative litigation jurisdiction (jurisdicción contenciosa administrativa). Nevertheless, I do consider the merits of the matter when other rights of the persons affected by the source of contamination are at stake, including health, quality of life, and the right to enjoy a healthy environment free from pollution (artículo 50, de la Constitución Política), as occurs in this case, in which the appellants allege the presumed contamination of potable water, springs, and water intakes supplied by the spring known as “Los Herrera,” located in the district of La Garita. They state that, since 2012, they have filed complaints with the Municipalidad de Alajuela without obtaining an effective solution.
The situation described constitutes an exception to my general position on this subject. I therefore consider it necessary for this Constitutional Court to examine the merits of the matter in order to verify or reject the appellants’ allegations.
VI.Documentation submitted to the case file (expediente). The party is hereby advised that, if it submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device or produced using new technologies, these must be retrieved from the Clerk’s Office within a maximum period of 30 business days from service of this judgment. Otherwise, any material not retrieved within that period shall be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session No. 27-11 of 22 de agosto de 2011, artículo XXVI, and published in Boletín Judicial number 19 of 26 de enero de 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session No. 43-12 held on 3 de mayo de 2012, artículo LXXXI.

The petition is granted. Roberto Hernán Thompson Chacón and Roy Delgado Alpízar, respectively Alcalde and Director de Planeamiento y Construcción de Infraestructura Municipal, both of the Municipalidad de Alajuela, or whoever holds those offices, are ordered to take the actions within the scope of their authority and establish the measures and coordination necessary so that, within a maximum period of six months from service of this judgment, the contracts and works deemed necessary are carried out and the relevant administrative measures and decisions are adopted to address the complaint filed by the appellants, and the appellants are duly notified. The respondents are warned that failure to comply with this order will constitute the criminal offense of disobedience and that, pursuant to artículo 71 of the Ley de esta jurisdicción, any person who receives an order issued in an amparo proceeding that the person is required to comply with or enforce, and who fails to comply with or enforce it, shall be sentenced to imprisonment for three months to two years, or a fine of twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty.
The Municipalidad de Alajuela is ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment before the administrative litigation jurisdiction. I.Cuestión Preliminar. De previo a analizar el fondo del asunto -por la presunta violación del derecho a un procedimiento pronto y cumplido- debe aclararse que, a partir de la sentencia No. 2008-02545 de las 8:55 horas de 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa -con algunas excepciones-, aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo -instruido de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes. Precisamente, en este caso, se plantea un supuesto de excepción, pues, se está ante una denuncia ambiental por contaminación de una naciente, la cual, presuntamente, no ha sido resuelta dentro de un plazo razonable por parte de las autoridades recurridas. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.
II.Objeto del recurso. Alegan los recurrentes que desde el año 2012 denunciaron ante la Municipalidad de Alajuela, por los problemas de contaminación constante del agua potable, de las nacientes y tomas de agua proveniente de la naciente conocida como “Los Herrera”. Aseguran que, a la fecha en que presentan este recurso, la denuncia no ha sido resuelta de manera definitiva por parte de las autoridades recurridas, lo que estima lesivo de sus derechos fundamentales.
III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
Por tanto, para eliminar este riesgo, se procedió a reparar las cajas existentes y también hacerlas más altas, para que los niveles de agua frente a una posible inundación no sobrepasaran la altura de estas cajas. • Dado que algunas de las tapas metálicas de las cajas de registro se encontraban en mal estado, se procedió a reparar o sustituir del todo las mismas, además de asegurarlas con Tornillo. Esto previene cualquier acceso indebido tanto de agua superficial, animales o personas. 4. Sin embargo, las obras de protección ejecutadas lo que permite a la Municipalidad de Alajuela es asegurar que el agua de la Naciente Los Herrera no será contaminada por las aguas de escorrentía propias de la zona, ni por vandalismo, o por los animales que se acercan a tomar agua en la quebrada. 5. No obstante, el caso que nos ocupa trata de una cantidad de agua pluvial que no es posible controlar con solo las obras realizadas por el Acueducto, pues como lo he indicado, se trata de un problema de alcantarillado pluvial y de permisos que se otorgaron en la zona industrial, sin tomar en consideración la capacidad de infraestructura pluvial existente. 6.
Por otra parte, el Acueducto Municipal mediante la cuadrilla de mantenimiento civil realiza de forma anual mantenimientos preventivos y correctivos de las nacientes, entre ellas las Nacientes Los Herreras, según ordenes de trabajos adjuntas (ver anexos página 1 a página 60), las cuales se adjunta copia. 7. Es importante recalcar que este proceso en agosto de 2024 comenzó a gestionar el proceso de licitación N° 2024LY-000004-0000500001 “Instalación de Redes de Conducción y Distribución de Agua Potable Cuantía Inestimable”, mediante la cual se planificó cambiar las tuberías de conducción provenientes de la Nacientes Los Herreras, dado que las mismas ya cumplieron su vida útil y con el fin evitar a futuro cualquier posible riesgo de contaminación, así las cosas se realizó la reconsideración del análisis técnico solicitado por la contraloría, y dicho documento actualmente se encuentra en Proveeduría Municipal en la elaboración final del proceso de adjudicación para ser remitido al Honorable Concejo Municipal para su aprobación. 8.
Por ultimo este Proceso esta anuente y comprometido por brindar un servicio de calidad a nuestros usuarios en apego a la reglamentación de la calidad del agua vigente, sin embargo, ante la problemática el Acueducto municipal ha realizado análisis físicos-químicos y microbiológicos del Sistema Los Herrera, según reportes AG-351-2025 y AG-433-2025 mismos que se adjuntan” (ver informe rendido por la autoridad recurrida y prueba aportada al expediente).
IV.Sobre el caso concreto. En el sub lite, la parte recurrente acusa que desde el año 2012 denunciaron ante la Municipalidad de Alajuela, por los problemas de contaminación constante del agua potable, de las nacientes y tomas de agua proveniente de la naciente conocida como “Los Herrera”. Aseguran que, a la fecha en que presentan este recurso, la denuncia no ha sido resuelta de manera definitiva por parte de las autoridades recurridas, lo que estima lesivo de sus derechos fundamentales.
Al respecto, esta Sala verifica que, en el caso concreto, efectivamente, se tiene conocimiento de una denuncia realizada ante la Municipalidad de Alajuela por parte de los recurrentes en diferentes momentos, la primera durante el año 2012, y posteriormente, el 10 de mayo de 2020, 5 de enero de 2024 y el 4 de junio de 2024, por el problema de contaminación que se da en la naciente “Los Herrera”, situación que es de pleno conocimiento de las autoridades municipales recurridas desde hace 13 años.
Ciertamente, se pudo verificar que, pese a que las autoridades recurridas tuvieron conocimiento de la situación denunciada desde el año 2012 y han intentado realizar actuaciones para corregir la problemática, no menos cierto es que, a la fecha de presentación de este recurso no se había atendido de manera definitiva la denuncia e incluso, se pudo comprobar que, las autoridades son conscientes de que los trabajos realizados en el pasado, no solucionan de manera alguna la problemática en cuestión, puesto que, reconocen en el informe rendido ante esta Sala que “1. Inicialmente el conflicto se presentó dado que existen construcciones en la zona industrial de El Coyol, evacuando sus aguas pluviales por medio de un “caño” que no contaba con capacidad para tal actividad. 2. Como ya se ha informado, el problema se acrecienta debido a que también afecta el servicio que brinda el Acueducto Municipal a los vecinos de La Garita y de Lagos del Coyol, pues dichas aguas pluviales llegan muy cerca de las fuentes que capta la Municipalidad y como el cuerpo receptor no cuenta con capacidad suficiente para evacuarlas, justo en donde está la Naciente Los Herrera el terreno se inunda, poniendo en riesgo la potabilidad del agua de las fuentes captadas. 3.
Este Proceso de Acueductos y Alcantarillados Municipales llevó a cabo un proyecto para construcción de obras de Protección de la Naciente Los Herrera; trabajo que fue concluido de forma satisfactoria, según lo establecido en el cartel de la licitación abreviada N° 2011LA-00006-01. • Dichos trabajos consistieron en brindar, tanto protección contra personas inescrupulosas, así como protección contra posible contaminación superficial de aguas pluviales o servidas. • Para impedir al ingreso de personas a las cajas de registro de las captaciones, se construyeron muros de concreto y malla ciclón rodeando las mismas, con accesos únicamente mediante portón con su respectivo candado. • Los puntos más probables de ingreso de escorrentía superficial, debido a algún evento de inundación eran precisamente las cajas de registro de las captaciones y de los tanques de reunión. Por tanto, para eliminar este riesgo, se procedió a reparar las cajas existentes y también hacerlas más altas, para que los niveles de agua frente a una posible inundación no sobrepasaran la altura de estas cajas. • Dado que algunas de las tapas metálicas de las cajas de registro se encontraban en mal estado, se procedió a reparar o sustituir del todo las mismas, además de asegurarlas con Tornillo.
Esto previene cualquier acceso indebido tanto de agua superficial, animales o personas. 4. Sin embargo, las obras de protección ejecutadas lo que permite a la Municipalidad de Alajuela es asegurar que el agua de la Naciente Los Herrera no será contaminada por las aguas de escorrentía propias de la zona, ni por vandalismo, o por los animales que se acercan a tomar agua en la quebrada. 5. No obstante, el caso que nos ocupa trata de una cantidad de agua pluvial que no es posible controlar con solo las obras realizadas por el Acueducto, pues como lo he indicado, se trata de un problema de alcantarillado pluvial y de permisos que se otorgaron en la zona industrial, sin tomar en consideración la capacidad de infraestructura pluvial existente. 6. Por otra parte, el Acueducto Municipal mediante la cuadrilla de mantenimiento civil realiza de forma anual mantenimientos preventivos y correctivos de las nacientes, entre ellas las Nacientes Los Herreras, según ordenes de trabajos adjuntas (ver anexos página 1 a página 60), las cuales se adjunta copia. 7.
Es importante recalcar que este proceso en agosto de 2024 comenzó a gestionar el proceso de licitación N° 2024LY-000004-0000500001 “Instalación de Redes de Conducción y Distribución de Agua Potable Cuantía Inestimable”, mediante la cual se planificó cambiar las tuberías de conducción provenientes de la Nacientes Los Herreras, dado que las mismas ya cumplieron su vida útil y con el fin evitar a futuro cualquier posible riesgo de contaminación, así las cosas se realizó la reconsideración del análisis técnico solicitado por la contraloría, y dicho documento actualmente se encuentra en Proveeduría Municipal en la elaboración final del proceso de adjudicación para ser remitido al Honorable Concejo Municipal para su aprobación”. Adicionalmente, se tuvo por acreditado que, el Proceso de Planeamiento y Construcción de Infraestructura de la Municipalidad de Alajuela “está en proceso de adjudicación de la pantalla de concreto, estructura que evitará la mezcla de las aguas pluviales con las de los sitios de captación de las nacientes. • Se mantiene la necesidad de una solución integral que requiere coordinación interinstitucional y recursos extraordinarios” (el resaltado no pertenece al original).
En este sentido, si bien esta jurisdicción constitucional comprende que se trata de un problema de larga data y que ha sido atendido por las autoridades recurridas en el pasado, no menos cierto es que, actualmente los procesos para brindar una solución definitiva a la denuncia planteada se encuentra en proceso de adjudicación y de licitación y las autoridades municipales no brindan en el informe rendido ante esta Sala un aproximado de cuándo será solucionada la situación descrita, razón por la cual, este Tribunal Constitucional debe intervenir en aras de proteger a los vecinos de la zona que se están viendo afectados por la contaminación de la naciente “Los Herrera” y de la falta de potabilidad en el agua que consumen.
En consecuencia, estima esta Sala que el plazo que ha transcurrido para resolver la denuncia planteada por la parte tutelada y comunicarle lo respectivo por parte de las autoridades recurridas es desproporcionado, por cuanto, ha transcurrido un plazo de, más de diez años, desde la presentación de la primera denuncia por parte de los recurrentes, sin que a la fecha esta haya sido resuelta, con el agravante que la presunta afectación denunciada continúa vigente. Bajo esta inteligencia, considera esta Sala que el recurso debe ser declarado con lugar, con las consideraciones que se dirán en la parte dispositiva de esta sentencia.
En asuntos ambientales, es criterio del suscrito, que, si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que los recurrentes denuncian la presunta contaminación, del agua potable, de las nacientes y tomas de agua proveniente de la naciente conocida como “Los Herrera”, ubicada en el distrito de La Garita. Aducen que desde el año 2012, han planteado denuncias ante la Municipalidad de Alajuela, sin obtener una solución efectiva.
La situación descrita constituye una excepción a mi posición general en esta materia, por lo que estimo necesario que este Tribunal Constitucional analizara por el fondo el asunto, con el fin de verificar o descartar los alegatos de la parte recurrente.
VI.Documentación aportada al expediente. Se previene a la parte que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 de 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial número 19 de 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.
Por tanto:
Se declara con lugar el recurso. Se ordena a Roberto Hernán Thompson Chacón y Roy Delgado Alpízar, por su orden Alcalde y Director de Planeamiento y Construcción de Infraestructura Municipal, ambos de la Municipalidad de Alajuela, o a quienes ocupen el cargo, que realicen las actuaciones que estén dentro del ámbito de sus competencias y establezcan las acciones y coordinaciones necesarias, para que en el plazo máximo de seis meses contados a partir de la notificación de esta sentencia, se ejecuten las contrataciones y obras que se estime necesarias y se adopten las medidas y resoluciones administrativas pertinentes, para atender la denuncia planteada por los recurrentes y se les comunique lo que corresponda. Se les advierte a los recurridos que, de no acatar la orden dicha, incurrirán en el delito de desobediencia y, que de conformidad con el artículo 71 de la Ley de esta jurisdicción, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.
Se condena a la Municipalidad de Alajuela al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. El Magistrado Salazar Alvarado consigna nota. Notifíquese.- Fernando Cruz C.
