Application for amparo (recurso de amparo) being processed under expediente número 25-019844-0007-CO, filed by Nombre01, identification card CED01, against the MINISTERIO DE SALUD (MS) and the MUNICIPALIDAD DE PARAÍSO.

Findings:

  1. 1In a written submission received and entered into the case file at 14:55 hours on 08 de julio de 2025, the petitioner filed an application for amparo against the MINISTERIO DE SALUD and the MUNICIPALIDAD DE PARAÍSO, stating that she lives with her mother—an older adult—and her two children—minors—in a home acquired through a social housing subsidy, located quinientos metros east of the Delegación de Policía de Cachí de Paraíso de Cartago. On the west side of her property there is an open ditch through which wastewater (aguas residuales) from several neighboring homes flows, discharging untreated into a watercourse (cauce) north of her property and causing open-air sewage (aguas negras) to pool. The wastewater from her home is channeled separately. Since 2023, she has made requests to the respondent local government seeking intervention regarding the sanitary conditions caused by the ditch.At the time, then-mayor Carlos Ramírez Sánchez told her that her request could not be addressed due to a lack of resources and time. She subsequently approached the Ministerio de Salud, which conducted an on-site inspection and, on 24 de abril de 2023, issued a health order (orden sanitaria) to the respondent municipality, warning that the accumulation of wastewater posed a risk to public health. However, it withdrew that order after the authorities of the respondent ministry stated that they could not intervene because the property was privately owned. At the beginning of 2025, she again appeared before the respondent local government, this time before Mayor Michael Álvarez Quirós, who verbally undertook to visit the property and seek a solution, an undertaking that has not been fulfilled to date. On 8 de abril of this year, she filed the corresponding environmental complaint (denuncia ambiental) with both respondent authorities (see evidence submitted).She alleges that the sanitary conditions resulting from the ditch have directly affected her family’s health, causing digestive and respiratory illnesses, infestation by botfly larvae, and constant insect bites and that, during the dry season, the proliferation of flies and mosquitoes becomes uncontrollable. She states that she lacks the financial means to pay for sewer works or the piping of the ditch. The ditch currently discharges the wastewater directly onto an adjoining coffee-growing property, creating a permanent pool of sewage, which entails broader environmental pollution and potential harm to third parties. She considers the foregoing to violate her fundamental rights.
  2. 2Carlos Granados Siles, in his capacity as Director del Área Rectora de Salud de Paraíso, reports under oath that

“(…) a) On 9 agosto 2023, Nombre01 submitted a written request to the Dirección Área Rectora Salud Paraíso seeking the withdrawal of her complaint because the reported events were not occurring on municipal property but rather on her own property (the referenced written request is attached).

  • b)In view of the foregoing, on 24 agosto 2023, official letter N° MS-DRRSCE-DARSP0894-2023, which I attach, was served on Nombre01, informing her that her case would be closed and, consequently, placed in the corresponding archive (…)
  • a)On 22 agosto 2025, a sanitary inspection (inspección sanitaria) was conducted (technical report N° CARTA-MS-DRRSCE-DARSP-IT-0601-2025 is attached) at Nombre01’s property, where water conveyance was observed in the area that Nombre01 identifies as her property. At the beginning of the conveyance, it lacks an enclosure; a subsequent section is enclosed by a gutter; and the final part of the conveyance has a damaged section, causing water to seep out and flow into the yard of her home. Nombre01 states that the deterioration of this final section of the gutters was caused by a neighbor and that this matter is currently the subject of judicial proceedings because of the damage caused. b) During the sanitary inspection, the reported water appeared clear and contained no solid materials; however, at one point, an odor characteristic of wastewater was detected. The water flows freely, and no pooling of water or disease vectors (vectores) were observed at the site; during the assessment, weather conditions were stable, with no rain, and it was determined that a significant quantity of water was flowing.

However, no body of water running through that area was observed. c) Nombre01 was asked whether she had any indication of who might be discharging wastewater at the site, for the purpose of conducting the corresponding dye tests (pruebas de coloración), to which she replied that she was not certain who they might be. She was also asked about the existence of this water channel across her property, to which she responded that she believes it was built by the Municipalidad and therefore contends that it is responsible for maintaining it.

d) Following an analysis of the matters stated in the preceding three points, it is unclear whether a duly registered drainage easement (servidumbre de paso de aguas) exists on the petitioner’s property or, alternatively, whether there is any formal agreement with the municipal agency concerning the conveyance of water across the complainant’s property, and whether stormwater (aguas pluviales) is being properly managed in the area. It is also necessary to ascertain the names of the owners of the homes that may be connecting their wastewater outlets to that channel so that the corresponding tests may be conducted and compliance or noncompliance with the sanitary regulations currently governing this matter may be verified. e) In view of the foregoing and with the aim of resolving the reported problem, the Municipalidad de Paraíso will be asked to submit, within 20 dias, a report on the current condition of the stormwater drainage system (sistema de evacuación de las aguas pluviales) in the area, also taking into account the water flowing across the complainant’s property. The report will be requested to examine the municipal agency’s responsibility for managing that water and to consider whether there may be a potable-water leak causing this water to flow at the site. We will keep the honorable Sala Constitucional duly informed (…)” (Sic).

He requests that the application be denied.

  1. 3Michael Álvarez Quirós, in his capacity as mayor of the Municipalidad de Paraíso, submits a report stating that:

“(…) FIRST: The petitioner alleges harm to health, pointing to the presence of wastewater near her property, as well as the existence of a health order previously issued against the Municipalidad. SECOND: That order was subsequently withdrawn because it was determined that the Municipalidad could not intervene since the land was privately owned. THIRD: A search conducted in the Sistema Nacional de Información para la Gestión Integrada de los Recursos Hídricos (SINIGIRH) identified opinion DA-UHCAROC-0417-2024, which determined that: There is a channel carrying domestic wastewater (aguas servidas) from homes located upstream, as well as stormwater from higher properties, which flows into the watercourse of the río Zapote. No natural water sources were identified. The watercourse has earthen sections and sections channeled in concrete. FOURTH: Because the wastewater is of unknown origin and is located on private properties, the Municipalidad cannot intervene directly using public funds, pursuant to the principle of legality (principio de legalidad) and the legal regime governing the public domain (régimen jurídico del dominio público).

FIFTH: According to technical criteria, fluorescein tests (pruebas de fluoresceína) must be conducted to determine the origin of that water, which falls within the authority of the Ministerio de Salud (...)”. He requests that the application be dismissed.

  1. 4The statutory requirements have been observed in the proceedings conducted.

Justice Salazar Alvarado authored the opinion; and,

Considerations:

I. PRELIMINARY ISSUE

Before examining the merits of the matter—concerning the alleged violation of the right to prompt and proper proceedings (derecho a un procedimiento pronto y cumplido)—it must be clarified that, since Judgment N° 2008-02545 of 8:55 hours on 22 de febrero de 2008, this Sala has referred to the administrative litigation jurisdiction (jurisdicción contencioso administrativa)—with some exceptions—those matters in which it is disputed whether the public administration complied with the deadlines established by the Ley General de la Administración Pública (artículos 261 y 325) or by sector-specific laws governing special administrative proceedings, either to conclude an administrative proceeding—initiated ex officio or at the request of a party—through a final administrative act (acto final), or to hear the applicable administrative appeals (recursos administrativos). This case presents precisely such an exception because it concerns an environmental complaint involving apparent pollution problems at her residence, and this Sala has continued to admit for review matters involving an alleged violation of the right to the environment. Having clarified this point, the Court proceeds to rule on the specific situation raised in this amparo proceeding.

II. SUBJECT MATTER OF THE APPLICATION

The petitioner states that she is a resident of Paraíso de Cartago and that there is an open ditch at her home through which wastewater from neighboring homes flows, causing sewage to pool. She states that she has asked the municipality to intervene in her situation, but this has not been possible. She adds that, on 24 de abril de 2023, the Ministerio de Salud conducted an on-site inspection and issued a health order to the respondent municipality. She states that she filed an environmental complaint in April of this year. She considers her fundamental rights to have been violated.

III.Proven facts. The following facts are deemed duly established and relevant to the resolution of this matter, either because they have been proven or because the respondent failed to address them as required in the initial order:

  • a)On 9 agosto 2023, the petitioner submitted a written request to the Dirección Área Rectora Salud Paraíso seeking the withdrawal of her complaint because the reported events were not occurring on municipal property but rather on her own property (see the report submitted by the Director del Área de Salud and the evidence provided).
  • b)Due to the withdrawal of the complaint, on 24 agosto 2023, official letter N° MS-DRRSCE-DARSP0894-2023 was served on the petitioner, informing her that her case would be closed and, consequently, placed in the corresponding archive (see the report submitted by the Director del Área de Salud and the evidence provided).
  • c)On 08 de abril de 2025, the petitioner filed a complaint with the Municipalidad de Paraíso and the Área de Salud de Paraíso concerning environmental and sanitary harm caused by the discharge and accumulation of wastewater adjoining her property (see the evidence submitted by the petitioner).
  • d)On 22 agosto 2025, the Área de Salud de Paraíso conducted a sanitary inspection at the protected party’s property, where water conveyance was observed in the area that the petitioner identifies as her property and where, at the beginning of the conveyance, there is no enclosure (see the report submitted by the Director del Área de Salud and the evidence provided).
  • e)A query of the Sistema Nacional de Información para la Gestión Integrada de los Recursos Hídricos (SINIGIRH) located opinion DA-UHCAROC-0417-2024, which determined that there is a channel carrying water from household wastewater discharged by homes located upstream, as well as stormwater from properties at higher elevations, which flows into the bed of the río Zapote. No natural water sources were identified. The channel has earthen sections and sections lined with concrete (see the report submitted by the mayor).

IV. REGARDING THE SPECIFIC CASE

In the case sub lite, the petitioner alleges that an open ditch runs through her residence, carrying water from other homes and causing sanitary problems. She asserts that she filed the respective complaints with the respondent authorities; however, the situation has not been resolved.

In this regard, it has been verified that the protected party did, in fact, file the respective complaints on April 8, 2025; however, as she alleges, at the time the amparo proceeding (recurso de amparo) was filed (July 8, 2025), she had received no response.

Accordingly, it should be noted that it was only in connection with the processing of this proceeding that the Área Rectora de Salud de Paraíso conducted an on-site inspection on August 22, 2025, and issued technical report N° CARTA-MS-DRRSCE-DARSP-IT-0601-2025 dated August 25, 2025, in which it expressly recommended:

“• Request that the Municipalidad de Paraíso submit, within 20 business days, a report on the current condition of the stormwater drainage system in the area, also taking into account the water flowing through the complainant’s property, and request a review of the responsibility of the municipal department in managing that water; likewise, consider whether there may be a potable-water leak causing this water to flow at the site. Subsequently, following an assessment of the response, an administrative act (acto administrativo) may be issued to require its correction.

• Inform both the complainant and the Municipalidad de Paraíso that, if any homes are suspected of discharging wastewater into the stormwater drainage system, the respective complaints must be filed, providing the owners’ names in order to ensure the corresponding administrative and legal procedures, as well as the effective use of the resources of this organizational unit.” Thus, although the Área Rectora de Salud de Paraíso conducted the aforementioned inspection and issued the cited report, it is no less true that it has not issued a final decision on the complaint filed, since the transcribed submission states that various actions must be undertaken before the corresponding administrative act can be issued, and there is no record that those actions have been carried out.

For its part, the respondent municipality merely states that “Because this involves wastewater of unknown origin located on private properties, the Municipality cannot intervene”; however, the local government itself reports that opinion DA-UHCAROC-0417-2024 described the area in question as follows: “A channel was identifyed (sic) carrying water from household wastewater discharged by the houses located upstream, as well as stormwater from the properties at higher elevations, which flows into the bed of the río Zapote; an inspection of the area was conducted, and the presence of natural water sources was ruled out. It includes some earthen sections and others lined with concrete.” Accordingly, the situation also involves an apparent stormwater-management problem, which must specifically be addressed by the local government. In this regard, it should first be noted that section 84 of the Código Municipal provides: “Article 84.- In accordance with the municipal regulatory plan, natural or legal persons who own or possess real property under any title shall comply with the following obligations: (…) f) Install downspouts and gutters to collect stormwater from buildings whose exterior walls immediately adjoin a public roadway.” Indeed, technical report N° CARTA-MS-DRRSCE-DARSP-IT-0601-2025 dated August 25, 2025, issued by the Área Rectora de Salud de Paraíso and cited ut supra, which pertains to this particular case, determined that addressing the complaint filed also required the intervention of the respondent municipality, specifically in accordance with the recommendations set forth in that submission.

In view of the foregoing, it is apparent that addressing and resolving the matter raised by the petitioner requires coordination between the health authority and the respondent municipality, which has not occurred effectively within a reasonable period. Consequently, the Chamber finds that the petition must be granted with respect to both agencies and orders that, within one month from notification of this judgment, a final decision be issued on the complaint filed by the protected party and that she be notified of the decision.

V. NOTE BY JUSTICE CASTILLO VÍQUEZ REGARDING PROMPT AND EFFECTIVE ADMINISTRATIVE JUSTICE

I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and effective justice in administrative proceedings, jurisdiction over the legal dispute lies with the Contentious-Administrative Courts and not with this Chamber. However, with the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, it has been established that this right may receive judicial protection through the amparo proceeding established by article 32 of the Ley de la Jurisdicción Constitucional, in relation to article 27 of the Constitución Política de la República de Costa Rica, in cases where the petitioner considers that the Administration’s material conduct, administrative acts, or response are affecting the petitioner’s fundamental rights. In my view, the recently enacted legislation does not require this Court to modify its line of precedent, since, pursuant to section 7 of its Law, this Court has exclusive authority to define its own jurisdiction.

Therefore, except for those constitutional-law disputes that this Chamber itself has recognized as exceptional circumstances that may properly be heard in this jurisdiction through the constitutional guarantee proceeding of amparo, in all other cases, and for the reasons stated by this Court (judgment N° 2008-02545 at 8:55 hours on February 22, 2008), jurisdiction lies with the Judges of the contentious-administrative jurisdiction. All of this is consistent with section 25 of the Convención Americana sobre Derechos Humanos, the Law of the Constitution (values, principles, and rules), and the corresponding statutory provisions, based on a logical, systemic, and teleological interpretation of the legal system.

VI. NOTE BY JUSTICE SALAZAR ALVARADO

As a general principle, cases involving the failure of the Public Administration to repair, construct, modify, or demolish any infrastructure work must be dismissed because such an omission is a matter of legality that must be adjudicated in the ordinary courts, where the interested person may challenge the matter more fully. However, when such administrative inaction results in a violation of other fundamental rights protected within this constitutional jurisdiction, or affects groups considered vulnerable, I do address the merits of the matter, as in this amparo proceeding, which involves protecting people’s health because, according to the petitioner, there is apparently contamination from municipal wastewater, causing sanitary and environmental problems. This constitutes an exception to my position on this subject.

VII. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced through new technologies, those materials must be collected from the court within a maximum period of thirty business days from notification of this judgment. Otherwise, all materials not collected within that period shall be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena in Session N° 27-11 of August 22, 2011, article XXVI, and published in the Boletín Judicial N° 19 of January 26, 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial in Session N° 43-12 held on May 3, 2012, article LXXXI.

Por tanto:

The petition is granted. Carlos Granados Siles and Michael Álvarez Quirós, respectively, director of the Área Rectora de Salud de Paraíso and mayor of the Municipalidad de Paraíso, or whoever may hold those offices, are ordered to coordinate as appropriate and undertake all actions within the scope of their respective authority so that, within ONE MONTH from notification of this judgment, a final decision is issued on the complaint filed by the petitioner and she is notified of that decision. The respondent authority is warned that, upon due notice and in accordance with article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in an amparo proceeding that the person is required to comply with or enforce, and fails to comply with or enforce it, shall be punished by imprisonment for three months to two years, or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The Municipalidad de Paraíso and the State are ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, the amounts of which shall be determined during enforcement of the judgment in the contentious-administrative jurisdiction. Revisión del Documento *CO* Res. Nº2025-028806 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las doce horas cuarenta y cinco minutos del cinco de setiembre de dos mil veinticinco.

Recurso de amparo que se tramita en expediente número 25-019844-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra el MINISTERIO DE SALUD (MS) y la MUNICIPALIDAD DE PARAÍSO.

Resultando:

  1. 1Por escrito recibido e incorporado al expediente a las 14:55 horas del 08 de julio de 2025, la recurrente interpone recurso de amparo contra el MINISTERIO DE SALUD y la MUNICIPALIDAD DE PARAÍSO, y manifiesta que, reside con su madre -persona adulta mayor- y sus dos hijos -personas menores de edad- en una vivienda adquirida mediante bono de vivienda social, ubicada quinientos metros al este de la Delegación de Policía de Cachí de Paraíso de Cartago. En el costado oeste de su propiedad existe una zanja abierta por la cual fluyen aguas residuales provenientes de varias viviendas vecinas, las cuales desembocan sin tratamiento en un cauce al norte de su finca, generando estancamiento de aguas negras a cielo abierto. Las aguas residuales de su vivienda están canalizadas de forma independiente. Desde el año 2023, ha gestionado ante el gobierno local recurrido a fin de lograr la intervención en la situación sanitaria causada por la zanja.En su momento, el entonces alcalde Carlos Ramírez Sánchez le indicó que no se podía atender su solicitud por falta de recursos y tiempo. Posteriormente, acudió al Ministerio de Salud, el cual realizó una inspección en el sitio y el 24 de abril de 2023 emitió una orden sanitaria dirigida a la municipalidad recurrida, en la que advirtió que la acumulación de aguas residuales representa un riesgo para la salud pública. No obstante, retiró dicha orden al señalar las autoridades del ministerio recurrido que no podían intervenir por tratarse de propiedad privada. A inicios de 2025, se apersonó nuevamente al gobierno local recurrido, esta vez ante el alcalde Michael Álvarez Quirós, quien se comprometió, verbalmente, a visitar la propiedad y buscar una solución, compromiso que no se ha cumplido a la fecha. El 8 de abril en curso interpuso la correspondiente denuncia ambiental ante ambas autoridades recurridas (véase prueba aportada).Acusa que la situación sanitaria derivada de la zanja ha afectado directamente la salud de su familia, provocando enfermedades digestivas y respiratorias, infestación por tórsalos y constantes picaduras de insectos y, en época seca, la proliferación de moscas y zancudos se vuelve incontrolable. Comenta que carece de los medios económicos para sufragar las obras de alcantarillado o entubamiento de la zanja. La zanja descarga actualmente las aguas residuales directamente sobre una finca de cultivo de café colindante, ocasionando un estanque permanente de aguas negras, lo que implica una contaminación ambiental más amplia y posibles perjuicios a terceros. Estima que lo anterior es violatorio de sus derechos fundamentales.
  2. 2Informa bajo juramento Carlos Granados Siles, en condición de Director del Área Rectora de Salud de Paraíso, que

“(…) a) El día 9 agosto 2023 la señora Nombre01 presenta nota ante la Dirección Área Rectora Salud Paraíso donde solicita el levantamiento de su denuncia por cuanto los hechos denunciados no se ocasionan en propiedad municipal sino en su propiedad (se adjunta nota indicada).

  • b)Debido a lo anterior el día 24 agosto 2023 se notifica oficio N° MS-DRRSCE-DARSP0894-2023, el cual adjunto, a la Sra. Nombre01, donde se le informa que se procede con el cierre de su caso y por ende al archivo correspondiente (…)
  • a)El día 22 agosto 2025 se realizó inspección sanitaria( se adjunta informe técnico N° CARTA-MS-DRRSCE-DARSP-IT-0601-2025) en la propiedad de la señora Nombre01 donde se observa la conducción de aguas en lo que la señora Nombre01 indica es su propiedad y en la cual al inicio de la conducción carecen de cerramiento, posteriormente una sección cuenta con cerramiento con cuneta y la parte final de la conducción posee una sección dañada, lo que ocasiona una filtración de las aguas las cuales escurren al patio de su vivienda; la Sra. Nombre01 menciona que el deterioro de esta sección final de las cunetas fue efectuada por un vecino y que dicho aspecto actualmente está judicializado por el daño causado. b) Durante la diligencia sanitaria las aguas denunciadas se observaron transparentes, sin materiales sólidos, no obstante, en algún momento se percibió un olor característico de aguas residuales.

Las aguas escurren con fluidez, no se observa estancamiento de aguas, ni vectores en el lugar; en el desarrollo de la evaluación las condiciones climáticas fueron estables, sin lluvia, donde se determinó que la cantidad de agua que escurre es importante, no obstante, no se observó existencia de un cuerpo de agua que discurra en esa zona. c) Se le consulta a la señora Nombre01 sí tiene algún indicio de quienes podrían estar vertiendo aguas residuales en el sitio con la finalidad de efectuar las pruebas de coloración respectiva, a lo que señaló no tener certeza de quienes podrían ser; así mismo, se consulta respecto a la existencia de dicha canalización de aguas por su propiedad a lo que indicó que cree que fue la Municipalidad la que construyó la misma, por lo que alude a que son ellos quienes deben dar el mantenimiento.

d)Luego del análisis de lo esgrimido en los tres puntos anteriores no existe claridad si existe o no una servidumbre de paso de aguas debidamente inscrita en la propiedad de la recurrente, o en su defecto algún acuerdo formal con la dependencia municipal respecto a la conducción de aguas en la propiedad de la persona denunciante y si se está dando el manejo adecuado de las aguas pluviales en el sector; así mismo, se requiere tener claridad de los nombres de los propietarios de las viviendas que podrían estar conectando la salida de aguas residuales a dicha conducción con la finalidad de poder efectuar las pruebas respectivas y verificar el cumplimiento o no de la normativa sanitaria vigente en dicho tema. e) Conforme a lo mencionado y en aras de solventar el problema denunciado se procederá a solicitar a la Municipalidad de Paraíso que remita en el plazo de 20 dias un informe respecto al estado actual del sistema de evacuación de las aguas pluviales en el sector, considerando además las aguas que escurren por la propiedad de la persona denunciante, en el cual se solicite la revisión de la responsabilidad de la dependencia municipal en el manejo de éstas; igualmente se considere si existe alguna situación de posible fuga agua potable que pueda generar el escurrimiento de estas aguas en el sitio, del cual mantendremos informado oportunamente a la honorable Sala Constitucional (…)” (Sic).

Solicita se declare sin lugar el recurso.

  1. 3Rinde informe Michael Álvarez Quirós, en calidad de alcalde de la Municipalidad de Paraíso, quien manifiesta que:

“(…) PRIMERO: La recurrente alega afectaciones a la salud, señalando la existencia de aguas residuales en las cercanías de su propiedad, así como la existencia de una orden sanitaria emitida con anterioridad contra la Municipalidad. SEGUNDO: Dicha orden fue posteriormente retirada, toda vez que se determinó que la Municipalidad no podía intervenir debido a tratarse de terrenos de propiedad privada. TERCERO: En consulta realizada en el Sistema Nacional de Información para la Gestión Integrada de los Recursos Hídricos (SINIGIRH) se encontró el dictamen DA-UHCAROC-0417-2024, el cual determinó que: Existe un canal con flujo de agua proveniente de aguas servidas de viviendas ubicadas aguas arriba, así como aguas pluviales de predios superiores, que discurren hasta el cauce del río Zapote. No se identificaron fuentes de agua naturales. El cauce presenta tramos en tierra y tramos canalizados en concreto CUARTO: Al tratarse de aguas residuales de origen desconocido y ubicadas en propiedades privadas, la Municipalidad no puede intervenir directamente con recursos públicos, conforme lo establece el principio de legalidad y el régimen jurídico del dominio público.

QUINTO: De acuerdo con criterios técnicos, se requiere la práctica de pruebas de fluoresceína para determinar el origen de dichas aguas, lo cual constituye una competencia del Ministerio de Salud (...)”. Solicita se desestime el recurso.

  1. 4En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta el magistrado Salazar Alvarado; y,

Considerando:

I. CUESTIÓN PRELIMINAR

De previo a analizar el fondo del asunto -por la presunta violación del derecho a un procedimiento pronto y cumplido- debe aclararse que, a partir de la Sentencia N° 2008-02545 de las 8:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa -con algunas excepciones-, aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo -instruido de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes. Precisamente, en este caso, se plantea un supuesto de excepción, pues, se trata de una denuncia ambiental por aparente problemas de contaminación que existen en su casa de habitación, siendo que esta Sala ha continuado admitiendo para valoración aquellos asuntos en los que está de por medio la presunta violación al medio ambiente. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.

II. OBJETO DEL RECURSO

La recurrente manifiesta que, es vecina de Paraíso de Cartago y que en su vivienda existe una zanja abierta por donde fluyen aguas residuales provenientes de viviendas vecinas, lo cual genera estancamiento de aguas negras. Indica que, ha gestionado ante la municipalidad que intervenga en su situación, pero no ha sido posible. Agrega que, el 24 de abril de 2023 Ministerio de Salud realizó una inspección en el sitio y emitió una orden sanitaria a la municipalidad recurrida. Manifiesta que, en abril del año en curso interpuso denuncia ambiental. Considera vulnerados sus derechos fundamentales.

III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:

  • a)El día 9 agosto 2023 la recurrente presenta nota ante la Dirección Área Rectora Salud Paraíso donde solicita el levantamiento de su denuncia por cuanto los hechos denunciados no se ocasionan en propiedad municipal sino en su propiedad (ver informe rendido por el Director del Área de Salud y prueba aportada).
  • b)Debido al desistimiento de la denuncia, el día 24 agosto 2023 se notifica oficio N° MS-DRRSCE-DARSP0894-2023, a la recurrente, donde se le informa que se procede con el cierre de su caso y por ende al archivo correspondiente (ver informe rendido por el Director del Área de Salud y prueba aportada).
  • c)El 08 de abril de 2025, la recurrente presentó denuncia ante la Municipalidad de Paraíso y el Área de Salud de Paraíso, por afectación ambiental y sanitaria causada por el vertido y acumulación de aguas residuales colindantes en su propiedad (ver prueba aportada por la recurrente).
  • d)El día 22 agosto 2025 se realizó inspección sanitaria en la propiedad de la tutelada, por parte del Área de Salud de Paraíso, donde se observa la conducción de aguas en lo que la amparada indica es su propiedad y en la cual al inicio de la conducción carecen de cerramiento (ver informe rendido por el Director del Área de Salud y prueba aportada).
  • e)En consulta realizada en el Sistema Nacional de Información para la Gestión Integrada de los Recursos Hídricos (SINIGIRH) se encontró el dictamen DA-UHCAROC-0417-2024, el cual determinó que existe un canal con flujo de agua proveniente de aguas servidas de viviendas ubicadas aguas arriba, así como aguas pluviales de predios superiores, que discurren hasta el cauce del río Zapote. No se identificaron fuentes de agua naturales. El cauce presenta tramos en tierra y tramos canalizados en concreto (ver informe rendido por el alcalde).

IV. SOBRE EL CASO CONCRETO

En el sub lite, la accionante acusa por su vivienda existe una zanja abierta por la que discurren aguas de otras viviendas, lo cual ocasiona problemas sanitarios. Alega que ha formulado las respectivas denuncias ante las autoridades recurridas; empero, la situación no ha sido resuelta.

Al respecto, se verifica que, efectivamente, la tutelada planteó las respectivas denuncias el 8 de abril de 2025; empero, tal como acusa, al momento de interposición del recurso (8 de julio de 2025), no había obtenido respuesta.

En ese tanto, véase que no fue sino con ocasión del trámite de este proceso, que el Área Rectora de Salud de Paraíso efectuó una inspección en el sitio el 22 de agosto de 2025 y emitió el informe técnico N° CARTA-MS-DRRSCE-DARSP-IT-0601-2025 de 25 de tal mes, en el que recomendó expresamente:

“• Solicitar a la Municipalidad de Paraíso remita en el plazo de 20 días hábiles informe respecto al estado actual del sistema de evacuación de las aguas pluviales en el sector, considerando además las aguas que escurren por la propiedad de la persona denunciante, en el cual se solicite la revisión de la responsabilidad de la dependencia municipal en el manejo de éstas; igualmente se considere si existe alguna situación de posible fuga agua potable que pueda generar el escurrimiento de estas aguas en el sitio. Posteriormente, según valoración de la respuesta, podrá emitirse acto administrativo para su corrección.

• Se le indique tanto a la persona denunciante como a la Municipalidad de Paraíso, en caso de que se sospeche de viviendas que están vertiendo aguas residuales al sistema de evacuación de aguas pluviales, debe interponerse las denuncias respectivas, facilitando los nombres de los propietarios con la finalidad de garantizar los procedimientos administrativos y legales correspondientes, así como un uso efectivo de los recursos de esta unidad organizativa”.

De esta forma, si bien el Área Rectora de Salud de Paraíso realizó la inspección referida y emitió el informe mencionado, no menos cierto es que no ha resuelto de manera definitiva la denuncia interpuesta, toda vez que, en el memorial transcrito, se consigna la necesidad de ejecutar distintas acciones para poder emitir el acto administrativo correspondiente, las cuales no constan que se hayan efectuado.

Por otra parte, la municipalidad recurrida se limita a señalar que “Al tratarse de aguas residuales de origen desconocido y ubicadas en propiedades privadas, la Municipalidad no puede intervenir”; sin embargo, el propio gobierno local informa que en el dictamen DA-UHCAROC-0417-2024 se detalló respecto de la zona en cuestión: “Se identifico (sic) un canal con flujo de agua proveniente de las aguas servidas de las casas ubicadas hacia aguas arriba, así como aguas pluviales de los predios superiores que discurren hasta el cauce del rio zapote, se realizó un recorrido descartándose la identificación de fuentes de agua naturales. Incorpora algunas secciones en tierra y otras canalizadas en concreto”.

De este modo, en la situación también incide un aparente problema de manejo de aguas pluviales, lo cual debe ser atendido precisamente por el gobierno local. En ese tanto, primeramente cabe advertir que, el numeral 84, del Código Municipal, estatuye: “Artículo 84.- De conformidad con el plan regulador municipal, las personas físicas o jurídicas, propietarias o poseedoras, por cualquier título, de bienes inmuebles, deberán cumplir las siguientes obligaciones: (…) f) Instalar bajantes y canoas para recoger las aguas pluviales de las edificaciones, cuyas paredes externas colinden inmediatamente con la vía pública”.

Justamente, el informe técnico N° CARTA-MS-DRRSCE-DARSP-IT-0601-2025 de 25 de agosto de 2025 del Área Rectora de Salud de Paraíso citado ut supra, atinente a este caso en particular, determinó que para abordar la denuncia incoada debía intervenir también la municipalidad recurrida, precisamente, en los términos de las recomendaciones consignadas en tal memorial.

En virtud de lo expuesto, se observa que, para la atención y resolución del asunto formulado por la recurrente, resulta necesaria la coordinación entre la autoridad sanitaria y la municipalidad recurrida, lo cual no se ha verificado de manera efectiva dentro de un plazo razonable. Por consiguiente, la Sala estima que se debe declarar con lugar el recurso en cuanto a ambas dependencias, y se ordena que, dentro del plazo de un mes, contado a partir de la notificación de esta sentencia, se resuelva en definitiva la denuncia incoada por la tutelada y se le notifique lo que se decida.

V. NOTA DEL MAGISTRADO CASTILLO VÍQUEZ, EN CUANTO A LA JUSTICIA ADMINISTRATIVA PRONTA Y CUMPLIDA

He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia.

Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.

VI. NOTA DEL MAGISTRADO SALAZAR ALVARADO

En tesis de principio, los casos relacionados con la inactividad de la Administración Pública en la reparación, construcción, modificación o demolición de cualquier obra de infraestructura, deben ser desestimados, por constituir, esa omisión, un tema de legalidad, cuya discusión corresponde a la jurisdicción ordinaria, ante la cual la persona interesada puede debatir, con mayor amplitud, sus disconformidades. Sin embargo, cuando de aquella conducta administrativa omisiva se derive alguna violación a otros derechos fundamentales tutelados en esta jurisdicción constitucional, o se afecten grupos considerados vulnerables, sí entro a conocer el fondo del asunto, tal y como sucede en este amparo, en que está de por medio la tutela de salud de las personas debido a que según lo dicho por el recurrente, en apariencia existe contaminación por aguas residuales de carácter municipal, lo que provoca problema sanitarios y ambientales, siendo ello una situación de excepción a mi posición en esta materia.

VII. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara con lugar el recurso. Se ordena a Carlos Granados Siles y Michael Álvarez Quirós, por su orden, director del Área Rectora de Salud de Paraíso y alcalde de la Municipalidad de Paraíso, o a quienes ocupen tales cargos, que coordinen lo correspondiente y ejecuten todas las actuaciones que estén dentro del ámbito de sus competencias respectivas para que, dentro del plazo de UN MES, contado a partir de la notificación de esta sentencia, se resuelva en definitiva la denuncia interpuesta por la parte accionante y se le notifique lo que se decida. Se le advierte a la autoridad recurrida que, bajo apercibimiento y de conformidad con lo establecido en el artículo 71, de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo, y no la cumpliere o hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Paraíso y al Estado al pago de las costas, daños y perjuicios ocasionados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
