Document Review Decision No. 2025034789 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine twenty a.m. on the twenty-fourth of October, two thousand twenty-five.
Petition for constitutional relief (recurso de amparo) filed by Nombre72812, identity card no. CED39182, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA).
Findings of Fact:
That is, this Chamber considers that, in the present case, it is more than evident that the residents and claimants have caused environmental pollution by discharging their excreta and sewage (aguas negras) into a sewerage system (sistema de alcantarillado) that lacks an interconnection and that is also being discharged into the local river, thereby polluting all other communities downstream.- For the foregoing reason, this claim is rejected, since the cited regulations place the relief sought within the jurisdiction of AyA, an entity that, based on the advisability and availability of resources for achieving the timely interconnection, supported by technical design, administrative procurement, and economic considerations, is responsible for the matter.-…” In light of the foregoing, it is clear that the pollution problem arises from the failure to bear the maintenance costs of the septic tanks (tanques sépticos), from businesses, and from all those who improperly dispose of wastewater (aguas residuales); it is the residents themselves who have irresponsibly endangered their health, causing the environmental pollution they allege, rather than any omission on the part of the Institution.
It must be borne in mind that the sewerage system that was designed and is currently in use was conceived so that the water conveyed through it could be discharged into the estuary without causing environmental harm; nevertheless, for the reasons already stated, improper practices exist that produce the opposite result. Septic-tank systems constitute an alternative technology to traditional collection networks, which is used nationally and worldwide as a suitable option for the proper treatment and disposal of wastewater, particularly in places where sanitary infrastructure does not exist or where, because of the terrain’s topography, interconnection with the collectors operated by AyA is not feasible. In Costa Rica, 70% of wastewater is disposed of and treated using septic-tank system technology, and owners must provide proper maintenance and refrain from building over the drainage system’s absorption and aeration areas.
Septic tanks are a technical solution to the wastewater problem, provided that they are built according to the design and characteristics of each type of soil. In the case of domestic wastewater, the septic tank must receive water from the kitchen sink, laundry sinks, washing machine, showers, washbasins, and toilets. It is important to emphasize that all wastewater we generate must be collected through dedicated piping inside the dwelling and discharged into the septic tank. A properly constructed and designed septic tank with an adequate drainage system (sistema de drenaje), depending on the number of people living in the dwelling, must be cleaned every 6 months or every year to remove the sludge that has settled and accumulated at the bottom of the tank. At the appropriate time, the Municipality was also responsible for verifying compliance with the technical and legal regulations in force concerning these matters.
It bears emphasizing that, at the constitutional level, the Local Government holds authority over land-use planning (Ordenamiento Territorial) and, accordingly, must not authorize construction in highly vulnerable areas without an adequate soil study, in areas prone to flooding or even landslides that therefore should not support any construction entailing a risk or danger to their owners or third parties. From that standpoint, the Municipality, as the entity responsible for land-use planning, bears an enormous responsibility for preventing situations that pose a risk to a community. It must be borne in mind that the Instituto Costarricense de Acueductos y Alcantarillados is barred by its Founding Law (Ley Constitutiva) from making donations or improvements to residents’ septic tanks, much less from undertaking the treatment of special-type wastewater generated, for example, by industries.
The foregoing is also supported by the fact that AyA’s revenues are derived solely from the rates paid by users for the services provided by the Instituto. In that regard, the law requires the authorized amounts set forth in the respective rate schedules (pliegos tarifarios) to be invested in providing services to our customers under conditions of quality, quantity, reliability, continuity, timeliness, and optimal delivery. The allocation by AyA of funds derived from rates to other institutions that are likewise required to meet their obligations through their own rates, loans, or other forms of financing acceptable within the public sector would entail not only a breach of various regulations, including those indicated above, but also of the entire applicable legal framework under the principle of legality (principio de legalidad) governing the actions of the Public Administration (in this regard, the obligations and prohibitions contained in the Ley de la Administración Financiera de la República y Presupuestos Públicos, Ley General de Control Interno, Ley de Creación de la Autoridad Reguladora de los Servicios Públicos, among others, would also apply).
It would likewise place the Instituto in the position of having to set aside some of the obligations requiring those funds, which were duly justified before ARESEP and authorized by it. Current status of the project With respect to the status of the project, it is important to quote the information provided in official letter UENPC- 2025-02809 dated 26 de setiembre, signed by Eng. Carlos Andrés Esquivel of the UEN Programación y Control, concerning the project entitled “Puntarenas Sanitary Sewerage System (Alcantarillado Sanitario de Puntarenas),” which states, insofar as relevant: “… The project “Construction of the sanitary sewerage system in Puntarenas” currently has completed final designs, approved and valid environmental feasibility (viabilidad ambiental) before SETENA, as well as all technical documentation (Terms of Reference (Términos de Referencia, TdR), Technical Specifications) finalized and ready for the project to be put out to tender.
This information is kept current and valid while the project’s various phases are completed. Work is currently under way on the expropriation proceedings (procesos de expropiación) to obtain all land and easements (servidumbres) required for the construction of the works included in the project. In addition, AyA is carrying out the process of updating the feasibility study (estudio de factibilidad) as required by MIDEPLAN, which constitutes a basic requirement and the starting point for the Institution to begin seeking financing. 3.COST AND FINANCING The investments required to implement the project have been identified within the 2024-2029 Investment Plan (currently in force), with a budget from the Institution’s own resources reserved during the years 2025 through 2028 for land acquisition and with disbursements for construction work expected to begin in 2029 and continue through 2031 (dates subject to the formalization and securing of a loan for the project’s development).
The total cost of the works included in this project is estimated at 104,382* million colones, which would be allocated between works for the conveyance and collection of wastewater generated throughout the entire project area (Stage II), investments that would be carried out between 2029 and 2031; and supplementary works to expand the Planta de Tratamiento El Roble (Stage III), which are projected for 2039 and would cost 4,872 million colones. *Source: 2024-2029 Investment Plan (…).”
Justice Araya García drafts the opinion; and,
Considering:
I.Subject matter of the appeal. The appellant alleges that there is a problem with the sanitary sewerage system (sistema de alcantarillado sanitario) of Puntarenas and that the respondent institute has not implemented adequate corrective measures, thereby perpetuating pollution and the risk to the population.
III.The right to health and to a healthy and ecologically balanced environment. The fundamental rights to health and to a healthy and ecologically balanced environment are constitutionally recognized (Articles 21, 50, 73 and 89 of the Political Constitution), as well as through the international rules applicable within the domestic legal system. In this regard, in judgment number 5928-06 at 15:00 hours on May 2, 2006, this Court held as follows:
“(…) The right to life recognized in Article 21 of the Constitution is the cornerstone upon which the other fundamental rights of the inhabitants of the Republic rest. Likewise, the right to health finds support in that provision of the political charter, because life is inconceivable unless human beings are guaranteed the minimum conditions necessary for an adequate and harmonious psychological, physical, and environmental balance. Public health and the right to a healthy and ecologically balanced environment are constitutionally recognized in Articles 21, 50, 73 and 89 of the Political Constitution. Specifically, Article 50 of the Constitution expressly recognizes the right of all inhabitants of the country to enjoy a healthy and perfectly balanced environment. That right is a fundamental guarantee for the protection of life and public health. In support of the foregoing, this Court has employed the concept of ‘environmental quality’ (calidad ambiental) specifically as a measure of people’s quality of life, in conjunction with other elements such as health, food, work, and housing, indicating that every person has the right to use the environment for his or her own development, but not without limits, because there is also a duty to protect and preserve the environment for present and future generations—the principle of sustainable development (principio de desarrollo sostenible) (…)”.
Furthermore, the second paragraph of Article 50 of the Political Constitution gives rise to the State’s obligation to protect the environment. That provision states:
“(...) Every person has the right to a healthy and ecologically balanced environment. Accordingly, every person has standing to report acts that violate that right and to seek redress for the harm caused (…)”.
This confirms that the various public authorities have an inescapable duty to preserve, defend, and guarantee every person’s fundamental right to health and to a healthy and ecologically balanced environment.
IV.The principle of coordination in environmental matters. This Court has recognized that one of the guiding principles of administrative organization is the coordination that must exist among all public entities and bodies when exercising their powers and providing the services assigned to them by the legal system. Thus, in judgment number 3404-2005 at 18:29 hours on March 29, 2005, this Chamber held as follows on this matter:
“(…) under the principle of coordination (principio de coordinación), the State is required to ensure that its entities adopt and implement all measures necessary to organize and harmonize their actions so that administrative management is as prompt and effective as possible for the benefit of the governed. With regard to internal relations within an Administration, this principle concerns the various responsibilities that, in processing a matter from its initial submission through the final decision, fall to different departments, whether or not subject to a vertical hierarchical relationship with one another but, in all cases, belonging to a single legal person governed by public law. In such a situation, the various internal departments of an entity responsible for developing and deciding certain sub-stages in processing the applications submitted to it must coordinate with one another to ensure an efficient and effective administrative proceeding for the benefit of the citizen. If a delay in any such sub-stage causes a general delay in the entire proceeding relating to an administrative claim, regardless of the particular responsibility borne by the body or department directly involved in the delay that occurred, the entity as such is likewise responsible for it (…)”.
Such administrative coordination is particularly important in cases involving environmental pollution because it enables the various public entities and bodies to combine their efforts so that every person’s fundamental right to a healthy and ecologically balanced environment can be protected promptly and effectively.
V.The collection, treatment, and final disposal of sewage.- To effectively ensure the protection of a healthy and ecologically balanced environment, the State, understood broadly, has a duty to adopt the measures necessary to provide timely and effective sewage treatment in the country’s communities. In this regard, this Constitutional Court has held that both the Instituto Costarricense de Acueductos y Alcantarillados and the Ministerio de Salud are responsible—within their respective spheres of authority—for ensuring the proper collection, treatment, and final disposal of such wastewater. Thus, in the specific case of the Instituto Costarricense de Acueductos y Alcantarillados, its own Founding Law (Ley Constitutiva)—Law No. 2726 of April 14, 1961, as amended—provides as follows:
“Article 1.- For the purpose of directing, establishing policies, establishing and applying standards, carrying out and promoting the planning, financing, and development of, and resolving all matters relating to, the supply of drinking water and the collection and disposal of sewage and liquid industrial waste, as well as the regulatory aspects of stormwater sewerage systems (sistemas de alcantarillado pluvial) in urban areas, the Instituto Costarricense de Acueductos y Alcantarillados is hereby created as an autonomous institution of the State for the entire national territory.” Accordingly, pursuant to Article 2 of that same body of law, said institution is responsible for “(…) Directing and overseeing all matters necessary to provide the inhabitants of the Republic with drinking-water service and with the collection and disposal of sewage, liquid industrial waste, and stormwater in urban areas (…)”.
Likewise, the General Health Law—Law No. 5395 of 30 October 1973—provides in Article 2 that the Executive Branch, through the Ministry of Health, is responsible for defining the national health policy and for planning and coordinating all public and private health-related activities, as well as for carrying out those activities assigned to it by law. Likewise, Article 341 of the aforementioned law establishes, among the powers of the Ministry of Health, the authority to order and adopt the special measures authorized by that legislation to prevent risks or harm to human health, or their spread or aggravation, and to prevent private parties from continuing or repeating an infringement. Regarding the specific matter at issue, the General Health Law, in Book 1, Title 3, Chapter 3, “Obligations and Restrictions Governing the Sanitary Disposal of Excreta and Wastewater,” provides, insofar as relevant, as follows:
“Article 285.- Excreta, sewage, wastewater, and stormwater shall be disposed of properly and under sanitary conditions so as to prevent contamination of the soil and natural water sources intended for human use and consumption, the formation of breeding grounds for disease vectors, and air pollution through conditions that impair its purity or quality.” (Emphasis not in the original).
“Article 287.- Every natural or legal person who owns dwellings, establishments, or buildings in which persons carry out their activities shall be responsible for ensuring that such properties have an excreta, sewage, and wastewater disposal system approved by the Ministry, and the users of dwellings, establishments, or buildings shall be required to maintain that system in proper working condition.” “Article 288.- Every owner shall be required to connect the excreta, sewage, and wastewater disposal system on their property to the sanitary sewerage system (alcantarillado sanitario) wherever the latter is operational, except in those exceptional cases recognized as permissible by the applicable regulations.” This legislation also establishes the obligation of the Ministry of Health authorities to oversee the application of and compliance with the provisions of that law and its regulations, without prejudice to the powers and obligations granted and imposed by special laws upon other public bodies or entities within their respective areas of responsibility (Article 337).
This confirms the various functions and obligations imposed by the legal system upon the Instituto Costarricense de Acueductos y Alcantarillados and the Ministry of Health with respect to the collection, treatment, and final disposal of sewage. Moreover, as previously indicated in the preceding recital (considerando), those functions and obligations must be exercised in a coordinated manner to ensure administrative effectiveness and efficiency.
VI.In the present matter, the petitioner (accionante) alleges that there is a problem with the Puntarenas sanitary sewerage system and that the respondent Institute has not implemented adequate corrective measures, thereby perpetuating the pollution and the risk to the population.
Regarding this matter, based on the facts appearing in the record and the reports submitted by the respondent authorities—which were made under oath following due warning of the consequences, including criminal consequences, provided for in Article 44 of the Law on Constitutional Jurisdiction—this Constitutional Court finds the petitioner’s allegation to be well-founded.
The evidence submitted to the case file and the report rendered under oath established that the Puntarenas sanitary sewerage system provides wastewater-collection services to 2.329 service connections and covers Dirección4311, from Antigua Atunera to Dirección727. Each user has a septic tank, which must receive the corresponding maintenance. This septic tank provides primary treatment by retaining settleable solids. The septic-tank effluent is subsequently received by the sanitary sewerage system, which collects the water generated by users and channels it toward the Puntarenas estuary. The first phase of this sanitary sewerage system was constructed using vitrified-clay pipe, and its second phase using asbestos-cement pipe. However, this piping has reached the end of its useful life, and the system currently experiences recurring collapses along sections of the pipeline. The check valves no longer exist.
In view of the foregoing, the respondent Institute has been taking action to resolve the reported problem, and in 2020, through procurement procedure 2019LI–000001–PRI, “Engagement of a Consulting Firm for the Projects of the Sanitation Program in Priority Areas of Gran Puntarenas, Tamarindo, and El Coco Sardinal,” the studies were updated and the Puntarenas sanitation system was redesigned. This project is registered in the MIDEPLAN Project Bank under BPIP 415, Construction of the Sanitary Sewerage System in Puntarenas, and has an estimated cost of $204,7 million. It is intended to treat an estimated flow of 355.1 L/s (by 2047) and comprises a series of infrastructure works to improve the collection, conveyance, pumping, treatment, and subsequent disposal of treated water at Playa El Roble. The project would treat water from the districts of Barranca, El Roble, Chacarita, and Puntarenas and is divided into 3 phases.
Phase I of the project consists of the Nombre72813 Collector Construction and Wastewater Treatment Plant Improvement Project, which is currently in the bidding stage under the BCIE executing unit. The project provides for expanding the coverage area in the district of Barranca, constructing a pumping station, and improving the treatment plant through the construction of a new module, the construction of a sludge line, and the relocation of the discharge point for previously treated water. The bidding process is currently at the bid-submission stage on the SICOP platform. Estimated cost: $38,5 (financing is available, with a budget of $43 million). The final designs have currently been completed, environmental feasibility (viabilidad ambiental) has been approved by SETENA and remains valid, and all technical documentation (Terms of Reference (TdR), Technical Specifications) has been completed (see the report of the respondent authorities).
The investments required to carry out the project have been identified in the current 2024-2029 Investment Plan, with internally generated funds budgeted from 2025 through 2028 for the acquisition of land and initial disbursements for construction works planned from 2029 through 2031 (these dates remain subject to the formalization and securing of a loan for the project’s development). The total cost of the works included in this project is estimated at 104,382 million colones, which would be allocated between works for the conveyance and collection of wastewater generated throughout the project area (Phase II), investments that would be carried out between 2029 and 2031; and supplementary works to expand the El Roble Treatment Plant (Phase III), which are planned for 2039 and would cost 4,872 million colones.
VII.This Court calls the attention of the authorities of the Instituto Costarricense de Acueductos y Alcantarillados (ICAA) to the fact that they have been aware of the situation described in this proceeding for more than twenty-five years. This is apparent from the report submitted under oath, which stated that “in 2001, the Instituto Costarricense de Acueductos y Alcantarillados contracted for feasibility studies and designs for the Gran Puntarenas sanitary sewerage system, so that sanitary sewerage coverage and wastewater treatment and disposal would be provided to the districts of Barranca, El Roble, Chacarita, and Puntarenas.”
Nevertheless, time has passed without an effective solution having been implemented, while the sanitary sewerage system of the central canton of Puntarenas remains in a state of severe deterioration, with obsolete infrastructure, pipeline collapses, and no control mechanisms such as check valves. This situation has resulted in wastewater being channeled directly into the Puntarenas estuary, continuously affecting public health and the environmental balance of the area.
Despite this, the respondent authorities state that the definitive solution is projected for 2047, which is disproportionate and unacceptable given the urgency of the reported problem. Such long-term planning, in a context where environmental and public-health harm has already been established, perpetuates the harm and breaches the constitutional duty to provide immediate protection for fundamental rights, particularly the right to health (Article 21) and the right to a healthy and ecologically balanced environment (Article 50).
A lack of material resources cannot be invoked as a valid justification for institutional inaction, particularly when fundamental rights are at stake and their protection requires diligent, coordinated, and effective action by the competent authorities.
This Court has repeatedly affirmed the obligation of public institutions to act in coordination to safeguard the rights of the public. In this particular case, there is no evidence that ICAA has taken effective steps to coordinate with the Municipalidad de Puntarenas or the Área Rectora de Salud, thereby preventing progress toward a comprehensive and immediate solution to the problem.
Consequently, the ICAA authorities are deemed to have violated the fundamental rights of the affected population by failing to adopt sufficient measures to eradicate environmental pollution and guarantee minimum sanitary conditions. An urgent call is therefore made to review the project implementation schedule, prioritize those phases that immediately address the most affected areas, and establish interinstitutional coordination mechanisms capable of effectively addressing the reported situation.
In environmental matters, it is also the undersigned Justice’s view that, where the Public Administration has already intervened, jurisdiction to hear and decide the matter lies with the administrative-litigation jurisdiction (jurisdicción contenciosa administrativa). Nevertheless, I do address the merits of the matter when other rights of the persons affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy a healthy, pollution-free environment (Article 50 of the Political Constitution), as occurs in this case, in which the petitioner alleges that there is a problem with the Puntarenas sanitary sewerage system and that the respondent Institute has not implemented adequate corrective measures, thereby perpetuating the pollution and the risk to the population, in violation of the right to enjoy a healthy and ecologically balanced environment and a decent standard of quality of life.
IX.Dissenting opinion (voto salvado) of Justice Garro Vargas. Although I have joined the majority opinion in cases raising similar grievances, upon further consideration, I believe that objections of this kind—intervention in a sanitary sewer system (alcantarillado sanitario)—should be pursued through the ordinary legal channels.
I consider that, in such cases, the failure to act should first be challenged before the authorities responsible for the public space in question and then, should the omission persist, before the administrative litigation jurisdiction (jurisdicción contencioso-administrativa). That court, having broader tools at its disposal, can examine and carefully weigh the underlying complaint, assess the administrative conduct, issue specific orders to address the stated problem and, of course, monitor compliance with the judgment.
In the case at bar, the petitioner alleges that there is a problem with the sanitary sewer system in Puntarenas and that the ICAA has not implemented appropriate corrective measures, thereby perpetuating the pollution and the risk to the population.
In addition to the foregoing, in this specific case it must be noted that the report submitted under penalty of perjury by the respondent authorities of the ICAA emphasized that “the Instituto Costarricense de Acueductos y Alcantarillados (ICAA) has promoted projects over the years to ensure adequate sanitation (saneamiento) (collection, treatment, and disposal of wastewater (aguas residuales)) in Gran Puntarenas, which includes the districts of Barranca, El Roble, Chacarita, and Puntarenas. However, despite the efforts made, it has not been possible to obtain the financing required to implement a sanitation system in Gran Puntarenas. To date, financing has been secured only for stage I of the project, whose objective is to provide sanitation services to a sector of the population of the district of Barranca.” In light of these considerations, I believe that intervention by this Court could disrupt the ICAA’s proper administrative planning for the execution of works that may be costly and could affect the proper administration and allocation of the resources available to that institution for such purposes.
For the foregoing reasons, I dissent and deny the amparo action (recurso de amparo).

The parties are advised that, if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device or produced by new technologies, they must retrieve them from the court office within a maximum period of thirty business days following notification of this judgment. Otherwise, any material not retrieved within that period will be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena in Sesión N° 27-11 del 22 de agosto del 2011, Article XXVI, and published in the Boletín Judicial N° 19 del 26 de enero del 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial in Sesión N° 43-12 celebrada el 3 de mayo del 2012, Article LXXXI.
Por tanto:
The action is granted. Alejandra Mora Segura and Kimberly Zamora Zamora, respectively general manager and head of the Puntarenas cantonal office, both of the Instituto Costarricense de Acueductos y Alcantarillados, or whoever may hold those positions in their stead, are ordered to coordinate with the Municipalidad de Puntarenas and the Área Rectora de Salud de Puntarenas so that the appropriate orders are issued and all actions falling within their respective areas of authority are carried out, such that, within a maximum period of SIX MONTHS following notification of this judgment, the measures necessary to prevent harm to the health of the inhabitants of the central canton of Puntarenas are put in place while a permanent solution to the problem at issue in these proceedings is implemented. The respondent authorities are likewise ordered to carry out and complete, within a maximum period of THREE YEARS following notification of this judgment, stage I of the project entitled “Construcción del Alcantarillado Sanitario de Puntarenas,” in accordance with the current investment plan.
It is further ordered that the entire project be completed within a maximum period of FIVE YEARS following notification of this judgment, in accordance with the matters set forth in Considerando VI. All of the foregoing shall be carried out under the terms stated in this judgment. The respondent authorities are warned that failure to comply with said order will constitute the offense of disobedience and that, pursuant to Article 71 of the Law governing this jurisdiction, anyone who receives an order issued in an amparo action that they must comply with or enforce and fails to comply with or enforce it shall be sentenced to imprisonment for three months to two years, or twenty to sixty day-fines (días multa), provided that the offense is not subject to a more severe penalty. The Instituto Costarricense de Acueductos y Alcantarillados is ordered to pay the costs, losses, and damages (costas, daños y perjuicios) caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment (ejecución de sentencia) before the administrative litigation jurisdiction. Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veinticuatro de octubre de dos mil veinticinco .
Recurso de amparo interpuesto por Nombre72812, cédula de identidad no. CED39182, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA).
Resultando:
Redacta el Magistrado Araya García; y,
Considerando:
I.Objeto del recurso. El recurrente acusa que existe un problema en el sistema de alcantarillado sanitario de Puntarenas y el instituto recurrido no ha implementado medidas correctivas adecuadas, perpetuando la contaminación y el riesgo de la población.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
III.Sobre el derecho a la salud y a un ambiente sano y ecológicamente equilibrado. Los derechos fundamentales a la salud y a un ambiente sano y ecológicamente equilibrado se encuentran reconocidos constitucionalmente (artículos 21, 50, 73 y 89 de la Constitución Política), así como a través de la normativa internacional aplicable al ordenamiento interno. En este sentido, en sentencia número 5928-06 de las 15:00 horas del 2 de mayo de 2006, este Tribunal estimó lo siguiente:
“(…) El derecho a la vida reconocido en el numeral 21 de la Constitución es la piedra angular sobre la cual descansan el resto de los derechos fundamentales de los habitantes de la república. De igual forma, en ese ordinal de la carta política encuentra asidero el derecho a la salud, puesto que, la vida resulta inconcebible si no se le garantizan a la persona humana condiciones mínimas para un adecuado y armónico equilibrio psíquico, físico y ambiental. Ahora bien, la salud pública y el derecho a un ambiente sano y ecológicamente equilibrado se encuentran reconocidos constitucionalmente en los artículos 21, 50, 73 y 89 de la Constitución Política. Específicamente, el artículo 50 constitucional reconoce de forma expresa el derecho de todos los habitantes del país a disfrutar de un medio ambiente saludable y en perfecto equilibrio. Ese derecho es garantía fundamental para la protección de la vida y la salud pública.
En apoyo de lo anterior este Tribunal ha recurrido a la utilización de la noción de “calidad ambiental” como un parámetro, precisamente, de la calidad de vida de las personas, que se conjuga con otros elementos tales como la salud, la alimentación, el trabajo y la vivienda, haciendo referencia a que toda persona tiene derecho a hacer uso del ambiente para su propio desarrollo pero no de manera ilimitada, ya que, también, existe un deber de protección y preservación del medio ambiente para las generaciones presentes y futuras –principio de desarrollo sostenible (…)”.
Asimismo, del segundo párrafo del artículo 50 de la Constitución Política se deriva la obligación del Estado de proteger el ambiente. Norma que establece al efecto:
"(...) Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. Por ello está legitimada para denunciar los actos que infrinjan ese derecho y para reclamar la reparación del daño causado (…)”.
Con lo que se corrobora que las distintas autoridades públicas tienen el deber ineludible de preservar, defender y garantizar el derecho fundamental de toda persona a la salud y a un ambiente sano y ecológicamente equilibrado.
IV.Acerca del principio de coordinación en materia ambiental. Este Tribunal ha reconocido que uno de los principios rectores de la organización administrativa lo constituye la coordinación que debe mediar entre todos los entes y órganos públicos al ejercer sus competencias y prestar los servicios que el ordenamiento jurídico les ha asignado. Así, esta Sala, en sentencia número 3404-2005 de las 18:29 horas del 29 de marzo de 2005, dispuso, sobre el particular, lo siguiente:
“(…) según el principio de coordinación, el Estado está obligado a que sus entidades adopten e implementen todas aquellas medidas requeridas para organizar y armonizar sus actuaciones para que la gestión administrativa sea lo más célere y efectiva posible en beneficio del administrado. En lo que concierne a las relaciones internas dentro de una Administración, ese principio se refiere a las diversas responsabilidades que en la tramitación de un asunto, desde su planteamiento inicial hasta la decisión definitiva, corresponden a diferentes departamentos, sujetos o no a una relación vertical de jerarquía entre sí pero, en todo caso, pertenecientes a una única persona jurídica de derecho público. En tal situación, las diversas dependencias internas de una entidad, responsables de gestar y decidir determinadas sub-etapas para la tramitación de las gestiones ante ella presentadas, deben coordinar entre sí a efectos de procurar un procedimiento administrativo ágil y efectivo en provecho del ciudadano. Si por un atraso en alguna de tales sub-etapas se produce un retardo general de toda el procedimiento relativo a un reclamo administrativo, independientemente de la responsabilidad particular que le incumba al órgano o departamento involucrado directamente en la demora acaecida, lo cierto es que la entidad como tal resulta igualmente responsable de la misma (…)”.
Dicha coordinación administrativa adquiere particular relevancia en el caso de problemas de contaminación ambiental, ya que, ésta permite que los distintos entes y órganos públicos puedan conjuntar esfuerzos, para que, se pueda proteger, de forma oportuna y efectiva, el derecho fundamental de toda persona a un ambiente sano y ecológicamente equilibrado.
V.Sobre la recolección, tratamiento y disposición final de las aguas negras.- Para cumplir, efectivamente, con la protección a un ambiente sano y ecológicamente equilibrado, el Estado, entendido en sentido amplio, está en el deber de disponer de las medidas necesarias para que en las comunidades del país se brinde tratamiento oportuno y efectivo a las aguas negras. En ese sentido, este Tribunal Constitucional ha sido del criterio que, tanto al Instituto Costarricense de Acueductos y Alcantarillados, como al Ministerio de Salud, les corresponde -dentro de sus respectivos ámbitos de competencia-, velar por la debida recolección, tratamiento y disposición final de tales aguas. Así, en el caso específico del Instituto Costarricense de Acueductos y Alcantarillados, su propia Ley Constitutiva -Ley No. 2726 de 14 de abril de 1961 y sus reformas-, dispone lo siguiente:
“Artículo 1.- Con el objeto de dirigir, fijar políticas, establecer y aplicar normas, realizar y promover el planeamiento, financiamiento y desarrollo y de resolver todo lo relacionado con el suministro de agua potable y recolección y evacuación de aguas negras y residuos industriales líquidos, lo mismo que el aspecto normativo de los sistemas de alcantarillado pluvial en áreas urbanas, para todo el territorio nacional se crea el Instituto Costarricense de Acueductos y Alcantarillados, como institución autónoma del Estado.” Por lo que a dicha institución le corresponde, conforme a lo dispuesto en el artículo 2° de ese mismo cuerpo normativo (…) Dirigir y vigilar todo lo concerniente para proveer a los habitantes de la república de un servicio de agua potable, recolección y evacuación de aguas negras y residuos industriales líquidos y de aguas pluviales en las áreas urbanas (…)”. De igual forma, la Ley General de Salud -Ley No. 5395 de 30 de octubre de 1973-, dispone, en su artículo 2°, que le corresponde al Poder Ejecutivo, a través del Ministerio de Salud, la definición de la política nacional de salud, planificación y coordinación de todas las actividades públicas y privadas relativas a salud, así como la ejecución de aquellas actividades que le competen conforme a la ley.
De igual forma, el artículo 341 de la referida ley establece, dentro de las atribuciones del Ministerio de Salud, la de ordenar y tomar las medidas especiales que habilita esa normativa para evitar el riesgo o daño a la salud de las personas o que éstos se difundan o se agraven y para inhibir la continuación o reincidencia en la infracción de los particulares. En cuanto al tema específico, la Ley General de Salud, en su Libro 1, Título 3, Capítulo 3, “De las obligaciones y restricciones para la evacuación sanitaria de excretas y aguas servidas”, dispone -en lo conducente-, lo siguiente:
“Artículo 285.- Las excretas, las aguas negras, las servidas y las pluviales, deberán ser eliminadas adecuada y sanitariamente a fin de evitar la contaminación del suelo y de las fuentes naturales de agua para el uso y consumo humano, la formación de criaderos de vectores y enfermedades y la contaminación del aire mediante condiciones que atenten contra su pureza o calidad.” (El destacado no forma parte del original).
“Artículo 287.- Toda persona, natural o jurídica, propietaria de viviendas o de establecimientos o edificios en que las personas desarrollen sus actividades, responderá de que tales bienes dispongan de un sistema de disposición de excretas y de aguas negras y servidas aprobado por el Ministerio y los usuarios de viviendas, establecimientos o edificios estarán obligados a mantener dicho sistema en buenas condiciones de funcionamiento.” “Artículo 288.- Todo propietario queda obligado a conectar el sistema de eliminación de excretas de aguas negras y servidas de su propiedad al alcantarillado sanitario en los lugares en que éste estuviera en funcionamiento, salvo en los casos de excepción que los reglamentos pertinentes reconozcan como procedentes.” Asimismo, de dicha normativa se colige la obligación de las autoridades del Ministerio de Salud de velar por la aplicación y el control del cumplimiento de las disposiciones de esa ley y de su reglamentación, sin perjuicio de las facultades y obligaciones que leyes especiales otorguen e impongan a otros órganos o entes públicos dentro de sus respectivos campos de acción (artículo 337).
Se corrobora, así, las distintas funciones y obligaciones que el ordenamiento jurídico le impone al Instituto Costarricense de Acueductos y Alcantarillados, y al Ministerio de Salud, en materia de recolección, tratamiento y disposición final de las aguas negras. Funciones y obligaciones que, además -y como ya se adelantó en el considerando anterior-, se deben ejercer de forma coordinada, para asegurar así la eficacia y eficiencia administrativas.
VI.En el presente asunto, el accionante alega que existe un problema en el sistema de alcantarillado sanitario de Puntarenas y el instituto recurrida no ha implementado medidas correctivas adecuadas, perpetuando la contaminación y el riesgo de la población.
Sobre el particular, este Tribunal Constitucional, de conformidad con hechos que constan en autos, así como de los informes rendidos por las autoridades recurridas -los cuales son dados bajo juramento con oportuno apercibimiento de las consecuencias, incluso penales, previstas en el artículo 44 de la Ley de la Jurisdicción Constitucional-, estima que lleva razón el recurrente en su alegato.
Por su parte, de la prueba aportada al expediente y del informe rendido bajo juramento se acreditó que el alcantarillado sanitario de Puntarenas brinda el servicio de recolección de las aguas residuales de 2.329 servicios, abarca el Dirección4311, desde la Antigua Atunera hasta el Dirección727. Cada usuario cuenta con un tanque séptico, el cual debe recibir el mantenimiento respectivo. Este tanque séptico realiza un tratamiento primario, reteniendo los sólidos sedimentables. Posteriormente, el efluente del tanque séptico se recibe en el alcantarillado sanitario, el cual colecta las aguas generadas por los usuarios y las canaliza hacia el estero de Puntarenas Dicho sistema de alcantarillado sanitario fue construido con tubería de alcarraza en su primera etapa y asbesto – cemento- en su segunda etapa. Sin embargo, dicha tubería cumplió con su vida útil, por lo cual actualmente el sistema presenta problemas recurrentes de colapso de tramos de tubería.
Las válvulas unidireccionales ya no existen. Debido a lo anterior, el instituto recurrido ha venido efectuando acciones con el fin de resolver el problema denunciando, y en el año 2020, mediante la contratación 2019LI–000001–PRI, “Contratación de firma consultora para los proyectos del Programa de Saneamiento en Zonas Prioritarias del Gran Puntarenas, Tamarindo y El Coco Sardinal” se actualizaron los estudios y se rediseñó el sistema de saneamiento de Puntarenas. Dicho proyecto se encuentra inscrito en el Banco de Proyectos de MIDEPLAN, bajo el BPIP 415 Construcción del Alcantarillado Sanitario en Puntarenas y tiene un costo estimado de $204,7 millones, pretende tratar un caudal estimado de 355.1 L/s (al año 2047) y constan de una serie de infraestructura para el mejoramiento tanto de la recolección, conducción, impulsión, tratamiento y posterior disposición de las aguas tratadas en Playa El Roble.
El proyecto estaría tratando las aguas de los distritos de Barranca, El Roble, Chacarita y Puntarenas y se divide en 3 etapas. En la etapa I del proyecto corresponde al proyecto Construcción Colector Nombre72813 y Mejoras a la Planta de Tratamiento de Agua Residual, el mismo se encuentra en etapa de licitación por parte de la unidad ejecutora BCIE. El proyecto contempla ampliación del área de cobertura en el distrito Barranca, construcción de estación de bombeo, mejoras en la planta de tratamiento que corresponden a construcción de un módulo nuevo, construcción de línea de lodos, reubicación del punto de vertido del agua previamente tratada, actualmente dicha licitación se encuentra en la etapa de recepción de ofertas en la plataforma SICOP. Costo estimado: $38,5 (se cuenta con el financiamiento y se posee un presupuesto de $43 millones). Cuenta actualmente con los diseños finales concluidos, la viabilidad ambiental aprobada y vigente ante SETENA, así como con toda la documentación técnica (Términos de Referencia (TdR), Especificaciones Técnicas) finalizada (ver informe de las autoridades recurridas).
Las inversiones requeridas para la ejecución del proyecto se tienen identificadas dentro del Plan de Inversiones 2024-2029 (vigente), reservándose presupuesto de recursos propios durante los años del 2025 al 2028 para la adquisición de terrenos, y teniéndose previsto el inicio de los desembolsos para la construcción de obras a partir del año 2029 y hasta el 2031 (fechas que quedan sujetas a la formalización y obtención de un préstamo para el desarrollo del proyecto). El costo total de las obras que contempla este proyecto se estima en 104,382 millones de colones, los cuales se estarían distribuyendo entre obras de conducción y recolección de aguas residuales generada dentro de toda el área del proyecto (Etapa II), inversiones que se estarían desarrollando entre los años 2029 y 2031; y obras complementarias para ampliación de la Planta de Tratamiento El Roble (Etapa III), las cuales se proyectan para el año 2039 y tendrían un costo de 4,872 millones de colones.
VII.Este Tribunal llama la atención a las autoridades del Instituto Costarricense de Acueductos y Alcantarillados (ICAA), por cuanto la situación expuesta en este recurso ha sido de su conocimiento desde hace más de veinticinco años. Así se desprende del informe rendido bajo juramento, en el cual se indicó que “el Instituto Costarricense de Acueductos y Alcantarillados en el año 2001, realizó la contratación de estudios de factibilidad y diseños de alcantarillado sanitario de la Gran Puntarenas, de manera que se diera cobertura de alcantarillado sanitario, tratamiento y disposición de las aguas residuales a los distritos de Barranca, El Roble, Chacarita y Puntarenas”.
No obstante, el tiempo ha transcurrido sin que se haya implementado una solución efectiva, mientras el sistema de alcantarillado sanitario del cantón central de Puntarenas continúa en estado de deterioro grave, con infraestructura obsoleta, colapsos en la tubería y ausencia de mecanismos de control como válvulas unidireccionales. Esta situación ha generado la canalización directa de aguas residuales hacia el estero de Puntarenas, afectando de forma continua la salud de la población y el equilibrio ambiental de la zona.
A pesar de ello, las autoridades recurridas indican que la solución definitiva se proyecta para el año 2047, lo cual resulta desproporcionado e inaceptable frente a la urgencia de la problemática denunciada. La planificación a tan largo plazo, en un contexto de afectación ambiental y sanitaria ya acreditada, constituye una forma de perpetuar el daño y de incumplir con el deber constitucional de protección inmediata de los derechos fundamentales, en especial el derecho a la salud (artículo 21) y el derecho a un ambiente sano y ecológicamente equilibrado (artículo 50).
La falta de recursos materiales no puede ser invocada como justificación válida para la omisión institucional, máxime cuando se trata de derechos fundamentales cuya protección exige una actuación diligente, coordinada y eficaz por parte de las autoridades competentes.
Este Tribunal ha reiterado la obligación de las instituciones públicas de actuar en coordinación para garantizar los derechos de la ciudadanía. En el caso concreto, no consta que el ICAA haya ejecutado acciones efectivas de articulación con la Municipalidad de Puntarenas ni con el Área Rectora de Salud, lo cual impide avanzar hacia una solución integral e inmediata del problema.
En consecuencia, se estima que las autoridades del ICAA han incurrido en una vulneración a los derechos fundamentales de la población afectada, al no adoptar medidas suficientes para erradicar la contaminación ambiental y garantizar condiciones mínimas de salubridad. Por lo tanto, se hace un llamado urgente a revisar el cronograma de ejecución del proyecto, priorizar las etapas que atiendan de forma inmediata los sectores más afectados, y establecer mecanismos de coordinación interinstitucional que permitan enfrentar de manera efectiva la situación denunciada.
En asuntos ambientales, es también criterio del suscrito, de que si ya ha habido intervención de la Administración Pública, considero que su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que la parte recurrente acusa que existe un problema en el sistema de alcantarillado sanitario de Puntarenas y el instituto recurrido no ha implementado medidas correctivas adecuadas, perpetuando la contaminación y el riesgo de la población, con violación del derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.
IX.Voto salvado de la magistrada Garro Vargas. Pese a que he concurrido con el voto en asuntos donde se plantean similares agravios, bajo una mejor ponderación estimo que este tipo de reproches —intervención de un alcantarillado sanitario— se deben plantear en las vías ordinarias de legalidad.
Considero que en tales supuestos procede, en primer término, cuestionar la inactividad ante las autoridades competentes en la atención del espacio público en cuestión y luego, de mantenerse la conducta omisa, ante la jurisdicción contencioso-administrativa. Dicha instancia jurisdiccional, con mayores herramientas, puede conocer con profundidad y sopesar la denuncia de fondo, valorar la conducta administrativa, dictar mandatos específicos para atender la problemática apuntada y, por supuesto, dar seguimiento a lo ordenado en sentencia.
En el sub lite, el recurrente acusa que existe un problema en el sistema de alcantarillado sanitario de Puntarenas y el ICAA no ha implementado medidas correctivas adecuadas, perpetuando la contaminación y el riesgo de la población.
Aunado a lo anterior, en el caso concreto se hace necesario evidenciar que, en el informe rendido, bajo la gravedad del juramento, por las autoridades recurridas del ICAA, se subrayó que “el Instituto Costarricense de Acueductos y Alcantarillados (ICAA) ha impulsado a lo largo de los años proyectos para asegurar el adecuado saneamiento (recolección, tratamiento y disposición de las aguas residuales) en la Gran Puntarenas, la cual incluye los distritos de Barranca, El Roble, Chacarita y Puntarenas. Sin embargo, a pesar de los esfuerzos realizados, no ha sido posible conseguir el financiamiento requerido para poder implementar un sistema de saneamiento en la Gran Puntarenas. A la fecha únicamente se cuenta con el financiamiento para la etapa I del proyecto, la cual tiene como objetivo brindar el servicio de saneamiento a un sector de la población del distrito de Barranca”.
A la luz de tales elementos, considero que la intervención de este Tribunal podría alterar la debida planificación administrativa del ICAA para la ejecución de unas obras que podrían ser onerosas y que pueden afectar la adecuada administración y previsión de los recursos con los que cuenta dicha institución para tales efectos.
En virtud de lo expuesto, salvo el voto y declaro sin lugar el recurso de amparo.
X.Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI
Por tanto:
Se declara con lugar el recurso. Se ordena a Alejandra Mora Segura y Kimberly Zamora Zamora, por su orden gerenta general y jefa de la oficina cantonal de Puntarenas, ambas del Instituto Costarricense de Acueductos y Alcantarillados, o a quienes en sus lugares ocupen dichos cargos, que procedan a coordinar con la Municipalidad de Puntarenas y con el Área Rectora de Salud de Puntarenas, a fin de que se giren las órdenes pertinentes y se ejecuten todas las actuaciones que correspondan dentro del ámbito de sus competencias, para que, en un plazo máximo de SEIS MESES, contado a partir de la notificación de la presente sentencia, se disponga lo necesario para evitar afectaciones a la salud de las personas habitantes en el cantón central de Puntarenas, mientras se implementa una solución definitiva al problema objeto del presente proceso. Asimismo, se ordena a las autoridades recurridas que, dentro del plazo máximo de TRES AÑOS, contado a partir de la notificación de esta sentencia, se ejecute y concluya la etapa I del proyecto denominado “Construcción del Alcantarillado Sanitario de Puntarenas”, conforme al plan de inversión vigente.
Además, se dispone que, en un plazo máximo de CINCO AÑOS, contado desde la notificación de esta sentencia, se finalice la totalidad del proyecto, en atención a lo expuesto en el considerando VI. Todo lo anterior, según los términos señalados en esta sentencia. Se advierte a las autoridades recurridas que, de no acatar la orden dicha, incurrirá en el delito de desobediencia y, que de conformidad con el artículo 71 de la Ley de esta jurisdicción, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Instituto Costarricense de Acueductos y Alcantarillados, al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. El Magistrado Salazar Alvarado pone nota. La magistrada Garro Vargas salva el voto y declara sin lugar el recurso de amparo en todos sus extremos. Notifíquese.- Paul Rueda L.
