Document Review Decision No. 2025034700 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine twenty in the morning on veinticuatro de octubre de dos mil veinticinco.

Amparo action (recurso de amparo) filed by Nombre72583 and Nombre72584, identity card CED39416, against the MUNICIPALIDAD DE ALAJUELA.

Findings of Fact:

  1. 1In a written submission received by the Office of the Clerk of the Chamber at 14:42 on 24 de marzo de 2025, the petitioner filed an amparo action against the Municipalidad de Alajuela. The petitioner states that they are older adults who reside in the area known as the Flor de Mayo farm or Jardín Flor de Mayo, located partly in Río Segundo and partly in Desamparados de Alajuela, and for which the petitioner serves as legal representative (representante legal). They indicate that during the rainy season they have experienced flooding originating from the municipal public roadway, entirely due to the absence of adequate infrastructure to channel that water and thereby prevent it from overflowing onto the property. They assert that on 30 de mayo de 2023, a request was submitted to the Municipalidad de Alajuela stating the following: “...we believe that this stormwater drainage charge is entirely improper and must be eliminated, because, to begin with, adequate stormwater infrastructure is practically nonexistent at every point along the frontage of our property and, more seriously, because under the conditions that have existed for several years, our property has instead, and entirely unfairly, received a large volume of stormwater from the public roadway with every rainfall and downpour, which has caused extensive damage from soil erosion and general harm to the property.Therefore, as shown by the video images and photographs contained in the attached files, it is clear that: 1. There is no stormwater infrastructure as such anywhere along the frontage of the property. 2. The infrastructure that does exist at this location and in front of the property is so inadequate that every time it rains, a large volume of water instead enters our property, causing tremendous damage from erosion and general harm. 3. At times, the water flowing onto our property smells like sewage. This is very concerning for people’s health, the condition of the land, and the contamination of our spring (naciente), registered with MINAE for human consumption under #10384-A. For all these reasons, we respectfully request that an analysis of the case be ordered, including a site visit and inspection to verify the matters described and a review of the attached images, and that your authority then order the elimination of all charges accumulated in the municipal system under the company’s name for stormwater drainage, because no service exists and, instead, the deficiencies in the system are causing serious harm to our farm...”.They state that, through Official Letter No. MA-AAP-5660-2023 of 11 de diciembre de 2024, they received a response from the respondent municipality rejecting the elimination of the stormwater service charge, without addressing their complaint concerning the lack of stormwater infrastructure and the damage and contamination that this situation causes to the Nombre72585 property, where there are not only species of flora and fauna but also a spring that is being affected. They assert that the property has been severely damaged by stormwater because the culvert does not have sufficient capacity for the amount of water it collects, a situation of which the municipality has been aware since 2023. They state that they have submitted requests informing the respondent authority of the problem caused by stormwater flooding the property and damaging the soil, trees, flora, fauna, and the environment or system composed of its various natural elements and their interactions and interrelationships with human beings. They complain that, as of the date this action was filed, the situation had not been resolved. They request the intervention of this Chamber and that the action be granted.
  2. 2By a decision issued at 8:18 on 27 de marzo de 2025, the proceeding was admitted, and the Mayor and the President of the Municipal Council, both of the Municipalidad de Alajuela, were ordered to submit a report concerning the facts alleged by the petitioner.
  3. 3By submission added to the digital case file at 15:53 hours on 7 de abril de 2025, Nombre5175, in his capacity as Mayor of the Municipality of Alajuela, reports under oath that “(…) By official letter N° MA-AAP-0404-2025 dated 04 de abril de 2025, signed by Eng. Nombre5228, Coordinator of the Stormwater Sewerage Activity, he stated as follows: “With regard to the decision issued at eight hours eighteen minutes on veintisiete de marzo de dos mil veinticinco, whereby the Constitutional Chamber requests a report concerning the constitutional amparo action (Recurso de Amparo) filed by Nombre72583, passport CED39413 , and Nombre72584, identity card CED39414 , processed under expediente N° 25-008378- 0007-CO, I hereby state: 1. I do not know the appellants’ place of residence; consequently, it is not feasible to verify whether they reside on the property known as Finca or Jardín Flor de Mayo. 2.To date, there is no record of any filings through which the appellants requested action or reported deficiencies in the area’s stormwater system, considering that, in the filings made, the relief sought has always been the removal of the stormwater sewerage service charge (filings N° 49130-2023 and N° 31245-2023), copies of which are attached (…) 4. Furthermore, it must be stated that stormwater infrastructure (infraestructura pluvial) does exist in front of the property identified by the appellants, known as Finca or Jardín Flor de Mayo. Most of this infrastructure consists of curbs and gutters, but stormwater piping is also installed at Dirección4290. Although the appellants’ property is at a lower elevation than the road, as stated by Eng. Nombre72586 in the report submitted by the appellants, there is no record at that location of incidents or complaints concerning any malfunction of the stormwater system.It should be emphasized that protecting properties in this condition (below street level) is the responsibility of their owners, who must construct the infrastructure necessary to channel stormwater from the access points (pedestrian or vehicular) and discharge it into the public stormwater system so that its flow does not cause damage within the properties. In light of the foregoing, it could be presumed that the situation described by the appellants does not arise directly from the management of water from the public roadway, since, as noted, the route has curbs and gutters, storm drains, and properly functioning stormwater pipes; rather, the condition may result from water management within the property because, according to Eng. Nombre72587’s report, no stormwater infrastructure for managing the water can be observed. It is important to inform you that the foregoing may be verified in photograph N° 4, ‘View of the dwelling from the point nearest the public roadway’ (see image N° 3 of this official letter), in the report submitted by the appellants (prepared by Eng.Nombre72587), which shows that the dwelling lies well below ground level and that there is no stormwater collector at the top of the slope; consequently, the water naturally flows to the lower portion. It must likewise be noted that the property known as Finca or Jardín Nombre72585 has an area of 33.973,03 m² (thirty-three thousand nine hundred seventy-three square meters and three square decimeters), as stated in the National Registry certification submitted by the appellants, thereby generating a substantial amount of surface runoff (…) The Municipal Tax System confirms that the application filed by Nombre72585 S.A, legal entity identification number CED39415 , bearing filing number N° 49130-2023, was duly answered by official letter N° MA-AAP-5660-2023 and duly served through the means designated for that purpose, (…) Likewise, filing N° 31245-2023 concerned a formal claim disputing a charge and was answered by official letter N° MA-AAP-3308-2023 (…) In light of the foregoing, this Municipality does not initially understand why this constitutional amparo action was filed on the stated grounds.None of the submissions made by the appellants informed us that any problem existed at the site. Indeed, according to internal records, there are no filings through which the appellants requested action or informed us of deficiencies in the area’s stormwater system. Instead, their applications sought removal of the stormwater sewerage service charge; they were not complaints and did not even report any problem. Much less was the ‘report’ entitled ‘Assessment of the Impact of Stormwater on Jardín Botánico Flor de Mayo,’ prepared by an engineer unaffiliated with this institution, ever brought to our attention (see attached evidence). Nevertheless, to date, there is no internal evidence, nor have the appellants established, that they made any effort to approach or engage with this Municipality, since there is no record of any filing or application submitted by the interested parties on the grounds stated in the pleading that initiated this action.The appellants filed this Recurso de Amparo to cause confusion, seeking to have the Municipality held liable for ‘inaction’ or ‘omission,’ even though it has followed the proper procedures by responding to the applications submitted by the interested parties as required by law (…) However, the attached photographs also show that the appellants’ property lies below the level of the road, and we reiterate that there is no record whatsoever of incidents or complaints concerning any malfunction of the stormwater system in the area. It is nevertheless important to clarify that protecting properties in that condition (below street level) is the responsibility of each owner, since the owners must construct the infrastructure necessary to channel stormwater from the access points (pedestrian or vehicular) and discharge it into the public stormwater system as required by law, so that its flow does not cause damage within the properties.It should also be noted that the report entitled ‘Assessment of the Impact of Stormwater on Jardín Botánico Flor de Mayo’ shows no stormwater infrastructure for managing the water; however, it does not indicate precisely where the dwelling depicted in that report is located. The ‘View of the dwelling from the point nearest the public roadway’ shows that the dwelling lies well below ground level and has no stormwater collector at the top of the slope, so the water naturally flows to the lower portion, taking into account that the property measures thirty-three thousand nine hundred seventy-three square meters and three square decimeters, thereby generating a substantial amount of surface runoff (see the photographs in image 3 of the report issued by this Municipality). In light of the foregoing and the statements made above, it has been demonstrated that the Administration and the Stormwater Sewerage Activity handled the interested parties’ applications as required by law, providing responses solely to what was requested.It has also been demonstrated that there was no omission or ‘inaction’ by the Municipality. Those subjective assertions merely reveal a clear lack of knowledge of the internal administrative procedures that must be followed in this Municipality, which are designed to comply with statutory requirements; moreover, this Municipality was unaware of the ‘problem’ described in this action. Accordingly, it is of the utmost importance to state that the applications filed by the appellants with this Municipality were processed in full.” They request that the action be dismissed.
  4. 4By submission added to the digital case file at 17:16 hours on 8 de abril de 2025, Nombre5176, in his capacity as President of the Concejo Municipal de Alajuela, reports under oath that “(…) pursuant to Article 13 of the Código Municipal, the collegiate body presided over by the undersigned establishes general policies; however, it does not jointly administer municipal affairs, since those functions fall directly within the authority of the Mayor’s Office and not the Concejo (…)”.

  6. 6The statutory requirements have been observed in the proceedings conducted.

Justice Araya García drafts the opinion; and,

Whereas:

I.Preliminary Matter. Before examining the merits of the matter—concerning the alleged violation of the right to prompt and proper proceedings—it must be clarified that, since judgment No. 2008-02545 issued at 8:55 hours on 22 de febrero de 2008, this Chamber has referred to the administrative litigation jurisdiction—with certain exceptions—those matters in which the issue is whether the public administration complied with the time limits established by the Ley General de la Administración Pública (Articles 261 and 325) or by sector-specific laws governing special administrative proceedings, either to conclude an administrative proceeding—initiated ex officio or at a party’s request—by issuing a final administrative act or to hear the applicable administrative appeals. This case falls precisely within an exception because it concerns an environmental complaint that the respondent authorities allegedly failed to resolve within a reasonable period. Having clarified that point, the Chamber proceeds to decide the specific situation raised in this amparo action.

II.Subject Matter of the Action. The appellants allege that, since 30 de mayo de 2023, they have filed a complaint with the Municipalidad de Alajuela concerning the lack of stormwater infrastructure and the harm and contamination that this situation causes to the Flor de Mayo property, which contains not only species of flora and fauna but also a spring (naciente) that is being affected, thereby directly affecting them. They assert that, as of the date on which they filed this action, the complaint had neither been finally resolved nor had they been informed how the respondent authorities would address it, which they consider a violation of their fundamental rights.

III. Proven Facts. The following facts relevant to the determination of this matter are deemed duly established

  • 1)The appellants reside on the property known as finca or Jardín Flor de Mayo, located partly in Río Segundo and partly in Desamparados de Alajuela (see the report submitted by the respondent authority).
  • 2)On 30 de mayo de 2025, the appellants filed a complaint with the Municipalidad de Alajuela concerning the lack of stormwater infrastructure and the harm and contamination that this situation causes to the Flor de Mayo property, which contains not only species of flora and fauna but also a spring that is being affected. They assert that the water flowing onto the property smells like a septic tank and that this affects people’s health (see evidence submitted to the case file).
  • 3)On 3 de abril de 2025, the respondent authorities were served with the decision admitting this proceeding for review (see certificates of service).
  • 4)The authorities of the Municipalidad de Alajuela indicated that “in front of the property identified by the petitioners, known as Finca or Jardín Flor de Mayo, stormwater infrastructure (infraestructura pluvial) does exist, consisting mostly of curb and gutter (cordón y caño), although storm sewer piping (tubería pluvial) has also been installed at Dirección4290. Although the petitioners’ property lies below the level of the road, as stated by Engineer Nombre72586 in the report submitted by the petitioners, there is no record at the site of any incidents or complaints concerning malfunction of the stormwater system. It should be emphasized that protecting properties in this situation (below street level) is the responsibility of their owners, who must construct the infrastructure needed to channel stormwater (aguas pluviales) from pedestrian or vehicular entrances into the public stormwater system, so that its flow does not cause damage within the properties.

In view of the foregoing, it could be presumed that the situation described by the petitioners does not arise directly from the management of water from the public roadway, since, as noted, the route has curb and gutter, storm drains (tragantes), and properly functioning storm sewer pipes; instead, the condition could result from the management of water within the property, since, as can be seen in the report by Engineer Nombre72587, no stormwater infrastructure for water management is evident” (see the report submitted by the respondent authority and the evidence included in the case file (expediente)).

IV.The specific case. In the case at bar, the petitioners allege that, since 30 de mayo de 2023, they have filed a complaint with the Municipalidad de Alajuela regarding the lack of stormwater infrastructure and the resulting damage and contamination at the Flor de Mayo property, where there are not only species of flora and fauna, but also a spring (naciente) that is being affected, which directly affects them. They assert that, as of the date on which they filed this proceeding, the complaint had not been finally resolved, nor had they been informed how the respondent authorities intended to address it, which they consider a violation of their fundamental rights.

In this regard, this Chamber finds that, in the specific case, there is indeed evidence of a complaint filed with the Municipalidad de Alajuela on 30 de mayo de 2023. That complaint is unrelated to the elimination of the charge mentioned by the municipal authorities, since neither the petition nor the petitioners’ specific requests refer to that matter. To the contrary, they emphasize that there is a problem involving a lack of stormwater infrastructure and resulting damage and contamination at the Flor de Mayo property, where there are not only species of flora and fauna, but also a spring that is being affected. They assert that the flow of water entering the property smells like a septic tank and that this affects people’s health.

It was indeed established that, although the respondent authorities had been aware of the reported situation since 30 de mayo de 2023, it is no less true that, as of the date this proceeding was filed, no action had been taken to address the complaint in question. It was only after the respondent authorities were served with the order admitting this proceeding that the authorities of the Municipalidad de Alajuela stated in the report submitted to this Chamber that “in front of the property identified by the petitioners, known as Finca or Jardín Flor de Mayo, stormwater infrastructure does exist, consisting mostly of curb and gutter, although storm sewer piping has also been installed in the area. 5. Although the petitioners’ property lies below the level of the road, as stated by Engineer Nombre72586 in the report submitted by the petitioners, there is no record at the site of any incidents or complaints concerning malfunction of the stormwater system.

It should be emphasized that protecting properties in this situation (below street level) is the responsibility of their owners, who must construct the infrastructure needed to channel stormwater from pedestrian or vehicular entrances into the public stormwater system, so that its flow does not cause damage within the properties. In view of the foregoing, it could be presumed that the situation described by the petitioners does not arise directly from the management of water from the public roadway, since, as noted, the route has curb and gutter, storm drains, and properly functioning storm sewer pipes; instead, the condition could result from the management of water within the property, since, as can be seen in the report by Engineer Nombre72587, no stormwater infrastructure for water management is evident.” Notwithstanding the foregoing, the record still does not show that any action has been taken that could resolve the complaint filed by the protected parties, or even that, as a result of this proceeding, they have received any response containing the explanation provided by the respondent authorities in the report submitted to this Constitutional Court.

It should be noted that, although two years have already elapsed since the petitioners filed the complaint, there is no evidence that any official inspection has been conducted at the site that would make it possible to issue an administrative act (acto administrativo) addressing the complaint or any findings that might be made.

Consequently, this Chamber finds that the time taken by the respondent authorities to resolve the complaint filed by the protected party and notify it accordingly is disproportionate, since more than two years have elapsed since the complaint was filed and it has not yet been resolved, with the aggravating circumstance that the alleged harm remains ongoing. On this basis, this Chamber considers that the petition must be granted, subject to the considerations set forth in the operative part (parte dispositiva) of this judgment.

V. NOTE BY JUSTICE SALAZAR ALVARADO

As a matter of principle, I consider that cases concerning action or inaction by the Public Administration (Administración Pública) in repairing, constructing, modifying, or demolishing any infrastructure project should be dismissed because such an omission concerns a matter of ordinary legality, the adjudication of which falls within the jurisdiction of the ordinary courts, where the interested person may present their objections more fully. However, when such administrative conduct, whether an omission or otherwise, results in a violation of other fundamental rights protected under this constitutional jurisdiction, or affects groups considered vulnerable, I do address the merits of the matter, since that situation constitutes an exception to my position on this subject. That is the case here, where the petitioners allege that, since 30 de mayo de 2023, they have filed a complaint with the Municipalidad de Alajuela concerning the lack of stormwater infrastructure and the resulting harm to the Nombre72585 property, and that, as of the date on which they filed this proceeding, the complaint had not been finally resolved, nor had they been informed how the respondent authorities intended to address it.

VI.Documentation submitted for inclusion in the case file. The party is hereby advised that, if it submitted any paper document, as well as any objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device or produced through new technologies, these must be collected from the Clerk’s Office within a maximum period of 30 business days from service of this judgment. Otherwise, any material not collected within that period will be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session No. 27-11 of 22 de agosto de 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 de enero de 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session No. 43-12 held on 3 de mayo de 2012, Article LXXXI.

Por tanto:

The petition is granted. Nombre5175, in the capacity of Alcalde Municipal de Alajuela, or whoever holds that office, is ordered to take all actions within the scope of that office’s authority and establish the necessary measures and coordination so that, within a maximum period of two months from service of this judgment, the corresponding verifications and coordination are carried out to provide a final solution to the issue raised, if appropriate, and the petitioners are formally informed of the actions taken and the decision reached. The respondents are warned that failure to comply with this order will constitute the offense of disobedience and that, pursuant to Article 71 of the Law governing this jurisdiction, any person who receives an order issued in an amparo proceeding (recurso de amparo) that the person must comply with or enforce, and who fails to comply with or enforce it, will be sentenced to imprisonment for three months to two years, or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The Municipalidad de Alajuela is ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment before the administrative-law court. Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veinticuatro de octubre de dos mil veinticinco .

Recurso de amparo interpuesto por Nombre72583 y Nombre72584, cédula de identidad CED39416, contra la MUNICIPALIDAD DE ALAJUELA.

Resultando:

  1. 1Por escrito recibido en la Secretaría de la Sala el 14:42 horas de 24 de marzo de 2025, el recurrente interpone recurso de amparo contra la Municipalidad de Alajuela. Manifiesta que son personas adultas mayores quienes residen en la zona conocida como finca o Jardín Flor de Mayo, ubicada en parte de Río Segundo y en parte de Desamparados de Alajuela, lugar del que es representante legal. Señalan que durante la época de invierno han sufrido de inundaciones provenientes de la vía pública municipal, todo debido a la ausencia de infraestructura adecuada que canalice dichas aguas y así evitar desborden a lo interno de la propiedad. Afirman que el 30 de mayo de 2023 se presentó una gestión ante la Municipalidad de Alajuela solicitando, lo siguiente: "...consideramos que dicho cobro por alcantarillado pluvial es absolutamente improcedente y debe ser eliminado, esto por cuanto para empezar no existe infraestructura pluvial adecuada en prácticamente ningún punto del frente de nuestra propiedad, y, lo más grave, por cuanto bajo las circunstancias existentes desde hace varios años, más bien de manera totalmente injusta nuestra propiedad ha recibido con cada lluvia y aguacero una gran cantidad de agua pluvial que viene desde la vía pública, lo cual ha generado grandes daños por erosión del terreno y afectación general de la propiedad.Por lo que, como consta de las imágenes de vídeos y fotografías visibles en los archivos adjuntos, es claro que: 1. No existe infraestructura pluvial como tal en todo el frente de la propiedad. 2. La misma infraestructura existente en este punto y frente a la propiedad es tan deficiente que más bien cada vez que llueve ingresa un gran caudal de agua a nuestra propiedad que genera tremendos daños por erosión y afectación general. 3. El caudal de agua que entra a nuestra propiedad, en ocasiones, huele a séptico. Esto es muy preocupante por la salud de las personas, la condición de la tierra, y por la contaminación al naciente nuestro, registrada en MINAE para consumo humano, #10384-A. Todo por lo cual de la forma más atenta solicitamos se ordene realizar el análisis del caso con vista e inspección al sitio para verificar lo indicado y revisión de las imágenes adjuntas y que su autoridad ordene entonces que se elimina todo el cobro acumulado en sistema municipal a nombre de la sociedad por el cobro de alcantarillado pluvial, por no existir servicio y más bien que, por deficiencia del sistema, nos ocasionan graves afectación a nuestra finca...".Comentan que por oficio No. MA-AAP-5660-2023 del 11 de diciembre de 2024 recibieron respuesta de la municipalidad recurrida en el que se rechazó la eliminación del cobro de servicios de aguas pluviales, sin pronunciarse sobre la denuncia que realizaron por los problemas de falta de infraestructura de aguas pluviales y la afectación y contaminación que dicha situación genera en la propiedad Nombre72585, en donde no solo existen especies de flora y fauna, sino también una naciente que se está viendo afectada. Afirman que la propiedad se encuentra muy dañada por las aguas pluviales ya que la alcantarilla no da abasto por la cantidad de agua que colecta, situación que ha sido conocida por la municipalidad desde el año 2023. Aseguran que han presentado gestiones en las que ha expuesto la problemática ante la autoridad recurrida de las aguas pluviales que inundan la propiedad y que provocan daños al suelo, árboles, la flora y la fauna y el ambiente o sistema constituido por los diferentes elementos naturales que lo integran y sus interacciones e interrelaciones con el ser humano. Reclaman que, a la fecha de presentación de este recurso, la situación no ha sido resuelta. Solicita la intervención de esta Sala y se declare con lugar el recurso.
  2. 2En resolución de las 8:18 horas de 27 de marzo de 2025, se da curso al proceso y se solicita informe al Alcalde y al Presidente del Concejo, ambos de la Municipalidad de Alajuela, sobre los hechos alegados por el recurrente.
  3. 3Mediante escrito agregado al expediente digital a las 15:53 horas de 7 de abril de 2025, informa bajo juramento Nombre5175, en su condición de Alcalde Municipal de Alajuela, que “(…) Mediante el oficio N° MA-AAP-0404-2025 de fecha 04 de abril de 2025, suscrito por el Ing. Nombre5228, Coordinador de la Actividad de Alcantarillado Pluvial, el mismo indicó que: “Con relación a la resolución de las ocho horas dieciocho minutos del veintisiete de marzo de dos mil veinticinco, mediante la cual la Sala Constitucional solicita brindar informe respecto al Recurso de Amparo interpuesto por el señor Nombre72583, pasaporte CED39413 y Nombre72584, cédula de identidad CED39414 , tramitado bajo el expediente N° 25-008378- 0007-CO, me permito indicar: 1. Que, desconozco el lugar de habitación de los señores recurrentes, por lo que no es factible verificar si los mismos residen o no en la propiedad conocida como Finca o Jardín Flor de Mayo. 2.Que, a la fecha, no se observa registro de trámites mediante el cual los recurrentes soliciten o informen de deficiencias en el sistema pluvial de la zona, considerando que en los trámites efectuados la petitoria siempre ha sido orientada a que se les elimine el cobro por servicio de alcantarillado pluvial (trámites N° 49130-2023 y N° 31245-2023), de los cuales se adjunta copia (…) 4. Además, es necesario indicar que, frente a la propiedad señalada por los recurrentes, conocida como Finca o Jardín Flor de Mayo, sí existe infraestructura pluvial, la cual en su mayor parte corresponde a cordón y caño, pero también existe tubería pluvial instalada en el Dirección4290. Que, si bien la propiedad de los recurrentes posee un nivel inferior a la carretera, tal y como lo expone la Ing. Nombre72586 en el informe aportado por los recurrentes, en el lugar no se tiene ningún registro de incidentes o denuncias por mal funcionamiento del sistema pluvial.Cabe destacar que la protección de las propiedades que se encuentran en esta condición (nivel inferior al nivel de calle) es responsabilidad de los propietarios y son estos quienes deben de construir la infraestructura necesaria para canalizar las aguas pluviales de los accesos (peatonales o vehiculares), depositándolas en el sistema pluvial público, de manera que el discurrir de estas no cauce afectaciones a lo interno de las propiedades. Dado lo anterior, se podría presumir que la situación expuesta por los recurrentes no tiene un origen directo en el manejo de las aguas de la vía pública, puesto que como se ha apuntado, la ruta cuenta con cordón y caño, tragantes y tuberías pluviales con un adecuado funcionamiento, sino que la condición podría generarse a partir del manejo de las aguas a lo interno de la propiedad, ya que según se logra apreciar en el reporte de la ingeniera Nombre72587, no se observa infraestructura pluvial para el manejo de las aguas.Resulta importante hacer de su conocimiento que lo anterior se puede comprobar en la foto N° 4, “Vista de la vivienda desde la parte más cercana a la vía pública” (ver imagen N° 3 del presente oficio), del informe presentado por los recurrentes (Elaborado por la Ing. Nombre72587), donde se aprecia el nivel de la vivienda muy por debajo del nivel de terreno, mismo que no cuenta con un colector pluvial en la parte superior del talud, por lo que el agua discurre naturalmente hasta la parte inferior. Así mismo, es necesario señalar que la propiedad conocida como Finca o Jardín Nombre72585 tiene una extensión de 33.973,03 m² (treinta y tres mil novecientos setenta y tres metros cuadrados con tres decímetros cuadros, tal y como lo señala la certificación del Registro Nacional, aportada por los recurrentes, generando una importante cantidad de escorrentía superficial (…) Se constata con el Sistema Tributario Municipal, que la gestión interpuesta por Nombre72585 S.A, cédula jurídica CED39415 , que tiene por número de trámite N° 49130-2023 fue debidamente contestada con el oficio N° MA-AAP-5660-2023, y debidamente notificada al medio señalado para tales efectos, (…) De igual forma, el trámite N° 31245-2023, se refereria a una solicitud formal de reclamo por un cobro, y el mismo fue contestado con el oficio N° MA-AAP-3308-2023 (…) En virtud de lo anterior, en primera instancia desconoce este Municipio el porqué de la interposición del presente recurso de amparo, en los términos expuestos.Ya que de acuerdo con los tramites presentados por los recurrentes, en ninguno de ellos se hace de nuestro conocimiento de que exista alguna problemática en el sitio. Incluso, de acuerdo a registros internos, no constan trámites mediante el cual los recurrentes soliciten o nos informen sobre deficiencias en el sistema pluvial de la zona, sino que más bien, las gestiones interpuestas van dirigidas a que se les elimine el cobro por servicio de alcantarillado pluvial, más no es una denuncia, ni tan siquiera informando de alguna problemática, y mucho menos, ha sido de nuestro conocimiento, el “informe” denominado “Evaluación del impacto de las aguas pluviales en el Jardín Botánico Flor de Mayo” realizado por una ingeniera ajena a esta institución (ver prueba adjunta). No obstante, a la fecha, a nivel interno, no se evidencia, ni los recurrentes comprueban que ha existido un acercamiento o interés de su parte para con este Municipio, lo anterior, por cuando, no se evidencia ningún trámite o gestión, presentado por los interesados en los términos expuestos en el escrito de interposición del presente recurso.Los recurrentes, interponen el presente Recurso de Amparo, para causar confusión, con el fin de que se condene a la Municipalidad, por “inacción” u “omisión” aun cuando ésta, ha realizado los procedimientos como corresponde, que es dar respuesta a las gestiones presentadas por los interesados como en derecho corresponde (…) Empero, también en las fotografías adjuntas se denota que, la propiedad de los recurrente se encuentra en un nivel menor o inferior a la carretera, y reiteramos, no se tiene ningún tipo de registro de incidentes o denuncias por mal funcionamiento del sistema pluvial en la zona. No obstante, es importante aclarar que, la protección de las propiedades que se encuentran en dicha condición (nivel inferior al nivel de calle) es responsabilidad de cada uno de los propietarios, ya que son estos, quienes deben de construir la infraestructura necesaria para canalizar las aguas pluviales de los accesos (peatonales o vehiculares), depositándolas el sistema pluvial público y como en derecho corresponde, de manera que el discurrir de estas, no cauce afectaciones a lo interno de las propiedades.Incluso conviene indicar también que, de acuerdo al informe rendido de “Evaluación del impacto de las aguas pluviales en el Jardín Botánico Flor de Mayo” se denota que, no se observa infraestructura pluvial para el manejo de las aguas, empero donde se ubica exactamente la casa de habitación que viene en dicho informe, ya que, de la “Vista de la vivienda desde la parte más cercana a la vía pública” se puede notar que, el nivel de la vivienda está muy por debajo del nivel de terreno, y no cuenta con un colector pluvial, en la parte superior del talud, por lo que el agua discurre naturalmente hasta la parte inferior, tomando en consideración que dicha finca mide treinta y tres mil novecientos setenta y tres metros cuadrados con tres decímetros cuadros, y esto genera una importante cantidad de escorrentía superficial (ver fotografías de imagen 3 del informe rendido por este Municipio). En virtud de lo anterior, y de lo señalado líneas atrás se demuestra que, la Administración y la Actividad de Alcantarillado Pluvial, atendieron las gestiones de los interesados, como en derecho corresponde, generando respuestas a lo solicitado únicamente.Por otro lado, se demuestra que no existe omisión o “inacción” por parte del Municipio, argumentos subjetivos, que lo que evidencian es un claro desconocimiento de los procedimientos administrativos internos a seguir en esta Municipalidad, procedimientos que van acorde a cumplir con los requerimientos de ley y desconocía este Municipio sobre la “problemática” indicada en el presente recurso, en virtud de lo anterior, es de suma importancia mencionar que, se ha cumplido a cabalidad con la tramitación de las gestiones realizadas por los recurrente ante este Municipio”. Solicitan se declare sin lugar el recurso.
  4. 4Por medio de escrito agregado al expediente digital a las 17:16 horas de 8 de abril de 2025, informa bajo juramento Nombre5176, en su condición de Presidente del Concejo Municipal de Alajuela, que “(…) conforme a lo dispuesto en el artículo 13 del Código Municipal, el órgano colegiado que preside el suscrito dicta las políticas generales, sin embargo, no coadministra, por lo que dichas funciones son resorte directo de la Alcaldía Municipal y no del Concejo (…)”.
  5. 5Mediante escrito agregado al expediente digital a las 12:04 horas de 11 de setiembre de 2025, la parte recurrente realiza manifestaciones.
  6. 6En los procedimientos seguidos se han observado las prescripciones legales.

Redacta el Magistrado Araya García; y,

Considerando:

I.Cuestión Preliminar. De previo a analizar el fondo del asunto -por la presunta violación del derecho a un procedimiento pronto y cumplido- debe aclararse que, a partir de la sentencia No. 2008-02545 de las 8:55 horas de 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa -con algunas excepciones-, aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo -instruido de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes. Precisamente, en este caso, se plantea un supuesto de excepción, pues, se está ante una denuncia ambiental, la cual, presuntamente, no ha sido resuelta dentro de un plazo razonable por parte de las autoridades recurridas. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.

II.Objeto del recurso. Alegan los recurrentes que desde el 30 de mayo de 2023 denunciaron ante la Municipalidad de Alajuela, por los problemas de falta de infraestructura de aguas pluviales y la afectación y contaminación que dicha situación genera en la propiedad Flor de Mayo, en donde no solo existen especies de flora y fauna, sino también una naciente que se está viendo afectada, lo cual, les afecta directamente. Aseguran que, a la fecha en que presentan este recurso, la denuncia no ha sido resuelta de manera definitiva ni se les ha indicado cómo procederán las autoridades recurridas para atenderla, lo que estima lesivo de sus derechos fundamentales.

III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

  • 1)Los recurrentes habitan en la propiedad conocida como finca o Jardín Flor de Mayo, ubicada en parte de Río Segundo y en parte de Desamparados de Alajuela (ver informe rendido por la autoridad recurrida).
  • 2)El 30 de mayo de 2025, los recurrentes realizaron una denuncia ante la Municipalidad de Alajuela, por los problemas de falta de infraestructura de aguas pluviales y la afectación y contaminación que dicha situación genera en la propiedad Flor de Mayo, en donde no solo existen especies de flora y fauna, sino también una naciente que se está viendo afectada. Aseguran que el caudal de agua que entra a la propiedad huele a tanque séptico y esto afecta la salud de las personas (ver prueba aportada al expediente).
  • 3)El 3 de abril de 2025, las autoridades recurridas fueron notificadas de la resolución de curso de este proceso (ver actas de notificación).
  • 4)Las autoridades de la Municipalidad de Alajuela indicaron que “frente a la propiedad señalada por los recurrentes, conocida como Finca o Jardín Flor de Mayo, sí existe infraestructura pluvial, la cual en su mayor parte corresponde a cordón y caño, pero también existe tubería pluvial instalada en el Dirección4290. Que, si bien la propiedad de los recurrentes posee un nivel inferior a la carretera, tal y como lo expone la Ing. Nombre72586 en el informe aportado por los recurrentes, en el lugar no se tiene ningún registro de incidentes o denuncias por mal funcionamiento del sistema pluvial. Cabe destacar que la protección de las propiedades que se encuentran en esta condición (nivel inferior al nivel de calle) es responsabilidad de los propietarios y son estos quienes deben de construir la infraestructura necesaria para canalizar las aguas pluviales de los accesos (peatonales o vehiculares), depositándolas en el sistema pluvial público, de manera que el discurrir de estas no cauce afectaciones a lo interno de las propiedades.

Dado lo anterior, se podría presumir que la situación expuesta por los recurrentes no tiene un origen directo en el manejo de las aguas de la vía pública, puesto que como se ha apuntado, la ruta cuenta con cordón y caño, tragantes y tuberías pluviales con un adecuado funcionamiento, sino que la condición podría generarse a partir del manejo de las aguas a lo interno de la propiedad, ya que según se logra apreciar en el reporte de la ingeniera Nombre72587, no se observa infraestructura pluvial para el manejo de las aguas” (ver informe rendido por la autoridad recurrida y prueba aportada al expediente).

IV.Sobre el caso concreto. En el sub lite, la parte recurrente acusa que desde el 30 de mayo de 2023 denunciaron ante la Municipalidad de Alajuela, por los problemas de falta de infraestructura de aguas pluviales y la afectación y contaminación que dicha situación genera en la propiedad Flor de Mayo, en donde no solo existen especies de flora y fauna, sino también una naciente que se está viendo afectada, lo cual, les afecta directamente. Aseguran que, a la fecha en que presentan este recurso, la denuncia no ha sido resuelta de manera definitiva ni se les ha indicado cómo procederán las autoridades recurridas para atenderla, lo que estima lesivo de sus derechos fundamentales.

Al respecto, esta Sala verifica que, en el caso concreto, efectivamente, se tiene conocimiento de una denuncia realizada ante la Municipalidad de Alajuela el 30 de mayo de 2023, la cual, no tiene relación con la eliminación del cobro que alegan las autoridades municipales, puesto que, ni el recurso ni las peticiones concretas de los recurrente se refieren a dicha situación y por el contrario, hace énfasis en que existe una problemática de falta de infraestructura de aguas pluviales y la afectación y contaminación que dicha situación genera en la propiedad Flor de Mayo, en donde no solo existen especies de flora y fauna, sino también una naciente que se está viendo afectada. Aseguran que el caudal de agua que entra a la propiedad huele a tanque séptico y esto afecta la salud de las personas.

Ciertamente, se pudo verificar que, pese a que las autoridades recurridas tuvieron conocimiento de la situación denunciada desde el 30 de mayo de 2023, no menos cierto es que, a la fecha de presentación de este recurso no se había realizado actuación alguna para atender la denuncia en cuestión y no fue sino hasta con ocasión de la notificación de la resolución de curso de este proceso a las autoridades recurridas, que las autoridades de la Municipalidad de Alajuela contestaron en el informe rendido ante esta Sala que “frente a la propiedad señalada por los recurrentes, conocida como Finca o Jardín Flor de Mayo, sí existe infraestructura pluvial, la cual en su mayor parte corresponde a cordón y caño, pero también existe tubería pluvial instalada en el sector. 5. Que, si bien la propiedad de los recurrentes posee un nivel inferior a la carretera, tal y como lo expone la Ing. Nombre72586 en el informe aportado por los recurrentes, en el lugar no se tiene ningún registro de incidentes o denuncias por mal funcionamiento del sistema pluvial.

Cabe destacar que la protección de las propiedades que se encuentran en esta condición (nivel inferior al nivel de calle) es responsabilidad de los propietarios y son estos quienes deben de construir la infraestructura necesaria para canalizar las aguas pluviales de los accesos (peatonales o vehiculares), depositándolas en el sistema pluvial público, de manera que el discurrir de estas no cauce afectaciones a lo interno de las propiedades. Dado lo anterior, se podría presumir que la situación expuesta por los recurrentes no tiene un origen directo en el manejo de las aguas de la vía pública, puesto que como se ha apuntado, la ruta cuenta con cordón y caño, tragantes y tuberías pluviales con un adecuado funcionamiento, sino que la condición podría generarse a partir del manejo de las aguas a lo interno de la propiedad, ya que según se logra apreciar en el reporte de la ingeniera Nombre72587, no se observa infraestructura pluvial para el manejo de las aguas”.

No obstante lo anterior, de los autos no se evidencia aún que exista actuación alguna que pueda resolver la denuncia planteada por los tutelados ni tan siquiera que, con ocasión de este recurso, se les haya brindado algún tipo de respuesta con la explicación que realizan las autoridades recurridas en el informe rendido ante este Tribunal Constitucional. Nótese que, pese a que transcurrieron ya dos años desde la presentación de la denuncia por parte de los recurrentes, no consta que se haya realizado alguna inspección oficial en el lugar que permita emitir algún acto administrativo tendiente a contestar la denuncia o antes cualquier hallazgo que pudiera llegar a encontrarse.

En consecuencia, estima esta Sala que el plazo que ha transcurrido para resolver la denuncia planteada por la parte tutelada y comunicarle lo respectivo por parte de las autoridades recurridas es desproporcionado, por cuanto, ha transcurrido un plazo de, más de dos años, desde la presentación de la denuncia apuntada, sin que a la fecha esta haya sido resuelta, con el agravante que la presunta afectación denunciada continúa vigente. Bajo esta inteligencia, considera esta Sala que el recurso debe ser declarado con lugar, con las consideraciones que se dirán en la parte dispositiva de esta sentencia.

V. NOTA DEL MAGISTRADO SALAZAR ALVARADO

En tesis de principio, considero que los casos relacionados con la actividad o inactividad de la Administración Pública en la reparación, construcción, modificación o demolición de cualquier obra de infraestructura, deben ser desestimados, por constituir, esa omisión, un tema de legalidad, cuya discusión corresponde a la jurisdicción ordinaria, ante la cual la persona interesada puede debatir, con mayor amplitud, sus disconformidades. Sin embargo, cuando de aquella conducta administrativa (omisiva o no) se derive alguna violación a otros derechos fundamentales tutelados en esta jurisdicción constitucional, o se afecten grupos considerados vulnerables, sí entro a conocer el fondo del asunto, por constituir esta situación una excepción a mi posición en esta materia, tal y como sucede en este caso, en que la parte recurrente acusa que desde el 30 de mayo de 2023 denunciaron ante la Municipalidad de Alajuela, por los problemas de falta de infraestructura de aguas pluviales y la afectación que dicha situación genera en la propiedad Nombre72585, siendo que, a la fecha en que presentan este recurso, la denuncia no ha sido resuelta de manera definitiva ni se les ha indicado cómo procederán las autoridades recurridas para atenderla.

VI.Documentación aportada al expediente. Se previene a la parte que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 de 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial número 19 de 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.

Por tanto:

Se declara con lugar el recurso. Se ordena a Nombre5175, en su condición de Alcalde Municipal de Alajuela, o a quienes ocupen el cargo, que realicen las actuaciones que estén dentro del ámbito de sus competencias y establezcan las acciones y coordinaciones necesarias, para que en el plazo máximo de dos meses contados a partir de la notificación de esta sentencia, se realicen las verificaciones y coordinaciones que correspondan para que dar solución definitiva a la problemática planteada, en caso de ser procedente y se informe de manera formal a la parte recurrente de lo actuado y resuelto. Se les advierte a los recurridos que, de no acatar la orden dicha, incurrirán en el delito de desobediencia y, que de conformidad con el artículo 71 de la Ley de esta jurisdicción, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Alajuela al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
