Document Review SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine twenty a.m. on seventeen October two thousand twenty-five.
Amparo appeal (recurso de amparo) processed under expediente nro. 25-026640-0007-CO, filed by Nombre72452, identity card CED39358, on behalf of Nombre72453, identity card CED39359, against the MINISTERIO DE SALUD and the MUNICIPALIDAD DE GOICOECHEA.
Findings of Fact:
Justice Rueda Leal writes the opinion; and,
Considering:
Before considering the merits, it must be clarified that, since judgment number 2008-02545, issued at 8:55 on 22 de febrero de 2008, this Sala has referred to the contentious-administrative jurisdiction (jurisdicción contencioso administrativa)—with certain exceptions—those matters in which it is disputed whether the Public Administration has complied with the time limits established by the Ley General de la Administración Pública (articles 261 and 325) or by sector-specific laws governing special administrative proceedings, either to conclude an administrative proceeding—instituted ex officio or at the request of a party—by means of a final administrative act or to hear the applicable administrative appeals. Specifically, the sub lite presents an exception, because it concerns a complaint regarding adverse sanitary impacts that allegedly was not resolved within a reasonable period. Having clarified that point, the Court proceeds to resolve the specific situation challenged in this amparo proceeding.
The petitioner states that the protected party is an older adult residing in Purral, La Lupita residential development, Dirección4264. She adds that, since 21 de enero de 2024, the person she represents has suffered contamination from sewage waste that pools in front of her house. She states that she has approached the respondent municipality on multiple occasions to report the situation; however, she has only been told that it falls within the jurisdiction of the Ministry of Health. In this regard, she notes that on 21 de febrero de 2024 the respondent local government informed her that the case had been referred to the Goicoechea Health Governing Area. She alleges that, at the time the petition was filed, the situation had not been resolved.
The following facts are deemed duly proven and relevant to the decision in this matter, either because they have been established as such or because the respondent authority failed to address them, as ordered in the initial ruling:
In the sub lite matter, the petitioner states that the protected party is an older adult residing in Purral, La Lupita residential development, Dirección4264. She adds that, since 21 de enero de 2024, the person she represents has suffered contamination from sewage waste that pools in front of her house. She states that she has approached the respondent municipality on multiple occasions to report the situation; however, she has only been told that it falls within the jurisdiction of the Ministry of Health. In this regard, she notes that on 21 de febrero de 2024 the respondent local government informed her that the case had been referred to the Goicoechea Health Governing Area. She alleges that, at the time the petition was filed, the situation had not been resolved.
A review of the record establishes that, by official letter no. MG-AG-DI-0381-2024 of 8 de febrero de 2024, addressed to the Goicoechea Health Governing Area, the Engineering, Operations, and Urban Planning Directorate of the respondent municipality stated: “This Directorate respectfully requests your assistance in conducting an inspection of the residence located in the District of Purral, Dirección4261, Dirección4265#, because, according to Ms. Nombre72454, she has observed sewage coming from the nearby shacks, and the odors are often so strong that they even have difficulty eating.”. On 23 de abril de 2024, the respondent Health Governing Area conducted an inspection at the site, and the protected party reported a “flooding incident (…) caused by the accumulation of solid waste deposited by neighbors on the sidewalk and in the municipal stormwater channel, compounded by the poor condition of this infrastructure.”.
On 8 de mayo de 2024, official Nombre72457, a Health Regulation Officer with the respondent Health Governing Area, reported that “the flooding occurred on a public roadway and was caused by heavy rainfall as well as by the accumulation of solid waste in the storm sewer system, which has structural damage. This report indicates that the wastewater comes from shacks ‘in the vicinity,’ which are informal dwellings.”. On 6 de septiembre de 2024, the respondent Health Governing Area sent official letter no. MS-DRRSCS-DARSG-1227-2024 to the Municipality of Goicoechea, requesting the creation of an interinstitutional commission to address the “improper disposal of wastewater, buildings lacking construction permits, encroachments into protected areas, and informal settlements.”. The La Lupita neighborhood case was also designated as a priority. On 9 de abril de 2025, the health authority conducted an inspection at the site, and the following was recorded: “the presence of several wastewater discharge sources that are channeled into the area’s storm sewer system; they originate from various dwellings located at the end of the road.
It was recorded that these dwellings are made of different materials and have informal design and layout conditions, indicating that the registered owners of the property would be identified in order to proceed.”. On 27 de agosto de 2025, the respondent authorities held a meeting within the framework of the interinstitutional commission created to address the situation at issue. It was agreed to prioritize attention to 5 settlements, including the La Lupita neighborhood. On 22 de septiembre de 2025, the interinstitutional commission held another follow-up meeting. By technical report no. MS-DRRSCS-DARS-G-1485-2025 of 24 de septiembre de 2025, the Goicoechea Health Governing Area stated: “It is recommended that the Municipality be asked to remove the solid waste present at the site and that the Interinstitutional Working Commission be strengthened in order to evict the informal dwellings that generate the wastewater being reported.”.
Against this backdrop, the intervention of this constitutional jurisdiction is necessary.
In this regard, it has been established that, since February of the previous year, the respondent authorities have been aware of the health problem reported by the protected party. Although some steps have been taken to address the matter (such as the creation of an interinstitutional working commission in which both respondent agencies participate), it is no less true that, approximately 1 year and 8 months later, no actions have been implemented to resolve the problem effectively.
In this regard, the latest action on record is technical report no. MS-DRRSCS-DARS-G-1485-2025 of 24 de septiembre de 2025, through which the respondent Health Governing Area asked the respondent municipality to remove the solid waste present at the site and recommended “strengthening the Interinstitutional Working Commission in order to evict the informal dwellings that generate the wastewater being reported.”. However, there is no evidence that the steps specified in the report have been carried out.
In view of the foregoing, it is apparent that the respondent authorities have failed to coordinate effectively to address and resolve the reported problem promptly, to the extent that, as stated supra, approximately 1 year and 8 months have elapsed without the situation being resolved.
Consequently, the petition is granted under the terms set forth in the operative portion of this judgment.
I consider that, in environmental matters, if the Public Administration has already intervened, jurisdiction to hear and decide the matter lies with the administrative litigation jurisdiction. Nevertheless, I do address the merits when other rights of the persons affected by the source of contamination are at stake, including health, quality of life, and the right to enjoy a healthy and pollution-free environment (Article 50 of the Political Constitution), as occurs in this case, in which the petitioner asserts that she reported to the Ministry of Health the problem of sewage pooling in front of her residence, without that authority allegedly having addressed it properly, thereby affecting the protected party’s right to enjoy a healthy and ecologically balanced environment and a dignified standard of quality of life.
Although I agree with the majority of the Chamber that the application (recurso) should be granted, given that the operative portion of this judgment states: “…that they issue the necessary orders, coordinate the relevant actions, and take the appropriate measures within the scope of their respective authority so that, within a maximum period of SEIS MESES from notification of this judgment, the health-related problem reported by the petitioner is definitively resolved…” I note that, with respect to this order, I disagree as to where jurisdiction over the enforcement phase (fase de ejecución) of this matter should lie, due to the lack of adequate mechanisms under the rules governing this constitutional jurisdiction for monitoring compliance with a judgment involving highly complex technical matters, such as resolving the problem reported by the appellant concerning contamination from sewage waste that accumulates in front of her property, located in Distrito de Purral, Urbanización La Lupita, because of the accumulation of solid waste deposited by neighbors on the sidewalk and in the municipal stormwater channel, compounded by the poor condition of the storm sewer infrastructure itself, which has structural damage, and by the fact that several wastewater discharge sources are channeled into the area’s storm sewer system.
By contrast, the provisions of the Código Procesal Contencioso-Administrativo concerning enforcement (Article 155 et seq.) offer clear advantages, such as the ability to require schedules, impose fines, establish liability, oversee stages of compliance, and so forth. Therefore, pursuant to Article 56 of the Ley de Jurisdicción Constitucional, I consider that the enforcement phase should be conducted before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under that Code’s rules governing enforcement of judgments (ejecución de sentencia).
The parties are hereby advised that, if they have submitted any paper document, objects, or evidence contained on any additional electronic, computerized, magnetic, optical, or telematic device, or produced using new technologies, such items must be retrieved within a maximum period of 30 business days from notification of this judgment. Notice is given that any material not retrieved within that period will be destroyed pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial" (approved by the Corte Plena in Article XXVI of session no. 27-11 of 22 de agosto de 2011 and published in Boletín Judicial no. 19 of 26 de enero de 2012) and Article LXXXI of the session of the Consejo Superior del Poder Judicial no. 43-12 of 3 de mayo de 2012.
Por tanto:
The application is granted. Nombre47909, Director of the Área Rectora de Salud de Goicoechea, or whoever holds that position, as well as Nombre42169 and Nombre56763, in their respective capacities as Mayor and Director of Engineering, Operations, and Urban Planning, both of the Municipalidad de Goicoechea, or whoever holds those positions, are ordered to issue the necessary orders, coordinate the relevant actions, and take the appropriate measures within the scope of their respective authority so that, within a maximum period of SEIS MESES from notification of this judgment, the health-related problem reported by the petitioner is definitively resolved. The respondent authority is warned that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in an application for a writ of amparo (recurso de amparo), which that person is required to comply with or enforce, and fails to comply with or enforce it, shall be punished by imprisonment for three months to two years or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.
The State and the Municipalidad de Goicoechea are ordered to pay the costs, damages, and losses caused by the facts underlying this ruling, the amounts of which shall be determined during enforcement of the judgment in contentious-administrative proceedings. Justice Salazar Alvarado enters a separate note. Justice Garro Vargas dissents with respect to enforcement of the operative portion of this judgment and, pursuant to Article 56 of the Ley de la Jurisdicción Constitucional, directs that enforcement be conducted before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under the enforcement rules established in Article 155 et seq. of the Código Procesal Contencioso Administrativo. She further orders that a copy of the judgment be transmitted to that body so that proceedings to enforce this ruling may be initiated. Let notice be given.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del diecisiete de octubre de dos mil veinticinco .
Recurso de amparo que se tramita en el expediente nro. 25-026640-0007-CO, interpuesto por Nombre72452, cédula de identidad CED39358, a favor de Nombre72453, cédula de identidad CED39359, contra el MINISTERIO DE SALUD y la MUNICIPALIDAD DE GOICOECHEA.
Resultando:
Redacta el Magistrado Rueda Leal; y,
Considerando:
Antes de analizar el fondo del asunto debe aclararse que, a partir de la sentencia número 2008-02545 de las 8:55 horas de 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones aquellos asuntos en los que se discute si la Administración Pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– o conocer de los recursos administrativos procedentes. Precisamente, en el sub lite, se plantea un supuesto de excepción, pues se está ante una denuncia por afectaciones sanitarias, la cual se acusa que no ha sido resuelta dentro de un plazo razonable. Aclarado el punto, se entra a resolver la situación concreta reclamada en este amparo.
La recurrente manifiesta que la amparada es una persona adulta mayor, vecina de Purral, urbanización La Lupita, Dirección4264. Acota que, desde el 21 de enero de 2024, su representada ha sufrido contaminación por desechos de aguas negras que se estacan al frente de su casa. Señala que ha acudido en múltiples ocasiones a la municipalidad accionada a denunciar la situación; empero, solo se le ha indicado que es competencia del Ministerio de Salud. En ese tanto, apunta que el 21 de febrero de 2024 el gobierno local accionado le informó que el caso había sido trasladado al Área Rectora de Salud de Goicoechea. Acusa que al momento de interposición del recurso la situación no se ha solucionado.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos, según lo prevenido en el auto inicial:
En el sub lite, la recurrente manifiesta que la amparada es una persona adulta mayor, vecina de Purral, urbanización La Lupita, Dirección4264. Acota que, desde el 21 de enero de 2024, su representada ha sufrido contaminación por desechos de aguas negras que se estacan al frente de su casa. Señala que ha acudido en múltiples ocasiones a la municipalidad accionada a denunciar la situación; empero, solo se le ha indicado que es competencia del Ministerio de Salud. En ese tanto, apunta que el 21 de febrero de 2024 el gobierno local accionado le informó que el caso había sido trasladado al Área Rectora de Salud de Goicoechea. Acusa que al momento de interposición del recurso la situación no se ha solucionado.
Del estudio de los autos se tiene por demostrado, que, mediante el oficio nro. MG-AG-DI-0381-2024 de 8 de febrero de 2024, dirigido al Área Rectora de Salud de Goicoechea, la Dirección de Ingeniería, Operaciones y Urbanismo de la municipalidad accionada indicó: “Esta Dirección le solicita de sus buenos oficios, con el fin de realizar una inspección en la vivienda ubicada en el Distrito de Purral, Dirección4261, Dirección4265# ya que según la señora Nombre72454, observa aguas negras provenientes de los ranchos cercanos, y que con frecuencia los olores son tan fuertes que les cuesta hasta comer.”. El 23 de abril de 2024, el Área Rectora de Salud accionada realizó una inspección en el sitio, y la tutelada reportó “caso de inundación (…) que es causado por la saturación de los desechos sólidos que los vecinos depositan en la acera y en el caño pluvial municipal, sumado al mal estado de esta infraestructura.”.
El 8 de mayo de 2024, el funcionario Nombre72457, regular de la Salud del Área Rectora de Salud accionada, reportó que “la inundación se dio en vía pública, la misma fue causada por una fuerte lluvia así como la acumulación de desechos sólidos en el alcantarillado pluvial, el cual se encuentra con daños estructurales. Este reporte señala que las aguas servidas provienen de los ranchos “de las inmediaciones”, los cuales son viviendas informales.”. El 6 de septiembre de 2024, el Área Rectora de Salud accionada remitió el oficio nro. MS-DRRSCS-DARSG-1227-2024 a la Municipalidad de Goicoechea, a través del cual solicitó la creación de una comisión interinstitucional para la atención de las “disposiciones inadecuadas de aguas residuales, las edificaciones sin permiso de construcción, las invasiones en zonas de protección y los asentamientos informales.”. Además, se indicó como prioritario el caso del barrio La Lupita.
El 9 de abril de 2025, la autoridad sanitaria realizó una inspección en el sitio y se consignó: “presencia de varias fuentes de descarga de aguas residuales que son canalizadas hacia el alcantarillado pluvial de la zona, las mismas provienen de distintas viviendas ubicadas al final de la carretera. Se consignó que estas viviendas son de distintos materiales y presentan condiciones informales de diseño y distribución, indicando que se revisará los dueños registrales de la propiedad para proceder.”. El 27 de agosto de 2025, las autoridades recurridas celebraron una reunión en el marco de la comisión interinstitucional creada para atender la situación de marras. Se acordó priorizar la atención de 5 asentamientos, incluido el barrio La Lupita. El 22 de septiembre de 2025, la comisión interinstitucional realizó otra reunión de seguimiento. Mediante el informe técnico nro. MS-DRRSCS-DARS-G-1485-2025 de 24 de septiembre de 2025, el Área Rectora de Salud de Goicoechea señaló: “Se recomienda solicitar a la Municipalidad la remoción de los residuos sólidos presentes en el sitio y, fortalecer la Comisión de Trabajo Interinstitucional, a fin de desalojar las viviendas informales, las cuales generan las aguas residuales que se denuncian.”.
Desde este panorama, resulta necesaria la intervención de esta jurisdicción constitucional.
Al respecto, se verifica que desde febrero del año anterior las autoridades recurridas tienen conocimiento del problema sanitario denunciado por la tutelada, y si bien se han efectuado algunas diligencias para atender el asunto (como la creación de una comisión de trabajo interinstitucional, en la que intervienen ambas dependencias recurridas), no menos cierto es que, aproximadamente 1 año y 8 meses después, no se han materializado acciones para la efectiva solución del problema.
En ese tanto, véase que la última actuación que se registra es el informe técnico nro. MS-DRRSCS-DARS-G-1485-2025 de 24 de septiembre de 2025, a través del cual el Área Rectora de Salud accionada solicita a la municipalidad recurrida remover desechos sólidos presentes en el sitio y recomienda “fortalecer la Comisión de Trabajo Interinstitucional, a fin de desalojar las viviendas informales, las cuales generan las aguas residuales que se denuncian.”. Empero, no consta que tales diligencias consignadas en el informe se hayan efectuado.
En virtud de lo expuesto, se observa que las autoridades recurridas han omitido realizar las coordinaciones efectivas para atender y solucionar el problema denunciado de manera célere, al punto que, como se indicó supra, ha transcurrido aproximadamente 1 año y 8 meses sin que se haya resuelto la situación.
En consecuencia, se declara con lugar el recurso, en los términos que se indican en la parte dispositiva de este pronunciamiento.
Considero que en asuntos ambientales, si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que la recurrente asegura haber denunciado, ante el Ministerio de Salud, la problemática de aguas negras que se estancan frente a su vivienda, sin que presuntamente haya sido debidamente atendido por esa autoridad, lo que afecta el derecho a disfrutar de un ambiente sano, ecológicamente equilibrado y de un nivel digno de calidad de vida a la amparada.
Si bien coincido con la mayoría de la Sala en que el recurso se debe declarar con lugar, dado que en la parte dispositiva de esta sentencia, se indica: “…que giren las órdenes necesarias, coordinen lo pertinente y dispongan lo oportuno dentro del ámbito de sus competencias correspondientes, para que, dentro del plazo máximo de SEIS MESES, contado a partir de la notificación de esta sentencia, se resuelva de manera definitiva la problemática sanitaria denunciada por la accionante…” hago ver que, en cuanto a esta orden, difiero sobre dónde residenciar la fase de ejecución del asunto, debido a la inexistencia de mecanismos adecuados previstos por la normativa que rige esta jurisdicción constitucional para dar seguimiento a una sentencia que reviste aspectos técnicos de gran complejidad, como es darle solución al problema denunciado por la parte recurrente referente a la contaminación por desechos de aguas negras que se estancan en frente de su propiedad, ubicada en el Distrito de Purral, Urbanización La Lupita, a causa de la saturación de desechos sólidos que los vecinos depositan en la acera y en el caño pluvial municipal, sumada al mal estado de la infraestructura misma del alcantarillado pluvial, que tiene daños estructurales, y al hecho de que varias fuentes de descarga de aguas residuales son canalizadas hacia el alcantarillado pluvial de la zona.
En cambio, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (artículo 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el artículo 56 de la Ley de Jurisdicción Constitucional, estimo que la fase de ejecución debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.
Se previene a las partes que, de haber aportado algún documento en papel u objetos o pruebas contenidos en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados en un plazo máximo de 30 días hábiles, contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo material que no sea recogido dentro de ese lapso, con base en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial" (aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 de 22 de agosto de 2011 y publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012) y en el artículo LXXXI de la sesión del Consejo Superior del Poder Judicial nro. 43-12 de 3 de mayo de 2012.
Por tanto:
Se declara con lugar el recurso. Se ordena a Nombre47909, directora del Área Rectora de Salud de Goicoechea, o a quien ocupe ese cargo, así como a Nombre42169 y Nombre56763, en su condición respectiva de alcalde y director Ingeniería, Operaciones y Urbanismo, ambos de la Municipalidad de Goicoechea, o a quienes ejerzan tales puestos, que giren las órdenes necesarias, coordinen lo pertinente y dispongan lo oportuno dentro del ámbito de sus competencias correspondientes, para que, dentro del plazo máximo de SEIS MESES, contado a partir de la notificación de esta sentencia, se resuelva de manera definitiva la problemática sanitaria denunciada por la accionante. Se advierte a la autoridad recurrida que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.
Se condena al Estado y a la Municipalidad de Goicoechea al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. El magistrado Salazar Alvarado consigna nota. La magistrada Garro Vargas salva el voto respecto a la ejecución de la parte dispositiva de esta sentencia y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución, establecidos en los artículos 155 y siguientes del Código Procesal Contencioso Administrativo. Asimismo, ordena que se le remita copia de la sentencia para que se inicie los procedimientos de ejecución de este fallo. Notifíquese.
