Document Review SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine twenty on diecisiete de octubre de dos mil veinticinco.
Amparo action (recurso de amparo) filed by Nombre32681, identity card CED14718, against LA MUNICIPALIDAD DE GOICOECHEA.
BACKGROUND:
Justice Araya García writes the opinion; and,
CONSIDERING:
The petitioner complains that, although the authorities of the Municipalidad de Goicoechea have known since 2022 of the existence of illegal structures erected within a river protection zone, as of the filing of this amparo action they had taken no steps to remove them, thereby violating the right to a healthy and ecologically balanced environment.
II.Preliminary Issue. Before examining the merits of the matter—concerning the alleged violation of the right to a prompt and duly completed proceeding (derecho a un procedimiento pronto y cumplido)—it must be clarified that, since Judgment No. 2008-02545 issued at 8:55 on 22 de febrero de 2008, this Chamber has referred to the administrative litigation jurisdiction (jurisdicción contencioso administrativa)—with certain exceptions—those matters involving disputes over whether the public administration has complied with the time limits established by Ley General de la Administración Pública (articles 261 and 325) or by sector-specific laws governing special administrative proceedings (procedimientos administrativos especiales), either to conclude an administrative proceeding—initiated ex officio or at a party’s request—through a final administrative act (acto final), or to adjudicate the applicable administrative appeals (recursos administrativos). This case presents precisely such an exception—supported by a majority of this Constitutional Court—because it concerns a request related to the environment. Having clarified this point, the Chamber proceeds to decide the specific situation raised in this amparo action.
The following facts relevant to deciding this amparo action are deemed established:
When deciding a case similar to the present one, in Judgment No. 2025-14025 issued at 13:05 hrs. on 9 de mayo de 2025 (subsequently corrected by Voto No. 2025-19272 issued at 13:29 hrs. on 20 de junio de 2025), this Chamber expressly stated as follows:
“(…) II.- SUBJECT MATTER OF THE ACTION. The petitioner states that on 09 de septiembre de 2024 he filed a complaint concerning the failure to remove certain structures near Río Ipís in the Municipalidad de Vásquez de Coronado, but that, to date, he has received no response and the respondent authority has not taken the appropriate action. (…)
In addition, the petitioner requests that the authority “…take all necessary steps to ensure that the river area is respected….” Having examined the response provided by the respondent authority, to the effect that no measure could be adopted to safeguard the river’s protection zone because of the age of the structures, the majority of the Chamber disagrees with that approach and finds that safeguarding the right to a healthy environment, of which the protection of bodies of water (cuerpos de aguas) is an essential component, requires a different solution.
To begin, a brief review of the legal framework protecting water resources leads to the conclusion that the temporal starting point for giving concrete effect to such protection could hardly be Ley Forestal No. 7575, dated 16 de abril de 1996. In other words, it is legally untenable to assert that violations of the setbacks (retiros) intended to protect water resources may be penalized only after abril de 1996. For example, Article 7 of Ley de Tierras y Colonización number 2825 dated 14 de octubre de 1961 provided:
“Article 7. - Until the State, on its own initiative or at the request of the Ministerio de Agricultura or the Instituto de Tierras y Colonización, for reasons of national interest, determines which lands must remain under its ownership, the following shall be deemed inalienable and incapable of being acquired by claim or possession, except for those held as private property under lawful title:(...)
Furthermore, the impact of the structures referred to by the petitioner on water resources is entirely disregarded. No technical study or inspection concerning this issue was conducted or cited that would make it possible to determine whether the effects are harmless or environmentally significant.
Thus, in light of the right to a healthy environment, the relinquishment of the municipal powers whose exercise was requested by the petitioner is unacceptable. The constitutional protection proceeding (amparo) must therefore be granted and official letter AL-200-0180-2025 annulled. The respondent authority must exercise its powers to ensure effective protection of the protected area (área de protección) of the río Ipís, as well as its powers to coordinate with the appropriate authorities, in accordance with the applicable environmental regulations. (…)
THEREFORE: By majority vote, the petition is granted insofar as it concerns the violation of the right to a healthy environment. Official letter AL-200-0180-2025 is annulled, and Nombre46689, mayor of Vázquez de Coronado, or whoever holds that office, is ordered to exercise the office’s powers to ensure effective protection of the protected area of the río Ipís, as well as its powers to coordinate with the appropriate authorities, in accordance with the applicable environmental regulations. With regard to the failure to respond to the request submitted by the petitioner on 09 de septiembre de 2024, and pursuant to Article 52 of Ley de la Jurisdicción Constitucional, the petition is granted without a specific award of costs or damages. Justice Jara Velásquez partially dissents and orders an award of damages and costs. Justice Salazar Alvarado dissents and would deny the petition, finding that it falls to the ordinary courts, specifically the contentious-administrative jurisdiction (jurisdicción contencioso-administrativa), to determine whether the challenged administrative actions and conduct substantively comply with the provisions of statutory law concerning the protection, safeguarding, and preservation of the right to a healthy and ecologically balanced environment (…)”.
The petitioner comes before this Chamber and states that, since 2022, the authorities of the Municipalidad de Goicoechea have been aware of structures erected along the bank of a river in the area and that, despite this, as of the date this amparo was filed, they had taken no action to remove them, in clear violation of the right to a healthy environment.
Having reviewed the record, this Constitutional Court finds sufficient grounds to grant this amparo proceeding for the specific reasons set forth below.
First, it was established that, since octubre 2022, the authorities of the Municipalidad de Goicoechea had verified the existence of four completed structures erected along the bank of the Río Purral identified by the petitioner. Although they stated that they would undertake the appropriate coordination with SINAC to determine the environmental damage, that action was ultimately not taken until octubre 2024—that is, after an entirely excessive and unreasonable period of two years had elapsed. It should be noted that, although it is understandable that SINAC first needed to inspect the site and submit a report to the municipality regarding the situation in question, it must also be taken into account that, as stated, the request to that institution was clearly and arbitrarily delayed.
Second, although the SINAC report was submitted to the Municipalidad de Goicoechea in julio 2025, confirming the encroachment upon the protected area or zone along the banks of the Río Purral, it was not until three months later (8 de octubre de 2025), and because of this amparo, that the respondents decided to comply with the recommendations issued and notified the occupants of the properties located within the protected zone (zona de protección) that they must vacate. They further warned that, should the occupants fail to do so, the municipality would proceed with the demolitions necessary to protect the encroached-upon protected area.
Third, in summary, the situation described was reported more than three years ago and, despite the excessive and unreasonable period that has elapsed since then, no final solution has been reached to date, in clear violation of Article 50 of the Constitución Política.
* Under this reasoning, this amparo must be granted, with the consequences set forth in the operative portion of this judgment.
I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and effective justice in administrative proceedings, the legal dispute must be heard by the Contentious-Administrative Courts and not by this Chamber. However, the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, established that this right may receive judicial protection through the amparo provided for in Article 32 of Ley de la Jurisdicción Constitucional, in connection with Article 27 of the Constitución Política de la República de Costa Rica, in cases in which the petitioner believes that the Administration’s physical acts, administrative acts, or response are affecting the petitioner’s fundamental rights. In my view, the newly enacted legislation does not require this Court to alter its line of precedent, since, pursuant to Article 7 of its Law, this Court alone is responsible for defining its own jurisdiction.
Consequently, except for those constitutional-law disputes that this Chamber itself has recognized as exceptional circumstances that may properly be heard in this jurisdiction through the constitutional amparo guarantee proceeding, in all other cases, and for the reasons given by this Court (judgment N° 2008-02545 at 8:55 hours on 22 de febrero de 2008), jurisdiction lies with the judges of the contentious-administrative jurisdiction. All of this is consistent with Article 25 of the Convención Americana sobre Derechos Humanos, the constitutional law (values, principles, and rules), and the relevant statutory provisions, based on a logical, systemic, and purposive interpretation of the legal system.
In the case under review (sub examine), the petitioner complains that the respondent municipality detected certain unlawful structures erected within the protected zone of the río Purral; however, the petitioner contends that, as of the date this proceeding was filed, the municipality had taken no action to remove them, thereby violating the right to a healthy and ecologically balanced environment.
In this regard, based on the report submitted by the Municipalidad de Goicoechea, I consider it essential to join the Sistema Nacional de Áreas de Conservación as a party. Along those lines, the mayor of the respondent municipality specified that the entity he represents lacks jurisdiction to determine whether environmental damage may exist, and it therefore follows that the municipality coordinated with the authorities of the Sistema Nacional de Áreas de Conservación, which conducted an inspection on 6 de febrero de 2025. The record shows that, as a result of that visit, official letter no. SINAC-ACC-OSJ-inf-254-2025 dated 24 de febrero de 2025 was issued, stating:
“Conclusions and recommendations: A visit was made to the specified site, where encroachment upon the protected area of the río Torres and the quebrada Mozotal was detected due to the construction of residential buildings. The estimated extent of the encroachments is set forth in Table 1 of this report. The encroachment upon the protected area was detected on two properties, which must be identified by the municipality so that it may submit the corresponding report to the Ministerio Pública. The encroachment upon the protected area was estimated using aerial imagery, the possible location of the watercourse, and field data; however, an exact survey must be conducted. It is therefore recommended that the survey be performed by qualified personnel, whether from the municipality itself or from Ingeniería Forense del OIJ, following the necessary steps by the Ministerio Público to obtain proper access to the property.
As measures to be taken, it is recommended that restoration of the site include demolition of the encroachments and removal of the debris so that the forest cover (cobertura forestal) typical of a riparian forest may be established. The plan must be prepared by a qualified professional and submitted to this office for the corresponding review and approval. It is important to note that every restoration project must be carried out with the greatest possible care and must consider the environmental impacts arising at the outset of the work and ensure that the measures adopted will make it possible to restore the site. It is recommended that any project to restore the protected area use native trees of low to medium stature and that they be planted away from the infrastructure. It is recommended that each tree have a minimum height of 1,5 meters to ensure the lowest possible mortality rate.” Consequently, I dissent and order that the processing of the petition continue so that a report may be requested from the Sistema Nacional de Áreas de Conservación.
viii.- Documentation submitted to the case file (expediente). The parties are hereby advised that, if they submitted any paper document, as well as any objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, they must retrieve them from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not retrieved within that period shall be destroyed, in accordance with the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at session number 27-11 of 22 de agosto de 2011, article XXVI, and published in Boletín Judicial number 19 of 26 de enero de 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session number 43-12 held on 3 de mayo de 2012, article LXXXI.
POR TANTO:
The appeal is granted. Nombre42169, in his capacity as Mayor, and Nombre56763, in his capacity as Director of Engineering and Operations, both of the Municipalidad de Goicoechea, or whoever may respectively hold those positions in their stead, are ordered to issue the appropriate directives and undertake all actions within the scope of their authority so that, within a maximum period of TWO MONTHS from notification of this judgment, a definitive solution is provided for the situation reported by the appellant (encroachment upon a protected area). The respondent authorities are hereby warned that, pursuant to article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo proceeding (recurso de amparo) that must be complied with or enforced, and who fails to comply with or enforce it, shall be subject to imprisonment for three months to two years or a fine of twenty to sixty days, provided that the offense is not punishable by a more severe penalty.
The Municipalidad de Goicoechea is ordered to pay the legal costs, damages, and losses arising from the facts underlying this ruling, which shall be assessed during enforcement of the judgment before the contentious-administrative jurisdiction (ejecución de sentencia de lo contencioso administrativo). Justice Castillo Víquez adds a separate note. Justice Garro Vargas dissents (salva el voto) and orders that processing of the appeal continue so that a report may be requested from the Sistema Nacional de Áreas de Conservación. Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del diecisiete de octubre de dos mil veinticinco .
Recurso de amparo interpuesto por Nombre32681, cédula de identidad CED14718, contra LA MUNICIPALIDAD DE GOICOECHEA.
RESULTANDO:
Redacta el Magistrado Araya García; y,
CONSIDERANDO:
El recurrente reclama que, pese a que desde el año 2022 las autoridades de la Municipalidad de Goicoechea tienen conocimiento de la existencia de edificaciones ilegales levantadas en zona de protección de un río, a la fecha de formulado este amparo no habían realizado gestión alguna para eliminarlas, lesionándose con esto el derecho a un ambiente sano y ecológicamente equilibrado.
II.Cuestión Preliminar. De previo a analizar el fondo del asunto –por la presunta violación del derecho a un procedimiento pronto y cumplido– debe aclararse que, a partir de la sentencia No. 2008-02545 de las 8:55 horas de 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones–, aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– o conocer de los recursos administrativos procedentes. Precisamente, en este caso se plantea un supuesto de excepción –respaldado por la mayoría de este Tribunal Constitucional–, pues se está ante una solicitud relacionada con el medio ambiente. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.
De relevancia para dirimir el presente recurso de amparo, se tienen por acreditados los siguientes:
Esta Sala, al conocer un caso similar al ahora planteado, en la Sentencia No. 2025-14025 de las 13:05 hrs. de 9 de mayo de 2025 (corregida posteriormente mediante el Voto No. 2025-19272 de las 13:29 hrs. de 20 de junio de 2025), señaló expresamente lo siguiente:
“(…) II.- OBJETO DEL RECURSO. El recurrente manifiesta que, realizó una denuncia en fecha 09 de septiembre de 2024, por la falta de retiro de unas construcciones respecto del Río Ipís, en la Municipalidad de Vásquez de Coronado, sin que a la fecha haya obtenido respuesta, ni la autoridad recurrida haya procedido de conformidad. (…)
Adicionalmente, la parte recurrente solicita “…proceder a realizar todas las gestiones necesarias para que se respete el área del río…”. Examinada la respuesta que brindó la autoridad recurrida, en el sentido de que, por la antigüedad de las obras, no podía adoptarse ninguna medida de salvaguarda del área de protección del río, difiere la mayoría de la Sala de ese enfoque y considera que la tutela del derecho a un medio ambiente sano, del cual forma parte esencial la protección de los cuerpos de aguas, impone una solución distinta.
Para empezar, un somero repaso del ordenamiento jurídico protector de aguas permite concluir que el punto de partida temporal para la concretización de tal tutela difícilmente podría ser la Ley Forestal No. 7575, de 16 de abril de 1996. Dicho con otras palabras, jurídicamente resulta insostenible afirmar que las infracciones a los retiros tendientes a proteger las aguas solo pueden sancionarse con posterioridad a abril de 1996. Por ejemplo, el artículo 7 de la Ley de Tierras y Colonización número 2825 de 14 de octubre de 1961 dispuso:
"Artículo 7º. - Mientras el Estado, por voluntad propia o por indicación del Ministerio de Agricultura o del Instituto de Tierras y Colonización, atendiendo razones de conveniencia nacional, no determine los terrenos que deben mantenerse bajo su dominio, se considerarán inalienables y no susceptibles de adquirirse por denuncio o posesión, salvo los que estuvieren bajo el domino privado, con título legítimo, los siguientes:(...)
Por otra parte, se omite toda referencia al impacto de las construcciones a las que se refiere el recurrente sobre el recurso hídrico. No se efectuó ni se citó ningún estudio de carácter técnico o inspección sobre este aspecto, que permita entender si se trata de afectaciones inocuas o ambientalmente relevantes.
De esta forma, a la luz del derecho a un medio ambiente sano, resulta inaceptable la renuncia de las competencias municipales cuyo ejercicio instó el actor y corresponde, por ende, estimar el amparo y anular el oficio AL-200-0180-2025. Deberá la autoridad recurrida ejercer sus competencias de tutela efectiva del área de protección del río Ipís, así como aquellas de coordinación con las autoridades correspondientes, de conformidad con la normativa ambiental aplicable. (…)
POR TANTO: Por mayoría, se declara con lugar el recurso, en cuanto a la infracción del derecho a un medio ambiente sano. Se anula el oficio AL-200-0180-2025 y se ordena a Nombre46689, alcaldesa de Vázquez de Coronado, o a quien ocupe su cargo, ejercer sus competencias de tutela efectiva del área de protección del río Ipís, así como aquellas de coordinación con las autoridades correspondientes, de conformidad con la normativa ambiental aplicable. En cuanto a la falta de respuesta de la gestión presentada por el recurrente en fecha 09 de septiembre de 2024 y de conformidad con lo dispuesto en el artículo 52, de la Ley de la Jurisdicción Constitucional, se estima el amparo, sin especial condenatoria en costas, daños y perjuicios. La Magistrada Jara Velásquez salva parcialmente el voto y dispone la condenatoria en daños, perjuicios y costas. El Magistrado Salazar Alvarado salva el voto y declara sin lugar el recurso, al estimar que corresponde a la jurisdicción ordinaria, en específico, a la contencioso-administrativa, determinar si las actuaciones y conductas administrativas acusadas se ajustan o no, en sustancia, a lo preceptuado en el ordenamiento jurídico de rango legal, en cuanto a la protección, tutela y conservación del derecho a un ambiente sano y ecológicamente equilibrado (…)”.
V.- caso concreto. El recurrente acude a esta Sala y señala que, desde el año 2022, las autoridades de la Municipalidad de Goicoechea tienen conocimiento de construcciones levantadas sobre el margen de un río de la zona y, pese a esto, para el día de formulado este amparo, no habían realizado gestión alguna para eliminarlas, en clara lesión del derecho a un ambiente sano.
Revisados los autos, este Tribunal Constitucional considera que existe mérito suficiente para acoger este proceso de amparo, por los motivos puntuales que se dirán a continuación.
Primero, por cuanto se demostró que, desde el mes de octubre del año 2022 las autoridades de la Municipalidad de Goicoechea verificaron la existencia de cuatro edificaciones consolidades y establecidas en el margen del Río Purral señalado por el recurrente y, pese haber sostenido que realizarían las gestiones pertinentes con el SINAC para determinar el daño ambiental, esta última actuación se llevó a cabo finalmente hasta en el mes de octubre de 2024, sea, luego de trascurrido un plazo absolutamente excesivo e irrazonable de dos años. Nótese que, si bien se puede entender que, de forma previa, el SINAC debía inspeccionar el sitio y rendir un informe al municipio respecto a la referida situación, lo cierto es que igualmente debe tomarse en cuenta que esa solicitud fue planteada, como se dijo, de manera evidente y arbitrariamente tardía ante la primera institución.
Segundo, dado que, pese a que el informe del SINAC fue rendido en julio de 2025 a la Municipalidad de Goicoechea (confirmándose la invasión al área o zona protegida de los márgenes del Río Purral), fue hasta tres meses después (8 de octubre de 2025) y, con motivo de este amparo, que los recurridos decidieron acatar las recomendaciones giradas y notificaron a los habitantes de los predios que se hallan en la zona de protección para que desalojen, advirtiéndose además, que, caso contrario, el municipio procedería a realizar las demoliciones para proteger el área protegida invadida.
Tercero, habida cuenta que, en resumen, la situación descrita tiene más de tres años de haber sido denunciada y, pese al excesivo e irrazonable plazo trascurrido desde entonces, no ha encontrado, a la fecha, una solución definitiva, en claro quebrantado de lo dispuesto de lo dispuesto en el ordinal 50 de la Constitución Política.
* Bajo dicha inteligencia, lo que procede es acoger este amparo, con las consecuencias que se dirán en la parte dispositiva de la presente sentencia.
He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia.
Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.
En el sub examine, la parte accionante reclama que el municipio accionado detectó unas edificaciones ilegales levantadas en la zona de protección del río Purral; sin embargo, reprocha que a la fecha de formulado este proceso no han realización acción alguna para eliminarlas, lesionándose con esto el derecho a un ambiente sano y ecológicamente equilibrado.
Al respecto, a partir del informe rendido por parte de la Municipalidad de Goicoechea considero imprescindible tener como parte al Sistema Nacional de Áreas de Conservación. En esa línea, el alcalde del municipio accionado puntualizó que su representada carece de competencia para determinar la existencia de un posible daño ambiental, motivo por el cual se desprende que procedieron a efectuar una coordinación con las autoridades del Sistema Nacional de Áreas de Conservación, quienes el 6 de febrero de 2025 llevaron a cabo una inspección. Consta que como resultado de dicha visita se emitió el oficio nro. SINAC-ACC-OSJ-inf-254-2025 del 24 de febrero de 2025, donde se consignó:
“Conclusiones y recomendaciones: Se realizó una visita al sitio indicado, donde se detecta invasión al área de protección del río Torres y la quebrada Mozotal, lo anterior por el establecimiento de edificaciones de tipo vivienda. La estimación de las invasiones se indica en el cuadro 1 del presente informe. Que la invasión al área de protección se detecta en dos predios los cuales se han de identificar por parte del municipio para que procedan a interponer el respectivo informe ante el Ministerio Pública. La invasión al área de protección se estima mediante el uso de imágenes aéreas, la posible ubicación del cauce y los datos de campo, sin embargo, es necesario realizar la medición exacta para lo cual, se recomienda que ésta se realice por personal atinente, ya sea del mismo Municipio o bien de ingeniería Forense del OIJ, previa gestión del Ministerio Público para el debido ingreso al predio.
Como medidas a tomar se recomienda que para la restauración del sitio se efectué la demolición de las invasiones y el retiro de los escombros para el establecimiento de la cobertura forestal típica de un bosque ribereño. El plan deberá ser elaborado por un profesional atinente y presentado ante esta oficina para el respectivo análisis y visto bueno. Importante señalar que todo proyecto de restauración deberá realizarse con el mayor cuidado posible y este debe considerar los impactos ambientales que se origen al inicio de las obras y garantizar que mediante las medidas adoptadas se podrá restaurar el sitio. Se recomienda que cualquier proyecto de restauración del área de protección se realice con árboles nativos de porte bajo a mediano y que los mismos se establezcan alejados de la infraestructura. Se recomienda que cada árbol posea una altura mínima de 1,5 metros con el fin de garantizar la menor mortalidad posible”.
En consecuencia, salvo el voto y ordeno continuar la tramitación del recurso a los efectos de que se solicite informe al Sistema Nacional de Áreas de Conservación.
viii.- Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión número 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión número 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.
POR TANTO:
Se declara con lugar el recurso. Se le ordena a Nombre42169, en su condición de Alcalde y a Nombre56763, en su condición de Director de Ingeniería y Operaciones, ambos de la Municipalidad de Goicoechea, o a quienes en su lugar ocupen respectivamente tales cargos, que giren las órdenes pertinentes y lleven a cabo todas las actuaciones que estén dentro del ámbito de sus competencias para que, dentro del plazo máximo de DOS MESES, contado a partir de la notificación de la presente sentencia, se brinde una solución definitiva a la situación denunciada por el recurrente (invasión de zona protegida). Se advierte a las autoridades recurridas que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.
Se condena a la Municipalidad de Goicoechea al pago de las costas, daños y perjuicios ocasionados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. El magistrado Castillo Víquez pone nota. La magistrada Garro Vargas salva el voto y ordena continuar la tramitación del recurso a los efectos de que se solicite informe al Sistema Nacional de Áreas de Conservación.
